Decision: 2023-0538 Case file: 12-001958-0472-Pe CRIMINAL JUDGMENT APPEALS COURT. Second Judicial Circuit of San José. Goicoechea, at fifteen hours thirty minutes on the twenty-fourth day of April twenty-three.- APPEAL filed in the present proceedings brought against [Nombre 001], of legal age, Costa Rican, identity card number [Valor 001], born in Limón on 8 de noviembre de 1951, son of [Nombre 002] and [Nombre 003], divorced, retired, resident of Limón; [Nombre 004], of legal age, Costa Rican, identity card number [Valor 002], born in Alajuela on 7 de diciembre de 1963, son of [Nombre 005] and [Nombre 006], single, farmer, resident of Limón; [Nombre 012], of legal age, Costa Rican, identity card number [Valor 003], born in Limón on 21 de marzo de 1968, son of [Nombre 008] and [Nombre 009], married, farmer, resident of Limón, for the offenses of UNLAWFUL OCCUPATION (USURPACIÓN) AND VIOLATION OF THE LEY FORESTAL, to the detriment of [Nombre 014].

Attorney Rodolfo Price Chinchilla appeared before this Court as private defense counsel, attorney José Ramírez Torres as public defender, attorney Randall Alban Aguirre Mena on behalf of the Procuraduría General de la República, and attorney Alan Elizondo Medina as private complainant (querellante) and.
FINDINGS:
I.By judgment number 045-2023, issued at eight hours on the twenty-third day of January two thousand twenty-three, the Criminal Court of the First Judicial Circuit of the Zona Atlántica ruled: “POR TANTO: In accordance with the foregoing; Articles 39 and 41 of the Constitución Política; Articles 1 through 6, 9, 31, 33, 34, 140, 142, 182, 184, 265, and 341 through 366 of the Código Procesal Penal; and Article 1, 140, of the Código Penal, IT IS HEREBY ORDERED: [Nombre 001], [Nombre 004], AND [Nombre 012] are acquitted of all punishment and liability for the offenses of unlawful occupation, tree cutting (tala de árboles), and land-use change (cambio de uso de suelo) with which they had been charged as committed to the detriment of [Nombre 014], [Nombre 020], and the Ley Forestal. No special award of costs is entered, and the expenses of the criminal proceedings shall be borne by the State. All precautionary measures (medidas cautelares) imposed on the defendants are hereby lifted.
The restoration of matters to their previous condition is ordered; consequently, the defendants herein are ordered evicted and the structures demolished. For that purpose, the appropriate police authorities are authorized to carry out the actions necessary to destroy the buildings located on the property represented by survey plan [Valor 004], land in the province of Limón, real-property folio registration [Valor 005]. Notice shall be given by reading.-” (sic).
III.Following the respective deliberation in accordance with Article 465 of the Código Procesal Penal, the Court considered the issues raised in the appeal.
Criminal Judgment Appeals Court Judge Quesada Salas writes the opinion; and,
CONSIDERING:
I.Admissibility based on timely filing. The appealed judgment is number 045-2023, issued at 08:00 hours on 23 de enero de 2023 by the Criminal Court of the First Judicial Circuit of the Zona Atlántica, which acquitted defendants [Nombre 001], [Nombre 004], and [Nombre 012] of all punishment and liability for the offenses of unlawful occupation, illegal tree cutting, and land-use change. The restoration of matters to their previous condition was also ordered, including the defendants’ eviction and the demolition of the structures. By a pleading filed on 20 de febrero de 2023, attorney Rodolfo Price Chinchilla, acting as private defense counsel for defendant [Nombre 012], and by a written submission filed on 20 de febrero de 2023, attorney José Ramírez Torres, public defender for [Nombre 001] and [Nombre 004], filed appeals against the aforementioned judgment. Review of the appeals established that they were filed within 15 business days after notice of the judgment, as provided by Article 459 of the Código Procesal Penal, and that they satisfy the admissibility requirements established by Articles 458 and 460 of that body of law, thereby permitting their consideration under Article 8.2 h of the Convención Americana sobre Derechos Humanos. They are therefore admitted for examination and a decision on the merits.
II.Inadmissibility (inadmisibilidad) for lack of prejudice (agravio) with respect to the first ground of attorney Price Chinchilla’s appeal. The appellant objected that he was not acquitted with certainty, but rather on the basis of doubt, stating that the acquittal based on doubt prevented him from filing a malicious-accusation complaint (denuncia calumniosa) against the complainants and, moreover, in the appellant’s view, affected his ability to initiate adverse-possession proceedings (procesos de usucapión) based on agrarian possession (posesión agraria). He argued that the accused’s participation was unclear even from the description of the facts in the indictment (acusación), and that there was no evidence establishing in any way that the defendant committed the charged offense of unlawful occupation (usurpación). He further argued that the complaints did not specifically mention any concrete acts carried out by [Nombre 012].
Although this ground mentioned that ordering the eviction (desalojo) was improper, that issue is properly the subject of the second ground of appeal. It was reiterated that the evidence presented at trial did not establish any action by the accused relating to the events described in the indictment. The ground is declared inadmissible. It does not satisfy the formal requirements for filing because it fails to describe the prejudice caused to the complaining party, as required by numeral 460, paragraph 2, of the Code of Criminal Procedure (Código Procesal Penal), which provides: “(…) The appellant shall state the grounds for disagreement, the prejudice caused, and the relief sought. In the same act, the appellant shall offer evidence in support of the arguments. (…)” (emphasis added). Under the heading “prejudice caused,” the challenge stated verbatim: “By considering events not charged in order to support an acquittal based on doubt, the trial court directly prejudiced my client because it deprived him of his right to receive an acquittal based on certainty, since it was proven that the core allegation contained in the indictment never existed.” This Chamber finds that the appellant did not demonstrate that the accused, [Nombre 012], suffered any harm from having been acquitted on the basis of doubt rather than certainty, since the acquittal does not prevent the defendants from initiating any legal proceedings they deem appropriate, filing a complaint for the offense of malicious accusation, or bringing agrarian proceedings (proceso agrario).
A ground of appeal must satisfy a series of formal requirements so that its relevance may be assessed at an initial stage. Although the appellant did provide grounds for the appeal and sought the accused’s acquittal based on certainty as to his innocence, requesting that this Court so order, neither the “prejudice” section at folio 27 of the appellate record (legajo de apelación) nor the appeal as a whole identifies the prejudice that the appellant claimed to have suffered as a result of the trial court’s decision. In other words, it does not identify the harm caused by his acquittal under the principle of in dubio pro reo rather than on the basis of certainty. On several occasions, including in the section entitled “prejudice,” it was asserted that the judgment under appeal acquitted the accused on the basis of doubt, thereby affecting his ability to initiate other criminal and agrarian proceedings.
This is incorrect, since nothing prevents [Nombre 012] from initiating any proceedings he deems appropriate. Furthermore, as reflected in the record, throughout the criminal proceedings against him, [Nombre 012] was never subjected to the precautionary measure (medida cautelar) of pretrial detention (prisión preventiva) or to any other measure restricting his freedom. Thus, Article 271 of the Code of Criminal Procedure provides for the factual situation in which, by way of illustration, an appeal filed by an acquitted defendant would be admissible: “Duty to compensate. The State shall compensate any person who has been improperly subjected to a precautionary measure by a public official who acted arbitrarily or with gross negligence, under the terms of Article 199 of the General Law of Public Administration (Ley General de la Administración Pública). In such a case, the official shall be jointly and severally liable with the State.
Compensation shall also be payable, solely by the State, when a person has been subjected to pretrial detention and is subsequently granted a dismissal (sobreseída) or acquitted, upon full proof of innocence.” The foregoing is relevant when considered in accordance with the rules governing objective appealability (impugnabilidad objetiva), since numerals 439, 459, and 462 of the Code of Criminal Procedure establish, as a general rule, that a person who has suffered or may suffer prejudice as a result of the decision may appeal; “prejudice” must be understood as the material or moral harm or burden that a ruling causes a litigant (https://dpej.rae.es/lema/agravio). If no prejudice exists, the challenge is inadmissible. In other words, to have the right to file the appeal, the appellant must establish standing (legitimación): the appellant must be authorized to pursue a means of challenge (medio impugnativo) and must have an interest in obtaining review of the ruling being challenged.
This interest arises from being prejudiced or harmed by the ruling, meaning that the appellant must identify the injury suffered by the appellant’s rights and interests. The aggrieved party will generally be the party upon whom the ruling has a negative effect; thus, prejudice establishes standing to challenge, without prejudice to the possibility that there may be no interest in appealing and, therefore, no need for an appeal. In reality, the appellant devoted considerable effort to demonstrating the alleged defect but never established specifically how it adversely affected the defendant. It is clear that the accused was acquitted; that is, he was released from all criminal punishment and liability for the offenses attributed to him. Neither the section entitled “prejudice” nor a comprehensive review of the appeal reveals the harm that the judgment caused the accused. Article 439 of the Code of Criminal Procedure establishes that only a person who has suffered prejudice may appeal and that the appeal must be based on a challenge to the defects causing that prejudice.
It is evident that if there is no interest of the kind contemplated by law, the person’s appellate activity (actividad impugnaticia) would lack a basis establishing its procedural utility; that is, the procedural benefit to the appellant must be explained, and that did not occur in this case. The Criminal Cassation Chamber (Sala de Casación Penal) has held that an appeal must clearly explain not only the alleged defect but also the harm it causes the challenging party. Resolution 987, issued at 11:44 on 7 de agosto del 2020, stated verbatim: “Under this appellate system, the parties are recognized as having the right to challenge before the Court of Appeals (Tribunal de Alzada) a first-instance judgment that causes prejudice, as well as the right to file a cassation appeal (recurso de casación) against rulings of the ad quem that cause prejudice, provided that the admissibility requirements established by law are met.
In other words, the right to appeal to a higher court is guaranteed through the creation of procedural mechanisms that allow the parties to challenge before a higher body those rulings that cause prejudice, provided that the admissibility requirements imposed by law are observed.[...].” As explained, the presumption of innocence (estado de inocencia) protecting every citizen—and, in this case, the accused—was not diminished in any respect. Likewise, in Resolution 816 of 30 de agosto del 2017, the Criminal Cassation Chamber held: “It must be duly grounded and must clearly cite the statutory provisions deemed not to have been observed or to have been erroneously applied, or must identify and state the content of the precedents deemed contradictory; in all cases, it shall identify the prejudice and the relief sought. Each ground and its supporting arguments must be stated separately. No other ground may be asserted after this opportunity.” Taking these legal parameters as a starting point, it is first determined that although the challenge is based on the alleged failure to observe or erroneous application of a procedural rule, it completely omits reference to the legal provision conferring standing for the relief sought, namely subsection b) of Article 468 of the Code of Criminal Procedure.
Given the formal nature of a cassation appeal, a general listing of articles without specifically identifying the rule authorizing the filing of the ground is insufficient. In addition, among the essential requirements for filing a cassation appeal, the legislature included the necessary and unavoidable obligation to clearly explain the prejudice, understood as the direct impairment of the convicted person’s rights and interests resulting from the alleged defect. In this regard, it is useful to recall how this Chamber has defined prejudice for purposes of filing a cassation appeal: “It should be noted that, according to the verb form and syntax used, the rule imperatively requires the party alleging the defect to specifically identify the harm caused by the court’s action. It is not enough to mention just any prejudice; rather, the precise prejudice must be identified—that is, the effect that the legal authorities’ erroneous conduct had on the operative provisions of the judgment and how the final outcome might have been different had they acted correctly.” (Third Chamber of the Supreme Court of Justice (Sala Tercera de la Corte Suprema de Justicia), Resolution number 1638-2012, issued at 09:33 on 02 de noviembre de 2012).
In the present challenge, the appellant does not refer to any specific prejudice but instead reiterates the defect she seeks to establish through circular reasoning, without specifically explaining how the alleged error could have harmed the convicted person’s interests and rights or how it concretely affected the final resolution of the matter.(…)." Based on the foregoing, it is clear that the defendant is dissatisfied because the acquittal entered in his favor resulted from the application of in dubio pro reo rather than from certainty; however, the outcome obtained was the same, as were its criminal consequences, since [Nombre 012] was released from all punishment and liability. On this basis, this Court finds no harm caused to the accused by the challenged judgment, which is a necessary prerequisite for considering this appeal. The appeal therefore cannot be entertained.
II.Appeal filed by attorney Price Chinchilla. Second ground. Disagreement with the determination ordering restoration of the property to its original condition. It was argued that the right to a defense and due process were violated because the trial court ordered restoration of the property to its original condition, which, it was alleged, was not at issue in the proceedings. It was asserted that, according to the assessment made by the deciding body, [Nombre 012] did not enter the injured party’s property clandestinely or by force. He maintained that possession had been public, peaceful, and continuous, and that the agricultural courts, through an injunction for the protection of agricultural possession (interdicto de amparo de posesión agraria), would determine who held agricultural possession (posesión agraria) of the land. Accordingly, the order of eviction was characterized as misguided and as violating the rules of subject-matter jurisdiction, since it was alleged that the criminal judge was not responsible for determining whether the intrusion constituted agricultural possession.
In his view, Article 140 of the Code of Criminal Procedure, which provides for the restoration of things to their original condition, establishes a provisional measure (medida provisional), rather than a final measure as ordered by the trial court. He alleged that the accused’s possessory rights (derechos de posesión) and the agricultural cycle of possession were violated because, if the restoration measure adopted were maintained, possession would be interrupted, thereby curtailing the right to resort to the agricultural courts. He insisted that the accused was not committing usurpation but exercising possession. He denied that the accused had invaded the disputed land and argued that the measure restoring the property caused harm to the accused by interrupting his right of possession. He requests that the judgment be declared ineffective insofar as it orders restoration of the property to its original condition.
Appeal filed by public defender José Ramírez Torres. Sole ground. Contradictory judgment and lack of subject-matter jurisdiction. It was explained that, despite the acquittal of defendants [Nombre 001] and [Nombre 004] on the offense of usurpation (usurpación), the ruling ordered, in recital IV, entitled “on the request to restore things to their prior condition,” that the accused be evicted from the premises, that the structures on the property be demolished, and that the crops located there whose continued presence prevents restoration of the property to its original forest condition be removed, for which all human intervention must be eliminated. He objected that the judge had exceeded his authority by arrogating powers that did not belong to him and that, in his view, the judge also lacked jurisdiction. He explained that Article 140 of the Code of Criminal Procedure establishes a provisional, rather than final, measure.
He challenged the violation of the right of possession regulated beginning with Article 277 of the Civil Code, noting that this right may be acquired by adverse possession (usucapión) after holding the property quietly and peacefully for 10 years. He criticized the finding because the property has all the characteristics of an agricultural holding (fundo agrario), as confirmed by the witnesses at trial, who testified that, before the accused entered the property, it had been invaded by other persons, which led to the filing of several agricultural possessory injunctions (interdictos agrarios). He objected that the accused had possessed the property peacefully, since it had never been established that they had committed acts of violence against the injured parties. He insisted that the defendants had carried out public acts of possession, the legal nature of which they expect to litigate before the agricultural courts, since they had exercised peaceful possession for 8 years, specifically since 2014, and questioned why no eviction had been ordered during that entire period.
He alleged that the matter before the agricultural court had not yet been resolved, but that ordering the eviction affected the right of possession they had been peacefully exercising. He indicated that ordinary agricultural proceedings 19-000090-0465 AG and 19-000096-465-AG had been filed by [Nombre 004] and [Nombre 001], and that the trial in the latter proceeding was scheduled for 25 de abril de 2024; through those proceedings, they seek to establish the possessory rights of [Nombre 004] and [Nombre 001]. He requests that the provision of the judgment ordering restoration of the property to its original condition be declared ineffective. Response of the Procuraduría General de la República. Page 54 of the case file contains the reinstatement of the five-day period granted by this court, as well as the transmission of the contents of both appeals, but no response was submitted. Response of attorney Alan Elizondo Medina, special judicial representative of [Nombre 014] and [Nombre 020].
He requests that both appeals be denied. 1. He argues that the appeals are inadmissible. Restoration of the property to its original condition was ordered on the basis of the forest’s irreducibility (irreductibilidad), a principle enshrined in Articles 50 and 74 of the Political Constitution. It was stated that an alleged and nonexistent right of possession based on activities declared unlawful after being proven as such in adversarial proceedings (contradictorio) cannot be weighed against that principle. He argued that accepting the defense’s position would entail recognizing a “right” derived from carrying out an unlawful activity based on harm to the protected ecosystem. The property on which the conduct occurred had for many years been protected under the special forest conservation regime, in accordance with the guidelines established by MINAET. It was added that the special forest protection and conservation regime (payment for environmental protection services) to which property [Valor 005] was subject safeguards the preservation of the natural environment and, furthermore, reinforces the ownership rights, within the meaning of Article 264 of the Civil Code, that the injured parties have exercised over that property. 2.
Opposition to the arguments raised in the appeal. He considers that restoring the forest is an indirect means of protecting ownership of the property in favor of its lawful owners. That obligation is not a direct consequence of the acts of usurpation carried out on the property, but rather a consequence of the environmental damage caused. He maintained that, under Article 50 of the Constitution, the adjudicator had a constitutional obligation to restore the property to its original condition. He asserted that the environmental damage had been proven at trial, which resulted in the order to restore the property to its prior condition pursuant to Article 52 of the Land Use, Management and Conservation Act; Articles 2, 6, 10(c), 19, and 38(f) of the Ley Forestal; Sections 53, 54, and 55 of the Organic Environmental Act; and Articles 53 and 54 of the Biodiversity Act. He considers that these provisions eliminate judicial discretion in their application and are mandatory.
He explained that, as a matter of case law, the Tribunal de Apelación de Sentencia de San Ramón held in decision 686-2020 that restoration of the property should not be viewed as a form of compensation for the injured party, but rather as a state response aimed at remedying the harm caused. In decision number 396-2003, the Tribunal de Casación Penal stated that restoration must arise from environmental damage proven in adversarial proceedings. He requested that the appeals be denied. Response of the Ministerio Público. This chamber gave the Ministerio Público an opportunity to respond to the appeal filed by defense counsel for the defendants, as reflected on page 15, but no response was submitted.
III.Because the grounds concern the same issue, they will be decided jointly. The ground cannot prevail. Upon reviewing the trial court’s arguments, it is apparent that, in Considerando IV, entitled “On the request to restore matters to their previous condition,” it essentially stated the following:
In the case of the offense (delito) of Infringement of the Soil Use and Conservation Law (Infracción a la Ley de Uso y Conservación de Suelos) (No. 7779 of 309 April 1998), Article 52 of that law provides that: “Anyone who contaminates or degrades the soil resource (recurso suelo), regardless of the existence of negligence or intent or the degree of participation, shall be responsible for paying compensation, through the appropriate judicial proceeding, and for repairing the damage caused to the environment,” from which follows a specific regulation requiring the offender to compensate for loss and damage (daños y perjuicios) or to repair the damage caused. From a procedural perspective, Articles 140 and 466 of the Code of Criminal Procedure (Código Procesal Penal) require the Judge to order the restoration of things to their condition prior to the offense (restitución de las cosas al estado anterior al delito), which the challenged judgment (fallo recurrido) fails to do, as the Office of the Attorney General (Procuraduría) correctly notes in its application; therefore, since the judgment established that the accused (imputado) committed the act and that the environment was harmed by the opening of a road through the forest to the river, it is appropriate to order the restoration of the affected area to its condition prior to the act, so that the offender does not benefit from the unlawful conduct and the environment altered by his actions may be restored in furtherance of protecting the interests of the community.
Similarly, this Court has ruled as follows: “As for the condition imposed itself, this court of cassation (corte de casación) finds it reasonable and proportionate to the acts giving rise to the criminal conviction. It should be noted that provision number 28 of the Political Constitution establishes that legal intervention is impermissible with respect to private actions that cause no harm, from which it follows that the limit of the State’s response is determined by the magnitude or seriousness of the injury or danger caused. In the present case, in which the harm consists of changing the land use (cambio del uso del suelo) from forest to agriculture, the State’s response is limited to repairing the harm, which in any event will not be completed during the three years of the conditionally suspended sentence (ejecución condicional de la pena), because a forest is the product of years and years of the birth, development, and death of many plant and animal organisms; nevertheless, removing the crops and everything else that has replaced the forest, as well as reestablishing plant species to the extent necessary to regenerate what was destroyed, constitutes the beginning of restoration, which will be achieved in several years.
It must be clear that the protection of forest soil (suelo de los bosques) enshrined in Articles 2, 6, 10.c, 19 and 38.f of the Ley Forestal, Article 52 of the Soil Use, Management and Conservation Law (Ley de Uso, Manejo y Conservación de Suelos), Articles 53, 54 and 55 of the Organic Environmental Law (Ley Orgánica del Ambiente), and Articles 53 and 54 of the Biodiversity Law (Ley de Biodiversidad) does not end or become suspended when the forest is diminished by human acts (deliberately set fires, illegal logging, etc.) or natural events (floods, earthquakes, fires, etc.); on the contrary, in such situations the State must act more aggressively to restore and conserve the forest. To believe that the duty to protect forest land (suelo forestal) and other forest components ends upon the occurrence of any of the events identified would amount to promoting unlawful activities harmful to the environment in order to replace the ecosystem with agricultural or other forms of exploitation, in which case there would be no genuine protection; that is, the area occupied by forests cannot be reduced through such means (principle of forest irreducibility (principio de irreductibilidad del bosque)).
Accordingly, anyone who damages the forest through logging or fires for the purpose of changing the designated use of the land, or anyone who seeks to profit from natural disasters that damage forest land, must understand that there is no possible means of changing the land’s designated use and that the State will do everything necessary to restore the forest. Thus, in the case before us, agricultural activity must cease at the site where the forest is to be regenerated, whether this is done by the convicted person in compliance with the condition under which the benefit of a conditionally suspended sentence is granted to him almost as an incentive, or through State action; the officials responsible for enforcement shall ensure the effectiveness of the judgment on the merits (fallo de mérito). There is no disproportionality or abuse in the condition imposed by the trial judge. This manner of ruling by the trial judge reaffirms the normative force of the Political Constitution, Articles 50 and 74 of which guarantee all humanity, as an unwaivable right, the right to a healthy and ecologically balanced environment.
In addition to the foregoing, the judicial order in this case is identical to the legislative provision adopted in numeral 52 of the Ley de Uso, Manejo y Conservación de Suelos, N° 7779 of 30 April 1.998…” (Judgment 2003-0366, at 11:54 hrs. on 5 May 2003, drafted by Judge Dall’anese Ruiz. This criterion was reiterated in judgment 2003-396) ... With respect to the case before us, the judgment did not provide for the restoration of things to their prior condition, as required by the cited provisions; nevertheless, because the judgment arose from an abbreviated proceeding (procedimiento abreviado), and because restoration is a direct consequence of the commission of the offense and does not require a civil action (acción civil), the proper course is to grant the cassation appeal (recurso de casación) filed and rule at this level of review by ordering the restoration of the affected forest area to its condition prior to the events.
(...) Accordingly, restoration in this case must be directed toward conserving the forest area, and for that purpose the road is ordered closed, its use in any possible form is prohibited, and restoration of the forest is ordered through the planting of species suitable for that purpose, compliance with which may be monitored by the administrative or enforcement authorities.” In the case under consideration, it was established that a protected area (área de protección) was encroached upon through the construction of a series of works that must be demolished or destroyed in order to preserve the balance of nature. The commission of a criminal offense is not required for the courts, even on their own motion (de oficio), to order the restoration of things to their condition prior to their alteration. It should be noted that Article 103 of the Criminal Code (Código Penal) itself requires only a punishable act (hecho punible), the scope of which is limited to a criminal wrong (injusto penal).
In this case, the existence of the wrong was established, because the act of ordering the construction whose demolition is now ordered violated the Ley Forestal. Moreover, no provision authorized those actions, and thus the conduct was also unlawful (antijurídica). The adjudicator was therefore required to order the demolition or destruction of the series of works mentioned in the judgment, because they were constructed within a protected area. Consequently, the objection raised cannot be sustained.” This criterion has been reiterated by this Court, as follows from ruling number 686-2020 of 21 July 2020, issued by the Tribunal de Apelación de Sentencia Penal del III Circuito Judicial de Alajuela San Ramón, and ruling number 291-2015, of 15 May 2015, of the Tribunal de Apelación de SentenciaPenal del II Circuito Judicial de San José. This means that, once the encroachment upon the land and the infringement of the property owner’s rights were established, restoration of the real property (bien inmueble) was to be ordered regardless of whether the defendants (encartados) were acquitted, because the existence of a punishable act alone is sufficient for the challenged measure to be warranted.
In this particular case, the accused could not claim that they were deprived of a right they had not acquired and that had not been declared, much less claim that their occupation of the real property had been peaceful when, from the filing of the criminal complaint (denuncia penal) in the year 2014, the real property had already become the subject of litigation and, from that time onward, their occupation could not be regarded as peaceful or in good faith. Based on the foregoing, the alleged defect (vicio alegado) is rejected, and the judgment on appeal (sentencia venida en alzada) is affirmed.
Por tanto
The first ground of the appeal filed by private defense counsel Rodolfo Price Chinchilla on behalf of [Nombre 012] is declared inadmissible, and the second ground is denied, as is the appeal filed by public defender José Ramírez Torres on behalf of the accused [Nombre 001] and [Nombre 004]. Notice shall be given.

Resolución: 2023-0538 TRIBUNAL DE APELACIÓN DE SENTENCIA PENAL. Segundo Circuito Judicial de San José. Goicoechea, a las quince horas treinta minutos del veinticuatro de abril veintitrés.- RECURSO DE APELACIÓN interpuesto en la presente causa seguida contra [Nombre 001], mayor, costarricense, cédula de identidad número [Valor 001], nacido en Limón, el 8 de noviembre de 1951, hijo de [Nombre 002] y de [Nombre 003], divorciado, pensionado, vecino de Limón; [Nombre 004] mayor, costarricense, cédula de identidad número [Valor 002], nacido en Alajuela, el 7 de diciembre de 1963, hijo de [Nombre 005] y [Nombre 006], soltero, agricultor, vecino de Limón; [Nombre 012] mayor, costarricense, cédula de identidad [Valor 003], nacido en Limón, el 21 de marzo de 1968, hijo de [Nombre 008] y [Nombre 009], casado, agricultor, vecino de Limón, por el delito de USURPACIÓN E INFRACCIÓN A LA LEY FORESTAL, en perjuicio de [Nombre 014]. Intervienen en la decisión del recurso, las juezas Francini Quesada Salas, Marianela Corrales Pampillo y el co-juez Gustavo Gillen Bermúdez. Se apersonó en esta sede el licenciado Rodolfo Price Chinchilla defensor particular, el licenciado José Ramírez Torres defensor público, el licenciado Randall Alban Aguirre Mena en representación de la Procuraduría General de la República y el licenciado Alan Elizondo Medina como querellante y.
RESULTANDO:
I.Que mediante sentencia número 045-2023, de las ocho horas del veintitrés de enero de dos mil veintitrés, el Tribunal Penal del Primer Circuito Judicial de la Zona Atlántica, resolvió: "POR TANTO: De conformidad con lo expuesto, artículos 39 y 41 de la Constitución Política; 1 a 6, 9, 31, 33, 34, 140, 142, 182, 184, 265, 341 a 366 del Código Procesal Penal; artículo 1, 140, del Código Penal, SE RESUELVE: absolver de toda pena y responsabilidad a [Nombre 001], [Nombre 004] Y [Nombre 012], de los delitos de Usurpación, Tala de Árboles y Cambio de Uso de Suelo, que se les venía atribuyendo como cometido en perjuicio de [Nombre 014], [Nombre 020] y la Ley Forestal. Se resuelve sin especial condenatoria en costas, siendo los gastos del proceso penal a cargo del Estado. Se ordena levantar toda medida cautelar que pese sobre los imputado. Se ordena la restitución de las cosas a su estado anterior, en consecuencia se ordena el desalojo de los aquí imputados y el derribo de las obras, para lo cual se autoriza la ejecución por medio de las autoridades policiales que correspondan, de los actos necesarios para la destrucción de las edificaciones que se encuentren ubicados en la propiedad que representa el plano [Valor 004], terreno del partido de Limón, folio real matricula [Valor 005]. Por Lectura Notifíquese.- " (sic).
II.Que contra el anterior pronunciamiento, licenciado Rodolfo Price Chinchilla y el licenciado José Ramírez Torres, interpusieron recurso de apelación.
III.Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 465 del Código Procesal Penal, el Tribunal se planteó las cuestiones formuladas en el recurso de apelación.
Redacta la jueza de Apelación de Sentencia Penal Quesada Salas ; y,
CONSIDERANDO:
I.Admisibilidad por presentación dentro del plazo. La sentencia apelada es la número 045-2023, dictada a las 08:00 horas del 23 de enero de 2023, por el Tribunal Penal del I Circuito Judicial de la Zona Atlántica, en la que se absolvió de toda pena y responsabilidad a los imputados [Nombre 001], [Nombre 004] y [Nombre 012], por los delitos de usurpación, tala ilegal de árboles y el cambio de uso de suelo. También se ordenó la restitución de las cosas a su estado anterior, ordenándose el desalojo de los imputados y el derribo de las obras. Mediante libelo presentado el 20 de febrero de 2023, el licenciado Rodolfo Price Chinchilla, en su condición de defensor particular del imputado [Nombre 012] y por medio de escrito presentado el 20 de febrero de 2023, el licenciado José Ramírez Torres, defensor público de [Nombre 001] y [Nombre 004], interpusieron recursos de apelación en contra de la sentencia ya citada.
De la revisión de los recursos se evidenció que fueron interpuestos dentro de los 15 días hábiles después de la notificación de la sentencia, según lo dispone el artículo 459 del Código Procesal Penal, y cumplen con los presupuestos de admisibilidad establecidos por los artículos 458 y 460 de dicho cuerpo normativo, lo cual permite su conocimiento en los términos del artículo 8.2 h de la Convención Americana sobre Derechos Humanos, por lo que se admiten para su estudio y resolución de fondo.
II.Inadmisibilidad por falta de agravio, en cuanto cuanto al primer motivo del recurso del licenciado Price Chinchilla. El recurrente objetó que no se le absolvió por certeza, sino por duda, indicando que la absolutoria por duda generó que no pueda denunciar a los ofendidos por denuncia calumniosa, además de que en criterio del recurrente le afectó la posibilidad de iniciar procesos legales de usucapión mediante posesión agraria. Que desde la propia descripción de los hechos en la acusación, no quedó claro la participación del sindicado, además, de la falta de prueba que acreditara de alguna forma que el encartado cometió el delito acusado de usurpación. Que en las denuncias no se mencionó con detalle actos concretos realizados por [Nombre 012]. Aunque se citó en este motivo lo improcedente de ordenar el desalojo, ese es propiamente el contenido del segundo motivo de apelación. Se reiteró que de la prueba en debate no se acreditó acción alguna que hubiese realizado el imputado del los eventos contenidos en la acusación.
Se declara inadmisible. El motivo no cumple con los requisitos formales para su interposición, ante la falta de descripción del agravio causado a la parte quejosa, tal y como lo dispone el numeral 460 párrafo 2, del Código Procesal Penal el cual indica: “(…) La parte recurrente deberá expresar los fundamentos de su inconformidad, el agravio que le causa y su pretensión. En el mismo acto ofrecerá la prueba en respaldo de sus alegatos. (…)” (el resaltado es suplido) La impugnación, en el acápite de “agravio provocado”, indicó textualmente: “Al tomar en cuenta el tribunal acontecimientos no acusados para sustentar una sentencia absolutoria por duda, se causó un agravio directo a mi defendido, pues se le suprimió su derecho de ser beneficiado con una sentencia absolutoria por certeza, al haberse probado que nunca existió el núcleo de la imputación contenido en la acusación”. Esta Cámara considera que el recurrente no demostró que el imputado [Nombre 012] sufrirera algún perjuicio con el hecho de que se le haya absuelto por duda y no por certeza, ya que la absolutoria, no impide que los imputados puedan presentar los procesos legales que consideren oportunos, ni interponer una denuncia por el delito de denuncia calumniosa o el proceso agrario.
El motivo debe de cumplir con una serie de requisitos formales a efectos de evaluar en una primera etapa su pertinencia. Si bien es cierto, el recurso fue fundamentado por el recurrente y se incluyó su pretensión de que se absuelva al imputado por tener certeza de su inocencia y que así sea dispuesto por esta instancia, no se logró verificar ni en el apartado de “agravio” a folio 27, del legajo de apelación, ni de la integralidad del recurso, cuál fue el agravio que arguyó el recurrente que sufrió por la decisión tomada por el tribunal de mérito. Es decir, el perjuicio que le generó haber sido absuelto aplicando el principio de indubio pro reo y no por certeza. En varias ocasiones, incluyendo el apartado titulado como “agravio”, se alegó que en la sentencia recurrida, al imputado se le absolvió por duda, lo que implicó que le afectaba poder interponer otros procesos penales y agrarios, lo que no es cierto, ya que no existe impedimento alguno para que [Nombre 012] pueda presentar los procesos que considere convenientes.
Además, según consta en autos, [Nombre 012], a lo largo del proceso penal seguido en su contra, nunca sufrió medida cautelar de prisión preventiva u otra que coartara su libertad. Así, el artículo 271 del Código Procesal Penal, prevé este supuesto fáctico en el que a manera de ilustración sería admisible el recurso planteado por el imputado absuelto: “Deber de indemnización. El Estado deberá indemnizar a la persona que haya sido sometida, indebidamente, a una medida cautelar por un funcionario público que actuó arbitrariamente o con culpa grave, en los términos del artículo 199 de la Ley General de la Administración Pública. En este caso, el funcionario será solidariamente responsable con el Estado. También procederá la indemnización, sólo a cargo del Estado, cuando una persona haya sido sometida a prisión preventiva y luego es sobreseída o absuelta, con plena demostración de inocencia”.
Lo anterior cobra relevancia al ser ponderado de conformidad con las reglas de impugnabilidad objetiva ya que los numerales 439, 459 y 462 del Código Procesal Penal, establecen como una de las reglas generales, que podrá recurrir quien haya sufrido, o pueda sufrir, un agravio con la decisión emitida; debiendo entenderse “agravio” como el perjuicio o gravamen, material o moral, que una resolución le causa a un litigante (https://dpej.rae.es/lema/agravio). En caso de no existir agravio, la impugnación deviene en inadmisible. Es decir, para que tenga el derecho de interponer el recurso, debe de acreditar su legitimación, éste debe estar facultado para interponer algún medio impugnativo, debe tener algún interés en que se revise la resolución por impugnar. Este interés se adquiere por verse agraviado o perjudicado con la resolución, es decir, que se indique cuál fue la lesión que sufrió a sus derechos e intereses.
La parte agraviada generalmente será la parte para la cual la resolución causará un efecto negativo, de manera que el agravio determina la legitimación para impugnar, sin perjuicio de que no haya interés para recurrir y por ende, no se requiere del recurso. En realidad, el impugnante se desgastó demostrando el vicio alegado, pero nunca llegó a determinar de qué forma en concreto, se le generó la afectación al encartado. Resulta claro que el sindicado fue absuelto, es decir, que penalmente fue liberado de toda pena y responsabilidad por los delitos que se le venían atribuyendo. Tanto del apartado denominado como “agravio” como del estudio integral del recurso, no se logró rescatar cuál fue el perjuicio que la sentencia le generó al sindicado. El artículo 439 del Código Procesal Penal, establece que sólo puede recurrir quien ha sufrido algún agravio y el deberá sustentarse en el reproche de los defectos que causan la afectación.
Es evidente que si no existe un interés, tal cual lo aprecia la ley, la actividad impugnaticia del sujeto carecería de un motivo que justifique la utilidad procesal, es decir, debe de explicarse la ventaja para el recurrente desde el punto de vista procesal y en el presente caso ello no fue así. La Sala de Casación Penal ha establecido que en el recurso de apelación debe de explicarse claramente además del vicio alegado, el perjuicio que el mismo le causa a la parte impugnante. En la resolución 987 de las 11:44 horas, del 7 de agosto del 2020, se indicó literalmente: “Bajo este sistema recursivo, se reconoce el derecho de las partes de impugnar ante el Tribunal de Alzada, la sentencia de primera instancia que cause un agravio, así como también el derecho de recurrir en casación, las resoluciones del ad quem que generen un agravio, siempre que se cumplan los requisitos de admisibilidad establecidos en la ley.
Es decir, el derecho de recurrir ante un tribunal superior se encuentra garantizado a través de la creación de mecanismos procesales que permiten a las partes impugnar ante un órgano superior aquellas resoluciones que generen agravio, siempre que sean observados los requisitos de admisibilidad que exige la ley.[...].” Como se ha explicado, el estado de inocencia que cobija a todo ciudadano, y en este caso al endilgado, tampoco sufrió demérito alguno. Así como en la resolución 816 del 30 de agosto del 2017, de la Sala de Casación Penal, dispuso: “Deberá estar debidamente fundado y citará, con claridad, las disposiciones legales que se consideren inobservadas o erróneamente aplicadas, o bien, la mención y el contenido de los precedentes que se consideren contradictorios; en todo caso, indicará cuál es el agravio y la pretensión. Deberá indicarse por separado cada motivo con sus fundamentos.
Fuera de esta oportunidad no podrá aducirse otro motivo”. Tomando como punto de partida estos parámetros legales, en primer lugar, se estima que la impugnación presentada si bien es cierto se sustenta en la supuesta inobservancia o errónea aplicación de una norma procesal, omite por completo la invocación del precepto legal que legitima su pretensión, a saber, el inciso b) del artículo 468 del Código Procesal Penal, y resulta insuficiente por la formalidad que reviste el recurso de casación la enunciación general de artículos sin hacer precisión concreta de la norma que autoriza la interposición del motivo. Sumado a ello, como parte de los requisitos esenciales en la formulación del recurso de casación, el legislador contempló la necesaria e ineludible obligación de exponer con claridad el agravio, entendido como la afectación directa a los derechos e intereses del sentenciado que viene aparejado al vicio que se reclama.
En este sentido, conviene recordar la delimitación que ha hecho esta Sala respecto del concepto de agravio, a efectos de la interposición del recurso de casación, de la siguiente forma: “Nótese que el mandato de la norma, conforme a la forma verbal y la sintaxis empleados, contempla de forma imperativa la insoslayable individualización del daño que el actuar jurisdiccional ha provocado, por parte de quien reclama el vicio. No se trata de mencionar cualquier agravio, sino, con exactitud, de cuál se trata, es decir, cuál es la incidencia que el erróneo proceder de los operadores jurídicos ostenta sobre el dispositivo y la forma en que el resultado final pudo haber sido distinto de haber procedido correctamente”. (Sala Tercera de la Corte Suprema de Justicia, resolución número 1638-2012 de las 09:33 horas del 02 de noviembre de 2012). En la presente impugnación la recurrente no alude a un agravio concreto, sino que reitera el vicio que pretende acreditar, bajo una argumentación circular, sin plantear puntualmente de qué manera el yerro que señala pudo haber perjudicado los intereses y derechos del sentenciado, y su incidencia concreta en la resolución final del asunto.(…)." Conforme a lo expuesto, queda claro que el encartado se encuentra inconforme porque la absolutoria dictada a su favor fue ante la aplicación del in dubio pro reo y no por certeza; sin embargo, la finalidad obtenida fue la misma, y las consecuencias penales del resultado también, habiéndose liberado de toda pena y responsabilidad a [Nombre 012].
Con base en lo anterior, no encuentra esta instancia el perjuicio causado al sindicado por medio de la sentencia impugnada, presupuesto necesario para proceder al conocimiento del presente recurso de apelación. De forma que el recurso resulta inatendible.
II.Recurso presentado por el licenciado Price Chinchilla. Segundo motivo. Inconformidad con la determinación de la orden de restituir el bien a su estado original. Se reclamó que se violentó el derecho de defensa y el debido proceso, que el tribunal de juicio ordenó la restitución de la cosa al estado original, lo que se alegó no fue objeto del proceso. Se afirmó que según la valoración que realizó el órgano decisor, [Nombre 012] no se introdujo en la propiedad del ofendido de manera clandestina, ni con fuerza. Aseguró que se poseyó en forma pública, pacífica y permanente, y será en la vía agraria, mediante un interdicto de amparo de posesión agraria, donde se procederá a determinar la posesión agraria del terreno. Por lo que, ordenar el desalojo, se tildó de una acción desarcertada, infringiendo las reglas de competencia material ya que se alegó que no le correspondía al juez penal determinar si la invasión resulta una posesión agraria.
El numeral 140 del Código Procesal Penal que dispone la acción de restablecimiento de las cosas a su estado original, en su criterio, es una medida provisional y no en forma definitiva como lo dispuso el tribunal de juicio. Alegó que se violaron los derechos de posesión del sindicado y el ciclo agrario de la posesión agraria, puesto que de mantenerse la medida de restitución adoptada, se estaría interrumpiendo la posesión, cercenando con ello el derecho a acudir a la vía judicial agraria. Insistió que el endilgado no estafa usurpando sino poseyendo. Rechazó que el acriminado hubiese invadido el terreno en discusión, se reclamó que la medida de restitución de la cosa, le causó un agravio al acusado, interrunpiéndole su derecho de posesión. Solicita se declare la ineficacia de la sentencia en cuanto a la disposición de restitución de la cosa a su estado original. Recurso presentado por el defensor público José Ramírez Torres.
Único motivo. Sentencia contradictoria y falta de competencia en razón de la materia. Se explicó que pese a haberse absuelto a los imputados [Nombre 001] y [Nombre 004], por el delito de usurpación, el fallo dispuso en el considerando IV titulado "sobre la solicitud de restitución de las cosas a su estado anterior", el desalojo de los endilgados del lugar y la demolición de las construcciones que hayan en la finca, así como eliminar los cultivos que se encuentran en el lugar y cuya permanencia impide la restitución de la finca, a su estado original de bosque, para lo que se requiere eliminar toda intervención humana. Objetó que el juez se extralimitó en sus funciones arrogándose atribuciones que no le correspondían, que además en su criterio no tenía competencia. Explicó que el numeral 140 del Código Procesal Penal es una medida provisional y no definitiva. Discutió la violación al derecho de posesión regulado a partir del artículo 277 del Código Civil, siendo que el mismo puede adquirirse por usucapión después de 10 años de conservar el bien en forma tranquila y pacífica.
Se fustiga que la finca tiene todas las condiciones de un fundo agrario, conforme lo conformaron los testigos en debate, quienes declararon que antes de que se diera el ingreso de los sindicados al predio, este había sido invadido por otras personas, lo que generó la interposición de varios interdictos agrarios. Se objetó que los endilgados habían poseído en forma pacífica, ya que en ningún momento se había constatado que hubieran ejercido actos de violencia en contra de los ofendidos. Insistió, que los encartados han realizado actos públicos de posesión, siendo la calidad la que esperan discutir en los tribunales agrarios, ya que han ejercido actos pacíficos de posesión por 8 años, propiamente desde 2014, cuestionándose que durante todo ese tiempo no se había ordenado el desalojo. Alegó que el asunto en el despacho agrario, todavía no se encuentra resuelto, mas al ordenar el desalojo afecto del derecho de posesión que en forma pacifica han venido ejerciendo.
Indicó que existen los expedientes ordinarios agrarios 19-000090-0465 AG y 19-000096-465-AG interpuestos por [Nombre 004] y [Nombre 001], siendo que de este último, el juicio se encuentra señalado el 25 de abril de 2024, mediante los cuales se pretende consolidar el derecho de posesión de los señores [Nombre 004] y [Nombre 001]. Se solicita se declare la ineficacia de la disposición de restitución de la cosa a su estado original, ordenada por el tribunal de juicio en sentencia. Contestación de la Procuraduría General de la República. A folio 54 del expediente consta la reposición del plazo de cinco días que realizó este instancia, así como el envío del contenido de ambos recursos, sin que se haya realizado algún pronunciamiento. Contestación del licenciado Alan Elizondo Medina, apoderado especial judicial de [Nombre 014] y [Nombre 020]. Solicita se rechacen ambos recurso de apelación. 1.
Reclama la Inadmisibilidad de los recursos de apelación. La restitución de las cosas a su estado original fue establecida en función del carácter de irreductibilidad del bosque, principio consagrado en los artículos 50 y 74 de la Constitución Política. Se indicó que no es posible ponderar un supuesto e inexistente derecho de posesión amparado en actividades declaradas ilícitas por haberse así demostrado en el contradictorio. Alegó que reconocer la tesis de la defensa, supone reconocer un "derecho" derivado del ejercicio de una actividad ilegítima amparada en la lesión del ecosistema protegido. El fundo en el que desarrollaron las conductas se encontraba protegido desde hace muchos años atrás bajo el régimen especial de conservación del bosque, según los lineamientos dispuestos por el MINAET. Se añadió que el régimen especial de protección y conservación del bosque (pago por servicios de protección ambiental) al que se encontraba sometido el inmueble [Valor 005], resguarda el mantenimiento del entorno natural y; por otro, refuerza el dominio en los términos del artículos 264 del Código Civil que los ofendidos han ejercido sobre dicho inmueble. 2.
Oposición a los alegatos planteados en el recurso. Considera que la restitución del bosque, es una manera indirecta de resguardar el dominio del fundo a favor de sus legítimos propietarios. Dicha obligación no es una consecuencia directa de las actividades de usurpación que se han desarrollado en el fundo, sino que es una repercusión de los daños medio ambientales ocasionados. Aseguró que era una obligación de orden constitucional de la persona juzgadora restituir la cosa a su estado original, según el artículo 50 constitucional. Aseguró que los daños ambientales fueron acreditados en el juicio, lo que generó que se ordenara la restitución del bien a su estado anterior conforme al artículo 52 de la Ley de Uso, Manejo y Conservación de Suelos, artículos 2, 6, 10 c, 19 y 38 f de la Ley Forestal parágrafo 53, 54 y 55 de la Ley Orgánica del Ambiente y los numerales 53 y 54 de la Ley de Biodiversidad, disposiciones que considera restan discrecionalidad al juzgador en su aplicación, que resulta de acatamiento obligatorio.
Explicó que jurisprudencialmente, el Tribunal de Apelación de Sentencia de San Ramón en la resolución 686-2020, dispuso que la restitución del bien no debe ser vista como una especie de indemnización en favor del ofendido, sino como una reacción estatal por la reparación del daño causado. El Tribunal de Casación Penal en la resolución número 396-2003, señaló que la restitución debe originarse del daño ambiental demostrado en el contradictorio. Solicitó se rechacen los recursos planteados. Contestación del Ministerio Público. Esta cámara, procedió a emplazar al Ministerio Público, en cuanto a la interposición del recurso de apelación planteado por la defensa de los imputados, conforme se verificó a folio 15, sin que se haya presentado algún pronunciamiento.
III.Por tratarse del mismo tema, se procederá a resolver los motivos en forma conjunta. El motivo no puede prosperar. Una vez verificabas las argumentaciones del tribunal de juicio se tiene que en el considerando IV. titulado sobre la solicitud de restitución de las cosas a su estado anterior", indicó esencialmente lo siguiente:
POR TANTO
Se declara inadmisible el primer motivo y sin lugar el segundo motivo del recurso presentado por el defensor particular Rodolfo Price Chinchilla en representación de [Nombre 012] y el recurso de apelación interpuesto por el defensor público José Ramírez Torres, en representación de los encartados [Nombre 001] y [Nombre 004].
