APPEAL AGAINST JUDGMENT (RECURSO DE APELACIÓN DE SENTENCIA) filed in these proceedings against [Nombre1], a naturalized Costa Rican citizen, identity card number CED1, for the offense of VIOLATION OF THE LEY FORESTAL, to the detriment of NATURAL RESOURCES. Judges Adriana Escalante Moncada, José Alberto Rojas Chacón, and Francisco Lemus Víquez participated in deciding the appeal. Criminal State Attorney Randall Aguirre Mena and the accused, [Nombre1], entered appearances in the appeal against judgment.

PROCEDURAL BACKGROUND:

  1. 1By oral judgment number 63-2018, issued at ocho horas on veintiséis de enero de dos mil dieciocho, the Court of the First Judicial Circuit of Alajuela ruled: POR TANTO: “In accordance with the foregoing; Articles 39 and41 of the Constitución Política; 1, 30, 45, 59, 62, and 71 to 74 of the Código Penal; 57, 58, and 61 of Ley Forestal número 7575; and Articles 1, 360, 361, 363, 364, 365, and 367 of the Código Procesal Penal, [Nombre1] is hereby acquitted of all punishment and liability for the offense of VIOLATION OF THE LEY FORESTAL, to the detriment of NATURAL RESOURCES, with which he had been charged. The request for restoration to the prior condition is denied. The civil damages action (acción civil resarcitoria) brought by the private complainant and civil plaintiff (querellante y actor civil), the Procuraduría General de la República, against the accused and civil defendant (querellado y demandado civil), [Nombre1], is dismissed. No specific award is made regarding payment of the costs of the proceedings, either criminal or civil, and the expenses thereof shall be borne by the State. Any measure affecting fundamental rights that may have been ordered against the accused herein shall cease, and the destruction of the physical evidence produced in this matter is ordered. NOTICE SHALL BE SERVED BY [Nombre2].—JUAN CARLOS CASTRO VILLALOBOS, TRIAL JUDGE.”
  2. 2Attorney Randall Aguirre Mena, in his capacity as Criminal State Attorney, filed an appeal against judgment challenging the lower-court ruling. That challenge was decided by the Second Section of the Court of Appeal Against Judgments through decision number 2019-264, at catorce horas veinticinco minutos on diez de abril de dos mil diecinueve, which provided as follows: “Por Tanto: The appeal against judgment filed by the representative of the Procuraduría General de la República is denied.”
  3. 3The Procuraduría General de la República filed a cassation appeal (recurso de Casación) against the foregoing ruling before the Sala Tercera de la Corte Suprema de Justicia. In his submission, State Attorney Randall Aguirre Mena raised two grounds for cassation (motivos de casación). The first concerned the erroneous failure to apply a legal provision, specifically Article 25 of the Ley de Construcciones, which led to the accused’s acquittal and, consequently, the dismissal of the civil action. His second ground for cassation challenged the decision of the Court of Appeal insofar as it rejected the third ground of challenge, which contested the trial court’s denial of an order to demolish the homes constructed within a protection zone (zona de protección).
  4. 4In decision number 2019-01076, issued at once horas diez minutos on cuatro de setiembre de dos mil diecinueve, the Sala Tercera de la Corte Suprema de Justicia ruled as follows regarding the admissibility of the cassation appeal: Por tanto. The first ground of the cassation appeal filed by attorney Randall Aguirre Mena, in his capacity as representative of the Procuraduría General de la República, is admitted for a decision on the merits. The second claim in the appeal brought by attorney Aguirre Mena, as well as the defense’s “special request” that costs be awarded against the State, are declared inadmissible. Notice shall be served.” (see folio 710) That challenge was decided by the Criminal Cassation Chamber through decision number o 2020-671, issued at nueve horas y cuarenta y ocho minutos on cinco de junio del año dos mil veinte, which provided as follows: “Por Tanto: The claim raised by the Procuraduría General de la República is granted. Judgment N°2019-00264 of the Court of Appeal Against Judgments of the Third Judicial Circuit of Alajuela, San Ramón, Second Section, issued at 14:25 horas on 10 de abril de 2019, is vacated; and the matter is remanded to that judicial authority for new proceedings in accordance with law.” (see reverse of folio 718).

Appellate Judge Escalante Moncada drafts the opinion; and,

WHEREAS:

I.In light of the rulings of the Cassation Chamber in decisions 2019-01076 and 2020-671, this Court of Appeal Against Judgments, sitting with a different panel, now considers the first ground of appeal raised in the appeal filed by the Procuraduría General de la República, which challenges the reasoning of the judgment of acquittal and the exclusion of evidence. Given the subject-matter jurisdiction of this Court of Appeal following the remand ordered by the Criminal Cassation Chamber, it will not consider the ground captioned in the appeal as “Third ground concerning the denial of the demolition request.” Although captioned as the third ground of challenge, under consecutive numbering that argument corresponds to the second ground of challenge. This is because, through decision number 2019-1076, the Cassation Chamber declared inadmissible the arguments raised against the manner in which this Court of Appeal had resolved that claim, an issue that had therefore already become final.

II.In the ground for appeal now under consideration, attorney Randall Aguirre Mena, Criminal Prosecutor, alleges a violation of the rules of sound judicial reasoning (sana crítica) and failure to comply with Articles 142, 184, 363 subsections c) and d), and 459 of the Código Procesal Penal. He asserts that the trial court relied on flawed reasoning and incorrectly analyzed the evidence, drawing conclusions contrary to sound judicial reasoning, which resulted in the acquittal and led to the dismissal of the civil action for damages (acción civil resarcitoria). He states that the facts—which he transcribes—are limited to the allegation that the defendant [Nombre1], in his capacity as a civil engineer, was responsible for constructing five social-interest housing units and fraudulently failed to inform the Municipalidad de Poás de Alajuela that the slope of the lot on which the houses were to be built was 53% in relation to the río Mastate, in order to evade the obligation to respect the 50-meter protection area (área de protección) along the bank of that river.

He asserts that this omission misled the operating Administration (Administración activa), which issued the building permits, and that this caused earthworks (movimientos de tierra) to be carried out and loose material to be deposited in the protection area of that watercourse, removing vegetation cover (cubierta vegetal) through the use of a backhoe and affecting an area of 700 square meters. He states that the impact became permanent because construction continued on the five social-interest housing units, each measuring 32 square meters. He specifies that the environmental impact (impacto ambiental) was assessed at [Dirección1]¢, comprising: a) assisted natural regeneration costs (reforestation of the 700 square meters); b) social cost in relation to the impact on the site, measured against the loss of landscape and scenic beauty for future generations; and c) loss of quality of life for the resources and species communities associated with that altered ecosystem.

He explains that the protection area was affected on two occasions: first through the earthworks and then through the final construction of the housing units. He asserts that the defendant is liable as the professional in charge of the project. He states that the trial court based its decision on the existence of reasonable doubt (duda), but argues that the scant intellectual analysis (análisis intelectivo) in the judgment of acquittal invalidates the decision because it is both insufficient and erroneous. Under this ground, the appellant adds two subheadings in which he offers further reasons. Because these additional arguments were duly summarized in judgment number 2019-264, issued by Section II of this Court of Appeals for Criminal Judgments, that summary will be used. “Regarding the acquittal on the offense of encroachment upon a protection area (invasión a un área de protección) through the construction of 5 social-interest housing units.” (verbatim copy from the reverse of folio 605).

He alleges that the trial judgment refers to uncertainty concerning the setback line (alineamiento) applicable in this case, in which the 15-meter setback established by the Instituto Nacional de Vivienda y Urbanismo is disputed, and that no other administrative entity established a different setback. He objects to this argument, stating that, in the closing arguments presented by the Procuraduría, it was argued that Article 34 of the 1996 Ley Forestal prohibits felling (talar) in protected areas, except for projects declared to be of national interest by the Executive Branch, and that the setback lines in such cases must be established by the Instituto Nacional de Vivienda y Urbanismo. He notes that it is clear that this entity is responsible for establishing watercourse setback lines (alineamientos pluviales) pursuant to Article 33 of Ley 7575. He objects to the judgment’s statement that this setback had expired while nevertheless treating it as valid in 2012.

He states that the stamps on the cadastral plans (planos catastrados) themselves indicated that the setback lines shown there were valid for one year (referring in this regard to folios 14 through 17). He maintains that the defendant falsely stated at trial that he had been told by telephone by the INVU that those setback lines did not expire, arguing that, pursuant to Article 25 of the Ley de Construcciones, setback lines had no expiration date; he states that the defendant did so in an effort to confuse the Court, because that provision concerns roadway setback lines (alineamientos viales) established by the Municipalities and the MOPT, and notes that this is because the Ley de Construcciones predates the Ley Forestal (Article 18 of the Ley de Construcciones). He therefore concludes that by 2012 the setback established in 2008 had expired and ceased to have effect. He states that the Court itself describes that setback as “expired,” but objects to its reasoning that, because there was no other setback for the location of the events, reasonable doubt had to be applied.

He maintains that this argument is wholly erroneous and based on false premises because, if the setback had ceased to be valid, then at the time of the events the properties had no valid setback issued by the competent entity; in other words, there was no valid and effective watercourse setback, the plans therefore failed to satisfy this essential requirement, and no construction of any kind could be undertaken without that setback. He thus alleges that evidence clearly establishing the defendant’s authorship (autoría) exists, but that the Court omitted it from its analysis and thereby failed to provide adequate intellectual reasoning (fundamentación intelectiva). He further complains that the Court failed to consider the statement by witness [Nombre3] regarding the setback requirement of 50 meters in such cases. He criticizes the lax analysis of the evidence used to conclude that it was impossible to establish that the defendant knew the setback had to differ from the 15 meters established in the plans and reflected in the municipal permits, arguing that evidence of the defendant’s knowledge was indeed submitted but was not evaluated by the sentencing court, and that this constitutes the failure to provide adequate reasoning.

In this regard, he notes that witness [Nombre3], a forestry technician (técnico forestal) with MINAE, whose testimony is transcribed, stated that the defendant was present when they visited the site of the events on 1 de noviembre de 2012 and that, although he invoked the permits, it was clear from the stamps that they had expired. The testimony also states that they informed the defendant that the earthworks were within the 50-meter area applicable in this case because the slope had a gradient of 54%. The transcribed witness account also states that, during a second visit, they confirmed the existence of the housing units, all of which were within the 50-meter protection area. He then refers to the defendant’s testimony, in which the defendant mentioned the visit by MINAE officials and how they told him that, in their view, the required setback was 50 meters and that the one established by the INVU was a desk-based setback (alineamiento de escritorio) that had expired.

He thus maintains that, upon receiving this information from MINAE officials, the defendant adopted a passive, unconcerned attitude, went home for several days, and waited for the construction work to be halted; according to the transcript of the defendant’s own statement, when no work-stoppage order (paralización de obras) was ultimately issued, he resumed and completed the work. He notes that the foregoing makes it clear that, despite knowing that construction within the protection area was prohibited and despite being in charge of the project, the defendant decided to carry out the criminal conduct and proceeded with the construction of the five housing units, offering as justification that the project had never been shut down. He objects that, although the officials warned the defendant about the situation, he did not verify the slope measurement and decided to continue constructing the housing units, thereby incurring, in the appellant’s view, the criminal liability alleged against him.

He also challenges the failure to weigh the testimony of [Nombre4], the official who accompanied [Nombre3] and corroborated that [Nombre3], using a clinometer, determined that the gradient at the site was 54%, a fact that he states was communicated to the defendant as the person in charge of the project. He thus states that the defendant, as an architect and civil engineer with extensive experience in construction, knew of the restriction under the Ley Forestal detailed on the plan; that the slope was apparent to the naked eye at the site; that he had seen the setback and knew that it had expired by 1 de noviembre de 2012; that on that date he was informed of the 50-meter protection area and had sufficient time to verify the gradient; and that he knew he could not construct any building at that location. He therefore states that, pursuant to Article 33 of the Ley Forestal, read in conjunction in this case with Article 2 of the Reglamento to that law, it is clear that, because the slope exceeded 40%, the required clearance (retiro) was 50 meters, and that the defendant knew this before the buildings were constructed but nevertheless carried out the project.

He thus states that the evidence establishes the defendant’s authorship of the offense charged against him; nevertheless, without adequate grounds and in violation of the rules of logic and inference (derivación), the court acquitted him without analyzing the evidence that, in the appellant’s view, established the defendant’s knowledge that the protection area applicable in this case was 50 meters. He therefore alleges that testimonial and documentary evidence clearly establishing those points—and, consequently, the criminal liability of the accused herein, as well as his civil liability for damages—was disregarded. 2.- Regarding the acquittal on the offense of encroachment upon a protection area through earthworks in the protection area of the río mastate. Quoting the reasoning of the judgment, the appellant states that the defendant was acquitted on this issue through application of reasonable doubt because, according to the judgment, although the MINAE officials confirmed that earthworks had occurred, they were unable to determine whether they were recent; moreover, although they observed machinery at the site, namely a backhoe, it was not operating.

Added to this was the defendant’s own statement that, when he took over the project and visited the property, the construction terraces (terrazas para construcción) had already been prepared. The appellant maintains that, through this reasoning, the judge again relied on the defendant’s statements to substantiate reasonable doubt and failed to analyze the evidence determining whether the alleged facts had been proven. He states that, in the judgment, the court indicates that witnesses [Nombre3] and [Nombre4] expressed uncertainty as to whether the earthworks were recent or had been carried out long before. He complains that other aspects of their accounts and of the evidence were not weighed, such as the fact that the document at folio 18 establishes that construction could begin as of 5 de setiembre de 2012 and that [Nombre1] was identified therein as the responsible engineer. He states that the inspection conducted on 1 de noviembre de 2012 shows that the backhoe operator was at the site, and objects that the court failed to consider why that person would have been there if not to perform the earthworks, with the defendant also present at the site as the person in charge of the project.

He argues that machinery was present at the site, that earth had recently been moved, and that the defendant had been in charge of the project since marzo de 2012 and had first visited the site at that time; he further states that folio 1 confirms that MINAE officials received a telephone complaint concerning earthworks at the site.

It argues that, if machinery was present at the site, whether on that same day or in the preceding days, and given that the defendant had been in charge of the project since September, the reasoning underlying the doubt as to whether it was the defendant who ordered or contracted for those works is objectionable. It thus alleges inadequate reasoning and a violation of the rules of logical inference in support of the defendant’s acquittal. It argues that the grievance lies in the failure to provide adequate grounds for the acquittal based on reasonable doubt with respect to both offenses of encroachment upon a protected area (invasión de un área de protección), and further maintains that the judgment reflects an erroneous assessment of the evidence affecting not only criminal liability but also the dismissal of the civil claim for damages (acción civil resarcitoria), thereby impairing the State’s criminal and civil claims. It requests that the judgment and the trial proceedings preceding it be vacated and that a new trial be ordered.

III.The claim asserted is denied. Upon review of the trial judgment and the respective evidence, it is concluded that there is an essential argument for affirming the acquittal handed down by the Tribunal de Juicio de Alajuela. In this regard, and having assessed that decision, it may be said that the trial judge based his decision on two mutually independent grounds. The first concerned the application and interpretation of Article 25 of the Ley de Construcciones in relation to the provisions of the Ley Forestal. The second ground focused on the failure to prove intentional conduct (dolo) by the accused, [Nombre1]. In this regard, and concerning the first argument, this Tribunal de Apelación de Sentencia considers that, as the Sala de Casación Penal indeed stated in decision number 2020-670, the Ley Forestal was enacted after the Ley de Construcciones, and it is environmental legislation that establishes the size of the protection area (área de protección) and, therefore, the required setback (retiro) that must be observed for areas of this kind adjoining riverbanks.

As relevant to the resolution of this specific case, Article 33(b) of the Ley Forestal states as follows: “b) A strip of fifteen meters in rural areas and ten meters in urban areas, measured horizontally on both sides along the banks of rivers, gullies, or streams if the terrain is flat, and fifty horizontal meters if the terrain is steep.” This provision, which is both specific and subsequent to the Ley de Construcciones, establishes the following protection areas: Protection areas. The following are declared protection areas: (…) b) A strip of fifteen meters in rural areas and ten meters in urban areas, measured horizontally on both sides along the banks of rivers, gullies, or streams if the terrain is flat, and fifty horizontal meters if the terrain is steep.” These provisions establish three protection areas: one of ten linear meters (urban area), another of fifteen meters (rural area)—in both cases, the terrain must be flat—and a third of fifty meters if the terrain is steep.

It is clear that determining the type of protected zone (zona de protección) requires certainty as to whether the land is located in a rural or urban area and whether it is flat or steep. Likewise, it is clear from the provision that, on steep land, the protection area along riverbanks is fifty meters. Having established this, these are the provisions that set the required dimensions of each protection area and, therefore, its respective setback line (alineamiento). Returning now to the case under review, one of the arguments in the trial judgment gave precedence to Article 25 of the Ley de Construcciones, which provides that established setback lines are indefinite, without considering that provision together with the Ley Forestal. That error by the trial court invalidates only that line of reasoning; it does not invalidate the trial court’s decision to acquit the defendant, [Nombre1], for the following reasons.

Several facts are undisputed in this case. The first is that each of the cadastral plans (planos catastrados) corresponding to the lots at issue was assigned a fifteen-meter setback line, as shown by pages 13 through 17. It is also undisputed that a dwelling was built on each lot. Another proven fact is that, during November 2012, officials from the Área de Conservación de la Cordillera Volcánica Central system inspected the land corresponding to those lots and determined that the slopes of those properties were steep and that, because they had an average gradient of 54%, the protection area was fifty meters rather than fifteen meters. Because of the discrepancy between the setback lines recorded on the cadastral plans and the results of the inspection conducted by officials of the Ministerio de Ambiente, the latter, by official letter number OG-1631-2012 addressed to the Dirección de Urbanismo del Instituto Nacional de Vivienda y Urbanismo, requested that a field inspection be conducted and that the fifteen-meter setback line granted for those properties be reviewed (see pages 1 through 5 and page 41).

These facts are relevant because they directly affect the manner in which the trial court resolved this proceeding. As stated above, the trial judge gave an additional reason supporting his decision, one independent of the first ground (the scope of Article 25 of the Ley de Construcciones): namely, that this proceeding did not establish with the required degree of certainty that the accused acted intentionally. This other argument, which is independent of the first, validly supports the lower court’s decision for the following reasons. The issue in dispute in this proceeding is whether the houses built by the accused encroach upon the protected zone and, consequently, whether this constitutes the offense established in Article 58(a) of the Ley Forestal, which provides as follows: “A term of imprisonment of three months to three years shall be imposed on anyone who: a) Encroaches upon a conservation or protection area, regardless of its management category, or upon other forest areas or lands subject to the forestry regime (régimen forestal), regardless of the area occupied and irrespective of whether the land is privately owned by the State or other Public Administration agencies or is privately owned by individuals.

The perpetrators of or participants in the act shall not be entitled to any compensation for any construction or work they may have carried out on the encroached-upon land.” This criminal offense (tipo penal) describes intentional conduct, and for purposes of the case under consideration, this means that the accused must know that the work performed—earthworks (movimientos de tierra) and construction of the houses—is encroaching upon a protected zone. By its nature, this criminal offense does not permit negligent commission (comisión culposa), since that manner of committing the criminal conduct is not expressly provided for (Articles 30 and 31 of the Código Penal). Accordingly, any mistake affecting knowledge of one of the objective elements of the offense (elementos objetivos del tipo penal) negates the intentional nature of conduct of this kind and, therefore, excludes its classification as a criminal offense (tipicidad).

Additionally, given the structure of the unlawful conduct under review, it is concluded that this offense permits only direct intent (dolo directo), because the perpetrator must know in advance that his actions encroach upon a protected zone. Commission with conditional intent (dolo eventual) would therefore not be possible, because conditional intent is directed primarily toward bringing about the result (Article 30 of the Código Penal), rather than toward knowledge of one of the objective elements of the offense. Moreover, the criminal offense provided for in Article 58(a) of the Ley Forestal is not a result-based offense (delito de resultado); on the contrary, it is a conduct offense (delito de mera actividad). In other words, its completion does not require that a result be produced; rather, the criminal wrong (injusto penal) is established solely by the acts of encroaching upon the protected zone.

Returning to the case under review, when the earthworks and construction of the dwellings were carried out, there was a setback line granted by the Dirección de Urbanismo del Instituto de Vivienda y Urbanismo establishing a setback of fifteen linear meters in relation to [Dirección2]. Therefore, regardless of whether that setback line remained in effect, the fact is that an administrative act (acto administrativo) issued by the competent entity established that the setback from the riverbank had to be fifteen meters. In other words, because the setback was established in this manner, it may be concluded that the protection area for each of those lots was set at fifteen meters. The Procurator’s argument is that, before building the houses, the accused received a visit from representatives of the Área de Conservación, who informed him that the technical opinion of that office was that the setback had to be fifty meters because the lot was steep.

Although the field inspection conducted by an official of the Ministerio de Ambiente, Área de Conservación, is a fact proven in the record by the report appearing on pages 1 through 5, as well as by the trial testimony of officials [Nombre3] and [Nombre4], it cannot be inferred from this evidence with the required degree of certainty that the accused acted with direct intent when he built the dwellings. This is so because, as the lower court judge correctly analyzed in his decision, the trial established that the entity with authority to determine setback lines is the Instituto Nacional de Vivienda y Urbanismo. This means that, although the Ley Forestal establishes the number of meters comprising each protection area (10, 15, or 50 meters), it is for the Dirección de Urbanismo, in each specific application, to determine the type of setback and protection area applicable to the particular case.

Official Carlos Gutiérrez Santana testified on this point and stated categorically: “On the first of November two thousand twelve, together with [Nombre4], we went to the site known as San Juan norte, Cabuyal, [Dirección3] [Nombre5]. We arrived at the scene in response to a complaint about earthworks in the protection area of the rio Mastate. When we arrived, engineer [Nombre6] and three other people were present: the owner of the backhoe, the driver, and a contractor. We explained the reason for our visit. They told us they had the permits, but we collected field data; the average gradient was measured and came to fifty-four percent. We then observed that the work was intended to level the lots and that part of the displaced earth was entering the protection area of the rio Mastate. We carried out and recorded the measurements and procedures for conducting studies at the office, and at the office we determined that the affected area was seven hundred square meters.

We proceeded to send a letter to INVU regarding the setback line because it is the competent entity (…) INVU is the entity that establishes the setback line; some Municipalidades do so, but the competent entity is INVU” (boldface in the original; compare the summary of evidence in the trial judgment, as well as the official letter on page 41). It was also established that the officials of the Área de Conservación expressly asked INVU to review that setback line. Nevertheless, as official Carlos Gutiérrez Santana and the accused, [Nombre1], testified, at the time of trial there was nothing in the record showing that the Dirección de Urbanismo had issued a technical opinion changing the setback line granted for those cadastral plans in 2008 or had responded to the request submitted by officials of the Área de Conservación through official letter OG-1631-2012. This is relevant because, although before the defendant built the houses there was a discrepancy between the position of the officials of the Área de Conservación and that of the officials of the Dirección de Urbanismo concerning the setback that had to be observed on that land—namely, according to the technical opinion of the officials of the Ministerio de Ambiente, it had to be fifty meters because the lots have a gradient greater than 54%, whereas according to the record of the Dirección de Urbanismo, that setback is fifteen meters.

And although the accused was aware of this discrepancy, it is also true that the record did not establish that, before the house-construction process began, that technical discrepancy had been resolved by the Urban Planning Directorate or that the defendant had been informed of a new criterion regarding the dimensions of the protection area (área de protección) to be observed. It therefore cannot be concluded that the accused had the requisite certainty that the houses were being built within the protection area. This additional argument was extensively addressed by the trial court in its examination of the evidence, and based on that assessment it determined that, in this case, it could not be established that the defendant acted willfully, since doubt existed on that point. In this regard, although the examination of the evidence is extensive and sufficient, it is relevant to quote the following excerpt from the trial judgment: “It is important to note here that we must apply all of the foregoing reasoning concerning the inability to determine the existence of the correct setback determination (alineamiento) for the area of the Mastate River at issue; moreover, there is no evidence whatsoever that comes even close to showing that the defendant knew beforehand that the setback had to be other than 15 meters.

On the contrary, the documents establishing the Municipality’s approvals and the existence of the purported 15-meter setback date from dos mil ocho, and there is not a single document in the record indicating that, between that date and the first visit by SINAC officers, there was any reason to question the setback established on the stated date – 2008 –, such that the defendant himself should have taken the corresponding measurements. On the contrary, the defendant recounts how he learned of this construction project and how his participation came about, stating in that regard: ‘How I came to be there. Grupo Mutual is devoted to providing housing solutions, and there are entities affiliated with the Mutual, such as the company for which I work, which has an established track record and develops projects; they have the names of the companies and give them to people who wish to sell in an area they intend to develop.

That is how I came to be involved, and the husband of the former owner called me—that is, the person who sold the lots to the current owners—because my name appeared on that list. Thus, in marzo de dos mil doce, I met that day with the owner’s husband to assess the possibility of submitting the lots for the development of low-income housing.— When we, as engineers, conduct a visit for an assessment, we require the property to be in good standing, meaning that it has a cadastral map (plano de catastro), is approved, and is recorded in the Public Registry. As for the technical requirements for housing construction, it must have water and electricity services.— Accordingly, in marzo I visited the properties, and the owner’s husband gave me a file containing these documents: cadastral maps, cadastral maps approved by the Municipality, confirmation of water and electricity availability, municipal land-use authorization (uso de suelo), and, in the case of the Municipalidad de Poás, an environmental approval.— I was given all the documents, and the lots had the registered permits and the INVU setback determination.

I want to emphasize that the setback determination dates from dos mil ocho. This means that, before I knew the properties, the properties and cadastral registrations dating from dos mil ocho had already been subdivided (segregadas), recorded in the Registry, submitted to the Municipality, and approved by the Municipality. For me as an engineer, or for any other engineer, the fact that the property has municipal approval indicates that the property has met all the requirements.’ The defendant continues, explaining: ‘… Returning to the point that I am at the site, I verify there that the documents reflect everything stated in them and that I can confirm it. I can confirm that there is a public road already built, that water, electricity, and telephone services are available, and that a house has been built on the property adjacent to one of the lots. I can also confirm—I do not know by whom—that the lots are completely level, meaning that earthworks (movimientos de tierra) have been carried out because they are ready for construction…’ Here the defendant states that, by marzo de dos mil doce, the lots had already been properly leveled, and we will return to this point below.

Continuing with the logic of the analysis, the defendant states: ‘… I told the owner’s husband that the properties were suitable for a housing project, and the project was then submitted to Grupo Mutual, whose first duty was to assess the feasibility of the project through three divisions: one technical division; one dealing with the social aspect, that is, whether the families who applied and are present here qualify for a state subsidy; another department, the legal department, which reviews the legal status of the properties to ensure that there are no impediments to their submission; and the third division, the technical division in the fields of engineering and architecture.— Another professional must therefore prepare a technical report on the properties and their value, that is, an appraisal.— Accordingly, in this case Luis Alfonso Ramírez performed the appraisal, verified the information I had submitted, confirmed that the lots were suitable for construction of the houses, and confirmed that they could indeed be submitted to BANHVI for approval…….

Continuing with the process for construction on these lots. The Mutual forwards the matters, the files, to BANVI; that is, it administers BANVI’s resources and also grants the owners a loan to purchase the properties. Here, the funds may be used to construct the real property—the house—and the funds to purchase the lots are provided through Mutual Alajuela. That, then, is the arrangement: they administer the resources and grant the loan for the purchase of the properties. ….. As to how construction began, once BANVHI approves the resources and agrees to provide the funds, building permits must be requested. The permits are requested from the MUNICIPALITY, which is the local government. A series of requirements must be met, and these differ among municipalities because of their autonomy, although some are standard nationwide, such as an approved cadastral map; setback determinations, when required; a road setback determination if the road is a national road; another from INVU for a stream or river; and a land-use authorization issued by the Muni, which states what may be done on that property and advises the municipal engineer of the restrictions at the cantonal or local level.

At that time, the Muni had one additional requirement: renewal of the environmental approval. I must emphasize that those approvals were renewed in agosto del dos mil doce, meaning that, when construction of the houses began, they had been issued less than tres meses earlier. If the environmental approval is reviewed, it states whether a protection area exists on the properties and grants the COMPLIANT USE…’ The prosecution evidence shows this authority that, from the outset of this issue, on primero de noviembre de dos mil doce, the defendant engineer explained and attempted to clarify with MINAET officials that the setback was 15 meters and not what they had stated during their visit. Indeed, the defendant even stated that he had contacted the appropriate INVU department and had been informed that an inspection would be conducted. There is no evidence whatsoever in the record, nor any means of refuting the defendant’s statements, or any evidence establishing that he had prior knowledge of the situation concerning the slope and, with that knowledge, acted fraudulently.

Because the Office of the Attorney General’s accusation is based on such prior knowledge, the only possible conclusion is to uphold what has already been stated: a judgment of acquittal” (verbatim copy of folios 560 and 561. Emphasis in the original). As can be seen, in this argument the judge refers to the absence of sufficient evidence to reach the required certainty that the defendant knew that the correct setback was the cincuenta metros specified by MINAE. Rather, the criterion issued by that environmental agency gave rise to a dispute between two public entities, without any showing that this technical dispute had been resolved and that the defendant therefore had certain and current knowledge of the dimensions of the protection area that had to be observed in that area. Stated differently, the proven factual circumstance—namely, that there was a prior setback determination prepared by INVU in the año 2008—established the dimensions of the protection area for each lot as quince metros líneales, regardless of whether that determination had expired or whether it was correct or incorrect; that is, any other area lying outside that demarcated area of quince metros would not constitute a protection area.

This demonstrates the relevance of that evidence, because it directly affects what the defendant knew as to whether the area in which the houses were built was a protection area. In other words, as the trial judge found, the existence of a quince-metros setback determination lends weight to the defense theory that the defendant reasonably believed that the houses were outside the protection area. Thus, in this case, there would be a mistake as to an element of the offense (error de tipo), with the result that the criminal conduct could not be established as willful. The state of doubt to which the judge refers concerns the defendant’s knowledge of one of the elements of the criminal offense (the protection area), which led to the trial court’s decision to acquit him. Following this reasoning, whether the mistake was avoidable or unavoidable (as the Office of the Attorney General contends) is a distinction without legal relevance to this particular case, because the criminal offense of encroachment upon a protection area (invasión a la zona de protección) may be committed only with direct intent; consequently, a mistake concerning one of the elements of the offense renders the conduct noncriminal, and the proper course is therefore to uphold the trial court’s decision.

With respect to the manner in which the court below ruled on the civil claim, that decision must be upheld for the following reason. In this case, as reflected in the record, the civil action filed by the Procuraduría General de la República based its statement of facts on the following factual allegations: “1.— In the año 2012, the defendant [Nombre1] worked as a civil engineer and was responsible for the construction of a social-housing project consisting of 5 houses measuring 42 square meters each, on land located in San Juan de Poás de Alajuela, from the local Catholic church [Dirección4]—specifically between coordinates [Dirección5]: , on lots, respectively, that are recorded in the Real Property Registry in the names of: [Nombre7], identity card number CED2; [Nombre8], identity card number CED3; [Nombre9], identity card number CED4; [Nombre10], identity card number CED5; and [Nombre11], identity card number CED6, with cadastral map numbers A-3482491996; A-346928-119; A-346927-119; A-346926-1996; and A-348254-1996, respectively in each case.

  1. 2Without the exact date or time having been determined, but prior to 01 de noviembre de 2012, the defendant [Nombre1], acting in his capacity as the civil engineer in charge of the work at the site described in Fact One and having third parties under his direction, knowing that the 50-meter protection area (área de protección) of the Mastate River applied because the land had a slope (pendiente) of 53%, fraudulently obtained, by omitting this information from the Municipalidad de Poás de Alajuela, the prescribed setback (retiro) and the corresponding building permits, without having permits from the Ministerio de Salud and without indicating in the building-permit application submitted to the Municipalidad the protective setback area required because of the slope, thereby misleading the competent administrative authority, encroached upon the protection area of the Mastate River by carrying out earthworks (movimientos de tierra), depositing loose material within that protection area, and removing vegetation cover (cubierta vegetativa), using a Back Hoe and affecting a surface area of 700 square meters; MINAE officials in Alajuela, Eliden Alcazar Barahona and Gerardo Martín Arguello Arce, warned him of the encroachment upon the riparian protection area (área de protección riberina) and, as an administrative precautionary measure (medida cautelar administrativa), ordered the suspension of further construction work at the site.- 3.- Without the exact date or time having been determined, after 01 de noviembre de 2012, the accused [Nombre1], with full knowledge and in breach of his duty of probity (deber de probidad), knowing the steepness of the slope and continuing to serve as the professional responsible for the housing project, through several persons hired and working under his direction, consolidated the encroachment upon the 50-meter protection area of the Mastate River, which has a slope of 53 %, by constructing a total of 5 social-housing units of 32 m2 each. 4.- The physical acts carried out by the accused caused multiple adverse impacts on the protection area of the Mastate River and the Environment, which were equitably assessed at ₵ 682.986,95 (SIX HUNDRED EIGHTY-TWO THOUSAND NINE HUNDRED EIGHTY-SIX COLONES AND NINETY-FIVE CENTIMOS), comprising: a) the costs of assisted natural regeneration (regeneración natural asistida) (reforestation) of the affected 700 m2 of the protection area; b) the Social Cost associated with the impact on the site in terms of the loss of landscape and scenic beauty for future generations; c) loss of quality of life of the resources and species communities associated with that altered ecosystem, these being the most important assessment items.” (verbatim copy from the private-prosecution complaint and civil action file).It follows from the Procuraduría’s factual account that the basis of attribution (criterio de imputación) used to seek the civil liability of the defendant [Nombre1] was direct subjective non-contractual civil liability (responsabilidad civil extracontractual subjetiva directa) for intentional acts committed by the accused, to the extent that it is alleged that the accused acted fraudulently and knowingly misled the Municipalidad into granting him the building permits. This basis of attribution set forth in the civil action is relevant because of the principle of congruence (principio de congruencia) governing civil matters, regarding which the Sala Tercera de Casación Penal has stated as follows: “It should be recalled that the bases invoked for attributing civil liability must be supported by the account of the facts or grounds on which the action is based, which, like the criminal charge, must be clear and specific so as to permit full exercise of the civil defendant’s right of defense, since that factual account will directly affect both the manner in which the opposing party answers the claim and the full exercise of the right of defense and the evidentiary issues (see articles 112 of the Código Procesal Penal and 290 of the Código Procesal Civil).The foregoing is also important for safeguarding the principle of congruence embodied in sections 99, 153 and 155 of the Código Procesal Civil. In this regard, the first provides: “Judgment shall be rendered within the limits established in the complaint. The judge is prohibited from ruling on matters not litigated with respect to which the law requires a party’s initiative.”; a rule that, for purposes of rendering judgment, is also contained in sections 153 and 155 of the same body of law, which provide: “ARTICLE 153.- Requirements and designation. Court rulings must be clear, precise, and congruent; they shall state the court issuing them and the place, hour, day, month, and year in which they are issued, and shall be designated as: (…) 3) Judgments, when they finally decide the matters litigated by ruling on the relief sought in the complaint. (…)”; “ARTICLE 155.- Requirements for judgments.Judgments shall resolve each and every issue that was the subject of litigation, with the ruling on each issue duly separated when there are several. They may not encompass matters other than those claimed, nor award more than was requested. (…)” The Tribunal de Apelaciones therefore ruled in accordance with the civil-law provisions whose absence the complainant alleges, stating that the principle of congruence and the right of defense had been grossly violated. The civil claimant now seeks to disregard the basis of attribution alleged against the notary [Nombre12], who was accused of having actively and intentionally participated in the criminal scheme to seize the properties of the victims and civil claimants, whom the perpetrators led to believe that they would purchase the properties, thereby inducing them, through the simulation of false facts, to sign the deeds transferring those assets.It is certainly clear that, as regards the civil action for damages (acción civil resarcitoria), the adjudicator has authority—under the principle of iura novit curia—to apply the law to the specific case; nevertheless, it cannot be overlooked that this authority is limited by the account of the facts contained in the civil action. Moreover, although adjudicators have the power to apply other bases of attribution, in this case they were limited by the factual account contained in the civil-claim file, and it is clear that this factual narrative does not describe negligent conduct by [Nombre12], that is, the provision of inadequate advice to the victims in his capacity as a notary. In summary, the factual framework set out in the civil action for damages filed by the Oficina de Defensa Civil de la Víctima indicates only one basis of civil liability (civil attribution), founded on the commission of an intentional criminal act and not on negligent conduct, as the court a quo attempted to recast it and as the claimant now seeks to exploit before this Court, to the detriment of the principle of congruence governing civil matters.In this regard, this Chamber stated the following on the subject in judgment Nº 2011-0173: “…if there is no civil fact supporting the relief sought in the civil action, it would not be legally possible to award compensation, because doing so would contravene the principle of congruence (art. 99 of the Código Procesal Civil). The drafting of the facts in the civil action is therefore of paramount importance, since they must be sufficiently complete to support the party’s claim. (In this regard, see: [Nombre13], . (2010). Simplemente la verdad. El juez y la construcción de los hechos. Translation by Daniela Accatino Seagliotti. Madrid. Ediciones Jurídicas y Sociales S.A. [Nombre14], Taruffo, Michele. (2008). La prueba. Madrid. Ediciones Jurídicas Sociales S.A.). Furthermore, the facts will establish the framework within which evidence is presented (art. 317 of the Código Procesal Civil)…” It has also held that “…with regard to the cause of action (causa de pedir), it has been stated that, in a civil action, the factual framework presented by the party defines the scope within which the adjudicator must rule on the claimant’s request…” (Sala Tercera de la Corte Suprema de Justicia, Voto número 56-2006, de las nueve horas, del tres de febrero de dos mil seis, reiterated in decision número 2012-00045 of this same Cassation body, a las diez horas y cuarenta minutos del trece de enero del dos mil doce), that ruling stating that, in both criminal and civil matters, the facts attributed to the civil defendants must be respected, since the full exercise of the rights of defense and to be informed of the allegations depends on those facts.” (Sala Tercera de la Corte Suprema de Justicia, número 2017-00205 de las diez horas trece minutos del veintidós de marzo del dos mil diecisiete).Returning to the case under review, the trial judge stated as follows: “With regard to the civil action for damages brought by the private prosecutor and civil claimant, the Procuraduría General de la República, against the accused and civil defendant [Nombre1], seeking payment as compensation for environmental damage (daño ambiental) to the protected area, the action must be dismissed because it remains ancillary to the criminal proceedings; in that regard, Mr. [Nombre1] was acquitted of punishment and criminal liability because of the prevailing doubt as to the existence of a boundary demarcation (alineamiento) different from and greater than fifteen meters. Consequently, it cannot be determined, and doubt remains, whether there was an event giving rise to the damage described; therefore, no decision is possible other than to deny the civil claims in this criminal matter, without a specific award of costs” (verbatim copy of the trial ruling).Upon examining the judgment as the logical and legal whole that it is, the Court finds that the denial of the civil action for damages was directly related to the inability to prove that the accused knew of the elements of the offense, given the inconsistencies between the boundary demarcations issued by two government entities (SINAC and INVU) regarding whether the houses were being built in encroachment upon the protection zone (zona de protección). In other words, the Trial Judge rejected intentional conduct by the defendant as the basis of attribution with respect to the encroachment upon the protection area resulting from construction of the houses. Likewise, the judgment shows that, with respect to the other event concerning removal of the vegetation layer (capa de vegetación) through earthworks carried out on those properties, which affected the protection area, it was not proven that the defendant performed or ordered that work (a conclusion shared by this Trial Chamber), and he was therefore also acquitted of those other acts.In his appeal, however, the Procurador refers to possible negligent conduct by omission on the part of the defendant (for failing to perform his duties adequately, or through negligence or recklessness). Nevertheless, once the existence of intent as a basis of attribution was rejected, it would not be appropriate to enter a civil judgment against him on another basis of attribution, such as direct subjective civil liability based on fault (responsabilidad civil subjetiva directa por culpa), or possible strict civil liability (responsabilidad civil objetiva), without violating the principle of congruence governing civil matters and the civil defendant’s right of defense. Accordingly, the trial court’s decision to dismiss the civil action is proper, and the trial ruling shall therefore remain undisturbed as to the matters reviewed on this occasion by the Appellate Chamber. Consequently, the ground of appeal raised by the Procuraduría General de la República that formed the basis for the issuance of this ruling is denied.

San Ramón, a las doce horas del diecisiete de marzo de dos mil veintiuno.

RECURSO DE APELACIÓN DE SENTENCIA interpuesto en la presente causa seguida contra [Nombre1] , costarricense por naturalización, cédula de identidad número CED1, por el delito de INFRACCIÓN A LA LEY FORESTAL en perjuicio de LOS RECURSOS NATURALES. Intervienen en la decisión del recurso, los jueces Adriana Escalante Moncada, José Alberto Rojas Chacón y Francisco Lemus Víquez. Se apersonan en apelación de sentencia, el Procurador Penal Randall Aguirre Mena y el imputado [Nombre1] .

RESULTANDO:

  1. 1Que mediante sentencia de manera oral número 63-2018 de las ocho horas del veintiséis de enero de dos mil dieciocho, el Tribunal del Primer Circuito Judicial de Alajuela, resolvió: POR TANTO: "De conformidad con lo expuesto, artículos 39 y41 de la Constitución Política, 1, 30, 45, 59, 62, 71 a 74 del Código Penal; 57, 58 y 61 de la Ley Forestal número 7575, artículos 1, 360, 361, 363, 364, 365, 367 del Código Procesal Penal. Se impone absuelve de toda pena y responsabilidad a [Nombre1] por el delito de INFRACCIÓN A LA LEY FORESTAL que en perjuicio de los RECURSOS NATURALES, se le venía atribuyendo. Se rechaza la solicitud de regresar las cosas a su estado anterior. Se declara sin lugar la acción civil resarcitoria establecida por el querellante y actor civil, la Procuraduría General de la República en contra del querellado y demandado civil [Nombre1] . Se falla sin especial condena en le condena al pago de las costas del juicio, tanto en la parte penal como en la civil, siendo los gasto de este a cargo del Estado. Cese cualquier medida de derechos fundamentales que se hubiere dictado en contra del aquí encartado y se ordena la destrucción de la evidencia material que se haya producido en este asunto. NOTIFÍQUESE POR [Nombre2].- JUAN CARLOS CASTRO VILLALOBOS, JUEZ DE TRIBUNAL".
  2. 2El licenciado Randall Aguirre Mena, en condición de Procurador Penal, interpuso recurso de apelación de sentencia contra el fallo de instancia. Dicha impugnación fue resuelta por la Sección Segunda del Tribunal de Apelación de Sentencia, mediante el voto número 2019-264, las catorce horas veinticinco minutos del diez de abril de dos mil diecinueve, en el que se dispuso lo siguiente: “Por Tanto:Se declara sin lugar el recurso de apelación de sentencia interpuesto por el representante de la Procuraduría General de la República”
  3. 3Contra el anterior pronunciamiento, la Procuraduría General de la República, interpuso recurso de Casación ante la Sala Tercera de la Corte Suprema de Justicia. En su libelo, el procurador Randall Aguirre Mena, interpone dos motivos de casación. El primero de ellos, relacionado a la falta errónea aplicación de un precepto legal, específicamente del artículo 25 de la ley de construcciones, lo que conllevó a la absolutoria del encartado, y consecuentemente al rechazo de la acción civil. En su segundo motivo de casación, se atacó la decisión de la Cámara de Apelación, en cuanto rechazó el tercer motivo de impugnación, mediante el que se atacaba la denegatoria por parte del Tribunal de instancia de la orden de derribo de las viviendas que están construidas en zona de protección.
  4. 4La Sala Tercera de la Corte Suprema de Justicia, mediante resolución número 2019-01076 de las once horas diez minutos del cuatro de setiembre de dos mil diecinueve, al referirse sobre la admisibilidad del recurso de Casación resolvió lo siguiente: Por tanto. Se admite para conocimiento de fondo, el primer motivo correspondiente al recurso de casación formulado por el licenciado Randall Aguirre Mena, en calidad de representante de la Procuraduría General de la República. Se declara inadmisible la segunda queja del recurso incoado por el licenciado Aguirre Mena, así como la “solicitud especial” de condena en costas al Estado por la defensa, Notifíquese.” (cfr.folio 710) Dicha impugnación fue resuelta por la Cámara de Casación Penal mediante voto número o 2020-671 de las nueve horas y cuarenta y ocho minutos del cinco de junio del año dos mil veinte, en el que se dispuso lo siguiente: “Por Tanto: Se acoge el reclamo planteado por la Procuraduría General de la República. Se anula la sentencia: N°2019-00264 del Tribunal de Apelación de Sentencia del Tercer Circuito Judicial de Alajuela, San Ramón, Sección Segunda, a las 14:25 horas, del 10 de abril de 2019; y se dispone el reenvío ante esa autoridad jurisdiccional para una nueva sustanciación conforme a derecho” (cfr. folio 718 vuelto).

Redacta la Jueza de Apelación de Sentencia Escalante Moncada; y,

CONSIDERANDO:

I.Con ocasión de lo resuelto por la Sala de Casación en las resoluciones 2019-01076 y 2020-671, este Tribunal de Apelación de Sentencia, con diversa integración, entra a conocer del primer motivo de apelación formulado en el recurso planteado por la Procuraduría General de la República, en el que se ataca la fundamentación de la sentencia absolutoria y el rechazo de la prueba. Debido a la competencia material que tiene esta Cámara de Apelación, con ocasión del reenvío ordenado por la Sala de Casación Penal, no se entra a conocer del motivo titulado en el recurso de apelación como “Tercer motivo sobre el rechazo de la solicitud de derribo”, el cual, si bien se titula como tercer motivo de impugnación, siguiendo una numeración consecutiva este alegato corresponde al segundo motivo de impugnación, esto debido a que lo que la Sala de Casación, mediante la resolución número 2019-1076, declaró inadmisible los alegatos que se habían planteado contra la forma en que este Tribunal de Apelación había resuelto dicho reclamo, aspecto que entonces ya había adquirido firmeza.

II.En el motivo de apelación que ahora se conoce, el licenciado Randall Aguirre Mena, Procurador Penal, alega violación a las reglas de la sana crítica, e irrespeto a los artículos 142, 184, 363 inciso c) y d) y 459 del Código Procesal Penal. Afirma que Tribunal de instancia incurre en una errada fundamentación y hace un incorrecto análisis de la prueba derivando aspectos contrarios a la sana crítica, lo que determina la absolutoria y conllevó al rechazo de la acción civil resarcitoria. Indica que los hechos – los cuales transcribe- se circunscriben a que el imputado [Nombre1] , en su calidad de ingeniero civil era el encargado de la construcción de cinco casas de interés social y, de forma fraudulenta, omitió informar a la Municipalidad de Poás de Alajuela de que la pendiente del lote en el que se edificarían las casas, con respecto del río Mastate era de un 53%, ello para evadir la obligación de respetar el área de protección de 50 metros respecto de la margen de dicho río.

Afirma que esta omisión indujo en error a la Administración activa, quien otorgó los permisos de construcción y eso ocasionó que se realizaran movimientos de tierra y se depositara material suelto en el área de protección de ese cause, eliminando cubierta vegetal mediante el uso de un back hoe, afectando una superficie de 700 metros cuadrados. Dice que la afectación se consolidó, debido a que se continuó con la construcción de las cinco viviendas de interés social con un área cada una de 32 metros cuadrados. Especifica que el impacto ambiental se fijó en [Dirección1]¢ , lo que implica: a) costos de regeneración natural asistida (reforestación de los 700 metros cuadrados, b) Costo Social en relación a la afectación del sitio frente al valor de pérdida de paisaje y belleza escénica frente a las futuras generaciones y c) pérdida en la calidad de vida de los recursos y comunidades de especie asociadas a dicho ecosistema alterado.

Explica que la afectación del área de protección se dio en dos oportunidades, primero con el movimiento de tierra y luego con la construcción definitiva de las viviendas. Afirma que el imputado, resulta responsable como profesional a cargo de esa obra. Refiere que el Tribunal de instancia sustenta su decisión en la existencia de una duda, pero estima que, el escaso análisis intelectivo de la sentencia absolutoria invalida la decisión, tanto por insuficiente como por erróneo. En este motivo, el apelante agrega dos subtítulos, en los que ofrece otras razones. Por encontrarse estos otros argumentos debidamente resumidos en el fallo número 2019-264, emitido por la Sección II de este Tribunal de Apelación de Sentencia, se hará uso de aquella síntesis. “En cuanto a la absolutoria del delito de invasión a un área de protección por la construcción de 5 viviendas de bien social.” (copia textual de folio 605 vuelto).

Alega que en la sentencia de instancia se alude a que existía una duda sobre el alineamiento que correspondía en este caso, donde se cuestiona el de 15 metros que había establecido el Instituto Nacional de Vivienda y Urbanismo, y que no se estableció por ningún otro ente administrativo otro alineamiento diferente. Objeta este argumenta, ya que indica que durante las conclusiones emitidas por parte de la Procuraduría se alegó la Ley Forestal de 1996 en el artículo 34 establece la prohibición de talar en áreas protegidas, salvo en proyectos declarados de conveniencia nacional por el Poder Ejecutivo, siendo que los alineamientos en estos casos deben ser realizados por el Instituto Nacional de Vivienda y Urbanismo. Señala que es claro que a esta entidad le corresponde realizar los alineamientos pluviales conforme al artículo 33 de la Ley número 7575. Objeta que la sentencia indique que dicho alineamiento había caducado y aún así le otorga vigencia en el año 2012.

Refiere que los mismos sellos de los planos catastrados expresaban que los alineamientos ahí consignados tenían una vigencia de un año (relaciona así los folios 14 a 17). Sostiene que el imputado, de forma falaz, en el debate dijo que por teléfono le habían indicado en el INVU que esos alineamiento no tenían vencimiento, argumentando que conforme al artículo 25 de la Ley de Construcciones los alineamientos no tenían vigencia, esto indica lo hizo con el afán de confundir al Tribunal, pues esa norma se refiere a los alineamientos viales que hacen Municipalidades y el MOPT, apunta que eso se debe a que la ley de construcciones es anterior a la ley forestal (artículo 18 de la ley de Construcciones). Concluye así que para el 2012 el alineamiento dispuesto en el 2008 había vencido y quedado sin efecto. Manifiesta que el mismo Tribunal califica de “caduco” dicho alineamiento, pero objeta que argumenta que como no había otro alineamiento para el lugar de los hechos, lo procedente era la aplicación de la duda.

Sostiene que tal argumento es completamente errado y parte de premisas falsas, porque, en tal caso si el alineamiento perdió vigencia entonces los terrenos no contaban, al momento de los hechos, con un alineamiento válido emitido por la entidad competente, es decir, no existía un alineamiento pluvial válido y eficaz, incumpliendo los planos con este requisito esencial y sin ese alineamiento no se puede realizar ningún tipo de construcción. Alega así que existe prueba que establece claramente la autoría del imputado, prueba que fue omitida en su análisis por el Tribunal incurriendo en falta de fundamentación intelectiva. Reclama que tampoco se tomó en cuenta lo referido por el testigo [Nombre3] sobre el alineamiento que dispone que son 50 metros para estos casos. Reprocha el análisis laxo de la prueba para concluir que no es posible acreditar que el imputado tenía conocimiento de que el alineamiento debía ser diferente a los 15 metros que establecía el alineamiento de los planos y conforme a los permisos municipales, reprochando que sí se aportó prueba sobre dicho conocimiento del imputado, que no fue valorada por el Tribunal sentenciador y en ello hace recaer la falta de fundamentación.

Al respecto señala que el testigo [Nombre3] , técnico forestal del MINAE, cuya declaración se transcribe, expresó que el día 1 de noviembre de 2012, cuando hicieron la visita al lugar de los hechos, se encontraba el imputado y que aunque este alegó lo referente a los permisos, era claro de los sellos que los mismos estaban vencidos, también se consigna que ellos le indicaron al imputado que el movimiento de tierra se encontraba dentro de los 50 metros que era lo aplicable a este caso por la pendiente del 54% de gradiente. En lo transcrito del relato del testigo también se hace referencia a que en una segunda visita constataron la existencia de las viviendas, todas dentro de los 50 metros del área de protección. De seguido hace referencia a la declaración del imputado en donde alude a la visita de los funcionarios del MINAE y como le indicaron que el alineamiento para ellos era de 50 metros y que el que había hecho el INVU era un alineamiento de escritorio que estaba vencido.

Sostiene así que el imputado, ante la información que le estaban siendo suministrada por los funcionarios del MINAE tomó una actitud pasiva, despreocupada y lo que hizo fue retirarse unos días para su casa y esperar a que le paralizaran las construcciones, las que, conforme la transcripción del dicho del mismo imputado, ante la no concreción de la paralización de obras reanudó y concluyó las mismas. Apunta que de lo anterior es claro que pese al conocimiento que tenía sobre la imposibilidad de construir dentro del área de protección y ser el encargado del proyecto, decidió materializar el comportamiento delictivo y llevó a cabo la construcción de las cinco viviendas, argumentando como justificación el que nunca le clausuraron la obra. Objeta que el imputado, siendo advertido por los funcionarios sobre la situación, no corroboró la medida de la pendiente y decidió continuar con la construcción de las viviendas, incurriendo así, a su criterio en la responsabilidad penal que se le reclama.

Cuestiona que no se ponderó tampoco el testimonio de [Nombre4] quien fue el funcionario que acompañó a [Nombre3] y corrobora como éste, mediante el uso de un clinómetro, constató que la gradiente del lugar era del 54%, cosa que indica que se hizo saber al imputado como encargado de la obra. Expresa así que el imputado como arquitecto e ingeniero civil cuenta con amplia experiencia en la materia de construcción de obras, conocía la existencia detallada en el plano de una restricción a la ley forestal en el lugar, que la pendiente era observable a simple vista en el sitio, que observó el alineamiento y sabía que estaba vencido para el primero de noviembre de 2012, que ese día fue informado sobre los 50 metros del área de protección y que tuvo el tiempo necesario para corroborar lo referente a la gradiente, que tenía conocimiento de que no podía construir ninguna edificación en ese lugar. Expresa así que conforme al artículo 33 de la Ley Forestal, en este caso en relación con el artículo 2 del Reglamento a dicha ley, es claro que al tratarse de una pendiente superior al 40%, el retiró debía ser de 50 metros y que eso lo supo el imputado antes de que se dieran las construcciones, pese a ello ejecutó la obra.

Expresa así que la prueba permite establecer la autoría del imputado en el delito que se le viene atribuyendo, no obstante, el tribunal de manera infundada y en lesión a las reglas de la lógica y la derivación procede absolver, sin analizar la prueba que a su criterio establecía el conocimiento del imputado sobre que el área de protección para este caso era de 50 metros. Alega así que se pretirió prueba testimonial y documental que establecía con claridad esos extremos y, por ende, la responsabilidad penal del aquí justiciable, así como la civil resarcitoria. 2.- En cuanto a la absolutoria del delito de invasión a un área de protección por los movimientos de tierra en el área de protección del río mastate. Relaciona el recurrente, con transcripción de la fundamentación del fallo, que en este aspecto se absuelve al imputado en aplicación de la duda, por cuanto, según se dice, los mismos funcionarios del MINAE, pese a que constataron la existencia del movimiento de tierra, no pudieron determinar si era reciente o no, además, aunque en el lugar observaron la presencia de maquinaria como lo es un Back Hoe, el mismo no estaba operando.

Se aúna a lo anterior que el mismo imputado indicó que en el momento en que él asume el proyecto y visita la propiedad ya las terrazas para construcción estaban hechas. Sostiene el recurrente que con esa argumentación, nuevamente el juez toma como referencia las declaraciones del imputado para sustentar la duda y no analiza la prueba que determina si los hechos querellados fueron o no acreditados. Expresa que en la sentencia, el tribunal indica que los testigos [Nombre3] y [Nombre4] apuntaron tener duda sobre si los movimientos de tierra eran recientes o de vieja data. Reclama que no se ponderan algunos otros aspectos del relato de estos y de la prueba, como es que del documento de folio 18 se establece que desde el 5 de setiembre de 2012 se podía iniciar la construcción y que desde ahí se establecía a [Nombre1] como el ingeniero responsable. Relaciona que de la inspección efectuada el día 1 de noviembre de 2012 se extrae que el operario del Back Hoe se encontraba en el sitio y objeta que no se analizara el sentido de que este estuviera en lugar si no fuera para los movimientos de tierra, ubicándose en el sitio al imputado como encargado del proyecto.

Argumenta que en el lugar se encontraba maquinaria, que había movimiento reciente de tierra, que desde marzo de 2012 el imputado era el encargado del proyecto y había ido por primera vez al lugar, además indica que en el folio 1 se constata que los funcionarios del MINAE recibieron una denuncia, vía telefónica, por movimientos de tierra en el lugar. Sostiene que, si en el lugar había maquinaria, ya fuera ese mismo día o los días previos, siendo el imputado desde setiembre el encargado del proyecto, objeta el razonamiento que sustenta la duda en cuanto a que no haya sido el imputado quién ordenó o contrató dichos trabajos. Reprocha así falta de fundamentación y violación de las reglas de la derivación al sustentar la absolutoria a favor del imputado. Sostiene que el agravio consiste en la no fundamentación de la absolutoria por duda respecto de ambos delitos de invasión de un área de protección, además de que sostiene incurre en una errada valoración de la prueba que incide no sólo en la responsabilidad penal, sino en el rechazo de la acción civil resarcitoria ocasionando un menoscabo en las pretensiones penales y civiles del Estado. Solicita se anule la sentencia y el debate que le antecedió y se proceda a ordenar un nuevo juicio.

III.Sin lugar el reclamo formulado. Revisada la sentencia de instancia, así como las probanzas respectivas, se concluye que existe un argumento esencial para confirmar la sentencia absolutoria dictada por el Tribunal de Juicio de Alajuela. Al respecto, y evaluada aquella decisión, se puede decir que el Juez de instancia, elaboró su decisión con fundamento en dos razones que son independientes entre sí. La primera de ellas, relativa a la aplicación e interpretación del artículo 25 de la Ley de Construcciones, en relación con la normativa que contiene la Ley Forestal. La segunda razón, estaba centrada, en la falta de demostración de una actuación dolosa por parte del imputado [Nombre1] . En este sentido, y en relación con el primer argumento, este Tribunal de Apelación de Sentencia, estima que, en efecto, tal y como lo indicó la Sala de Casación Penal en el voto número 2020-670, la Ley Forestal es norma posterior a la Ley de Construcciones, y es en la legislación ambiental que se establece el tamaño del área de protección, y por ende el tipo de retiro que debe respetarse para este tipo zonas que son colindantes con las laderas de los ríos.

En lo que interesa para la resolución del caso concreto, la Ley Forestal en el artículo 33 inciso b) indica lo siguiente: “b) Una franja de quince metros en zona rural y de diez metros en zona urbana, medidas horizontalmente a ambos lados, en las riberas de los ríos, quebradas o arroyos, si el terreno es plano, y de cincuenta metros horizontales, si el terreno es quebrado.” Esta norma, que es especial y posterior a la Ley de Construcciones, establece que las áreas de protección son las siguientes: Áreas de protección Se declaran áreas de protección las siguientes: (…) b) Una franja de quince metros en zona rural y de diez metros en zona urbana, medidas horizontalmente a ambos lados, en las riberas de los ríos, quebradas o arroyos, si el terreno es plano, y de cincuenta metros horizontales, si el terreno es quebrado”. De esta normativa, se establecen tres áreas de protección, una de diez metros lineales (zona urbana), otra de quince metros (zona rural), en ambos casos el terreno debe ser plano, y una tercera de cincuenta metros si el terreno es quebrado.

Es claro, que para la determinación del tipo de zona de protección debe existir exactitud de si el terreno está ubicado en zona rural o urbana y si este es plano o quebrado. De igual manera, de la norma se extrae con claridad, que en terrenos quebrados el área de protección en las laderas de los ríos es de cincuenta metros. Establecido esto, se tiene que, esta normativa es la que fija la medida que debe tener cada área de protección y, por ende, su alineamiento respectivo. Ahora bien, retomando el caso bajo examen, se tiene que, en el fallo de instancia, en uno de los argumentos se le dio prevalencia a lo que establecía el artículo 25 de la Ley de Construcciones que establece que los alineamientos que se elaboren son indefinidos, sin ponderar esa norma, en forma conjunta con lo que establecía la Ley Forestal. Ese yerro de la Cámara de instancia solo invalida esa argumentación, más no invalida la decisión de instancia de absolver al encartado [Nombre1] , por lo siguiente.

En este caso, hay varios hechos que no son controvertidos, el primero de ellos es que a cada uno de los planos catastrados que corresponden a los lotes objeto de este asunto, se les dio un alineado de quince metros según se desprende de los folios 13 al 17. Así como que en cada lote se construyó una casa de habitación. Otro suceso demostrado, es que funcionarios del sistema de Áreas de Conservación de la Cordillera Volcánica Central, realizaron durante el mes de noviembre de 2012, una inspección, en el terreno correspondiente a dichos lotes, y determinaron que las laderas de esas propiedades eran quebradas y que al tener una pendiente promedio de 54% por cierto, el área de protección es de cincuenta metros y no de quince metros. Que, en virtud de la discrepancia existente entre el alineamiento consignados en los planos catastrados y los resultados de la inspección realizada por los funcionarios del Ministerio de Ambiente, estos últimos mediante oficio número OG-1631-2012, dirigido a la Dirección de Urbanismo del Instituto Nacional de Vivienda y Urbanismo, peticionaron que se hiciera una inspección de campo y se revisara el alineamiento de quince metros otorgado a dichas propiedades (cfr.

Folios 1 al 5, y folio 41). Estos hechos son relevantes, porque inciden directamente en la forma que se resolvió este proceso por parte del Tribunal de instancia. Como se lleva dicho, el Juez de instancia externó un razonamiento más para sustentar su decisión, y que es independiente al primero (alcance del artículo 25 de la Ley de Construcciones), consiste en que en este proceso no se demostró con la certeza requerida que el imputado actuara con dolo. Este otro argumento, que es independiente del primero, resulta válido para sustentar la decisión del A quo por lo siguiente. El punto en discusión en este proceso, radica en establecer si las casas construidas por el imputado invaden la zona de protección, y con ello si se configura el delito previsto en el artículo 58 inciso a) de la Ley Forestal que establece lo siguiente: “Se impondrá prisión de tres meses a tres años a quien: a) Invada un área de conservación o protección, cualquiera que sea su categoría de manejo, u otras áreas de bosques o terrenos sometidos al régimen forestal, cualquiera que sea el área ocupada; independientemente de que se trate de terrenos privados del Estado u otros organismos de la Administración Pública o de terrenos de dominio particular.

Los autores o partícipes del acto no tendrán derecho a indemnización alguna por cualquier construcción u obra que hayan realizado en los terrenos invadidos.” Este tipo penal describe una conducta dolosa, y para los efectos del caso en estudio, significa que el imputado tiene que conocer que con las obras realizadas (movimiento de tierras y construcción de las casas) se está invadiendo una zona de protección. Por su configuración, este tipo penal no admite la comisión culposa, ya que no está prevista de forma expresa esa manera de comisión de esa conducta delictiva (artículos 30 y 31 del Código Penal). Por ello, cualquier error que recaiga sobre el conocimiento de uno de los elementos objetivos del tipo penal, elimina la configuración dolosa de esta clase de conductas y, por ende, se excluye la tipicidad de éstas. Adicionalmente, debido a la construcción que tiene la ilicitud bajo estudio, se concluye que este tipo penal solo admite el dolo directo, ya que el autor tiene que conocer de antemano, que con sus acciones invade una zona de protección, por lo que, la comisión por dolo eventual no sería factible, ya que el dolo eventual está dirigido esencialmente a la producción del resultado (artículo 30 del Código Penal), y no al conocimiento de uno de los elementos objetivos del tipo penal.

Adicionalmente, el tipo penal revisto en el artículo 58 inciso a) de la Ley Forestal, no es un delito de resultado; por el contrario, es un delito de mera actividad. Es decir, su consumación no requiere de la producción de un resultado, sino que el injusto penal se configura con las meras acciones de invadir la zona de protección. Retomando el caso bajo examen, se tiene que para el momento en que se ejecutaron los trabajos de movimiento de tierras y construcción de las viviendas, existía un alineamiento otorgado por la Dirección de Urbanismo del Instituto de Vivienda y Urbanismo, en el que se fijó un retiro de quince metros lineales en relación con el [Dirección2] . Por ello, con independencia si ese alineamiento estaba vigente o no, lo cierto es que existía un acto administrativo otorgado por el ente competente en el que se establecía que el retiro en relación con la ladera del río debía de ser de quince metros.

En otras palabras, al fijarse de esta forma el retiro, se puede concluir que el área de protección, para cada uno de esos lotes quedó fijada en quince metros. El alegato del Procurador gira en torno a que el imputado, antes de construir las casas, recibió la visita de los personeros del Área de Conservación, quienes le información, que el criterio técnico de esa oficina era que el retiro debía de ser de cincuenta metros, por ser un lote quebrado. Si bien, la inspección de campo realizada por funcionario del Ministerio de Ambiente, Área de Conservación, es un hecho que se demostró en autos, a partir del informe que consta a folios del 1 al 5, así como con lo declarado en juicio por los funcionarios [Nombre3] y [Nombre4] , de estos elementos de prueba no se puede inferir con la certeza requerida que el imputado haya actuado con dolo directo al momento de construir las viviendas. Esto es así, ya que como bien lo analizó el Juez A quo en su fallo, en debate se demostró que la entidad competente para hacer los alineamientos es el Instituto Nacional de Vivienda y Urbanismo.

Esto quiere decir, que, aunque la Ley Forestal establezca la cantidad de metros que conforman cada área de protección (10, 15, o 50 metros), le corresponde a la Dirección de Urbanismo, para cada gestión concreta establecer el tipo de retiro y el área de protección que se aplica a cada caso en particular. Sobre este punto declaró el funcionario Carlos Gutiérrez Santana, quien fue categórico en decir “El primero de noviembre de dos mil doce, con [Nombre4] , nos presentamos en el sitio, conocido como San Juan norte, Cabuyal, [Dirección3] [Nombre5] , llegamos al lugar de los hechos por una queja, por movimientos de tierra en área de protección del rio Mastate, llegamos al sitio y estaban presente el ingeniero [Nombre6] y tres personas más, el dueño del Back hoc, el chofer y un contratista. Se les explica el motivo de la visita, nos manifiestan que tienen los permisos, pero nosotros tomamos la información de campo, se toma la pendiente promedio y nos da un cincuenta y cuatro por ciento, luego se observa que o que es para aplanar los lotes, parte de ese movimiento se está yendo para el área de protección del río mastate, hicimos y tomamos el área y procedimientos, para hace estudios en la oficina y en la oficina determinamos que el área afectada son setecientos metros cuadrados, se procede a hacer una nota al INVU para el alineamiento, porque ellos son el ente competente (…) El INVU es el que da el alineamiento; hay Municipalidades que lo hacen, pero el ente competente es el INVU (la negrita pertenece al original, confrontar sumario de prueba del fallo de instancia.

Así como el oficio de folio 41) También, se acreditó que los funcionarios del Área de Conservación, de forma expresa, pidieron al INVU revisara aquel alineamiento, sin embargo, tal y como lo declaró el funcionario Carlos Gutiérrez Santana, y el imputado [Nombre1] , para la época de realización del debate, no constaba en autos, que la Dirección de Urbanismo haya emitido un criterio técnico variando el alineamiento otorgado a esos planos catastrados en el año 2008 o que haya contestado la gestión formulada por los funcionarios del Área de Conservación mediante el oficio OG-1631-2012. Esto es relevante, porque si bien, para antes de que se construyeran las casas por parte del encartado, existía una discrepancia entre el criterio de los funcionarios del Área de Conservación y los funcionarios de la Dirección de Urbanismo, en cuanto al retiro que debía respetarse en dichos terrenos, a saber, según el criterio técnico de los funcionarios del Ministerio de Ambiente debía de ser de cincuenta metros, porque los lotes tienen una pendiente superior a 54% y, según consta en el expediente de la Dirección de Urbanismo, dicho retiro es de quince metros.

Y aunque esta discrepancia era conocida por el acusado, lo cierto también es que, no se demostró en autos, que para antes de que se iniciara el proceso de construcción de las casas, esa discrepancia técnica haya sido resuelta por la Dirección de Urbanismo y le fuera informado al encartado de un nuevo criterio en cuanto a las dimensiones del área de protección a respetar. De ahí que no se puede concluir, que el acusado tenía la certeza necesaria de que las casas estaban siendo construidas en el área de protección. Este otro argumento, fue ampliamente expuesto por el Tribunal de instancia, al hacer un examen de las probanzas, y es a partir de esa ponderación establece que en este caso no se podía acreditar que el imputado actuó de forma dolosa, ya que sobre ese extremo existía una duda. En este sentido, si bien el examen de las probanzas es amplio y suficiente, es relevante traer a colación el siguiente extracto que contiene el fallo de instancia: “Es importante indicar aquí que debemos aplicar todo lo razonado anteriormente en cuanto a que no logra determinarse la existencia del alineamiento correcto para la zona del río Mastate en cuestión; pero es que no existe prueba alguna que logra ni siquiera acercarse a que el imputado tenía conocimiento previo de que el retiro debía ser diferente a 15 metros, por el contrario, los documentos en los cuales se establecen los visados de la Municipalidad y la existencia del supuesto alineamiento de 15 metros datan de dos mil ocho, y no existe en autos un solo documento para indicar que entre esa fecha y la primera visita de los oficiales del SINAC, existiera motivo alguno para dudar del alineamiento establecido en la data dicha – 2008 -, como para que el propio imputado realizara las medidas respectivas, por el contrario, narra el imputado como es que él entra en conocimiento de ésta construcción y la forma en la que se produce su participación y en ese sentido manifestó “ Como llegue ahí.

Grupo Mutual se dedica a solventar vivienda y existen aliados a la Mutual, como el caso de la empresa que trabajo, que tiene una trayectoria y desarrolla los proyectos, tienen los nombres de las compañías y se las dan a personas que quieran vender en una zona que quieren desarrollar. Yo llego así y me llama el esposo de la propietaria anterior, sea el que le vendió los lotes a los propietarios actuales, dado que mi nombre aparece en la lista dicha, así en marzo de dos mil doce, ese día me reuní con el esposo de la propietaria, para evaluar la posibilidad de que los lotes fueron presentados para desarrollar viviendas de interés social.- Cuando nosotros como Ingenieros se visita para evaluar, lo que se solicita que la propiedad ese al día, o sea que tenga el plano de castrato y que este visado, e inscrito en el registro público. Y en la parte técnica, la construcción de vivienda, sea que tenga los servicios de agua y electricidad.- Es así como en marzo visito las propiedad y el esposo de la propiedad me entrega un expediente, se encuentran estos documentos, planos de catastro, plano de catastro visados por la Municipalidad, disponibilidad de agua y electricidad uso de suelo municipal y en el caso de la Municipalidad de Poás se requiere un visado ambiental.- Todos los documentos me fueron entregados y los lotes tenían los permisos inscritos, y tenían el alineamiento del INVU, quiero enfatizar en esto que, el alineamiento data del año dos mil ocho, esto quiere decir que cuando yo no conocía las propiedad, las propiedades y catastrados que datan del dos mil ocho las propiedades fueron segregadas, inscritas ante el registro, presentadas ante la municipalidad y la municipalidad viso la propiedades, para mí como ingeniero o a cualquier otro, que la propiedad tenga el visado municipal, indica que la propiedad a cumplido con todos los requisitos” Continua el imputado aclarando “…

Volvemos al punto de que estoy en el sitio, ahí verificó que los papeles indiquen todo lo que dicen esos papeles y que lo puedo constatar, puedo constatar que hay una calle pública construida, que hay servicios de agua luz y teléfono y constato que en la propiedad contigua a uno de los lotes, existe una vivienda construida. Puedo constatar además, no se quien, pero los lotes están totalmente planos, o sea que se han movido tierras porque están listos para construir…” aquí el demandado hace mención que para marzo de dos mil doce, ya los lotes están debidamente nivelados y sobre este punto volveremos más adelante; en la lógica del análisis, continúa el imputado diciendo “… le indico al esposo de la propietaria que las propiedades son aptas para un proyecto de vivienda y se procede a presentar el proyecto ante el Grupo Mutual, que en primer caso, su deber es evaluar la vialidad de este proyecto, por medio de tres partes, una parte, que es la técnica, en el aspecto social, o sea si las familias que se presentaron y aquí presentes, cumplen para un subsidio del estado, otro departamento, que es el legal, que revisa el estado legal de las propiedad, que no hayan impedimento para poder ser presentadas, y la tercera parte, es la parte técnica en el área de ingeniería y arquitectura.- Es así como otro profesional debe realizar un informe técnico de las propiedades y del valor de las mismas, o sea el avalúo.- Es así como en este caso Luis Alfonso Ramírez, hace el avalúo, constata la información por mi presentada, constata que los lotes sean aptos para la construcción de las viviendas, y que efectivamente puedan ser presentados para el BANHVI para su aprobación…….Siguiendo con el proceso de construcción de estos lotes.

La Mutual eleva los asuntos al BANVI los expedientes, o sea que es el administrador de los recursos del BANVI, sino que les otorga un crédito a los propietarios para comprar las propiedades; aquí los dineros pueden ser utilizados para la construcción de bien inmueble casa y el dinero para comparar los lotes por la mutual Alajuela, entonces esa es la posición, sea administran el recurso y otorgan el crédito para la compra de las propiedades. ….. Como llegamos al arranque de las obras, una vez que el BANVHI aprueba los recurso y que va a dar los dineros, se tienen que solicitar los permisos de construcción, los permisos se solicitan ante la MUNICIPALIDAD que es el gobierno local, se debe de cumplir una serie de requisitos, y en todas las municipalidades son diferentes por su independencia, pero algunos son típicos a nivel nacional, como son, el plano de catastro visado, alineamientos en caso que los necesitas, un alineamiento vial si la calle es nacional, por parte del INVU otro por quebrada o rio, un uso de suelos que lo da la Muni y dice que podemos hacer en esa propiedad e indica al ingeniero municipal y cuáles las restricciones a nivel cantonal o local, en ese momento la Muni tiene un requisito más, el renovación del visado ambiental, debo ser enfático, puesto que esos visados se renuevan estos en agosto del dos mil doce, o sea que para la construcción de las viviendas no tenían ni tres meses de emitidos y si puede revisar el visado ambiental, se indica si existe una zona de protección en las propiedades y se da el USO CONFORME…”, la prueba de cargo hacen ver a esta autoridad, como desde el inicio de esta problemática, el día primero de noviembre de dos mil doce, el ingeniero imputado, aclara e intenta aclarar con los funcionarios del MINAET que el alineamiento es de 15 metros y no como lo indicaron en su visita, tanto así que incluso manifestó el encartado haberse comunicado con el departamento respectivo en el INVU y le informaron que iban a realizar una inspección; no existe en autos prueba alguna, o manera alguna de desvirtuar lo dicho por el imputado, o prueba que venga a acreditar la existencia de un conocimiento previo sobre la situación de la pendiente y que con ese conocimiento el imputado actuara fraudulentamente y siendo que en ese conocimiento previo se basa la acusación de la Procuraduría, no puede más que confirmarse lo ya indicado, una sentencia absolutoria” (copia textual de folios 560 y 561.

El resaltado pertenece al original). Como se aprecia, en este argumento, el juez hace referencia a que no había prueba suficiente que permitiera llegar a la certeza requerida de que el encartado conociera que el alineamiento correcto era el de cincuenta metros que señalaba el MINAE, ya que más bien, a partir de ese criterio de dicho órgano ambiental, es que surge una controversia entre dos entidades públicas, sin que se acreditara la resolución de esa disputa técnica, y que el encartado, entonces, tuviera conocimiento, certero y actualizado, de la dimensión del área de protección que debía respetarse en esa zona. Dicho de otra forma, la circunstancia fáctica que fue demostrada, referente a que existía un alineamiento previo elaborado por el INVU en el año 2008, con independencia si dicho alineamiento había caducado o no o si era correcto o incorrecto, establecía la dimensión del área de protección para cada lote en quince metros líneales, es decir, cualquier otra zona que estuviera fuera de esa área demarcada de quince metros no sería área de protección.

Es aquí donde se aprecia la relevancia de esas probanzas, ya que inciden directamente, en el conocimiento que tenía el imputado acerca de si el área en el que se construyeron las casas era un área de protección. Es decir, según lo analizó el Juez de instancia, al existir un alineamiento de quince metros, la tesis defensiva cobra relevancia, al aducir, de que el encartado estimó válidamente que las casas estaban fuera del área de protección. De ahí, se tiene que, en este caso, estaríamos frente a un error de tipo, el cual tiene como resultado que no sería factible la configuración dolosa de la conducta delictiva. Ahora bien, el estado de duda al que alude el juez, es sobre el conocimiento de uno de los elementos del tipo penal (área de protección), por parte del encartado y de ahí la decisión que se emitió en instancia de absolver al encartado. En este orden de ideas, si el error de tipo era vencible (como lo propone la Procuraduría) o invencible, esa distinción carece de relevancia jurídica para este caso concreto, ya que el tipo penal de invasión a la zona de protección solo permite la comisión por dolo directo y, por ende, un error en uno de los elementos del tipo penal lo que produce es la atipicidad de la conducta y de ahí que, lo procedente es mantener la decisión de instancia.

En lo que respecta a la forma en que se resolvió la demanda civil por parte del A quo, esta decisión debe mantenerse por lo siguiente. En este caso, según consta en autos la acción civil interpuesta por la Procuraduría General de la República, basó la relación de hechos, en el siguiente cuadro fáctico: “1.- Que para el año 2012 el imputado [Nombre1] se desempeñaba como ingeniero civil teniendo a su cargo la construcción de un proyecto de bienes social consistente en la fabricación de 5 casas de 42 metros cuadrados cada una, en un terreno ubicado en San Juan de Poás de Alajuela, de la Iglesia católica del lugar [Dirección4] – propiamente entre coordenadas [Dirección5] : , en lotes, respetivamente los cuales aparecen inscritos en el Registro Público Inmobiliario a nombre de los señores: [Nombre7] , cédula de identidad número CED2; [Nombre8] , cédula de identidad número CED3; [Nombre9] , cédula de identidad número CED4; [Nombre10] , cúedla de identidad CED5 y, [Nombre11] , cédula de identidad CED6, con planos catastrados números A-3482491996; A-346928-119; A-346927-119; A-346926-1996 y, A-348254-1996, respectivamente en cada caso. 2.- Sin precisarse fecha ni hora exacta pero, con anterioridad al 01 de noviembre de 2012, el encartado [Nombre1] , ejerciendo su condición de ingeniero civil encargado de las obras en el sitio descrito en el Hecho Primero, teniendo bajo sus órdenes a terceros, a sabiendas de que el área de protección de 50 metros del río Mastate por corresponderle una pendiente de 53% de inclinación y obtener fraudulentamente al omitir este dato a la Municipalidad de Poás de Alajuela dicho retiro y obtener los permisos de construcción respectivos, sin contar con los permisos del Ministerio de Salud y no indicar en la solicitud de permiso de construcción ante la Munipalidad el área de retiro de protección por la inclinación de la pendiente lo que indujo a error a la Administración activa competente, invadió el área de protección del rio Mastate al realizar movimientos de tierra y depositar el material suelto dentro de la referida área de protección y se eliminó cubierta vegetativa, mediante el uso de un Back Hoe, afectando una superficie de 700 metros cuadrados, siendo que los funcionarios del MINAE de Alajuela señores Eliden Alcazar Barahona, y Gerardo Martín Arguello Arce le advierten sobre la invasión al área de protección riberina y la suspensión de la continuidad de las obras constructivas en el sitio como medida cautelar administrativa.- 3.- Sin precisar fecha ni hora exactas, con posterioridad al 01 de noviembre de 2012 el endilgado [Nombre1] , con pleno conocimiento y faltando al deber de probidad a sabiendas de la inclinación de la pendiente, continuando con la labor como profesional responsable del proyecto habitacional, a través de varias personas contratadas bajo sus órdenes, consolidó la invasión al área de 50 metros de protección del río Mastate el cual presenta una inclinación de 53 % de pendiente, al construir un total de 5 casas de bien social de 32 m2 cada una. 4.- Los actos materiales desplegados por el imputado generaron múltiples impactos negativos al área de protección del río Mastate y el Ambiente, los cuales fueron fijados prudencialmente en la suma de ₵ 682.986,95 (SEISCIENTOS OCHENTA Y DOS MIL NOVECIENTOS OCHENTA Y SEIS COLONES NOVENTA Y CINCO CENTIMOS) al comprender: a) los costos de regeneración natural asistida (reforestación) de los 700 m2 afectados del área de protección; b) el Costo Social en relación a la afectación del sitio frente al valor pérdida de paisaje y belleza escénica frente a las futuras generaciones; c) perdida en la calidad de vida de los recursos y comunidades de especie asociadas a dicho ecosistema alterado, en tanto los ítems de estimación más importantes.” (copia textual de legajo de querella y acción civil).

De la descripción fáctica que hace la Procuraduría, se deriva que el criterio de imputación que se utilizó para reclamar la responsabilidad civil del encartado [Nombre1] , fue por una responsabilidad civil extracontractual subjetiva directa, por acciones dolosas realizadas por el imputado, al punto que se afirma que la actuación del imputado fue fraudulenta y que de forma consciente indujo en error a la Municipalidad para que le otorgara los permisos de construcción. Este criterio de imputación que se plasmó en la acción civil, cobra relevancia, debido al principio de congruencia que rige la materia civil y sobre el que la Sala Tercera de Casación Penal ha indicado lo siguiente: “Conviene recordar que los criterios de imputación de responsabilidad civil que se invoquen, deben encontrarse amparados en la relación de hechos o motivos en que la acción se basa, la cual, al igual que la acusación penal, debe ser clara y específica, para permitir el ejercicio pleno del derecho de defensa de la parte demandada civil, toda vez que esa relación fáctica va a incidir de manera directa tanto en la forma en que sea contestada la demanda por la contraparte, como en el ejercicio pleno del derecho de defensa y la cuestión probatoria (ver artículos 112 del Código Procesal Penal y 290 del Código Procesal Civil).

Lo anterior cobra también importancia para salvaguardar el principio de congruencia, contenidos en los numerales 99, 153 y 155 del Código Procesal Civil. Sobre el particular, el primero indica: “La sentencia se dictará dentro de los límites establecidos en la demanda. Es prohibido para el juez pronunciarse sobre cuestiones no debatidas respecto de las cuales la ley exige la iniciativa de la parte.”; regulación que, para los efectos del dictado de la sentencia, también se contienen en los ordinales 153 y 155 del mismo cuerpo normativo, cuando indican: “ARTÍCULO 153.- Requisitos y denominación. Las resoluciones de los tribunales deben ser claras, precisas y congruentes; deberán expresar el tribunal que las dicta, el lugar, la hora, el día, el mes y el año en el que se dicten, y se denominarán: (…) 3) Sentencias, cuando decidan definitivamente las cuestiones debatidas mediante pronunciamiento sobre la pretensión formulada en la demanda.

(…)”; “ ARTÍCULO 155.- Requisitos de las sentencias. Las sentencias deberán resolver todos y cada uno de los puntos que hayan sido objeto del debate, con la debida separación del pronunciamiento correspondiente a cada uno de ellos, cuando hubiere varios. No podrán comprender otras cuestiones que las demandadas, ni conceder más de lo que se hubiere pedido. (…)” El Tribunal de Apelaciones resolvió entonces conforme la normativa civil que extraña el quejoso, al señalar que se vulneró de manera grosera el principio de congruencia y el derecho de defensa. La parte actora civil pretende ahora desconocer el principio de imputación atribuido al notario [Nombre12] , a quien le atribuyen haber participado de una forma activa y dolosamente en el plan delictivo para apoderarse de las propiedades de los ofendidos y actores civiles, a quienes les hicieron creer que se las comprarían, logrando mediante la simulación de hechos falsos que estos firmaran las escrituras de traspaso de esos bienes.

Ciertamente, resulta patente que el Juzgador, en lo que concierne a la acción civil resarcitoria es soberano -por el principio iura novit curia-, en la aplicación del derecho para el caso concreto; no obstante, no puede obviarse que su límite está circunscrito a la relación de hechos, que la acción civil contenga. Además, si bien los juzgadores tienen la potestad de aplicar otros criterios de imputación, en este caso estaban limitados por la relación de hechos contenida en el legajo de la demanda civil, siendo patente que dicha narración fáctica no describe una actuación negligente de parte de [Nombre12] es decir, que asesorara inadecuadamente como notario a los ofendidos. En síntesis, el cuadro fáctico consignado en el documento de acción civil resarcitoria formulado por la Oficina de Defensa Civil de la Víctima, indica únicamente la existencia de un criterio de responsabilidad civil (imputación civil), basado en la comisión de un hecho delictivo de carácter doloso y no un actuar negligente como intentó enderezar el tribunal a quo, y del que ahora pretende aprovecharse el reclamante en esta sede, en detrimento del principio de congruencia que rige en la materia civil.

En este sentido, esta Sala, en sentencia Nº 2011-0173, sobre el tema señaló: “…si no existe un hecho civil que sustente la pretensión de la acción civil no sería jurídicamente factible otorgar una reparación porque ello iría en contra el principio de congruencia (art. 99 del Código Procesal Civil). De ahí que la redacción de los hechos en la acción civil tenga una trascendencia preponderante, pues deben ser lo suficientemente completos para sustentar la pretensión de la parte. (En este sentido puede consultarse: [Nombre13], . (2010). Simplemente la verdad. El juez y la construcción de los hechos. Traducción de Daniela Accatino Seagliotti. Madrid. Ediciones Jurídicas y Sociales S.A. [Nombre14], Taruffo, Michele. (2008). La prueba. Madrid. Ediciones Jurídicas Sociales S.A.). Además, los hechos fijarán el marco sobre el cual se aportará la prueba (art. 317 del Código Procesal Civil)…” También ha establecido que “…en relación con la causa de pedir, se ha señalado que respecto a la acción civil el cuadro fáctico que expone la parte es el marco de acción dentro del cual debe el juzgador resolver sobre la petición del accionante…” (Sala Tercera de la Corte Suprema de Justicia , Voto número 56-2006, de las nueve horas, del tres de febrero de dos mil seis, reiterado en el voto de este mismo órgano de Casación número 2012-00045, a las diez horas y cuarenta minutos del trece de enero del dos mil doce), siendo que dicho fallo señala que tanto en materia penal como en civil deben respetarse los hechos imputados a los demandados civiles, pues de ellos depende, el ejercicio pleno del derecho de defensa y de imputación.” (Sala Tercera de la Corte Suprema de Justicia, número 2017-00205 de las diez horas trece minutos del veintidós de marzo del dos mil diecisiete).

Retomando el caso bajo examen, se tiene que el Juez de instancia, indicó lo siguiente: “En cuanto a la acción civil resarcitoria instaurada por el querellante y actor civil, la Procuraduría General de la República en contra el imputado- demandado civil [Nombre1] , consistente en el pago como indemnización del daño ambiental a la zona protegida, debe rechazarse la misma, por cuanto esta subsiste como accesoria a lo penal, y en ese sentido se absolvió de pena y responsabilidad penal al señor [Nombre1] , en virtud del estado de duda imperante sobre la existencia de un alineamiento diferente y mayor a los quince metros, con ellos no logra determinarse y queda en duda si existió un hecho generador de los daños que fueron descritos y ante eso no es posible tomar otra decisión que denegar los aspectos civiles de este asunto penal, ello sin especial condena en costas” (copia textual del fallo de instancia).

Examinada la sentencia, como la unidad lógico jurídica que es, se tiene que la denegatoria de la acción civil resarcitoria estaba directamente relacionada con el hecho de que no se pudo demostrar que el acusado tenía conocimiento de los elementos del tipo, en virtud de las inconsistencias en los alineamientos dados por dos entidades gubernamentales (SINAC e INVU) que las casas eran construidas invadiendo la zona de protección. En otras palabras, el Juez de Juicio descartó como criterio de imputación una actuación dolosa por parte del encartado, en lo que se refiere a la invasión del área de protección por la construcción de las casas. Asimismo, de la sentencia se desprende que, para el otro evento referente a la remoción de la capa de vegetación por los movimientos de tierras realizados en dichos terrenos y que afectaron él área de protección, no se demostró que fuera el encartado, quien realizó u ordenó esas labores (conclusión que es compartida por esta Cámara de Juicio), y por ello, también se le absolvió por esos otros hechos.

Ahora bien, en su recurso, el Procurador, alude a una eventual actitud omisiva del encartado, de índole culposa (por no cumplir con sus deberes de forma adecuada, o por negligencia o imprudencia). No obstante, al descartarse la existencia del criterio de imputación por dolo, no sería procedente emitir una sentencia condenatoria en lo civil, por otro criterio de imputación, tal como una responsabilidad civil subjetiva directa por culpa, o una eventual responsabilidad civil objetiva, sin que se violente el principio de congruencia que rige en materia civil, así como el derecho de defensa del demandado civil. Por ello, la decisión de instancia de rechazar la acción civil es procedente y por ende se dispone mantener incólume el fallo de instancia, en los aspectos valorados en esta oportunidad por la Cámara de Apelación. En consecuencia, se declara sin lugar el motivo de apelación interpuesto por la Procuraduría General de la República y que sustentó la emisión de este fallo.

POR TANTO:

Se declara sin lugar el motivo de apelación interpuesto por la Procuraduría General de la República y que sustentó la emisión de este fallo. Notifíquese.
