This Tribunal reviews the order declining jurisdiction (resolución inhibitoria) 2023000339, issued at nueve horas con cincuenta y cinco minutos on veintiocho de setiembre del año dos mil veintitrés.- Judge Darcia Carranza drafts the decision; and,

WHEREAS:

I.By order No. 2023000339, issued at nueve horas cincuenta y cinco minutos on veintiocho de setiembre de dos mil veintitrés, the court below declines jurisdiction over this matter, stating that the contract concerns the extraction of river materials and that the agrarian jurisdiction (jurisdicción agraria) therefore lacks jurisdiction to decide it.

II.Jurisdiction over agrarian matters is generally determined by Articles 1 and 2(h) of the Ley de Jurisdicción Agraria. The fundamental criterion for determining subject-matter jurisdiction (competencia en razón de la materia) is the agrarian production activity (actividad agraria de producción), whether animal husbandry or plant cultivation—conducted as business or subsistence activities—or related activities, as well as sustainable agro-environmental activities (actividades agroambientales sostenibles). The nature or suitability of the productive property and its size, as well as the persons participating in the agrarian proceeding as plaintiffs or defendants, have been established as supplementary criteria. The nature or suitability of the property is closely linked to agrarian holdings (fundos agrarios), incorrectly referred to in legislation as rural properties (predios rústicos), which are devoted, or are capable of being devoted, to productive agrarian activities or to forest conservation and the sustainable management of agro-environmental activities. Likewise, such persons qualify as “agrarian parties” (sujetos agrarios) because they engage in productive agrarian activities. The fundamental criterion is always the functional one—that is, the activity—to which both the objective and subjective criteria are referred.

III-. The present proceeding concerns claims seeking enforcement of a contract between private parties regarding the exploitation of soil—in this case, river material—which, of course, is covered by a concession. Pursuant to the provisions of section 56 of the Soil Use, Management and Conservation Law: “The Agrarian Courts shall have jurisdiction to hear and finally decide matters arising from the application of this law...” In this regard, the First Chamber of the Supreme Court of Justice has stated the following: “...In the present case, the claims seek enforcement of a contract entered into by the parties concerning a right of possession over property of an agrarian nature, which the plaintiff intends to exercise in order to carry out possible mining operations (quarry - open pit); an aspect that was established in the contract and which, pursuant to Article 56 of the Soil Use, Management and Conservation Law, falls within the jurisdiction of the specialized agrarian courts.

(Voto 456-2014 del 27/03/2014 de la Sala Primera de la Corte Suprema de Justicia). Likewise, in an earlier decision, the same Chamber had stated the following: “...The soil resource is protected by environmental law and agrarian law. The purpose of the Soil Management, Use and Conservation Law is the protection, conservation, and improvement of soils through integrated and sustainable management alongside other natural resources, by means of promotion and planning, with jurisdiction vested in the agrarian courts (Article 56 ibid.). It is under this understanding that this Chamber considers that mining operations on the property at issue in this matter must be brought before the specialized agrarian courts...” (Voto 562-2012 10/05/2012 de la Sala Primera). From the foregoing, it is clear and evident that the present matter must be heard by this specialized court, given that the Soil Use, Management and Conservation Law itself grants the Agrarian Jurisdiction subject-matter jurisdiction over disputes between private parties concerning the application of those provisions, as stipulated in section 56 of that law.

IV- The soil resource as an object protected by Environmental Law and Agrarian Law. Legislation protecting the environment arises from the need to safeguard the vital elements of the ecosystem against human actions that degrade the capacity of systems and their resources to perpetuate themselves. Within this body of legislation, Soil Management, Use and Conservation Law N. 7779 was enacted, whose purpose is the protection, conservation, and improvement of soils through integrated and sustainable management alongside other natural resources, by means of promotion and planning. That statute establishes obligations for State bodies and private parties, directing them to take effective and preventive action to protect the soil resource.

To that end, the State, through its Ministries and agencies, must apply the environmental principle of coordination of administrative powers in order to achieve the environmental protection established by this law. This is because the soil resource is an element subject to use and enjoyment by private parties in their various activities. Soil, or the fertile layer, as a complex component of the environment, may technically be defined by the following characterization: ‘The solid surface on which we walk and build cities and roads is called soil. Although it may not appear so at first glance, soil constitutes a natural, complex, and dynamic system in which multiple processes occur and numerous factors, both biotic and abiotic, are involved. Soil, a thin layer only a few centimeters deep, is formed through the continuous action of the aforementioned factors upon the parent rock. Thus, soil consists of materials resulting from the physical and chemical breakdown of surface rocks and of organic materials derived from the activity of millions of microorganisms, as well as plants and animals.

The processes through which soil forms are extremely slow: hundreds or thousands of years must elapse for 30 cm. of soil to mature. For this reason, we must understand that soil is a natural resource that is difficult to renew and that its conservation is essential’ (taken from http://www.oni.escuelas.edu.ar//2002/santiago_delestero/madre-fertil/explota.htm on 9 de mayo a las 10:45 horas del 2011). Like other elements such as the atmosphere, soil is not conceived of as public-domain property, but rather as an element that must be used rationally and sustainably. This means that activities carried out upon it must respect its structure and prevent its degradation. Among the resources degraded by the various activities of the human species, the fertile layer, or soil, is one of the most severely affected. Humanity as we know it today has arisen upon this element, and negative pressure has been exerted upon it throughout humanity’s entire existence.

This natural resource constituted the foundation of human civilization and has been regarded as the basic means of production within the economic systems of the most advanced societies throughout history. Through agriculture, humanity succeeded in exploiting the fertile-layer resource, thereby obtaining benefits that shaped the structure of the modern world. The human species’ constant dependence on land, manifested in the need to provide food and meet the other basic needs of all humanity, has led it to disregard the resource’s capacity for regeneration, without appreciating the fragility of its structure or the slowness of its formation and regeneration process. Accordingly, legal provisions have arisen that seek its protection through the actions of public and private parties, at both the international and national levels. In order to protect soil, our legal system contains Law 7.779, as stated above, and its Regulations, corresponding to decree number 29.375.

The latter, in its definitions, states that soil degradation is: ‘Deterioration of the chemical, physical, and biological characteristics of soil, with a decline in its productivity over time as a consequence of processes such as water or wind erosion, salinization, waterlogging, depletion of plant nutrients, contamination by slowly decomposing agrochemical products or heavy elements, deterioration of structure, compaction, sedimentation, and other forms of degradation,’ and defines soil as: ‘a natural body located on the earth’s surface, formed from a variable mixture of mineral and organic materials through the action over time of chemical, physical, and biological weathering factors, capable of sustaining the growth of plants and other living organisms, and susceptible to modification by human beings and natural events.’ It is within this conceptual framework that the protected object of the legislation governing the soil resource must be understood.

V-. The jurisdiction of the Agrarian Jurisdiction over matters concerning the soil resource and matters arising from the application of Law N. 7779. The emergence of Agrarian Law as a branch of law revolves around productive activity, and although new cultivation methods that do not require use of the soil resource or fertile layer are now emerging, its exploitation remains, for the most part, the foundation and support of agrarian activities throughout the world, and our national territory is no exception. With respect to the functional jurisdiction of this judicial forum to hear disputes arising from the application of the Soil Use, Management and Conservation Law and its regulations, Article 56 of that law states verbatim, insofar as relevant: ‘The Agrarian Courts shall have jurisdiction to hear and finally decide matters arising from the application of this Law. Accordingly, this court considers that even though State actors and private parties whose action is required converge in the enforcement of these provisions, the legislature reserved jurisdiction over the application of the law to the specialized agrarian courts because the protected object is fully connected to the object regulated and studied by Agrarian Law.

This situation is explained by the fact that the very foundation of this field of Law lies in agrarian production, whose traditional core is the use of land or the fertile layer, which constitutes an object specific to agrarian law and whose unifying object has been cultivation of the land. Following the Theory of Agrarianity set forth in agrarian legal scholarship, the body of rules governing this field was enacted. In this regard, section 1 of the Agrarian Jurisdiction Law provides: “Article 1.- Based on the provisions of Article 153 of the Political Constitution, the agrarian jurisdiction is hereby created as a special function of the Judicial Branch, with exclusive authority to hear and finally decide disputes arising from the application of agrarian legislation and the legal provisions governing activities involving the production, processing, industrialization, and transfer of agricultural products, in accordance with the following Article.

Thus, pursuant to Article 56 of the Soil Use, Management and Conservation Law and Article 1 of the Agrarian Jurisdiction Law, jurisdiction over this case lies with the specialized agrarian courts. In addition to the foregoing, in decision number 9928 of the Constitutional Chamber of the Supreme Court of Justice, issued at fifteen hours on nueve de junio de dos mil diez, when ruling on the public-employment regime, although it had been determined that jurisdiction lay with the contentious-administrative courts and not the labor courts, the Chamber analyzed the delimitation of the subject-matter jurisdiction of the Contentious-Administrative Jurisdiction and other jurisdictions, such as the labor and agrarian jurisdictions. In that decision, it modified the position that had previously been expressed by that High Court in several of its rulings and held: ‘on that occasion “... 3°) The derivative constituent authority, or amending power, established a constitutional reservation of the subject-matter jurisdiction of the contentious-administrative courts by providing that their purpose is to “guarantee the legality of administrative functions”; consequently, the ordinary legislature, in exercising its freedom to shape or configure the law, may not assign that jurisdiction to any judicial branch other than the contentious-administrative branch, because doing so would deprive the institutional guarantee and the fundamental right enshrined in Article 49 of the Constitution of their substance.

On this particular point, and upon better consideration, this Constitutional Court changes or reverses the position set forth in Votos Nos. 3095-94 de las 15:57 hrs. de 3 de agosto de 1994, 7540-94 de las 17:42 hrs. de 21 de diciembre ambos de 1994, 5686-95 de las 15:39 hrs. de 18 de octubre de 1995 y 14999-2007 de las 15:06 hrs. de 17 de octubre de 2007.

The foregoing means that when a litigant (justiciable) brings a claim (pretensión) challenging the invalidity of, or substantial nonconformity with, the administrative legal order (ordenamiento jurídico-administrativo) of administrative conduct (conducta administrativa) or any individual manifestation of the administrative function (función administrativa)—whether a formal or material omission, formal activity, material action, or administrative legal relationship (relación jurídico-administrativa)—the contentious-administrative jurisdiction (jurisdicción contencioso-administrativa) must, without exception, hear and adjudicate it.” The foregoing entails that the Contentious-Administrative Jurisdiction (Jurisdicción Contenciosa Administrativa) has jurisdiction to review the legality of administrative acts (actos administrativos), which is also subject to criteria relating to the substantive content of the claim; other jurisdictions may have jurisdiction over the proceeding, provided that the matter does not concern solely substantial conformity or nonconformity with the administrative function or conduct.

In the case at bar (subjúdice), the substantive legal subject matter of this ordinary proceeding (ordinario) is defined by the relief sought in the complaint, which is aimed at establishing and quantifying the damages caused to the environment and, specifically, to the soil resource or fertile layer (recurso suelo o capa fértil), which are alleged to have resulted from the private defendants’ pineapple-growing activities; the plaintiffs also request that the defendants be ordered to halt such production until the competent Ministries issue a series of technical instruments required and established by law to ensure the rational use of the resource they consider to have been harmed or to be at risk of degradation. Retaining jurisdiction over this proceeding in the agrarian courts (sede agraria) does not conflict with the functions assigned by law to the Jurisdicción Contenciosa Administrativa, and the interests of the State will be safeguarded because the Ministerio de Ambiente, Energía y Telecomuncaciones, Ministerio de Salud, Ministerio de Agricultura and Procuraduría General de la República are parties.

Furthermore, environmental law is cross-cutting in nature, meaning that it affects all administrative and judicial fields, as well as the activities of private parties. All such spheres must manage their affairs with the environmental variable (variable ambiental) incorporated into them, and all persons residing within the national territory are obligated to endeavor to protect the environment and apply environmental legislation. Accordingly, the ground asserted in the objection for lack of jurisdiction (excepción de incompetencia)—namely, that because the State is a party, the proceeding must be referred to the Jurisdicción Contenciosa Adminsitrativa—is unavailing, since environmental matters fall within every area of law. Voto 460-C-2011 de las 11:01 del 10/05/2011). In view of the foregoing, the trial judge’s declination of jurisdiction (inhibitoria) is rejected.

THEREFORE:

The recusal ordered by the trial judge is denied. This matter shall be returned to the court of origin for further proceedings, unless otherwise precluded.

CONSIDERANDO:

I.Mediante resolución N° 2023000339 de las nueve horas cincuenta y cinco minutos del veintiocho de setiembre de dos mil veintitrés el juez ad quo se inhibe del conocimiento del presente asunto indicando se basa el contrato en al extracción de materiales de río, por lo que no le compete a la jurisdicción agraria resolver.

II.La competencia en materia agraria está determinada en forma genérica por los artículos 1 y 2 inciso h) de la Ley de Jurisdicción Agraria. El criterio fundamental para determinar la competencia en razón de la materia es el de la actividad agraria de producción, sea de cría de animales o cultivo de vegetales (actividades empresariales o de subsistencia), o cuando se trate de actividades conexas, así como actividades agroambientales sostenibles. Como criterios complementarios, se han establecido, la naturaleza o aptitud del bien productivo, así como su extensión, y los sujetos que participan dentro del proceso agrario como actores o demandados. La naturaleza oaptitud del bien está estrechamente vinculada a los fundos agrarios (denominados incorrectamente por la legislación como predios rústicos), dedicados o que sean susceptibles de destinarse al ejercicio de actividades agrarias productivas, o a la conservación de bosques y manejo sostenible de actividades agroambientales. Los sujetos, igualmente, adquieren su calificativo de "sujetos agrarios", por su dedicación al ejercicio de actividades agrarias productivas. El criterio fundamental es siempre el funcional, es decir, la actividad, al cual son reconducidos los criterios tanto objetivos como subjetivos.

III-. En el presente proceso se trata de pretensiones tendientes al cumplimiento de un contrato entre particulares sobre la explotación del suelo en este caso material de río, el cuenta desde luego con concesión. Conforme a lo establecido por el ordinal 56 de la Ley de Uso, Manejo y Conservación de Suelos: "Corresponde a los Tribunales Agrarios conocer y resolver definitivamente, los asuntos originados en la aplicación de la presente ley..." . En dicho sentido la Sala Primera de la Corte Suprema de Justicia a indicado lo siguiente: "...En el presente caso, se está en presencia de pretensiones tendentes al cumplimiento de un contrato suscrito por las partes sobre un derecho de posesión de un inmueble de naturaleza agraria, que pretende materializar la actora para desarrollar una eventual explotación minera (cantera - tajo); aspecto que quedó establecido en el contrato, y que de acuerdo al artículo 56 de la Ley de Uso Manejo y Conservación de Suelos, refiere su conocimiento a la jurisdicción especializada agraria.

(Voto 456-2014 del 27/03/2014 de la Sala Primera de la Corte Suprema de Justicia). Igualmente en un voto anterior a este la misma Sala había indicado lo siguiente: "...El recurso suelo es tutelado por el derecho ambiental y del derecho agrario. La Ley de Manejo, Uso y Conservación de Suelos tiene como finalidad la protección, conservación y mejoramiento de los suelos en una gestión integrada y sostenible con los demás recursos naturales, mediante el fomento y planificación, siendo competente la jurisdicción agraria (artículo 56 ibídem). Es bajo esta inteligencia que estima esta Cámara, que la explotación minera del inmueble objeto de este asunto, debe residenciarse en la sede especializada agraria..." (Voto 562-2012 10/05/2012 de la Sala Primera). De lo anteriormente expuesto resulta claro y evidente, el presente asunto debe ser conocido en esta sede especializada, dado la misma Ley de Uso, Manejo y Conservación de Suelos, le otorga la competencia material para la discusión sobre conflictos privados, en cuanto a la aplicación de dicha normativa, a la Jurisdicción Agraria conforme lo estipula el ordinal 56 de dicha ley.

En igual sentido puede verse Voto de este Tribunal N° 460-C-2011 de las 11:01 horas del 10 de mayo de 2011, en el cual se anliza la competencia de los Tribunales Agrarios: "... IV- Sobre el recurso suelo como objeto de tutela del derecho Ambiental y del derecho Agrario. Las legislaciones tutelares del ambiente, surgen debido al necesidad de resguardar los vitales elementos del ecosistema de las acciones humanas, que degradan la capacidad de perpetuación de los sistemas y sus recursos. Dentro de complejo normativo, se emite la Ley de Manejo, Uso y Conservación de Suelos N. 7779, que tiene como finalidad la protección, conservación y mejoramiento de los suelos en una gestión integrada y sostenible con los demás recursos naturales, mediante el fomento y planificación.Dicha norma legal establece obligaciones a los órganos del Estado y a los particulares, que reconducen a la toma de acciones efectivas y preventivas para la pretección del recurso suelo.

Para ello, el Estado a través de sus Ministerios y dependencias deberá aplicar el principio ambiental de la coordinación de competencias administrativas, para el logro de la protección ambiental establecido en esta ley. Lo anterior obedece a que el recurso suelo es un elemento sujeto al uso y disfrute de particulares en sus diversas acciones. El suelo o capa fértil como compenente complejo de ambiente, puede definirse técnicamente desde la siguiente caracterización: " La superficie sólida sobre la que caminamos, construimos ciudades y caminos, se denomina suelo. Aunque a simple vista no lo parezca, el suelo constituye un sistema natural, complejo y dinámico, donde se desarrollan múltiples procesos e intervienen numerosos factores, tanto bióticos como abióticos. El suelo, capa delgada de unos cuantos centímetros de profundidad, está formada por la actividad permanente de los factores que mencionábamos anteriormente sobre la roca madre.

Es así que el suelo está compuesto por materiales que provienen de la desintegración física y química de las rocas superficiales y por materiales orgánicos derivados de la actividad de millones de microorganismos e incluso también de plantas y animales. Los procesos por los cuales se forma el suelo son extremadamente lentos: para poder obtener 30 cm. de suelo es necesario que transcurran cientos o miles de años para su maduración. Es por esto que debemos saber que el suelo es un recurso natural difícilmente renovable, y se hace indispensable su conservación" (tomado de http://www.oni.escuelas.edu.ar//2002/santiago_delestero/madre-fertil/explota.htm el 9 de mayo a las 10:45 horas del 2011). Al igual que otros elementos tales como la atmósfera, el suelo no es concebido como un bien demanial, sino como un elemento del cual se debe hacer un uso racional y sostenible. Lo anterior significa que las actividades que se realicen en él, deben respetar su estructura y evitar su degradación.

Dentro de los recursos que han sido degradados por las diversas actividades de la especie humana, la capa fértil o suelo es de los más afectados. Es este elemento sobre el cual se ha erigido la humanidad, tal y como se le conoce actualmente y sobre el mismo se ha ejercido una presión negativa a lo largo de toda su existencia. Este recurso natural, constituyó la base de la civilización humana y ha sido concebido como el medio de producción básico del sistema económico de las sociedades más avanzadas a lo largo de la historia. Mediante la agricultura la humanidad logró explotar el recurso capa fértil, obteniendo con ello beneficios que moldearon la estructura del mundo moderno. La constante dependencia de la especie humana con la tierra, manifestada en la necesidad de proveer alimento y demás necesidades básicas a toda la humanidad, lo ha llevado a desconocer la capacidad de regeneración del recurso, sin valorar la fragilidad de su estructura y la lentitud de su proceso de formación y regeneración.

Por ello, ha nacido las normativa legal que procura su protección con el actuar de sujetos públicos y privados, tanto a nivel internacional como nacional. Nuestro ordenamiento jurídico, en aras de tutelar el suelo, contiene la Ley 7.779 como fue indicado, y su Reglamento, que corresponde al decreto número 29.375. Este último en sus definiciones, reza que la degradación del suelo es el: " Deterioro de las características químicas, físicas y biológicas del suelo, con disminución de su productividad en el tiempo, como consecuencia de procesos tales como erosión hídrica o eólica, salinización, anegamiento, agotamiento de los elementos nutritivos para las plantas, contaminación con productos agroquímicos de lenta descomposición o elementos pesados, el deterioro de la estructura, compactación, sedimentación y otras formas de degradación ", y como suelo entiende: "cuerpo natural localizado en la superficie de la tierra, formado a partir de una mezcla variable de materiales minerales y orgánicos, mediante la acción de factores de meteorización, químicos, físicos y biológicos en el tiempo, capaz de sustentar el crecimiento de las plantas y otros seres vivos, y susceptible de modificaciones por el ser humano y por eventos naturales." Es dentro de ese marco conceptual, que debe ser entendido el objeto tutelado de la normativa del recurso suelo.

V-. Sobre la competencia de la Jurisdicción Agraria en el conocimiento de materia del recurso suelos y de los asuntos originados en la aplicación de la Ley N. 7779. El nacimiento del Derecho Agrario como rama jurídica, gira en torno a la actividad producción, y si bien actualmente surgen nuevas modalidades de cultivos que no requieren el uso del recurso suelo o la capa fértil, mayoritarimente su explotación es la base y sostén de las actividades agrarias del mundo entero y nuestro territorio nacional, no es la excepción. En cuanto a la competencia funcional de esta vía jurisdiccional para conocer conflictos originados en la aplicación de la Ley de Uso, Manejo y Conservación de Suelos y su reglamento, el artículo 56 de dicha ley reza textualmente en lo que interesa: " Corresponderá a los Tribunales Agrarios conocer y resolver, definitivamente, los asuntos originados en la aplicación de la presente Ley.

Por ello, estima esta sede, que aún y cuando en el cumplimiento de dicha normativa convergen actores estatales y sujetos privados que deben actuar, el legislador reservó el conocimiento de la aplicación de la ley a la sede especializada agraria debido al objeto que se tutela que esta vinculando plenamente con el objeto de regulación y estudio del Derecho Agrario. Dicha situación se explica en que el fundamento mismo de esta materia del Derecho, se encuentra a partir de la producción agraria cuyo núcleo tradicional es el uso de la tierra o capa fértil, constituyéndose un objeto propio del derecho agrario y cuyo objeto unificador ha sido el cultivo de la tierra. Siguiendo la Teoría de la Agrariedad expuesta por la doctrina agrarista, se emite el conjunto de normas que rigen esta materia. Al respecto, el numeral 1 de la Ley de la Jurisdicción Agraria dispone: “Artículo 1.- Con fundamento en lo dispuesto por el artículo 153 de la Constitución Política, créase la jurisdicción agraria, como función especial del Poder Judicial, a la que corresponderá, en forma exclusiva, conocer y resolver definitivamente sobre los conflictos que se susciten, con motivo de la aplicación de la legislación agraria y de las disposiciones jurídicas que regulan las actividades de producción, transformación, industrialización y enajenación de productos agrícolas de conformidad con lo dispuesto en el artículo siguiente.

De tal forma, según lo regula el artículo 56 de la Ley de Uso, Manejo y Conservación de Suelos, y el artículo 1 de la Ley de Jurisdicción Agraria, el conocimiento de esta causa le corresponde a la sede especializada agraria. Aunado a lo anterior, en el voto de la Sala Constitucional de la Corte Suprema de Justicia número 9928 de las quince horas de nueve de junio de dos mil diez, al pronunciarse sobre el régimen de empleo público, a pesar haberse dispuesto correspondía a los tribunales contenciosos su conocimiento y no a los laborales, analizó sobre la delimitación de la competencia material de la Jurisdicción Contenciosa Administrativa y otras jurisdicciones como la laboral y la agraria. En tal resolución, se modificó el criterio que venía siendo externado por ese alto Tribunal, en varios de sus pronunciamientos y resolvió: " en esa oportunidad "... 3°) El constituyente derivado o poder reformador estableció una reserva constitucional de la competencia material de la jurisdicción contencioso-administrativa al estatuir que su objeto es “garantizar la legalidad de la función administrativa”, razón por la cual el legislador ordinario, en el ejercicio de su libertad de conformación o configuración, no puede atribuirle esa competencia a otro orden jurisdiccional que no sea el contencioso-administrativo, puesto que, de ser así, estaría vaciando de contenido la garantía institucional y el derecho fundamental que consagra el artículo 49 de la Constitución.

Sobre este punto en particular y, bajo una mejor ponderación, este Tribunal Constitucional varía o revierte la tesis expuesta en los Votos Nos. 3095-94 de las 15:57 hrs. de 3 de agosto de 1994, 7540-94 de las 17:42 hrs. de 21 de diciembre ambos de 1994, 5686-95 de las 15:39 hrs. de 18 de octubre de 1995 y 14999-2007 de las 15:06 hrs. de 17 de octubre de 2007. Lo anterior significa que cuando un justiciable deduce una pretensión para cuestionar la invalidez o disconformidad sustancial con el ordenamiento jurídico-administrativo de una conducta administrativa o cualquier manifestación singular de la función administrativa (omisión formal o material, actividad formal o actuación material o relación jurídico-administrativa), debe conocerla y resolverla, indefectiblemente, la jurisdicción contencioso-administrativa.” Lo anterior conlleva que será de competencia de la Jurisdicción Contenciosa Administrativa, la revisión de la legalidad de actos administrativos la cual también esta sujeta, a criterios relacionados con el contenido material de la pretensión, pudiendo otras jurisdicciones ostentar competencia sobre proceso, siempre que no medie solamente la conformidad o disconformidad sustancial con la función o conducta administrativa.

En el subjúdice, el objeto jurìdico material de este ordinario, se define por la pretensión de la demanda que se dirige a establecer y cuantificar daños y perjuicios ocasionados al ambiente y en forma específica al recurso suelo o capa fértil, que aducen han sido producidos por la actividad de los sujetos privados demandados, que consiste en el cultivo de la piña, y se pide se les ordene detener tal producción, hasta tanto los Ministerios competentes emitan una serie de instrumentos técnicos necesarios y establecidos por Ley, para lograr el uso racional del recurso que consideran lesionado o con peligro de degradación. Mantener el conocimiento de este proceso en sede agraria, no riñe con las funciones dadas por ley a la Jurisdicción Contencioso Administrativa y los intereses del Estado serán resguardados, al tener como parte al Ministerio de Ambiente, Energía y Telecomuncaciones, Ministerio de Salud, Ministerio de Agricultura y Procuraduría General de la República.

Por otra parte, la materia ambiental es de carácter transversal, lo cual conlleva a afectar a todos los ámbitos administrativos, judiciales y las actividades de los particulares. Todos esos espacios deben gestionar sus asuntos con la variable ambiental incorporada en ellos y es obligación de todas las personas que habitan el territorio nacional, procurar el resguardo del ambiente y aplicar la legislación ambiental. Por ello, no resulta de recibo el motivo de la excepción de incompetencia, cuando se indica que al mediar como parte el Estado, debe remitirse el proceso al la Jurisdicción Contenciosa Adminsitrativa, pues la materia ambiental le compete a todas las áreas del Derecho. Voto 460-C-2011 de las 11:01 del 10/05/2011). En razón de lo expuesto se rechaza la inhibitoria decretada por el juzgador de instancia.

POR TANTO:

Se rechaza la inhibitoria decretada por el juzgador de instancia. Devuélvase el presente asunto al juzgado de origen para que continué con su tramitación si otra causa no lo impide.
