Amparo action (recurso de amparo) processed under expediente número 11-001777-0007-CO, filed by MAURICIO MARIN SEVILLA, identity card 0108260001, on behalf of LA ASOCIACION DE DESARROLLO INTEGRAL DE LA RESERVA INDIGENA BRIBRI DE KËKÖLDI, legal entity identification number 3-002-084794, against EL INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS, EL MINISTERIO DE AMBIENTE, ENERGIA Y TELECOMUNICACIONES, and LA SECRETARIA TECNICA NACIONAL AMBIENTAL.

Resultando:

  1. 1In a written submission received by the Secretariat of the Chamber at 16:30 hrs. on 14 de febrero del 2011, the petitioner filed an amparo action against the Instituto Costarricense de Acueductos y Alcantarillados, the Ministerio de Ambiente, Energía y Telecomunicaciones, and the Secretaría Técnica Nacional Ambiental, stating that the Instituto Costarricense de Acueductos y Alcantarillados intends to undertake a project known as “Alcantarillado Sanitario de Puerto Viejo y Cocles,” in the Provincia de Limón. To that end, it began the illegal felling of trees and the opening of a trail or road to reach the site of the new treatment plant. This action was carried out arbitrarily and without prior notice to the residents of the Reserva Indígena Bribrí de Këköldi, located in Cocles de Manzanillo. In response, members of the indigenous community and of the Asociación de Desarrollo Integral de la Reserva Indígena Bribrí de Këköldi requested information from the Secretaría Técnica Nacional Ambiental concerning the works within the protected area, where they were informed that the respondent Instituto had not applied for environmental feasibility approval (viabilidad ambiental) for the project.He alleges that the respondent authorities plan to discharge sewage from the treatment or collection plant into Río Cocles, which empties onto playa Cocles and whose waters flow through important mangroves and aquifers in the area, particularly through the Refugio Nacional de Vida Silvestre de Gandoca–Manzanillo and the protected area of Cocles. He reiterates that the respondents are indiscriminately felling primary forests and native species of the area, including species that are endangered. Furthermore, these works are being performed without any form of supervision or regulation and in violation of the law, because the corresponding studies and permits required to protect the soil and biodiversity of the area in question have not been obtained. He considers that the acts and omissions attributable to the respondent authorities infringe his fundamental rights.
  2. 2By an order issued at 14:19 hrs. on 16 de febrero del 2011, the amparo action was admitted for processing and reports were requested from the respondent authorities.
  3. 3Teófilo de la Torre Argüello, in his capacity as Ministro de Ambiente, Energía y Telecomunicaciones, states under oath that he has no personal knowledge of any of the facts alleged by the petitioner because, after reviewing the database maintained by the Ministerio, it was established that Mauricio Marín Sevilla had not filed an environmental complaint concerning the alleged violation of legislation protecting the environment and natural resources arising from the development of the project known as Alcantarillado Sanitario de Puerto Viejo y Cocles in the Reserva Indígena Bribrí de Këköldi. The petitioner’s allegation that the Ministerio failed to take action to prevent significant adverse environmental harm is therefore untrue, since no formal complaint concerning environmental damage had been filed. He adds that, in any event, given the seriousness of the alleged facts, the matter was referred to the Tribunal Ambiental Administrativo, the decentralized body of that Ministerio with jurisdiction to hear and process complaints concerning violations of legislation protecting the environment and natural resources, so that the investigations necessary to establish the substantive truth of the facts may be conducted.
  4. 4Uriel Juarez Baltodano, in his capacity as ad hoc Secretario General of the Secretaría Técnica Nacional Ambiental, states under oath that, after the various databases were reviewed, it was determined that there is no record whatsoever concerning this case. The referenced project has not been submitted for the corresponding environmental assessment (evaluación ambiental).
  5. 5José Madrigal García, in his capacity as Director de la Región Huetar Atlántica of the Instituto Costarricense de Acueductos y Alcantarillados, states under oath that the Alcantarillado Sanitario de Puerto Viejo y Cocles project is part of the Programa de Abastecimiento de Agua Potable para el Area Metropolitana de San José, Acueductos Urbanos y Alcantarillado Sanitario de Puerto Viejo de Limón, which is financed through loan agreement 1725 AyA/Banco Centroamericano de Integración Económica (BCIE) and the corresponding national counterpart funding. Regarding the alleged illegal felling, he states that the petitioner’s accusation that primary forests and native species of the area are being felled indiscriminately, much less endangered species, is entirely false. To that effect, he alleges that, pursuant to report SUB-G-AID-UEN-EyP-2011-172, several possible sites have been analyzed to date, including land belonging to Héctor Umaña Chavarría.Verbal permission to conduct the relevant studies was obtained from that individual, who is duly recognized as the possessor of real property located within the Reserva Indígena Bribrí de Këköldi, so that topographic surveys could be performed. According to that report, on “3 de junio del 2010, a technical surveying team … entered the AyA site of interest by the route shown by Mr. Umaña Chavarría. It should be noted that the route traveled and the site visited consist predominantly of an abandoned cacao plantation. The property was entered by a route that Mr. Umaña described as a road that he had used for decades and that this road was an access route used by the indigenous inhabitants of the Reserva….” Furthermore, report SUB-G-AID-UEN-EyP-2010-1078 states that “no fruit tree was cut down, nor was any utility pole or fence destroyed, much less was there total destruction of 40 m2. Only molasses grass and/or branches of abandoned cacao trees were cut, as was essential to position and operate the usual surveying equipment….” He states that, in addition, the corresponding permission was obtained from the Asociación de Desarrollo Integral de la Reserva Indígena Bribrí de Këköldi, as was the approval of the Comisión Nacional de Asuntos Indígenas (CONAI), for the PTAR to be constructed within that reserve should the technical studies so recommend.He further states that the project serves the public interest because it will be constructed to improve and eliminate the practice of discharging wastewater into drainage channels and gutters, necessitated by the inefficiency of the septic tanks and drainage systems built within the project area, and to improve the quality of the groundwater in the study area. 2 sanitary sewer branches will be constructed. One would begin near the former Puerto Viejo airport and the other at the private primary school in Punta Uva. Both branches will drain toward the community of Cocles, where the PTAR will be located. Approximately 17 kilómetros of sanitary sewer network will be constructed using plastic pipes with watertight seals, with diameters of 150 and 200 mm. The sewer network will include the manholes necessary for its proper operation and maintenance. Pumping wells will also be constructed so that the pipes can be laid at a maximum depth of 4 metros.An aerobic treatment plant for ordinary wastewater will be designed and constructed, and its treated effluent will be discharged into Río Cocles or Río Caño Negro. The February 2011 progress report entitled “Terrenos para la Planta de Tratamiento para las Aguas Residuales de Cocles y Puerto Viejo de Limón” states: “Given the characteristics … it is recommended that the land belonging to Mr. Alejo Pacheco be selected for construction of the treatment plant…. This land is located outside the Reserva Indígena Kekóldi, outside the Reserva Nacional de Vida Silvestre Gandoca-Manzanillo, and also outside the Zona Marítimo Terrestre ZMT…. It offers the advantage of … an extensive boundary with Río Caño Negro.” He clarifies that the final discharge of wastewater from the treatment plant is precisely the result of an entire process intended to significantly reduce elements that pollute the environment, in compliance with the discharge limits specified in the Reglamento de Vertidos.This is intended to protect not only the aquifers, mangroves, biodiversity, and the environment in general, but also the health of the inhabitants of those communities, while improving their quality of life and promoting sustainable development in the area. Regarding the project’s permitting process, the project is currently at the preliminary design stage under the Dirección de Estudios y Proyectos del AyA, and therefore no permit has yet been processed before SETENA or any other institution. The reason it remains at that stage is the difficulty of technically recommending a site that meets all the conditions required for locating a wastewater treatment plant while producing the least possible environmental and social impact, because environmentally fragile areas are located within that region. In addition to the permits obtained for the preliminary studies and investigations, coordination meetings have been held with personnel from the Dirección de Conservación de Vida Silvestre del Caribe Sur and the Oficina Convenio entre la Municipalidad de Talamanca-SINAC, for the purpose of coordinating what is necessary for the project.He concludes that AyA is not constructing the reported treatment plant and will not do so until a suitable site has been secured, the designs have been prepared, and the environmental impact studies (estudios de impacto ambiental) requested by SETENA have been completed.
  6. 6Eduardo Lezama Fernández, in his capacity as Subgerente General of the Instituto Costarricense de Acueductos y Alcantarillados, reports in terms similar to those used by the Director de la Región Huetar Atlántica of that institution.
  7. 7The legal requirements have been observed in the processing of these proceedings.

Drafted by Magistrado Armijo Sancho; and,

Considerando:

I.Purpose of the remedy of amparo (recurso de amparo). The appellant alleges that the Instituto Costarricense de Acueductos y Alcantarillados intends to construct a wastewater treatment plant (planta de tratamiento de aguas residuales) within the Reserva Indígena Bribrí de Këköldi as part of the “Alcantarillado Sanitario de Puerto Viejo y Cocles” project. He claims that the institution has already begun the work by clearing a trail or road to reach the treatment plant construction site and by illegally and indiscriminately cutting down trees, affecting primary forests and native species in the area, including species that are endangered. As an aggravating circumstance, before such work began, no notice whatsoever was given to the Asociación de Desarrollo Integral de la Reserva Indígena Bribrí de Këköldi, nor was the corresponding environmental approval (viabilidad ambiental) obtained from the Secretaría Técnica Nacional Ambiental. He also complains that the Instituto Costarricense de Acueductos y Alcantarillados intends to discharge the plant’s sewage into the Río Cocles, which flows into Playa Cocles and passes through important mangroves and aquifers in the area and, in particular, through the Refugio Nacional de Vida Silvestre de Gandoca-Manzanillo.

II.Merits. The authorities of the Instituto Costarricense de Acueductos y Alcantarillados refute the appellant’s various allegations and state in their reports—which were submitted under oath, after due warning of the consequences, including the criminal consequences, provided for in Article 44 of the Ley de la Jurisdicción Constitucional—that the institution has not begun construction of the aforementioned treatment plant, nor has it carried out the alleged cutting of trees. They explain that, to date, the project remains in the preliminary design stage (etapa de pre-diseño), and the site where the treatment plant might be constructed has not even been determined. In fact, various properties are currently being studied and analyzed in order to determine which would be most suitable for that purpose; it is therefore untrue that a decision has already been made to construct the plant within the Reserva Indígena Bribrí de Këköldi.

Moreover, only once that matter has been determined may the plant’s design stage begin, along with the corresponding process of applying for and obtaining the permits and authorizations necessary to construct the aforementioned sewerage system. Finally, they state that the purpose of constructing the treatment plant is to ensure that the water ultimately discharged has undergone a process that significantly reduces environmentally polluting substances, in accordance with the applicable regulations, including the parameters and limits established in the Reglamento de Vertido y Reuso de Aguas Residuales. They state that the aim is thereby to protect aquifers, mangroves, and the environment in general, as well as to safeguard the health of the area’s inhabitants. Accordingly, this Chamber does not find that the case under review involves a violation or threat of violation of the protected party’s (amparada) fundamental rights.

As already stated, and in light of the evidence submitted in the proceedings, it has not been established that the Instituto Costarricense de Acueductos y Alcantarillados has already begun construction of the treatment plant without first obtaining the corresponding permits or authorizations—in breach of its duty to guarantee, defend, and preserve the fundamental right to a healthy and ecologically balanced environment. On the contrary, it is established that the institution is only at the initial preliminary design stage of the aforementioned sanitary sewerage project. The amparo is therefore clearly premature. Nor has it been established that the institution carried out the alleged cutting of trees. In any event, it should be noted that the Ministro del Ambiente, Energía y Telecomunicaciones reports that this matter has been referred to the Tribunal Ambiental Administrativo so that the corresponding administrative investigation may be conducted.

The protected party may therefore appear before that Tribunal to raise her objections so that they may be examined with the appropriate breadth of evidence. For the foregoing reasons, the amparo under review must be dismissed, as hereby ordered.

Por tanto:

The remedy is DENIED.

SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las once horas y tres minutos del once de marzo del dos mil once.

Recurso de amparo que se tramita en expediente número 11-001777-0007-CO, interpuesto por MAURICIO MARIN SEVILLA, cédula de identidad 0108260001, a favor de LA ASOCIACION DE DESARROLLO INTEGRAL DE LA RESERVA INDIGENA BRIBRI DE KËKÖLDI, cédula jurídica número 3-002-084794, contra EL INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS, EL MINISTERIO DE AMBIENTE, ENERGIA Y TELECOMUNICACIONES y LA SECRETARIA TECNICA NACIONAL AMBIENTAL.

Resultando:

  1. 1Por escrito recibido en la Secretaría de la Sala a las 16:30 hrs. del 14 de febrero del 2011, el recurrente interpone recurso de amparo contra el Instituto Costarricense de Acueductos y Alcantarillados, el Ministerio de Ambiente, Energía y Telecomunicaciones y la Secretaría Técnica Nacional Ambiental, en el que manifiesta que el Instituto Costarricense de Acueductos y Alcantarillados pretende realizar un proyecto denominado “Alcantarillado Sanitario de Puerto Viejo y Cocles”, en la Provincia de Limón. Para lo cual inició las obras de tala ilegal de árboles y la apertura de una trocha o camino para llegar a la zona de ubicación de la nueva planta de tratamiento. Actuación que se llevó a cabo de forma arbitraria y sin mediar comunicación previa a los vecinos de la Reserva Indígena Bribrí de Këköldi, ubicada en Cocles de Manzanillo. Ante tal situación, miembros de la comunidad indígena y de la Asociación de Desarrollo Integral de la Reserva Indígena Bribrí de Këköldi solicitaron información ante la Secretaría Técnica Nacional Ambiental respecto a las obras dentro del área protegida, donde se les indicó que el Instituto recurrido no había solicitado la viabilidad ambiental para dicho proyecto.Alega que las autoridades accionadas planean que las aguas negras de la planta o de captación sean depositadas en Río Cocles, el cual desemboca en playa Cocles, y cuyo caudal pasa por importantes manglares y acuíferos de la zona, en especial por el Refugio Nacional de Vida Silvestre de Gandoca– Manzanillo y la zona protegida de Cocles. Reitera que los recurridos están talando en forma indiscriminada bosques primarios y de especies nativas de la zona, que incluso se encuentran en peligro de extinción. Por otra parte, dichas obras se efectúan sin ningún tipo de supervisión o regulación y al margen de la ley al no contar con los estudios y permisos correspondientes, a efecto de proteger los suelos y la biodiversidad de la zona en cuestión. Considera que las acciones y omisiones atribuibles a las autoridades recurridas lesionan sus derechos fundamentales.
  2. 2Mediante resolución de las 14:19 hrs. del 16 de febrero del 2011 se dio curso al amparo y se solicitó informes a las autoridades recurridas.
  3. 3Informa bajo juramento Teófilo de la Torre Argüello, en su calidad de Ministro de Ambiente, Energía y Telecomunicaciones, que no le consta ninguno de los hechos alegados por el recurrente, ya que revisada la base de datos que lleva el Ministerio, se ha podido constatar que Mauricio Marín Sevilla no ha interpuesto una denuncia de carácter ambiental, referente a la supuesta violación a la legislación tutelar del ambiente y los recursos naturales, producto del desarrollo del proyecto denominado Alcantarillado Sanitario de Puerto Viejo y Cocles, en la Reserva Indígena Bribrí de Këköldi. Por lo que no es cierto el alegato del recurrente, en el sentido que el Ministerio no ha tomado acciones a fin de evitar daños ambientales negativos significativos, al no haber interpuesto formalmente una denuncia por daños ambientales. Añade que, en todo caso, ante la gravedad de los hechos acusados, se procedió a trasladar el asunto al Tribunal Ambiental Administrativo, por ser el órgano desconcentrado de dicho Ministerio con competencia para conocer y tramitar las denuncias por violaciones a la legislación tutelar del ambiente y los recursos naturales, para que se realicen las investigaciones necesarias para establecer la verdad real de los hechos.
  4. 4Informa bajo juramento Uriel Juarez Baltodano, en su condición de Secretario General ad hoc de la Secretaría Técnica Nacional Ambiental, que luego de revisarse las distintas bases de datos se logró determinar que no consta registro alguno sobre este caso. No se ha presentado el referido proyecto para la respectiva evaluación ambiental.
  5. 5Informa bajo juramento José Madrigal García, en su condición de Director de la Región Huetar Atlántica del Instituto Costarricense de Acueductos y Alcantarillados, que el proyecto de Alcantarillado Sanitario de Puerto Viejo y Cocles forma parte del Programa de Abastecimiento de Agua Potable para el Area Metropolitana de San José, Acueductos Urbanos y Alcantarillado Sanitario de Puerto Viejo de Limón, que se encuentra financiado mediante el contrato de préstamo 1725 AyA/Banco Centroamericano de Integración Económica (BCIE) y la correspondiente contrapartida nacional. En cuanto a la acusada tala ilegal, indica que es absolutamente falso lo acusado por el recurrente, al señalar que se están talando de forma indiscriminada bosques primarios y de especies nativas de la zona, y mucho menos especies que se encuentren en peligro de extinción. Alega, al efecto, que de conformidad con el informe SUB-G-AID-UEN-EyP-2011-172, a la fecha se han analizado varias opciones de terreno, incluido un terreno perteneciente a Héctor Umaña Chavarría.Para realizar los estudios respectivos se obtuvo permiso verbal de dicha persona, quien está debidamente acreditada como poseedora de un inmueble ubicado dentro de la Reserva Indígena Bribrí de Këköldi, para realizar los estudios topográficos. Según tal informe, el día “3 de junio del 2010, un equipo técnico de topografía… ingresó al sitio de interés del AyA por la ruta mostrada por el señor Umaña Chavarría. Vale señalar que el camino recorrido y el sitio visitado es mayoritariamente un cacaotal abandonado. El ingreso al terreno se realizó por una ruta que el señor Umaña indicó que se trataba de un camino que durante décadas él ha utilizado y que ese camino corresponde a un acceso transitado por los indígenas de la Reserva…”. Por otra parte, en el informe SUB-G-AID-UEN-EyP-2010-1078 se indica que “no se realizó la corta de ningún árbol frutal, ni la destrucción de ningún poste de luz ni cerca alguna y mucho menos la total destrucción de 40 m2.Sólo se cortó la melaza y/o ramas de cacaoteros abandonazo que fue imprescindible para colocar y operar el equipo topográfico usual…”. Afirma que, complementariamente, se obtuvo el permiso correspondiente por parte de la Asociación de Desarrollo Integral de la Reserva Indígena Bribrí de Këköldi y el aval de la Comisión Nacional de Asuntos Indígenas (CONAI) para que se construya dentro de esa reserva la PTAR, en el caso de que los estudios técnicos que se realicen así lo recomienden. Señala que, por otra parte, el proyecto responde a un interés público, ya que se construirá con el fin de mejorar y eliminar las prácticas de descarga de aguas residuales a los caños y cunetas, debido a la ineficiencia de los tanques sépticos y drenajes construidos en el área del proyecto, así como para el mejoramiento de la calidad de las aguas subterráneas presentes en la zona de estudio. Se construirán 2 ramales de alcantarillado sanitario.Uno de ellos iniciaría en las inmediaciones del antiguo aeropuerto de Puerto Viejo y el otro en la escuela primaria privada de Punta Uva. Ambos ramales drenarán hacia la comunidad de Cocles, donde se ubicará la PTAR. Se construirán aproximadamente 17 kilómetros de red de alcantarillado sanitario, con tubería de plástico con empaques herméticos, en 150 y 200 mm de diámetro. La red de alcantarillado tendrá los pozos de registro que sean necesarios, para su adecuada operación y mantenimiento. También se construirán pozos de bombeo, que servirán para que las tuberías se puedan colocar a una profundidad máxima de 4 metros. Se diseñará y se construirá una planta de tratamiento para aguas residuales ordinarias aeróbica, cuyo efluente tratado será descargado al Río Cocles o al Río Caño Negro. Según informe de avance “Terrenos para la Planta de Tratamiento para las Aguas Residuales de Cocles y Puerto Viejo de Limón”, de febrero del 2011, se indica: “Por las características… se recomienda escoger para la construcción de la planta de tratamiento el terreno del señor Alejo Pacheco….Este terreno se encuentra fuera de la Reserva Indígena Kekóldi, fuera de la Reserva Nacional de Vida Silvestre Gandoca-Manzanillo y también fuera de la Zona Marítimo Terrestre ZMT…. Ofrece ventaja en… amplia colindancia con el Río Caño Negro”. Aclara que el desfogue final de las aguas residuales provenientes de la planta de tratamiento es precisamente el resultado de todo un proceso que busca reducir de manera significativa los elementos que contaminan el ambiente, cumpliendo con los límites de vertido que indica el Reglamento de Vertidos. Con lo que se procura proteger no sólo los acuíferos, manglares, biodiversidad y medio ambiente en general, sino que también la salud de los habitantes de esas comunidades, mejorando a la vez su calidad de vida y propiciando un desarrollo sostenible en la zona. En cuanto a la tramitología del proyecto, al día de hoy, el proyecto está en etapa de pre-diseño, por parte de la Dirección de Estudios y Proyectos del AyA, por lo que no se ha tramitado permiso ante SETENA u otra institución.La razón por la cual se encuentra en tal etapa obedece a la dificultad para recomendar técnicamente un terreno que cumpla todas las condiciones necesarias para la ubicación de una planta de tratamiento de aguas residuales, de manera que se produzca el menor impacto ambiental y social posible, debido a que en esa área se localizan zonas ambientalmente frágiles. Además de los permisos obtenidos para los estudios e investigaciones preliminares, se han realizado reuniones de coordinación con personal de la Dirección de Conservación de Vida Silvestre del Caribe Sur y la Oficina Convenio entre la Municipalidad de Talamanca-SINAC, con el propósito de coordinar lo necesario para dicho proyecto. Concluye que el AyA no se encuentra construyendo la planta de tratamiento denunciada, hasta que se cuente con el terreno idóneo, se realicen los diseños y se cumpla con los estudios de impacto ambiental que sean solicitados por la SETENA.
  6. 6Informa Eduardo Lezama Fernández, en su condición de Subgerente General del Instituto Costarricense de Acueductos y Alcantarillados, en similares términos que el Director de la Región Huetar Atlántica de dicha institución.
  7. 7En la substanciación del proceso se han observado las prescripciones legales.

Redacta el Magistrado Armijo Sancho; y,

Considerando:

I.Objeto del recurso. El recurrente alega que el Instituto Costarricense de Acueductos y Alcantarillados pretende construir una planta de tratamiento de aguas residuales, dentro de la Reserva Indígena Bribrí de Këköldi, como parte del proyecto de “Alcantarillado Sanitario de Puerto Viejo y Cocles”. Acusa que la institución ya inició tales obras con la apertura de una trocha o camino para llegar al sitio de construcción de la planta de tratamiento y con una tala ilegal e indiscriminada de árboles que afecta bosques primarios y especies nativas de la zona, que incluso se encuentran en peligro de extinción. Con el agravante que de previo a iniciarse tales obras no se realizó comunicación alguna a la Asociación de Desarrollo Integral de la Reserva Indígena Bribrí de Këköldi, ni se obtuvo la respectiva viabilidad ambiental de parte de la Secretaría Técnica Nacional Ambiental. También reclama que el Instituto Costarricense de Acueductos y Alcantarillados pretende que las aguas negras de la planta sean depositadas en el Río Cocles, el cual desemboca en Playa Cocles y pasa por importantes manglares y acuíferos de la zona y, en especial, por el Refugio Nacional de Vida Silvestre de Gandoca-Manzanillo.

II.Sobre el fondo. Las autoridades del Instituto Costarricense de Acueductos y Alcantarillados refutan los distintos reproches del recurrente e indican en sus informes –que son rendidos bajo la solemnidad del juramento, con oportuno apercibimiento de las consecuencias, incluso penales, previstas en el artículo 44 de la Ley de la Jurisdicción Constitucional-, que la institución no ha iniciado la construcción de la mencionada planta de tratamiento, ni tampoco se ha procedido con la acusada tala de árboles. Explican que, a la fecha, el proyecto aún está en etapa de pre-diseño y ni tan siquiera se ha definido el lugar en el que se podría construir la referida planta de tratamiento. De hecho, en este momento se están estudiando y analizando diversos terrenos a fin de poder establecer el que resulte más idóneo para tales efectos, por lo que no es cierto que ya se haya determinado que la planta deba construirse dentro de la Reserva Indígena Bribrí de Këköldi.

Además, será hasta que se defina tal extremo que se podrá iniciar la etapa de diseño de la planta y el respectivo proceso de solicitud y obtención de los permisos y autorizaciones necesarias para la construcción del mencionado sistema de alcantarillado. Finalmente, indican que la construcción de la planta de tratamiento lo que procura es garantizar que las aguas que finalmente se desfoguen hayan sido sometidas a un proceso que reduzca significativamente los elementos que contaminan el ambiente, conforme a lo dispuesto por la normativa aplicable, incluidos los parámetros y límites previstos en el Reglamento de Vertido y Reuso de Aguas Residuales. Señalan que, con ello, lo que se procura es la protección de los acuíferos, manglares y medio ambiente en general, así como la tutela de la salud de los habitantes de la zona. Así las cosas, esta Sala no constata que en el caso en estudio se haya configurado una violación o amenaza de violación a los derechos fundamentales de la amparada.

Pues, como ya se indicó, y a la luz de los elementos probatorios aportados al proceso, no se acredita que el Instituto Costarricense de Acueductos y Alcantarillados ya haya iniciado la construcción de la referida planta de tratamiento sin haber obtenido previamente los respectivos permisos o autorizaciones -en infracción de su deber de garantizar, defender y preservar el derecho fundamental a un ambiente sano y ecológicamente equilibrado-, sino que, por el contrario, se constata que la institución tan sólo está en la etapa inicial de pre-diseño del mencionado proyecto de acueducto sanitario. Por lo que el amparo resulta claramente prematuro. Tampoco se acredita que dicha institución haya procedido con la acusada tala de árboles. En todo caso, cabe señalar que el Ministro del Ambiente, Energía y Telecomunicaciones informa que se ha procedido a trasladar el presente asunto al Tribunal Ambiental Administrativo para que se realice la correspondiente investigación administrativa.

Por lo que la amparada podrá apersonarse ante dicho Tribunal a plantear sus reparos, para que estos puedan ser analizados con la debida amplitud probatoria. En razón de lo antes indicado, procede desestimar el amparo en estudio, como así se dispone.

Por tanto:

Se declara SIN LUGAR el recurso.
