Writ of amparo (recurso de amparo) proceeding under case number 11-006336-0007-CO, filed by LUIS VARGAS FERNANDEZ, of legal age, identity card 1-365-127, against LA MUNICIPALIDAD DE SAN JOSE, EL MINISTERIO DE SALUD and EL INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.
Resultandos (Resultando):
Justice Ulate Chacón drafted the opinion; and, Considerandos (Considerando):
The petitioner alleges that, in San José, near the former Registro Civil building, there is a sewer on the sidewalk in front of Hotel Los Recuerdos whose deteriorated condition causes excrement and other waste to rise onto the public roadway when it rains.
The following facts relevant to deciding this matter are deemed duly established, either because they were proven or because the respondent failed to address them as ordered in the initial decision:
a. On 5 de agosto del 2011, the Instituto Costarricense de Acueductos y Alcantarillados inspected the sanitary-sewer system inspection chamber serving Hotel Los Recuerdos and located on the sidewalk, confirming that the chamber was obstructed at that time. It was also determined that the property owner had failed to maintain and clean the inspection chamber, that it was damaged, and that it lacked grease traps to prevent its collapse due to saturation with solid waste. It was further established that it did not meet the requirements imposed by the applicable technical regulations because the siphon openings lacked the respective safety plugs needed to prevent pressurized water flow whenever it rained. All those factors caused residual sludge to spill when it rained (see the report submitted by the respondent authority and the copy of the technical report dated 5 de agosto del 2011); b. In view of the foregoing, and to prevent possible obstructions in the sanitary sewer service connection serving Hotel Los Recuerdos, on 5 de agosto del 2011 the Instituto Costarricense de Acueductos y Alcantarillados suctioned the wastewater accumulated in the inspection chamber, used probes to clean the service connection, and cleaned the pipe located along the centerline of the roadway to eliminate possible obstructions in the main network. As a result, the water resumed flowing normally (see the report submitted by the respondent authority and the copy of the technical report dated 5 de agosto del 2011).
The following facts relevant to deciding this amparo proceeding are not deemed established:
a. That, before filing this amparo proceeding, the petitioner had submitted any complaint to the respondent authorities concerning the events that gave rise to this petition (the case file); b. That, as of this date, the Instituto Costarricense de Acueductos y Alcantarillados has issued and formally communicated an administrative act (acto administrativo) to the owner of the property where Hotel Los Recuerdos is located, informing the owner of the deficiencies detected in the inspection chamber and ordering the measures necessary to correct the problem and prevent it from collapsing again (the case file).
It must first be stated that the fundamental rights to health and to a healthy and ecologically balanced environment are constitutionally recognized (Articles 21, 50, 73 and 89 of the Constitución Política), as well as recognized through the international legal framework applicable in Costa Rica. In this regard, in judgment 2006-005928 issued at 15:00 on 2 de mayo del 2006, this Court held:
“(…) The right to life recognized in Article 21 of the Constitution is the cornerstone upon which the other fundamental rights of the inhabitants of the Republic rest. Likewise, that provision of the Political Constitution provides the basis for the right to health, since life is inconceivable unless human beings are guaranteed minimum conditions for an adequate and harmonious psychological, physical, and environmental balance. Public health and the right to a healthy and ecologically balanced environment (derecho a un ambiente sano y ecológicamente equilibrado) are constitutionally recognized in Articles 21, 50, 73, and 89 of the Political Constitution. Specifically, Article 50 of the Constitution expressly recognizes the right of all inhabitants of the country to enjoy a healthy and perfectly balanced environment. That right is a fundamental guarantee for the protection of life and public health.
In support of the foregoing, this Court has used the concept of ‘environmental quality’ (calidad ambiental) precisely as a measure of people’s quality of life, in conjunction with other elements such as health, food, work, and housing, noting that every person has the right to use the environment for their own development, but not without limitation, since there is also a duty to protect and preserve the environment for present and future generations—the principle of sustainable development (principio de desarrollo sostenible).” Likewise, Article 50 of the Political Constitution gives rise to the State’s obligation to protect the environment. That provision establishes:
“The State shall seek the greatest welfare for all inhabitants of the country by organizing and promoting production and the most appropriate distribution of wealth.
Every person has the right to a healthy and ecologically balanced environment. Accordingly, every person has standing to report acts that violate that right and to seek compensation for the harm caused.
The State shall guarantee, defend, and preserve that right. The law shall determine the corresponding liabilities and penalties.” As a consequence of the foregoing, this Chamber has repeatedly recognized that the State’s primary and fundamental obligations include the duty to respect, protect, and guarantee—in a diligent and timely manner—the right to health and to a healthy and ecologically balanced environment (see, e.g., judgments 1992-1915 issued at 14:12 on 22 de julio de 1992, 2004-10039 issued at 14:39 on 13 de septiembre del 2004, 2006-17126 issued at 15:05 on 28 de noviembre del 2006, and 2008-001003 issued at 14:56 on 23 de enero del 2008).
It has been fully established that the public-health problem alleged by the amparo petitioner (amparado), involving a sewage spill (derrame de aguas negras), does in fact exist in the case under review. The Municipalidad de San José reports that, following the filing of this application for amparo (recurso de amparo), an on-site inspection was conducted and it was determined that the sewage-overflow problem was related to deterioration of the sanitary system’s inspection chambers (cajas de registro). This situation was confirmed by the Instituto Costarricense de Acueductos y Alcantarillados itself, since on 5 de agosto del 2011 it inspected the inspection chamber of the sanitary sewer system (sistema de alcantarillado sanitario) serving Hotel Los Recuerdos, located on the sidewalk, and found that the chamber was obstructed. It was determined that the property owner had failed to maintain and clean the inspection chamber, which was damaged and lacked grease traps (trampas de grasas) to prevent it from collapsing due to saturation with solid waste.
It was also determined that the chamber did not meet the requirements established by the applicable technical regulations, because the siphon openings lacked the corresponding safety plugs to prevent pressurized water flow when it rained. All these factors caused residual sludge (lodos residuales) to spill when it rained. In response, and to prevent possible obstructions in the sanitary service connection (prevista sanitaria) of Hotel Los Recuerdos, the Instituto Costarricense de Acueductos y Alcantarillados suctioned out the wastewater accumulated in the inspection chamber, used probes to clean the service connection, and cleaned the pipe located along the centerline of the roadway in order to eliminate possible obstructions in the general network. As a result, the water resumed flowing normally. The Instituto Costarricense de Acueductos y Alcantarillados further reports that, pursuant to the applicable statutory and regulatory provisions, responsibility for maintaining and cleaning these inspection chambers lies with the property owner.
It also reports that, before this application for amparo was filed, the appellant (recurrente) had not submitted any complaint to the institution concerning the aforementioned public-health problem. Accordingly, it is established that the sewage-overflow problem arose from a private-law party’s failure to properly maintain and clean an inspection chamber on property owned by that party, and that the chamber was constructed without complying with the technical regulations. It is also established that, before filing this application for amparo, the appellant had not submitted the corresponding complaint to the competent authority to notify it of the sewage-overflow problem so that the matter could be investigated and the necessary technical measures determined. In any event, once the Instituto Costarricense de Acueductos y Alcantarillados learned of the situation as a result of the filing of this application for amparo, it promptly investigated the source of the problem and even performed cleaning work so that the sewage could flow properly through the sanitary sewer network.
Consequently, with respect to this aspect of the claim, this Chamber finds no violation of the petitioner’s fundamental rights. Similar considerations apply to the Ministerio de Salud and the Municipalidad de San José because, first, there is no evidence that the petitioner submitted any complaint to those authorities and, second, the sewage-spill problem relates to the sanitary sewer system administered by the Instituto Costarricense de Acueductos y Alcantarillados.
VI.Notwithstanding the foregoing, this Chamber cannot overlook the fact that the Instituto Costarricense de Acueductos y Alcantarillados has determined that the inspection chamber in question may collapse again unless the property owner “reconstructs the inspection chamber and installs the aforementioned plugs. Additionally, the owner of the Hotel must install grease traps upstream from the inspection chamber and maintain them continuously, because even if the inspection chamber is repaired and AyA cleans the service connection and the general network, if the improper practice of discharging waste into the sanitary system or maintaining unlawful stormwater connections continues, it will undoubtedly collapse again” (see folio 3 of the technical report dated 5 de agosto del 2011). In this case, neither the report submitted by the respondent authority nor the evidence in the record indicates that, as of this date, the Instituto Costarricense de Acueductos y Alcantarillados has issued and formally served an administrative act (acto administrativo) on the owner of the property where Hotel Los Recuerdos is located, informing the owner of the deficiencies detected in the inspection chamber and warning the owner of the measures required to correct the problem and prevent the chamber from collapsing again.
Accordingly, with respect to this point, the respondent authority has not acted diligently to prevent harm and protect public health and the environment. The application for amparo must therefore be partially granted against the Instituto Costarricense de Acueductos y Alcantarillados as to this particular issue. In all other respects, the application for amparo under review must be denied.
Por tanto:
The application is declared partially GRANTED against the Instituto Costarricense de Acueductos y Alcantarillados. Eduardo Lezama Fernández, in his capacity as Deputy General Manager of the Instituto Costarricense de Acueductos y Alcantarillados, or whoever holds that office, is ordered, within the non-extendable period of fifteen days from service of this decision, to issue and formally serve an administrative act on the owner of the property where Hotel Los Recuerdos is located, informing the owner of the deficiencies detected in the inspection chamber corresponding to the property and warning the owner of the measures necessary to correct the problem and prevent the chamber from collapsing again. Eduardo Lezama Fernández, in his capacity as Deputy General Manager of the Instituto Costarricense de Acueductos y Alcantarillados, or whoever holds that office, is advised that failure to comply with this order will constitute the offense of disobedience and that, pursuant to Article 71 of the Law governing this jurisdiction, anyone who receives an order issued in an application for amparo that the person is required to comply with or enforce, and who fails to comply with or enforce it, shall be punished by imprisonment for three months to two years or by a fine of twenty to sixty day-fines, provided that the offense is not subject to a more severe penalty.
The Instituto Costarricense de Acueductos y Alcantarillados is ordered to pay the costs, damages, and losses caused by the facts underlying this ruling, which shall be quantified during enforcement of the judgment before the administrative-litigation jurisdiction (jurisdicción de lo contencioso administrativo). In all other respects, the application is denied. This decision shall be personally served on Eduardo Lezama Fernández, in his capacity as Deputy General Manager of the Instituto Costarricense de Acueductos y Alcantarillados, or whoever holds that office.

Recurso de amparo que se tramita en expediente número 11-006336-0007-CO, interpuesto por LUIS VARGAS FERNANDEZ, mayor, cédula de identidad 1-365-127, contra LA MUNICIPALIDAD DE SAN JOSE, EL MINISTERIO DE SALUD y EL INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.
Resultando:
Redacta el Magistrado Ulate Chacón; y,
Considerando:
El recurrente acusa que en San José, en las cercanías del antiguo edificio del Registro Civil, en la acera ubicada frente al Hotel Los Recuerdos, existe una cloaca cuyo estado de deterioro provoca que, cuando llueve, excrementos y otros desechos afloren a la vía pública.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ello según lo prevenido en el auto inicial:
a. el 5 de agosto del 2011, el Instituto Costarricense de Acueductos y Alcantarillados inspeccionó la caja de registro del sistema de alcantarillado sanitario del Hotel Los Recuerdos ubicada en la acera y se comprobó que, en ese momento, la referida caja estaba obstruida. También se determinó que el propietario del inmueble no le había dado mantenimiento y limpieza a la caja de registro, estaba dañada y no contaba con trampas de grasas para evitar su colapso por saturación de desechos sólidos. También se estableció que no cumplía los requisitos dispuestos por la normativa técnica aplicable, pues las bocas del sifón no contaban con los respectivos tapones de seguridad para evitar el flujo de agua a presión cada vez que llovía. Todos esos factores provocaban que los lodos residuales se derramaran cuando llovía (ver informe rendido por la autoridad recurrida y copia del informe técnico del 5 de agosto del 2011); b. en razón de lo anterior, y para evitar posibles obstrucciones en la prevista sanitaria del Hotel Los Recuerdos, el 5 de agosto del 2011 el Instituto Costarricense de Acueductos y Alcantarillados procedió a succionar el agua residual acumulada en la caja de registro, con el uso de sondas realizó una limpieza de la prevista y se procedió con la limpieza de la tubería ubicada en la línea centro de la carretera a fin de eliminar posibles obstrucciones en la red general. Como producto de ello el agua quedó fluyendo con normalidad (ver informe rendido por la autoridad recurrida y copia del informe técnico del 5 de agosto del 2011).
No se estiman demostrados los siguientes hechos de relevancia para la resolución de este amparo:
a. que, de previo a la interposición de este amparo, el recurrente hubiese interpuesto alguna denuncia ante las autoridades recurridas por los hechos que motivaron la interposición de este recurso (los autos); b. que, a la fecha, el Instituto Costarricense de Acueductos y Alcantarillados haya emitido y comunicado formal acto administrativo al propietario del inmueble en donde se ubica Hotel Los Recuerdos, a fin de informarle sobre las deficiencias detectadas en la referida caja registro y prevenirle sobre las medidas necesarias para corregir dicho problema y evitar que colapse nuevamente (los autos).
Debe indicarse, en primer lugar, que los derechos fundamentales a la salud y a un ambiente sano y ecológicamente equilibrado se encuentran reconocidos constitucionalmente (artículos 21, 50, 73 y 89 de la Constitución Política), así como a través de la normativa internacional aplicable en Costa Rica. En este sentido, en sentencia 2006-005928 de las 15 horas del 2 de mayo del 2006, este Tribunal resolvió:
“(…) El derecho a la vida reconocido en el numeral 21 de la Constitución es la piedra angular sobre la cual descansan el resto de los derechos fundamentales de los habitantes de la república. De igual forma, en ese ordinal de la carta política encuentra asidero el derecho a la salud, puesto que, la vida resulta inconcebible si no se le garantizan a la persona humana condiciones mínimas para un adecuado y armónico equilibrio psíquico, físico y ambiental. Ahora bien, la salud pública y el derecho a un ambiente sano y ecológicamente equilibrado se encuentran reconocidos constitucionalmente en los artículos 21, 50, 73 y 89 de la Constitución Política. Específicamente, el artículo 50 constitucional reconoce de forma expresa el derecho de todos los habitantes del país a disfrutar de un medio ambiente saludable y en perfecto equilibrio. Ese derecho es garantía fundamental para la protección de la vida y la salud pública.
En apoyo de lo anterior este Tribunal ha recurrido a la utilización de la noción de “calidad ambiental” como un parámetro, precisamente, de la calidad de vida de las personas, que se conjuga con otros elementos tales como la salud, la alimentación, el trabajo y la vivienda, haciendo referencia a que toda persona tiene derecho a hacer uso del ambiente para su propio desarrollo pero no de manera ilimitada, ya que, también, existe un deber de protección y preservación del medio ambiente para las generaciones presentes y futuras –principio de desarrollo sostenible–.” Asimismo, del artículo 50 de la Constitución Política se deriva la obligación del Estado de proteger el ambiente. Norma que establece al efecto:
"El Estado procurará el mayor bienestar a todos los habitantes del país, organizando y estimulando la producción y el más adecuado reparto de la riqueza.
Toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado. Por ello está legitimada para denunciar los actos que infrinjan ese derecho y para reclamar la reparación del daño causado.
El Estado garantizará, defenderá y preservará ese derecho. La ley determinará las responsabilidades y las sanciones correspondientes" Como derivación de lo anterior, esta Sala ha reconocido de forma reiterada que, como parte de las obligaciones primarias y fundamentales del Estado, está el deber de respetar, proteger y garantizar –de forma diligente y oportuna- el derecho a la salud y a un ambiente sano y ecológicamente equilibrado (ver, p. ej., sentencias 1992-1915 de las 14:12 horas del 22 de julio de 1992, 2004-10039 de las 14:39 horas del 13 de septiembre del 2004, 2006-17126 de las 15:05 horas del 28 de noviembre del 2006 y 2008-001003 de las 14:56 horas del 23 de enero del 2008).
Se tiene plenamente acreditado que, efectivamente, en el caso en estudio se plantea el problema sanitario acusado por el amparado, por derrame de aguas negras. La Municipalidad de San José informa que, con ocasión a la interposición de este amparo, se realizó una inspección en el sitio y se determinó que el referido problema de desbordamiento de aguas negras se relacionaba con el deterioro de las cajas de registro del sistema sanitario. Situación confirmada por el propio Instituto Costarricense de Acueductos y Alcantarillados, ya que el 5 de agosto del 2011 se inspeccionó la caja de registro del sistema de alcantarillado sanitario del Hotel Los Recuerdos que se ubica en la acera y se comprobó que dicha caja estaba obstruida. Se detectó que el propietario del inmueble no le había dado mantenimiento y limpieza a la caja de registro, la cual estaba dañada y no contaba con trampas de grasas para evitar su colapso por saturación de desechos sólidos.
También se determinó que no cumplía los requisitos dispuestos por la normativa técnica aplicable, pues las bocas del sifón no contaban con los respectivos tapones de seguridad para evitar el flujo de agua a presión cuando llovía. Todos esos factores provocaban que los lodos residuales se derramaran cuando llovía. Ante ello, y para evitar posibles obstrucciones en la prevista sanitaria del Hotel Los Recuerdos, el Instituto Costarricense de Acueductos y Alcantarillados procedió a succionar el agua residual acumulada en la caja de registro, con el uso de sondas realizó una limpieza de la prevista y se procedió con la limpieza de la tubería ubicada en la línea centro de la carretera a fin de eliminar posibles obstrucciones en la red general. Como producto de ello el agua quedó fluyendo con normalidad. Por otra parte, el Instituto Costarricense de Acueductos y Alcantarillados también informa que, según lo dispuesto por normativa legal y reglamentaria aplicable, el mantenimiento y limpieza de dichas cajas de registro es responsabilidad del propietario del inmueble.
También informa que, con anterioridad a la interposición de este amparo, el recurrente no había planteada denuncia alguna ante la institución, referente al citado problema sanitario. Así las cosas, se constata que el origen del mencionado problema de desbordamiento de aguas negras se debe a la omisión de un sujeto de derecho privado en brindar el debido mantenimiento y limpieza a la caja de registro de un inmueble de su propiedad y que ésta fue construida sin ajustarse a la normativa técnica. Asimismo, se acredita que de previo a la interposición de este amparo el recurrente no había planteado la respectiva denuncia ante la autoridad competente, para hacer de su conocimiento la existencia del mencionado problema de desbordamiento de aguas negras, a fin que se investigara el tema y se pudieran determinar las medidas técnicas que debían adoptarse. En todo caso, una vez que el Instituto Costarricense de Acueductos y Alcantarillados fue puesto en conocimiento de la situación, en razón de la interposición de este amparo, procedió de forma oportuna a investigar el origen del problema e incluso procedió a realizar trabajos de limpieza, en procura que las aguas negras pudiesen fluir debidamente a través de la red sanitaria.
Por lo que, en cuanto a este extremo, esta Sala no observa una infracción a los derechos fundamentales del amparado. Similares consideraciones son aplicables respecto al Ministerio de Salud y la Municipalidad de San José, pues, en primer lugar, no consta que el amparado haya planteado denuncia alguna ante tales autoridades, y, en segundo lugar, el referido problema de derrame de aguas negras se relaciona con el alcantarillado sanitario que administra el Instituto Costarricense de Acueductos y Alcantarillados.
VI.No obstante lo anterior, no puede obviar esta Sala que el Instituto Costarricense de Acueductos y Alcantarillados ha establecido que la caja de registro en cuestión puede colapsar nuevamente, salvo que el propietario del inmueble proceda a “reconstruir la caja de registro y colocar los mencionados tapones. Adicionalmente debe el propietario del Hotel, proceder a colocar trampas de grasas antes de la caja de registro y brindarle mantenimiento permanente, ya que aún y cuando se repare la caja de registro y el AyA limpie la prevista y la red general, si continúan con la mala práctica de lanzar desechos al sistema sanitario o con las conexiones ilícitas de aguas de lluvia, indudablemente este volverá a colapsar” (ver folio 3 del informe técnico del 5 de agosto del 2011). En cuyo caso, ni del informe aportado por la autoridad recurrida, ni de la prueba aportada los autos, se desprende que, a la fecha, el Instituto Costarricense de Acueductos y Alcantarillados haya emitido y comunicado formal acto administrativo al propietario del inmueble en donde se ubica el Hotel Los Recuerdos, con el objeto de informarle sobre las deficiencias detectadas en la referida caja registro y prevenirle sobre las medidas necesarias para corregir dicho problema y evitar con ello que colapse nuevamente.
Por lo que, en cuanto a este punto, no se observa una actuación diligente de prevención de parte de la autoridad recurrida, en protección de la salud pública y el medio ambiente. De allí que procede acoger parcialmente el amparo, en contra del Instituto Costarricense de Acueductos y Alcantarillados, respecto a este punto en particular. En lo demás, debe desestimarse el amparo en estudio.
Por tanto:
Se declara parcialmente CON LUGAR el recurso, en contra del Instituto Costarricense de Acueductos y Alcantarillados. Se ordena a Eduardo Lezama Fernández, en su condición de Subgerente General del Instituto Costarricense de Acueductos y Alcantarillados, o a quien ocupe el cargo, que en el término improrrogable de quince días, contado a partir de la notificación de esta resolución, se emita y comunique formal acto administrativo al propietario del inmueble en donde se ubica el Hotel Los Recuerdos, a fin de informarle sobre las deficiencias detectadas en la caja de registro correspondiente a su propiedad y se le prevenga sobre las medidas necesarias para corregir dicho problema y evitar que colapse nuevamente. Se le advierte a Eduardo Lezama Fernández, en su condición de Subgerente General del Instituto Costarricense de Acueductos y Alcantarillados, o a quien ocupe el cargo, que de no acatar la orden dicha, incurrirá en el delito de desobediencia y, que de conformidad con el artículo 71 de la Ley de esta jurisdicción, se le impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.
Se condena al Instituto Costarricense de Acueductos y Alcantarillados al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. En lo demás, se declara sin lugar el recurso. Notifíquese la presente resolución a Eduardo Lezama Fernández, en su condición de Subgerente General del Instituto Costarricense de Acueductos y Alcantarillados, o a quien ocupe el cargo, en forma personal.
