PODER JUDICIAL TRIBUNAL DE APELACIÓN DE SENTENCIA PENAL JUVENIL Case file: 20-000333-1259-PE (1) Decision: 2023-000153 TRIBUNAL DE APELACIÓN DE SENTENCIA PENAL JUVENIL. Second Judicial Circuit of San José, (acting in the capacity of the T.A.S.P. of Guanacaste, Santa Cruz seat) Goicoechea, at fifteen hours on veintinueve de marzo dos mil veintitrés.
APPEAL (recurso de apelación) filed in the present case brought against [Nombre 001], an adult, Costa Rican, identity card [Valor 001], born on 17 de octubre de 1971, and [Nombre 002], an adult, Costa Rican, identity card [Valor 002], born on 12 de julio de 1955, for the Offense of Illegal Acquisition of Forest Products (Delito de Adquisición Ilegal de Productos Forestales). Judge Flory Chaves Zárate and Judges Gustavo A. Jiménez Madrigal and Jorge A. Camacho Morales participate in deciding the appeal. Attorney Edie Roberto Cortés Matarrita, private defense counsel (defensor particular) for defendant [Nombre 002], and attorney Jorge Enrique Porras Leiva, private defense counsel for defendant [Nombre 001], entered appearances before this Court.
BACKGROUND (RESULTANDO):
By judgment number 677-2022, issued at thirteen hours and fifteen minutes on once de octubre del dos mil veintidós, the Court of the First Judicial Circuit of Guanacaste, Santa Cruz Seat, Flagrante Delicto Section, ruled: “POR TANTO: In accordance with the foregoing and pursuant to Articles 39 and 41 of the Political Constitution, 08 of the American Convention on Human Rights, 14 of the International Covenant on Civil and Political Rights, 01, 30, 31, 45, 50, 51, 59 to 63, 71, 73, 74, 103, and 110 of the Criminal Code; 01, 03, 06, 09, 45, 142, 265 to 270, and 324 to 367 of the Code of Criminal Procedure; 01, 03, 54, 55, 56, 61 subsection b), 65, and 66 of Ley 7575 or Ley Forestal; and 02 and 31 of the Regulations to Ley Forestal, this Court finds [Nombre 001] and [Nombre 002] criminally responsible as perpetrators of ONE OFFENSE OF ILLEGAL ACQUISITION OF FOREST PRODUCTS and imposes upon each of them a sentence of ONE MONTH OF IMPRISONMENT, to be served at the correctional facility designated by prison regulations, with credit for any time spent in pretrial detention (prisión preventiva), if applicable.
Pursuant to Articles 59 to 63 of the Criminal Code, THE CONVICTED PERSONS ARE GRANTED THE BENEFIT OF CONDITIONAL EXECUTION OF THE SENTENCE (EJECUCIÓN CONDICIONAL DE LA PENA) FOR A THREE-YEAR PROBATIONARY PERIOD, during which each convicted person shall: 1- Refrain from committing another intentional offense for which a sentence exceeding six months of imprisonment is imposed. Otherwise, the benefit granted herein may be revoked, and the imposed sentence must be served. This matter is resolved without a special award of costs. The costs of the proceedings shall be borne by the State. Pursuant to section 65 of Ley Forestal, THE FORFEITURE (COMISO) is ordered of the Volvo truck, license plate number [Valor 003], Fe style, model 1989, described in record N° 0156, and of the timber seized under record N° 0157. The Civil Action for Damages (Accion Civil Resarcitoria) is granted, with its value to be determined in separate proceedings.
Once this judgment becomes final, it shall be entered in the Judicial Registry, and the customary certified copies shall be forwarded to the Instituto Nacional de Criminología and the Juzgado de Ejecución de la Pena. In due course, the case file shall be archived and removed from the court’s intake docket. The parties shall be notified through a complete reading hereof.” (see front and back of folio 208) Attorney Edie Roberto Cortés Matarrita, private defense counsel for defendant [Nombre 002], and attorney Jorge Enrique Porras Leiva, private defense counsel for defendant [Nombre 001], appealed the foregoing decision.
Having conducted the corresponding deliberation pursuant to Article 465 of the Code of Criminal Procedure, the Court considered the issues raised in the appeal.
The relevant statutory requirements have been observed throughout the proceedings.
Appellate Judge Chaves Zárate authors the decision, and, CONSIDERING (CONSIDERANDO):
I—Jurisdiction of this Court to decide this appeal from the judgment: Pursuant to the agreement of Corte Plena at session 22-2022, dated 16 de mayo de 2022, Article XXXIV, and the agreement of Corte Plena at session 75-2022, dated 19 de noviembre de 2022, Article XVII, this Court has jurisdiction to hear applications to extend pretrial detention that fall within the jurisdiction of the Tribunal de Apelación de Sentencia Penal de Guanacaste, Santa Cruz seat, as well as appeals from judgments, in accordance with the criteria defined in both sessions and for the period agreed upon therein, which extends through the first half of this year, 2023. Accordingly, this Chamber proceeds to hear the appeal in this case.
II.Admissibility: Attorney Jorge Enrique Porras Leiva, private defense counsel for defendant [Nombre 001], filed an appeal on 1 de noviembre de 2022 against judgment number 677-2022, issued at 13:15 hours on 11 de octubre de 2022 by the Tribunal Penal de Guanacaste, Liberia Seat (folios 209 to 215 of the case file). The record likewise shows that attorney Edie Roberto Cortés Matarrita, private defense counsel for accused [Nombre 002], filed an appeal (folios 216 to 220 of the case file). Review of the appeals shows that they were filed within fifteen business days after notice of the judgment, as provided by Article 459 of the Code of Criminal Procedure, and that they satisfy the admissibility requirements established by Articles 458 and 460 of that body of law. They may therefore be heard pursuant to Article 8.2(h) of the American Convention on Human Rights and are admitted for consideration and a decision on the merits.
III.Appeals filed by defense counsel: Attorney Jorge Enrique Porras Leiva, private defense counsel for defendant [Nombre 001], and attorney Eddie Roberto Cortés Matarrita, private defense counsel for accused [Nombre 002], independently appealed the judgment of conviction. This Appellate Chamber concludes that although their formats differ, the arguments and claims presented in both appeals from the judgment are identical, as detailed below.
A.—First ground: As their first claim of error, attorneys Porras Leiva and Cortez Matarrita asserted their disagreement with the trial court’s legal reasoning, alleging inadequate reasoning in the judgment. They state that the lower court (tribunal a quo) never explained in its reasoning how it determined the manner in which, and the place where, defendants [Nombre 001] and [Nombre 002] acquired the timber. Accordingly, in the appellants’ view, the lower court made unfounded conjectures in its ruling, thereby violating their clients’ right to a defense and presumption of innocence. In support of their arguments, they transcribed part of the facts that the trial court deemed proven. The appellants then asserted that the sentencing court’s reasoning was erroneous because it failed to recognize that this proceeding did not concern the offense of illegal transportation of timber. Specifically, they supported their claims as follows: “The error is glaring, since even the judge himself failed to realize that this matter differs from a charge of illegal transportation of timber, stating in his ruling: ‘Thus, after analyzing the evidence individually and as a whole, in accordance with sound judicial reasoning (sana crítica), we reach the sole and unequivocal conclusion that [Nombre 002] and [Nombre 001] must be deemed perpetrators responsible for the offense of violating the Ley Forestal, in the form of acquisition of forest products, committed to the detriment of natural resources, as has been attributed to them, since it has been duly established that on 22 de mayo del año 2020, on the road in El Arbolito de Pagases, they were detained while transporting and possessing cocobolo timber without demonstrating its origin and without having the corresponding transport permit (guía),” that is, “he acquired it because he possessed and transported timber without the corresponding permits” (Spelling errors appear in the original, pages 210 and reverse of 216 of the case file).
In view of the foregoing reasoning by the trial court in its judgment, attorneys Porras Leiva and Cortez Matarrita stated that, in addressing the operative verbs constituting the offense under investigation here, the court a quo could not engage in analogical reasoning detrimental to the defendants (imputados), because, in their view, the criminal offense (tipo penal) provides for punishment of acquisition, and the trial court could not replace that verb with one resembling it or with another verb that better fits the unlawful conduct, since the determination of whether conduct satisfies the elements of the offense (tipicidad) is governed by the principle of criminal legality (principio de legalidad criminal) and, with it, the prohibition against the use of analogy. Accordingly, the appellants stated that, upon examining the conduct alleged by the private complainant (parte querellante), it is known that two individuals were traveling in a vehicle, that the vehicle was stopped by the forest police, and that the timber that was seized was being carried inside it.
Thus, according to the appellants, if one begins with the fact that the illegal transportation of timber was not at issue in this trial because the Ministerio Público, which originally charged it, chose not to participate in the trial, while the Procuraduría General de la República (PGR), in its private complaint (querella), did not charge the offense of illegal transportation because it did not allege that the timber was transported without permits, then it must be concluded “that what exists is timber in the bed of a vehicle, without knowing to whom that timber belongs, since the timber could very well belong to Mr. [Nombre 002] and Mr. [Nombre 001] could merely be transporting the timber (which was not charged), or, alternatively, Mr. [Nombre 001] could be the owner and transporter of the timber, while Mr. [Nombre 002] could merely be accompanying him and might either know that the acquisition was unlawful or be entirely unaware of it, which presents a problem as to whether the conduct satisfies the elements of the offense” (pages 211 and 217 of the case file).
Therefore, according to appellants Porras Leiva and Cortez Matarrita, the verb “to acquire” entails taking possession of an item with the power to dispose of it, an action that could be performed by one person; however, when two or more persons are involved, the possible variations in their conduct increase as follows: i.- One of them could be entirely innocent of the unlawful act; ii.- Both persons could be responsible; iii.- One of the individuals could be responsible and the other a participant in the unlawful act; iv.- Both could merely be transporters of timber acquired from a third party who is not a party to the criminal proceedings. Based on the foregoing analysis, both defense attorneys argued in their appeals that the key issue was that both the charging instrument and the judgment had to specify how the defendants participated in the unlawful act, and that it is unknown in this case who acquired the timber, which is an act distinct from transporting it; under that reasoning, in their view, the acquisition could be unlawful even though the transportation was not.
The appellants also offered as an example supporting their arguments that the timber could have been purchased legally and transported illegally. Thus, in their view, conduct involving illegal transportation cannot be equated with acquisition, given the legally protected interest (bien jurídico protegido). For that reason, both defense attorneys maintained in their appeals that the “principal failing in these proceedings is that, because of the haste of the flagrante delicto procedure (procedimiento de Flagrancias), no investigation was conducted, such that everything originally focused on illegal transportation, and therefore it was never determined who acquired that timber, or how, when, or where it was acquired; the problem arises when the Ministerio Público abandons the prosecution and leaves the PGR solely with a private complaint concerning facts that were never verified and that, unlike the transportation, did not occur in flagrante delicto (flagrancia) as described in section 236 of the CPP, because the acquisition, as a specific act, occurred some time before the defendants were detained, without that act having been witnessed by SINAC officers or by any other person who testified at trial” (pages 211 and reverse of 217 of the case file).
Accordingly, both attorney Porras Leiva and attorney Cortez Matarrita challenged the trial court’s reasoning on the ground that it changed the meaning of the verb “acquisition” to “possession” and thereby, in the appellants’ view, changed the unlawful act, all because, according to the court’s reasoning in its judgment, it equated the conduct based on the nature of the industry and of the property possessed. In support of their claim, they transcribed a portion of the reasons given by the judge in the judgment on this issue. Because of this reasoning by the trial court, both appellants emphasized that Article 2 of the Criminal Code established the prohibition against analogy for the imposition of a penalty, and they reiterated that possessing is not the same as acquiring. They further stated that even if the trial court intended—although it did not say so in its judgment—to hold that acquisition implicitly entailed possession, or vice versa, the judge should have examined the matter more thoroughly in order to understand, from a legal perspective, the scope of the verb “to possess,” in accordance with the definition provided by the dictionary of the Real Academia Española, hereinafter RAE, which refers to a position of control over things and which they quoted.
Thus, according to both appellants, control over an item entails the ability to make decisions concerning it, and that act was not established during the trial, even though both appellants pointed this out to the trial court. The appellants likewise stated that “…control over an item entails the ability to make decisions concerning it, an act that, in this case, was not established with respect to either of the two defendants, and we repeatedly pointed this out to the trial court during the proceedings....” (pages 212 and 218 of the case file). Therefore, according to defense attorneys Porras Leiva and Cortez, at that point in the judgment the judge could not deem proven the specific moment at which either defendant acquired the timber, or whether the acquisition had been lawful. According to the appellants, it is important to determine whether the acquisition occurred in accordance with the rules established in Article 236 of the Code of Criminal Procedure; the situation would then be different.
However, conduct consisting of transportation would not constitute acquisition. In accordance with the foregoing, both appellants argued that the forest officers did not request purchase invoices for the timber because an invoice is not a valid document for transporting timber logs, and they therefore did not attempt to verify whether the timber had been legally acquired at a place authorized for that purpose. Consequently, in the appellants’ view, under the Costa Rican accusatorial system (modelo acusatorio costarricense), it was incumbent upon the prosecuting party and the court, in its judgment, to prove that the acquisition was unlawful. The appellants transcribed part of the judge’s reasoning concerning his treatment of the fact that co-defendant Adalberto declined to testify, without stating that he was unaware of what was being transported in the truck. According to the appellants, the first conclusion arising from the judge’s reasoning in the judgment is that the court punished the defendant for not testifying, while disregarding the fact that both defendants denied the charges during the trial.
The second conclusion is that the judge was always aware that the matter being tried was the illegal transportation of timber. Accordingly, the claimed error (agravio) consisted of a breach of the duty to provide adequate reasons for the judgment.
B.-Second ground, titled lack of reasoning concerning the participation of multiple persons. The appellants argued that, in its reasoning, the trial court did not analyze the defendants’ participation in the events and merely declared them criminally liable as principals (autores) for the offense of violating the Ley Forestal in the form of acquisition of forest products. They also quoted that portion of the oral judgment. Accordingly, the appellants contended that, where multiple persons participate in an offense, the judge was, in their view, required to establish each person’s degree of participation in the criminal conduct, whether as co-principals (coautores) or accomplices (colaboradores); if they were co-principals, the judge was required to specify the form of joint perpetration (coautoría), that is, whether it was successive or accessory, whereas if their role was merely one of assistance, the judge had to establish each defendant’s causal contribution to the offense based on the available evidence.
Nevertheless, they stated that the court merely indicated that the defendants were the principals responsible for the act, without providing any explanation, and that the absence of reasons establishing the position of each defendant within the chain of causation (nexo causal) rendered the judgment ineffective, in their view, pursuant to Article 142 of the Code of Criminal Procedure, which prescribes that sanction. They therefore maintained that a human right had been violated, which constituted the resulting prejudice.
C.-Third ground. It is alleged that the judgment failed to provide reasons concerning the civil action for damages (acción civil resarcitoria), because the judge merely stated that he would not address it in depth and that liability was imposed with damages to be determined (condena en abstracto). For this purpose, they transcribed that statement by the trial court in their appeals. Accordingly, both appellants maintained that they did not know the statute or legal provision on which the court a quo relied in entering the civil judgment. No analysis was made of the causal link between the conduct and the harm. Nor was any reason stated as to why their clients were civilly liable, and there was no explanation of the damages and losses caused by them, much less of which facts underlying the civil action for damages were deemed proven. They reiterated that the resulting prejudice consisted of a breach of the duty to provide reasons, thereby violating the guarantee of due process (debido proceso); without an adequately reasoned judgment, justice is denied. They request that the appeal be granted, that the judgment under appeal be vacated, and that the matter be remanded for a new proceeding before a differently constituted court.
IV Position of the Procuraduría General de la República. Attorney Kasandra Mora Salguero, Criminal State Attorney, in her capacity as representative of the State’s interests, responded to the opportunity afforded to her and requested that the appeals be denied because both appeals merely expressed dissatisfaction with the unfavorable judgment convicting private defendants and civil defendants [Nombre 001] and [Nombre 002].
Ms. Mora Salguero clarified that the Office of the Attorney General of the Republic was the prosecuting party and civil plaintiff (actora civil), not the Public Prosecutor’s Office. For that reason, the Office of the Attorney General of the Republic appealed the judgment to the higher court. That appeal (recurso de apelación) was granted by the Santa Cruz Court of Appeals in a decision issued at 10:45 hours on July 28, 2022, which ordered a remand for a new trial. That trial was held on October 11, 2022, and the judgment challenged herein was rendered. The Criminal Affairs Attorney then maintained that the first alleged defect, concerning an “Incorrect statement of reasons for the judgment,” does not exist, because the Office of the Attorney General of the Republic charged the offense of violating the Ley Forestal, established in Article 61(b) of the Ley Forestal, in the form of acquiring forest products.
The statutory offense (tipo penal) contained in that article does not require proof of how or under what circumstances the acquisition occurred, where it took place, much less who made the acquisition, as both appellants contend in their claims; the sole requirement is failure to comply with the requirements established by Article 61(b) of the Ley Forestal itself. This is because, in the Criminal Affairs Attorney’s view, the Costa Rican legislature provided for criminal punishment of anyone who unlawfully acquires forest products, which are not freely available for disposal by private parties. In the case of natural resources, there is an interest in regulating how they are used and consumed in order to preserve an appropriate ecological balance. Accordingly, in her view, forest products must always be accompanied by documentation permitting the lawful exploitation of the resources, as follows from Article 55 of the Ley Forestal, which she quotes.
For that reason, Ms. Mora Salguero maintains that, in this particular case, the prohibited conduct described in the private criminal complaint (querella) was completed by the actions of the accused parties, “since they acquired the forest products without having any permit whatsoever or documentation that would at least establish a lawful harvesting of forest products; on the contrary, the accused parties had no document whatsoever demonstrating the lawful origin and possession of the forest resources required by that article, as was proven by the evidence in the record” (folio 226 of the expediente). Thus, according to the State’s representative, each defense counsel stated separately in an appeal, “but with identical wording” (folio 226 of the expediente). In this regard, she quoted a portion of the argument made by both appellants in their appeals, in which they alleged that the issue was whether the conduct satisfied the statutory elements (tipicidad), because the charge did not state to whom the timber belonged, and all that could be asserted was that timber was found in the bed of a vehicle without knowing to whom it belonged, since it could have belonged to co-accused [Nombre 002], with [Nombre 001] serving as the transporter of the timber, or alternatively the latter could have been its owner and transporter, while the accused [Nombre 002] was the passenger, whether or not he knew that the acquisition was unlawful.
In response to that argument by the appellants, the Attorney General stated that, although neither accused was caught at the moment when possession of the forest resources was obtained, the fact remained that they already possessed and were transporting them in a truck, from which it logically followed that they had acquired them and intended to use them for their own benefit. The representative of the Office of the Attorney General of the Republic further stated that objective statutory correspondence (tipicidad objetiva) does not require proof of the manner or time of acquisition because, as movable property, sawn timber or logs are subject to the presumption that possession constitutes title. This is particularly so because the logs were inside a truck belonging to the defendant [Nombre 001], and documentation demonstrating both the origin of the timber and its lawful harvesting or lawful acquisition—through a certificate of origin, a harvesting permit, or, if it came from the industry, an invoice—would always be required.
She also addressed the appellants’ contention that the person who acquired the timber might have done so lawfully even though its transportation was unlawful. After quoting that claim, she refuted it by referring both to the position of the Guanacaste Judgment Appeals Court, Santa Cruz seat, and to sentencia 53-16 de las 15:21 horas del 9 de marzo de 2016, without identifying the court, while reproducing part of a passage from its reasoning stating that the transportation of timber required the corresponding documentation, depending on each situation, such as an authorization guide, certificate of origin, and so forth, from which a harmonious and systematic interpretation together with the articles of the Ley Forestal would follow. The Criminal Affairs Attorney further stated that she rejected the appellants’ argument that the forest police officers did not request the timber purchase invoices and that it was the duty of the prosecuting body and the court to prove the unlawful acquisition.
Ms. Mora Salguero, acting as the State’s private prosecutor (querellante) and civil plaintiff, maintained that anyone possessing a document establishing the lawful acquisition of the forest product would act to prevent being accused of committing an offense. Thus, in her view, the appellants’ reasoning conflicts with the most elementary logic, particularly given that the defendant [Nombre 001] stated that he worked as a merchant and transporter and therefore, in the State representative’s view, should have known the requirements governing timber transportation. Ms. Mora further noted that, in this case, the suitability of the documentation for transporting timber was not disputed; rather, the accused parties were charged with having no documents whatsoever. Consequently, the appellants’ argument is unfounded and bears no relation whatsoever to the reasoning contained in the judgment. The State representative also alleged the existence of collusion (contubernio) between the accused parties, which was evidenced by the fact that, despite having two privately retained defense attorneys, they filed appeals that were identical copies.
Ms. Mora Salguero specifically stated: “…What is striking in this particular case is that, although each defendant has his own legal representative (as is proper to avoid conflicts of interest), the appeals filed are exact copies of one another: each defense counsel merely changes the heading, but in reproducing the document, each defends both defendants. This not only demonstrates the collusion between the two accused, but also the impossibility that, if responsibility rested solely with one of them (as they sought to suggest), the other would have said so either at the time of arrest or at any stage of the proceedings in his defense…” (Cfr. Folio 227 vuelto). Moreover, according to the private prosecutor and civil plaintiff, the appellants’ argument concerning the trial court’s analysis regarding the accused [Nombre 002], who did not state that he had not participated in the events, was intended to allow him to exercise his personal defense (defensa material), regardless of whether he testified during the trial.
Nevertheless, the appellants rely on that reasoning in an attempt to mislead the Court of Appeals by asserting that the Court shifted the burden of proof and that the Judge was adjudicating a case of timber transportation. The Criminal Affairs Attorney states that this is not true, because that verb was used in the private criminal complaint just as any other verb could have been used to describe “the act of moving something from one place to another for the purpose of benefiting from the unlawful acquisition” (folio of the expediente). She therefore cited voto 315-22 de las 10:45 horas del 28 de julio de 2022 of the Court of Appeals, which explained, in light of Article 55 of the Ley Forestal, that the person “must establish that the forest product is covered by the corresponding harvesting permit, when applicable, or demonstrate its origin when requested by the State Forestry Administration.” (Boldface supplied)” (folio of the expediente).
That requirement was not met in the present case because they carried no permit demonstrating the origin of the cocobolo timber inside the truck, nor any document such as an invoice that might have led them to believe, mistakenly, that the acquisition was lawful. Finally, with respect to the award of damages on the civil action brought by the Office of the Attorney General of the Republic in an amount to be determined (en forma abstracta), she argued that Article 432 of the Code of Criminal Procedure permits an award in an amount to be determined, in this case because of the environmental damage caused. In her view, there was no omission rendering the judgment ineffective, because once the matter is referred to judgment-enforcement proceedings, the party will have every opportunity to present its arguments concerning the civil award. She therefore requests that the appeal filed by both appellants be denied and that the judgment remain undisturbed. This claim must be rejected as informal and lacking in rigor.
Appeal granted. For reasons different from those asserted by the Defense, the appeal filed is granted. Regarding the determination of absolute defects (defectos absolutos), Article 178 of the procedural rules provides: “No prior objection shall be necessary, and the following defects may be identified even by the court on its own motion: a) Those concerning the intervention, assistance, and representation of the defendant in the cases and forms established by law, or those entailing failure to observe rights and guarantees provided for by the Political Constitution, International or Community Law in force in the country, and the law. b) Those concerning the appointment, capacity, and constitution of judges or courts. c) Those concerning the initiative of the Public Prosecutor’s Office in exercising the criminal action and its participation in the proceedings.
Following a comprehensive review of the judgment and the oral trial that preceded it, this The Court of Appeal finds that, at the outset of the trial, the court below excluded the Public Prosecution Service from the criminal proceedings brought, on the grounds that, during the first trial, which resulted in the defendants’ acquittal, the Prosecutor’s Office did not file an appeal. As grounds for that decision, it was asserted that the Guanacaste Criminal Judgment Appeals Court ordered that the facts be heard in a new trial based on the private criminal complaint (querella) and the civil action for damages (acción civil resarcitoria) filed by the Procuraduría General de la República. To analyze the actions of the court below, it must first be noted that, by decision 315-22 at 10 hours 45 minutes on 28 de julio de 2022, the appellate court stated: “...therefore, what the judge stated is not true, namely, that in this case the prosecuting entity must prove whether its origin is a plantation or a forest, because, as stated, it is an endangered species protected under the referenced decree, and its trade and transportation are therefore restricted by the State; a matter that should have been discussed at trial.
Accordingly, the appeal filed by the Procuraduría General de la República is granted; the judgment is vacated insofar as it acquitted the defendants of the acts alleged by the Procuraduría General de la República and ruled on the civil action for damages filed by the State’s representative. The case is remanded for new proceedings as pertinent. And the operative part states: Por tanto, the appeal filed by the Procuraduría General de la República is granted; the judgment is vacated insofar as it acquitted the defendants of the acts alleged by the Procuraduría General de la República and ruled on the civil action for damages filed by the State’s representative. The case is remanded for new proceedings as pertinent. Before a differently constituted panel. Let notice be served” (cf. folio 182 of the main case file). Based on the foregoing, it must first be stated that the judge relied on the decision of the Criminal Judgment Appeals Court to interpret something that the ruling does not state—namely, that the Public Prosecution Service may not intervene—and, moreover, could not state, because doing so would create an atypical sanction or a consequence not provided for by procedural law against the prosecuting authority for failing to appeal.
Furthermore, the decision of the Guanacaste Criminal Judgment Appeals Court merely grants the appeal filed by the Procuraduría General de la República and rules on that appeal with the corresponding legal consequences; it need not tell the trial court what it must do, but only that it has issued a determination regarding what was submitted for its consideration, “as pertinent,” within its jurisdiction and without going beyond it. The fact remains, however, that it declared the judgment ineffective, and therefore the criminal action (acción penal) has in no way ceased to exist. Consequently, private defense counsel made a serious error in requesting the exclusion of the Prosecutor’s Office based on the phrase used by the higher court in directing that the matter be heard again “as pertinent,” since none of the matters decided remained undisturbed. Moreover, a review of the trial supports the inference that the female prosecutor was taken by surprise by these motions and merely stated that she should indeed remain at the trial.
Although this Court considers it serious that the Prosecutor’s Office did not object to the grave violation of the principle of participation by the prosecuting authority (principio de intervención del ente fiscal), the fact remains that the defect is absolute and may therefore be declared by the court on its own motion (de oficio) at this stage even though no corresponding objection was made. Accepting the position expressed by the court below would not only lead to the irreconcilable contradiction that the charges brought by the Prosecutor’s Office have become final, but could also affect the allegations made in the private criminal complaint insofar as they coincide factually with respect to the acquisition and movement of forest products. In addition, the appeal filed by the Procuraduría General de la República and granted by the appellate court has legal consequences for all parties, not only for the appellant as the judge construed it.
Indeed, as the judge himself stated, to rule on the Defense’s request to exclude the Public Prosecution Service, he reviewed the judgment that had been declared ineffective in order to interpret the Guanacaste Criminal Judgment Appeals Court’s decision (“as pertinent”) and thereby separate the respective participation of the various parties to the proceedings. Although the passivity of the prosecution’s representative throughout these proceedings is regrettable, the fact remains that the legally improper manner in which the representative was excluded cannot be upheld without violating the principle of procedural legality (principio de legalidad procesal) and, consequently, due process (debido proceso). Nor are there any facts or circumstances that have become final, precisely because of the timely actions of the Procuraduría, and even assuming that the trial is based solely on the facts alleged by the private complainant, that does not provide legal authority to exclude the Prosecutor’s Office.
Accepting actions of this kind would lead to the erroneous conclusion that the ruling became partially final with respect to the facts alleged by the Public Prosecution Service and that those facts may not be litigated, while those alleged in the private criminal complaint may be, none of which follows from the appellate court’s decision; this renders the actions of the court below inconsistent. Nor can it be argued that the prosecuting authority lacked interest, since it did appear for trial but was arbitrarily excluded when it was about to read the indictment (acusación). Moreover, treating prosecutorial inaction as a prerequisite for exclusion from the proceedings would entail imposing a procedural sanction not provided for by the legislature, irrespective of the fact that the female prosecutor showed no interest in filing an objection concerning an absolute procedural defect against the decision of the court below.
Although this Court is surprised by such inaction, the fact remains that this circumstance did not authorize the court below to exclude a party to the proceedings, nor may this Court validate an error of this nature. The fact is that the first judgment was declared ineffective by a decision of the appellate court that nowhere states that the Prosecutor’s Office may not intervene; nor could it now be maintained that there was no prejudice because the female prosecutor left without resistance. Notwithstanding both actions, the exercise of the criminal action remains undisturbed, and the only matter that might eventually require examination is the conduct of the prosecution’s representative, so that the Public Prosecution Service may determine internally whether this reflects a problem of training or knowledge of the duties entrusted to the prosecuting authority; this would also encompass the judge who presided over this trial.
Nor can it be argued that the defect may be cured by having the prosecuting authority enter an appearance at this stage, because doing so would violate the duty of objectivity (deber de objetividad) by constructing the premise that the Prosecutor’s Office’s sole purpose in criminal proceedings is to secure the conviction of an accused person, while also violating the principle of unity of action and hierarchical subordination (principio de unidad de actuaciones y dependencia jerárquica), given that, in this case, even an amendment cannot be considered (art 18 LOMP). Furthermore, the Prosecutor’s Office acts not only during the investigation and trial stages, but also during appeals and the enforcement of sentence (ejecución de sentencia), all of which would be affected within the logic of criminal proceedings. Accordingly, by its very nature, the absolute defect (defecto absoluto) cannot be validated in any manner, even by accepting that a criminal conviction approximating the Public Prosecution Service’s requested punishment would constitute a valid reason to find no prejudice merely because that conviction approximates what was initially sought.
Without wishing to be repetitive, this Chamber considers that the conviction was not obtained in accordance with lawful procedure; failure to appeal the first judgment cannot be interpreted as a procedural sanction (sanción procesal) resulting in a limitation on the exercise of the criminal action (acción penal), much less as legally establishing the prosecution service’s inability to continue participating, including in pursuing its punitive claims. The impairment of the initiative of the Ministerio Público and of due process (debido proceso) arises from the compulsory exclusion of one of the essential parties to the proceedings. The absolute defect (vicio absoluto) cannot be cured either by the inaction of the Ministerio Público or, much less, by the conviction obtained by the private prosecuting party (parte actora penal) (Procuraduría General de la República). Finally, the trial (debate) contains serious errors that render the ruling against the defendants (encartados) illegitimate, to the extent that there is not even any reasoning supporting the order that the female prosecutor (Fiscala) leave the hearing; worse still, the judge alleges that, before doing so, he reviewed the entirety of the decision to determine whether the Fiscalía should remain at trial, which meant having prior knowledge or a preconceived view of what was going to occur.
This concerns a publicly prosecuted offense (delito de acción pública) (Violation of Ley Forestal (Infracción a la Ley Forestal)), which makes it clear that, under the procedural rules, the criminal action remains pending resolution (cfr 19, 72 y 74 del Cpp); it is not a privately prosecuted offense (ilícito de acción privada) among those provided for in artículo 20 del CPP. Nor has the publicly prosecuted action been converted into a private one; therefore, the proceeding is the ordinary proceeding (procedimiento ordinario), and the Fiscalía was and remains required to participate. Although it is true that the Defense erroneously filed the application and that the Ministerio Público would be expected to take a clearer and more forceful position in response to an improper act, the fact remains that the judge knows the law and should have ruled as required, namely, by continuing the trial with all parties present.
Moreover, artículo 321 provides: Prerequisite for committal for trial (Presupuesto para la apertura a juicio) The committal order (auto de apertura a juicio) may be issued on the basis of the charging instrument (acusación) filed by the Ministerio Público or by the private complainant (querellante). If the trial is commenced solely on the basis of the private charging instrument, the private complainant shall continue to exercise the action exclusively, without prejudice to the representative of the Ministerio Público choosing to continue participating in the proceeding, although the representative shall not be required to maintain the private complainant’s claim. As can be seen, the participation of the Ministerio Público is fully guaranteed by law, and it may participate even if only the charging instrument filed by the private prosecuting party or private complainant is admitted; it may even continue with the proceeding and depart from the private prosecuting party’s claim.
In such circumstances, the decision not to continue participating belongs to the Ministerio Público and not to the judicial authority, as occurred in this case. Accordingly, it is clear that, following a declaration that a judgment of acquittal (sentencia absolutoria) was ineffective—a declaration not sought by the Ministerio Público—the Ministerio Público could return to trial in order to continue the proceeding and fulfill its proper role. Thus, the issue here is whether the court below (juez a quo) could exclude the Ministerio Público because it did not file an appeal (recurso de apelación) against the judgment of acquittal, as the trial judge appears to have understood; this Chamber answers that question by stating that such exclusion was legally impossible for the reasons set forth above. The second issue is whether the interpretation adopted by the judge was appropriate, particularly because the trial court was procedurally sanctioning the Fiscalía for its inaction, but without any legal basis permitting it, and whether the decision of the Tribunal de Apelación de Sentencia Penal de Guanacaste had in any way indicated that the matter was to be heard solely with the participation of the Procuraduría General de la República.
The answer to those questions is also no, because the trial was annulled, the judgment was declared ineffective, the criminal action remains in force, and the Ministerio Público must participate in the performance of its duties. The defect is absolute, and although the defendant (imputado) was convicted, this could not be interpreted as an outcome satisfying the prosecution service because, as stated, it must act in accordance with its duties and was denied the opportunity to fulfill its role, whether by actually requesting that the defendants be found responsible for the offense or not, or even, after directly receiving the evidence (inmediar la prueba), by requesting an acquittal—under the principle of objectivity (principio de objetividad)—none of which was possible because of the judge’s ruling.
POR TANTO
For reasons different from those asserted, the appeal filed by the defense of defendants [Nombre 001] and [Nombre 002] is granted, and the ruling and the trial preceding it are declared ineffective. The case file is ordered returned to the office of origin for new proceedings before a judge other than the one who issued the decision, in order to safeguard the rights of all parties; in the retrial on remand (juicio de reenvío), the participation of the Ministerio Público must necessarily be permitted. PODER JUDICIAL TRIBUNAL DE APELACIÓN DE SENTENCIA PENAL JUVENIL Resolución: 2023-000153 TRIBUNAL DE APELACIÓN DE SENTENCIA PENAL JUVENIL. Segundo Circuito Judicial de San José, (en función del T.A.S.P. de Guanacaste, sede Santa Cruz) Goicoechea, las quince horas del veintinueve de marzo dos mil veintitrés.
RECURSO DE APELACIÓN interpuesto en la presente causa seguida contra [Nombre 001], mayor, costarricense, cédula de identidad [Valor 001], nacido el 17 de octubre de 1971 y [Nombre 002], mayor, costarricense, cédula de identidad [Valor 002], nacido el 12 de julio de 1955, por un Delito de Adquisición Ilegal de Productos Forestales. Intervienen en la decisión del recurso la jueza Flory Chaves Zárate y los jueces Gustavo A. Jiménez Madrigal y Jorge A. Camacho Morales. Se aperson ó en esta sede el licenciado Edie Roberto Cortés Matarrita, defensor particular del encartado [Nombre 002] y el licenciado Jorge Enrique Porras Leiva, defensor particular del encartado [Nombre 001].
RESULTANDO:
Que mediante sentencia número 677-2022, de las trece horas quince minutos del once de octubre del dos mil veintidós, el Tribunal del I Circuito Judicial de Guanacaste, Sede Santa Cruz, Seccion Flagrancia resolvió: “POR TANTO: De conformidad con lo expuesto y con sustento en los artículos 39 y 41 de la Constitución Política, 08 de la Convención Americana Sobre Derechos Humanos, 14 del Pacto Internacional de Derechos Civiles y Políticos, 01, 30, 31, 45, 50, 51, 59 a 63, 71, 73, 74, 103, y 110 del Código Penal; 01, 03, 06, 09, 45, 142, 265 a 270, y 324 a 367 del Código Procesal Penal, 01, 03, 54, 55, 56, 61 inciso b), 65 y 66 de la Ley 7575 o Ley Forestal, 02 y 31 del Reglamento a la Ley Forestal, este Tribunal declara a [Nombre 001] y [Nombre 002] autores responsables de UN DELITO DE ADQUISICIÓN ILEGAL DE PRODUCTOS FORESTALES, por el cual se le impone como pena, el tanto de UN MES DE PRISIÓN, sanción que deberá descontar en el centro carcelario que los reglamentos penitenciarios indiquen, previo abono de la preventiva sufrida si la hubiere.
De conformidad con lo dispuesto por los artículos 59 a 63 del Código Penal, SE LE OTORGA A LOS SENTENCIADOS EL BENEFICIO DE EJECUCIÓN CONDICIONAL DE LA PENA por un PERÍODO DE PRUEBA DE TRES AÑOS, durante los cuales el condenado deberá de: 1- Abstenerse de cometer otro delito doloso en el que se le imponga una pena superior a los seis meses de prisión. Pues de lo contrario se le podrá revocar el beneficio que aquí se le otorga, y deberá purgar la pena impuesta. Se resuelve la presente sin especial condenatoria en costas. Son los gastos del proceso a cargo del Estado. De conformidad con el numeral 65 de la Ley Forestal, se ordena EL COMISO del camión placa numero [Valor 003] marca Volvo, estilo Fe, modelo 1989 descrito en el acta N° 0156, y de la madera decomisada mediante acta N° 0157. Se acoge la Accion Civil Resarcitoria dejando el valor de la misma en Abstracto. Firme esta sentencia inscríbase en el Registro Judicial y remítanse los testimonios de estilo ante el Instituto Nacional de Criminología y el Juzgado de Ejecución de la Pena.
Oportunamente archívese el expediente y sáquese del libro de entradas del despacho.Mediante su lectura integral notifíquese". (cfr fte y vto fl.208) Que contra el anterior pronunciamiento interpusieron recurso de apelación el licenciado Edie Roberto Cortés Matarrita, defensor particular del encartado [Nombre 002] y el licenciado Jorge Enrique Porras Leiva, defensor particular del encartado [Nombre 001].
Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 465 del Código de Procesal Penal, el Tribunal se planteó las cuestiones formuladas en el recurso de apelación.
Que en los procedimientos se han observado las prescripciones legales pertinentes.
Redacta la Jueza de Apelación, Chaves Zárate, y,
CONSIDERANDO:
I-Sobre la competencia de este Tribunal para resolver este recurso de apelación de sentencia: Conforme el acuerdo de Corte Plena en sesión 22-2022, del 16 de mayo de 2022, artículo XXXIV y acuerdo de Corte Plena en sesión 75-2022 del 19 de noviembre de 2022, artículo XVII, este Tribunal tiene competencia para conocer de las solicitudes de prórroga de prisión preventiva que corresponda conocerlas al Tribunal de Apelación de Sentencia Penal de Guanacaste, sede Santa Cruz, así como de los recursos de apelación de sentencia, conforme los criterios en ambas sesiones definidos y por el plazo allí acordado, que alcanza el primer semestre de este año 2023. En razón de ello, entra a conocer esta Cámara del recurso de apelación en este caso.
II.Admisibilidad: Contra la sentencia número 677-2022, dictada a las 13:15 horas del 11 de octubre de 2022, por el Tribunal Penal de Guanacaste, Sede Liberia, el licenciado Jorge Enrique Porras Leiva defensor particular del encartado [Nombre 001], en fecha 1 de noviembre de 2022, interpuso recurso de apelación (folios 209 a 215 del expediente). Asimismo, consta que licenciado Edie Roberto Cortés Matarrita defensor particular del imputado [Nombre 002], interpuso recurso de apelación (folios 216 a 220 del expediente) . De la revisión de los recursos se evidencian que fueron interpuestos dentro de los quince días hábiles después de la notificación de la sentencia, según lo dispone el artículo 459 del Código Procesal Penal, y cumple con los presupuestos de admisibilidad establecidos por los artículos 458 y 460 de dicho cuerpo normativo, lo cual permite su conocimiento en los términos del artículo 8.2 h de la Convención Americana sobre Derechos Humanos, por lo que se admite para su estudio y resolución de fondo.
III.Recursos de apelación interpuestos por la defensa técnica: El licenciado Jorge Enrique Porras Leiva defensor particular del encartado [Nombre 001] y el licenciado Eddie Roberto Cortés Matarrita defensor particular del imputado [Nombre 002], de forma independiente recurrieron la sentencia condenatoria. A su vez, esta Cámara de Apelación colige que sus formatos son diferentes, pero los argumentos y reclamos vertidos en ambos recursos de apelación de sentencia son idénticos, como a continuación se detallan.
A.- Primer motivo: Los licenciados Porras Leiva y Cortez Matarrita alegaron como primer reproche su inconformidad con la fundamentación jurídica del tribunal de juicio, por una Incorrecta fundamentación de la sentencia. Señalan que el tribunal a quo nunca explicó en su motivación, sobre cómo determinó la forma cómo y en qué lugar los encartados [Nombre 001] y [Nombre 002] adquirieron la madera. Conforme a lo anterior, en criterio de los apelantes, el tribunal a quo realizó conjeturas infundadas en su fallo, violentando de esta manera el derecho de defensa y el principio de inocencia que les asiste a sus representados. En apoyo de sus argumentos transcribieron parte de los hechos que tuvo por demostrado el tribunal de juicio. De seguido, los impugnantes señalaron la existencia del yerro en la fundamentación del tribunal sentenciador, al no percatarse que este proceso no era por un delito de transporte ilegal de madera.
Propiamente así lo sustentaron en sus reclamos: “El yerro es de bulto, pues ni el propio juzgador logró darse cuenta que este asunto es distinto a la acusación por transporte ilegal de madera, al explicar (en) su fallo indica “Así pues analizada individualmente y en conjunto la prueba, conforme a la sana crítica arribamos a una única e inequívoca conclusión que es que, [Nombre 002] y [Nombre 001] se les debe tener como autores responsables del delito de infracción a la ley forestal en su modalidad de adquisición de productos forestales cometido en perjuicio de los recursos naturales conforme se les ha venido atribuyendo puesto que ha quedado debidamente acreditado que fecha de 22 de mayo del año 2020 carretera en el arbolito de pagases fueron detenidos mientras transportaban y poseían madera cocobolo sin demostrar la procedencia y sin contar con la guía respectiva”, es decir, adquirió porque poseyó y transportó madera sin los permisos respectivos” (Los errores ortográficos son del original folios 210 y 216 vuelto del expediente).
En virtud del anterior razonamiento del tribunal de juicio en su sentencia, los licenciados Porras Leiva y Cortez Matarrita señalaron, que el manejo de los verbos típicos que corresponde al delito aquí investigado, el tribunal a quo no podía efectuar razonamientos analógicos lesivos para los imputados, por cuanto en su criterio, el tipo penal estable que se sanciona la adquisición y el tribunal de juicio no podía variar el verbo a uno que se le pareciera o, a otro verbo que se ajuste mejor a la conducta ilícita, pues el ejercicio de la tipicidad se enmarca en el principio de legalidad criminal y con él, la prohibición de la aplicación de la analogía. Conforme a ello, los apelantes señalaron que al estudiar la conducta que fue acusada por la parte querellante, se sabe que dos sujetos viajaban en un vehículo, siendo este automotor detenido por la policía forestal y en el interior de este carro, se llevaba la madera que fue decomisada.
Por lo que, para los recurrentes, si se parte del hecho que el transporte ilegal de manera no se estaba discutiendo en este debate, porque el Ministerio Público que lo acusó originalmente, no participó en este juicio por decisión propia, mientras la Procuraduría General de la República (PGR), en su querella, no imputó el delito de transporte ilegal, porque en su querella no acusó que se transportara la madera sin guías y por ello, para los recurrentes, se tiene que afirmar “que lo que existe es madera en el cajón de un vehículo, sin saber a quién le pertenece dicha madera, pues bien podría la madera ser del señor [Nombre 002] y don [Nombre 001] sólo ser transportista de la madera (que no se acusó), o en su defecto, que el señor [Nombre 001] sea el dueño y transportista de la madera, mientras el señor [Nombre 002] sólo ser un acompañante de este, el cual podría conocer la ilicitud de la adquisición o desconocerla totalmente, lo que propone un problema de tipicidad de la conducta ” (folios 211 y 217 del expediente) .
Por lo anterior, para los recurrentes Porras Leiva y Cortez Matarrita, el verbo adquirir conlleva una entrada de posesión de una cosa, con el poder para disponer de ella, acción que podría hacerlo una persona, pero cuando existen dos o más personas, las variables se amplían en relación con su actuar, de la siguiente manera: i.- Alguna de ellas podría ser totalmente inocente del acto ilícito, ii.- Ambas personas podrían ser responsable, iii.- Alguno de los sujetos podría ser responsable y el otro partícipe de la acción ilegal, iv.- Ambos son solo transportistas de madera que adquirieron de un tercero que no figura en la causa penal. Bajo el anterior análisis, ambos Defensores reprocharon en sus recursos que, el punto radica que tanto la acusación como la sentencia debían proponer la forma en que los acusados concurrieron en la acción ilícita y no se sabe en este caso, quién adquirió la madera, acto distinto a transportar, y bajo esa tesitura, en su criterio, la adquisición podría ser ilícita, a pesar que el transporte no lo fuera.
A la vez, los apelantes, aportaron como un ejemplo de sus alegatos, el sustentar que la madera se podría haber comprado de manera legal y transportarse ilegalmente. De ahí que, en su criterio, no se puede equiparar una conducta de transporte ilegal con la adquisición, en virtud del bien jurídico protegido. Motivo de ello ambos defensores sostuvieron en sus recursos que el “principal pecado de este proceso, es que la premura del procedimiento de Flagrancias, no existió investigación, de manera que originalmente todo se centró en el transporte ilegal, de forma que nunca se averiguó quien, cómo, cuándo o dónde se adquirió esa madera, el problema surge, cuando el Ministerio Público abandona el ejercicio de la acción penal y deja la PGR sólo con una querella por hechos que nunca fueron objeto de verificación y que a diferencia del transporte, No sucedieron en flagrancia conforme describe el numeral 236 del CPP, pues la adquisición como acción concreta, se dio tiempo antes de la detención de los encartados, sin que esta hubiese presenciada por los oficiales del SINAC o por alguna otra persona que hubiese declarado en el debate ” (folios 211 y 217 vuelto del expediente).
De manera consecuente, tanto para el licenciado Porras Leiva como para el licenciado Cortez Matarrita cuestionaron que el órgano juzgador en su fundamentación cambio el significado del verbo “adquisición” por “poseer”, y con esto en criterio de los recurrentes, la acción ilícita, todo por cuanto, de acuerdo con el raciocinio del juzgador en su fallo, equiparó conductas al estar autorizado por la naturaleza de la industria y del bien poseído. En apoyo de su reclamo, transcriben un fragmento de la fundamentación dada por el juez en sentencia en ese sentido. Motivo de este razonamiento del órgano juzgador, para ambos recurrentes, resaltaron que el artículo 2 del Código Penal, estableció la prohibición de la analogía para imponer una sanción y reiteran que no es lo mismo poseer que adquirir. A la vez, que señalaron, que aún si lo que el tribunal juzgador pretendía, porque no lo dijo en su fallo y el sostener que en la adquisición llevaba implícita una posesión o viceversa, debió profundizar el juez en su análisis para entender desde la perspectiva jurídica los alcances del verbo poseer, de acuerdo con su concepto previsto en este según el diccionario de la Real Academia Española en adelante RAE, que aporta la situación de poder sobre las cosas, el cual cita.
Por lo que para ambos recurrentes, el poder de una cosa implica la capacidad de tomar decisiones sobre ella, siendo este acto que no se acreditó durante el debate, a pesar que, ambos recurrentes así se lo indicaron al tribunal de juicio. A la vez que para los recurrentes “…el poder sobre una cosa, implica la capacidad de tomar decisiones sobre ella, acto que en la especie no se acreditó para ninguno de los dos imputados, y que fuimos bastos en indicárselo al tribunal de juicio durante el debate...”. (folios 212 y 218 del expediente). Por lo que, los defensores Porras Leiva y Cortez, en ese punto de la sentencia, el juez, no pudo tener por demostrado el momento material de la adquisición de la madera por parte de alguno de los imputados, la adquirió hubiera sido lícita. Lo que, para los recurrentes, es importante el determinar si la adquisición hubiera sido conforme a las reglas que estableció el artículo 236 del Código Procesal penal, el panorama sería distinto, sin embargo, en la modalidad del transporte, no sería la adquisición.
Con forme a lo anterior, para ambos impugnantes, los oficiales forestales no solicitaron las facturas de compra de la madera, ya que no es un documento válido para transportar madera en trozas, y por ello no se ocuparon en verificar si la madera fue adquirida legalmente en el lugar autorizado para hacerlo o no Por ello, en criterio de los recurrentes, le correspondía al ente acusador y al tribunal en la sentencia, demostrar que la adquisición era ilegal, de acuerdo con el modelo acusatorio costarricense. Los recurrentes transcriben parte del razonamiento del juez, en relación con el abordaje que éste efectuó en relación a que el co imputado Adalberto, se abstuvo de declarar, sin señalar que no conocía que se transportaba en el camión. Para los apelantes, este raciocinio realizado por el juez en su fallo, conlleva como primera conclusión que el tribunal sancionó al imputado por no declarar, omitiendo que ambos imputados durante el debate rechazaron los cargos acusados.
Y la segunda conclusión es que el juzgador siempre tuvo conciencia que se estaba juzgado un transporte ilegal de madera. De manera consecuente el agravio consistió en la violación de deber de fundamentar adecuadamente el fallo.
B.-Segundo motivo, titulado falta de fundamentación respecto del concurso de personas, Alegaron los impugnantes, que el tribunal de juicio en su fundamentación, no realizó un razonamiento sobre la participación de los encartados en los hechos, únicamente los declaró autores responsables de delito de infracción a la ley forestal en su modalidad de adquisición de productos forestales. A la vez que citan dicho fragmento de la sentencia oral. Conforme a ello, los apelantes aducen que, al existir un concurso de personas en un delito en su criterio era obligación del juzgador establecer las cuotas de participación de cada uno de ellos en la acción típica, sea como coautores o colaboradores, ya que si son coautores, debía indicar si tipo de coautoría, es decir si fue sucesiva o accesoria, pero si es una simple colaboración, establecer cuál fue el aporte causal en el delito de cada uno de los encartados, a partir de la prueba existente. Sin embargo, señalaron que solo se indicó que eran autores del hecho, sin explicación al respecto y ante la ausencia de fundamentación de la ubicación de cada uno de los encausados dentro del nexo causal convierte en su criterio a la sentencia en una pieza ineficaz, de conformidad con el artículo 142 del Código Procesal Penal, que así lo estipula como sanción. Por ello sostienen que se lesionó el derecho humano, siendo ese el agravio ocasionado.
C.-Tercer motivo, se alega la inexistencia de fundamentación, respecto a la acción civil resarcitoria , ya que el juez se limitó a decir, que no se referiría a profundidad y que se condenaba en abstracto. Para lo que transcribieron en sus recursos dicha manifestación del tribunal de juicio. De manera consecuente, ambos recurrentes sostuvieron que no saben bajo que normativa, precepto legal en el cual, se fundamentó el tribunal a quo para dictar la sentencia condenatoria civilmente. No se hizo un análisis del nexo de causalidad entre el comportamiento y lo perjudicado. Tampoco se señaló el motivo por el cual, sus representados son responsables civilmente, ni se explicó cuáles fueron los daños y perjurios causados por ellos, mucho menos los hechos de la acción civil resarcitoria que se tuvo por demostrados. Reiteraron que el agravio ocasionado consistió, en el quebranto del deber de fundamentación lesionando la garantía del debido proceso sin una sentencia adecuadamente fundamentada, se le deniega la justicia.
Solicita que se declare con lugar el recurso de apelación, se anule la sentencia venida en alzada y se ordena el reenvió con una nueva integración IV Posición de la Procuraduría General de la República, la licenciada Kasandra Mora Salguero Procuradora Penal, en su condición de representante de los intereses del Estado, contestó la audiencia conferida, solicitando que los recursos planteados se declaren sin lugar, por ser ambos recursos una manifestación de inconformidad, por lo adverso que resulto la sentencia condenatoria en contra de los querellados y demandados civiles [Nombre 001] y [Nombre 002].
Licenciada Mora Salguero aclaró que la Procuraduría General de la República, fue la parte acusadora y actora civil, no así el Ministerio Público Motivo por el cual, la Procuraduría General de la República, recurrió el fallo ante el superior. Recurso de apelación que fue declarado con lugar por parte del Tribunal de Apelación de Santa Cruz, mediante resolución de las 10:45 horas del 28 de julio de 2022, que ordenó el reenvío para la realización de un nuevo juicio. Debate que se realizó el 11 de octubre de 2022 y en el cual se dictó la sentencia aquí recurrida. De seguido, la Procuradora Penal, sostuvo que no existe el primer vicio alegado que versa sobre una “Incorrecta fundamentación de la sentencia ”, porque se acusó por parte de la Procuraduría General de la República, el delito de infracción a la Ley Forestal, previsto en el artículo 61 inciso b) de la Ley Forestal, en su modalidad de adquisición de productos forestales, tipo penal contenido en este artículo no exige demostrar cómo o en qué condiciones se dio la adquisición, donde fue adquirida y mucho menos quién la adquirió, como pretende ambos apelantes en sus reclamos, pues la única exigencia es incumplir con los requisitos que el propio numeral 61 inciso b de la Ley Forestal establece.
Ello, porque para la Procuradora Penal, el legislador costarricense previó la sanción punitiva a quien adquiera de forma ilícita productos forestales, los cuales no se encuentran a la libre disposición de los administrados, en el caso de los recursos naturales existe un interés por regular la forma en que son utilizados y consumidos, ello en procura del sostenimiento del adecuado equilibrio ecológico. Por lo que los productos forestales deben, en su criterio acompañarse siempre de la documentación que permita ejercer legítimamente el provecho de los recursos, lo cual, se desprende del artículo 55 de la Ley Forestal, el cual cita. Motivo por el cual, sostiene la licenciada Mora Salguero, que en este caso en concreto, la conducta típica descrita en la querella, fue colmada por el actuar de los querellados, “toda vez que adquirieron los productos forestales sin contar con permiso alguno no documentación que al menos acreditara un aprovechamiento lícito de productos forestales, sino que por el contrario, los querellados no contaban con documento alguno que demostrara la lícita procedencia y tenencia de los recursos forestales que establece dicho artículo y así quedó demostrado con la prueba que consta en autos” (folio 226 del expediente).
Por lo que, para representante del Estado, al manifestar los defensores cada uno por separado en un recurso, “pero de forma idéntica en su redacción” (folio 226 del expediente). Para lo cual, citó un fragmento del argumento dado por ambos impugnantes en sus recurso de apelación, en el cual, alegaron que, lo que existió fue un problema de tipicidad de la conducta, en virtud que no se acusó a quién pertenecía la madera y lo único que se podía afirmar era que lo que existió fue madera en el cajón de un vehículo, sin saber a quién pertenece, pues podría ser del co encartado [Nombre 002] y ser [Nombre 001] el transportista de la madera, o en su defecto, éste último ser su dueño y transportista de la madera, mientras el querellado [Nombre 002], el acompañante, conociendo o desconociendo la ilicitud de la adquisición. Por lo que, la Procuradora General, ante dicho alegato sustentado por los recurrentes, aunque ambos querellados no fueron sorprendidos al momento de la entrada en posesión de los recursos forestales, lo cierto es que ya los poseían y transportaban en un camión, por lo que lógicamente se sigue que los adquirieron y que aprovecharían en su beneficio.
Aunado que, para la representante de la Procuraduría General de la República, la tipicidad objetiva no exige la demostración de la forma o momento de la adquisición; porque, como bien mueble que es, la madera aserrada o en troza, es susceptible de aplicar la presunción de que la posesión vale por título, tanto así que al tener las trozas dentro de un camión que le pertenece al imputado [Nombre 001], porque siempre será necesaria la documentación que demuestre el origen de la madera como su legítimo aprovechamiento o legitima adquisición, a través de un certificado de origen, o un permiso de aprovechamiento, o una factura en el caso de que proceda de la industria. Además, señaló con respecto al reproche de los recurrentes en el sentido de que la persona que adquirió la madera podría haberlo efectuado de forma lícita pero el transporte no lo fuera, del cual citó dicho reclamo, refutó señalando que tanto el criterio del tribunal de apelación de sentencia de Guanacaste, sede Santa Cruz, que fue retomado en la sentencia 53-16 de las 15:21 horas del 9 de marzo de 2016, sin indicar el tribunal, pero en el cual, copio parte de un fragmento de su razonamiento, en el cual se alude que para el transporte de madera, se requería el contar con la documentación respectiva, dependiente de cada supuestos como la guía de autorización, certificado de origen, etcétera y de la cual se derivará una interpretación armónica y sistemática con los artículos de la ley forestal.
A la vez que indica la Procuradora Penal, fustigó el argumento de los apelantes que los oficiales de la policía forestal no solicitaron las facturas de compra de la madera, como ser obligación del órgano acusador y del tribunal de acreditar la adquisición ilegal. En virtud, que para de la licenciada Mora Salguero en su función de querellante y actora civil del Estado, sostuvo que, si alguien teniendo un documento que acredite la adquisición licita del producto forestal, su conducta sería el no dejar que le atribuyeran la comisión de un delito. Por lo que, la forma de razonar, de los apelantes, en su criterio lidia con la lógica más elemental, y aún más partiendo que el imputado [Nombre 001], quién manifestó que la actividad a la que él se dedicaba era comerciante y transportista, debiendo para la representante del Estado, de conocer el querellado [Nombre 001], los requisitos para realizar transporte de madera.
Aunado a ello señaló la licenciada Mora, que en este caso no se cuestionó la idoneidad de la documentación para el transporte de manera, sino a los querellados se les atribuyó la total ausencia de documentos, por lo que no los apelantes no les asiste la razón, ni está relacionado en forma alguna con el razonamiento contenido en la sentencia. También para la representante del Estado, alegó la existencia de un contubernio entre los querellados que se vio plasmado a pesar de la existencia de dos defensores particulares, pero quienes interpusieron recursos de apelación siendo copia idéntica. Propiamente así lo señaló la licenciada Mora Salguero: “…Y es que llama la atención en este caso en concreto que si bien cada uno de los imputados tiene su propio representante legal (que es lo correcto para evitar conflictos de interés) los recursos presentados son una copia fiel uno del otro, donde cada uno de los defensores lo que cambia es el encabezado, pero al replicar el documento hacen la defensa de los dos imputados, lo cual no solo denota el contubernio entre los dos encartados, sino la imposibilidad de que si la responsabilidad recae únicamente sobre uno de ellos (como quisieron hacerlo ver), el otro lo manifestara ya sea al momento de la detención o en cualquier etapa del proceso en su defensa…” (Cfr.
Folio 227 vuelto). Por otra parte, también para la querellante y actora civil, el alegato de los recurrentes sobre el análisis que hizo el tribunal de juicio en relación que el querellado [Nombre 002], quien no señaló que no tenía participación en los hechos, fue con el fin que éste ejerciera su defensa material, haya declarado o no durante el debate. Sin embargo, los apelantes, se valen de dicha fundamentación para intentar inducir a error al Tribunal de Apelación al indicar que el Tribunal invirtió la carga de la prueba y, que el Juez estaba conociendo era un transporte de madera, lo cual señala la Procuradora Penal, que no es cierto, porque ese verbo fue utilizado en la querella como pudo haber sido cualquier otro que describiera “la acción de movilizar de un lugar a otro con el fin de sacar el provecho de la adquisición ilegal” (folio del expediente). De allí que citó el voto 315-22 de las 10:45 horas del 28 de julio de 2022 del Tribunal de Apelación, en el cual se desarrolló a la luz del articulo 55 de la ley Forestal, que la persona “deberá comprobar que el producto forestal está amparado por el respectivo permiso de aprovechamiento cuando proceda o bien, demostrar su procedencia, cuando la Administración Forestal del Estado lo solicite”.
(La negrita es suplida)” (folio del expediente). Circunstancia que no se cumple en el presente caso, porque no portaba permiso que demostrar la procedencia de la madera de cocobolo que llevaban dentro del camión o algún tipo de documento como una factura que los hubiera hecho caer en algún error de que la adquisición había sido licita. Finalmente, en relación con la condena de la acción civil planteada por la Procuraduría General de la República en forma abstracta, argumentó que el artículo 432 del Código Procesal Penal, permite, la condenatoria en abstracto y en este caso en virtud del daño ocasionado al ambiente. No existiendo a su criterio omisión con el fin de provocar la ineficacia de la sentencia, ya que al remitirse al proceso de ejecución de sentencia tendrá la parte toda la posibilidad de presentar sus argumentos con respecto a la condena civil. Por lo que solicita que se declara sin lugar el recurso de apelación presentado por ambos recurrentes y se mantenga la sentencia incólume. este reclamo debe ser desestimado por informal y carente de rigor.
Con lugar el recurso de apelación. Por razones distintas a las alegadas por la Defensa se declara con lugar el recurso de apelación presentado. En la determinación de los defectos absolutos la normativa procesal artículo 178 establece: " No será necesaria la protesta previa y podrán ser advertidos aun de oficio, los defectos concernientes: a) A la intervención, asistencia y representación del imputado en los casos y formas que la ley establece o los que impliquen inobservancia de derechos y garantías previstos por la Constitución Política, el Derecho Internacional o Comunitario vigentes en el país y la ley. b) Al nombramiento, capacidad y constitución de jueces o tribunales. c) A la iniciativa del Ministerio Público en el ejercicio de la acción penal y su participación en el procedimiento.
Luego de una revisión integral del fallo y del juicio oral que lo precedió, esta Cámara de Apelación detecta que al inicio del debate el juez a quo excluyó al Ministerio Público del proceso penal incoado, esto bajo la justificación de que en la celebración de un primer debate que resultó con una absolutoria de los encartados, la Fiscalía no presentó recurso de apelación. Como argumento de dicha resolución se aduce que el Tribunal de Apelación de Sentencia de Guanacaste dispuso que se conocieran los hechos en un nuevo juicio con base en la querella y la acción civil resarcitoria presentada por la Procuraduría General de la República. Para analizar lo actuado por el a quo lo primero que se debe indicar es que el Tribunal ad quem mediante voto 315-22 de las 10 horas 45 minutos del 28 de julio de 2022 indica: "...por lo que no es cierto lo indicado por el juzgador que para esta especie sea necesaria la demostración por parte del ente acosador de qué su origen edad de plantación o de bosque, porque como se indicó, se trata de una especie en peligro de extinción, de las amparadas en la vida del decreto referido, por lo que su comercio y transporte es restringido por el Estado; situación que debió discutirse en el debate.
Por consiguiente, se declara con lugar el recurso de apelación interpuesto por la Procuraduría General de la República, se anula la sentencia en relación con absolutoria dictada por los hechos querellados por la Procuraduría General de la República y para la acción civil resarcitoria interpuesta por la representación del Estado. Se ordena el reenvío del expediente para una nueva sustanciación en lo pertinente. Y la parte dispositiva indica: Por tanto se declara con lugar el recurso de apelación interpuesto por la Procuraduría General de la República, se anula la sentencia en relación con la absolutoria dictada por los hechos querellados por la Procuraduría General de la República y para la acción civil resarcitoria impuesta por la representación del Estado. Se ordena el reenvío del expediente para una nueva sustanciación en lo pertinente. Con otra integración. Notifíquese" (cfr. folio 182 del legado principal).
Sobre la base de lo expuesto se debe indicar en primer lugar que el juzgador tomó como fundamento la resolución del Tribunal de Apelación de Senencia Penal en la que se interpreta algo que el fallo no indica, como lo es que el Ministerio Público no puede intervenir, pero además no podría indicarlo porque sería construir una sanción atípica o consecuencia no prevista por el ordenamiento procesal al ente fiscal por no haber apelado. Mas aun la resolución del Tribunal de Apelación de Sentencia Penal de Guanacaste lo que hace es acoger el recurso de la Procuraduría General de la República, pronunciarse sobre el recurso incoado con las consecuencias jurídicas que correspondan, pero no le tiene que decir al tribunal lo que debe de hacer, sino únicamente que ha emitido criterio sobre lo que le fue sometido a su consideracion "lo pertinente" según su competencia y sin ir mas allá, pero lo cierto del caso es que declaró la ineficacia de la sentencia, por lo que de ningún modo ha dejado de existir la acción penal y por ello resulta grave el error de la defensa privada al solicitar la exclusión de la Fiscalía por la frase consignada por el superior al indicar que se conozca nuevamente "en lo pertinente", pues nada de lo resuelto quedó incólume.
Por otra parte, de la revisión del debate se puede inferir que la señora Fiscala se vio sorprendida frente a este tipo de gestiones y nada más indicó que sí debía de continuar en el debate, y aunque a los ojos de este Tribunal resulta grave que la Fiscalía no protestó por la grave violación al principio de intervención del ente fiscal, lo cierto del caso es que el vicio es absoluto y por ello declarable de oficio en esta sede aunque no se haya hecho la protesta respectiva. Admitir el criterio externado por el a quo implica no solamente llegar a una contradicción insalvable de que los hechos acusados por parte de la Fiscalía se encuentran firmes, sino que podrían afectar los hechos acusados en la querella en cuanto coinciden en el cuadro fáctico respecto de la adquisición y trasiego de productos forestales. Aunado a lo anterior, el recurso planteado por la Procuraduría General de la República y que fuera acogido por el ad quem, tiene consecuencias jurídicas para todas las partes, no solamente para la parte recurrente como lo interpretó el juez, al punto de que según él mismo indicó, que para resolver la exclusión o no del Ministerio Público planteada por la Defensa, se fue a revisar la sentencia declarada ineficaz, para con ello interpretar (lo pertinente) la resolución del Tribunal de Apelación de Sentencia Penal de Guanacaste y con ello escindir las distintas participaciones de los intervinientes.
Si bien es cierto resulta lamentable la pasividad de la representación fiscal a lo largo de todo este proceso, es lo cierto que la forma jurídicamente incorrecta como se le excluyó no puede ser sustentada sin incurrir en violación al principio de legalidad procesal y con ello al debido proceso. Tampoco hay hechos o circunstancias consolidadas, precisamente por la actuación oportuna de la Procuraduría y aun admitiendo que el debate se fundamente solamente en los hechos que acusa la parte querellante, ello no da autorización legal para que se excluya a la Fiscalía. Admitir este tipo de actuaciones conlleva a considerar erróneamente que el fallo adquirió firmeza parcial en cuanto a los hechos descritos por el Ministerio Público y no pueden ser discutidos, pero sí lo pueden ser los de la querella, nada de lo cual se extrae de la resolución del ad quem, dejando incongruente el actuar del a quo.
No se puede tampoco alegar que hubo falta de interés del ente fiscal, el cual sí se presentó a juicio, pero fue arbitrariamente excluido cuando iba a proceder a la lectura de la acusación. Por otra parte, admitir la inercia fiscal como presupuesto para excluirlo del proceso implicaría imponerle una sanción procesal,no prevista por el legislador.Independientemente de que la señora Fiscala no haya mostrado interés por presentar una protesta procesal de carácter absoluto ante la resolución del a quo. Si bien esta Cámara se sorprende de dicha inacción lo cierto del caso es que esa circunstancia no autorizaba al a quo al excluir una parte procesal y tampoco puede esta Cámara convalidar un yerro de esta naturaleza. Lo cierto del caso es que la primera sentencia fue declarada ineficaz, por resolución del ad quem que en ningún momento señala que la Fiscalía no puede intervenir, como tampoco se podría indicar en este momento que no hay perjuicio porque la señora Fiscala se retiró dócilmente.
A pesar de ambas actuaciones el ejercicio de la acción penal se mantiene incólume y eventualmente lo único que se debería analizar es el actuar de la representación fiscal para que a lo interno del Ministerio Público se determine si esto es un problema de capacitación o conocimiento de las propias funciones encomendadas al ente fiscal, lo cual comprendería también al juzgador quien dirigió este debate. Tampoco se puede alegar que el defecto es saneable con apersonar en este momento al ente fiscal, puesto que con ello se violentaría el deber de objetividad, edificando que el único fin de la Fiscalía en el proceso penal es lograr la condenatoria de una persona imputada, pero también el principio de unidad de actuaciones y dependencia jerárquica, dado que en este caso ni siquiera se puede valorar una enmienda (art 18 LOMP). Aunado a lo anterior la Fiscalía no solo actúa en la etapa de investigación y juicio, sino en la de impugnaciones o en la ejecución de sentencia, todo lo cual se vería afectado dentro de la lógica del proceso penal, de ahí que por su propia naturaleza, el defecto absoluto no puede se convalidado de ninguna manera, ni siquiera aceptando que una condena en lo penal, que se acerque a las pretensiones punitivas del Ministerio Público, sería razón válida para indicar que no hay perjuicio, porque dicha condena se acerca a lo pretendido inicialmente.
Sin pretender ser reiterativa esta Cámara considera que la condena no se ha obtenido dentro de la legalidad del proceso, el no recurrir la primera sentencia no puede interpretarse como un sanción procesal que derive en una limitación para el ejercicio de la acción penal y mucho menos que se ha consolidado legalmente la incapacidad del ente fiscal para continuar con su intervención incluso con sus pretensiones punitivas, el menoscabo a la iniciativa del Ministerio Público y al debido proceso se da a partir de excluir coactivamente a una de las partes esenciales del proceso, el vicio absoluto no se puede convalidar ni por la inercia del Ministerio Público, ni mucho menos por la condenatoria adquirida por la parte actora penal (Procuraduría General de la República). Finalmente, el debate tiene errores graves que tornan ilegítimo el fallo en contra de los encartados, al punto incluso que ni siquiera hay razonamientos para ordenar la salida de la audiencia de la Fiscala, y peor aun el juez alega que previo a ello, se fue a imponer de la totalidad del fallo para definir si la Fiscalía debía o no permanecer en juicio, lo que implicó tener un conocimiento o visión previa de lo que se iba a producir.
Se está ante un delito de acción pública (Infracción a la Ley Forestal) lo que permite entender que desde la normativa procesal la acción penal sigue pendiente de resolución (cfr 19, 72 y 74 del Cpp) no ante un ilícito de acción privada de los previstos en el artículo 20 del CPP, tampoco se ha convertido la acción pública en privada por lo que el procedimiento es el ordinario y la Fiscalía debía y debe seguir interviniendo. Si bien es cierto la Defensa fue la que presentó erróneamente la gestión y lo esperable es que el Ministerio Público tuviera una posición más clara y enérgica frente a un acto irregular, lo cierto del caso es que el juez conoce el derecho y debió resolver lo que corresponde, es decir continuar con el juicio con la presencia de todas las partes. A mayor abundamiento el artículo 321 indica: Presupuesto para la apertura a juicio El auto de apertura a juicio se podrá dictar con base en la acusación del Ministerio Público o la del querellante.
Si se abre el juicio con base únicamente en la acusación particular, el querellante continuará en forma exclusiva el ejercicio de la acción, sin perjuicio de que el representante del Ministerio Público opte por continuar interviniendo en el procedimiento, pero no estará obligado a mantener la pretensión de aquel. Como puede apreciarse la intervención del Ministerio Público está plenamente garantiza por Ley e incluso puede participar, si solamente se admitiera la acusación de la parte actora penal o querellante, puede incluso seguir adelante con el proceso y hasta separarse de la pretensión de la parte actora penal. En tal supuesto, la decisión de no seguir interviniendo es del Ministerio Público y no de la autoridad jurisdiccional, como sucedió en este caso. Por lo anterior, resulta claro que ante la declaratoria de ineficacia de una sentencia absolutoria, no gestionada por por el Ministerio Público, podía volver a juicio en aras de continuar con el proceso y cumplir el rol que le corresponde.
Así, el cuestionamiento acá es si el juez a quo podía excluir al Ministerio Público, porque este no presentó recurso de apelación contra la sentencia absolutoria, como parece entenderlo el juzgador, cuestionamiento al que esta Cámara responde señalando la imposibilidad jurídica de dicha exclusión por las razones supra expuestas. El segundo aspecto es si la interpretación que hizo resulta atinente, en especial porque el tribunal de juicio lo que está haciendo es sancionando procesalmente a la Fiscalía por su inercia, pero sin un fundamento legal que lo permita y si de algún modo la resolución del Tribunal de Apelación de Sentencia Penal de Guanacaste había señalado que el asunto debía conocerse solamente con la intervención de la Procuraduría General de la República, a las que responde también que no, porque el debate fue anulado, la sentencia declarada ineficaz, la acción penal sigue subsistiendo y el Ministerio Público tiene que intervenir en el ejercicio de sus funciones.
El vicio es absoluto, y aunque se haya condenado al imputado ello no podría interpretarse como un logro que satisfaga al ente fiscal, porque incluso como se mencionó, este debe actuar de acuerdo a sus funciones y no tuvo la oportunidad de cumplir con su rol ya sea pidiendo efectivamente que se considerara a lo encartados responsables o no del delito, sino incluso luego de inmediar la prueba pudo haber pedido una absolutoria (principio de objetividad) nada le lo cual fue posible por la resolución del juez.
POR TANTO
Por razones distintas a las alegadas se declara con lugar el recurso de apelación presentado por la defensa de los encartados [Nombre 001] y [Nombre 002], se declara la ineficacia de la resolución y del juicio que la precedió. Se ordena devolver el expediente a su oficina de origen para una nueva substanciación por una persona juzgadora distinta a la que resolvió en resguardo de los derechos de todas las partes, juicio de reenvío en el que deberá necesariamente permitirse la intervención del Ministerio Público.
