SECOND JUDICIAL CIRCUIT OF SAN JOSÉ, Dirección200 . , at eight twenty-five in the morning on ocho de diciembre del año dos mil veintiuno. - This Court, acting in its capacity as the non-hierarchical reviewer of legality (contralor no jerárquico de legalidad), hears the appeal filed by Nombre106648, holder of identity card CED83876, against resolution N°101-ALC-2019 issued by the Office of the Mayor of El Guarco, which upheld closure order N°2808 concerning construction without a municipal license. - Judge Chaves Torres drafting; and,
WHEREAS.
I.Background. For purposes of rendering a decision, the following is deemed duly established:
II.Merits. As a preliminary matter, it is considered important to clarify that, by legal mandate, this instance conducts only a review of legality (control de legalidad) regarding the formal actions of municipal authorities—the Mayor’s Office or Municipal Council—and that the appeal constitutes the limit of the Court’s jurisdiction; accordingly, it is at the request of the party who considers itself dissatisfied with the decision, and through its specific prayer for relief, that this Chamber proceeds to analyze the matter in order to determine whether or not the decision is consistent with law. This oversight function is thus grounded in the prior statement of the specific and precise grounds of grievance, which delimit the review of the decision, without the Court being able to address matters other than those claimed or rule on grievances not raised. Therefore, in its role as Reviewer of Legality, this Judicial Court is restricted to examining the claims submitted and may consider only the points that are the subject of the challenge—181 of the General Law of Public Administration—without being able to conduct an ex officio review of the Municipal Body’s decision when the appeal lacks supporting arguments.
It is therefore an indispensable requirement that the appellant formulate the appeal clearly and precisely and outline the objections maintained against the challenged ruling, being required to set forth transparently the alleged errors in the decision or resolution being challenged, so that the appeal is self-contained and fully comprehensible, expressly identifying the violations allegedly committed therein. In this regard, despite the complaint of delay in administrative justice against the Mayor’s Office, the appellant merely sets forth a single grievance on which she bases her request to have the challenged decision declared null and void. The appellant states that the decision under appeal is contrary to law regarding the requirements that must be met to carry out minor works (obras menores), because in her case they do not exceed the minimum monetary threshold for that type of work.
She adds that the work was shut down without sufficient technical grounds, disregarding the Municipality’s own building regulations, which establish that an improvement such as the one she intends to carry out does not require construction or electrical plans, but only a sketch, a requirement she has met. She alleges that the provisions of the regulations invoked in the decision under appeal apply to new works or improvements having a value greater than that established in the regulations. Court’s Assessment. Upon conducting a thorough review of decision N° 101-ALC-2019 in comparison with the appeal filed by Ms. Nombre106648 , this Chamber considers it appropriate to identify at least four matters on which the Mayor of El Guarco ruled: first, the shutdown ordered by his subordinate under N°2808 against the construction project was affirmed; second, the improvements that the appellant intends to make to her property were again classified as minor works; third, she was ordered to process the municipal building permit (licencia municipal constructiva) in order to regularize the property’s status; and fourth, the municipal authority ordered the woman to meet the following requirements: “...submit a sketch of the work to be performed, complete the form, submit the consent of all co-owners, and comply with the other formalities required by law and regulations...”; regarding this last point, it is important to note that the appeal brief does not disclose any grievance specifically contesting it.
Now, concerning shutdown order N°2808 issued by the Municipality of El Guarco and affirmed in the decision challenged herein, this Chamber considers it necessary to provide the context that this order arises from the exercise of the Municipal Administration’s police power (Poder de Policía), a concept etymologically defined as the “...set of rules imposed upon citizens so that order, tranquility, and security may prevail within a social body. Police power, for its part, is a foreign expression of a political-administrative nature and European origin, developed and disseminated through the decisions of the Supreme Court of the United States of America (police power), through which it was incorporated into our judicial and doctrinal language, and refers to the regulatory, rulemaking, and co-legislative authority of the legislative and executive bodies, in accordance with the powers assigned by the National Constitution...”.

In local land-use law (derecho urbanístico), it consists of the authority to impose public-order regulations on a property owner’s ownership rights, as an expression of the principle that the general interest prevails over the individual interest. Therefore, once the absence of a municipal building permit is confirmed, the Municipality’s duty under sections 63, 88, 96 of the Construction Law is to order the shutdown of the construction process so that the owner may regularize the legal status of the property, as occurred in the present case with Ms. Nombre106648 ’s property. It is important to emphasize here that, since decision N°052-ALC-2018, the Mayor’s Office had informed Ms. Nombre106648 that her construction process was considered minor work and that she was required to meet the requirements for obtaining a municipal permit, except for construction plans signed by a responsible professional; in their place, she was required to provide only a sketch of the work to be performed, a determination affirmed in the now-challenged act N°101-ALC-2018, precisely as the appellant seeks in her appeal.
In other words, there is no dispute on this point; therefore, the Court must refrain from any analysis thereof. Furthermore, regarding the regulatory basis relied upon by the Mayor’s Office in the decision under appeal, this Chamber observes from a simple reading of the act that it is based on section 9.1 of the Partial Zoning Plan (Plan Regulador Parcial) for the Canton of El Guarco and section 83 bis of the (pre-constitutional) Construction Law N° 833. This makes the final proposition set forth in the appellant’s grievance incomprehensible, since she refers to an erroneous application of regulatory provisions because she believes that there is a limit based on the monetary value of the construction that exempts her, without providing any further explanation in that regard. Undoubtedly, the party’s argument is incomplete; that is, it is impossible to ascertain exactly what the alleged error consists of or how it adversely affects her legal position.
Consequently, in light of the cited section 181 of LGAP, this Non-Hierarchical Reviewer of Legality is unable to conduct an ex officio analysis of that assertion. Nevertheless, it must be clarified that the provisions invoked by the Mayor’s Office do not distinguish construction processes involving “minor works” on the basis of their monetary value. Moreover, section 9.1 of the Zoning Plan for the Canton of El Guarco and section 83bis of the Construction Law respectively provide as follows:
“9.1 Permit exception for small-scale works. Improvements, maintenance, or safety work on real property that is classified as small-scale and performed on the exterior of buildings shall be exempt from the permit requirement, provided that such work does not alter their area or morphology, including: installation of gutters and downspouts, construction and repair of sidewalks, installation of fences, grilles, steel shutters, and air-conditioning, clearing the topsoil layer from land, replacement of roof coverings measuring less than 30 m2, and fencing of property. For this type of work, the interested party must submit written notice to the Urban Planning Directorate of the Municipality of El Guarco for the corresponding oversight and scheduling coordination. At a minimum, that document shall contain the interested party’s declaration of responsibility for any damage that such work may cause to third parties.” “Article 83 bis- Permit for minor works.
Any person may carry out repairs, renovations, additions, and other minor works on their own behalf or for third parties, without requiring the authorization of the professional referred to in article 83 of this law, provided that such work does not exceed the equivalent of ten base salaries, calculated in accordance with article 2 of Ley N.º 7337, de 5 de mayo de 1993; however, that person must obtain the permit issued by the corresponding municipal unit, which shall be required to oversee the work for which it authorized the permit. The conditions governing this type of construction shall be regulated by minor-works building regulations issued by the respective municipality. Such regulations shall take into account the protection of property, public health, and the human and animal life that will make use of it, absolute respect for environmental sustainability, and all regulations that the municipality deems appropriate in pursuit of comprehensive development that guarantees the individual and collective right to a healthy and balanced environment.
Construction work that, according to the specialized technical judgment of the competent municipal official, includes modifications to a building’s structural, electrical, or mechanical system that endanger the safety of its occupants shall not be considered minor work. If, within twelve months from the issuance of a minor-works permit authorizing repairs, renovations, additions, and other minor works, new applications for minor work on the same property are submitted, the municipality shall, following an inspection, deny the new permit if it determines that a major project is being divided into smaller parts to evade the corresponding controls, without prejudice to the interested party’s right to apply for a construction permit in accordance with article 83 of this law.” Finally, it should be emphasized that, in light of section 2 of the Construction Law currently in force, which provides: “Scope of this Law.
This law applies throughout the Republic.”, this Court considers the Mayor’s Office’s conclusion concerning the requirement of a building permit for minor work to be correct. Because every aspect of the grievance asserted by the appellant has been rejected, her appeal must be denied, and the administrative remedies (vía administrativa) deemed exhausted. This is without prejudice to reiterating that no ruling is made on the lawfulness or unlawfulness of the specific requirements imposed in the decision under appeal, in strict adherence to section 181 of LGAP.
III.Copy of the case file and return of documents. Because the proceedings before this body were conducted electronically, the parties may obtain a complete copy containing both the administrative case file submitted by the Municipal Corporation and all documents comprising this appeal, for which purpose they must provide an electronic storage device (USB flash drive or compact disc). Likewise, if physical or electronic documentation (plans, photographs, reports, etc.) was submitted and remains in the custody of the Court Office, the person who submitted it may retrieve it within 30 business days, in accordance with article 12 of the «Reglamento sobre Expediente Electrónico ante el Poder Judicial», approved by the Full Court at session n.° 27-11 del 22 de agosto del 2011, article XXVI and published in the Boletín Judicial n.° 19 del 26 de enero del 2012, as well as the resolution approved by the Superior Council of the Judiciary at session n.° 43-12 celebrada el 3 de mayo del 2012, article LXXXI.

SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ, Dirección200 . , a las ocho horas veinticinco minutos del ocho de diciembre del año dos mil veintiuno. - Conoce este Tribunal en su función de contralor no jerárquico de legalidad, del recurso de apelación interpuesto por Nombre106648 , portadora de la cédula de identidad CED83876, contra la resolución N°101-ALC-2019 dictada por la Alcaldía Municipal del Guarco, mediante la cual se confirma la orden de clausura N°2808 con construcción sin licencia municipal. - Redacta el juez Chaves Torres; y,
CONSIDERANDO.
I.Antecedentes. Para decidir, se tiene como debidamente acreditado lo siguiente:
II.Sobre el fondo. De previo se considera importante aclarar, que, en esta instancia por mandato legal se desarrolla únicamente un control de la legalidad sobre la actuación formal de los jerarcas municipales -Alcaldía o Concejo Municipal-, siendo que el recurso se constituye en el límite de la competencia del Tribunal, de forma tal que es a instancia de la parte que se considera inconforme con la resolución y a través de su ruego específico, que esta Cámara procede a su análisis a los efectos de determinar si se encuentra o no ajustada a derecho. Esa función contralora así, encuentra sustento en la exposición previa de los motivos concretos y precisos del agravio, los cuales, delimitan el examen de lo resuelto sin que sea posible al Tribunal abarcar aspectos diversos a los reclamados ni resolver sobre agravios no deducidos. Por ello, este Tribunal Judicial en su función de Contralor de Legalidad, se restringe al estudio de los cargos sometidos y solo podrá conocer de los puntos objeto del reclamo -181 de la Ley General de la Administración Pública-, sin poder verificar un examen oficioso de lo decidido por el Órgano Municipal ante carencias argumentativas del recurso.
Se impone como requisito indispensable entonces, que el recurrente formule en forma clara y precisa el recurso, que esboce los reparos que mantiene contra el pronunciamiento impugnado, quedando obligado a exponer en forma diáfana, los errores acusados en la resolución o acuerdo a impugnar, para que se baste a sí mismo en cuanto a su cabal entendimiento, con expresa indicación de las infracciones que acusa como cometidas por aquél. En este sentido, pese al reclamo por retardo de justicia administrativa contra la Alcaldía, la apelante se limita a exponer solamente un agravio sobre el que fundamenta la solicitud de nulidad de la resolución impugnada. Señala la apelante que la resolución recurrida le resulta contraria a derecho sobre los requisitos a cumplir para realizar obras menores, dado que en su caso no superan el mínimo de la cuantía de dicho tipo de obras. Agrega que se le clausura sin mayor criterio técnico desconociendo su propio reglamento constructivo, que establece que una mejora como la que intenta realizar no requiere plano constructivo o eléctrico, solo un croquis, lo cual ha cumplido.
Acusa que las invocaciones al reglamento efectuadas en la resolución apelada, son aplicables para obras nuevas o mejoras con un valor superior a lo que establece el reglamento. Criterio del Tribunal. Al realizar un estudio minucioso de la resolución apelada N° 101-ALC-2019 en contraste con el recurso de apelación presentado por la señora Nombre106648 , esta Cámara considera oportuno reconocer al menos cuatro aspectos sobre los cuales el señor Alcalde del Guarco emite pronunciamiento, es decir, primero se ratifica la clausura decretada por su inferior N°2808 contra el desarrollo constructivo; segundo es nuevamente calificada de obra menor las mejoras pretendidas realizar por la apelante a su inmueble; tercero se ordena tramitar la licencia municipal constructiva para regularizar la situación del inmueble; y cuarto la autoridad municipal le ordena a la señora cumplir con los siguientes requisitos: “...presentar un croquis de las obras a realizar, llenar formulario, presentar el consentimiento de todos los copropietarios y demás formalidades de ley y reglamentos...”, sobre este último punto es importante señalar que en el libelo recursivo no se desprende agravio que le contradiga puntualmente.
Ahora bien, en relación a la clausura girada por el Municipio del Guarco N°2808, confirmada en la resolución aquí impugnada, esta Cámara considera necesario contextualizar que dicha orden obedece al ejercicio del Poder de Policía de la Administración Municipal, concepto que es definido en forma etimológica como el “...conjunto de reglas impuestas al ciudadano para que reine el orden, la tranquilidad y la seguridad dentro de un cuerpo social. Por su parte, poder de policía es una expresión foránea, de naturaleza político-administrativa y origen europeo, desarrollada y difundida por los fallos de la Corte Suprema de los Estados Unidos de Norteamérica (police power), a través de los cuales se incorporó a nuestro lenguaje judicial y doctrinario, y alude a la capacidad regulatoria y reglamentaria, y colegislativa del órgano legislativo y del órgano ejecutivo, conforme las competencias asignadas por la Constitución Nacional...”.

Por ello, al confirmarse la falta de licencia municipal constructiva, el deber municipal a la luz del ordinal 63, 88, 96 de la Ley de Construcciones es imponer la clausura del proceso constructivo a fin que el propietario regularice la situación jurídica de su inmueble, tal y como sucedió en el presente caso con la propiedad de la señora Nombre106648 . Aquí es importante resaltar que desde la resolución N°052-ALC-2018, la Alcaldía Municipal le había indicado a la señora Nombre106648 que su proceso constructivo es considerado como obra menor y debía cumplir con los requisitos para la obtención de la licencia municipal, con excepción de los planos constructivos firmados por un profesional responsable; y en su lugar le previno únicamente un croquis de las obras a realizar, situación que se ratifica en el acto ahora impugnado N°101-ALC-2018; tal y como lo pretende la apelante en su recurso, es decir, sobre este punto no existe contradictorio, ergo, se impone obviar cualquier análisis del Tribunal al respecto.
Por otra parte, y en relación al respaldo normativo utilizado por la Alcaldía en la resolución apelada; esta Cámara advierte de una simple lectura del acto, que se fundamenta en el ordinal 9.1 del Plan Regulador Parcial para el Cantón del Guarco y el 83 bis de la Ley de Construcciones (preconstitucional) N° 833; esta razón hace incomprensible la última idea expuesta en el agravio por la señora recurrente, toda vez que se hace mención a una errónea aplicación de normas reglamentarias dado que considera existencia de un límite sobre la cuantía de la edificación que le exonera, sin mayor explicación al respecto. Indubitablemente, queda inconcluso el argumento de la parte, es decir, se ignora exactamente en que consiste dicho error y como le perjudica a su situación jurídica. Por consiguiente, a la luz del citado numeral 181 de LGAP, este Contralor no Jerárquico de Legalidad se ve imposibilitado para realizar un análisis oficioso sobre dicha expresión; no obstante, es menester aclarar que las normas invocadas por la Alcaldía no discriminan los procesos constructivos “obras menores” en razón de la cuantía; a mayor abundamiento el numeral 9.1 del Plan Regulador para el Cantón del Guarco y 83bis de la Ley de Construcciones disponen respectivamente lo siguiente:
“9.1 Excepción de licencia para obras de pequeña magnitud. Se exceptúan de la obligatoriedad de licencia, las obras de mejoras, mantenimiento o seguridad en los inmuebles, que se catalogan como de pequeña magnitud, que se realicen en el exterior de las edificaciones, siempre que éstas no varíen su área ni morfología, tales como: instalación de canoas y bajantes, construcción y reparación de aceras, instalación de verjas, rejas, cortinas de acero, aire acondicionado, limpieza de terreno de capa vegetal, cambio de cubierta de techo menores a 30 m2, y cercado de propiedad. Para este tipo de obras el interesado deberá hacer una comunicación por escrito ante la Dirección de Urbanismo de la Municipalidad de El Guarco para su respectivo control y coordinación horaria, documento que contendrá como mínimo su declaración de responsabilidad en cuanto daños que se puedan causar a terceros, producto de dichas obras.” “Artículo 83 bis- Permiso para obras menores.
Toda persona puede hacer reparaciones, remodelaciones, ampliaciones y otras obras de carácter menor, por cuenta propia o de terceros, sin necesidad de contar con la autorización del profesional contemplado en el artículo 83 de la presente ley, siempre y cuando dichas obras no excedan el equivalente a diez salarios base, calculado conforme a lo dispuesto en el artículo 2 de la Ley N.º 7337, de 5 de mayo de 1993, pero deberá contar con la licencia expedida por la unidad municipal correspondiente, la cual tendrá la obligación de vigilar las obras para las que haya autorizado la licencia. Las condiciones para ese tipo de construcción deberán estar reguladas por un reglamento de construcción de obras menores, emitido por la municipalidad respectiva. Esta reglamentación considerará la protección de la propiedad, la salud pública, la vida humana y animal que lo utilizarán, el respeto absoluto de la sostenibilidad ambiental y todas las regulaciones que considere el municipio, en función del desarrollo integral que garantice el derecho a un ambiente sano y equilibrado, individual y colectivo.
No se considerarán obras menores las obras de construcción que, según el criterio técnico especializado del funcionario municipal competente, incluyan modificaciones al sistema estructural, eléctrico o mecánico de un edificio, que pongan en riesgo la seguridad de sus ocupantes. Si dentro del plazo de doce meses, contado a partir del otorgamiento de un permiso de obra menor, que establezca realizar reparaciones, remodelaciones, ampliaciones y otras obras de carácter menor, se presentan nuevas solicitudes de obra menor sobre un mismo inmueble, la municipalidad, previa inspección, denegará el nuevo permiso si se determina que una obra mayor está siendo fraccionada para evadir los respectivos controles, sin perjuicio de que el interesado pueda solicitar el permiso de construcción, conforme a lo dispuesto en el artículo 83 de esta ley.” Finalmente, cabe resaltar que a la luz del ordinal 2 de la Ley de Construcciones vigente, que establece: “Alcance de esta Ley.
Esta ley rige en toda la República.”; este Tribunal considera correcta la conclusión de la Alcaldía sobre el requerimiento de la licencia constructiva para obra menor. Al haberse rechazado cada uno de los extremos del agravio expuesto por la apelante, se impone declarar sin lugar su recurso de apelación; y dar por agotada la vía administrativa. No sin antes reiterar que se omite pronunciamiento sobre la licitud o ilicitud de los requisitos específicos prevenidos en la resolución apelada, ello en estricto apego del ordinal 181 de LGAP.
III.De la copia del expediente y devolución de documentos. Al haberse sustanciado esta sede en forma electrónica, queda a disposición de las partes obtener una copia integral que contiene tanto el expediente administrativo remitido por la Corporación Municipal, así como la totalidad de las piezas que conforman la presente alzada, para lo cual deberá aportar el dispositivo electrónico de almacenamiento (llave maya o disco compacto). Asimismo, en caso que hubiere ingresado documentación física o electrónica (planos, fotografías, informes, etc) que permanezca aún en custodia el Despacho, podrá retirarla quien la aportó en un plazo de 30 días hábiles, de conformidad con lo dispuesto en el artículo 12 del «Reglamento sobre Expediente Electrónico ante el Poder Judicial», aprobado por la Corte Plena en sesión n.° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial n.° 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión n.° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
POR TANTO
