Res. 03305-2023 Tribunal Contencioso Administrativo · Tribunal Contencioso Administrativo · 13/09/2023
OutcomeResultado
The appeal is denied; the Municipality's decision rejecting the requested permits is confirmed, as they are reproductive acts of previously consented ones and, in any case, due to a complete lack of technical-environmental studies for a project with potential serious impact.
SummaryResumen
The Administrative Court denied an appeal by Parque Industrial JATEO S.A. against the Municipality of Mora's refusal to grant road alignment and stormwater drainage permits for a landfill project. The court held that the challenged acts merely reproduced previous decisions that had been tacitly accepted, rendering them unreviewable. It also found that the municipal solid waste regulation had been duly published, rejecting the claim of ineffectiveness. More importantly, the court emphasized the complete lack of technical and environmental studies supporting the project. Citing the preventive and precautionary principles of international environmental law and constitutional jurisprudence on the right to a healthy environment, the judge ruled that in the face of uncertainty regarding the environmental impacts of a landfill, the permits could not be granted without adequate technical justification.

Thus, regardless of any discussion about whether we are in the presence of consented acts, acts that reproduce previous acts, or whether the Public Service Regulation for Integrated Solid Waste Management of the Canton of Mora was correctly published, sound rational criticism under its vectors of science, experience, and logic leads this judge to see that there are insufficient technical criteria in the record—criteria that were not even known or discussed—aimed at understanding the environmental sustainability of permits or municipal licenses related to the construction of a landfill. All of this creates a situation of uncertainty that is regulated by the Rio Summit, under the Preventive Principle, with deep constitutional roots as cited above, which guides the legal operator, who judges this case, to deny the specific request to grant the required licenses to the respective local government. (...) As for the grievances that were addressed in this resolution, the administrative process is hereby deemed exhausted, as ordered.

IMPROPER HIERARCHICAL APPEAL (Municipal) PLAINTIFF:
PARQUE INDUSTRIAL JATEO SA DEFENDANT:
MUNICIPALIDAD DE MORA No. N° 2023003305 ADMINISTRATIVE AND CIVIL COURT OF THE TREASURY, SECOND JUDICIAL CIRCUIT, SAN JOSÉ, GOICOECHEA, at nineteen hours and twenty-two minutes on the thirteenth of September, two thousand twenty-three.- This Court hears, in its capacity as non-hierarchical reviewer of legality, the appeal filed by Mario Esteban Sánchez Sibaja, identity card 1-0817-0765, as general attorney-in-fact without limitation as to amount for Paque Industrial JATEO S.A., corporate identification number 3-101-295773, against resolution AMR-047-2020 issued at 11:00 hours on May 15, 2020, by the Office of the Mayor of the Muncipalidad de Mora.
WHEREAS:
I- Admissibility of the appeal:
On May 22, 2020, the challenged resolution was served by email. This means that, pursuant to the rules contained in Article 38 of the Judicial Notice Act, the moving party could file the appeal through June 01, 2020. Therefore, upon verifying in image 203 of the court case file that the appeal against resolution AMR-047-2020 of May 15, 2020, issued by the Office of the Mayor of the Muncipalidad de Mora, bears a receipt stamp dated May 29, 2020, it is concluded that it was timely filed, and the appeal is therefore admissible.
II-) Procedural background:
1-) The case originated in applications submitted by the claimant in the administrative proceeding to obtain a stormwater discharge permit (permiso de desfogue) and road alignment (alineamiento vial), filed on May 17, 2018 (See appeal).
2-) The applications identified in the preceding paragraph were stayed by official letters DIG-019-18 and DDCU-13-2018 of May 23, 2018, pending the Administrative Court’s consideration of an appeal, also filed by the moving party, concerning official letters AMR-18-2017 of June 27, 2017, and ARM-2017 of September 08, 2017 (See appeal).
3-) On February 18, 2020, after the Administrative Court issued decision 611-2019, the moving party again requested consideration of the May 17, 2018 applications concerning road alignment and stormwater discharge.
4-) By resolution DDCU-011-2020 dated March 04, 2020, the Department of Urban Development and Control and the Road Management Unit denied the applications of May 17, 2018 (See appeal).
5-) On March 09, 2020, the moving party filed a motion for reconsideration with a subsidiary appeal (recurso de revocatoria con apelación en subsidio) against resolution DDCU-011-2020 dated March 04, 2020 (See appeal in images 181 to 188 of the court case file).
6-) By resolution DDCU-035-2020 dated April 13, 2020, the Department of Urban Development and Control and the Road Management Unit denied the motion for reconsideration on the merits, while correcting a clerical error in which it had been stated that the applications concerned a land-use (uso de suelo) matter instead of road alignment and water discharge. (See appeal and resolution appearing in images 189 to 191 of the court case file).
7-) On May 22, 2020, resolution AMR-047-2020 of the Office of the Mayor of Mora was served, denying the appeal of March 09, 2020. In essence, that resolution determined that: in resolution 611-2019 issued at 09:15 hours on November 27, 2019, the Administrative Court affirmed all acts issued by the Office of the Mayor of Mora; with respect to the circumstances addressed in resolution 611-2019, it considered that the factual framework had not changed and that the facts were being repeated in the context of an acquiesced act (acto consentido), because the affected party had not appealed or challenged the act within the applicable time limit and through the proper channels; disputing the validity of the Public Service Regulations for the comprehensive management of solid waste in the canton of Mora was not a new fact, nor was it a circumstance previously alleged among the facts addressed in resolution 611-2019; it stated that the Public Service Regulations for the comprehensive management of solid waste in the canton of Mora were published in La Gaceta number 72 of April 16, 2013, pages 33 to 39; and in La Gaceta number 122 of June 26, 2013, page 64 (See appeal and resolution appearing in images 194 to 198 of the court case file).
8-) On May 29, 2020, the moving party filed a motion for reconsideration with a subsidiary appeal against resolution AMR-047-2020 of May 15, 2020, alleging as grounds of error (agravios) that: there are new facts relative to those adjudicated by this Court in resolution 2019-611, issued in case file 18-004025-1027-CA, and these are not acts repeating earlier acts; the Regulations Governing the Public Service for the Comprehensive Management and Utilization of Solid Waste in the Canton of Mora were being applied to it even though they had not been published in full in the Official Gazette, La Gaceta; this renders those regulations ineffective, emphasizing that, for the regulations to have legal effect, they must be published in the Official Gazette, rather than in SINALEVI, and asserting violations of Articles 11, 27, 30, 41 and 129 of the Political Constitution; Article 43 of the Municipal Code; and Article 240 of the General Public Administration Act; a situation that, in its view, causes it harm because consideration of its application cannot be made subject to a rule that has not been published in full in the Official Gazette.
Finally, in that appeal it requested that resolution AMR-47-2020 of May 15, 2020, be vacated and that the requested road-alignment and discharge authorizations of May 17, 2018, be granted; for that purpose, it requested that the Regulations for the Comprehensive Management and Utilization of Solid Waste in the Canton of Mota not be used as grounds, because it considered them an ineffective rule (See appeal in images 203 to 228 of the court case file).
9-) In resolution AMR-056-2020 issued at 13:30 hours on June 8, 2020, the Office of the Mayor of the Muncipalidad de Mora ruled on the motion for reconsideration filed against resolution AMR-047-2020 of May 15, 2020, determining that: the Public Service Regulations for the comprehensive management of solid waste in the canton of Mora were published in La Gaceta number 72 of April 16, 2013, pages 33 to 39; and in La Gaceta number 122 of June 26, 2013, page 64; resolution 611-2019 issued at 09:15 hours on November 27, 2019, affirmed the decision of the Municipalidad de Mora concerning the provisions of the Public Service Regulations for the comprehensive management of solid waste in the canton of Mora; in that regard, it maintained that the factual circumstances addressed in resolution 611-2019 had not changed, arguing that the matter involved the same stormwater-discharge and road-alignment resolutions, the same applicants, the same property number, and the same project purpose, regarding which the Court had declared the exhaustion of administrative remedies (agotamiento de la vía administrativa); it affirmed the ruling contained in resolution AMR-047-2020 of May 15, 2020; and it rejected the appellant’s position by stating that the opinions of the Procuraduría General de la República are binding only upon the entity requesting the opinion and not upon other entities. Based on the foregoing, the appeal was principally denied in all respects (See appeal and images 291 to 299 of the court case file).
III-) The Court’s analysis on the merits:
1-) Preliminary matter:
Regarding the period requested in the relief sought in the appeal for submitting grounds of error, Article 192 of the Administrative Litigation Procedure Code provides: “1) Upon receipt of the case file or submission of its certified copy, the Court shall grant the interested parties a hearing for five business days so that they may state their grounds of error, and the municipal council so that it may make any arguments it deems pertinent. Once that period has elapsed, the corresponding final resolution shall be issued within the fifth business day”; this Court has interpreted and holds that such additional hearing for stating grounds of error is reserved for cases challenging an act or formal administrative conduct (conducta administrativa formal) emanating from the Municipal Council, and not for appeals filed against acts issued by municipal mayoral offices; this conclusion follows from the plain language, consistent with the emphasis noted above in the cited article. This circumstance does not result in any denial of the right to a defense (indefensión), since on May 29, 2020, the moving party filed a motion for reconsideration with a subsidiary appeal against resolution AMR-047-2020 of May 15, 2020, in which it stated the grounds of error now being considered by this Court. Having clarified the foregoing, Article 192 of Ley 8508 shall not be applied.
2-) The alleged new facts and the repetition of prior acts connected with resolution 2019-611 issued in case file 18-004025-1027-CA:
With regard to the resolution just cited, it is important to highlight the facts it found proven:
“I.- Background: The following matters relevant to the resolution of this appeal have been established:
“IV.- The specific case: Before undertaking a review of the grievances raised by the appellant, it is essential to provide certain procedural clarifications that are fundamental to understanding how the appeal against resolution AMR-18-2017 will be decided. At this point, it is necessary to briefly review the doctrines of a “consented act” (acto consentido) and an “act reproducing a prior act” (acto reproductor de otro anterior). Regarding the first of the aforementioned categories of acts, namely, the consented act, it arises when the recipient of such conduct expressly accepts it by unequivocally stating so, or when the act is not challenged in a timely manner, a situation that constitutes what is known as a tacitly consented act (acto tácitamente consentido). In analyzing this procedural phenomenon within the context of the mandatory exhaustion of remedies in municipal matters (agotamiento preceptivo de la vía en materia municipal), the Constitutional Chamber specified the following: “a tacitly consented act that has an irrefutable logic in relation to the mandatory exhaustion of administrative remedies.
If the exhaustion of administrative remedies—based on the privilege of declaratory self-enforcement (autotutela declarativa)—is a mandatory admissibility requirement, then, consequently, if the governed party does not pursue the applicable administrative remedies in a timely and proper manner, the legislature presumes, based on the governed party’s failure to act, that the party has tacitly consented to the administrative act by failing to challenge it within the time limits and through the means established by the legal system.” (Constitutional Chamber vote 3669-2006). A review of the case file shows that resolution AMR-603-2016, issued by the Office of the Mayor of Mora, is a tacitly consented act because, although it was contrary to the interests of the party that requested it, that party did not challenge it within the time limit established by the legal “system.” Having provided the foregoing consideration, it is now appropriate to define the contours of an “act reproducing a prior act” (acto reproductor de otro previo), which is the relevant issue for deciding the appeal under review.
To date, both legal scholarship and case law agree unequivocally that an act reproducing a prior act is not subject to judicial challenge. This type of act is defined by Prof. Jesús González Pérez as one that: “is issued on the basis of the same facts and identical grounds, in the same case file and with respect to the same interested parties, and reproduces the denial ordered by the prior consented resolution.” Gonzáles Pérez, Jesús, Comentarios a la Ley Reguladora de la Jurisdicción contencioso Administrativa, Editorial Cívitas, Madrid, year 1999, p. 703. As reflected both in official communications DDCU-006-2017 and DIG-031-2017, issued by bodies subordinate to the Office of the Mayor, and in official communications AMR-18-2017 and AMR-27-2017, the appellant was informed that its request had been denied because of the existence of ruling AMR-603-2016. Accordingly, it is clear from the express wording of all conduct issued in 2017 that the local government considered the acts issued after resolution AMR-603-2016 to reproduce that resolution and therefore to be unchallengeable.
In view of the foregoing, the Court proceeds to review the grievances raised by the appellant’s representative. As its first objection, the appellant’s representative states that no rule prohibits repeated applications for stormwater discharge authorizations (desfogues), alignments (alineamientos), etc.; consequently, the Office of the Mayor acted unlawfully. The grievance is unfounded and is rejected. This Section must first state that the appellant is correct insofar as the legal “system” does not limit its right to request the issuance of municipal administrative acts, such as a stormwater discharge authorization, a land-use certificate (certificado de uso de suelo), a building permit (licencia constructiva), etc., as often as it deems necessary. Notwithstanding the foregoing, it is also true that if an administrative act issued by the municipality that is contrary to the applicant’s interests is not challenged in a timely manner, that municipal administrative act becomes a tacitly consented administrative act.
Accordingly, if a new application is filed with the local government without any change in the factual circumstances or legal framework, it is evident that the new act denying the application, which merely decides it in the same manner—or even, as occurred in this case, expressly refers to a prior denial—is what was previously defined as an act reproducing a prior act, because it would simply reiterate the ruling of which the party was already aware. Apart from the controversy over whether the prior requirement of exhaustion of administrative remedies is a right of the Public Administration before it is sued, or whether it is a right of the governed party to pursue its dispute through an informal channel before resorting to judicial proceedings, the fact remains that, in municipal matters, a ruling declaring the “exhaustion of administrative remedies” as the final step in the proceeding pursued by a person challenging municipal administrative conduct believed to be contrary to the body of legality (bloque de legalidad) has the sole effect of permitting administrative acts to be challenged in administrative-litigation proceedings, thereby enabling the filing of an ordinary proceeding.
At present, the function of the Third Section of the Administrative Litigation Court, acting as a nonhierarchical overseer of legality (contralor no jerárquico de legalidad), is precisely to issue that ruling. In the dispute under review, resolution AMR-603-2016 is a tacitly consented act, and the Office of the Mayor’s resolutions AMR-18-2017 and AMR-27-2017 are acts reproducing the first, insofar as they maintain the same position while expressly referring to that conduct. It should be noted that, in its subsequent challenges, the appellant does not claim that circumstances had changed or that the applicable law had varied. Moreover, a review of the challenges also makes clear that the substantive objections raised by the representative of the appellant companies concern the considerations set forth in official communication AMR-603-2016, which are specifically listed and challenged. Plainly, the procedure for exhausting administrative remedies at the municipal level is justified when it provides the possibility of subsequently resorting to the courts if the act believed to be unlawful is not corrected at the administrative level.
Conversely, when it is impossible to file an administrative-litigation proceeding, the procedure for exhausting administrative remedies is improper because it serves no useful purpose. In the Costa Rican legal “system,” subsection one of Article 38 of the Administrative Litigation Procedure Code expressly establishes that an action seeking the annulment of acts reproducing prior acts that were consented to may not be filed. It should be noted that, without such a limitation, the limitation periods for bringing an action, which embody the constitutionally rooted Principle of Legal Certainty (Principio de Seguridad Jurídica), could easily be circumvented. Insofar as relevant, that provision states verbatim: “Article 38.- 1) A claim for annulment shall not be admissible with respect to acts that, although defective, have been expressly consented to or reproduce prior acts, whether such prior acts are final and binding or confirm acts that were consented to.” (The original is not underlined).
For the foregoing reason, irrespective of the argument raised by the appellant concerning the series of provisions relied on by the Office of the Mayor of Mora to determine that an act reproducing a prior consented act cannot be challenged, there can be no doubt that the declared non-challengeability is fully lawful. At this point, it is also worth emphasizing that the rule established in Article 163(b) of the Municipal Code is based on the same considerations set forth above. Second, the appellant raises a set of grievances intended to establish the unlawfulness of the substantive reasoning contained in official communication AMR-603-2016. This set of grievances is unfounded and is rejected. As stated throughout this recital (considerando), resolution AMR-603-2016 is a tacitly consented act that cannot be reviewed by this Chamber through an appeal, and it is expressly clarified that, in this resolution, the Court does not conduct any review whatsoever of its legal validity.
For the foregoing reason, this Court must necessarily affirm the declaration made by the Office of the Mayor of Mora regarding the non-challengeability of acts reproducing other consented acts. The position just stated is precisely what will determine the scope of the ruling on exhaustion of administrative remedies contained in this resolution, which shall be limited exclusively to declaring these administrative remedies exhausted solely with respect to the issue of whether reproducing acts may be challenged under the terms described above; this resolution may not serve as the basis for any dispute regarding the lawfulness of official communication AMR-603-2016 or its grounds, matters which, as previously stated, are neither reviewed nor affirmed by this Section.
With respect to the consented act, it was decided and determined that resolution AMR-603-2016, issued by the Office of the Mayor of Mora, is a tacitly consented act because it was not challenged in a timely manner, since, although it was contrary to the interests of the party that requested it, that party did not challenge it within the time limit established by the legal “system.” As to whether this constitutes an act reproducing a prior act, the Court determined that such conduct is not subject to judicial challenge because it involves the same facts and grounds, in the same case file and with respect to the same interested parties, all within the context of the denial ordered by the prior consented resolution. In this regard, the Court found at that time that official communications DDCU-006-2017 and DIG-031-2017, issued by bodies subordinate to the Office of the Mayor, as well as official communications AMR-18-2017 and AMR-27-2017, show that the requesting party’s application was denied on the basis of the existence of ruling AMR-603-2016.
Accordingly, the Court agreed with the local government’s position that, through the conduct issued in 2017, the local government concluded that the acts issued after resolution AMR-603-2016 reproduce that resolution and are therefore unchallengeable. Notwithstanding the foregoing, it is also important to quote the operative portion, or “por tanto,” of resolution 2019-611, which expressly stated:
“Por Tanto.
The appeal filed against resolution AMR-27-2017 is declared inadmissible, and the appeal filed against official communication AMR-18-2017 is denied; both were issued by the Office of the Mayor of Mora and are hereby affirmed. Administrative remedies are deemed exhausted with respect to the issue of the challengeability of reproducing acts arising from the appeal filed against resolution AMR-18-2017.
This supports the conclusion, based on the highlighted content, that the municipal appeals process has already been concluded and that judicial review remains open and available to challenge the appealability of the alleged acts reproducing prior acts (actos reproductores); all through the avenue and in the manner that the party may have deemed appropriate for protecting its rights and interests. Continuing with the analysis of the claim of error, and having reviewed case files 18-004025-1027-CA and 20-003085-1027-CA, it is important to emphasize that we are not dealing with new facts or events occurring at a time and place different from the factual framework cited above, in connection with what was adjudicated concerning whether there was an accepted act (acto consentido), or whether the acts reproduced prior acts; that is, circumstances that would call that conclusion into question or contradict it in the context of the road-alignment and water-discharge permits for the construction of the sanitary landfill.
All of this makes sense because, although the party complains that the new fact is the allegedly disputed validity of the Reglamento de Servicio Público para la gestión integral de residuos sólidos del cantón de Mora, it must be clarified that this matter was not even discussed in the proceeding heard under summary case 18-004025-1027-CA, particularly because this court understands, as will be explained in the following section, that the regulation was published in Gaceta number 72 of 16 de abril de 2013, pages 33 to 39, and in Gaceta number 122 of 26 de junio de 2013, page 64 (see the official Imprenta Nacional website, in the search-engine section for previous editions, accessed on 12 de septiembre de 2023):
https://museodegacetas.imprentanacional.go.cr/ver/pub/2013/04/16/COMP_16_04_2013.pdf https://museodegacetas.imprentanacional.go.cr/ver/pub/2013/06/26/COMP_26_06_2013.pdf It is clear from the foregoing that the regulation was published in full on 16 de abril de 2013 and, at the same time, submitted for the consultation provided for in Article 43 of the Código Municipal, in conjunction with Article 240 of the Ley General de la Administración Pública; and that, because no objections to the regulation were raised, a supplementary resolution was published on 26 de junio de 2013, referring to the publication made on 16 de abril de 2013 and providing that the regulation would enter into force on 26 de junio de 2013. Accordingly, pursuant to Articles 129 of the Constitución Política, 8 of the Código Civil, 43 of the Código Municipal, and 240 of the Ley General de la Administración Pública, since the regulation was approved and published in the Gaceta as described above, the moving party’s argument that the alleged failure to publish the regulation constitutes a new fact is inadmissible, as this would entail disregarding the constitutional maxim that no one may plead ignorance of the law, enshrined in Article 129 of the Constitución Política. In accordance with the ruling, the claimed error does not exist.
3-) Regarding the failure to publish the Reglamento de Servicio Público para la gestión integral de residuos sólidos del cantón de Mora:
More specifically, regarding the claim of error challenging the effectiveness of the aforementioned regulation and, consequently, the validity of the challenged decision, it is important to recall that the Reglamento de Servicio Público para la gestión integral de residuos sólidos del cantón de Mora was published in Gaceta number 72 of 16 de abril de 2013, pages 33 to 39, and in Gaceta number 122 of 26 de junio de 2013, page 64 (see the official Imprenta Nacional website, in the search section for previous editions, accessed on 12 de septiembre de 2023):
https://museodegacetas.imprentanacional.go.cr/ver/pub/2013/04/16/COMP_16_04_2013.pdf https://museodegacetas.imprentanacional.go.cr/ver/pub/2013/06/26/COMP_26_06_2013.pdf In accordance with the foregoing, pursuant to Articles 129 of the Constitución Política, 8 of the Código Civil, 43 of the Código Municipal, and 240 of the Ley General de la Administración Pública, since the regulation was approved and published in the Gaceta, the moving party’s argument that this circumstance affects the effectiveness of the regulation and the validity of the challenged decision is inadmissible; as correctly stated, the regulation was approved and published in full in the Official Gazette. Furthermore, for the sake of completeness, the specific request for the issuance of road-alignment and water-discharge permits for the construction of a sanitary landfill cannot be granted in these proceedings because, as stated, the adjudicating judge can discern no grounds for invalidating the challenged decision.
Moreover, the record contains no technical assessments for that purpose; instead, within the matters debated in this appeal proceeding, there is merely the moving party’s subjective semantic-legal perception, in the context of a proposed sanitary landfill that could have a significant impact on the environment. In other words, there is no specific procedure for that purpose, no technical assessments provided by geologists, biologists, environmental specialists, or other experts, and no permits issued by other public entities or bodies involved in environmental protection and the authorization of urban developments with environmental impacts that might ultimately justify such municipal operating licenses. This is particularly significant because the adjudicating judge is thoroughly familiar with the Prevention and Precautionary Principles (Principios Preventivo y Precautorio) embodied in the well-known Cumbre de Río and in the Convenio sobre Diversidad Biológica y Anexos (Río de Janeiro, 1992), ratified by Ley 7416 of 30 de junio de 1994. In accordance with the foregoing, the Sala Constitucional has explained:
The case law of this Chamber has repeatedly emphasized that the right to a healthy and ecologically balanced environment is recognized at both the constitutional and treaty levels. It has likewise stated that effective protection of this right requires the rational use of resources, in which context the State and the public at large must act in accordance with the principles governing environmental matters. In this regard, specialized legal scholarship has stated that the prevention principle (principio preventivo) requires that, when there is certainty regarding possible environmental harm, the activity causing that harm must be prohibited, limited, or made subject to compliance with specified requirements. In general, this principle applies when risks are clearly defined and identified as at least probable; it is also useful when there are no technical reports or administrative permits guaranteeing the sustainability of an activity, but sufficient grounds exist to anticipate potential adverse impacts.
The precautionary principle (principio precautorio), on the other hand, provides that when there is a threat of serious and irreversible harm, a lack of absolute scientific certainty shall not be used as a reason for postponing cost-effective measures to prevent environmental degradation. It follows that this principle is based on reasonable scientific uncertainty combined with the threat of serious and irreversible environmental harm. In general terms, a significant difference between the prevention and precautionary principles lies in the level of knowledge and certainty concerning the risks posed by an activity or project. While such certainty exists under the former, the latter involves a state of doubt arising from scientific information or technical studies. Thus, the Costa Rican State is required to adopt measures that ensure the effective defense and preservation of the environment in accordance with these principles.
This objective obligation does not necessarily entail a subjective right of individuals to demand, through the courts, that a particular measure be adopted; it does, however, include the right to have appropriate measures adopted to protect that right in the face of openly negligent conduct by authorities or by natural or legal persons, in accordance with the recognized doctrine of the horizontal effect of fundamental rights (Drittwirkung der Menschenrechte), one of whose procedural manifestations is the amparo proceeding against private-law parties.” (Decision of the Sala Constitucional number 2021-024807, issued at 09:20 on 5 de noviembre de 2021).
Accordingly, irrespective of any discussion as to whether we are dealing with accepted acts, acts reproducing prior acts, or whether the Reglamento de Servicio Público para la gestión integral de residuos sólidos del cantón de Mora was properly published, the reasoned judgment standard (sana crítica racional), guided by science, experience, and logic, makes it clear to the adjudicating judge that the record contains insufficient technical assessments—which were not even examined or discussed—concerning the environmental sustainability of permits or municipal licenses associated with constructing a sanitary landfill. All of this creates a situation of uncertainty governed by the Cumbre de Río under the Prevention Principle, which has deep constitutional roots as cited above and guides the legal decision-maker—the judge adjudicating this case—to deny the specific request that the respective local government issue the required licenses. Finally, on the grounds set forth above, the moving party must abide by the challenged decision, whose contents are hereby affirmed by this court. With respect to the matters raised as claims of error and adjudicated in this decision, administrative remedies are deemed exhausted, as is hereby ordered.
POR TANTO:
The appeal is DENIED; decision AMR-047-2020, issued at 11:00 on 15 de mayo de 2020 by the Mayor’s Office of the Muncipalidad de Mora, is affirmed. PARQUE INDUSTRIAL JATEO SA DEMANDADO/A:
CONSIDERANDO:
