SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at diecisiete horas y cincuenta y uno minutos on veintinueve de marzo del dos mil once.
Amparo proceeding (recurso de amparo) processed under expediente number 08-006616-0007-CO, filed by ALVARO FRANCISCO UGALDE VIQUEZ, identity card 0400900976, of legal age, single, biologist, resident of Barrio Córdoba, against the MINISTRA DE CULTURA, JUVENTUD Y DEPORTES, MINISTRO DE TURISMO, and MINISTRO DEL AMBIENTE, ENERGÍA Y TELECOMUNICACIONES.- Findings of Fact (Resultando):
We consider, as that same Chamber has held on previous occasions, that this right is not limited to abstract enjoyment; rather, it is necessary to assess in each case whether there is actual enjoyment. The right to a healthy and ecologically balanced environment (derecho a un ambiente sano y ecológicamente equilibrado) is not violated, since the integration of these two elements of the right is evident: both the right to a healthy environment and the right to enjoy it. Decree 29277-MINAE does not take Ley 5469 into consideration and violated the provisions of Article 121, subsection 1, of our Political Constitution, because it effectively stripped the Law of its substance—a de facto repeal (derogación por vía de hecho)—disregarding the legislature’s intent and transgressing the limitations established by the Constituent Assembly. Ley 5469 was enacted by the legislature pursuant to Article 105, approved by a qualified two-thirds majority (mayoría calificada de dos terceras partes), vetoed because of the period granted to the Executive Branch to vacate the penitentiary, and approved again by a qualified two-thirds majority on April 25, 1974.
Ley 5469, which remains fully in force, effectively transferred Isla San Lucas to the Municipalidad de Puntarenas, stating that it was to be used as a tourist center and authorizing the Municipality to contract for infrastructure works. Among other matters concerning the Law, it states that, in order to fulfill the specific purposes established in Ley 5469, it is feasible to release 5.5% of the current land area so that it may be used for low-impact, low-density sustainable tourism development (desarrollo turístico sostenible), contributing to the development, study, and maintenance of the Island and the surrounding communities. Executive Decree No. 29277-MINAE, published in La Gaceta No. 30 on Monday, February 12, 2001, was not supported by a comprehensive study addressing the sustainable development (desarrollo sostenible) needs of the Island and the region, including sustainable tourism (turismo sostenible).
The Decree rendered the legislature’s provisions in Ley 5469 devoid of substance, frustrating the fulfillment of the objectives pursued by that Law and, consequently, the intent of the legislature itself. It did not take into account the existence of the former prison buildings on the Island, which have been declared Historical-Architectural Heritage (Patrimonio Histórico-Arquitectónico) and whose history and existence have become known throughout the world through national and foreign literary works and scientific-cultural studies. This omission prevents the Ministerio de Cultura and the Municipality itself from carrying out their conservation, restoration, and national and international promotion, to the detriment of the Convenio de Defensa del Patrimonio Histórico (Ley No. 7555) and its Reglamento 32749. The principle of objectification of environmental protection (principio de objetivación de la tutela ambiental), or the principle of adherence to science and technology (principio de la vinculación a la ciencia y a la técnica), conditions State action to protect the environment on the need for decisions to be accompanied by technical studies.
Another set of principles that must be analyzed consists of the principles of reasonableness (principios de razonabilidad) as a standard of constitutionality and the principle prohibiting arbitrariness (principio de interdicción de la arbitrariedad). It emphasizes that the principle of separation of powers (principio de separación de poderes) has been impaired because an unlawful decree was issued that repealed and stripped a special law of the Republic of its substance. It cites the Código Ético Mundial para el Turismo, which proclaims: “The possibility of direct and personal access to the discovery of the riches of our world shall be a right equally open to all inhabitants of our planet.” Additionally, an analysis of Decree No. 29277-MINAE shows that it neither takes Ley No. 5469 into consideration nor contemplated its existence, even though both concern Isla San Lucas, and it is therefore manifestly null and void.
Nor does it comply with the provisions of Article 36 of the Ley Orgánica del Ambiente. Thus, the appellant proceeds from the premise that the establishment of Refugio de Vida Silvestre Isla San Lucas (Wildlife Refuge) complied with the entire legal system, even though official letter SINAC-DG-517 of March 17, 2008, attached to the MINAE report, supports the conclusion that no prior technical study directly concerning the feasibility of establishing the refuge existed or was commissioned. This omission flagrantly violated the principle prohibiting arbitrariness and the exercise of regulatory authority (potestad reglamentaria). Limits are established whose violation constitutes prohibited arbitrary action lacking validity and effectiveness (validez y eficacia), both under constitutional law and under subconstitutional law (derecho jurídico infraconstitucional). In this regard, it cites judgment 2004-14421.
Regarding the hierarchy of legal norms (jerarquía normativa) as a constitutional value, it refers to legislative expediente No. 5008 (concerning Ley No. 5469), Article 78 of the Ley sobre la Zona Marítimo Terrestre, and Opinion No. C-210-2002 of the Procuraduría General de la República, which it transcribes, emphasizing the following: “Nevertheless, irrespective of any defects the Decree may have, it lacks legal authority to modify the sector’s statutory designation. In opinion C-028-94, we stated that ‘the use assigned by law to an area in the public domain (dominio público) may be changed only by legislative action, and that the use of the area allocated to the Proyecto de Papagayo is tourism.’” It follows from judgment No. 6689-96 that the State is required to take the necessary measures aimed at protecting the environment. It is indeed true that, when the Executive Branch issues a declaration of this kind, it does so pursuant to express statutory authorization and in compliance with its constitutional duties toward the environment.
After transcribing excerpts from the judgment, it argues that the legal instruments are identical in purpose; that is, an attempt has been made to repeal or strip of its substance a special law of the Republic that was approved in four debates and by two different legislatures, including by a qualified majority, and was enacted by the First Branch of the Republic. Thus, the will of the people, delegated to the legislators, yielded to the subjective judgment, unsupported by technical evidence, on which the decree establishing the refuge was based. All of this would entail the violation of the values and principles analyzed, such as separation of powers, the hierarchy of the legal system, and the principle of legality (principio de legalidad), among others. The legislature’s intent, as embodied in Ley 5469, must be implemented. It requests that the action filed be dismissed.
Justice Araya Garcia authors the opinion; and,
Whereas:
I.Subject Matter of the Writ.- The petitioner alleges that the exclusion of one land portion and one marine portion from the Isla San Lucas national wildlife refuge, by an act of the Executive Branch and without the technical studies justifying such a measure, violates the principles of legality and hierarchical order, as well as the constitutional right to enjoy a healthy and ecologically balanced environment, guaranteed by Articles 11 and 50 of the Constitution.
II.Admissibility of the Writ. Regarding standing (legitimación activa) in cases alleging harm to the environment, the Chamber (Sala) has stated:
“Regarding the admissibility of the writ, it is important to state that, pursuant to Article 89 in relation to Articles 21, 10, and 48 of the Political Constitution and Article 33 of the Law on Constitutional Jurisdiction (Ley de la Jurisdicción Constitucional), any person may file an amparo action in defense of the right to preserve the country’s natural resources. Although the petitioner does not suffer direct and clear harm, as would occur in the case of a specific act by the State against an individual, all inhabitants suffer harm from violations of that article in the same proportion as if it were direct harm. They are therefore deemed to possess an interest entitling them to bring an action to protect that right to maintain the ecosystem’s natural balance.” (Judgment N°1700-93 at 15:09 hours on 16 de abril de 1993).
The cited case law applies to the present case; consequently, the writ is admissible.
III.Merits.- For purposes of this writ of amparo, it is essential to indicate that, in the constitutional challenge processed under expediente número 08-0004317-007-CO, this Constitutional Court ruled on the constitutionality of Executive Decree 34282-TUR-MINAE-C, which amended Executive Decree N° 29277-MINAE to permit the protection and reconstruction of the buildings on Isla San Lucas declared Historical-Architectural Heritage by the Ministerio de Cultura, and also to expand and modify the boundaries of the Refugio Nacional de Vida Silvestre Isla San Lucas. In that action, this Chamber determined that the provisions challenged by the petitioner were partially inconsistent with Constitutional Law (Derecho de la Constitución), for which reason it issued judgment No. 2010-013099 at fourteen hours and fifty-six minutes on cuatro de agosto del dos mil diez, stating as follows:
“(...) The arguments in the three consolidated constitutional challenges share as their common denominator the alleged violation of Article 50 of the Constitution due to noncompliance with Article 38 of the Organic Environmental Law (Ley Orgánica del Ambiente). To declare the provision unconstitutional, it is sufficient to establish that the mandate set forth in the latter article was breached when the size of the protected wildlife area was modified. Article 38 states: ‘The surface area of protected wildlife areas constituting the natural heritage of the State, regardless of their management category, may be reduced only by a Law of the Republic, after completion of the technical studies justifying that measure.’ Accordingly, the Executive Branch may not reduce those areas without observing the legislative and technical procedure. The Chamber therefore partially grants the action and annuls Article 1° solely insofar as it excludes from the protected area of the Refugio Nacional de Vida Silvestre Isla San Lucas the ‘5.5% of the current area for the protection of cultural heritage,’ due to violation of Articles 11, 50, and 89 of the Constitution, but not insofar as it adds the marine sector and islets, since the Executive Branch is permitted to adopt that measure by Executive Decree.”
Accordingly, on that occasion the Chamber held Article 1° of Executive Decree No. 34282-TUR-MINAET-C dated 25 de enero de 2008, published in Supplement 10 to La Gaceta No. 28 of 8 de febrero de 2008, to be unconstitutional and annulled it from the legal system because it modifies subsection a) of Article 1 of Executive Decree No. 33327-MINAE; however, it exempted from that declaration the addition of the portion of water added to the Refugio Nacional de Vida Silvestre Isla San Lucas and Section B, which remains in force. This is because, as the Chamber stated, once a particular area has been designated as a protected zone by an act of the State, the State may not simply remove that designation (desafectarlo), in whole or in part, to protect other interests—public or private—to the detriment of the enjoyment of a healthy environment, pursuant to Article 50 of the Constitution.
IV.Protection of Cultural Heritage.- In the previously cited judgment, the Chamber determined that the significance of the allegations in the action at issue lies precisely in establishing the extent to which the protection and preservation of the National and Cultural Heritage must be guaranteed, and how this must be reconciled with the right to a healthy and ecologically balanced environment. For those purposes, the Chamber found that the passage of decades had allowed the secondary forest to regenerate, while the lack of maintenance of the historic center had caused its progressive deterioration and posed a threat to the historical and cultural assets existing on Isla San Lucas. In view of the foregoing, the cited judgment held that:
“Assets of cultural interest require protection and conservation measures in the environment in which they are located so that they may be distinguished as tourism resources; otherwise, the State’s omission would constitute unlawful abandonment from a constitutional standpoint and in light of the international treaties in force in the Republic. In addition, conservation entails ensuring protection and permanence within the context of the values and customs inherent to urban and rural areas, and therefore sustainability criteria and practices must be accepted. The administration and development of the asset must be protected, and the asset must be enhanced in accordance with the characteristics of its environment; therefore, if it consists of human-made infrastructure, this will entail technical management requiring maintenance and investment measures to ensure both its development when its value is brought to the fore and its conservation.
In the case of Isla San Lucas, subsection f) of section 38 of the Ley Orgánica del Ambiente applies insofar as there are not only elements of natural heritage, since, as a site containing historic and archaeological buildings, they are important to national culture and identity,” Accordingly, a form of low-ecological-impact rural tourism that complies with environmental regulations is compatible with Constitutional Law (Derecho de la Constitución), particularly Article 89 of the Constitución Política, which establishes cultural objectives, including protecting natural beauty and preserving and developing historical heritage, whose value is enhanced by the access the population may have to it. Therefore, as the Chamber states in the aforementioned decision, no incompatibility has been demonstrated between environmental protection and the conservation of cultural assets made available to humanity, on the one hand, and a project that must be developed in full compatibility with the environment, on the other.
Consequently, works that failed to take into account the protection regimes in force on the Island, such as the construction of large-scale infrastructure works, would be constitutionally questionable, because the continued application of its status as a protected area would entail a substantial change in land use (uso de suelo), unlike the human-made structures that existed long before the Island was designated a Protected Wildlife Area (Área Silvestre Protegida) and historical-architectural heritage site. Hence, the Chamber does not find that Articles 2, 3, 4, 6, and 7 of Decreto Ejecutivo 34282-TUR-MINAET-C contain constitutional defects; it is therefore evident that the respondent authority’s application of the regulations at issue is neither arbitrary nor disproportionate and that, accordingly, the resulting legal effects fall within our Legal System (Ordenamiento Jurídico).
V.Conclusion.- In view of the foregoing, the proper course is to grant the action solely insofar as the decree was unconstitutional because it reduced the protected area in question without satisfying the requirements necessary for that purpose. Nevertheless, the action is denied with respect to the use authorized therein.

The action is partially granted under the terms established in judgment No. 2010-13099. The State is ordered to pay the legal costs and the damages and losses caused by the facts underlying this declaration, which shall be assessed during enforcement proceedings before the administrative litigation jurisdiction (contencioso administrativo).

SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las diecisiete horas y cincuenta y uno minutos del veintinueve de marzo del dos mil once.
Recurso de amparo que se tramita en expediente número 08-006616-0007-CO, interpuesto por ALVARO FRANCISCO UGALDE VIQUEZ, cédula de identidad 0400900976, mayor, soltero, biólogo, vecino de Barrio Córdoba contra la MINISTRA DE CULTURA, JUVENTUD Y DEPORTES, MINISTRO DE TURISMO y el MINISTRO DEL AMBIENTE, ENERGÍA Y TELECOMUNICACIONES.-
Resultando:
Redacta el Magistrado Araya Garcia; y,
Considerando:
I.Objeto del recurso.- El recurrente alega que la exclusión de una porción terrestre y otra marina del refugio nacional de vida silvestre Isla San Lucas, mediante acto del Poder Ejecutivo y sin contar con los estudios técnicos que justifiquen tal medida, vulnera el principio de legalidad y orden jerárquico, así como el derecho constitucional a disfrutar de un ambiente sano y ecológicamente equilibrado, garantizados en los artículos 11 y 50 constitucionales.
II.Sobre la admisibilidad del recurso. La Sala ha señalado en cuanto a la legitimación activa en casos en que se acuse la lesión al medio ambiente:
"En cuanto a la admisibilidad del recurso, es importante expresar que cualquier persona se encuentra, de conformidad con el artículo 89 en relación con el 21, 10 y 48 de la Constitución política y 33 de la Ley de la Jurisdicción Constitucional, para interponer el amparo en defensa del derecho a la conservación de los recursos naturales del país. A pesar de no existir un perjuicio directo y claro para el accionante como en el caso de un acto concreto del Estado en contra de un particular, todos los habitantes, en cuanto a las transgresiones al artículo, sufren un perjuicio en la misma proporción que si se tratara de un daño directo, por lo que se considera que existe en su favor un interés que los faculta a accionar para proteger ese derecho a mantener un equilibrio natural en el ecosistema." (Sentencia N°1700-93 de las 15:09 horas del 16 de abril de 1993).
La jurisprudencia citada es aplicable en el presente caso, en consecuencia, el recurso es admisible.
III.Sobre el fondo.- Para efectos del presente recurso de amparo, resulta indispensable indicar, que en la acción de inconstitucionalidad tramitada bajo expediente número 08-0004317-007-CO, este Tribunal Constitucional se pronunció en cuanto a la constitucionalidad del Decreto Ejecutivo 34282-TUR-MINAE-C, que modificaba el Decreto Ejecutivo N° 29277-MINAE con la finalidad de permitir la protección y reconstrucción de las edificaciones en la Isla San Lucas declaradas Patrimonio Histórico - Arquitectónico por el Ministerio de Cultura y también para ampliar y modificar los límites del Refugio Nacional de Vida Silvestre Isla San Lucas. En dicha acción, esta Sala determinó que la normativa que cuestiona el recurrente riñe parcialmente con el Derecho de la Constitución, razón por la cual emitió la sentencia No. 2010-013099 de las catorce horas y cincuenta y seis minutos del cuatro de agosto del dos mil diez, en la cual indicó lo siguiente:
"(...)Los argumentos en las tres acciones de inconstitucionalidad acumuladas tienen como común denominador la aludida infracción al artículo 50 constitucional, por la inobservancia del artículo 38 de la Ley Orgánica del Ambiente. Para declarar la inconstitucionalidad basta comprobar que fue incumplido el mandato establecido en este último numeral, al modificar la cabida del área silvestre protegida. El numeral 38 indica que: “La superficie de las áreas silvestres protegidas, patrimonio natural del Estado, cualquiear sea su categoría de manejo, sólo podrá reducirse por Ley de la República, después de realizar los estudios técnicos que justifiquen esta medida”. De ahí que el Poder Ejecutivo no puede reducir éstas áreas sin observar el procedimiento legislativo y técnico, razón por la cual, la Sala declara parcialmente con lugar la demanda para anular el artículo 1° únicamente en cuanto excluye del área protegida del Refugio Nacional de Vida Silvestre Isla San Lucas, el “5.5% del área actual para la protección del patrimonio cultural”, lo anterior por infracción a lo dispuesto por los artículos 11, 50 y 89 constitucionales, y no en cuanto a la adición del sector marino e islotes, toda vez que ello es permitido al Poder Ejecutivo acordarlo mediante Decreto Ejecutivo".
Así las cosas, en esta ocasión la Sala consideró que el artículo 1° del Decreto Ejecutivo No. 34282-TUR-MINAET-C de 25 de enero de 2008, publicado en el Alcance 10 a La Gaceta No. 28 del 8 de febrero de 2008, es inconstitucional y lo anuló del ordenamiento jurídico debido a que modifica el inciso a) del artículo 1 del Decreto Ejecutivo No. 33327-MINAE; sin embargo, exceptúa de dicha declaratoria la adición de la porción de agua que se agrega al Refugio Nacional de Vida Silvestre Isla San Lucas y el apartado B que mantiene su vigencia. Lo anterior, por cuanto tal y como lo indicó, una vez declarada una determinada área como zona protectora por un acto del Estado, no puede éste, simplemente, desafectarlo en todo o en parte, para proteger otros intereses –públicos o privados- en menoscabo del disfrute de un ambiente sano, de conformidad con lo dispuesto en el artículo 50 constitucional.
IV.En cuanto a la protección al patrimonio cultural.- En la sentencia previamente citada, la Sala analizó que la importancia de lo denunciado en la acción en cuestión precisamente radica en determinar en qué grado debe garantizarse la protección y conservación del Patrimonio Nacional y Cultural, y cómo se debe conciliar éste con el derecho a un ambiente sano y ecológicamente equilibrado. Para tales efectos, la Sala constató que el paso de las décadas ha permitido la regeneración del bosque secundario, así como la falta de mantenimiento del centro histórico ha provocado su deterioro progresivo y la amenaza sobre los bienes históricos y culturales existentes en la Isla San Lucas. En virtud con lo anterior dispuso en la sentencia de cita que:
"Los bienes de interés cultural requieren de protección y medidas conservacionistas en el medio en que se encuentran, para que se le pueda singularizar como recurso turístico, o de lo contrario la omisión del Estado implicaría un abandono ilícito desde el punto de vista constitucional y a la luz de los tratados internacionales vigentes en la República. Aunado a lo anterior, conservar implica la idea de asegurar protección y permanencia, dentro del contexto de los valores y costumbres propios de los espacios urbanos y rurales, por lo que se deben admitir criterios y prácticas de sustentabilidad. La administración y el desarrollo del bien se debe proteger, así como realzar el bien según las características en su medio ambiente, por lo que si se trata de infraestructura creada por el hombre, implicará un manejo técnico, que exige medidas de mantenimiento e inversión para asegurarle el desarrollo a la hora de ser puesto en valor, como su conservación.
En el caso de la Isla San Lucas, el inciso f) del numeral 38 de la Ley Orgánica del Ambiente aplica en el tanto existen no solo elementos del patrimonio natural, pues como sitio con edificaciones históricos, y arqueológicos, son importantes para la cultura e identidad nacional", De esta manera, un tipo de turismo rural de bajo impacto ecológico respetuoso de la normativa ambiental, resulta compatible con el Derecho de la Constitución, en especial con el artículo 89 de la Constitución Política que fija los objetivos culturales, entre ellos: proteger las bellezas naturales, conservar y desarrollar el patrimonio histórico, y cuyo valor se potencia en el acceso que pueda tener de él la población. Por ello, según indica la Sala en la resolución aludida no se demuestran incompatibilidades entre la protección al ambiente y la conservación de bienes culturales puestos a disposición de la humanidad, con un proyecto que debe desarrollarse y ser compatible integralmente con el ambiente.
En consecuencia, serían cuestionables constitucionalmente si se realizaran obras que no tuvieran en cuenta los regímenes de protección vigentes en la Isla, como la construcción de obras de infraestructura de gran envergadura, dado que la vigencia del régimen como área protegida implicaría un cambio sustancial al uso de suelo, y no por las obras humanas que existieron mucho antes de la declaratoria de la Isla como Área Silvestre Protegida y de patrimonio histórico-arquitectónico. De ahí que, no estima la Sala que los artículos 2, 3, 4, 6 y 7 del Decreto Ejecutivo 34282-TUR-MINAET-C presenten vicios de constitucionalidad por lo que es evidente que la actuación de la autoridad recurrida de aplicar la normativa en cuestión no resulta arbitraria, ni desproporcionada y, por lo tanto, los efectos jurídicos que se hayan producido se enmarcan dentro de nuestro Ordenamiento Jurídico.
V.Conclusión.- En mérito de lo expuesto, lo procedente es declarar con lugar el recurso únicamente en cuanto a que el decreto resultó inconstitucional por reducir el área de protección en cuestión, sin los requisitos necesarios al efecto. No obstante, sin lugar en cuanto al uso que se autorizó al mismo.
Por tanto:
Se declara parcialmente con lugar el recurso, en los términos establecidos en la sentencia No. 2010-13099. Se condena al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contenciosos administrativo.
