Amparo proceeding (recurso de amparo) filed by Eduardo Campos Salas, without indicating an identification number, against the Hospital de Golfito, the Ministerio de Salud, and the Instituto Costarricense de Acueductos y Alcantarillados.

Justice Ulate Chacón drafts the opinion; and,

Considerations

I. Proven facts. The following facts are deemed duly proven and relevant to the decision in this matter

1. The Hospital de Golfito Wastewater Operational Report, dated 24 de junio de 2009, establishes that the medical center’s laundry wastewater fails to comply with two of the nine available parameters and issues recommendations regarding the activities to be performed (folio 30).

2. A certification issued by the Unidad Estratégica de Negocios, Programación y Control of the Instituto Costarricense de Acueductos y Alcantarillados, dated 17 de marzo de 2010, establishes that the ordinary budgets for the years 2010 and 2011 contain funds for conducting the Feasibility Studies and Preliminary Designs for the Proyecto de Saneamiento Ambiental de Golfito (folio 27).

3. By official letter number RB-PARA-ARS-GO-BJ-0053-2010 from the Área Rectora de Salud de Golfito, dated 29 de octubre de 2010, the Hospital de Golfito was requested to implement a system for disposing of laundry wastewater (folio 62).

II.The right to a healthy and ecologically balanced environment. Article 50 of the Constitución Política establishes every person’s right to a healthy and ecologically balanced environment as a fundamental right. Before this Article fifty was amended to expressly address environmental matters, the Chamber had already derived this right through its case law from the constitutional provisions of Articles twenty-one—the right to life and health—sixty-nine—the rational use of land—and eighty-nine—the protection of natural beauty. The Chamber has adopted a broad, or macro-level, understanding of the concept of the environment and of the protection afforded to it, going beyond the basic or primary protection of soil, air, water, marine and coastal resources, minerals, forests, the diversity of flora and fauna, and the landscape, to also encompass elements relating to the economy, the generation of foreign currency through tourism, agricultural exploitation, and other matters. Accordingly, in judgment number 5893-095, at nine hours forty-eight minutes on 27 de octubre de 1993, the Chamber held that:

“Environmental Law (Derecho Ambiental) must not be associated solely with nature, because nature is only one part of the environment. The policy for protecting nature also extends to other matters, such as the protection of hunting, forests, natural parks, and natural resources. It is therefore a macro-environmental concept intended to ensure that important concepts are not excluded and thus to unify the body of law that we call Environmental Law.”

III.The State’s duty to protect the environment. Following the amendment of Article 50 of the Constitution, which expressly enshrined environmental rights (derecho ambiental) as fundamental rights, the State’s obligation to guarantee, defend, and protect those rights was also conclusively established, thereby making the State the guarantor of the protection and safeguarding of the environment and natural resources. From this provision, in conjunction with Articles 20, 69, and 89 of the Constitución Política, arose the State’s responsibility to exercise a protective and governing role in this field, as provided by the constitutional rule under discussion, a role developed by environmental legislation. Thus, the constitutional mandate establishes the State’s duty to guarantee, defend, and preserve that right. In this regard, it must be considered that the applicable legal framework designates the Ministerio del Ambiente y Energía as the governing body for the natural resources, energy, and mining sector, pursuant to Article 2 of that ministry’s Organic Law, number 7152, dated 4 de junio de 1990.

In the Chamber’s view, this governing authority in environmental matters encompasses not only the establishment of appropriate regulations for the use of forest resources and natural resources, as also provided in Article 56 of the Ley Orgánica del Ambiente, but also confers the important function of exercising leadership in environmental matters, which entails maintaining a preeminent role in this field. In this respect, the monitoring and enforcement of environmental matters and activities constitute an essential function of the State under Article 50 of the Constitution, whose third paragraph provides, insofar as relevant: “The State shall guarantee, defend, and preserve that right”; this is consistent with the constitutional principle established in the second paragraph of Article 9 of the Constitución Política, which expressly prohibits the branches of government from delegating the exercise of their own functions, particularly when those functions are essential.

Accordingly, with respect to environmental protection, the functions of governance, monitoring, and enforcement in environmental matters belong to the State and are entrusted to its various administrative agencies.

IV.Prevention of environmental risk (prevención del riesgo ambiental). Since this obligation of the State has been established at the constitutional level, it is important to consider how the international instruments for the protection of human rights also establish specific obligations that must be respected. In environmental matters, the duty of prevention (deber de prevención) applicable in this area has been defined; the Rio Declaration, adopted at the United Nations Conference on Environment and Development, provides that:

“Principle 15.- In order to protect the environment, States shall widely apply the precautionary approach (criterio de precaución) according to their capabilities. Where there is a threat of serious and irreversible damage, lack of full scientific certainty shall not be used as a reason for postponing cost-effective measures to prevent environmental degradation.” Prevention seeks to anticipate adverse effects and ensure the protection, conservation, and proper management of resources. Consequently, the guiding principle of prevention (principio rector de prevención) is based on the need to take and implement every precautionary measure necessary to prevent or contain potential harm to the environment or human health. Thus, where there is a risk of serious or irreversible harm—or uncertainty in that regard—a precautionary measure must be adopted, and the activity in question may even have to be postponed.

This is because, in environmental matters, enforcement after the fact is ineffective: once the harm has occurred, its biologically and socially harmful consequences may be irreparable; punishment may carry moral significance, but it will scarcely compensate for the damage caused to the environment. As stated both in the aforementioned international instrument and in Article 50 of the Constitution, the State is responsible for carrying out this preventive work, as this Chamber recognized in judgment number 2001-6503, of 6 de julio de 2001, when it held:

“The third paragraph of Article 50 of the Constitution states with complete clarity that the State must guarantee, defend, and preserve every person’s right to a healthy and ecologically balanced environment; this means that public entities are not only required to ensure that private parties and other public entities comply with environmental legislation, but also, above all, that they must conform their own conduct to the requirements of those protective bodies of law. State institutions are the first entities called upon to comply with protective environmental legislation, and there is no justification whatsoever for exempting them from compliance with environmental requirements, such as, by way of example, the environmental impact study (estudio de impacto ambiental) required by the Ley Orgánica del Ambiente for activities undertaken by public entities that, by their nature, may alter or destroy the environment.” (emphasis added)

V.Coordination among public institutions for comprehensive environmental protection. The State—as a whole—is obligated to take the measures necessary to protect the environment, in order to prevent levels of pollution, deforestation, extinction of flora and fauna, and excessive or improper use of natural resources that endanger the health of the governed population. For purposes of this task, a public institution is understood to include both the Central Administration—Ministries such as the Ministerio del Ambiente y Energía and the Ministerio de Salud, which, by reason of their subject matter, have extensive involvement and responsibility with respect to environmental conservation and preservation; these generally act through their specialized divisions, such as the Dirección General de Vida Silvestre, the Dirección Forestal, and the Secretaría Técnica Nacional Ambiental (SETENA)—and decentralized institutions such as the Instituto Nacional de Vivienda y Urbanismo, SENARA, Instituto Costarricense de Turismo, and Instituto Costarricense de Acueductos y Alcantarillados.

Municipalities likewise bear significant responsibility for this task within their territorial jurisdiction. Given the diversity of actors that may be involved, one might think that this shared responsibility would cause chaos in administrative management. Therefore, to prevent the simultaneous coexistence of spheres of authority of differing origins and natures, the duplication of national and local efforts, and confusion regarding the rights and obligations of the various parties involved, it is necessary to establish a series of coordinating relationships among the various divisions of the Executive Branch and decentralized institutions, and between those entities and the municipalities, so that they may perform the functions entrusted to them. This Chamber has already addressed the principle of coordination (principio de coordinación) between public agencies and municipalities in the pursuit of common purposes, stating in judgment number 5445-99, at catorce horas treinta minutos on 14 de julio de 1999, that:

“[C]oordination is the ordering of relationships among these various independent activities, taking into account their convergence upon the same object or entity so as to make that convergence useful to an overall public plan, without eliminating the reciprocal independence of the participating entities. Because there is no hierarchical relationship among decentralized institutions, or between the State itself and the municipalities, particular courses of conduct cannot be imposed upon them; this gives rise to the indispensable interinstitutional ‘agreement,’ in the strict sense, whereby autonomous and independent centers of action agree upon that preventive and comprehensive framework, within which each fulfills a role with a view toward a mission entrusted to the others. Thus, relationships between municipalities and other public entities may be conducted only on an equal footing, resulting in mutually agreed forms of coordination and excluding any mandatory arrangement detrimental to their autonomy that would subject corporate entities to a coordination framework without or against their consent; this does, however, permit the necessary subordination of such entities to the State and in its interest (through the State’s ‘administrative oversight’ (tutela administrativa), and specifically through the function of reviewing legality entrusted to it, with powers of general supervision over the entire sector).” Furthermore, failures to fulfill the duty to protect the environment and comply with environmental regulations are constitutionally significant because the Administration’s inaction in this area may cause harm to the environment and natural resources, sometimes with consequences similar to or more severe than those arising from the Administration’s actions.

Examples include authorizing zoning plans (planes reguladores) or construction projects without approval of the environmental impact study by the Secretaría Técnica Nacional Ambiental; failing, through the Dirección General de Vida Silvestre of the Ministerio del Ambiente y Energía, to monitor and supervise implementation of management plans (planes de manejo) for protected areas; allowing businesses to operate without health permits concerning wastewater treatment (tratamiento de aguas residuales)—Acueductos y Alcantarillados and Ministerio de Salud—or failing to verify noise-level controls in bars, restaurants, or event venues—municipalities and Ministerio de Salud.

VI.The specific case. The situation alleged by the petitioner for constitutional relief (amparado). Based on its examination of the record and the reports submitted under oath, the Chamber finds it established that Hospital de Golfito is a structure built nearly seventy years ago. It is also established that wastewater from that medical facility’s laundry undergoes basic sedimentation treatment, consisting of passage through three separate inspection chambers—a process during which it is combined with wastewater from other sources—before being discharged into Golfo Dulce. It is likewise shown that the condition of the laundry wastewater is analyzed quarterly to assess the degree of contamination and that, according to the report filed in the record, the wastewater fails to meet two of the established parameters—out of nine possible parameters. The authorities of the Ministerio de Salud, for their part, state that the petitioner (recurrente) had not filed any complaint with their offices regarding the reported situation, which is why they only now conducted the relevant investigation, ultimately concluding and recommending that the Hospital implement a system for disposing of the laundry wastewater.

In this regard, the record establishes that, as part of the efforts of the Instituto Costarricense de Acueductos y Alcantarillados, a feasibility study and preliminary designs are being prepared for the Golfito environmental sanitation project, which would make it possible in the future for the Hospital’s laundry wastewater to receive appropriate treatment before final disposal. However, this remains at the design stage, and considering that the existing disposal system is indeed rudimentary and that the Ministerio de Salud has already ordered the implementation of an appropriate wastewater-disposal system, the proper course is to order the respondent authorities to establish appropriate coordination mechanisms so that, within a maximum period of six months from notification of this judgment, Hospital de Golfito will have a system for disposing of its laundry wastewater that complies with all environmental parameters, prevents its discharge into Golfo Dulce, and eliminates the potential risk that such discharge poses to the health of the general population.

Por tanto

The action is granted. Guillermo Mendieta Ramírez, General Director of Hospital de Golfito; Gustavo Cintrón Machón, Director of the Área Rectora de Salud de Golfito of the Ministerio de Salud; Noylin Gutiérrez Arias, Cantonal Head in Golfito of the Instituto Costarricense de Acueductos y Alcantarillados; and Julián Villegas Pérez, President of the Asociación Administradora del Acueducto de Golfito, or whoever holds their respective offices, are ordered to take immediately, within their respective spheres of authority, the necessary actions to establish appropriate coordination mechanisms so that, within six months from notification of this judgment, Hospital de Golfito has a system for disposing of wastewater (aguas residuales) from its laundry that complies with all environmental parameters and prevents untreated discharge into Golfo Dulce. They are advised that, pursuant to Article 71 of the Law governing this jurisdiction, anyone who receives an order issued in an amparo action (recurso de amparo) that they are required to comply with or enforce, and fails to comply with or enforce it, shall be punished by imprisonment for three months to two years, or by twenty to sixty day-fines (días multa), provided that the offense is not subject to a more severe penalty.

The State is ordered to pay the legal costs, damages, and losses caused by the events underlying this ruling, which shall be assessed during enforcement of the judgment before the administrative litigation court (jurisdicción de lo contencioso administrativo). This decision shall be served personally on Guillermo Mendieta Ramírez, General Director of Hospital de Golfito; Gustavo Cintrón Machón, Director of the Área Rectora de Salud de Golfito of the Ministerio de Salud; Noylin Gutiérrez Arias, Cantonal Head in Golfito of the Instituto Costarricense de Acueductos y Alcantarillados; and Julián Villegas Pérez, President of the Asociación Administradora del Acueducto de Golfito, or whoever holds their respective offices. SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las doce horas y cero minutos del cuatro de marzo del dos mil once.

Recurso de amparo presentado por Eduardo Campos Salas, sin indicar número de cédula, contra el Hospital de Golfito, el Ministerio de Salud, y el Instituto Costarricense de Acueductos y Alcantarillados.

Resultando

  1. 1Mediante resolución de esta Sala, número 2009-8, de las catorce horas treinta y siete minutos del 5 de enero de 2010, dictada dentro del expediente número 09-002156-0007-CO, se ordena tramitar esta acción como un asunto nuevo.
  2. 2Por resolución de esta Sala, número 2010-170, de las quince horas cuarenta y nueve minutos del 12 de febrero de 2010 (folio 4), se rechaza de plano el recurso en cuanto a la aducida desobediencia de una sentencia dictada dentro de la acción de amparo 09-00156-0007-CO, y se ordena dar curso sobre la nueva situación planteada por el recurrente.
  3. 3Por escrito recibido en la Secretaría de la Sala a las catorce horas cuarenta minutos del 17 de noviembre de 2009 (folio 2), el recurrente aduce la omisión del Ministerio de Salud para regular el vertido que de las aguas de la lavandería hace el Hospital de Golfito directamente al mar, con la consiguiente afectación al ambiente en perjuicio de todos los habitantes. Solicita declarar con lugar el recurso.
  4. 4Mediante resolución de esta Sala, de las dieciséis horas doce minutos del 25 de febrero de 2010 (folio 8), se da curso a la presente acción de amparo.
  5. 5Por escrito recibido en la Secretaría de la Sala a las quince horas once minutos del 16 de marzo de 2010 (folio 17), informa bajo fe de juramento Noilyn Gutiérrez Arias, Jefe Cantonal del Instituto Costarricense de Acueductos y Alcantarillados, quien señala que corresponde al Ministerio de Salud verificar si los hechos aducidos se están presentando, que es competencia del Hospital velar por contar con un sistema de tratamiento de aguas residuales, y que el acueducto de Golfito se encuentra bajo administración de la Asociación Administradora del Acueducto y Alcantarillado de Golfito. Solicita declarar sin lugar el recurso.
  6. 6Mediante escrito recibido en la Secretaría de la Sala a las doce horas cuarenta y ocho minutos del 19 de marzo de 2010 (folio 22), informa bajo fe de juramento Fabio Robleto Flores, Director Médico del Área de Salud de Golfito, de la Caja Costarricense de Seguro Social, quien señala ser el Director del EBAIS de Golfito, que la contaminación aducida sería responsabilidad del centro hospitalario, y que la vigilancia corresponde al Ministerio de Salud. Solicita declarar sin lugar el recurso.
  7. 7Por escrito recibido en la Secretaría de la Sala a las doce horas treinta y seis minutos del 19 de marzo de 2010 (folio 26), informa bajo fe de juramento Julián Villegas Pérez, Presidente de la Asociación Administradora del Acueducto de Golfito, quien señala que se han ocupado de la situación aducida, y que el Director del Hospital les mostró los análisis físico-químicos y microbiológicos realizados por el Laboratorio de Análisis Ambientales, que demuestran el cumplimiento de la mayoría de parámetros, y se hacen alguna recomendaciones correctivas para mejorar esos parámetros. Acredita que las aguas no llegan directamente al mar, sino que pasan por un proceso de tanques que contribuyen a la sedimentación y purificación parcial. Indica que estos análisis se efectúan trimestralmente. Agrega que el Hospital tiene previsto remodelar la lavandería y cambiar el tipo de detergentes. Añade que el Instituto Costarricense de Acueductos y Alcantarillados está finalizando los términos de referencia para contratar el estudio de factibilidad y diseños preliminares de alcantarillado sanitario y planta de tratamiento de aguas residuales de Golfito. Solicita declarar sin lugar el recurso.
  8. 8Mediante resolución de esta Sala, de las once horas treinta y cinco minutos del 6 de octubre de 2010 (folio 49), se amplían las partes consignadas en este recurso de amparo, y se otorga audiencia al Director General del Hospital de Golfito, y al Área Rectora de Salud de Golfito, del Ministerio de Salud.
  9. 9Por escrito recibido en la Secretaría de la Sala a las ocho horas once minutos del 2 de noviembre de 2010 (folio 61), el Área Rectora de Salud de Golfito, del Ministerio de Salud, aporta documentación sobre la inspección realizada en el Hospital de Golfito. El informe explica el procedimiento de depósito de las aguas de la lavandería del Hospital, y concluye solicitando al centro médico la implementación de un sistema para la disposición final de las aguas residuales de la lavandería.
  10. 10Mediante escrito recibido en la Secretaría de la Sala a las trece horas cincuenta y tres minutos del 2 de noviembre de 2010 (folio 66), informa Guillermo Mendieta Ramírez, Director General a cargo del Hospital de Golfito, quien señala que el edificio del Hospital tiene más de setenta años de existencia. Agrega que se realizan evaluaciones trimestrales de sus aguas residuales, y el informe que aporta establece que se cumplen varios de los parámetros establecidos, y los que no, es por los residuos de materia orgánica en los tanques, razón por la cual están siguiendo las indicaciones para la limpieza de esos tanques. Aduce que todos los detergentes utilizados son biodegradables, y que el calor aplicado en el proceso de lavado impide que sobrevivan patógenos. Solicita declarar sin lugar el recurso.
  11. 11Por escrito recibido en la Secretaría de la Sala a las catorce horas diez minutos del 3 de noviembre de 2010 (folio 71), informa bajo fe de juramento Gustavo Cintrón Machón, Director del Área Rectora de Salud de Golfito, quien señala que el recurrente no ha presentado gestión alguna al respecto ante esa dependencia, por lo que será a partir de ese momento que realizarán las investigaciones para determinar las medidas a implementar. Solicita declarar sin lugar el recurso.
  12. 12Mediante escrito recibido en la Secretaría de la Sala a las once horas cuarenta y cuatro minutos del 4 de noviembre de 2010 (folio 72), manifiesta Víctor Hugo Villalobos González, Director General a cargo del Hospital de Golfito, que por las emergencia nacional vivida en esa fecha, se imposibilita hacer entrega del
  13. 13En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta el Magistrado Ulate Chacón; y,

Considerando

I.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:

1. El Reporte Operacional de Aguas Residuales del Hospital de Golfito, de 24 de junio de 2009, acredita que las aguas residuales de la lavandería del centro médico incumplen dos de nueve parámetros disponibles, y emite recomendaciones de las actividades a realizar (folio 30).

2. Mediante certificación de la Unidad Estratégica de Negocios, Programación y Control del Instituto Costarricense de Acueductos y Alcantarillados, de 17 de marzo de 2010, se acredita que en los presupuestos ordinarios de los años 2010 y 2011 se cuenta con recursos para la realización de los Estudios de Factibilidad y Diseños Preliminares del Proyecto de Saneamiento Ambiental de Golfito (folio 27).

3. Por oficio del Área Rectora de Salud de Golfito, número RB-PARA-ARS-GO-BJ-0053-2010, de 29 de octubre de 2010, se solicita al Hospital de Golfito implementar un sistema para la disposición de las aguas residuales de la lavandería (folio 62).

II.El derecho a un ambiente sano y ecológicamente equilibrado. El artículo 50 de la Constitución Política establece como fundamental el derecho de toda persona a un ambiente sano y ecológicamente equilibrado. De previo a la modificación de este artículo cincuenta para considerar de manera expresa lo relativo al ambiente, ya la Sala, a través de su labor jurisprudencial, había derivado este derecho a partir de las disposiciones constitucionales de los artículos veintiuno –derecho a la vida y a la salud-, sesenta y nueve –explotación racional de la tierra- y ochenta y nueve –protección de las bellezas naturales-. La Sala ha optado por una consideración abierta o macro del concepto ambiente y de la protección que se brinda al mismo, trascendiendo de la protección básica o primaria del suelo, el aire, el agua, los recursos marinos y costeros, minerales, bosques, diversidad de flora y fauna, y paisaje, para considerar también elementos referentes a la economía, a la generación de divisas a través del turismo, la explotación agrícola y otros. Así, mediante sentencia número 5893-095, de las nueve horas cuarenta y ocho minutos del 27 de octubre de 1993, la Sala estableció que:

“[E]l Derecho Ambiental no debe asociarse sólo con la naturaleza, pues ésta es únicamente parte del ambiente. La política de protección a la naturaleza se vierte también sobre otros aspectos como la protección de la caza, de los bosques, de los parques naturales y de los recursos naturales. Se trata, entonces, de un concepto macro-ambiental, para no dejar conceptos importantes por fuera y así lograr unificar el conjunto jurídico que denominamos Derecho Ambiental"

III.El deber del Estado en la tutela del ambiente. A partir de la reforma del artículo 50 constitucional, en la cual se consagró expresamente el derecho ambiental como un derecho fundamental, se estableció también -en forma terminante- la obligación del Estado de garantizar, defender y tutelar este derecho, con lo cual, el Estado se constituye en el garante en la protección y tutela del medio ambiente y los recursos naturales. Es a tenor de esta disposición, en relación con los artículos 20, 69 y 89 de la Constitución Política, que se derivó la responsabilidad del Estado de ejercer una función tutelar y rectora en esta materia, según lo dispone la propia norma constitucional en comentario, función que desarrolla la legislación ambiental. Es así como el mandato constitucional establece el deber para el Estado de garantizar, defender y preservar ese derecho. En este orden de ideas, debe considerarse que la normativa establece al Ministerio del Ambiente y Energía como el órgano rector del sector de los recursos naturales, energía y minas, según lo dispuesto en el artículo 2 de la Ley Orgánica de este ministerio, número 7152, de 4 de junio de 1990.

Esta función de rectoría en la materia ambiental, a criterio de la Sala, comprende no sólo el establecimiento de regulaciones adecuadas para el aprovechamiento del recurso forestal y los recursos naturales, según lo dispone también el artículo 56 de la Ley Orgánica del Ambiente, sino que le confiere la importante función de ejercer la rectoría en la materia ambiental, consistente en mantener un papel preponderante en esta materia. En este sentido, el control y fiscalización de la materia y actividad ambiental se constituye en una función esencial del Estado según lo dispuesto en el artículo 50 de la Constitución, en tanto dispone en lo que interesa en el párrafo tercero: "El Estado garantizará, defenderá y preservará ese derecho"; lo cual resulta concordante con el principio constitucional establecido en el párrafo segundo del artículo 9 de la Constitución Política, que expresamente prohíbe a los Poderes del Estado la delegación del ejercicio de funciones que le son propias, máxime cuando se constituyen en esenciales.

De esta manera, tratándose de la protección ambiental, las funciones de rectoría, control y fiscalización de la materia ambiental, corresponden al Estado, a cargo de las diversas dependencias administrativas.

IV.La prevención del riesgo ambiental. Estableciéndose a nivel constitucional esta obligación del Estado, resulta importante apreciar cómo a nivel de los instrumentos internacionales de protección de los derechos humanos también se establecen obligaciones concretas que deben ser respetadas. En materia ambiental se ha definido el deber de prevención que debe existir en este ámbito; la Declaración de Río, adoptada en la Conferencia de las Naciones Unidas sobre el Medio Ambiente y el Desarrollo, dispone que:

"Principio 15.- Con el fin de proteger el medio ambiente, los Estados deberán aplicar ampliamente el criterio de precaución conforme a sus capacidades. Cuando haya peligro de daño grave e irreversible, la falta de certeza científica absoluta no deberá utilizarse como razón para postergar la adopción de medidas eficaces en función de los costos para impedir la degradación del medio ambiente".

La prevención pretende anticiparse a los efectos negativos, y asegurar la protección, conservación y adecuada gestión de los recursos. Consecuentemente, el principio rector de prevención se fundamenta en la necesidad de tomar y asumir todas las medidas precautorias para evitar o contener la posible afectación del ambiente o la salud de las personas. De esta forma, en caso de que exista un riesgo de daño grave o irreversible -o una duda al respecto-, se debe adoptar una medida de precaución e inclusive posponer la actividad de que se trate. Lo anterior debido a que en materia ambiental la coacción a posteriori resulta ineficaz, por cuanto de haberse producido el daño, las consecuencias biológicas y socialmente nocivas pueden ser irreparables; la represión podrá tener una trascendencia moral, pero difícilmente compensará los daños ocasionados al ambiente. Tal como lo señala el instrumento internacional de cita como el mismo artículo 50 constitucional, es el Estado el llamado a efectuar esta labor de prevención, y así lo ha reconocido esta Sala al afirmar, mediante sentencia número 2001-6503, de 6 de julio de 2001, que:

“El párrafo tercero del numeral 50 Constitucional señala con toda claridad que el Estado debe garantizar, defender y preservar el derecho de todas persona a un ambiente sano y ecológicamente equilibrado; lo que implica afirmar que los entes públicos no sólo están en la obligación de hacer cumplir –a los particulares y otros entes públicos- la legislación ambiental, sino también, ante todo, que deben ajustar su accionar a los dictados de esos cuerpos normativos tutelares. Las instituciones del Estado son las primeras llamadas a cumplir con la legislación tutelar ambiental, sin que exista justificación alguna para eximirlas del cumplimiento de requisitos ambientales como, a manera de ejemplo, el estudio de impacto ambiental que exige la Ley Orgánica del Ambiente para las actividades que emprendan los entes públicos que, por su naturaleza, puedan alterar o destruir el ambiente." (énfasis añadido)

V.La coordinación de las instituciones públicas en la protección integral al ambiente. Existe una obligación para el Estado –como un todo- de tomar las medidas necesarias para proteger el ambiente, a fin de evitar grados de contaminación, deforestación, extinción de flora y fauna, uso desmedido o inadecuado de los recursos naturales, que pongan en peligro la salud de los administrados. En esta tarea, por institución pública se entiende tanto a la Administración Central –Ministerios, como el Ministerio del Ambiente y Energía y el Ministerio de Salud, que en razón de la materia, tienen una amplia participación y responsabilidad en lo que respecta a la conservación y preservación del ambiente; los cuales actúan, la mayoría de las veces, a través de sus dependencias especializadas en la materia, como por ejemplo, la Dirección General de Vida Silvestre, la Dirección Forestal, y la Secretaría Técnica Nacional Ambiental (SETENA)-, así como también las instituciones descentralizadas como el Instituto Nacional de Vivienda y Urbanismo, el SENARA, el Instituto Costarricense de Turismo o el Instituto Costarricense de Acueductos y Alcantarillados.

Del mismo modo, en esta tarea tienen gran responsabilidad las municipalidades en lo que respecta a su jurisdicción territorial. Debido a la diversidad de actores que pueden intervenir, podría pensarse que esta múltiple responsabilidad provocaría un caos en la gestión administrativa. Por ello, a fin de evitar la coexistencia simultánea de esferas de poder de diferente origen y esencia, la duplicación de los esfuerzos nacionales y locales, así como la confusión de derechos y obligaciones entre las diversas partes involucradas, se hace necesario establecer una serie de relaciones de coordinación entre las diversas dependencias del Poder Ejecutivo y las instituciones descentralizadas, y entre éstas con las municipalidades, a fin de poder llevar a cabo las funciones que les han sido encomendadas. Esta Sala se ha referido ya al principio de coordinación de las dependencias públicas con las municipalidades en la realización de fines comunes, al señalar mediante sentencia número 5445-99, de las catorce horas treinta minutos del 14 de julio de 1999, que:

"[L]a coordinación es la ordenación de las relaciones entre estas diversas actividades independientes, que se hace cargo de esa concurrencia en un mismo objeto o entidad, para hacerla útil a un plan público global, sin suprimir la independencia recíproca de los sujetos agentes. Como no hay una relación de jerarquía de las instituciones descentralizadas, ni del Estado mismo en relación con las municipalidades, no es posible la imposición a éstas de determinadas conductas, con lo cual surge el imprescindible «concierto» interinstitucional, en sentido estricto, en cuanto los centros autónomos e independientes de acción se ponen de acuerdo sobre ese esquema preventivo y global, en el que cada uno cumple un papel con vista en una misión confiada a los otros. Así, las relaciones de las municipalidades con los otros entes públicos, sólo pueden llevarse a cabo en un plano de igualdad, que den como resultado formas pactadas de coordinación, con exclusión de cualquier forma imperativa en detrimento de su autonomía, que permita sujetar a los entes corporativos a un esquema de coordinación sin su voluntad o contra ella; pero que sí admite la necesaria subordinación de estos entes al Estado y en interés de éste (a través de la «tutela administrativa» del Estado, y específicamente, en la función de control la legalidad que a éste compete, con potestades de vigilancia general sobre todo el sector).” Por otro lado, las omisiones al deber de protección del ambiente y de cumplimiento de la normativa ambiental son de relevancia constitucional, por cuanto como consecuencia de la inercia de la Administración en esta materia, se puede producir un daño al ambiente y a los recursos naturales, a veces, de similares o mayores consecuencias que de las derivadas de las actuaciones de la Administración; como lo es la autorización de planes reguladores, o construcciones sin la aprobación del estudio de impacto ambiental por parte de la Secretaría Técnica Nacional Ambiental, o la falta de control y fiscalización en la ejecución de los planes de manejo de las áreas protegidas por parte de la Dirección General de Vida Silvestre del Ministerio del Ambiente y Energía, el permitir el funcionamiento de empresas sin los permisos de salud en lo que respecta al tratamiento de aguas residuales -Acueductos y Alcantarillados y Ministerio de Salud-, o no verificar los controles sónicos en bares, restaurantes o centros de fiestas -municipalidades y Ministerio de Salud-.

VI.El caso concreto. La situación aducida por el amparado. Del estudio de los autos y de los informes rendidos bajo fe de juramento, la Sala tiene por acreditado que el Hospital de Golfito es una estructura cercana a los setenta años de construcción. Consta, asimismo, que las aguas residuales de la lavandería de dicho centro médico, son sometidas a un tratamiento básico de sedimentación que consiste en el paso a través de tres distintas cajas de registro –proceso en el cual se une a las aguas residuales de otros agentes- antes de ser vertidas en el Golfo Dulce. De igual manera, se demuestra que la situación de esas aguas residuales de la lavandería, son analizadas de manera trimestral para evaluar el grado de contaminación, y del reporte presentado al establecidos –de nueve posibles-. Por otra parte, las autoridades del Ministerio de Salud manifiestan que el recurrente no ha presentado denuncia alguna ante sus dependencias sobre la situación denunciada, razón por la cual es hasta este momento que realizan la investigación pertinente, concluyendo y recomendando al Hospital la implementación de un sistema para la disposición de las aguas residuales de la lavandería.

Al respecto, consta que como parte de la gestión del Instituto Costarricense de Acueductos y Alcantarillados, se está desarrollando un estudio de factibilidad y diseños preliminares del proyecto de saneamiento ambiental de Golfito, el cual permitiría en el futuro que las aguas residuales de la lavandería del Hospital reciban un tratamiento adecuado antes de su disposición final. Sin embargo, esto aún se encuentra en la fase de diseño, y tomando en consideración que ciertamente el sistema de disposición existente es elementa, y que ya el Ministerio de Salud ordenó la implementación de un sistema apropiado para la disposición de las aguas residuales, lo que corresponde es ordenar a las autoridades recurridas establecer las instancias de coordinación adecuadas que permitan al Hospital de Golfito contar en un plazo máximo de seis meses contados a partir de la notificación de esta sentencia, de un sistema de disposición de las aguas residuales de su lavandería que cumpla con todos los parámetros ambientales e impida el vertido sobre el Golfo Dulce y el eventual riesgo que esto representa para la salud de la población en general.

Por tanto

Se declara con lugar el recurso. Se ordena a Guillermo Mendieta Ramírez, Director General del Hospital de Golfito; Gustavo Cintrón Machón, Director del Área Rectora de Salud de Golfito, del Ministerio de Salud; Noylin Gutiérrez Arias, Jefe Cantonal en Golfito del Instituto Costarricense de Acueductos y Alcantarillados; y a Julián Villegas Pérez, Presidente de la Asociación Administradora del Acueducto de Golfito; o a quienes ocupen sus cargos, que de inmediato interpongan las actuaciones que se encuentren dentro de sus ámbitos de competencia, para establecer las instancias de coordinación adecuadas para que en el plazo de seis meses contados a partir de la notificación de esta sentencia, el Hospital de Golfito cuente con un sistema de disposición de las aguas residuales de su lavandería, que cumpla con todos los parámetros ambientales e impida el vertido sin tratamiento sobre el Golfo Dulce.

Se les advierte que de conformidad con el artículo 71 de la Ley de esta jurisdicción, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. Notifíquese la presente resolución a Guillermo Mendieta Ramírez, Director General del Hospital de Golfito; Gustavo Cintrón Machón, Director del Área Rectora de Salud de Golfito, del Ministerio de Salud; Noylin Gutiérrez Arias, Jefe Cantonal en Golfito del Instituto Costarricense de Acueductos y Alcantarillados; y a Julián Villegas Pérez, Presidente de la Asociación Administradora del Acueducto de Golfito; o a quienes ocupen sus cargos, en forma personal.
