Proceeding for constitutional relief (recurso de amparo) processed under case number 11-001846-0007-CO, filed by ZAIDA LORENA VALVERDE HERNÁNDEZ, identity card 0106240926, of legal age, in her capacity as President of the Asociación de Desarrollo Específica Pro Mejoras de Lagos de Lindora de Santa Ana, legal entity identification number 3-002-084878, against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS, the ÁREA RECTORA DE SALUD DE SANTA ANA, and the MUNICIPALIDAD DE SANTA ANA.
Findings of Fact:
Drafted by Justice Araya Garcia; and, Conclusions of Law:
I.Proven Facts. Of importance to the decision in this matter, the following facts are deemed duly established, either because they have been proven or because the respondent failed to address them as ordered in the initial ruling:
(folio 91 of the copy of the administrative record submitted by the Santa Ana Health Governing Area) f) In 2002, the President of the Association informed AYA of the problem caused by the treatment plant at the Lagos de Lindora Residential Development and requested the institution’s cooperation. (see copy of the administrative record submitted by the Santa Ana Health Governing Area) g) In August 2003, the Regional Director of the Ministry of Health requested that the Head of the Environmental Protection Unit take the necessary steps for AYA to take over the Lagos de Lindora treatment plant. (folio 135 of the copy of the administrative record submitted by the Santa Ana Health Governing Area) h) In 2004, the President of the Association informed the Municipality of Santa Ana of the Residential Development’s sewage problem and requested its cooperation. (folio 146 of the copy of the administrative record submitted by the Municipality) i) On January 15, 2004, the Human Environment Control Department of the Ministry of Health requested that the Association submit the treatment plant’s operational report.
(folio 138 of the copy of the administrative record submitted by the Santa Ana Health Governing Area) j) On June 16, 2004, the Ministry of Health issued a sanitary order against the Association because of sanitary deficiencies in the sewage disposal and drainage piping, and stated that otherwise all affected dwellings would be declared uninhabitable (folio 144 of the copy of the administrative record submitted by the Santa Ana Health Governing Area) k) By official letter DASS-331-04 dated June 2004, the health authorities informed AYA of the Residential Development’s sewage problem. (folio 141 of the copy of the administrative record submitted by the Santa Ana Health Governing Area) l) In 2006, at the Association’s request, the Municipality acquired equipment for the Residential Development’s treatment plant, and at ordinary session No. 34 of December 19, 2006, AYA’s Director of Wastewater undertook to acquire the other blower required to make the plant operational.
(see documentation submitted by the respondent Municipality) m) By resolution of AYA’s Board of Directors No. 2008-068 dated February 5, 2008, it was determined that AYA is not authorized to take over treatment plants for residential developments and condominiums that do not comply with the maximum permissible limits established by law. (see copy of the internal communication concerning the Board of Directors’ resolution submitted by AYA) n) In 2009, the Mayor’s Office and the Association arranged a meeting with the Deputy Manager of the Metropolitan Area and the Executive President, at which they undertook to review all actions taken in order to determine what remained to be done to complete the process. (report of the respondent authority) o) By memorandum SYB-G-SGAM-UEN.RYT-EXT-2009-129 dated November 5, 2009, AYA informed the Director of the Health Area that the transfers of the property where the plant is located were being processed.
(report of the respondent authority) p) By official letter ARSSA-2846-2010 dated December 15, 2010, the Director of the Health Governing Area requested information from AYA regarding the process for transferring the treatment plant, but received no response. (report of the respondent authority) q) To date, the treatment plant and pumping station are not operational, and the civil infrastructure has deteriorated. (see technical report submitted by AYA).
II.Subject Matter of the Action.- The petitioner alleges that the homes in the Lagos de Lindora Residential Development discharge untreated sewage into the Virilla River because, several years ago, the Costa Rican Institute of Aqueducts and Sewers stated that it would assume operation of that plant; however, despite the numerous requests, it has neither done so nor provided a solution to the problem, thereby violating the rights to health and to a healthy and ecologically balanced environment.
III.Merits. In the present case, given the involvement of various administrative entities, the actions of each will be analyzed separately.
IV.Regarding the actions of the Costa Rican Institute of Aqueducts and Sewers. Pursuant to its Organic Law, Law No. 2726 of April 14, 1961, as amended, the Costa Rican Institute of Aqueducts and Sewers is the institution created by law to direct and oversee all matters related to providing the inhabitants of the Republic with services for the collection and disposal of sewage, liquid industrial waste, and stormwater in urban areas. In this regard, Article 2 provides, insofar as relevant, as follows:
“Article 2.- (*) The Costa Rican Institute of Aqueducts and Sewers shall:
Under no circumstances may it delegate the administration of the aqueduct and sanitary sewerage systems of the Metropolitan Area.
Nor may it delegate the administration of systems for which financial responsibility exists while such responsibility rests directly with the Institute.
Nevertheless, since December 2000, the respondent Institute has been aware of this problem because the President of the Lagos de Lindora Housing Development and Housing Improvement Association requested that the Costa Rican Institute of Aqueducts and Sewers assume administration of the Residential Development’s treatment plant. That request was reiterated over several years by both the residents and the municipal and health authorities. To date, the Institute has issued no administrative act aimed at resolving the serious problem affecting that community, and the only action appearing in the record is a legal process to transfer those properties to the Institute. The Chamber therefore finds it established that this institution’s neglect in addressing the sewage-disposal problem makes it jointly responsible for the violations of the rights to health and the environment. Accordingly, it shall be responsible for providing the required technical advice and cooperation so that the infrastructure works necessary to resolve the sewage-disposal problem in the Lagos de Lindora Residential Development may be constructed.
V.Regarding the actions of the Municipalidad de Santa Ana.- The Código Municipal requires the municipalities of each canton to ensure that residents are guaranteed the real and effective enjoyment of the right to health and to a healthy environment. The documents submitted in the case file, as well as the sworn report provided by the Municipal President and the respondent Mayor, establish that, since 2000, those authorities have been aware of the problems experienced by the Asociación de Desarrollo de Vivienda y Mejoramiento Habitacional with the treatment plant and of the financial difficulties involved in maintaining and operating that plant. In view of the foregoing, the respondent Municipality applied to the Compañía Nacional de Fuerza y Luz for a preferential rate, purchased equipment for the Association so that the plant could operate properly, and, during 2008 and 2009, coordinated meetings with the President of AYA to transfer the plant to AYA and thereby provide a solution to the problem of sewage (aguas negras) disposal from that residential development.
Nevertheless, to date, the respondent Municipality has not undertaken any specific administrative act (acto administrativo), within the scope of its powers, to solve this problem. The Municipality’s role must not be limited to referring health and pollution problems to other entities; rather, it is obligated to guarantee, defend, and preserve everyone’s right to enjoy a healthy and ecologically balanced environment. Article 75 of the Código Municipal provides that, in accordance with the Municipal Regulatory Plan (Plan Regulador Municipal), natural or legal persons who own or possess real property under any title must fulfill certain obligations intended to safeguard the appearance of the community and protect the environment; failure to fulfill those obligations may subject such persons to fines, following due process (debido proceso). In the opinion of this Chamber, the Municipalidad de Santa Ana has demonstrated an inability to enforce the applicable laws and fulfill its obligation to guarantee the residents of the area the enjoyment of a healthy and ecologically balanced environment, with resulting consequences for their health due to the nature of the sanitation problem affecting them.
Thus, despite being fully aware of the problem affecting the residents of Urbanización Lagos de Lindora, the Municipalidad de Santa Ana has confined itself to confirming its existence and seeking a solution from the Instituto Costarricenses de Acueductos y Alcantarillados, thereby evading its responsibility. Consequently, the Municipalidad de Santa Ana has taken no action to remedy the sanitation problem repeatedly reported by local residents. Accordingly, this amparo proceeding (recurso de amparo) must be granted against the Municipalidad de Santa Ana for the constitutional violation of Articles 50 and 21 of the Constitución Política, to the detriment of the petitioners and the other residents of Urbanización Lagos de Lindora.
VI.Regarding the actions of the Ministerio de Salud.- Although the State must respect individual rights, it must also safeguard the well-being of the community. Public health and environmental protection are principles protected both constitutionally (Articles 21, 50, 73, and 89 of the Carta Magna) and under international law. In this case, the Ley General de Salud authorizes the Ministerio de Salud to adopt the corresponding health measures (medidas sanitarias) and impose penalties. Accordingly, the Ministerio de Salud has not only a duty to enforce the Ley General de Salud, but also a duty to protect public health, which is classified as a matter of public interest, because the rights to health and to a healthy, pollution-free environment—at least below levels tolerable to human beings—are fundamental, inalienable rights whose violation cannot legitimately be accepted. The report submitted to this Chamber and the documentary evidence provided establish that, since 1996, health officials have conducted various inspections at Urbanización Lagos de Lindora.
In March 1999, the environmental sanitation technician from the Área Rectora indicated that a pipe at the site discharged untreated sewage into the Río Virilla; in 2000, a health order (orden sanitaria) was issued in that regard; in 2001, an operational report on the plant was received; the following year, a request was submitted to AYA for assistance; in June 2004, another health order was issued directing that drainage work be performed and that the pipe carrying and discharging sewage and sink water be cleared; and, in 2005, an inspector verified that the problem had been resolved. Nevertheless, the problem persisted in subsequent years, and in November 2009 the Departamento de Recolección y Tratamiento-SUBGAM informed the Director that, as of that date, the treatment system had neither been operated nor maintained by AYA, that it remained registered in the Association’s name, and that the plant had been completely dismantled.
However, it was not until notice of this amparo proceeding was served—that is, in May 2011—that the respondent authority conducted another inspection in the area. On that occasion, it found that Urbanización Lagos de Lindora’s wastewater treatment system (sistema de tratamiento de aguas servidas) was not operating because it had been entirely abandoned and that untreated sewage and wastewater (aguas servidas) were being discharged into the Río Virilla, clearly creating a very serious problem by endangering the residents’ health. Although, before this proceeding was filed, the health authority had on some occasions conducted an inspection and issued several health orders granting a period within which to keep the treatment plant in good condition, and had brought the matter to the attention of senior authorities and the President of AYA, it took no further action. It declined to exercise its powers and authority by failing to compel the responsible parties to cease discharging these pollutants into the river or to remedy the problem caused by the failure to operate the residential development’s treatment plant.
Furthermore, it has been established that, apart from the inspections conducted, the case file reflects no other action by this authority to provide a comprehensive solution to the problem. Consequently, this omission also requires that the proceeding be granted with respect to this institution. In this particular case, the health authorities failed to give the seriousness of the water-pollution problem affecting the Río Virilla as a result of the unscrupulous conduct of residents of the residential development the attention it warranted. They failed to fulfill their obligation to safeguard the population’s right to health, and that omission has consequently infringed the fundamental rights of all local residents. The respondent authority, like the other respondent institutions, should be reminded of its obligation—as part of the State—to guarantee, defend, and preserve everyone’s right to enjoy a healthy and ecologically balanced environment.
In its particular case, this duty is even clearer, because constitutional protection encompasses and links an ecologically balanced environment with the fundamental right to health, both mental and physical. Ley General de Salud number 5395 provides, in its first article, that public health is a matter of public interest protected by the State and, in its second article, that the Poder Ejecutivo, through the Ministerio de Salud, is responsible for defining national health policy and for regulating, planning, and coordinating all public and private health-related activities, as well as carrying out those activities assigned to it by law. It further provides that the Ministry has the authority to enforce its orders, including with the assistance of law-enforcement authorities, in order to protect the legal interest entrusted to it. In a similar case, the Chamber held in judgment No. 2006-08983, issued at eleven sixteen on June twenty-third, 2006: “This Constitutional Court finds that the Ministerio de Salud failed to fulfill its obligations to protect the right to health of the amparo petitioner and the other residents of the residential development at issue, because it failed to exercise its statutory powers to definitively resolve the sanitation problem affecting them and formally reported by them.
Its actions were insufficient, untimely, and ineffective, as demonstrated by the fact that the problem persists because it took no concrete action in exercise of the police power (poder de policía) granted to it by law to enforce its orders. The members of this Constitutional Court are thus left with the impression that this was the conduct of a ‘paper administration,’ whose activity is exhausted by mere bureaucratic procedures and which merely conducts inspections and issues recommendations or health orders, without taking any measures to verify compliance and, worse still, without undertaking any effective action genuinely aimed at definitively resolving the sanitation problem described, as it must do to fulfill the public purpose entrusted to it. This is detrimental to health and the environment and therefore violates constitutional Article 50, a situation that this Chamber finds intolerable.” Based on the foregoing, and there being no reason to depart from the stated position or reconsider the issue, the proceeding must be granted with respect to the Ministerio de Salud.
VII.- Conclusion.- The Chamber concludes that, in the present case, we are faced with a serious public-health problem affecting the environment and the health of the residents of the Urbanización Lagos de Lindora community; and in its consistent case law, the Chamber has held that it is unacceptable for human beings to be denied the right to a healthy environment and the right to health because the corresponding public authorities are unable to exercise effectively the oversight powers granted to them by law or to solve the problems entrusted to them. The documents and reports submitted under oath and contained in the case file show that, although the respondent authorities have been fully aware for twenty years of the serious defects affecting the sewage treatment plant (planta de tratamiento de aguas negras)—which is owned by the aforementioned Association—they have not, to date, taken the actions necessary to safeguard the health of the residents and protect the environment.
This has consequently harmed the health of those living in the surrounding area and even that of a larger portion of the national population, because sewage (aguas negras) from homes in Urbanización Lagos de Lindora has been allowed to flow untreated into the Río Virilla. These respondent authorities are responsible for violating the fundamental rights of the protected parties because they failed to safeguard promptly and effectively the health of that population and the environment. The reported problem demonstrates that the actions taken by the Instituto Costarricense de Acueductos y Alcantarillados, the Municipalidad de Santa Ana, and the Ministerio de Salud, within the scope of their respective authority, in exercising their powers of control or oversight to protect health and the environment have clearly been insufficient. They have thus incurred liability for failing to exercise those powers, which in turn violates the citizens’ unnamed or atypical constitutional right to receive efficient and effective public services. For the foregoing reasons, and pursuant to Article 29 of the Ley de la Jurisdicción Constitucional, this amparo petition (recurso de amparo) must be granted.
Por tanto:
The petition is GRANTED for violation of Articles 21 and 50 of the Constitución Política. Dagoberto Trejos Azofeifa, or whoever holds the position of Director del Área Rectora de Salud de Santa Ana; Gerardo Oviedo Espinoza, in his capacity as Alcalde Municipal del Cantón de Santa Ana; Marianela Lobo Cabezaso, or whoever holds the position of Presidenta del Concejo Municipal de la Municipalidad de Santa Ana; and Eduardo Lezama Fernández, or whoever holds the position of Sub Gerente del Instituto Costarricense de Acueductos y Alcantarillados in his stead, are ordered, WITHIN ONE YEAR from notification of this decision, to take the measures necessary to resolve definitively the public-health and environmental problem affecting the protected parties and the other residents of Urbanización Lagos de Lindora. Within that period, they must coordinate and jointly undertake the works necessary to eliminate the discharge into the Río Virilla of untreated sewage originating from Urbanización Lagos de Lindora and take measures to begin the process of repairing the environmental damage caused to that river, insofar as possible, including by exercising the powers granted to them by our legal system to determine the cause of the problem and identify those responsible, as well as to compel anyone who disobeys their orders to comply with them in the manner and within the period prescribed.
Dagoberto Trejos Azofeifa, or whoever holds the position of Director del Área Rectora de Salud; Gerardo Oviedo Espinoza, in his capacity as Alcalde Municipal del Cantón de Santa Ana; Marianela Lobo Cabezas, or whoever holds the position of Presidenta del Concejo Municipal de la Municipalidad de Santa Ana; and Eduardo Lezama Fernández, or whoever holds the position of Sub Gerente del Instituto Costarricense de Acueductos y Alcantarillados in his stead, are advised that failure to comply with this order will constitute the offense of disobedience and that, pursuant to Article 71 of the Ley de esta jurisdicción, any person who receives an order issued in an amparo proceeding that the person is required to comply with or enforce, and who fails to comply with or enforce it, shall be sentenced to imprisonment for three months to two years or fined twenty to sixty day-fines, provided that the offense is not punishable by a more severe penalty.

Recurso de amparo que se tramita en expediente número 11-001846-0007-CO, interpuesto por ZAIDA LORENA VALVERDE HERNÁNDEZ, cédula de identidad 0106240926, mayor, en su condición de Presidenta de la Asociación de Desarrollo Específica Pro Mejoras de Lagos de Lindora de Santa Ana, cédula jurídica 3-002-084878 contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS, EL ÁREA RECTORA DE SALUD DE SANTA ANA Y LA MUNICIPALIDAD DE SANTA ANA.
Resultando:
Redacta el Magistrado Araya Garcia; y,
Considerando:
I.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
(folio 91 de la copia del f) En el año 2002, el Presidente de la Asociación puso en conocimiento al AYA el problema que genera la planta de tratamiento de la Urbanización Lagos de Lindora y solicitó la cooperación de la institución. (ver copia del expediente administrativo aportado por el Área Rectora de Salud de Santa Ana) g) En agosto de 2003, el Director Regional del Ministerio de Salud solicitó al Jefe de la Unidad de Protección al Ambiente las gestiones correspondientes para que la planta de tratamiento de Lagos de Lindora sea recibida por el AYA. (folio 135 de la copia del expediente administrativo aportado por el Área Rectora de Salud de Santa Ana) h) En el año 2004, el Presidente de la Asociación puso en conocimiento a la Municipalidad de Santa Ana el problema de aguas negras de la Urbanización y solicitó su colaboración. (folio 146 de la copia del expediente administrativo aportado por la Municipalidad) i) El 15 de enero de 2004, el Departamento de Control al Ambiente Humano del Ministerio de Salud le solicitó a la Asociación el reporte operacional de la planta de tratamiento.
(folio 138 de la copia del expediente administrativo aportado por el Área Rectora de Salud de Santa Ana) j) El 16 de junio de 2004, el Ministerio de Salud giró la orden sanitaria contra la Asociación debido a que existen deficiencias sanitarias en la tubería de disposición y evacuación de aguas negras, y se indicó que en caso contrario se procederá a declarar inhabitable todas las viviendas involucradas (folio 144 de la copia del expediente administrativo aportado por el Área Rectora de Salud de Santa Ana) k) Mediante oficio DASS-331-04 del mes de junio de 2004 las autoridades sanitarias pusieron en conocimiento al AYA el problema de aguas negras de la Urbanización. (folio 141 de la copia del expediente administrativo aportado por el Área Rectora de Salud de Santa Ana) l) En el año 2006 ante la solicitud de la Asociación, la Municipalidad adquiere un equipo para la planta de tratamiento de la Urbanización y en la sesión ordinaria No. 34 del 19 de diciembre de 2006, el Director de Aguas Residuales del AYA se comprometió a adquirir el otro soplador que se requiere para poner a funcionar la planta.
(ver documentación aportada por la Municipalidad recurrida) m) Que por acuerdo de Junta Directiva del AYA No. 2008-068 del 5 de febrero de 2008, se dispuso que el AYA no se encuentra autorizado a recibir plantas de tratamiento para Urbanizaciones y Condominios que no cumplen los límites máximos permisibles establecidos en la legislación. (ver copia de la comunicación interna del Acuerdo de la Junta Directiva aportado por el AYA) n) En el año 2009, entre la Alcaldía y la Asociación gestionaron una reunión con el Sub gerente del Área Metropolitana y el Presidente Ejecutivo, en la cual se comprometieron a revisar todo lo actuado para determinar lo que hacía falta para completar el proceso. (informe de la autoridad recurrida) o) Por memorial SYB-G-SGAM-UEN.RYT-EXT-2009-129 del 5 de noviembre del 2009, el AYA le comunicó a la Directora del Área de Salud que se está en proceso de realizar los traspasos de al propiedad donde se ubica la planta.
(informe de la autoridad recurrida) p) Mediante oficio ARSSA-2846-2010 del 15 de diciembre de 2010, la Directora del Área Rectora de Salud solicitó al AYA información sobre el trámite de traspaso de la planta de tratamiento, sin embargo no recibió respuesta. (informe de la autoridad recurrida) q) A la fecha la planta de tratamiento y la estación de bombeo se encuentran fuera de funcionamiento y la infraestructura civil se encuentra deteriorada. (ver informe técnico presentado por el AYA).
II.Objeto del recurso.- La recurrente alega que las viviendas de la Urbanización Lagos de Lindora lanzan las aguas negras sin tratamiento al río Virilla, debido a que desde hace varios años el Instituto de Acueductos y Alcantarillados indicó que iba asumir la operación de dicha planta; sin embargo, y a pesar de la múltiples solicitudes no han efectuado ni se ha dado una solución al problema, por lo que se violenta el derecho a la salud y a disfrutar de un ambiente sano y ecológicamente equilibrado.
III.Sobre el fondo. En el presente caso, en virtud de la participación de diferentes entes administrativos, se procederá a realizar el análisis de las actuaciones de cada uno de ellos en forma separada.
IV.En cuanto a las actuaciones del Instituto Costarricense de Acueductos y Alcantarillados. Mediante su Ley Constitutiva, Ley No. 2726 de 14 de abril de 1961 y sus reformas, el Instituto Costarricense de Acueductos y Alcantarillados, es la institución creada por ley para dirigir y vigilar todo lo concerniente para proveer a los habitantes de la República de un servicio de recolección y evacuación de aguas negras y residuos industriales líquidos y de aguas pluviales en las áreas urbanas. Sobre el particular, el artículo 2° señala en lo conducente, lo siguiente:
“Artículo 2.- (*) Corresponde al Instituto Costarricense de Acueductos y Alcantarillados:
Bajo ningún concepto podrá delegar la administración de los sistemas de acueductos y alcantarillado sanitario del Área Metropolitana.
Tampoco podrá delegar la administración de los sistemas sobre los cuales exista responsabilidad financiera y mientras ésta corresponda directamente al Instituto.
Ciertamente, los responsables de los hechos denunciados son las personas que viven en el sector, por cuanto lanzan las aguas negras al río debido a que la planta de tratamiento no funciona desde hace muchos años, la cual actualmente sigue siendo propiedad de una Asociación. Sin embargo, desde diciembre del 2000, el Instituto accionado ha tenido conocimiento de esta problemática, debido a que la Presidenta de la Asociación de Desarrollo de Vivienda y Mejoramiento Habitacional del Proyecto Lagos de Lindora le solicitó que el Instituto Costarricense de Acueductos y Alcantarillados asumiera la administración de la planta de tratamiento de la Urbanización, situación que fue reiterada en el transcurso de varios años tanto por los vecinos, así como por las autoridades municipales y sanitarias, siendo que a la fecha no ha dictado ningún acto administrativo tendiente a resolver el grave problema que afecta dicha comunidad, y lo único que consta al respecto es un trámite a nivel legal para el traspaso de dichos terrenos al Instituto, por lo que la Sala tiene por demostrado la desidia de esta Institución en atender el problema de evacuación de aguas negras la convierte en co- responsable de las violaciones a la salud y al ambiente y, por ende, le corresponderá brindar asesoría técnica y la colaboración requerida, para que se construyan las obras de infraestructura necesarias para solventar el problema de evacuación de aguas negras en la Urbanización Lagos de Lindora.
V.En cuanto a la actuación de la Municipalidad de Santa Ana.- El Código Municipal obliga a las Municipalidades de cada cantón a velar porque al munícipe se le garantice el disfrute real y efectivo del derecho a la salud y a un ambiente sano. De los documentos aportados al expediente, así como del informe dado bajo juramento por la Presidenta Municipal y el Alcalde recurrido, se tiene por demostrado que desde el año 2000, dichas autoridades han tenido conocimiento del problema que ha tenido la Asociación de Desarrollo de Vivienda y Mejoramiento Habitacional con la planta de tratamiento, y las dificultades económicas que les representa el mantenimiento y la operación de dicha planta. En virtud de lo anterior, la Municipalidad recurrida gestionó ante la Compañía Nacional de Fuerza y Luz una tarifa preferencial, les compró un equipo para ponerla en funcionamiento correctamente y durante los años 2008 y 2009 coordinó reuniones con el Presidente del AYA para traspasar la planta a AYA y así brindar una solución al problema de evacuación de las aguas negras de dicha Urbanización.
No obstante, a la fecha no existe algún acto administrativo en concreto efectuado por la Municipalidad accionada, y de conformidad a sus competencias para dar solución a este problema. El papel de la Municipalidad no se debe limitar a trasladar los problemas de salud y contaminación a otros entes, sino que su obligación se encuentra en garantizar, defender y preservar el derecho de todos a disfrutar de un ambiente sano y ecológicamente equilibrado. El Código Municipal estatuye en su artículo 75, que de conformidad con el Plan Regulador Municipal, las personas físicas o jurídicas, propietarias o poseedoras, por cualquier título, de bienes inmuebles, deberán cumplir ciertas obligaciones tendientes a velar por el ornato y la tutela del ambiente, cuyo incumplimiento puede hacer a las personas que no cumplan al pago de multas, previo debido proceso. A juicio de esta Sala, en la especie la Municipalidad de Santa Ana ha mostrado incapacidad para hacer cumplir las leyes en la materia y su obligación de garantizar el disfrute de los habitantes de la zona a un ambiente sano y ecológicamente equilibrado, con las consecuencias para la salud de esas personas, debido a la naturaleza del problema sanitario que les aqueja.
Es así como la Municipalidad de Santa Ana teniendo pleno conocimiento de la problemática que afecta a los pobladores de la Urbanización Lagos de Lindora se ha limitado a constatar su existencia, gestionar ante el Instituto Costarricenses de Acueductos y Alcantarillados la solución al problema y así evadir su responsabilidad. En consecuencia, la Municipalidad de Santa Ana no ha tomado acción alguna para solucionar el inconveniente sanitario que con insistencia revelan los vecinos del lugar. En tal virtud, se impone la estimatoria de este recurso contra la Municipalidad de Santa Ana por la violación constitucional a los artículos 50 y 21 de la Constitución Política en perjuicio de los recurrentes y demás vecinos de la Urbanización Lagos de Lindora.
VI.En cuanto a las actuaciones del Ministerio de Salud.- Si bien es cierto, el Estado debe respetar el derecho de los individuos, también lo es que debe velar por el bienestar de la comunidad. La Salud Pública y la protección del ambiente son principios tutelados tanto a nivel constitucional (artículos 21, 50, 73 y 89 de la Carta Magna), como a través de la normativa internacional. En este caso, la Ley General de Salud, autoriza al Ministerio de Salud para tomar las medidas sanitarias correspondientes e imponer las sanciones, con lo cual el Ministerio de Salud no solo tiene el deber de hacer cumplir la Ley General de Salud, sino el de proteger la salud pública calificada como bien de interés público, pues los derechos a la salud y a un ambiente sano y libre de contaminación -al menos por debajo de los límites tolerables para el ser humano- son derechos fundamentales irrenunciables y cuya violación no se puede legítimamente consentir.
Ahora bien, del informe presentado a esta Sala y la prueba documental aportada, se tiene por demostrado, que desde el año 1996, funcionarios sanitarios han realizado diversas inspecciones a la Urbanización Lagos de Lindora, siendo que en marzo de 1999, el técnico en saneamiento ambiental del Área Rectora indicó que en lugar existe una tubería prevista hacia el Río Virilla donde se depositan las aguas negras sin ningún tratamiento, en el año 2000 se giró una orden sanitaria al respecto, en el 2001 se recibió un reporte operacional de la planta, al año siguiente se gestionó ante el AYA la solicitud de ayuda al AYA, en junio de 2004, se giró otra orden sanitaria ordenando realizar las obras de drenaje y desobstrucción de la tubería de conducción y evacuación de aguas negras y de pila, y en el 2005 un inspector verificó que el problema había sido resuelto. No obstante, el problema continuó en los últimos años y en noviembre de 2009, el Departamento de Recolección y Tratamiento-SUBGAM le informó a la Directora, que el sistema de tratamiento hasta la fecha no ha sido operado ni mantenido por el AYA y que aún se encuentra registrado a nombre de la Asociación y la planta se encuentra totalmente desmantelada.
Sin embargo, es hasta la notificación de este amparo, es decir en el mes de mayo del 2011, que la autoridad recurrida efectúa otro control en el sector y en esta ocasión constató que el sistema de tratamiento de aguas servidas de la Urbanización Lagos de Lindora no se encuentra funcionando debido a que está en total abandono, siendo que las aguas negras y servidas son enviadas al Río Virilla sin ningún tratamiento, lo que evidentemente genera un problema muy serio al poner en riesgo la salud de los habitantes. Si bien, previo a la interposición del presente proceso, en algunas ocasiones la autoridad sanitaria realizó un reconocimiento y giró algunas órdenes sanitarias, en la que se otorgó un plazo para mantener en buenas condiciones la planta de tratamiento, y puso en conocimiento el caso a las autoridades superiores y al Presidente del AYA, no ha procedido más allá de eso, declinando el ejercicio de sus competencias y atribuciones, al no constreñir a quienes corresponda, a no lanzar este tipo de contaminantes al río o a solucionar el problema que ocasiona la falta de operación de la planta de tratamiento de la Urbanización.
Además, queda demostrado que más allá de las inspecciones realizadas, no se desprende del expediente ninguna otra actuación de parte de esta autoridad para dar solución integral al problema y por ende, tal omisión implica también en cuanto a esta institución, la estimación del recurso. En el caso concreto, las autoridades sanitarias no le dieron la importancia que el caso amerita al grave problema de contaminación de aguas que presenta el río Virilla por la acción inescrupulosa de los vecinos de la Urbanización y han omitido cumplir con su obligación de velar por el derecho a la salud de la población y por ende, tal omisión ha ocasionado lesiones a los derechos fundamentales de todos los habitantes del lugar. Conviene recordar a la autoridad recurrida, al igual que se hizo con las otras instituciones recurridas, su obligación –como parte del Estado- de garantizar, defender y preservar el derecho de todos a disfrutar de un ambiente sano y ecológicamente equilibrado.
En su caso particular se trata de un deber aún más claro, pues la protección constitucional cubre y vincula el ambiente ecológicamente equilibrado con el derecho fundamental a la salud, tanto en el plano psíquico como en el físico, siendo que la Ley General de Salud número 5395 establece, en su artículo primero, que la salud de la población es un bien de interés público tutelado por el Estado y, en su artículo segundo, que corresponde al Poder Ejecutivo, por medio del Ministerio de Salud, la definición de la política nacional de salud, la normación, planificación y coordinación de todas las actividades públicas y privadas relativas a salud, así como la ejecución de aquellas actividades que le competen conforme a la ley; de igual forma, que tendrá potestades para hacer cumplir sus órdenes incluso con ayuda de la fuerza pública en protección del bien jurídico que está llamado a tutelar. En un caso similar la Sala en sentencia No. 2006-08983 de las once horas dieciséis minutos del veintitrés de junio de 2006 dispuso: “ Estima este Tribunal Constitucional que el Ministerio de Salud ha sido omiso en el cumplimiento de sus obligaciones en tutela del derecho a la salud del amparado y demás vecinos de la urbanización de marras, al no hacer uso de sus potestades legales con el fin de solucionar, definitivamente, el problema sanitario que les afecta y que han denunciado formalmente, pues ha realizado una actividad insuficiente, inoportuna e ineficaz que se comprueba con el hecho de que el problema subsiste, al no haber concretado ninguna acción en ejercicio del poder de policía que le asiste por ley para hacer cumplir sus órdenes.
Queda así en los miembros de este Tribunal Constitucional la percepción de que ha sido la actuación de una “Administración de papel”, que agota su actividad en meros trámites burocráticos, simplemente limitándose a realizar inspecciones y girar recomendaciones u órdenes sanitarias, sin que se tome medida alguna para corroborar que se hayan cumplido y, lo que es peor, sin que se evidencien de su parte acciones eficaces, verdaderamente encaminadas a resolver en definitiva la problemática sanitaria expuesta, como corresponde para cumplir el fin público que se le ha encomendado, lo que redunda en detrimento de la salud y el medio ambiente y, por consiguiente, en violación del artículo 50 constitucional, situación que resulta intolerable para esta Sala”. Partiendo de lo anterior y no existiendo ningún motivo para variar el criterio expuesto, ni reconsiderar la cuestión, se impone declarar con lugar el recurso con respecto al Ministerio de Salud.
VII.Conclusión.- La Sala concluye que en el presente caso, nos encontramos ante un problema sanitario grave que afecta al ambiente y la salud de los habitantes de la comunidad de la Urbanización Lagos de Lindora; y en reiterada jurisprudencia la Sala ha dicho que no se puede aceptar que a los seres humanos se les niegue el derecho a un ambiente sano, el derecho a la salud, debido a la incapacidad de las autoridades públicas correspondientes para ejercer efectivamente las potestades de vigilancia y la solución a los problemas otorgados por ley. De los documentos y los informes rendidos bajo juramento que constan en el expediente, se desprende que las autoridades recurridas, a pesar que desde hace veinte años han tenido pleno conocimiento de los graves defectos que adolecía la planta de tratamiento de aguas negras -cuya propiedad es de la Asociación citada-, a la fecha no han realizado los actos necesarios para garantizar la salud de los habitantes y la protección al ambiente con el consiguiente daño a la salud de los habitantes que radican en sus alrededores e incluso de una porción mayor de la población nacional al permitir que las aguas negras provenientes de las viviendas de la Urbanización Lagos de Lindora fluyan sin tratamiento hasta el Río Virilla.
Estas autoridades recurridas son responsables del daño a los derechos fundamentales de las personas amparadas, por la omisión en velar pronta y eficazmente por la salud de esa población, y al ambiente. El problema denunciado demuestra que las acciones en ejercicio de la potestad de control o vigilancia desplegadas en tutela de la salud y del ambiente por parte del Instituto Costarricense de Acueductos y Alcantarillados, de la Municipalidad de Santa Ana, y del Ministerio de Salud, dentro del marco de sus competencias, han sido claramente insuficientes, incurriendo así en responsabilidad por omisión en el ejercicio de esas potestades que, a su vez, lesiona el derecho constitucional innominado o atípico de los ciudadanos a que les presten servicios públicos eficientes y eficaces. En razón de lo anterior, y de conformidad con lo establecido en el artículo 29 de la Ley de la Jurisdicción Constitucional, procede declarar con lugar el presente recurso de amparo.
Por tanto:
Se declara CON LUGAR el recurso por violación a los artículos 21 y 50 de la Constitución Política. Se ordena a Dagoberto Trejos Azofeifa o a quien ocupe el cargo de Director del Área Rectora de Salud de Santa Ana; Gerardo Oviedo Espinoza en su condición de Alcalde Municipal del Cantón de Santa Ana, a Marianela Lobo Cabezaso, o quien ocupe el cargo de Presidenta del Concejo Municipal de la Municipalidad de Santa Ana, y a Eduardo Lezama Fernández o a quien en su lugar ocupe el cargo de Sub Gerente del Instituto Costarricense de Acueductos y Alcantarillados, que en el PLAZO DE UN AÑO contado a partir de la comunicación de esta resolución, deben tomar las medidas necesarias para que se solucione, definitivamente el problema sanitario y ambiental que afecta a los amparados y demás vecinos de la Urbanización Lagos de Lindora, y en este plazo deben realizar en forma coordinada y conjunta las obras que sean necesarias para eliminar el desfogue de aguas negras sin tratamiento al río Virilla provenientes de la Urbanización Lagos de Lindora y tomar medidas para iniciar el proceso de reparación del daño ambiental ocasionado en ese río, en la medida en que ello fuere posible, incluso haciendo uso de las potestades que nuestro ordenamiento jurídico les otorga para determinar la causa del problema e individualizar a los responsables, así como para constreñir a quienes desobedezcan sus órdenes a que las cumplan, en la forma y plazo que se les otorgue.
Se le advierte a Dagoberto Trejos Azofeifa o a quien ocupe el cargo de Director del Área Rectora de Salud; Gerardo Oviedo Espinoza en su condición de Alcalde Municipal del Cantón de Santa Ana, a Marianela Lobo Cabezas o a quien ocupe el cargo de Presidenta del Concejo Municipal de la Municipalidad de Santa Ana, y a Eduardo Lezama Fernández o a quien en su lugar ocupe el cargo de Sub Gerente del Instituto Costarricense de Acueductos y Alcantarillados, que de no acatar la orden dicha incurrirá en el delito de desobediencia y que de conformidad con el artículo 71 de la Ley de esta jurisdicción, se le impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al ESTADO, a la MUNICIPALIDAD DE SANTA ANA y al INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo.
Notifíquese la presente resolución a Dagoberto Trejos Azofeifa o a quien ocupe el cargo de Director del Área Rectora de Salud de Santa Ana; Gerardo Oviedo Espinoza en su condición de Alcalde Municipal del Cantón de Santa Ana, a Marianela Lobo Cabezaso a quien ocupe el cargo de Presidenta del Concejo Municipal de la Municipalidad de Santa Ana, y a Eduardo Lezama Fernández o a quien en su lugar ocupe el cargo de Sub gerente del Instituto Costarricense de Acueductos y Alcantarillados, todos en forma personal.
