MARVIN PORRAS SANCHEZ No. N° 2024001143 TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA, SEGUNDO CIRCUITO JUDICIAL, SAN JOSÉ, GOICOECHEA, at nineteen hours and forty-nine minutes on veintitres de Febrero del dos mil veinticuatro.- Action for a declaration of injury to the public interest (proceso de lesividad) brought by the INSTITUTO DE DESARROLLO RURAL (INDER), represented by Rodrigo Cervantes Barrantes in his capacity as special counsel of record (apoderado especial judicial), bar card 7896, against MARVIN PORRAS SÁNCHEZ, identity card 1-0427-0886, and PALACIOS Y PARAÍSOS TROPICALES S.A., represented by José Luis Rodríguez Jiménez, bar card 5194. The State participates as an interested third party, represented by Mauricio Castro Lizano in his capacity as State Attorney.

BACKGROUND

  1. 1The Instituto de Desarrollo Rural filed the action for a declaration of injury to the public interest by submission dated 18 de noviembre del 2015, seeking the following relief: “1. That this action be deemed duly filed. 2. That, because it is injurious to the public interest, the resolution adopted by the Board of Directors of the Instituto de Desarrollo Agrario in Article 39 of session 031-04, dated 23 de agosto del 2004, be annulled solely insofar as it concerns the granting of title (titulación) to the property located in Partido de Puntarenas, Real Property Folio Registration number 139717-000, in favor of MARVIN PORRAS SÁNCHEZ, whose particulars are stated above, corresponding to Cadastral Plan P-0862160-2003. 3. By connection, that the public deed issued by the Instituto de Desarrollo Agrario be annulled solely insofar as it concerns the granting of title to the property located in Partido de Puntarenas, Real Property Folio Registration number 139717-000, in favor of MARVIN PORRAS SÁNCHEZ, whose particulars are stated above, corresponding to Cadastral Plan P-0862160-2003. 4.By connection, that the registration entry for the property registered under the Real Property Folio system in Partido de Puntarenas, Real Property Folio Registration number 139717-000, issued by the Registro Nacional, be annulled. 5. By connection, that any registration deriving from the registration of the real property recorded in the Registro Nacional, Provincia de Puntarenas, Real Property Folio Registration number 139717-000, be annulled. 6. That the defendant be ordered to pay both categories of costs in these proceedings.” (Images 1-28, 117-120 of the electronic case file).
  2. 2Counsel for Palacios y Paraísos Tropicales S.A. opposed the complaint, raising the defenses of expiration (caducidad), lack of legal entitlement (falta de derecho), and statute of limitations (prescripción). (Images 125-147 of the electronic case file).
  3. 3Marvin Porras Sánchez was declared in default (rebelde) by order issued at nine hours and twenty-five minutes on veintiuno de junio del dos mil dieciséis. He entered an appearance in the proceeding by submission dated 5 de octubre del 2020, opposing the complaint. (Images 185-186, 276-277 of the judicial case file).
  4. 4The preliminary hearing provided for in Section 90 of the Código Procesal Contencioso Administrativo (hereinafter CPCA) was held on 7 de diciembre del 2017. At that hearing, the claims were established as set forth in Background paragraph one. The documentary evidence submitted, consisting of the administrative case file, and the testimonial evidence were admitted. (Audio recording in the Sistema de Gestión).
  5. 5On 17 de diciembre del 2019, the State entered an appearance in the proceeding as an interested third party, pursuant to decision N.117-2019-I issued at eight hours and thirty-five minutes on veintisiete de noviembre del dos mil diecinueve. (Images 220-223 and 232).
  6. 6The public oral trial was held with the participation of the parties on 5 de febrero del 2024. The proceeding was declared highly complex pursuant to Section 111 of the CPCA.
  7. 7The statutory formalities have been observed in the proceedings before this Court, and there are no nullities requiring correction or resulting in a denial of due process. Following deliberation, this decision is issued unanimously, drafted by Judge Gómez Chacón, with Judge Soto Fonseca and Judge Mejías Rodríguez concurring.

CONSIDERING:

I.Evidence to assist the Court in reaching its decision (prueba para mejor resolver): During the oral trial, the defendants offered the following documents as evidence to assist the Court in reaching its decision: bill of sale from Pedro Godínez Zúñiga to Víctor Godínez Alvarado; bill of sale from Víctor Godínez Alvarado to Filiberto Porras Fonseca; promissory note from Filiberto Porras Fonseca in favor of Víctor Godínez Alvarado; sworn statement before a Notary Public by Secundino Picado León, signed on 12 de marzo de 2008, concerning ownership of the property at issue; and sworn statement made before a Notary Public on 12 de marzo de 2008 by Carlos Morales Cruz, stating that he acted as a witness to the purchase made by Eliberto Porras Fonseca from Victor Godínez Alvarado on 15 de abril de 1974, when the sale agreement and promissory note were executed jointly. Regarding the documents submitted, this Panel considers that, given the manner in which this matter is decided, they are irrelevant to its resolution; accordingly, that evidence is rejected.

II.Proven facts (hechos probados). For purposes relevant to these proceedings, the following is deemed established: 1. On 26 de noviembre del 2003, Mr. Marvin Porras Sánchez filed an application with the Department of Agrarian Planning to obtain title to the property located in Santa Juana, in the third District of Naranjito, Sixth Canton of Aguirre, Province of Puntarenas, described in cadastral survey plan (plano catastrado) number P-862160 del año 2003, with an area of 96829 square meters and 30 square decimeters. He alleged that he had obtained original possession more than fifteen years earlier, at a value of one hundred thousand colones. The application included statements by Trinidad Vargas Castillo, Carmen Artavia Barrantes, Secundino Picado León, Eduardo del Carmen Artavia Barrantes, and Eliberto Porras Fonseca, as well as the following documents: the original cadastral survey plan, a copy of his identity card, certification from MINAE, and certification from the National Registry stating that he had not registered any real property under the Ley de Informaciones Posesorias and its amendments, together with an affidavit (declaración jurada) made before a notary public stating that the property was not registered in the Public Registry and that there was no judicial or extrajudicial dispute concerning the land.

In connection with that application, the Instituto de Desarrollo Agrario conducted an on-site inspection, determining that the property for which title was sought, recorded as covering a total area of nine hectares and 6829 square meters, consisted of forest (bosque) (Images 20, 21, 36-38 of the court record); 2. Through official letter SINAC-DS-OFAY-C-3125-2003, the Ministry of Environment and Energy of the Sistema Nacional de Áreas de Conservación certified as follows: “Following a review of the corresponding map sheets of the basic map of Costa Rica at a scale of 1:50.000, it has been determined, based on the location shown on cadastral survey plan number P-862160-2003, in the name of I.D.A. and in the possession of MARVIN PORRAS SÁNCHEZ, that it describes a property located OUTSIDE ANY PROTECTED WILDLIFE AREA (área silvestre protegida), REGARDLESS OF ITS MANAGEMENT CATEGORY, ADMINISTERED BY THE MINISTRY OF ENVIRONMENT AND ENERGY.

HOWEVER, IT CONSTITUTES STATE NATURAL HERITAGE (PATRIMONIO NATURAL DEL ESTADO) PURSUANT TO ARTICLES 13, 14 AND 15 OF LEY FORESTAL 7575 DEL 16 DE ABRIL DE 1996.” That certification, issued on 21 de julio del 2003, was submitted by Marvin Porras Sánchez in support of the land-titling application before the IDA. (Image 40 of the court record); 3. At the request of Marvin Porras Sánchez, the Public Registry certified that no properties acquired under the Ley de Informaciones Posesorias appeared registered in his name. (Image 41 of the court record); 4. An affidavit executed as public deed (escritura pública) number two hundred eighteen before notary public María Verónica Méndez Reyes states: “He is the owner of the property described as mountainous land, located in Santa Juana, third district of Naranjillo, Canton of Aguirre, Province of Puntarenas, bounded on the north by Eliberto Porras Fonseca, on the south by Inversiones Fafer S.A., on the west by Roberto Muñoz Sánchez, and on the east by a public road; it measures ninety-six thousand eight hundred twenty-nine square meters and thirty square decimeters, according to cadastral survey plan P- ocho- seis- dos- uno seis- cero- del dos mil tres; it is free of encumbrances (gravámenes) and annotations, and is located within the Proyecto de Titulación Puriscal Parrita, under real-property folio (folio real) San José uno, dos, nueve, tres, nueve, cero, cero, cero.” (Images 42-43 of the court record); 5.

Cadastral survey plan P-822160-2003 describes the land owned by the IDA and possessed by Marvin Porras Sánchez as mountainous land. (Image 49 of the court record); 6. Through Article 39 of session 31-04 del 23 de agosto del 2004 of the Board of Directors of the Instituto de Desarrollo Agrario, based on the “Programa de Titulación Puriscal Parrita,” created by Executive Decree number 3667-G del 18 de marzo de 1974, it was ordered: “In compliance with institutional policies and upon the recommendation of the Parrita Regional Office pursuant to official letter OSP-163-04, the approval of the Central Regional Directorate pursuant to unnumbered official letter, and the Regional Agrarian Coordinator’s review of the requirements for the titling procedure, and in accordance with the Board of Directors’ resolution described in Article XXI, Session 065-00 de 11 de setiembre del 2000, all requirements established by the Regulations for the Titling of Lands in National Reserves (Reglamento para la titulación de tierras en reservas nacionales), published in the official gazette La Gaceta 173 del 10 de setiembre del 2002, having been met, pursuant to the Ley de Tierras y Colonización 2825 del 14 de octubre de 1961 and the Ley de creación del Instituto de Desarrollo Agrario 6735 del 29 de marzo de 1982, authorization is granted to subdivide and transfer the parcel for issuance of a supplementary title of ownership (título supletorio de dominio) to Marvin Porras Sánchez, identity card 1-427-886, regarding the property described in plan 862160-2003.

The resolution further provides that the costs shall be paid within one year and secured by a first-priority mortgage in favor of the Instituto de Desarrollo Agrario, accruing interest at 8% on outstanding balances, except where payment is made upon execution of the deed. The conditions and restrictions applicable to the parcels and lots covered by this resolution are the same as those contained in Article XVIII of the Regulations for the Titling of Lands in National Reserves, published in La Gaceta 173 del 20 de setiembre del 2002. Mr. Walter Céspedes Salazar, Executive President, and Engineer Marco Aurelio Bolaños Víquez, General Manager, are authorized to appear in due course before the assigned notary, Luis Enrique Wong, for the execution of the respective deeds of transfer. Once the notarial record has been signed and the principal deed closed, the notaries may not use this resolution for individual proceedings.” (Images 53-56 of the court record, undisputed fact); 7.

By public deed number one hundred one, executed before Notary Public Luis Enrique Wong Sánchez, title to parcel 19297045 was registered in the name of Marvin Porras Sánchez. (Images 59-66 of the court record); 8. By public deed number one hundred eighty-six, executed before Notary Public Gladys Marín Villalobos, Marvin Porras Sánchez transferred the property registered under number 139717-000 of the Puntarenas Registry District to Palacios y Paraísos Tropicales la Selvita Sociedad Anónima. (Images 66-74 of the court record); 9. Through Resolution Number 47 of Ordinary Session 36 del 5 de octubre of the INDER Board of Directors, the administrative acts issued through resolutions 39 and 49 of ordinary session 031-04, held on 23 de agosto del 2004; session 49 of ordinary session 025-05, held on 4 de julio del 2005; 50 and 57 of ordinary session 044-04, held on 29 de noviembre de 2004; 53 and 58 of ordinary session 022-05, held on 13 de junio del 2005; 53 of session 039-05, held on 10 de octubre del 2005; and 45 of ordinary session 016-04, held on 3 de mayo del 2004, were declared injurious to the public interest (lesivos a los intereses públicos).

At the oral trial, Mr. Marvin Porras testified that the property was acquired from Víctor Fonseca, that it had never belonged to the IDA, and that the INDER mechanism was used to obtain title to it. He stated that the land has a forestry purpose, that ecotourism is now conducted there, and that the crops were abandoned, leaving it as secondary forest. There was forest, but very little; the farm ceased cultivating crops because it entered forestry incentive programs. He stated that the farm described in Víctor Fonseca’s bill of sale is the property described in the cadastral survey plan. The second bill of sale describes the same property. He explained that Filiberto was the person who sold it to his father. There were agroforestry plantings. By this he meant crops consisting of shrubs; there was annatto, and title was obtained through the IDA system because it was easier than obtaining title through possessory-information proceedings (información posesoria).

The payment described in the promissory note was for the purchase; the property was purchased in installments. (Audio in SIGAO); 11. At trial, Mr. Eduardo Artavia Barrantes testified that the farm belonged to Live Porras and that he knew the place because his father worked there and took him there when he was a child. The farm is located along the road to San Marcos de Tarrazú, between Paso Real and Santa Juana. His father took him to that farm; he used to go there when he was between 9 and 10 years old, and he is now 59 years old. His father went there to work on the annatto plantings and cleared those crops; he helped his father on that farm, but later stopped visiting the place. He knows that there are some canopy tours on the farm, but knows nothing further. It had forested areas, pastures, a house, and annatto fields. It was mixed-use; no one completely cleared the wooded areas. The portions under cultivation were maintained. (SIGAO audio); 12. These proceedings were filed before this Court on 18 de noviembre del 2015. (Image 9 of the court record).

III.Unproven facts (hechos no probados): 1. That the property titled in favor of Marvin Porras Sánchez, registered under number 139717-000 and corresponding to Cadastral Survey Plan P-0862160-2003, was located outside a National Reserve (Reserva Nacional). (The record).

IV.Subject matter of the proceeding: This proceeding examines the injuriousness (lesividad) of the following acts: a. Article 39 of session 031-04, dated 23 de agosto del 2004, solely insofar as it concerns the granting of title (titulación) to the property in the Puntarenas Division, Real Property Folio, Registration number 139717-000, in favor of Mr. Marvin Porras Sánchez, whose personal details were previously stated, corresponding to Cadastral Plan P-0862160-2003. b. The public deed issued by the Instituto de Desarrollo Agrario, solely insofar as it concerns the granting of title to the property in the Puntarenas Division, Real Property Folio, Registration number 139717-000, in favor of Mr. Marvin Porras Sánchez, whose personal details were previously stated, corresponding to Cadastral Plan P-0862160-2003. c. The registration entry for the property registered under the Real Property Folio system in the Puntarenas Division, Real Property Folio, Registration number 139717-000, issued by the Registro Nacional.

A declaration that those acts are injurious is sought on the basis of the following arguments: The Instituto de Desarrollo Agrario, now the Instituto de Desarrollo Rural, promoted a series of Titling Programs in National Reserves, pursuant to the Ley de Titulación de Tierras ubicadas en Reservas Nacionales number 7599 of 9 de agosto de 1996, Articles 11 and 12 of the Ley de Tierras y Colonización No 2825 of 14 de octubre de 1961, and Article 32(a) of the Ley de Creación del Instituto de Desarrollo Agrario No 6735. The aforementioned Titling Programs were established in response to a national need, since there were large areas of the national territory in which farmers lacked title to their land. Within those programs, the IDA’s work focused on declaring Titling Zones in areas where persons possessed land but lacked title to it; it then conducted the survey and cadastral registration (catastro) of properties that were not registered in the Registro Público and registered the corresponding title.

The beneficiaries were required to pay the titling and land-surveying costs; those costs were far below the average market cost of obtaining title to land and had to be paid to the IDA within a maximum term of one year. Among those Titling Programs was the program known as the “Programa de Titulación Puriscal Parrita,” created by Decreto Ejecutivo number 3667-G of 18 de marzo de 1974, published in the Diario Oficial La Gaceta number 72 of 17 de abril de 1974. An area of 267.239 has was registered with the Registro Nacional in the name of the IDA under Real Property Folio, Registration number 219039-000. Within the framework of the Programa de Titulación Puriscal Parrita, by means of a written application filed with this Institute on 26 de noviembre del año 2003, the defendant applied for title to parcel 97045 of block 192, described in Cadastral Plan number P-0862160-2003. The titling file shows that certificate number SINAC-DS-OFAU-C-3125-2003, dated 21 de julio del año 2003, was submitted before the property was titled in the defendant’s favor.

It was issued by the Sistema Nacional de Áreas de Conservación del Ministerio de Ambiente y Energía and submitted by the interested party himself before parcel 192-97045 was registered in the defendant’s favor. It stated that the property was located outside any protected wildlife area (área silvestre protegida) under the environmental and energy authorities. However, it partially forms part of the State’s natural heritage (patrimonio natural del Estado), pursuant to Articles 13, 14, and 15 of the same law. During the parcel-titling proceedings, the defendant did not submit a conforming land-use study (estudio de uso conforme de suelo) from INTA or from any duly accredited private professional authorized to conduct such a study. There is no record that any report from the Instituto Geográfico Nacional was submitted. The requirements supporting registration in the defendant’s favor were not met during the property-titling proceeding.

By resolution of the IDA Board of Directors adopted in Article 39 of Ordinary Session 031-04, held on 23 de agosto del año 2004, the subdivision and conveyance (segregación y traspaso) of the property in the defendant’s favor was authorized. The property consists of parcel number 192-97045 of the Proyecto de Titulación Puriscal Parrita, located in Distrito Naranjillo, Cantón Aguirre de la Provincia de Puntarenas, measuring noventa y seis mil ochocientos veintinueve metros con treinta decímetros cuadrados, corresponding to the property in the Puntarenas Division, Real Property Folio number 139717-000, Cadastral Plan number P- 0862160-2003. By public deed number 101 executed before Notary Public Luis Enrique Wong Sánchez, the Instituto de Desarrollo Agrario subdivided and conveyed the aforementioned parcel to the defendant. By public deed number 186 executed before Notary Public Gladys Marín Villalobos, the defendant Porras Sánchez conveyed the aforementioned property to the defendant Palacios y Paraísos Tropicales la Selvita Sociedad Anónima.

A document entitled “Study to Support Oversight Work on Land Titling in the Coto Brus, Cuenca del Río Aranjuez, Llanuras de San Carlos y Sarapiquí, Tierras Altas de Santa Cruz, and Zona Norte Projects of the Instituto de Desarrollo Agrario (IDA)” was prepared and transmitted by No. DGEO-096-08 of 5 de agosto de 2008; it describes, among other matters, the status of the lands comprising the Proyecto Coto Brus. Report No DFOE-PGAA-20-2008, dated 27 de agosto del 2008, issued by the Contraloría General de la República, entitled “Results of Studies on the Titling of Lands in National Reserves Located on Lands Belonging to the State’s Natural Heritage,” and addressed to the Instituto de Desarrollo Agrario, states that the study determined that, within the substantive framework of the various titling projects and in contravention of Articles 13, 14, 15, and 33 of Ley Forestal No 7575 of 5 de febrero de 1996, the IDA granted title to properties that were partially or entirely under forest cover (cobertura boscosa), or whose land-use and topographical characteristics classified them as lands suitable for forestry (terrenos de aptitud forestal) and protection areas (áreas de protección).

Consequently, they could not be removed from State administration or be eligible for titling in favor of the applicants because they formed part of the State’s Natural Heritage and because not all of the requirements necessary to proceed in accordance with the body of law (bloque de legalidad) in force at that time had been satisfied or submitted so that the titling at issue could lawfully proceed. By resolution adopted by the INDER Board of Directors in Article 47 of Ordinary Session 36-2015 of 05 de octubre del 2015, the administrative act issued through resolution number 39 of Ordinary Session number 031-04, held on 23 de agosto del año 2004 by the Board of Directors of this Institution, was declared injurious to the public interest. That act gave rise to the property title registered in the Registro de la Propiedad, Puntarenas Division, Real Property Folio Registration number 139717-000, in favor of Mr.

Marvin Porras Sánchez, and was declared injurious because it had been granted to the detriment of the State’s natural heritage. It was established that the titling proceeding for the specified parcel failed to comply with the necessary regulatory requirements established in the Ley de Titulación de Tierras en Reservas Nacionales number 7599 of 29 de abril de 1996, read together with Ley Forestal No 7575 of 5 de febrero de 1996 and the Reglamento a la Ley de Uso de Suelos 29375-MAG-MINAE-S HACIENDA-MOPT, as requirements for the IDA’s titling of parcels; that noncompliance renders the administrative act defective (vicios del acto administrativo). The ground for nullity (causal de nulidad) in the cases at issue in this proceeding affects the public interest because, as a result of the aforementioned regulatory violations, the IDA authorized the conveyance of the parcel, which forms part of the State’s Natural Heritage.

First, brief reference must be made to the titling programs through which the IDA granted title to properties in favor of private parties. The lands forming part of the titling projects were conveyed to the IDA by decree (in the specific case of the “Programa de Titulación Puriscal-Parrita,” created by Decreto Ejecutivo number 3667-G of 18 de marzo de 1974, published in the Diario Oficial La Gaceta number 72 of 17 de abril de 1974, an area of 267.239 has was registered with the Registro Nacional in the name of the IDA under Real Property Folio 219039-000) for the purpose of carrying out the respective titling projects. These conveyances of the areas to be titled were justified by the possession of unregistered properties by possessors and constituted a legal fiction (ficción legal) through which an extensive geographical area was conveyed to the IDA that indiscriminately encompassed registered and unregistered lands, lands owned by the State and by private parties, and lands with or without possessors.

Consequently, the conveyances were made without prejudice to rights already registered over specific portions within the general boundaries of the respective zone, to possessory-information proceedings (información posesoria) pending when the decree on Titling of Lands in National Reserves was published in La Gaceta, to rights registered in the future, or to portions designated for public use. The purpose of these conveyances was to provide the IDA with a mechanism enabling it to subdivide and convey those lands, likewise under a legal fiction, and thereby register properties in favor of possessors who had possessed the lands under the conditions established by the legal system, in order to facilitate access to credit. In the case of the parcel at issue, which was registered in the defendant’s favor, the fact that the lands had been possessed demonstrates that possession of the parcels predated the Board of Directors’ resolution authorizing their conveyance (adopted in Article 39 of Ordinary Session number 031-04, held on 23 de agosto del 2004).

Accordingly, it is considered that the possessors’ basis for acquiring those lands was their exercise of possession, rather than the conveyances or sales made by the IDA, because the only consideration received by the Institute was payment of the cost of preparing the corresponding plans, not the actual price of the properties. Thus, there was no agreement as to the property and price; the Institute could not convey the lands to the highest bidder but was required to convey them to the possessor who demonstrated compliance with the legal requirements, with the Institute’s role being limited to verifying those requirements. The legal nature of the acts carried out in the IDA’s titling projects was merely declaratory: they were limited to recognizing a person’s ownership right acquired through adverse possession (usucapión) so that it could be registered in the Registro Público; they were not acts constituting the ownership right.

The IDA committed an irregularity during the titling proceeding for that property, and that irregularity is precisely what renders the administrative conveyance act null. It must therefore be stated that the IDA Board of Directors was advised to authorize the conveyance of the respective parcel, purportedly because the requirements previously established in law 7599 had been met, and this was the basis for the administrative acts ordering the conveyance of the property at issue in favor of the defendant.

Despite this, it was found that such compliance did not occur for the following reasons: Page 6 of the titling proceeding (expediente de titulación) contains certificate number SINACDS- OFAU-C-3125-2003, dated 21 de julio del año 2003, prior to the titling of the property in favor of the defendant, issued by the Sistema Nacional de Áreas de Conservación del Ministerio de Ambiente y Energía and submitted by the interested party himself before parcel 192-97045 was registered in the defendant’s name, stating that the property lies outside any protected wildlife area (área silvestre protegida), regardless of its administrative management category under the Ministerio del Ambiente y Energía. Nevertheless, under Articles 13, 14, and 15 of that same law, it partially constitutes State Natural Heritage (Patrimonio Natural del Estado). Despite the evident failure to satisfy this requirement, the titling of the parcel in question was recommended, even though, as stated, land administered by MINAE—such as State Natural Heritage under the Ley Forestal—was required to be excluded from the titling process.

Accordingly, in this case, an evident and manifest defect resulting in absolute nullity (vicio de nulidad absoluta evidente y manifiesta) arose. Additionally, there is no evidence that a soil-conforming-use study (estudio de uso conforme de suelos) was submitted, as required by the regulations implementing the Land Use Law, number 29375-MAG-MINAE-S- HACIENDA-MOPT. Thus, Article 58 of those regulations provides: “In every adverse-possession titling proceeding (información posesoria), or proceeding filed with the IDA or the Courts of Justice for the purpose of registration in the Public Property Registry, the interested party, in addition to the requirements imposed by the generally applicable rules, must demonstrate through an adequate soil study that possession has been exercised in compliance with the soil use appropriate to the activity conducted, in accordance with the approved methodology, and that such activity has been carried out using best management practices and the best available technology, in compliance with Articles 3, 6, 12, 13, 19, 26, 27, 41,43 and 64 of ley 7779 and its regulations.” This Article 58 establishes that, in every adverse-possession titling proceeding filed with the IDA, the applicant for title must demonstrate through an adequate soil study that possession has been exercised in compliance with appropriate soil use, and the IDA is mandatorily required to have that study.

With respect to these provisions, the regulations entered into force on 21 de marzo de 2001, that is, before parcel 192-97045 was titled in favor of the defendant. The study was therefore mandatory, and failure to provide it gives rise to another defect resulting in absolute nullity. By virtue of the foregoing, it must be stated that the ground for nullity of the titling of the parcel at issue lies in the absence, within the body of applicable law (bloque de legalidad), of any rule or procedure whatsoever permitting this type of titling or otherwise justifying the issuance of a valid and effective administrative act, in accordance with the Principle of Legality in Public Law and the rules governing the application of Public Law in time and space. Article 158 of the General Law of Public Administration (Ley General de la Administración Pública) provides that the absence or defect of any requirement of an administrative act that is expressly or implicitly required by the legal system constitutes a defect in that act.

When read in conjunction with Article 166 of the same law, which establishes that an act is absolutely null when one or more of its actual or legal constituent elements is entirely absent, and Article 167, which provides that an act is relatively null when one of its constituent elements is defective, unless the defect prevents the attainment of its purpose, in which case the nullity is absolute, these provisions collectively support the conclusion that the absence of essential requirements for titling the parcel in question renders that administrative act absolutely null. For its part, Article 133 of the General Law of Public Administration, referring to the grounds (motivo) as an element of the validity of an administrative act, provides that such grounds must be lawful and must exist as they were taken into account when the act was issued. In the case of land titling in National Reserves (Reservas Nacionales), the grounds were regulated; therefore, failure to comply with the requirements established by the applicable law or regulations, as occurred in the present case, constitutes defects rendering the act null because the grounds did not exist as they purportedly did when the act was issued.

Article 129 of the Political Constitution (Constitución Política) establishes that acts and agreements contrary to prohibitory laws shall be null unless those laws provide otherwise. Articles 13, 14, 15, 33, and 34 of the Ley Forestal are prohibitory provisions, and the administrative act authorizing the transfer of the parcel to the defendant is contrary to those provisions because it authorized the titling of land forming part of a National Wildlife Refuge (Refugio Nacional de Fauna Silvestre) and, consequently, of the State Natural Heritage. This unquestionably contravenes Article 13 of the Ley Forestal, which declares forestlands and forests in National Reserves to be part of the State Natural Heritage and places them under the administration of MINAE; Article 14 of the same law, which establishes that land within such natural heritage is not subject to attachment and is inalienable, that its possession by private parties creates no rights whatsoever, that it may not be registered through an adverse-possession titling proceeding, and that the State’s action for recovery of possession (acción reivindicatoria) is not subject to a statute of limitations; Article 15 of that law, which concerns the restrictions preventing the Public Administration from transferring, conveying, or leasing rural real property owned or administered by it unless such property has first been classified by MINAE; and, finally, Articles 33 and 34 of the Ley Forestal, which designate protection areas (áreas de protección).

The consequence of contravening these provisions is absolute nullity. The nullity of the administrative act—due to noncompliance with essential requirements and its conflict with prohibitory provisions—through which the property at issue here was titled harms the public interest because that absolutely null act resulted in the titling of land forming part of the State Natural Heritage. Under Article 28 of the Political Constitution, private actions that do not harm morality or public order or prejudice third parties are beyond the reach of the law. The titling of the State Natural Heritage harms public order by impeding the enjoyment of every person’s right to a healthy and ecologically balanced environment, as provided in Article 50 of the Political Constitution, which is itself a public-order provision. It must further be added that the right to a healthy and ecologically balanced environment is a third-generation fundamental right (derecho fundamental de tercera generación) that arose with the Universal Declaration of Human Rights in 1948.

For its part, the 1988 Lisbon Declaration, issued within the framework of the “International Conference on Guarantees of the Human Right to the Environment,” called for recognition of every person’s right to live in a healthy and ecologically balanced environment and also urged States to create legal mechanisms enabling each individual to exercise and assert, without impediment, the right to inhabit a healthy environment in which to develop their life.

V.Regarding the defendants’ position: They state that, pursuant to section 34 of the Code of Administrative Litigation Procedure, the Administration has the authority to seek the annulment of an administrative act before this jurisdiction within one year from the day following the date on which it was issued. Subsection 2) exempts the protection of public-domain property from that time limit. However, considering that the act predates the entry into force of the current Code of Administrative Litigation Procedure, Transitory Provision III thereof must be applied, which refers to the law in force when the act was issued, namely the now-repealed Law Regulating the Administrative Litigation Jurisdiction, section 35 of which provided: “1. When the Administration itself, as the issuer of an act declaring rights, seeks its annulment before the administrative litigation jurisdiction, it must first declare that act detrimental to public, economic, or other interests, within four years from the date on which it was issued.” Both statutory provisions make clear that the one-year or four-year period has long since elapsed, particularly with respect to the defects alleged by INDER in facts 6 and 7 of the complaint, since they are wholly unrelated to the land’s purported public-domain status (naturaleza demanial).

Consequently, the limitation period has expired (caducidad), and they request that it be so declared. Given the alleged ownership status and the principle that public-domain property is not subject to limitation periods (imprescriptibilidad), if this were public-domain property because it constituted the State’s natural heritage (patrimonio natural del Estado), an action seeking a declaration of detriment to the public interest (lesividad) could still be brought. However, that is true only if the property is in fact public-domain property. The public status of property depends on the legislature’s intent; therefore, its dedication to or withdrawal from the public domain (afectación o desafectación) is normally accomplished through ordinary legislation. INDER alleges that the public-domain status of the property owned by the party it represents arises from the declaration of State natural heritage set forth in Ley Forestal No. 7575.

Indeed, Ley Forestal No, 7575, published in La Gaceta No. 72 of 16 de abril de 1996, provides that, as of that date, “the forests and forest lands within national reserves, areas declared inalienable, properties registered in the State’s name, and properties belonging to municipalities, autonomous institutions, and other agencies of the Public Administration” become part of the public domain. First, it should be noted that, on the date the law was published, INDER, formerly IDA, did not own the property that now belongs to the party it represents; nor had the territory been declared inalienable as of that date, and it did not form part of any national reserves because it consisted of unregistered property owned by private parties. It must be considered that, in Ley Forestal No. 7575 itself, Article 72, the legislature amended Article 7 of the Law on Possessory Information (Ley de Informaciones Posesorias), allowing title to be obtained to forest-covered land, even where such land forms part of protected wilderness areas (áreas silvestres protegidas).

Based on the legislature’s provision, it must be understood that the property acquires public-domain status only where there are no possessors of the land who could obtain title to it by demonstrating that they have possessed it for ten years or more openly, peacefully, continuously, without disturbance, and as owners, while caring for the forest and marking its boundaries with fences or cleared boundary lines. That is the only reasonable interpretation because, if public-domain status were recognized without regard to that exception, no one could obtain title to forest land, in which case the cited section 7 would serve no purpose whatsoever. The Constitutional Chamber itself analyzed the content of section 7 of the Ley de Informaciones Posesorias, confirming that title may be obtained to forest-covered real property, even when located in protected wilderness areas. Accordingly, if private parties who demonstrate ten years’ possession can obtain title to the real property, this means that it does not constitute public-domain property; therefore, the action seeking a declaration of detriment in administrative litigation proceedings is subject to a time limit, which in this particular case has elapsed because it expired on 23 de agosto de 2008.

Any other interpretation would effectively endorse an outright confiscation, which is inconsistent with the principles comprising our legal system and the system of law and justice chosen by Costa Rica. Based on the foregoing considerations, because the real property at issue in the litigation is not part of the public domain, since it had been possessed by private parties for more than ten years before the declaration made in the Ley Forestal, and because a private party’s right to acquire it by adverse possession (usucapir) and obtain title in its own name upon satisfying the requirements stated above is recognized, the mandatory statute-of-limitations period within which the State or any other institution, such as INDER, could seek to appropriate the territory has run; accordingly, the preliminary defense based on the statute of limitations (prescripción) is raised. There are two types of proceedings through which a declaration of nullity may be sought, based on the principle that the Administration may not derogate from its own acts (inderogabilidad de los actos propios), which prevents it from unilaterally revoking acts that have conferred rights upon third parties.

The first is that in which the Administration resorts to the detriment-to-the-public-interest proceeding (procedimiento de lesividad) provided for in Article 174 of the General Law of Public Administration (Ley General de la Administración Pública), in conjunction with Articles 10(5) and 34 of the Code of Administrative Litigation Procedure. The second permits a declaration of nullity in administrative proceedings, following an administrative proceeding and a favorable opinion from the Procuraduría General de la República or, in the case of acts involving administrative procurement, from the Contraloría General de la República. In the proceeding examined here, the Administration chose the detriment-to-the-public-interest procedure, which is reserved for cases involving relative or absolute nullity (nulidad relativa o absoluta) that is not evident and manifest; this latter aspect is of vital importance to the analysis because, if the status or nature of the titled land could readily be classified as public domain, a different avenue would have been chosen.

In a detriment-to-the-public-interest proceeding, the head of the Administration that adopted the act whose annulment is sought must conduct an analysis and, based on the results of that examination, issue an act or resolution declaring it detrimental. That declaration that the act is detrimental to public, economic, or other interests must first identify the defects and their severity in order to determine whether the nullity at issue is itself sufficient to be detrimental to the public interest. The grounds for that declaration must be clearly and precisely ascertainable from the act; otherwise, the threshold requirement for this action is not satisfied. Indeed, the administrative decision declaring the act detrimental, submitted by the plaintiff as evidence numbered 9, neither establishes nor determines in any way the material inconsistency with the legal system that renders the administrative act declared detrimental invalid (Article 158.2 of the Ley General de la Administración Pública); it does not even analyze the elements of the act in order to identify a defect in any of them, in accordance with the guidance provided by section 158.1 Ibidem.

Still less does it identify the public interest to which the other act is detrimental, which plainly does not constitute an adequate and proper statement of reasons. (133 and 136 of the Ley General de la Administración Pública). The purported omissions identified by INDER as the basis for the request for a declaration of detriment, consisting of the absence of a “soil study” and an “IGN study,” are omissions that fall, at most, within the scope of relative nullity; therefore, the rules governing cure or validation (saneamiento o convalidación) of administrative acts may be applied. Validation is accomplished through a new administrative act expressly identifying the defect and its correction, and it has retroactive effect as of the date of the validated act. The new act shall be deemed to have corrected or cured the irregularities or defects; consequently, because the defects are curable, the Administration must apply subsection 2 of section 174 of the Ley General de la Administración Pública, which provides: “Article 174.- 1.

The Administration shall be required to annul on its own initiative an absolutely null act, subject to the limitations of this Law. 2. The annulment on the Administration’s own initiative of a relatively null act shall be discretionary and must be justified by a specific 11 current expediency ground. The act by which INDER’s Board of Directors declared detriment contains no supporting grounds whatsoever; therefore, the basic requirement for resorting to this avenue has not been met, and that institution’s special judicial attorneys-in-fact lack authority to substitute their judgment for that of the Administration or to submit arguments that do not arise from the resolution declaring detriment. Another reason why the defense of lack of legal right (falta de derecho) should be granted is that the Administration has failed to prove that the real property it now seeks to appropriate is public-domain property.

Other than a certificate lacking any technical support, it has no evidence proving that the property was forested on the date title was obtained or that it was not then possessed by private parties for purposes of adverse possession (ad usucapione). Lastly, the defense of lack of legal right should be granted because allowing the State—in this case, INDER—to register in its own name unregistered properties belonging to private parties for the purpose of facilitating the issuance of title to them, only then to allege without any basis that those territories belong to it, would amount to legalizing confiscation, in violation of the most fundamental principles of Administrative Law, which, at least in our country, has proscribed “arbitrariness.” The status of a good-faith third-party purchaser (tercero adquiriente de buena fe) presupposes that a person, whether natural or legal, acquires property believing that it is being transferred by its lawful owner and without knowledge of any potential defects in the acquisition.

In legal systems such as ours that have a public registry of real property, the public notice afforded by the registry (publicidad registral) protects a person who acquires from the party appearing in the registry as the owner. A purchaser acts in good faith provided that the purchaser does not know beforehand of defects affecting the validity of the right and its registration, and that the invalidity is not apparent from the registry entry. The doctrine of the good-faith purchaser based on the public notice afforded by the registry is embodied in Article 456 of our Civil Code, which provides: “Article 456.- Registration does not validate registered acts or contracts that are null or voidable under the law. Nevertheless, once registered, acts performed or contracts executed by a person who appears in the Registry to be entitled to do so shall not be invalidated as against a third party, even if the grantor’s right is subsequently annulled or terminated by virtue of an unregistered instrument, implicit grounds, or grounds that, although explicit, do not appear in the Registry.” Furthermore, Article 457 of the same Code protects the registered owner against actions for termination or rescission that could invalidate the transferor’s right, subject only to the exceptions established in that provision.

It provides: “Article 457.- Actions for rescission or termination shall not prejudice a third party who has registered its right. The following are excepted: 1 °.- Actions for rescission or termination arising from grounds that, having been expressly stipulated by the parties, appear in the Registry.

2°.- Rescission actions (acciones rescisorias) concerning transfers (enajenaciones) made in fraud of creditors (fraude de acreedores) in the following cases: 1°.- When the second transfer was made gratuitously (por título lucrativo); and 2°.- When the third party was aware of the debtor’s fraud.” The foregoing is based on the principle of public notice or public reliance on the Registry (publicidad o fe pública registral), which, as already explained, presupposes that whoever appears in the Public Registry as the holder of rights in rem (derechos reales) is the lawful owner. This principle seeks to ensure legal certainty (seguridad jurídica) regarding the chain of title (tracto) of real property, as well as to preserve the public interest involved in protecting legal interests (bienes jurídicos) that are fundamental to social coexistence, such as the right to private ownership of real property.

The protection afforded by this principle of public reliance on the Registry means that, in the event that the non-owner’s (non domino) ownership right is invalid, the ownership right of the acquiring third party does not inherit the invalidity of the previously registered right. Hence, the protection that our legal system affords a good-faith third-party purchaser (tercero adquiriente de buena fe) is clear: that party retains its right despite the possible nullity or annulment of the preceding legal transaction or contract. In view of the foregoing, my client, as a good-faith purchaser, not only owns the property but also acquired it from the person listed in the Registry as its owner. Moreover, INDER has never been the owner, since the registration in its name at one time had the sole purpose of facilitating the formalization of the rights of private parties who possessed the land as owners and met all the requirements for obtaining title (titular), including having exercised ecological possession (posesión ecológica), which, as we noted, has been duly recognized and, in the case under review, precludes the possibility that the land became part of the public domain (dominio público).

In any event, as established by Article 144 of the General Law of Public Administration (Ley General de la Administración Pública), “1. An administrative act (acto administrativo) may neither take effect nor be enforced to the detriment of the subjective rights (derechos subjetivos) of good-faith third parties, unless the legal system expressly or unequivocally provides otherwise. 2. Any harm caused by an act to the subjective rights of good-faith third parties shall be compensated in full, without prejudice to any appropriate annulment,” and neither the administrative record (expediente administrativo) nor the judicial record (expediente judicial) shows that the Public Administration has made provision to compensate my client in full. Such compensation must at least be a concomitant action, given the evidence that my client made the acquisition in reliance on the public notice provided by the Registry.

I respectfully ask the Court to consider that the cited provision is clear in requiring the Administration to compensate the subjective rights of good-faith third parties, a status of which INDER is aware; it must therefore act accordingly, since the rule does not require the third party to file a counterclaim or bring an independent action, thereby aggravating its losses. For his part, defendant Porras Sánchez opposes the complaint, asserting that title to the property was obtained over property eligible for titling (titulación) because it had always been privately owned, having been acquired by means of a lawful purchase-and-sale instrument (título de compraventa), and he therefore considers that it was never public-domain property (bien demanial); the titling process of the Instituto de Desarrollo Agrario was used solely as a matter of convenience.

VI.The State’s position: It states that, at ordinary meeting of the Board of Directors No. 36-2015 of 5 de octubre de 2015, article 47, INDER declared adverse to the public interest (lesivos) the challenged resolutions that gave rise to registration 6-139717-000, survey plan P-862160-2003, covering a mountain area of 9 Ha. 6829.30 ms. The INTA soil study and the Instituto Geográfico Nacional report were not submitted in those title proceedings (trámite de titulación). Furthermore, certification SINAC-DS-OFAUC- 3125-2003 of 21 de julio de 2003 stated that the aforementioned property constitutes State Natural Heritage (Patrimonio Natural del Estado). In that regard, it should be noted that the field inspection report of 29 de marzo de 2004, prepared by an official of the Oficina Regional de Parrita, reported that the property in its entirety contains a forest area of 9 Ha. 6829.30 m2. In addition to protected wildlife areas (áreas silvestres protegidas), that Heritage also includes forests, forest lands, and lands suitable for forestry.

The proceedings in this case were conducted pursuant to the Reglamento para la titulación de Tierras en Reservas Nacionales, adopted by resolution of the Board of Directors of the Instituto de Desarrollo Agrario and published in La Gaceta No. 173 of 10 de setiembre del 2002, which was annulled in constitutional proceedings with effects “retroactive to the effective date of the provisions being annulled, namely, twelve August two thousand two,” because IDA lacked authority to issue it and no legal grounds existed to support it. Accordingly, the administrative acts challenged herein are vitiated by absolute nullity (nulidad absoluta) because they affect State Natural Heritage and were carried out pursuant to an unconstitutional regulation. Furthermore, article 10 of the aforementioned annulled Regulation permitted only the transfer of lands “that are not subject to administration by MINAE” and required an “original certification issued by MINAE stating that the land to be titled, according to the cadastral plan, is not affected by or included within... the State’s natural heritage.” Article 1° of the annulled Regulation stated: “The purpose of this legal instrument is to regulate the provisions of the Ley de Tierras y Colonización relating to the titling of lands in the National Reserves....” However, the Ley de Tierras y Colonización, No. 2825 of 14 de octubre de 1961, does not govern land titling; it addresses only parceling (parcelación) in articles 49 to 81 and colonization (colonización) in sections 82 to 91.

Titling, or the procedure for obtaining a registrable title of ownership (título de dominio inscribible), premised on the exercise of possession ad causam and subject to the requirements listed in the Código Civil, differs from parceling and colonization. Parceling and colonization are declaratory agreements for acquiring ownership from the public agrarian entity, subject to conditions different from those governing titling. Colonization may even involve forms of land tenure other than ownership, such as leasing, with or without an option to purchase, sharecropping, or usufruct. The Ley de Tierras y Colonización did not authorize IDA to issue titles or promulgate a Reglamento para la Titulación de Tierras en Reservas Nacionales. That Regulation circumvented legislative authority by creating a special, summary administrative procedure that excluded the judicial procedure established in the Ley de Informaciones Posesorias, No. 139 of 14 de julio de 1941.

This was all the more so because it amended the titling rules by authorizing titling of lands registered in IDA’s name (articles 7 of the Regulation and 1° of the Ley de Informaciones Posesorias). All legislation that previously authorized administrative titling before ITCO or IDA, and that is no longer in force today, had the force of law: Ley de Informaciones Posesorias Administrativas No. 3971 of 11 de octubre de 1967, Ley de Informaciones Posesoras No. 4545 of 20 de marzo de 1970, and Ley de Titulación Múltiple de Tierras No. 5064 of 22 de agosto de 1972. Certification No. SINAC-DS-OFAU-C-3125-2003 of 21 de julio de 2003 stated that survey plan P-862160-2003 constitutes State Natural Heritage; similarly, the field inspection of 29 de marzo de 2004, conducted by an official of the Oficina Regional de Parrita, reiterated that the property in its entirety contains a forest area of 9 Ha. 6829.30 m2.

Accordingly, the forests and forest lands or lands suitable for forestry contained within property 6-139717-000 constitute State Natural Heritage under article 13 of the Ley Forestal. As such, they could not be exchanged, assigned, alienated in any manner, conveyed, or leased (Ley7575, articles 13, 14 and 15). Article 10 of the aforementioned annulled Regulation permitted only the transfer of lands not subject to administration by MINAE and required a certification stating that the land to be titled, according to the cadastral plan, was not affected by or included within the State’s natural heritage; in view of certification SINAC-DS-OFAU-C-3125-2003, it is clear that those requirements were not met. The defendant contends that it acquired the property in reliance on the public land registry and in good faith. It asserts expiration (caducidad) and prescription (prescripción), invokes lack of legal entitlement (falta de derecho), and maintains that it must be compensated for purchasing the property.

Those defenses and objections are unfounded. The principles of inalienability and immunity from prescription that characterize public-domain property (bienes demaniales), together with the legal notice afforded by its public-domain status (publicidad legal del demanio), preclude reliance against it on the status of a registered third party (tercero registral) to consolidate private ownership unlawfully removed from that regime. Another aspect that must not be overlooked is that the designation for public-domain purposes (afectación demanial) of forest lands and forests did not begin with Ley Forestal No. 7575 of 1996, but derives from earlier forestry laws. Where provisions place the same property within the public domain, the applicable principle is that public-domain status is deemed to have arisen under the first provision designating it as such. Therefore, the title issued by INDER over public-domain property is null and void.

Indeed, registration does not cure the nullity of a title. The registry does not cure defects in the registered instrument or the act embodied therein, and those defects persist. Faced with an illegitimate registration, a private party acquires no right; the act remains absolutely null and void. Good faith and legitimate expectations (confianza legítima) cannot prevail with respect to public-domain property, regardless of the passage of time, tolerance, or administrative actions that may have encouraged the improper occupancy, which must be reversed; nor may that occupancy be based on an asserted vested legal situation (situación jurídica consolidada), because the lands are subject to the public domain and cannot be appropriated or used by private parties unless they hold an administrative authorization or concession permitting such use. The public-domain nature of the occupied land defeats any claim of good faith, and the principle of legitimate expectations does not apply.

VII.Concerning the prerequisites for proceedings for declaration of harmfulness (proceso de lesividad). For purposes of analyzing these proceedings, it is important to begin by determining whether the prerequisites imposed by the legal system for the filing of proceedings for declaration of harmfulness by the Public Administration have been met, since the absence of any one of them would render an examination of the merits unnecessary. In general terms, this Tribunal has already indicated that the various Sections of the Tribunal Contencioso Administrativo have specified in their judgments that the declaration of harmfulness (lesividad) is a judicial mechanism by which the Administration seeks the invalidation of one of its own acts that produces favorable effects or declares rights in favor of a private party and, at the same time, considers those effects detrimental to the public interest, whether economic, social, tax-related, health-related, or otherwise.

Logically, the nature of this claim requires the participation of anyone adversely affected by the annulment of the conduct granting the individual right or benefit, so that such person may defend their interests through adversarial proceedings (contradictorio). In accordance with the foregoing, it is the Judge who must analyze the validity of administrative conduct having favorable content. The statutory provisions governing this procedural mechanism are contained in the Ley General de la Administración Pública and the Código Procesal Contencioso Administrativo. The latter, in Article 34, establishes the preliminary elements and procedural rules applicable to this mechanism, in conjunction with Articles 173(6) and 183 of the Ley General de la Administración Pública. In summary, the cited provisions establish the subjective, objective, procedural, and temporal requirements for an action for declaration of harmfulness (acción de lesividad).

First, regarding the subjective element, it must be specified that standing to bring the action (legitimación activa) is granted to the Administration that issued the challenged act, while the party with standing to be sued (legitimado pasivo) is the recipient of the effects of the conduct declared harmful—that is, the person who obtains its benefits. The objective element concerns the mechanism for legally invalidating administrative acts that are favorable to, or declare rights in favor of, a private party, but which the Administration considers to be vitiated by absolute or relative nullity (nulidad absoluta o relativa) and which, therefore, are substantially inconsistent with the legal system. With respect to the procedural requirements, the Administration must declare that conduct harmful to the public interest, and the highest-ranking authority of the respective Public Administration must declare the act harmful, whether because it injures economic, social, fiscal, or other interests arising from the public interest.

For this purpose, that authority must have an underlying legal and technical opinion supporting the determination. It is important to recall that, because this is a procedural requirement that will be submitted for judicial review, unlike the administrative proceeding for declaring an absolute, evident, and manifest nullity (nulidad absoluta, evidente y manifiesta), which is conducted administratively by the Administration that issued the act, the private party is not granted a hearing here. This is because it is an internal action of the Administration intended to ascertain the will of its highest-ranking authority and, in turn, to permit the commencement of judicial proceedings. It is during those proceedings that any person deriving rights from the challenged act may exercise the right of defense. Consequently, the absence of that person’s participation in the administrative phase of the declaration of harmfulness does not in any way impair their right to due process or administrative procedure.

Another significant issue when analyzing the act declaring harmfulness is determining whether the act was issued by the highest-ranking administrative authority. The rules are as follows: when the act emanates from the State—that is, from the Central Administration—under Article 16 of the Código Procesal Contencioso Administrativo, the claim may be filed only by the Procuraduría General de la República, following a request from the highest-ranking authority and an internal declaration of harmfulness detailing the reasons underlying that determination. The same procedural rule applies when the harmful act emanates from the Poder Legislativo, Poder Judicial, or Tribunal Supremo de Elecciones, insofar as they exercise administrative functions. In the case of acts of the Poder Judicial issued in the exercise of its administrative function, such representation further requires that acts issued by the Consejo Superior, for example, be declared harmful by the Corte Plena.

Finally, with respect to decentralized public administrations, the declaration must be issued by the highest body in the administrative hierarchy. Another matter to be considered is that, procedurally, the Administration is barred from asserting the claim for annulment by way of counterclaim. Finally, Article 34 of the Código Procesal Contencioso Administrativo establishes a temporal limitation consisting of a period of one year, calculated from the business day following issuance of the act, within which the act must be declared harmful to the public interest through administrative channels. This is without prejudice to cases in which the act is affected by absolute nullity and continues to produce effects; in that event, pursuant to Article 34(1) of the same body of law, the internal declaration may be made for as long as those effects continue. Under that hypothesis, the one-year period is calculated from the date on which those effects cease, and any judgment ordering nullity shall do so solely for purposes of annulment and the future non-application of the annulled conduct.

Following that declaration, a period of one year is granted to file the administrative litigation action (acción contenciosa administrativa), subject to forfeiture of the action (caducidad), as provided in Article 39(e) of the Código Procesal Contencioso Administrativo. The exception to the temporal rules cited above concerns the protection of public-domain property (dominio público), in which case the action for declaration of harmfulness is not subject to any time limit, as follows from Article 34(2) of the Código Procesal Contencioso Administrativo, pursuant to the general rule that property of this kind is not subject to prescription (imprescriptibilidad), as established in Article 261 of the Código Civil. It should therefore be noted that when an action for declaration of harmfulness concerns State public-domain property (bienes demaniales), the time limit for declaring harmfulness under the procedural provisions at issue is inapplicable, meaning that the declaration may be made at any time without incurring any procedural penalty.

It must also be noted that Article 41(2) of the Código Procesal Contencioso Administrativo expressly establishes that, in tax matters, the maximum period for commencing proceedings shall be the same limitation period established by the legal system for the respective substantive right at issue. Lastly, when reviewing judicial proceedings for declaration of harmfulness, the Tribunal must determine whether the act sought to be annulled was issued before the Código Procesal Contencioso Administrativo entered into force—that is, on 1 de enero del 2008—because, if so, Transitorio III of that body of law must be applied. Under that provision, challenges to administrative acts that became final through administrative channels before the cited Code entered into force shall be governed by the legislation then in effect. Having clarified the foregoing, we now analyze whether, in this specific case, the statutory prerequisites for granting the action have been met. (See, to the same effect, judgment 119 of 20 de setiembre del 2020, issued by the Sección Primera del Tribunal Contencioso Administrativo y Civil de Hacienda).

VIII.Regarding compliance with the requirements for the declaration of harmfulness to the public interest (declaratoria de lesividad): According to the judicial record (expediente judicial), the plaintiff entity has indeed satisfied the objective, subjective, temporal, and procedural requirements for the subject matter of the proceedings to be examined by this Chamber of Judges. First, the subjective element has been satisfied, since the Board of Directors of the Instituto de Desarrollo Rural issued the administrative act (acto administrativo) declaring harmful to the public interest the resolution granting individual rights (derechos subjetivos) to Marvin Porras Sánchez and Palacios y Paraísos Tropicales, which acquired, through purchase and sale, the transfer of the titling right that was declared harmful. Following that reasoning, in Resolution Number 47 of Ordinary Session 36 of 5 de octubre, the Institute’s Board of Directors declared harmful to the public interest the administrative acts issued through resolutions 39 and 49 of ordinary session 031-04, held on 23 de agosto del 2004; resolution 49 of ordinary session 025-05, held on 4 de julio del 2005; resolutions 50 and 57 of ordinary session 044-04, held on 29 de noviembre de 2004; resolutions 53 and 58 of ordinary session 022-05, held on 13 de junio del 2005; resolution 53 of session 039-05, held on 10 de octubre del 2005; and resolution 45 of ordinary session 016-04, held on 3 de mayo del 2004, which authorized titling in favor of Marvin Porras Sánchez, setting out in general terms the defects rendering the act null and void (vicios de nulidad) and the grounds supporting the declaration of harmfulness; accordingly, the grounds for nullity alleged by the defendant with respect to that act are not apparent.

It should be noted that, through a resolution of the Board of Directors, Article 39 of session 31-04 of 23 de agosto del 2004 of the Board of Directors of the Instituto de Desarrollo Agrario, it was ordered: “In compliance with institutional policies and upon the recommendation of the Parrita Regional Office pursuant to official letter OSP-163-04, the approval of the Dirección Regional Central pursuant to official letter S/N, and the review by the Coordinador Agrario Regional of the requirements for the titling procedure, and in accordance with the resolution of the Board of Directors described in Articulo XXI, Session 065-00 of 11 de setiembre del 2000, and all the requirements established by the Reglamento para la titulación de tierras en reservas nacionales, published in the official gazette La Gaceta 173 of 10 de setiembre del 2002, having been satisfied, under the authority of the ley de Tierras y Colonización 2825 of 14 de octubre de 1961 and the Ley de creación del Instituto de Desarrollo Agrario 6735 of 29 de marzo de 1982, authorization is granted to subdivide and transfer the parcel for a supplementary title of ownership (título supletorio de dominio) to Marvin Porras Sánchez, identity card 1-427-886, namely the property described in survey plan (plano) 862160-2003; that resolution was formalized through public deed (escritura pública) number ciento uno executed before Notary Public Luis Enrique Wong Sánchez, whereby parcel registration 19297045 was titled in the name of Marvin Porras Sánchez and registered as property number 139717-000 in the Puntarenas Registry District.

Subsequently, through public deed number 186 executed before Notary Public Gladys Marín Villalobos, Marvin Porras Sánchez transferred the property registered under number 139717-000 in the Puntarenas Registry District to Palacios y Paraísos Tropicales La Selvita Sociedad Anónima. As to the subject matter of the proceedings, it is clear that they concern a declaration of nullity (declaratoria de nulidad) of the administrative act granting rights to an individual, Porras Sánchez; therefore, the claim for annulment (pretensión anulatoria) is consistent with proceedings for a declaration of harmfulness to the public interest (proceso de lesividad). Likewise, the action was brought by the aforementioned Institute, as the issuer of the challenged act, against the persons in whose favor the beneficial effects of the act arose, who in this case are the beneficiary of the titling; consequently, with respect to both the active and passive subjective scope and the objective scope, the requirements referred to in the preceding section have been satisfied.

Regarding timeliness, because the dispute concerns property classified as public-domain property (bien de dominio público), the limitation period (plazo de caducidad) governed by Article 39 of the Código Procesal Contencioso Administrativo is inapplicable. To reach that conclusion, however, the evidence entered into the record must be examined, since the matter involves review of the validity of an administrative act issued in the year 2005—that is, before the Código Procesal Administrativo entered into force. The Third Transitory Provision (Transitorio Tercero) of that body of law is therefore applicable, and accordingly, challenges to administrative acts that became final at the administrative level (firmes en la vía administrativa) before that Code entered into force are governed by the legislation then in effect (Ley Reguladora de la Jurisdicción Contencioso Administrativa), unless, of course, it can be shown that the property is public-domain property (bien demanial), for which an action for recovery of title (acción reivindicatoria) is not subject to time limits.

Accordingly, the Court considers it essential to determine whether the property is public-domain property and then to examine the temporal aspects of the proceedings for a declaration of harmfulness to the public interest and, if necessary, rule on the merits of the matter.

IX.Subject Matter of the Proceedings: Declaration of nullity of the administrative act (acto administrativo) for violating rules of public law governing public-domain property (bienes demaniales): In these proceedings, the Instituto de Desarrollo Rural seeks the annulment of the resolution adopted by its Junta Directiva, Article 39, at session 031-04, dated 23 de agosto del 2004, solely insofar as it concerns the granting of title (titulación) to the property in the Puntarenas Registry District, Real Property Folio Registration number 139717-000, in favor of Mr. Marvin Porras Sánchez, whose particulars were stated above, corresponding to Cadastral Plan (Plano Catastrado) P-0862160-2003. On the ground of relatedness (conexidad), it requests the annulment of the public deed (escritura pública) issued by the Instituto de Desarrollo Agrario, solely insofar as it concerns the granting of title to the property in the Puntarenas Registry District, Real Property Folio Registration number 139717-000, in favor of Mr.

Marvin Porras Sánchez, corresponding to Plano Catastrado P-0862160-2003. It also requests the annulment of the registry entry (asiento registral) recording the property registered under the Real Property Folio system in the Puntarenas Registry District, Real Property Folio Registration number 139717-000, issued by the Registro Nacional, as well as any derivative registration. In essence, it argues that the aforementioned resolution is void because it adversely affects the public interest, since it authorized the transfer of a parcel forming part of the public domain (dominio público), as it constitutes State Natural Heritage (Patrimonio Natural del Estado), and because title was granted without compliance with the statutory and regulatory requirements imposed by the legal system. This position is supported by the representation of the State as an interested third party (tercero interesado) in these proceedings.

The representative of Palacios y Paraísos Tropicales S.A, for its part, states that, pursuant to provisions 455, 456 and 457 of the Código Civil and the principle of public notice through registration (principio de publicidad registral), the claimed nullity cannot be asserted against its ownership right. It further contends that the property is not public-domain property within the meaning of provision 7 of the Ley de Informaciones Posesorias and that, accordingly, the action for declaration of adverse effect (acción de lesividad) is time-barred by expiration and limitation (caduca y prescrita). It also asserts that the defects in the act arising from the missing requirements constitute curable relative nullity (nulidad relativa subsanable), rather than absolute nullity (nulidad absoluta). Lastly, it states that the declaration of adverse effect (acto de lesividad) does not satisfy the statutory requirements.

Defendant Porras Sánchez opposes the claim, stating that the property titled in his favor is private in nature and was acquired through a lawful purchase and sale. To address the merits of the matter, the Court must briefly discuss public-domain property and its special protective regime. In that regard, this Court recently stated: “First, we must be clear that not all property belonging to public entities is in the public domain, because such entities also hold patrimonial property (bienes patrimoniales), or private-domain property (bienes de dominio privado). The former is governed by Public Law and therefore subject to it, whereas the private-law regime, subject to special coordination rules, applies to the latter. For purposes of rendering this judgment, we must focus on determining the concept of public-domain property. This distinction is grounded in the Código Civil itself, Article 261 of which states: ‘Public things are those that, by law, are permanently allocated to any service of general utility, and those that everyone may use because they have been made available for public use.

All other things are private and subject to private ownership, even if they belong to the State or to Municipalities, which, for these purposes and as civil persons, are no different from any other person.’ Indeed, by their nature, such assets are subject to a special Public Law regime. They form part of the public domain (demanio público), understood as ‘(…) the collection of assets subject to a special legal regime distinct from that governing private ownership, which, in addition to belonging to or being administered by public legal entities, are allocated or intended for purposes of public utility, as manifested in the direct or indirect use that every person may make of them. (…)’ (Judgment No. 3145, issued by the Sala Constitucional at 9 hours 27 minutes on 28 de junio de 1996). In light of the foregoing, we may affirm that the public domain comprises assets which, by the legislature’s express will, have the special purpose of serving the community and the public interest, and whose titleholder is the State in the broad sense, for the exercise of its administrative and protective responsibilities.

We must understand that these are things that do not belong individually to private persons, are intended for public use, and are subject to a special regime outside private commerce among human beings. Thus, they are assets belonging to the State in the broadest sense of the term, allocated to the service they provide and governed, for that purpose, by the public interest. Legal scholarship also recognizes public-domain property intended for public use, property held under public protection, property known as State patrimony, and, lastly, temporary property. As may be noted, these are different, although directly related, categories. To explain this classification, we first identify a group of assets intended for general use, such as streets, parks, and beaches, among others. They are classified as public-domain property because of their use, and access to them is generally free, without charge, and unrestricted, as in the case of streets, parks, and beaches.

This constitutes a direct allocation (afectación) to public use, which justifies its relevance and usefulness within this classification. The second group of public-domain assets comprises those whose public use is indirect, encompassing all assets directly allocated to a public service. It is appropriate to add here that, irrespective of who holds title to the service, insofar as it is public, it satisfies a general or collective interest; consequently, the assets comprising it are indispensable to prevent harm to the community, and for that reason the legislature grants them special protection. Their relationship with society is therefore described as indirect, insofar as their collective use does not occur through direct use by persons, but through the service itself. Another classification concerns public-domain property safeguarded by the State, such as national parks, volcanoes, and islands.

In another category, we have public-domain property constituting State patrimony, governed by Article 121, subsection 14) of the Constitución Política, without this being understood as a closed list (numerus clausus). Such assets are understood as mineral or natural assets that the State retains within its domain and in which, depending on the relevant requirements, it allows private persons to participate—for example, deposits of petroleum, aluminum, copper, mercury, water, gold, etc. Lastly, there is temporary public-domain property, meaning assets that may be transferred by the State to private persons when a special statutory procedure is followed for the purpose of fulfilling public objectives, or when, because of their use, they cease to be useful. These are ordinarily technological assets that, upon becoming obsolete with the passage of time, lose their public-domain status. Accordingly, this Court has repeatedly stated in prior cases that these assets have a nature and legal regime distinct from those of private property, because, by the legislature’s express will, they are allocated to the special purpose of serving the community—that is, the public interest—and therefore cannot be privately owned.

They are consequently outside private commerce and cannot belong individually either to private persons or, strictly speaking, to the State, since the State’s role is limited to their administration and protection. In view of the parties’ arguments, it is also important to clarify that an allocation established by operation of law (por ministerio de ley) constitutes an exercise of public authority which, in accordance with political and historical decisions, may be structured to operate individually with respect to particular assets or generally, including through the automatic allocation of an asset merely because it meets the statutory conditions. An administrative act may declare such an allocation, as occurs with historical and architectural heritage, or it may arise from a general legislative provision, as occurs with State Natural Heritage. Indeed, public property may be natural or artificial, depending on whether it consists of assets declared public by the legislature in the condition in which nature presents or provides them, or assets declared public by the legislature whose creation or existence depends on human action.

Public-domain assets, however, must possess certain essential elements in order to qualify as such. The subjective element (elemento subjetivo) concerns the public entity holding title to the asset for purposes of its administration, preservation, protection, and defense. The objective element (elemento objetivo) concerns all assets that may be included within the public domain, whether by a general statutory provision or by a provision that individually identifies a particular asset. The normative element (elemento normativo) is, of course, the statutory rule so providing. It is important to clarify that national assets included by the will of the Constituent Assembly in Article 21 subsection 14) of our Carta Magna likewise possess the status of public-domain assets. Lastly, the purposive element (elemento finalista) concerns the public purpose pursued, as discussed above.” (Judgment n°119 of 20 de setiembre del 2020 of the Sección Primera del Tribunal Contencioso Administrativo y Civil de Hacienda).

From the passage quoted, it follows that, insofar as the four stated elements are satisfied, the constituent assets enjoy special protection by virtue of being deemed inalienable, not subject to acquisitive prescription, and immune from attachment (inalienables, imprescriptibles e inembargables), with all the resulting consequences. For that reason, an action to recover them is not subject to expiration periods (plazos de caducidad), as expressly stated in provision 34 of the Código Procesal Contencioso Administrativo; accordingly, their use or exploitation is subject to the police power (poder de policía) exercised by the institution or public entity responsible for their administration and ownership. In summary, as may be seen, public-domain status (régimen de demanialidad) is a legal concept requiring a formal legislative declaration that specified assets are subject to the public-domain regime, the designation of the titleholder responsible for their defense, administration, and protection, and identification of the purpose pursued. To examine in greater depth the particular assets constituting State Natural Heritage, we analyze them in the following recital (considerando).

X.On public-domain assets (bienes de dominio público) constituting the State Natural Heritage (Patrimonio Natural del Estado): This subject has been extensively addressed in case law. The First Chamber of the Supreme Court of Justice has stated: “(…) Pursuant to section 13 of the Ley Forestal, ‘The State Natural Heritage shall consist of the forests and forestlands (terrenos forestales) of national reserves, areas declared inalienable, properties registered in its name, and properties belonging to municipalities, autonomous institutions, and other agencies of the Public Administration, except for real property securing credit transactions with the National Banking System that becomes part of their assets...’ Accordingly, the provision establishes three categories of assets comprising said heritage: a) forests and forestlands of national reserves; b) forests and forestlands of areas declared inalienable; and c) forests and forestlands of properties registered in its name and properties belonging to municipalities, autonomous institutions, and other agencies of the Public Administration, except for real property securing credit transactions with the National Banking System that becomes part of their assets.” (In this regard, judgments numbers 1070, issued at 9 hours 45 minutes on 3 de setiembre de 2010, and 1088, issued at 8 hours 55 minutes on 8 de agosto de 2011, may be consulted).

As the First Chamber states in the referenced ruling, the State Natural Heritage is defined by the provisions of the Ley Forestal, which also establishes in section 14 the public-domain status (demanialidad) applicable to the areas defined as part of the State Natural Heritage, as follows: “Article 14.- Unattachable and inalienable status of the natural heritage: The forestlands and forests constituting the State Natural Heritage, as detailed in the preceding article, shall be unattachable and inalienable; possession thereof by private parties shall create no right in their favor, and the State’s action for recovery of title (acción reivindicatoria) to such lands shall not be subject to any statute of limitations (imprescriptible). Consequently, they may not be registered in the Public Registry through possessory title proceedings (información posesoria), and both their invasion and occupation shall be punished in accordance with the provisions of this law.” With respect to the inalienability of these lands, section 15 of the same law provides: “Article 15.- Restrictions.

Agencies of the Public Administration may not exchange, assign, alienate in any manner, transfer, or lease rural lands owned or administered by them unless such lands have first been classified by the Ministry of Environment and Energy. If they are covered by forest, they shall automatically be incorporated into the State Natural Heritage, and a restriction shall be established and recorded in the Public Registry.” Pursuant to the foregoing sections, it is clear that the assets constituting the State Natural Heritage are inherently public-domain assets, which, by virtue of their status, are not subject to any statute of limitations, are inalienable, and are outside private commerce.

XI.On the nature of the property at issue in this specific case: Admissibility of the action for annulment of a favorable administrative act (acción de lesividad): In this matter, as indicated, the Instituto de Desarrollo Rural argues that the administrative act is vitiated by absolute nullity (nulidad absoluta), because it infringes the public-domain regime (régimen demanial) established in the Ley Forestal, insofar as the agreement adopted by its Board of Directors under article 39 of session 031-04, dated 23 de agosto del 2004, authorized, solely with respect to the granting of title (titulación) to the property in the Partido de Puntarenas, Folio Real Matrícula número 139717-000, in favor of Mr. Marvin Porras Sánchez, corresponding to Plano Catastrado P-0862160-2003, and its related acts, without satisfying the prescribed legal requirements, even though the land forms part of the Natural Heritage of the State (Patrimonio Natural del Estado).

That granting of title was formalized in public deed number ciento uno executed before Notary Public Luis Enrique Wong Sánchez, whereby title to parcel 19297045 was registered in the name of Marvin Porras Sánchez; that parcel is registered as property number 139717-000 in the Partido de Puntarenas. Subsequently, by public deed number 186 executed before Notary Public Gladys Marín Villalobos, Marvin Porras Sánchez transferred the property registered under number 139717-000 in the Partido de Puntarenas to Palacios y Paraísos Tropicales la Selvita Sociedad Anónima. In this regard, to determine whether or not that property forms part of the public domain (demanio público), the concurrence of the subjective, normative, objective, and purposive elements must be analyzed, as explained in recital IX (considerando IX) of this judgment. In this respect, as established in the record, the granting of title originated in the establishment of the Programa de Titulación Puriscal-Parrita, created by Decreto Ejecutivo número 3667-G del 18 de marzo de 1974, published in the Diario Oficial La Gaceta número 72 del 17 de abril de 1974.

An area of 267.239 has was registered in the Registro Nacional in the name of the IDA under Folio Real Matricula 219039-000 (an undisputed fact), pursuant to the Ley de Titulación de Tierras en Reservas Nacionales número 7599 de 1996, which was declared unconstitutional in the year 2001 by the Sala Constitucional. The Board of Directors therefore proceeded to grant title to the property at issue in these proceedings pursuant to the regulation entitled Titulación de Tierras ubicadas en Reservas Nacionales, issued by the IDA Board of Directors, which replicated the provisions of Ley 7599 and was likewise declared unconstitutional by a decision of the Sala Constitucional in the year 2007. The first section of that regulation provided: “Article 1º- The purpose of this legal instrument is to regulate the provisions of the Ley de Tierras y Colonización concerning the granting of title to land in National Reserves, providing legal certainty in land tenure (tenencia de la tierra) through recognition of full ownership in areas where the possessors have acquired the right to registered title.” That regulation defined “National reserves (Reservas nacionales): Land located within the boundaries of the Republic that is not registered in the name of third parties, Municipalities, Autonomous Institutions, or the State in general.” Under this reasoning, it is clear that the property to which title was granted in favor of defendant Porras Sánchez consisted of assets forming part of national reserves—because they arose from authorization to register property having the characteristics of National Reserves, as established by Ley 7599 de 1996—meaning that, pursuant to section 13 of the Ley Forestal, those territories are among the properties that the legislature declared to be part of the Natural Heritage of the State; consequently, they are outside private commerce (fuera del comercio de los hombres) and may not be titled as private property.

In this regard, it should be noted that voto 2063-2007 of the Sala Constitucional de la Corte Suprema de Justicia, which declared the Reglamento Titulación de Tierras ubicadas en Reservas Nacionales unconstitutional, stated:

“In the case under examination, the challenged provision seeks to grant title to areas that have been declared protected, precisely because of the importance of conserving them against the various human activities that alter the ecosystems and environmental habitats found in those places, as well as preserving forests, which are important for generating essential and invaluable resources such as water. In this law, the legislature expresses the need to grant ownership title to the occupants of the areas in question, noting that acquisition is subject to the applicable environmental restrictions and protections. However, an examination of the challenged provision shows that the power to grant title in these areas has an indiscriminate scope of application. If applied in this manner, title could be granted to areas in which many human activities are incompatible and could seriously harm the ecosystem found there, while also impairing the State’s ability to exercise proper oversight over them.

Even assuming that these persons have occupied these areas, which are public-domain property (bienes de dominio público), for many years, this does not in any way justify granting title to any such area, because the State itself, in order to protect the environment, may order these persons evicted from areas where their presence is instead producing a harmful effect. Consequently, if title were granted to these types of areas, the State would have to expropriate property that it may previously have had to expropriate in order to declare it a protected area, thereby engaging in an unreasonable act. The foregoing does not mean that the State may not remove a particular area from the public domain (desafectar) because the purposes for which it was protected are no longer being fulfilled, or even seek to grant title to specific areas. It may, however, do so only where a prior technical study demonstrates the nature of the area to be titled, the possible coexistence of human beings and the ecosystem, and the resulting consequences.

Title therefore cannot be granted indiscriminately to areas of this nature, because doing so would contravene the very environmental conservation policies pursued by the State pursuant to the mandates of the Constitución Política and the Convenios Internacionales that it has signed” (sentencia número 2988-99, supra citada). For these purposes, it is important to emphasize that the concept of a national reserve is defined in the regulation itself—through the combined provisions of sections 3 subsection k), 6, and 7—in such a way as to make it entirely clear that these are properties specifically incorporated into the Natural Heritage of the State regime for the proper protection and conservation of the natural environment. (...) First, it should be noted that the challenged provision does not prevent title from being granted to these protected areas, but instead facilitates it, and it does not even consider the legal nature of these properties—as public-domain property—which are subject to some type of dedication (afectación) that, it bears repeating, is intended to make environmental protection effective—as required by article 50 of the Constitution.

Thus, only a record of that dedication remains, while the granting of title to these public-domain properties is permitted, as this Court previously stated: “Protected areas include land located within national reserves, certain areas along rivers, a strip on either side of the line of maximum depression of drainage basins, land bordering springs (manantiales) originating in the hills as well as those originating on level ground, and certain areas along the banks of rivers, streams, lakes, lagoons, or natural reservoirs” (sentencia número 2988-99, supra citada). Second, it does not consider the existence of other types of public-domain property, such as the maritime-terrestrial zone (zona marítimo terrestre), which is administered by the municipalities, and/or the historical-architectural and archaeological heritage, which is administered by the Ministerio de Cultura, Juventud y Deportes.

Consequently, the Instituto de Desarrollo Agrario does not even consult beforehand regarding the possible impact on such property for purposes of a future granting of title, nor does it establish any impediment to granting title thereto—in this regard, see article 10 of this Regulation. This reveals the serious situation permitted by this regulation, which disregards the essential characteristics of public-domain property that specifically remove it from private commerce—contrary to the prior provisions of article 262 of the Código Civil, dating from mil ochocientos ochenta y seis—and consequently make its possession, sale, or encumbrance absolutely impossible unless it has first been removed from the public domain, a matter which, it bears repeating, is reserved to formal and substantive legislation (enacted by the Asamblea Legislativa in accordance with the ordinary legislative procedures), following a technical study determining the effects of human coexistence with ecosystems, as required by the principle of environmental objectification or adherence to science and technology (principio de la objetivación ambiental o vinculación a la ciencia y técnica), developed in article 38 of the Ley Orgánica del Ambiente.

This is because, although protected zones are not perpetual and may therefore be removed from the public domain, it is not legitimate to do so to protect other public or private interests—such as the provision of housing or land tenure—to the detriment of environmental protection and the enjoyment of a healthy and ecologically balanced environment (sentencia número 7294-98). Accordingly, any regulatory provision that permits or empowers the Administration to grant title generically to public-domain property shall be unconstitutional, particularly when the property forms part of the Natural Heritage of the State, regardless of its designation or category—national parks, forest reserves, biological reserves, protected zones, wildlife refuges, wetlands, natural monuments—the maritime-terrestrial zone, watershed protection zones, indigenous reserves, historical-architectural heritage, mineral resources, archaeological heritage, or border zones, in order to subject such property to the private ownership regime, especially where no prior technical-scientific study has been conducted, as noted above.” It is clear from the reasoning of the Sala Constitucional that, because the granting of title originated with properties designated as national reserves, which as part of the Natural Heritage of the State are outside private commerce, the nature of the property plainly precluded the granting of title.

Indeed, precisely because the property at issue in the action for annulment originated in national reserves, it could not be titled in favor of a private individual, irrespective of the provisions of section 7 of the Ley de Informaciones Posesorias invoked by the defendant. Section 7 of the Ley de Informaciones Posesorias provides:

“Article 7º.- When the property to which the proceeding pertains is located within a protected wildlife area (área silvestre protegida), regardless of its management category, the applicant for title (titulante) must demonstrate that he or she holds the legal rights arising from ten-year possession (posesión decenal), exercised for at least ten years before the effective date of the law or decree creating that protected wildlife area.

Properties located outside those areas and containing forests may be titled only if the applicant proves that he or she holds the legal rights arising from ten-year possession (posesión decenal), exercised for at least ten years, and has protected that natural resource, it being understood that the property must be duly demarcated and enclosed by fences or cleared boundary lanes. Without exception, the cadastral plans submitted in possessory-information proceedings (diligencias de información posesoria) must be certified by the Ministerio del Ambiente y Energía, through the competent entity, which shall certify whether the property for which title is sought is located inside or outside those protected wilderness areas (áreas silvestres protegidas)." If we analyze the nature of the assets constituting the State Natural Heritage (Patrimonio Natural del Estado)—section 13 of the Ley Forestal—and the reference to the provisions of section 7, second paragraph, it may be concluded that the assets referred to by the legislature in the cited provision do not include assets derived from national reserves (reservas nacionales), insofar as that provision refers to assets that, although they may have a forestry vocation (vocación forestal) or forestry suitability (aptitud forestal), the legislature has allowed to be managed and conserved by private parties; these cannot be assets derived from national reserves because national reserves constitute State Natural Heritage and therefore form part of the public domain (demanio público).

This conclusion was developed by the Sala Constitucional in judgment 4587 of 5 de agosto de 1997, which stated: "(...) In that regard, the doctrine concerning forest property (propiedad forestal) developed by the Sala Primera de la Corte Suprema de Justicia may be summarized as follows: forest property is a distinct type of property with its own characteristics and particularities and a special regime; forest property is conceived primarily for conservation, not for production or participation in private commerce; forestry legislation has passed through three stages, but it was only upon the enactment of Law No.7032 of 7 de abril de 1986 that a better-designed instrument became available to address the complex forestry problem; Law No.7032 of 7 de abril de 1986 was declared unconstitutional, and Law No.7171 of 28 de junio de 1990 was subsequently enacted with the text of the former law; the protection of natural resources has made significant advances in recent times; international instruments concerning fundamental rights and developments in case law have prompted changes in international legislation aimed at protecting the right to a healthy and ecologically balanced environment; legislative changes have extended to the Constitution itself, and the right to the environment is now understood as a true human right; developments in this field have progressed to the point that a genuine legal classification has emerged: environmental law (derecho ecológico); under the Ley Forestal, the State Forest Heritage (patrimonio forestal del Estado) encompasses the entire national territory and is divided into three areas: land subject to the forestry regime (régimen forestal), forest harvesting (aprovechamientos forestales) on privately owned land, and national reserves; the forestry regime is defined as the body of legal, economic, and technical provisions giving substance to conservation; the forestry regime has three subareas: a.-protective zones (zonas protectoras), b.-national parks, forest reserves, and biological reserves, and c.-forests and forest lands (terrenos forestales); the term national reserves has been used since the Ley de Tierras y Colonización No.2825 del 14 de octubre de 1961 to identify all lands referred to by the Código Fiscal de 1865, and subsequently by Law No.13 de 19 de enero de1939, as national wastelands (baldíos nacionales); these are properties that are not privately owned—not registered in the Registro Público under articles 267 and 486 of the Código Civil—and that are also not registered in the name of the State or its institutions; national wastelands constitute the remainder after the two foregoing forms of ownership; following the principles of the Código Civil, the Ley General de Baldíos Nacionales No.13 de 10 de enero de 1939 declared them to belong to the State within the boundaries of the Republic; the Ley de Tierras y Colonización No.2825 de 14 de octubre de 1961 maintained the same approach and expanded the areas declared inalienable by the prior law; in general, those reserves have been subject to limits—as to surface area—and restrictions on their possession and registration through possessory-information proceedings; all lands regarded as national reserves become immediately dedicated to the purposes of forestry legislation; on such lands, the State may establish forest reserves, protective zones, national parks, wildlife refuges, and biological reserves, thereby forming the State Forest Heritage; legislative authorization is required to colonize or alienate them, and when they are possessed by third parties, those parties acquire no rights, while the State’s right to recover them is not subject to limitation (imprescriptible); under the regulations currently in force, harvesting in national reserves may be carried out only under a concession granted by the State; the harvesting of forest resources on privately owned land does not exclude such land from the State Forest Heritage; the State Forest Heritage applies to all national assets on which natural forest resources exist; on lands containing natural resources, private parties must prepare technical forestry plans and obtain long-term concessions in order to exploit timber resources; the State grants a series of incentives for the management and regulation of privately owned forests and forest lands; with respect to national parks and biological reserves, El Poder Ejecutivo is authorized to include within their boundaries any privately owned properties or portions thereof needed to achieve their objectives, and those lands shall be acquired by purchase or expropriation; for the establishment of forest reserves, protective zones, and wildlife refuges, the State must purchase or expropriate the land unless, at the request of the Dirección General Forestal, its owners agree to submit to the applicable forestry regime; forests and lands suitable for forestry are devoted to a public purpose and, consequently, are subject to expropriation, except for those voluntarily submitted to the forestry regime; forests and lands suitable for forestry constituting public and private forest areas are subject to the corresponding management plan (plan de manejo) for their conservation and development; forestry legislation establishes a special regime applicable to all forest resources; national reserves are subject to the regime by operation of law because they belong to the State; expropriation is appropriate only in the case of private assets designated for the establishment of national parks, forest or biological reserves, forests, or forest lands; on privately owned properties, the establishment of forest property necessarily requires the owner to submit voluntarily to the legal regime established by law, specifically to the limitations imposed on property in the social interest; for the establishment of protective zones on properties subject to the private-property regime, the law makes them subject to a mandatory forestry regime that limits agricultural work or the destruction of vegetation—except with express authorization—and affords the same benefits granted to private parties voluntarily subject to the regime (see judgments of the Sala Primera de la Corte Suprema de Justicia number 189 at 10:20 hours on 30 de octubre de 1991 and 51 at 15:15 hours on 26 de mayo de 1995).

It follows from this analysis that certain assets suitable for forestry may be privately owned and serve a public purpose, and are therefore subject to a special conservation regime while in private hands; these are precisely the assets referred to in section 7, second paragraph, of the Ley de Informaciones Posesorias. They cannot, however, include assets constituting national reserves because the latter are subject to the special public-domain regime, placing them outside private commerce, and the only means of alienating them is through their removal from public-domain status (desafectación) by the legislature; that is, their use under the regime to which they belong is possible only through a concession, while private ownership is inadmissible. Accordingly, possession such as that alleged by the defendant creates no right whatsoever over the property, and it likewise cannot be maintained that the State’s right to seek its recovery has become time-barred, because, in essence, the property cannot be subject to any limitation period in either of its two forms: acquisitive, for purposes of acquisition by adverse possession (usucapión), or extinctive, for purposes of limiting the State’s right to recover it.

By that reasoning, the defendant’s argument that the action for annulment of an injurious administrative act (acción de lesividad) is time-barred because the property is private in nature cannot be accepted, since, as stated, because the property’s titling arose from a national reserve, there was no valid possession capable of consolidating a property right such as that claimed. It must also be noted that, given the nature and vocation of these assets, as stated in the preceding recitals (considerandos), and their characteristics as inalienable, not subject to limitation, and not subject to attachment (inembargable), the position of the defendant company’s representative—that the claimed nullity cannot be asserted against it under the principle of reliance on the public registry (publicidad registral) and the provisions of sections 455, 456, and 457 of the Código Civil—is not pertinent and cannot be accepted in determining the right to bring and the merits of the action for annulment of an injurious administrative act.

This is because the nature of the property is the basis for the finding of injuriousness (lesividad), and that nature existed even before the property’s registration was established; ergo, it is the factual substrate that gives meaning or origin to the registered folio (matrícula) as an act representing ownership. Once that substrate is identified as public in nature, the erroneously created private real right (derecho real privado) is deprived of substance, and the registration cannot, as the defendant seeks, be maintained under the protection of reliance on the public registry; it is therefore impossible for a privately registered property to have public-domain substance. In any event, although our civil-law system protects ownership of assets acquired in reliance on the public registry, that principle cannot prevail over the nature of public-domain assets, particularly assets such as the one at issue in these proceedings, whose vocation predates the very declaration of their status in the year 1996 by the Ley Forestal.

Thus, it is not valid to claim that the exercised possession was transferred beginning in the 1970s, as the defendants allege, because its vocation arose earlier, insofar as that vocation has defined such assets since their very existence. It must be emphasized that the action for annulment of an injurious administrative act serves the purpose of recovering that public ownership, insofar as the very basis of the claim is the recovery of land that, although part of the public-domain regime (régimen de demanialidad), is alleged to have been unlawfully transferred to the private-property regime.

It should now be added that, although the defendants maintain that the property titled in their favor and subsequently conveyed to a third party was never part of a national reserve and that it has not been shown to have the characteristics of State Natural Heritage (Patrimonio Natural del Estado), that argument is wholly unsupported by any evidence beyond their own assertions, since no technical evidence has been submitted to rebut the classification made by the authority competent to establish it, namely, the Ministerio de Ambiente, to which the legislature entrusted the protection and administration of such properties; consequently, the testimony of the defendant himself is insufficient to discredit the certification contained in the record. Moreover, it is clear from the record that even the registered survey plan (plano catastrado) used to obtain title to the property, as well as the inspection conducted for that proceeding, show that the site is located in mountainous terrain and consists entirely of forest, conditions characteristic of forest land forming part of the State Natural Heritage, which, in any event, as stated above, originated from the authorization to title National Reserves; the defendant has failed to disprove that circumstance, and it must be emphasized that the conveyance of the property by purchase and sale does not negate its status as public-domain property (demanialidad), as explained above.

Furthermore, based on our analysis, this property satisfies the requirements for inclusion in the public domain (demanio público): as to the subjective element, its administration is vested in the State through the Ministerio de Ambiente; as to the objective element, it is immovable property capable of forming part of the public domain, a classification that is technical in nature and is supported by evidence submitted in the case file, because the record contains certification SINAC-DS-OFAY-C-3125-2003, in which the Ministerio de Ambiente y Energía del Sistema Nacional de Áreas de Conservación certifies that: “Following a study of the corresponding cartographic sheets of the basic map of Costa Rica at a scale of 1:50.000, it has been determined, based on the location shown on registered survey plan number P-862160-2003 in the name of I.D.A. and in the possession of MARVIN PORRAS SÁNCHEZ, that the plan describes an immovable property located OUTSIDE ANY PROTECTED WILDLIFE AREA, REGARDLESS OF ITS MANAGEMENT CATEGORY, ADMINISTERED BY THE MINISTERIO DEL AMBIENTE Y ENERGÍA.

HOWEVER, IT FORMS PART OF THE STATE NATURAL HERITAGE UNDER ARTICLES 13, 14 y 15 OF LEY FORESTAL 7575 DEL 16 DE ABRIL DE 1996.” Moreover, the normative element required for public-domain property is established, as indicated, in sections 13 and 14 of the Ley Forestal, and the property serves the purpose of guaranteeing the constitutional right to a healthy and ecologically balanced environment. It should be noted that it is precisely the existence of the aforementioned certification—which was submitted by the defendant himself to satisfy the titling requirements imposed by the Reglamento de Titulación de Reservas Nacionales—that gives rise to a defect in the act, insofar as that certification established the preexistence of a condition that precluded titling under that regulation and constitutes a defect of absolute nullity (nulidad absoluta) in the grounds for the act (motivo), which cannot be cured as the defendant company alleges, since it is an indispensable condition that cannot be remedied or validated.

Consequently, that defect is sufficient to declare the titling act null, irrespective of the absence of any other requirement applicable to that regulated act (acto reglado), because the defect identified is so gross that the mere existence of that condition renders the action for a declaration of injury to the public interest (acción de lesividad) admissible, as the immovable property at issue in these proceedings unquestionably forms part of the public domain. Accordingly, the complaint should be granted with respect to the declaration of nullity of the resolution set forth in article 39 of session 31-04 of 23 de agosto del 2004 of the Junta Directiva del Instituto de Desarrollo Agrario, which provided: “In compliance with institutional policies and upon the recommendation of the oficina Regional de Parrita pursuant to official letter OSP-163-04, the approval of the Dirección Regional Central pursuant to official letter S/N, and the review by the Coordinador Agrario Regional of the requirements imposed for the titling proceeding, and in accordance with the resolution of the Junta Directiva described in Article XXI, Session 065-00 of 11 de setiembre del 2000, and all requirements established by the Reglamento para la titulación de tierras en reservas nacionales, published in the official gazette La Gaceta 173 of 10 de setiembre del 2002, having been satisfied, pursuant to the ley de Tierras y Colonización 2825 of 14 de octubre de 1961 and the Ley de creación del Instituto de Desarrollo Agrario 6735 of 29 de marzo de 1982, authorization is hereby granted to subdivide and convey to Marvin Porras Sánchez, identification card 1-427-886, for purposes of a supplementary title of ownership (título supletorio de dominio), the parcel described in plan 862160-2003.” By reason of their connection, the implementation of that resolution through public deed number one hundred and one, executed before Notary Public Luis Enrique Wong Sánchez, whereby parcel registration 19297045 was titled in the name of Marvin Porras Sánchez and registered as property number 139717-000 of the Partido de Puntarenas, is annulled, as is public deed number 186, executed before Notary Public Gladys Marín Villalobos, whereby Marvin Porras Sánchez conveyed the property registered as number 139717-000 of the Partido de Puntarenas to Palacios y Paraísos Tropicales la Selvita Sociedad Anónima, and therefore its corresponding registration is likewise annulled.

Furthermore, it is important to note that counsel for the defendant company argues that, pursuant to section 144 of the Ley General de la Administración Pública, it must be compensated in its capacity as a good-faith purchaser (adquirente de buena fe). However, it did not assert such a claim in the procedurally appropriate manner, by way of a counterclaim (contrademanda), making it impossible to consider that issue in the absence of the required procedural formalities, which safeguard the right of defense and due process. It must be clarified that the cited section of the Ley General de la Administración Pública establishes a basis for the Administration’s liability, but such liability does not arise automatically; the right must be asserted through an action in which compliance with sections 190 and following of the Ley General de la Administración Pública must also be demonstrated. Based on the foregoing analysis, this Court concludes that the challenged act is injurious to the public interest and substantially inconsistent with the legal system.

Therefore, pursuant to articles 11, 128, 131, 132, 133, 158, 166, 169 y 171 of the Ley General de la Administración Pública, the resolution set forth in article 39 of session 31-04 of 23 de agosto del 2004 of the Junta Directiva del Instituto de Desarrollo Agrario shall be declared null. That resolution provided: “In compliance with institutional policies and upon the recommendation of the oficina Regional de Parrita pursuant to official letter OSP-163-04, the approval of the Dirección Regional Central pursuant to official letter S/N, and the review by the Coordinador Agrario Regional of the requirements imposed for the titling proceeding, and in accordance with the resolution of the Junta Directiva described in Article XXI, Session 065-00 of 11 de setiembre del 2000, and all requirements established by the Reglamento para la titulación de tierras en reservas nacionales, published in the official gazette La Gaceta 173 of 10 de setiembre del 2002, having been satisfied, pursuant to the ley de Tierras y Colonización 2825 of 14 de octubre de 1961 and the Ley de creación del Instituto de Desarrollo Agrario 6735 of 29 de marzo de 1982, authorization is hereby granted to subdivide and convey to Marvin Porras Sánchez, identification card 1-427-886, for purposes of a supplementary title of ownership, the parcel described in plan 862160-2003.

By reason of their connection, the implementation of that resolution through public deed number one hundred and one, executed before Notary Public Luis Enrique Wong Sánchez, whereby parcel registration 19297045 was titled in the name of Marvin Porras Sánchez and registered as property number 139717-000 of the Partido de Puntarenas, is annulled, as is public deed number 186, executed before Notary Public Gladys Marín Villalobos, whereby Marvin Porras Sánchez conveyed the property registered as number 139717-000 of the Partido de Puntarenas to Palacios y Paraísos Tropicales la Selvita Sociedad Anónima, and therefore its corresponding registration is likewise annulled. Pursuant to articles 171 of the Ley General de la Administración Pública and 131 of the Código Procesal Contencioso Administrativo, this declaration of absolute nullity has declaratory and retroactive effect as of the effective date of the annulled acts.

XII.Regarding the defenses. The defenses of the statute of limitations (prescripción) and expiration (caducidad) were raised; for the reasons stated, they are unfounded, since the property belongs to the public domain (demanio público), and therefore the corresponding right is not subject to prescription, and consequently the action to annul an administrative act adverse to the public interest (acción de lesividad) is not subject to the time limit established in the Ley Reguladora de la Jurisdicción Contencioso Administrativa. As to the defense of lack of legal entitlement (falta de derecho), it must be rejected because, for the reasons explained, the challenged resolution is absolutely null and void, since it awarded a parcel whose entire area belongs to the public domain; therefore, it could not be privately owned. As stated in the preceding recitals (considerandos), the proceeding to annul an administrative act adverse to the public interest was conducted in accordance with the legal system and fully satisfies all applicable requirements.

XIII.Regarding procedural costs and attorneys’ fees (costas procesales y personales). Pursuant to section 193 of the Código Procesal Contencioso Administrativo, procedural costs and attorneys’ fees constitute a burden imposed on the losing party by virtue of having lost. Waiver of such an award is permissible only when, in the Court’s judgment, there were sufficient grounds to litigate or when the judgment is rendered on the basis of evidence whose existence was unknown to the opposing party. In this case, the Court finds sufficient grounds to apply the exceptions established by the applicable provisions, because the defendants were brought into the proceeding due to the nullity that created vested rights (derechos subjetivos) through the favorable administrative act that has been annulled in this case. This supports the conclusion that there were grounds to litigate, since the Administration induced them into error by issuing an act declaratory of rights that was contrary to the legal system. Accordingly, this matter is resolved without a specific award of costs.

POR TANTO

The defenses of expiration, statute of limitations, and lack of legal entitlement are rejected. Consequently, the complaint is granted, and it is ordered as follows: 1. Article 39 of session 31-04 of August 23, 2004, of the Board of Directors of the Instituto de Desarrollo Agrario, which authorized the subdivision and transfer of the parcel for a supplementary title of ownership (título supletorio de dominio) to Marvin Porras Sánchez, identification card 1-427-886, concerning the property described in survey plan 862160-2003, is hereby annulled. 2. By reason of relatedness (conexidad), public deed number one hundred one, executed before Notary Public Luis Enrique Wong Sánchez, whereby title to parcel 19297045 was registered in the name of Marvin Porras Sánchez, and which is recorded as property number 139717-000 in the Partido de Puntarenas, is hereby annulled. 3. By reason of relatedness, public deed number 186, executed before Notary Public Gladys Marín Villalobos, whereby Marvin Porras Sánchez transferred the property recorded as number 139717-000 in the Partido de Puntarenas to Palacios y Paraísos Tropicales la Selvita Sociedad Anónima, is hereby annulled, as is the corresponding registration.

Pursuant to Articles 171 of the Ley General de la Administración Pública and 131 of the Código Procesal Contencioso Administrativo, this declaration of absolute nullity (nulidad absoluta) has declaratory and retroactive effect as of the effective date of the annulled acts. 4. This judgment shall be communicated to the Archivo Nacional and the Registro Nacional for the corresponding annotations in the indicated notarial protocols and registry entries, and so that, within the scope of their authority, they may adopt the measures required by law to safeguard the public interests recognized in this judgment. The foregoing shall be determined during the judgment-enforcement phase (fase de ejecución de sentencia). 5. Because grounds for exemption exist, this matter is resolved without a specific award of costs. MARVIN PORRAS SANCHEZ Nº N° 2024001143 TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA, SEGUNDO CIRCUITO JUDICIAL, SAN JOSÉ, GOICOECHEA, a las diecinueve horas con cuarenta y nueve minutos del veintitres de Febrero del dos mil veinticuatro.- Proceso de lesividad establecido por el INSTITUTO DE DESARROLLO RURAL (INDER), representado por Rodrigo Cervantes Barrantes, en su condición de apoderado especial judicial, carnet 7896 contra MARVIN PORRAS SÁNCHEZ, cédula 1-0427-0886 y PALACIOS Y PARAÍSOS TROPICALES S.A., representado por José Luis Rodríguez Jiménez, carnet 5194. Participa como tercero interesado el Estado representado por Mauricio Castro Lizano en su condición de Procurador.

RESULTANDO

  1. 1El Instituto de Desarrollo Rural interpone la demanda de lesividad mediante escrito de fecha 18 de noviembre del 2015, cuyas pretensiones son las siguientes: "1. Que se tenga por interpuesta la presente demanda. 2. Que en razón de ser lesivos a los intereses públicos se anule el acuerdo tomado por la Junta Directiva del Instituto de Desarrollo Agrario, en el artículo 39, de la sesión 031-04, de fecha 23 de agosto del 2004, únicamente en lo que se refiere a la titulación de la finca Partido de Puntarenas, Folio Real Matrícula número 139717-000 a favor del señor MARVIN PORRAS SÁNCHEZ, de calidades antes indicadas, correspondiente al Plano Catastrado P-0862160-2003. 3. Por conexidad, que se anule la escritura pública emitida por el Instituto de Desarrollo Agrario, únicamente en lo que se refiere a la titulación de la finca Partido de Puntarenas, Folio Real Matrícula número 139717-000 a favor del señor MARVIN PORRAS SÁNCHEZ, de calidades antes indicadas, correspondiente al Plano Catastrado P-0862160-2003. 4.Por conexidad, que se anule el asiento registral de inscripción de la finca inscrita bajo sistema de Folio Real Partido de Puntarenas, Folio Real Matrícula número 139717-000 emitido por el Registro Nacional. 5. Por conexidad, se anule cualquier inscripción que depare de la inscripción del inmueble inscrito en el Registro Nacional, Provincia de Puntarenas Folio Real Matrícula número 139717-000. 6. Que se condene al demandado al pago de ambas costas de este juicio" . (Imágenes 1-28, 117-120 del expediente electrónico).
  2. 2La representación de Palacios y Paraísos Tropicales S.A. contestó negativamente la demanda, oponiendo las excepciones de caducidad, falta de derecho y prescripción. (Imágenes 125-147 del expediente electrónico).
  3. 3El señor Marvin Porras Sánchez fue declarado rebelde mediante resolución de las nueve horas y veinticinco minutos del veintiuno de junio del dos mil dieciséis. Apersonándose al proceso mediante escrito del 5 de octubre del 2020, rechazando la demanda. (Imágenes 185-186, 276-277 del expediente judicial).
  4. 4La audiencia preliminar establecida en el ordinal 90 del Código Procesal Contencioso Administrativo (en adelante CPCA) fue celebrada el 7 de diciembre del 2017. En dicha audiencia se fijaron las pretensiones conforme al resultando primero. Se procedió a admitir la prueba documental aportada, consistente en el expediente administrativo y prueba testimonial.   5. 5El 17 de diciembre del 2019, se apersonó al proceso como tercero interesado el Estado, de acuerdo con la resolución N.117-2019-I de las ocho horas y treinta y cinco minutos del veintisiete de noviembre del dos mil diecinueve. (Imágenes 220-223 y 232).
  6. 6El juicio oral y público fue celebrado con la participación de las partes el día 5 de febrero del 2024. El proceso fue declarado muy complejo de conformidad con lo establecido en el numeral 111 del CPCA.
  7. 7En los procedimientos ante este Tribunal se han cumplido las formalidades de ley y no se observan nulidades que subsanar o que generen indefensión. Previa deliberación, se dicta esta resolución por unanimidad, con redacción de la jueza Gómez Chacón y el voto favorable de la jueza Soto Fonseca y el juez Mejías Rodríguez.

CONSIDERANDO:

I.Sobre la prueba para mejor resolver: Las partes demandadas en la celebración del juicio oral, ofrecieron como prueba para mejor resolver los siguientes documentos: Carta venta de Pedro Godínez Zúñiga a Víctor Godínez Alvarado, carta venta de Víctor Godínez Alvarado a Filiberto Porras Fonseca, pagaré de Filiberto Porras Fonseca a favor de Víctor Godínez Alvarado, declaración jurada ante notario Público de Secundino Picado León, suscrita el 12 de marzo de 2008 que relata sobre la propiedad de la finca en cuestión, declaración jurada ante Notario Público el 12 de marzo de 2008, de Carlos Morales Cruz, mediante la cual señala que fungió como testigo de la compra que le hizo don Eliberto Porras Fonseca al señor Victor Godínez Alvarado, el 15 de abril de 1974, donde se suscribió venta y pagaré en forma conjunta. De los documentos aportados estima esta Cámara que, por la forma en cómo se resuelve el presente asunto, los mismos resultan impertinentes para la resolución del caso, en consecuencia, dicha prueba se tiene por rechazada.

II.Hechos probados. De relevancia para efectos del presente proceso, se tiene por acreditado lo siguiente: 1. El 26 de noviembre del 2003, el señor Marvin Porras Sánchez, presentó solicitud ante el Departamento de Ordenamiento Agrario, para titular la propiedad la cual se encuentra ubicada en Santa Juana, del Distrito tercero Naranjito, cantón Sexto Aguirre de la Provincia de Puntarenas y que describe el plano catastrado número P-862160 del año 2003 con una medida de 96829 metros con 30 decímetros cuadrados. Alegando que obtuvo la posesión originaria desde hace más de quince años, en un valor de cien mil colones. En dicha solicitud se aportó la declaración de Trinidad Vargas Castillo, Carmen Artavia Barrantes, Secundino Picado León, Eduardo del Carmen Artavia Barrantes, y Eliberto Porras Fonseca, además de aportar los siguientes documentos: Plano catastrado original, copia de cédula de identidad, certificación de MINAE, certificación del Registro Nacional, donde se indica que no he inscrito algún inmueble al amparo de la Ley de Informaciones Posesorias y sus reformas, declaración jurada ante notaria pública de que la propiedad no está inscrita del Registro Público, y de que no tiene sobre este terreno disputa judicial o extrajudicial.

Sobre dicha solicitud el Instituto de Desarrollo Agrario realizó inspección en sitio determinándose que el inmueble sobre el que se solicita la titulación en el que se consigna que el área abarca un total de nueve hectáreas 6829 metros cuadrados, de bosque (Imágenes 20, 21, 36-38 del expediente judicial); 2. Mediante oficio SINAC-DS-OFAY-C-3125-2003 se certifica de parte del Ministerio de Ambiente y Energía del Sistema Nacional de Áreas de Conservación, en el que se indicó: "Efectuado el estudio en las hojas cartográficas respectivas del mapa básico de Costa Rica escala 1:50.000, se ha determinado con base en la ubicación consignada en el plano catastrado número P-862160-2003 a nombre de I.D.A. en posesión de MARVIN PORRAS SÁNCHEZ, que este describe un inmueble que se ubica FUERA DE CUALQUIER área SILVESTRE PROTEGIDA SEA CUAL SEA SU CATEGORÍA DE MANEJO ADMINISTRADA POR EL MINISTERIO DEL AMBIENTE Y ENERGÍA.

SIN EMBARGO, CONSTITUYE PATRIMONIO NATURAL DEL ESTADO SEGÚN ARTÍCULOS 13, 14 y 15 DE LA LEY FORESTAL 7575 DEL 16 DE ABRIL DE 1996". Dicha certificación emitida el 21 de julio del 2003, fue aportada por Marvin Porras Sánchez para el trámite de solicitud de titulación de terreno ante el IDA. (Imagen 40 del expediente judicial); 3. El Registro Público certificó a solicitud de Marvin Porras Sánchez, que no aparece con fincas inscritas a su nombre, adquiridas al amparo de la Ley de Informaciones Posesorias. (Imagen 41 del expediente judicial); 4. Mediante declaración jurada emitida ante escritura pública doscientos dieciocho, ante la notaria pública María Verónica Méndez Reyes, se describe que: "Es propietario de la finca que se describe que es naturaleza de terreno montaña, situada en Santa Juana distrito tercero de Naranjillo en el Cantón de Aguirre de la provincia de Puntarenas que linda a Norte con Eliberto Porras Fonseca, al sur con Inversiones Fafer S.A. al Oeste con Roberto Muñoz Sánchez y al este con calle pública, mide noventa y seis mil ochocientos veintinueve metros con treinta decímetros cuadrados, según plano catastrado P- ocho- seis- dos- uno seis- cero- del dos mil tres, libre de gravámenes y de anotaciones, inmueble que se encuentra dentro del Proyecto de Titulación Puriscal Parrita, bajo el folio real San José uno, dos, nueve, tres, nueve, cero, cero, cero".

(Imagen 42-43 del expediente judicial); 5. Que el plano P-822160-2003, describe el terreno propiedad del IDA en posesión de Marvin Porras Sánchez es montaña. (Imagen 49 del expediente judicial); 6. Mediante artículo 39 de la sesión 31-04 del 23 de agosto del 2004 de la Junta Directiva del Instituto de Desarrollo Agrario, con base en el "Programa de Titulación Puriscal Parrita" creado mediante el Decreto Ejecutivo número 3667-G del 18 de marzo de 1974 se dispuso: "En cumplimiento a las políticas institucionales y con la recomendación de la oficina Regional de Parrita según oficio OSP-163-04 y el visto bueno de la Dirección Regional Central según oficio S/N y la revisión de los requisitos exigidos para el trámite de titulación por parte del Coordinador Agrario Regional y de conformidad con el acuerdo de Junta Directiva descrito en el Articulo XXI, Sesión 065-00 de 11 de setiembre del 2000, y habiéndose cumplido con todos los requisitos que establece el Reglamento para la titulación de tierras en reservas nacionales publicado en el diario oficial La Gaceta 173 del 10 de setiembre del 2002, al amparo de la ley de Tierras y Colonización 2825 del 14 de octubre de 1961 y la Ley de creación del Instituto de Desarrollo Agrario 6735 del 29 de marzo de 1982 se autoriza segregar y traspasar la parcela para el título supletorio de dominio a Marvin Porras Sánchez cédula 1-427-886, la finca descrita en el plano 862160-2003, se agrega en dicho acuerdo que los costos se cancelaran en un año plazo y se garantizaran mediante hipoteca de primer grado a favor del Instituto de Desarrollo Agrario devengando intereses del 8% sobre los saldos, excepto los que cancelen en el acto de firmarse la escritura.

Las condiciones y restricciones a que quedan sujetas las parcelas y lotes de este acuerdo son las mismas que contiene el articulo XVIII del reglamento para la titulación de tierras en reservas nacionales, publicado en gaceta 173 del 20 de setiembre del 2002. Se autoriza a los Señores Walter Césped es Salazar, Presidente Ejecutivo, como al Ingeniero Marco Aurelio Bolaños Víquez, Gerente General, para que comparezcan en su momento ante el notario asignado Luis Enrique Wong para el otorgamiento de las respectivas escrituras de traspaso. Concluida la firma de protocolo y cerrada la escritura principal los notarios no podrán hacer uso de este acuerdo para trámites individuales". (Imágenes 53-56 del expediente judicial, hecho no controvertido); 7. Mediante escritura pública número ciento uno otorgada ante el Notario Público Luis Enrique Wong Sánchez, se titula la inscripción de la parcela 19297045 a nombre de Marvin Porras Sánchez.

Mediante la escritura pública número ciento ochenta y seis otorgada ante la Notaria Pública Gladys Marín Villalobos, Marvin Porras Sánchez traspasa la propiedad inscrita con número 139717-000 del Partido de Puntarenas a favor de Palacios y Paraísos Tropicales la Selvita Sociedad Anónima. (Imágenes 66-74 del expediente judicial); 9. Mediante acuerdo Número 47 de la Sesión Ordinario 36 del 5 de octubre de la Junta Directiva del INDER, se declara lesivo a los intereses públicos los actos administrativos dictados mediante los acuerdos 39 y 49 de la sesión ordinaria 031-04, celebrada el 23 de agosto del 2004, sesión 49 de la sesión ordinaria 025-05 celebrada el 4 de julio del 2005, 50 y 57 de la sesión ordinaria 044-04 celebrada el 29 de noviembre de 2004, 53 y 58 de la sesión ordinaria 022-05 celebrada el 13 de junio del 2005, 53 de la sesión 039-05 celebrada el 10 de octubre del 2005, y 45 de la sesión ordinaria 016-04 celebrada el 3 de mayo del 2004.

En el juicio oral declaró el señor Marvin Porras el cual indicó que el bien se adquirió de Víctor Fonseca, nunca fue del IDA, se utilizó la figura del INDER para titularla. Señala que el terreno tiene un objetivo forestal, hoy se practica ecoturismo, se abandonó las cosechas, quedó como bosque forestal secundario. Había bosque, pero muy poco, la finca abandonó los cultivos, porque se metió en incentivos forestales. Indica que la finca que se describe en la carta de compraventa de Víctor Fonseca es la propiedad que se describe en el plano catastrado. La segunda compraventa describe la misma propiedad. Expone que Filiberto es quien le vendió a su padre. Había siembras agroforestales. Agriculturas que son arbustos a eso se refiere, había achiote, se titularon por el sistema del IDA, que eran más fácil que titular información posesoria. El pago que se describe en el pagaré es por la compra de la venta, se compró a pagos.

En el juicio declaró el señor Eduardo Artavia Barrantes, exponiendo que la finca era de Live Porras, el conoce porque ahí porque su papá trabajó ahí y lo llevaba ahí pequeño, la finca queda en el camino, a San Marcos de Tarrazú, entre Paso Real y Santa Juana. Su papá lo llevaba a esa finca, a esa finca andaba entre 9 y 10 años, tienen 59 años, su papá iba a trabajar por las siembras de achiote, el limpiaba esos cultivos, el ayudaba al papa en esa finca, ya después no visitó más el lugar. Sabe que en la finca están ubicados unos canopys, de ahí no sabe más, tenía partes de bosques, potreros, casa, y los achiotales. Era mixta nadie quitaba del todo las montañas. Se mantenía sus partes de trabajar. (Audio SIGAO); 12. El presente proceso fue presentado ante este Despacho el día 18 de noviembre del 2015. (Imagen 9 del expediente judicial).

III.Hechos no probados: 1. Que el inmueble titulado a favor de Marvin Porras Sánchez, inscrito con número 139717-000 correspondiente al Plano Catastrado P-0862160-2003, estuviera fuera de una Reserva Nacional. (Los autos).

IV.Objeto del proceso: En el presente proceso se analiza la lesividad de los actos: a. El artículo 39, de la sesión 031-04, de fecha 23 de agosto del 2004, únicamente en lo que se refiere a la titulación de la finca Partido de Puntarenas, Folio Real Matrícula número 139717-000 a favor del señor Marvin Porras Sánchez, de calidades antes indicadas, correspondiente al Plano Catastrado P-0862160-2003. b. La escritura pública emitida por el Instituto de Desarrollo Agrario, únicamente en lo que se refiere a la titulación de la finca Partido de Puntarenas, Folio Real Matrícula número 139717-000 a favor del señor Marvin Porras Sánchez, de calidades antes indicadas, correspondiente al Plano Catastrado P-0862160-2003. c. El asiento registral de inscripción de la finca inscrita bajo sistema de Folio Real Partido de Puntarenas, Folio Real Matrícula número 139717-000 emitido por el Registro Nacional. Dichos actos se solicita se declare lesivos con base en los siguientes argumentos: El Instituto de Desarrollo Agrario hoy Instituto de Desarrollo Rural, impulsó una serie de Programas de Titulación en Reservas Nacionales, con fundamento en la Ley de Titulación de Tierras ubicadas en Reservas Nacionales número 7599 del 9 de agosto de 1996, en los artículos 11 y 12 de la Ley de Tierras y Colonización No 2825 del 14 de octubre de 1961 y el artículo 32 inciso a) de la Ley de Creación del Instituto de Desarrollo Agrario No 6735.

Que los Programas de Titulación antes relacionados, se establecieron como una necesidad nacional, ya que existían grandes extensiones del territorio nacional donde los campesinos carecían de título de propiedad. La labor del IDA dentro de los programas de cita se orientó a declarar Zonas de Titulación en áreas donde las personas se encontraban en posesión de la tierra, pero carecían de título de propiedad, procediéndose a realizar el levantamiento y catastro de las fincas que no se encontraban inscritas en el Registro Público y a inscribir el título respectivo, debiendo pagar los beneficiarios los costos por la titulación y agrimensura, dichos costos fueron muy inferiores al promedio del mercado para titular tierras, y debían ser cancelados al IDA como máximo a un año plazo. Dentro de esos Programas de Titulación, se encontró el denominado: "Programa de Titulación Puriscal Parrita" creado mediante el Decreto Ejecutivo número 3667-G del 18 de marzo de 1974, publicado en el Diario Oficial La Gaceta número 72 del 17 de abril de 1974, se inscribió en el Registro Nacional a nombre del IDA un área de 267.239 has, con el Folio Real Matrícula número 219039-000.

Dentro del marco del programa de Titulación Puriscal Parrita, y mediante escrito presentado ante este Instituto, el demandado en fecha 26 de noviembre del año 2003, presentó solicitud de titulación de la parcela 97045 del bloque 192 descrita en el Plano Catastrado número P-0862160-2003. En el expediente de titulación consta que se presentó la certificación número SINAC-DS-OFAU-C-3125-2003, de fecha 21 de julio del año 2003, con anterioridad a la titulación del inmueble a favor del demandado, emitida por el Sistema Nacional de Áreas de Conservación del Ministerio de Ambiente y Energía, y aportada por el propio interesado, antes de la inscripción registral de la parcela 192-97045 a favor del demandado, estableciendo que el inmueble se ubica fuera del cualquier área silvestre protegida sea del ambiente y energía. Sin embargo, constituye parcialmente patrimonio natural del Estado según artículos 13, 14 y 15 de la misma ley.

El demandado no presenta dentro del trámite de titulación de la parcela el estudio de uso conforme de suelo del INTA o bien de algún profesional privado debidamente acreditado para realizar dicho estudio. No consta que se haya presentado informe alguno del Instituto Geográfico Nacional. En el proceso de titulación de la finca no se cumplieron los requisitos que fundamentaran dicha inscripción a favor del demandado. Mediante acuerdo de Junta Directiva del IDA tomado en artículo 39 de la Sesión Ordinaria 031-04 celebrada el 23 de agosto del año 2004, se autoriza la segregación y traspaso del inmueble a favor del demandado, inmueble que lo constituye la parcela número 192-97045 del Proyecto de Titulación Puriscal Parrita, ubicado en Distrito Naranjillo, Cantón Aguirre de la Provincia de Puntarenas, con una medida de noventa y seis mil ochocientos veintinueve metros con treinta decímetros cuadrados, correspondiente a la finca Partido de Puntarenas Folio Real número 139717-000, Plano Catastrado número P- 0862160-2003.

Mediante escritura pública número 101 otorgada ante el Notario Público Luis Enrique Wong Sánchez, el Instituto de Desarrollo Agrario segrega y traspasa la parcela referida antes, al demandado. Mediante la escritura pública número 186 otorgada ante la Notaria Pública Gladys Marín Villalobos, el demandado Porras Sánchez traspasa la propiedad antes referida a favor de la demandada Palacios y Paraísos Tropicales la Selvita Sociedad Anónima. Se elaboró documento denominando "Estudio para Apoyar Trabajo de Fiscalización sobre Titulación de Tierras en los proyectos Coto Brus, Cuenca del Río Aranjuez, Llanuras de San Carlos y Sarapiquí, Tierras Altas de Santa Cruz, y Zona Norte del Instituto de Desarrollo Agrario (IDA)”, que fue remitido mediante No. DGEO-096-08 del 5 de agosto de 2008, en que se describe la situación de los terrenos que conforman el Proyecto Coto Brus, entre otros. Mediante el Informe No DFOE-PGAA-20-2008 de fecha 27 de agosto del 2008 de la Contraloría General de la República denominado "Resultado de estudios de titulación de tierras en reservas nacionales en terrenos pertenecientes al Patrimonio Natural del Estado" y dirigido al Instituto de Desarrollo Agrario, se indica que dicho estudio permitió determinar que en el marco de contenido de los diferentes proyectos de titulación y en contravención a lo señalado en los artículos 13, 14, 15 y 33 de la Ley Forestal No 7575 del 5 de febrero de 1996 el IDA tituló propiedades con cobertura parcial o totalmente boscosa o que poseían características de uso suelo y topográficas que les otorgaban la categoría de terrenos de aptitud forestal y de áreas de protección, y por lo tanto, no podían salir de la Administración del Estado, ni ser susceptibles de titular a favor de los solicitantes por ser parte del Patrimonio Natural, y por no concurrir, ni haberse aportado todos y cada uno los requisitos necesarios para proceder de conformidad con el bloque de legalidad vigente en aquel momento para que fuera procedente la titulación de tratamiento.

Mediante acuerdo tomado por la Junta Directiva del INDER en artículo 47 de la Sesión Ordinaria 36-2015 del 05 de octubre del 2015, se declaró Lesivo a los intereses públicos el acto administrativo dictado mediante el acuerdo número 39 de la Sesión Ordinaria número 031-04 celebrada el 23 de agosto del año 2004 de la Junta Directiva de ésta Institución, que dio origen al título de propiedad inscrito en el Registro de la Propiedad, Partido de Puntarenas, Matrícula de Folio Real número 139717-000 a favor del señor Marvin Porras Sánchez, por haber sido otorgado en detrimento del patrimonio natural del Estado. Se constata que en el proceso de titulación de la indicada parcela, se incumplió con - requerimientos normativos necesarios y previstos en la Ley de Titulación de Tierras en Reservas Nacionales número 7599 del 29 de abril de 1996, en concordancia con la Ley Forestal No 7575 del 5 de febrero de 1996 y el Reglamento a la Ley de Uso de Suelos 29375-MAG-MINAE-S HACIENDA-MOPT, establecían como requisitos para la titulación de las parcelas por parte del IDA, incumplimiento que genera vicios del acto administrativo.

La causal de nulidad en los casos objeto de este proceso, afecta el interés público, ya que, con motivo de los incumplimientos de la normativa antes relacionada, el IDA autorizó el traspaso de la parcela dicha, que es parte del Patrimonio Natural del Estado. En primer lugar, debe hacerse una breve referencia a los programas de titulación mediante los cuales el IDA tituló predios a favor de particulares. Los terrenos que formaban parte de los proyectos de titulación le eran traspasados al IDA a través de decreto (en el caso específico del "Programa de Titulación Puriscal-Parrita" creado mediante el Decreto Ejecutivo número 3667-G del 18 de marzo de 1974, publicado en el Diario Oficial La Gaceta número 72 del 17 de abril de 1974, se inscribió en el Registro Nacional a nombre del IDA un área de 267.239 has, con el Folio Real Matricula 219039-000), con el objeto de cumplir con los respectivos proyectos de titulación.

Estos traspasos de las áreas a titular se justificaban en la tenencia de las fincas sin inscribir por parte de poseedores y se trataba de una ficción legal, mediante la cual se le traspasaba al IDA una extensa área geográfica que abarcaba en forma indistinta, terrenos inscritos, sin inscribir, propiedad del Estado y de particulares, con poseedores o sin estos, de ahí que los traspasos se hacían sin perjuicio de los derechos ya inscritos sobre porciones determinadas dentro del perímetro general de la zona respectiva, ni de los derechos de información posesoria en trámite en el momento de publicarse en la Gaceta el decreto la Titulación de Tierras en Reservas Nacionales, o los que se inscriban en el futuro ni de las porciones destinadas al uso público. Estos traspasos tenían por objetivo darle al IDA, un instrumento para que pudiera segregarlos y traspasarlos, también bajo una ficción legal, y así inscribir predios a favor de los poseedores que hayan poseído esos terrenos bajo las condiciones que establecía el ordenamiento jurídico con la finalidad de facilitar la obtención de crédito.

En el caso de la parcela de marras, inscrita a favor del demandado, el hecho de haber poseído los terrenos, lo cual evidencia la preexistencia de la tenencia posesoria de las parcelas con anterioridad al acuerdo de Junta Directiva de su traspaso (tomado en artículo 39 de la Sesión Ordinaria número 031-04 celebrada el 23 de agosto del 2004). En tal, sentido, se considera que la causa de adquisición de esos terrenos por parte de los poseedores era la posesión ejercida por éstos y no los traspasos o ventas hechos por el IDA, ya que el Instituto lo único que recibía a cambio era el costo de la confección de los planos correspondientes y no el precio en sí de los predios, en tal sentido, no se daba un acuerdo entre cosa y precio, el Instituto no podía traspasar los terrenos al mejor oferente sino que tenía que traspasarlos al poseedor que le demostrara haber cumplido con los requisitos legales, limitándose a constatar esos requisitos.

La naturaleza jurídica de los actos en los proyectos de titulación realizados por el IDA era meramente declarativos, se limitaban a reconocer el derecho de propiedad adquirido por una persona por medio de la figura de la usucapión, para su inscripción en el Registro Público y no actos constitutivos del derecho de propiedad. El IDA incurrió dentro del procedimiento de titulación de ese predio y que es el que precisamente produce la nulidad del acto administrativo de traspaso. De esta manera debe indicarse que a la Junta Directiva del IDA se le recomendó autorizar el traspaso de la respectiva parcela, supuestamente porque se había cumplido con los requisitos que antes se establecían en la ley 7599, siendo éste el motivo de los actos administrativos que acordaron el traspaso del inmueble de marras a favor del demandado. Pese a esto, se halló que tal cumplimiento no se dio por lo siguiente: En el expediente de titulación consta a folio 6 certificación número SINACDS- OFAU-C-3125-2003, de fecha 21 de julio del año 2003, con anterioridad a la titulación del inmueble a favor del demandado, emitida por el Sistema Nacional de Áreas de Conservación del Ministerio de Ambiente y Energía, y aportada por el propio interesado, antes de la inscripción registral de la parcela 192-97045 a favor de demandado, estableciendo que el inmueble se ubica fuera de cualquier área silvestre protegida sea cual sea su categoría de manejo administrativa por el Ministerio del Ambiente y Energía.

Sin embargo, constituye parcialmente patrimonio natural del estado según los artículos 13, 14 y 15 de esa misma ley. Pese a la evidente falta de ese requisito, se recomendó la titulación de la respectiva parcela pese a que conforme se señalaba se deberían excluir del trámite de titulación a los terrenos que se encuentran bajo la administración del MINAE, como es el caso del Patrimonio Natural del Estado conforme a la Ley Forestal, por lo que en este caso se generó un vicio de nulidad absoluta evidente y manifiesta. Adicionalmente, no consta que se haya presentado el estudio de uso conforme de suelos el cual es requerido por el Reglamento a la Ley de Uso de Suelos número 29375-MAG-MINAE-S- HACIENDA-MOPT. Así, el artículo 58 de este reglamento dispone: "En toda información posesoria o que se presente ante el IDA o ante los Tribunales de Justicia, con el fin de inscribir en el Registro Público de la Propiedad, el interesado, además de los requisitos que exige la normativa común, deberá de demostrar con un estudio adecuado de suelos, que ha ejercido la posesión cumpliendo con el uso conforme de suelo para la actividad que realiza de acuerdo con la metodología aprobada y ejecutándolas con las mejores prácticas de manejo, según la mejor tecnología disponible en cumplimiento de lo dispuesto en los artículos 3, 6, 12, 13, 19, 26, 27, 41,43 y 64 de la ley 7779 y su reglamento" Este artículo 58 establece que en toda información posesoria que se presente ante el IDA el titulante deberá demostrar con un estudio adecuado de suelos que ha ejercido la posesión cumpliendo con el uso adecuado de suelos, estudio con el cual debe contar obligatoriamente el IDA.

Respecto a esta normativa el reglamento entró en vigencia el 21 de marzo de 2001, es decir, con anterioridad a la titulación de la parcela 192-97045 a favor del demandado, de ahí que el estudio era obligatorio por lo que el incumplimiento de éste genera otro un vicio de nulidad absoluta. En virtud de lo anterior, debe indicarse que la causal de nulidad de la titulación de la parcela de marras, reside en la inexistencia dentro del bloque de legalidad de norma o procedimiento alguno para llevar a cabo titulación de este tipo o bien justificar el dictado de un acto administrativo valido y eficaz, de conformidad con el Principio de Legalidad del Derecho Público, y las normas que regulan la aplicación del Derecho Público en el tiempo y en el espacio. El artículo 158 de la Ley General de la Administración Pública, dispone que la falta o defecto de algún requisito del acto administrativo expresa o implícitamente exigido por el ordenamiento jurídico constituirá un vicio de éste, artículo que en relación con el 166 de la misma ley que establece que habrá nulidad absoluta del acto cuando falte totalmente uno o varios elementos constitutivos real o jurídicamente, y el artículo 167 que dispone que habrá nulidad relativa del acto cuando sea imperfecto uno de sus elementos constitutivos, salvo que la imperfección impida la realización del fin en cuyo caso la nulidad será absoluta.

Todos estos artículos relacionados permiten concluir que la falta de requisitos esenciales para la titulación de la parcela de referencia produce la nulidad absoluta de dicho acto administrativo. Por su parte, el artículo 133 de la Ley General de la Administración Pública, al referirse al motivo como elemento de validez del acto administrativo dispone que éste tiene que ser legítimo y existir tal y como ha sido tomado en cuenta para dictar el acto. En el caso de las titulaciones de tierras en Reservas Nacionales, el motivo se encontraba regulado, por lo que el incumplimiento de los requisitos establecidos en la ley o el reglamento respectivo como sucedió en el caso que nos ocupa, constituyen en si vicios de nulidad del acto, por no existir tal y como habría sido tomado en cuenta para su dictado. El artículo 129 de la Constitución Política, establece que los actos y convenios contra las leyes prohibitivas serán nulos, si las mismas leyes no disponen otra cosa.

Los artículos 13, 14, 15, 33 y 34 de la Ley Forestal, corresponden a normas prohibitivas, y el acto administrativo que autorizó el traspaso de la parcela a favor del demandado es contrario a tales normas, toda vez que mediante dicho acto se autorizó la titulación de terrenos que forman parte de un Refugio Nacional de Fauna Silvestre, por consiguiente del Patrimonio Natural del Estado, lo cual contraviene sin lugar a dudas, el artículo 13 de la Ley Forestal, que declara que el Patrimonio Natural del Estado a los terrenos forestales y bosques en Reservas Nacionales y los somete a la administración del MINAE, el artículo 14 de la misma ley que establece la condición de inembargables e inalienables de los terrenos de ese patrimonio natural, que la posesión de éstos por los particulares no genera derecho alguno y no se pueden inscribir por información posesoria, siendo imprescriptible la acción reivindicatoria del Estado, el artículo 15 también de esa ley que se refiere a los impedimentos de la Administración Pública de traspasar, entregar o dar en arrendamiento inmuebles rurales de su propiedad o bajo su administración, sin que antes hayan sido clasificados por el MINAE, y finalmente 33 y 34 de la Ley Forestal que declaran áreas de protección, siendo la consecuencia de la contravención de los artículos relacionados, la nulidad absoluta.

La nulidad del acto administrativo (debido al incumplimiento de requisitos esenciales y por ser contrario a normas prohibitivas) por el que se produjo la titulación del inmueble que se discute aquí, lesiona el interés público toda vez que a través de dicho acto nulo de forma absoluta, se titulan terrenos que forman parte del Patrimonio Natural del Estado. Según el artículo 28 de la Constitución Política, las acciones privadas que no dañen la moral o el orden público, o que no a perjudiquen a tercero, están fuera de la acción de la ley, la titulación del Patrimonio Natural del Estado, daña el orden público, al impedir el disfrute del derecho que tiene toda persona a un ambiente sano y ecológicamente equilibrado, en los términos del artículo 50 de la Constitución Política, la cual es a su vez una norma de orden público. A lo anterior debe adicionarse, que el derecho a un ambiente sano y ecológicamente equilibrado es un derecho fundamental de tercera generación, que surge con la Declaración Universal de los Derechos Humanos en 1948.

Por su parte, la Declaración de Lisboa de 1988 emitida dentro del marco de la "Conferencia Internacional sobre garantías del Derecho Humano al Ambiente", exhortó a reconocer el derecho que tiene una persona a vivir en un ambiente sano y ecológicamente equilibrado, y a la vez sugirió a los estados crear mecanismos jurídicos que hagan posible que cada individuo pueda ejercer y exigir sin impedimentos, el derecho a habitar en un medio ambiente saludable para el desarrollo de su vida.

V.Sobre la posición de los demandados: Señalan que, de conformidad con el numeral 34 del Código Procesal Contencioso Administrativo, la Administración tiene la potestad de demandar la anulación de un acto administrativo ante esta jurisdicción, dentro del plazo de un año a partir del día siguiente en que este haya sido dictado. Salva el inciso 2) del plazo, respecto de la tutela de bienes de dominio público. Ahora bien, teniendo en cuenta que el acto es anterior a la vigencia del actual Código Procesal Contencioso Administrativo, se debe aplicar su Transitorio III que remite a la normativa vigente al momento de su dictado, siendo esta la escrita en la Ley Reguladora de la Jurisdicción Contencioso Administrativa, ya derogada, que indicaba en su numeral 35: "1. Cuando la propia Administración, autora de algún acto declarativo de derechos, pretenda demandar su anulación, ante la jurisdicción contencioso-administrativa, previamente deberá declararlo lesivo a los intereses públicos, económicos o de otra naturaleza, en el plazo de cuatro años contados a partir de la fecha en que haya sido dictado”.

De ambas disposiciones legales tenemos claro que el plazo anual o cuatrienal ya ha transcurrido sobradamente, y especialmente en cuanto a los defectos esgrimidos por el INDER en los hechos 6 y 7 de la demanda, pues no están relacionados en lo absoluto con la naturaleza supuestamente demanial del terreno. En virtud de eso, la caducidad se ha producido y solicita sea declarada. Dada la naturaleza dominical que se alega y que se caracteriza por la imprescriptibilidad, de estar ante un bien de dominio público, por ser patrimonio natural del Estado, aun habría plazo para demandar la lesividad. No obstante, eso es sólo si efectivamente se está ante un bien de dominio público. La naturaleza pública de un bien depende de la voluntad del legislador, por lo que su afectación o desafectación normalmente se hace vía legislación ordinaria. El INDER alega que la naturaleza demanial del bien propiedad de su representada, deviene de la declaratoria de patrimonio natural del Estado prevista en la Ley Forestal No. 7575.

Efectivamente, la Ley Forestal No, 7575 publicada en La Gaceta No. 72 del 16 de abril de 1996, dispone a partir de esa fecha que "los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, de las fincas inscritas a su nombre y de las pertenecientes a municipalidades, instituciones autónomas y demás organismos de la Administración Pública", entran a formar parte del dominio público. En primer término, hacer notar que, a la fecha de publicación de la ley, el INDER antiguo IDA, no era propietario de la finca que hoy pertenece a su representada, tampoco a esa fecha el territorio había sido declarado inalienable, y no formaba parte de reservas nacionales pues eran propiedad sin inscribir de particulares. Debe considerarse que el legislador en la misma Ley Forestal No. 7575, en su artículo 72, introduce una modificación al artículo 7 de la Ley de Informaciones Posesorias, que permite la titulación de terrenos cubiertos de bosque, aun en aquellos casos donde dichos terrenos formen parte de áreas silvestres protegidas.

A partir de lo dispuesto por el legislador, debe interpretarse que la naturaleza demanial del bien surge siempre y cuando no existan en el terreno poseedores que pudieren titular dicho bien, al demostrar que han poseído por diez años o más en forma quieta pública, pacífica ininterrumpida y a título de dueños, cuidando el bosque y delimitándolo con cercas o carriles. Esa es la única interpretación razonable, pues si el dominio público se reconoce sin sujeción a esa excepción, nadie podría titular terrenos en bosque, caso en el cual el numeral 7 citado no tendría razón alguna de ser. La misma Sala Constitucional analizó el contenido del numeral 7 de la Ley de Informaciones Posesorias, confirmando la posibilidad de titular inmuebles cubiertos de bosque, aun cuando fuere en áreas silvestres protegidas. Así las cosas, si el bien inmueble puede titularse por particulares que demuestren una posesión decenal, quiere decir que este no tiene la condición de bien de dominio público, y por ende la acción para establecer la lesividad en la vía contenciosa, sí está sujeta a plazo que en el caso particular está sobrepasado pues vencía el 23 de agosto de 2008.

Interpretarlo de manera distinta implicaría patrocinar una clara confiscación, lo que no es acorde con los principios que integran nuestro ordenamiento jurídico y el régimen de derecho y justicia que Costa Rica ha elegido. Con fundamento en las consideraciones expuestas, dado que el inmueble objeto de Litis no forma parte del dominio público, pues ha estado en posesión por particulares desde más de diez años antes de la declaratoria hecha en la Ley Forestal, y se reconoce el derecho del particular de usucapir y titularlo a su nombre cumpliendo con los requisitos ya expuestos, al Estado y a cualquier otra institución como el INDER le ha corrido el plazo fatal de prescripción para pretender apropiarse del territorio, virtud de lo cual se opone la excepción previa de prescripción. Existen dos tipos de procedimiento para intentar la declaratoria de nulidad, partiendo del principio de "inderogabilidad de los actos propios" que impide a la Administración derogar actos de manera unilateral que han concedido derechos a terceros.

El primero es aquel en que la administración acude al procedimiento de lesividad contemplado en el artículo 174 de la Ley General de la Administración Pública en concordancia con los artículos 10 inciso 5 y 34 del Código Procesal Contencioso Administrativo. El segundo permite la declaratoria de la nulidad en la vía administrativa, previo procedimiento administrativo y dictamen favorable de la Procuraduría General de la República o de la Contraloría General de la República en caso de actos de la materia de contratación administrativa. En el procedimiento que aquí se examina, la Administración ha elegido la lesividad, reservada para aquellos casos en que se está ante una nulidad relativa o absoluta, pero que no es evidente y manifiesta, aspecto este último que resulta de vital análisis, pues si la condición o naturaleza del terreno titulado fuese fácilmente calificable como de dominio público, otra vía habría sido la escogida.

Resulta necesario en el proceso de lesividad que el jerarca de la Administración que adoptó el acto que se pretende anular, realice un análisis y a partir de los resultados del examen plasme un acto o acuerdo que declare la lesividad. Esa declaratoria de lesividad a los intereses públicos, económicos o de otra índole, debe primero establecer los defectos y su gravedad a efecto determinar si estamos ante una nulidad que a su vez sea suficiente para ser Lesiva al interés público. Los motivos de esa declaratoria deben extraerse de forma clara y precisa del acto, pues de lo contrario no se cumple con el requisito primario para este juicio. Efectivamente, la resolución administrativa que declara la lesividad, y cuya prueba aporta el actor numerada como 9, no establece ni determina en forma alguna cuál es la disconformidad sustancial con el ordenamiento jurídico que configura la invalidez del acto administrativo declarado lesivo (art. 158.2 de la Ley General de la Administración Pública); ni siquiera hace un análisis de los elementos del acto a fin de ubicar la existencia de algún vicio en uno de éstos, según pauta orientadora del numeral 158.1 Ibidem.

Y mucho menos identifica frente a cuál, el interés público aquél otro acto resulta lesiva, lo cual obviamente no constituye una debida y correcta fundamentación. (133 y 136 de la Ley General de la Administración Pública). Las supuestas omisiones que hace el INDER y que sirven de base para la solicitud de lesividad consistentes en la ausencia de "estudio de suelo" y "estudio del IGN", son omisiones que caen dentro de la esfera a lo sumo de la nulidad relativa, por tanto es dable aplicar el régimen de saneamiento o convalidación de los actos administrativos. La convalidación se verifica a través de un acto administrativo nuevo que contenga mención expresa del vicio y de su corrección y tiene efectos retroactivos a la fecha del acto convalidado. En el nuevo acto se tendrán por corregidas o subsanadas las irregularidades o defectos, en consecuencia, que al estar ante defectos subsanables lo que la Administración debe hacer es aplicar el numeral el inciso 2 del numeral 174 de la Ley General de la Administración Pública que indica: "Artículo 174.- 1.

La Administración estará obligada a anular de oficio el acto absolutamente nulo, dentro de las limitaciones de esta Ley. 2. La anulación de oficio del acto relativamente nulo será discrecional y deberá estar justificada por un motivo de oportunidad, especifico 11 actual. No se deriva del acto que declara la lesividad por parte de la Junta Directiva del INDER, fundamentación alguna en ningún sentido, por lo que no se cumple el requisito básico para acudir a esta vía, no teniendo al efecto los apoderados especiales judiciales de dicha institución, potestades para sustituir el juicio de la Administración, ni aportar argumentaciones que no se derivan del acuerdo de lesividad. Otro motivo por el cual resulta procedente la excepción de falta de derecho, es que la Administración no ha logrado acreditar que el inmueble que ahora pretende apropiar es un bien de dominio público. Salvo una certificación sin sustento técnico alguno, no cuenta con prueba que venga a acreditar que el inmueble era de bosque a la fecha de titulación, y a su vez no estuviere en posesión ad usucapione por parte de particulares.

Por último, procede la excepción de falta de derecho, por cuanto admitir que el Estado, en este caso el INDER, tiene la potestad de registrar a su nombre fincas de propiedad sin inscribir de particulares, con el ánimo de aligerarles su titulación, para luego alegar sin motivo alguno que esos territorios le pertenecen, resulta en la legalización de la confiscación, lo cual violenta los más elementales principios del Derecho Administrativo, que ha proscrito, al menos en nuestro país la "arbitrariedad". La figura del tercero adquiriente de buena fe presupone que una persona, ya sea física o jurídica, adquiere un bien con la creencia de que éste es transmitido por el propietario legítimo y con la ignorancia de los posibles vicios de la adquisición. En los sistemas jurídicos como el nuestro que cuentan con un registro público de la propiedad inmueble la publicidad registral hace de quién adquiere de aquél que aparece como dueño según el registro.

Un adquirente es de buena fe, siempre y cuando no conozca de antemano de los vicios que afecten la validez del derecho y su inscripción o del asiento registral no se desprenda su invalidez. La doctrina del adquirente de buena fe con base en la publicidad registral la recoge nuestro Código Civil en el artículo 456, el cual dispone: "Artículo 456.- La inscripción no convalida los actos o contratos inscritos que sean nulos o anulables conforme a la ley. Sin embargo, los actos o contratos que se ejecuten u otorguen por persona que en el Registro aparezca con derecho para ello, una vez inscritos, no se invalidarán en cuanto a tercero, aunque después se anule o resuelva el derecho del otorgante en virtud de título no inscrito, o de causas implícitas, o de causas que aunque explícitas no constan en el Registro." Por otra parte, el artículo 457 del mismo Cuerpo legal protege al propietario registral frente a acciones de resolución o rescisión que pudiesen invalidar el derecho del transmitente, con las únicas excepciones que la misma norma establece.

Establece: "Artículo 457.- Las acciones de rescisión o resolución no perjudicarán a tercero que haya inscrito su derecho. Exceptúense: 1 °.- Las acciones de rescisión o resolución que deban su origen a causas que, habiendo sido estipuladas expresamente por las partes, consten en el Registro. 2°.- Las acciones rescisorias de enajenaciones en fraude de acreedores en los casos siguientes: 1°.- Cuando la segunda enajenación ha sido hecha por título lucrativo; y 2°.-Cuando el tercero haya tenido conocimientos defraude del deudor". Lo anterior se fundamenta en el principio de publicidad o fe pública registral, como ya se explicó, presupone que quien aparece en el Registro Público como titular de derechos reales es el dueño legitimo. Este principio procura la seguridad jurídica con respecto al tracto de bienes inmuebles, así como preservar el interés público que recae en la protección de bienes jurídicos fundamentales para la convivencia social, como es el caso del derecho de propiedad privada inmobiliaria.

La protección que brinda este principio de fe pública registral se manifiesta en el sentido de que, ante la eventual invalidez del derecho de propiedad del non domino, el derecho de propiedad del tercero que adquiere no arrastra la invalidez del derecho previamente inscrito. De ahí que es clara la protección que nuestro ordenamiento otorga al tercero adquiriente de buena fe, quien mantiene su derecho a pesar de la posible nulidad o anulación del negocio o contrato jurídico anterior. En razón de lo dicho, mi representada como adquirente de buena fe, no sólo es propietaria del inmueble, sino que lo adquirió de quien constaba en el Registro era el propietario, aunado a que el INDER nunca ha sido propietario, pues el registro a su nombre en una época tenía como único un facilitar la formalización de los derechos de los particulares, quienes poseían a título de dueños, y cumplían con todos los requisitos para titular, entre ellos haber ejercido una posesión ecológica, que como anotamos está debidamente reconocida, y excluye en el caso bajo examen la posibilidad de que el terreno haya entrado a formar parte del dominio público.

En todo caso, tal y como lo establece el artículo 144 de la Ley General de la Administración Pública "1. El acto administrativo no podrá surtir efecto ni ser ejecutado en perjuicio de derechos subjetivos de terceros de buena fe, salvo disposición expresa o inequívoca en contrario del ordenamiento. 2. Toda lesión causada por un acto a derechos subjetivos de terceros de buena fe deberá ser indemnizada en su totalidad, sin perjuicio de la anulación procedente", siendo que no se deriva del expediente administrativo ni del judicial, la existencia de previsiones por parte de la Administración Pública, para indemnizar integralmente a su representada, lo cual debe ser al menos una actuación concomitante, dada la evidencia de que se está ante una adquisición bajo la publicidad registral de su representada. Ruego considere el Tribunal, que la disposición citada es clara, al obligar a la Administración proceder a la indemnización de derechos subjetivos de terceros de buena fe, condición que el INDER conoce, por ende, debe actuar en ese sentido, pues la norma no obliga al tercero a tener que acudir a contrademandar o demandar en un juicio independiente, agravando sus perjuicios.

Por su parte el demandado Porras Sánchez se opone a la demanda señalando que la titulación del bien se hizo sobre un bien con aptitud de titulación por cuanto siempre fue propiedad privada en su haber adquirido por título de compraventa legitima, por lo que estima que nunca se ha tratado de un bien demanial, únicamente se acudió al proceso de titulación del Instituto de Desarrollo Agrario por conveniencia.

VI.De la posición del Estado: Señala que en sesión ordinaria de Junta Directiva No. 36-2015 de 5 de octubre de 2015, articulo 47, el INDER declaró lesivos los acuerdos ¡impugnados que originaron la inscripción 6-139717-000, plano P-862160-2003, con un área de montaña de 9 Ha. 6829.30 ms. En dicho trámite de titulación no se presentó el estudio de suelos del INTA ni el informe del Instituto Geográfico Nacional. Además, la certificación SINAC-DS-OFAUC- 3125-2003 de 21 de julio de 2003 indicó que el citado inmueble constituye Patrimonio Natural del Estado. En ese orden, nótese que el informe de inspección de campo del 29 de marzo de 2004, realizado por el funcionario de la Oficina Regional de Parrita, reportó que el inmueble en su totalidad presenta un área de bosque de 9 Ha. 6829.30 m2. Además de las áreas silvestres protegidas, también integran ese Patrimonio los bosques terrenos forestales o con esa aptitud.

El trámite en este caso, se realizó con base en el Reglamento para la titulación de Tierras en Reservas Nacionales, adoptado por acuerdo de la Junta Directiva del Instituto de Desarrollo Agrario, publicado en La Gaceta No. 173 del 10 de setiembre del 2002, el cual fue anulado en la sede constitucional con efectos "retroactivos a la fecha de vigencia de las normas que se anulan, sea el doce de agosto del dos mil dos", ante la falta de competencia del IDA para emitirlo e inexistencia de presupuestos legales que lo sustentaran. Por ende, los actos administrativos aquí impugnados están viciados de nulidad absoluta por afectar Patrimonio Natural del Estado y haberse realizado con base en un reglamento inconstitucional. Además, el artículo 10 del citado Reglamento anulado permitió solo traspasar tierras "que no estén sujetas a la administración por parte del MINAE y requería "certificación original extendida por el MINAE en donde conste que el terreno a titular según el plano catastrado no está afectado o inmerso dentro de... patrimonio natural del Estado".

El artículo 1° del Reglamento anulado indicaba: "El presente instrumento jurídico tiene como finalidad reglamentar lo establecido en la Ley de Tierras y Colonización relativo a la titulación de tierras en las Reservas Nacionales...". Sin embargo, la Ley de Tierras y Colonización, No. 2825 de 14 de octubre de 1961, no regula la titulación de tierras, sólo se ocupa de la parcelación en los artículos 49 a 81, y de la colonización en los numerales 82 a 91. La titulación o procedimiento para obtener un título de dominio inscribible, comentado en el ejercicio de la posesión ad causam, con los requisitos que enumera el Código Civil, es diversa de la parcelación y colonización. La parcelación y la colonización son convenios declarativos para adquirir la propiedad del ente público agrario con presupuestos diversos a la titulación. Incluso, la colonización puede tener regímenes de tenencia de la tierra distintos de la propiedad, como el arrendamiento, con opción de compra o sin ella, aparcería o usufructo.

La Ley de Tierras y Colonización no autorizó al IDA a titular ni emitir un Reglamento para la Titulación de Tierras en Reservas Nacionales. Ese Reglamento evadió la competencia legislativa al crear un procedimiento administrativo especial y sumario excluyente del judicial previsto en la Ley de Informaciones Posesorias, No. 139 de 14 de julio de 1941. Más aún al reformar las reglas de titulación, autorizándola en terrenos escritos a nombre del IDA (artículos 7 del Reglamento y 1° de la Ley de Informaciones Posesorias). Toda la normativa que en el pasado autorizó la titulación administrativa, ante el ITCO o IDA, hoy insubsistente, tuvo rango de ley: Ley de Informaciones Posesorias Administrativas No. 3971 de 11 de octubre de 1967, Ley de Informaciones Posesoras No. 4545 de 20 de marzo de 1970 y Ley de Titulación Múltiple de Tierras No. 5064 de 22 de agosto de 1972. La certificación No. SINAC-DS-OFAU-C-3125-2003 de 21 de julio de 2003, indicó que el plano P-862160-2003, construye Patrimonio Natural del Estado, en el mismo sentido la inspección de campo del 29 de marzo de 2004, realizada por el funcionario de la Oficina Regional de Parrita, replicó que el inmueble en su totalidad presenta un área de bosque de 9 Ha. 6829.30 m2.

Por ende, las áreas de bosques y terrenos forestales o de aptitud forestal que contiene el inmueble 6-139717-000 constituyen Patrimonio Natural del Estado según el artículo 13 de la Ley Forestal. En esa condición no podían ser permutados, cedidos, enajenados de ninguna manera, entregados, ni dados en arrendamiento (Ley7575, artículos 13, 14 y 15). El artículo 10 del citado Reglamento anulado permitía únicamente el traspaso de tierras que no estén sujetas a la administración por parte del MINAE y requería certificación extendida en donde conste que el terreno a titular según el plano catastrado no está afectado o inmerso dentro del patrimonio natural del Estado, y con vista de la indicada certificación SINAC-DS-OFAU-C-3125-2003 es claro que no se cumplen esos requisitos. Aduce la parte demanda que adquirió al amparo de la publicidad registral y a buena fe. Alega caducidad y prescripción e invoca falta de derecho y estima que debe indemnizársele por la compra del inmueble.

Las defensas y excepciones no son de recibo. Los principios de inalienabilidad e imprescriptibilidad que caracterizan los bienes demaniales y la publicidad legal del demanio se oponen a que en su contra pueda esgrimirse la figura del tercero registral para consolidar la propiedad privada ilícitamente sustraída de ese régimen. Otro aspecto que no debe perderse de vista es que la afectación demanial de los terrenos forestales y de bosque no se inicia con la Ley Forestal No. 7575 de 1996, sino que proviene de otras leyes forestales anteriores. Tratándose de normas afectantes al dominio público sobre un mismo bien, debe estarse al principio de que la demanialidad se tiene por constituida desde la primera normativa afectante. Entonces, la titulación realizada por el INDER se hizo sobre un bien de dominio público es nula. Efectivamente, porque la inscripción no convalida la nulidad de un título.

El registro no subsana los vicios que puede tener el documento inscrito o el acto contenido y subsisten. Ante el registro ¡legitimo el particular no adquiere ningún derecho, el acto sigue siendo absolutamente nulo. La buena fe y la confianza legítima no caben frente a los bienes demaniales, sin importar el tiempo transcurrido, tolerancia o actuaciones administrativas que pudieron alentar la permanencia indebida y debe revertirse, no siendo dable basar esa ocupación en una situación jurídica consolidada por tratarse de terrenos sometidos al demanio, que no pueden ser apropiados ni usados por los particulares a no ser que cuenten con autorización o concesión administrativa que faculte el uso. Esa naturaleza demanial del terreno ocupado demerita la buena fe y no cabe el principio de confianza legítima.

VII.Sobre los presupuestos para el proceso de lesividad. Para realizar el análisis del presente proceso, es importante partir del cumplimiento de los presupuestos que impone el ordenamiento jurídico para la interposición de un proceso de lesividad por parte de la Administración Pública, toda vez que la ausencia de uno de ellos haría innecesario el examen de fondo. En términos generales, ya este Tribunal ha indicado que las diversas Secciones del Tribunal Contencioso Administrativo, han precisado en sus sentencias que la lesividad es un mecanismo jurisdiccional en virtud del cual, la Administración pretende la supresión de un acto propio que genera efectos favorables o declara derechos en favor de un administrado y a su vez, estima que esos efectos, son desfavorables para el interés público, sea éste económico, social, tributario, sanitario, u otro. Lógicamente, la naturaleza de esta pretensión, demanda la participación de todo aquel que se encuentra perjudicado por la anulación de la conducta que concede el derecho subjetivo o beneficio, a efecto que ejerza la defensa de sus intereses a través del contradictorio.

En orden a lo descrito, es el Juez quien debe proceder a analizar la validez de una conducta administrativa de contenido favorable. Las disposiciones normativas que regulan esta figura procesal se encuentran contenidas en la Ley General de la Administración Pública y el Código Procesal Contencioso Administrativo. Éste último, en su artículo 34, fija los elementos previos y regulaciones procesales de esta figura, en relación con los numerales 173 inciso 6) y 183 de la Ley General de la Administración Pública. En resumen, las normas de cita imponen las condiciones subjetivas, objetivas, procedimentales y temporales de la acción de lesividad. En primer término, al referirnos al elemento subjetivo, debemos precisar que la legitimación activa se concede a la Administración autora del acto cuestionado, en tanto que el legitimado pasivo es el receptor de los efectos de la conducta declarada lesiva, sea, quien obtiene sus beneficios.

El elemento objetivo, se refiere al mecanismo de supresión jurídica de actos administrativos que son favorables o declarativos de derechos al administrado pero que, estima la Administración, se encuentran viciados de nulidad absoluta o relativa y que por ende, se tornan sustancialmente disconformes con el ordenamiento jurídico. En lo que respecta al orden procedimental, es requisito que la Administración declare lesivo a los intereses públicos esa conducta, siendo imperativo que el jerarca máximo supremo de la Administración Pública respectiva declare la lesividad del acto, sea por lesión a intereses económicos, sociales, fiscales o de otra índole que se desprendan del interés público, para lo cual, ha de contar con un criterio jurídico-técnico de base que sustente esa determinación. Es importante recordar, que por tratarse de un requisito procedimental que será sometido al conocimiento de la sede jurisdiccional, a diferencia del procedimiento administrativo para declarar la nulidad absoluta, evidente y manifiesta que realiza en sede administrativa la propia Administración productora del acto, acá no se concede audiencia al administrado, por cuanto, se trata de una acción de naturaleza interna de la Administración, que se orienta a verificar la voluntad del máximo jerarca, y a su vez, permite el inicio del proceso judicial y será en el curso de éste, que podrá ejercer su derecho de defensa aquel que derive derechos derivados del acto impugnado, por lo que la ausencia de su participación dentro de la fase administrativa para la declaratoria de lesividad, no cercena en modo alguno su derecho al debido proceso o procedimiento administrativo.

Otro aspecto de trascendencia al analizar el acto que declara su lesividad, es el determinar si el acto emana del máximo jerarca administrativo. Las reglas son las siguientes, cuando el acto emane del Estado, sea, de la Administración Central, de acuerdo con el artículo 16 del Código Procesal Contencioso Administrativo, la demanda solo podrá ser incoada por la Procuraduría General de la República, previo pedimento del jerarca máximo supremo y declaratoria interna de lesividad, con detalle de los motivos de ese criterio. La misma regla procesal opera cuando el acto lesivo dimane de los Poderes Legislativo y Judicial, así como del Tribunal Supremo de Elecciones, en cuanto ejerzan función administrativa. Tal representación impone, además, en el caso de los actos del Poder Judicial emitidos en el ejercicio de su función administrativa, como es el caso de los actos dictados por el Consejo Superior, cuya lesividad debe declararse por la Corte Plena.

Por último, en cuanto a las administraciones públicas descentralizadas, deberá realizar la declaratoria el órgano superior supremo de la jerarquía administrativa. Otro aspecto para tomar en cuenta es que, procesalmente, existe el impedimento para que la Administración formula vía contrademanda, la pretensión anulatoria. Por último, existe una limitación temporal dispuesta en el artículo 34 del Código Contencioso Administrativo, el cual establece un plazo de un año contado a partir del día hábil siguiente a su emisión para declarar lesivo el acto a los intereses públicos en sede administrativa. Lo anterior, salvo los supuestos en que el acto padeciere de nulidad absoluta y siga surtiendo efectos, en cuyo caso, al tenor de lo regulado por el ordinal 34 inciso

  • 1)del mismo cuerpo normativo, esa declaratoria interna puede hacerse mientras éstos perduren. En tal hipótesis, el año se computa desde el cese de los mismos y la sentencia que disponga la eventual nulidad, lo hará únicamente para la anulación e inaplicabilidad futura de la conducta anulada. Luego de esa declaratoria, se otorga un plazo de un año para plantear la acción contenciosa administrativa, bajo pena de caducidad, según lo estatuye el artículo 39 inciso e) del Código Procesal Contencioso Administrativo. Ahora bien, la excepción a estas regulaciones temporales que hemos citado, gira en torno a la tutela del dominio público, caso en el que la acción de lesividad no está sujeta a plazo, según se deriva del artículo 34 inciso
  • 2)del Código Procesal Contencioso Administrativo, en aplicación de la cláusula general de imprescriptibilidad de ese tipo de bienes, según se deriva del artículo 261 del Código Civil. Nótese entonces que cuando al acción de lesividad gira en torno a bienes demaniales del Estado, el plazo para declarar la lesividad en las normas procesales de referencia es inaplicable, lo que implica que puede disponerse en cualquier momento sin que medie sanción procesal alguna. Por último, debemos advertir que el ordinal 41 inciso
  • 2)del Código Procesal Contencioso Administrativo, establece de forma expresa que tratándose de materia tributaria, el plazo máximo para incoar el proceso será el mismo que disponga el ordenamiento jurídico como plazo de prescripción para el respectivo derecho de fondo que se discute. Por último, al estudiar el Tribunal un proceso judicial de lesividad, debe advertir si el acto que se pretende anular fue dictado con anterioridad a la entrada en vigencia del Código Procesal Contencioso Administrativo, esto es, en fecha 1 de enero del 2008, ya que de ser así, debe aplicarse lo dispuesto en el Transitorio III del citado cuerpo normativo, conforme al cual, el régimen de impugnación de los actos administrativos que hayan quedado firmes en la vía administrativa antes de la vigencia del citado Código, se regirán por la legislación vigente en ese momento. Teniendo claro lo anterior, de seguido analizamos si en el caso concreto, se cumplen los presupuestos de ley, para la estimatoria de la acción. (Consultar en el mismo sentido la sentencia 119 del 20 de setiembre del 2020 de la Sección Primera del Tribunal Contencioso Administrativo y Civil de Hacienda).

VIII.Sobre el cumplimiento de los requisitos para la declaratoria de lesividad: De acuerdo con el expediente judicial, tenemos que efectivamente la entidad accionante cumple con los requisitos objetivos, subjetivos, de temporalidad y procedimiento para que el objeto del proceso sea analizado por esta Cámara de Jueces. En primer lugar, tenemos que el elemento subjetivo se ha cumplido, toda vez que la Junta Directiva del Instituto de Desarrollo Rural dictó el acto administrativo que declara lesivo al interés público el acuerdo que concede derechos subjetivos a favor de Marvin Porras Sánchez y Palacios y Paraísos Tropicales que adquirió la transmisión del derecho de titulación que se declara lesivo por compraventa. En esa lógica, la Junta Directiva del Instituto, Número 47 de la Sesión Ordinario 36 del 5 de octubre, se declara lesivo a los intereses públicos los actos administrativos dictados mediante los acuerdos 39 y 49 de la sesión ordinaria 031-04, celebrada el 23 de agosto del 2004, sesión 49 de la sesión ordinaria 025-05 celebrada el 4 de julio del 2005, 50 y 57 de la sesión ordinaria 044-04 celebrada el 29 de noviembre de 2004, 53 y 58 de la sesión ordinaria 022-05 celebrada el 13 de junio del 2005, 53 de la sesión 039-05 celebrada el 10 de octubre del 2005, y 45 de la sesión ordinaria 016-04 celebrada el 3 de mayo del 2004, que autorizó la titulación a favor de Marvin Porras Sánchez, exponiendo a grosso modo los vicios de nulidad del acto y la razón que fundamenta la lesividad, por lo que no se advierten los motivos de nulidad sobre tal acto que reprocha el demandado.

Debe indicarse que, mediante acuerdo de Junta Directiva, artículo 39 de la sesión 31-04 del 23 de agosto del 2004 de la Junta Directiva del Instituto de Desarrollo Agrario, se dispuso: "En cumplimiento a las políticas institucionales y con la recomendación de la oficina Regional de Parrita según oficio OSP-163-04 y el visto bueno de la Dirección Regional Central según oficio S/N y la revisión de los requisitos exigidos para el trámite de titulación por parte del Coordinador Agrario Regional y de conformidad con el acuerdo de Junta Directiva descrito en el Articulo XXI, Sesión 065-00 de 11 de setiembre del 2000, y habiéndose cumplido con todos los requisitos que establece el Reglamento para la titulación de tierras en reservas nacionales publicado en el diario oficial La Gaceta 173 del 10 de setiembre del 2002, al amparo de la ley de Tierras y Colonización 2825 del 14 de octubre de 1961 y la Ley de creación del Instituto de Desarrollo Agrario 6735 del 29 de marzo de 1982 se autoriza segregar y traspasar la parcela para el título supletorio de dominio a Marvin Porras Sánchez cédula 1-427-886, la finca descrita en el plano 862160-2003, dicho acuerdo se materializó mediante escritura pública número ciento uno otorgada ante el Notario Público Luis Enrique Wong Sánchez, en el cual se titula la inscripción de la parcela 19297045 a nombre de Marvin Porras Sánchez, la cual se encuentra inscrita con el número de finca 139717-000 del Partido de Puntarenas.

Posteriormente mediante la escritura pública número 186 otorgada ante la Notaria Pública Gladys Marín Villalobos, Marvin Porras Sánchez traspasa la propiedad inscrita con número 139717-000 del Partido de Puntarenas a favor de Palacios y Paraísos Tropicales La Selvita Sociedad Anónima. Ahora bien, en cuanto al objeto del proceso, es claro que éste versa en la declaratoria de nulidad del acto administrativo que declara derechos a favor de un administrado Porras Sánchez, por lo que la pretensión anulatoria es congruente con el proceso de lesividad. De igual modo, la demanda la formula el referido instituto, como autor del acto cuestionado y se presenta en contra de las personas a favor de quienes surgen los efectos beneficiosos del acto que corresponden en este caso a el beneficiario de la titulación, por lo que, en términos del ámbito subjetivo tanto activo como pasivo y el objetivo, se cumplen con las exigencias referidas en el apartado anterior.

En cuanto a la temporalidad, tenemos que al tratarse la discusión respecto a un bien que se califica de dominio público, es inaplicable el plazo de caducidad que regula el artículo 39 del Código Procesal Contencioso Administrativo, pero para arribar a esa conclusión, debe examinarse la prueba allegada a los autos, toda vez que tratándose el examen acerca de la validez de un acto administrativo dictado en el año 2005, esto es, con anterioridad a la entrada en vigencia del Código Procesal Administrativo, deviene en aplicable el Transitorio Tercero del citado cuerpo normativo y en ese tanto, el régimen de impugnación de los actos administrativos que hayan quedado firmes en la vía administrativa antes de la vigencia del citado Código, se regirá por la legislación vigente en ese momento (Ley Reguladora de la Jurisdicción Contencioso Administrativa), salvo, claro está, que logre demostrarse que se está en presencia de un bien demanial, cuya acción reivindicatoria no se encuentra sujeta a plazos.

Así las cosas, estima el Tribunal que resulta indispensable determinar si se está o no frente a a un bien de dominio público para luego examinar lo relativo a los aspectos temporales del proceso de lesividad y de ser necesario, pronunciarse en cuanto al fondo del asunto.

IX.Sobre el objeto del proceso: Declaratoria de nulidad del acto administrativo por infringir normas del derecho público relativo a los bienes demaniales: En el presente proceso, el Instituto de Desarrollo Rural, pretende que se anule el acuerdo tomado por su Junta Directiva, artículo 39, de la sesión 031-04, de fecha 23 de agosto del 2004, únicamente en lo que se refiere a la titulación de la finca Partido de Puntarenas, Folio Real Matrícula número 139717-000 a favor del señor Marvin Porras Sánchez, de calidades antes indicadas, correspondiente al Plano Catastrado P-0862160-2003. Por conexidad, solicita que se anule la escritura pública emitida por el Instituto de Desarrollo Agrario, únicamente en lo que se refiere a la titulación de la finca Partido de Puntarenas, folio Real matrícula número 139717-000 a favor del señor Marvin Porras Sánchez, correspondiente al Plano Catastrado P-0862160-2003.

Y el asiento registral de inscripción de la finca inscrita bajo sistema de Folio Real Partido de Puntarenas, Folio Real Matrícula número 139717-000 emitido por el Registro Nacional. Así como cualquier inscripción derivada. En lo medular, argumenta que el referido acuerdo es nulo por cuanto genera una afectación del interés público porque, se autorizó el traspaso de una parcela que es parte del dominio público, al constituir Patrimonio Natural del Estado y por haberse otorgado dicha titulación sin cumplir con los requisitos legales y reglamentarios que el ordenamiento jurídico le imponía. Postura que respalda la representación del Estado como tercero interesado de este proceso. Por su parte, la representación de Palacios y Paraísos Tropicales S.A, indica que de acuerdo a lo establecido en el numeral 455, 456 y 457 del Código Civil y el principio de publicidad registral, la nulidad reclamada no es oponible a su derecho de propiedad, agrega además que no se trata de un bien de dominio público en los términos que establece el numeral 7 de la Ley de Informaciones Posesorias y que en ese tanto, la acción de lesividad se encuentra caduca y prescrita, además señala que los vicios del acto por los requisitos faltantes se tratan de una nulidad relativa subsanable y no absoluta.

Por último, indica que el acto de lesividad no cumple los requisitos de ley. El demandado Porras Sánchez se opone indicando que la naturaleza del bien titulado a su favor es de naturaleza privada y fue adquirido por compraventa legitima. Para abordar el fondo del asunto, es necesario que el Tribunal se refiera brevemente al tema de los bienes de dominio público y su régimen especial de tutela. En ese sentido este Tribunal ha indicado recientemente: "En primer lugar, debemos tener claro que no todos los bienes de los entes públicos son de dominio público porque éstos cuentan, también, con bienes patrimoniales o de dominio privado. Los primeros, regulados por el Derecho Público y por ende, subordinados a éste, mientras que respecto de los segundos, deviene en aplicable el régimen privado, sujeto a reglas especiales de coordinación. En lo que interesa para el dictado de la presente sentencia, debemos centrarnos en la determinación de concepto de bienes de dominio público.

Esta distinción encuentra sustento en el propio Código Civil que en su artículo 261 señala que: “Son cosas públicas las que por ley, están destinadas de un modo permanente a cualquier servicio de utilidad general, y aquellas de que todos pueden aprovecharse por estar entregadas al uso público. Todas las demás cosas son privadas y objeto de propiedad particular, aunque pertenezcan al Estado o a los Municipios, quienes para el caso, como personas civiles, no se diferencian de cualquier otra persona”. En efecto, por su naturaleza este tipo de bienes se encuentran sometidos a un régimen especial de Derecho Público. Forman parte del demanio público, entendido como “(…) el conjunto de bienes sujeto a un régimen jurídico especial y distinto al que rige el dominio privado, que además de pertenecer o estar bajo la administración de personas jurídicas públicas, están afectados o destinados a fines de utilidad pública y que se manifiesta en el uso directo o indirecto que toda persona puede hacer de ellos.

(…)” (Sentencia No. 3145, dictada por la Sala Constitucional a las 9 horas 27 minutos del 28 de junio de 1996). En virtud de lo expuesto, podemos afirmar que el dominio público se encuentra integrado por bienes que manifiestan, por voluntad expresa del legislador, un destino especial de servir a la comunidad, al interés público, siendo el titular el Estado en sentido amplio, para el ejercicio de su administración y tutela. Debemos comprender, que son cosas que no pertenecen individualmente a los particulares y que están destinados a un uso público y sometidos a un régimen especial, fuera el comercio privado de los seres humanos. Así, son bienes que pertenecen al Estado en el sentido más amplio del concepto, están afectos al servicio que prestan, mediando al efecto, el interés público. También la doctrina reconoce bienes de dominio público destinados al uso público, al resguardo público, los que se conocen como patrimonio del Estado y por último, los temporales.

Como puede notarse, hay categorías diferentes, aún y cuando directamente relacionadas. Para explicar esta clasificación, primero identificaremos un primer grupo de bienes lo componen aquellos destinados al uso general, como el caso de las calles, los parques, la playa, entre otros, que se clasifican como bienes de dominio público por su uso y generalmente, su acceso es libre, gratuito e ilimitado, tales como las calles, los parques y las playas. Se trata de una afectación directa al uso público, que justifica su pertinencia y utilidad en corresponder a esta clasificación. El segundo grupo de bienes demaniales lo componen aquellos cuyo uso público es indirecto, correspondiendo a todos aquellos afectos de manera directa a un servicio público. Aquí es oportuno agregar, que al margen de la titularidad del servicio, en tanto sea público, satisface un interés general o colectivo; de manera que los bienes que lo componen le resultan indispensables para evitar una afectación a la colectividad y por esa razón, el legislador le brinda la tutela especial.

Por eso se indica que su relación con la sociedad es indirecto, en la medida que su uso colectivo no es por propia mano con las personas sino en el servicio propiamente dicho. Otra clasificación, refiere a los bienes de dominio público de resguardo por parte del Estado, como los parques nacionales, los volcanes, las islas. En otro orden, tenemos los bienes de dominio público que refieren a un patrimonio del Estado, regulados en el articulo 121, inciso 14) de la Constitución Política, sin que pueda entenderse que se trata de numerus clausus. Ellos son entendidos como aquellos bienes de carácter mineral o natural, que el Estado guarda en su dominio, dependiendo del requerimiento, éste permite que particulares participen de ellos por ejemplo, los yacimientos de petróleo, aluminio, cobre, mercurio, agua, oro, etc. Por último, tenemos los bienes de dominio público temporal, que se refieren a bienes que pueden ser objeto de traspaso por parte del Estado a particulares cuando media un procedimiento especial por ministerio de ley, con el objetivo de cumplir fines públicos, o bien, cuando por su mismo uso, pierden utilidad, normalmente se trata de bienes de carácter tecnológico, que al desactualizarse por el transcurso del tiempo, pierden el carácter demanial.

De aquí que de manera reiterada este Tribunal ha señalado en ocasiones anteriores que estos bienes tienen una naturaleza y régimen jurídico diverso de los bienes privados, en tanto, por expresa voluntad del legislador se encuentran afectos a un destino especial de servir a la comunidad, sea al interés público, y que por ello, no pueden ser objeto de propiedad privada, de modo que están fuera del comercio de las personas, por lo cual, no pueden pertenecer individualmente a los particulares, ni al Estado, en sentido estricto, por cuanto éste se limita a su administración y tutela. En razón de la línea argumentativa de las partes, es de interés precisar además, que la afectación dispuesta por ministerio de ley, se traduce en una manifestación del Poder Público que atendiendo a decisiones políticas e históricas, pueden cursarse de forma tal, que operen de forma individualizada sobre los bienes o de forma general, aplicando incluso, una afectación automática al bien, por el simple hecho, de cumplir con los presupuestos de la norma.

Puede mediar un acto administrativo que así lo declare, como ocurre con el patrimonio histórico arquitectónico o por disposición legislativa genérica, como ocurre con el patrimonio natural del Estado. En efecto, un bien público puede ser natural o artificial, según se trate de bienes declarados públicos por el legislador considerándolos en el estado en que la naturaleza los presenta u ofrece, o de bienes declarados públicos por el legislador pero cuya creación o existencia depende de un hecho humano. Ahora bien, los bienes demaniales, para ser tales, deben reunir algunos elementos que resultan indispensables. El elemento subjetivo se refiere al sujeto público titular del bien para su administración, protección, tutela y defensa. El elemento objetivo, está dirigido a todos aquellos bienes que pueden ser incluidos dentro del dominio público, que puede devenir por disposición legal genérica o bien, que de forma particular individualiza el bien.

Obviamente, el elemento normativo es la norma legal que así lo dispone, siendo de interés aclarar, que también ostentan la condición de bienes demaniales, aquellos bienes de la nación, que están comprendidos por voluntad del Constituyente en el artículo 21 inciso 14) de nuestra Carta Magna. Por último, el elemento finalista se orienta al fin público perseguido, los cuales abordamos líneas atrás". (Sentencia n°119 del 20 de setiembre del 2020 de la Sección Primera del Tribunal Contencioso Administrativo y Civil de Hacienda). De lo transcrito tenemos que en el tanto se cumplan los cuatro elementos indicados, podemos entender que opera una protección especial a los bienes que lo conforman, que radican en considerarse inalienables, imprescriptibles e inembargables, con las consecuencias que de ello se derivan. Por esa razón, la acción para recuperarlos no está sujeta a plazos de caducidad, como expresamente lo señala el numeral 34 del Código Procesal Contencioso Administrativo, de suerte que su uso o aprovechamiento están sujetos al poder de policía a cargo de la institución o sujeto público a quien le corresponda su administración y titularidad.

Como puede observarse, en síntesis, el régimen de demanialidad, impone un concepto jurídico que requiere de una declaración formal de carácter legislativo de someter a régimen de dominio público determinados bienes, señalar a su titular para su defensa, administración y protección, amén del fin perseguido. Ahora bien, para ahondar particularmente en los bienes que constituyen Patrimonio Natural del Estado, realizamos su análisis en el considerando siguiente.

X.Sobre los bienes de dominio público constituyentes del Patrimonio Natural del Estado: Este es un tema de amplio tratamiento jurisprudencial, la Sala Primera de la Corte Suprema de Justicia ha indicado que : “(…) Conforme al numeral 13 de la Ley Forestal “El patrimonio natural del Estado estará constituido por los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, de las fincas inscritas a su nombre y de las pertenecientes a municipalidades, instituciones autónomas y demás organismos de la Administración Pública, excepto inmuebles que garanticen operaciones crediticias con el Sistema Bancario Nacional e ingresen a formar parte de su patrimonio...”. De esta forma, son tres posibilidades las que brinda la norma, respecto a los bienes que integran dicho patrimonio: a) bosques y terrenos forestales de las reservas nacionales; b) bosques y terrenos forestales de las áreas declaradas inalienables, y c) bosques y terrenos forestales de las fincas inscritas a su nombre y de las pertenecientes a municipalidades, instituciones autónomas y demás organismos de la Administración Pública, excepto inmuebles que garanticen operaciones crediticias con el Sistema Bancario Nacional e ingresen a formar parte de su patrimonio.” (Al respecto pueden consultarse las sentencias números 1070 de las 9 horas 45 minutos del 3 de setiembre de 2010 y 1088 de las 8 horas 55 minutos del 8 de agosto de 2011).

Tal como lo indica la Sala Primera en el voto de referencia, el Patrimonio Natural del Estado se encuentra definido en lo expuesto en la Ley Forestal, normativa que expone además en su numeral 14 la condición de demanialidad que cubre a las áreas definidas dentro del Patrimonio Natural del Estado, señalando lo siguiente: "Artículo 14.- Condición inembargable e inalienable del patrimonio natural: Los terrenos forestales y bosques que constituyen el patrimonio natural del Estado, detallados en el artículo anterior, serán inembargables e inalienables; su posesión por los particulares no causará derecho alguno a su favor y la acción reivindicatoria del Estado por estos terrenos es imprescriptible. En consecuencia, no pueden inscribirse en el Registro Público mediante información posesoria y tanto la invasión como la ocupación de ellos será sancionada conforme a lo dispuesto en esta ley". Por su parte respecto a la inalienabilidad de estos terrenos señala el ordinal 15 de la misma norma: "Artículo 15.- Impedimentos.

Los organismos de la Administración Pública no podrán permutar, ceder, enajenar, de ninguna manera, entregar ni dar en arrendamiento, terrenos rurales de su propiedad o bajo su administración, sin que antes hayan sido clasificados por el Ministerio del Ambiente y Energía. Si están cubiertos de bosque, automáticamente quedarán incorporados al patrimonio natural del Estado y se constituirá una limitación que deberá inscribirse en el Registro Público". Conforme a los numerales anteriores es claro que los bienes que constituyen Patrimonio Natural del Estado son de naturaleza demanial por vocación, los cuales por su condición son imprescriptibles e inalienables y se encuentran fuera del comercio de los hombres.

XI.Sobre la naturaleza del bien que se discute en el caso concreto: Procedencia de la acción de lesividad: En el presente asunto, como se indicó el Instituto de Desarrollo Rural argumenta que el acto administrativo se encuentra viciado de nulidad absoluta, por cuanto infringe el régimen demanial previsto en la Ley Forestal, en el tanto se autorizó mediante acuerdo tomado por su Junta Directiva, artículo 39, de la sesión 031-04, de fecha 23 de agosto del 2004, únicamente en lo que se refiere a la titulación de la finca Partido de Puntarenas, Folio Real Matrícula número 139717-000 a favor del señor Marvin Porras Sánchez, correspondiente al Plano Catastrado P-0862160-2003 y sus actos conexos, sin cumplir con los requisitos legales dispuestos y terreno que es parte del Patrimonio Natural del Estado, dicha titulación se materializó en la escritura pública número ciento uno otorgada ante el Notario Público Luis Enrique Wong Sánchez, en el cual se titula la inscripción de la parcela 19297045 a nombre de Marvin Porras Sánchez, misma que se encuentra inscrita con el número de finca 139717-000 del Partido de Puntarenas.

Posteriormente mediante la escritura pública número 186 otorgada ante la Notaria Pública Gladys Marín Villalobos, Marvin Porras Sánchez traspasa la propiedad inscrita con número 139717-000 del Partido de Puntarenas a favor de Palacios y Paraísos Tropicales la Selvita Sociedad Anónima. En este sentido, para determinar si ese inmueble integra o no el demanio público, debe analizarse la concurrencia de los elementos subjetivo, normativo, objetivo y el finalista, tal y como se explicó en el considerando IX de la presente sentencia. En sentido tenemos que tal como se acredita a los autos el origen de la titulación surgió de la Constitución del Programa de Titulación Puriscal-Parrita" creado mediante el Decreto Ejecutivo número 3667-G del 18 de marzo de 1974, publicado en el Diario Oficial La Gaceta número 72 del 17 de abril de 1974, se inscribió en el Registro Nacional a nombre del IDA un área de 267.239 has, con el Folio Real Matricula 219039-000 (hecho no controvertido), creado conforme a lo que disponía la Ley de Titulación de Tierras en Reservas Nacionales número 7599 de 1996, la cual fue declarada inconstitucional, en el año 2001 por la Sala Constitucional, por lo cual la Junta Directiva procedió a titular inmueble objeto de este proceso conforme a lo establecido en el Reglamento denominado Titulación de Tierras ubicadas en Reservas Nacionales, emanado de la Junta Directiva del IDA, el cual replicaba lo dispuesto en la Ley 7599, el cual, igualmente fue declarado inconstitucional por voto de la Sala Constitucional en el año 2007.

Dicha norma señalaba en su numeral primero: Artículo 1º- El presente instrumento jurídico tiene como finalidad reglamentar lo establecido en la Ley de Tierras y Colonización relativo a la titulación de tierras en las Reservas Nacionales, otorgando seguridad jurídica en la tenencia de la tierra mediante el reconocimiento del domino pleno en áreas donde sus poseedores han adquirido el derecho a la titulación registral”. Ese reglamento conceptualizaba a las "Reservas nacionales: Terrenos comprendidos dentro de los límites de la República que, no estén inscritos a nombre de terceros, de las Municipalidades, Instituciones Autónomas o del Estado en general". En esa lógica, es claro que el origen del bien que se tituló a favor del demandado Porras Sánchez, eran bienes constituyentes de reservas nacionales, -por cuanto surgen de la autorización de inscripción de bienes con la características de Reservas Nacionales según lo señalaba la Ley 7599 de 1996-, es decir el origen es esos territorios de acuerdo a lo señalado en el numeral 13 de la Ley Forestal corresponden a lo que el legislador declaró como bienes integrantes del Patrimonio Natural del Estado, y por ende se encuentran fuera del comercio de los hombres y no pueden ser susceptibles de ser titulados como propiedad privada.

Nótese que en ese sentido, que el voto 2063-2007 de la Sala Constitucional de la Corte Suprema de Justicia, el cual declaró la inconstitucionalidad del Reglamento Titulación de Tierras ubicadas en Reservas Nacionales indicó al respecto: "En el caso bajo examen, la norma impugnada pretende titular unas zonas que han sido declaradas protegidas, precisamente por lo importante que resulta su conservación frente a las diversas actividades propias del hombre que vienen a alterar los ecosistemas y hábitat del medio ambiente que se desarrolla en estos lugares, así como la preservación de los bosques, los cuales son importantes para la generación de bienes esenciales e invaluables, como lo es el agua. El legislador en la presente ley, pone de manifiesto la necesidad de otorgarle un título de propiedad a los ocupantes de las zonas en cuestión, haciendo ver que la adquisición es con las limitaciones y protecciones ambientales que al respecto existen, sin embargo, del estudio de la norma impugnada se tiene que la facultad de titular en estas áreas, recae sobre un ámbito indiscriminado de aplicación, lo cual, de suceder así, podría estarse titulando áreas en las que son incompatibles muchas de las actividades que realiza el hombre y que podrían perjudicar seriamente el ecosistema ahí desarrollado así como la vulneración que existiría por parte del Estado para poder ejercer una adecuada vigilancia en ellas, lo cual, aún en el caso de que se parta del supuesto de que esas personas han venido ocupando desde hace muchos años estas áreas que son bienes de dominio público, esto no justifica en forma alguna que se pueda titular cualquiera de estas áreas, puesto que, el mismo Estado en protección del medio ambiente puede ordenar el desalojo de estas personas, en aquellas áreas donde más bien su presencia estén produciendo un efecto contraproducente, lo que provocaría consecuentemente, que en el caso de que se titularan este tipo de áreas, tendría el Estado que expropiar un bien que tal vez tuvo que expropiar alguna vez para declararlo zona de protección, incurriéndose en un acto irrazonable.

Lo anterior no implica que el Estado no pueda desafectar un área determinada en virtud de que ya no se cumplen los fines para los cuales se le protegió, o que inclusive, se pretenda titular zonas específicas, sin embargo, puede hacerse donde exista un estudio técnico previo que demuestre la naturaleza del área a titular y la posible convivencia tanto del hombre como del ecosistema así como las consecuencias que se deriven de ello, por lo que no se puede permitir que se titulen áreas de esta naturaleza en forma indiscriminada, ya que esto iría contra las mismas políticas conservacionistas del ambiente que ha procurado el Estado en virtud de los cometidos ordenados por la Constitución Política y los Convenios Internacionales que ha suscrito" (sentencia número 2988-99, supra citada). A tal efecto, interesa resaltar que la definición del concepto de reserva nacional está dado en la propia regulación –de la relación de los artículos 3 inciso k), 6 y 7– de manera tal que permite concluir con absoluta claridad que se trata de los inmuebles que precisamente han sido incorporados al régimen del patrimonio natural del Estado, precisamente para la debida tutela y conservación del ambiente natural.

(...)En primer lugar, cabe advertir que la norma impugnada no impide la titulación de estas zonas protegidas, sino más bien las facilita, y ni siquiera toma en consideración la naturaleza jurídica de estos bienes –demaniales– sobre los que pesa algún tipo de afectación, que se repite, es con fines de efectivizar la tutela ambiental –como lo manda el artículo 50 constitucional–, de manera que únicamente queda la constancia de tal afectación, y permite la titulación de estos bienes demaniales; tal y como lo manifestó con anterioridad este Tribunal: "Dentro de las zonas protegidas quedan comprendidos los terrenos que se encuentran situados en las reservas nacionales, cierta zona a lo largo de los ríos, una faja a uno y otro lado de la depresión máxima de las cuencas hidrológicas, los terrenos que bordean los manantiales que nacen en los cerros y también los que nacen en terrenos planos, cierta área en la ribera de los ríos arroyos, lagos, lagunas, o embalses naturales" (sentencia número 2988-99, supra citada).

En segundo lugar, no toma en consideración la existencia de otros tipos de bienes demaniales, tales como la zona marítimo terrestre, cuya administración está a cargo de las municipalidades, y/o los patrimonios histórico-arquitectónico y arqueológico, que están bajo la administración del Ministerio de Cultura, Juventud y Deportes; con lo cual, su posible afectación ni siquiera es consultada previamente por el Instituto de Desarrollo Agrario para efectos de una futura titulación, ni tampoco prevé impedimento para su titulación –en este sentido, ver artículo 10 de este Reglamento–. En virtud de lo cual, se evidencia la grave situación que permite esta regulación, desconociendo las características esenciales de los bienes de dominio público, que precisamente los sacan del comercio de los hombres –contrario a lo previsto con antelación el artículo 262 del Código Civil, que data de mil ochocientos ochenta y seis–, y que en consecuencia hace que sea absolutamente imposible su posesión, venta o gravación, sin antes haberse desafectado, materia que se repite, está reservada a la ley formal y material (emanada de la Asamblea Legislativa conforme a los procedimientos ordinarios de formación de las leyes), previo estudio técnico al efecto, que determine los efectos de la convivencia del hombre con los ecosistemas, como lo exige el principio de la objetivación ambiental o vinculación a la ciencia y técnica, desarrollado en el artículo 38 de la Ley Orgánica del Ambiente; lo anterior por cuanto, aún cuando las zonas protectoras no son zonas perpetuas, y a tal efecto pueden ser desafectas, no resulta legítima su desafectación para proteger otros intereses públicos o privados –como lo es la dotación de vivienda o de la tenencia de la tierra– en menoscabo de la tutela ambiental y del disfrute a un ambiente sano y ecológicamente equilibrado (sentencia número 7294-98).

Por ello, será inconstitucional toda disposición normativa que permita o faculte a la Administración titular bienes de dominio público de manera genérica, y máxime cuando se trate de bienes que conforman el patrimonio natural del Estado cualquiera que sea su denominación o categoría –parques nacionales, reservas forestales, reservas biológicas, zonas protectoras, refugios de vida silvestre, humedales, monumentos naturales– zona marítimo terrestre, zonas de protección hidrográfica, reservas indígenas, patrimonio histórico-arquitectónico, recursos mineros, patrimonio arqueológico, zona limítrofe, para someterlas al régimen de dominio privado, máxime cuando no se cuenta con el estudio técnico-científico previo, según se ha anotado". Es claro, del razonamiento dado por la Sala Constitucional que, al tener el origen de la titulación en bienes constituidos como reservas nacionales, éstas al ser Patrimonio Natural del Estado están fuera del comercio de los hombres y por ende es notorio que efectivamente la naturaleza del bien imposibilitaba su titulación.

Ahora bien es precisamente por tener el bien objeto de la lesividad su origen en reservas nacionales, que surge una imposibilidad de titulación a favor de un particular, más allá de lo señalado en el numeral 7 de la Ley de Informaciones Posesorias como expone el demandado, veamos, el numeral 7 de la Ley de Informaciones Posesorias señala que: "Artículo 7º.- Cuando el inmueble al que se refiera la información esté comprendido dentro de un área silvestre protegida, cualquiera que sea su categoría de manejo, el titulante deberá demostrar ser el titular de los derechos legales sobre la posesión decenal, ejercida por lo menos con diez años de antelación a la fecha de vigencia de la ley o decreto en que se creó esa área silvestre. Las fincas ubicadas fuera de esas áreas y que tengan bosques, sólo podrán ser tituladas si el promoviente demuestra ser el titular de los derechos legales de posesión decenal, ejercida por lo menos durante diez años y haber protegido ese recurso natural, en el entendido de que el inmueble tendrá que estar debidamente deslindado y con cercas o carriles limpios.

Sin excepción alguna, los planos catastrados que se aporten en diligencias de información posesoria, deberán ser certificados por el Ministerio del Ambiente y Energía, por medio del ente encargado, el cual dará fe de si el inmueble que se pretende titular se encuentra dentro o fuera de esas áreas silvestres protegidas", si analizamos la naturaleza de los bienes que constituyen el Patrimonio Natural del Estado- numeral 13 de la Ley Forestal y la referencia de lo indicado en el numeral 7 párrafo segundo, es posible concluir que los bienes a los que se refiere el legislador en el ordinal señalado, no alcanza a los bienes derivados de reservas nacionales, en el tanto, ese numeral hace alusión a bienes que si bien puedan tener vocación forestal o aptitud forestal, los cuales el legislador ha admitido su manejo y conservación en manos de particulares, estos no pueden ser aquellos que se derivan de reservas nacionales, por cuanto las reservas nacionales son constitutivos de Patrimonio Natural del Estado y por ende son parte del demanio público, tal conclusión lo desarrolló la Sala Constitucional en el voto 4587 del 5 de agosto de 1997, el cual señaló: "(...) En ese sentido, el desarrollo que en materia de propiedad forestal ha realizado la Sala Primera de la Corte Suprema de Justicia, se puede sintetizar como sigue: la propiedad forestal es un tipo diferente de propiedad con características y particularidades propias y un régimen especial; la propiedad forestal se concibe fundamentalmente para conservar, no para producir ni ser parte del comercio de los hombres; la normativa forestal presenta tres momentos, pero no es sino a partir de la promulgación de la Ley No.7032 de 7 de abril de 1986, que se contó con un instrumento mejor concebido para hacerle frente al complejo problema forestal; la Ley No.7032 de 7 de abril de 1986, fue declarada inconstitucional, y la No.7171 de 28 de junio de 1990, se promulgó nuevamente con el texto de la anterior; la tutela de los recursos naturales ha sufrido avances significativos en los últimos tiempos; los instrumentos internacionales de derechos fundamentales y el desarrollo jurisprudencial han provocado cambios en la legislación internacional tendientes a proteger el derecho a un ambiente sano y ecológicamente equilibrado; los cambios en la legislación han alcanzado a la propia constitución y actualmente se concibe al derecho al ambiente como un verdadero derecho humano; el desarrollo en este tema ha sido tal que se ha podido formular una verdadera clasificación jurídica: el derecho ecológico; de acuerdo con la Ley Forestal el patrimonio forestal del Estado incluye todo el territorio nacional y se subdivide en tres áreas: la comprendida por el régimen forestal, los aprovechamientos forestales en terrenos de propiedad privada y las reservas nacionales; el régimen forestal se define como el conjunto de disposiciones jurídicas, económicas y técnicas que dan contenido a la conservación; el régimen forestal tiene tres subáreas: a.-zonas protectoras, b.-parques nacionales, reservas forestales y biológicas, y c.-bosques y terrenos forestales; el término reservas nacionales se utiliza a partir de la Ley de Tierras y Colonización No.2825 del 14 de octubre de 1961, para identificar todas aquellas tierras denominadas por el Código Fiscal de 1865, y luego por la Ley No.13 de 19 de enero de1939, como baldíos nacionales; se trata de los inmuebles que no están sometidos a la propiedad privada -no están inscritos en el Registro Público en los términos de los artículos 267 y 486 del Código Civil- y aquellos que tampoco están inscritos a nombre del Estado o de sus instituciones; los baldíos nacionales resultan ser el remanente de las dos formas de propiedad anteriores; siguiendo los lineamientos del Código Civil, la Ley General de Baldíos Nacionales No.13 de 10 de enero de 1939, los declaró pertenecientes al Estado, dentro de los límites de la República; La Ley de Tierras y Colonización No.2825 de 14 de octubre de 1961, mantuvo la misma orientación y amplió las zonas declaradas por la ley anterior como inalienables; en general esas reservas han tenido límites -en cuanto a la superficie-, límites para poseerlas y para inscribirlas mediante el procedimiento de informaciones posesorias; todas las tierras consideradas como reservas nacionales quedan afectadas en forma inmediata a los fines de la normativa forestal; sobre ellas el Estado puede crear reservas forestales, zonas protectoras, parques nacionales, refugios de vida silvestre y reservas biológicas, conformando así el patrimonio forestal; para poder colonizarlas o enajenarlas se requiere autorización legislativa, y cuando son poseídas por terceros, éstos no adquieren ningún derecho, siendo imprescriptible el derecho del Estado para reivindicar; de acuerdo con la regulación vigente el aprovechamiento en reservas nacionales solo se puede practicar mediante concesión otorgada por el Estado; el aprovechamiento del recurso forestal en terrenos de propiedad privada no excluye estas tierras del patrimonio forestal del Estado; el patrimonio forestal del Estado es aplicable a todos los bienes nacionales donde existan recursos naturales forestales; en las tierras donde existan recursos naturales, para poder explotar los recursos maderables los privados deben elaborar planes técnicos forestales y obtener concesiones a largo plazo; el Estado otorga una serie de incentivos para el manejo y reglamentación de los bosques y terrenos forestales de dominio particular; en cuanto a los parques nacionales y reservas biológicas, El Poder Ejecutivo está facultado para incluir dentro de sus límites las fincas o partes de fincas particulares necesarias para lograr sus objetivos, y esos terrenos serán adquiridos por compra o expropiación; para la creación de reservas forestales, zonas protectoras y refugios de vida silvestre, el Estado deberá comprar, expropiar, salvo que, a requerimiento de la Dirección General Forestal, sus propietarios acepten someterse al régimen forestal respectivo; los bosques y terrenos de aptitud forestal son de utilidad pública y -en consecuencia- susceptibles de expropiación, salvo los sometidos voluntariamente al régimen forestal; los bosques y terrenos de aptitud forestal que constituyen las áreas forestales públicas y las privadas están sometidos al respectivo plan de manejo, para su conservación y fomento; la normativa forestal establece un régimen especial aplicable a todos los recursos forestales; las reservas nacionales están sometidas de derecho al régimen porque pertenecen al Estado; solo procede la expropiación cuando se trata de bienes privados que se afectan para conformar parques nacionales, reservas forestales o biológicas, bosques o terrenos forestales; en las fincas de propiedad privada para poder constituir la propiedad forestal necesariamente su titular debe someterse voluntariamente al régimen jurídico establecido por la ley, específicamente a las limitaciones de interés social impuestas a la propiedad; para la creación de zonas protectoras en fincas sometidas a régimen privado, la ley somete a las mismas a un régimen forestal obligatorio, limitado a efectuar labores agrícolas o destrucción de vegetales -salvo autorización expresa- con las mismas ventajas otorgadas a los privados sometidos voluntariamente al régimen (véanse sentencias de la Sala Primera de la Corte Suprema de Justicia número 189 de las 10:20 horas del 30 de octubre de 1991 y 51 de las 15:15 horas del 26 de mayo de 1995).

De dicho análisis, se desprende que existen bienes con aptitud forestal capaz de ser parte de dominio de particulares y que cumplen un fin de utilidad público, por eso sometidos a un régimen especial de conservación en manos del administrado y son esos bienes precisamente a los que se refiere el numeral 7 párrafo segundo de la Ley de Informaciones Posesorias, pero éstos no pueden incluir a los bienes constitutivos de reservas nacionales porque estos están sujetos al régimen especial de demanio público que se encuentre fuera del comercio de los hombres, y la única forma de enajenación es mediante la desafectación dada por el legislador, es decir, su aprovechamiento por el régimen al que pertenece solo es posible por la figura de la concesión, pero resulta inadmisible el régimen de propiedad privad. De ahí que la existencia de una posesión como la alegada por el demandado no genera derecho alguno sobre el mismo, y en consecuencia tampoco podría pensarse que este prescrito el derecho del Estado de pretender su reivindicación, por cuanto en esencia el bien, no puede ajustarse a ningún plazo de prescripción en ninguna de sus dos variables sea positiva a efectos de ser usucapido o negativo a efectos de limitar el derecho de reivindicación del mismo en manos del Estado.

En esa lógica resulta inatendible el argumento del demandado al señalar que la acción de lesividad se encuentra caduca por tratarse de un bien de naturaleza privada, por cuanto como se indicó al derivarse la titulación del bien de una reserva nacional, no existía posesión válida capaz de consolidar un derecho de propiedad como el que se reclama. Cabe advertir que igualmente por la naturaleza y vocación de estos bienes tal como se señaló en los considerandos anteriores, y sus características al ser inalienable, imprescriptible e inembargable, no resulta atinente la postura de la representación de la sociedad demandada, respecto a que no le resulta oponible la nulidad reclamada bajo el principio de publicidad registral y lo indicado en los numerales 455, 456 y 457 del Código Civil, posición que no puede ser atendida, para analizar el derecho y procedencia de la acción de lesividad, por cuanto, la naturaleza del bien es la base del criterio de lesividad, y esa naturaleza se encontraba conformada previo a la misma constitución de la inscripción registral del inmueble, ergo, es el sustrato fáctico que le da sentido u origen a la matrícula como acto representativo de dominio, al identificarse que dicho sustrato es de naturaleza pública, vacía de contenido el derecho real privado creado erróneamente, sin que sea posible, como lo pretende el demandado, que se mantenga la inscripción al amparo de la publicidad registral, siendo por ello imposible la existencia de una identificación inmobiliaria privada, con un contenido de demanio público.

En todo caso, si bien nuestro sistema de derecho civil, protege la titularidad de los bienes adquiridos al amparo de la publicidad registral, tal criterio, no puede oponerse a la naturaleza de los bienes de carácter demanial, sobre todo en bienes como el discutido en este proceso, donde su vocación se remonta antes de la propia declaración de su condición en el año 1996 con la Ley Forestal, es decir no resulta válido que la posesión ejercida fuera trasmitida desde los años setenta como alegan los demandados, por cuanto su vocación tiene origen previo, en el tanto esa vocación es definida a estos bienes desde la existencia misma de ellos. Debe enfatizarse que la acción de lesividad ostenta una finalidad de reivindicación de ese dominio, en la medida en que la razón misma de la demanda, es la recuperación de un terreno que, siendo parte del régimen de demanialidad, se alega fue trasladado de manera ilegítima al régimen privado.

Ahora cabe agregar, que si bien las partes demandadas sostienen que el bien titulado a su favor y posteriormente trasmitido a un tercero, nunca fue parte de una reserva nacional, ni se ha demostrado que haya tenido características de Patrimonio Natural del Estado, tal argumentación resulta carente de toda prueba que así lo sustente, más que con su propio dicho, al no haberse acreditado prueba técnica que desvirtué la calificación dada por el ente competente para establecer esa calificación como es el Ministerio de Ambiente, a quien el legislador le concedió la tutela y administración de esos bienes, por lo que el testimonio del propio demandado no es suficiente para desacreditar la certificación que consta en autos. Además es claro de los autos que incluso el plano catastrado utilizado para la titulación del bien, así como la inspección realizada al efecto de aquel trámite, evidencian que el sitio se encuentra ubicado en montaña y que su constitución en forma completa es bosque, condiciones propias de un terreno forestal constituyente de Patrimonio Natural del Estado, que en todo caso como se indicó, su origen viene de la autorización de titulación de Reservas Nacionales, circunstancia que el demandado no logra desacreditar, y es que debe insistirse, la transmisión del bien por compra venta no desvirtúa aquella característica de demanialidad como se explicó.

Por otra parte, con lo que analizamos tenemos que este bien cumple con los requisitos para que se encuentre incorporado al demanio público, en su elemento subjetivo, su administración recae en manos del Estado a través del Ministerio de Ambiente, en cuanto al elemento objetivo, tenemos que se trata de un bien inmueble que es susceptible de integrar el demanio público, calificación que es de orden técnico y es aportada al expediente, al existir en los autos la certificación SINAC-DS-OFAY-C-3125-2003 en la cual se certifica de parte del Ministerio de Ambiente y Energía del Sistema Nacional de Áreas de Conservación, que: "Efectuado el estudio en las hojas cartográficas respectivas del mapa básico de Costa Rica escala 1:50.000, se ha determinado con base en la ubicación consignada en el plano catastrado número P-862160-2003 a nombre de I.D.A. en posesión de MARVIN PORRAS SÁNCHEZ, que este describe un inmueble que se ubica FUERA DE CUALQUIER ÁREA SILVESTRE PROTEGIDA SEA CUAL SEA SU CATEGORÍA DE MANEJO ADMINISTRADA POR EL MINISTERIO DEL AMBIENTE Y ENERGÍA.

SIN EMBARGO, CONSTITUYE PATRIMONIO NATURAL DEL ESTADO SEGÚN ARTÍCULOS 13, 14 y 15 DE LA LEY FORESTAL 7575 DEL 16 DE ABRIL DE 1996". Además, el elemento normativo como requisito de bien demanial se configura como lo indicamos en el numeral 13 y 14 de la Ley Forestal y cumple con un fin, el cual es garantizar el derecho constitucional a un ambiente sano y ecológicamente equilibrado. Cabe advertir, que es precisamente la existencia de esa certificación indicada, la cual fue presentada por el propio demandado para cumplir con los requisitos de titulación que exigía el Reglamento de Titulación de Reservas Nacionales que se origina un vicio en el acto, en el tanto, esa certificación indicaba la preexistencia de una condición que imposibilitaba la titulación en los términos de aquel reglamento y que constituye un vicio de nulidad absoluto, en el elemento motivo, que no es posible de ser subsanado como lo alega la sociedad demandada, en el entendido, que se trata de una condición indispensable y que no es posible de subsanar o convalidar, consecuentemente, tal vicio es suficiente para la declarar la nulidad de ese acto de titulación, más allá de la ausencia de cualquier otro requisito, de aquel acto de naturaleza reglado, al ser tan grosero el vicio expuesto, que la existencia en si misma de esa condición hace que la acción de lesividad sea procedente, al ser sin duda el inmueble objeto del proceso, parte del demanio público.

Así las cosas, resulta procedente, declarar con lugar la demanda con respecto a la declaratoria de nulidad del acuerdo expuesto en el artículo 39 de la sesión 31-04 del 23 de agosto del 2004 ,de la Junta Directiva del Instituto de Desarrollo Agrario, en el cual se dispuso: "En cumplimiento a las políticas institucionales y con la recomendación de la oficina Regional de Parrita según oficio OSP-163-04 y el visto bueno de la Dirección Regional Central según oficio S/N y la revisión de los requisitos exigidos para el trámite de titulación por parte del Coordinador Agrario Regional y de conformidad con el acuerdo de Junta Directiva descrito en el Articulo XXI, Sesión 065-00 de 11 de setiembre del 2000, y habiéndose cumplido con todos los requisitos que establece el Reglamento para la titulación de tierras en reservas nacionales publicado en el diario oficial La Gaceta 173 del 10 de setiembre del 2002, al amparo de la ley de Tierras y Colonización 2825 del 14 de octubre de 1961 y la Ley de creación del Instituto de Desarrollo Agrario 6735 del 29 de marzo de 1982 se autoriza segregar y traspasar la parcela para el título supletorio de dominio a Marvin Porras Sánchez cédula 1-427-886, la finca descrita en el plano 862160-2003”.

Por conexidad se anula la materialización de dicho acuerdo mediante escritura pública número ciento uno otorgada ante el Notario Público Luis Enrique Wong Sánchez, en el cual se titula la inscripción de la parcela 19297045 a nombre de Marvin Porras Sánchez, la cual se encuentra inscrita con el número de finca 139717-000 del Partido de Puntarenas, así como la escritura pública número 186 otorgada ante la Notaria Pública Gladys Marín Villalobos, en la cual Marvin Porras Sánchez traspasa la propiedad inscrita con número 139717-000 del Partido de Puntarenas a favor de Palacios y Paraísos Tropicales la Selvita Sociedad Anónima y por ende su respectiva inscripción. Por otra parte, es importante advertir que la representación de la sociedad demandada alega que por disposición del numeral 144 de la Ley General de la Administración Pública, debe indemnizarse su condición de adquirente de buena fe, no obstante, no formuló tal pretensión como procesalmente corresponde, vía contrademanda, lo que imposibilita analizar ese extremo, ante la ausencia de la ritualidad procesal, en garantía del derecho de defensa y debido proceso.

Y es que debe aclararse que el numeral referido en la Ley General de la Administración Pública expone una causa de responsabilidad de la Administración, pero la misma no surge de forma automática, debe accionarse el derecho, acción en que se deberá demostrar además el cumplimiento de lo dispuesto en los ordinales 190 y siguientes de la Ley General de la Administración Pública. Con base en lo analizado, concluye este Tribunal que el acto impugnado es lesivo a los intereses públicos y sustancialmente disconforme con el ordenamiento jurídico. Por ello, de conformidad con los artículos 11, 128, 131, 132, 133, 158, 166, 169 y 171 de la Ley General de la Administración Pública, deberá declararse nulo el acuerdo establecido en el artículo 39 de la sesión 31-04 del 23 de agosto del 2004 de la Junta Directiva del Instituto de Desarrollo Agrario, que dispuso: "En cumplimiento a las políticas institucionales y con la recomendación de la oficina Regional de Parrita según oficio OSP-163-04 y el visto bueno de la Dirección Regional Central según oficio S/N y la revisión de los requisitos exigidos para el tramite de titulación por parte del Coordinador Agrario Regional y de conformidad con el acuerdo de Junta Directiva descrito en el Articulo XXI, Sesión 065-00 de 11 de setiembre del 2000, y habiéndose cumplido con todos los requisitos que establece el Reglamento para la titulación de tierras en reservas nacionales publicado en el diario oficial La Gaceta 173 del 10 de setiembre del 2002, al amparo de la ley de Tierras y Colonización 2825 del 14 de octubre de 1961 y la Ley de creación del Instituto de Desarrollo Agrario 6735 del 29 de marzo de 1982 se autoriza segregar y traspasar la parcela para el título supletorio de dominio a Marvin Porras Sánchez cédula 1-427-886, la finca descrita en el plano 862160-2003.

Por conexidad se anula la materialización de dicho acuerdo mediante escritura pública número ciento uno otorgada ante el Notario Público Luis Enrique Wong Sánchez, en el cual se titula la inscripción de la parcela 19297045 a nombre de Marvin Porras Sánchez, la cual se encuentra inscrita con el número de finca 139717-000 del Partido de Puntarenas, así como la escritura pública número 186 otorgada ante la Notaria Pública Gladys Marín Villalobos, en la que Marvin Porras Sánchez traspasa la propiedad inscrita con número 139717-000 del Partido de Puntarenas a favor de Palacios y Paraísos Tropicales la Selvita Sociedad Anónima y por ende su respectiva inscripción. De conformidad con los artículos 171 de la Ley General de la Administración Pública y 131 del Código Procesal Contencioso Administrativo, esta declaración de nulidad absoluta tiene efectos declarativos y retroactivos a la fecha de vigencia de los actos anulados.

XII.Sobre las excepciones. Se formularon las excepciones de prescripción y caducidad, las cuales por las razones dadas resultan improcedentes, al tratarse de un bien perteneciente al demanio público, por lo que resulta imprescriptible su derecho y por ende la acción de lesividad no se encuentra sujeta al límite temporal previsto en la Ley Reguladora de la Jurisdicción Contenciosa Administrativa. Respecto a la falta de derecho, la misma debe ser rechazada, ya que, por las razones explicadas, el acuerdo impugnado resulta absolutamente nulo, por cuanto adjudicó una parcela cuyo 100% de cabida pertenece al dominio público, razón por la cual no podía ser objeto de titularidad a favor de sujetos privados y tal y como se indicó en los considerandos anteriores, el procedimiento de lesividad llevado a cabo es conforme al ordenamiento jurídico y cumple a cabalidad con todos sus presupuestos.

XIII.Sobre las costas procesales y personales. De conformidad con el numeral 193 del Código Procesal Contencioso Administrativo, las costas procesales y personales constituyen una carga que se impone a la parte vencida por el hecho de serlo. La dispensa de esta condena solo es viable cuando hubiere, a juicio del Tribunal, motivo suficiente para litigar o bien, cuando la sentencia se dicte en virtud de pruebas cuya existencia desconociera la parte contraria. En la especie, estima el Tribunal que existe motivo suficiente para aplicar las excepciones que fija la normativa aplicable, ya que los accionados fueron traídos al proceso en razón de la nulidad que creó derechos subjetivos mediante el acto favorable que es el que se ha anulado en esta causa, lo que permite estimar que existe mérito para litigar, ya que la Administración es quien les indujo a error, al emitir un acto declarativo de derechos contrario al ordenamiento jurídico, por lo que se resuelve este asunto sin especial condena en costas.

POR TANTO

Se rechazan las defensas de caducidad, prescripción y falta de derecho. En consecuencia, se declara con lugar la demanda y se dispone: 1. La nulidad del artículo 39 de la sesión 31-04 del 23 de agosto del 2004 de la Junta Directiva del Instituto de Desarrollo Agrario, que autoriza segregar y traspasar la parcela para el título supletorio de dominio a Marvin Porras Sánchez cédula 1-427-886, la finca descrita en el plano 862160-2003. 2. Por conexidad se anula la escritura pública número ciento uno otorgada ante el Notario Público Luis Enrique Wong Sánchez, en el cual se titula la inscripción de la parcela 19297045 a nombre de Marvin Porras Sánchez, la cual se encuentra inscrita con el número de finca 139717-000 del Partido de Puntarenas. 3. Por conexidad se anula la escritura pública número 186 otorgada ante la Notaria Pública Gladys Marín Villalobos, donde Marvin Porras Sánchez traspasa la propiedad inscrita con número 139717-000 del Partido de Puntarenas a favor de Palacios y Paraísos Tropicales la Selvita Sociedad Anónima y por ende su respectiva inscripción.

De conformidad con los artículos 171 de la Ley General de la Administración Pública y 131 del Código Procesal Contencioso Administrativo, esta declaración de nulidad absoluta tiene efectos declarativos y retroactivos a la fecha de vigencia de los actos anulados. 4. Deberá comunicarse esta sentencia al Archivo Nacional y al Registro Nacional a efectos de las anotaciones respectivas en los protocolos y asientos indicados; así como para que, dentro del ámbito de sus competencias, dispongan las medidas que corresponda en Derecho a fin de garantizar el resguardo de los intereses públicos reconocidos en esta sentencia. Lo anterior se establecerá en fase de ejecución de sentencia. 5. Por existir causal eximente, se resuelve este asunto sin especial condena en costas.
