Considerations:
I.Subject matter of the action. The petitioners object to the use of the basketball court in the Cantón Central de Puntarenas for the installation of food stands and similar facilities during the Cantón’s carnivals.
II.Proven facts. The following facts are deemed duly established and relevant to the resolution of this matter, either because they have been substantiated or because the respondent failed to address them as directed in the initial order:
III.Merits. From the report and documentation submitted by the respondents, the Chamber concludes that the alleged change in designated use does not entail a violation of any fundamental right. It is explained that authorization was granted by the Comité Cantonal de Deportes for the installation of businesses unrelated to sports and that this authorization consisted of a temporary license. Consequently, this aspect of the constitutional protection action must be dismissed.
IV.Regarding the petitioners’ complaint of improper treatment of the solid waste generated by the provisionally authorized activity, although the respondent authorities were notified of this allegation, they failed to address it. Article 45 of the Ley de la Jurisdicción Constitucional must therefore be applied, and the allegation deemed true in view of the respondents’ silence. Because the management of this type of waste is connected to the right to a healthy and ecologically balanced environment, this aspect of the constitutional protection action must be granted. Since the relevant dates have already passed (10 al 22 de febrero), the respondent authorities are hereby warned that they must not engage in further conduct similar to that giving rise to this favorable ruling.
Therefore (Por tanto):
The action is granted solely on the ground of infringement of the right to a healthy environment. Pursuant to Article 50 of the Ley de la Jurisdicción Constitucional, Rafael Ángel Rodríguez Castro, Municipal Mayor, and Luis Guillermo Ugalde Méndez, President of the Concejo Municipal, both of the Cantón Central de Puntarenas, or whoever may hold their respective offices, are hereby warned that they must refrain in the future from again engaging in conduct similar to that which gave rise to this favorable ruling; otherwise, they could be punished by imprisonment for six months to three years or by a fine of sixty to one hundred twenty days (Article 72 of the same Law). In all other respects, the constitutional protection action is denied. The Municipalidad de Puntarenas is ordered to pay the costs, damages, and losses caused, which shall be determined in proceedings to enforce the judgment before the contentious-administrative jurisdiction (ejecución de sentencia de lo contencioso administrativo). Resultando:
Redacta el Magistrado Armijo Sancho; y,
Considerando:
I.Objeto del recurso. Los recurrentes manifiestan su desacuerdo con la utilización de la cancha de baloncesto del Cantón Central de Puntarenas para instalar puestos de comida y similares durante los carnavales del Cantón.
II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
III.Sobre el fondo. Del informe y documentación que aportan los accionados concluye la Sala que el cambio de destino denunciado no acarrea violación de ningún derecho fundamental. Se explica que se dio autorización del Comité Cantonal de Deportes para la instalación de giros diversos del deportivo y que consistió en una licencia de carácter temporal. Este extremo del amparo, consecuentemente, debe desestimarse.
IV.Sobre el reclamo de los recurrentes de un tratamiento inadecuado de los desechos sólidos que genera la actividad autorizada provisionalmente, pese a que del hecho se dio traslado a las autoridades recurridas, ellas omitieron referirse a él, con lo que debe aplicarse el artículo 45 de la Ley de la Jurisdicción Constitucional, y tenerlo por cierto, ante el silencio de los recurridos. Al vincularse el manejo de esa clase de desechos con el derecho a un ambiente sano y ecológicamente equilibrado, corresponde acoger este aspecto del amparo. Por tratarse de fechas ya transcurridas (10 al 22 de febrero), se advierte a las autoridades accionadas que no deberán incurrir en nuevos hechos similares a los que dan lugar a la presente estimatoria.
