San José, at ten thirty-six a.m. on May twenty-seven, two thousand eight.- Writ of amparo (recurso de amparo) filed by CARLOS ALBERTO RAMÍREZ AGUILAR, identity card number 104500628, on behalf of MARION EDITH UNGLAUBE, passport number 6522016523, against the MINISTERIO DE AMBIENTE Y ENERGÍA.
Background:
Justice Cruz Castro drafts the opinion; and,
Whereas:
I.Subject matter of the proceeding. The appellant alleges a violation of her fundamental rights arising from the failure of the authorities of the Ministry of Environment and Energy to expropriate the property owned by the protected party, and from the failure of the National Environmental Technical Secretariat to rule on the appeals filed against order number 2238-2005-SETENA dated 30 de agosto de 2005, which suspends the environmental impact assessment procedure until the Constitutional Chamber rules on proceeding 05-002756-0007-CO.
II.Proven facts. The following facts are deemed duly established and material to the determination of this matter, either because they have been proven or because the respondent failed to address them as ordered in the initial order:
III.Merits.- In this matter, the complaint concerns, on the one hand, the respondent Ministry’s failure to expropriate the privately owned land belonging to the protected party and located within Las Baulas National Park, despite the fact that the law creating that National Park, Law Nº7524 dated 10 de julio de 1995, establishes that obligation in order to safeguard the nesting of the leatherback sea turtle, and despite the fact that, by order R-421-MINAE issued at 10:30 hours on 8 de noviembre de 2004 and published in La Gaceta N°237 on 3 de diciembre de 2004, the acquisition of a portion of the property recorded in the National Registry under Real Property Folio registration 5066513-000, owned by Ms. Marion Edith Unglaube, was declared to be in the public interest. In this regard, Article 2 of Law Nº7524 provides:
“ARTICLE 2.- Expropriations. To implement this Law, the competent institution shall undertake the expropriation of all or part of the properties located within the area delimited in the preceding article.
The privately owned lands located within that boundary shall be subject to expropriation and shall be considered part of Las Baulas Marine National Park until acquired by the State through purchase, donation, or expropriation; in the meantime, the owners shall enjoy the full exercise of the incidents of ownership.” Regarding the processing of the expropriation of the property belonging to the amparo petitioner (amparada), the respondent Minister reports that, by Resolution NºR–421–MINAE of 10:30 hrs. on 8 de noviembre de 2004, published in the Official Gazette La Gaceta Nº237 of 3 de diciembre de 2004, the acquisition of part of the property belonging to Ms. Marion Edith Unglaube was declared to be in the public interest (interés público). Nevertheless, this Constitutional Court notes that Ley Nº7524 entered into force on 16 de agosto de 1995; therefore, almost ten years elapsed before the Executive Branch began the expropriation of those properties, which is excessive and unjustified.
Although the acquisition of part of the property owned by the amparo petitioner and recorded in the National Registry under Real Property Folio (Folio Real), registration number 5066513-000, was declared to be in the public interest, the expropriation was not ordered until December 2004 and has not been carried out to date. Rather, the Office of the Attorney General of the Republic states in the report submitted to the Chamber (folio 361) that the request filed in 2005 by the respondent MINAE with the Office of the Attorney General, for the purpose of initiating judicial expropriation proceedings (diligencias judiciales expropiatorias) concerning the property belonging to Ms. Marion Edith Unglaube, was not processed because it was legally impossible to grant the request due to defects in the administrative procedure (procedimiento administrativo) reflected in the case file (as indicated in official letter ADPb-476-2005 of 28 de febrero de 2005, addressed to Lic. Carlos Manuel Rodríguez Echandi, Minister of Environment and Energy).
Added to the foregoing is the statement made by the Attorney General of the Republic in her report, according to which: “...a review of the computer system in which requests to process expropriation cases are recorded confirmed that no new request from MINAE has been processed concerning the filing of judicial expropriation proceedings against Ms. Marion Edith Unglaube.” The foregoing factual circumstances reveal an excessive delay by the Administration in initiating the expropriation procedure (procedimiento expropiatorio), which was ordered by Resolution NºR–421–MINAE of 10:30 hrs. on 8 de noviembre de 2004, and violate the constitutional principle contained in Article 41 of the Political Constitution requiring prompt and full justice (justicia pronta y cumplida), because almost 18 months elapsed between the issuance of the resolution declaring the acquisition of part of Ms. Marion Edith Unglaube’s property to be in the public interest and the date on which this action was filed, without the expropriation process having begun.
This delay cannot be justified—as the respondent authority mistakenly argues—by errors attributable to the Administration, such as the fact that appraisal (avalúo) AA-46-2004 granted her eight days to file an appeal against the appraisal before the Administrative Tax Court, even though no such appeal exists because Article 26 of the Expropriations Act, which provided for that possibility, was repealed by Article 1 of Ley n°7757 of 10 de marzo de 1998, or the fact that the survey plans were not properly registered during all that time. On the contrary, the facts deemed duly established in this matter, together with the evidence obtained to facilitate adjudication (prueba para mejor resolver), namely the report submitted by the Office of the Attorney General of the Republic (folio 361), show that the respondent MINAE has repeatedly urged the Office of the Attorney General to initiate the expropriation proceeding sought by the amparo petitioner.
The Office of the Attorney General has been unable to process the matter because of procedural errors that it specifically identified to MINAE, without MINAE, in almost two years, having taken the necessary steps to correct the defects identified by that Office. In view of the foregoing, the appropriate course is to grant the amparo insofar as it is directed against the Ministry of Environment and Energy—for its failure to initiate and process, with due diligence, the expropriation procedure concerning the amparo petitioner affected by Ley Nº7524 of 10 de julio de 1995.
IV.Violation of Articles 27 and 41 of the Political Constitution by the National Environmental Technical Secretariat. The appellant (recurrente) further alleges that, although in September 2005 she filed a motion for reconsideration or revocation (recurso de reconsideración o de revocatoria) and an appeal (apelación) against Resolution N.° 2238-2005-SETENA 30 de agosto del 2005, by which SETENA agreed to suspend the processing of environmental approvals (viabilidades ambientales), as of the date this action was filed the respondent authority had neither decided nor communicated its decision on the remedies filed. As this Court has held in its case law, the right established in Article 27 of the Political Constitution refers to every citizen’s right to submit a written petition to any public official or government entity for the purpose of presenting a matter of interest. That guarantee is complemented by the right to receive a prompt response, although the latter does not necessarily mean a favorable response.
In other words, what is guaranteed is the right to ask, not the right to obtain what is requested, even though the public official must decide in strict accordance with the law, because freedom of petition rests on another principle: the Administration may not restrict the right of the governed to address public bodies. Thus, the petition procedure makes it possible to submit to the Administration matters that cannot be obtained through an administrative remedy, provided that the Administration is not barred from acting because the matter is governed by mandatory rules (materia reglada). However, as the Chamber has repeatedly stated, when claims or remedies are involved, the applicable constitutional provision is not Article 27 but Article 41: “By resorting to the laws, everyone shall obtain redress for injuries or damage suffered to their person, property, or moral interests. They must receive prompt and full justice, without denial and in strict accordance with the laws.” This is because administrative claims and remedies, unlike ordinary petitions, require a procedure to verify the facts that will constitute the grounds for the final administrative act (acto final), as well as the adoption of the pertinent evidentiary measures.
With respect to the period granted to the Administration to respond, Article 32 of the Constitutional Jurisdiction Act provides as follows: “When the amparo concerns the right of petition and the right to obtain a prompt decision, established in Article 27 of the Political Constitution, and no period for responding has been specified, the violation shall be deemed to occur once ten business days have elapsed from the date on which the request was submitted to the administrative office, without prejudice to consideration, in deciding the action, of the reasons asserted for deeming that period insufficient, in light of the circumstances and nature of the matter.” In this case, the documentary evidence entered into the record, as well as the report submitted by the Secretary General of the National Environmental Technical Secretariat, establishes that the remedies filed by the amparo petitioner in September 2005 were decided by Resolution number 680-2006–SETENA, of 5 de abril de 2006 (folio 121).
Almost 7 months elapsed between the challenge filed by the appellant and the date on which the remedies were decided, which is unquestionably excessive and violates the principle of prompt and full justice; accordingly, the action must be granted on this issue.
V.Conclusion. Consequently, the appropriate course is to grant the amparo insofar as it is directed against the Ministry of Environment and Energy because of the delay in initiating and processing the expropriation procedure concerning the amparo petitioner’s private parcel of land (fundo privado), affected by the provisions of Ley Nº7524 of 10 de julio de 1995, and against SETENA because of the delay in deciding the remedies filed by the amparo petitioner against Resolution number 680-2006–SETENA, of 5 de abril de 2006. On this point, the appellant is advised that it is not for this Court to instruct the respondent Administration as to which body of law must be applied in the expropriation procedure, because this is a question of ordinary legality that must be argued before the Administration itself or, where appropriate, before the corresponding ordinary court.

The action is granted. Insofar as it is directed against the Ministry of Environment and Energy, it is granted because the Ministry delayed for more than 10 years in pursuing the expropriation procedures for private parcels of land located within Parque Nacional Marino Las Baulas, under the terms of Ley Nº7524 of 10 de julio de 1995. Carlos Manuel Rodríguez Echandi, in his capacity as Minister of Environment and Energy, or whoever holds that office, is ordered, if he deems it appropriate, to proceed with the expropriation of the amparo petitioner’s private parcel of land affected by Ley 7524 of 10 de junio de 1995, in which case the corresponding actions must be continued within a reasonable period. If sufficient budgetary resources are unavailable for the expropriation, the private owners must be granted the permits and authorizations necessary for them to exercise their property rights effectively, provided they have the necessary environmental impact study (estudio de impacto ambiental) and environmental licenses (licencias ambientales) ruling out the possibility of endangering the conservation of endangered species.
As to SETENA, the action is granted for violation of the principle of prompt and full justice due to the delay in deciding the motions for revocation with appeal (recursos de revocatoria con apelación) filed against Resolution N.° 2238-2005-SETENA 30 de agosto del 2005. Carlos Manuel Rodríguez Echandi, in his capacity as Minister of Environment and Energy, or whoever holds that office, is advised that failure to comply with this order will constitute the offense of disobedience and that, pursuant to Article 71 of the Law governing this jurisdiction, anyone who receives an order issued in an amparo proceeding that must be complied with or enforced, and who fails to comply with or enforce it, shall be punished by imprisonment for three months to two years, or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The State is ordered to pay costs and compensation for damages arising from the freezing of the amparo petitioner’s parcel of land without the expropriation process being determined within a reasonable period. This decision shall be served personally upon Carlos Manuel Rodríguez Echandi, in his capacity as Minister of Environment and Energy, or whoever holds that office. LET IT BE COMMUNICATED.

San José, a las diez horas con treinta y seis minutos del veintisiete de mayo del dos mil ocho.- Recurso de amparo interpuesto por CARLOS ALBERTO RAMÍREZ AGUILAR, cédula de identidad número 104500628, a favor de MARION EDITH UNGLAUBE, pasaporte número 6522016523, contra el MINISTERIO DE AMBIENTE Y ENERGÍA.
Resultando:
Redacta el Magistrado Cruz Castro; y,
Considerando:
I.Objeto del recurso. La recurrente reclama la violación de sus derechos fundamentales, por la omisión de las autoridades del Ministerio de Ambiente y Energía, y de la Secretaría Técnica Nacional Ambiental de expropiar el inmueble propiedad de la amparada el primero y de resolver los recursos interpuestos contra la resolución número 2238-2005-SETENA de 30 de agosto de 2005; que suspende el procedimiento de evaluación de impacto ambiental hasta que la Sala Constitucional resuelve el recurso 05-002756-0007-CO.
II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
III.Sobre el fondo.- En este asunto se reclama por un lado la omisión del Ministerio recurrido de Nacional Las Baulas, pese a que la Ley de creación de ese Parque Nacional, Ley Nº7524 de 10 de julio de 1995, estipula esa obligación para salvaguardar la anidación de la tortuga baula y de que por resolución R-421-MINAE de las 10:30 horas del 8 de noviembre de 2004, publicada en La Gaceta N°237 de 3 de diciembre de 2004, se declara de interés público la adquisición de parte del inmueble inscrito en el Registro Nacional al Folio Real matrícula 5066513-000 propiedad de las señora Marion Edith Unglaube. Al respecto, el artículo 2º de la Ley Nº7524, estipula:
“ARTICULO 2.- Expropiaciones. Para cumplir con la presente Ley, la institución competente gestionará las expropiaciones de la totalidad o de una parte de las fincas comprendidas en la zona delimitada en el artículo anterior.
Los terrenos privados comprendidos en esa delimitación serán susceptibles de expropiación y se considerarán parte del Parque Nacional Marino las Baulas, hasta tanto no sean adquiridos por el Estado, mediante compra, donaciones o los atributos del dominio.” En cuanto a la tramitación de la expropiación de la propiedad de la amparada, el Ministro accionado informa que por resolución NºR–421–MINAE de las 10:30 hrs. de 8 de noviembre de 2004, publicada en el Diario Oficial La Gaceta Nº237 de 3 de diciembre de 2004, se declaró de interés público la adquisición de parte del inmueble de la señora Marion Edith Unglaube. No obstante, llama la atención de este Tribunal Constitucional que la Ley Nº7524 entró en vigencia desde el 16 de agosto de 1995; de modo que el plazo transcurrido para que el Poder Ejecutivo comenzara la expropiación de esos inmuebles, es de casi diez años, lo que es excesivo e injustificado.
Véase que a pesar de que se declaró de interés público la adquisición de parte del inmueble inscrito en el Registro Nacional al Folio Real matrícula 5066513-000 propiedad de la amparada, la llevado a cabo; sino que apunta la Procuraduría General de la República en el informe rendido a la Sala (folio 361) que la solicitud planteada por el MINAE recurrido ante la Procuraduría General en el 2005, afín de entablar diligencias judiciales expropiatorias relacionadas con el inmueble propiedad de la Sra. Marion Edith Unglaube no fue gestionada debido a que existe imposibilidad jurídica para acceder a lo solicitado por vicios de procedimiento administrativo que presenta el expediente (así señalado en el oficio ADPb-476-2005 de 28 de febrero de 2005 dirigido al Lic. Carlos Manuel Rodríguez Echandi; Ministros de Ambiente y Energía). A lo anterior se agrega lo expuesto por la Procuradora General de la República en su informe según el cual: "...consultado el sistema informático en el que se registran las peticiones para tramitar procesos de expropiación, se constató que no se ha tramitado ninguna nueva solicitud del MINAE en relación con la interposición de diligencias judiciales de expropiación contra la Sra. Marion Edith Unglaube." El cuadro fáctico anterior revela tardanza excesiva de la Administración de iniciar el procedimiento expropiatorio, que se ordenó por resolución NºR–421–MINAE de las 10:30 hrs. de 8 de noviembre de 2004 y resulta lesivo del principio constitucional que contiene el artículo 41 de la Constitución Política, de justicia pronta y cumplida, pues ha trascurrido un plazo de casi de 18 meses entre la emisión de la resolución que declaró de interés público la adquisición de parte del inmueble de la señora Marion Edith Unglaube y la fecha de interposición del recurso, sin que se haya iniciado el trámite la autoridad recurrida-, en errores atribuibles a la Administración, tales como que el avalúo AA-46-2004, en que se le otorgó un plazo de ocho días para presentar recurso de apelación contra el avalúo ante el Tribunal Fiscal Administrativo, recurso que no existe por haberse derogado el artículo 26 de la Ley de Expropiaciones que otorgaba dicha posibilidad, mediante el artículo 1 de la Ley n°7757 de 10 de marzo de 1998 o que en todo ese tiempo no se hayan catastrado los planos como corresponde.
Por el contrario, de los hechos que se tienen por debidamente demostrados en este asunto en relación con la prueba para mejor resolver que es el informe rendido por la Procuraduría General de la República (folio 361) se tiene que el MINAE recurrido, ha instado en varias ocasiones a la Procuraduría General para que inicie el proceso expropiatorio que reclama la amparada, siendo que la Procuraduría se ha visto imposibilitada de tramitar lo que corresponde, debido a errores en el procedimiento que ha señalado puntualmente al MINAE sin que éste, en casi dos años, haya hecho lo propio por corregir los vicios señalados por la Procuraduría. En virtud de lo contra el Ministerio de Ambiente y Energía –por su omisión de iniciar y tramitar, con la celeridad debida, el procedimiento de expropiación de la amparada afectado por la Ley Nº7524 de 10 de julio de 1995.
IV.De la violación a los artículos 27 y 41 de la Constitución Política por parte de la Secretaría Técnica Nacional Ambiental. Acusa además la recurrente que a pesar de que presentó desde setiembre de 2005, recurso de reconsideración o de revocatoria y apelación contra la resolución N.° 2238-2005-SETENA 30 de agosto del 2005 la SETENA que acuerda suspender los trámites para otorgar viabilidades ambientales a la fecha de presentación de este recurso, la autoridad recurrida no ha resuelto ni comunicado los recursos interpuestos. Tal y como lo ha sostenido este Tribunal a través de su jurisprudencia, el derecho establecido en el artículo 27 de la Constitución Política hace referencia a la facultad que posee todo ciudadano para dirigirse por escrito a cualquier funcionario público o entidad oficial con el fin de exponer un asunto de su interés. Esa garantía se complementa con el derecho a obtener pronta respuesta; pero esto último no necesariamente significa una contestación favorable.
En otras palabras, es el derecho a pedir y no el derecho a obtener lo que se pide, lo que se garantiza, aún cuando el funcionario público deba resolver con estricta sujeción a la ley, pues la libertad de petición se funda en otro principio, esto es, en que no puede coartarse por la Administración el derecho de los gobernados para dirigirse a los órganos públicos. De manera que, la vía de petición permite plantear a la Administración lo que no se puede obtener por vía de recurso ante ella, siempre y cuando a ésta no le esté vedado hacerlo por tratarse de materia reglada. Sin embargo, como lo ha señalado repetidamente la Sala, no es el artículo 27 constitucional el aplicable sino el 41 cuando se trata de reclamos o recursos: "Ocurriendo a las leyes, todos han de encontrar reparación para las injurias o daños que hayan recibido en su persona, propiedad o intereses morales. Debe hacérseles justicia pronta, cumplida, sin denegación y en estricta conformidad con las leyes".
Lo anterior por cuanto los reclamos y recursos administrativos, a diferencia de las peticiones puras, requieren un procedimiento para verificar los hechos que han de servir de motivo al acto final, así como adoptar las medidas probatorias pertinentes. En cuanto al plazo otorgado a la administración para contestar tenemos que el artículo 32 de la Ley de la Jurisdicción Constitucional establece lo siguiente: "Cuando el amparo se refiera al derecho de petición y de obtener pronta resolución, establecido en el artículo 27 de la Constitución Política, y no hubiere plazo señalado para contestar, se entenderá que la violación se produce una vez transcurridos diez días hábiles desde la fecha en que fue presentada la solicitud en la oficina administrativa, sin perjuicio de que, en la decisión del recurso, se aprecien las razones que se aduzcan para considerar insuficiente ese plazo, atendidas las circunstancias y la índole del asunto".
En este asunto, de la prueba documental allegada a los autos, como del informe rendido por el Secretario General de la Secretaría Técnica Nacional Ambiental se tiene por acreditado que los recursos interpuestos por la amparada en setiembre de 2005 fueron resueltos por resolución número 680- 2006–SETENA, de 5 de abril de 2006 (folio 121). Han trascurrido casi de 7 meses, de la impugnación planteada por la recurrente a la fecha de resolución de los recursos presentados, lo que indudablemente resulta excesivo, y es violatorio del principio de justicia pronta y cumplida, por lo que procede acoger el recurso en cuanto a este extremo.
V.Conclusión. Como consecuencia, lo procedente es declarar con lugar el amparo, en cuanto se dirige contra el Ministerio de Ambiente y Energía por el retraso en la iniciación y tramitación del procedimiento de expropiación del fundo privado de la amparada afectado por lo dispuesto en la Ley Nº7524 de 10 de julio de 1995 y contra la SETENA, en la resolución de los recursos presentados por la amparada contra la resolución número 680-2006–SETENA, de 5 de abril de 2006. En este punto se advierte a la recurrente que no compete a este Tribunal indicar a la administración recurrida cuál es la normativa que debe aplicarse en el procedimiento de expropiación, por tratarse de un tema de legalidad que debe discutir ante la propia administración o en su caso, ante el juez ordinario correspondiente.
Por tanto:
Se declara con lugar el recurso. En cuanto se dirige contra el Ministerio de Ambiente y Energía por haber demorado más de 10 años en gestionar los procedimientos de expropiación de los fundos privados situados dentro del Parque Nacional Marino Las Baulas, en los términos de la Ley Nº7524 de 10 de julio de 1995. Se ordena a Carlos Manuel Rodríguez Echandi, en su condición de Ministro de Ambiente y Energía o a quien ocupe el cargo, proceder si lo estima conveniente, a la expropiación del fundo privado propiedad del amparado efectuado por la Ley 7524 del 10 de junio de 1995, en cuyo caso se deberá continuar con las acciones correspondientes en un plazo razonable. En caso de no contar con los recursos presupuestarios suficientes para expropiar, concederle a los propietarios privados los permisos y autorizaciones para que puedan ejercer efectivamente su derecho de propiedad en el tanto cuenten con el estudio de impacto ambiental necesario y las licencias ambientales que descarten la posibilidad de poner en riesgo la conservación de especies en peligro de extinción.
En cuanto a SETENA, se declara con lugar el recurso por violación al principio de justicia pronta y cumplida, por la tardanza en la resolución de los recursos de revocatoria con apelación formulados contra la resolución N.° 2238-2005-SETENA 30 de agosto del 2005. Se le advierte a Carlos Manuel Rodríguez Echandi, en su condición de Ministro de Ambiente y Energía o a quien ocupe el cargo, que de no acatar la orden dicha, incurrirá en el delito de desobediencia y, que de conformidad con el artículo 71 de la Ley de esta jurisdicción, se le impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado Se condena al Estado al pago de costas, daños y perjuicios por el congelamiento al que se sometió el fundo del amparado, sin que se definiera en un plazo razonable el trámite de la expropiación. Notífiquese esta resolución a Carlos Manuel Rodríguez Echandi, en su condición de Ministro de Ambiente y Energía o a quien ocupe el cargo, de forma personal. COMUNÍQUESE.
