Ordinary proceeding (proceso de conocimiento) declared to involve purely legal issues, brought by Nombre81933, of legal age, identity card CED60946, divorced, in a domestic partnership, farmer, resident of Los Ángeles Drake, Cantón Osa, province of Puntarenas, against the Instituto de Desarrollo Rural (hereinafter, INDER). Attorney Nombre81934 appears as counsel and special judicial attorney-in-fact (apoderada especial judicial) for the plaintiff, as evidenced by the power of attorney appearing in image 6 of the court file. Attorney Ana Gabriela Chaves Peralta represents the interests of INDER (images 74-75 and 258-259 of the court file, as well as the audio recording of the preliminary hearing). The State participates as an interested third party (tercero interesado), represented by State Attorney Mauricio Castro Lizano (images 240, 243 through 247, and 250 of the court file). The legal requirements have been observed in the conduct of the proceeding, and no defects or omissions capable of rendering the actions taken and decisions issued null and void are apparent. Following the deliberation required by law, the Collegiate Court assigned by rotation to hear this matter now renders judgment by unanimous vote of its members.

WHEREAS
1. The plaintiff filed the complaint before the agrarian court on September 30, 2019 (images 1 through 5 of the court file).
2. By interlocutory judgment (auto sentencia) N°262-2019 issued at seven hours and twenty-eight minutes on October third, two thousand nineteen, the Agrarian Court of the II Judicial Circuit of the Southern Zone declined jurisdiction over the subject matter, ruling: “In accordance with the foregoing, the undersinged (sic) judge declines to continue hearing this matter because it should be adjudicated in the Administrative Litigation Jurisdiction and refers it to the Agrarian Appellate Court to resolve the jurisdictional dispute” (images 26-27 of the court file).
3. By Voto N°893-C-19 issued at sixteen hours and thirty-six minutes on October thirty-first, two thousand nineteen, the Agrarian Appellate Court of the Second Judicial Circuit of San José ruled: “The decision of the Agrarian Court of the Second Judicial Circuit of the Southern Zone declining jurisdiction is affirmed. The matter shall be referred to the Administrative Litigation Court of the Second Judicial Circuit of San José, Annex A, for further proceedings” (images 29 through 31 of the court file).
4. By decision issued at ten hours and thirty-eight minutes on November twenty-first, two thousand nineteen, the Administrative Litigation and Civil Court of the Treasury ordered: “Because this is an ordinary proceeding, and in accordance with the amendment provided for in Article 212 of the Administrative Litigation Procedural Code, in relation to Article 97 of (sic) the Organic Law of the Judiciary, this proceeding shall be referred to the ADMINISTRATIVE LITIGATION AND CIVIL COURT OF THE TREASURY OF THE II JUDICIAL CIRCUIT OF SAN JOSÉ, ANNEX A, for whatever ruling it deems appropriate” (image 35 of the court file).
5. By decision issued at thirteen hours and thirty-four minutes on December ninth, two thousand nineteen, the judge presiding over the case-management stage (etapa de trámite) of this Court assumed jurisdiction over the case and ordered the proceeding to continue. The plaintiff was directed to restate the facts alleged in the complaint, present the grounds thereof in a properly organized manner, and identify the legal provisions and arguments so as to state clearly and coherently the legal grounds supporting the relief sought; the plaintiff was also directed to specify the requested relief, clarify whether annulment of any specific action by the defendant was sought, and submit the copies required by law (image 37 of the court file).
6. The plaintiff complied with the order in a filing dated December 19, 2019. By decision issued at fourteen hours and forty-seven minutes on January thirteenth, two thousand twenty, the complaint was served upon INDER. The relief sought in the proceeding is: “1)- That judgment be entered granting this complaint in all (sic) respects. 2)- That (sic) my client has standing to bring this complaint because he is duly recognized by INDER AS A PARCEL HOLDER (PARCELERO). That the possession exercised has always been undisturbed, public, peaceful, and to the exclusion of every other person. 3)- That the judgment instruct the INDER BOARD OF DIRECTORS to grant my client the required authorization TO ENROLL THE FARM FOR INCENTIVES WITH THE FONDO DE DIVERSIDAD SOSTENIBLE (FBS). 4)- That the attached documents demonstrate that, in the past, my client had (sic) the required authorization from the INDER Board of Directors, as did other parcel holders whose lands are held under a possessory right and are not titled, and who, with authorization from the INDER Board of Directors, may receive incentives under the FONDO DE DIVERSIDAD SOSTENIBLE (FBS) program.
Today, in order to apply for and receive such incentive for five years from the FONDO DE DIVERSIDAD SOSTENIBLE (FBS), THE APPROVAL AND AUTHORIZATION OF INDER IS REQUIRED. 5) That (sic) the judgment confirm that the attached documentation demonstrates that in prior years my client had (sic), like other parcel holders, the required authorization from the INDER Board of Directors to enroll the farm for incentives.” (images 40 through 45 and 55 through 57 of the court file).
7. INDER answered the complaint on March 03, 2020. It requested that the complaint be dismissed in all respects, that the Institution be found to have acted in good faith, and that the plaintiff be ordered to pay attorneys’ fees and litigation costs. It asserted the defenses of failure to join necessary parties (falta de integración de la litis) (with respect to MINAE, SINAC, and FONAFIFO), lack of active and passive standing, payment, and failure to state a legal right (falta de derecho) (images 62 through 72 of the court file).
8. By decision N°1310-2020 issued at fifteen hours and twenty-five minutes on August eleventh, two thousand twenty, the judge presiding over the case-management stage ruled on the alleged joinder of the State, the Fondo Nacional de Financiamiento Forestal (FONAFIFO), and the Sistema Nacional de Áreas de Conservación (SINAC), stating: “The preliminary defense of failure to join necessary defendants (litis consorcio pasivo necesario) raised by INDER’s representative is DENIED. Pursuant to Article 15 of the Administrative Litigation Procedural Code, the State and SINAC shall be notified of the existence of this proceeding so that, once apprised thereof, they may state within five business days whether they are interested in appearing herein. For that purpose, the plaintiff is directed to submit, within three business days, two sets of copies of the entire record, under penalty of having future applications disregarded” (images 198 through 202 of the court file).
9. By decision Nº044-2021 issued at eleven hours and thirty-five minutes on February fourth, two thousand twenty-one, the Administrative Litigation and Civil Appellate Court of the Treasury, Section I, affirmed decision N°1310-2020 (images 206 through 238 of the court file, appellate record).
10. By order issued at eleven hours and one minute on March seventeenth, two thousand twenty-one, decision N°1310-2020, issued at fifteen hours and twenty-five minutes on August eleventh, two thousand twenty, was served upon the Procuraduría General de la República and the Sistema de Áreas de Conservación (image 239 of the court file).
11. By order issued at fifteen hours and thirty-eight minutes on June seventh, two thousand twenty-one, the judge presiding over the case-management stage ordered: “In view of the filing dated April seventh of the current year, submitted by Attorney Mauricio Castro Lizano on behalf of the State, the party’s statements are noted and, pursuant to Article 13 of the Administrative Litigation Procedural Code, the State is recognized as an interested third parties (sic) in this proceeding. Similarly, the parties are hereby informed that the Sistema Nacional de Áreas de Conservación did not state a position in this regard (...)” (image 250 of the court file).
12. The State appeared in the proceeding as an interested party through the filing appearing in images 243 through 247 of the court file, stating that “because the disputed land forms part of the Patrimonio Natural del Estado, I request that INDER’s defense of failure to state a legal right be sustained and that the complaint be dismissed in all respects.” 13. A preliminary hearing was held at ten hours and three minutes on October nineteenth, two thousand twenty-one, with only the State, as an interested third party, present at its commencement. The plaintiff was not present and did not justify his absence. The presiding judge read aloud the relief sought in the proceeding, appearing in image 44 of the court file. The State’s representative stated that the requested relief was clear. Upon reviewing the preliminary defenses, the court explained that joinder had been resolved by an interlocutory ruling and that only defenses on the merits remained.
The State’s representative joined in the defense of failure to state a legal right asserted by INDER. Based on the amended pleading filed on December 19, 2019, all allegations in the complaint are deemed disputed. INDER’s legal representative joined the hearing when evidence was offered (audio recording beginning at minute 00:12:00). Only documentary evidence was admitted. A deadline was granted for submitting closing arguments in writing. The State’s representative submitted his closing arguments, which appear in images 277 through 280, and the plaintiff submitted his in the filing appearing in images 281 through 283. INDER’s representative did not submit closing arguments, or at least none appear in the court file (images 268 through 272 of the court file).
In an amended complaint filed on 19 de diciembre de 2019, the plaintiff stated: “FIRST: I hereby appear to file a formal complaint against the INSTITUTO DE DESARROLLO AGRARIO (...) SECOND: My client owns an unregistered possessory right (derecho de posesión), which has been held for more than sixty. During these years, he has maintained uninterrupted and peaceful possession (posesión) of said property under a claim of ownership, carrying out throughout this period all manner of maintenance work and complete clearing of paths, planting fruit trees, and maintaining and caring for the forest and its ecological system in accordance with Ley Foresta (sic), preserving the diversity of its scenic beauty, protecting the water, protecting the forest, and protecting biodiversity; the property is described as mountainous land and scrubland (tacotales). Located in Junta Quebradas, Dirección8836, Osa, Province of Puntarenas, with the following current boundaries: North: Nombre81936, Ganadera Guayacán de Ceibo sociedad (sic) Anónima, and Dirección336.
South: Nombre81937, with a stream between them. East: Nombre81938 and a public road. West: Nombre81939. It measures ninety-six hectares, five thousand eight hundred ninety-one square meters and seventy-six square decimeters, according to the survey plan (plano) registered with the national cadastre under number P-UNO UNO DOS OCHO CUATRO- DOS MIL SIETE. THIRD: Although it is true that, during the nineteen-eighties, the State [acted] with respect to a large number of smallholders: ‘ICTC; SECRETARÍA GENERAL, San José, 10 de diciembre de 1980, Se (sic) Secretaría General. Subject: Segregation and Transfer. To: Sec. Land Planning and Tenure. ..., please take note for the corresponding processing; I hereby inform you of the resolution adopted by the Board of Directors in its Article N°XII of Session N°2429, held on 1-12-80 de diciembre de 1980’; at that time, the undersigned was excluded from said allocation and segregation (segregación), and the same occurred in 2005, pursuant to Resolution thirty-nine of Session N°044-05, held on 14 de noviembre 2005, subject: proceed with deed.
By that time, as in 2012, the boundaries of the Asentamiento Campesino Osa were already located within Reserva Forestal Golfo Dulce, created by executive decree number 5493-A of 1 de junio de 1978, so that public deeds could be granted for their parcels. In that same year, Your Honor, the undersigned was excluded from said proceeding, based on the assessment contained in the technicians’ report at that time; and following the repeal effected by the new regulations, he was excluded from the entire procedure governing the administrative proceeding through which he could become the beneficiary of a deed or receive payment for the expropriation (expropiación). My client received neither. See attached copy. FOURTH: At that time, the State did not grant my client the deed, nor did it purchase his possessory right in his capacity as owner; and, in the past, the State itself sic) granted him the corresponding authorization to obtain incentives for the farm for five years.
However, the funds allocated for that purpose were exhausted, and he did not receive that benefit. FIFTH: FOR THE PRESENT YEAR 2019, my client requested the required authorization to obtain incentives for the farm through the PROGRAMA DE CONSERVACIÓN DE LA BIODIVERSIDAD SOSTENIBLE (FBS); nevertheless, in their recommendation to the Board of Directors, the technicians stated that they did not recommend granting such authorization. See attached document. To obtain incentives for the farm through the PROGRAMA DE CONSERVACIÓN DE LA BIODIVERSIDAD SOSTENIBLE (FBS) (emphasis added), my client requires said authorization. SEE ATTACHED DOCUMENT. SIXTH: I hereby inform Your Honor that, as of today, the State has not paid him any money for that (sic) possessory right in his capacity as owner, WITH CADASTRAL PLAN P-1128424-2007 for the Province of Puntarenas, showing an area of 96 ha. 5.891,76 square centimeters.
This is an opportunity under the PROGRAMA DE CONSERVACIÓN DE LA BIODIVERSIDAD SOSTENIBLE (FBS). ON A PREVIOUS OCCASION, AN APPLICATION WAS MADE TO OBTAIN INCENTIVES (sic) UNDER the Pago de Servicios Ambientales of the programa de fondo nacional de financiamiento forestal (fonafifo), and he did receive the required authorization: Secretaría General, San José, 21 de junio de 2011/Subject: Authorize smallholders who have been allocated land or recognized as surveyed possessors by the Institute and who meet the requirements established in decreto 3076- MINAE dated 4 de octubre de 2002 TO ACCESS THE PAGO DE SERVICIOS AMBIENTALES OF THE PROGRAMA DE FONDO NACIONAL DE FINANCIAMIENTO FORESTAL. Resolution adopted by the Board of Directors in Article N°41 of Ordinary Session 022-2011, held on 20 de junio de 2011. See attached document’ (images 40 to 45 of the judicial case file).”
TRUE. SECOND: DENIED IN THE TERMS IN WHICH IT IS PRESENTED. This legal representative has no knowledge of the alleged right of possession (derecho de posesión), nor has the plaintiff proven it. In fact, this administrative litigation jurisdiction (jurisdicción contenciosa administrativa) has a considerable number of court cases in which precisely that issue, and whether compensation is warranted, is under discussion. Accordingly, this representative denies the allegation, because Inder lacks jurisdiction to recognize, either judicially or administratively, a right of possession or ownership (derecho de propiedad), a highly complex matter that has been submitted for consideration by the judges. THIRD: DENIED AS INACCURATE AND IN THE TERMS IN WHICH IT IS PRESENTED. Nor does this representative have knowledge of the plaintiff’s exclusion with respect to the technical studies he cites. However, regarding the aforementioned IDA Board of Directors Resolutions (Acuerdos de Junta Directiva), this representative Nombre81940 that: a. The IDA Board of Directors Resolution, Article 13 (XII) of session number 2429 of 1-12-1980, HAS NO connection with Asentamiento OSA; that resolution concerns the so-called Proyecto Puriscal-Parrita (Documentation attached to this brief). b. The IDA Board of Directors Resolution, Article 39 of session number 44-05 of 14-11-2005, resulted from a special procedure applicable exclusively to the titling (titulación) of land in Asentamiento Campesino Osa, under which a series of requirements had to be met and a complete verification procedure had to be conducted by both Oficina Subregional de Osa and MINAE, which would jointly issue the corresponding recommendation after verifying compliance with the required conditions, expressing either their favorable opinion regarding the granting of title or their reasons for denying it.
That resolution remained in force for 2 years. However, IT WAS REPEALED by Article 35 of Ordinary Session 040-2007, held on 19 de noviembre de 2007, when the Board of Directors resolved to revoke the aforementioned Resolution N°39 of 2005 because, based on the analysis (sic) of various opinions issued by Procuraduría General de la República, the Institute had been advised that it was legally impossible to grant title in the area because these lands were located within Reserva Forestal Golfo Dulce and constituted State Forest Heritage (Patrimonio Forestal del Estado), now State Natural Heritage (Patrimonio Natural del Estado) (Documentation attached to this brief). FOURTH: DENIED AS INACCURATE AND IN THE TERMS IN WHICH IT IS PRESENTED. This legal representative has no knowledge of the allegations. Nevertheless, it should be noted that the plaintiff himself states that it was the “State,” rather than Inder, that paid him the incentive for the property for 5 years.
In order to ascertain the terms of the contract, it is noted that, by official letter INDER-PE-AJ-137-2020 (documentation attached to this brief), this legal representative requested from Nombre28548 the administrative record (expediente administrativo) concerning Mr. Nombre81933’s PSA contract, but no response had been received by the deadline for answering the complaint. However, the forms that Nombre28548 makes available to persons wishing to enroll in the PSA Program (documentation attached to this brief) warn applicants that payment is subject both to “prioritization criteria” and to the “availability of resources.” Thus, applicants are aware of these financial conditions. FIFTH: DENIED AS INACCURATE AND IN THE TERMS IN WHICH IT IS PRESENTED. According to the website of Fondo de Biodiversidad Sostenible, the “Programa de Conservación de la Biodiversidad” (PCB, or FBS according to its initials in English) is defined as: “a voluntary mechanism that seeks to implement a system of financial and nonfinancial incentives for biodiversity conservation that recognizes the contributions made by local communities, strengthening economically, socially inclusive, and environmentally sustainable development.
It (sic) is based on two main components: a financial incentive and support for owners and possessors of private land” (...) Several aspects of the foregoing definition should be highlighted: a) The program seeks to grant incentives to persons pursuing “biodiversity conservation”; nevertheless, according to technical agrarian inspections (inspecciones agrarias técnicas) conducted by Oficina Subregional de Osa, the most recent on 7-5-2019, burns are evident on both what appears to be a dwelling and the land on parcel N°28 of Asentamiento Osa, located in Sector el Progreso, Drake (the subject of the litigation). In this regard, see official letter OTOS-255-2019, appearing at folio 15 of the administrative record for parcel N°28 of Asentamiento Osa, located in Sector el Progreso, Drake (documentation attached to this brief). Thus, under the legal system itself, this constitutes a practice inconsistent with environmental conservation, because conservation necessarily entails the duty to protect and preserve the land and forest so as to establish ecological possession (posesión ecológica). b) The program seeks to provide an incentive to “owners” of “private land.” In other words, accepting that they are entitled to payment means accepting that they are “owners” or possess some right over the “private” land.
Nevertheless, there are many aspects to be analyzed, namely: first, their status as good-faith possessors (poseedores de buena fe), and second, the legal nature of “private land,” since, as has been duly stated, these forest-suitable lands form part of RFGD, which the PGR itself has characterized as public-domain property (bienes de dominio público) incorporated into State Natural Heritage. Procuraduría General de la República, in opinion C-321-2003 of 9 de octubre de 2003, stated [citation omitted]. In this regard, consideration should also be given to the Legal Opinions issued by the institution, namely: official letters DAJ-295-2012 of 21-6-2012, AJ-410-2018 of 11-9-2018, and INDER-PE-AJ- 523-2019 of 25-11-2019 (documentation attached to this brief). These Legal Opinions concern PSA and its immediate relationship to the designation (afectación) of those lands as State Natural Heritage.
It should also be noted that the plaintiff acknowledges and accepts this status of RFGD in his account of the third factual allegation in this complaint. The plaintiff, for his part, states that the Institution’s technical reports recommend against authorizing PSA; however, the technical reports of Oficina Territorial Osa cannot and must not issue any “AUTHORIZATION,” because such authorization falls within FONAFIFO’s jurisdiction. Those technical opinions merely set out a series of observations concerning the parcel, including that Mr. Nombre81933 appears in the database as the occupant of parcel 28, but Nombre81940, that “the information was verified in the field, and therefore the entry in that census does not mean that rights of any kind are recognized (neither possession nor ownership).” In this regard, see the reference form concerning an inspection conducted, appearing at folios 10-11 of the administrative record for parcel N°28 of Asentamiento Osa, located in Sector del Progreso, Drake (documentation attached to this brief).
SIXTH: FALSE. The Costa Rican State, through Nombre28548, has paid PSA; nevertheless, that same Institution must determine whether the documents submitted satisfy the requirements imposed by the legal system. In this regard, see Ley N°8640 del 2008 Manual de Procedimiento para el pago de Servicios Ambientales in its entirety, particularly Articles 8 and 9. ON THE MERITS (SOBRE EL FONDO DEL ASUNTO): In recent months, our Institution has been seriously harmed by a very poor public image and by distorted “lobbying” concerning certain matters, such as PSA; our territorial offices have been directly attacked as a result of applicants’ heightened hostility over Inder’s alleged sole responsibility for denying this incentive. However, that allegation is false, because INDER merely fulfills one portion of the statutory requirements and is not the entity that grants the incentive. In this particular case (sic), even under the basic principle of legality (principio de legalidad) in Administrative Law, the incentive is granted by Nombre28548, which may determine whether or not PSA should be granted.
(...) Inder’s “role” regarding Pago de Servicios Ambientales is limited to certifying whether the applicant is a possessor recorded in the IDA census, a declared beneficiary, or an awardee (adjudicatario); it does not include (sic) granting authorizations for persons to receive payments for environmental services, as that is not a function assigned by the law establishing Inder. For Inder to grant authorizations would be contrary to law; this is an error of interpretation, perhaps induced by the manner in which the words are used. Under the applicable regulations, FONAFIFO alone has the authority and jurisdiction to determine whether a person qualifies to receive Pago de Servicios Ambientales. Unfortunately, however, Nombre28548 is the entity that expects direct approval from Inder and its Board of Directors. For its part, in light of what occurred in expediente 15-8145-1027-CA Resolución N°30-2018 -VIII de abril 218 caso Nombre81941 y Nombre81942, Inder must exercise great caution when issuing administrative acts (actos administrativos), even procedural ones, and/or official letters of any kind, because the Institution lacks jurisdiction to recognize administratively either rights of possession or ownership on the basis of a database or censuses that were never verified in the field.
For that reason, applicants and senior authorities have been advised that “for all administrative or judicial purposes, Oficina de Desarrollo Territorial de Osa must clarify and emphasize that none of the certifications issued through official letters RECOGNIZE RIGHTS OF ANY KIND (neither possession nor ownership) in favor of the alleged occupants, because the information provided comes from the Institution’s old databases and censuses, which were never verified in the field.” Inder’s administration, both operational and senior, is prohibited from delivering documents that could recognize or create rights over property which, because of its public-domain status (demanialidad), is not susceptible to appropriation; if it were to do so, those documents would be completely null and void and without legal effect under our legal system. With the enactment of Ley 8640 “Aprobación del Contrato de Préstamo N°7388-CR y sus anexos entre la República de Costa Rica y el Banco Internacional de Reconstrucción y Fomento (BIRF),” Article 9 established the requirements to be met by persons seeking Pago de Servicios Ambientales [transcription omitted].
Subsection b refers to the procedure that Inder must perform, which consists solely of issuing a certification stating whether the persons are possessors recorded in the census, declared beneficiaries, or awardees. It is not responsible for authorizing Pago de Servicios Ambientales, as erroneously stated in the official letter. Under the cited Law, the legal obligation to issue the authorization rests directly with FONAFIFO, as demonstrated by subsection e) of the article in question, which authorizes (sic) it to conduct an inspection of the property where possession is exercised and thereby determine whether the benefit may be granted. The regulations implementing Ley Forestal N°25721, in Article 55(b), state that the functions of FONAFIFO’s Board of Directors, in addition to those stipulated by law, include establishing the procedures for Pago de Servicios Ambientales in accordance with Ley Forestal N°7575 and its Regulations.
Nombre28548 is responsible for processing and paying for environmental services provided by forests and forest plantations, as well as for other activities necessary to strengthen the development of the country’s natural-resources sector; SINAC is responsible for part of the oversight, monitoring, and promotion of Programa de pagos por Servicios Ambientales.
Additionally, Article 39 of the Regulation (Reglamento) authorizes the Fondo Nacional de Financiamiento Forestal to issue manuals and/or procedures for payment for environmental services (pago de servicios ambientales, PSA—Manual de Procedimiento para el Pago de Servicios Ambientales, published in La Gaceta N°46 of 6 de marzo del 2009, as amended). Continuing with the regulatory analysis, Article 22 of the Ley Forestal states: [transcribed] It follows from the foregoing that the powers granted by law are vested in Nombre28548 and that Inder’s basic function is to indicate whether the person is a possessor (poseedor), beneficiary (beneficiario), or awardee (adjudicatario); it does not issue any authorization for obtaining payment for environmental services” (images 62 to 72 of the court case file (expediente judicial)).
1. This is not a fact. 2. It is not true that the plaintiff possesses the property as owner. The forests and forestlands or lands suitable for forestry within Reserva Forestal Golfo Dulce, created by Decreto 5493 of 1 de junio de 1978, and the property registered in the name of IDA (INDER) under N°39334-000 of the Puntarenas Registry District constitute State Natural Heritage (Patrimonio Natural del Estado) pursuant to Articles 13, 14 and 39, subsection i, of the Ley Forestal, and Article 38 of Ley 7554), and are therefore part of the public domain (dominio público) and not susceptible to possession (Sala Primera judgments numbers 59-F-99, 1070-F-S1-2010 and 1088-F-S1-2011; constitutional decisions 8945-2005, 2063-2007, 16975-2008, 17650-2008, 17659-2008, 21258-2010 and 16938-2011). That State Natural Heritage is administered by MINAE-SINAC under the provisions of the Ley de Conservación de la Vida Silvestre, Article 83, second paragraph; Ley Forestal, Articles 3, subsections b) and d), 13, 14 and 15; Ley 6043, Article 73; Ley Orgánica del Ambiente, section 32; Ley de Biodiversidad, Articles 22 and 28 (constitutional judgment 16975-08; opinions OJ-122-2000, C-26-2001, C-210-2002, OJ-253-2003, C-321-2003, OJ-14-2004, OJ-93-2004, C-297-2004, C-339-2004, OJ-56-2005, OJ-22-2006, C-74-2007, C-93-2007).
In that capacity, it may not be exchanged, assigned, conveyed in any manner, transferred, or leased (Ley 7575, Articles 13, 14 and 15): “VIII.- IDA states that the Court failed to consider that it was MINAET that transferred the lands to it in the year 2000, and that this situation led it to understand that those lands did not fall within the categories established by the Ley Forestal as comprising the State Natural Heritage... Having been established in these proceedings that most of the property at issue in this case is covered by forest, it follows that the very regulations invalidated as unconstitutional precluded the transfer of the land to IDA. Similarly, section 14 of the Ley Forestal provides that the forestlands and forests constituting the State Natural Heritage ‘…shall be immune from attachment and inalienable; their possession by private parties shall create no right in their favor, and the State’s action for recovery (acción reivindicatoria) of these lands shall not be subject to limitation.
Consequently, they may not be registered in the Public Registry through possessory information proceedings (información posesoria), and both their invasion and occupation shall be punished in accordance with this law.’ Notwithstanding the grounds asserted by IDA—namely, that MINAET transferred the lands to it, which it claims led it into error—that circumstance does not relieve it of its obligation to conform its conduct to the legal framework in force; the alleged error is therefore without merit. Likewise, the assertion that the Court failed to consider that the land had been possessed by private parties does not constitute a claim that may be entertained by this Chamber, because the Ley Forestal clearly provides that these are inalienable assets whose possession by private parties creates no right in their favor, and that the State’s action for recovery is not subject to limitation.” (Sala Primera, No. 1070-2010).
On this issue, the Tribunal Contencioso Administrativo held in decision 38-2010-VI: [citation included]. Furthermore, survey plans (planos) do not confer ownership or possessory rights (Código Civil, Article 301; Decreto 34331, Article 57, paragraph 3°; Sala Primera Civil, judgments of 2:30 pm. of 23 de octubre de 1936, N°40 of 14:20 hrs. of 9 de enero de 1960, N°95 of 9:10 hrs of 6 de abril 1979; Sala de Casación, judgments of 16:30 hrs. of 20 de mayo de 1938, recital 2; 15:10 hrs. of 24 de mayo de 1944, recital XII; N° 69 of 14:30 hrs. of 10 de agosto de 1960; N°31 of 15:30 hrs. of 8 de mayo de 1981; Sala Primera, judgments 6-90, 230-90, 241-90, 243-90, 123-92, 126-92, 171-92, 56-1994, 66-1994, 33-1995), still less to the detriment of the public domain. Nor do sworn statements establish possession (Sala Primera, decisions 216-2008 and 808-2012). In this matter, according to the inspection of 7 de mayo de 2019 conducted by INDER officials (court case file, image 174), the disputed property contains one burned hectare and small, untended palm plants; no persons are present; and, most importantly, the remainder of the area is forest, a condition also recorded in plan P-1128424-2007 (court case file, images 46, 126, 186).
INDER-GG-DRT-FT-IRT-0197-2020 of 25 de febrero de 2020 further states that the land lies within Reserva Forestal Golfo Dulce and Asentamiento Osa (court case file, images 129-130). Likewise, official letters DSA-OF-0020-2020 and DSA-OF-002-2020, of 4 y 5 de marzo de 2020, respectively, establish that the plaintiff has not been a beneficiary of Pago de Servicios Ambientales (court case file, images 192-194). 3. It is admitted only that Reserva Forestal Golfo Dulce was established on 28 de abril de 1978. The party’s allegations are denied. There is no evidence that acquisitive prescription (usucapión) had vested before the Reservas Nacionales were dedicated to the public domain (Article 8 of the Ley de Tierras y Colonización, No. 2825 of 14 de octubre de 1961; Sala Primera, judgments 51-1995 and 59-1999). 4.- I have no knowledge of this. It is denied. In opinion C-321-2003 of 9 de octubre del 2003, we stated that the titling of State Natural Heritage lands was impermissible: “(…) The State Natural Heritage includes, among other lands, the forests and forestlands of the national reserves, as well as properties registered in the name of the State and those belonging to autonomous institutions, except where they secure credit transactions with the Sistema Bancario Nacional and thereby enter its assets.
By virtue of their essential legal attributes of inalienability, immunity from attachment, and the absence of limitation periods for actions for recovery, such assets are, by operation of law, immediately dedicated to the State’s public domain, without any supplementary act conferring that status. (…) Even if IDA had acquired the lands under earlier legislation for multiple-title programs, if it disposed of them under Ley 7599, it was required to comply with all provisions governing its conduct when issuing the titles. Likewise, the Ley de Uso, Manejo y Conservación de Suelos, Articles 27 and 64, and its Reglamento, Article 63, in fine, prevent IDA from acquiring, awarding, or granting title to lands that, according to the soil study, are not classified as suitable for agricultural purposes.” Likewise, opinion OJ-129-2002 of 12 de setiembre del 2002, addressed to IDA and MINAE, stated that State Natural Heritage lands in Reserva Forestal Golfo Dulce could not be conveyed: “1) Under the legal framework in force on the date of agreement No. 11 from session No. Placa13265, which ordered that parcel … be awarded to Mr. …, the property described in cadastral plan number P-488147-98 formed part of the State Natural Heritage, having entered it automatically because it belonged to an autonomous institution and lay within the boundaries of Reserva Forestal Golfo Dulce (Sala Constitucional, Decision No. 1763 at 16 hours, 45 minutes on 13 de abril de 1994, and Procuraduría General de la República, Opinion C-049-98 of 20 de marzo de 1998), in addition to its forest cover (cobertura boscosa) (Article 13 of the Ley Forestal).
Consequently, upon its incorporation into the State Natural Heritage, it became a public-domain asset and, as such, became inalienable and not subject to prescription; the Instituto de Desarrollo Agrario was therefore legally barred from conveying it (section 14 of the Ley Forestal), and the aforementioned agreement must accordingly be annulled.” Indeed, the titling, segregation (segregación), parceling (parcelación), or conveyance of lands from property 39334-000 of the Puntarenas Registry District located within Reserva Forestal Golfo Dulce is impermissible. See constitutional decisions 2988-1999, 8560-2001, 2063-2007, clarified by 4517-2007, and 8098-2007, the last of which stated: “The petitioners essentially seek to have this Court analyze and determine whether a land-titling process in the Golfo Dulce protected area is permissible, because they believe they hold that right and that the respondents have refused to recognize it.
First, the petitioners should be advised that, as shown by the initial petition itself and by the Decrees cited therein, the designation of the protected area or Reserva Forestal Golfo Dulce, encompassing eighty percent of the property in question, dates from April nineteen seventy-eight, while the expropriation of those lands from Osa Productos Forestales occurred in May nineteen seventy-nine. This means that the lands they inhabit were declared a Forest Reserve before being distributed among the petitioners, and therefore neither ITCO nor, subsequently, IDA could grant title to them… Under such circumstances, it is materially impossible for the respondents to grant title to lands within forest reserves because doing so would be unconstitutional, as held by this Court…” This criterion was reiterated by the Sala Constitucional in decision 8075-2008: “IV.- The specific case. The granting of property titles for properties subject to Reserva Forestal Golfo Dulce.
The petitioner states that, although he has occupied a parcel belonging to the Instituto de Desarrollo Agrario in Sierpe de Osa for twenty-six years, that public institution has failed to grant title to the properties, to his detriment and that of a large number of occupants. Some deeds had previously been granted, and it is therefore inconsistent for the administration to continue delaying the titling process. Based on the report submitted under oath and the evidence in the record, the Chamber finds it established that the parcel occupied by the protected party lies within the so-called Asentamiento Osa, which is situated within the properties that the State once expropriated from Osa Productos Forestales S.A. and that were subsequently made subject to a special protection regime upon the establishment of Reserva Forestal Golfo Dulce. As the respondent authority notes, the Instituto de Tierras y Colonización—later the Instituto de Desarrollo Agrario—began progressively granting title to the properties at the relevant time, but because of the significance of the lands’ designation as part of that forest reserve, it was compelled to suspend titling because it is legally barred and unable to carry it out.
As a public institution, it must adhere to the principle of legality (principio de legalidad), and in the present case clear provisions require that properties such as the one occupied by the petitioner be inalienable. In accordance with the cited case law, the Chamber notes that the administration is indeed absolutely barred from continuing the process of granting title to lands encompassed within Reserva Forestal Golfo Dulce—unless a technically supported future legislative amendment were to remove the protected designation—and therefore this is not an arbitrary or unlawful act by the administration, but rather conduct justifiably supported by a broad body of rules—international, constitutional, statutory, and executive-decree provisions—.” 5. This is unrelated to my submission. It is denied in accordance with the responses to facts 1, 2, 3 and 4. 6. The response to the preceding fact is incorporated herein.
Evidence: The record and portions of the case file identified in this submission. Based on the foregoing factual and legal grounds, and because the disputed land forms part of the State Natural Heritage, I request that INDER’s affirmative defense of lack of legal entitlement (excepción de falta de derecho) be sustained and that the complaint be dismissed in its entirety” (images 243 to 247 of the court case file).
The following facts relevant to the resolution of this matter are deemed established:

Accordingly, the proposal by Fondo de Biodiversidad Sostenible (FBS) set forth in FBS-OF-135-2018 lies outside our institutional authority and is also contrary to the Institute’s interests, insofar as its approval would entail implicit recognition of possessory rights in favor of the persons listed in ‘Anexo 1: Possessors Applying for Admission to Programa de Conservación de la Biodiversidad.’ Therefore, this Asesoría recommends rejecting the proposal by Fondo de Biodiversidad Sostenible and referring the matter to the competent entity, which is ultimately responsible for granting the appropriate authorization under the legal framework currently governing these lands, which, due to their special nature, belong to the Costa Rican State...” (images 140 to 141 of the judicial case file).
However, during an inspection conducted by this office on 07 de mayo de 2019 of the aforementioned parcel, it was determined that Mr. Nombre81933 does not reside on the parcel because he does not live in the area. Parcel 48 of Asentamiento Osa, Sector El Progreso forms part of the real-property folio, Property Registration Number Placa13266, owned by the Instituto de Desarrollo Rural, and is entirely affected by the Reserva Forestal Golfo Dulce, created by Decreto Ejecutivo 8494-A of 26 de abril de 1978, published in Supplement Number 92 of La Gaceta Number 104 of 01 de junio de 1978. Because the aforementioned parcel is affected by the Reserva Forestal Golfo Dulce, it automatically constitutes State Natural Heritage (Patrimonio Natural del Estado), as established in Articles 13, 14, and 15 of the Ley Forestal, Number 7575 of 5 de febrero del año 1996. Published in La Gaceta N°72 of 16 de abril del año 1996.
Supplement: 21. Article 13.—Establishment and administration. State Natural Heritage shall consist of the forests and forest lands (terrenos forestales) of national reserves, areas declared inalienable, properties registered in the State’s name, and properties belonging to municipalities, autonomous institutions, and other Public Administration bodies, except for real property securing credit transactions with the Sistema Bancario Nacional that becomes part of its assets. The Ministerio del Ambiente y Energía shall administer the heritage. When appropriate, acting through the Procuraduría General de la República, it shall register the land in the Registro Público de la Propiedad as individually identified properties owned by the State. Non-governmental organizations that acquire real property containing forest or suitable for forestry (aptitud forestal), using funds from donations or the public treasury obtained on behalf of the State, shall transfer such property into the State’s name.
Article 14.—Non-attachable and inalienable status of State Natural Heritage. The forest lands and forests constituting State Natural Heritage, as specified in the preceding article, shall be exempt from attachment and inalienable; possession thereof by private persons shall create no rights in their favor, and the State’s action for recovery of such lands (acción reivindicatoria) shall not be subject to limitation. Consequently, they may not be registered in the Registro Público through possessory information proceedings (información posesoria), and both their invasion and occupation shall be punished in accordance with this law. Article 15.—Restrictions. Public Administration bodies may not exchange, assign, alienate in any manner, surrender, or lease rural land owned or administered by them unless it has first been classified by the Ministerio del Ambiente y Energía. If it is covered by forest, it shall automatically be incorporated into State Natural Heritage, and a restriction shall be established and recorded in the Registro Público. 4—With respect to State Natural Heritage under the control of Inder, the Contraloría General de la República, in its report No. DFOE ED 7-2007 dated 15 de marzo del 2007 regarding compliance with and the continuing validity of the functions assigned to the Institute, Section 2.3.3, subsections a) and b), made certain observations and warnings to the Institution; accordingly, Part 2.3.3, subsections a) and b), of the aforementioned report is attached to this report for analysis. ‘2.3.3.
FAILURES TO COMPLY WITH THE OBLIGATIONS OF THE LEY FORESTAL. a) Resistance to transferring “State Natural Heritage” to MINAE. The Ley de Tierras y Colonización placed under State ownership what it called the “State’s agricultural property” and assigned its administration to the Instituto de Desarrollo Agrario. That property includes what are now known as protected wilderness areas (áreas silvestres protegidas), springs (nacientes), and protection areas (áreas de protección) for rivers and streams, among others. With the enactment of the first Ley Forestal and other special laws such as the Ley sobre la Zona Marítimo Terrestre, areas included within the “State’s agricultural property” were declared inalienable and not subject to acquisition, were designated “State Forest Heritage” (patrimonio forestal del Estado), and their administration was gradually transferred to other institutions. In 1996, the current Ley Forestal was enacted, changing the name of such areas to “State Natural Heritage” and providing that it consists “of the forests and forest lands of national reserves, areas declared inalienable, properties registered in the State’s name, and properties belonging to municipalities, autonomous institutions, and other Public Administration bodies, except for real property securing credit transactions with the Sistema Bancario Nacional that becomes part of its assets.
The Ministerio del Ambiente y Energía shall administer the heritage.” Pursuant to Article 32 of the Ley Orgánica del Ambiente and Articles 2 and 13 of the Ley Forestal, the “State Natural Heritage” under the control of IDA should have been transferred and registered in the name of MINAE. However, as of the date of this study, the Institute’s Área de Topografía reported 65 settlements that include part or all of a protected wilderness area declared as such by law or executive decree, indicating that, except for the lands of the Reserva Biológica Lomas de Barbudal and the Bosque Nacional Diriá, the remaining areas have not been surveyed and entered in the cadastre (catastradas). The refusal of the IDA authorities to transfer these areas to MINAE has been repeated, given that since 1990, when this Contraloría, pursuant to the legal framework, directed the Institute through report N°79/90 to identify properties subject to development restrictions because protected wilderness areas were located within them and to proceed in accordance with the results, no transfer has occurred.
Such identification, accompanied by a legal study duly coordinated with the competent external bodies (e.g., MINAE, Procuraduría General de la República), is urgent so that this situation may be brought into compliance with the law as soon as possible, particularly because it may ultimately affect property owners and the public treasury. This is because, of the 65 settlements reported, 47 were acquired as part of a settlement before the protected wilderness area was declared, and 18 were acquired after the wilderness area was created. For all the foregoing reasons, this office refrains from recommending Pago de Servicios Ambientales for Parcel Number 48 of Asentamiento Osa, Sector El Progreso, as requested by Mr. Nombre81933 through official letter SN-047-2019 dated 16 de junio de 2019, because it is land entirely affected by the Reserva Forestal Golfo Dulce and constitutes State Natural Heritage. Accordingly, the decision made by this office is intended to prevent economic harm to State assets’” (images 13 to 16 of the judicial case file).
Under that rationale, the Administration is barred from issuing documents that could recognize or create rights over assets that, because of their public-domain status (demanialidad), are not susceptible to appropriation; if it were to do so, such documents would be completely null and void (...).” The official letter cited Article 9 of Ley 8640 and, based on the statutory text, stated: “Subsection b refers to the procedure that Inder must carry out, which consists solely of issuing a certificate stating whether the persons are census-registered possessors, declared beneficiaries, or allottees. It is not responsible for authorizing the Pago de Servicios Ambientales, as the official letter erroneously states. Under the cited Law, the legal obligation to issue the authorization falls directly upon FONAFIFO, as demonstrated in subsection e) of the aforementioned article, ...” The Reglamento de la Ley Forestal (N°25721, Articles 39 and 55, subsection b) was also analyzed, as was section 22 of the Ley Forestal.
“(...) The official letter concludes: ‘By reason of the principle of administrative caution (principio de precaución administrativa), the precautionary principle (principio precautorio), and legal certainty (seguridad jurídica), in view of the judgment rendered, the public purpose served by those lands, and the fact that public funds are involved, this Legal Advisory Office agrees with the Administration’s decision—which, as we have stated, has not been officially communicated to us—to cease issuing this type of document endorsing before FONAFIFO a legal situation contrary to the foregoing until the appeal in cassation (recurso de casación) filed against that judicial ruling has been decided and the decision has become final’” (images 144 to 154 of the judicial case file).
The following facts relevant to the resolution of this matter are deemed unproven:
With the enactment of Ley N°8640 of 05 de junio de 2008, the Legislative Assembly decreed the “Approval of Loan Agreement N°7388-CR and its annexes between the Republic of Costa Rica and the International Bank for Reconstruction and Development (IBRD),” intended to finance environmental management projects. The project’s objective was to foster the conservation of biodiversity—of global importance—and ensure its long-term sustainability by supporting the development and implementation of market-based instruments and promoting forest conservation in buffer zones of protected areas through the Pago de Servicios Ambientales (PSA) Program [see text of the Law, Anexo 1]. Regarding the implementation and payment of environmental services, Article 9 stated: “Nombre28548 is hereby authorized to pay for environmental services under the forest-protection modality to forest possessors in the priority areas established by Sinac.
Possession (posesión) must be continuous, public, and peaceful. A possessor of real property who is granted payment for environmental services under the terms of this article must demonstrate ten years of possession of the property prior to the effective date of this Law. For these purposes, the possessor must establish protection of the forest resource in a manner constituting ecological possession (posesión ecológica). Additionally, to establish possession, the possessor must meet the following requirements: 1) Submit a certified copy of the cadastral survey plan (plano catastrado) of the property under possession or a plan prepared by the Instituto de Desarrollo Agrario (IDA). Without exception, all cadastral survey plans submitted must be certified by Minae through Sinac, which shall attest whether the property is located inside or outside protected wildlife areas (áreas silvestres protegidas). b) A deed of sale notarized before a notary public, bearing the certified date on which the property was acquired, if that was the method of acquisition, or proof that the possessors were registered in the IDA census and declared beneficiaries and awardees.
If the possessor is the original possessor or lacks transfer documents executed with the required formalities, the possessor must submit affidavits from three witnesses documenting in detail the origin and activities of the possession exercised. These affidavits must be recorded in a public instrument (escritura pública). The possessor may also submit any other document concerning judicial proceedings or proceedings before public institutions that clearly demonstrates possession of the land. c) An affidavit before a notary public by the applicant possessor containing: a description of the nature of the property; its location by province, district, canton, hamlet, or local settlement; the full names of all current adjoining landowners; the cadastral survey plan number; area; duration of possession; method of acquisition; and a description of the possessory acts (actos posesorios). d) An affidavit, authenticated by an attorney, from at least three adjoining landowners, stating that they are aware of the applicant’s possession as an adjoining landowner and have no conflict or dispute regarding that boundary or its boundary markers, fences, or similar features.
Where the boundary is natural or consists of a public road, no affidavit is required. Where the adjoining party is a public entity, an official letter from the appropriate authority stating the matters specified in this article shall suffice. If the property adjoins a protected area, only a letter issued by the director of the respective conservation area may be submitted. e) The State, through Nombre28548 and in all cases by the mechanisms it determines, must inspect the property where possession is exercised” (Ley N°8640 consulted at www.fonafifo.go.cr on 7 de diciembre de 2021, and Ley N°8058 of 08 de enero de 2001 and ). Through DE Nº30761-MINAE, of 23 de agosto de 2002, considering that the Ley de Biodiversidad “promotes Incentive Plans, including payment for environmental services benefiting activities or programs carried out by national natural or legal persons that contribute to achieving the objectives of this body of law; likewise, payment for environmental services may be made to possessors in designated strategic areas.
However, achievement of the objectives of the Pago de Servicios Ambientales program has thus far been limited solely to the inclusion of land recorded in the property registry, without genuine participation by natural persons who possess land”; a new article was added to the Regulations to the Ley Forestal, Decreto Ejecutivo number 25721-MINAE of 17 de octubre de 1996, to read: “Article 107. Forest-conservation projects on land held under a right of possession (derecho de posesión) may be covered by the Pago de Servicios Ambientales program under the protection modality. To qualify for the Pago de Servicios Ambientales program, legally accredited possessors must meet the following requirements: a) Submit a duly certified cadastral survey plan of the property or a plan prepared by the Instituto de Desarrollo Agrario-IDA. b) A Deed of Sale Notarized before a Notary Public, bearing a certified date of acquisition of the property, if that was the method of acquisition, or proof that the possessors were registered in the Instituto de Desarrollo Agrario census and declared beneficiaries and awardees.
If the possessor is the original possessor or lacks transfer documents executed with the required formalities, the possessor must submit affidavits from three witnesses documenting in detail the origin and activities of the possession exercised. These affidavits must be set forth in a public instrument. The possessor may also submit any other document concerning judicial proceedings or proceedings before public institutions that clearly demonstrates possession of the land. c) An affidavit before a notary public by the applicant possessor containing: a description of the nature of the property; its location by province, district, canton, hamlet, or local settlement; the full names of all current adjoining landowners; the cadastral survey plan number; area; duration of possession; method of acquisition; and a description of the possessory acts. d) An affidavit in a public instrument from all adjoining landowners, stating that they are aware of the applicant’s possession as an adjoining landowner and that they have no conflict or dispute regarding that boundary or its boundary markers, fences, or similar features.
Where the boundary is natural or consists of a public road, no affidavit is required. Where the adjoining party is a public entity, an official letter from the appropriate authority stating the matters specified in this article shall suffice. If the property adjoins a protected area, only a letter issued by the Director of the respective Conservation Area may be submitted. e) The State, through the Fondo Nacional de Financiamiento Forestal (FONAFIFO), must in all cases, using the mechanisms it determines, inspect the property where possession is exercised. For farms located within declared protected wildlife areas, a letter of no objection from the Director of the respective Conservation Area must be submitted. Once the foregoing requirements have been met, FONAFIFO shall publish a notice in the Diario Oficial La Gaceta for two consecutive days, granting a period of 10 business days for objections to be heard; if no objection is filed, or if those filed are rejected, the corresponding contract shall be signed.
If the objecting party’s arguments demonstrate a dispute over the property, the case file shall be immediately closed, and the parties must resort to the appropriate judicial proceedings. FONAFIFO may publish consolidated notices at least once a month. The Fondo Nacional de Financiamiento Forestal has a duty to maintain an updated registry of Pago de Servicios Ambientales projects approved under the possession modality, containing the information necessary to identify them and supported by a geographic information system” (consulted at www.pgr.go.cr on martes 07 de diciembre de 2021). Subsequent executive decrees regulated the payment per area and the price in dollars or colones, as well as the procedure to be followed by persons interested in entering the Pago de Servicios Ambientales Program (see DE N°351459-MINAET, Gaceta N°80 of 27 de abril de 2009; DE N°36353-MINAET of 20 de enero de 2011 (which established the procedure); DE N°36516-MINAET, Gaceta N°79 of 26 de abril de 2011; DE N°37660-MINAET, Gaceta N°27 of 23 de abril de 2013; DE N°38323-MINAET, Gaceta N°72 of 14 de abril de 2014, among others / consulted at Dirección8837).
Having described the legal framework, a brief reference must be made to the situation of the parcel holders (parceleros) of Asentamiento Osa, as explained in official letter DAJ-295-2012 of 21 de junio de 2012, which is a study and recommendation submitted to the Institution’s Board of Directors by the Legal Directorate of the then IDA—now INDER. In general terms and for purposes of this decision, it is relevant to note that Asentamiento Campesino Osa was affected by the creation of Reserva Forestal Golfo Dulce, with the State transferring those properties to the former ITCO, an institution that was aware of the occupancy of the expropriated farms, the purpose being to transfer the land pursuant to Ley de Tierras y Colonización N°2825. Several transfers were made until, in 1994, by judgment of the Constitutional Chamber N°1763 at 16:45 hours on 13 de mayo de 1994, the award procedures (procedimientos de adjudicaciones) in Asentamiento Campesino Osa and Asentamiento Los Planes de Drake in Sierpe de Osa were suspended.
Moreover, the payment for environmental services through Nombre28548 was promoted in DE N°30761-MINAE, Gaceta N°191 of 4 de octubre de 2002; see images 132 to 136 of the judicial case file. The information in the record shows that INDER issued certificates to applicants for payment for environmental services stating whether they were possessors registered in the Institution’s census or had been declared beneficiaries or awardees (see images 145 to 154). With the regulatory basis for the payment for Environmental Services that gave rise to the claim filed by the plaintiff now established, this Chamber shall proceed to review the relief sought.
Mr. Nombre81933 stated in the complaint that he has been the “owner” of an unregistered possessory right (derecho de posesión) over mountain land and brushland (tacotales) for more than 60 years, located in Junta Quebrada, third district of Sierpe, measuring 96 ha 5891.76 m2, where he has planted fruit trees and protected the forest and water. According to the first and second proven facts, the property described by the plaintiff is located within Reserva Forestal Golfo Dulce, created by Decreto N°8494 of 1 de junio de 1978, which, according to Article 2°, comprises an area of 84 538 Ha I 875 m2; the lands within that boundary are declared inalienable (Article 3 of the Decreto). Currently, one of the properties comprising it is registered in the name of Instituto de Desarrollo Rural (INDER) under registration Placa78 “Asentamiento Osa” (consultation of www.pgr.co.gr on martes 7 de diciembre de 2021).
By filing this complaint, the plaintiff seeks the following (filing of 19 de diciembre de 2019): “1)- That judgment be entered granting this complaint in all of its (sic) respects. 2)- that (sic) my client has standing to file this complaint, since he is duly recognized by INDER AS A PARCEL HOLDER. That the possession exercised has always been undisturbed (sic), public, peaceful, and to the exclusion of any other person. 3)- That the judgment instruct the BOARD OF DIRECTORS OF INDER to grant my client the proper authorization to QUALIFY THE PROPERTY FOR INCENTIVES FROM THE SUSTAINABLE DIVERSITY FUND (FBS). 4)- That the attached documents demonstrate that in the past my client had (sic) the proper authorization from the board of directors of INDER, as did other parcel holders, so that their lands, which are held under a possessory right and are not titled by deed, may, with authorization from the board of directors of INDER, qualify for incentives under the SUSTAINABLE DIVERSITY FUND (FBS) program.
Today, the requirement for applying for and receiving that incentive for five years from the SUSTAINABLE DIVERSITY FUND (FBS) IS TO HAVE THE APPROVAL AND AUTHORIZATION OF INDER. 5) that (sic) the judgment confirm that the attached documentation demonstrates that in other years my client had (sic), like other parcel holders, the proper authorization to qualify the property for incentives through the Board of Directors of INDER.” (images 40 to 45 and 55 to 57 of the court file). From the relief requested in the complaint, whose wording, it must be noted, is confusing, it may be inferred that it seeks affirmative conduct by INDER that would allow the plaintiff to pursue payment for environmental services (pago por servicios ambientales) before the respective administrative authorities (FONAFIFO). There is no claim for annulment or review of administrative conduct; this panel understands that the relief sought corresponds to that set forth in section 42(g) of the CPCA: “That the Administration be ordered to perform any specific administrative conduct required by the legal system.” To that end, each claim will be reviewed individually, as set forth below.
Let us examine them: “1)- That judgment be entered granting this complaint in all of its (sic) respects.” This is not technically a claim for relief, and no ruling is made on it because it is ineffectual. The second claim: “2)- that (sic) my client has standing to file this complaint, since he is duly recognized by INDER AS A PARCEL HOLDER. That the possession exercised has always been undisturbed (sic), public, peaceful, and to the exclusion of any other person.” The plaintiff seeks a declaration that he is a parcel holder (parcelero); he asserted in the complaint that he has been the owner of an unregistered possessory right for more than sixty years, which he has maintained publicly, peacefully, and continuously, and that he has carried out clearing work, planted fruit trees, and cared for the forest and water. He describes the property under survey plan number P-uno uno dos ocho cuatro-dos mil siete, measuring ninety-six hectares, five thousand eight hundred ninety-one square meters and seventy-six square decimeters, located at “Dirección8838 , , Osa in the Province of Puntarenas, with current boundaries as follows: North: Nombre81936 , Ganadera Guayacán de Ceibo Sociedad Anónima and Dirección336 , South: Nombre81937, with a stream in between.
East: Nombre81938 and Dirección336 West: Nombre81939 .” Although the plaintiff neither states nor expressly identifies it, based on the information provided by INDER (first and second proven facts), the plaintiff appears—according to the defendant institution’s records—as the occupant of parcel N°28 of Asentamiento Osa, Sector El Progreso, which forms part of the property recorded in the Real Property Folio under registration Placa13266, owned by Instituto de Desarrollo Rural. That property is affected in its entirety by Reserva Forestal Golfo Dulce, created by Decreto Ejecutivo 8494-A of 28 de abril de 1978, published in Supplement number 92 of La Gaceta Number 104 of 01 de junio de 1978; this makes it part of the State Natural Heritage (Patrimonio Natural del Estado), as established in Articles 13, 14 and 15 of Ley Forestal, N°7575. Certification INDER-GG-DRT-FT-IRT-0197-2020, issued by Área de Información de Registro de Tierras, stated: “the cartographic location shown on registered survey plan P-un millón ciento veintiocho mil cuatrocientos veinte cuatro - dos mil siete, located in distrito Sierpe, cantón Osa, provincia Puntarenas, which (sic) describes a property that OVERLAPS with Asentamiento Osa Productos Forestales, administered by INDER, and Reserva Forestal Golfo Dulce, according to the attached overlay; the foregoing insofar as the parcel is correctly located by the responsible professional” (images 126 to 130 of the court file).
This information appears in the administrative file maintained by Oficina de Desarrollo Territorial de Osa concerning Asentamiento Osa, Sector El Progreso de Drake, and has neither been rebutted nor denied by the plaintiff. Sala Constitucional has defined public-domain properties (inmuebles de naturaleza demanial) as “...those having a nature and legal regime different from private property—which is governed by property law under the terms of Article 45 of Constitución Política—inasmuch as, by the legislature’s express intent, they are dedicated to the special purpose of serving the community, that is, the public interest, and therefore cannot be privately owned, such that they are outside the stream of commerce and thus cannot belong individually to private persons, or to the State in the strict sense, since the latter is limited to their administration and protection. […] Accordingly, these are assets to which the State holds title in its capacity as administrator; they must be understood as assets belonging (sic) to the ‘Nation’ and therefore forming part of the public patrimony; and, because of their special legal nature, they possess the following attributes: they are not subject to acquisitive prescription (imprescriptibles), which means that ownership of them, or even mere possession, cannot be acquired through the passage of time; that is, they cannot be acquired through adverse possession (usucapión), nor can they be lost by prescription.
For this reason, the use permits granted over them by the Administration are always precarious in nature, meaning that they may be revoked by the Administration at any time for reasons of expediency or convenience—under the terms provided in Articles 154 and 155 of Ley General de la Administración Pública—and concessions granted over them for their use may likewise be canceled through the applicable proceeding; they are not subject to attachment (inembargables), meaning that they cannot be subject to any lien or attachment, whether by private parties or by the Administration; and they are inalienable, meaning that they are outside the stream of commerce and therefore cannot be transferred, sold, or acquired, either gratuitously or for consideration, by private parties or by the State; thus, they are excluded from commerce among persons and are subject to a special and enhanced legal regime.
Furthermore, their use and exploitation are subject to the police power, since, as assets that cannot be possessed, much less owned, their use and exploitation are possible only through duly authorized acts, whether by concession or use permit, granted by the competent authority, and are subject to ongoing oversight by the Public Administration. They therefore comprise real property having a nature and legal regime virtually opposite to private property, as follows from Article 45 of the Constitution” (voto 2007-2408 at 16 horas 13 minutos on 21 de febrero de 2007, emphasis added). The property described in proven fact N°1 is an asset owned by INDER that belongs to Reserva Forestal Golfo Dulce and is protected under the special protective regime governing public-domain assets (bienes demaniales); neither the plaintiff nor any other person may claim title, lawful possession, or a superior right over it.
Because the land is public-domain property (bien de dominio público), any dispute concerning possession or occupancy is legally improper and constitutes an inadmissible claim, since the plaintiff lacks standing to assert a right over that land, as explained in the cited case law. With respect to the following claim for relief: “3)- That the judgment instruct the BOARD OF DIRECTORS OF INDER to grant my client the proper authorization to QUALIFY THE PROPERTY FOR INCENTIVES FROM THE SUSTAINABLE DIVERSITY FUND (FBS).” In this regard, it must be noted that the affirmative conduct sought by the plaintiff must be required of the defendant Administration by the legal system, and its imposition must fall within the bounds of legality. In 2019, the plaintiff submitted to INDER a: “...request FOR THE FIRST TIME FOR SUCH AUTHORIZATION TO ENTER THE SUSTAINABLE BIODIVERSITY FUND (FBS) OF THE BIODIVERSITY CONSERVATION PROGRAM (PBC)...”.
In response to that request, officials from INDER’s Oficina Territorial de Osa conducted an inspection visit to parcel N°28 on 07 de mayo de 2019, which showed that Mr. Nombre81933 does not reside on the parcel because he does not live in the area. In addition, it was determined that the land is affected in its entirety by Reserva Forestal Golfo Dulce and constitutes State Natural Heritage, grounds supporting the recommendation against payment for environmental services (see proven fact N°6). Likewise, as stated in proven fact N°8, another visit to parcel N°28 was conducted on 09 de agosto de 2019. On that occasion, INDER officials confirmed that no one lives there; that approximately one hectare had been cleared and apparently burned, with natural grass already growing back; that they observed the remains of what had been a burned wooden dwelling, six oil-palm plants, one mature mango tree, several square-banana plants, growing cassava plants, and a fence in poor condition on the upper portion. The remainder of the land is covered by secondary forest (bosque secundario).
In this regard, it is necessary to note that the plaintiff does not deny this situation; rather, in the closing-arguments brief, the plaintiff stated that another person has maintained the property and its forests and conserved its flora and fauna over the last two years. The plaintiff therefore denies that the land has been abandoned and requested that the Court conduct a site inspection; that request is inadmissible at this stage of the proceedings, but it demonstrates the plaintiff’s lack of interest in proving that, as the occupant of parcel N°28, the plaintiff does in fact live there. The plaintiff thereby failed to comply with the duty imposed by article 41.1 of the Código Procesal Civil: “The burden of proof rests upon: 1. Whoever asserts a claim, with respect to the facts establishing that party’s right.” The claimant failed to attempt to rebut the factual circumstances of the property and the plaintiff’s absence from the parcel, as certified by INDER officials, who expressly state that the plaintiff does not live on parcel N°28, for which the plaintiff seeks the Pago de Servicios Ambientales incentive, and that the parcel is not receiving the necessary attention and care.
The plaintiff does not challenge that administrative decision. Instead, the plaintiff seeks to have the Court instruct the INDER Board of Directors to grant what the plaintiff calls authorization, which, as indicated, is a certification of the plaintiff’s status as an occupant, beneficiary, or awardee that would allow the plaintiff to satisfy another series of requirements before Nombre28548 in order to apply for the Pago por Servicios Ambientales incentive. The relief sought is inadmissible. The relief that this Court may impose upon an administrative authority is contingent upon its being provided for under the legal system. The plaintiff submitted an application to INDER, which was denied; however, the plaintiff did not challenge the legality of that administrative act (acto administrativo), and it is therefore valid and effective. Through the requested relief, the plaintiff seeks to have the Court substitute itself for the administrative authority, which cannot be entertained.
As a corollary of the foregoing, claim three is manifestly contrary to the jurisdiction of this Court; the requested relief is therefore inadmissible, and the Court so declares. Because requests for relief 4 and 5 are virtually identical, they are reviewed jointly: “4)- That the attached documents demonstrate that, in the past, my client had (sic) the proper authorization from the INDER Board of Directors, as did other parcel holders whose lands constitute a possessory right and are not titled, and that, with authorization from the INDER Board of Directors, they may receive incentives under the FONDO DE DIVERSIDAD SOSTENIBLE (FBS) program. Today, its authority is a requirement for applying for and receiving that incentive for five years from the FONDO DE DIVERSIDAD SOSTENIBLE (FBS), NAMELY, HAVING INDER’S APPROVAL AND AUTHORIZATION. 5) that (sic) the judgment confirm that the attached documentation demonstrates that in prior years my client had (sic), like other parcel holders, the proper authorization to obtain incentives for the property through the INDER Board of Directors.” The plaintiff alleged in the complaint that, in the past, the plaintiff was authorized by IDA to receive the benefit of the payment for environmental services (pago por servicios ambientales).
The administrative record submitted by INDER shows that, through official letter OSO-423-2013 of 11 de setiembre de 2013 (proven fact N°3), the Board of Directors’ resolution, Article 78 of Ordinary Session 015-2013, held on 29 de abril de 2013, authorized the possessors applying for admission to Pago de Servicios Ambientales, located in Reserva Forestal Osa, to enroll their properties in the 2013 environmental-services program, including the plaintiff. Nevertheless, the plaintiff did not prove—once again failing to comply with the obligation imposed by numeral 41.1 of the Código Procesal Civil—that the plaintiff received any payment. It must be considered that, pursuant to article 9 of Ley N°8640 of 05 de junio de 2008, “Aprobación del Contrato de Préstamo N°7388-CR y sus anexos entre la República de Costa Rica y el Banco Internacional de Reconstrucción y Fomento (BIRF),” Nombre28548 was authorized to pay for environmental services under the forest-protection category to possessors of forests in the priority areas established by Sinac, and that DE Nº30761-MINAE, of 23 de agosto de 2002, added article 107 to the Reglamento a la Ley Forestal, Decreto Ejecutivo número 25721-MINAE of 17 de octubre de 1996, which defined the requirements to be submitted by persons applying to the Pago de Servicio Ambientales program, particularly subsection “b) Deed of Sale Executed Before a Notary Public, bearing a date certain for the acquisition of the property, if that was the method of acquisition, or possessors registered in the census by the Instituto de Desarrollo Agrario and declared beneficiaries and awardees.” Therefore, the actual payment of that incentive cannot be verified as the plaintiff claims, beyond the plaintiff’s assertion, which is respected but, it bears repeating, lacks factual substantiation.
If INDER issued the certification in the past, that is no reason why it must issue it again in response to the application submitted in 2019, regarding which the plaintiff stated: “...to request SUCH AUTHORIZATION FOR THE FIRST TIME IN ORDER TO ENROLL IN THE FONDO DE BIODIVERSIDAD SOSTENIBLE (FBS) OF THE PROGRAMA DE CONSERVACIÓN DE LA BIODIVERSIDAD (PBC)...” (proven fact N°7). Pursuant to Ley N°8640 and DE N°25721-MINAE of 17 de octubre de 1996, INDER must certify the status as occupant, awardee, or beneficiary of anyone who wishes to apply for the payment-for-environmental-services incentive, but this is only one of the requirements imposed by the legal system. The record does not even show that the plaintiff submitted any application to FONAFIFO, the body legally empowered to authorize payment. To the foregoing, it must be added that, in the application submitted in 2019, the plaintiff expressly stated that this was the first time the application had been submitted; as previously indicated, that application is nothing more than a certification, issued by INDER, of the applicant’s status as occupant, possessor, or beneficiary.
For the reasons stated, the relief identified as the second claim is inadmissible because the plaintiff lacks standing (legitimación activa) to assert a right over property that is part of the public domain (demanial), as verified in these proceedings (proven facts 1 and 1), and requests for relief three through five are inadmissible; accordingly, the complaint must be dismissed in its entirety.
INDER raised the defense of payment (excepción de pago), which must be rejected because the subject matter of these proceedings does not concern any payment. It alleged lack of standing to sue and be sued (falta de legitimación activa y pasiva). In light of the foregoing, this Court concludes that Mr. Nombre81933 lacks standing on the merits (legitimación ad causam) to seek recognition of a right over real property belonging to the State’s forest estate (patrimonio forestal del Estado), which is therefore public-domain property (demanial). A person has standing in the proceedings when that person may demand adjudication of the claims asserted in the complaint—that is, a determination, through a favorable or unfavorable judgment, as to whether the substantive right claimed exists. Therefore, when either party lacks such standing, the judge may not issue a decision on the merits and is precluded from doing so.
Article 10 of the Code of Contentious-Administrative Procedure (Código Procesal Contencioso Administrativo) provides: “1) The following shall have standing to bring an action: a) Those who allege impairment of legitimate interests or individual rights...” Under the foregoing provision, an action may be brought only by a person possessing an enabling legal basis (título habilitante), arising from an administrative act, rule, or contract, to support what that person asserts as a right against third parties or with respect to a particular individual legal situation. Because he lacks such a basis, as established in the record, he has no standing whatsoever; accordingly, the complaint is declared inadmissible with respect to the second claim. With respect to claims three through five, the defense of lack of a legal right (falta de derecho) raised by INDER is sustained for the reasons stated.
By express provision of Article 193 of the Code of Contentious-Administrative Procedure, the ruling on the costs of the proceedings must be made sua sponte, ordering the unsuccessful party to pay them. Costs are imposed on the losing party by virtue of having lost—that is, for losing the litigation. The plaintiff was unsuccessful; accordingly, the plaintiff must be ordered to pay both categories of costs in this action, as there are no grounds warranting exemption under subsections a) and b) of the aforementioned Article 193. The costs shall accrue interest once their amount has been determined and becomes due and payable.
POR TANTO
The defense of payment is rejected. The defense of lack of a legal right is sustained with respect to claims three through five. The defense of lack of standing to sue is sustained with respect to claim number two. Consequently, the second claim is declared inadmissible, and all other relief sought in the complaint filed by Mr. Nombre81933 against INDER is denied as unfounded. The plaintiff and unsuccessful party is ordered to pay both categories of costs, together with the corresponding interest at the statutory rate, the amounts of which shall be determined during enforcement of the judgment (ejecución de sentencia). Goicoechea, a las diez horas del quince de diciembre del dos mil veintiuno.
Proceso de conocimiento declarado de puro derecho, incoado por Nombre81933 , mayor de edad, cédula de identidad CED60946, divorciado, en unión libre, agricultor, vecino de Los Ángeles Drake, Cantón Osa provincia de Puntarenas; contra el Instituto de Desarrollo Rural (en adelante el INDER). Interviene como abogada y apoderada especial judicial de la parte accionante la Licda. Nombre81934 , según consta en poder visible en imagen 6 del expediente judicial. En representación de los intereses del INDER la Licda. Ana Gabriela Chaves Peralta (imágenes 74-75 y 258-259 del expediente judicial así como registro de audio de la audiencia preliminar). Participa como tercero interesado el Estado, representado por el señor Procurador Mauricio Castro Lizano (imágenes 240, 243 a 247 y 250 del expediente judicial). Se han observado las prescripciones legales en la substanciación del proceso y no se observan defectos u omisiones capaces de producir la nulidad de lo actuado y resuelto. A continuación, el Tribunal Colegiado al que por turno correspondió conocer de este asunto, procede a dictar la sentencia con el voto unánime de sus miembros, previa deliberación de ley.

CONSIDERANDO
1. La parte actora presentó demanda en sede agraria el 30 de setiembre de 2019 (imágenes 1 a 5 del expediente judicial).
2. Mediante auto sentencia N°262-2019 de las siente horas y veintiocho minutos del tres de octubre de dos mil diecinueve, el Juzgado Agrario del II Circuito Judicial de la Zona Sur, declaró inhibitoria en razón de la materia, resolviendo: "De conformidad con lo expuesto el suscirto (sic) juzgador se inhibe de seguir conociendo este asunto, por considerar debe ventilarse en la Jurisdicción Contenciosa Administrativa y lo remite al Tribunal Agrario para que dirima la competencia" (imágenes 26-27 del expediente judicial).
3. Mediante Voto N°893-C-19 de las dieciséis horas y treinta y seis minutos del treinta y uno de octubre de dos mil diecinueve, el Tribunal Agrario del Segundo Circuito Judicial de San José, resolvió:"Se aprueba la inhibitoria del Juzgado Agrario del Segundo Circuito Judicial de la Zona Sur. Se ordena remitir el asunto al Juzgado Contencioso Administrativo del Segundo Circuito Judicial de San José, Anexo A, para continuar la tramitación del asunto" (imágenes 29 a 31 del expediente judicial).
4. El Juzgado Contencioso Administrativo y Civil de Hacienda, mediante resolución de las diez horas y treinta y ocho minutos del veintiuno de noviembre de dos mil diecinueve, dispuso:"Siendo que el presente proceso obedece a un proceso de conocimiento, y de conformidad con la reforma que dispone el 212 del Código Procesal Contencioso Administrativo, en relación con el artículo 97 del (sic) la Ley Orgánica del Poder Judicial, se ordena remitir el presente proceso al TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA DEL II CIRCUITO JUDICIAL DE SAN JOSÉ, ANEXO A, para lo que a bien tenga resolver" (imagen 35 del expediente judicial).
5. Mediante resolución de las trece horas y treinta y cuatro minutos del nueve de diciembre de dos mil diecinueve, el Juez de la etapa de trámite de este Tribunal, se arrogó el conocimiento de la causa ordenando continuar con el trámite. Previno a la parte actora reformular los hechos de la demanda, presentar los fundamentos de la misma en adecuada ilación y señalamiento de normas y argumentos jurídicos a fin de expresar de una manera clara y coherente cuales son los motivos jurídicos en los que se funda su pretensión; además precisar pretensiones de manera concreta y aclarar si pretende nulidad contra alguna actuación específica del demandado y presentar copias de ley (imagen 37 del expediente judicial).
6. La parte actora cumplió con lo prevenido en escrito del 19 de diciembre de 2019. Mediante resolución de las catorce horas y cuarenta y siete minutos del trece de enero de dos mil veinte se dio traslado de la demanda al INDER. La pretensión del proceso es: "1)- Que en sentencia, sea declarado con lugar la presente demanda, en todos los (sic) sus extremos. 2)- que (sic) mi representado está legitimado para interponer la presente demanda, puesto se encuentra debidamente reconocido por el INDER COMO PARCELERO. Que la posesión ejercida, lo ha sido siempre en forma quiete (sic), pública, pacífica, y con exclusión de cualquier otra persona. 3)- Que se instruya en sentencia a la JUNTA DIRECTIVA DEL INDER, que se le otorgue a mi representado la debida autorización para ACCEDER A INCENTIVAR LA FINCA ANTE EL FONDO DE DIVERSIDAD SOSTENIBLE (FBS). 4)- Que con los documentos adjuntos queda demostrado que mi representado en el pasado conto (sic) con la debida autorización de la junta directiva del INDER, al igual que otros parceleros, que sus tierras que son un derecho de posesión y no están con escritura, y con la autorización de la junta directiva del INDER, puedan incentivar en el programa FONDO DE DIVERSIDAD SOSTENIBLE (FBS).
Hoy su autoridad es requisito para solicitar y que le brinden dicho incentivo por cinco años, ante el FONDO DE DIVERSIDAD SOSTENIBLE (FBS) ES CONTAR CON EL VISTO BUENO Y AUTORIZACIÓN DEL INDER. 5) que (sic) en sentencia sea ratificado que la documentación adjunta queda demostrado que mi representado en otros años conto (sic) con la debida autorización al igual que otros parceleros la debida autorización para incentivar la finca por medio de la Junta Directiva del INDER." (imágenes 40 a 45 y 55 a 57 del expediente judicial).
7. El INDER contestó la demanda el 03 de marzo de 2020. Solicitó se declare sin lugar la demanda en todos sus extremos, actuación de buena fe de la Institución y se condene a la parte actora al pago de costas personales y procesales. Opuso las defensas de falta de integración de la litis (respecto de MINAE, SINAC y FONAFIFO) falta de legitimación activa y pasiva, excepción de pago y falta de derecho (imágenes 62 a 72 del expediente judicial).
8. Mediante resolución N°1310-2020 de las quince horas veinticinco minutos del once de agosto del año dos mil veinte, el Juez de la etapa de trámite resolvió la alegada integración de la litis con el Estado, el Fondo Nacional de Financiamiento Forestal (FONAFIFO) y el Sistema Nacional de Áreas de Conservación (SINAC), indicando:"Se DECLARA SIN LUGAR la defensa previa de litis consorcio pasivo necesario interpuesta por la representación del Inder. De conformidad con el artículo 15 del Código Procesal Contencioso Administrativo, se ordena poner en conocimiento del Estado y del SINAC la existencia del presente proceso, para que una vez impuestos de la misma, en el plazo de cinco días hábiles manifiesten su interés en apersonarse al mismo. Para tal efecto, se previene a la parte actora presentar en el plazo de tres días hábiles dos juegos de copias de todo lo actuado, bajo pena de no atender futuras gestiones" (imágenes 198 al 202 del expediente judicial).
9. El Tribunal de Apelaciones de lo Contencioso Administrativo y Civil de Hacienda, Sección I, mediante resolución Nº044-2021, de las once horas treinta y cinco minutos del cuatro de febrero de dos mil veintiuno, confirmó la resolución N°1310-2020 (imágenes 206 a 238 del expediente judicial, legajo de apelación).
10. Mediante auto de las once horas y un minuto del diecisiete de marzo de dos mil veintiuno se notificó la resolución N°1310-2020 de las quince horas veinticinco minutos del once de agosto del año dos mil veinte a la Procuraduría General de la República y al Sistema de Áreas de Conservación (imagen 239 del expediente judicial).
11. Mediante auto de las quince horas treinta y ocho minutos del siete de junio de dos mil veintiuno, el Juez de la etapa de trámite dispuso:"En vista del memorial de fecha siete de abril año en curso, presentado por el Licenciado Mauricio Castro Lizano, en representación del Estado, se toma nota de la manifestaciones de la parte y de conformidad con el artículo 13 del Código Procesal Contencioso Administrativo, se tiene como tercer interesados (sic) dentro del presente proceso al Estado. En el mismo orden de ideas se hace de conocimiento de las partes que el Sistema Nacional de Áreas de Conservación, no se pronunció al respecto (...) (imagen 250 del expediente judicial).
12. El Estado se apersonó al proceso como parte interesada, mediante escrito visible de imágenes 243 a 247 del expediente judicial, manifestando que "como el terreno en litigio integra el Patrimonio Natural del Estado, solicito acoger la excepción de falta de derecho del INDER, y declarar sin lugar la demanda en todos sus extremos".
13. Se realizó una audiencia preliminar a las diez horas tres minutos del diecinueve de octubre del año dos mil veintiuno, con la presencia al inicio, únicamente del Estado como tercero interesado. La parte actora no estuvo presente ni justificó su ausencia. El Juez a cargo, hizo lectura de las pretensiones del proceso, visibles en imagen 44 del expediente judicial. El representante estatal indicó tener claras las mismas. Al revisar las defensas previas, se explicó que la integración de litis se resolvió interlocutoriamente y que solo quedan defensas de fondo. El representante estatal se adhirió a la defensa de falta de derecho opuesta por el INDER. En relación a los hechos de la demanda, tomando como base el escrito de reformulación presentado el 19 de diciembre de 2019, se tienen todos por controvertidos. La representante legal del INDER se incorporó en el momento de ofrecer prueba (registro de audio a partir del minuto 00:12:00). Se admitió únicamente prueba documental. Se dio plazo para que las conclusiones de presentaran por escrito. El representante estatal presentó las mismas visibles en imágenes 277 a 280 y la parte actora en memorial visible en imágenes 281 a 283. La representación del INDER no presentó conclusiones, al menos no constan en el expediente judicial (imágenes 268 a 272 del expediente judicial).
En escrito de reformulación de demanda, presentado el 19 de diciembre de 2019, señaló:"PRIMERO: Me apersono a establecer formal demanda contra el INSTITUTO DE DESARROLLO AGRARIO (...) SEGUNDO: Mí, (sic) representado es dueño de un derecho de posesión, sin inscribir ante el Registro de la Propiedad, dicha posesión ha sido por más de sesenta. Durante estos años ha mantenido la posesión en dicho inmueble en forma ininterrumpida, pacífica y a titulo (sic) de dueño, realizando en este período todo tipo de actos de mantenimiento y limpieza total de carriles, siembra de árboles frutales y mantenimiento y cuido del bosque y su sistema ecológico de acuerdo a la Ley Foresta (sic), protección de la diversidad de la belleza escénica, la protección del agua, la protección del bosque, protección de la biodiversidad, que se describe como terreno de montaña y tacotales. Situada en Junta Quebradas, Dirección8836 , Osa de la provincia de Puntarenas, colindancias actuales: Norte: Nombre81936 , Ganadera Guayacán de Ceibo sociedad (sic) Anónima y Dirección336 .
Sur: Nombre81937 y quebrada de por medio. Este: Nombre81938 y calle pública. Oeste: Nombre81939 . Mide Noventa y seis hectáreas, cinco mil ochocientos noventa y un metros con setenta y seis decímetros cuadrados, según plano inscrito en el catastro nacional bajo el número P-UNO UNO DOS OCHO CUATRO- DOS MIL SIETE. TERCERO: Que si bien es cierto en la década de los años ochenta a gran cantidad de parceleros, el estado "ICTC; SECRETARIA GENERAL, San José, 10 de diciembre de 1980, Se (sic) Secretaría General. Asunto: Segregación y Traspaso. A: Sec. Ordenamiento y tenencia de Tierras. ..., tomar nota para el trámite correspondiente, pongo en su conocimiento el acuerdo tomado por la Junta Directiva en su artículo N°XII de la sesión N°2429 celebrada el 1-12-80 de diciembre de 1980, para ese entonces el suscrito quedo (sic) por fuera de dicha adjudicación y segregación, misma suerte en el año 2005, según el acuerdo treinta y nueve de la sesión N°044-05 celebrada el 14 de noviembre 2005 asunto, continuar escritura.
Para ese momento como en el año 2012, ya la demarcación del Asentamiento Campesino Osa, se ubica dentro de la Reserva Forestal Golfo Dulce, creada mediante decreto ejecutivo número 5493-A del 1 de junio de 1978, a fin de que se otorga (sic) escritura pública de sus parcelas. En ese mismo año su autoridad el suscrito queda excluido de dicho procedimiento, a criterio del informe de los técnicos de ese entonces, y con la derogación que realizaran con el nuevo reglamento queda por fuera todo el procedimiento que contemplaba el procedimiento administrativo para ser beneficiario con escritura o bien para que se le cancelara la expropiación, a mi representado ni una ni otra. Ver copia adjunta. CUARTO: Que a mi representado el estado (sic) en aquel momento no le otorgo (sic) la escritura, ni tampoco le compro (sic) su derecho de posesión en su calidad de dueño, y en el pasado el mismo estado sic) le otorgo (sic) la autorización correspondiente para poder incentivar la finca por cinco años sin embargo el dinero destinado para ese fin se agotó y no obtuvo dicho beneficio.
QUINTO: PARA EL PRESENTE AÑO 2019, mi representado solicito (sic) la debida autorización para lograr incentivar la finca, con el PROGRAMA DE CONSERVACIÓN DE LA BIODIVERSIDAD SOSTENIBLE (FBS), no obstante por recomendación de los técnicos ante la junta directiva, indicaron que no recomendaban dicha autorización. Ver documento adjunto. Para incentivar la finca con el PROGRAMA DE CONSERVACIÓN DE LA BIODIVERSIDAD SOSTENIBLE (FBS) (la negrita es nuestra) mi representado, requiere dicha autorización. VER DOCUMENTO ADJUNTO. SEXTO: Hacer saber a su autoridad que a la fecha de hoy el Estado, no le ha cancelado dinero alguno por esa (sic) derecho de posesión en su condición de dueño, CON EL PLANO CATASTRADO P-1128424-2007 de la provincia de Puntarenas con plano 96 ha. 5.891,76 centímetros cuadrados. Es un criterio de oportunidad con el PROGRAMA DE CONSERVACIÓN DE LA BIODIVERSIDAD SOSTENIBLE (FBS).
QUE EN OTRA OPORTUNIDAD SE GESTIONO PARA INSENTIVAR (sic) ANTE el pago de servicios ambientales de programa de fondo nacional de financiamiento forestal (fonafifo) y sí recibió la debida Autorización, Secretaría General San José, 21 de junio de 2011/Asunto: Autorizar a Parceleros que se encuentren adjudicados o reconocidos como poseedores censados por el instituto y que cumplan con los requisitos exigidos en el decreto 3076- MINAE de fecha 4 de octubre de 2002, para que ACCEDAN AL PAGO DE SERVICIOS AMBIENTALES DEL PROGRAMA DE FONDO NACIONAL DE FINANCIAMIENTO FORESTAL. Acuerdo tomado por la Junta Directiva en el Artículo N°41 de la Sesión Ordinaria 022-2011, celebrada el 20 de junio de 2011. Ver documento adjunto" (imágenes 40 a 45 del expediente judicial).
ES CIERTO. SEGUNDO: SE RECHAZA EN LOS TÉRMINOS QUE VIENE EXPUESTO. No le consta a esta representación legal, ni así lo demuestra el actor, su supuesto derecho de posesión. De hecho, esta jurisdicción contenciosa administrativa tiene una cantidad considerable de casos judiciales donde se discute justamente ese tema y, su procedencia a indemnizar o no. De manera que, esta representación rechaza lo alegado, pues el Inder no es competente para reconocer ni judicial ni administrativamente un derecho de posesión o de propiedad, aspecto de alta complejidad que se ha sometido a consideración de los jueces. TERCERO: SE RECHAZA POR INEXACTO Y EN LOS TÉRMINOS EN QUE VIENE EXPUESTO. Tampoco le consta a esta representación la exclusión del actor, referentes a los estudios técnicos que señala. Sin embargo, en relación con los mencionados Acuerdos de Junta Directiva del IDA esta representación Nombre81940 que: a. El Acuerdo de Junta Directiva del IDA, Artículo 13 (XII) de la sesión número 2429 del 1-12-1980, NO TIENE relación con el Asentamiento OSA, ese acuerdo tiene relación con el denominado Proyecto Puriscal-Parrita (Documentación adjunta con este escrito). b. El Acuerdo de Junta Directiva del IDA, Artículo 39 de la sesión número 44-05 del 14-11-2005, respondió a un procedimiento especial y exclusivo para titular en el Asentamiento Campesino Osa, donde debían cumplirse una serie de requisitos y realizarse todo un procedimiento de verificación por parte tanto de la Oficina Subregional de Osa como del MINAE quienes en conjunto emitirían la recomendación respectiva expresando una vez verificado el cumplimiento de los requisitos exigidos, su opinión favorable para el otorgamiento del título o las razones para negarlo.
Ese acuerdo estuvo vigente por 2 años. No obstante FUE DEROGADO, mediante artículo 35 de la Sesión Ordinaria 040-2007, celebrada el 19 de noviembre de 2007, cuando la Junta Directiva acordó revocar el precitado acuerdo N°39 del 2005, pues bajo el análisis (sic) sendos pronunciamiento de la Procuraduría General de la República se había indicado la imposibilidad legal del Instituto de titular en la zona al estar inmersos estos terrenos en la Reserva Forestal Golfo Dulce y por ser esta Patrimonio Forestal del Estado actualmente Patrimonio Natural del Estado (Documentación adjunta con este escrito). CUARTO: SE RECHAZA POR INEXACTO Y EN LOS TÉRMINOS EN QUE VIENE EXPUESTO. No le consta a esta representación legal lo alegado. No obstante, se rescata que es la misma parte actora quien señala que fue el "Estado" no el Inder quien le otorgó el pago del incentivo de la finca por 5 años. Con la intención de saber en qué términos existe el contrato, se indica que esta representación legal mediante oficio INDER-PE-AJ-137-2020 (documentación adjunta con este escrito) solicitó al Nombre28548 el expediente administrativo del contrato PSA del señor Nombre81933 , no teniendo respuesta al momento del vencimiento del plazo para la contestación de la demanda.
Sin embargo, de los formularios que tiene el Nombre28548 a la disposición de las personas que quieren inscribirse al Programa de PSA (documentación adjunta con este escrito), se rescata que en ellos se les advierte a los administrados que el pago está sujeto tanto a "criterios de priorización" como a la "disponibilidad de recursos". De manera, que los administrados tienen conocimiento de estas condiciones financieras. QUINTO: SE RECHAZA POR INEXACTO Y EN LOS TÉRMINOS EN QUE VIENE EXPUESTO. Según la página web del Fondo de Biodiversidad Sostenible, el "Programa de Conservación de la Biodiversidad" (PCB o FBS por sus siglas en inglés) se define como: "un mecanismo voluntario que busca implementar un esquema de incentivos financieros y no financieros para la conservación de la biodiversidad que reconozca los aportes que brindan las comunidades locales, fortaleciendo el desarrollo económico, socialmente inclusivo y ambientalmente sostenible.
Este (sic) se basa en dos componentes principales, un incentivo financiero y un acompañamiento a los propietarios y poseedores de terrenos privados" (...) Del concepto anterior, cabe destacar varios aspectos: a) El programa busca otorgar incentivos a las personas que buscan la "conservación de la biodiversidad" no obstante, según inspecciones agrarias técnicas (la última realizada el 7-5-2019) de la Oficina Subregional de Osa, en la parcela N°28 del Asentamiento Osa ubicada en el Sector el Progreso, en Drake (objeto del litigio), se denota quemas tanto de lo que parece ser una casa de habitación como del terreno. Al respecto, véase el oficio OTOS-255-2019, visible a folio 15 del expediente administrativo de la parcela N°28 del Asentamiento Osa ubicado en el Sector el Progreso en Drake (documentación adjunta con este escrito). De manera que, de conformidad con el mismo ordenamiento jurídico es una práctica no conservacionista del ambiente, pues por antonomasia, la conservación conlleva el deber de proteger y reservar el terreno y el bosque, de manera que se configure la posesión ecológica. b) El programa busca dar un incentivo a "propietarios" en "terrenos privados".
Es decir, aceptar que, si les procede el pago, es aceptar que ellos son "propietarios" o que tienen algún derecho sobre el terreno "privado". No obstante, muchas son las aristas a analizar, a saber: primero la condición de poseedores de buena fe y, segundo la naturaleza jurídica de "terrenos privados", pues como bien se ha indicado esos terrenos de aptitud forestal forman parte de la RFGD, concebida -por la misma PGR- como bienes de dominio público incorporados a Patrimonio Natural del Estado. La Procuraduría General de la República, en el dictamen C-321-2003 del 9 de octubre de 2003, señaló [hizo cita]. Al respecto, también valórese el contenido de los Criterios Jurídicos emanados por la institución, a saber: oficios DAJ-295-2012 del 21-6-2012, AJ-410-2018 del 11-9-2018 e INDER-PE-AJ- 523-2019 del 25-11-2019 (documentación adjunta con este escrito). Criterios Jurídicos referentes a PSA y su relación inmediata con la afectación de esos terrenos a Patrimonio Natural del Estado.
También nótese que esta condición de la RFGD la conoce y la acepta el actor en la narración del hecho tercero de esta demanda. Por su parte, el actor indica que los informes técnicos de la Institución recomiendan no autorizar el PSA, sin embargo, los informes técnicos de la Oficina Territorial Osa, no pueden ni deben realizar ninguna "AUTORIZACIÓN", pues esa autorización es una competencia del FONAFIFO, esos criterios técnicos lo que emanan son una serie de consideraciones de la parcela, entre esas indica que el señor Nombre81933 , se encuentra en la base de datos como ocupante de la parcela 28, pero Nombre81940, que "la información fuera verificada en el campo, por lo que el registro de ese censo no significa que se reconozca derechos de ningún tipo (ni de posesión ni de propiedad)". Al respecto, véase la ficha de referencia por una inspección realiza, visible al folio 10-11 del expediente administrativo de la parcela N°28 del Asentamiento Osa ubicado en el Sector del Progreso, en Drake (documentación adjunta con este escrito).
SEXTO: ES FALSO. El Estado Costarricense, a través del Nombre28548 si ha cancelado el PSA, no obstante, es esta misma Institución quien debe valorar si con los documentos presentados, se cumple con los requisitos que el ordenamiento jurídico exige. Al respecto se encuentra toda la Ley N°8640 del 2008 Manual de Procedimiento para el pago de Servicios Ambientales, especialmente los artículos 8 y 9. SOBRE EL FONDO DEL ASUNTO: En los últimos meses, nuestra Institución se ha visto realmente afectada por una muy mala imagen y el "lobby" distorsionado de algunos temas como es el caso del PSA, nuestras oficinas territoriales ha sido directamente atacadas por un ánimo exacerbado de los administrados, por la supuesta responsabilidad plena del Inder en la negatoria de este incentivo. No obstante, lo anterior es falso, pues el INDER sólo cumple con una parte de los requisitos que dicta la ley, pero no es quien otorga el incentivo.
En el caso en concreto (sic) incluso por un principio de legalidad básico del Derecho Administrativo, el incentivo lo otorga Nombre28548, quien puede valorar si se otorga o no el PSA. (...) La "función" del Inder en materia de pago de servicios ambientales, está limitada a hacer constar si el solicitante es poseedor censado por el IDA, declarado beneficiario o adjudicatario, no a (sic) otorgar autorizaciones para que las personas reciban pagos por servicios ambientales, no es una función señalada en la ley de creación del Inder. Corresponde al Inder otorgar autorizaciones, sería contrario a la ley, es un error de apreciación, quizás inducido por la forma en qué se utilizan las palabras. Por normativa, corresponde y compete exclusivamente al FONAFIFO, determinar si una persona califica o no para recibir el pago por servicios ambientales. Pero lamentablemente, es Nombre28548 quien espera un aval directo del Inder y su Junta Directiva.
Por su parte, el Inder, por lo ya ocurrido en el expediente 15-8145-1027-CA Resolución N°30-2018 -VIII de abril 218 caso Nombre81941 y Nombre81942 , debe tener mucha prudencia en realizar actos administrativos (aunque sean de trámite) y/o oficios de cualquier índole, pues la Institución no tiene la competencia para reconocer administrativamente ni derechos de posesión o de propiedad, bajo una base de datos o censos que nunca fueron corroborados en campo. Es por lo anterior que a los administrados y a las autoridades superiores se les ha hecho ver que "para todos los efectos administrativos o judiciales, la Oficina de Desarrollo Territorial de Osa debe aclarar y enfatizar que todas las constancias emitidas mediante los oficios, NO RECONOCEN DERECHOS DE NINGÚN TIPO (ni de posesión ni de propiedad) a los supuestos ocupantes puesto, la información proporcionada proviene de bases de datos y censos antiguos de la Institución que nunca fue verificada en el campo".
La administración (tanto la activa como la superior) del Inder está limitada a no entregar documentos, que puedan reconocer o generar derechos sobre bienes en los cuales por su demanialidad no son susceptibles de apropiación, y si así lo hiciere sería completamente nulos, sin valor legal para nuestro ordenamiento. Con la aprobación de la Ley 8640 "Aprobación del Contrato de Préstamo N°7388-CR y sus anexos entre la República de Costa Rica y el Banco Internacional de Reconstrucción y Fomento (BIRF), se estableció en su artículo 9, los requisitos que deben cumplir las personas que pretendan el pago de los servicios ambientales [hizo transcripción]. El inciso b, hace referencia al trámite que debe realizar el Inder, siendo únicamente, otorgar una constancia en la que se indica si las personas son poseedoras censadas, declarados beneficiarios o adjudicatarios. No el encargado de autorizar el pago de servicios ambientales, como erróneamente se indica en el oficio.
La obligación legal de la autorización de acuerdo a la Ley citada, recae directamente en FONAFIFO, como se demuestra en inciso e) del artículo en mención, facultado (sic) a hacer una inspección en el inmueble donde se ejerce la posesión y determinar así la posibilidad de otorgar el beneficio. El reglamento a la Ley Forestal N°25721, en el artículo 55 inciso b) indica que, serán funciones de la Junta Directiva de FONAFIFO, además de las estipuladas en la Ley, entre otras establecer los procedimientos de Pago de Servicios Ambientales, de acuerdo a lo establecido en la Ley Forestal N°7575 y su Reglamento. Nombre28548 tiene como función, el trámite y pago de servicios ambientales que brindan los bosques y plantaciones forestales y otras actividades necesarias, para fortalecer el desarrollo del sector de recursos naturales del país, al SINAC le corresponde parte del control, seguimiento y fomento del Programa de pagos por Servicios Ambientales.
Adicionalmente, en el artículo 39 del Reglamento, se autoriza al Fondo Nacional de Financiamiento Forestal, a emitir los Manuales y/o procedimientos de pago de servicios ambientales (PSA-Manual de Procedimiento para el Pago de Servicios Ambientales, publicado en la Gaceta N°46 del 6 de marzo del 2009 y sus reformas). Continuamos con el análisis normativo, en el artículo 22 de la Ley Forestal se señala: [hizo transcripción] De lo anterior, se desprende que las facultades otorgadas por ley están dadas a Nombre28548 y que el Inder tiene como función básica indicar si la persona es poseedor, beneficiario o adjudicatario, no emite ninguna autorización para la obtención del pago de servicios ambientales" (imágenes 62 a 72 del expediente judicial).
1. No es un hecho. 2. No es cierto que el actor posea el inmueble a título de dueño. Los bosques y terrenos forestales o de aptitud forestal de la Reserva Forestal Golfo Dulce, creada por el Decreto 5493 del 1 de junio de 1978 y la finca inscrita a nombre del IDA (INDER) N°39334-000 del Partido de Puntarenas, constituyen Patrimonio Natural del Estado conforme con los artículos 13, 14 y 39, inciso. i de la Ley Forestal, y 38 de la Ley 7554) y por ende de dominio público y no susceptibles de posesión (Sala Primera sentencias números 59-F-99, 1070-F-S1-2010 y 1088-F-S1-2011; votos constitucionales 8945-2005, 2063-2007, 16975-2008, 17650-2008, 17659-2008, 21258-2010 y 16938-2011). Ese Patrimonio Natural del Estado es administrado por el MINAE-SINAC bajo los supuestos de la Ley de Conservación de la Vida Silvestre, artículo 83, párrafo segundo; Ley Forestal, artículos 3, incisos b) y d), 13, 14 y 15; Ley 6043, artículo 73; Ley Orgánica del Ambiente, numeral 32; Ley de Biodiversidad, artículos 22 y 28 (sentencia constitucional 16975-08; pronunciamientos OJ-122-2000, C-26-2001, C-210-2002, OJ-253-2003, C-321-2003, OJ-14-2004, OJ-93-2004, C-297-2004, C-339-2004, OJ-56-2005, OJ-22-2006, C-74-2007, C-93-2007).
En esa condición no puede ser permutado, cedido, enajenado de ninguna manera, entregado, ni dado en arrendamiento (Ley 7575, artículos 13, 14 y 15): “VIII.- Refiere el IDA, que el Tribunal no valoró que fue el MINAET quien le traspasó los terrenos, en el año 2000; y esta situación los hizo entender, que dichos terrenos, no estaban dentro de las categorías que establece la Ley Forestal, como conformación del patrimonio natural del Estado... Al haberse demostrado en esta sede, que el inmueble objeto de este proceso está cubierto de bosque en su mayoría, se concluye que la propia normativa anulada por inconstitucionalidad, impedía el traspaso del terreno a favor del IDA. En igual sentido, la Ley Forestal en el ordinal 14, determina que los terrenos forestales y bosques que constituyen el patrimonio natural de Estado, “…serán inembargables e inalienables; su posesión por los particulares no causará derecho alguno a su favor y la acción reivindicatoria del Estado por estos terrenos es imprescriptible.
En consecuencia, no pueden inscribirse en el Registro Público mediante información posesoria y tanto la invasión como la ocupación de ellos será sancionada conforme a lo dispuesto en esta ley.” Pese al fundamento apuntado por el IDA, en el sentido de que el MINAET le traspasó los terrenos, lo cual aduce, los indujo a error, esta situación no los exime de su obligación de apegar su conducta al marco de legalidad vigente, por lo que agravio no es de recibo. En igual sentido, lo indicado respecto a que el Tribunal no consideró que el terreno ha estado en posesión de particulares, no resulta un reclamo atendible ante esta Sala, por ser la Ley Forestal clara, en el sentido de que se trata de bienes inalienables, cuya posesión por particulares no causará derecho alguno a su favor, siendo imprescriptible la acción reinvindicatoria del Estado.” (Sala Primera, No. 1070-2010). Sobre el tema, el Tribunal Contencioso Administrativo, voto 38-2010-VI dispuso: [hizo cita].
Luego, los planos no confieren derecho de propiedad o posesión (Código Civil, artículo 301; Decreto 34331, artículo 57 párrafo 3°; Sala Primera Civil, sentencias de 2:30 pm. de 23 de octubre de 1936, N°40 de 14:20 hrs. del 9 de enero de 1960, N°95 de 9:10 hrs del 6 de abril 1979; Sala de Casación, sentencias de 16:30 hrs. del 20 de mayo de 1938, considerando 2; 15:10 hrs. del 24 de mayo de 1944, considerando XII; N° 69 de 14:30 hrs. del 10 de agosto de 1960; N°31 de 15:30 hrs. del 8 de mayo de 1981; Sala Primera, sentencias 6-90, 230-90, 241-90, 243-90, 123-92, 126-92, 171-92, 56-1994, 66-1994, 33-1995), menos aún en perjuicio del dominio público. Tampoco las declaraciones juradas demuestran la posesión (Sala Primera, votos 216-2008 y 808-2012). En este asunto, de acuerdo con la inspección del 7 de mayo de 2019 realizada por funcionarios del INDER (expediente judicial, imagen 174), el inmueble en litigio presenta una hectárea quemada, pequeñas plantas de palma no asistidas, no hay personas, y, en lo medular, el resto del área es bosque, condición que también reporta el plano P-1128424-2007 (expediente judicial, imágenes 46, 126, 186).
El oficio del INDER-GG-DRT-FT-IRT-0197-2020 de 25 de febrero de 2020, agrega que el terreno está dentro de la Reserva Forestal Golfo Dulce y el Asentamiento Osa (expediente judicial, imágenes 129-130). Asimismo, los oficios DSA-OF-0020-2020 y DSA-OF-002-2020, de 4 y 5 de marzo de 2020, respectivamente, acreditan que el actor no ha sido beneficiario del pago de servicios ambientales (expediente judicial, imágenes 192-194). 3. Solo se acepta que el 28 de abril de 1978 se estableció la Reserva Forestal Golfo Dulce. Se rechazan los alegatos de parte. No consta que se haya consolidado la usucapión previamente a la afectación al dominio público de las Reservas Nacionales (artículo 8 de la Ley de Tierras y Colonización, No. 2825 de 14 de octubre de 1961; Sala Primera, sentencias 51-1995 y 59-1999). 4.- No me consta. Se rechaza. En el dictamen C-321-2003 del 9 de octubre del 2003, señalamos la improcedencia de la titulación de terrenos del Patrimonio Natural del Estado: “(…) Son parte del Patrimonio Natural del Estado, entre otros, los bosques y terrenos forestales de las reservas nacionales, así como de las fincas inscritas a nombre del Estado y las pertenecientes a las instituciones autónomas, excepto que garanticen operaciones crediticias con el Sistema Bancario Nacional e ingresen a su patrimonio.
A través de sus notas jurídicas esenciales de inalienabilidad, inembargabilidad, imprescriptibilidad de las acciones reivindicatorias, dichos bienes tienen por ley una afectación inmediata al dominio público del Estado, sin acto complementario atributivo de ese carácter. (…) Aunque el IDA hubiera adquirido los terrenos con una normativa anterior, para programas de titulación múltiple, si dispuso de estos (sic) con la Ley 7599 debía respetar todos los preceptos que normaban su actuación al otorgar los títulos. Asimismo la Ley de Uso, Manejo y Conservación de Suelos, arts. 27 y 64, y su Reglamento, artículo 63, in fine, impiden al IDA adquirir, adjudicar o titular tierras que no clasifiquen para fines agrarios, según el estudio de suelos.” Asimismo, en el pronunciamiento OJ-129-2002 del 12 de setiembre del 2002, dirigida al IDA y al MINAE, se indicó la imposibilidad de enajenación de terrenos del Patrimonio Natural del Estado, en la Reserva Forestal Golfo Dulce: “1) De acuerdo con el ordenamiento jurídico vigente para la fecha del acuerdo No. 11 de la sesión No. Placa13265, en el que se dispone la adjudicación de la parcela … al señor …, el inmueble descrito por el plano catastrado número P-488147-98, formaba parte del patrimonio natural del Estado, habiendo ingresado a éste automáticamente al pertenecer a una institución autónoma y estar comprendido dentro de los límites de la Reserva Forestal Golfo Dulce (Sala Constitucional, Voto No. 1763 de las 16 horas, 45 minutos del 13 de abril de 1994 y Procuraduría General de la República, Dictamen C-049-98 del 20 de marzo de 1998), sin olvidar su cobertura boscosa (artículo 13 de la Ley Forestal).
En consecuencia, desde su incorporación al patrimonio natural del Estado, se convierte en un bien de dominio público, y en esa medida, deviene en inalienable e imprescriptible, por lo que el Instituto de Desarrollo Agrario estaba impedido legalmente para enajenarlo (numeral 14 de la Ley Forestal), y en esa medida, procede la anulación del citado acuerdo.” Así es, no procede la titulación, segregación, parcelación o enajenación de terrenos de la finca 39334-000 del Partido de Puntarenas ubicados en la Reserva Forestal Golfo Dulce. Ver los votos constitucionales 2988-1999, 8560-2001, 2063-2007 aclarado por el 4517-2007 y 8098-2007, indicándose en el último: “Los recurrentes pretenden que este Tribunal, en el fondo, analice y determine la procedencia de un proceso de titulación de tierras en la zona protegida de Golfo Dulce, pues estiman que les asiste ese derecho y que los recurridos no se los ha querido reconocer.
En primer término cabe indicarle a los petentes que, según se desprende del propio memorial inicial y de los Decretos en él citados, la declaratoria de zona protegida o Reserva Forestal de Golfo Dulce, en la cual se vio inmerso un ochenta por ciento del inmueble en cuestión data de abril mil novecientos setenta y ocho y la expropiación de esas tierras a Osa Productos Forestales de mayo de mil novecientos setenta y nueve. Eso quiere decir que las tierras que habitan fueron declaradas Reserva Forestal antes de ser repartidas entre los recurrentes, por lo que de hecho no podía el ITCO y luego el IDA titular sobre las mismas…En tales supuestos, existe una imposibilidad material para los recurridos de titular terrenos dentro de las reservas de carácter forestal por resultar tal proceder inconstitucional, según lo dispuesto por este Tribunal…” Criterio reiterado por la Sala Constitucional en el voto 8075-2008: “IV.- El caso concreto.
El otorgamiento de títulos de propiedad en inmuebles sometidos a la Reserva Forestal Golfo Dulce. Refiere el recurrente que manteniendo una ocupación de veintiséis años sobre una parcela del Instituto de Desarrollo Agrario en Sierpe de Osa, tal institución pública omite la titulación de las propiedades en perjuicio suyo y de una gran cantidad de ocupantes, siendo que ya se habían otorgado con anterioridad algunas escrituras, por lo que resulta inconsecuente que la administración continúe atrasando la titulación. Del informe rendido bajo la gravedad del juramento y de la prueba que consta en autos, la Sala tiene por acreditado que la parcela que ocupa el amparado se encuentra dentro del denominado Asentamiento Osa, el cual se enclava dentro de las propiedades que en su momento el Estado expropió a la compañía Osa Productos Forestales S.A., y que quedó luego afectada bajo un régimen especial de protección al constituirse la Reserva Forestal Golfo Dulce.
Tal como lo señala la autoridad recurrida, el Instituto de Tierras y Colonización –luego Instituto de Desarrollo Agrario- inició en su oportunidad la titulación de los inmuebles de manera paulatina, pero que por la trascendencia de la afectación de los terrenos como pertenecientes a la citada reserva forestal, hubo de suspender la titulación pues legalmente se encuentra impedido e imposibilitado de hacerlo, pues como institución pública debe apegarse al principio de legalidad y, en el presente caso, existen claras disposiciones que ordenan la inalienabilidad de los inmuebles como el ocupado por el recurrente. De conformidad con la jurisprudencia de cita, la Sala advierte que en efecto la administración se encuentra absolutamente impedida de continuar con el proceso de titulación de los terrenos que quedaron inmersos dentro de la Reserva Forestal Golfo Dulce -salvo que en el futuro sobreviniera una reforma legal técnicamente fundamentada que eliminara la afectación-, por lo que no se está en presencia de un acto arbitrario o ilegítimo de la administración, sino de actuaciones amparadas de manera justificada en un amplio espectro normativo –internacional, constitucional, legal y vía decreto ejecutivo-.” 5.
Es ajeno a mi presentado. Se rechaza conforme con las respuestas de los hechos 1, 2, 3 y 4. 6. Se reproduce la contestación al hecho anterior. Prueba: Los autos y piezas del expediente indicados en este memorial. Con base en las razones de hecho y derecho expuestas, como el terreno en litigio integra el Patrimonio Natural del Estado, solicito acoger la excepción de falta de derecho del INDER, y declarar sin lugar la demanda en todos sus extremos" (imágenes 243 a 247 del expediente judicial).
De relevancia para la resolución de este asunto se tiene por probado 1) Mediante certificación INDER-GG-DRT-FT-IRT-0197-2020, emitida por el Área de Información de Registro de Tierras se indicó,"la ubicación cartográfica consignada en el plano catastrado P-un millón ciento veintiocho mil cuatrocientos veinte cuatro - dos mil siete, situado en el distrito Sierpe, cantón Osa, provincia Puntarenas, que este (sic) describe un inmueble que TRASLAPA con el asentamiento Osa Productos Forestales administrado por el INDER y la Reserva Forestal Golfo Dulce, según montaje que se adjunta; lo anterior en tanto que el predio esté correctamente ubicado por el profesional responsable" (imágenes 126 a 130 del expediente judicial).

Por lo que la propuesta del Fondo de Biodiversidad Sostenible (FBS) plasmada en FBS-OF-135-2018, resulta fuera de nuestras competencias institucionales además de ser contraria a los intereses institucionales en tanto su aprobación contendría el reconocimiento implícito de derechos de posesión a favor de las personas enlistadas en el "Anexo 1: Poseedores que solicitan ingreso al Programa de Conservación de la Biodiversidad". Por lo anterior, esta Asesoría recomienda rechazar la propuesta del Fondo de Biodiversidad Sostenible y remitirse al ente competente, que es en definitiva el que debe otorgar lo correspondiente según el ordenamiento jurídico vigente dispuesto para dichas tierras que por su naturaleza especial pertenecen al Estado Costarricense..." (imágenes 140 a 141 del expediente judicial).
Sin embargo en inspección realizada por parte de esta oficina en fecha 07 de mayo de 2019 a la citada parcela, se determinó que el señor Nombre81933 no habita la parcela en razón a que no vive en la zona. Que la parcela 48 del Asentamiento Osa, Sector El Progreso es parte de la finca Folio Real, Matrícula Placa13266, propiedad del Instituto de Desarrollo Rural y la misma se encuentra afectada en su totalidad por la Reserva Forestal Golfo Dulce, creada mediante Decreto Ejecutivo 8494-A del 26 de abril de 1978, publicado en el alcance número 92 de la Gaceta Número 104 del 01 de junio de 1978. Que al estar la citada parcela afectada por la Reserva Forestal Golfo Dulce ésta automáticamente constituye Patrimonio Natural del Estado, establecido así en los artículos 13, 14 y 15 de la Ley Forestal, Número 7575 del 5 de febrero del año 1996. Publicada en la Gaceta N°72 del 16 de abril del año 1996.
Alcance: 21. Artículo 13.- Constitución y administración. El patrimonio natural del Estado estará constituido por los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, de las fincas inscritas a su nombre y de las pertenecientes a municipalidades, instituciones autónomas y demás organismos de la Administración Pública, excepto inmuebles que garanticen operaciones crediticias con el Sistema Bancario Nacional e ingresen a formar parte de su patrimonio. El Ministerio del Ambiente y Energía administrará el patrimonio. Cuando proceda, por medio de la Procuraduría General de la República, inscribirá los terrenos en el Registro Público de la Propiedad como fincas individualizadas de propiedad del Estado. Las organizaciones no gubernamentales que adquieran bienes inmuebles con bosque o de aptitud forestal, con fondos provenientes de donaciones o del erario, que se hayan obtenido a nombre del Estado, deberán traspasarlos a nombre de este.
Artículo 14.- Condición inembargable e inalienable del patrimonio natural. Los terrenos forestales y bosques que constituyen el patrimonio natural del Estado, detallados en el artículo anterior, serán inembargables e inalienables; su posesión por los particulares no causará derecho alguno a su favor y la acción reivindicatoria del Estado por estos terrenos es imprescriptible. En consecuencia, no pueden inscribirse en el Registro Público mediante información posesoria y tanto la invasión como la ocupación de ellos será sancionada conforme a lo dispuesto en esta ley. Artículo 15.- Impedimentos. Los organismos de la Administración Pública no podrán permutar, ceder, enajenar, de ninguna manera, entregar ni dar en arrendamiento, terrenos rurales de su propiedad o bajo su administración, sin que antes hayan sido clasificados por el Ministerio del Ambiente y Energía. Si están cubiertos de bosque, automáticamente quedarán incorporados al patrimonio natural del Estado y se constituirá una limitación que deberá inscribirse en el Registro Público.4- Que respecto al Patrimonio Natural del Estado bajo el dominio del Inder, la Contraloría General de la República en su informe No. DFOE ED 7-2007 de fecha 15 de marzo del 2007, respecto al cumplimiento y vigencia de las funciones asignadas al Instituto; Punto:2.3.3, Incisos: a) y b) hace algunas observaciones y advertencias a la institución, por lo que se agrega al presente informe para su análisis la Parte 2.3.3, incisos a) y b) del citado informe.
"2.3.3. INCUMPLIMIENTOS EN LAS OBLIGACIONES DE LA LEY FORESTAL. a) Resistencia a trasladar el "patrimonio natural del Estado" al MINAE. La Ley de Tierras y Colonización afectó al dominio estatal lo que denominó "propiedad agrícola del Estado" y le asignó su administración al Instituto de Desarrollo Agrario. Esa propiedad incluye lo que actualmente se conoce como: áreas silvestres protegidas, nacientes y áreas de protección de ríos y quebradas, entre otros. Con la promulgación de la primera Ley Forestal y otras leyes especiales como la Ley sobre la Zona Marítimo Terrestre, áreas comprendidos en la "propiedad agrícola del Estado" fueron declaradas como inalienables y no susceptibles de adquisición, denominándoseles como "patrimonio forestal del Estado" y su administración se fue trasladando a otras instituciones. En el año 1996 se promulga la actual Ley Forestal que modifica la denominación de dichas áreas a "patrimonio natural del Estado" y se indica que está constituido "por los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, de las fincas inscritas a su nombre y de las pertenecientes a municipalidades, instituciones autónomas y demás organismos de la Administración Pública, excepto inmuebles que garanticen operaciones crediticias con el Sistema Bancario Nacional e ingresen a formar parte de su patrimonio.
El Ministerio del Ambiente y Energía administrará el patrimonio.". Con fundamento en los artículos 32 de la Ley Orgánica del Ambiente, y los artículos 2 y 13 de la Ley Forestal, el "patrimonio natural del Estado" bajo el dominio del IDA debió ser trasladado e inscrito a nombre del MINAE. Sin embargo, a la fecha del presente estudio el Área de Topografía del Instituto reportó 65 asentamientos que incluyen parte o la totalidad de un área silvestre protegida declarada como tal, vía ley o decreto ejecutivo, indicando que con excepción de los terrenos de la Reserva Biológica Lomas de Barbudal y el Bosque Nacional Diriá, las demás áreas no han sido catastradas. La negativa por parte de las autoridades del IDA de traspasar estas áreas al MINAE es reiterada, toda vez que desde el año 1990, fecha en que esta Contraloría con fundamento en el ordenamiento dispuso al Instituto mediante informe N°79/90, que se identificaran las fincas con limitaciones de explotación por encontrarse áreas silvestres protegidas dentro de ellos y se procediera conforme los resultados.
Dicha identificación acompañada de un estudio jurídico, debidamente coordinado con órganos externos competentes (Ej. MINAE, Procuraduría General de la República), es apremiante a fin de que en el menor tiempo esta situación se ajuste a derecho y en especial porque eventualmente afectará a los dueños de propiedades y al erario público. Lo anterior ya que según se reporta de los 65 asentamientos, 47 fueron adquiridos como parte de un asentamiento antes de ser declarada el área silvestre protegida y 18 fueron adquiridas luego de creada el área silvestre. Es por todo lo anterior que esta oficina se abstiene de recomendar el Pago de Servicios Ambientales para la Parcela Número 48 del Asentamiento Osa, Sector El Progreso, solicitado por el señor Nombre81933 mediante oficio SN-047-2019 de fecha 16 de junio de 2019, esto por cuanto es un terreno afectado en su totalidad por la Reserva Forestal Golfo Dulce y constituye Patrimonio Natural del Estado. Así las cosas, la decisión tomada por esta oficina es con el fin de evitar perjuicio económico al patrimonio del Estado" (imágenes 13 a 16 del expediente judicial).
Bajo esa tesitura, la administración está limitada a no entregar documentos, que puedan reconocer o generar derechos sobre bienes en los cuales por su demanialidad no son susceptibles de apropiación, y si así lo hiciere sería completamente nulos (...). En el oficio, se hizo cita del artículo 9 de la Ley 8640 y, con base en el texto legal se indicó: "En el inciso b, hace referencia al trámite que debe realizar el Inder, siendo únicamente, otorgar una constancia en la que se indica si las personas son poseedoras censadas, declarados beneficiarios o adjudicatarios. No es el encargado de autorizar el pago de servicios ambientales, como erróneamente se indica en el oficio. La obligación legal de la autorización de acuerdo a la Ley citada, recae directamente en FONAFIFO, como se demuestra en inciso e) del artículo en mención, ...". Además se analizó el Reglamento de la Ley Forestal (N°25721 artículos 39 y 55 inciso b), así como el numeral 22 de la Ley Forestal" (...) El oficio concluye:"En razón del principio de precaución administrativa y el principio precautorio y la seguridad jurídica en virtud de la sentencia dictada, por el fin público que cumplen esos terrenos, y en tratándose de fondos públicos, ésa asesoría comparte la decisión de la administración, que indicamos no conocemos oficialmente, de no seguir otorgando este tipo de documentos, que avalen ante el FONAFIFO, una situación jurídica contraria a lo indicado, hasta tanto no se conozca el resultado del recurso de casación y en firme planteada contra dicha resolución judicial" (imágenes 144 a 154 del expediente judicial).
De relevancia para la resolución de este asunto se tiene por no probado:
Con la promulgación de la Ley N°8640 del 05 de junio de 2008 la Asamblea Legislativa decretó la "Aprobación del Contrato de Préstamo N°7388-CR y sus anexos entre la República de Costa Rica y el Banco Internacional de Reconstrucción y Fomento (BIRF)", orientado a financiar proyectos de gestión ambiental. El objetivo del proyecto era propiciar, la conservación de la biodiversidad -de importancia global- y garantizar su sostenibilidad a largo plazo, mediante el apoyo al desarrollo e implementación de instrumentos de mercado, promover la conservación de bosques en zonas de amortiguamiento de las áreas protegidas, a través del Programa de Pago por Servicios Ambientales (PSA) [ver texto de la Ley, Anexo 1]. Para la ejecución y pago de los servicios ambientales, el artículo 9 señaló: "Autorízase al Nombre28548 para que pague servicios ambientales en la modalidad de protección de bosque, a los poseedores de bosques en las áreas prioritarias establecidas por el Sinac.
La posesión ha de ser continua, pública y pacífica. El poseedor del inmueble al que se le reconozca el pago de servicios ambientales en los términos de este artículo, deberá demostrar la posesión decenal sobre el inmueble con antelación a la fecha de vigencia de esta Ley. Para estos efectos, deberá acreditar la protección del recurso del bosque de manera que se configure la posesión ecológica. Adicionalmente, para acreditar la posesión, el poseedor deberá cumplir con los siguientes requisitos: 1) Presentar certificación del plano catastrado del inmueble en posesión o plano elaborado por el Instituto de Desarrollo Agrario (IDA). Sin excepción alguna, los planos catastrados que se aporten deberán ser certificados por el Minae, por medio del Sinac, el cual dará fe de si el inmueble se encuentra dentro de áreas silvestres protegidas o fuera de ellas. b) Carta de venta protocolizada ante notario público, con la fecha cierta de la adquisición del inmueble, si tal fue el modo de adquisición o ser poseedores censados por el IDA, declarados beneficiarios y adjudicatarios.
En caso de que el poseedor sea originario o no tenga los documentos de traspaso con las formalidades establecidas, deberá presentar la declaración jurada de tres testigos que documenten en forma detallada, el origen y las actividades de la posesión ejercida. Estas declaraciones deberán constar en escritura pública. También podrá presentar cualquier otro documento sobre procesos judiciales o ante instituciones públicas que demuestren con claridad la posesión del terreno. c) Declaración jurada, ante notario público, del poseedor solicitante que contenga: descripción de la naturaleza del inmueble, ubicación por provincia, distrito, cantón, caserío o población local, indicación de los nombres completos de todos los colindantes actuales, número de plano catastrado, medida, tiempo de poseerlo, modo de adquisición y descripción de los actos posesorios. d) Declaración jurada, autenticada por abogado, de al menos tres de los colindantes del inmueble, en la que indiquen conocer de la posesión con el colindante, y no tener conflicto ni disputa por dicha colindancia o sus mojones, cercas o similares.
En los casos en que el límite sea natural o un camino público, no se requiere presentar declaración. Cuando el limitante sea una entidad pública, bastará una nota oficial por parte de la autoridad que corresponda, donde se indique lo estipulado en este artículo. Si la colindancia es con un área protegida, solo procederá la presentación de una nota emitida por el director del área de conservación respectiva. e) El Estado, por medio del Nombre28548 y en todos los casos por los mecanismos que este determine, deberá hacer una inspección en el inmueble donde se ejerce la posesión" (consulta Ley N°8640 en www.fonafifo.go.cr, el 7 de diciembre de 2021 y Ley N°8058 del 08 de enero de 2001 y ). Mediante DE Nº30761-MINAE, del 23 de agosto de 2002, considerando que la Ley de Biodiversidad "promueve los Planes de Incentivos, entre ellos, el pago de servicios ambientales a favor de las actividades o programas realizados por personas físicas o jurídicas nacionales que contribuyan a alcanzar los objetivos de este cuerpo normativo; de igual manera, se permite el pago por servicios ambientales a poseedores en áreas estratégicas definidas.
Sin embargo, el logro de los objetivos del Programa de pago de servicios ambientales, se ha visto limitado hasta ahora, únicamente a la inclusión de terrenos inscritos registralmente, sin que exista una verdadera participación de personas físicas que ostenten terrenos en posesión"; se adiciona un nuevo artículo al Reglamento a la Ley Forestal, Decreto Ejecutivo número 25721-MINAE del 17 de octubre de 1996, que se lea:"Artículo 107. Los proyectos de conservación de bosque en terrenos amparados al derecho de posesión, podrán ser cubiertos por el programa de Pago de Servicios Ambientales, en la modalidad protección. Para optar al programa de Pago de Servicios Ambientales, los poseedores legalmente acreditados, deberán cumplir con los siguientes requisitos: a) Presentar Plano catastrado del inmueble debidamente certificado, o plano elaborado por el Instituto de Desarrollo Agrario-IDA. b) Carta de Venta Protocolizada ante Notario Público con fecha cierta de la adquisición del inmueble, si este fuese el modo de adquisición o poseedores censados por el Instituto de Desarrollo Agrario, declarados beneficiario y adjudicatarios.
En caso de que el poseedor sea originario o no tenga los documentos de traspaso con las formalidades establecidas, deberán presentar la declaración jurada de tres testigos que en forma detallada documenten el origen, y actividades de la posesión ejercida. Estas declaraciones deberán ser en escritura pública. También podrá presentar cualquier otro documento sobre procesos judiciales o ante instituciones públicas que demuestren con claridad la posesión del terreno. c) Declaración jurada ante notario público del poseedor solicitante que contenga: descripción de la naturaleza del inmueble, ubicación por provincia, distrito, cantón caserío o población local indicación de los nombres completos de todos los colindantes actuales, número de plano catastrado, medida, tiempo de poseer, modo de adquisición y descripción de los actos posesorios. d) Declaración jurada en escritura pública de todos los colindantes del inmueble en la que indiquen que conocen de la posesión con el colindante, de que no tienen conflicto ni disputa por dicha colindancia o sus mojones, cercas o similares.
En aquellos casos en que el límite sea natural o un camino público no requiere la presentación de declaración. En caso de que el limitante sea una entidad pública, bastará con una nota oficial, por la autoridad que corresponda, en donde se indique lo estipulado en este artículo. Si la colindancia es con un área protegida, solo procederá la presentación de una nota emitida por el Director del Área de Conservación respectiva. e) El Estado a través del Fondo Nacional de Financiamiento Forestal (FONAFIFO) en todos los casos por medio de los mecanismos que este determine, deberá hacer una inspección en el inmueble donde se ejerce la posesión. En aquellas fincas que se encuentren dentro de áreas silvestres protegidas declaradas, deberá presentarse una nota de no objeción por el Director del Área de Conservación respectiva. Cumplidos los anteriores requisitos, FONAFIFO, publicará en el Diario Oficial La Gaceta, durante dos días consecutivos, un edicto, otorgando un plazo de 10 días hábiles para oír oposiciones, de no presentarse ninguna o de rechazarse las presentadas, se firmará el correspondiente contrato.
En caso de que los argumentos del opositor, demuestren un conflicto por el inmueble, el expediente quedará archivado en forma inmediata, y las partes deberán acudir a la vía judicial correspondiente. FONAFIFO, podrá realizar publicaciones agrupadas al menos una vez al mes. Es deber del Fondo Nacional de Financiamiento Forestal mantener un registro actualizado de los proyectos de pago de servicios ambientales aprobados bajo la modalidad de posesión, con la información necesaria para identificación de los mismos, con respaldo de un sistema de información geográfica" (consulta en www.pgr.go.cr el martes 07 de diciembre de 2021). Posteriores decretos ejecutivos regularon el pago por área y precio en dólares o colones así como el procedimiento que debían seguir los interesados en ingresar al Programa de Pago de Servicios Ambientales (puede consultarse los DE N°351459-MINAET Gaceta N°80 del 27 de abril de 2009; DE N°36353-MINAET del 20 de enero de 2011 (estableció el procedimiento); DE N°36516-MINAET Gaceta N°79 del 26 de abril de 2011; DE N°37660-MINAET Gaceta N°27 del 23 de abril de 2013, DE N°38323-MINAET Gaceta N°72 del 14 de abril de 2014, entre otros / consulta en Dirección8837 ).
Descrito el marco legal, es preciso hacer breve referencia a la situación de los parceleros del Asentamiento Osa, explicado en el oficio DAJ-295-2012 del 21 de junio de 2012 que es un estudio y recomendación que la Dirección Jurídica del entonces IDA -hoy INDER- remite a la Junta Directiva de la Institución-. En términos generales y, para efectos de esta resolución, interesa señalar que el Asentamiento Campesino Osa, fue afectado por la creación de la Reserva Forestal Golfo Dulce, traspasando el Estado esos inmuebles al antiguo ITCO; institución que tenía conocimiento de la ocupación de las fincas expropiadas, siendo el objetivo el traspaso de las tierras en atención a la Ley de Tierras y Colonización N°2825. Se hicieron varios traspasos hasta que en 1994 mediante el voto de la Sala Constitucional N°1763 de las 16:45 horas del 13 de mayo de 1994, se suspendieron los procedimientos de adjudicaciones en el Asentamiento Campesino Osa y en el Asentamiento Los Planes de Drake en Sierpe de Osa.
Por otra parte, el pago de servicios ambientales por medio de Nombre28548 fue impulsado en el DE N°30761-MINAE, Gaceta N°191 del 4 de octubre de 2002, ver imágenes 132 a 136 del expediente judicial. De la información que consta en autos, se desprende que el INDER otorgó las constancias a los solicitantes al pago de servicios ambientales, de si era poseedor censado por la Institución, declarado beneficiario o adjudicatario (ver imágenes 145 a 154). Teniendo claro el fundamento normativo del pago de Servicios Ambientales que da origen a la demanda presentada por la parte actora, procede esta Cámara a revisar lo pretendido.
El señor Nombre81933 , indicó en el escrito de demanda, ser "dueño" de un derecho de posesión sin inscribir de montaña y tacotales desde hace más de 60 años, situado en Junta Quebrada, distrito tercero Sierpe, con una medida de 96 ha 5891.76 m2, en el que ha realizado labores de siembra de árboles frutales, protección del bosque y del agua. De acuerdo con los hechos probados primero y segundo, el inmueble que describe el actor se ubica en la Reserva Forestal Golfo Dulce, creada mediante Decreto N°8494 del 1 de junio de 1978 y que, de acuerdo con el Artículo 2° comprende una área de 84 538 Ha I 875 m2 y, los terrenos comprendidos en esa delimitación se declaran inalienables (artículo 3 del Decreto). Actualmente, una de las fincas que lo componen, está inscrita a nombre del Instituto de Desarrollo Rural (INDER) con la matrícula Placa78 "Asentamiento Osa" (consulta www.pgr.co.gr el martes 7 de diciembre de 2021).
Con la presentación de esta demanda pretende la parte actora (escrito del 19 de diciembre de 2019): "1)- Que en sentencia, sea declarado con lugar la presente demanda, en todos los (sic) sus extremos. 2)- que (sic) mi representado está legitimado para interponer la presente demanda, puesto se encuentra debidamente reconocido por el INDER COMO PARCELERO. Que la posesión ejercida, lo ha sido siempre en forma quiete (sic), pública, pacífica, y con exclusión de cualquier otra persona. 3)- Que se instruya en sentencia a la JUNTA DIRECTIVA DEL INDER, que se le otorgue a mi representado la debida autorización para ACCEDER A INCENTIVAR LA FINCA ANTE EL FONDO DE DIVERSIDAD SOSTENIBLE (FBS). 4)- Que con los documentos adjuntos queda demostrado que mi representado en el pasado conto (sic) con la debida autorización de la junta directiva del INDER, al igual que otros parceleros, que sus tierras que son un derecho de posesión y no están con escritura, y con la autorización de la junta directiva del INDER, puedan incentivar en el programa FONDO DE DIVERSIDAD SOSTENIBLE (FBS).
Hoy su autoridad es requisito para solicitar y que le brinden dicho incentivo por cinco años, ante el FONDO DE DIVERSIDAD SOSTENIBLE (FBS) ES CONTAR CON EL VISTO BUENO Y AUTORIZACIÓN DEL INDER. 5) que (sic) en sentencia sea ratificado que la documentación adjunta queda demostrado que mi representado en otros años conto (sic) con la debida autorización al igual que otros parceleros la debida autorización para incentivar la finca por medio de la Junta Directiva del INDER." (imágenes 40 a 45 y 55 a 57 del expediente judicial). De los extremos petitorios de la demanda, cuya redacción es necesario advertir es confusa, puede deducirse que se orientan a una conducta de hacer por parte del INDER, que le permita al actor gestionar el pago por servicios ambientales, ante las autoridades administrativas respectivas (FONAFIFO). No hay pretensión de nulidad ni de revisión de conducta administrativa, entendiendo este Colegio que lo pretendido corresponde a lo señalado en el numeral 42 inciso g) del CPCA "Que se condene a la Administración a realizar cualquier conducta administrativa específica impuesta por el ordenamiento jurídico".
Para ello, se revisará una a una las pretensiones, según se expondrá. Veamos: "1)- Que en sentencia, sea declarado con lugar la presente demanda, en todos los (sic) sus extremos. No es técnicamente una pretensión, se omite pronunciamiento por inane. La pretensión segunda: "2)- que (sic) mi representado está legitimado para interponer la presente demanda, puesto se encuentra debidamente reconocido por el INDER COMO PARCELERO. Que la posesión ejercida, lo ha sido siempre en forma quiete (sic), pública, pacífica, y con exclusión de cualquier otra persona". Pretende el actor, la declaratoria de parcelero; aseveró en el escrito de demanda es dueño de un derecho de posesión sin inscribir por más de sesenta años, que ha mantenido de forma pública, pacífica, ininterrumpida, que ha realizado actos de limpieza, siembra de árboles frutales, cuido del bosque y del agua. Describe el inmueble con el número de plano P-uno uno dos ocho cuatro-dos mil siete con una medida de noventa y seis hectáreas, cinco mil ochocientos noventa y un metros con setenta y seis decímetros cuadrados; ubicado en "Dirección8838 , , Osa de la Provincia de Puntarenas, colindancias actuales Norte: Nombre81936 , Ganadera Guayacán de Ceibo Sociedad Anónima y Dirección336 , Sur: Nombre81937 y Quebrada de por medio.
Este: Nombre81938 y Dirección336 Oeste: Nombre81939 . A pesar de que el actor no lo señala ni identifica expresamente, por la información suministrada por el INDER (hechos probados primero y segundo), el actor figura -según registros de la institución demandada-, como ocupante de la parcela N°28 del Asentamiento Osa, Sector El Progreso, que es parte de la finca Folio Real, Matrícula Placa13266, propiedad del Instituto de Desarrollo Rural. Esa finca, se encuentra afectada en su totalidad por la Reserva Forestal Golfo Dulce, creada mediante Decreto Ejecutivo 8494-A del 28 de abril de 1978, publicado en el alcance número 92 de la Gaceta Número 104 del 01 de junio de 1978; lo que la constituye como Patrimonio Natural del Estado, establecido así en los artículos 13, 14 y 15 de la Ley Forestal, N°7575. En la certificación INDER-GG-DRT-FT-IRT-0197-2020, emitida por el Área de Información de Registro de Tierras se indicó, "la ubicación cartográfica consignada en el plano catastrado P-un millón ciento veintiocho mil cuatrocientos veinte cuatro - dos mil siete, situado en el distrito Sierpe, cantón Osa, provincia Puntarenas, que este (sic) describe un inmueble que TRASLAPA con el asentamiento Osa Productos Forestales administrado por el INDER y la Reserva Forestal Golfo Dulce, según montaje que se adjunta; lo anterior en tanto que el predio esté correctamente ubicado por el profesional responsable" (imágenes 126 a 130 del expediente judicial), información que consta en el expediente administrativo que la oficina de Desarrollo Territorial de Osa lleva del Asentamiento Osa, Sector El Progreso de Drake y que, no ha sido desvirtuada ni ha negado el actor.
La Sala Constitucional ha definido los inmueble de naturaleza demanial, como“...aquellos que tienen una naturaleza y régimen jurídico diverso de los bienes privados –los cuales se rigen por el derecho de propiedad en los términos del artículo 45 de la Constitución Política–, en tanto, por expresa voluntad del legislador se encuentran afectos a un destino especial de servir a la comunidad, sea al interés público, y que por ello, no pueden ser objeto de propiedad privada, de modo que están fuera del comercio de los hombres, por lo cual, no pueden pertenecer individualmente a los particulares, ni al Estado, en sentido estricto, por cuanto éste se limita a su administración y tutela. […] Así, se trata de bienes cuya titularidad ostenta el Estado en su condición de administrador, debe entenderse que se trata de bienes que pertenecen (sic) la "Nación", con lo cual, conforman parte del patrimonio público; y que, por su especial naturaleza jurídica, presentan los siguientes atributos: son imprescriptibles, lo cual implica que por el transcurso del tiempo, no puede adquirirse el derecho de propiedad sobre ellos, ni siquiera de mera posesión, es decir, no pueden adquirirse mediante la usucapión, así como tampoco pueden perderse por prescripción; motivo por el cual los permisos de uso que la Administración conceda sobre ellos, siempre tienen un carácter precario, lo cual hace que puedan ser revocadas por motivos de oportunidad o conveniencia en cualquier momento por la Administración -en los términos previstos en los artículos 154 y 155 de la Ley General de la Administración Pública-; y las mismas concesiones que se otorguen sobre ellos para su aprovechamiento, pueden ser canceladas, mediante procedimiento al efecto; son inembargables, que hace que no pueden ser objeto de ningún gravamen o embargo, ni por particulares, ni por la Administración; y son inalienables, lo que se traduce en la condición de que están fuera del comercio de los hombres; de donde no pueden ser enajenados, vendidos o adquiridos, ni a título gratuito ni oneroso, ni por particulares, ni por el Estado, de modo que están excepcionados del comercio los hombres y sujetos a un régimen jurídico especial y reforzado.
Además su uso y aprovechamiento está sujeto al poder de policía, en tanto, por tratarse de bienes que no pueden ser objeto de posesión, y mucho menos de propiedad, su utilización y aprovechamiento es posible únicamente a través de actos debidamente autorizados, sea mediante concesión o permiso de uso, otorgado por la autoridad competente; y al control constante de parte de la Administración Pública. De manera que comprende bienes inmuebles que tienen una naturaleza y régimen jurídico virtualmente opuesto a la propiedad privada, que deriva de lo dispuesto en el artículo 45 constitucional” (voto 2007-2408 de las 16 horas 13 minutos del 21 de febrero de 2007, agregado el énfasis). El inmueble descrito en el hecho probado N°1, corresponde a un bien que es propiedad del INDER, que pertenece a la Reserva Forestal Golfo Dulce, está protegido por el régimen especial de protección que tienen los bienes demaniales; ni la parte actora ni otra persona pueden alegar titularidad ni posesión legítima o tener un mejor derecho respecto del mismo, al ser el terreno un bien de dominio público, toda discusión orientada a tenencia u ocupación resulta improcedente legalmente y, como pretensión inadmisible, al carecer de legitimación activa para pretender un derecho sobre esos terrenos, según se explica en la jurisprudencia de cita.
Respecto al extremo petitorio: "3)- Que se instruya en sentencia a la JUNTA DIRECTIVA DEL INDER, que se le otorgue a mi representado la debida autorización para ACCEDER A INCENTIVAR LA FINCA ANTE EL FONDO DE DIVERSIDAD SOSTENIBLE (FBS)". Al respecto es preciso indicar que, como conducta de hacer que pretende el actor, ésta debe orientarse y someterse a que el ordenamiento jurídico la imponga a la Administración demandada y que se encuentre su imposición dentro de los parámetros de legalidad. El actor, presentó en el año 2019 al INDER: "...solicitud COMO UNA PRIMERA VEZ DICHA AUTORIZACIÓN PARA, INGRESAR AL FONDO DE BIODIVERSIDAD SOSTENIBLE (FBS) DEL PROGRAMA DE CONSERVACIÓN DE LA BIODIVERSIDAD (PBC)...". En atención a la gestión, se realizó una visita de inspección a la parcela N°28 por funcionarios del INDER de la Oficina Territorial de Osa, visita que tuvo lugar el 07 de mayo de 2019, evidenciando que el señor Nombre81933 no habita la parcela en razón de que no vive en la zona.
Aunado a lo indicado, se consideró que se trata de un terreno afectado en su totalidad por la Reserva Forestal Golfo Dulce y que, constituye Patrimonio Natural del Estado, razones que fundamentan la no recomendación para el pago de servicios ambientales (ver hecho probado N°6). En ese mismo sentido, y según se indicó en el hecho probado N°8, el 09 de agosto de 2019, se llevó a cabo otra visita a la parcela N°28. En esa ocasión, funcionarios del INDER, corroboraron que en el lugar no vive nadie, que hay como una hectárea limpia y en apariencia le pegaron fuego y la hierba natural ya estaba creciendo, que se observaron escombros de lo que fue una casa de habitación de madera quemada, seis matas de palma de aceite, un árbol de mango adulto, unas sepas de cuadrado, matas de yuca en crecimiento, en la parte alta una cerca en mal estado. El resto del terreno está cubierto por bosque secundario.
Al respecto, es necesario señalar que, la parte actor no niega tal situación, sino que en el escrito de conclusiones advirtió que es otra persona la que en los últimos dos años ha dado mantenimiento a la finca, a los bosques, a la conservación de la flora y fauna, por lo que niega que el terreno esté abandonado y, pidió al Tribunal, se realice una visita de campo; gestión improcedente en este estadio procesal, pero que denota la ausencia de interés de la parte actora en acreditar que como ocupante de la parcela N°28 sí vive ahí. Incumpliendo con ello el deber que le impone el artículo 41.1 del Código Procesal Civil "Incumbe la carga de la prueba: 1. A quien formule una pretensión, respecto de los hechos constitutivos de su derecho". Hay una omisión del accionante en intentar desvirtuar la situación fáctica del inmueble y la no presencia de la parte actora en la parcela, según lo certificado por los funcionarios del INDER, que expresamente señalan que el actor no vive en la parcela N°28 sobre la que pretende el incentivo por Pago de Servicios Ambientales y que la misma está sin atención y cuidados debidos.
La parte actora, no impugna tal decisión administrativa. Lo que pretende es que el Tribunal instruya a la Junta Directiva del INDER para que otorgue lo que denomina autorización, que es como se indicó, una certificación de su condición de ocupante, beneficiario o adjudicatario que le permita cumplimentar otra serie de requisitos ante el Nombre28548 para optar por el incentivo del Pago por Servicios Ambientales. Lo pretendido es improcedente. La pretensión de hacer que este Tribunal puede imponer a una Administración está supeditada a que esté contemplada por el ordenamiento jurídico. El actor presentó una gestión ante el INDER, que le fue rechazada; sin embargo no impugnó la legalidad de ese acto administrativo, con lo cual el mismo es válido y eficaz. Con lo pretendido, se busca que el Tribunal sustituya a la Administración, lo que resulta inatendible. Corolario de lo expuesto, la pretensión tres, es abiertamente contrario a las competencias de esta jurisdicción, resultando improcedente lo pedido y así se declara.
Los extremos petitorios 4 y 5 por ser prácticamente iguales, se revisan conjuntamente: "4)- Que con los documentos adjuntos queda demostrado que mi representado en el pasado conto (sic) con la debida autorización de la junta directiva del INDER, al igual que otros parceleros, que sus tierras que son un derecho de posesión y no están con escritura, y con la autorización de la junta directiva del INDER, puedan incentivar en el programa FONDO DE DIVERSIDAD SOSTENIBLE (FBS). Hoy su autoridad es requisito para solicitar y que le brinden dicho incentivo por cinco años, ante el FONDO DE DIVERSIDAD SOSTENIBLE (FBS) ES CONTAR CON EL VISTO BUENO Y AUTORIZACIÓN DEL INDER. 5) que (sic) en sentencia sea ratificado que la documentación adjunta queda demostrado que mi representado en otros años conto (sic) con la debida autorización al igual que otros parceleros la debida autorización para incentivar la finca por medio de la Junta Directiva del INDER".
Adujo el actor en la demanda, fue autorizado por el IDA en el pasado para recibir el beneficio del pago por servicios ambientales. Consta en el expediente administrativo aportado por el INDER que mediante oficio OSO-423-2013 del 11 de setiembre de 2013 (hecho probado N°3) el acuerdo de Junta Directiva, Artículo 78 de la Sesión Ordinaria 015-2013, celebrada el 29 de abril de 2013, se autorizó a los poseedores solicitantes de ingreso al Pago de Servicios Ambientales, ubicados en la Reserva Forestal Osa, para que puedan ingresar sus fincas al programa de servicios ambientales 2013, y entre ellos al actor. No obstante, no acreditó el actor -faltando una vez más con ello a la obligación impuesta por el numeral 41.1 del Código Procesal Civil- que recibiera pago alguno. Debe considerarse que, al amparo del artículo 9 de la Ley N°8640 del 05 de junio de 2008 "Aprobación del Contrato de Préstamo N°7388-CR y sus anexos entre la República de Costa Rica y el Banco Internacional de Reconstrucción y Fomento (BIRF)", se autorizó al Nombre28548 para que pague servicios ambientales en la modalidad de protección de bosque, a los poseedores de bosques en las áreas prioritarias establecidas por el Sinac y que fue mediante DE Nº30761-MINAE, del 23 de agosto de 2002, que se adicionó el artículo 107 al Reglamento a la Ley Forestal, Decreto Ejecutivo número 25721-MINAE del 17 de octubre de 1996, en el que se definían los requisitos que debían presentar quienes optaran por el programa de Pago de Servicio Ambientales, destacando el inciso "b) Carta de Venta Protocolizada ante Notario Público con fecha cierta de la adquisición del inmueble, si este fuese el modo de adquisición o poseedores censados por el Instituto de Desarrollo Agrario, declarados beneficiario y adjudicatarios".
Por lo que, no puede verificarse la materialización del pago por tal incentivo, como lo afirma el actor, más allá de su aseveración, la que se respeta pero se insiste, carece de comprobación fáctica. Si en el pasado el INDER otorgó la certificación, ello no es razón para que ante la gestión presentada en el año 2019, y que el mismo actor manifestó: "...solicitar COMO UNA PRIMERA VEZ DICHA AUTORIZACIÓN PARA, INGRESAR AL FONDO DE BIODIVERSIDAD SOSTENIBLE (FBS) DEL PROGRAMA DE CONSERVACIÓN DE LA BIODIVERSIDAD (PBC)..." (hecho probado N°7) se deba otorgar nuevamente. El INDER, al amparo de la Ley N°8640 y del DE N°25721-MINAE del 17 de octubre de 1996, debe certificar la condición de ocupante, adjudicatario o beneficiario de quien desea optar por el incentivo del pago por servicios ambientales, pero es solo uno de los requisitos que le impone el ordenamiento. En autos ni siquiera consta que la parte actora haya presentado gestión alguna ante el FONAFIFO, órgano que es quien por disposición legal autoriza el pago.
A lo señalado, debemos agregar que en la gestión presentada en el año 2019, la misma parte actora señaló que se trata de la primera vez que presenta la solicitud, que como se indicó previo, no es otra cosa que una certificación de la condición de ocupante, poseedor o beneficiario que da el INDER. Por las razones expuestas, lo señalado como pretensión segunda, resulta inadmisible por carecer de legitimación activa para pretender un derecho sobre un bien cuya naturaleza es demanial, según se ha verificado en este proceso (hechos probados 1 y 1) y, los extremos petitorios del tres al cinco improcedentes, con lo cual se impone el rechazo de la demanda en todos sus extremos.
El INDER opuso las excepciones de pago, la que debe ser rechazada, al no girar el objeto de este proceso respecto de pago alguno. Alegó, falta de legitimación activa y pasiva. A la luz de lo expuesto, concluye este Tribunal, el señor Nombre81933 , no tiene legitimación ad causam para pretender se le reconozca un derecho sobre un inmueble que pertenece al patrimonio forestal del Estado y por ello su naturaleza es demanial. Legitimado en la causa es quien puede exigir que se resuelvan las peticiones hechas en la demanda, es decir, la existencia o no del derecho material que se pretende, por medio de sentencia favorable o desfavorable. Por ende, cuando alguna de las partes no tiene esa legitimación el juzgador no puede adoptar una decisión de fondo, encontrándose inhibido para ello. Dispone el artículo 10 del Código Procesal Contencioso Administrativo: ”1) Estarán legitimados para demandar: a) Quienes invoquen la afectación de intereses legítimos o derechos subjetivos...".
De conformidad con la anterior norma, sólo podría demandar quien tenga un título habilitante por acto administrativo, norma o contrato para sustentar lo que alega como su derecho frente a terceros o frente a una determinada situación subjetiva y al carecer de ello, como está acreditado en autos, no le ampara legitimación alguna y por ende se declara la inadmisibilidad de la demanda respecto de la pretensión segunda. Respecto de las pretensiones tres a cinco se acoge la falta de derecho opuesta por el INDER, por las razones expuestas.
Por expresa disposición del artículo 193 del Código Procesal Contencioso Administrativo, el pronunciamiento sobre las costas del proceso debe hacerse de oficio, condenando al vencido a su reconocimiento. La condenatoria se impone al perdidoso por el hecho de serlo. Es decir, por perder el litigio. La parte actora resultó vencida, procede condenarla al pago de ambas costas de esta acción, sin que medien razones que justifiquen su exoneración conforme los incisos a) y b) del numeral 193 citado. Las costas generarán intereses una vez que sea determinado y exigible su monto.
POR TANTO
Se rechaza la excepción de pago. Se acoge la excepción de falta de derecho respecto de las pretensiones tres a cinco. Se acoge la excepción de falta de legitimación activa respecto de la pretensión número dos. Consecuentemente se declara inadmisible la pretensión segunda e improcedentes los demás extremos petitorios de la demanda del señor Nombre81933 contra el INDER. Se condena a la parte actora y vencida, al pago de ambas costas, así como sus respectivos intereses al tipo legal, extremos que se liquidarán en ejecución de sentencia. Notifíquese.
