Amparo proceeding (recurso de amparo) filed by CARMEN MARÍA ESPINOZA TORRES, identity card 0600660230, against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.
Background:
Justice Salazar Murillo delivers the opinion; and,
Considering:
The petitioner believes that her fundamental rights have been violated because Judgment No. 2009-09880 partially granted the amparo proceeding (recurso de amparo) concerning the failure to treat sewage (aguas negras) in the Cantón de Golfito; however, to date, there is no sewage treatment plant (planta de tratamiento de aguas negras), even though she is charged for sewerage service (servicio de alcantarillado), which she does not receive. She complains that the respondent has not begun the construction or repair of the sewerage system in her community, despite the money charged for sewerage service.
The following facts are deemed duly established and relevant to the determination of this matter:
To effectively safeguard the right to a healthy and ecologically balanced environment, the State, understood in the broad sense, has a duty to implement the measures necessary to ensure the timely and effective treatment of sewage in the country’s communities. In this regard, this Constitutional Court has held that the Instituto Costarricense de Acueductos y Alcantarillados, the Municipalities, and the Ministerio de Salud are responsible—within their respective spheres of authority—for ensuring the proper collection, treatment, and final disposal of such wastewater. Thus, specifically in the case of the Instituto Costarricense de Acueductos y Alcantarillados, its Constitutive Law—Ley No. 2726 de 14 de abril de 1961 y sus reformas—provides as follows:
“Article 1.- For the purpose of directing, setting policies, establishing and enforcing regulations, carrying out and promoting planning, financing, and development, and resolving all matters relating to the supply of drinking water and the collection and disposal of sewage and liquid industrial waste, as well as the regulatory aspects of storm sewerage systems (sistemas de alcantarillado pluvial) in urban areas, the Instituto Costarricense de Acueductos y Alcantarillados is hereby created as an autonomous State institution with jurisdiction throughout the national territory.” Accordingly, under Article 2 of that same body of law, that institution is responsible for (…) Directing and overseeing all matters concerning the provision to the inhabitants of the Republic of drinking-water service, the collection and disposal of sewage and liquid industrial waste, and stormwater in urban areas (…)”.
Regarding the Municipalities, it should be noted that Article 169 of the Constitución Política grants them authority to plan and oversee the urban development of their localities, as a consequence of their duty to administer local interests and services in each canton. In view of the foregoing, each municipality is responsible for establishing a comprehensive urban-planning policy that ensures development consistent with the efficient operation of a drinking-water supply system and a system for the collection, treatment, and final disposal of sewage. Likewise, the Ley General de Salud—Ley No. 5395 de 30 de octubre de 1973—provides in Article 2 that the Executive Branch, acting through the Ministerio de Salud, is responsible for defining national health policy, regulating, planning, and coordinating all public and private health-related activities, and carrying out those activities assigned to it by law.
Similarly, Article 341 of that law establishes, among the powers of the Ministerio de Salud, the power to order and adopt the special measures authorized by that legislation to prevent risks or harm to human health, to prevent such risks or harm from spreading or worsening, and to prevent private parties from continuing or repeating violations. With respect to the specific matter at issue, the Ley General de Salud, in Book 1, Title 3, Chapter 3, “Obligations and Restrictions Concerning the Sanitary Disposal of Excreta and Wastewater,” provides, in relevant part, as follows:
“Article 285.- Excreta, sewage, wastewater (aguas servidas), and stormwater (aguas pluviales) shall be disposed of properly and hygienically in order to prevent contamination of the soil and natural water sources intended for human use and consumption, the creation of breeding grounds for disease vectors, and air pollution through conditions that impair its purity or quality.” (Emphasis not in the original).
“Article 287.- Every natural or legal person who owns a dwelling, establishment, or building in which persons conduct their activities shall be responsible for ensuring that such property has a system for the disposal of excreta, sewage, and wastewater approved by the Ministerio, and users of dwellings, establishments, or buildings shall be required to maintain that system in good working order.” “Article 288.- Every owner shall be required to connect the system for disposing of excreta, sewage, and wastewater from the owner’s property to the sanitary sewerage system wherever that system is operational, except in those cases recognized as appropriate exceptions under the applicable regulations.” That legislation also establishes the obligation of the authorities of the Ministerio de Salud to ensure the application of and compliance with the provisions of that law and its regulations, without prejudice to the powers and obligations granted and imposed by special laws upon other public bodies or entities within their respective spheres of action (Article 337).
This confirms the various functions and obligations that the legal system imposes upon the Instituto Costarricense de Acueductos y Alcantarillados, the Ministerio de Salud, and the municipalities with respect to the collection, treatment, and final disposal of sewage. Moreover—as already indicated in the preceding recital (considerando)—those functions and obligations must be exercised in a coordinated manner to ensure administrative effectiveness and efficiency.
The petitioner considers that her fundamental rights have been violated because, by judgment No. 2009-09880, the action was partially granted due to the failure to treat sewage (aguas negras) in the Canton of Golfito; however, to date there is no sewage treatment plant. She complains that the respondent has not begun construction or repairs of the sewer system in her community, despite the money charged for sewer service. In this regard, it is established that on 19 de junio de 2009, this Court partially granted the action through decision No. 2009-009880 and ordered the following: “to immediately adopt the appropriate measures within the scope of their authority to expedite the commencement of construction and commissioning of the Wastewater Treatment Plant (Planta de Tratamiento de Aguas Residuales, PTAR) of the city of Golfito.” As a result of that judgment No. 2009-009880, the procurement process for “Engineering Services for the preparation of feasibility studies and final designs for the sanitary sewer system of the city of Golfito Puntarenas” was initiated through bidding process 2014LA-000005-PRI, the principal result of which was the final construction plans that will enable the implementation of an entirely new wastewater collection and treatment system using modern technology.
The project has approved financing from the German bank KfW and counterpart funding from the Instituto Costarricense de Acueductos y Alcantarillados. The project is intended to benefit 7.137 inhabitants of the area, and its objectives are: “a) Construction of the sanitary sewer network in the city of Golfito. b) Construction of a Wastewater Treatment Plant that will ensure compliance with the Reglamento de Vertidos, thereby reducing pollution in the effluents. c) Sanitary sewer coverage for 90% of the population served by the drinking-water system by the year 2046. d) Elimination of untreated wastewater discharges directly into rivers and the sea.” It is likewise verified that the project is currently in the design stage and is 77% complete, and completion of construction is estimated for the month of octubre del año 2024. However, following the filing of this constitutional protection action (recurso de amparo), the respondent included the “Construction of the Sanitary Sewer System for the city of Golfito, Puntarenas” project within the Programa de Saneamiento en Zonas Prioritarias, which consists of the following stages: Stage I: Assessment and Evaluation of Works; Stage II: Feasibility and Prioritization of Works; Stage III: Final Design (of both the wastewater collection system and the Wastewater Treatment Plant “PTAR”); and Stage IV: Construction (of both the wastewater collection system and the Wastewater Treatment Plant “PTAR”).
The respondent reported that an agreement between the INSTITUTO COSTARRICENSE DE FERROCARRILES and AYA is close to being finalized for the purpose of obtaining authorization to install the conveyance and distribution line that will run along the railroad right-of-way (derecho de vía férrea) from the vicinity of the depósito libre to the outskirts of central Golfito, an approximate distance of 3 kilómetros, where it will connect to the Treatment Plant to be constructed. The petitioner has five drinking-water services identified by numbers NIS 542-0141 / 528-7154 / 528-7155, which are current, while services Nis 528-9122 and 542-6965 have outstanding balances; all are located in the Pueblo Civil Golfito sector. The protected party’s services are connected to the 300mm wastewater collection network, which receives preventive maintenance to avoid obstructions in the network and repair services, with three officials assigned to provide the maintenance and assistance in question.
Accordingly, this Court observes that, 10 years after judgment 2009-009880 was issued, the problem persists, thereby confirming that the violation of the petitioner’s fundamental rights continues. Although the respondents have taken some steps aimed at resolving the cited problem, the fact remains that those measures have been insufficient to bring the situation to an end. It should be noted that the respondent states that the works would be completed in octubre de 2024; nevertheless, this Chamber considers the period of 4 years that the community of Golfito would have to wait while the project is completed to be excessive. In view of the foregoing considerations, the appropriate course is to grant the action, with the consequences to be specified in the operative portion.
V.Finally, the petitioner alleges that she is charged for sewer service that she does not receive and therefore believes that the money charged for that service should be refunded. However, it is noted that the matter raised by the claimant is merely a dispute involving ordinary legality (legalidad ordinaria), which does not involve, at least directly, any fundamental right and therefore exceeds the scope of this Chamber’s jurisdiction. Indeed, this Court is neither a reviewer of legality nor an additional administrative instance, and therefore it is not for this Court to determine whether the charges on bills for sewer service are proper. Those claims therefore concern matters of ordinary legality that must be resolved by the Administration or, where appropriate, by the ordinary courts (jurisdicción ordinaria). Consequently, any violation of the protected party’s rights in connection with this issue is ruled out.
In environmental matters, it is the undersigned Justice’s view that, if the Public Administration has already intervened, jurisdiction to hear and resolve the matter lies with the administrative litigation courts (jurisdicción contenciosa administrativa). Nevertheless, I do address the merits of the matter when other rights of persons affected by the lack of sewage treatment in the Canton of Golfito are at stake, including health, quality of life, and the right to enjoy a healthy, pollution-free environment (artículo 50, de la Constitución Política), as is the case here, where the failure of the respondent authorities to begin construction or repairs of the sewer network intended for the treatment of sewage and wastewater is alleged. In this regard, this omission affects the health of local residents, in violation of the right to enjoy a healthy and ecologically balanced environment and a dignified standard of quality of life.
The petitioner is advised that, if she submitted any paper document, as well as any objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device, she must retrieve them from the court office within a maximum period of 30 business days from notification of this judgment. Otherwise, any material not retrieved within that period shall be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session No. 27-11 of 22 de agosto del 2011, artículo XXVI, and published in the Boletín Judicial No. 19 of 26 de enero del 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial at session No. 43-12 held on 3 de mayo del 2012, artículo LXXXI.
Por tanto:
The action is partially granted, solely due to the lack of a sewage treatment system in the community of Golfito. Irving Zelaya Palacios, in his capacity as Acting Director of the Región Brunca; Noilyn Gutiérrez Arias, in her capacity as Head of the Oficina Cantonal de Golfito, both of the Instituto Costarricense de Acueductos y Alcantarillados; and Fernando Mata Castro, in his capacity as Director of the Área Rectora de Salud del Ministerio de Salud, or whoever holds those positions, are ordered to adopt immediately and in coordination, within the scope of their authority, the measures and actions necessary to complete construction of the Wastewater Treatment Plant project for the city of Golfito and place it into operation within the non-extendable period of twenty-four months from notification of this decision. They must also submit a semiannual report on the project’s progress to this Court.
The respondent authorities are warned that, pursuant to artículo 71, de la Ley de la Jurisdicción Constitucional, imprisonment from three months to two years or a fine of twenty to sixty days shall be imposed on anyone who receives an order issued in a constitutional protection action that the person is required to comply with or enforce and fails to comply with or enforce it, provided that the offense is not subject to a more severe penalty. The State and the Instituto Costarricense de Acueductos y Alcantarillados are ordered to pay the costs, damages, and losses caused by the facts underlying this ruling, the amounts of which shall be determined in proceedings to enforce the judgment before the administrative litigation courts. In all other respects, the action is denied. Let notice be given. Justice Salazar Alvarado files a separate note.

Revisión del Documento *200137250007CO* SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas quince minutos del cuatro de setiembre de dos mil veinte .
Recurso de amparo interpuesto por CARMEN MARÍA ESPINOZA TORRES, cédula de identidad 0600660230, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.
Resultando:
Redacta el Magistrado Salazar Murillo; y,
Considerando:
La recurrente estima lesionados sus derechos fundamentales, toda vez que por sentencia No. 2009-09880, se declaró parcialmente con lugar el recurso por el no tratamiento de las aguas negras del Cantón de Golfito; sin embargo, hasta la fecha no se cuenta con planta de tratamiento de aguas negras, pese a que se le cobra por el servicio alcantarillado que no recibe. Reclama que el recurrido no ha empezado la construcción o arreglo del alcantarillado de su comunidad, a pesar del dinero cobrado por el servicio de alcantarillado.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
Para cumplir, efectivamente, con la protección a un ambiente sano y ecológicamente equilibrado, el Estado, entendido en sentido amplio, está en el deber de disponer de las medidas necesarias para que en las comunidades del país se brinde tratamiento oportuno y efectivo a las aguas negras. En ese sentido, este Tribunal Constitucional ha sido del criterio que, tanto al Instituto Costarricense de Acueductos y Alcantarillados, como a las Municipalidades y al Ministerio de Salud, les corresponde -dentro de sus respectivos ámbitos de competencia-, velar por la debida recolección, tratamiento y disposición final de tales aguas. Así, en el caso específico del Instituto Costarricense de Acueductos y Alcantarillados, su propia Ley Constitutiva -Ley No. 2726 de 14 de abril de 1961 y sus reformas-, dispone lo siguiente:
“Artículo 1.- Con el objeto de dirigir, fijar políticas, establecer y aplicar normas, realizar y promover el planeamiento, financiamiento y desarrollo y de resolver todo lo relacionado con el suministro de agua potable y recolección y evacuación de aguas negras y residuos industriales líquidos, lo mismo que el aspecto normativo de los sistemas de alcantarillado pluvial en áreas urbanas, para todo el territorio nacional se crea el Instituto Costarricense de Acueductos y Alcantarillados, como institución autónoma del Estado.” Por lo que a dicha institución le corresponde, conforme a lo dispuesto en el artículo 2° de ese mismo cuerpo normativo (…) Dirigir y vigilar todo lo concerniente para proveer a los habitantes de la república de un servicio de agua potable, recolección y evacuación de aguas negras y residuos industriales líquidos y de aguas pluviales en las áreas urbanas (…)”. En lo referente a las Municipalidades, debe indicarse que el artículo 169 de la Constitución Política le otorga a éstas la competencia para planificar y vigilar el desarrollo urbano de su localidad, como derivación de su deber de administrar los intereses y servicios locales en cada cantón.
En razón de lo anterior, corresponde a cada municipio establecer una política integral de planteamiento urbano, que garantice un desarrollo en congruencia con el funcionamiento eficiente de un sistema de provisión de agua potable y de recolección, tratamiento y disposición final de las aguas negras. De igual forma, la Ley General de Salud -Ley No. 5395 de 30 de octubre de 1973-, dispone, en su artículo 2°, que le corresponde al Poder Ejecutivo, a través del Ministerio de Salud, la definición de la política nacional de salud, la normación, planificación y coordinación de todas las actividades públicas y privadas relativas a salud, así como la ejecución de aquellas actividades que le competen conforme a la ley. Igualmente, el artículo 341 de la referida ley establece, dentro de las atribuciones del Ministerio de Salud, la de ordenar y tomar las medidas especiales que habilita esa normativa para evitar el riesgo o daño a la salud de las personas o que éstos se difundan o se agraven y para inhibir la continuación o reincidencia en la infracción de los particulares.
En cuanto al tema específico, la Ley General de Salud, en su Libro 1, Título 3, Capítulo 3, “ De las obligaciones y restricciones para la evacuación sanitaria de excretas y aguas servidas”, dispone -en lo conducente-, lo siguiente:
“ Artículo 285.- Las excretas, las aguas negras, las servidas y las pluviales, deberán ser eliminadas adecuada y sanitariamente a fin de evitar la contaminación del suelo y de las fuentes naturales de agua para el uso y consumo humano, la formación de criaderos de vectores y enfermedades y la contaminación del aire mediante condiciones que atenten contra su pureza o calidad.” (El destacado no forma parte del original).
“Artículo 287.- Toda persona, natural o jurídica, propietaria de viviendas o de establecimientos o edificios en que las personas desarrollen sus actividades, responderá de que tales bienes dispongan de un sistema de disposición de excretas y de aguas negras y servidas aprobado por el Ministerio y los usuarios de viviendas, establecimientos o edificios estarán obligados a mantener dicho sistema en buenas condiciones de funcionamiento.” “ Artículo 288.- Todo propietario queda obligado a conectar el sistema de eliminación de excretas de aguas negras y servidas de su propiedad al alcantarillado sanitario en los lugares en que éste estuviera en funcionamiento, salvo en los casos de excepción que los reglamentos pertinentes reconozcan como procedentes.” Asimismo, de dicha normativa se colige la obligación de las autoridades del Ministerio de Salud de velar por la aplicación y el control del cumplimiento de las disposiciones de esa ley y de su reglamentación, sin perjuicio de las facultades y obligaciones que leyes especiales otorguen e impongan a otros órganos o entes públicos dentro de sus respectivos campos de acción (artículo 337).
Se corrobora, así, las distintas funciones y obligaciones que el ordenamiento jurídico le impone al Instituto Costarricense de Acueductos y Alcantarillados, al Ministerio de Salud y a las municipalidades, en materia de recolección, tratamiento y disposición final de las aguas negras. Funciones y obligaciones que, además -y como ya se adelantó en el considerando anterior-, se deben ejercer de forma coordinada, para asegurar así la eficacia y eficiencia administrativas.
La recurrente estima lesionados sus derechos fundamentales, toda vez que por sentencia No. 2009-09880, se declaró parcialmente con lugar el recurso por el no tratamiento de las aguas negras del Cantón de Golfito; sin embargo, hasta la fecha no se cuenta con planta de tratamiento de aguas negras. Reclama que el recurrido no ha empezado la construcción o arreglo del alcantarillado de su comunidad, a pesar del dinero cobrado por el servicio de alcantarillado. Al respecto, se constata que el 19 de junio de 2009, este Tribunal declaró parcialmente con lugar mediante resolución No. 2009-009880, y ordenó lo siguiente: “adoptar de manera inmediata las medidas pertinentes dentro de la esfera de sus competencias, para acelerar el inicio de la construcción y puesta en funcionamiento de la Planta de Tratamiento de Aguas Residuales (PTAR) de la ciudad de Golfito”. Ahora con ocasión de esa sentencia No. 2009-009880, se inició la contratación “Servicios en Ingeniería para la elaboración de los estudios de factibilidad y diseños finales del sistema de alcantarillado sanitario de la ciudad de Golfito Puntarenas” mediante licitación 2014LA-000005-PRI cuyo principal resultado fueron los planos constructivos finales que permiten implementar un sistema de recolección y tratamiento de aguas residuales totalmente nuevo y de tecnología moderna, proyecto que cuenta con un financiamiento aprobado con el Banco Alemán KfW y contrapartida del Instituto Costarricense de Acueductos y Alcantarillados, Con dicho proyecto, se pretende beneficiar a 7.137 habitantes de la zona y sus objetivos son: “ a) Construcción de la red de alcantarillado sanitario en la ciudad de Golfito. b) Construcción de una Planta de Tratamiento de Aguas Residuales que permita cumplir con el Reglamento de Vertidos, disminuyendo la contaminación de los efluentes. c) Cobertura del alcantarillado sanitario de un 90% de la población servida con el sistema de agua potable, al año 2046. d) Eliminación de las descargas de aguas residuales sin tratamiento directamente en los ríos y en el mar.” Asimismo, se verifica que actualmente el proyecto se encuentra en la etapa de diseño y cuenta con un 77% de avance, se tiene estimada la finalización de la construcción de las obras para el mes de octubre del año 2024.
Sin embargo, con ocasión de la interposición de este amparo el recurrido incluyó el proyecto de “Construcción del Alcantarillado Sanitario para la ciudad de Golfito, Puntarenas” dentro del Programa de Saneamiento en Zonas Prioritarias, que consta de las siguientes etapas: Etapa I: Diagnóstico y Evaluación de obras, Etapa II: Factibilidad y Priorización de obras, Etapa III: Diseño Final (tanto del sistema de recolección de aguas residuales como de la Planta de Tratamiento de Aguas Residuales “PTAR”) y Etapa IV: Construcción (tanto del sistema de recolección de aguas residuales como de la Planta de Tratamiento de Aguas Residuales “PTAR”). El recurrido informó que se está próximo a finiquitar un convenio con el INSTITUTO COSTARRICENSE DE FERROCARRILES y el AYA con la finalidad de que se otorgue el aval para la colocación de la línea de conducción y distribución que correrá por el derecho de vía férrea desde las cercanías del depósito libre hasta las afueras del centro de Golfito, distancia aproximada a los 3 kilómetros, la cual conectará con la Planta de Tratamiento que se construirá.
La recurrente cuenta con cinco servicios de agua potable identificados bajo los números NIS 542-0141 / 528-7154 / 528-7155 los cuales se encuentran al día y los servicios Nis 528-9122 y 542-6965 tienen cuenta pendiente; todos se ubican en el sector de Pueblo Civil Golfito. Los servicios de la amparada se encuentran conectados a la red de recolección de aguas residuales de 300mm, al que se le brinda el servicio de mantenimiento preventivo para evitar obstrucciones en la red y atención de averías, con tres funcionarios destacados para brindar la atención y mantenimiento en cuestión. Así las cosas, este Tribunal advierte que tras 10 años de haberse emitido la sentencia 2009-009880, el problema persiste, con lo que se verifica que subsiste la infracción a los derechos fundamentales de la recurrente. Si bien los recurridos han realizado algunas acciones tendientes a resolver la problemática de cita, lo cierto es que las mismas han sido insuficientes para poner un fin a la situación.
Nótese que el recurrido afirma que las obras quedarían concluidas en octubre de 2024; empero, estima esta Sala que el plazo de 4 años que la comunidad de golfito se vería sometida a esperar mientras se concluye el proyecto deviene excesivo. En mérito de las consideraciones expuestas, lo procedente es declarar con lugar el recurso con las consecuencias que se indicaran en la parte dispositiva.
V.Finalmente, la recurrente acusa que pese a que se le cobra por el servicio alcantarillado que no recibe, por lo que estima que se le debe devolver el dinero por tal concepto. Ahora bien, se advierte que lo planteado por la accionante no es más que un conflicto de legalidad ordinaria, que no involucra, al menos en forma directa, derecho fundamental alguno, razón por la cual excede el ámbito de competencia de esta Sala. En efecto, este Tribunal no es un contralor de legalidad ni una instancia más de la administración, de modo que no le corresponde determinar si procede o no el cobro de los recibos por concepto del servicio de alcantarillado. Por lo que esos reclamos constituyen extremos de legalidad ordinaria que deben ser resueltos por la Administración o, en su caso, por la jurisdicción ordinaria. En consecuencia, se descarta la lesión a los derechos de la tutelada en relación con este extremo.
En asuntos ambientales, es criterio del suscrito, que si ya ha habido intervención de la Administración Pública, su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por la falta de tratamiento de las aguas negras del Cantón de Golfito, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que se acusan la omisión de las autoridades recurridas de iniciar la construcción o arreglo de la red de alcantarillado destinado al tratamiento de aguas negras y servidas. En este sentido, esta omisión afecta la salud de los vecinos del lugar, con violación del derecho a disfrutar de un ambiente sano y ecológicamente equilibrado y de un nivel digno de calidad de vida.
Se previene a la parte recurrente que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, deberá retirarlos del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión No. 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial No. 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión No. 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara parcialmente con lugar el recurso, únicamente por la falta de sistema de tratamiento de aguas negras de la comunidad de golfito. Se ordena a Irving Zelaya Palacios, en su condición de Director a.i. de la Región Brunca, Noilyn Gutiérrez Arias, en su condición de Jefe de la Oficina Cantonal de Golfito, ambos del Instituto Costarricense de Acueductos y Alcantarillados, y Fernando Mata Castro, en su condición de Director del Área Rectora de Salud del Ministerio de Salud, o a quienes desempeñen dichos cargos, adoptar en forma inmediata y coordinada las medidas y acciones necesarias, dentro del ámbito de sus competencias, para que se finalice la construcción de las obras del proyecto de la Planta de Tratamiento de Aguas Residuales de la ciudad de Golfito y la misma sea puesta en funcionamiento en el término improrrogable de veinticuatro meses contado a partir de la notificación de esta resolución.
Asimismo, deberán presentar a este Tribunal un informe semestral del avance del proyecto. Se advierte a las autoridades recurridas que, de conformidad con lo establecido por el artículo 71, de la Ley de la Jurisdicción Constitucional se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado y al Instituto Costarricense de Acueductos y Alcantarillados al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. En lo demás se declara sin lugar el recurso. Notifíquese. El Magistrado Salazar Alvarado consigna nota.
