Amparo petition (recurso de amparo) processed under expediente number 15-008401-0007-CO, filed by [Name 001], identity card [value 001], against the DIRECTOR OF THE COLEGIO TÉCNICO PROFESIONAL DE ALAJUELITA, THE HEAD OF HUMAN RESOURCES, AND THE MINISTER OF PUBLIC EDUCATION.-
Findings:
Justice Castillo Víquez authored the opinion; and,
Whereas:
I.Subject matter of the petition: The petitioner alleges that, eleven months ago, she was assigned to the Colegio Técnico Profesional de Alajuelita, an educational institution with an enrollment of 480 students and approximately 50 coworkers, including teaching and administrative staff. She states that the problem she faces is that, during the months she has worked at that educational institution, she has been solely responsible for cleaning the entire physical facility, including classrooms, restrooms, common areas, hallways, offices, and other areas. In addition to imposing an excessive workload on her, this has required her to work long shifts of up to twelve hours a day, thereby endangering her physical and mental health.
II.Proven facts. The following facts are deemed duly established and relevant to the determination of this matter, either because they have been substantiated or because the respondent failed to address them as directed in the initial order (auto inicial):
IV.The right to enjoy a healthy and ecologically balanced environment in educational institutions.- The right to health recognized in Articles 21 of the Constitución Política, 1 and 11 of the Declaración Americana de los Derechos y Deberes del Hombre, 4 of the Convención Americana sobre Derechos Humanos, and 10 of the Protocolo Adicional a la Convención Americana sobre Derechos Humanos en Materia de Derechos is closely linked to the right to live in a healthy and balanced environment, enshrined in Article 50 of the Constitution. Environmental quality is a fundamental measure of quality of life, as are health, food, work, housing, and education, among others. Consequently, the State has an obligation to provide adequate protection for the environment and, to that end, must take the measures necessary to ensure that the environment is free from pollution and that alterations caused by either human beings or nature, in the immediate or more distant surroundings, do not harm the environment or the health of the persons living there.
This right is particularly recognized when it is associated with other fundamental rights, such as the right to education. The latter is established as a fundamental right, embodied in the public service provided by the State through the country’s various educational institutions. Therefore, at a minimum, the State must ensure that, in providing this public service, it does not infringe other fundamental rights, such as the right to health and to a healthy environment, of both the students and the teaching and administrative staff of the educational institution (see, to this effect, judgment No. 17719-07 at 15:50 hrs on 5 de diciembre de 2007, as well as judgment No. 2012-014633 at 9:05 hrs on 19 de octubre del 2012).
V.Analysis of the case. The petitioner’s objection concerns what she describes as a series of abusive working conditions to which she is subjected in performing her work as a custodian assigned to the Colegio Técnico Profesional de Alajuelita. She alleges that, despite the increase in enrollment at that educational institution, another custodian has not been appointed, leaving her solely responsible for cleaning the entire physical facility, including classrooms, restrooms, common areas, hallways, offices, and other areas. In addition to imposing an excessive workload on her, this has required her to work long shifts of up to twelve hours a day, thereby endangering her physical and mental health. It also infringes the right to health and to a healthy environment of both the students and the teaching and administrative staff of the educational institution. In response, the authorities of the Ministerio de Educación Pública acknowledge that they are unable to increase staffing because the position code for a new custodian is on a waiting list, as it requires budgetary authorization from the Secretaria Técnica de la Autoridad Presupuestaria del Ministerio de Hacienda.
Nevertheless, the reports submitted by the respondent authorities themselves establish in the record a violation of the rights to health, to a healthy environment, and to work under dignified conditions of the custodian who is the petitioner in this case, since those officials do not refute the facts she described and merely set forth the attempts and administrative actions they have undertaken to increase staffing and modify her working conditions. In this regard, this Constitutional Court finds that, although the authorities of the Ministerio de Educación Pública are aware of the conditions under which this employee works, as they have acknowledged, they have not adopted effective measures to remedy the problem. This circumstance led to the filing of this amparo petition and the resulting declaration that the right to work under dignified conditions was violated. The Chamber finds, in the terms set forth in the preceding whereas clause of this decision, that to secure effective protection of workers’ health while also guaranteeing the right to health and to a healthy environment of both the students and the teaching and administrative staff of the educational institution, the Ministerio de Educación Pública must take all necessary actions relating to the petitioner’s work activity.
Therefore, the petition is granted in part for violation of Articles 21, 50, and 56 of the Constitución Política. By virtue of the remedial nature of the judgments issued by this Chamber, the Ministerio de Educación Pública is ordered to take the pertinent actions to increase the custodial staff at the respondent educational institution, as appropriate, thereby providing the conditions necessary to protect the petitioner’s health and dignity.
The undersigned Justice clarifies that, although he refers environmental matters involving administrative action of any kind to the administrative-law jurisdiction (jurisdicción contencioso administrativa), he will not do so when the matter concerns a complaint alleging pollution that affects the students of an educational institution—as occurs in this specific case. This is because other rights of the protected minors are at stake, such as the rights to health and to enjoy a dignified quality of life.
VII.DISSENTING OPINION OF JUSTICE HERNÁNDEZ LÓPEZ REGARDING THE CLAIM OF A VIOLATION OF ARTICLE 50 OF THE POLITICAL CONSTITUTION. In this matter, an alleged violation of the rights enshrined in Articles 21 and 50 of the Constitution is claimed based on the alleged failure to hire a custodian at an educational institution.- In such situations, I believe that—unless a current and imminent threat to human health can be demonstrated—such disputes must be addressed in administrative proceedings (sede administrativa), since they concern alleged deficiencies in the management of public resources with respect to human resources.- To hold otherwise, as the majority does, would result in the Chamber hearing and deciding any deficiency in public services—this time concerning what is considered to be the number of custodians required for each public building.- Thus, in the case under consideration, the proven facts establish the absence of any threat to the right to health, and therefore the Chamber must defer jurisdiction over the matter to the public bodies specifically established to hear such cases.- The petition for constitutional relief (recurso) must therefore be denied.-
I have agreed with the position maintained by Justice Jinesta Lobo on this matter; consequently, in environmental matters, it is also the undersigned’s view that, where the Public Administration has already intervened, jurisdiction to hear and decide the matter lies with the contentious-administrative jurisdiction (jurisdicción contenciosa administrativa). Nevertheless, I do consider the merits of the matter when other rights of the persons affected by the source of pollution are at stake, including health, quality of life, and the right to enjoy a healthy and pollution-free environment (Article 50 of the Political Constitution), as is the case here, where pollution problems affecting the students of an educational institution are alleged, in violation of the right of minors to enjoy a healthy and ecologically balanced environment and a decent standard of quality of life.

The petition is GRANTED. Sonia Marta Mora Escalante, Minister, and Yaxinia Díaz, Director of Human Resources, both of the Ministerio de Educación Pública, or whoever may hold those positions in their stead, are ordered to take the appropriate measures to appoint a custodian immediately and thereby definitively resolve the problem of deficient working conditions affecting the petitioner. The State is ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed during enforcement of the judgment before the contentious-administrative court. This decision shall be personally served on Sonia Marta Mora Escalante, Minister, and Yaxinia Díaz, Director of Human Resources, both of the Ministerio de Educación Pública, or whoever may hold those positions in their stead. Recurso de amparo que se tramita en expediente número 15-008401-0007-CO, interpuesto por [Nombre 001], cédula de identidad [valor 001], contra el DIRECTOR DEL COLEGIO TÉCNICO PROFESIONAL DE ALAJUELITA, LA JEFE DE RECURSOS HUMANOS Y LA MINISTRA DE EDUCACIÓN PÚBLICA.-
Resultando:
Redacta el Magistrado Castillo Víquez; y,
Considerando:
I.Objeto del recurso: Alega la recurrente que desde hace once meses, se le ubicó en el Colegio Técnico Profesional de Alajuelita, centro educativo que alberga una matrícula de 480 alumnos, más aproximadamente 50 compañeros de trabajo, entre personal docente y administrativo. Manifiesta que el problema que enfrenta es que durante los meses que ha estado laborando en dicho centro educativo, es la única encargada de realizar la limpieza de toda la planta física, incluyendo aulas, baños, zonas comunes, corredores, oficinas y otros, lo cual, aparte de que le genera una carga desmedida de trabajo, ha tenido que atender largas jornadas laborales de hasta doce horas diarias, exponiendo su salud física y mental.
II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
IV.Sobre el derecho a gozar de un ambiente sano y ecológicamente equilibrado en los Centros de Educación.- El derecho a la salud reconocido en los artículos 21 de la Constitución Política, 1 y 11 de la Declaración Americana de los Derechos y Deberes del Hombre, 4 de la Convención Americana sobre Derechos Humanos y 10 del Protocolo Adicional a la Convención Americana sobre Derechos Humanos en Materia de Derechos, se encuentra íntimamente ligado al derecho a vivir en un ambiente sano y equilibrado, consagrado en el artículo 50 constitucional. La calidad ambiental es un parámetro fundamental de la calidad de vida; al igual que la salud, alimentación, trabajo, vivienda, educación, entre otros. En consecuencia, el Estado tiene la obligación de procurar una protección adecuada al ambiente, para lo cual debe tomar las medidas necesarias a fin de que el medio esté libre de contaminación, y que las alteraciones producidas tanto por el hombre como por la naturaleza, en el entorno próximo o lejano, no constituyan una lesión al ambiente ni a la salud de las personas que en él habitan.
Se reconoce especialmente este derecho cuando está asociado a otros derechos fundamentales, como lo sería el derecho a la educación. Este último se configura como un derecho fundamental, el cual se traduce en el servicio público que brinda el Estado en los distintos centros educativos del país. Por lo tanto, lo menos que puede hacer el Estado es que al brindar la prestación de este servicio público no lesione otros derechos fundamentales, como sería el derecho a la salud y a un ambiente sano, tanto de los estudiantes como del personal docente y administrativo de la institución educativa (véanse en este sentido la sentencia No. 17719-07 de las 15:50 hrs del 5 de diciembre de 2007, así como la sentencia No. 2012-014633 de las 9:05 hrs del 19 de octubre del 2012).
V.Análisis del caso. La disconformidad de la recurrente radica en lo que describe como una serie de condiciones laborales abusivas a las que se ve sometida en el desempeño de su trabajo como conserje, destacada en el Colegio Técnico Profesional de Alajuelita, pues alega que pese al incremento de la matrícula en ese centro educativo, no han nombrado otro conserje, siendo así la única encargada de realizar la limpieza de toda la planta física, incluyendo aulas, baños, zonas comunes, corredores, oficinas y otros, lo cual, aparte de que le genera una carga desmedida de trabajo, ha tenido que atender largas jornadas laborales de hasta doce horas diarias, exponiendo su salud física y mental, también lesiona el derecho a la salud y a un ambiente sano, tanto de los estudiantes como del personal docente y administrativo de la institución educativa. En contraposición, las autoridades del Ministerio de Educación Pública reconocen la imposibilidad que tienen para reforzar el personal, toda vez que el código para un nuevo conserje está en lista de espera, ya que requiere contar con el contenido presupuestario autorizado por parte de la Secretaria Técnica de la Autoridad Presupuestaria del Ministerio de Hacienda.
No obstante ello, de los propios informes rendidos por las autoridades recurridas, se encuentra acreditado en autos el quebranto al derecho a la salud, a un ambiente sano y al trabajo en condiciones dignas de la conserje aquí recurrente, pues dichas funcionarias no refutan los hechos descritos por la tutelada y solamente describen los intentos y gestiones que han realizado para reforzar el personal y variar las condiciones laborales de ésta. Al respecto, considera este Tribunal Constitucional que pese a que las autoridades del Ministerio de Educación Pública tienen conocimiento de las condiciones bajo las cuales labora ésta trabajadora, según así se ha aceptado, no se han adoptado medidas efectivas para corregir dicha problemática, circunstancia que llevó a la interposición del presente amparo y la consecuente declaratoria de la violación del derecho a un trabajo en condiciones dignas. La Sala estima, en los términos expuestos en el considerado anterior de esta resolución, que para obtener la tutela efectiva de la salud de los trabajadores y a la vez garantizar el derecho a la salud y a un ambiente sano, tanto de los estudiantes como del personal docente y administrativo de la institución educativa, debe el Ministerio de Educación Pública ejecutar todos las acciones necesarias que guarden relación con la actividad laboral de la recurrente.
Por lo tanto, se declara parcialmente con lugar el recurso por violación a los artículos 21, 50 y 56 de la Constitución Política. En virtud del carácter reparador de las sentencias emitidas por esta Sala, se ordena al Ministerio de Educación Pública ejecutar las acciones pertinentes para que se refuerce el personal conserje en el centro educativo recurrido, según corresponda, y así se den las condiciones necesarias para la protección de su salud y dignidad.
El suscrito Magistrado aclara que si bien los asuntos ambientales, cuando hay intervención administrativa de cualquier índole, los remite a la jurisdicción contencioso administrativa, lo cierto es que tratándose de una denuncia donde se alega contaminación que afecta a los estudiantes de un centro educativo -como sucede en el caso concreto-, no lo hará así. Esto, por cuanto, se encuentran en juego otros derechos de los menores amparados, tales como la salud y a gozar de un nivel digno de calidad de vida.
VII.VOTO SALVADO DE LA MAGISTRADA HERNÁNDEZ LÓPEZ RESPECTO DEL RECLAMO POR INFRACCIÓN DEL ARTÍCULO 50 DE LA CONSTITUCIÓN POLÍTICA. En este asunto, se reclama una supuesta lesión a los derechos recogidos en los artículos 21 y 50 Constitucionales por la supuesta falta de contratación de un conserje en un centro educativo.- En tales situaciones estimo que –a menos que se logre demostrar una puesta en peligro actual e inminente de la salud de las personas- tales discrepancias deben discutirse en sede administrativa pues responden a supuestas deficiencias en la forma de gerenciar los recursos públicos, en lo que a recurso humano se refiere.- Entender lo contrario como hace la mayoría, da como resultado que la Sala entre a conocer y resolver cualquier deficiencia en el servicio –esta vez en relación con lo que se estima el número de conserjes necesarios para cada edificación pública.- De ese modo, en el caso en estudio, los hechos probados dejan establecida la ausencia se amenaza al derecho a la salud, por lo cual la Sala debe ceder su competencia sobre el tema a los órganos públicos diseñados específicamente para conocer estos casos.- Por ello el recurso debe declararse sin lugar.-
He coincidido con la posición sustentada por el Magistrado Jinesta Lobo en esta materia, por lo que, en asuntos ambientales, es también criterio del suscrito, de que si ya ha habido intervención de la Administración Pública, considero que su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, que se denuncian problemas de contaminación que afecta a los estudiantes de un centro educativo, con violación del derecho a disfrutar de un ambiente sano y ecológicamente equilibrado y de un nivel digno de calidad de vida de las personas menores de edad.
Por tanto:
Se declara CON LUGAR el recurso. Se le ordena a Sonia Marta Mora Escalante, Ministra y a Yaxinia Díaz, Directora de Recursos Humanos, ambas del Ministerio de Educación Pública, o a quienes en su lugar ocupen esos puestos, que tomen las medidas que correspondan a fin de que designen en forma inmediata un conserje, y así solucionen en forma definitiva el problema de las deficientes condiciones de trabajo que aqueja a la recurrente. Se condena al Estado al pago de las costas, daños y perjuicios causados por los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo.
