Amparo proceeding (recurso de amparo) filed by MARCO ANTONIO HERRERO PINTO, holder of identity card number uno- cuatrocientos noventa y nueve- ochocientos once, against the CONSEJO DE CONCESIONES DEL MINISTERIO DE OBRAS PÚBLICAS Y TRANSPORTES, AUTOPISTAS DEL SOL SOCIEDAD ANÓNIMA, AND OTHERS.
Findings of Fact:
Establish land-use (uso de suelo) regulations in a strip on both sides of the highway to prevent activities that could contaminate the aquifer (acuífero).” Based on the analyses, conclusions, and recommendations issued in the “Detailed Hydrogeological Study of the Sector between Río Virilla and Río Segundo, Section II, San José-Caldera Highway” (“Estudio Hidrogeológico detallado del sector entre el Río Virilla y Río Segundo Tramo II, Carretera San José-Caldera”), as well as the provisions contained in SENARA official letter DIGH-0459-2009, particularly the conclusion that “The comprehensive analysis of the Barva aquifer makes it possible to determine that the highway project may indeed continue, provided that the mitigation recommendations established in Chapter 4 above are taken into account,” at a meeting of the Comité Técnico, the Gerencia de Proyecto and the Sociedad Concesionaria agreed to resume work in the sector between PK 16+185 and PK 20+000, since it was extremely important and urgent to begin implementing, as soon as possible, the mitigation measures (medidas de mitigación) defined in the aforementioned official letter and validated by SENARA, in order to mitigate the effects caused in the area affecting the aquitards (acuitardos) and the Barva aquifer.
At this time, the Concessionaire has already implemented the mitigation measures defined in the “Detailed Hydrogeological Study of the Sector between Río Virilla and Río Segundo, Section II, San José-Caldera Highway” (“Estudio Hidrogeológico detallado del sector entre el Río Virilla y Río Segundo Tramo II, Carretera San José-Caldera”), in accordance with the provisions issued by SENARA in Official Letter DIGH-0459-2009, such as the construction of subdrains (subdrenajes) and works to waterproof (impermeabilización) the exposed area of the aquifer roof (techo del acuífero); land-use regulations were also established in a strip on both sides of the highway to prevent activities that could contaminate the aquifer. These works were carried out by the Concessionaire in coordination with and under the supervision of SENARA. Once that entity had accepted the mitigation works implemented, the Concessionaire continued constructing the highway works themselves—drainage works (obras de drenaje), earthworks (movimientos de tierras), and paving (pavimentación)—which is why the highway is currently in operation.
With regard to the meeting with SETENA requested on dieciocho de junio, which was held on primero de julio del dos mil nueve, although the Secretaría Técnica del CNC was informed that the environmental authority would address the alleged environmental damage caused by this project, its cost, and the corrective measures that would be required of the Concessionaire, to date SETENA has not determined the amount of the damages; consequently, the Administration has been unable to impose any sanction or measure against the Concessionaire because there are no clear and conclusive findings from SETENA regarding the Concessionaire’s failure to comply with its environmental obligations. In the Administration’s view, SETENA is the entity responsible for assessing the Concessionaire’s compliance with its environmental obligations, as well as for establishing the corresponding sanctions and fines for any noncompliance that may be proven.
By Resolution number 1153-09-TAA, issued at siete horas con cinco minutos del veintiuno de setiembre del dos mil nueve, the Tribunal Ambiental Administrativo informed the Ministra de Obras Públicas of the anonymous complaint filed with that body concerning the San José-Caldera project for alleged environmental damage, including impacts on the Barva aquifer. To date, the Administration has received no communication concerning the final conclusions, nor any other resolution from the Tribunal Ambiental Administrativo regarding the investigation conducted by that entity in connection with the anonymous complaint received concerning the condition of the Barva aquifer. It requests that this application for amparo relief (recurso de amparo) be denied.
Magistrate Pacheco Salazar drafts the opinion; and,
Whereas:
I.Subject matter of the appeal. The appellant alleges that, on the western side of his property, the respondents broke through the surface rocks containing the so-called Barva aquifer, causing water to flow through the location where the highway was to be built. He asserts that the breach of the aquifer caused the flow rate of the water well on his property to begin decreasing, to the point that the water is currently insufficient for his vital needs, thereby violating the right to enjoy a healthy and ecologically balanced environment, as well as the right to health, due to the encroachment upon and contamination of that public area; he therefore asks that the appeal be granted.
II.Proven facts. The following facts relevant to deciding this amparo appeal are deemed established, either because they have been proven or because the respondent failed to address them as directed in the initial order:
<![if !supportLists]>a. <![endif]>The well designated AB-1540 is covered by concession number 1555, is located at topographic coordinates 510050-212250, has a depth of forty meters, reports no groundwater level, and has a flow rate of 0.5 liters per second (as stated under oath by the respondent authority at folio 170); <![if !supportLists]>b. <![endif]>According to administrative case file number 5155-P in the Concession Registry of the Dirección de Aguas, on veinticuatro de setiembre de dos mil nueve, Mr. Marco Antonio Herrero Pinto, now Tropical Foliage of Costa Rica S.A., applied to renew the water concession for a flow rate of 3.78 liters per second from well AB-1540 (at folio 76); <![if !supportLists]>c. <![endif]>The Secretaría Técnica Nacional Ambiental granted environmental viability (viabilidad ambiental) to Autopistas del Sol through resolution number 2077-2006-SETENA (undisputed fact); <![if !supportLists]>d. <![endif]>There is no hydrogeological assessment (evaluación hidrogeológica) defining the cone of depression (cono de abatimiento) caused by the highway cut and its potential effect on groundwater levels in the area.
There is no historical record of groundwater levels; therefore, it is impossible to prepare the well hydrograph (hidrograma del pozo) and observe variations in those levels caused by external factors (as stated under oath by the respondent authorities at folios 171 and 294 verso); <![if !supportLists]>e. <![endif]>At private oral hearing number 04 of 15 de abril de 2009, conducted by the Comisión Plenaria de la SETENA, it was agreed that a site visit to the project would be conducted on 20 de abril de 2009 (appearing in the administrative case file of the Secretaría Técnica Nacional Ambiental); <![if !supportLists]>f. <![endif]>The Comisión Plenaria de la SETENA held private oral hearing number 02 on 01 de julio de 2009 and agreed: “Request that the ASA Department submit, no later than lunes 06 de julio de 2009, the proposed resolution concerning the most recent project inspection. It must incorporate the TRR from the Environmental Audit (Auditoría Ambiental), the Barva aquifer mitigation measures (implementation), and the environmental oversight team (equipo regencia ambiental), among other matters.” (appearing in the administrative case file of the Secretaría Técnica Nacional Ambiental); <![if !supportLists]>g. <![endif]>According to the “Estudio Hidrogeológico detallado del sector entre el Río Virilla y Río Segundo, Tramo II, Carretera San José-Caldera,” the mitigation measures intended to lessen the effects of cutting through the roof in the sector where the Barva aquifer emerges are: “…a) Construct engineering works that will adequately drain the flow of water emerging in the sector where the Barva lavas outcrop (the final design of these drains must be submitted to SETENA through the environmental oversight reports (informes de regencia ambiental)).
The final discharge from the drains must be conveyed through suitable piping to Río Segundo, which is, in any event, the aquifer’s effluent river under natural conditions; b) A secure waterproofing system must be installed over the drainage system to be constructed, including an impermeable geomembrane covering to ensure that no substance spilled on the highway can infiltrate; c) The highway’s stormwater system (sistema de pluviales) must have a separate discharge into Río Segundo; d) A 25-meter strip on both sides of the highway, solely in the sector where the lavas of the Formación Barva outcrop, must be demarcated as a protection zone (zona de protección) regulating the activities to be conducted so as not to harm the drained sector of the Barva aquifer; e) The regulations to be established must include restrictions on development for projects handling hydrocarbon raw materials or hydrocarbon products, chemicals, organic solid waste, or agricultural plantations using agrochemicals.
Examples include fuel stations, livestock activity, crops, chemical industries, and septic tanks” (as stated under oath by the respondent authority at folio 184); <![if !supportLists]>h. <![endif]>That by resolution number 1840-2009-SETENA, issued at 08:05 on 11 de agosto de 2009, the Secretaría Técnica Nacional Ambiental ruled: “FIRST: After reviewing the information contained in the file for the San José-Caldera project and analyzing the inspection results, this Commission concludes that the principal problems identified concern Section II (Ciudad Colón-Orotina) and are as follows: 3. Barva aquifer (acuífero de Barva). The work performed during construction of the highway breached part of the aquifer seal (sello del acuífero). Regarding this issue, the file contains SENARA memorandum DIGH-0280-200, which makes a series of recommendations for resolving this problem; furthermore, there is a study prepared by hydrogeologist Sandra Arredondo that must be followed up on. …THIRD: …4.
Provide details on the results of implementing the corrective environmental measures (medidas ambientales correctivas) in relation to the problems identified in each section of the highway (spoil disposal sites (Escombreras), Quebrada Salitral, and Barva Aquifer)…” (appearing at folios 1169 to 1145 of the SETENA administrative file); <![if !supportLists]>i. <![endif]>That according to technical report AT-0213-2010 of 02 de setiembre de 2009. geologist Víctor Hugo Vargas López, an official of the Dirección de Aguas, states that: “…the Tribunal Ambiental Administrativo (TAA), the Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA), and the Secretaría Técnica Nacional Ambiental (SETENA) have already ordered Autopistas del Sol S.A. to implement, as soon as possible, mitigation, corrective, and precautionary measures (medidas de mitigación, correctivas y precautorias) in order to prevent damage to the Barva aquifer, such as installing a geomembrane (geomembrana) to prevent contaminants from reaching the groundwater level and piping to redirect the water that filters into the aquifer toward Río Segundo.
It is also recommended that a perimeter or strip be designated on both sides of the highway where the construction of facilities such as repair shops and bus stops that could potentially cause fuel or oil spills into the Barva aquifer would not be permitted.” (appearing at folios 41 and 42); <![if !supportLists]>j. <![endif]>That by memorandum DIGH-0459-2009 of 17 de agosto de 2009, the Dirección de Investigación y Gestión Hídrica of SENARA informed the General Manager that: “…1. during the inspection conducted on 21 de abril de 2009, it was determined that the road grade (rasante) of the highway under construction reached the top of the Barva aquifer and caused it to surface. …3. The Hydrogeological Study (Estudio Hidrogeológico) between Río Virilla and Río Segundo, Section II, San José-Caldera highway, prepared by hydrogeologist Sandra Arredondo, Tecnoambiente, was reviewed. Three piezometers (piezometros) (core samplers) were drilled very close to the highway area. 4.
Based on this hydrogeological study submitted by Arredondo, five mitigation measures were proposed…” (appearing at folios 48, 49, 112 and 113); <![if !supportLists]>k. <![endif]>That by memorandum GE-790-2009 of 02 de setiembre de 2009, the General Manager of the Servicio Nacional de Aguas informed the engineer from Tecnoambiente S.A. that the proposed measures to mitigate the impacts on the Barva Aquifer were accepted (appearing at folios 47 and 111); <![if !supportLists]>l. <![endif]>That the Concessionaire (Concesionario) has already implemented the mitigation measures established in the “Detailed Hydrogeological Study of the Area between Río Virilla and Río Segundo, Section II, San José-Caldera Highway” ("Estudio Hidrogeológico detallado del sector entre el Río Virilla y Río Segundo Tramo II, Carretera San José-Caldera"), in accordance with the provisions issued by SENARA in Memorandum DIGH-0459-2009 (as stated under oath by the respondent authority (autoridad recurrida), appearing at folio 193); <![if !supportLists]>m.<![endif]>That the Tribunal Ambiental Administrativo of the Ministerio del Ambiente, Energía y Telecomunicaciones conducted site visits on 28 de setiembre, 01 de diciembre, 04 de noviembre, all in 2009, and 27 de abril de 2010, to the San José-Caldera project, Autopistas del Sol (appearing at folios 1072, 1210, 2657 and 3107 of the Tribunal Ambiental Administrativo file); <![if !supportLists]>n. <![endif]>That by memorandum IMN-DA-3132-2009 of 01 de octubre de 2009, the Deputy Head of the Departamento de Aguas of the Ministerio de Ambiente, Energía y Telecomunicaciones informed the Tribunal Ambiental Administrativo that “…IV.
It is considered that the work performed has not affected the Barva aquifer; on the contrary, waterproofing work (obras de impermeabilización) was performed to mitigate and prevent contamination by infiltration in an area naturally composed of permeable rock…” (appearing at folios 43 and 44 of the file); <![if !supportLists]>o. <![endif]>That on 27 de enero de 2010, the Dirección de Investigación y Gestión Hídrica of the Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento submitted an expert opinion (dictamen) to the Tribunal Ambiental Administrativo, stating: “…3. Once the road grade caused the groundwater levels of the Barva Aquifer to surface, Tecnoambiente prepared a hydrogeological study for the purpose of mitigating the surfacing of the water; the proposed measures were endorsed by SENARA…” (appearing at folios 173 to 182); <![if !supportLists]>p. <![endif]>That by memorandum DEA-1108-2010 of 05 de abril de 2010, the Departamento de Evaluación Ambiental and the Departamento de Auditoría y Seguimiento Ambiental informed the SETENA Plenary Commission (Comisión Plenaria) that “…Regarding the Barva aquifer, a Mitigation Plan (Plan de Mitigación) was submitted and approved by the competent entity (SENARA), according to memorandum GE-790-2009 of 02 de setiembre de 2009, signed by Bernal Soto Zúñiga in his capacity as General Manager; this document is the only one that complies with the requirements of subsection 4 of the THIRD operative part (por tanto) of resolution 1840-2009-SETENA…” (appearing in the administrative file of the Secretaría Técnica Nacional Ambiental); <![if !supportLists]>q. <![endif]>That by resolution number 628-2010-SETENA, issued at 08:00 on 06 de abril de 2010, the Secretaría Ambiental Nacional Ambiental established: “7. …Regarding the Barva aquifer, a Mitigation Plan was submitted and approved by the competent entity (SENARA), according to memorandum GE-790-2009 of 02 de setiembre de 2009, signed by Bernal Soto Zúñiga in his capacity as General Manager; this document is the only one that complies with the requirements of subsection 4 of the THIRD operative part of resolution 1840-2009-SETENA” (appearing in the administrative file of the Secretaría Técnica Nacional Ambiental).
III.Regarding the right to health and to a healthy environment. On repeated occasions, this Chamber has stated that public health and the right to a healthy and ecologically balanced environment are constitutionally recognized (Articles 21, 50, 73 and 89 of the Constitution (Carta Magna)), as well as under international law. This is supplemented by the provisions of Article 11 of the “Additional Protocol to the American Convention on Human Rights in the Area of Economic, Social and Cultural Rights” ("Protocolo Adicional a la Convención Americana sobre Derechos Humanos en materia de Derechos Económicos, Sociales y Culturales"). A harmonious interpretation of these provisions yields the precautionary principle (principio precautorio), pursuant to which the State must take all necessary measures—within the scope permitted by law—to prevent irreversible harm to the environment. One of the guiding principles of Environmental Law (Derecho Ambiental) is the precautionary principle, also known as the principle of prudent avoidance (evitación prudente).
This principle is embodied in the United Nations Conference on Environment and Development, or Rio Declaration, which states literally: “Principle 15.- In order to protect the environment, States shall widely apply the precautionary approach according to their capabilities. Where there is a threat of serious and irreversible damage, lack of absolute scientific certainty shall not be used as a reason for postponing the adoption of cost-effective measures to prevent environmental degradation.” Within the domestic legal system, the Biodiversity Law (Ley de Biodiversidad) (No. 7788 of 30 de abril de 1998), in Article 11, establishes the following principles as interpretive parameters (parámetros hermenéuticos): “1.- Preventive approach (Criterio preventivo): It is recognized that anticipating, preventing, and addressing the causes of biodiversity loss or threats thereto is of vital importance. 2.- Precautionary approach, or in dubio pro natura (Criterios precautorio o indubio pro natura): Where there is a danger or threat of serious or imminent harm to elements of biodiversity and the knowledge associated with them, the absence of scientific certainty shall not be used as a reason for postponing the adoption of effective protective measures.” In this Chamber’s Judgment (Voto) No. 1250-99, issued at 11:24 on 19 de febrero de 1999 (reiterated in Judgments Nos. 9773-00, issued at 9:44 on 3 de noviembre del 2000; 1711-01, issued at 16:32 on 27 de febrero del 2001; and 6322-03, issued at 14:14 on 3 de julio del 2003), this Court held as follows: “(...) Prevention seeks to anticipate negative effects and ensure the protection, conservation, and proper management of resources.
Consequently, the guiding principle of prevention is based on the need to take and adopt all precautionary measures to avoid or contain potential harm to the environment or human health. Accordingly, where there is a risk of serious or irreversible harm—or uncertainty in that regard—a precautionary measure must be adopted, including postponement of the activity concerned. This is because, in environmental matters, after-the-fact enforcement (coacción a posteriori) is ineffective, since once socially harmful biological consequences have already occurred, punishment may have moral significance but is unlikely to compensate for the environmental damage caused.” Subsequently, in Judgment No. 3480-03, issued at 14:02 on 2 de mayo del 2003, this Court stated that “Properly understood, the precautionary principle concerns the adoption of measures not in the absence of knowledge of the facts giving rise to the risk, but in the absence of certainty as to whether those facts will actually produce harmful effects on the environment.” In the case of groundwater contained in aquifers and recharge and discharge areas (áreas de carga y descarga), the precautionary principle, or in dubio pro natura, entails that when there are no studies or reports prepared in accordance with the univocal and exact rules of science and technology that would make it possible to attain absolute certainty regarding the harmlessness of the activity intended to be carried out with respect to the environment, or when such studies or reports contradict one another, the entities and bodies of the central and decentralized administration must refrain from authorizing, approving, or permitting any new application or application for modification, suspend those currently pending until the uncertainty has been resolved, and, at the same time, adopt all measures aimed at protection and preservation in order to guarantee the right to a healthy and ecologically balanced environment.
In essence, the sound environmental management of groundwater requires protecting the resource before it is contaminated or degraded (judgment number 2004-001923 of fourteen hours and fifty-five minutes on veinticinco de febrero del dos mil cuatro).
IV.Regarding the specific case. In the matter under review, the appellant, in his capacity as a resident and because he considers his rights to health and to enjoy a healthy and ecologically balanced environment to have been violated, files a complaint against Autopistas del Sol S.A. and the Consejo Nacional de Concesiones, alleging that actions violating his right to the environment have been carried out during the construction of the San José-Caldera highway. In particular, he claims that the Barva aquifer has been breached and that, once the highway is opened, both the vibrations and the passage of thousands of vehicles could further fracture the aquifer’s rock and cause greater water leakage, affecting his well, contaminating groundwater, and leaving many people without water. The evidence entered into the record establishes that Autopistas del Sol Sociedad Anónima submitted the San José-Caldera highway construction project to the Secretaría Técnica Nacional Ambiental and that, after the environmental assessment (evaluación ambiental) process was completed, that authority granted it environmental feasibility approval (viabilidad ambiental) through resolution number 2077-2006-SETENA.
During construction of the highway, Autopistas del Sol S.A. cut through the roof of the Barva Aquifer, an occurrence that was assessed by the Secretaría Técnica Nacional Ambiental and the Consejo Nacional de Concesiones. Through resolution number 1840-2009-SETENA of once de agosto de dos mil nueve, the Secretaría Técnica Nacional Ambiental ordered the respondent company to comply with a series of mitigation measures (medidas de mitigación) for the Barva aquifer; and through resolution number 628-2010-SETENA of seis de abril de dos mil diez, it reiterated that the Barva aquifer Mitigation Plan (Plan de Mitigación) complied with the requirements of resolution 1840-2009-SETENA. Engineering works were constructed to drain the water emerging in the area where the Barva aquifers outcrop, with the final discharge from the drains conveyed by pipeline to the río Segundo, which is the river that naturally receives water from the aquifer; a waterproofing system was installed over the drainage system, including an impermeable geomembrane cover to ensure that substances spilled on the highway would not infiltrate; the highway’s stormwater system is separate from the discharge into the río Segundo; and a strip of veinticinco metros was demarcated on both sides of the highway, together with a protection zone (zona de protección) regulating the activities that may be conducted there so as not to harm the Barva aquifer.
The Tribunal Ambiental Administrativo is currently hearing the matter and has ordered measures to prevent damage to the Barva aquifer. This Chamber finds that the right to a healthy and ecologically balanced environment has been violated; neither the respondent company nor the respondent authorities took the measures necessary to prevent the roof of the Barba aquifer from being breached. As established in the preceding considerando, the measures necessary to comply with the precautionary principle (principio precautorio), or principle of prudent avoidance (principio de evitación prudente), were not taken. Given the scale of the highway construction and the environmental damage that could be caused, effective and cost-efficient measures should have been taken to prevent environmental degradation. The Ley de Biodiversidad establishes in artículo 11 the obligation to anticipate, prevent, and address the causes of biodiversity loss or threats to biodiversity, and thereby to adopt effective protective measures.
The respondent authorities were obligated to refrain from authorizing, approving, or permitting any new application or modification, to suspend those already in progress until the uncertainty had been resolved and, in parallel, to adopt all measures aimed at protecting and preserving the aquifer in order to guarantee the right to a healthy and ecologically balanced environment.
V.Regarding the impact on the well designated AB-1540, it is located at topographic coordinates 510050-212250, has a depth of cuarenta metros, and has no reported groundwater level; the flow rate shown in the SENARA database is 0.5 litros por segundo, and there is no technical drilling report (folio170). The sworn report submitted by the Representative of the Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento establishes that there is no hydrogeological assessment (evaluación hidrogeológica) defining the drawdown cone (cono de abatimiento) caused by the highway cut and its possible effect on groundwater levels in the area. Likewise, there is no historical record of groundwater levels, making it impossible to prepare a hydrograph of the well and observe variations in those levels caused by external factors such as highway cuts, climate change, and years of low precipitation. Accordingly, it cannot be deemed established that the flow rate of the well held under concession (concesión) by the appellant decreased as a result of the cutting of the roof of the Barva aquifer.
VI.Autopistas del Sol S.A. is hereby advised that it must ensure that its actions do not cause damage to the Barva aquifer. The respondent authorities are likewise advised, each within its respective sphere of authority, of their obligation to oversee the Proyecto San José-Caldera and to prevent the respondent company from engaging in acts that damage the Barva aquifer.
VII.The appeal shall be granted on the ground that the breach of the roof of the Barva aquifer violated the right to a healthy and ecologically balanced environment. Accordingly, it is granted solely against the Consejo Nacional de Concesiones del Ministerio de Obras Públicas y Transportes, Secretaría Técnica Nacional Ambiental, Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento, and Autopistas del Sol S.A.
Por tanto:
The appeal is granted on the ground that the breach of the roof of the Barva aquifer violated the right to a healthy and ecologically balanced environment. Hadda Muñoz Sibaja, Sonia Espinoza Valverde, and Bernal Soto Zúñiga, in their respective capacities as Manager of the Proyecto San José-Caldera of the Consejo Nacional de Concesiones, Acting Secretary General of the Secretaría Técnica Nacional Ambiental, and General Attorney-in-Fact of the Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento, are ordered to monitor the Barva aquifer continuously and, within un mes, to report on the effectiveness of the mitigation measures for the Barva aquifer. Hadda Muñoz Sibaja, Sonia Esponiza Valverde, Bernal Soto Zúñiga, Cristian Eduardo Sandoval Cataldo, and Carlos Jorge Jaraquemada Valle, in their respective capacities as Manager of the Proyecto San José-Caldera of the Consejo Nacional de Concesiones, Acting Secretary General of the Secretaría Técnica Nacional Ambiental, General Attorney-in-Fact of the Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento, and General Attorneys-in-Fact of Autopistas del Sol S.A., are likewise ordered to refrain from again engaging in the conduct that provided the basis for granting this amparo appeal (recurso de amparo).
The State and Autopistas del Sol S.A. are ordered to pay the legal costs, damages, and losses caused, which shall be assessed during enforcement of the judgment before the administrative-litigation and civil jurisdiction. This decision shall be served on the respondents Hadda Muñoz Sibaja, Sonia Esponiza Valverde, Bernal Soto Zúñiga, Cristian Eduardo Sandoval Cataldo, and Carlos Jorge Jaraquemada Valle, in their respective capacities as Manager of the Proyecto San José-Caldera of the Consejo Nacional de Concesiones, Acting Secretary General of the Secretaría Técnica Nacional Ambiental, General Attorney-in-Fact of the Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento, and General Attorneys-in-Fact of Autopistas del Sol S.A. Autopistas del Sol S.A. and the respondent authorities shall take note of the provisions of Considerando VI.

Recurso de amparo interpuesto por MARCO ANTONIO HERRERO PINTO, portador de la cédula de identidad número uno- cuatrocientos noventa y nueve- ochocientos once, contra el CONSEJO DE CONCESIONES DEL MINISTERIO DE OBRAS PÚBLICAS Y TRANSPORTES, AUTOPISTAS DEL SOL SOCIEDAD ANÓNIMA Y OTROS.
Resultando:
Redacta la Magistrada Pacheco Salazar; y,
Considerando:
I.Objeto del recurso. Alega el recurrente que en el costado oeste de su propiedad, los recurridos rompieron las rocas superficiales que contenían el denominado acuífero Barva, causando que el agua corriera por el lugar donde se construiría la carretera. Acusa que la ruptura del acuífero generó que el pozo del agua de su propiedad, empezara a bajar el caudal, al punto que en la actualidad el agua le es insuficiente para sus necesidades vitales y con ello se está vulnerando el derecho a disfrutar de un ambiente sano y ecológicamente equilibrado así como también el derecho a la salud debido a la invasión y contaminación de esa área pública, por lo que pide que se declare con lugar el recurso.
II.Hechos probados. De relevancia para dirimir el presente recurso de amparo, se tienen por demostrados los siguientes, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ello según lo prevenido en el auto inicial:
<![if !supportLists]>a. <![endif]>Que el pozo denominado AB-1540, cuenta con la concesión número 1555, localizado en las coordenadas topográficas 510050-212250, con una profundidad de cuarenta metros, no reporta nivel de agua subterránea y el caudal es de 0.5 litros por segundo (según indica bajo juramento la autoridad recurrida visible a folio 170); <![if !supportLists]>b. <![endif]>Que de acuerdo al expediente administrativo número 5155-P, en Registro de Concesiones de la Dirección de Aguas, el señor Marco Antonio Herrero Pinto, ahora Tropical Foliage of Costa Rica S.A. gestionó el veinticuatro de setiembre de dos mil nueve, la renovación de la concesión de aguas con un caudal de 3.78 litros por segundo del pozo AB-1540 (visible a folio 76); <![if !supportLists]>c. <![endif]>Que la Secretaría Técnica Nacional Ambiental le otorgó la viabilidad ambiental a Autopistas del Sol mediante resolución número 2077-2006-SETENA (hecho no controvertido); <![if !supportLists]>d. <![endif]>Que no existe una evaluación hidrogeológica que defina el cono de abatimiento del rompimiento de la carretera y su posible afectación a los niveles de agua subterránea de la zona.
Que no existe un registro histórico de niveles de agua subterránea, por lo que es imposible tener el hidrograma del pozo y poder observar variaciones de los niveles por factores externos (según indican bajo juramento las autoridades recurridas visibles a folios 171 y 294 vuelto); <![if !supportLists]>e. <![endif]>Que en audiencia oral y privada número 04 del 15 de abril de 2009, y realizada por la Comisión Plenaria de la SETENA se acuerda llevar a cabo una gira al proyecto en fecha 20 de abril de 2009 (visible en el expediente administrativo de la Secretaría Técnica Nacional Ambiental); <![if !supportLists]>f. <![endif]>Que la Comisión Plenaria de la SETENA realizó audiencia oral y privada número 02 del 01 de julio de 2009 y acordó: “Solicitar al Departamento ASA que remita a más tardar el lunes 06 de julio de 2009, la propuesta de resolución de la última inspección del proyecto. En la misma se deberá incorporar los TRR de la Auditoría Ambiental, medidas de mitigación acuífero Barva (implementación) y lo del equipo regencia ambiental, entre otros.” (visible en el expediente administrativo de la Secretaría Técnica Nacional Ambiental); <![if !supportLists]>g. <![endif]>Que de acuerdo al “Estudio Hidrogeológico detallado del sector entre el Río Virilla y Río Segundo, Tramo II, Carretera San José-Caldera”, las medidas de mitigación para atenuar el corte en el techo del sector donde aflora el acuífero Barva, son: "…a) Desarrollar obras de ingeniería que permitan drenar adecuadamente el flujo de agua que brota en el sector donde afloran las lavas Barva (el diseño final de estos drenajes deberá presentarse a la SETENA a través de los informes de regencia ambiental).
La descarga final de los drenajes debe ser conducida por tubería adecuada hacia el río Segundo que de todos modos es el río efluente del acuífero en condiciones naturales; b) Se deberá instalar un sistema de impermeabilización segura sobre el sistema de drenaje a construir que incluya la cubierta de una geomembrana impermeable que asegure la no infiltración de ninguna sustancia que pueda derramarse sobre la carretera; c) El sistema de pluviales que tendrá la carretera deberá ser independiente en su descarga al río Segundo; d) se debe delimitar en una franja de 25 metros a ambos lados de la carretera y sólo en el sector donde afloran las lavas de la Formación Barva una zona de protección que regule las actividades a desarrollarse para no perjudicar el sector drenado del acuífero Barva; e)Dentro de las regulaciones a establecer es la restitución de desarrollo para proyectos que manejen materias primas de hidrocarburos o productos de ellos, químicos, desechos sólidos orgánicos o plantaciones agrícolas que utilicen agroquímicos.
Se pueden mencionar; estaciones de combustible, actividad pecuniaria, cultivos, industrias químicas, tanques sépticos" (según indica bajo juramento la autoridad recurrida visible a folio 184); <![if !supportLists]>h. <![endif]>Que mediante resolución número 1840-2009-SETENA, de las 08:05 horas del 11 de agosto de 2009, la Secretaría Técnica Nacional Ambiental resuelve: “PRIMERO: Que luego de revisar la información existente en el expediente del proyecto San José-Caldera y de analizar el resultado de las inspecciones, esta Comisión llega a la conclusión de que los principales problemas que se presentan corresponden al tramo II (Ciudad Colón-Orotina) y son los siguientes: 3. Acuífero de Barva. Los trabajos realizados durante la construcción de la carretera rompieron parte del sello del acuífero. Con relación a este punto, en el expediente se encuentra el oficio DIGH-0280-200 del SENARA en el que se hacen una serie de recomendaciones para solucionar este problema; además, existe un estudio hecho por la hidrogeóloga Sandra Arredondo, al cual se le debe dar seguimiento. …TERCERO: …4.
Detallar el resultado de la implementación de las medidas ambientales correctivas con relación a los problemas detectados en cada uno de los tramos de la carretera (Escombreras, Quebrada Salitral y Acuífero Barva)…” (visible a folios 1169 a 1145 del expediente administrativo de la SETENA); <![if !supportLists]>i. <![endif]>Que según informe técnico AT-0213-2010 del 02 de setiembre de 2009. el geólogo Víctor Hugo Vargas López, funcionario de la Dirección de Aguas indica que: “… el Tribunal Ambiental Administrativo (TAA), el Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA) como la Secretaría Técnica Nacional Ambiental (SETENA), ya le ordenaron a la empresa Autopistas del Sol S.A. para que implemente lo antes posible las medidas de mitigación, correctivas y precautorias a fin de evitar daños al acuífero de Barva, como por ejemplo, la colocación de una geomembrana que impida el paso de contaminantes hasta el nivel del agua subterránea y tubería para redireccionar el agua se filtra al acuífero hasta el río Segundo.
Asimismo se recomienda declarar un perímetro o franja a ambos lados de la carretera en donde no se permitan construir actividades como talleres, paradas de buses que pudieran eventualmente ocasionar derrames de combustibles o aceites hacia el acuífero Barva.” (visible a folios 41 y 42); <![if !supportLists]>j. <![endif]>Que mediante oficio DIGH-0459-2009 del 17 de agosto de 2009, la Dirección de Investigación y Gestión Hídrica del SENARA le comunica al Gerente General que: “… 1. durante la inspección realizada el 21 de abril de 2009, se determinó que la rasante de la carretera en construcción alcanzó el techo del acuífero Barva y generó un afloramiento del mismo. …3. Se revisó el Estudio Hidrogeológico entre el Río Virilla y Río Segundo, Tramo II, carretera San José-Caldera, elaborado por la hidrogeóloga Sandra Arredondo, Tecnoambiente. Se perforaron tres piezometros (saca núcleos) ubicados muy cerca de la zona de la carretera. 4.
De acuerdo a este estudio hidrogeológico aportado por Arredondo, se planteó cinco medidas de mitigación …” (visible a folios 48, 49, 112 y 113); <![if !supportLists]>k. <![endif]>Que mediante oficio GE-790-2009 del 02 de setiembre de 2009, el Gerente General del Servicio Nacional de Aguas le comunica a la ingeniera de la empresa Tecnoambiente S.A. que se acepta la propuesta de medidas para mitigar los impactos ocurridos en el Acuífero Barva (visible a folios 47 y 111); <![if !supportLists]>l. <![endif]>Que el Concesionario ya implementó las medidas de mitigación definidas en el "Estudio Hidrogeológico detallado del sector entre el Río Virilla y Río Segundo Tramo II, Carretera San José-Caldera", conforme las disposiciones emitidas por el SENARA en el Oficio DIGH-0459-2009 (según indica bajo juramento la autoridad recurrida visible a folio 193); <![if !supportLists]>m.<![endif]>Que el Tribunal Ambiental Administrativo del Ministerio del Ambiente, Energía y Telecomunicaciones realizó visitas en fechas 28 de setiembre, 01 de diciembre, 04 de noviembre, todos de 2009 y 27 de abril de 2010 al proyecto San José-Caldera, Autopistas del Sol (visible a folios 1072, 1210, 2657 y 3107 del expediente del Tribunal Ambiental Administrativo); <![if !supportLists]>n. <![endif]>Que mediante oficio IMN-DA-3132-2009 del 01 de octubre de 2009, el Subjefe del Departamento de Aguas del Ministerio de Ambiente, Energía y Telecomunicaciones le informa al Tribunal Ambiental Administrativo que “…IV.
Se considera que no se ha afectado el acuífero Barva con las obras realizadas y al contrario se realizaron obras de impermeabilización para mitigar y prevenir la contaminación por infiltración en una zona naturalmente formada por rocas permeables…” (visible a folios 43 y 44 del expediente); <![if !supportLists]>o. <![endif]>Que el 27 de enero de 2010, la Dirección de Investigación y Gestión Hídrica del Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento presenta dictamen al Tribunal Ambiental Administrativo y se señala “…3. Una vez que la rasante de la carretera puso a aflorar los niveles de agua subterránea del Acuífero Barva, se elaboró un estudio hidrogeológico, realizado por la Empresa Tecnoambiente con el objetivo de mitigar el afloramiento de agua, las medidas propuestas fueron avaladas por el SENARA…” (visible a folios 173 a 182); <![if !supportLists]>p. <![endif]>Que mediante oficio DEA-1108-2010 del 05 de abril de 2010, el Departamento de Evaluación Ambiental y el Departamento de Auditoría y Seguimiento Ambiental el comunican a la Comisión Plenaria de la SETENA que “…En relación al acuífero Barva se presenta un Plan de Mitigación que fue aprobado por el ente competente (SENARA), según el oficio GE-790-2009 del 02 de setiembre de 2009, firmado por Bernal Soto Zúñiga, en calidad de Gerente General, este documento es el único que se cumple de acuerdo a los solicitado en el inciso 4 del por tanto TERCERO de la resolución 1840-2009-SETENA…” (visible en el expediente administrativo de la Secretaría Técnica Nacional Ambiental); <![if !supportLists]>q. <![endif]>Que mediante resolución número 628-2010-SETENA de las 08:00 horas del 06 de abril de 2010, la Secretaría Ambiental Nacional Ambiental establece: “7. …En relación al acuífero Barva se presenta un Plan de Mitigación que fue aprobado por el ente competente (SENARA), según el oficio GE-790-2009 del 02 de setiembre de 2009, firmado por Bernal Soto Zúñiga, en calidad de Gerente General, este documento es el único que se cumple de acuerdo a lo solicitado en el inciso 4 del por tanto TERCERO de la resolución 1840-2009-SETENA” (visible en el expediente administrativo de la Secretaría Técnica Nacional Ambiental).
III.Sobre el derecho a la salud y a un ambiente sano. En reiteradas ocasiones esta Sala ha manifestado que la salud pública y el derecho a un ambiente sano y ecológicamente equilibrado se encuentran reconocidos constitucionalmente (artículos 21, 50, 73 y 89 de la Carta Magna) así como a través de la normativa internacional. Se complementa por lo establecido en el numeral 11 del "Protocolo Adicional a la Convención Americana sobre Derechos Humanos en materia de Derechos Económicos, Sociales y Culturales". Interpretando armónicamente las normas, se puede derivar el principio precautorio, según el cual, el Estado tiene que disponer todo lo que sea necesario – dentro del ámbito permitido por la ley – a efecto de impedir que se produzcan daños irreversibles al ambiente. Uno de los principios rectores del Derecho Ambiental lo constituye el precautorio o de evitación prudente. Este principio se encuentra recogido en la Conferencia de las Naciones Unidas sobre el Medio Ambiente y el Desarrollo o Declaración de Río, la cual literalmente indica “Principio 15.- Con el fin de proteger el medio ambiente, los Estados deberán aplicar ampliamente el criterio de precaución conforme a sus capacidades.
Cuando haya peligro de daño grave e irreversible, la falta de certeza científica absoluta no deberá utilizarse como razón para postergar la adopción de medidas eficaces en función de los costos para impedir la degradación del medio ambiente”. En el ordenamiento jurídico interno la Ley de Biodiversidad (No. 7788 del 30 de abril de 1998), en su artículo 11 recoge como parámetros hermenéuticos los siguientes principios: “1.- Criterio preventivo: Se reconoce que es de vital importancia anticipar, prevenir y atacar las causas de la pérdida de biodiversidad o sus amenazas. 2.- Criterios precautorio o indubio pro natura: Cuando exista peligro o amenaza de daños graves o inminentes a los elementos de la biodiversidad y al conocimiento asociado con estos, la ausencia de certeza científica no deberá utilizarse como razón para postergar la adopción de medidas eficaces de protección”. En el Voto de esta Sala No. 1250-99 de las 11:24 horas del 19 de febrero de 1999 (reiterado en los Votos Nos. 9773-00 de las 9:44 horas del 3 de noviembre del 2000, 1711-01 de las 16:32 horas del 27 de febrero del 2001 y 6322-03 de las 14:14 horas del 3 de julio del 2003) este Tribunal estimó lo siguiente: “(...) La prevención pretende anticiparse a los efectos negativos, y asegurar la protección, conservación y adecuada gestión de los recursos.
Consecuentemente, el principio rector de prevención se fundamenta en la necesidad de tomar y asumir todas las medidas precautorias para evitar contener la posible afectación del ambiente o la salud de las personas. De esta forma, en caso de que exista un riesgo de daño grave o irreversible –o una duda al respecto-, se debe adoptar una medida de precaución e inclusive posponer la actividad de que se trate. Lo anterior debido a que en materia ambiental la coacción a posteriori resulta ineficaz, por cuanto de haberse producido ya las consecuencias biológicas socialmente nocivas, la represión podrá tener una trascendencia moral, pero difícilmente compensará los daños ocasionados en el ambiente”. Posteriormente, en el Voto No. 3480-03 de las 14:02 horas del 2 de mayo del 2003, este Tribunal indicó que “Bien entendido el principio precautorio, el mismo se refiere a la adopción de medidas no ante el desconocimiento de hechos generadores de riesgo, sino ante la carencia de certeza respecto de que tales hechos efectivamente producirán efectos nocivos en el ambiente”.
Para el caso de las aguas subterráneas contenidas en los mantos acuíferos y áreas de carga y descarga, el principio precautorio o de indubio pro natura, supone que cuando no existan estudios o informes efectuados conforme a las regla unívocas y de aplicación exacta de la ciencia y de la técnica que permitan arribar a un estado de certeza absoluta acerca de la inocuidad de la actividad que se pretende desarrollar sobre el medio ambiente o éstos sean contradictorios entre sí, los entes y órganos de la administración central y descentralizada deben abstenerse de autorizar, aprobar o permitir toda solicitud nueva o de modificación, suspender las que estén en curso hasta que se despeje el estado dubitativo y, paralelamente, adoptar todas las medidas tendientes a su protección y preservación con el objeto de garantizar el derecho a un ambiente sano y ecológicamente equilibrado. En esencia, una gestión ambiental segura de las aguas subterráneas pasa por proteger el recurso antes de su contaminación o degradación (sentencia número 2004-001923 de las catorce horas cincuenta y cinco minutos del veinticinco de febrero del dos mil cuatro).
IV.Sobre el caso concreto. En el asunto bajo estudio, el recurrente, en su condición de habitante y por estimar vulnerados sus derechos a la salud así como el de disfrutar de un ambiente sano y ecológicamente equilibrado, presenta una denuncia en contra de Autopistas del Sol S.A. y el Consejo Nacional de Concesiones al considerar que en el proceso de construcción de la autopista San José-Caldera, se han realizado actuaciones que vulneran su derecho al ambiente, en especial reclama que hay una ruptura del acuífero Barva y que con la apertura de la pista, tanto la vibración como el rodamiento de miles de vehículos, pueden romper más las rocas del acuífero y provocar un mayor escape de agua, afectando su pozo, contaminando aguas subterráneas y dejando sin agua a muchas personas. De las pruebas aportadas a los autos se tiene que la empresa Autopistas del Sol Sociedad Anónima, presentó proyecto para la construcción de la autopista San José-Caldera ante la Secretaría Técnica Nacional Ambiental, y después de concluirse el proceso de evaluación ambiental, mediante resolución número 2077-2006-SETENA, esa autoridad le otorgó viabilidad ambiental.
La empresa Autopistas del Sol S.A., en el proceso constructivo de la autopista, cortó el techo del Acuífero de Barva, que fue valorado por la Secretaría Técnica Nacional Ambiental y el Consejo Nacional de Concesiones. La Secretaría Técnica Nacional Ambiental mediante resolución número 1840-2009-SETENA del once de agosto de dos mil nueve, ordena a la empresa recurrida cumplir con una serie de medidas de mitigación en el acuífero de Barva; y mediante resolución número 628-2010-SETENA del seis de abril de dos mil diez, se recalca que el Plan de Mitigación del acuífero Barva cumplió con lo solicitado en la resolución 1840-2009-SETENA. Se desarrollaron obras de ingeniería para drenar el agua que brota en el sector donde afloran los acuíferos de Barva, la descarga final de los drenajes conducida por tubería hacia el río Segundo, que es el río afluente del acuífero en condiciones naturales; se instaló un sistema de impermeabilización sobre el sistema de drenaje que incluyó la cubierta de una geomembrana impermeable para garantizar la no infiltración de sustancias que pudieran derramarse sobre la carretera; el sistema de pluviales que tiene la carretera es independiente de la descarga al río Segundo; se delimitó una franja de veinticinco metros a ambos lados de la carretera y una zona de protección que regule las actividades a desarrollarse y no perjudicar el acuífero de Barva.
El Tribunal Ambiental Administrativo actualmente está conociendo el asunto y ha ordenado las medidas para prevenir daños al acuífero de Barva. Constata esta Sala que se ha dado una vulneración al derecho a un ambiente sano y ecológicamente equilibrado; tanto la empresa recurrida como las autoridades accionadas no tomaron las medidas necesarias con el fin de evitar que se rompiera el techo del acuífero de Barba. Como se estableció en el considerando anterior, no se tomaron las medidas necesarias para cumplir con el principio precautorio o de evitación prudente. Debido a la magnitud de la construcción de la carretera y el daño ambiental que se podía ocasionar, se debían tomar medidas eficaces en función de los costos para impedir la degradación del ambiente. La Ley de Biodiversidad establece en el artículo 11 la obligación de anticipar, prevenir y atacar las causas de la pérdida de biodiversidad o sus amenazas y así adoptar las medidas eficaces de protección.
Las autoridades recurridas tenían la obligación de abstenerse de autorizar, aprobar o permitir toda solicitud nueva o modificación, suspender las que estuvieran en curso hasta que se despejara el estado dubitativo y, paralelamente, adoptar todas las medidas tendientes a su protección y preservación con el objeto de garantizar el derecho a un ambiente sano y ecológicamente equilibrado.
V.En cuanto a la afectación al pozo denominado AB-1540, se encuentra localizado en las coordenadas topográficas 510050-212250, con una profundidad de cuarenta metros y no reporta nivel de agua subterránea y el caudal que aparece en la base de datos del SENARA es de 0.5 litros por segundo; no presenta informe técnico de la perforación (folio170). Del informe rendido bajo juramento por el Apoderado del Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento, se constata que no existe una evaluación hidrogeológica que defina el cono de abatimiento del rompimiento de la carretera y su posible afectación a los niveles de agua subterránea de la zona. De la misma manera, no existe un registro histórico de niveles de agua subterránea, por lo que es imposible tener un hidrograma del pozo y poder observar variaciones de los niveles por factores externos como cortes de la carretera, cambio climático y años de poca precipitación. De lo anterior, no se puede tener como demostrado que a raíz del corte de el techo del acuífero de Barva, el pozo que tiene en concesión el recurrente haya bajado en su caudal.
VI.Se le advierte a la empresa Autopistas del Sol S.A. que debe velar porque no hayan daños al acuífero de Barva producto de sus actuaciones. Así mismo se le advierte a las autoridades recurridas, cada una en sus ámbitos de competencia, de su obligación de vigilar el Proyecto San José-Caldera y de evitar que la empresa recurrida incurra en actos que dañen el acuífero de Barva.
VII.Procede declarar con lugar el recurso por la violación a un ambiente sano y ecológicamente equilibrado por el rompimiento del techo del acuífero de Barva. En el mismo sentido, se declara con lugar únicamente contra el Consejo Nacional de Concesiones del Ministerio de Obras Públicas y Transportes, Secretaría Técnica Nacional Ambiental, Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento y la empresa Autopistas del Sol S.A.
Por tanto:
Se declara con lugar el recurso por la violación a un ambiente sano y ecológicamente equilibrado, por el rompimiento del techo del acuífero de Barva. Se le ordena a Hadda Muñoz Sibaja, Sonia Espinoza Valverde y Bernal Soto Zúñiga en su condición de Gerente del Proyecto San José-Caldera del Consejo Nacional de Concesiones, Secretaria General a.i. de la Secretaría Técnica Nacional Ambiental y Apoderado Generalísimo del Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento, monitorear permanentemente el acuífero de Barva, así como informar en el plazo de un mes la efectividad de las medidas de mitigación del acuífero de Barva. De igual manera se ordena a Hadda Muñoz Sibaja, Sonia Esponiza Valverde, Bernal Soto Zúñiga, Cristian Eduardo Sandoval Cataldo y Carlos Jorge Jaraquemada Valle, en su condición de Gerente del Proyecto San José-Caldera del Consejo Nacional de Concesiones, Secretaria General a.i. de la Secretaría Técnica Nacional Ambiental, Apoderado Generalísimo del Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento y Apoderados Generalísimos de la empresa Autopistas del Sol S.A., respectivamente, abstenerse de incurrir, nuevamente, en los hechos que dieron fundamento a la estimatoria de este recurso de amparo.
Se condena al Estado y a la empresa Autopistas del Sol S.A. al pago de de las costas, daños y perjuicios causados, los que se liquidarán en ejecución de sentencia ante la jurisdicción contencioso administrativa y lo civil. Notifíquese a los recurridos la presente resolución a Hadda Muñoz Sibaja, Sonia Esponiza Valverde, Bernal Soto Zúñiga, Cristian Eduardo Sandoval Cataldo y Carlos Jorge Jaraquemada Valle, en su condición de Gerente del Proyecto San José-Caldera del Consejo Nacional de Concesiones, Secretaria General a.i. de la Secretaría Técnica Nacional Ambiental, Apoderado Generalísimo del Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento y Apoderados Generalísimos de la empresa Autopistas del Sol S.A., respectivamente. Tomen nota la empresa Autopistas del Sol S.A. y las autoridades recurridas, de lo establecido en el VI considerando.
