Decision No. 2011003744 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at fourteen hours and forty minutes on veintitrés de marzo del dos mil once.

Amparo proceeding processed under expediente número 10-006096-0007-CO, filed by CARLOS MARTIN CHACON MARTINEZ, identity card 0302590773, against the MUNICIPAL MAYOR OF THE CANTON OF TURRIALBA, ASADA OF CARMEN LYRA, DIRECTOR OF THE TURRIALBA HEALTH AREA OF THE MINISTRY OF HEALTH, EXECUTIVE PRESIDENT OF THE COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS.-

Whereas:

  1. 1By written submission received by the Chamber’s Secretariat at 10:35 on 06 de mayo de 2010, the petitioner files an amparo proceeding against the MUNICIPAL MAYOR OF THE CANTON OF TURRIALBA, ASADA OF CARMEN LYRA, DIRECTOR OF THE TURRIALBA HEALTH AREA OF THE MINISTRY OF HEALTH, and EXECUTIVE PRESIDENT OF THE COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS, and states that the Carmen Lyra neighborhood, located east of Turrialba, is a social-welfare housing project that initially had a treatment plant, but over time it was abandoned, and it now causes environmental pollution of the Aquiares River. He states that this treatment plant no longer has its motors, that its tanks are broken, and that untreated water leaks out and forms a swamp in the pasture and the Aquiares River. He notes that a pipe discharging a large quantity of sewage into the same river can be observed at the site. He asserts that the foregoing constitutes environmental damage and, consequently, a violation of his right to a healthy and ecologically balanced environment. He requests that the respondent authorities be ordered to take appropriate measures to prevent the discharge of sewage, wastewater, and effluent into the channel of the Aquiares River.
  2. 2José Manuel Madrigal Fuentes, in his capacity as President of the Carmen Lyra de Turrialba Drinking Water Supply and Sewerage System Administrative Association (folio 29), reports under oath that the Carmen Lyra housing development in Turrialba was created as a social-welfare housing project in 1991. Initially, the water supply and sewerage system, including the wastewater treatment tank, was administered by a local committee, and in julio de 2003 the Association, or Asada, that he represents was created for the purpose of administering, operating, expanding, and maintaining the water supply system in good condition. However, oversight, maintenance, and protection of the sanitary sewerage system have neither been delegated to them nor ever assumed by them. He states that this responsibility belongs to the Municipality of Turrialba and that the Ministry of Health has issued sanitary orders to the Municipality and even filed a complaint with the Turrialba Prosecutor’s Office on 02 de julio de 2004. He requests that the proceeding filed be dismissed.
  3. 3Manolo Alfonso Bogantes Bolaños and Carmen Machado Montoya, in their capacities as Municipal Mayor and President of the Turrialba Municipal Council (folio 53), report under oath that the water supply and sanitary sewerage services of the Carmen Lyra Residential Development are administered by the ASADA of Carmen Lyra, with AyA serving as the governing entity, and that they therefore do not fall within the Municipality’s jurisdiction. They state that actions to ensure the proper discharge of sewage and wastewater fall within the jurisdiction of the Ministry of Health, which approved the sewage treatment plant that is currently under the responsibility and management of the ASADA, the entity charged with providing the service under AyA regulation. In other words, oversight and technical supervision of sewerage systems fall to that Ministry and AyA, while their administration and operation fall to AyA.They add that, according to the reports submitted by the Environmental Manager and the Urban Development Coordinator, there is no record of any complaint filed by the petitioner, and therefore the alleged facts have not been brought to the attention of the municipal authorities. They state that the Commission for the Planning and Management of the Reventazón River Basin sent a memorandum to the president of the ASADA concerning wastewater and runoff management. They note that the ecological conservation and protection of watersheds and the control of water pollution fall within the jurisdiction of the Costa Rican Institute of Aqueducts and Sewers. They request that the proceeding filed be dismissed.
  4. 4Giselle Solano Fernández, in her capacity as Director of the Governing Health Area of the Ministry of Health in Turrialba (folio 70), reports under oath by submitting the administrative file concerning the Carmen Lyra Treatment Plant in Turrialba. By written submission filed with the Secretariat of this Chamber at 09:18 on 28 de mayo de 2010 (folio 74), she reports on an inspection conducted jointly with officials from the Municipality and the ASADA.
  5. 5Eduardo Leazma Fernández, in his capacity as Deputy General Manager of the Costa Rican Institute of Aqueducts and Sewers (folio 81), reports under oath that he requests that the National Institute of Housing and Urban Development be joined as a party to these proceedings, because it is the entity responsible for safeguarding groundwater-recharge areas, among other powers relevant to this matter. He states that the Carmen Lyra social-housing project has neither completed procedures nor obtained plan approval from the Functional Urban Development Area, because the project developer failed to construct the water supply system properly or comply with the technical requirements concerning design, financing, or guarantees for the works; accordingly, the Institute neither approved nor accepted the project and does not provide service to it. He adds that, under the Institute’s enabling statute, every housing construction project must first obtain authorization from AyA, under penalty of nullity; in this case, such technical approval has not been granted, nor has confirmation of service availability been issued, which is a necessary requirement for the local government to grant the construction permit. He requests that the proceeding filed be dismissed.
  6. 6Eugenia Vargas Gurdián, in her capacity as Executive President of the National Institute of Housing and Urban Development (folio 107), reports under oath that the Carmen Lyra social-housing project was not developed by that institution. She states that, in cases involving the construction of residential developments, INVU’s role is limited to receiving the plans and distributing them to the various agencies responsible for reviewing and approving them. This urban-planning review of the works is unrelated to sewerage, stormwater drainage, or other systems, which fall within the jurisdiction of AyA and the Ministry of Health; INVU merely verifies compliance with article IV.16 of the Construction Regulations concerning the installation of public utilities. She requests that the proceeding be dismissed as to the institution she represents.
  7. 7The statutory requirements have been observed in the proceedings conducted.

Justice Salazar Cambronero writes the opinion; and,

Considering:

I.Subject matter of the proceeding. The petitioner alleges that the treatment plant serving the Carmen Lyra housing project was abandoned by all the responsible authorities, resulting in sewage forming stagnant pools and polluting the Aquiares River.

II.Proven facts. The following facts, which are relevant to the resolution of this matter, are deemed duly established, either because they have been proven or because the respondent failed to address them as ordered in the initial ruling:

a. The wastewater treatment plant serving the Carmen Lyra social-housing project is inoperable and abandoned (undisputed fact).

b. The Carmen Lyra social-housing project has neither completed procedures nor obtained plan approval from the Functional Urban Development Area of the Costa Rican Institute of Aqueducts and Sewers (folio 84).

III.Merits. The case law of this Chamber has repeatedly recognized that public health and the right to a healthy and ecologically balanced environment are protected both constitutionally and under international law; that the legitimate exercise of this right requires resources to be used rationally; and that the State is responsible for protecting the environment pursuant to the precautionary principle governing environmental matters. This principle requires the State to provide for everything necessary within the scope permitted by law to prevent irreversible environmental damage and to assume responsibility for achieving the social conditions needed for each person to enjoy health, such right being understood as a state of physical, psychological (or mental), and social well-being. See Decision No. 180-98, at 16:24 on 13 de enero de 1998. The State’s objective obligation regarding environmental protection does not necessarily entail a subjective right of individuals to demand, through the courts, that a particular measure be taken, but it does entail a right to the adoption of measures suitable for safeguarding that right in the face of openly negligent conduct by public authorities or by natural and legal persons.

The State therefore assumes the obligation to regulate those areas of social life from which dangers to the physical existence of the inhabitants of its territory may arise, as well as those that harm the environment. It may do so through statutes, regulations, agreements, or other measures relating to administrative organization and procedures, and individuals have a subjective right to require that this be done diligently. Consequently, the ability to demand judicially, through an amparo proceeding, a specific type of affirmative action by the State in fulfillment of its duty to protect the life, health, or environmental rights of its inhabitants is restricted to cases in which a clear and imminent danger to those individual rights has been established. It follows that intervention by the constitutional jurisdiction is viable only where it has been proven that the State, through its competent bodies, has failed to act upon demands made by the country’s inhabitants in the exercise of their rights.

IV.Regarding the specific case. The petitioner alleges that the wastewater treatment plant in the neighborhood known as Carmen Lyra is not operating properly. After analyzing the evidence in the case file, as well as the reports submitted under oath by the respondents, this Court has verified that the wastewater treatment plant at that location is indeed not operating properly and lacks authorization from the Costa Rican Institute of Aqueducts and Sewers. This Chamber finds that, in this specific case, there has indeed been a lack of coordination among the Municipality of Turrialba, the Carmen Lyra ASADA, the Ministry of Health, AyA, and INVU, even though each of them, within the scope of its authority, has been assigned duties that must be directed toward protecting the environment. In this regard, the Chamber has repeatedly held that such coordination among public agencies is unquestionably necessary in this area in order to guarantee environmental protection, which is a responsibility shared equally by all; that is, the State—as a whole—is under an obligation to adopt the measures necessary to protect the environment so as to prevent levels of pollution, deforestation, extinction of flora and fauna, and excessive or improper use of natural resources that endanger the health of the governed.

Based on the foregoing, there is no doubt that any failure to fulfill the duty of cooperation among public institutions could endanger environmental protection, since governmental inaction in this area may cause harm to the environment and natural resources with consequences similar to or greater than those arising from governmental actions (see, to that effect, judgment number 2005-01173, issued at 15:11 hours on 08 February 2005). To effectively comply with that mandate, the Public Administration—understood in the broad sense—must adopt the measures necessary to ensure the timely and effective treatment of wastewater in the country’s communities, requiring all relevant technical studies for that purpose. The actions of the various entities involved are governed, for example, by the General Health Law and the Organic Environmental Law, which call for the health authorities of the Executive Branch, together with local governments, to assume responsibility for resolving difficulties such as the one at issue in this amparo proceeding.

Both in relation to other bodies or entities in the public sector and vis-à-vis private parties, particular emphasis is placed on the role of the Ministry of Health as the governing authority in its specialized field and on the role of the Municipalities in safeguarding the living conditions of the inhabitants of the canton. In this particular case, this translates into the need to support with technical criteria any decisions that may affect the environment. Projects such as the one challenged must therefore be approved by the various entities involved—in this specific case, by the Costa Rican Institute of Aqueducts and Sewers with respect to drinking-water and wastewater-treatment systems. In other words, the technical analyses and assessments conducted by the various competent authorities determine the environmental impact within the project-approval process; this reflects the concept of the objectification of environmental law, which requires not merely compliance with certain formalities but the use of every legally and factually available means to preserve the environment.

Thus, the Municipality is called upon to enter into cooperative relations with other public entities, and vice versa, given that their interests concerning a specific matter are, in many cases, concurrent or overlapping. Proper and mandatory coordination must exist between the State and local corporate entities, thereby complying with this provision without encroaching upon municipal autonomy. In this particular case, this duty of coordination requires the respondent entities to combine their efforts toward the common goal of resolving the sewage and wastewater-disposal problem in the Carmen Lyra housing development, so as to provide effective protection of the right to a healthy and ecologically balanced environment established in Article 50 of the Constitution. The reports submitted by the respondent authorities show that no entity has fully assumed its duties and responsibilities regarding the management of the sewage system and the disposal of wastewater in the Carmen Lyra Urban Development, beyond a complaint filed by the Governing Health Area.

Accordingly, this Court finds that the authorities in question have not acted decisively, effectively, or diligently to put an end to this irregularity; it is therefore unacceptable to endorse their permitting the treatment plant to remain inoperative or the permits required by the Legal System to remain absent. Based on the reasons stated above, this Chamber finds that, in this particular case, there has been a lack of coordination to the detriment of the public interest in preserving the right to a healthy and ecologically balanced environment. For this reason, and in light of the considerations set forth in this judgment, it is essential to order the entities involved, each within the scope of its authority, to reassess the project and adopt the measures necessary to comprehensively remedy the sanitary-sewer and wastewater-treatment problems in the Carmen Lyra housing development, in order to preserve the right to a healthy and ecologically balanced environment and in accordance with the precautionary principle. Consequently, for the reasons stated above, the amparo petition is well-founded because of the threat to the environment, and it is hereby so declared.

Por tanto:

The petition is granted. Eduardo Leazma Fernández, in his capacity as General Deputy Manager of the Costa Rican Institute of Aqueducts and Sewers; Giselle Solano Fernández, in her capacity as Director of the Governing Area of the Ministry of Health in Turrialba; José Manuel Madrigal Fuentes, in his capacity as President of the Administrative Association of the Carmen Lyra Potable-Water Aqueduct and Sewer System of Turrialba; and Manolo Alfonso Bogantes Bolaños, in his capacity as Municipal Mayor of Turrialba, are ordered, within a period of three months, to define a final solution for the disposal of sewage and wastewater from the Carmen Lyra housing development and to adopt—each within the scope of his or her authority—the measures necessary to bring the wastewater treatment plant into legal compliance and operation and to provide a comprehensive solution to the sanitary-sewer and wastewater-treatment problem.

Any works deemed necessary must be completed within the twelve months following preparation of the comprehensive plan. They are likewise ordered, should they leave office, to inform their successors of this judgment and the deadlines established herein and to report to this Chamber on the actions ordered. The State, the Costa Rican Social Security Fund, and the Municipality of Turrialba are ordered to pay the resulting costs, damages, and losses, which shall be assessed during enforcement of the judgment in the administrative litigation proceeding. Eduardo Leazma Fernández, in his capacity as General Deputy Manager of the Costa Rican Institute of Aqueducts and Sewers; Giselle Solano Fernández, in her capacity as Director of the Governing Area of the Ministry of Health in Turrialba; José Manuel Madrigal Fuentes, in his capacity as President of the Administrative Association of the Carmen Lyra Potable-Water Aqueduct and Sewer System of Turrialba; and Manolo Alfonso Bogantes Bolaños, in his capacity as Municipal Mayor of Turrialba, or whoever may hold their respective offices, are hereby advised that, pursuant to Article 71 of the Constitutional Jurisdiction Law, any person who receives an order issued in an amparo proceeding that he or she is required to comply with or enforce, and who fails to comply with or enforce it, shall be punished by imprisonment for three months to two years or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las catorce horas y cuarenta minutos del veintitrés de marzo del dos mil once.

Recurso de amparo que se tramita en expediente número 10-006096-0007-CO, interpuesto por CARLOS MARTIN CHACON MARTINEZ, cédula de identidad 0302590773, contra ALCALDE MUNICIPAL DEL CANTON DE TURRIALBA, ASADA DE CARMEN LYRA, DIRECTORA DEL AREA DE SALUD DEL MINISTERIO DE SALUD DE TURRIALBA, PRESIDENTE EJECUTIVO DEL INSTITUTO DE ACUEDUCTOS Y ALCANTARILLADOS.-

Resultando:

  1. 1Por escrito recibido en la Secretaría de la Sala a las 10:35 horas del 06 de mayo de 2010, el recurrente interpone recurso de amparo contra ALCALDE MUNICIPAL DEL CANTON DE TURRIALBA, ASADA DE CARMEN LYRA, DIRECTORA DEL AREA DE SALUD DEL MINISTERIO DE SALUD DE TURRIALBA, PRESIDENTE EJECUTIVO DEL INSTITUTO DE ACUEDUCTOS Y ALCANTARILLADOS y manifiesta que el Barrio Carmen Lyra, ubicado al este de Turrialba, es un proyecto habitacional de bien social, que en un principio contaba con planta de tratamiento, pero con el paso del tiempo la abandonaron, por lo que ahora provoca contaminación ambiental del Río Aquiares. Indica que dicha planta de tratamiento ya no cuenta con los motores, los tanques están rotos y se filtra el agua sin tratar y se empantana en el potrero y el Río Aquiares. Señala que en el lugar se observa un tubo con gran cantidad de aguas negras que se dirigen al mismo río. Afirma que lo anterior constituye un daño ambiental y, consecuentemente, una lesión a su derecho a un ambiente sano y ecológicamente equilibrado. Solicita que se ordene a las autoridades recurridas tomar las medidas adecuadas para evitar el desfogue de aguas negras, servidas y residuales en el cauce del Río Aquiares
  2. 2Informa bajo juramento José Manuel Madrigal Fuentes, en su calidad de Presidente de la Asociación Administradora del Acueducto Potable y Alcantarillado Carmen Lyra de Turrialba (folio 29), que la ciudadela Carmen Lyra de Turrialba fue creada como proyecto habitacional de bien social en 1991. Al inicio, la administración del acueducto y alcantarillado con tanque de tratamiento de aguas residuales estaba a cargo de un comité local, y en julio de 2003 se creó la Asociación o Asada que representa, con el fin de administrar, operar, ampliar y conservar en buenas condiciones el acueducto. Sin embargo, no se les ha delegado ni han asumido nunca la vigilancia, mantenimiento y protección del alcantarillado sanitario. Indica que dicha responsabilidad es de la Municipalidad de Turrialba, y que el Ministerio de Salud le ha girado a ésta órdenes sanitarias y hasta interpuso una denuncia ante la Fiscalía de Turrialba el 02 de julio de 2004. Solicita que se desestime el recurso planteado.
  3. 3Informan bajo juramento Manolo Alfonso Bogantes Bolaños y Carmen Machado Montoya, en su condición de Alcalde Municipal y Presidente del Concejo Municipal de Turrialba (folio 53), que los servicios de acueductos y alcantarillado sanitario de la Urbanización Carmen Lyra son administrados por la ASADA de Carmen Lyra, siendo el ente rector el AyA, por lo que no es competencia de la Municipalidad. Indican que las acciones para el correcto desfogue de aguas negras y residuales es competencia del Ministerio de Salud, que fue quien aprobó la planta de tratamiento de aguas negras que actualmente se encuentra bajo responsabilidad y manejo de la ASADA, ente encargado de brindar el servicio bajo la regulación de AyA. Es decir, compete a dicho Ministerio y al AyA el control y la supervisión técnica de los sistemas de alcantarillado y al Aya la administración y operación de éstos. Añaden que, según los informes rendidos por el Gestor Ambiental y el Coordinador de Desarrollo Urbano, no se registra ningún tipo de denuncia tramitada por el recurrente, de modo que los hechos acusados no han sido puestos en conocimiento de las autoridades municipales.Manifiestan que la Comisión para el Ordenamiento y Manejo de la Cuenca del Río Reventazón dirigió una nota al presidente de la ASADA relacionada al manejo de aguas residuales y escorrentía. Señalan que la conservación y protección ecológica de las cuencas hidrográficas y el control de la contaminación del agua compete al Instituto Costarricense de Acueductos y Alcantarillados. Solicita que se desestime el recurso planteado.
  4. 4Informa bajo juramento Giselle Solano Fernández, en su calidad de Directora del Área Rectora del Ministerio de Salud en Turrialba (folio 70), y lo hace remitiendo el expediente administrativo de la Planta de Tratamiento Carmen Lyra de Turrialba. Mediante escrito presentado en la Secretaría de esta Sala a las 09:18 horas del 28 de mayo de 2010 (folio 74), informa sobre inspección realizada en conjunto con funcionarios de la Municipalidad y de la ASADA.
  5. 5Informa bajo juramento Eduardo Leazma Fernández, en su condición de Subgerente General del Instituto Costarricense de Acueductos y Alcantarillados (folio 81), que solicita se incluya como parte en este proceso al Instituto Nacional de Vivienda y Urbanismo, por ser a quien compete velar por la protección de las áreas de recarga acuífera, entre otras competencias que son de interés en el presente asunto. Indica que el proyecto de interés social Carmen Lyra no cuenta con trámites ni aprobación de planos ante el Área Funcional de Urbanizaciones; puesto que el desarrollador del proyecto no cumplió con la construcción adecuada del acueducto, con las exigencias técnicas de diseño, financiamiento ni garantía de las obras, de modo que no se aprobó ni recibió dicho proyecto ni se presta servicio por parte del Instituto. Añade que según la ley constitutiva del Instituto, es un requisito obligatorio de todo proyecto constructivo habitacional contar de previo con la autorización de AyA, bajo pena de nulidad; siendo que en este caso no se ha manifestado técnicamente dicho beneplácito ni se ha emitido la disponibilidad del servicio, que es requerimiento necesario para que el gobierno local genere el permiso constructivo. Solicita que se desestime el recurso planteado.
  6. 6Informa bajo juramento Eugenia Vargas Gurdián, en su condición de Presidenta Ejecutiva del Instituto Nacional de Vivienda y Urbanismo (folio 107), que el proyecto habitacional de interés social Carmen Lyra no fue desarrollado por esa institución. Señala que en los casos de construcción de urbanizaciones, el papel del INVU se limita a recibir los planos y distribuirlos a las diversas instancias encargadas de revisarlos y aprobarlos. Esta función de revisión desde el punto urbanístico de las obras no tiene relación con los sistemas de alcantarillado, drenaje pluvial u otros, que son competencia de AyA y del Ministerio de Salud; siendo que el INVU se limita a verificar el cumplimiento del artículo IV.16 del Reglamento de Construcciones relativo a la instalación de servicios públicos. Solicita que se desestime el recurso en cuanto a su representada.
  7. 7En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta la Magistrada Salazar Cambronero; y,

Considerando:

I.Objeto del recurso. Acusa el recurrente que la planta de tratamiento del proyecto habitacional Carmen Lyra fue abandonada por todas las autoridades encargadas, lo cual trae como consecuencia que las aguas negras se apantanen y contaminen el río Aquiares.

II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:

a. La planta de tratamiento de aguas residuales del proyecto de interés social Carmen Lyra se encuentra inservible y en estado de abandono (hecho no controvertido).

b. El proyecto de interés social Carmen Lyra no cuenta con trámites ni aprobación de planos ante el Área Funcional de Urbanizaciones del Instituto Costarricense de Acueductos y Alcantarillados (folio 84).

III.Sobre el fondo. En reiteradas ocasiones la jurisprudencia de esta Sala ha reconocido que la salud pública y el derecho a un ambiente sano y ecológicamente equilibrado se encuentran reconocidos tanto a nivel constitucional como a través de la normativa internacional; que el ejercicio legítimo de ese derecho requiere que los recursos sean utilizados de manera racional; y que corresponde al Estado la protección del ambiente, según el principio precautorio que rige en materia ambiental. Este principio obliga al Estado a disponer todo lo que sea necesario dentro del ámbito permitido por la ley, a efecto de impedir que se produzcan daños irreversibles en el medio ambiente, debiendo asumir la responsabilidad de lograr las condiciones sociales propicias a fin de que cada persona pueda disfrutar de su salud, entendido tal derecho, como una situación de bienestar físico, psíquico (o mental) y social.

Véase la resolución Nº 180-98, de las 16:24 horas del 13 de enero de 1998. La obligación objetiva del Estado en materia de protección ambiental no apareja, ineludiblemente, un derecho subjetivo de las personas a exigir, a través de los organismos judiciales, que se tome una medida determinada, pero sí a que se adopten las que sean idóneas en tutela de ese derecho, ante actitudes abiertamente negligentes de las autoridades públicas o bien, de personas físicas y jurídicas. De este modo, el Estado adquiere la obligación de regular las áreas de la vida social de las cuales puedan surgir peligros para la existencia física de los habitantes de su territorio así como también aquellas que vulneren el ambiente, lo cual puede hacer a través de la ley, de reglamentos, de acuerdos o de otras medidas relacionadas con la organización y los procedimientos administrativos, y del derecho subjetivo de las personas a que así se proceda, en forma diligente.

En consecuencia, la posibilidad de exigir, judicialmente, a través del recurso de amparo, un tipo específico de actividad prestacional por parte del Estado en cumplimiento de su deber de protección a la vida, salud o derecho al ambiente en beneficio de sus habitantes, está restringida a la clara verificación de un peligro inminente contra esos derechos de las personas. De lo que se desprende que la injerencia de la jurisdicción constitucional solamente es viable ante la inercia comprobada del Estado, a través de sus órganos competentes, en atender las demandas que en ejercicio de sus derechos realicen los habitantes del país.

IV.Sobre el caso concreto. Acusa el recurrente que la planta de tratamiento de aguas residuales del barrio conocido como Carmen Lyra, no está funcionando adecuadamente. Este Tribunal, después de analizar la prueba existente en el bajo la fe de juramento, logra constatar que efectivamente en dicha ubicación la planta de tratamiento de aguas residuales no funciona adecuadamente ni cuenta con la autorización del Instituto Costarricense de Acueductos y Alcantarillados. Estima esta Sala que en el caso concreto efectivamente se ha dado una falta de coordinación entre la Municipalidad de Turrialba, la ASADA Carmen Lyra, el Ministerio de Salud, el AyA y el INVU; a pesar de que cada una de ellas, dentro del ámbito de sus competencias, tienen asignadas funciones que deben estar dirigidas a proteger el ambiente. Sobre el particular, ha dicho la Sala en reiteradas ocasiones que en esta materia es indiscutiblemente necesaria esa coordinación entre las dependencias públicas, ello en aras de garantizar la protección del medio ambiente que es una tarea que corresponde a todos por igual, es decir, que existe una obligación para el Estado –como un todo- de tomar las medidas necesarias para proteger el medio, a fin de evitar grados de contaminación, deforestación, extinción de flora y fauna, uso desmedido o inadecuado de los recursos naturales, que pongan el peligro la salud de los administrados.

Partiendo de lo dicho, no cabe duda de que cualquier omisión al deber de colaboración entre instituciones públicas, podría poner en peligro la protección del ambiente; puesto que la inercia de la Administración en esta materia puede producir un daño al ambiente y a los recursos naturales, de similares o mayores consecuencias que de las derivadas de las actuaciones de la Administración (ver en ese sentido sentencia número 2005-01173 de las 15:11 horas del 08 de febrero de 2005). Para cumplir efectivamente con dicho mandato, se requiere que la Administración Pública -entendida en sentido amplio- disponga las medidas necesarias para que en las comunidades del país se brinde un tratamiento oportuno y efectivo de las aguas residuales, exigiendo para ello todos los estudios técnicos pertinentes. La actuación de los diferentes entes involucrados se encuentra regulada, por ejemplo, en la Ley General de Salud y en la Ley Orgánica del Ambiente, en las que se propugna la responsabilización de las autoridades sanitarias del Poder Ejecutivo junto con los gobiernos locales, en la solución de dificultades como la que ocupa en este amparo.

Tanto en relación con otros órganos o entes del sector público como frente a los particulares, destacan el papel del Ministerio de Salud como rector del área de su especialidad, y el de las Municipalidades de velar por las condiciones de vida de los habitantes del cantón. En el caso específico se traduce en la necesidad de sustentar con criterios técnicos las decisiones que puedan tener incidencia en el ambiente. Se requiere, entonces, la aprobación de proyectos como el acusado por parte de los diferentes entes que intervienen, en el caso concreto, del Instituto Costarricense de Acueductos y Alcantarillados en relación con los sistemas de agua potable y tratamiento de aguas residuales. En otras palabras, los análisis técnicos y evaluaciones de las distintas autoridades competentes determinan la afectación al ambiente dentro del proceso de aprobación de los proyectos; lo que responde al concepto de objetivación del derecho ambiental que no exige solamente cumplir con ciertas formalidades, sino utilizar todos los medios jurídica y fácticamente posibles para preservar el ambiente.

Así, la Municipalidad está llamada a entrar en relaciones de cooperación con otros entes públicos, y viceversa, dado el carácter concurrente o coincidente - en muchos casos-, de intereses en torno a un asunto concreto. Debe existir una debida y obligada coordinación entre el Estado y los entes corporativos locales, cumpliéndose así lo ordenado por esta disposición, sin que ello implique una invasión a la autonomía municipal. En el caso concreto, este deber de coordinación requiere que los entes recurridos reúnan esfuerzos para la consecución del fin común de solventar el problema de alcantarillado y disposición de aguas negras en el proyecto habitacional Carmen Lyra, para poder ofrecer una efectiva tutela del derecho a un ambiente sano y ecológicamente equilibrado, dispuesto en el artículo 50 de la Carta Magna. De los informes rendidos por las autoridades recurridas, se desprende que ninguna entidad ha asumido completamente sus funciones y responsabilidad en relación con el manejo del alcantarillado y disposición de aguas negras de la Urbanización Carmen Lyra, más allá de una denuncia presentada por el Área Rectora de Salud.

Así las cosas, estima este Tribunal que las autoridades cuestionadas no han actuado con contundencia, eficacia ni diligencia para poner fin a esa irregularidad; por ello no es aceptable avalar que permitan la inoperancia de la planta de tratamiento, ni la ausencia de los permisos que el Ordenamiento Jurídico le exige. Con fundamento en las razones expuestas, considera esta Sala que en el caso particular ha existido falta de coordinación, en detrimento del interés público de preservar el derecho al ambiente sano y ecológicamente equilibrado. Por esta razón y en mérito de lo que se ha venido considerando en esta sentencia, se hace indispensable ordenar a los entes involucrados que, cada uno, dentro del ámbito de sus competencias valoren nuevamente el proyecto y dicten las medidas que sean necesarias para sanear integralmente el problema del alcantarillado sanitario y tratamiento de aguas negras del proyecto habitacional Carmen Lyra, ello en aras de preservar el derecho a un ambiente sano y ecológicamente equilibrado y en atención al principio precautorio. En consecuencia, por los motivos ofrecidos anteriormente, el amparo resulta procedente por amenaza al ambiente, como en efecto se declara.

Por tanto:

Se declara con lugar el recurso. Se ordena a Eduardo Leazma Fernández, en su condición de Subgerente General del Instituto Costarricense de Acueductos y Alcantarillados; Giselle Solano Fernández, en su calidad de Directora del Área Rectora del Ministerio de Salud en Turrialba; José Manuel Madrigal Fuentes, en su calidad de Presidente de la Asociación Administradora del Acueducto Potable y Alcantarillado Carmen Lyra de Turrialba; y Manolo Alfonso Bogantes Bolaños, en su condición de Alcalde Municipal de Turrialba; que dentro del plazo de tres meses definan una respuesta final a la disposición de aguas negras y residuales del proyecto habitacional Carmen Lyra, y adopten -cada uno dentro del ámbito de sus competencias- las medidas que sean necesarias para poner a derecho y en funcionamiento la planta de tratamiento de aguas residuales y darle una solución integral al problema de alcantarillado sanitario y tratamiento de las aguas negras, debiendo concluir las obras que se estime necesarias en los doce meses posteriores a la elaboración del plan integral.

Asimismo, se les ordena, en caso de dejar su puesto, poner en conocimiento de sus sucesores esta sentencia y los plazos que ella fija, e informar a esta Sala sobre las actuaciones ordenadas. Se condena al Estado, a la Caja Costarricense de Seguro Social y a la Municipalidad de Turrialba al pago de las costas, daños y perjuicios ocasionados, los cuales se liquidarán en ejecución de sentencia de lo contencioso administrativo. Se advierte a Eduardo Leazma Fernández, en su condición de Subgerente General del Instituto Costarricense de Acueductos y Alcantarillados; Giselle Solano Fernández, en su calidad de Directora del Área Rectora del Ministerio de Salud en Turrialba; José Manuel Madrigal Fuentes, en su calidad de Presidente de la Asociación Administradora del Acueducto Potable y Alcantarillado Carmen Lyra de Turrialba; y Manolo Alfonso Bogantes Bolaños, en su condición de Alcalde Municipal de Turrialba; o a quienes ocupen sus cargos, que, de conformidad con el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Notifíquese a los recurridos la presente resolución EN FORMA PERSONAL. Comuníquese.- Gilbert Armijo S.
