Amparo proceeding (recurso de amparo) processed under expediente número 10-014327-0007-CO, filed by DORELL ROJAS FONSECA, identity card 0106580729, GABRIELA INCER DELOYA, identity card 0114360730, JOSE PABLO CORTES UREÑA, identity card 0114190740, RAMIRO FERNANDEZ ALFARO, identity card 0701920003, against THE MUNICIPAL MAYOR OF DESAMPARADOS, THE MINISTER OF HEALTH, THE MINISTER OF ENVIRONMENT, ENERGY AND TELECOMMUNICATIONS, THE PRESIDENT OF THE MUNICIPAL COUNCIL OF DESAMPARADOS, AND THE EXECUTIVE PRESIDENT OF THE INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.-
Findings:

Considering:
I.Proven facts. For purposes of deciding this matter, the following facts are deemed duly established, either because they have been proven or because the respondent failed to address them as required by the initial order:
II.Subject matter of the amparo proceeding (objeto del recurso).- The petitioners (recurrentes) allege that, since September 2010, they have filed separate complaints with the respondent authorities due to residents of the communities of Barrio Bambú and Lomas de San Rafael Arriba de Desamparado discharging untreated sewage (aguas negras) and wastewater into the Río Jorco, and that the problem has not been resolved to date, thereby violating their rights to health and to the environment.
III.Regarding the right to health.- Article 21 of the Constitución Política states: “Human life is inviolable.” It is undeniably from this constitutional principle that the right to health and to physical, mental, and social well-being arises—a human right that is indissolubly linked to the right to health and to the State’s obligation to protect human life. The State is required to take the measures necessary to protect the environment and prevent levels of pollution that endanger the health of the inhabitants. Specifically, in matters of public health, the State, through its institutions, must remain vigilant regarding activities potentially harmful to public health and must therefore exercise constant and effective oversight.
IV.Regarding environmental protection.- In the case under analysis, the petitioners report the contamination of a water resource (recurso hídrico), and constitutional case law has held that protecting the environment is a task that belongs equally to everyone; that is, the State as a whole is obligated to take the measures necessary to protect the environment so as to prevent levels of pollution, deforestation, extinction of flora and fauna, and excessive or improper use of natural resources that endanger the health of the governed. For purposes of this task, the term public institution must be understood to include both the Central Administration—Ministries such as the Ministerio del Ambiente y Energía and the Ministerio de Salud, which, by virtue of their subject matter, have broad participation and responsibility with respect to environmental conservation and preservation and which, in most cases, act through their specialized departments—and, of course, the municipalities, which bear significant responsibility within their territorial jurisdiction.
It might therefore be thought that this multiple responsibility would cause chaos in administrative management, but that is not the case because, to avoid the simultaneous coexistence of spheres of authority of differing origin and nature, duplication of national and local efforts, and confusion regarding the rights and obligations of the various parties involved, it is necessary to establish a series of coordinating relationships among the various agencies of the Executive Branch and decentralized institutions, and between those bodies and the municipalities, so that they may carry out the functions entrusted to them. This Chamber has previously—and quite clearly—addressed the principle of coordination between public agencies and municipalities in pursuing common purposes—which must obviously be extended to the relationship between Central Administration institutions and decentralized institutions in performing this important function—and therefore refers to what was stated on that occasion (judgment number 5445-99, issued at fourteen hours thirty minutes on July fourteenth, nineteen ninety-nine):
“Thus, coordination is the ordering of relations among these various independent activities, taking account of their convergence upon the same object or entity in order to make that convergence useful to an overall public plan, without eliminating the mutual independence of the acting entities. Because there is no hierarchical relationship among decentralized institutions, or between the State itself and the municipalities, specific conduct cannot be imposed upon the latter; hence the indispensable interinstitutional ‘concerted action’ (concierto), in the strict sense, whereby autonomous and independent centers of action agree upon that preventive and comprehensive framework, within which each performs a role with a view to a mission entrusted to the others. Accordingly, relations between municipalities and other public entities may be conducted only on an equal footing, resulting in agreed forms of coordination and excluding any mandatory arrangement detrimental to their autonomy that would subject corporate entities to a coordination framework without or against their consent; this nevertheless permits the necessary subordination of these entities to the State and in the State’s interest (through the State’s ‘administrative oversight’ (tutela administrativa), specifically its function of reviewing legality, which includes powers of general supervision over the entire sector).” Moreover, failures to fulfill the duty to protect the environment, to comply with environmental regulations, and to safeguard the inhabitants’ right to health are constitutionally significant because administrative inaction in these matters may cause serious harm to a community’s health, the environment, and natural resources.
V.Regarding the merits (fondo).- In view of the participation of different administrative entities in this matter, the actions of each will be analyzed separately.
VI.Regarding the actions of the Ministerio de Ambiente, Energía y Telecomunicaciones.- In his defense, the respondent Minister argues that the complaint filed by the petitioners was duly resolved and notice thereof was given within a reasonable period, and that they were informed that the reported problem was the responsibility of the Instituto Costarricense de Acueductos y Alcantarillados, the entity providing water-supply and sanitary-sewer-network services. Nevertheless, the case under analysis involves not only a problem concerning the discharge of sewage and stormwater (aguas pluviales) from homes in the area; it also involves environmental contamination, specifically contamination of the water resource, and therefore, under the legal system, the Ministerio de Ambiente, Energía y Telecomunicaciones is also the entity competent to address this type of problem. Accordingly, given the importance of this matter, there can be no doubt that the Costa Rican State, through its various institutions but primarily the respondent institution here, bears direct responsibility for guaranteeing effective environmental protection, and any omission or delay in performing that function gives rise to liability.
Thus, in this specific case, the Ministerio de Salud, the Instituto Costarricense de Acueductos y Alcantarillados, and the Municipalidad de Desamparados share a State obligation because all of them are required to ensure compliance with existing regulations in order to protect the environment, water and natural resources, among others, which are essential to the lives of residents and the future of coming generations. It must be remembered that there is no right to pollute water; quite the contrary, the right of all persons to water free of contaminants derives, in accordance with the fundamental right to enjoy a healthy environment, and this right translates into the State’s duty to safeguard water quality and its authority to punish anyone who pollutes it (see, to that effect, judgment number 2006-009170, issued at sixteen hours thirty-six minutes on June twenty-eighth, two thousand six).
Consequently, the inaction of the respondent Ministry and its irresponsible approach have violated the rights to health and to the environment, as it has tolerated the reported situation by taking no action and failing to implement the measures provided by the legal system to remedy a situation that endangers human health and the right to enjoy a healthy and balanced environment. It therefore cannot shift to other institutions the responsibility for solving a problem that jeopardizes the environment, since that inaction constitutes an infringement of the constitutional rights of the protected parties (amparados), as well as those of the inhabitants of that community. As a corollary to the foregoing, this proceeding must be granted against the Ministerio de Ambiente, Energía y Telecomunicaciones for the constitutional violation of Articles 50 and 21 of the Constitución Política, to the detriment of the petitioners and the other residents of the Barrio Bambú and Lomas de San Rafael de Desamparados area.
VI.Regarding the actions of the Instituto Costarricense de Acueductos y Alcantarillados.- Pursuant to its Organic Law (Ley Constitutiva), Law No. 2726 of April 14, 1961, as amended, the Instituto Costarricense de Acueductos y Alcantarillados is the institution established by law to direct and oversee all matters relating to providing the inhabitants of the Republic with services for collecting and disposing of sewage, liquid industrial waste, and stormwater in urban areas. In this regard, the relevant portion of Article 2° states:
“Article 2.- (*) The Instituto Costarricense de Acueductos y Alcantarillados shall be responsible for:
Under no circumstances may it delegate the administration of the water supply and sanitary sewerage systems (alcantarillado sanitario) of the Área Metropolitana.
Nor may it delegate the administration of systems for which there is financial liability (responsabilidad financiera) for as long as such liability rests directly with the Instituto.
Certainly, those responsible for the reported conduct are the persons living in the area, since they discharge sewage into the river instead of channeling it to a septic tank (tanque séptico), because no sewerage infrastructure exists. Nevertheless, it is not only the lack of oversight by other authorities, but also this institution’s neglect, that makes it jointly responsible for the cited environmental violations and, therefore, it shall be required to provide the technical advice and assistance needed to construct the infrastructure works necessary to resolve the sewage-disposal problem in Barrio Bambú and Lomas.
VII.Regarding the conduct of the Municipalidad de Desamparados.- The Código Municipal requires the municipalities of each canton to ensure that residents are guaranteed the actual and effective enjoyment of the right to health and to a healthy environment. The documents submitted in the case file (expediente), as well as the sworn report provided by the respondent Mayor, indicate that when the complaint was received, it was referred to the Ministerio de Salud and the Instituto Costarricense de Acueductos y Alcantarillados because, in his view, those institutions have jurisdiction to resolve the problem. However, its role must not be limited to referring health and pollution problems to other entities; rather, its obligation is to guarantee, defend, and preserve everyone’s right to enjoy a healthy and ecologically balanced environment. Article 75 of the Código Municipal provides that, in accordance with the Municipal Regulatory Plan (Plan Regulador Municipal), natural or legal persons who own or possess real property under any title must fulfill certain obligations intended to safeguard the appearance of the community and protect the environment, and that failure to comply may subject such persons to fines following due process (debido proceso).
In this Chamber’s judgment, the Municipalidad de Desamparados has demonstrated an inability in this case to enforce the relevant laws and fulfill its obligation to guarantee the inhabitants of the area the enjoyment of a healthy and ecologically balanced environment, with the resulting consequences for those persons’ health given the nature of the sanitation problem affecting them. Thus, despite having full knowledge of the problem affecting residents of the area adjacent to the Jorco riverbed, the Municipalidad de Desamparados has merely verified its existence, referred the complaint to the Ministerio de Salud, and thereby evaded its responsibility. The Chamber notes that, despite residents’ complaints and confirmation of the sanitation problem that endangers human health and the environment, the respondent Municipalidad has taken no action to resolve the problem, limiting itself to stating that it lacks jurisdiction.
It is therefore evident that the Municipalidad has not verified whether the property owners in that settlement have septic tanks and drainage systems, the condition of those systems, or whether they discharge contaminated water into the river. Such verification is necessary to impose the legally applicable penalties after affording them the due process and right of defense (derecho de defensa) to which they are entitled. Consequently, the Municipalidad de Desamparados has taken no action to determine the existence of the problem or its possible contribution to the sanitation issue repeatedly reported by local residents. Accordingly, this action is granted against the Municipalidad de Desamparados for the constitutional violation of Articles 50 and 21 of the Constitución Política, to the detriment of the petitioners and the other residents of the Barrio Bambú and Lomas de San Rafael de Desamparados area.
VIII.- Regarding the actions of the Ministerio de Salud.- Although it is true that the State must respect the rights of individuals, it is also true that it must safeguard the well-being of the community. Public Health (Salud Pública) and environmental protection are principles protected both at the constitutional level (Articles 21, 50, 73 and 89 of the Carta Magna) and through international law. In this case, the Ley General de Salud authorizes the Ministerio de Salud to adopt the corresponding health measures (medidas sanitarias) and impose sanctions; consequently, the Ministerio de Salud not only has a duty to enforce the Ley General de Salud, but also to protect public health, which is classified as a matter of public interest (bien de interés público), because the rights to health and to a healthy environment free of pollution—at least below the limits tolerable for human beings—are fundamental rights that cannot be waived and whose violation cannot legitimately be consented to.
Now, from the report submitted to this Chamber and the documentary evidence provided, it is deemed proven that, following the complaint filed by the petitioners, the health authorities conducted an inspection on 28 de setiembre de 2010 and verified that one residence was responsible for the reported problem, for which reason the corresponding sanitary order (orden sanitaria) was issued. However, it was not until notice of this amparo proceeding (amparo) was served, that is, on 19 de octubre de 2010, that the respondent authority conducted another inspection in the area and, on that occasion, determined that additional residences were discharging sewage and wastewater (aguas negras y residuales) into the river, which clearly creates a very serious problem and endangers the health of the inhabitants. Although, prior to the filing of this proceeding, the health authority conducted an inspection and issued a sanitary order granting a period of 30 days for the occupants of those residences to dispose of sewage and wastewater properly and hygienically through an authorized sanitary system, such as a septic tank and its corresponding drainage system or another similar system, and requiring them to maintain it in good condition, that has been its only action, thereby declining to exercise its powers and authority by failing to compel the appropriate persons not to discharge such pollutants into the river.
Furthermore, it has been established that, beyond the inspections conducted, the record contains no evidence of any other action by this authority to provide a comprehensive solution to the problem; consequently, this omission also warrants granting the petition as to this institution. In this specific case, the health authorities failed to give the serious water-pollution problem affecting the río Jorco as a result of the unscrupulous conduct of certain residents the attention it required, and they failed to fulfill their obligation to safeguard the population’s right to health; consequently, that omission has infringed the fundamental rights of all the inhabitants of the area. The respondent authority, like the other respondent institutions, should be reminded of its obligation—as part of the State—to guarantee, defend, and preserve everyone’s right to enjoy a healthy and ecologically balanced environment.
In its particular case, that duty is even clearer, because constitutional protection encompasses and links an ecologically balanced environment with the fundamental right to health, both mental and physical. Ley General de Salud number 5395 establishes in its first article that the health of the population is a matter of public interest protected by the State and, in its second article, that the Poder Ejecutivo, through the Ministerio de Salud, is responsible for defining national health policy and for regulating, planning, and coordinating all public and private health-related activities, as well as carrying out those activities assigned to it by law; likewise, it has the authority to enforce its orders, including with the assistance of law enforcement, in order to protect the legal interest (bien jurídico) that it is charged with safeguarding. In a similar case, the Chamber held in judgment No. 2006-08983, issued at eleven hours sixteen minutes on veintitrés de junio de 2006: “This Constitutional Court finds that the Ministerio de Salud failed to fulfill its obligations to protect the right to health of the protected petitioner and the other residents of the housing development in question, by failing to exercise its statutory powers to provide a definitive solution to the health problem affecting them and which they formally reported, because its actions were insufficient, untimely, and ineffective, as demonstrated by the fact that the problem persists, since it took no concrete action in the exercise of the police power (poder de policía) conferred upon it by law to enforce its orders.
The members of this Constitutional Court are thus left with the impression that its conduct was that of a ‘paper administration,’ one whose activity is exhausted in mere bureaucratic procedures, simply limiting itself to conducting inspections and issuing recommendations or sanitary orders, without taking any measure to verify compliance and, worse still, without demonstrating any effective action genuinely aimed at definitively resolving the health problem described, as required to fulfill the public purpose entrusted to it. This is detrimental to health and the environment and, consequently, violates Article 50 of the Constitution, a situation that this Chamber finds intolerable.” Based on the foregoing, and there being no reason to depart from the stated criterion or reconsider the matter, the petition must be granted with respect to the Ministerio de Salud.
IX.Conclusion.- The Chamber concludes that this case concerns a serious public-health problem affecting the environment and the health of the inhabitants of the community of Barrio Bambú Desamparados. In its consistent case law, the Chamber has held that human beings cannot be denied the right to a healthy environment or the right to health because the corresponding public authorities are unable to exercise effectively the oversight powers and problem-solving authority granted to them by law. The documents and sworn reports contained in the record show that the respondent authorities, despite being fully aware of the problem described herein, have not taken the actions necessary to guarantee the health of the inhabitants and the protection of the environment. In conclusion, this Chamber finds that the omissions of the Instituto Costarricense de Acueductos y Alcantarillados, the Municipalidad de Desamparados, the Ministerio de Ambiente, Energía y Telecomunicaciones, and the Ministerio de Salud have endangered the right to health of the protected petitioners, the residents of the San Rafael de Desamparados area, and, in general, all inhabitants of the Republic.
These respondent authorities are responsible for the injury to the fundamental rights of the protected persons because they failed to safeguard promptly and effectively the health of that population and the environment. The reported problem demonstrates that the actions undertaken by the Instituto Costarricense de Acueductos y Alcantarillados, the Municipalidad de Desamparados, the Ministerio de Ambiente, Energía y Telecomunicaciones, and the Ministerio de Salud, within the scope of their respective powers, in exercising their regulatory or oversight authority to protect health and the environment, have clearly been insufficient. They have thereby incurred liability by omission in the exercise of those powers, which, in turn, infringes the citizens’ unenumerated or atypical constitutional right (derecho constitucional innominado o atípico) to receive efficient and effective public services. For the foregoing reasons, and pursuant to Article 29 of the Ley de la Jurisdicción Constitucional, this petition for amparo relief must be granted.
Por tanto:
The petition is GRANTED for violation of Articles 21 and 50 of the Constitución Política. María Luisa Avila Agüero, or whoever holds the office of Ministra de Salud; Maureen Fallas Fallas, or whoever holds the office of Alcalde de la Municipalidad de Desamparados; Andrei Borrouet Vargas, or whoever holds the office of Ministro de Ambiente, Energía y Telecomunicaciones; and Oscar Núñez Calvo, or whoever instead holds the office of Presidente Ejecutivo del Instituto Costarricense de Acueductos y Alcantarillados, are ordered, WITHIN A PERIOD OF ONE YEAR from the date notice of this decision is given, to adopt the measures necessary to resolve definitively the health and environmental problem affecting the protected petitioners and the other residents of the communities of Barrio El Bambú and Lomas; within that period, they must jointly and in coordination carry out all necessary works. María Luisa Avila Agüero, or whoever holds the office of Ministra de Salud; Maureen Fallas Fallas, or whoever holds the office of Alcalde de la Municipalidad de Desamparados; Andrei Borrouet Vargas, or whoever holds the office of Ministro de Ambiente, Energía y Telecomunicaciones; and Oscar Núñez Calvo, or whoever instead holds the office of Presidente Ejecutivo del Instituto Costarricense de Acueductos y Alcantarillados, are warned that failure to comply with the foregoing order will constitute the offense of disobedience and that, pursuant to Article 71 of the Ley de esta jurisdicción, anyone who receives an order issued in an amparo proceeding that the person is required to comply with or enforce, and who fails to comply with or enforce it, shall be punished by imprisonment for three months to two years or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty.
The STATE, the MUNICIPALIDAD DE DESAMPARADOS, and the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS are ordered to pay the legal costs, damages, and losses caused by the events underlying this ruling, which shall be assessed in administrative-litigation judgment enforcement proceedings (ejecución de sentencia de lo contencioso administrativo). *100143270007CO* SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las doce horas y veintitrés minutos del veintinueve de abril del dos mil once.
Recurso de amparo que se tramita en expediente número 10-014327-0007-CO, interpuesto por DORELL ROJAS FONSECA, cédula de identidad 0106580729, GABRIELA INCER DELOYA, cédula de identidad 0114360730, JOSE PABLO CORTES UREÑA, cédula de identidad 0114190740, RAMIRO FERNANDEZ ALFARO, cédula de identidad 0701920003 contra EL ALCALDE MUNICIPAL DE DESAMPARADOS, LA MINISTRA DE SALUD, EL MINISTRO DEL AMBIENTE, ENERGIA Y TELECOMUNICACIONES, EL PRESIDENTE DEL CONCEJO MUNICIPAL DE DESAMPARADOS Y EL PRESIDENTE EJECUTIVO DEL INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.-
Resultando:
Redacta el Magistrado Araya Garcia; y,
Considerando:
I.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
II.Objeto del recurso.- Los recurrentes alegan que desde el mes de septiembre de 2010 han presentado sendas denuncias ante las autoridades recurridas, debido a que los vecinos de la comunidad de Barrio Bambú y Lomas de San Rafael Arriba de Desamparado lanzan al río Jorco las aguas residuales negras y residuales sin ningún tratamiento y a la fecha no se ha resuelto problema, lo que lesiona su derecho a la salud y al ambiente.
III.Sobre el derecho a la salud.- El artículo 21 de la Constitución Política señala: "La vida humana es inviolable." Es de este principio constitucional de donde innegablemente se desprende el derecho a la salud, al bienestar físico, mental y social, derecho humano que se encuentra indisolublemente ligado al derecho de la salud y a la obligación del Estado de proteger de la vida humana. El Estado está obligado a tomar las medidas necesarias para proteger el ambiente y evitar grados de contaminación que pongan en peligro la salud de los habitantes. Precisamente, en materia de salud pública, el Estado mediante sus instituciones, debe estar siempre vigilante de las actividades potencialmente lesivas de la salud pública, por lo que debe de ejercer un control constante y efectivo.
IV.Sobre la protección al ambiente.- En el caso bajo análisis, los recurrente denuncian la contaminación de un recurso hídrico y la jurisprudencia constitucional ha indicado que la protección del ambiente es una tarea que corresponde a todos por igual, es decir, que existe una obligación para el Estado –como un todo- de tomar las medidas necesarias para proteger el medio, a fin de evitar grados de contaminación, deforestación, extinción de flora y fauna, uso desmedido o inadecuado de los recursos naturales, que pongan el peligro la salud de los administrados. En esta tarea, por institución pública, debe entenderse comprendida tanto la Administración Central –Ministerios, como el Ministerio del Ambiente y Energía y el Ministerio de Salud, que en razón de la materia, tienen una amplia participación y responsabilidad en lo que respecta a la conservación y preservación del ambiente; los cuales actúan, la mayoría de las veces, a través de sus dependencias especializadas en la materia, y sin olvidar, por supuesto, las municipalidades que tienen gran responsabilidad, en lo que respecta a su jurisdicción territorial.
Es por ello, que podría pensarse que esta múltiple responsabilidad provocaría un caos en la gestión administrativa, lo cual no es cierto, por cuanto a fin de evitar la coexistencia simultánea de esferas de poder de diferente origen y esencia, la duplicación de los esfuerzos nacionales y locales, así como la confusión de derechos y obligaciones entre las diversas partes involucradas, es que se hace necesario establecer una serie de relaciones de coordinación entre las diversas dependencias del Poder Ejecutivo y las instituciones descentralizadas, y entre éstas con las municipalidades, a fin de poder llevar a cabo las funciones que les han sido encomendadas. Esta Sala con anterioridad –y en forma bastante clara- se refirió al principio de coordinación de las dependencias públicas con las municipalidades en la realización de fines comunes -lo cual, obviamente se debe hacer extensivo a la relación que en esta importante función realizan las instituciones de la Administración Central y las descentralizadas-, para lo cual se remite a lo indicado en aquella ocasión (sentencia número 5445-99, de las catorce horas treinta minutos del catorce de julio de mil novecientos noventa y nueve):
"De manera que la coordinación es la ordenación de las relaciones entre estas diversas actividades independientes, que se hace cargo de esa concurrencia en un mismo objeto o entidad, para hacerla útil a un plan público global, sin suprimir la independencia recíproca de los sujetos agentes. Como no hay una relación de jerarquía de las instituciones descentralizadas, ni del Estado mismo en relación con las municipalidades, no es posible la imposición a éstas de determinadas conductas, con lo cual surge el imprescindible «concierto» interinstitucional, en sentido estricto, en cuanto los centros autónomos e independientes de acción se ponen de acuerdo sobre ese esquema preventivo y global, en el que cada uno cumple un papel con vista en una misión confiada a los otros. Así, las relaciones de las municipalidades con los otros entes públicos, sólo pueden llevarse a cabo en un plano de igualdad, que den como resultado formas pactadas de coordinación, con exclusión de cualquier forma imperativa en detrimento de su autonomía, que permita sujetar a los entes corporativos a un esquema de coordinación sin su voluntad o contra ella; pero que sí admite la necesaria subordinación de estos entes al Estado y en interés de éste (a través de la «tutela administrativa» del Estado, y específicamente, en la función de control la legalidad que a éste compete, con potestades de vigilancia general sobre todo el sector).” Por otro lado, las omisiones al deber de protección del ambiente y de cumplimiento de la normativa ambiental así como al derecho a la salud de los habitantes son de relevancia constitucional, por cuanto a consecuencia de la inercia de la Administración en estas materias, se pueden producir graves daños a la salud de una comunidad, al ambiente y a los recursos naturales.
V.Sobre el fondo.- En virtud de la participación de diferentes entes administrativos en el presente asunto, se procederá a realizar el análisis de las actuaciones de cada uno de ellos en forma separada.
VI.En cuanto a las actuaciones del Ministerio de Ambiente, Energía y Telecomunicaciones.- El Ministro accionado en su defensa arguye que la denuncia presentada por los recurrentes fue debidamente resuelta y notificada dentro de un plazo razonable y en ella se les indicó que el problema acusado es responsabilidad del Instituto Costarricense de Acueductos y Alcantarillados, que es el ente prestatario de abastecimiento de agua y disposición de la red de alcantarillado sanitario. No obstante, en el caso bajo análisis, no solo se trata de un problema de la evacuación de aguas negras y pluviales provenientes de unas viviendas de la zona; sino que la cuestión aquí también involucra la contaminación al ambiente, en concreto al recurso hídrico, por lo que, según lo dispuesto por el ordenamiento jurídico, el Ministerio de Ambiente, Energía y Telecomunicaciones es el ente competente para atender también este tipo de problema.
De esta manera, dada la relevancia del tema, no cabe duda de que el Estado costarricense, a través de sus diferentes instituciones pero principalmente la aquí recurrida, es el responsable directo de garantizar la defensa efectiva del ambiente, con lo cual, cualquier omisión o retardo en atender tal función, genera responsabilidad. De tal modo, en el caso concreto, hay una obligación estatal compartida entre el Ministerio de Salud, el Instituto Costarricense de Acueductos y Alcantarillados y la Municipalidad de Desamparados, en virtud de que todas tienen la obligación de velar por el cumplimiento de la normativa existente en aras de proteger el ambiente, los recursos hídricos, naturales, entre otros, que implican vida para los pobladores y el futuro de las generaciones venideras. Debe recordarse que no existe un derecho a contaminar el agua sino todo lo contrario, en concordancia con el derecho fundamental a gozar de un ambiente sano deriva el derecho de todas las personas a que el agua esté libre de contaminantes; derecho que se traduce en el deber del Estado de velar por la calidad del agua y en su potestad de sancionar a todo aquél que la contamine (ver en ese sentido sentencia número 2006-009170 de las dieciséis horas treinta y seis minutos del veintiocho de junio del dos mil seis).
Así las cosas, la inercia del Ministerio recurrido y la irresponsabilidad asumida ha provocado una violación al derecho a la salud y al ambiente, siendo que ha sido tolerante con la situación denunciada en virtud de que no ha realizado ningún acto y no ha ejecutado las medidas que el Ordenamiento Jurídico provee para remediar una situación en la que se pone en peligro la salud humana y el derecho a gozar de un medio sano y equilibrado. De manera que, no puede trasladar la solución a otras instituciones de un problema que compromete el ambiente, pues esa inercia se traduce en una infracción a los derechos constitucionales de los amparados, así como de los habitantes de esa comunidad. Corolario a lo anterior, se impone la estimatoria de este recurso contra el Ministerio de Ambiente, Energía y Telecomunicaciones por la violación constitucional a los artículos 50 y 21 de la Constitución Política en perjuicio de los accionantes y demás vecinos del sector de Barrio Bambú y Lomas de San Rafael de Desamparados.
VI.En cuanto a las actuaciones del Instituto Costarricense de Acueductos y Alcantarillados. Mediante su Ley Constitutiva, Ley No. 2726 de 14 de abril de 1961 y sus reformas, el Instituto Costarricense de Acueductos y Alcantarillados, es la institución creada por ley para dirigir y vigilar todo lo concerniente para proveer a los habitantes de la República de un servicio de recolección y evacuación de aguas negras y residuos industriales líquidos y de aguas pluviales en las áreas urbanas. Sobre el particular, el artículo 2° señala en lo conducente, lo siguiente:
“Artículo 2.- (*) Corresponde al Instituto Costarricense de Acueductos y Alcantarillados:
Bajo ningún concepto podrá delegar la administración de los sistemas de acueductos y alcantarillado sanitario del Área Metropolitana.
Tampoco podrá delegar la administración de los sistemas sobre los cuales exista responsabilidad financiera y mientras ésta corresponda directamente al Instituto.
Ciertamente, los responsables de los hechos denunciados son las personas que viven en el sector, por cuanto lanzan las aguas negras al río en lugar de conducirlas al tanque séptico en virtud de que no existe infraestructura de alcantarillado. No obstante, no solo es la falta de vigilancia por parte de otras autoridades, sino también la desidia de esta Institución lo que la convierte en co- responsable de las violaciones al ambiente apuntadas y, por ende, le corresponderá brindar asesoría técnica y la colaboración requerida, para que se construyan las obras de infraestructura necesarias para solventar el problema de evacuación de aguas negras en Barrio Bambú y Lomas.
VII.En cuanto a la actuación de la Municipalidad de Desamparados.- El Código Municipal obliga a las Municipalidades de cada cantón a velar porque al munícipe se le garantice el disfrute real y efectivo del derecho a la salud y a un ambiente sano. De los documentos aportados al expediente, así como el informe dado bajo juramento por el Alcalde recurrido, indica que al momento que se recibió la denuncia la misma fue trasladada al Ministerio de Salud y al Instituto Costarricense de Acueductos y Alcantarillados, por cuanto según su criterio, dichas instituciones son las competentes para solucionar el problema . Sin embargo, su papel no se debe de limitar a trasladar los problemas de salud y contaminación a otros entes, sino que su obligación se encuentra en garantizar, defender y preservar el derecho de todos a disfrutar de un ambiente sano y ecológicamente equilibrado. El Código Municipal estatuye en su artículo 75 que, de conformidad con el Plan Regulador Municipal, las personas físicas o jurídicas, propietarias o poseedoras, por cualquier título, de bienes inmuebles, deberán cumplir ciertas obligaciones tendientes a velar por el ornato y la tutela del medio ambiente, cuyo incumplimiento puede hacer a las personas que no cumplan al pago de multas, previo debido proceso.
A juicio de esta Sala, en la especie la Municipalidad de Desamparados ha mostrado incapacidad para hacer cumplir las leyes en la materia y su obligación de garantizar el disfrute de los habitantes de la zona a un ambiente sano y ecológicamente equilibrado, con las consecuencias para la salud de esas personas debido a la naturaleza del problema sanitario que les aqueja. Es así como la Municipalidad de Desamparados, teniendo pleno conocimiento de la problemática que afecta a los pobladores de la zona aledaña al cauce del río Jorco se ha limitado a constatar su existencia, trasladar la demanda presentada al Ministerio de Salud y así evadir su responsabilidad. Advierte la Sala, que pese a las quejas de los vecinos y la verificación del problema sanitario que pone en riesgo la salud humana y al ambiente, la Municipalidad recurrida no ha tomado acción alguna para solucionar el problema, circunscribiéndose a indicar que no es competente.
Se observa entonces, que la Municipalidad no ha verificado si los propietarios de inmuebles en ese caserío cuentan con tanque séptico y drenajes, el estado en que se encuentran o si lanzan al río aguas contaminadas. Lo anterior, con el fin de imponer las sanciones que en Derecho corresponda una vez otorgado el debido proceso y derecho de defensa que les asiste. En consecuencia, la Municipalidad de Desamparados no ha tomado acción alguna para determinar la existencia del problema y su eventual incidencia en el inconveniente sanitario que con insistencia revelan los vecinos del lugar. En tal virtud, se impone la estimatoria de este recurso contra la Municipalidad de Desamparados por la violación constitucional a los artículos 50 y 21 de la Constitución Política en perjuicio de los recurrentes y demás vecinos de la zona barrio Bambú y Lomas de San Rafael de Desamparados.
VIII.En cuanto a las actuaciones del Ministerio de Salud.- Si bien es cierto, el Estado debe respetar el derecho de los individuos, también lo es que debe velar por el bienestar de la comunidad. La Salud Pública y la protección del medio ambiente son principios tutelados tanto a nivel constitucional (artículos 21, 50, 73 y 89 de la Carta Magna), como a través de la normativa internacional. En este caso, la Ley General de Salud, autoriza al Ministerio de Salud para tomar las medidas sanitarias correspondientes e imponer las sanciones, con lo cual el Ministerio de Salud no solo tiene el deber de hacer cumplir la Ley General de Salud, sino el de proteger la salud pública calificada como bien de interés público, pues los derechos a la salud y a un ambiente sano y libre de contaminación -al menos por debajo de los límites tolerables para el ser humano- son derechos fundamentales irrenunciables y en cuya violación no se puede legítimamente consentir.
Ahora bien, del informe presentado a esta Sala y la prueba documental aportada, se tiene por demostrado que efectivamente posterior a la denuncia presentada por los recurrentes, las autoridades sanitarias realizaron una inspección el día 28 de setiembre de 2010 y se verificó que una vivienda era responsable del problema denunciado, por lo que se giró la orden sanitaria correspondiente. Sin embargo, no es hasta la notificación de este amparo, es decir el 19 de octubre de 2010, que la autoridad recurrida efectúa otro control en el sector y en esta ocasión constató que existen más viviendas que lanzan al río las aguas negras y residuales, lo que evidentemente, genera un problema muy serio y pone en riesgo la salud de los habitantes. Si bien, previo a la interposición del presente proceso, la autoridad sanitaria realizó un reconocimiento y giró una orden sanitaria, en la que se otorgó un plazo de 30 días para que los moradores de dichas viviendas dispongan adecuada y sanitariamente las aguas negras y servidas a un sistema sanitario legalizado como el tanque séptico y drenaje respectivo u otro similar y el deber de mantenerlo en buenas condiciones, esa ha sido su única actuación, declinando el ejercicio de sus competencias y atribuciones, al no constreñir a quienes corresponda, a no lanzar este tipo de contaminantes al río.
Además, queda demostrado que más allá de las inspecciones realizadas, no se desprende del expediente ninguna otra actuación de parte de esta autoridad para dar solución integral al problema y por ende, tal omisión implica también en cuanto a esta institución, la estimación del recurso. En el caso concreto, las autoridades sanitarias no le dieron la importancia que el caso amerita al grave problema de contaminación de aguas que presenta el río Jorco por la acción inescrupulosa de algunos vecinos y han omitido cumplir con su obligación de velar por el derecho a la salud de la población y por ende, tal omisión ha ocasionado lesiones a los derechos fundamentales de todos los habitantes del lugar. Conviene recordar a la autoridad recurrida, al igual que se hizo con las otras instituciones recurridas, su obligación –como parte del Estado- de garantizar, defender y preservar el derecho de todos a disfrutar de un ambiente sano y ecológicamente equilibrado.
En su caso particular se trata de un deber aún más claro, pues la protección constitucional cubre y vincula el ambiente ecológicamente equilibrado con el derecho fundamental a la salud, tanto en el plano psíquico como en el físico, siendo que la Ley General de Salud número 5395 establece, en su artículo primero, que la salud de la población es un bien de interés público tutelado por el Estado y, en su artículo segundo, que corresponde al Poder Ejecutivo, por medio del Ministerio de Salud, la definición de la política nacional de salud, la normación, planificación y coordinación de todas las actividades públicas y privadas relativas a salud, así como la ejecución de aquellas actividades que le competen conforme a la ley; de igual forma, que tendrá potestades para hacer cumplir sus órdenes incluso con ayuda de la fuerza pública en protección del bien jurídico que está llamado a tutelar. En un caso similar, la Sala en sentencia No. 2006-08983 de las once horas dieciséis minutos del veintitrés de junio de 2006 dispuso: “ Estima este Tribunal Constitucional que el Ministerio de Salud ha sido omiso en el cumplimiento de sus obligaciones en tutela del derecho a la salud del amparado y demás vecinos de la urbanización de marras, al no hacer uso de sus potestades legales con el fin de solucionar, definitivamente, el problema sanitario que les afecta y que han denunciado formalmente, pues ha realizado una actividad insuficiente, inoportuna e ineficaz que se comprueba con el hecho de que el problema subsiste, al no haber concretado ninguna acción en ejercicio del poder de policía que le asiste por ley para hacer cumplir sus órdenes.
Queda así en los miembros de este Tribunal Constitucional la percepción de que ha sido la actuación de una “Administración de papel”, que agota su actividad en meros trámites burocráticos, simplemente limitándose a realizar inspecciones y girar recomendaciones u órdenes sanitarias, sin que se tome medida alguna para corroborar que se hayan cumplido y, lo que es peor, sin que se evidencien de su parte acciones eficaces, verdaderamente encaminadas a resolver en definitiva la problemática sanitaria expuesta, como corresponde para cumplir el fin público que se le ha encomendado, lo que redunda en detrimento de la salud y el medio ambiente y, por consiguiente, en violación del artículo 50 constitucional, situación que resulta intolerable para esta Sala”. Partiendo de lo anterior y no existiendo ningún motivos para variar el criterio expuesto, ni reconsiderar la cuestión, se impone declarar con lugar el recurso con respecto al Ministerio de Salud.
IX.Conclusión.- La Sala concluye que en el presente caso, nos encontramos ante un problema sanitario grave que afecta al ambiente y la salud de los habitantes de la comunidad del Barrio Bambú Desamparados; y en reiterada jurisprudencia la Sala ha dicho que no se puede aceptar que a los seres humanos se les niegue el derecho a un ambiente sano, el derecho a la salud, debido a la incapacidad de las autoridades públicas correspondientes para ejercer efectivamente las potestades de vigilancia y la solución a los problemas otorgadas por ley. De los documentos y los informes rendidos bajo juramento que constan en el expediente, se desprende que las autoridades recurridas, a pesar de que tienen pleno conocimiento del problema aquí de los habitantes y la protección al ambiente. En conclusión, estima esta Sala que las omisiones tanto del Instituto Costarricense de Acueductos y Alcantarillados, de la Municipalidad de Desamparados, del Ministerio de Ambiente, Energía y Telecomunicaciones y del Ministerio de Salud, han puesto en peligro el derecho a la salud de los amparados, de los vecinos de la zona de San Rafael de Desamparados y en general de todos los habitantes de la República.
Estas autoridades recurridas son responsables del daño a los derechos fundamentales de las personas amparadas, por la omisión en velar, pronta y eficazmente por la salud de esa población y al ambiente. El problema denunciado demuestra que las acciones en ejercicio de la potestad de control o vigilancia desplegadas en tutela de la salud y del ambiente por parte del Instituto Costarricense de Acueductos y Alcantarillados, de la Municipalidad de Desamparados, del Ministerio de Ambiente, Energía y Telecomunicaciones y del Ministerio de Salud, dentro del marco de sus competencias, han sido claramente insuficientes, incurriendo así en responsabilidad por omisión en el ejercicio de esas potestades que, a su vez, lesiona el derecho constitucional innominado o atípico de los ciudadanos a que les presten servicios públicos eficientes y eficaces. En razón de lo anterior, y de conformidad con lo establecido en el artículo 29 de la Ley de la Jurisdicción Constitucional, procede declarar con lugar el presente recurso de amparo.
Por tanto:
Se declara CON LUGAR el recurso por violación a los artículos 21 y 50 de la Constitución Política. Se ordena a María Luisa Avila Agüero o a quien ocupe el cargo de Ministra de Salud; a Maureen Fallas Fallas, o a quien ocupe el cargo de Alcalde de la Municipalidad de Desamparados, a Andrei Borrouet Vargas, o a quien ocupe el cargo de Ministro de Ambiente, Energía y Telecomunicaciones y a Oscar Núñez Calvo o a quien en su lugar ocupe el cargo de Presidente Ejecutivo del Instituto Costarricense de Acueductos y Alcantarillados, que en el PLAZO DE UN AÑO, contado a partir de la comunicación de esta resolución, deben tomar las medidas necesarias para que se solucione, definitivamente, el problema sanitario y ambiental que afecta a los amparados y demás vecinos de la comunidad de Barrio El Bambú y Lomas, y en este plazo deben realizar en forma coordinada y conjunta las obras que sean necesarias.
Se le advierte a María Luisa Avila Agüero o a quien ocupe el cargo de Ministra de Salud, a Maureen Fallas Fallas, o a quien ocupe el cargo de Alcalde de la Municipalidad de Desamparados, a Andrei Borrouet Vargas , o a quien ocupe el cargo de Ministro de Ambiente, Energía y Telecomunicaciones y a Oscar Núñez Calvo o a quien en su lugar ocupe el cargo de Presidente Ejecutivo del Instituto Costarricense de Acueductos y Alcantarillados, que de no acatar la orden dicha incurrirá en el delito de desobediencia y que de conformidad con el artículo 71 de la Ley de esta jurisdicción, se le impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al ESTADO, a la MUNICIPALIDAD DE DESAMPARADOS y al INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo.
Notifíquese la presente resolución María Luisa Avila Agüero o a quien ocupe el cargo de Ministra de Salud, a Maureen Fallas Fallas, o a quien ocupe el cargo de Alcalde de la Municipalidad de Desamparados, a Andrei Borrouet Vargas , o a quien ocupe el cargo de Ministro de Ambiente, Energía y Telecomunicaciones y a Oscar Núñez Calvo o a quien en su lugar ocupe el cargo de Presidente Ejecutivo del Instituto Costarricense de Acueductos y Alcantarillados, todos en forma personal.- Gilbert Armijo S.
