PROCEDURAL BACKGROUND (RESULTANDO):
ALVARADO FLORES deny the complaint and raise the defenses of lack of a legal right, lack of standing to sue and be sued, and expiration. (see escritorio virtual del Juzgado Agrario de Alajuela, filing incorporated on 25/06/2018 02:00:04 .

III.Attorney José Luis Ramos Castellón, in his capacity as special judicial attorney-in-fact for the plaintiff-counterclaim defendant and for 3-101-689148 S.A, filed an appeal against that ruling, stating essentially as follows: “GROUNDS FOR APPEAL (AGRAVIOS): 1.- The ruling under appeal states that my clients committed the first violation of the special rules governing the parcel in dispute because they verbally agreed with Pablo Solórzano Alvarado to work ‘on shares’ the mango grove located within the portion in dispute. There is nothing improper about this, nor does it violate the special rules governing the parcel at issue in this proceeding, because what my clients and Pablo Solórzano Alvarado established was a ‘Rural Sharecropping Agreement’ (Contrato de Aparcería Rural), which is contemplated in Article 69 of La Constitución Política and therefore constitutes a rule superior in rank to Article 67 of La Ley de Tierras y Colonización and to that law generally. 2.- As a second violation of the special rules governing the parcel in dispute, the ruling under appeal states that, without Inder’s authorization, my clients CARLOS MONTERO MONTERO AND ANAIS SALAS MESEN, by public deed number 34-10 executed before Notary Pía Picado González at 18 hours on 06 de junio del 2000, bequeathed parcel M-7 of Asentamiento Coyolar to Pablo Solorzano Alvarado, Gabriela Solorzano Alvarado, Roxana Solorzano Alvarado, and Guadalupe Alvarado Flores. 3.- The ruling under appeal states that my client Carlos Montero Montero abandoned the parcel ten years before the trial held on 05 de marzo de 2021, which is untrue, as we have conclusively demonstrated in this proceeding and will explain further below. 4.- The ruling under appeal states that the plaintiffs transferred the property in question to the defendant company before their title had become fully vested, which is untrue, as we will conclusively refute in the corresponding section. 5.- The award of the parcel cannot be revoked, my clients’ resulting title cannot be annulled, and the parcel in dispute cannot be reverted to INDER because, by the date of INDER’s intervention in this proceeding, the restrictions encumbering that parcel had already expired; the parcel had therefore become property held by my clients in full ownership and was registered in the name of a family-owned commercial company.” (see virtual desktop of the Juzgado Agrario de Alajuela, filing entered on 08/12/2021 11:19:28).-
IV.ON THE FOURTH AND FIFTH SUBSTANTIVE GROUNDS OF APPEAL CONCERNING THE INADMISSIBILITY OF THE COUNTERCLAIM FILED BY THE INSTITUTO DE DESARROLLO RURAL BECAUSE THE PUBLIC-INTEREST RESTRICTIONS HAD EXPIRED BY THE TIME IT WAS FILED: The appellant’s argument is unfounded. A chronological account of the events is appropriate in order to resolve this ground of appeal: The Instituto de Desarrollo Rural (hereinafter INDER) initiated an administrative proceeding (procedimiento administrativo) against the plaintiffs for revocation of title to the property and revocation of the parcel award on 24 de agosto del 2008, two days before the fifteen-year term of the public-interest restrictions under the land-allocation agreement expired. That administrative proceeding was conducted under expediente 246-08 for noncompliance with Articles 67 and 68 of Ley 2825. On the same day the restrictions expired, the property at issue in this proceeding was encumbered by an annotation under filing references 0578-00005971-001, “EXHORTO DE NULIDAD DEL IDA,” filed on 26 de noviembre del 2008.
(See image 35, part VII of the electronic case file, submission added on 04/07/2014 10:50:19). The plaintiffs herein filed this action on seis de octubre del 2010, and notice of it was entered in the margin of the registration for the property at issue in this proceeding on 30 de junio del 2015, pursuant to the decision issued on 29 de junio del 2015. (See acknowledgment of receipt at image 78 of the case file converted into book format as a PDF, image 21, part I of the scanned physical case file added to the record on 09/09/2011 18:17:23, and the aforementioned decision ordering the annotation of the complaint, which was associated with the record on 29 de junio del 2015). INDER was served with the complaint upon joinder of the necessary party (integración de litis) and filed a counterclaim (reconvención) in setiembre del 2011, seeking revocation of the title on the same grounds asserted in the administrative proceeding (see the virtual desktop of the Juzgado Agrario de Alajuela, associated documents, main case file, part IX, added on 09/09/2011 18:22:33, images 5 through 17).
Subsequently, by a decision issued in that forum at 09:05 hours on 09 de junio del 2014, the administrative proceeding’s directing body ordered the administrative case file closed, without prejudice to the decision to be rendered in this proceeding (Submissions Tray, 04/07/2014 10:50:19). This historical account shows that INDER initiated the revocation proceeding while the restrictions remained in force, kept the matter pending through the Exhorto de Nulidad by annotating the parcel, and even filed the counterclaim while the property remained subject to that annotation. Indeed, from 9 de setiembre del 2011 to 9 de junio del 2014, its revocation claim was processed concurrently in the administrative and judicial forums, until, on the latter date, that entity ordered the administrative proceeding closed so that the matter could ultimately be resolved through declaratory proceedings (vía declarativa).
Accordingly, this ground of appeal is without merit, because the cited exhorto interrupted the limitations period, preserving INDER’s authority to seek the nullity of the title and revocation of the award through the present day. In this regard, this Court has held: “Irrespective of whether the restrictions had expired when this action was brought, that does not cure the defect in the agreement, which has an object prohibited by law and is therefore absolutely null and void (nulidad absoluta). Recently, in a similar case, this Court ruled: ‘(...) what occurred was a sale transaction, an act prohibited by Article 67 of the Ley de Tierras y Colonización, which provides, insofar as relevant: “Any agreement entered into without compliance with the foregoing provisions shall be absolutely null and void,” given that authorization from the Instituto de Desarrollo Agrario, now the Instituto de Desarrollo Rural (INDER), was required and was not obtained in this specific case.
Because the property remained subject to restrictions imposed by that Institute, the awardee did not yet hold full ownership rights permitting its unrestricted conveyance, since the Institute could still recover it for its social purposes. Consequently, because the awardee lacked full power to dispose of the property, the transaction entered into, styled as an option to purchase and sell (opción de compra venta), is null and void because the required authorization from the aforementioned Institute was not obtained, as provided by the cited statute.- Nor can the appellant’s theory that the transaction was subject to a condition precedent (condición suspensiva) be accepted, because accepting that position would constitute a flagrant violation of rules of public policy (normas de orden público), such as the Ley de Tierras y Colonización, which establishes the legal regime governing the property in question.
Accordingly, disposition of this type of property does not operate as it would in an ordinary private transaction, as the appellant maintains in this ground of appeal; rather, that system of restrictions constitutes the legal framework governing the right, which is precisely why those restrictions are recorded in the Registro Público de la Propiedad. Any contrary interpretation would create interpretive loopholes that beneficiaries of the Programa de Asignación de Tierras of the Instituto de Desarrollo Rural could exploit to disregard the imposed restrictions under the guise of options to sell or sales subject to the condition precedent that the existing restrictions expire, which, as stated, contravenes rules of public policy. This would validate transactions through which an economic benefit would be obtained from the social welfare system itself, a system intended for persons with a particular economic and social profile and funded by the State with public funds, whose objectives are set forth in Articles 1 and 2 of the Ley de Tierras y Colonización.- V.- The appellant asserts that the court may not declare the legal transaction null and void on its own motion (declaratoria oficiosa), because the opposing party did not request such relief.
However, determining whether the plaintiff was entitled to the relief sought requires an analysis of the legal nature of the transaction and whether the conditions of validity existed when it was executed. As stated, an essential element was lacking—namely, authorization from the aforementioned Institute—and omission of that requirement mandates nullity as a matter of law under Article 67 ibídem.- Article 835 of the Código Civil provides: ...“Acts or agreements are absolutely null and void: 1.- When any condition essential to their formation or existence is lacking. 2. When any requirement or formality that the law demands for the validity of certain acts or agreements is lacking, having regard to the nature of the act or agreement rather than the status or condition of the person participating therein....” This provision establishes the nullity of a transaction lacking any such condition.
In the present case, because the agreement is governed by rules of public policy rather than private-law rules, absolute nullity under the Código Civil, which cannot be declared by the court on its own motion, is not applicable in isolation. Instead, the civil-law provision must be read together with Article 67 of the Ley de Tierras y Colonización (a rule of public policy), which categorically establishes the absolute nullity of any agreement entered into without the required authorization from the aforementioned Institute; nullity is therefore mandatory as a matter of law.- The appellant argues that there is a legal gap on the part of INDER regarding the means of preventing this type of commitment between awardees and private parties, and that only an amendment to the Law incorporating an option-to-purchase mechanism into its provisions could create a legal instrument barring a private transaction between the parties.
The appellant contends that, absent such an amendment, it is improper to declare this legal instrument, which is intended to produce future legal effects, null and void. As to this ground of appeal, the preceding recital explained why, notwithstanding the name given to the agreement as asserted by the appellant, what the parties actually agreed upon was a purchase and sale; nullity is therefore mandatory. In any event, the cited Article 67 provides that any agreement is absolutely null and void, which encompasses the transaction at issue regardless of the name assigned to it.- (TRIBUNAL AGRARIO. VOTO N° 981-F-16 de las quince horas y cuarenta y uno minutos del veintiuno de octubre de dos mil dieciséis).’ Under this reasoning, any possession exercised by the plaintiff after entering into that agreement with the defendant, as well as any debts paid to INDER, are irrelevant arguments for resolving the claim asserted in the complaint, because no registrable legal effects may arise from a conveyance agreement (contrato traslativo) whose object is property that was outside the stream of commerce (fuera del comercio), based on a purpose contrary to law.
The exercise of the property’s social function (función social), offered as an argument legitimizing the plaintiff’s right, is unavailing, because the very law cited by the appellant, in Article 67, establishes the prohibition against conveyance. That restriction is specifically intended to ensure that property allocated by the State to award programs for social and productive purposes is not used by persons who have not qualified as awardees, since those programs are financed with public funds. Allowing otherwise, on the ground that the property has been made productive, would undermine the integrity of the objectives of the Ley de Tierras y Colonización, namely, to provide land to persons meeting a particular socioeconomic and technical profile so that they may make it productive while assuming a comprehensive legal relationship with that entity. If the plaintiff wished to succeed the defendant as awardee of the property, the plaintiff was required to apply to that Institute to formalize the authorization, since the aforementioned Article 67 provides for that possibility; the plaintiff failed to show that such an application was made or that authorization was obtained.” TRIBUNAL AGRARIO, Voto No. 1065-F-16 de las 13:59 horas del 15 de noviembre del 2016.- In accordance with the foregoing, the appellant is incorrect in asserting that his ownership right had become vested, because the claim for revocation of the award has remained pending since 24 de noviembre del 2008, when the restrictions were still in force.
Therefore, the transfer to the co-defendant corporation (whose officers are the plaintiffs themselves) occurred while this proceeding was pending before the courts and the present complaint was annotated in the property registry (see registry certification at image 112 of the electronic case file). Consequently, the fourth and fifth substantive grounds of appeal are rejected.-
V.REGARDING THE FIRST SUBSTANTIVE GROUND OF APPEAL (agravio de fondo), ALLEGING THAT THE AGREEMENT ENTERED INTO BY THE PLAINTIFFS WITH CO-DEFENDANT PABLO SOLORZANO CONSTITUTES A SHARECROPPING AGREEMENT (contrato de aparcería) HAVING A CONSTITUTIONAL RANK SUPERIOR TO THE PUBLIC-INTEREST RESTRICTIONS (limitaciones de interés social) OF THE LAND AND COLONIZATION LAW (Ley de Tierras y Colonización): The appellant’s interpretation on which this ground of appeal is based is likewise incorrect. The “Rural Sharecropping Agreement” (“Contrato de Aparcería Rural”) is indeed provided for in Article 69 of the Political Constitution; however, the public-interest restrictions under Article 67 of the Land and Colonization Law also have a constitutional basis in Article 45, second paragraph, of our Constitution, and the latter, concerning the right to property and the social function of agricultural property (función social de la propiedad agraria), is a programmatic provision of higher rank than the aforementioned Article 69.
This is because the right to property has the status of a fundamental right, which is not absolute and specifically permits restrictions such as that under Article 67 of the Land and Colonization Law to limit the primary attribute of ownership, specifically the right of alienation, based on the premise that land belongs to those who actually and physically work it (Article 4 of the LTC). This Tribunal has interpreted it accordingly: “The Tribunal’s reasoning reinforces some of the ideas supporting the declaration of nullity of agreements entered into in contravention of Article 67 of the Land and Colonization Law: a) Restrictions on the sale of property are valid insofar as they accord with the socioeconomic function of agricultural property, which seeks, on the one hand, to prevent the accumulation of land and wealth by certain persons to the detriment of the collective’s economic well-being. b) This interventionist legislation is reflected in the systemic body of rules set forth in the Land and Colonization Law. c) Consequently, the restriction is a matter of public policy (orden público), and we may therefore reasonably link it to the second part of Article 45 of the Constitution, in the sense of establishing a restrictive regime governing the right to property when warranted by the circumstances of the case in pursuit of the common welfare of society as a whole. d) The restriction would have ceased to have any effect if the Instituto de Desarrollo Agrario had expressly authorized the sale made by the allottee (adjudicatario), since in that event it would have to be presumed that the regulatory entity considered the alienation consistent with the system, principally because the third-party purchaser met the conditions required by the social function of property for the land to be used satisfactorily and rationally by persons or microenterprises possessing the technical capacity for agricultural activity and warranting state support.” TRIBUNAL AGRARIO, Vote No. 014-F-19 at 11:08 hours on January 29, 2019.- Consequently, it is not constitutionally correct to interpret that the allottee may disregard that restriction in order to enter into a rural sharecropping agreement merely because such an agreement is also contemplated in constitutional law, particularly where its execution constitutes a breach of the land-allocation agreement (contrato de asignación de tierras) and is grounds for revocation of the allotment (revocatoria de adjudicación). The first substantive ground of appeal is rejected.-
VI.REGARDING THE SECOND SUBSTANTIVE GROUND OF APPEAL, ALLEGING THAT THE BEQUEST MADE BY THE PLAINTIFFS IN A PUBLIC DEED (escritura pública) IN FAVOR OF CO-DEFENDANTS PABLO SOLORZANO ALVARADO, GABRIELA SOLORZANO ALVARADO, ROXANA SOLORZANO ALVARADO, AND GUADALUPE ALVARADO FLORES SHOULD NOT BE DEEMED A VIOLATION OF THE PUBLIC-INTEREST RESTRICTIONS: The appellant is incorrect. The reason INDER requested that the challenged judgment revoke the parcel allotment was different, as reflected in the relief sought in its counterclaim (reconvención): “a) That this counterclaim or cross-claim against Carlos Montero Montero and Anais Salas Mesén be granted in its entirety because it is legally well-founded and because the defendants failed to comply with the obligations imposed upon them, given that neither they nor their family have been in possession of parcel No. 7 of the Sector M settlement in Coyolar de Orotina for several years, and it was established that the parcel is worked, exploited, brought into production, cleared, maintained, harvested, and commercially operated by an unrelated third party” (see the virtual case file of the Juzgado Agrario de Alajuela, associated documents, main case file, Part IX, added on 09/09/2011 18:22:33, images 5 through 17).
In other words, the asserted ground was the indirect exploitation (explotación indirecta) of the parcel. The nullity ordered by the court below (a power conferred upon it ex officio under Article 868 of the Civil Code) with respect to public deed number 34-10, executed before Notary Pía Picado González at 18 hours on June 06, 2000, whereby parcel M-7 of the Asentamiento Coyolar was bequeathed to Pablo Solorzano Alvarado, Gabriela Solorzano Alvarado, Roxana Solorzano Alvarado, and Guadalupe Alvarado Flores, is a consequence of the principal ground of indirect exploitation having been deemed proven; the assessment of the evidence is the subject of the third ground of appeal and will be analyzed in the following recital (considerando). Consequently, the second ground of appeal is rejected.-
VII.REGARDING THE THIRD AND FINAL GROUND OF APPEAL CONCERNING THE ABANDONMENT OF THE PARCEL ATTRIBUTED TO THE APPELLANT IN THE CHALLENGED JUDGMENT: The appellant is likewise incorrect. The judgment grants the counterclaim insofar as it seeks revocation of the title to the allotted parcel on the ground of indirect exploitation, finding the following proven: “3-) Without establishing an exact date, but sometime between 2000 and 2001, plaintiff and counterclaim defendant Carlos Montero Montero verbally agreed to work ‘on a half-share basis’ the mango grove located within the disputed portion; that is, they agreed with co-litigant (litisconsorte) Pablo Solórzano Alvarado to a partial exploitation of the parcel at issue in these proceedings. They did so without the corresponding authorization from INDER and for a period of approximately 3 or 4 years. (testimony under examination of plaintiffs and counterclaim defendants Carlos Montero Montero and Anais Salas Mesén; testimony of Pablo Solórzano Alvarado, in the audio recording added on 06/03/2012 08:32:32, under tab 16 of the procedural-history details in the Virtual Case File, and its backup added on 30-11-2021 because the system does not permit the first recording to be heard).” It should be noted that the appellant does not challenge this fact and, moreover, in their complaint, specifically in the seventh and eighth allegations of fact, the plaintiffs admit that they entered into an agreement with defendant Pablo Solórzano to work the parcel “on a half-share basis,” without authorization from INDER, which constitutes a spontaneous admission (confesión espontánea) under Article 341 of the 1990 Code of Civil Procedure, applied supplementarily to this matter because it was the law in force when this complaint was filed.
It was previously stated in Considerando V that the fact that this agreement, which the plaintiffs characterize as Rural Sharecropping, does not place it above the public-interest restrictions contained in Article 67 of the Land and Colonization Law. Accordingly, the ground of indirect exploitation has not only been proven but was also spontaneously acknowledged by the appellant in the seventh and eighth allegations of fact in the complaint; therefore, this final ground of appeal is likewise without merit and must be rejected, and the judgment must be affirmed as to the matters appealed.-

SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las quince horas diez minutos del veinte de febrero de dos mil veintitrés.- PROCESO ORDINARIO promovido por CARLOS MONTERO MONTERO, mayor, casado, empresario agrario, vecino de Coyolar, orotina, cédula de identidad número dos - doscientos ocho - setecientos cuarenta y siete; ANAIS SALAS MESÉN, mayor, administradora de hogar, cédula de identidad número dos - ciento noventa y cuatro - cuatrocientos treinta y uno; ambos vecinos de Orotina, contra ÁLVARO ENRIQUE SANDOVAL ARAYA, mayor, soltero, comerciante, vecino de Orotina, cédula de identidad número seis - trescientos treinta y cinco - cero treinta; INSTITUTO DE DESARROLLO RURAL, representado por Carlos Enrique García Anchía, mayor, casado, abogado, vecino de Alajuela, cédula de identidad número dos - trescientos cincuenta y cuatro - doscientos sesenta y cinco.
Asimismo el último presentó reconvención contra CARLOS MONTERO MONTERO Y ANAIS SALAS MESÉN, de calidades antes mencionadas. Intervienen como LITISCONSORTES: ÁLVARO ENRIQUE SANDOVAL ARAYA, de calidades y vecindario antes mencionados; LA SOCIEDAD 3 - 101 - 689148 SOCIEDAD ANÓNIMA, representada por sus apoderados generalísimos sin límite de suma Carlos Montero Montero y Anais Salas Mesen, ambos de calidades antes citados; PABLO SOLÓRZANO ALVARADO, mayor, soltero, empresario, cédula de identidad número dos - cuatrocientos ochenta y siete - quinientos veinte; GABRIELA SOLÓRZANO ALVARADO, mayor, casada una vez, farmacéutica, cédula de identidad número dos - quinientos seis - cuatrocientos once; ROXANA SOLÓRZANO ALVARADO, soltera, arquitecta, cédula de identidad número uno - mil ciento noventa y nueve - cuatrocientos sesenta y ocho; GUADALUPE ALVARADO FLORES, administradora del hogar, viuda una vez; cédula de identidad número uno - trescientos ochenta y cinco - ochocientos setenta.
Actúa como apoderado especial judicial de los actores Carlos Montero Montero, Anais Salas Mesén y de la sociedad 3 - 101 - 689148 SOCIEDAD ANÓNIMA, el licenciado José Luis Ramos Castellón, cédula de identidad dos trescientos setenta y nueve - setecientos treinta y seis; del demandado y litisconsorte Álvaro Sandoval Araya, el letrado Sebastián Calderón Cerdas, colegiado veinte mil cuatrocientos cuarenta y seis; del INDER, el licenciado Adán Gómez Calvo, colegiado siete mil trescientos setenta; y la licenciada María Isabel Escalante Gutiérrez; como apoderada especial judicial de los Litisconsortes Pablo Solórzano Alvarado, Gabriela Solórzano Alvarado, Roxana Solórzano Alvarado y Guadalupe Alvarado Flores, la Licenciada Reina Ester Ramos Madriz, cédula de identidad seis - trescientos noventa y cuatro - quinientos cincuenta y cuatro, colegiada veintisiete mil quinientos veintisiete. Tramitado ante el Juzgado Agrario del Primer Circuito Judicial de Alajuela Alajuela.
RESULTANDO:
ALVARADO FLORES, contestan la demanda en forma negativa e interponen las excepciones de falta de derecho, falta de legitimación activa y pasiva, excepción de caducidad ( ver escritorio virtual del Juzgado Agrario de Alajuela, escrito incorporado el 25/06/2018 02:00:04 .
Redacta el juez Picado Vargas, y;
CONSIDERANDO
III.El licenciado José Luis Ramos Castellón, en su condición de apoderado especial judicial de la parte actora - reconvenido y de la sociedad 3-101-689148 S.A, interpuso recurso de apelación contra dicha resolución, manifestando en lo medular lo siguiente: "AGRAVIOS: 1.- Indica la resolución recurrida que mis representados cometen la primer violación a la normativa especial que regula la parcela en pleito, dado que convienen, verbalmente trabajar “a medias” la arboleda de mangos existente dentro de la parte en litis”, con el señor Pablo Solórzano Alvarado, lo cual no es nada irregular, ni viola tampoco la normativa especial que regula la parcela objeto de este proceso, por cuanto lo que establecieron mis representados y el señor Pablo Solórzano Alvarado, fue un “Contrato de Aparcería Rural” el cual está contemplado en el artículo 69 de La Constitución Política y por ende es norma de rango superior al artículo 67 de La Ley de Tierras y Colonización y dicha ley en general. 2.- Indica la resolución recurrida como una segunda violación a la normativa especial, que regula la parcela en litis, que mis representados CARLOS MONTERO MONTERO Y ANAIS SALAS MESEN, sin contar con autorización del Inder, mediante escritura pública numero 34-10, otorgada ante la notaría Pía Picado González a las 18 horas del 06 de junio del 2000, legaron la parcela M-7, del Asentamiento Coyolar a Pablo Solorzano Alvarado, Gabriela Solorzano Alvarado, Roxana Solorzano Alvarado y Guadalupe Alvarado Flores. 3.- Indica la resolución recurrida que mi representado Carlos Montero Montero abandonó la parcela diez años anteriores a la celebración del juicio llevado a cabo el día 05 de marzo de 2021, lo cual no es cierto como contundentemente lo hemos demostrado en el presente proceso y lo aclararemos más adelante. 4.- La resolución recurrida indica que los actores traspasan el inmueble de marras a la sociedad demandada, sin que su título estuviera consolidado, lo cual no es cierto como contudententemente lo refutaremos en el punto correspondiente. 5.- No es posible revocar la adjudicación de la parcela y su consecuente nulidad de título a mis representados y revertir la parcela en litis al INDER, por cuanto a la fecha de intervención del INDER en el presente proceso, las limitaciones que soportaba dicha parcela ya habían vencido y por lo tanto dicha parcela se había consolidado como una propiedad plena de dominio en favor de mis representados inscrita a nombre de una sociedad mercantil de carácter familiar." (ver escritorio virtual del Juzgado Agrario de Alajuela, escrito incorporado el 08/12/2021 11:19:28).-
IV.SOBRE LOS AGRAVIOS CUARTO Y QUINTO AGRAVIO DE FONDO REFERIDO A LA IMPROCEDENCIA DE LA RECONVENCIÓN DEL INSTITUTO DE DESARROLLO RURAL POR ENCONTRARSE VENCIDAS LAS LIMITACIONES DE INTERES SOCIAL AL MOMENTO DE SU INTERPOSICIÓN: No lleva razón el recurrente en su argumento. Conviene hacer una narración cronológica de cómo se dieron los acontecimientos para resolver este agravio: El Instituto de Desarrollo Rural (en adelante INDER) inició un procedimiento administrativo de revocatoria de título de propiedad y adjudicación de parcela contra los actores el día 24 de agosto del 2008, dos días antes de que vencieran los quince años de plazo de limitaciones de interés social del contrato de asignación de tierras, procedimiento administrativo que se tramitó tramitado bajo expediente 246-08 por incumplimiento de los artículos 67 y 68 de la Ley 2825. El mismo día que vencían las limitaciones, la finca objeto de este proceso, quedó anotada bajo las citas 0578-00005971-001 "EXHORTO DE NULIDAD DEL IDA", presentado el 26 de noviembre del 2008.
(Ver imagen 35 parte VII del expediente electrónico, escrito incorporado el 04/07/2014 10:50:19). Los aquí actores presentaron la presente demanda el seis de octubre del 2010 y la misma fue anotada al margen de la finca objeto de este proceso, el 30 de junio del 2015 en cumplimiento de resolución dictada el 29 de junio del 2015. ( ver razón de recibo a imagen 78 del expediente convertido a modo de libro en formato en pdf, a imagen 21 parte I del expediente físico escaneado e incorporado a los autos en fecha: 09/09/2011 18:17:23 y referida resolución que ordenó la referida anotación de demanda asociada a los autos el día 29 de junio del 2015). El INDER fue notificado de la demanda por integración de litis y presentó reconvención en setiembre del 2011 solicitando la revocatoria del título por las mismas causales que había sustentado en el procedimiento administrativo (ver escritorio virtual del Juzgado Agrario de Alajuela, documentos asociados, expediente principal parte IX, incorporada el 09/09/2011 18:22:33, imágenes 5 a 17).
Posteriormente, el órgano director del procedimiento administrativo mediante resolución dictada en esa sede, a las 09:05 horas del 09 de junio del 2014, ordenó el archivo del expediente administrativo sin perjuicio de la decisión que se dicte en el presente proceso (Bandeja de escritos 04/07/2014 10:50:19). Este recuento histórico arroja que el INDER entabló el procedimiento de revocatoria estando vigentes las limitaciones, manteniendo bajo la palestra el mismo con el Exhorto de Nulidad anotando la parcela e incluso presentó la reconvención estando anotada la finca, al punto que del 9 de setiembre del 2011 al 9 de junio del 2014 su pretensión de revocatoria estuvo paralelamente tramitada en sede administrativa y sede judicial, hasta que es esa última fecha dicho ente ordenó el archivo del procedimiento administrativo para terminar de resolverlo en la vía declarativa. Por ende, el agravio no es de recibo, ya que el exhorto citado es un acto interruptor de la prescripción, manteniendo viva la potestad del INDER de perseguir la nulidad del título y la revocatoria de la adjudicación hasta el día de hoy.
Al respecto ha dicho este Tribunal: "Independientemente que las limitaciones estén vencidas al momento de incoarse la presente demanda, ello no elimina el vicio de esa contratación, al contener un objeto prohibido por ley, lo que conlleva a la nulidad absoluta. Recientemente, este Tribunal, en caso similar resolvió: " (...) lo que se realizó fue el negocio de la venta, lo cual es un acto prohibido por el numeral 67 de la Ley de Tierras y Colonización, que establece en lo conducente: "Será absolutamente nulo cualquier contrato que se celebre sin que se cumplan las disposiciones anteriores", siendo que se requería de la autorización del Instituto de Desarrollo Agrario, hoy Instituto de Desarrollo Rural (INDER), lo cual en el caso concreto no ocurrió. Al soportar limitaciones del referido Instituto, el adjudicatario aún no tenía dominio pleno del derecho de propiedad como para enajenarlo libremente, pues aún el Instituto podría recuperarlo para sus fines sociales.
Debido a ello, al no tener esa disposición plena del bien, el negocio celebrado denominado opción de compra venta, es nulo al no contarse con la autorización requerida por parte del Instituto dicho, según la norma citada.- Tampoco es factible considerar la tesis del recurrente en cuanto la negociación se da bajo una condición suspensiva, pues de admitir este criterio se estaría ante una flagrante contravención de las normas de orden público como lo es la Ley de Tierras y Colonización, régimen jurídico impuesto sobre el inmueble en cuestión, de manera que la disposición de ese tipo de bienes no opera como en cualquier negocio privado, conforme lo sostiene el apelante en su agravio, sino que ese régimen de limitaciones conforman el marco jurídico que regula ese derecho, y precisamente por ello se publicitan en el Registro Público de la Propiedad. Interpretar lo contrario, es abrir portillos interpretativos de los cuales se puedan servir los beneficiarios del Programa de Asignación de Tierras del Instituto de Desarrollo Rural, haciendo caso omiso de la limitaciones impuestas, bajo el disfraz de opciones de ventas o ventas con la condición suspensiva del vencimiento temporal de las limitaciones existentes, lo cual como se indicó, va en contravención a la normativa de orden público.
Ello implicaría validar negociaciones, en las que se obtendría un beneficio económico del propio sistema social benefactor, que va dirigido a personas de determinado perfil económico y social y que el Estado provee con fondos públicos, cuyos objetivos son plasmados en los artículos 1 y 2 de la Ley de Tierras y Colonización.- V.- Aduce el apelante, no es factible la declaratoria oficiosa de la nulidad del negocio jurídico, pues así no fue solicitado por la contraparte. Sin embargo, para conocer si el actor tenía o no derecho sobre sus pretensiones, es necesario analizar la naturaleza jurídica del negocio y si las condiciones de validez estuvieron presentes al momento de la negociación, y como se dijo faltó un elemento esencial, el cual es la falta de autorización del Instituto referido y al ser omitido ese requisito, deviene la nulidad como un imperativo legal establecido en el artículo 67 ibídem.- Dispone el artículo 835 del Código Civil: ..."Hay nulidad absoluta en los actos o contratos: 1.- Cuando falta alguna de las condiciones esenciales para su formación o para su existencia. 2.
Cuando falta algún requisito o formalidad que la ley exige para el valor de ciertos actos o contratos, en consideración a la naturaleza del acto o contrato y no la calidad o estado de la persona que en ellas interviene...". Se establece en esta norma la nulidad del negocio al que le falta alguna de las condiciones, y en el caso de marras, al ser un contrato regulado por normas de orden público y no por normas de orden privado, no es de aplicación la nulidad absoluta en los términos del Código Civil que no es declarable de oficio, si no que debe complementarse la norma civil, con lo estipulado en el artículo 67 de la Ley de Tierras y Colonización (norma de orden público), en la que se establece de manera categórica la nulidad absoluta del contrato que se celebre sin la autorización debida del Instituto referido, por lo cual se impone la nulidad como un imperativo legal.- Arguye el apelante, que se está ante un vacío legal por parte del INDER, para poder evitar este tipo de compromiso entre adjudicados y particulares, solo en el caso de una modificación a la Ley en la que se integre al articulado el mecanismo de opción de compra venta, como instrumento legal que se opone a un negocio privado entre partes.
Considera que sin esa modificación, deviene en improcedente el declarar nulo este instrumento legal que tiene efectos jurídicos con efectos a futuro. Respecto a este agravio, nótese se indicó en el considerando anterior las razones por las que se considera que aunque se haya denominado el contrato como indica el recurrente, en realidad lo pactado fue una compra venta, por lo que la nulidad se impone. En todo caso, dispone el citado artículo 67, que es absolutamente nulo cualquier contrato, lo cual comprende el negocio de marras, independientemente de la nominación que se le haya dado.-(TRIBUNAL AGRARIO. VOTO N° 981-F-16 de las quince horas y cuarenta y uno minutos del veintiuno de octubre de dos mil dieciséis). Bajo esta tesitura, la posesión ejercida por el actor que haya desplegado con posterioridad a ese convenio realizado con la demandada, y deudas que haya cancelado ante el INDER, resulta argumentos irrelevantes para resolver la pretensión deducida en la demanda, pues no es dable derivar efectos jurídicos registrales de un contrato traslativo cuyo objeto sea un bien que estaba fuera del comercio, siendo una causa contraria a la ley.
El ejercicio de la función social sobre el inmueble, como argumento para legitimar su derecho, es inatendible, pues la misma ley que cita el apelante, en su artículo 67, es la que establece la prohibición de enajenación, limitación que es precisamente contemplada para regular que los bienes destinados por el Estado para programas de adjudicación con fines sociales y productivos, no sean utilizados por quienes no han calificado como adjudicatarios, toda vez esos programas son financiados con fondos públicos. Permitir lo contrario, bajo la justificación de que se ha puesto a producir el bien, atenta contra la integridad de los objetivos de la Ley de Tierras y Colonización, que es el dotar de tierras a personas bajo cierto perfil socio económico y técnico, para que las pongan a producir, asumiendo toda una relación jurídica con esa entidad. Si la parte actora deseaba suceder a la demandada en la adjudicación del bien, debía de acudir ante dicho Instituto para formalizar la autorización, ya que la ley prevé esa posibilidad en el mencionado artículo 67, lo cual no demostró haber hecho o bien obtenido una autorización." TRIBUNAL AGRARIO, Voto No. 1065-F-16 de las 13:59 horas del 15 de noviembre del 2016.- Conforme a lo aquí expuesto, no lleva razón el recurrente en cuanto a que su derecho de propiedad se había consolidado, pues la pretensión de revocatoria de la adjudicación se ha mantenido pendiente desde el 24 de noviembre del 2008, estando vigentes las limitaciones, por lo que el traspaso realizado a la sociedad codemandada (cuyos personeros son los mismos actores) se realizó estando este proceso en estrados judiciales y anotada la presente demanda (Ver certificación registral a imagen 112 del expediente electrónico). En consecuencia, se rechaza el cuarto y quinto agravio de fondo.-
V.SOBRE EL PRIMER AGRAVIO DE FONDO REFERIDO A QUE EL ACUERDO TOMADO POR LOS ACTORES CON EL CODEMANDADO PABLO SOLORZANO CONSTITUYE UN CONTRATO DE APERCERÍA CON RANGO CONSTITUCIONAL SUPERIOR A LAS LIMITACIONES DE INTERES SOCIAL DE LA LEY DE TIERRAS Y COLONIZACIÓN: Tampoco lleva razón el recurrente en la interpretación en que funda su agravio. Ciertamente, el “Contrato de Aparcería Rural” está contemplado en el artículo 69 de La Constitución Política; pero las limitaciones de interés social del artículo 67 de La Ley de Tierras y Colonización también tiene su fundamento constitucional en el artículo 45 párrafo segundo de nuestra Carta Magna y ésta, referida al derecho de propiedad y la función social de la propiedad agraria es una norma programática de mayor nivel que el referido artículo 69. Ello por cuanto el derecho de propiedad tiene el rango de derecho fundamental, el cual no es absoluto y permite precisamente que limitaciones como la del artículo 67 de la Ley de Tierras y Colonización limiten el atributo primario del dominio, específicamente el de enajenación bajo la premisa de que la tierra es para quien real y materialmente la trabaje (artículo 4 de la LTC).
Asi lo ha interpretado este Tribunal: "De lo esbozado por el tribunal se refuerzan algunas de las ideas que respaldan la declaratoria de nulidad de los contratos celebrados en contravención al ordinal 67 de la Ley de Tierras y Colonización: a) Las limitaciones para la venta de la propiedad son válidas en armonía con la función socio económica de la propiedad agraria que pretende por un lado evitar la acumulación de tierras y riquezas en algunas personas en detrimento del bienestar patrimonial del colectivo. b) Esta legislación intervencionista se refleja en el conjunto sistémico de normas expuesto por la Ley de Tierras y Colonización. c) Por ende, la limitación es de orden público y de ahí que podríamos vincularla razonablemente con la segunda parte del artículo 45 constitucional en el sentido de formular un régimen restrictivo del derecho de propiedad cuando las circunstancias del caso lo ameriten en boga del bienestar común del conjunto social. d) La limitación hubiese quedado sin efecto alguno si el Instituto de Desarrollo Agrario hubiese autorizado expresamente la venta realizada por el adjudicatario, pues ante tal supuesto habría que suponer que la entidad reguladora hubiese considerado que la enajenación resulta congruente con el sistema, principalmente porque el tercero comprador reúne las condiciones que la función social de la propiedad exige para que la tierra sea aprovechada satisfactoria y racionalmente por personas o microempresas con capacidad técnica para la actividad agraria que ameriten el apoyo estatal." TRIBUNAL AGRARIO, Voto No. 014-F-19 de las 11:08 horas del 29 de enero del 2019.- Por ende, no es constitucionalmente correcto interpretar que el adjudicatario puede pasar por alto dicha limitación para celebrar un contrato de aparcería rural por el hecho de que el mismo también esté en la normativa constitucional, máxime si su celebración constituye un incumplimiento del contrato de asignación de tierras y sea una causal de revocatoria de adjudicación. Se rechaza el primer agravio de fondo.-
VI.SOBRE EL SEGUNDO AGRAVIO DE FONDO RELATIVO A QUE NO DEBE TOMARSE COMO VIOLACIÓN A LAS LIMITACIONES DE INTERES SOCIAL EL LEGADO QUE EN ESCRITURA PUBLICA REALIZARON LOS ACTORES A FAVOR DE LOS CODEMANDADOS PABLO SOLORZANO ALVARADO, GABRIELA SOLORZANO ALVARADO, ROXANA SOLORZANO ALVARADO Y GUADALUPE ALVARADO FLORES: No lleva razón el recurrente. La razón por la cual el INDER pidió que en la sentencia impugnada se revocara la adjudicación de parcela fue otra, de lo cual consta en su petitoria de reconvención: "a) Que se acoge en un todo, la presente reconvención o contrademanda en contra de Carlos Montero Montero y Anais Salas Mesén, por estar ajustada a derecho y por no cumplir los demandados con las obligaciones impuestas, al no estar ellos ni su familia desde hace varios años en posesión la parcela N° 7 del asentamiento sector M en Coyolar de Orotina, por quedar corroborado que la parcela es trabajada, explotada, inducida su producción, limpieza, mantenimiento, recolección de cosecha y comercialización por un tercero ajeno a ello" (ver escritorio virtual del Juzgado Agrario de Alajuela, documentos asociados, expediente principal parte IX, incorporada el 09/09/2011 18:22:33, imágenes 5 a 17).
Es decir, la causal invocada fue la explotación indirecta de la parcela. La nulidad decretada por la a quo (potestad que le confiere de oficio el artículo 868 del Código Civil) sobre la escritura pública numero 34-10, otorgada ante la notaría Pía Picado González a las 18 horas del 06 de junio del 2000, legaron la parcela M-7, del Asentamiento Coyolar a Pablo Solorzano Alvarado, Gabriela Solorzano Alvarado, Roxana Solorzano Alvarado y Guadalupe Alvarado Flores es consecuencia del hecho de haberse tenido por demostrada la causal principal de explotación indirecta, cuya valoración de la prueba es objeto del tercer agravio y que será analizado en el próximo considerando. En consecuencia, se rechaza el segundo agravio.-
Tampoco lleva razón el recurrente. La sentencia acoge la reconvención en cuanto a la revocatoria de tírulo de propiedad de la parcela adjudicada por la causal de explotación indirecta, al tener por demostrado lo siguiente: "3-) Sin precisar fecha exacta, pero entre los años 2000 y 2001, el actor y reconvenido Carlos Montero Montero convienen, verbalmente, trabajar "a medias" la arboleda de mangos existente dentro de la parte en litis, es decir, acuerdan una explotación parcial de la parcela objeto de este proceso, con el Litisconsorte Pablo Solórzano Alvarado. Ello, sin contar con la respectiva autorización del INDER y por un espacio de tiempo aproximado a los 3 ó 4 años. (confesional de los actores- reconvenidos, Carlos Montero Montero y Anais Salas Mesén, testimonial de Pablo Solórzano Alvarado, en registro de audio incorporado en fecha 06/03/2012 08:32:32, en la pestaña 16 del detalle de actuaciones del Escritorio Virtual y su respaldo incorporado el 30-11-2021 por cuanto el primer registro el sistema no permite escucharlo)." Cabe indicar que este hecho no es protestado por el recurrente, además de que en su demanda, específicamente en los hechos sétimo y octavo, los actores admiten que celebraron con el demandado Pablo Solórzano el trabajar "a medias" la parcela, sin mediar autorización del INDER, lo cual constituye confesión espontánea de acuerdo al numeral 341 del Código Procesal Civil de 1990, aplicado supletoriamente a esta materia por ser la norma vigente al interponerse esta demanda.
Ya anteriormente, en el Considerando V, se indicó que el hecho de que dicho pacto, que la parte actora califica de Aparcería Rural, no está por encima de las limitaciones de interés social contenidas en el artículo 67 de la Ley de Tierras y Colonización, por lo que la causal de explotación indirecta no solo ha sido acreditada sino también reconocida espontáneamente por el recurrente en los hehcos sétimo y octavo de la demanda; por lo que este último agravio tampoco es de recibo y debe rechazarse el mismo, confirmando la sentencia en lo que fue objeto de apelación.-
POR TANTO
Se confirma la sentencia en lo que fue objeto del recurso.- ???????????????
