Findings of Fact (Resultando):
Justice Certad Maroto drafted the opinion; and,
Considering:
I.Subject matter of the action. Based on the allegations raised by the petitioner, this Chamber admitted the following claims for consideration: that the so-called “Villa Hermosa” mega residential development, being developed in San Rafael de Oreamuno, presents a series of irregularities surrounding the supply of drinking water, anomalies concerning the stormwater easement toward the Río Tatiscu, and failure to comply with the buffer or protection zone in relation to Agroindustria Prococo, S.A., all of which violates the protected parties’ right to a healthy and ecologically balanced environment, as well as their health. The petitioner requests protection of the residents’ right to enjoy a healthy, harmonious, and ecologically balanced environment, as well as their safety, health, and physical integrity.
II.Proven facts. The following facts are deemed duly established and relevant to the disposition of this matter, either because they have been substantiated or because the respondent failed to address them as directed in the initial order:
III.Regarding the irregularities in supplying drinking water to the Villa Hermosa housing project. As established by Article 169 of the Constitución Política, the Código Municipal, and the Ley de Construcciones, municipalities are responsible for administering local services and interests in order to promote the comprehensive development of the cantons in harmony with national development. Consequently, municipalities must establish a comprehensive urban-planning policy (política integral de planeamiento urbano), in accordance with the applicable law, aimed at the efficient and harmonious development of urban centers and guaranteeing—at a minimum—efficient electricity and communications services; sound systems for supplying drinking water and disposing of wastewater (aguas servidas), through adequate aqueduct and sewer systems; modern systems for lighting and beautifying cities; efficient services for constructing, repairing, and cleaning streets and other public roads; and, in general, concrete and practical plans to make life comfortable and safe for the population within their respective jurisdictions.
In the case before us, the petitioner (recurrente) alleges that the “Villa Hermosa” residential development, located in San Rafael de Oreamuno, displays a series of irregularities concerning its drinking water supply; in summary, he asserts that the project was approved by the Concejo Municipal on the assumption that it had its own well with sufficient capacity to supply the drinking water it required; that the municipal engineer arranged for the project to receive water from the Municipalidad’s network but failed to inform the Concejo thereof, and that there are no studies showing that the project’s actual needs would be met, in addition to the fact that no tests have been conducted regarding the well’s capacity and useful life. He asserts that a laboratory determined that the well could be operated for only eighteen hours per day because it must be allowed time to recover, but the municipal engineer exempted the project from installing storage tanks in the homes; he further asserts that the well-protection area (zona de protección)—a radius of 15 meters around the well—was not respected.
The respondent authorities (autoridades recurridas) reject the petitioner’s assertion in this regard, and it is deemed established that, beginning in January two thousand five, INVU’s Dirección de Urbanismo granted its approval (visado) to the Vista Hermosa residential complex by means of the corresponding stamps. On those same construction plans, on the following January twenty-five, the Municipalidad de Oreamuno affixed its “Approved” stamp for that project, which was ratified by the Alcalde Municipal and the professional responsible for the project on behalf of that municipal entity, engineer Armando Campos Quesada. It is likewise deemed proven, based on the reports submitted and the evidence entered into the record, that official letters DI-URBA-13-03 and DI-URBA-13a-04 of October twenty-two, two thousand four, and December seventeen of the same year, respectively, signed by engineer Luis Armando Campos Q. in his capacity as Ingeniero Municipal for the canton of Oreamuno de Cartago, certified the availability of drinking water for the project, as stated in Official Letter SG-OF-0346- 2006 signed by the Subgerente General del Banco Hipotecario de la Vivienda, appearing at folio 111; furthermore, through resolution number 317-2006-SETENA of February fourteen, two thousand six, the Environmental Impact Study, together with its Annex and supplementary requirements, was approved, for which reason the Comisión Plenaria de la Secretaría Técnica Ambiental granted environmental clearance (viabilidad ambiental) to the Urbanización Vista Hermosa project, expediente number 181-2005-SETENA.
In fact, SETENA’s representatives informed the Sala that the petitioner’s concerns at issue in this amparo proceeding were answered by the Secretaría Técnica Nacional Ambiental through resolution number 866-2006-SETENA at fourteen hours forty minutes on May seventeen, two thousand six, when ruling on a motion for nullity (incidente de nulidad) and a motion for reconsideration with a subsidiary appeal (recurso de revocatoria con apelación en subsidio), filed by the Frente Ciudadano pro mejoramiento de la calidad de vida de Oreamuno against resolution number 317-2006- SETENA. Likewise, resolution 865-2006-SETENA of May seventeen, two thousand six, relying on the technical opinion issued in official letter number DAP-196-06 by the Project Administration Department, signed by geographer Esaú Chaves and dated March thirty, two thousand six, established the following regarding the alleged irregularities concerning the drinking water supply for the housing project that is the subject of this amparo proceeding: “As stated in Anexo 14 of the Environmental Impact Study for the Vista Hermosa Project, pumping tests were conducted on well IS - 468, which will supply water to the project, beginning in September 2002.
According to those data, the well has the appropriate technical conditions to serve as the project’s water-supply source. If deemed necessary, the construction company shall equip the homes with water-storage tanks.” It is also deemed established that the housing project has a sewer network and treatment plant, and that there is no contamination of the well, which is not shallow but is more than one hundred fifty meters deep. This application was reviewed and approved by SETENA and the Ministerio de Salud. In that context, no violation or unlawful threat to any person’s fundamental rights can be discerned in connection with the project at issue as to this matter; accordingly, these allegations warrant dismissal of this appeal, and it is hereby so ordered, without ruling on any potential irregularities committed by the officials responsible for granting the respective permits, because that matter exceeds the jurisdiction of this Sala and must therefore be heard—should the petitioner so choose—in ordinary proceedings (vía ordinaria).
IV.Irregularities concerning the stormwater easement (servidumbre pluvial). The petitioner asserts that the municipal engineer of Oreamuno, acting irregularly and unlawfully, ordered the imposition of an easement encumbrance (gravamen de servidumbre) to divert stormwater from the residential development to the Tatiscú River, which he deemed indispensable for carrying out the project, or else improperly authorized the project, since he stamped its development plans, which showed the easement across third-party properties toward the Tatiscú River, without authorization from the competent body. He also states that authorization from the Legislative Assembly was required to empower the Junta Administrativa del Liceo Carrillo to authorize that encumbrance, but that requirement has not been met, nor was an appraisal conducted to estimate the value of that easement in an acceptable manner. Despite this and the progress of the work, the easement has not even been authorized.
He asserts that the risk of flooding that occurs every year on the properties located south of the parcel has likewise not been addressed, because the precautions required by sound engineering practice were not taken, thereby increasing the risk; and that, despite the requirement imposed by INVU for a ten-meter setback (retiro) on each side of the “unnamed” irrigation ditch (acequia “sin nombre”), this requirement is not met with respect to the homes located south of the parcel, even though they will receive the increased flow in that same channel. Worse still, he says, it appears that the requirement to obtain a stormwater easement over the Liceo Carrillo property to divert water from the private residential development toward the Tatiscú River was not fulfilled, which could increase the risk of flooding already reported by residents of the area who have been affected by the situation. In this regard, the petitioner must be advised that defining and enforcing the requirements for establishing an easement such as the one he describes does not fall within the jurisdiction of this Chamber, nor does ruling on any irregularities that officials may have committed when processing or granting the corresponding permits.
The only issue concerning that easement that is within this Court’s jurisdiction is whether the respondent competent authorities considered the precautions necessary to prevent construction of the project in question from creating a greater risk of flooding at the site, where flooding—as this Chamber has been informed—already occurs, which could potentially endanger the fundamental rights of persons who might be affected, including their lives and property. In this respect, official letter SG-OF- 0346-2006, signed by the Deputy General Manager of the Banco Hipotecario de la Vivienda, establishes that the Municipalidad de Oreamuno granted authorization to discharge the project’s stormwater into Dirección01. It also establishes that, because problems arose concerning the creation of the easement required for the discharge initially planned into the Tatiscú River, the project developer proposed, as an alternative solution, discharging stormwater from the entire project into the Chinchilla River, a proposal endorsed by the Municipalidad de Oreamuno.
In this regard, according to the sworn report submitted to this Chamber by the municipal authorities, in order not to aggravate the flooding problem that already exists in the area and affects existing homes outside the project, the diversion of the “unnamed” stream (quebrada “sin nombre”) to the Chinchilla River was contemplated; moreover, in the Urbanización El Agropecuario, it runs through a pipe beneath the existing public street. The Ministerio del Ambiente y Energía and the Secretaria General de la Secretaría Técnica Nacional Ambiental reported on this matter that, according to the construction plan, the setback from the “unnamed” irrigation ditch crossing the property has been maintained throughout the project, thereby preventing the danger of flooding. Regarding this aspect, official letter SG-OF-0346-2006, signed by the Deputy General Manager of the Banco Hipotecario de la Vivienda (appearing at folio 113), states that precisely because of this circumstance, the project has three fewer lots that could not be developed, in order to comply fully with the competent authorities’ requirements concerning the need for that setback.
Based on the foregoing, the Chamber concludes that, at least with respect to the facts alleged by the petitioner, there are no apparent omissions by the respondent authorities that place any person’s fundamental rights at risk concerning the possibility that development of the project at issue could cause flooding due to the improper disposal of stormwater. Accordingly, the amparo petition (amparo) must also be dismissed as to this claim, and it is so ordered.
V.Regarding the buffer or protection zone (zona de amortiguamiento o protección) in relation to Agroindustria Prococo, S.A. The petitioner alleges that adjacent to the “Villa Hermosa” housing project there is an agroindustrial plantation that makes intensive use of agrochemicals, and therefore it is not sufficient merely to “inform” residents of the risk or expect them to take preventive measures to avoid it, as this situation endangers human health. Regarding this matter, official letter SG-OF-0346-2006, signed by the Deputy General Manager of the Banco Hipotecario de la Vivienda, states that the project plans approved by the Dirección de Urbanismo del INVU and the Municipalidad de Oreamuno contain no indication of a buffer zone along the boundary with Prococo S.A. Nevertheless, that official letter also states that, according to an unnumbered note dated veintisiete de julio de dos mil seis, engineer Luis Blanco Castro indicated that, pursuant to the environmental manager’s (regente ambiental) instructions, the following measures had been taken at the boundary with Prococo S.A.: “The established protection strip, that is, 4 meters wide, shall be provided as follows: one meter on the property of Prococo S.A. and three meters within the project area; additionally, wherever required, a prefabricated wall 2.5. meters high is being constructed ‘to separates’ (sic) the two properties; in due course, a bamboo hedge will be planted within the Prococo S.a. area, and pine trees will be planted, all of this as recommended by the Environmental Manager and in furtherance of the applicable requirements.” (see folio 114).
This information was confirmed in its essential respects in the sworn report submitted by the municipal authorities (folio 192), according to which they were aware that, on an unspecified date, a satisfactory agreement had been reached between PROCOCO and the developers of the Vista Hermosa housing project for the purpose of establishing a buffer strip between that project and the land on which the company conducts its operations. There is also a commitment to reforest that area, which will be three meters wide, with an additional two meters along the PROCOCO boundary, where the natural barrier specified by PROCOCO’s own forestry professionals has already been planted. The Housing Project constructed a wall along the boundary, in addition to the commitment that no agrochemicals will be used within fifteen meters of that boundary because PROCOCO is certified under ISO standards. The Chamber finds that, given the decisions adopted concerning this matter, no violation of any person’s fundamental rights or unlawful threat warranting the granting of this petition has been established.
Nevertheless, the Ministra de Salud, the Alcalde de la Municipalidad de Oreamuno, and Setena are hereby advised that, within the scope of their respective powers, they must take timely and periodic measures to verify compliance with these provisions and oversee their continued observance, in order to safeguard the right of the future residents of the homes being built in the project at issue to enjoy a healthy and ecologically balanced environment and their right to health.

The petition is denied. The Ministra de Salud, the Alcalde de la Municipalidad de Oreamuno, and Setena shall take note of the provisions stated in Considerando VI insofar as they concern their respective responsibilities.

Resultando:
Redacta el Magistrado Certad Maroto; y,
Considerando:
I.Objeto del recurso. De los alegatos esgrimidos por el recurrente esta Sala dio curso a los siguientes: que el llamado mega proyecto urbanístico "Villa Hermosa", desarrollado en San Rafael de Oreamuno, evidencia una serie de irregularidades en torno a la dotación de agua potable, anomalías sobre la servidumbre pluvial hacia el Río Tatiscu e incumplimiento de la zona de amortiguamiento o protección en relación con la Agroindustria Prococo, S.A., todo lo cual violenta el derecho a un ambiente sano y ecológicamente equilibrado, así como la salud de los amparados. Solicita que se salvaguarde el derecho de los habitantes a disfrutar de un medio ambiente sano, armónico y ecológicamente equilibrado, así como la seguridad, la salud y la integridad física.
II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
III.Sobre las irregularidades para la dotación de agua potable al proyecto habitacional Villa Hermosa. Conforme lo establece el artículo 169 de la Constitución Política, el Código Municipal y la Ley de Construcciones, corresponde a las municipalidades la administración de los servicios e intereses locales con el fin de promover el desarrollo integral de los cantones, en armonía con el desarrollo nacional. En consecuencia las municipalidades deben establecer una política integral de planeamiento urbano, de acuerdo con la ley respectiva, que persiga el desarrollo eficiente y armónico de los centros urbanos y que garantice -al menos- eficientes servicios de electrificación y de comunicación; buenos sistemas de provisión de agua potable y evacuación de aguas servidas, mediante adecuados sistemas de acueductos y alcantarillado, modernos sistemas de iluminación y ornato de las ciudades; eficientes servicios de construcción, reparación y limpieza de calles y otras vías públicas y, en general, planes concretos y prácticos para hacer confortable y segura la vida de la población en sus respectivas jurisdicciones.
En el caso que nos ocupa el recurrente acusa que el proyecto urbanístico "Villa Hermosa", sito en San Rafael de Oreamuno, evidencia una serie de irregularidades en torno a la dotación de agua potable; en síntesis, afirma que el proyecto fue aprobado por el Concejo Municipal sobre el supuesto de que contaba con un pozo propio con capacidad para abastecer el agua potable que requería; que el ingeniero municipal dispuso otorgar agua de la red de la Municipalidad a ese proyecto pero omitió informar eso al Concejo y no se tienen estudios de que se cubrirían las necesidades reales del proyecto, amen de que no se han realizado pruebas de la capacidad y vida útil del pozo. Afirma que un laboratorio determinó que el pozo sólo sería explotable durante dieciocho horas al día pues se le debe dar tiempo de recuperación, pero el ingeniero municipal eximió al proyecto de la instalación de tanques de almacenamiento en las viviendas, además, afirma que la zona de protección para el pozo (radio de 15 metros alrededor del pozo) no se respetó.
Las autoridades recurridas rechazan la afirmación del recurrente al respecto y se tiene por cierto que desde enero de dos mil cinco la Dirección de Urbanismo del INVU, mediante los sellos correspondientes, otorgó el visado para el conjunto residencial Vista Hermosa. En los mismos planos constructivos el veinticinco de enero siguiente la Municipalidad de Oreamuno emitió el sello de "Aprobado" para dicho proyecto, lo que fue ratificado por Alcalde Municipal y el profesional responsable del proyecto por parte de ese ente municipal, ingeniero Armando Campos Quesada. Se tiene por demostrado de igual forma, con base en los informes rendidos y la prueba allegada a los autos, que mediante los oficios DI-URBA-13-03 y DI-URBA-13a-04 del veintidós de octubre de dos mil cuatro y diecisiete de diciembre del mismo año, respectivamente, firmados por el ingeniero Luis Armando Campos Q. en calidad de Ingeniero Municipal del cantón de Oreamuno de Cartago, se otorgó disponibilidad de agua potable para el proyecto, según consta en el Oficio SG-OF-0346- 2006 suscrito por el Subgerente General del Banco Hipotecario de la Vivienda visible a folio 111; además, por resolución número 317-2006-SETENA del catorce de febrero de dos mil seis se aprobó el Estudio de Impacto Ambiental, juntamente con su Anexo y requisitos complementarios, motivo por el cual la Comisión Plenaria de la Secretaría Técnica Ambiental otorgó la viabilidad ambiental al proyecto Urbanización Vista Hermosa, expediente número 181-2005-SETENA.
De hecho, la representación de la SETENA informó a la Sala que las inquietudes del recurrente objeto de este amparo fueron contestadas por la Secretaría Técnica Nacional Ambiental mediante resolución número 866-2006-SETENA de las catorce horas cuarenta minutos del diecisiete de mayo de dos mil seis, al resolver un incidente de nulidad y recurso de revocatoria con apelación en subsidio interpuestos por el Frente Ciudadano pro mejoramiento de la calidad de vida de Oreamuno contra la resolución número 317-2006- SETENA. De igual forma en la resolución 865-2006-SETENA del diecisiete de mayo de dos mil seis, apoyándose en el criterio técnico emitido en el oficio número DAP-196-06 del Departamento de Administración de Proyecto, suscrito por el geógrafo Esaú Chaves con fecha treinta de marzo de dos mil seis, se estableció lo siguiente sobre las alegadas irregularidades sobre la dotación de agua potable para el proyecto habitacional objeto de este amparo : "Según consta en el Anexo 14 del Estudio de Impacto Ambiental del Proyecto Vista Hermosa desde el mes de septiembre del 2002 se realizaron las pruebas de bombeo en el pozo IS - 468 que aportará el agua al proyecto.
Según dichos datos el pozo tiene condiciones técnicas apropiadas como fuente de abastecimiento de agua para el proyecto. En caso de considerarlo necesario la empresa constructora deberá dotar a las viviendas de tanques para el almacenamiento de agua." Se tiene por cierto también que el proyecto habitacional cuenta con red de cloaca y planta de tratamiento, así como que no hay contaminación hacia el pozo, el cual no es superficial sino un pozo de más de ciento cincuenta metros de profundidad. Esta gestión fue analizada y aprobada por SETENA y el Ministerio de Salud. En ese contexto, no se aprecia lesión alguna o amenaza ilegítima a los derechos fundamentales de persona alguna con el proyecto de marras en cuanto a este extremo y, por consiguiente, sobre estos alegatos procede la desestimatoria de este recurso y así se procede, sin emitir pronunciamiento sobre eventuales irregularidades cometidas por los funcionarios encargados de otorgar los permisos respectivos, por ser un asunto que excede las competencias de esta Sala y que, por consiguiente, debe ventilarse -si a bien lo tiene el recurrente- en la vía ordinaria.
IV.Anomalías sobre la servidumbre pluvial. Aduce el recurrente que el ingeniero municipal de Oreamuno, en forma anómala e ilegal dispuso imponer un gravamen de servidumbre para desviar aguas pluviales de la urbanización hacia el río Tatiscú, que él determinó como indispensable para poder realizar el proyecto o bien autorizó indebidamente el proyecto, pues selló los planos urbanísticos del mismo que indicaban la servidumbre sin estar autorizada por el órgano competente, a través de fincas ajenas hacia el río Tatiscú. También señala que se requería la autorización de la Asamblea Legislativa que facultara a la Junta Administrativa del Liceo Carrillo para que autorizara ese gravamen, pero no se cuenta con ese requisito, así como tampoco se efectuó un avalúo para estimar, en forma aceptable, el valor de esa servidumbre. Pese a ello y al avance de las obras, la servidumbre no ha sido siquiera autorizada.
Afirma que tampoco se ha resuelto el riesgo de inundaciones que se producen todos los años en las propiedades ubicadas al sur de la finca, porque no se tomaron las previsiones que la buena técnica exige, aumentando la situación de riesgo y a pesar del requisito de un retiro de diez metros a cada lado de la acequia "sin nombre" que fue exigido por el INVU, sostiene que no se cumple en las viviendas ubicadas al sur de la finca, no obstante que recibirán el incremento de caudal en ese mismo cauce, peor aún porque al parecer -dice- no se cumplió con obtener el requisito de servidumbre pluvial sobre la finca del Liceo Carrillo para desviar aguas de la urbanización privada hacia el río Tatiscú, lo que podría aumentar el riesgo de inundaciones, ya denunciado por los habitantes de la zona víctimas de la situación. Al respecto, debe indicarse al recurrente que definir y hacer cumplir los requisitos para constituir una servidumbre como la que él indica no es competencia de esta Sala, así como tampoco pronunciarse sobre eventuales irregularidades que hayan cometido los funcionarios tramitar u otorgar los permisos correspondientes.
Ahora bien, el único problema que incumbe a este Tribunal en lo que atañe a la servidumbre a la que se refiere el recurrente, es si las autoridades competentes recurridas han considerado las previsiones necesarias para evitar que con la construcción del proyecto en cuestión se produzca un mayor riesgo de inundaciones en el lugar, de las que -según se informa a la Sala- ya ocurren, lo que eventualmente pondría en peligro derechos fundamentales de personas que podrían verse afectadas, derechos tales como la vida y su patrimonio. Sobre el particular, se tiene por demostrado con vista en el oficio SG-OF- 0346-2006 suscrito por el Subgerente General del Banco Hipotecario de la Vivienda que la Municipalidad de Oreamuno otorgó la autorización para desfogar las aguas pluviales del proyecto al Dirección01; asimismo, que debido a que surgieron problemas en torno a la creación de la servidumbre que debía ser creada para realizar el desfogue inicialmente previsto en el río Tatiscú, el desarrollador del proyecto planteó como alternativa de solución para desfogar el agua pluvial de todo el proyecto en el río Chinchilla, propuesta que fue avalada por la Municipalidad de Oreamuno.
En ese sentido, según informaron bajo juramento las autoridades municipales a esta Sala, para no incrementar el problema de inundaciones que ya existe en la zona, perjudicando viviendas existentes y externas al proyecto, se contempló el desvío de la quebrada "sin nombre" al Río Chinchilla; asimismo, en la Urbanización El Agropecuario pasa entubada debajo de la calle pública existente ahí. Informó sobre este tema el Ministerio del Ambiente y Energía y la Secretaria General de la Secretaría Técnica Nacional Ambiental que según el plano constructivo se ha guardado a todo lo largo del proyecto el retiro de la acequia "sin nombre" que pasa por la propiedad, con lo que se evita el peligro de inundaciones. En cuanto a este aspecto, consta en el oficio SG-OF-0346-2006 suscrito por el Subgerente General del Banco Hipotecario de la Vivienda (visible a folio 113), que justamente por esta circunstancia el proyecto cuenta con tres lotes menos que no se pudieron desarrollar, para dar cabal cumplimiento a lo dispuesto por las autoridades competentes sobre la necesidad de ese retiro.
Concluye la Sala de lo expuesto que, al menos por los hechos que acusa el recurrente, no se aprecian omisiones de las autoridades recurridas que pongan en riesgo los derechos fundamentales de persona alguna, en lo que atañe a la posibilidad de que con el desarrollo del proyecto que nos ocupa se produzcan inundaciones por indebida disposición de aguas pluviales. En tal virtud, también en cuanto a este extremo el amparo debe desestimarse y así se procede.
V.En cuanto a la zona de amortiguamiento o protección en relación con la Agroindustria Prococo, S.A. Alega el recurrente que contiguo al proyecto habitacional "Villa Hermosa" existe una plantación agroindustrial que aplica agroquímicos en forma intensiva, por lo que no basta con "informar" a los habitantes del riesgo ni pretender que ellos tomen las medidas preventivas para evitarlos, situación que pone en peligro la salud humana. Sobre este tema, consta en el oficio SG-OF-0346-2006 suscrito por el Subgerente General del Banco Hipotecario de la Vivienda que en los planos aprobados para el proyecto por la Dirección de Urbanismo del INVU y por la Municipalidad de Oreamuno que no existe indicación de zona de amortiguamiento con el colindante Prococo S.A.; no obstante, también en ese oficio se consigna que de acuerdo con nota sin número del veintisiete de julio de dos mil seis, el ingeniero Luis Blanco Castro indicó que según disposición del regente ambiental, actualmente en torno al punto de la colindancia con Prococo S.A. se han actuado de la siguiente manera: "La franja de protección establecida, sean 4 metros de ancho, estarán cedidas de la siguiente manera, un metro en propiedad de Prococo S.A. y tres metros en la zona del proyecto; adicionalmente se esta (sic) construyendo donde se requiere una tapia en sistema prefabricado con una altura de 2.5. metros "de desvincula" (sic) ambas fincas, se construirá en su momento y en la zona de Prococo S.a. un seto de Bambú y se plantaran (sic) árboles de Pino, todo esto como recomendación del Regente Ambiental y en procura de lo dispuesto." (ver folio 114).
Esta información fue ratificada en lo medular en el informe rendido bajo juramento por las autoridades municipales (folio 192), según el cual tienen conocimiento de que en fecha no determinada se llegó a un arreglo satisfactorio entre la empresa PROCOCO y los desarrolladores del proyecto habitacional Vista Hermosa, con el afán de formar una franja de amortiguamiento entre ese proyecto y el terreno donde se desarrolla la actividad de esa empresa. También existe un compromiso de reforestación de esa zona, la cual va a ser de tres metros de ancho y dos metros en la colindancia de PROCOCO, sobre lo cual ya se cultivó la barrera natural definida por los propios forestales de PROCOCO. Por parte del Proyecto de Vivienda se construyó una tapia sobre la colindancia, en forma adicional al compromiso de que a quince metros de dicho lindero no se utilizará ningún agroquímico debido a que la empresa PROCOCO es certificada con las normas ISO.
Estima la Sala que al haberse tomado las decisiones indicadas sobre este aspecto no se constata ninguna lesión a los derechos fundamentales de persona alguna ni amenaza ilegítima que amerite la estimatoria de este recurso; sin embargo, se apercibe a la Ministra de Salud, al Alcalde de la Municipalidad de Oreamuno y a la Setena que dentro del marco de sus competencias deberán tomar, oportuna y periódicamente, las medidas correspondientes con el fin de verificar el cumplimiento de esas disposiciones y fiscalizar que se mantengan, en tutela del derecho a disfrutar de un medio ambiente sano y ecológicamente equilibrado y del derecho a la salud de los futuros habitantes de las viviendas que se construyen en el proyecto que nos ocupa.
Por tanto:
Se declara sin lugar el recurso. Tomen nota la Ministra de Salud, al Alcalde de la Municipalidad de Oreamuno y a la Setena de lo indicado en el Considerando VI para lo de su cargo.
