Amparo proceeding (recurso de amparo) processed under expediente número 13-011876-0007-CO, filed by ROGELIO CROOKS THOMPSON, identity card 0700550535, an adult resident of Siquirres, against the INSTITUTO NACIONAL DE VIVIENDA Y URBANISMO, the MINISTERIO DE SALUD, and the MUNICIPALIDAD DE SIQUIRRES.-

Findings:

  1. 1In a written submission received by the Clerk’s Office of the Chamber at 11:48 on 18 de octubre de 2013, the petitioner filed an amparo proceeding against the Instituto Nacional de Vivienda y Urbanismo, the Ministerio de Salud, and the Municipalidad de Siquirres. He states that he is a resident of the Brooklyn neighborhood in Siquirres, a locality that for more than 15 years has experienced serious problems with the public sewer system, because sewage, soapy water, and wastewater are discharged through underground drains into the community’s streams. He states that the Instituto Nacional de Vivienda y Urbanismo (INVU) built the second stage of Urbanización María Auxiliadora, consisting of more than 150 housing units, and that the vast majority of these houses have an urban sewer system; that is, the discharged water and stormwater from these houses were channeled through gutters that then flow into catch basins, which in turn flow into underground drains, thus forming an underground sewer system, with the water subsequently conveyed toward the stream known as Siquirrito.He indicates that 32 of the dwellings in this development were not connected to that water-disposal system and that the water was initially discharged onto the street. He indicates that few people initially lived there and, therefore, the water did not disturb other residents; however, over the years, the houses became occupied and the number of family members also increased, consequently increasing the volume of discharged water. This was compounded by the fact that, in some units, more than one house was built per lot or the buildings were expanded. He states that the Municipalidad subsequently intervened by installing drains that discharge this water onto Aida Francis’s property; because of the elevation, the water flows until it reaches other properties farther downhill, including his own, where at that time he had a forest with fruit trees such as caimito, guanábana, cacao, limón, coto, and other timber trees, and the soapy water began causing effects of which he was unaware.He indicates that when the development was built, the street was a dead end, and that his property contains several springs (nacientes), which he sometimes uses and where fish, turtles, and other species live. He states that he reported the problem to the local Ministerio de Salud and requested an on-site inspection so that a viable solution to the problem could be provided. During the resulting visit, the problem and the environmental damage being caused in the neighborhood were confirmed, but they were never given a document setting out possible solutions to permanently resolve the problem of sewage, soapy water, and wastewater. He states that on 24 de abril de 2006 he applied to the Tribunal Ambiental Administrativo and that, through official letter 495-2006-OSSM of 22 de noviembre de 2006, the Oficina Subregional Siquirres Matina of MINAET described the affected area and determined the economic value of the affected timber.It therefore became clear that, in response to the Tribunal’s inquiries to the Municipalidad de Siquirres, the Mayor serving during that period stated that the water was rainwater, but to date no solution to the problem has been provided. He indicates that in enero de 2011 he applied to the Defensoría de los Habitantes and, after several meetings with representatives of the institutions involved by the Defensoría, an alternative solution was pursued with the Ministerio de Salud and the Municipalidad. However, it has serious and substantial drawbacks, such as the Municipalidad’s intention to divert the discharged water toward a street that did not exist when the project was built, thereby exposing another forest to destruction, as occurred with the first one. In addition, a copy of the project design to be implemented, together with its corresponding technical justification, was requested, but a ditch almost 2 meters wide was constructed on the west side of the Municipalidad de Siquirres, destroying the entrance to his home, and it was never repaired.The ditches prevent access if a vehicle must enter the property and are almost 2 meters deep, with the danger this poses to anyone who might fall into them;. In turn, the site where the water originates is a pedestrian lane located very close to the catch basins on the development’s other street, whereas the municipal proposal seeks to build a 156-meter ditch, which obviously entails spending additional public funds and constitutes a solution inconsistent with the housing development built by INVU. He complains that it remains unclear how the destruction will be prevented and who will assume responsibility for it when attempting to remedy the problem caused by water saturation in this area. The petitioner requests that the proceeding be granted and that the Municipalidad be ordered to discharge the water into the underground piping of the Urbanización.
  2. 2In a written submission received by the Clerk’s Office of the Chamber at 10:45 on 28 de octubre de 2013, Álvaro González Alfaro, in his capacity as Executive President of the Instituto Nacional de Vivienda y Urbanismo, reports under oath that the correct name of the project developed by INVU is “Urbanización Siquirres,” a housing project created approximately between 1977/1979. However, because of its age, no institutional records are available. According to the report contained in official letter PT-003-2012 of 2 de enero de 2012, the responsible official stated that “over time, some of the water has been channeled through pipes by the Municipalidad, but this has not been done completely; the site’s topography is also a factor, since the area where Mr. Crooks’s land is located is the lowest sector. Another factor is the size of the population in the area, and there is no control over the discharge of wastewater.” Accordingly, the respondent Institution bears no responsibility for the discharge of water onto Aida Francis’s property or the petitioner’s property, since the problem is caused by the difference in elevation among the properties in the area.Consequently, the growth of the population settled around the project and the construction of new buildings—which should have building permits from the local Municipalidad and therefore comply with the applicable technical standards—have caused an increase in wastewater. Together with the local Municipalidad’s failure to channel that water adequately, this is causing the problem reported by the petitioner. He requests that the proceeding be dismissed.
  3. 3In a written submission received by the Clerk’s Office of the Chamber at 11:41 on 30 de octubre de 2013, Geovanny Bonilla Bolaños, in his capacity as Director of the Área Rectora de Salud de Siquirres, Limón, reports under oath that the complaint filed by the protected party concerning the sanitary condition involving stormwater was duly addressed. Accordingly, an interinstitutional meeting was held with representatives of the Ministerio de Salud, Municipalidad de Siquirres, Defensoría de los Habitantes, CONAVI, Colegio Federado de Ingenieros y Arquitectos, the protected party, and certain members of the community. All those involved inspected the site, and it was agreed that a topographic survey would be conducted and that joint Ministerio de Salud–Municipalidad visits would be made in Barrios INVU Nuevo and Brooklyn to identify dwellings that might be discharging wastewater into the stormwater channel.He states that the reported sector consists of Barrios INVU Nuevo and Barrio Brooklyn, which have steep topography where stormwater and other water discharge onto the petitioner’s land. Those sectors were inspected by the health authorities, and the corresponding sanitary orders were issued due to the improper disposal of wastewater discharged into the stormwater channel. In addition, sanitary order HA-ARS-S-3142-2012 was issued to Mayor Yelgi Lavignia Night of the Municipalidad de Siquirres, ordering her to: “... carry out the necessary works to provide for the proper disposal of stormwater originating from Urbanización INVU Nuevo, preventing it from being directed through the property of Mr. Rogelio Crooks or neighboring properties ...”; the order was extended for 2 months. However, report HA-ARS-S-2119-2013 confirmed noncompliance with sanitary order HA-ARS-S-3142-2012, for which reason a criminal complaint was filed with the courts for the offense of disobedience to authority.Under summary proceeding numbers 12-201174-436-PE INT 2215-3-12 and expediente 13-200264-486-PE INT1112-3-13, the complaint was received by the Fiscalía de Siquirres and remains pending. He considers it important that the Municipalidad not only conduct the topographic survey but also carry out the works necessary to resolve the problem reported by the protected party. He requests that the proceeding be denied.
  4. 4In a written submission received by the Clerk’s Office of the Chamber at 10:42 on 31 de octubre de 2013, Arturo Castillo Valverde, in his capacity as President of the Municipal Council of the Municipalidad de Siquirres, reports under oath that the Defensoría de los Habitantes informed them of the actions that had been taken before the Municipal Mayor, of which the Concejo Municipal was unaware until 19 de junio del 2013, when the Defensoría requested that a special session be held. Special Session No. 122 was held that same day, at which Resolution No. 2495-19-06-2013 was adopted: “submitted to a vote, it is unanimously resolved to request that the administration submit a budget amendment for ora lunes 24 de junio del 2013 at 5:15 p,m, exclusively for the allocation of funds to the INVU Nuevo wastewater-solution project, for which this Concejo contributes 1.000.000,00 (one million colones exactly) from the training budget line, and that the administration undertake to obtain the remaining financial resources; resolution declared finally approved.” This was done to provide budgetary funding for the solution to the wastewater problem. To date, he is unaware of the scope of the actions taken by the Alcaldía, and there has been no request from the Alcaldía for additional budgetary funding. He requests that the proceeding be denied.-
  5. 5In a written statement received by the Secretariat of the Chamber at 15:31 hours on 6 de noviembre de 2013, Yelgi Lavinia Verley Knight, in her capacity as Mayor of the Municipalidad de Siquirres, states under oath that not everything asserted by the petitioner is true. At Ordinary Session Number 112 of the Concejo Municipal de Siquirres, held at 17:00 hours on 19 de junio del 2013, under Article 11, the Deputy Ombudsman was heard and expressed concern regarding a complaint filed with the Ministry in 2009 and with the Defensoría de los Habitantes in 2011. The complaint alleged irregularities in the disposal of wastewater (aguas servidas) in the Urbanización Invu Nuevo, where 17 homes discharge their wastewater into the drainage channel (caño) without any treatment. The wastewater reaches a point where it crosses and pools in the middle of a series of private properties because of the terrain’s topography, thereby causing foul odors and pests.To date, the Municipalidad is seeking a solution to the problem, and at Extraordinary Session Number 112, held at 17 :15 hours on 19 de junio del 2013, the Concejo Municipal adopted Resolution Number 24925 and ordered in 2495-19-06-2013: “... to request that the administration submit a budget amendment for Monday, 24 de junio del 2013, at 5:15 p,m, exclusively for the allocation of funds to the INVU Nuevo wastewater-solution project, for which this Concejo shall contribute 1.000.000,00 (one million colones exactly) from the training budget line, and that the administration undertake to secure the remaining financial resources; resolution declared finally approved.” This gave rise to “Direct Procurement 2013-CD- 000205-01 Project Number 1 Improvements to the Germania Community Hall, 2. INVU Stormwater Drainage,” and according to the INVU Nuevo Water Drainage Record dated 12:15 hours on 17 de septiembre del 2013, it was agreed with the protected party that he would grant permission to carry out the work covered by that budget.The case file, at folios 58 to 67, also contains the Scope of the INVU Stormwater Drainage Budget, details regarding the distances and elevations of the Project, plans for the work, stormwater-drainage reports, and the field inspection establishing the Project’s technical specifications. The petitioner, for his part, told the Chamber that the municipal proposal was to excavate a 156-meter ditch, which would obviously entail expenditure of public funds. This is untrue, since the protected party is aware of the work to be performed, and a survey of 126 linear meters had previously been prepared for the project, involving excavation measuring 0.8 mts. x 0.8 mts, 3 residential crossings using 80 cm pipe, and 3 concrete inspection chambers (cajas de registro) measuring 0.85 x 0.85 mts and rated at 210 kg/cm, over 95% Proctor ballast 10 cm thick at the base, with their ends 7-10- cast in place using # 3@ 20 cm A-D reinforcing bar.The project had been budgeted at ¢ 2.100.000,00 and was duly awarded for execution. Furthermore, when the petitioner signed the aforementioned record, he undertook to “grant permission to proceed with the work corresponding to the budget for said project.” She requests that the amparo proceeding (recurso de amparo) be dismissed.-
  6. 6The statutory requirements have been observed in the proceedings conducted.

Justice Salazar Murillo drafts the opinion; and,

Considering:

I.Subject matter of the proceeding.- The petitioner alleges that the Instituto Nacional de Vivienda y Urbanismo built a housing development containing 32 houses that discharge sewage (aguas negras), greywater (aguas jabonosas), and wastewater directly into the ditch (cuneta), which then empties onto his property, causing foul odors and harming a forest and a spring (naciente) located on his property. He states that, despite the foregoing, the respondent authorities have not resolved his problem.

II.Proven facts. The following facts are deemed duly established and relevant to the decision in this matter, either because they have been substantiated or because the respondent failed to address them as ordered in the initial ruling:

  • a)The Instituto Nacional de Vivienda y Urbanismo bears no responsibility for the discharge of wastewater onto the protected party’s property (see copy of memorandum PT-709-2012 dated 14 de junio de 2012, submitted by the representative of INVU).
  • b)Since 2011, the respondent Ministry has undertaken interagency coordination with the other state entities connected with the complaint filed by the petitioner: Instituto Costarricense de Acueductos y Alcantarillados, Colegio Federado de Ingenieros y Arquitectos, Municipalidad de Siquirres, and Defensoría de los Habitantes. Together, they verified the existence of an improper discharge of stormwater (aguas pluviales) and wastewater from homes in Urbanización INVU, which crosses the petitioner’s property and pools there, producing foul odors and vector-breeding sites and placing the neighbors’ health at risk (see official communications HA-ARS-S-1925-2011, A-ARS-S-1922-2011, and A-ARS-S-1927-2011, all dated 29 de agosto de 2011, submitted by the Director of the Área de Salud).
  • c)In julio de 2012, the Área Rectora de Salud inspected 27 homes in Urbanización INVU Nuevo. It found that 17 discharged wastewater into the stormwater channel and issued the corresponding health orders (órdenes sanitarias), requiring the necessary works to ensure proper wastewater disposal. It was not possible to verify the situation at the other 9 houses (see the respondent’s report and copy of official communication HA-ARS-S-3697-2012 dated 16 de agosto de 2012).
  • d)Through health order HA-ARS-S-3142-2012, served on 6 de agosto de 2012, the respondent Ministry ordered Mayor Yelgi Lavignia Night of the Municipalidad de Siquirres to undertake the necessary works to ensure proper disposal of stormwater from the Urbanización INVU Nuevo and prevent it from being directed through the property of Mr. Rogelio Crooks or neighboring properties, with a compliance deadline of 6 de octubre de 2012 (see copy of the submitted health order).
  • e)On 31 de octubre de 2012, staff from the Área Rectora de Siquirres met with officials from the Municipalidad, the petitioner, and neighbors to provide an accounting to the affected residents (see copy of the documentation submitted by the respondent Ministry).
  • f)On 14 de diciembre de 2012, the respondent Área de Salud filed the corresponding criminal complaints with the Fiscalía de Siquirres for failure to comply with the health orders issued against residents of the homes in Urbanización INVU concerning the improper discharge of stormwater and wastewater (see copy of official communication HA-ARS-S-6204-2012).
  • g)On 28 de enero de 2013, the respondent Municipalidad asked the Concejo Municipal to include funding in the budget. The request was considered at Ordinary Session No. 143 held on that same date, and the official communication was referred to the Comisión de Hacienda y Presupuesto (see copy of official communication DA-3-4019-2013).
  • h)On 13 de mayo de 2013, the Director of the respondent Área de Salud filed a criminal complaint with the Fiscalía de Siquirres regarding the Siquirres Mayor’s failure to comply with health order .HA-ARS-S-3142-2012 (see copy of the complaint and the record dated 15:30 hours on 10 de junio de 2013).
  • i)The petitioner filed a complaint with the Tribunal Ambiental, which is being processed under expediente 113-06-01-TAA (see copy of the submitted documentation).

III.Merits. In the case under review, the Chamber considers it established that the Instituto Nacional de Vivienda y Urbanismo built the Urbanización Siquirres more than 30 years ago and that, because of growth in the population settled around the project and the erection of new buildings, the amount of wastewater increased. Combined with the failure to channel this wastewater properly, this is causing the problem reported by the petitioner. In turn, following the complaint filed by the petitioner in 2010, the Área Rectora de Salud de Siquirres, Limón took the appropriate steps and, in coordination with the Municipalidad, the Defensoría de los Habitantes, the Colegio Federado de Ingenieros, and the Instituto Costarricense de Acueductos, conducted on-site inspections (inspecciones in situ) in 2012. It found that the homes were disposing of wastewater into the stormwater ditch and issued health orders both to the homeowners and to Municipal Mayor Yelgi Lavignia Night.

In the latter order, she was specifically instructed that she must “... undertake the necessary works to ensure proper disposal of stormwater from the Urbanización INVU Nuevo, preventing it from being directed through the property of Mr. Rogelio Crooks or neighboring properties ...”. Nevertheless, the respondent party verified noncompliance with those health orders, and a criminal complaint for disobedience of authority (desobediencia a la autoridad) was therefore filed with the Courts and processed under summary proceedings numbers 12-201174-436-PE INT 2215-3-12 and 13-200264-486-PE INT1112-3-13. Accordingly, with respect to the respondent Institute and the respondent Ministry, the Chamber finds that they have not violated the petitioner’s fundamental rights because, before this amparo proceeding was filed, they performed the duties assigned to them by the legal system in an effort to resolve the problem reported by the petitioner.

IV.Furthermore, with respect to the actions of the respondent Municipal Authority, the President of the Municipal Council reported that he did not become aware of the problem until 19 de junio del 2013, when the Defensoría requested that a special session be held. That same day, special session No. 122 was held, at which resolution No. 2495-19-06-2013 was adopted, directing the administration to submit, by 24 de junio del 2013, a budget amendment exclusively for the allocation of funds to resolve the sewage problem in the Urbanización del Invu. A financial contribution of ¢ 1.000.000,00 (one million colones exactly) was also approved to resolve the sewage problem. In turn, the Office of the respondent Mayor stated that, pursuant to the aforementioned resolution adopted by the Municipal Council, it carried out “Direct Procurement 2013-CD- 000205-01 Project Number 1 Improvements to the Germania Community Hall, 2.

INVU Stormwater Drainage,” and, as recorded in the INVU Nuevo Water Drainage Record, at 12:15 on 17 de septiembre del 2013, the protected party agreed to grant permission to perform the work covered by that budget. Accordingly, it follows that, before filing this constitutional rights proceeding (recurso de amparo), the petitioner was aware of the works that the respondent Municipality planned to carry out. Indeed, according to the respondent authority’s sworn statement, the record signed by the petitioner at 12:15 on 17 de septiembre del 2013 shows that he granted permission to perform the work covered by the approved budget, which gave rise to “Direct Procurement 2013-CD- 000205-01 Project Number 1 Improvements to the Germania Community Hall, 2. INVU Stormwater Drainage.” Although the specified Direct Procurement remains pending, the Chamber considers the time elapsed since the petitioner filed the complaint to be excessive and disproportionate, and, to date, the Municipality has not resolved the problem.

This situation requires that the amparo be granted because, despite being aware of the reported situation, the municipal authorities failed to adopt the appropriate measures or actions to resolve the problem definitively within a reasonable period. Moreover, in the Chamber’s view, Municipalidad de Siquirres has demonstrated an inability to enforce the relevant laws and fulfill its obligation to guarantee that the area’s inhabitants may enjoy a healthy and ecologically balanced environment. In this regard, there is no indication that the Municipality has taken specific actions within the scope of its authority, even though an imminent state of necessity exists to which the Administration must respond in order to protect the health of the residents of that community, which is being affected by a public-health and pollution problem. In the case under review, however, it did not proceed in that manner, making it imperative to grant the petition on this issue.

V.Finally, regarding the type of works that the respondent Municipality intends to perform to alleviate the stated problem, that claim falls outside the scope of this Jurisdiction’s authority. The protected party must therefore express his disagreement before the competent authorities of the respondent Municipality itself or, failing that, through the competent judicial proceedings, so that the matter may be decided as legally appropriate, since the issue raised concerns a dispute of ordinary legality that must properly be resolved through those channels. The mere mention of expert evidence reveals that what is sought in this case is for the Chamber to review the reasons and grounds on which the Municipality intends to carry out the water-discharge works. This falls outside the inherently summary nature of the amparo proceeding, which is incompatible with slow and complex evidentiary measures, such as reviewing the challenged administrative and technical criteria. Consequently, the argument raised on this issue in the petition must be submitted to the competent authorities so that they may decide the matter as technically and legally appropriate.

VI.Dissenting opinion of Justice Hernández López regarding the claim alleging a violation of Article 50 of the Political Constitution.

I agree with Justice Jinesta Lobo’s reasoning for dismissing this petition insofar as it alleges a violation of Article 50 of the Political Constitution, and I add the following:

1. The historical context that once prompted the Chamber’s extensive involvement in environmental matters has changed considerably, requiring this body to reconsider the conditions governing its participation in safeguarding the right of persons to a healthy and balanced environment, as protected by Article 50 of the Political Constitution. Indeed, the present situation—characterized by an extremely extensive body of statutory and regulatory law that includes substantive rules, procedures, and the creation of bodies responsible for enforcing the provisions of the Fundamental Charter—is radically different from the prior situation, in which the absence of regulations and state bodies with appropriate authority compelled the Chamber to assume a leading, almost exclusive, role in defending the aforementioned constitutional right.

2. Today, we face a “dense network” of environmental regulations—as Justice Jinesta Lobo aptly described it in his dissenting opinion on this subject—which has produced two significant phenomena. The first and most obvious is the emergence of comprehensive legal regulation governing activities whose environmental impact was previously subject to little or no regulation, as well as the creation of state bodies empowered to supervise and control the effects of human activity on the environment. The second phenomenon is that this increasing juridification—predominantly through statutes and regulations—necessarily brings both administrative justice and the ordinary courts, primarily the administrative litigation jurisdiction (jurisdicción contenciosa administrativa), but also the criminal jurisdiction, onto the scene. Consistent with the importance of environmental law, these forums have been provided with broad procedural avenues and inclusive rules of standing (legitimación), enabling affected persons to enforce the provisions of the extensive legal framework relating to environmental matters.

3. In this context, it is inappropriate, both legally and functionally, for the Constitutional Chamber to displace—or, worse still, replace—the ordinary judicial bodies in carrying out their task, which is also constitutional in rank, of ensuring effective compliance with statutes and regulations. It is legally inappropriate because, in the vast majority of these cases, the Chamber is asked to interpret and enforce statutory and regulatory provisions, thereby risking an overlap between its jurisdiction and that of other judicial bodies that were specifically created to perform those tasks. It is also functionally inappropriate because the design of its proceedings is poorly suited to the complexity present in numerous environmental disputes, which consist of technically and legally complex sequences of facts and acts. There are well-known examples relating to both issues in which the Chamber has issued an incomplete or technically deficient ruling, or in which unnecessary friction and harm to legal certainty have resulted.

4. Among the technical considerations I have assessed, I would add that this jurisdiction lacks judgment-enforcement judges (jueces ejecutores de sentencia) capable of properly monitoring compliance with such judgments—which are generally complex—and which sometimes require the monitoring of remedial plans, among other measures, involving interinstitutional coordination and oversight lasting months or even years.

5. From that perspective, this Court’s decision to step aside in environmental matters should not be viewed as abandoning environmental protection but, on the contrary, as ensuring its proper protection in the forum best suited to the nature of its complexity and diversity. Nor should it be viewed as this body’s relinquishment of its duty to protect the constitutional rights entrusted to it by the Political Constitution and its Organic Law, a duty which, in my view, remains reserved in this field for specific cases. Rather, it is a matter of reallocating the burdens and tasks assigned to the various state bodies so that each may fully perform its work within its assigned sphere, as well as an exercise of defining its own jurisdiction, as established in Article 7 of its Organic Law.

6. It is clear that the Chamber does not propose leaving the protection of persons’ environmental rights entirely to other jurisdictions. It is well understood that, although any claim alleging a violation of statutory or regulatory provisions may ultimately be traced to the constitutional sphere, some cases require nothing more than the application of constitutional law. The objective, therefore, is for the Chamber to become one participant among others, so that—collectively, with each acting within its own sphere—the full range of situations involved in protecting the right to a healthy and balanced environment may be addressed within a society in which other equally pressing needs also exist. With this position, I firmly believe that citizens lose not one iota of protection, while substantial gains are made in breadth, perspective, and respect for the balance and distribution of powers.

This last principle must necessarily be considered because it governs the constitutional dynamics of every liberal and democratic system such as ours.- 7. Consistent with the foregoing, I maintain that this Chamber should refrain from hearing claims alleging a purported violation of Article 50 of the Political Constitution and should leave their adjudication to administrative justice and the administrative litigation jurisdiction. This is stated as a general principle, without prejudice to recognizing the existence of particular cases or categories of cases that, in my view, would still be better protected by this Chamber and should therefore be heard and decided by it.- Among such categories of cases, without this enumeration being deemed a closed and definitive list, I would note that the Chamber should retain jurisdiction over situations such as claims involving environmental violations that also directly endanger human health or the accessibility or quality of water; and cases involving gross and direct harm to the environment in which there is a manifest absence of protection by state authorities, provided that the nature of the claim also allows it to be addressed through the amparo mechanism as a special and summary procedural remedy. I likewise believe that the amparo should not be converted into an ordinary proceeding in order to address, even in the cases cited above, matters exceeding its capacity to handle them adequately.

8. In this specific case, the situation presented falls among those in which the protective mechanisms of ordinary justice provide a broader and more comprehensive avenue. Accordingly, pursuant to the foregoing reasoning and Article 9 of the Law on Constitutional Jurisdiction, I vote to summarily dismiss the petition.

Por tanto:

The appeal is granted solely with respect to the Municipalidad de Siquirres. Yelgi Lavinia Verley Knight and Arturo Castillo Valverde, Mayor and President of the Council, respectively, both of the Municipalidad de Siquirres, or whoever may hold those offices in their stead, are ordered, within 4 months, to provide a permanent solution to the water-discharge problem affecting the appellant’s property. They are hereby warned that failure to do so will constitute the offense of disobedience of authority established in Article 71 of the Ley de la Jurisdicción Constitucional. The Municipalidad de Siquirres is ordered to pay the costs, damages, and losses caused, which shall be determined during enforcement of the judgment before the administrative litigation court. This decision shall be personally served on the respondent parties. Justice Hernández López dissents and summarily dismisses the appeal.-

Recurso de amparo que se tramita en expediente número 13-011876-0007-CO, interpuesto por ROGELIO CROOKS THOMPSON, cédula de identidad 0700550535, mayor, vecino de Siquirres contra el INSTITUTO NACIONAL DE VIVIENDA Y URBANISMO, el MINISTERIO DE SALUD y la MUNICIPALIDAD DE SIQUIRRES.-

Resultando:

  1. 1Por escrito recibido en la Secretaría de la Sala a las 11:48 horas del 18 de octubre de 2013, el recurrente interpone recurso de amparo contra el Instituto Nacional de Vivienda y Urbanismo, el Ministerio de Salud y la Municipalidad de Siquirres. Manifiesta que es vecino del barrio Brooklyn en Siquirres, localidad que desde hace más de 15 años presenta graves problemas con el sistema de alcantarillado público, debido a que las aguas negras, jabonosas y servidas desfogan por medio de alcantarillas subterráneas en los riachuelos de la comunidad. Dice que el Instituto Nacional de Vivienda y Urbanismo (INVU) construyó la segunda etapa de la Urbanización María Auxiliadora, de más de 150 unidades habitacionales, y la gran mayoría de estas casas tienen un sistema de alcantarillado urbano, sea que de estas casas, las aguas desfogadas y pluviales se encausaron mediante cunetas, que luego va a dar a los tragantes, y estas a su vez, a las alcantarillas subterráneas conformando esto un sistema de alcantarillado subterráneo, aguas que luego son conducidas hacia la quebrada conocida como Siquirrito.Indica que en esta urbanización 32 de las viviendas, no se conectaron a dicho sistema de evacuación de aguas que inicialmente eran arrojadas a la calle. Indica que inicialmente allí vivían pocas personas, por lo tanto las aguas no causaban molestias a otros vecinos, pero al pasar los años las casas fueron habitadas y los miembros que integran las familias también fueron creciendo, consecuentemente aumentó la producción de aguas desfogadas, aunado a que en algunas de las unidades en vez de una casa por lote se construyeron más casas o se ampliaron las edificaciones. Dice que posterior a ello, intervino la Municipalidad colocando unas alcantarillas que lanzan estas aguas a la propiedad de Aida Francis, aguas que discurren debido a la altura hasta llegar a otras propiedades más abajo, en cuenta la suya, donde en ese entonces tenía un bosque con árboles frutales como caimito, guanábana, cacao, limón, coto, y otros maderables, siendo que las aguas jabonosas fueron causando ciertos efectos que desconocía.Indica que cuando se construyó la urbanización la calle era ciega, y en su propiedad hay varias nacientes de agua que en algunas ocasiones utiliza y es el lugar donde viven peces, tortugas y otras especies. Señala que denunció el problema ante el Ministerio de Salud local y les solicitó una inspección en el lugar para que dieran una solución viable al problema, así en la visita que se realizó se comprobó la problemática y el daño al ambiente que se está generando en el barrio pero nunca les dieron un documento que señalara las posibles soluciones para solventar el problema de las aguas negras, jabonosas y servidas en forma definitiva. Dice que el 24 de abril de 2006 acudió ante el Tribunal Ambiental Administrativo y por oficio 495-2006-OSSM de 22 de noviembre de 2006, la Oficina Subregional Siquirres Matina del MINAET detalló el área afectada y se determinó el valor económico de la madera afectada, por lo que resultó notorio que en las consultas hechas por el Tribunal a la Municipalidad de Siquirres, el Alcalde de ese período mencionó que las aguas eran llovidas, pero a la fecha no hay solución alguna al problema.Indica que acudió en enero de 2011 a la Defensoría de los Habitantes y luego de varias reuniones con los representantes de las instituciones que la Defensoría involucró, se logró accionar con el Ministerio de Salud y la Municipalidad una alternativa de solución; sin embargo esta tiene graves y grandes inconvenientes, tales como que la Municipalidad pretende desviar las aguas desfogadas hacia una calle que no existía cuando se construyó el proyecto, lo que expone a otro bosque a ser destruido tal como sucedió con el primero. Además, se les solicitó copia del diseño del proyecto a realizar con su respectiva justificación técnica, pero al costado oeste de la Municipalidad de Siquirres se construyó un zanjón de casi 2 metros de ancho, el cual destruyó la entrada a su casa de habitación y nunca lo repararon, zanjones que impiden el acceso en caso de tener que entrar a la propiedad con un vehículo y que tienen casi 2 metros de profundidad, con el peligro que ello representa para cualquier persona si cayera ahí;.A su vez, el sitio donde se originan las aguas, es una alameda, que está muy cerca de los tragantes que se ubican en la otra calle de la urbanización , mientras que la propuesta municipal pretende hacer un zanjón de 156 metros lo que obviamente implica el gasto de más recursos del erario público, presentando una solución no acuerde con el desarrollo urbanístico construido por el INVU. Reclama que aún no tiene claro cómo se evitará la destrucción y quién asumirá esta responsabilidad al pretender reparar el problema debido a la saturación de agua en esta zona. Solicita el recurrente que se declare con lugar el recurso y se ordene a la Municipalidad desfogar las aguas a la tubería subterránea de la Urbanización.
  2. 2Por escrito recibido en la Secretaría de la Sala a las 10:45 horas del 28 de octubre de 2013, informa bajo juramento Álvaro González Alfaro, en su condición de Presidente Ejecutivo del Instituto Nacional de Vivienda y Urbanismo, que el nombre correcto del proyecto desarrollado por el INVU es "Urbanización Siquirres", el cual es un proyecto habitacional creado aproximadamente entre los años 1977/1979; sin embargo por la antigüedad del mismo, no se cuenta con registros institucionales. Según el informe que consta en el oficio PT-003-2012 de 2 de enero de 2012, el funcionario encargado indicó que "con el paso del tiempo las aguas en parte han sido entubadas por la Municipalidad, pero no se hace en forma completa también se suma la topografía del lugar, donde se ubican los terrenos del señor Crooks es el sector más bajo, otro aspecto que también afecta es la cantidad de población en la zona y no se tiene un control de la salida de las aguas servidas".De modo que la Institución accionada no tiene responsabilidad por el desfogue de las aguas hacia la propiedad de Aida Francis ni a la del recurrente, pues el problema se debe a la existencia de un desnivel en los terrenos de la zona. En consecuencia, con el crecimiento de la población asentada en los alrededores del proyecto y el levantamiento de nuevas construcciones, -que deberían contar con los permisos constructivos de la Municipalidad del lugar y por tanto ajustarse a las normas técnicas en la materia­ se ha producido un incremento de aguas residuales, lo que sumado a la no canalización de éstas en forma adecuada por parte de la Municipalidad del lugar, se está provocando el problema denunciado por el accionante. Solicita que se desestime el recurso planteado.
  3. 3Por escrito recibido en la Secretaría de la Sala, a las 11:41 horas del 30 de octubre de 2013, informa bajo juramento Geovanny Bonilla Bolaños, en calidad de Director del Área Rectora de Salud de Siquirres, Limón, que la denuncia interpuesta por el tutelado por la situación sanitaria de aguas pluviales fue debidamente atendida. En virtud de ello se realizó una reunión interinstitucional con representantes el Ministerio de Salud, Municipalidad de Siquirres, Defensoría de los Habitantes, CONAVI, Colegio Federado de Ingenieros y Arquitectos, el tutelado y algunos miembros de la comunidad. De tal forma que todos los involucrados inspeccionaron el sitio, se acordó realizar un levantamiento topográfico y realizar visitas en conjunto Ministerio de Salud-Municipalidad, en los Barrios INVU Nuevo y Brooklyn para identificar las posibles viviendas que desfoguen las aguas servidas hacia el caño pluvial.Señala que el sector denunciado es conformado por los Barrios INVU Nuevo y Barrio Brooklyn, que cuentan con una topografía pronunciada donde las aguas pluviales y otras van a desfogar en el terreno del recurrente. Dichos sectores fueron inspeccionados por las autoridades de salud y se giraron las ordenes sanitarias correspondientes debido a disposición inadecuada de aguas servidas que van a desfogar al caño pluvial. Además de lo anterior, se giró orden sanitaria HA-ARS-S-3142-2012 a la Alcaldesa Yelgi Lavignia Night de la Municipalidad de Siquirres, en la cual se le ordenó: " ... realizar las obras necesarias para brindar una adecuada disposición de las aguas pluviales provenientes de la urbanización INVU nuevo, evitando que las mismas se direccionen por la propiedad del señor Rogelio Crooks o propiedades vecinas ... " , la que fue prorrogada por 2 meses. Sin embargo, mediante informe HA-ARS-S-2119-2013, se verificó el incumplimiento a la orden sanitaria HA-ARS-S-3142-2012, por lo cual se interpuso denuncia ante los tribunales por el delito de desobediencia a la autoridad, y mediante sumarias números 12-201174-436-PE INT 2215-3-12 y expediente 13-200264-486-PE INT1112-3-13, se recibió la denuncia en la Fiscalía de Siquirres, la cual está en proceso.Considera que es importante que la Municipalidad no solo debe realizar el levantamiento topográfico, sino además que efectuar las obras necesarias a fin de resolver la problemática denunciada por el tutelado. Solicita se declare sin lugar el recurso.
  4. 4Por escrito recibido en la Secretaría de la Sala a las 10:42 horas del 31 de octubre de 2013, informa bajo juramento Arturo Castillo Valverde, en su condición de Presidente Municipal de la Municipalidad de Siquirres, que la Defensoría de los Habitantes les comunicó de las gestiones que se habían realizado ante la Alcaldesa Municipal, de las cuales el Concejo Municipal no tuvo conocimiento hasta el 19 de junio del 2013, cuando la Defensoría solicitó la celebración de una sesión extraordinaria y ese mismo día se efectúo la sesión extraordinaria No. 122, en la que se tomó el acuerdo No. 2495-19-06-2013 "sometido a votación por unanimidad se acuerda solicitarle a la administración que presente una modificación presupuestaria para el ora lunes 24 de junio del 2013 al ser las 5:15 p,m, que la misma sea exclusiva para girar recursos al proyecto del INVU nuevo de solución de aguas servidas, para lo cual este Concejo da un aporte económico de 1.000.000,00 (un millón de colones exactos) de la partida presupuestaria de capacitaciones y la administración se avoque a buscar el recurso económico restante, acuerdo definitivamente aprobado." Lo anterior con el fin de dar contenido presupuestario para la solución del problema que presentaban las aguas servidas.A la fecha, desconoce el alcance de las gestiones realizadas por la Alcaldía y no existe ninguna solicitud de parte de la Alcaldía para dotar de mayor contenido presupuestario. Solicita se declare sin lugar el recurso.-
  5. 5Por escrito recibido en la Secretaría de la Sala, a las 15:31 horas del 6 de noviembre de 2013, informa bajo juramento Yelgi Lavinia Verley Knight, en su condición de Alcaldesa de la Municipalidad de Siquirres, que no todo lo manifestado por el recurrente es cierto, pues en Sesión Ordinaria Numero 112 del Concejo Municipal de Siquirres a las 17:00 horas del 19 de junio del 2013, en el artículo 11 se dio atención al Defensor Adjunto de los Habitantes, quien manifestó la preocupación por una queja que se hizo en el Ministerio en el año 2009 y ante la Defensoría de los Habitantes en el 2011, en la que se denunció la irregularidad en la disposición de las aguas servidas en la Urbanización Invu Nuevo, pues 17 viviendas desfogan sus aguas servidas en el cordón del caño sin recibir ningún tratamiento, llegan a un punto que atraviesan y se estancan por el centro de una serie de propiedades privadas, en virtud de la topografía del terreno, lo cual general malos olores y plagas.A la fecha, la Municipalidad está buscando solución al problema y en la sesión extraordinaria número 112 de las 17 :15 horas del 19 de junio del 2013, el Concejo Municipal tomó el Acuerdo numero 24925 y dispuso que 2495-19-06-2013 "... solicitarle a la administración que presente una modificación presupuestaria para el ora lunes 24 de junio del 2013 al ser las 5:15 p,m, que la misma sea exclusiva para girar recursos al proyecto del INVU nuevo de solución de aguas servidas, para lo cual este Concejo da un aporte económico de 1.000.000,00 (un millón de colones exactos) de la partida presupuestaria de capacitaciones y la administración se avoque a buscar el recurso económico restante, acuerdo definitivamente aprobado." Lo anterior dio origen a la "Contratación Directa 2013-CD- 000205-01 Proyecto Número 1 Mejoras al Salón Comunal Germania, 2. Evacuación Pluvial INVU" y según consta en el Acta de Evacuación de Aguas INVU Nuevo, de las 12:15 horas del 17 de septiembre del 2013, se acordó con el amparado dar permiso para proceder hacer el trabajo correspondiente a dicho presupuesto.Asimismo, consta en el expediente a folios 58 a 67 el Alcance del Presupuesto Evacuación Pluvial INVU, el detalle de la distancia y elevaciones de dicho Proyecto, planos del trabajo, informes de evacuación pluvial, inspección de campo realizada donde se establece las especificaciones técnicas del Proyecto. Por su parte, el recurrente le indicó a la Sala, que la propuesta municipal es hacer un zanjón de 156 metros lo que obviamente implica el gastos de erario público, lo cual no es cierto, dado que es del conocimiento del amparado los trabajos a realizar y para el proyecto se hizo un levantamiento con anterioridad de 126 metros lineales, excavación de 0.8 mts. x 0.8 mts , 3 pasos domiciliares en tubo de 80 cm, 3 cajas de registro de 0.85 x 0.85 mts en concreto de 210 kg/cm sobre lastre proctor 95% con 10 cm de espesor en su base con sus extremos 7-10- chorreada en el sitio con varilla # 3@ 20 cm A-D.Dicho proyecto estaba presupuestado por un monto de ¢ 2.100.000,00 el cual fue debidamente adjudicado para su ejecución. Asimismo, el recurrente cuando firmó el acta mencionada se comprometió a "dar el permiso para proceder hacer el trabajo correspondiente al presupuesto para dicho proyecto." Solicita se declare sin lugar el recurso.-
  6. 6En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta el Magistrado Salazar Murillo; y,

Considerando:

I.Objeto del recurso.- El recurrente alega que el Instituto Nacional de Vivienda y Urbanismo construyó una urbanización en la que existen 32 casas que evacuan las aguas negras, jabonosas y servidas directamente en la cuneta, la cual va a desfogar en su propiedad, lo que provoca malos olores y ha perjudicado un bosque y naciente de agua que se ubican en su inmueble. Señala que pese a lo anterior, las autoridades recurridas no ha solucionado su problema.

II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:

  • a)El Instituto Nacional de Vivienda y Urbanismo no tiene responsabilidad por el desfogue de las aguas servidas en la propiedad del amparado (ver copia del memorando PT-709-2012 del 14 de junio de 2012 aportado por el representante del INVU).
  • b)Desde el año 2011, el Ministerio recurrido realizó gestiones de coordinación institucional con los demás entes estatales relacionados con la denuncia interpuesta por el recurrente: Instituto Costarricense de Acueductos y Alcantarillados, Colegio Federado de Ingenieros y Arquitectos, Municipalidad de Siquirres, Defensoría de los Habitantes y entre todos verificaron la existencia de un desfogue iandecuado de aguas pluviales y servidas provenientes de viviendas de Urbanización INVU, que atraviesan la propiedad el recurrente y se estancan, lo que produce malos olores criadores de vectores y ponen en riesgo la salud de lo vecinos (ver oficios HA-ARS-S-1925-2011, A-ARS-S-1922-2011, A-ARS-S-1927-2011 todos del 29 de agosto de 2011 aportados por el Director del Área de Salud).
  • c)En el mes de julio de 2012, el Área Rectora de Salud realizó la inspección a 27 viviendas de la Urbanización INVU Nuevo, se detectó que 17 arrojaban las aguas servidas al caño de aguas pluviales y giró las ordenes sanitarias respectivas para que se realizaran las obras necesarias para brindar una adecuada disposición de las aguas servidas, las otras 9 casas no fue posible verificar la situación (ver informe de la recurrida, copia del oficio HA-ARS-S-3697-2012 del 16 de agosto de 2012).
  • d)Mediante orden sanitaria HA-ARS-S-3142-2012 notificada el 6 de agosto de 2012, el Ministerio recurrido ordenó a la Alcaldesa Yelgi Lavignia Night de la Municipalidad de Siquirres, efectuar las obras necesarias para brindar una adecuada disposición de las aguas pluviales provenientes de la urbanización INVU Nuevo, y evitar que se direccionen por la propiedad del señor Rogelio Crooks o propiedades vecinas, con fecha de vencimiento 6 de octubre de 2012 (ver copia de la orden sanitaria aportada).
  • e)El 31 de octubre de 2012, personal del Área Rectora de Siquirres se reunieron con funcionarios de la Municipalidad, el recurrente, vecinos, con el fin de rendir cuentas antes los vecinos afectados (ver copia de la documentación aportada por el Ministerio recurrido) f) El 14 de diciembre de 2012, el Área de Salud recurrida interpuso las denuncias respectivas ante la Fiscalía de Siquirres por incumplimiento de las ordenes sanitarias giradas en contra de los habitantes de las viviendas de la Urbanización INVU por el desfogue inadecuado de las aguas pluviales y servidas (ver copia del oficio HA-ARS-S-6204-2012).
  • g)El 28 de enero de 2013, la Municipalidad accionada solicitó al Concejo Municipal incorporar contenido económico en el presupuesto, lo cual fue conocido en la sesión ordinaria No. 143 de igual fecha y se trasladó el oficio a la Comisión de Hacienda y Presupuesto (ver copia del oficio DA-3-4019-2013).
  • h)El 13 de mayo de 2013, la Directora del Area de Salud recurrida interpuso la denuncia ante la Fiscalía de Siquirres por incumplimiento por parte de la Alcaldesa de Siquirres la orden sanitaria .HA-ARS-S-3142-2012(ver copia de la denuncia y acta de las 15:30 horas del 10 de junio de 2013).
  • i)El recurrente interpuso denuncia ante el Tribunal Ambiental, la cual se tramita bajo el expediente 113-06-01-TAA (ver copia de la documentación aportada)

III.Sobre el fondo. En el caso bajo estudio, la Sala tiene por demostrado que el Instituto Nacional de Vivienda y Urbanismo construyó la Urbanización Siquirres hace más de 30 años y dado el crecimiento de la población asentada en los alrededores del proyecto y el levantamiento de nuevas construcciones, se produjo un incremento de aguas residuales, lo que sumado a la no canalización de éstas en forma adecuada, está provocando el problema denunciado por el accionante. A su vez, en virtud de la denuncia efectuada desde el año 2010 por el recurrente, el Área Rectora de Salud de Siquirres, Limón realizó las gestiones correspondientes y en coordinación con la Municipalidad, la Defensoría de los Habitantes, el Colegio Federado de Ingenieros y el Instituto Costarricense de Acueductos, efectuaron en el año 2012 las inspecciones in situ, se detectó que las viviendas disponían de las aguas servidas a la cuneta pluvial y giró las ordenes sanitarias tanto a los propietarios de las viviendas como a la Alcaldesa Municipal Yelgi Lavignia Night, en la precisamente se le ordenó que debía" ... realizar las obras necesarias para brindar una adecuada disposición de las aguas pluviales provenientes de la urbanización INVU nuevo, evitando que las mismas se direccionen por la propiedad del señor Rogelio Crooks o propiedades vecinas ...".

No obstante, la parte recurrida verificó el incumplimiento a dichas ordenes sanitarias, por lo cual se interpuso denuncia ante los Tribunales por el delito de desobediencia a la autoridad, tramitada mediante sumarias números 12-201174-436-PE INT 2215-3-12 y 13-200264-486-PE INT1112-3-13. Así las cosas, en relación con el Instituto recurrido y el Ministerio accionado, la Sala verifica que no han lesionado los derechos fundamentales del recurrente por cuanto, previo a la interposición del presente recurso de amparo realizaron las funciones que les fueron encomendadas en el ordenamiento jurídico para lograr solucionar el problema denunciado por el recurrente.

IV.Por otra parte, con respecto a las actuaciones del Ente Municipal recurrido, el Presidente del Concejo Municipal informó que tuvo conocimiento de la problemática hasta el 19 de junio del 2013, cuando la Defensoría solicitó la celebración de una sesión extraordinaria y ese mismo día se llevó a cabo la sesión extraordinaria No. 122, en la que se tomó el acuerdo No. 2495-19-06-2013 en el que se dispuso solicitar a la administración que presentara una modificación presupuestaria para el 24 de junio del 2013 exclusiva para girar recursos para la solución de aguas servidas en la Urbanización del Invu, para lo cual también se aprobó un aporte económico de ¢ 1.000.000,00 (un millón de colones exactos) para la solución del problema que presentaban las aguas servidas. A su vez, el Despacho de la Alcaldía recurrida indicó que, dado el acuerdo tomado por el Concejo Municipal supraindicado, realizó la "Contratación Directa 2013-CD- 000205-01 Proyecto Número 1 Mejoras al Salón Comunal Germania, 2.

Evacuación Pluvial INVU" y según consta en el Acta de Evacuación de Aguas INVU Nuevo, de las 12:15 horas del 17 de septiembre del 2013, el amparado acordó dar permiso para realizar el trabajo correspondiente a dicho presupuesto. Así las cosas, se desprende que previo a la interposición del presente recurso de amparo, el recurrente tenía conocimiento de las obras que tiene proyectado ejecutar la Municipalidad recurrida e incluso, según lo dicho bajo juramento por la autoridad recurrida consta en el acta rubricada por el recurrente de las 12:15 horas del 17 de septiembre del 2013, que otorgó el permiso para realizar el trabajo correspondiente al presupuesto acordado y que dio origen a la Contratación Directa 2013-CD- 000205-01 Proyecto Número 1 Mejoras al Salón Comunal Germania, 2. Evacuación Pluvial INVU". Si bien, se encuentra pendiente de ejecutar la Contratación Directa señalada, la Sala considera que el tiempo transcurrido desde que el recurrente presentó la denuncia, es excesivo y desproporcionado y a la fecha, la Municipalidad no ha solucionado el problema.

Tal situación hace que se deba acoger el amparo, toda vez que a pesar de que las autoridades municipales tenían conocimiento de la situación denunciada, no adoptaron las medidas o acciones pertinentes para solucionar definitivamente tal problemática dentro de un plazo razonable. Por otro lado, en criterio de la Sala, la Municipalidad de Siquirres ha mostrado incapacidad para hacer cumplir las leyes en la materia y su obligación de garantizar el disfrute de los habitantes de la zona a un ambiente sano y ecológicamente equilibrado. En este sentido, no se observa que se hayan ejecutado acciones concretas para las cuales se encuentra facultada dicha Municipalidad, esto por cuanto existe un estado de necesidad inminente ante lo cual la Administración debe responder a fin de resguardar la salud de los vecinos de esa comunidad que, se está viendo afectado debido a un problema de salud pública y contaminación; sin embargo, en el caso bajo estudio, no se procedió de tal manera, haciendo imperativa la estimatoria del recurso en cuanto este extremo.

V.Finalmente, en relación con el tipo de obras que la Municipalidad recurrida va a realizar para paliar la problemática expuesta, dicha pretensión es ajena al ámbito de competencia de esta Jurisdicción, por lo que el amparado deberá manifestar su inconformidad ante las propias autoridades competentes de la Municipalidad accionada, o en su defecto, en la vía jurisdiccional competente, a fin de que se resuelva lo que en derecho corresponda, pues lo planteado hace referencia a un conflicto de legalidad ordinaria propio de resolverse en tales vías. La sola mención de una actividad probatoria pericial hace ver que en este caso lo que se pretende es que la Sala revise las razones y fundamentos con base en los cuales la Municipalidad va ejecutar las obras de desfogue de aguas, ello resulta ajeno al carácter eminentemente sumario del proceso de amparo, que es incompatible con la práctica de diligencias probatorias lentas y complejas, como lo sería revisar los criterios administrativos y técnicos impugnados. En consecuencia, el alegatos aducido en este extremo del recurso deberán plantearse ante las autoridades competentes, a efecto de que sean éstas las que resuelvan lo que técnicamente y en derecho corresponda.

VI.Voto salvado de la Magistrada Hernández López respecto del reclamo por infracción del artículo 50 de la Constitución Política.

Coincido con los razonamientos del Magistrado Jinesta Lobo para desestimar este recurso por infracción del artículo 50 de la Constitución Política, y agrego lo siguiente:

1. El contexto histórico que motivó en su momento la amplia intervención de la Sala en materia ambiental, ha tenido una considerable variación que impone a este órgano reconsiderar las condiciones para su participación en el aseguramiento del derecho de las personas a un ambiente sano y equilibrado, tal y como ha sido tutelado en el artículo 50 de la Constitución Política. En efecto, la situación actual –caracterizada por una amplísima producción legal y reglamentaria que incluye reglas de fondo, procedimientos y creación de órganos para el cumplimiento de lo ordenado en la Carta Fundamental- es radicalmente diferente de la anterior, en la cual la ausencia de normativa y de instancias estatales con competencia apropiada, le impuso a la Sala un papel de protagonista, casi único, en la defensa del precitado derecho constitucional.

2. Hoy en día, nos encontramos frente a un “denso entramado” de normativa ambiental –tal y como acertadamente lo ha descrito el Magistrado Jinesta Lobo en su voto salvado sobre este tema- lo cual ha producido dos fenómenos relevantes: el primero y más obvio, es el surgimiento de una abarcadora regulación jurídica respecto de actividades cuya incidencia en el ambiente estaba poco o nada ordenada, así la creación de órganos estatales con potestades de vigilancia y control sobre los efectos de la actividad humana en el entorno. El segundo fenómeno consiste en que esa creciente juridificación –predominantemente legislativa y reglamentaria– trae aparejada una ineludible entrada en escena tanto de la justicia administrativa como de la jurisdicción ordinaria -prioritariamente la contencioso administrativa, pero también la penal. En ellas, acorde con la importancia del derecho ambiental, se han regulado de forma amplia vías procesales y medios de legitimación incluyentes, de manera que los administrados puedan hacer valer lo establecido en ese amplio orden jurídico que se relaciona con el tema ambiental.

3. En ese contexto, no resulta apropiado jurídicamente, ni desde el punto de vista funcional, que la Sala Constitucional desplace, o -peor aún- sustituya, a los órganos de justicia ordinarios en la realización de su tarea, también de rango constitucional, de velar por el efectivo cumplimiento de leyes y reglamentos. Es impropio jurídicamente porque en la inmensa mayoría de estos casos lo que se solicita es que interprete y haga valer normas legales y reglamentarias con lo que arriesga traslapar sus competencias con las de otros órganos jurisdiccionales que –ellos sí- han sido creados para ejecutar tales tareas; y resulta también funcionalmente incorrecto, porque el diseño de sus procesos se aviene mal con la complejidad que está presente en numerosos conflictos ambientales que se componen de series de hechos y actos técnica y jurídicamente complejos. Sobre ambas cuestiones existen conocidos ejemplos en los que la Sala ha arrojado una resolución a medias o técnicamente incompleta, o bien se han generado fricciones innecesarias y afectación de la seguridad jurídica.

4. Como parte de los aspectos técnicos que he valorado, añado que está el hecho de que esta jurisdicción no cuenta con jueces ejecutores de sentencia que permitan darle seguimiento adecuado a las mismas -generalmente complejas-, que implican en ocasiones el seguimiento de planes remediales, entre otros, con coordinación interinstitucional y seguimiento de meses y hasta años.

5. Desde esa perspectiva, la decisión de dar un paso al lado en la materia ambiental por parte de este Tribunal no debe ser vista como un abandono de la materia ambiental, sino al contrario, de su adecuada tutela en la instancia que mejor se aviene a la naturaleza de su complejidad y diversidad. Asimismo tampoco debe ser visto como la declinación de esta instancia en su tarea de protección de los derechos constitucionales que le imponen la Constitución Política y su Ley Orgánica, que desde mi punto de vista, queda reservada en esta materia para casos específicos. Se trata más bien, de un ejercicio de reacomodo de las cargas y tareas que corresponden a los distintos órganos estatales, de manera que cada uno de ellos, pueda desplegar plenamente su labor dentro del ámbito que se le ha asignado, así como del ejercicio de fijar su propia competencia, según lo establece el artículo 7 de su Ley Orgánica.

6. Queda claro que la Sala no se plantea abandonar a otras jurisdicciones la labor de protección de los derechos de las personas en materia ambiental. Es conocido que si bien todo reclamo por infracción de normas legales y reglamentarias puede ser reconducido hasta el ámbito constitucional, existen casos cuya resolución no exige más que la aplicación del derecho de la Constitución. Se trata entonces de lograr que la Sala se convierta en protagonista junto con otros, de manera que –entre todos y cada uno en su espacio- se pueda cubrir toda la variedad de situaciones que presenta una protección del derecho a un medio ambiente sano y equilibrado dentro de una sociedad en la que también existen otras necesidades igual de acuciantes. Con esta posición creo firmemente que el ciudadano no pierde un ápice de protección pero se gana sustancialmente en amplitud, en perspectiva y en respeto al equilibrio y distribución de poderes, principio este último de obligada consideración, puesto que rige la dinámica constitucional de cualquier sistema liberal y democrático como el nuestro.- 7.

En línea con lo anterior, sostengo que esta Sala debe abstenerse de conocer los reclamos que se le presenten por supuesta infracción al artículo 50 de la Constitución Política para dejar en manos de la justicia administrativa y la jurisdicción contenciosa administrativa su conocimiento. Lo anterior se deja afirmado con carácter general, sin perjuicio de reconocer la existencia de casos particulares o grupos de casos que, según mi criterio, si resultarían aún mejor tutelados por esta Sala y por tanto deben ser conocidos y resueltos por ella.- Dentro de tales grupos de casos, y sin que esta enunciación pueda considerarse como una lista cerrada y definitiva, puedo señalar que la Sala debe reservarse el conocimiento de situaciones como por ejemplo los reclamos por infracciones ambientales que además pongan en riesgo directo la salud de las personas, o el acceso o calidad del agua; los casos de violaciones groseras y directas al ambiente y en los cuales se constate una palmaria ausencia de la protección por parte de las autoridades estatales, siempre y cuando además la naturaleza del reclamo permita ser abordado mediante el instrumento del amparo como instituto procesal sumario y especial, ya que estimo que tampoco se debe “ordinariar” el amparo para abordar, aún en estos casos citados, temas que rebasen la capacidad de ser atendidos adecuadamente en el mismo.

8. En el caso concreto, se observa que la situación planteada se ubica dentro de aquellas situaciones en las que la intervención de los medios de protección de la justicia ordinaria, resultan ser una vía más amplia y completa por lo cual, en aplicación de los anteriores razonamientos y el artículo 9 de la Ley de la Jurisdicción Constitucional, voto por rechazar de plano el recurso

Por tanto:

Se declara con lugar el recurso únicamente con respecto a la Municipalidad de Siquirres. Se le ordena a Yelgi Lavinia Verley Knight y Arturo Castillo Valverde, por su orden Alcaldesa y Presidente del Concejo, ambos de la Municipalidad de Siquirres, o a quienes en su lugar ejerzan dichos cargos, que en el plazo de 4 meses procedan a solucionar en forma definitiva el problema de desfogue de aguas que afecta la propiedad del recurrente. Lo anterior, bajo el apercibimiento de que si así no lo hicieren, incurrirán en el delito de desobediencia a la autoridad tipificado en el artículo 71 de la Ley de la Jurisdicción Constitucional. Se condena a la Municipalidad de Siquirres al pago de las costas, daños y perjuicios causados, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. Notifíquese a las partes recurridas la presente resolución, en forma personal. La Magistrada Hernández López salva el voto y rechaza de plano el recurso.-
