SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- At eleven hours and six minutes on the twenty-sixth of April, two thousand twenty-one.- SUMMARY TREE-REMOVAL PROCEEDING (sumario de derribo) brought by [Nombre1], of legal age, divorced, educator, resident of Jicaral, Puntarenas, identity card CED1 - -; against JUNTA ADMINISTRATIVA COLEGIO PROFESIONAL AGROPECUARIO DE JICARAL, PUNTARENAS, legal entity identification number CED2 - -, represented by its president, [Nombre2], of legal age, married, resident of Dominicas, Jicaral, identity card CED3 - -. Judge Darcia Carranza authors the decision; and,

WHEREAS:

I.The defendant, Junta Administrativa del Colegio Técnico Profesional Agropecuario de Jicaral, raises an objection for lack of subject-matter jurisdiction (incompetencia material), asserting that this matter should not be heard by the Agrarian Jurisdiction (Jurisdicción Agraria) because it does not concern an agricultural property (fundo agrario), but rather property of a civil nature. It further asserts that the Juzgado Agrario de Santa Cruz lacks territorial jurisdiction (competencia territorial) (see answer to the complaint entered on 12/10/21 at 05:03:24).

II.Agrarian jurisdiction (competencia agraria), by reason of subject matter, is defined generally by Articles 1 and 2(h) of the Ley de Jurisdicción Agraria. The fundamental criterion is agricultural production activity (actividad agraria de producción), whether animal husbandry or crop cultivation (business or subsistence activities), or related activities, as well as sustainable agro-environmental activities (actividades agroambientales sostenibles). The nature or suitability of the productive asset, its size, and the persons participating in the agrarian proceeding (proceso agrario) as plaintiffs or defendants have been established as supplementary criteria. The nature or suitability of the asset is closely connected to agricultural properties (incorrectly referred to in legislation as rural parcels (predios rústicos)) that are devoted, or are capable of being devoted, to productive agricultural activities (actividades agrarias productivas), forest conservation, or the sustainable management of agro-environmental activities. Likewise, such persons acquire the designation of “agrarian parties” (sujetos agrarios) through their engagement in productive agricultural activities. The fundamental criterion is always functional—that is, the activity—to which both the objective and subjective criteria are referred.

III.In this matter, the principal claim (pretensión principal) seeks to compel the defendant to cut down a cenízaro tree located in front of the plaintiff’s property, with a public road between them, because, in her view, it poses a danger to her physical safety and that of her family members, as well as to the existing structures. The defendant argues that the matter does not fall within the subject-matter jurisdiction of the Agrarian Jurisdiction because no agricultural activity is conducted and it must therefore be heard in civil proceedings. In this respect, the defendant is partially correct, because neither the land on which the tree is located nor the plaintiff’s land is an agricultural property. However, Section 108 of the Ley de Biodiversidad confers subject-matter jurisdiction upon us. In this regard, that provision states: “...Jurisdictional authority (competencia jurisdiccional).

In biodiversity matters, and until an environmental jurisdiction exists, every dispute shall fall within the exclusive jurisdiction of the contentious-administrative courts. As exceptions to the foregoing rule, offenses against biodiversity shall be adjudicated by the criminal courts; likewise, disputes arising between private parties that do not involve an administrative act or public-domain property shall fall within the jurisdiction of the agrarian courts.” It follows from the foregoing that this is a dispute concerning the removal of trees in which no administrative act is involved and which does not concern public-domain property (bien demanial); therefore, the special law confers subject-matter jurisdiction upon us.

IV.For the foregoing reasons, pursuant to Article 16 of the Ley de Jurisdicción Agraria and Section 108 of the Ley de Biodiversidad, the objection for lack of jurisdiction raised by the defendant must be denied because this is a matter pertaining to agrarian law. As to territorial jurisdiction, it lies with the Juzgado Agrario headquartered at the Segundo Circuito Judicial de Guanacaste, Santa Cruz seat. The case file shall be returned to the court of origin for final disposition as appropriate.

THEREFORE:

The objection for lack of subject-matter and territorial jurisdiction raised by the defendant is denied.

SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las once horas seis minutos del veintiséis de abril de dos mil veintiuno.- SUMARIO DE DERRIBO promovido por [Nombre1] , mayor, divorciada, educadora, vecina de Jicaral, Puntarenas, cédula de identidad CED1 - - ; contra la JUNTA ADMINISTRATIVA COLEGIO PROFESIONAL AGROPECUARIO DE JICARAL, PUNTARENAS, cédula jurídica CED2 - - , representada por su presidente [Nombre2] , mayor, casado, vecino de Dominicas, Jicaral, cédula de identidad CED3 - - . Actúa como defensor publico de la parte actora, el letrado Oscar Cerdas Fonseca, de calidades desconocidas en autos; y como apoderado especial judicial de la parte demandada, el licenciado Jorge Alberto López González, colegiado cinco mil seiscientos setenta y ocho. Redacta el juez Darcia Carranza; y,

CONSIDERANDO:

I.La demandada Junta Administrativa del Colegio Técnico Profesional Agropecuario de Jicaral, opone la excepción de incompetencia material indicando este asunto no debe ser conocido en la Jurisdicción Agraria por cuanto no se trata de un fundo de naturaleza agraria sino de naturaleza civil. Igualmenet indica que por territorio no le compete al Juzgado Agrario de Santa Cruz (ver contestación de demanda incorporada el 12/10/21 a las 05:03:24).

II.La competencia agraria, por razón de la materia, está determinada en forma genérica por los artículos 1 y 2 inciso h) de la Ley de Jurisdicción Agraria. El criterio fundamental es el de la actividad agraria de producción, sea de cría de animales o cultivo de vegetales (actividades empresariales o de subsistencia), o cuando se trate de actividades conexas, así como actividades agroambientales sostenibles. Como criterios complementarios, se han establecido, la naturaleza o aptitud del bien productivo, así como su extensión, y los sujetos que participan dentro del proceso agrario como actores o demandados. La naturaleza o aptitud del bien está estrechamente vinculada a los fundos agrarios (denominados incorrectamente por la legislación como predios rústicos), dedicados o que sean susceptibles de destinarse al ejercicio de actividades agrarias productivas, o a la conservación de bosques y manejo sostenible de actividades agroambientales. Los sujetos, igualmente, adquieren su calificativo de “sujetos agrarios”, por su dedicación al ejercicio de actividades agrarias productivas. El criterio fundamental es siempre el funcional, es decir, la actividad, a la cual son reconducidos los criterios tanto objetivos como subjetivos.

III.En el presente asunto la pretensión principal tiende a que se obligue a la parte accionada a cortar un árbol de cenízaro que se encuentra al frente de la propiedad de la actora, con una calle pública en medio, ello por cuanto a criterio de esta constituye un peligro para su integridad física y la de sus familiares, así como de las construcciones existentes.
