Document Review Decision No. 2026005259 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine thirty-four a.m. on February thirteenth, two thousand twenty-six.

Amparo appeal (recurso de amparo) processed under case number 25-037879-0007-CO, filed by [Name 001], identity card number [Value 001], against the CONSEJO NACIONAL DE VIALIDAD -CONAVI-.

Facts:

  1. 1By a written submission filed with this Court at 11:30 on 04 de diciembre de 2025, the appellant filed an amparo appeal against CONAVI. The appellant states that, for several years, Route 415 has experienced progressive deterioration of its roadway surface (superficie de rodamiento), slopes (taludes), and drainage structures (obras de paso), a problem that worsened in April 2021 when a landslide occurred in the Pascua de Siquirres area, causing the collapse of an entire section of the roadway and the complete closure of vehicular passage, as a result of which traffic was diverted via Route 10. The appellant indicates that, instead of receiving a prompt and effective response from the authorities, the local residents—including the appellant—improvised a temporary passage, which was never replaced by permanent infrastructure by the Consejo Nacional de Vialidad. The appellant states that subsequently, in 2024, the bridge located in San Antonio sustained structural damage to its support foundations due to cold surge No. 3, leaving it visibly deteriorated and “unstable,” which currently poses a genuine risk of collapse.The appellant further recounts that earth movement (movimiento de tierra) is also occurring in the same area and has caused deep cracks, subsidence, and deformation of the roadway, without any appropriate technical intervention; the appellant therefore complains that the lack of stabilization, drainage, and retaining works increases the risk of further landslides during heavy rainfall. The appellant emphasizes that Route 415 is vital to the community because it is used by workers, carriers, students, and vehicles transporting sick persons, and that each day of inaction increases the risk of serious accidents, unattended medical emergencies, or loss of income due to the inability to travel. The appellant alleges that, in view of this situation, the local residents—including the appellant—have submitted formal and informal petitions (gestiones) to CONAVI (see the evidence submitted by the appellant), requesting the repair and stabilization of the route and the bridge; however, the appellant complains that the responses have been inadequate, generic, or dilatory, and have been limited to minor work or mere technical assessments without the execution of specific works.The appellant considers that this ongoing omission by CONAVI perpetuates a latent risk affecting rights such as life, health, freedom of movement, work, education, and access to efficient public services, constituting a current and continuing violation attributable to the Administration’s inaction. In light of the foregoing, the appellant requests that this appeal be granted and that the appropriate relief under law be ordered.
  2. 2By decision issued at 10:02 on 16 de diciembre de 2025, the Presidency of the Court admitted this constitutional proceeding for review and requested that the executive director of CONAVI submit a report concerning the facts alleged by the appellant.
  3. 3In a written submission added to the digital case file at 10:57 on 06 de enero de 2026, Mauricio Sojo Quesada, in his capacity as acting executive director of CONAVI, reports under oath as follows:

“IV. CONSIDERATION OF THE MERITS OF THE PETITION In this regard, it should be noted that this analysis is confined exclusively to matters falling within the scope of the powers legally vested in this Administration, in strict adherence to the Principle of Legality and the functions conferred upon the Consejo Nacional de Vialidad. For the proper consideration of the situation raised in this amparo petition (recurso de amparo), the Road and Bridge Maintenance Management Office and the Road and Bridge Construction Management Office, both management offices of the Consejo Nacional de Vialidad, were asked to issue the corresponding technical reports concerning the facts alleged in this amparo petition. In that context, the technical report issued by the Road and Bridge Maintenance Management Office, identified as CARTA-CONAVI-CA-DIE-GCSV-DRHA-077-2025 dated 19 de diciembre de 2025, addresses the situation of the bridge located in the San Antonio sector.

For its part, the technical report prepared by the Road and Bridge Construction Management Office, identified as CARTA-CONAVI-CA-DIE-GCTR-DVP-DDV-021-2025, dated 18 de diciembre de 2025, addresses matters related to the landslide that occurred in the Pascua de Siquirres sector. Based on the aforementioned technical reports, and in accordance with the Principle of Legality, the scope of the powers vested in the Consejo Nacional de Vialidad, and the rules of sound rational judgment (sana crítica racional) and logic, this institutional representative hereby responds, in an orderly, objective, and specific manner, to the allegations made by the petitioner in this amparo petition, in order to refute the alleged omission and substantiate the technical and administrative actions undertaken by this Administration. The petitioner attributes to the Consejo Nacional de Vialidad (CONAVI) an alleged continuing failure to address conditions on Ruta Nacional N.º 415, specifically in the Pascua de Siquirres and San Antonio sectors, citing deterioration of the roadway, damage caused by landslides, and an alleged structural risk affecting the bridge over the río Blanco.

In this regard, the petitioner requests the intervention of the Sala Constitucional, asserting that the current condition of Ruta Nacional N.º 415 reveals progressive deterioration of its roadway surface, slopes, and drainage structures (obras de paso). The petitioner states that this problem allegedly worsened beginning in abril de 2021, when a landslide occurred in the Pascua de Siquirres sector that—according to the petitioner—caused the collapse of an entire section of the roadway and the complete closure of the road to vehicular traffic. In that context, the petitioner specifically alleges that: 1. I am a regular user of Ruta Nacional n.° 415, specifically the section between La Alegría and Bonilla. This road is the only route available for the daily travel of local residents to workplaces, educational institutions, healthcare facilities, commercial establishments, and other basic services.

This is partially admitted. CONAVI does not dispute that Ruta Nacional N.° 415 is an important road for the communities of La Alegría, Bonilla, Pascua, and San Antonio, or that it is used to access basic services. However, the fact that a route is important does not mean that any damage caused by natural phenomena automatically constitutes a violation of fundamental rights. Rather, specialized technical assessments must be conducted to determine whether an actual risk exists and which measures are appropriate; such assessments were in fact conducted by CONAVI in this case. 2. For several years, Ruta 415 has experienced progressive deterioration of its roadway surface, slopes, and drainage structures. However, the situation became particularly severe following the landslide that occurred in abril del año 2021 in the Pascua de Siquirres sector, which caused the collapse of an entire section of the roadway and the complete closure of Ruta Nacional n.° 415 to vehicular traffic, as officially reported by the Comisión Municipal de Emergencias de Siquirres, requiring all traffic to be diverted via Ruta 10.

The petitioner’s allegation is based on a partially accurate fact but contains technical inaccuracies and erroneous conclusions by attributing to the Consejo Nacional de Vialidad an alleged prolonged omission or worsening of conditions attributable to the Administration. It is true that a landslide occurred in the Pascua de Siquirres sector in el año 2021; however, it must be clarified that this event: • Resulted from natural and geological conditions of the terrain beyond the Administration’s control. • Was addressed within the available technical and operational capabilities, taking into account the geotechnical complexity of the area, which may contain active geological faults, as confirmed by the most recent technical reports. It should be emphasized that geodynamic processes cannot be corrected immediately or through a linear process, and addressing them requires prior comprehensive studies; it is therefore technically incorrect to claim that the Administration has remained inactive.

First, it should be noted that the event that occurred in abril de 2021 in the Pascua de Siquirres sector was a naturally occurring landslide associated with the area’s particular geological, geomorphological, and hydrological conditions, rather than a construction defect, a failure of routine maintenance, or an administrative omission, as shown by the technical reports issued by the competent CONAVI Management Offices. Indeed, the technical reports state that the area at kilometer 29+200 of Ruta Nacional n.° 415 is situated on terrain that is highly susceptible to instability and where the following conditions converge: • Geotechnically unstable materials, • The presence of surface water and groundwater, • Steep slopes, • And conditions under which landslides can foreseeably occur during severe hydrometeorological events. From the standpoint of rational analysis, it is incorrect to assert that the route’s “progressive deterioration” results from a lack of administrative intervention when the phenomena described arise from complex natural processes that cannot be addressed through routine maintenance work alone but instead require highly complex structural solutions that have been properly studied and designed.

With respect to the complete closure of the road to vehicular traffic in el año 2021, it is true that the route was temporarily closed and traffic was diverted via Ruta Nacional N° 10 for reasons of road safety and the protection of human life. However, that closure: • Was a necessary and reasonable preventive measure adopted in response to a sudden natural event, • Does not in itself constitute evidence of administrative inaction, • Nor does it mean that the Administration abandoned its efforts to address the problem. On the contrary, far from failing to act, CONAVI began a progressive technical and administrative process that is duly documented in the reports submitted, including:

  • 1)The procurement of specialized studies through Licitación N.° 2022CD-000147- 0006000001, aimed at preparing the design for a permanent solution to the landslide that affected kilometer 29+200.
  • 2)Completion of the design phase, with provisional and final approval of the Final Report in el año 2025, once the corresponding technical and professional requirements had been met.
  • 3)Formal commencement of the pre-construction phase, which includes the complex process of land acquisition and expropriations necessary before any permanent project can be undertaken.
  • 4)The technical assessment of various construction alternatives, some of which entail extremely high costs and must be evaluated under technical, economic, and functional prefeasibility criteria, in accordance with the principle of reasonableness in the use of public funds. From a logical and objective standpoint, it is not legally valid to demand an immediate or improvised solution when the technical reports themselves warn that interventions not preceded by adequate studies could worsen the instability of the terrain and create a greater risk for users. Accordingly, although the landslide in el año 2021 was a serious event that affected travel along Ruta Nacional n.° 415, it cannot be asserted that the situation “worsened” because of CONAVI’s inaction or that the reported deterioration resulted from an administrative omission, because: • The problem is predominantly natural in origin, • The Administration has acted in a technical, gradual, and documented manner, • And the matter is currently at an essential preliminary stage preceding the execution of permanent works. For all the foregoing reasons, allegation N.° 2 made by the petitioner lacks sufficient technical and legal grounds to establish a violation of fundamental rights attributable to the Consejo Nacional de Vialidad. 3. Subsequently, rather than receiving a prompt and effective response from the competent authorities, the residents themselves used makeshift methods and limited resources to open a temporary passage so that travel could continue. This community “repair” was never replaced with a formal, safe, and permanent project undertaken by CONAVI. This allegation is denied because it is stated in general terms and lacks technical or evidentiary support. CONAVI cannot endorse or carry out improvised or informal works, precisely because it has a duty to ensure technically sound and safe solutions. The existence of makeshift interventions by third parties cannot be attributed to an administrative omission and does not replace the institution’s responsibility to act in accordance with technical, legal, and budgetary criteria. The petitioner’s allegation that, in the absence of a prompt and effective response from the competent authorities, the residents themselves used makeshift methods to open a temporary passage that was never replaced with a formal, safe, and permanent project undertaken by CONAVI is inconsistent with the facts duly established in the technical reports and does not reflect CONAVI’s actions concerning Ruta Nacional n.° 415. According to technical reports CARTA-CONAVI-CA-DIE-GCTR-DVP-DDV-021 2025 and CARTA-CONAVI-CA-DIE-GCSV-DRHA-077-2025, the instability event that occurred in the Pascua de Siquirres sector in el año 2021 was a complex geodynamic phenomenon associated with the natural conditions of the terrain, which could not be addressed through an immediate and permanent intervention without first conducting the necessary technical, geological, hydraulic, and structural studies. From a technical and administrative standpoint, it is improper to assert either that the residents’ temporary opening of a passage replaces or displaces CONAVI’s authority or that this community action is attributable to an institutional omission. Any formal intervention at the site required specialized studies because of the instability of the slope and the risk of recurring landslides; therefore, a permanent project without technical support would have been contrary to the principle of legality and the duty to protect human life. The Administration could not immediately undertake permanent works without an approved technical design, environmental feasibility (viabilidad ambiental), budgetary availability, and contractual authorization in accordance with public procurement regulations. The community passage referenced by the petitioner was not constructed, authorized, or endorsed by CONAVI and therefore cannot be attributed to this Institution or regarded as a temporary institutional solution.

It should be emphasized that, according to the technical reports incorporated into this response, CONAVI did carry out assessment, inspection, and monitoring activities at the site, incorporating the affected section of National Route No. 415 into a progressive technical approach consistent with the magnitude of the event and the complexity of the terrain. The immediate absence of permanent works does not constitute per se an administrative omission, but rather the logical consequence of a technical process requiring planning, preliminary studies, and strict compliance with the applicable legal framework. It is not reasonable to require the Administration to execute permanent works at a geologically unstable site without the necessary technical and legal conditions, particularly when doing so could aggravate the risk or give rise to governmental liability for improper interventions. Consequently, claim No. 3 lacks technical and legal support because it is based on the petitioner’s subjective assessments and disregards the site’s technical complexity, as well as the legal limitations governing the execution of public works.

Therefore, neither an omission attributable to the National Roadway Council nor a current violation of fundamental rights arising from the alleged facts has been established. 4. At present, the bridge near San Antonio is visibly deteriorated and “undermined,” with damage to its structure and support foundations caused by cold surge #3 of 2024. This creates a reasonable fear that a serious accident or even the collapse of the structure may occur.” Rejected. The petitioner asserts that the bridge is in poor structural condition. However, those assertions are not duly supported by technical evidence. Specifically, the petitioner: • Provides no technical reports. • Presents no structural assessments issued by a competent professional. • Attaches no evaluations regarding structural capacity, useful life, service condition, or damage to the structure itself. • Nor does the petitioner include tests, measurements, or expert assessments that would allow the assertions to be objectively verified.

For this reason, the petitioner’s statements are limited to subjective assessments without verifiable technical support, making it impossible to conclude that any real, current, or imminent structural risk exists. By contrast, CONAVI did conduct specialized technical inspections. In accordance with the inspections performed by the Department of Road and Bridge Design, and as recorded in technical report No. DVP-42-2024-0547 (0223), the following was determined: Structural condition of the bridge The bridge structure shows no damage to its superstructure (superestructura) or substructure (subestructura) that would compromise user safety, trafficability, or its normal operation. The inspections identified no active structural failures or unsafe conditions, as corroborated by the photographic record included in the report. Condition observed at the site A localized process of erosion and scour (socavación) was identified around abutment (bastión) No. 2.

Nevertheless, the abutments are embedded at a sufficient distance from the bridge structure precisely to prevent phenomena of this type from affecting its stability. In addition, stabilization and preventive works have already been carried out, including the installation of erosion-control mats. Origin of the problem The observed conditions are primarily attributable to natural environmental factors, such as: • Local geological conditions, • The presence of groundwater, • Intense surface runoff caused by rainfall, • Soil saturation and loss of ground cohesion. These factors are not attributable to structural failures of the bridge or deficiencies in the roadway infrastructure. Service condition The technical assessments conclude that the bridge remains in adequate service condition and does not represent a current or imminent risk to users, because the detected erosion processes are external to the structure and inherent to the natural surroundings. 5.

Furthermore, on National Route No. 415 near San Antonio, there is also evident ground movement (movimiento de tierra), which has caused deep cracks, subsidence, and deformation of the road surface. The roadway appears fractured and has lost support along one side, without any clear explanation or adequate technical intervention by the competent authorities to date. Rejected. The petitioner maintains that CONAVI has allegedly failed to attend to or has neglected National Route No. 415. However, that assertion is inconsistent with the technical and administrative reality, because the route and the identified sections have received diligent, continuous, and proactive attention from the Administration with respect to road maintenance. The route receives ongoing maintenance through the current road-maintenance contracts. Although the sector contains an extensive geological fault encompassing part of the route alignment, this natural condition has been continuously addressed.

Because of that fault, the road surface experiences recurrent deformation; nevertheless, CONAVI has carried out the work necessary to ensure trafficability, user safety, and the uninterrupted passage of vehicles. In support of the foregoing, maintenance work has been carried out during various quarters of the current year, and interventions are also scheduled for the first quarter of next year. This work includes routine maintenance such as pothole repairs, clearing, brush cutting, maintenance of drainage ditches, and repair of failures and subsidence caused by the ground’s constant movement, demonstrating the existence of a systematic and continuous program for maintaining the route. Existing contract and ongoing maintenance Under the current maintenance contract: • Maintenance work is scheduled and performed on a recurring basis according to the needs identified at the site. • The route is periodically serviced to preserve its trafficability, safety, and functionality. • Images No. 6, 7, 8, and 9 show the current condition of National Route No. 415 and the scheduled maintenance work being carried out along that section.

It may therefore be concluded and has been demonstrated that the route is passable and in good condition for safe travel through the area, allowing the passage of vehicles and other users traveling through the location, since the corresponding maintenance has been performed over time. Geological condition of the route It is important to note that National Route No. 415 is located in an area with particular geological characteristics. These conditions make the terrain highly susceptible to problems such as soil saturation and rainfall runoff, causing recurrent events that require corrective action because of the geological fault in the sector. These situations do not arise from a lack of maintenance but are attributable to the area’s natural conditions. For this reason, CONAVI has established a permanent system for monitoring and maintaining the route. Monitoring and communication with the community Additionally, the condition of the route is continuously monitored through: • Periodic on-site technical inspections. • Timely response to reported incidents. • Direct and ongoing communication with local residents, who report specific situations that are technically analyzed and addressed, to the extent possible, within the contractual scope.

This coordination and response system demonstrates that the route has not been abandoned, as the petitioner claims, but instead receives constant attention and is subject to active communication with the community to monitor roadway conditions. 6. The lack of adequate technical intervention is also evident from the absence of slope-stabilization works (obras de estabilización de taludes), appropriate drainage systems, and retaining walls in the affected area. This means that intense rainfall or other climatic conditions create a high risk of further landslides or falling material that could aggravate the route’s condition even further. Rejected. The petitioner makes several assertions that, as with claim No. 4, lack technical support. Indeed, the petitioner provides no soil studies, slope-stability analyses, hydrological or hydraulic studies, or professional opinions issued by competent specialists that would allow the assertions to be verified.

Accordingly, those statements are based more on the petitioner’s personal and subjective assessments arising from personal observations than on objective technical evidence. Consequently, the matters stated do not constitute suitable evidence to conclusively demonstrate the existence of actual harm or to attribute an omission or improper conduct to the Administration on the basis of an alleged failure to provide attention, as claimed in this amparo proceeding (recurso de amparo). The absence of objective technical evidence prevents the alleged facts from being deemed proven, particularly because the case file contains no technical support substantiating them. 7. “…Route 415 is essential to the community’s daily functioning: it is used by workers traveling to their jobs, carriers transporting agricultural and commercial products, students traveling to schools and high schools, as well as vehicles transporting sick persons or persons requiring medical care at healthcare facilities located in other districts or cantons.

Each day of inaction increases the risk that someone experiencing a medical emergency will not arrive in time, or that an accident will occur. Rejected. First, although this Administration recognizes the functional and social importance of National Route No. 415 to the communities it connects, that circumstance does not in itself constitute proof of a violation of fundamental rights, nor does it automatically establish the existence of an administrative omission or a current or imminent risk attributable to CONAVI. Second, the petitioner makes several assertions that, as with claim No. 4, lack technical support. Indeed, the petitioner provides no soil studies, slope-stability analyses, hydrological or hydraulic studies, or professional opinions issued by competent specialists that would allow the assertions to be verified. It should be noted that no direct causal relationship has been established between CONAVI’s actions and the harms alleged by the petitioner, such as inability to access healthcare services, loss of employment, or interruption of the educational process.

Nor has it been demonstrated that those consequences actually materialized in a specific, real, and verifiable manner. Accordingly, those statements are based more on the petitioner’s personal and subjective assessments arising from personal observations than on objective technical evidence. Consequently, the matters stated do not constitute suitable evidence to conclusively demonstrate the existence of actual harm or to attribute an omission or improper conduct to the Administration on the basis of an alleged failure to provide attention, as claimed in this amparo proceeding. The absence of objective technical evidence prevents the alleged facts from being deemed proven, particularly because the case file contains no technical support substantiating them. 8.

“…In view of this situation, local residents—including myself—have approached the competent authorities on several occasions, submitting formal and informal filings and requests to CONAVI and other institutions so that the existing risk may be assessed and the necessary repair and stabilization works may be carried out on Route 415 and the bridge in question…” Rejected. The appellant does not provide suitable documentary evidence showing the processing of the purported formal filings that he claims to have submitted to CONAVI, having stated that he submitted formal and informal filings and requests on several occasions. He provides only an image capture corresponding to a complaint filed in 2022 through CONAVI’s then-current complaints and reports system. Nevertheless, the evidence provided by the appellant himself shows that the filing was duly addressed, as evidenced by the response issued by the Administration.

The appellant provides no new evidence or information different from that already analyzed in the preceding facts. He merely reiterates allegations previously addressed, which are unsupported by technical documentation. His arguments are based on subjective assumptions, as well as social-media posts and photographs of past events, which do not reflect the current situation or the interventions carried out by CONAVI as of the date of this report. 9. Notwithstanding the foregoing, the responses received, when any have been provided, have been insufficient, generic, or merely dilatory. No permanent solution has been implemented, nor have measures been adopted to ensure the structural safety of the bridge and the route; at best, the Administration has limited itself to minor works or mere technical assessments that have not resulted in concrete works. Rejected. As previously demonstrated and substantiated, concrete field actions have been carried out to ensure passability (transitabilidad) in the area, despite the existence of a geological fault (falla geológica) encompassing both the alignment of the national route and the adjacent land and properties.

These conditions cause recurring and accelerated damage to the roadway surface (superficie de rodamiento), which is why the route remains under constant monitoring and corrective actions are diligently scheduled. Because this is a repetitive allegation, it is important to recall what was stated in the preceding points, where the ongoing maintenance and attention provided to the route over time have been demonstrated. Therefore, the appellant’s statements are insufficient to support the relief sought in the appeal, since no suitable technical evidence is provided to substantiate his assertions. Consequently, the appellant’s allegation lacks technical support, since CONAVI has acted within the scope of its authority, with diligence, planning, and attention to the safety of the road and bridge, as indicated in the technical reports cited above. 10. “…This continued omission by CONAVI and the responsible authorities not only perpetuates the latent risk of a serious accident, but in fact already affects the exercise of rights such as freedom of movement, health, work, and education by forcing the population either to use dangerous infrastructure on a daily basis or to make longer, more costly, and inefficient journeys via alternative routes…” Rejected.

The appellant reiterates the same assertions made in allegation N.° 7 without providing evidence to support them. The Administration provides constant and diligent attention to the route, thereby ensuring safe passage at the location. For this reason, the appellant fails to establish specifically which fundamental rights would be violated, since the route is currently passable and safe for travel, allowing users to exercise freedom of movement. 11. “…Consequently, the failure to intervene promptly and adequately on National Route N.º 415 and the affected bridge constitutes a current and continuing violation of the fundamental rights identified in the preceding section, attributable to the Administration’s inaction because, despite having a legal duty to ensure the safety and functionality of the road infrastructure, it has failed to fulfill its obligations…” Rejected. The appellant once again alleges a purported violation of rights that he fails to establish, since the ongoing scheduling of maintenance work on National Route N.° Page 30 of 34 415 has been duly demonstrated in this case, as has the documented traceability of the actions undertaken by the Administration.

Management scheduling and traceability. Conservation management (gestión de conservación) in the sector is carried out under a formal, continuous, and verifiable framework that includes: • Continuous scheduling of maintenance activities, with annual and monthly planning of interventions, including preventive and corrective work. • Detailed recording and monitoring of each intervention, allowing the condition of the road, the work performed, and the mitigation measures implemented to be documented. • Ongoing technical monitoring of the route’s condition, with periodic inspections by professionals from the Departamento de Conservación de Vías y Puentes. This management model ensures that all actions are traceable and verifiable, ruling out any abandonment, inaction, or neglect by CONAVI. It should be recalled that the legal mandate of the Gerencia de Conservación Vial includes ensuring the proper operation of the country’s national routes and their maintenance.

Based on the information provided in the transmitted case file (expediente), as well as the inspections conducted, it was determined that the case under review does not involve a condition caused by the Red Vial Nacional, but rather by geological faults and force majeure events (eventos de fuerza mayor) that cause ground movement. The purported violation of rights alleged by the appellant lacks support, since CONAVI’s actions have been documented, planned, and carried out in accordance with current technical and administrative procedures, and the problems observed on Route 415 arise from natural causes unrelated to institutional management. V. CONCLUSIONS. In accordance with the technical and legal analysis conducted, it is concluded that:

  • 1)National Route N.º 415 and the bridge located in the sectors of Pascua and San Antonio exhibit neither structural damage nor an imminent risk that would compromise user safety, in accordance with Informe N.º DVP-42-2024-0547 (0223) and the supplementary reports of the Departamento de Diseño de Vías y Puentes.
  • 2)The observed impacts, including erosion processes, localized scour (socavación localizada), and slope conditions (condiciones de los taludes), result from geological, hydrogeological, and surface-runoff factors inherent to the surrounding environment and are not attributable to infrastructure deficiencies or omissions by the Administration.
  • 3)The Administration, through the Gerencia de Conservación de Vías y Puentes, has carried out an ongoing, documented, and traceable program for maintaining and attending to the route, including pothole repair (bacheo), vegetation clearing (descuaje), brush cutting (chapea), and the repair of deformations caused by ground movement, thereby ensuring the road’s passability and functionality.
  • 4)Licitación No. 2022CD-000147-0006000001, entitled “Studies to prepare the designs for the permanent solution to the landslide that blocked passage at kilometer 29+200, National Route No. 415, Siquirres, Limón,” has completed the design stage and is currently in “pre-execution.”
  • 5)The Departamento de Adquisición de Bienes Inmuebles (DABI) of the Ministerio de Obras Públicas y Transportes (MOPT) was asked to initiate the land-acquisition process, and the administrative process involving appraisals, notice, and negotiation is currently underway. Although an estimate of the cost of the works is already available, it remains highly uncertain. The corresponding evaluations will be conducted at the pre-feasibility stage (prefactibilidad).
  • 6)The appellant’s statements are limited to subjective assessments and opinions and lack verifiable technical support, tests, measurements, or expert assessments (peritajes) capable of substantiating the existence of a real, current, or imminent structural risk. Consequently, the purported violation of rights alleged is not established, nor is any negligent or deficient action by the Administration demonstrated. On the contrary, the technical and administrative evidence demonstrates that CONAVI has acted diligently, continuously, and in accordance with the current legal framework, ensuring the safety and functionality of National Route N.° 415 and the bridge in question. Therefore, granting the relief sought by the appellant is unwarranted because there are no technical or legal grounds supporting his allegations. In accordance with the principle of legality (principio de legalidad) governing the actions of the Public Administration (Administración Pública), the Consejo Nacional de Vialidad has acted within its statutory and regulatory authority and has undertaken the pertinent interinstitutional measures. In conclusion, no omission or arbitrary action attributable to CONAVI has occurred, and the institution has not violated any fundamental rights. The Consejo Nacional de Vialidad continues to implement road-attention and monitoring programs with the aim of strengthening public administration and ensuring the safety of users of the Red Vial Nacional.”
  1. 4The legal requirements have been observed in the proceedings conducted.

Justice Castillo Víquez writes the opinion; and,

Whereas:

I.Subject matter of the appeal. The appellant alleges that CONAVI has engaged in a prolonged and unjustified failure to maintain, repair, and stabilize National Route 415, despite the progressive deterioration of its roadway surface, slopes, and drainage-crossing structures, as well as the occurrence of events that have seriously compromised road safety. The protected party contends that, since the landslide that occurred in April 2021 in the Pascua de Siquirres sector, which caused the collapse of an entire section of the roadway and the complete closure of traffic, the Administration has not implemented a definitive structural solution, and that the residents themselves constructed an improvised temporary passage that remains in use to date. The protected party states that the bridge located in San Antonio subsequently sustained significant structural damage to its supports, leaving it in a condition of latent risk, compounded by earthworks (movimientos de tierra) that have caused cracks, subsidence, and deformation of the roadway, without any technical stabilization, drainage, or retaining works having been performed.

The petitioner alleges that, despite multiple requests submitted to CONAVI, the responses have been merely generic or dilatory, limited to technical assessments or minor interventions, without the execution of specific works to mitigate the existing danger. In that context, the petitioner maintains that the administrative inaction perpetuates a current and ongoing risk affecting fundamental rights such as life, health, freedom of movement, work, education, and effective access to public services, and therefore requests the corresponding constitutional protection.

II.Preliminary matter. Before analyzing the merits of the case, it must be clarified that, beginning with judgment number 2008-02545 of 8:55 a.m. on February 22, 2008, this Chamber has referred to the administrative litigation jurisdiction, subject to certain exceptions, those matters in which it is disputed whether the public administration has complied with the time limits established by the General Law of Public Administration (Articles 261 and 325) or by sector-specific laws governing special administrative proceedings, either to conclude an administrative proceeding initiated ex officio or at the request of a party by issuing a final administrative decision, or to hear the applicable administrative appeals. Specifically, the case sub lite presents such an exception because it concerns the appellant’s objection to the National Road Council’s inaction in the face of a situation that, according to the allegations, directly jeopardizes road safety and the physical integrity of users of National Route No. 415, specifically in the Pascua de Siquirres sector, as a result of the landslide that occurred in April 2021, without a definitive structural solution having been implemented to date that adequately restores passability and mitigates the existing risk. Having clarified this point, the Chamber proceeds to rule on the specific situation raised in this constitutional protection proceeding (amparo).

III.Proven facts. The following facts are deemed duly established and relevant to the determination of this matter, either because they have been substantiated or because the respondent failed to address them as ordered in the initial ruling:

  • a)In 2021, a landslide occurred in the Pascua de Siquirres sector, specifically at kilometer 29+200 of National Route No. 415, prompting the temporary closure of vehicular passage and the diversion of traffic through National Route No. 10 (see the reports of the respondent authorities and the evidence submitted in the digital case file).
  • b)In 2022, the National Road Council processed tender No. 2022CD-000147-0006000001, entitled “Studies to prepare the designs for the definitive solution to the landslide that blocked passage at kilometer 29+200, National Route No. 415, Siquirres, Limón” (see the reports of the respondent authorities and the evidence submitted in the digital case file).
  • c)In 2024, the Road and Bridge Design Department of the National Road Council issued technical report DVP-42-2024-0547 (0223), concerning specialized technical inspections of the bridge over the río Blanco in the San Antonio sector, and stated that the structure presented no damage to its superstructure or substructure that would jeopardize user safety, as reported by the respondent authority (see the reports of the respondent authorities and the evidence submitted in the digital case file).
  • d)In 2024, a localized erosion and scouring process was identified and, consequently, CONAVI carried out stabilization and preventive works by installing erosion-control mats (see the reports of the respondent authorities and the evidence submitted in the digital case file).
  • e)On December 18, 2025, the Road and Bridge Construction Management Office of the National Road Council issued technical report CARTA-CONAVI-CA-DIE-GCTR-DVP-DDV-021-2025 concerning the landslide that occurred in the Pascua de Siquirres sector on National Route No. 415. That report stated as follows: “1. Identification of the route and specific site. The Road and Bridge Construction Management Office promoted Tender No. 2022CD 000147-0006000001, entitled, ‘Studies to prepare the designs for the definitive solution to the landslide that blocked passage at kilometer 29+200, National Route No. 415, Siquirres, Limón.’ The structure to be designed is the permanent structure for remedying the landslide at kilometer 29+200 of National Route No. 415 and encompasses a length of approximately 165,00 (one hundred sixty-five) linear meters, between the points with coordinates CRTM05 E=541823.12; N=1107019.8 and E=541747.3; N=1106891.9, as shown below. 2.

Actions undertaken by CONAVI. Provisional approval of the Final Report was granted on August 5, 2025, and final approval on September 1, 2025, after the plans were registered with the Colegio Federado de Ingenieros y de Arquitectos. With the design completed, the project has now entered the pre-execution stage (Pre ejecución). Through CARTA CONAVIGCTR- 02-2025-1378 of June 10, 2025, the Department of Real Property Acquisition (DABI) of the Ministry of Public Works and Transportation (MOPT) was asked to begin the land-acquisition process. Consequently, the start of the pre-execution stage was moved forward to June 2025, whereas it had previously been scheduled to begin in January 2026. Completion of the pre-execution stage remains scheduled for June 2027. […] 3. Technical limitations (costs). In progress. The design cost had previously been estimated at ₡34.633.935; however, two cadastral plans (planos de catastro) covering an area of up to 1500 m² and two cadastral plans covering an area from 1500 to 5000 m² had been contemplated.

In contrast, one cadastral plan covering an area of up to 1500 m² and three cadastral plans covering an area from 1500 to 5000 m² were prepared. This entailed an increase of ₡266.680. In addition, a penalty of ₡70.489,40 was imposed because a third version of the Final Report had to be submitted. Furthermore, ₡357.362,77 was added for the price adjustment to the Final Report, while ₡1543,72 was deducted as an adjustment to the penalty; thus, the net adjustment amount was ₡355.819,05. Accordingly, the final design amount was ₡35.185.944,65. The preliminary cost of land acquisition during pre-execution increases from ₡13.968.900 to ₡16.550.700 because of the increase in area. The budget for the base design, which uses gabion walls (muros de gaviones) on the fill slope, increased to ₡1.666.065.667. It was also determined that this base design does not satisfy the overall stability criteria under seismic conditions; therefore, another alternative design was prepared, incorporating a pile wall (pantalla de pilotes) beneath the gabion walls and their approaches.

This alternative has a cost of ₡7.899.340.866. For greater clarity, the intervention to restore the section of road affected by the landslide would include: • Soil-nailed wall (muro de suelo cosido) with a 0,5H:1V gradient on the cut slope, with 3 m-long anchors spaced every 1,5 m in both directions. • Wall 1 on the fill slope, extending 98 m, with 7 m-high Terramesh gabions and 3 m-high gabions over a pile wall (2 rows of piles, each 1 m in diameter and 15 m deep). • Wall 2 on the fill slope, extending 62 m, with 7 m-high gabions over a pile wall (3 rows of piles, each 1 m in diameter and 15 m deep). As an intermediate alternative, the pile wall could be installed only beneath the gabion walls, but not along their approaches, resulting in an approximate cost of ₡4.320.320.639. The complete solution, which satisfies all stability criteria, is considered excessively costly in view of the road’s low traffic volume.

Therefore, all three alternatives must be evaluated at the prefeasibility stage (prefactibilidad). 4. Technical conclusions. • Tender No. 2022CD-000147-0006000001, entitled, ‘Studies to prepare the designs for the definitive solution to the landslide that blocked passage at kilometer 29+200, National Route No. 415, Siquirres, Limón,’ has completed the design stage and is currently in pre-execution. • The Department of Real Property Acquisition (DABI) of the Ministry of Public Works and Transportation (MOPT) was asked to begin the land-acquisition process, and the administrative process involving appraisals, notice, and negotiation is currently underway. • Although an estimate of the cost of the works is already available, it remains highly uncertain. The corresponding evaluations will be conducted at the prefeasibility stage. Accordingly, it is recommended that the appellant’s request be denied, given that the actions taken by the National Road Council and the Road and Bridge Construction Management Office to address and remedy the landslide at kilometer 29+200 on National Route N°160 have been demonstrated” (see the reports of the respondent authorities and the evidence submitted in the digital case file).

  • f)On December 19, 2025, the Road and Bridge Conservation Department of the Consejo Nacional de Vialidad issued technical report CARTA-CONAVI-CA-DIE-GCSV-DRHA-077-2025 concerning the condition of the bridge located in the San Antonio sector on National Route No. 415. The report stated, insofar as relevant, the following: “Based on the technical inspections conducted by the Road and Bridge Design Department and as stated in report No. DVP-42-2024-0547 (0223), the following is concluded: Structural condition of the bridge According to report No. DVP-42-2024-0547 (0223), neither the superstructure nor the substructure of the bridge exhibits structural damage that would compromise safe passage by users, trafficability, or its operational functionality. Furthermore, the inspections identified no active structural failures or unsafe structural conditions, as shown in Images No. 1, 2, 3, 4, and 5, which depict the bridge’s current condition.

Condition observed at the site A localized scouring (socavación) and erosion process is occurring in the immediate vicinity of abutment (bastión) No. 2, resulting in exposure of the bridge abutments, which are embedded at a considerable distance beneath the structure precisely to prevent the bridge from becoming vulnerable to any surface scouring, thereby ensuring its structural safety. In addition to the foregoing, the stabilization and preventive works specified in report N° DVP-42-2024-0547 (0223) have been performed, such as the erosion-control mat shown in Image N° 2. The Road and Bridge Design Department also determined that the observed problem is primarily attributable to the geological, hydrogeological, and surface-runoff conditions inherent to the surrounding area, including: • Possible local geological faults, • Presence of groundwater, • Concentrated runoff resulting from intense rainfall, • Soil saturation and loss of ground cohesion.

These factors are not attributable to structural deficiencies in the bridge or the existing road infrastructure, nor do they pose a risk to user safety. Service condition Structural assessments of the bridge conducted by specialized technical bodies conclude that the structure exhibits no structural damage, maintains adequate service conditions, and presents no current or imminent risk to users. The observations identify erosive processes in the surrounding area that are not attributable to structural failures of the bridge. Allegation No. 5 5. Furthermore, on National Route No. 415 near San Antonio, there is also evident earth movement (movimiento de tierra), which has caused deep cracks, subsidence, and deformation of the road surface. The roadway appears fractured and has lost support along one side, with no clear explanation or adequate technical intervention by the competent authorities to date.

Regarding this point, the Petitioner (Recurrente) suggests an alleged lack of attention or neglect concerning the route at issue in this amparo proceeding (Recurso de Amparo); however, that assertion is inconsistent with the technical and administrative facts, because the route in question, as well as the identified sections, have received diligent, continuous, and proactive attention from the Administration over time in the area of road conservation through the contractual mechanisms available for that purpose. Although the site lies within a geological fault spanning several hectares, including the route, strict maintenance of the road surface has been maintained. That surface undergoes constant deformation as a result of the geological fault; nevertheless, given the situation presented, the corresponding works have been carried out to ensure trafficability, safety, and uninterrupted passage along the route for users.

As evidence of the foregoing, as part of the road-conservation maintenance activities, routine maintenance work—including pothole repairs, clearing, brush cutting, drainage-ditch maintenance, and repair of failures and subsidence caused by the ground’s constant movement—has been and remains scheduled during the first, second, and fourth quarters of the current year and the first quarter of next year, thereby maintaining a continuous and systematic program of attention to the route. Existing contract and ongoing attention Under the aforementioned maintenance contract: • Work is scheduled and performed on a recurring basis according to the needs arising at the site. • The route undergoes periodic interventions intended to preserve the road’s trafficability, safety, and functionality. • Images 6, 7, 8, 9, 10, and 11 show the route’s current condition, as well as the scheduled maintenance work being performed on National Route 415.

It follows from the foregoing, and has been demonstrated, that the route is passable and in good condition for safe travel through the area, permitting passage by vehicles and users traveling through the site, since the corresponding maintenance has been performed over time. Particular geological condition of the route It is technically relevant to note that the route is located in an area with particular geological conditions characterized by: • High susceptibility to impacts resulting from soil saturation and runoff, • Recurring events requiring immediate corrective attention due to the geological fault at the site. These conditions are not the result of a lack of maintenance but are inherent to the sector’s geological environment, which is why the Administration has implemented a continuous monitoring and response system. Monitoring and communication with the community In addition, the route’s condition is continuously monitored, supported by: • Technical field follow-up. • Timely attention to reported incidents. • Direct and ongoing communication with certain residents of the sector, who report specific situations that are technically assessed so they may be addressed as soon as possible within the contractual scope.

This coordination and response system demonstrates not only that the route has not been abandoned, as the Petitioner seeks to portray as fact, but also that ongoing communication with the community and attention to the route are being maintained. Allegation No. 6 6. The lack of adequate technical intervention is also evident from the absence of slope-stabilization works, appropriate drainage systems, and retaining walls in the affected area. This means that intense rainfall or other weather conditions create a high risk of further landslides or falling material that could worsen the route’s condition even more. Response to Allegation No. 6 The Petitioner makes a series of assertions that, as with Allegation No. 4, are unsupported by a soil study, slope-stability studies, hydrological studies, hydraulic studies, professional opinions issued by a qualified specialist, and/or any technical evidence capable of substantiating or validating those assertions.

Instead, the assertions amount to a subjective judgment expressing an evaluative opinion based on the Petitioner’s personal observation. Accordingly, the statements are limited to subjective assessments, which do not constitute suitable evidence reliably demonstrating the existence of actual harm, much less attributing an omission or improper action to the Administration based on the alleged lack of attention at issue in this amparo proceeding. The absence of such elements prevents the stated facts from being deemed established, particularly because no supporting technical basis has been submitted in the case file (expediente). 7. Route 415 is essential to the community’s daily activities: it is used by workers traveling to their jobs, carriers transporting agricultural and commercial products, students traveling to schools and secondary schools, and vehicles transporting persons who are ill or require medical care at healthcare facilities located in other districts or cantons.

Each day of inaction increases the risk that a medical emergency will not reach care in time, that a fatal accident will occur, or that people will lose their source of income because they cannot travel safely. Response to Allegation No. 7 As stated in the preceding points, the Petitioner again presents a situation that the Petitioner seeks to associate with an alleged lack of attention in the sector; however, that contention is inconsistent with the effective management that remains continuously active on the route, as demonstrated in this report. The sector is covered by a current maintenance program that is implemented continuously, in a planned and monitored manner, in response to the particular conditions of the surrounding area and the needs arising at the site. Active and monitored maintenance program Under that program: • The condition of the road is monitored continuously. • Conditions warranting intervention are technically assessed. • Corrective and emergency actions are scheduled in accordance with technical and contractual criteria.

This working arrangement demonstrates that diligent and continuous attention has been maintained over time to provide road maintenance and ensure trafficability. 8. In response to this situation, local residents, including me, have approached the competent authorities on various occasions, submitting formal and informal petitions and requests to CONAVI and other institutions so that the existing risk may be assessed and the necessary repair and stabilization works performed on Route 415 and the bridge in question. Response to Allegation No. 8 Regarding this point, the Petitioner introduces no new elements and provides no information different from that already analyzed in connection with the preceding facts, merely reiterating previously addressed assertions unsupported by technical documents capable of substantiating them. Instead, the arguments are based on subjective assumptions, as well as social-media posts and photographs of past events that do not reflect the current status of the interventions completed as of the date of this report.

Allegation No. 9 9. Notwithstanding the foregoing, the responses received, when any have been provided, have been insufficient, generic, or merely dilatory. No permanent solution has been implemented, nor have measures been adopted to ensure the structural safety of the bridge and the route; at best, the Administration has limited itself to minor work or mere technical assessments that have not resulted in concrete works. Response to Allegation No. 9 Regarding this point, as previously demonstrated and evidenced, concrete actions resulting in fieldwork have been undertaken to ensure trafficability in the area, where a geological fault covers the entire area through which the national route passes, as well as the adjoining properties and lands. Such faults cause accelerated and continuous damage to the road surface, which is why the route is monitored continuously and concrete actions are diligently scheduled to provide the corresponding and appropriate attention.

That being so, because this is a repetitive allegation, it is important to note what was stated in the preceding points, in which the maintenance of and attention to the route over time have been demonstrated. The statements made by the Appellant (Recurrente) are insufficient to support the claims asserted in the appeal, as no technical evidence has been submitted to substantiate them. Allegation No. 10 10. This ongoing omission by CONAVI and the responsible authorities not only perpetuates the latent risk of a serious accident but also already affects the exercise of rights such as freedom of movement, health, work, and education, by forcing the population either to use dangerous infrastructure every day or to travel longer, more costly, and less efficient routes. Response to Allegation No. 10 With respect to this point, the Appellant reiterates the same assertions contained in Allegation No. 7 without providing evidence substantiating them.

Given the constant and diligent attention provided by the Administration, which ensures safe passage through the area, the Appellant has failed to establish specifically which fundamental rights have been violated, since the route is currently passable and provides safe passage; accordingly, there is safe and unrestricted movement along the roadway. Allegation No. 11 11. Consequently, the failure to intervene promptly and adequately on National Route No. 415 and the affected bridge constitutes a present and continuing violation of the fundamental rights identified in the preceding section, attributable to the Administration’s inaction, as it has failed to fulfill its legal duty to ensure the safety and functionality of the road infrastructure. Response to Allegation No. 11 The Appellant once again alleges a purported violation of rights but fails to substantiate it, since the constant scheduling of maintenance work on the route, as well as the traceability of the actions undertaken by the Administration, has been duly demonstrated in this case.

Scheduling and traceability of management Conservation management in the sector is carried out under a framework comprising: • Continuous scheduling of maintenance activities. • Recording and monitoring of interventions. • Ongoing technical monitoring of the roadway’s condition. This operating model makes it possible to verify, document, and monitor each action, thereby ruling out any inaction, abandonment, or neglect and demonstrating diligent and verifiable administrative action. Failure to substantiate the fundamental facts In contrast with this documented management, the Appellant: • Does not demonstrate the alleged fundamental facts through objective evidence. • Does not establish a nexus between the allegations and any specific act or omission by the Administration. • Does not rebut the traceability of the actions undertaken within the framework of road conservation. Consequently, the alleged violation of rights has not been established because the essential facts supporting such a claim have not been substantiated.

Technical and administrative assessment From a technical and administrative standpoint, the existence of traceable, continuous, and documented management precludes a finding that the facts invoked by the Appellant have been established, making it improper to attribute liability to the Administration. Under the current regulatory framework, the Administration fulfills the construction-related and functional obligations concerning the infrastructure within its legal jurisdiction. That being so, and as technically evidenced and demonstrated in this report, the situation described is not the result of an omission or harm caused by work performed by the Administration or by its inaction. Rather, the problem arises from a geologically vulnerable area where, despite constant ground movement, periodic and continuous maintenance has been performed over time, including whenever an emergency causes severe deformation.

It should be recalled that the Road Conservation Management Division (Gerencia de Conservación Vial) is legally responsible for ensuring the proper operation and maintenance of the country’s national routes. Based on the information provided in the submitted case file and the inspections performed, it was determined that the case under review does not arise from a condition caused by the National Road Network (Red Vial Nacional), but from geological faults and force majeure events that cause ground movement. It should also be noted that this Road and Bridge Conservation Management Division (Gerencia de Conservación de Vías y Puentes) performs maintenance on the National Routes through the conservation contracts in effect over time, doing so promptly, diligently, and responsibly to ensure their proper operation and provide adequate maintenance that guarantees safe passage along the roadway.

Conclusions 1. The assertions concerning an allegedly deficient structural condition of the bridge lack technical support. Report No. DVP-42-2024-0547 (0223), issued by the Road and Bridge Design Department (Departamento de Diseño de Vías y Puentes), demonstrates that the structure presents neither damage nor structural risk. 2. The statements made are limited to subjective assessments lacking verifiable technical support, which precludes a finding that any real, present, or imminent structural risk exists. 3. The observed impacts—the scouring (socavación) of the protective works at abutment No. 2—are attributable to erosive processes and geological conditions inherent to the surrounding area, and no direct causal nexus with the road infrastructure has been established. 4. During the inspections, no active structural failures or unsafe structural conditions were identified, as shown in images No.1, 2, 3, 4 and 5, which depict the bridge’s current condition. 5.

Structural assessments of the bridge conducted by specialized technical bodies conclude that the structure has no structural damage, remains in adequate service condition, and shows no present or imminent risk to users. The observations identify erosive processes in the surrounding area that are not attributable to structural failures of the bridge. 6. During the current year, maintenance work has been and remains scheduled for the first, second, and fourth quarters, as well as the first quarter of next year, including routine maintenance such as pothole patching, removal of uprooted vegetation, brush clearing, drainage-channel maintenance, and repair of failures and subsidence (hundimientos) caused by the constant movement of the ground, thereby maintaining a continuous and systematic program of attention to the route. 7. Repetitive assertions and personal opinions do not constitute competent evidence (prueba idónea) supporting the actual condition of the route or the Administration’s attention to it. 8.

The statements made are limited to subjective assessments, which do not constitute competent evidence conclusively demonstrating the existence of actual harm, much less attributing an omission or improper action to the Administration based on the purported lack of attention at issue in this amparo appeal (Recurso de Amparo). 9. The Administration has provided and maintained diligent and continuous attention over time to maintain the roadway and ensure that it remains passable” (see the reports of the respondent authorities and the evidence submitted in the digital case file).

  • g)Tender n.°2022CD-000147-0006000001 completed the design stage, with provisional and final approval of the final report, and the project was in the “pre-execution (pre ejecución)” stage (see the reports of the respondent authorities and the evidence submitted to the digital case file).
  • h)Ruta Nacional n.°415 receives maintenance under current road-maintenance contracts, and work was also carried out during different quarters of 2025. In addition, interventions were scheduled for the first quarter of 2026, including pothole repair, tree-limb removal, brush cutting, ditch maintenance, and repair of failures and subsidence (see the reports of the respondent authorities and the evidence submitted to the digital case file).

IV.Regarding the landslide in Pascua de Siquirres. The petitioner maintains that Ruta Nacional n.° 415 has undergone progressive deterioration, which worsened when a section collapsed in April 2021, resulting in the complete closure of the road to vehicular traffic, and that, in the absence of a prompt and effective response from Consejo Nacional de Vialidad, local residents themselves opened a temporary passage that, to date, has not been replaced by a permanent structure.

In this matter, this Chamber finds that the protected party’s fundamental rights were violated because, although the landslide that occurred in 2021 at kilometer 29+200 of Ruta Nacional n.° 415 in the Pascua de Siquirres sector resulted from natural conditions beyond the Administration’s control, it caused an objective and prolonged impairment of travel on a road that provides an essential connection for the communities in the area. Thus, although the institutional response has included technical and administrative measures, it has not succeeded in implementing, within a reasonable period, a permanent solution that restores stable and safe travel conditions.

First, it should be clarified that the amparo proceeding (amparo) is not intended to require the Administration to undertake a specific project or to substitute this Chamber’s judgment for the technical judgment entrusted to the specialized bodies of Consejo Nacional de Vialidad. Rather, it is intended to examine whether, in response to a persistent impairment of the national road network that affects freedom of movement and, because of its close connection thereto, effective access to basic services, the public authorities acted promptly and effectively enough to neutralize the risk and restriction arising from the collapse of the section. In this regard, although CONAVI maintains that the phenomenon is attributable to complex geodynamic processes and that addressing it requires prior comprehensive studies, the fact remains that the established factual record shows that the situation has continued without a permanent structure since 2021. This goes beyond a merely technical dispute and places the matter within the sphere of effective protection of the fundamental rights at issue.

The evidence in the record clearly shows that the Administration undertook relevant actions: tender n.° 2022CD-000147-0006000001 was processed to prepare the designs for the permanent solution; the final report received provisional approval on 5 de agosto de 2025 and final approval on 1° de setiembre de 2025; and pre-execution measures were initiated, including a request to the Departamento de Adquisición de Bienes Inmuebles del MOPT to process land acquisitions and expropriations, with that stage even being brought forward to junio de 2025. However, precisely because an administrative course of action is acknowledged to exist, what must be determined is whether, in light of the time elapsed since the initial event and the practical impact of the absence of a permanent solution, that sequence of actions has been sufficient to ensure the restoration of freedom of movement under stable and safe conditions in a real, rather than merely programmatic, manner.

In this regard, although CONAVI explains that there are construction alternatives within different cost ranges and that the complete solution would be “excessively costly,” noting that a prefeasibility assessment (evaluación de prefactibilidad) is required, it must be emphasized that such considerations, while reasonable from a technical and budgetary standpoint, cannot result in the indefinite continuation of a situation in which travel depends on temporary conditions and on the persistence of unstable terrain. This is especially so when the technical report itself acknowledges that the necessary intervention exceeds the scope of routine maintenance and that pre-execution extends, according to the institutional schedule, until junio de 2027. Therefore, even accepting that the Administration has not remained inactive, the practical result is that, several years after the section collapsed, no permanent structure has been built to stabilize the site definitively. This perpetuates an ongoing impairment of the right to freedom of movement and, by extension, of continuity of access to essential services that depend on this road.

Accordingly, from a constitutional perspective, the issue is not whether to impose a specific technical solution, but whether the public response must be genuinely capable of removing, within a reasonable period, the prolonged restriction affecting those who use Ruta Nacional n.° 415 at this critical point. Constitutional relief is therefore warranted to order the Administration to advance and implement, with due diligence, the measures necessary to complete the permanent solution already designed and proceed with its construction within a verifiable timeframe, without prejudice to the applicable technical assessments and legal procedures. Consequently, because the impairment has persisted for a prolonged period without implementation of a permanent solution, the appeal must be partially granted solely with respect to the landslide in the Pascua de Siquirres sector.

V.Regarding the bridge in the San Antonio sector of Ruta Nacional n.° 415. The protected party states that the bridge located in San Antonio subsequently sustained significant structural damage to its supports, leaving it in a state of latent risk, together with earthworks (movimientos de tierra) that have caused cracks, subsidence, and deformation of the roadway, without any technical stabilization, drainage, or retaining works having been performed. The claimant alleges that, despite multiple requests submitted to CONAVI, the responses have been merely generic or dilatory, limited to technical assessments or minor interventions without carrying out specific work to mitigate the existing danger. In that context, the petitioner maintains that the administrative inaction perpetuates a current and continuous risk affecting fundamental rights such as life, health, freedom of movement, work, education, and effective access to public services, and therefore requests the corresponding constitutional protection.

As to this claim, this Chamber finds no violation of the fundamental rights invoked because the evidence entered in the case file does not establish the existence of any real, current, or imminent structural risk attributable to an act or omission of the respondent authority. Indeed, although the protected party asserts that the bridge has sustained significant damage to its supports and that the adjacent roadway shows cracks, subsidence, and deformation, those assertions are not supported by appropriate technical evidence that would objectively confirm the existence of a structural deficiency or a specific danger to road users.

First, it should be noted that Consejo Nacional de Vialidad did conduct specialized technical inspections at the site, the results of which are set forth in technical report DVP-42-2024-0547 (0223), prepared by the Departamento de Diseño de Vías y Puentes. That report concluded that neither the superstructure nor the substructure of the bridge exhibits damage compromising its safety, trafficability, or normal operation, and that no active structural failures or unsafe conditions were identified during the assessments performed. Based on that analysis, it was determined that the observed impacts consist of localized erosion and scouring processes in the immediate vicinity of one of the abutments, without those phenomena directly affecting the bridge’s structural stability, particularly because the supports are embedded at a sufficient distance to prevent them from being vulnerable to such processes.

Moreover, the evidence submitted under oath shows that the Administration did not confine itself to a merely passive technical assessment, but carried out stabilization and preventive work, such as installing erosion-control mats specifically intended to mitigate the effects of the geological and hydrological conditions inherent to the surrounding area. In that context, the technical reports consistently indicate that the identified problem is attributable primarily to natural factors, such as the presence of groundwater, intense surface runoff, and soil saturation, rather than to structural deficiencies in the bridge or a lack of maintenance attributable to CONAVI.

Likewise, with respect to the earthworks and deformations of the roadway surface near San Antonio, it was established that the route is covered by current road-maintenance contracts and has been subject to a continuous and systematic maintenance program comprising pothole repair, tree-limb removal, brush cutting, ditch maintenance, and repair of failures and subsidence, with interventions carried out during different quarters and others already scheduled for the following period. In this regard, the existence of an extensive geological fault in the sector is not, by itself, sufficient to establish abandonment or administrative inaction when the evidence shows that the respondent authority maintains an ongoing system of monitoring, maintenance, and communication with the community to preserve the road’s trafficability and safety.

Accordingly, although this Chamber recognizes the functional and social importance of Ruta Nacional n.° 415 to the communities it connects, the petitioner did not establish, with respect to this claim, a direct causal link between CONAVI’s conduct and any specific, real, and verifiable impairment of the fundamental rights invoked. The available technical evidence rules out the existence of a current or imminent structural risk to the bridge and demonstrates active administrative management of the affected section. Consequently, because neither the alleged inaction nor the claimed danger has been established, this grievance must be rejected and the appeal denied with respect to the bridge in the San Antonio sector and the roadway conditions associated with that location.

VI.Note by Justice Castillo Víquez regarding prompt and effective administrative justice. I have supported this Court’s position that, when a litigant alleges a violation of the right to prompt and effective justice in the administrative forum (sede administrativa), the legal dispute must be heard by the Contentious-Administrative Courts, rather than by this Chamber. Nevertheless, with the recent enactment of Ley n.° 9097, Ley de Regulación del Derecho de Petición, it has been established that this right is eligible for judicial protection through the amparo proceeding (recurso de amparo) established by article 32 of the Ley de la Jurisdicción Constitucional, in connection with article 27 of the Political Constitution of the Republic of Costa Rica, in those cases in which petitioners consider that the Administration’s material conduct, its administrative acts (actos administrativos), or its response are affecting their fundamental rights.

In my view, the recently enacted legislation does not mean that this Court must modify its line of precedent, since, pursuant to section 7 of its Law, it has exclusive authority to define its own jurisdiction. Therefore, except for those constitutional-law disputes that this Chamber itself has recognized as exceptional circumstances and that may indeed be heard in this jurisdiction through the constitutional guarantee proceeding of amparo, in all other cases, and for the reasons given by this Court (judgment N° 2008-02545 at 8:55 hours on 22 de febrero de 2008), jurisdiction lies with the judges of the contentious-administrative jurisdiction (jurisdicción de lo contencioso-administrativo), all of which is consistent with section 25 of the American Convention on Human Rights, Constitutional Law (values, principles, and rules), and the corresponding statutory provisions, based on a logical, systemic, and purposive interpretation of the legal system.

VII.Note by Justice Salazar Alvarado. As a matter of principle, I consider that cases concerning the Public Administration’s failure to repair, construct, modify, or demolish any infrastructure works should be dismissed because such an omission is a matter of statutory legality (legalidad), the discussion of which belongs before the ordinary courts, where the interested person may present their objections more fully. However, when such administrative inaction results in a violation of other fundamental rights protected in this constitutional jurisdiction, or affects groups considered vulnerable, I do consider the merits of the matter, because that situation constitutes an exception to my position on this issue, as occurs in this case, in which it is alleged that the Consejo Nacional de Vialidad has engaged in a prolonged and unjustified failure to maintain, repair, and stabilize national route 415, despite the progressive deterioration of its roadway surface, slopes, and drainage and crossing structures, as well as the occurrence of events that have seriously compromised road safety, creating a present and ongoing risk that affects fundamental rights such as life, health, freedom of movement, work, education, and effective access to public services.

VIII.Dissenting opinion (voto salvado) of Justice Garro Vargas. Although I have joined the majority in cases raising similar grievances, upon further consideration, I believe that objections of this kind should be brought through the ordinary statutory remedies. This is particularly so when the record does not establish the existence of a duly identified person who requires the protection of this jurisdiction because of threats to the fundamental rights already mentioned, or who belongs to a vulnerable group requiring the intervention of this Chamber.

I consider that, in such circumstances, the failure to act should first be challenged before the authorities responsible for maintaining the route in question and then, if the omission continues, before the contentious-administrative jurisdiction. That court, with more extensive tools at its disposal, can thoroughly examine and weigh the underlying complaint, assess the administrative conduct, rule on jurisdiction—national road network or cantonal road network—issue specific orders to address the identified problem, and, of course, monitor compliance with the judgment.

In the sub lite, the petitioner alleges significant deterioration of National Route n.° 415, particularly in the Pascua de Siquirres sector, resulting from a landslide that occurred in 2021, as well as damage in the San Antonio sector, which, in the petitioner’s view, poses a risk to persons and vehicles traveling through the area.

Without identifying any specific individual or making any concrete subjective determination, the petitioner alleges that this situation creates difficulties for vehicular and pedestrian traffic, causing safety risks for persons traveling through the sector. In my view, that fact alone is sufficient to dismiss the amparo proceeding. This Court has noted that, based on the effects that the Ley de la Jurisdicción Constitucional attributes to the amparo proceeding (arts. 41 and 49), it must be concluded that any person may file such a proceeding, provided that they identify the persons whose fundamental rights they believe were violated (see, for example, judgments numbers 2019-003879, 2021-017532 and 2022-009133, among others). Consequently, respectfully and from my perspective, it does not appear valid for this forum to hear, on the basis of a generic argument, an alleged administrative failure to act that is more properly brought before the contentious-administrative jurisdiction.

In light of these considerations, I find that a direct and imminent threat to the aforementioned fundamental rights has not been established. Rather, this Court’s intervention could disrupt the Consejo Nacional de Vialidad’s (CONAVI) proper administrative planning for the execution of works of significant technical complexity and high cost, which could affect the proper management and allocation of the resources available to that institution for such purposes.

For the foregoing reasons, I dissent and deny the amparo proceeding.

VIII.Documentation submitted to the case file (expediente). The parties are advised that, if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced through new technologies, these must be collected from the court office within a maximum period of thirty business days from notification of this judgment. Otherwise, any material not collected within that period shall be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena in Session No. 27-11 of 22 de agosto del 2011, article XXVI, and published in Boletín Judicial No. 19 of 26 de enero del 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial in Session No. 43-12 held on 3 de mayo del 2012, article LXXXI.

Por tanto:

The amparo proceeding is granted solely with respect to the Consejo Nacional de Vialidad’s failure to implement a permanent solution for the landslide that occurred in the Pascua de Siquirres sector on National Route n.° 415. Accordingly, Mauricio Sojo Quesada, in his capacity as acting executive director of the Consejo Nacional de Vialidad, or whoever holds that office, is ordered to coordinate the pertinent actions, take the necessary measures, and issue the corresponding orders within the scope of their authority so that, within a maximum period of TWELVE MONTHS from notification of this judgment, the permanent solution for the aforementioned landslide is implemented, ensuring the safe and adequate restoration of trafficability along the affected section of National Route n.° 415. The respondent is warned that, pursuant to article 71 of the Ley de la Jurisdicción Constitucional, any person who receives an order issued in an amparo proceeding that they are required to comply with or enforce, and who fails to comply with or enforce it, shall be punished by imprisonment for three months to two years, or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty.

The Consejo Nacional de Vialidad is ordered to pay the damages and losses caused by the facts underlying this ruling, which shall be quantified during enforcement of the contentious-administrative judgment. In all other respects, the amparo proceeding is denied. Justice Castillo Víquez files a note. Justice Salazar Alvarado files a note. Justice Garro Vargas dissents and denies the amparo proceeding. Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta y cuatro minutos del trece de febrero de dos mil veintiseis .

Recurso de amparo que se tramita en expediente número 25-037879-0007-CO, interpuesto por [Nombre 001], cédula de identidad [Valor 001], contra el CONSEJO NACIONAL DE VIALIDAD -CONAVI-.

Resultando:

  1. 1Por escrito presentado ante esta Sala a las 11:30 horas del 04 de diciembre de 2025, la parte recurrente interpone recurso de amparo en contra del CONAVI. Manifiesta que desde hace varios años la ruta 415 presenta un deterioro progresivo en su superficie de rodamiento, taludes y obras de paso, cuya problemática se agravó en abril de 2021 cuando ocurrió un deslizamiento en el sector de Pascua de Siquirres provocando el colapso de un tramo completo de la calzada y el cierre total del paso vehicular, por lo que el tránsito fue desviado por la Ruta 10. Señala que en lugar de una respuesta pronta y efectiva por parte de las autoridades, fueron los vecinos -incluida su persona- quienes habilitaron artesanalmente un paso provisional, el cual nunca fue sustituido por una obra formal por parte del Consejo Nacional de Vialidad. Comenta que posteriormente en el 2024, el puente ubicado en San Antonio sufrió daños estructurales en sus bases de apoyo a causa del empuje frío n.° 3, quedando visiblemente deteriorado y "falseado", lo que en la actualidad genera un riesgo real de colapso.Relata que además en la misma zona se presenta un movimiento de tierra que ha provocado grietas profundas, hundimientos y deformaciones en la calzada, sin que exista una intervención técnica adecuada, por lo que reclama que la falta de obras de estabilización, drenaje y contención incrementa el riesgo de nuevos deslizamientos ante lluvias intensas. Recalca que la ruta 415 es vital para la comunidad, pues por ella circulan trabajadores, transportistas, estudiantes y vehículos que trasladan personas enfermas y cada día de inacción aumenta el riesgo de accidentes graves, emergencias médicas sin atención o pérdida de ingresos por la imposibilidad de movilizarse. Alega que ante esta situación, los vecinos -incluida su persona- han presentado gestiones formales e informales ante CONAVI (véase en la prueba aportada por la parte recurrente), solicitando la reparación y estabilización de la ruta y el puente; sin embargo, reclama que las respuestas han sido insuficientes, genéricas o dilatorias, limitándose a trabajos menores o simples valoraciones técnicas sin ejecución de obras concretas.Considera que esta omisión continuada por parte de CONAVI mantiene un riesgo latente que afecta derechos como la vida, la salud, el libre tránsito, el trabajo, la educación y el acceso a servicios públicos eficientes, constituyendo una violación actual y continua atribuible a la inacción de la Administración. En virtud de lo expuesto solicita se declare con lugar el presente recurso y se ordene lo que en derecho corresponda.
  2. 2Por resolución de las 10:02 horas del 16 de diciembre de 2025, la Presidencia de la Sala dio curso a este proceso constitucional y se le solicitó informe al director ejecutivo del CONAVI, sobre los hechos alegados por la parte recurrente.
  3. 3Mediante escrito incorporado al expediente digital a las 10:57 horas del 06 de enero de 2026, informa bajo juramento Mauricio Sojo Quesada, en su condición de director ejecutivo a.i del CONAVI, lo siguiente:

“IV. ATENCION DEL RECURSO POR EL FONDO En tal sentido, corresponde indicar que el presente análisis se circunscribe exclusivamente a los aspectos que resultan pertinentes dentro del ámbito de las competencias legalmente atribuidas a esta Administración, en estricto apego al Principio de Legalidad y a las funciones conferidas al Consejo Nacional de Vialidad. Para la debida atención de la situación planteada en el presente recurso de amparo, se solicitó a la Gerencia de Conservación de Vías y Puentes y a la Gerencia de Construcción de Vías y Puentes, ambas gerencias del Consejo Nacional de Vialidad, la emisión de los informes técnicos correspondientes con relación con los hechos denunciados en el presente recurso de amparo. En ese contexto, el informe técnico emitido por la Gerencia de Conservación de Vías y Puentes, identificado como CARTA-CONAVI-CA-DIE-GCSV-DRHA-077-2025 de fecha 19 de diciembre de 2025, brinda respuesta a la situación del puente ubicado en el sector de San Antonio.

Por su parte, el informe técnico elaborado por la Gerencia de Construcción de Vías y Puentes, identificado como CARTA-CONAVI-CA-DIE-GCTR-DVP-DDV-021-2025, de fecha 18 de diciembre de 2025, atiende lo relacionado con el deslizamiento ocurrido en el sector de Pascua de Siquirres. Con fundamento en los informes técnicos antes señalados, y en atención al Principio de Legalidad, al ámbito de competencias atribuidas al Consejo Nacional de Vialidad, así como a las reglas de la sana crítica racional y la lógica, procede esta representación institucional a dar respuesta, de manera ordenada, objetiva y puntual, a los alegatos formulados por la parte recurrente en el presente recurso de amparo, con el fin de desvirtuar la supuesta omisión alegada y acreditar las actuaciones técnicas y administrativas desplegadas por esta Administración. El recurrente atribuye al Consejo Nacional de Vialidad (CONAVI) una supuesta omisión continuada en la atención de la Ruta Nacional N.º 415, específicamente en los sectores de Pascua de Siquirres y San Antonio, señalando el deterioro de la calzada, afectaciones derivadas de deslizamientos y un presunto riesgo estructural del puente sobre el río Blanco.

En tal sentido, solicita la intervención de la Sala Constitucional al considerar que el estado actual de la Ruta Nacional N.º 415 evidencia un deterioro progresivo en su superficie de rodamiento, taludes y obras de paso. Afirma que dicha problemática se habría agravado a partir del mes de abril de 2021, cuando ocurrió un deslizamiento en el sector de Pascua de Siquirres, el cual —según indica— provocó el colapso de un tramo completo de la calzada y el cierre total del paso vehicular. Bajo ese contexto, alega concretamente que: 1. Soy usuario habitual de la Ruta Nacional n.° 415, específicamente en el tramo comprendido entre La Alegría y Bonilla. Dicha vía constituye la ruta única para el traslado diario de las personas residentes en la zona hacia centros de trabajo, estudio, salud, comercio y otros servicios básicos. Se acepta parcialmente, el CONAVI no controvierte que la Ruta Nacional N.° 415 constituye una vía de importancia para las comunidades de La Alegría, Bonilla, Pascua y San Antonio, ni que sea utilizada para el acceso a servicios básicos.

Sin embargo, el hecho de que una ruta sea relevante no significa que cualquier daño ocasionado por fenómenos naturales implique, de forma automática, una violación de derechos fundamentales. Por el contrario, resulta necesario realizar valoraciones técnicas especializadas que permitan determinar si existe un riesgo real y cuáles son las medidas que corresponden, análisis que efectivamente se llevaron a cabo en el presente caso por parte del CONAVI. 2. Desde hace varios años, la Ruta 415 presenta un deterioro progresivo en su superficie de rodamiento, taludes y obras de paso. Sin embargo, la situación se agravó de manera especial a partir del deslizamiento ocurrido en abril del año 2021, en el sector de Pascua de Siquirres, que ocasionó el colapso de un tramo completo de la calzada y el cierre total del paso vehicular sobre la Ruta Nacional n.° 415, según lo comunicó oficialmente la Comisión Municipal de Emergencias de Siquirres, obligando a desviar todo el tránsito por la Ruta 10.

El alegato del recurrente parte de un hecho parcialmente cierto, pero incurre en imprecisiones técnicas y conclusiones erróneas, al atribuir al Consejo Nacional de Vialidad una supuesta omisión prolongada o un agravamiento imputable a la Administración. Es cierto que en el año 2021 se presentó un evento de deslizamiento en el sector de Pascua de Siquirres; sin embargo, debe precisarse que dicho evento: • Obedeció a condiciones naturales y geológicas del terreno, ajenas a la voluntad de la Administración. • Fue atendido dentro de las posibilidades técnicas y operativas disponibles, considerando la complejidad geotécnica de la zona, la cual presenta posibles fallas geológicas activas, tal como lo confirman los informes técnicos más recientes. Debe resaltarse que los procesos geodinámicos no se corrigen de manera inmediata ni lineal, y su atención requiere estudios integrales previos, razón por la cual resulta técnicamente incorrecto afirmar que la Administración ha permanecido inactiva.

En primer término, debe indicarse que el evento ocurrido en abril de 2021 en el sector de Pascua de Siquirres corresponde a un deslizamiento de origen natural, asociado a condiciones geológicas, geomorfológicas e hidrológicas propias de la zona, y no a una falla constructiva, de mantenimiento ordinario ni a una omisión administrativa, tal como se desprende de los informes técnicos emitidos por las Gerencias competentes del CONAVI. En efecto, los informes técnicos señalan que el sector del kilómetro 29+200 de la Ruta Nacional n.° 415 se encuentra emplazado sobre un terreno con alta susceptibilidad a inestabilidad, donde confluyen: • Materiales geotécnicamente inestables, • Presencia de agua superficial y subterránea, • Taludes de elevada pendiente, • Y condiciones que hacen previsible la ocurrencia de deslizamientos ante eventos hidrometeorológicos intensos. Desde el análisis racional, resulta incorrecto afirmar que el “deterioro progresivo” de la ruta derive de una falta de intervención administrativa, cuando los fenómenos descritos responden a procesos naturales complejos, cuya atención no se limita a labores rutinarias de conservación, sino que exige soluciones estructurales de alta complejidad técnica, debidamente estudiadas y diseñadas.

Ahora bien, en relación con el cierre total del paso vehicular en el año 2021, es cierto que, por razones de seguridad vial y protección de la vida humana, se procedió al cierre temporal de la ruta y al desvío del tránsito por la Ruta Nacional N° 10. Sin embargo, dicho cierre: • Fue una medida preventiva necesaria y razonable, adoptada ante un evento súbito de fuerza natural, • No constituye por sí mismo prueba de inacción administrativa, • Ni implica que la Administración haya abandonado la atención del problema. Por el contrario, lejos de existir omisión, el CONAVI inició un proceso técnico-administrativo progresivo, el cual se encuentra debidamente documentado en los informes aportados, incluyendo:

  • 1)La contratación de estudios especializados mediante la Licitación N.° 2022CD-000147- 0006000001, orientada a elaborar el diseño de la solución definitiva para el deslizamiento que afectó el kilómetro 29+200.
  • 2)La culminación de la etapa de diseño, con aprobación provisional y definitiva del Informe Final en el año 2025, una vez cumplidos los requisitos técnicos y profesionales correspondientes.
  • 3)El inicio formal de la etapa de pre-ejecución, que incluye el complejo proceso de adquisición de terrenos y expropiaciones, indispensable para poder ejecutar cualquier obra definitiva.
  • 4)La valoración técnica de distintas alternativas constructivas, algunas de ellas de altísimo costo, que deben ser evaluadas bajo criterios de prefactibilidad técnica, económica y funcional, conforme al principio de razonabilidad en el uso de fondos públicos. Desde una valoración lógica y objetiva, no resulta jurídicamente válido exigir una solución inmediata o improvisada, cuando los propios informes técnicos advierten que intervenciones no precedidas de estudios adecuados podrían agravar la inestabilidad del terreno y generar un riesgo mayor para los usuarios. En consecuencia, si bien el deslizamiento del año 2021 constituyó un evento grave que afectó la transitabilidad de la Ruta Nacional n.° 415, no puede afirmarse que la situación se haya “agravado” por inacción del CONAVI, ni que el deterioro señalado sea consecuencia de una omisión administrativa, pues: • El origen del problema es predominantemente natural, • La Administración ha actuado de forma técnica, gradual y documentada, • Y la atención del caso se encuentra actualmente en una fase previa indispensable para la ejecución de obras definitivas. Por todo lo anterior, el alegato N.° 2 del recurrente carece de sustento técnico y jurídico suficiente para configurar una violación de derechos fundamentales atribuible al Consejo Nacional de Vialidad. 3. Luego, en lugar de existir una respuesta pronta y efectiva por parte de las autoridades competentes, fueron los propios vecinos quienes, de forma artesanal y con recursos limitados, habilitaron un paso provisional para poder continuar transitando. Este “arreglo” comunitario nunca fue sustituido por una obra formal, segura y definitiva a cargo de CONAVI. Se rechaza, este alegato se formula de manera genérica y sin respaldo técnico ni probatorio. El CONAVI no puede avalar ni ejecutar obras improvisadas o informales, precisamente porque su deber es garantizar soluciones técnicamente sustentadas y seguras. La existencia de intervenciones empíricas por terceros no puede imputarse como omisión administrativa, ni sustituye la responsabilidad institucional de actuar conforme a criterios técnicos, legales y presupuestarios. El alegato del recurrente, en el sentido de que, ante la ausencia de una respuesta pronta y efectiva por parte de las autoridades competentes, los propios vecinos habrían habilitado de forma artesanal un paso provisional que nunca fue sustituido por una obra formal, segura y definitiva a cargo del CONAVI, no se ajusta a los hechos debidamente acreditados en los informes técnicos, ni refleja la actuación del CONAVI desplegada en la Ruta Nacional n.° 415. De conformidad con los informes técnicos CARTA-CONAVI-CA-DIE-GCTR-DVP-DDV-021 2025 y CARTA-CONAVI-CA-DIE-GCSV-DRHA-077-2025, el evento de inestabilidad ocurrido en el sector de Pascua de Siquirres en el año 2021 correspondió a un fenómeno de carácter geodinámico complejo, asociado a las condiciones naturales del terreno, cuya atención no podía resolverse mediante una intervención inmediata y definitiva, sin antes realizar los estudios técnicos, geológicos, hidráulicos y estructurales necesarios. Desde la lógica técnica y administrativa, resulta improcedente afirmar que la habilitación temporal de un paso por parte de vecinos sustituye o desplaza la competencia del CONAVI, ni que dicha actuación comunitaria sea atribuible a una omisión institucional. Cualquier intervención formal en el sitio requería estudios especializados, debido a la inestabilidad del talud y al riesgo de recurrencia de deslizamientos, por lo que una obra definitiva sin sustento técnico habría sido contraria al principio de legalidad y al deber de protección de la vida humana. La Administración no podía ejecutar obras permanentes de manera inmediata, sin contar con diseño técnico aprobado, viabilidad ambiental, disponibilidad presupuestaria y respaldo contractual conforme a la normativa de contratación pública. La habilitación comunitaria a la que alude el recurrente no fue una obra ejecutada, autorizada ni avalada por el CONAVI, por lo que no puede imputarse a esta Institución ni considerarse como una solución institucional provisional. Debe destacarse que, conforme a los informes técnicos incorporados a la presente respuesta , el CONAVI sí realizó actuaciones de valoración, inspección y seguimiento del sitio, integrando el tramo afectado de la Ruta Nacional N.° 415 dentro de un abordaje técnico progresivo, acorde con la magnitud del evento y la complejidad del terreno. La inexistencia inmediata de una obra definitiva no constituye per se una omisión administrativa, sino la consecuencia lógica de un proceso técnico que exige planificación, estudios previos y cumplimiento estricto del marco jurídico aplicable. No resulta razonable exigir a la Administración la ejecución de una obra definitiva en un sitio geológicamente inestable, sin contar con las condiciones técnicas y legales necesarias, máxime cuando ello podría agravar el riesgo o generar responsabilidad patrimonial por intervenciones inadecuadas. En consecuencia, el alegato N° 3 carece de sustento técnico y jurídico, al basarse en apreciaciones subjetivas del recurrente y omitir la complejidad técnica del sitio, así como las limitaciones legales que rigen la ejecución de obras públicas. No se configura, por tanto, una omisión atribuible al Consejo Nacional de Vialidad ni una vulneración actual de derechos fundamentales derivada de los hechos alegados. 4. En la actualidad, el puente a la altura de San Antonio, se encuentra visiblemente deteriorado y “falseado”, con daños en su estructura y en las bases de apoyo a causa del empuje frío #3 del 2024. Esto genera un temor razonable a que ocurra un accidente grave o incluso el colapso de la estructura.” Se rechaza, el recurrente afirma que el puente presenta una condición estructural deficiente. Sin embargo, dichas afirmaciones no están debidamente respaldadas con pruebas técnicas. En concreto, el recurrente: • No aporta informes técnicos. • No presenta criterios estructurales emitidos por un profesional competente. • No adjunta evaluaciones sobre capacidad estructural, vida útil, estado de servicio o daños propios de la estructura. • Tampoco incorpora ensayos, mediciones o peritajes que permitan comprobar objetivamente lo señalado. Por esta razón, sus manifestaciones se limitan a apreciaciones subjetivas, sin sustento técnico verificable, lo que impide concluir que exista un riesgo estructural real, actual o inminente. Por el contrario, el CONAVI sí realizó inspecciones técnicas especializadas. De conformidad con las inspecciones efectuadas por el Departamento de Diseño de Vías y Puentes, y según lo consignado en el informe técnico N.º DVP-42-2024-0547 (0223), se determinó que: Estado estructural del puente La estructura del puente no presenta daños en su superestructura ni en su subestructura que comprometan la seguridad de los usuarios, la transitabilidad o su funcionamiento normal. Durante las inspecciones no se identificaron fallas estructurales activas ni condiciones inseguras, lo cual se respalda con el registro fotográfico incluido en el informe. Condición observada en el sitio Se identificó un proceso localizado de erosión y socavación en el entorno del bastión N.° 2. No obstante, los bastiones se encuentran empotrados a una distancia suficiente de la estructura del puente, precisamente para evitar que este tipo de fenómenos afecte su estabilidad. Además, ya se ejecutaron obras de estabilización y prevención, como la colocación de mantos de control de erosión. Origen de la problemática Las condiciones observadas responden principalmente a factores naturales del entorno, tales como: • Condiciones geológicas locales, • Presencia de aguas subterráneas, • Escorrentías superficiales intensas producto de lluvias, • Saturación del suelo y pérdida de cohesión del terreno. Estos factores no son atribuibles a fallas estructurales del puente, ni a deficiencias en la infraestructura vial. Condición de servicio Las valoraciones técnicas concluyen que el puente mantiene condiciones adecuadas de servicio y no representa un riesgo actual ni inminente para los usuarios, siendo los procesos erosivos detectados externos a la estructura y propios del entorno natural. 5. Asimismo, en la Ruta Nacional N.º 415, a la altura de San Antonio, se presenta además un movimiento de tierra evidente, que ha provocado grietas profundas, hundimientos y deformaciones en la superficie de rodamiento. La calzada se observa fracturada y con pérdida de soporte en uno de los costados, sin que hasta la fecha exista una explicación clara ni una intervención técnica adecuada por parte de las autoridades competentes. Se rechaza, el recurrente sostiene que existe una supuesta falta de atención o descuido por parte del CONAVI en la Ruta Nacional N.° 415. Sin embargo, dicha afirmación no se ajusta a la realidad técnica ni administrativa, ya que la ruta y los tramos señalados han recibido una atención diligente, constante y proactiva por parte de la Administración en materia de conservación vial. La ruta cuenta con mantenimiento permanente a través de los contratos de conservación vial vigentes. Si bien en el sector existe una falla geológica de gran extensión que incluye parte del trazado de la ruta, esta condición natural ha sido atendida de forma continua. Debido a dicha falla, la superficie de rodamiento presenta deformaciones recurrentes; no obstante, el CONAVI ha ejecutado las obras necesarias para garantizar la transitabilidad, la seguridad de los usuarios y la continuidad del paso vehicular. Como respaldo de lo anterior, durante el presente año se han ejecutado labores de mantenimiento en distintos trimestres, y además se encuentran programadas intervenciones para el primer trimestre del próximo año. Estas labores incluyen mantenimiento rutinario como bacheo, descuaje, chapea, atención de cunetas y reparación de fallas y hundimientos generados por el movimiento constante del terreno, lo que demuestra la existencia de un programa sistemático y continuo de atención de la ruta. Existencia de contrato y atención permanente En el marco del contrato de mantenimiento vigente: • Se programan y ejecutan trabajos de atención de forma recurrente, conforme a las necesidades detectadas en el sitio. • La ruta es intervenida periódicamente con el objetivo de conservar su transitabilidad, seguridad y funcionalidad. • Las imágenes N.° 6, 7, 8, 9, evidencian el estado actual de la Ruta Nacional N.° 415 y los trabajos de mantenimiento programado que se ejecutan en dicho tramo. De lo anterior se concluye y se demuestra que la ruta se encuentra transitable y en buen estado para la operación segura de la zona, permitiendo el paso de los vehículos y usuarios que transitan por el lugar, toda vez que, se ha realizado el mantenimiento correspondiente a lo largo del tiempo. Condición geológica de la ruta Es importante señalar que la Ruta Nacional N.° 415 se ubica en una zona con características geológicas particulares. Estas condiciones hacen que el terreno sea altamente susceptible a problemas como la saturación de suelos y las escorrentías producto de las lluvias, lo que provoca la aparición recurrente de eventos que requieren atención correctiva debido a la falla geológica existente en el sector. Estas situaciones no se originan por falta de mantenimiento, sino que responden a las condiciones naturales del entorno. Por esta razón, el CONAVI ha establecido un esquema permanente de vigilancia y atención de la ruta. Monitoreo y comunicación con la comunidad De manera adicional, se realiza un seguimiento constante del estado de la ruta mediante: • Inspecciones técnicas periódicas en campo. • Atención oportuna de los incidentes que son reportados. • Comunicación directa y continua con vecinos del sector, quienes informan sobre situaciones específicas que son analizadas técnicamente y atendidas, en la medida de lo posible, dentro del alcance contractual. Este esquema de coordinación y respuesta evidencia que la ruta no se encuentra en abandono, como lo afirma el recurrente, sino que existe una atención constante y una comunicación activa con la comunidad para dar seguimiento a las condiciones de la vía. 6. La falta de intervención técnica adecuada también se evidencia en la ausencia de obras de estabilización de taludes, sistemas de drenaje apropiados y muros de contención en la zona afectada. Esto implica que, ante eventos de lluvia intensa u otras condiciones limáticas, exista un alto riesgo de nuevos deslizamientos o desprendimientos de material que podrían agravar todavía más el estado de la ruta Se rechaza, el recurrente realiza varias afirmaciones que, al igual que en el alegato N.° 4, no cuentan con respaldo técnico. En efecto, no aporta estudios de suelos, análisis de estabilidad de taludes, estudios hidrológicos o hidráulicos, ni criterios profesionales emitidos por especialistas competentes que permitan verificar lo señalado. Por ello, dichas manifestaciones responden más a apreciaciones personales y subjetivas del recurrente, basadas en observaciones propias, y no a pruebas técnicas objetivas. En consecuencia, lo expuesto no constituye prueba idónea para demostrar de manera fehaciente la existencia de una afectación real, ni para atribuir una omisión o actuación indebida a la Administración por una supuesta falta de atención, como se pretende en el presente recurso de amparo. La ausencia de elementos técnicos objetivos impide tener por acreditados los hechos alegados, máxime cuando no se incorpora al expediente ningún sustento técnico que los respalde. 7. “…La Ruta 415 es indispensable para el funcionamiento cotidiano de la comunidad: por ella circulan trabajadores que se desplazan a sus empleos, transportistas que llevan productos agrícolas y comerciales, estudiantes que se dirigen a escuelas y colegios, así como vehículos que trasladan personas enfermas o que requieren atención médica en centros de salud ubicados en otros distritos o cantones. Cada día de inacción incrementa el riesgo de que una emergencia médica no llegue a tiempo, que se produzca un accidente Se rechaza, en primer término, si bien esta Administración reconoce la importancia funcional y social de la Ruta Nacional N.° 415 para las comunidades que comunica, tal circunstancia no constituye por sí misma prueba de una vulneración a derechos fundamentales, ni permite concluir automáticamente la existencia de una omisión administrativa o de un riesgo actual o inminente atribuible al CONAVI. En segunda instancia, el recurrente realiza varias afirmaciones que, al igual que en el alegato N.° 4, no cuentan con respaldo técnico. En efecto, no aporta estudios de suelos, análisis de estabilidad de taludes, estudios hidrológicos o hidráulicos, ni criterios profesionales emitidos por especialistas competentes que permitan verificar lo señalado. Debe indicarse que no se acredita una relación causal directa entre las actuaciones del CONAVI y las afectaciones alegadas por el recurrente, tales como la imposibilidad de acceso a servicios de salud, pérdida de empleo o interrupción del proceso educativo. Tampoco se demuestra que dichas consecuencias se hayan materializado de forma concreta, real y verificable. Por ello, dichas manifestaciones responden más a apreciaciones personales y subjetivas del recurrente, basadas en observaciones propias, y no a pruebas técnicas objetivas. En consecuencia, lo expuesto no constituye prueba idónea para demostrar de manera fehaciente la existencia de una afectación real, ni para atribuir una omisión o actuación indebida a la Administración por una supuesta falta de atención, como se pretende en el presente recurso de amparo. La ausencia de elementos técnicos objetivos impide tener por acreditados los hechos alegados, máxime cuando no se incorpora al expediente ningún sustento técnico que los respalde. 8. “…Ante esta situación, los vecinos de la zona —incluyéndome— hemos acudido en diversas ocasiones a las autoridades competentes, presentando gestiones y solicitudes formales e informales ante CONAVI y otras instituciones, con el fin de que se valore el riesgo existente y se ejecuten las obras de reparación y estabilización necesarias en la Ruta 415 y el puente en cuestión…” Se rechaza, El recurrente no aporta prueba documental idónea de tramitación de las supuestas gestiones formales que afirma haber presentado ante el CONAVI, ya que insinuó haber presentado en varias ocasiones gestiones y solicitudes formales e informales. Únicamente aporta una captura de imagen correspondiente a una queja presentada en el año 2022 a través del entonces vigente sistema de quejas y denuncias del CONAVI. No obstante, de la misma prueba aportada por el propio recurrente se desprende que dicha gestión sí fue debidamente atendida, constando la respuesta brindada por la Administración. El recurrente no aporta elementos nuevos ni información distinta a la ya analizada en los hechos anteriores. Se limita a reiterar señalamientos previamente abordados, los cuales no cuentan con documentación técnica que los respalde. Sus argumentos se basan en suposiciones subjetivas, así como en publicaciones de redes sociales y fotografías de eventos pasados, las cuales no reflejan la situación actual ni las intervenciones realizadas por el CONAVI hasta la fecha del presente informe. 9. Pese a lo anterior, las respuestas obtenidas, cuando las ha habido, han sido insuficientes, genéricas o meramente dilatorias. No se ha ejecutado una solución definitiva ni se han adoptado medidas que garanticen la seguridad estructural del puente y la ruta, limitándose la Administración, en el mejor de los casos, a trabajos menores o a simples valoraciones técnicas que no se han traducido en obras concretas Se rechaza, como se ha demostrado y evidenciado anteriormente, se han ejecutado acciones concretas en campo para garantizar la transitabilidad en la zona, a pesar de la existencia de una falla geológica que abarca tanto el trazado de la ruta nacional como los terrenos y propiedades adyacentes. Estas condiciones generan daños recurrentes y acelerados en la superficie de rodamiento, razón por la cual se mantiene un monitoreo constante de la ruta y una programación diligente de acciones correctivas. Dado que se trata de un alegato reiterativo, es importante recordar lo señalado en los puntos anteriores, donde se ha evidenciado el mantenimiento y la atención continua de la ruta a lo largo del tiempo. Por lo tanto, lo manifestado por el recurrente no es suficiente para sustentar las pretensiones formuladas en el recurso, toda vez que no se aporta prueba técnica idónea que respalde sus afirmaciones. En consecuencia, el alegato del recurrente carece de sustento técnico, toda vez que el CONAVI ha actuado dentro del marco de su competencia, con diligencia, planificación y atención a la seguridad de la vía y el puente, tal y como se señala en los informes técnicos anteriormente citados. 10. “…Esta omisión continuada por parte de CONAVI y las autoridades responsables no solo mantiene el riesgo latente de un accidente grave, sino que de hecho ya afecta el ejercicio de derechos como el libre tránsito, la salud, el trabajo y la educación, al obligar a la población a utilizar diariamente una infraestructura en condiciones de peligro, o bien a hacer recorridos más largos, costosos e ineficientes por rutas alternas…” Se rechaza, el recurrente reitera los mismos señalamientos del alegato N.° 7 sin aportar pruebas que los respalden. La Administración mantiene una atención constante y diligente de la ruta, lo que garantiza la transitabilidad segura en el lugar. Por esta razón, el recurrente no logra acreditar de manera concreta qué derechos fundamentales se verían vulnerados, ya que la ruta se encuentra actualmente transitable y con paso seguro, permitiendo el libre tránsito de los usuarios. 11. “…En consecuencia, la falta de intervención oportuna y adecuada en la Ruta Nacional N.º 415 y en el puente afectado constituye una violación actual y continua de los derechos fundamentales señalados en la sección anterior, atribuible a la inacción de la Administración, que, teniendo el deber jurídico de garantizar la seguridad y funcionalidad de la infraestructura vial, ha omitido cumplir con sus obligaciones…” Se rechaza, el recurrente sostiene nuevamente una supuesta vulneración de derechos, la cual no logra acreditar, toda vez que en el presente caso se encuentra debidamente demostrada la programación constante de labores de mantenimiento en la Ruta Nacional N.° Página 30 de 34 415, así como la trazabilidad documentada de las actuaciones realizadas por la Administración. Programación y trazabilidad de la gestión La gestión de conservación en el sector se ejecuta bajo un esquema formal, continuo y verificable, que incluye: • Programación continua de actividades de mantenimiento, con planificación anual y mensual de intervenciones, incluyendo labores preventivas y correctivas. • Registro y seguimiento detallado de cada intervención, lo que permite documentar el estado de la vía, los trabajos ejecutados y las medidas de mitigación implementadas. • Monitoreo técnico permanente del estado de la ruta, con inspecciones periódicas por parte de profesionales del Departamento de Conservación de Vías y Puentes. Este modelo de gestión garantiza que todas las actuaciones sean rastreables y verificables, descartando la existencia de abandono, inacción o desatención por parte del CONAVI. Se recuerda que, la Gerencia de Conservación Vial tiene dentro de sus alcances legales garantizar el buen funcionamiento de las rutas nacionales del país, así como el mantenimiento de las mismas, por lo que, con la información aportada dentro del expediente remitido, así como en las inspecciones realizadas se determinó que el caso en estudio no obedece a una situación causada por la Red Vial Nacional, sino por fallas geórgicas y eventos de fuerza mayor que mueven el terreno. La supuesta vulneración de derechos alegada por el recurrente carece de sustento, toda vez que las actuaciones del CONAVI se encuentran documentadas, planificadas y ejecutadas conforme a procedimientos técnicos y administrativos vigentes, y los problemas observados en la Ruta 415 se originan por causas naturales y ajenas a la gestión institucional. V. CONCLUSIONES De conformidad con el análisis técnico y jurídico realizado, se concluye que:
  • 1)La Ruta Nacional N.º 415 y el puente ubicado en los sectores de Pascua y San Antonio no presentan daños estructurales ni riesgo inminente que comprometan la seguridad de los usuarios, conforme a lo establecido en el Informe N.º DVP-42-2024-0547 (0223) y los informes complementarios del Departamento de Diseño de Vías y Puentes.
  • 2)Las afectaciones observadas, incluyendo procesos de erosión, socavación localizada y condiciones de los taludes, responden a factores geológicos, hidrogeológicos y de escorrentía superficial propios del entorno, los cuales no son atribuibles a deficiencias de la infraestructura ni a omisiones de la Administración.
  • 3)La Administración, a través de la Gerencia de Conservación de Vías y Puentes, ha ejecutado un programa constante, documentado y trazable de mantenimiento y atención de la ruta, incluyendo labores de bacheo, descuaje, chapea y reparación de deformaciones ocasionadas por el movimiento del terreno, garantizando la transitabilidad y funcionalidad de la vía.
  • 4)La Licitación No. 2022CD-000147-0006000001, denominada, "Estudios para elaborar los diseños de la solución definitiva al deslizamiento que cortó el paso en el kilómetro 29+200, Ruta Nacional No. 415, Siquirres, Limón”, ya finalizó la etapa de diseño y se encuentra en “pre ejecución”.
  • 5)Se solicitó al Departamento de Adquisición de Bienes Inmuebles (DABI) del Ministerio de Obras Públicas y Transportes (MOPT) que iniciara el trámite de adquisición de los terrenos, y actualmente el trámite administrativo de los avalúos, notificación y negociación está en proceso. Aunque ya se tiene estimación del costo de las obras, todavía tiene mucha incertidumbre. Las evaluaciones correspondientes se realizarán en prefactibilidad.
  • 6)Las manifestaciones realizadas por el recurrente se limitan a apreciaciones subjetivas y juicios de opinión, careciendo de respaldo técnico verificable, ensayos, mediciones o peritajes que permitan sustentar la existencia de un riesgo estructural real, actual o inminente. En consecuencia, no se acredita la supuesta vulneración de derechos alegada, ni se evidencia una actuación negligente o deficiente por parte de la Administración. Por el contrario, la evidencia técnica y administrativa demuestra que el CONAVI ha actuado de manera diligente, continua y conforme al marco legal vigente, garantizando la seguridad y funcionalidad de la Ruta Nacional N.° 415 y del puente en cuestión. Por lo tanto, resulta improcedente conceder las pretensiones del recurrente, al no existir fundamentos técnicos ni jurídicos que respalden sus alegaciones. De acuerdo con el principio de legalidad que rige la actuación de la Administración Pública, el Consejo Nacional de Vialidad ha obrado dentro de sus competencias legales y reglamentarias, llevando a cabo las gestiones interinstitucionales pertinentes. En conclusión, no se configura una omisión ni actuación arbitraria atribuible al CONAVI, y no existe vulneración de derechos fundamentales por parte de la institución. El Consejo Nacional de Vialidad continúa desarrollando programas de atención y seguimiento vial, con el objetivo de fortalecer la gestión pública y garantizar la seguridad de los usuarios de la Red Vial Nacional”.
  1. 4En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta el Magistrado Castillo Víquez; y,

Considerando:

I.Objeto del recurso. El recurrente alega que el CONAVI ha incurrido en una omisión prolongada e injustificada en el mantenimiento, reparación y estabilización de la ruta nacional 415, pese al deterioro progresivo de su superficie de rodamiento, taludes y obras de paso, así como a la ocurrencia de eventos que han comprometido gravemente la seguridad vial. Sostiene el amparado que, desde el deslizamiento ocurrido en abril de 2021 en el sector de Pascua de Siquirres, que provocó el colapso de un tramo completo de la calzada y el cierre total del tránsito, la Administración no ejecutó una solución estructural definitiva, siendo los propios vecinos quienes habilitaron de forma artesanal un paso provisional que se mantiene hasta la fecha. Afirma el tutelado que, posteriormente, el puente ubicado en San Antonio sufrió daños estructurales relevantes en sus apoyos, quedando en una condición de riesgo latente, aunado a movimientos de tierra que han generado grietas, hundimientos y deformaciones en la vía, sin que se hayan realizado obras técnicas de estabilización, drenaje o contención.

Alega el accionante que, pese a múltiples gestiones formuladas ante CONAVI, las respuestas han sido meramente genéricas o dilatorias, limitándose a valoraciones técnicas o intervenciones menores, sin ejecución de obras concretas que mitiguen el peligro existente. En ese contexto, sostiene la promovente que la inacción administrativa mantiene una situación de riesgo actual y continuo que afecta derechos fundamentales como la vida, la salud, el libre tránsito, el trabajo, la educación y el acceso efectivo a servicios públicos, por lo que solicita la tutela constitucional correspondiente.

II.Cuestión preliminar. Antes de analizar el fondo del asunto debe aclararse que, a partir de la sentencia número 2008-02545 de las 8:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa, con algunas excepciones aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo, instruido de oficio o a instancia de parte, o conocer de los recursos administrativos procedentes. Precisamente, en el sub lite, se plantea un supuesto de excepción, pues se está ante el reproche formulado por la parte recurrente respecto de la inacción del Consejo Nacional de Vialidad frente a una situación que, según se alega, compromete de manera directa la seguridad vial y la integridad de los usuarios de la Ruta Nacional n.° 415, concretamente en el sector de Pascua de Siquirres, a raíz del deslizamiento ocurrido en abril de 2021, sin que, a la fecha, se haya materializado una solución estructural definitiva que restablezca adecuadamente la transitabilidad y mitigue el riesgo existente. Aclarado el punto, se entra a resolver la situación concreta planteada en este amparo.

III.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque la parte recurrida haya omitido referirse a ellos según lo prevenido en el auto inicial:

  • a)En el año 2021, en el sector de Pascua de Siquirres, específicamente en el kilómetro 29+200 de la Ruta Nacional n.° 415, se presentó un evento de deslizamiento que motivó el cierre temporal del paso vehicular y el desvío del tránsito por la Ruta Nacional n.° 10 (véanse los informes de las autoridades recurridas y la prueba aportada al expediente digital) b) En el año 2022, el Consejo Nacional de Vialidad tramitó la licitación n.° 2022CD-000147-0006000001, denominada “Estudios para elaborar los diseños de la solución definitiva al deslizamiento que cortó el paso en el kilómetro 29+200, Ruta Nacional No. 415, Siquirres, Limón” (véanse los informes de las autoridades recurridas y la prueba aportada al expediente digital).
  • c)En el año 2024, el Departamento de Diseño de Vías y Puentes del Consejo Nacional de Vialidad emitió el informe técnico DVP-42-2024-0547 (0223), referido a inspecciones técnicas especializadas del puente sobre el río Blanco, en el sector de San Antonio, y consignó que la estructura no presentaba daños en su superestructura o subestructura que comprometieran la seguridad de los usuarios, según lo reportado por la autoridad recurrida (véanse los informes de las autoridades recurridas y la prueba aportada al expediente digital).
  • d)En el año 2024, se identificó un proceso localizado de erosión y socavación y, en consecuencia, el CONAVI ejecutó obras de estabilización y prevención mediante colocación de mantos de control de erosión (véanse los informes de las autoridades recurridas y la prueba aportada al expediente digital).
  • e)El 18 de diciembre de 2025, la Gerencia de Construcción de Vías y Puentes del Consejo Nacional de Vialidad emitió el informe técnico CARTA-CONAVI-CA-DIE-GCTR-DVP-DDV-021-2025, relativo al deslizamiento ocurrido en el sector de Pascua de Siquirres en la Ruta Nacional n.° 415. En dicho informe, se indicó lo siguiente: “1. Identificación de la ruta, sitio específico La Gerencia de Construcción de Vías y Puentes, promovió la Licitación No. 2022CD 000147-0006000001, denominada, "Estudios para elaborar los diseños de la solución definitiva al deslizamiento que cortó el paso en el kilómetro 29+200, Ruta Nacional No. 415, Siquirres, Limón . La estructura a diseñar corresponde a la estructura definitiva para el mejoramiento del deslizamiento del kilómetro 29+200, de la Ruta Nacional No. 415, y que comprende una longitud de aproximadamente 165,00 (ciento sesenta y cinco) metros lineales, comprendida entre los puntos con coordenadas CRTM05 E=541823.12; N=1107019.8 y E=541747.3; N=1106891.9, según se observa a continuación. 2.

Gestiones realizadas por CONAVI Se brindó aprobación provisional al Informe Final el 5 de agosto de 2025 y la aprobación definitiva el 1° de setiembre de 2025, luego de que los planos se registraran ante el Colegio Federado de Ingenieros y de Arquitectos. Al concluir el diseño, la etapa actual pasa a ser Pre ejecución. Mediante CARTA CONAVIGCTR- 02-2025-1378 del 10 de junio de 2025 se solicitó al Departamento de Adquisición de Bienes Inmuebles (DABI) del Ministerio de Obras Públicas y Transportes (MOPT) que iniciara el trámite de adquisición de los terrenos. Por ello, se adelantó el inicio de la etapa de Pre ejecución a junio de 2025, mientras que antes estaba programada para iniciar en enero de 2026. Se mantiene la finalización de la etapa de Pre ejecución en junio de 2027. […] 3. Limitaciones técnicas (costos) En proceso Anteriormente el costo del diseño se había estimado en ₡34.633.935; sin embargo, se estaban contemplando dos planos de catastro con área de hasta 1500 m² y dos planos de catastro con área de 1500 a 5000 m².

En contraste, se ejecutaron un plano de catastro con área de hasta 1500 m² y tres planos de catastro con área de 1500 a 5000 m². Esto implicó un aumento de ₡266.680. Por otro lado, se cobró una multa de ₡70.489,40, debido a que se requirió presentar una tercera versión del Informe Final. Además, se sumaron ₡357.362,77 por el reajuste del Informe Final, pero se restaron ₡1543,72 como reajuste de la multa; por lo que el monto efectivo de reajustes fue de ₡355.819,05. Entonces, el monto final de diseño fue de ₡35.185.944,65. El costo preliminar para la adquisición de los terrenos (pre ejecución) se aumenta de ₡13.968.900 a ₡16.550.700, debido al aumento del área. El presupuesto para el diseño base (que utiliza muros de gaviones en el talud de relleno) se incrementó a ₡1.666.065.667. Además, se determinó que ese diseño base no cumple los criterios de estabilidad global en condición de sismo, por lo que se hizo otro diseño alternativo, que incluye una pantalla de pilotes debajo de los muros de gaviones y sus aproximaciones.

Tal alternativa tiene un costo de ₡7.899.340.866. Para mayor claridad, se explica que la intervención para restaurar la sección de carretera afectada por deslizamiento incluiría: • Muro de suelo cosido pendiente 0,5H:1V en talud de corte con anclajes de 3 m de longitud cada 1,5 m en ambas direcciones. • Muro 1 en talud de relleno a lo largo de 98 m con gaviones terramesh en altura de 7 m y gaviones en altura de 3 m sobre pantalla de pilotes (2 filas de pilotes de 1 m de diámetro y 15 m de profundidad). • Muro 2 en talud de relleno a lo largo de 62 m con gaviones de 7 m de altura sobre pantalla de pilotes (3 filas de pilotes de 1 m de diámetro y 15 m de profundidad). Como alternativa intermedia, podría aplicarse la pantalla de pilotes solamente debajo de los muros de gaviones, pero no en sus aproximaciones, con lo que se tendría un costo aproximado de ₡4.320.320.639. Se valora que la solución completa, que cumple con todos los criterios de estabilidad, sería excesivamente costosa, si se tiene en cuenta el bajo tránsito que posee la vía.

Por ello, se requiere que las tres alternativas sean evaluadas en prefactibilidad. 4. Conclusiones técnicas • La Licitación No. 2022CD-000147-0006000001, denominada, "Estudios para elaborar los diseños de la solución definitiva al deslizamiento que cortó el paso en el kilómetro 29+200, Ruta Nacional No. 415, Siquirres, Limón , ya finalizó la etapa de diseño y se encuentra en pre ejecución. • Se solicitó al Departamento de Adquisición de Bienes Inmuebles (DABI) del Ministerio de Obras Públicas y Transportes (MOPT) que iniciara el trámite de adquisición de los terrenos, y actualmente el trámite administrativo de los avalúos, notificación y negociación está en proceso. • Aunque ya se tiene estimación del costo de las obras, todavía tiene mucha incertidumbre. Las evaluaciones correspondientes se realizarán en prefactibilidad. Así las cosas, se recomienda desestimar la solicitud presentada por la recurrente, siendo que se demuestra las acciones tomadas por el Consejo Nacional de Vialidad y por la Gerencia de Construcción de Vías y Puentes para la atención del mejoramiento del deslizamiento del kilómetro 29+200 en la Ruta Nacional N°160” (véanse los informes de las autoridades recurridas y la prueba aportada al expediente digital).

  • f)El 19 de diciembre de 2025, la Gerencia de Conservación de Vías y Puentes del Consejo Nacional de Vialidad emitió el informe técnico CARTA-CONAVI-CA-DIE-GCSV-DRHA-077-2025, relativo a la situación del puente ubicado en el sector de San Antonio, en la Ruta Nacional n.° 415. En dicho informe, se consignó, en lo que interesa, lo siguiente: “Se tiene que, de conformidad con las inspecciones técnicas realizadas por el Departamento de Diseño de Vías y Puentes, y según lo consignado en el informe No. DVP-42-2024-0547 (0223), se concluye lo siguiente: Estado estructural del puente Según se desprende del informe No. DVP-42-2024-0547 (0223), la estructura del puente no presenta daños estructurales en su superestructura ni subestructura que comprometan la el paso seguro de los usuarios, transitabilidad, o su funcionalidad operativa. Asimismo, durante las inspecciones, no se identificaron fallas estructurales activas ni condiciones inseguras de la estructura, tal y como se evidencia en la imagen No.1, 2, 3, 4 y 5, las cuales muestran el estado actual del puente.

Condición observada en el sitio Se tiene un proceso de socavación y erosión localizado en el entorno inmediato del bastión N.º 2, lo cual corresponde a un descubrimiento de los bastiones del puente, mismos que se encuentran empotrados a una distancia considerable de la estructura del mismo, a fin de evitar precisamente la vulnerabilidad del del puente en función de cualquier socavación en la superficie, garantizando así su seguridad estructural. Aunado a lo anterior descrito, se ha realizado las obras de estabilización y prevención indicadas en el informe N° DVP-42-2024-0547 (0223), como por el ejemplo en manto de control de erosión mostrado en la Imagen N° 2. Asimismo, el Departamento de Diseño de Vías y Puentes determinó que la problemática observada responde principalmente a condiciones geológicas, hidrogeológicas y de escorrentía superficial propias del entorno, incluyendo: • Posibles fallas geológicas locales, • Presencia de aguas subterráneas, • Escorrentías concentradas producto de precipitaciones intensas, • Saturación del suelo y pérdida de cohesión del terreno.

Estos factores no son atribuibles a deficiencias estructurales del puente ni a la infraestructura vial existente, ni representan un riesgo a la seguridad de los usuarios. Condición de servicio Las valoraciones estructurales del puente realizadas por instancias técnicas especializadas concluyen que la estructura no presenta daños estructurales, mantiene condiciones adecuadas de servicio y noentr evidencia riesgo actual o inminente para los usuarios. Las observaciones identifican procesos erosivos en el entorno y no atribuibles a fallas estructurales del puente. Alegato N.º 5 5. Asimismo, en la Ruta Nacional N.º 415, a la altura de San Antonio, se presenta además un movimiento de tierra evidente, que ha provocado grietas profundas, hundimientos y deformaciones en la superficie de rodamiento. La calzada se observa fracturada y con pérdida de soporte en uno de los costados, sin que hasta la fecha exista una explicación clara ni una intervención técnica adecuada por parte de las autoridades competentes.

En relación a este punto, el Recurrente sugiere una supuesta falta de atención o descuido en la ruta objeto del presente Recurso de Amparo, no obstante, dicha afirmación no obedece a la realidad técnica, ni administrativa, esto por cuanto a la ruta en mención, así como los tramos señalados, cuentan con unas atención por parte de la Administración de forma diligente, constante y proactiva, en materia de conservación vial, a lo largo del tiempo, mediante las figuras contractuales con que se cuentan para este fin, siendo que pese a que en el lugar existe una falla geológica, de hectáreas, dentro de las cuales se encuentra la ruta, se ha mantenido un escrito mantenimiento a la superficie de ruedo, la cual sufre constantes deformaciones productor de dicha falla geológica, no obstante, dado la situación presentada, se ha realizado las obras correspondientes para garantizar la transitabilidad, seguridad y no interrupción del paso por la ruta de los usuarios.

Como evidencia de lo anterior descrito, dentro de las labores de mantenimiento de conservación vial, se tiene que durante el presente año, en los trimestres, primero, segundo, cuarto y el primer trimestre del próximo año, se ha tenido y se tiene en programación, labores de mantenimiento rutinario como bacheo, descuaje, chapea, atención de cuentas y reparación de las falla y hundimientos que se generan debido al movimiento contante del terreno, manteniendo así un programa constante y sistemático de atención de la ruta. Existencia de contrato y atención permanente En el marco del citado contrato de mantenimiento: • Se programan y ejecutan trabajos de atención de manera recurrente, en función de las necesidades que se presentan en sitio. • La ruta es objeto de intervenciones periódicas, orientadas a preservar la transitabilidad, seguridad y funcionalidad de la vía. • Las imágenes 6, 7, 8, 9, 10 y 11, evidencian el estado actual de la ruta, así como los trabajos de mantenimiento programado que se realizan en la Ruta Nacional 415.

De lo anterior se concluye y se demuestra que la ruta se encuentra transitable y en buen estado para la operación segura de la zona, permitiendo el paso de los vehículos y usuarios que transitan por el lugar, toda vez que, se ha realizado el mantenimiento correspondiente a lo largo del tiempo. Condición geológica particular de la ruta Resulta técnicamente relevante indicar que la ruta se localiza en una zona con condiciones geológicas particulares, caracterizadas por: • Alta susceptibilidad a afectaciones derivadas de saturación de suelos y escorrentías, • Aparición Recurrente de eventos que requieren atención correctiva inmediata debido a la falla geológica existente en el lugar. Estas condiciones no son producto de falta de mantenimiento, sino inherentes al entorno geológico del sector, razón por la cual la Administración ha implementado un esquema de vigilancia y respuesta continua. Monitoreo y comunicación con la comunidad Adicionalmente, se mantiene un monitoreo constante del estado de la ruta, reforzado por: • Seguimientos técnicos de campo. • Atención oportuna de incidencias reportadas. • Comunicación directa y permanente con algunos vecinos del sector, quienes informan situaciones puntuales que son valoradas técnicamente para su atención dentro del alcance contractual, lo antes posible.

Este esquema de coordinación y respuesta se demuestra que la ruta no solo no se encuentra en abandono, tal como pretende el Recurrente señalar como una realidad, sino que también se mantiene una constante comunicación con la comunidad y atención a la ruta. Alegato N.º 6 6. La falta de intervención técnica adecuada también se evidencia en la ausencia de obras de estabilización de taludes, sistemas de drenaje apropiados y muros de contención en la zona afectada. Esto implica que, ante eventos de lluvia intensa u otras condiciones climáticas, exista un alto riesgo de nuevos deslizamientos o desprendimientos de material que podrían agravar todavía más el estado de la ruta. Respuesta al Alegato N.º 6 El Recurrente formula una serie de afirmaciones que, al igual que en el alegato N.º 4, no se encuentran respaldadas con estudio de suelos, estudios de estabilidad de taludes, estudios hidrológicos, estudios hidráulicos, criterios profesionales emitidos por especialista competente y/o cualquier prueba de carácter técnico que permita acreditar o validar lo señalado, siendo que la afirmación corresponde mas a un criterio subjetivo, con un opinión de valor a una observación personal realizada por el Recurrente.

En consecuencia, lo expuesto se limita a apreciaciones subjetivas, las cuales no constituyen prueba idónea para demostrar de fehaciente la existencia de una afectación real, ni mucho menos para imputar una omisión o actuación indebida por parte de la Administración, por una supuesta falta de atención objeto del presente Recurso de Amparo. La ausencia de dichos elementos impide tener por acreditados los hechos expuestos, máxime cuando no se aporta sustento técnico que los respalde dentro del expediente. 7. La Ruta 415 es indispensable para el funcionamiento cotidiano de la comunidad: por ella circulan trabajadores que se desplazan a sus empleos, transportistas que llevan productos agrícolas y comerciales, estudiantes que se dirigen a escuelas y colegios, así como vehículos que trasladan personas enfermas o que requieren atención médica en centros de salud ubicados en otros distritos o cantones.

Cada día de inacción incrementa el riesgo de que una emergencia médica no llegue a tiempo, que se produzca un accidente fatal o que las personas pierdan su fuente de ingreso por no poder movilizarse con seguridad. Respuesta al Alegato N.º 7 Tal como se indició en los puntos anteriores el Recurrente plantea nuevamente una situación que pretende asociarse a una supuesta falta de atención en el sector; sin embargo, dicho planteamiento no se sostiene frente a la gestión efectiva que se mantiene activa y de forma constante en la ruta, tal como se ha demostrado en el presente informe. El sector cuenta con un programa de mantenimiento vigente, el cual se ejecuta de manera permanente, planificada y monitoreada, en atención a las condiciones particulares del entorno y a las necesidades que se presentan en sitio. Programa de mantenimiento activo y monitoreado En el marco de dicho programa: • Se realiza seguimiento continuo del estado de la vía. • Se valoran técnicamente las condiciones que ameritan intervención. • Se programan acciones correctivas y de urgencia conforme a criterios técnicos y contractuales.

Este esquema de trabajo demuestra que se mantiene una atención diligente y contante a lo largo del tiempo en función de brindar el mantenimiento de la vía garantizando la transitabilidad. 8. Ante esta situación, los vecinos de la zona incluyéndome hemos acudido en diversas ocasiones a las autoridades competentes, presentando gestiones y solicitudes formales e informales ante CONAVI y otras instituciones, con el fin de que se valore el riesgo existente y se ejecuten las obras de reparación y estabilización necesarias en la Ruta 415 y el puente en cuestión. Respuesta al Alegato N.º 8 En relación a este punto, el Recurrente no introduce elementos nuevos, ni aporta información distinta a la ya analizada en los hechos anteriores, limitándose a reiterar señalamientos previamente abordados y que no cuentan con documentos técnicos que logre acreditar lo señalado, siendo que los argumentos se basados en supuestos de carácter subjetivo, así como publicaciones de redes sociales y fotográficas de eventos pasados, que no son sujetos a la realidad actual de las intervenciones realizadas a la fecha del presente informe.

Alegato N.º 9 9. Pese a lo anterior, las respuestas obtenidas, cuando las ha habido, han sido insuficientes, genéricas o meramente dilatorias. No se ha ejecutado una solución definitiva ni se han adoptado medidas que garanticen la seguridad estructural del puente y la ruta, limitándose la Administración, en el mejor de los casos, a trabajos menores o a simples valoraciones técnicas que no se han traducido en obras concretas. Respuesta al Alegato N.º 9 En relación a este punto, tal como se ha demostrado y evidenciado anteriormente, se han realizado acciones concretas, traducías en obras en campo, a fin de garantizar la transitabilidad en la zona, siendo que en el lugar existe una falla geológica la cual cubre el área completa por donde pasa la ruta nacional, así como las propiedades y terrenos adyacentes a la misma. Dichas fallas provocan daños acelerados y constantes a la superficie de ruedo, razón por la cual se mantiene un monitoreo constante de la ruta, así como una programación diligente de acciones contras para la atención correspondiente e idóneas.

Así las cosas, por tratarse de un alegato reiterativo, es importante señalar lo indicado en los puntos anterior en los cuales se ha demostrado el mantenimiento y atención a la ruta a lo largo del tiempo, siendo que lo indicado por el Recurrente no resultan suficientes para sustentar las pretensiones formuladas en el recurso, en función de que no se aporta prueba técnica que sustente lo señalado. Alegato N.º 10 10. Esta omisión continuada por parte de CONAVI y las autoridades responsables no solo mantiene el riesgo latente de un accidente grave, sino que de hecho ya afecta el ejercicio de derechos como el libre tránsito, la salud, el trabajo y la educación, al obligar a la población a utilizar diariamente una infraestructura en condiciones de peligro, o bien a hacer recorridos más largos, costosos e ineficientes por rutas alternas. Respuesta al Alegato N.º 10 Se tiene que, en relación a este punto, el Recurrente reitera los mismos señalamientos contenidos en el alegato N.º 7, sin aportar pruebas que acrediten lo señalado, toda vez que al contar con una atención constante y diligente por parte de la Administración, el cual garantiza la transitabilidad segura por el lugar, esto conlleva a que el Recurrente no logre acreditar de forma concreta, cuales son los derechos fundamentales que se le violenta, en función de que actualmente, la ruta se encuentra transitable y con paso seguro atreves de la misma, por lo que se tiene un libre tránsito seguro por la vía.

Alegato N.º 11 11. En consecuencia, la falta de intervención oportuna y adecuada en la Ruta Nacional N.º 415 y en el puente afectado constituye una violación actual y continua de los derechos fundamentales señalados en la sección anterior, atribuible a la inacción de la Administración, que, teniendo el deber jurídico de garantizar la seguridad y funcionalidad de la infraestructura vial, ha omitido cumplir con sus obligaciones. Respuesta al Alegato N.º 11 El Recurrente sostiene nuevamente una supuesta vulneración de derechos, la cual no logra acreditar, toda vez que en el presente caso se encuentra debidamente demostrada la programación constante de labores de mantenimiento en la ruta, así como la trazabilidad de las actuaciones realizadas por la Administración. Programación y trazabilidad de la gestión La gestión de conservación en el sector se ejecuta bajo un esquema de: • Programación continua de actividades de mantenimiento. • Registro y seguimiento de intervenciones. • Monitoreo técnico permanente del estado de la vía.

Este modelo de trabajo permite verificar, documentar y dar seguimiento a cada actuación, lo cual descarta la existencia de inacción, abandono o desatención, y evidencia una actuación administrativa diligente y verificable. Inexistencia de acreditación de los hechos fundamentales En contraste con dicha gestión acreditada, el Recurrente: • No demuestra con prueba objetiva los hechos fundamentales que afirma. • No establece un nexo entre lo alegado y una actuación u omisión concreta de la Administración. • No desvirtúa la trazabilidad de las acciones ejecutadas en el marco de la conservación vial. En consecuencia, no se configura la supuesta vulneración de derechos alegada, al no acreditarse los hechos esenciales que sustentarían tal pretensión. Valoración técnico administrativa Desde el punto de vista técnico y administrativo, la existencia de una gestión trazable, continua y documentada impide tener por demostrados los hechos invocados por el Recurrente, resultando improcedente imputar responsabilidad a la Administración.

Conforme al marco normativo vigente, la Administración atiende las obligaciones constructivas y funcionales de la infraestructura bajo su competencia legal. Así las cosas, por lo tanto, tal como se ha evidenciado y demostrado técnicamente en el presente informe, la situación descrita no obedece a una omisión o afectación causada por obras realizadas por parte de la Administración o la inacción de parte esta, siendo que la naturaleza del problema corresponde a un área vulnerable geológicamente de la cual, pese a sus movimientos constantes se ha realizado un mantenimiento periódico y constante a lo largo del tiempo, toda vez que, incluso cuando se presenta alguna emergencia que provoque una deformación severa. Se recuerda que, la Gerencia de Conservación Vial tiene dentro de sus alcances legales garantizar el buen funcionamiento de las rutas nacionales del país, así como el mantenimiento de las mismas, por lo que, con la información aportada dentro del expediente remitido, así como en las inspecciones realizadas se determinó que el caso en estudio no obedece a una situación causada por la Red Vial Nacional, sino por fallas geórgicas y eventos de fuerza mayor que mueven el terreno.

No se omite indicar que esta Gerencia de Conservación de Vías y Puentes, realiza el mantenimiento de las Ruta Nacionales, mediante los contratos de conservación con que se cuenta a lo largo del tiempo, de manera oportuna, diligente y responsable, en función de contar con un buen funcionamiento de este y brindar un mantenimiento adecuado que garantice la transitabilidad segura por la vía. Conclusiones 1. Los señalamientos sobre una supuesta condición estructural deficiente del puente no cuentan con respaldo técnico, quedando demostrado, mediante el informe No. DVP-42-2024-0547 (0223) emitido por el Departamento de Diseño de Vías y Puentes, que la estructura no presenta daños ni riesgo estructural. 2. Las manifestaciones realizadas se limitan a apreciaciones subjetivas, carentes de sustento técnico verificable, lo cual impide considerar la existencia de un riesgo estructural real, actual o inminente. 3.

Las afectaciones observadas la socavación de la protección del bastión N° 2, corresponden a procesos erosivos y condiciones geológicas propias del entorno, sin que se establezca nexo causal directo con la infraestructura vial. 4. Durante las inspecciones, no se identificaron fallas estructurales activas ni condiciones inseguras de la estructura, tal y como se evidencia en la imagen No.1, 2, 3, 4 y 5, las cuales muestran el estado actual del puente 5. Las valoraciones estructurales del puente realizadas por instancias técnicas especializadas concluyen que la estructura no presenta daños estructurales, mantiene condiciones adecuadas de servicio y no evidencia riesgo actual o inminente para los usuarios. Las observaciones identifican procesos erosivos en el entorno y no atribuibles a fallas estructurales del puente. 6. Durante el presente año, en los trimestres, primero, segundo, cuarto y el primer trimestre del próximo año, se ha tenido y se tiene en programación, labores de mantenimiento rutinario como bacheo, descuaje, chapea, atención de cuentas y reparación de las falla y hundimientos que se generan debido al movimiento contante del terreno, manteniendo así un programa constante y sistemático de atención de la ruta. 7.

Los hechos reiterativos y juicios de opinión personal no constituyen prueba idónea para sustentar las condiciones reales de la ruta y su atención por parte de la Administración. 8. Lo expuesto se limita a apreciaciones subjetivas, las cuales no constituyen prueba idónea para demostrar de fehaciente la existencia de una afectación real, ni mucho menos para imputar una omisión o actuación indebida por parte de la Administración, por una supuesta falta de atención objeto del presente Recurso de Amparo. 9. La Administración ha realizado y mantenido una atención diligente y contante a lo largo del tiempo en función de brindar el mantenimiento de la vía garantizando la transitabilidad” (véanse los informes de las autoridades recurridas y la prueba aportada al expediente digital).

  • g)La licitación n.°2022CD-000147-0006000001 finalizó la etapa de diseño, con aprobación provisional y definitiva del informe final, y que el proyecto se encontraba en etapa de “pre ejecución” (véanse los informes de las autoridades recurridas y la prueba aportada al expediente digital).
  • h)La Ruta Nacional n.°415 recibe mantenimiento mediante contratos de conservación vial vigentes y además, durante el año 2025, se ejecutaron labores durante el año en distintos trimestres. Además, se programaron intervenciones para el primer trimestre del año 2026, incluyendo bacheo, descuaje, chapea, atención de cunetas y reparación de fallas y hundimientos (véanse los informes de las autoridades recurridas y la prueba aportada al expediente digital).

IV.Sobre el deslizamiento en Pascua de Siquirres. La parte recurrente sostiene que la ruta 415 presenta un deterioro progresivo que se agravó con el colapso de un tramo en abril de 2021, lo que ocasionó el cierre total del paso vehicular, y que, ante la falta de una respuesta pronta y efectiva por parte del Consejo Nacional de Vialidad, fueron los propios vecinos quienes habilitaron un paso provisional que, hasta la fecha, no ha sido sustituido por una obra formal.

En el presente asunto, esta Sala verifica la violación de los derechos fundamentales de la parte amparada, ya que el evento de deslizamiento ocurrido en el año 2021 en el sector de Pascua de Siquirres kilómetro 29+200 de la Ruta Nacional n.° 415, si bien obedece a condiciones naturales ajenas a la voluntad administrativa, generó una afectación objetiva y prolongada en la transitabilidad de una vía que sirve de conexión esencial para las comunidades de la zona, de modo que la respuesta institucional, aun cuando ha incluido actuaciones técnicas y administrativas, no ha logrado materializar, en un plazo razonable, una solución formal que restituya condiciones estables y seguras de circulación.

En primer término, conviene precisar que el amparo no se orienta a exigir a la Administración una obra determinada ni a sustituir el criterio técnico que corresponde a los órganos especializados del Consejo Nacional de Vialidad, sino a examinar si, frente a una afectación persistente en la red vial nacional que impacta el libre tránsito y, por su estrecha conexión, el acceso efectivo a servicios básicos, la actuación pública ha sido suficientemente oportuna y eficaz para neutralizar el riesgo y la restricción derivados del colapso del tramo. En esa línea, aun cuando el CONAVI sostiene que el fenómeno responde a procesos geodinámicos complejos y que su atención exige estudios integrales previos, lo cierto es que el marco fáctico acreditado evidencia que la situación se mantiene sin una obra formal definitiva desde el año 2021, lo cual trasciende la mera discusión técnica y coloca el asunto en el plano de la tutela efectiva de los derechos fundamentales comprometidos.

Ahora bien, resulta claro, a partir de los elementos probatorios incorporados, que la Administración emprendió acciones relevantes, pues se tramitó la licitación n.° 2022CD-000147-0006000001 para elaborar los diseños de la solución definitiva, se aprobó de manera provisional el informe final el 5 de agosto de 2025 y de forma definitiva el 1° de setiembre de 2025, y se dio inicio a gestiones de pre-ejecución que incluyen la solicitud al Departamento de Adquisición de Bienes Inmuebles del MOPT para la tramitación de terrenos y expropiaciones, incluso adelantando dicha etapa a junio de 2025. Sin embargo, precisamente porque se reconoce la existencia de una ruta de gestión, lo que corresponde dilucidar es si, a la luz del tiempo transcurrido desde el evento inicial y del impacto práctico que produce la falta de una solución formal, esa secuencia ha sido suficiente para garantizar, de manera real y no meramente programática, el restablecimiento del libre tránsito en condiciones estables y seguras.

En ese sentido, aunque el CONAVI explica que existen alternativas constructivas con distintos rangos de costo y que la solución completa sería “excesivamente costosa”, señalando que se requiere una evaluación de prefactibilidad, debe destacarse que dichas consideraciones, aun siendo atendibles desde la racionalidad técnica y presupuestaria, no pueden traducirse en una prolongación indefinida de un escenario en el que la transitabilidad depende de condiciones provisorias y de la persistencia de un terreno inestable, máxime cuando el propio informe técnico reconoce que la intervención necesaria supera el marco de un mantenimiento rutinario y que la pre-ejecución se extiende, según programación institucional, hasta junio de 2027. De ahí que, aun aceptando que la Administración no ha permanecido inactiva, la consecuencia material es que, transcurridos varios años desde el colapso del tramo, no existe una obra formal ejecutada que estabilice definitivamente el sitio, lo cual mantiene una afectación actual al derecho al libre tránsito y, por conexión, a la continuidad en el acceso a servicios esenciales que dependen de esa vía.

Por consiguiente, desde la óptica constitucional, el problema no radica en imponer una solución técnica específica, sino en constatar que la respuesta pública debe ser efectivamente conducente a remover, en un plazo razonable, la restricción prolongada que pesa sobre quienes utilizan la Ruta Nacional n.° 415 en ese punto crítico, de manera que la tutela se impone para ordenar a la Administración que impulse y materialice, con la debida diligencia, las actuaciones necesarias para concretar la solución formal ya diseñada y llevarla a ejecución dentro de un marco temporal verificable, sin perjuicio de las valoraciones técnicas y procedimientos legales que correspondan. En consecuencia, al mantenerse la afectación por un lapso prolongado sin que se haya implementado una solución formal definitiva, procede declarar parcialmente con lugar el recurso, únicamente en lo relativo al deslizamiento del sector de Pascua de Siquirres.

V.Respecto al puente del sector de San Antonio en la Ruta Nacional n.° 415. Afirma el tutelado que, posteriormente, el puente ubicado en San Antonio sufrió daños estructurales relevantes en sus apoyos, quedando en una condición de riesgo latente, aunado a movimientos de tierra que han generado grietas, hundimientos y deformaciones en la vía, sin que se hayan realizado obras técnicas de estabilización, drenaje o contención. Alega el accionante que, pese a múltiples gestiones formuladas ante CONAVI, las respuestas han sido meramente genéricas o dilatorias, limitándose a valoraciones técnicas o intervenciones menores, sin ejecución de obras concretas que mitiguen el peligro existente. En ese contexto, sostiene la promovente que la inacción administrativa mantiene una situación de riesgo actual y continuo que afecta derechos fundamentales como la vida, la salud, el libre tránsito, el trabajo, la educación y el acceso efectivo a servicios públicos, por lo que solicita la tutela constitucional correspondiente.

En cuanto a este extremo, esta Sala descarta la existencia de una vulneración a los derechos fundamentales invocados, ya que de los elementos probatorios incorporados al expediente no se desprende la configuración de un riesgo estructural real, actual o inminente atribuible a la actuación u omisión de la autoridad recurrida. En efecto, aun cuando la parte amparada afirma que el puente presenta daños relevantes en sus apoyos y que la calzada adyacente evidencia grietas, hundimientos y deformaciones, tales manifestaciones no se encuentran respaldadas por prueba técnica idónea que permita corroborar objetivamente la existencia de una condición estructural deficiente o de peligro concreto para los usuarios de la vía.

En primer lugar, conviene señalar que el Consejo Nacional de Vialidad sí realizó inspecciones técnicas especializadas en el sitio, cuyos resultados constan en el informe técnico DVP-42-2024-0547 (0223), elaborado por el Departamento de Diseño de Vías y Puentes, en el cual se concluyó que la estructura del puente no presenta daños en su superestructura ni en su subestructura que comprometan la seguridad, la transitabilidad o su funcionamiento normal, ni se identificaron fallas estructurales activas o condiciones inseguras durante las evaluaciones efectuadas. A partir de ese análisis, se determinó que las afectaciones observadas corresponden a procesos localizados de erosión y socavación en el entorno inmediato de uno de los bastiones, sin que tales fenómenos incidan directamente sobre la estabilidad estructural del puente, máxime cuando los apoyos se encuentran empotrados a una distancia suficiente para evitar su vulnerabilidad frente a dichos procesos.

Ahora bien, aunado a lo anterior, de la prueba rendida bajo juramento se desprende que la Administración no se limitó a una mera valoración técnica pasiva, sino que ejecutó obras de estabilización y prevención, como la colocación de mantos de control de erosión, precisamente orientadas a mitigar los efectos de las condiciones geológicas e hidrológicas propias del entorno. En ese contexto, los informes técnicos son consistentes al indicar que la problemática identificada responde principalmente a factores naturales, tales como la presencia de aguas subterráneas, escorrentías superficiales intensas y saturación del suelo, y no a deficiencias estructurales de la obra ni a una falta de mantenimiento atribuible al CONAVI.

De igual forma, en relación con los movimientos de tierra y deformaciones en la superficie de rodamiento a la altura de San Antonio, se acreditó que la ruta se encuentra incluida dentro de contratos de conservación vial vigentes y que ha sido objeto de un programa continuo y sistemático de mantenimiento, que comprende labores de bacheo, descuaje, chapea, atención de cunetas y reparación de fallas y hundimientos, con intervenciones ejecutadas durante distintos trimestres y otras ya programadas para el período siguiente. En esa línea, la existencia de una falla geológica de gran extensión en el sector no permite, por sí sola, afirmar la existencia de abandono o inacción administrativa, cuando se demuestra que la autoridad recurrida mantiene un esquema permanente de vigilancia, atención y comunicación con la comunidad para preservar la transitabilidad y seguridad de la vía.

Por consiguiente, aun cuando esta Sala reconoce la importancia funcional y social de la Ruta Nacional n.° 415 para las comunidades que comunica, lo cierto es que, en este extremo, la parte recurrente no logró acreditar un nexo causal directo entre la conducta del CONAVI y una afectación concreta, real y verificable de los derechos fundamentales que invoca, pues la prueba técnica disponible descarta la existencia de un riesgo estructural actual o inminente en el puente y evidencia una gestión administrativa activa en la atención del tramo. En consecuencia, al no demostrarse la supuesta inacción ni el peligro alegado, corresponde rechazar este agravio y declarar sin lugar el recurso en lo relativo al puente del sector de San Antonio y a las condiciones de la calzada asociadas a dicho punto.

VI.Nota del Magistrado Castillo Víquez, en cuanto a la justicia administrativa pronta y cumplida. He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales.

A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia. Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.

VII.Nota del magistrado Salazar Alvarado. En tesis de principio, considero que los casos relacionados con la inactividad de la Administración Pública en la reparación, construcción, modificación o demolición de cualquier obra de infraestructura, deben ser desestimados, por constituir, esa omisión, un tema de legalidad, cuya discusión corresponde a la jurisdicción ordinaria, ante la cual la persona interesada puede debatir, con mayor amplitud, sus disconformidades. Sin embargo, cuando de aquella conducta administrativa omisiva se derive alguna violación a otros derechos fundamentales tutelados en esta jurisdicción constitucional, o se afecten grupos considerados vulnerables, sí entro a conocer el fondo del asunto, por constituir esta situación una excepción a mi posición en esta materia, tal y como sucede en este caso, en que se reclama, que el Consejo Nacional de Vialidad ha incurrido en una omisión prolongada e injustificada en el mantenimiento, reparación y estabilización de la ruta nacional 415, pese al deterioro progresivo de su superficie de rodamiento, taludes y obras de paso, así como a la ocurrencia de eventos que han comprometido gravemente la seguridad vial, generando una situación de riesgo actual y continuo que afecta derechos fundamentales como la vida, la salud, el libre tránsito, el trabajo, la educación y el acceso efectivo a servicios públicos.

VIII.Voto salvado de la magistrada Garro Vargas. Pese a que he concurrido con el voto en asuntos donde se plantean similares agravios, bajo una mejor ponderación estimo que este tipo de reproches se deben plantear en las vías ordinarias de legalidad. Lo anterior, máxime si, de los autos, no se constata la existencia de una persona debidamente individualizada que requiera del amparo de esta jurisdicción por las amenazas a los derechos fundamentales ya indicados o que pertenezca a un grupo vulnerable que demande la intervención de esta Sala.

Considero que en tales supuestos procede, en primer término, cuestionar la inactividad ante las autoridades competentes en el mantenimiento de la ruta en cuestión y luego, de mantenerse la conducta omisa, ante la jurisdicción contencioso-administrativa. Dicha instancia jurisdiccional, con mayores herramientas, puede conocer con profundidad y sopesar la denuncia de fondo, valorar la conducta administrativa, resolver sobre la competencia ‒red vial nacional o red vial cantonal‒, dictar mandatos específicos para atender la problemática apuntada y, por supuesto, dar seguimiento a lo ordenado en sentencia.

En el sub lite, la parte recurrente acusa que existe un deterioro relevante en la Ruta Nacional n.° 415, particularmente en el sector de Pascua de Siquirres, derivado de un deslizamiento ocurrido en el año 2021, así como afectaciones en el sector de San Antonio, lo cual, a su criterio, representa un riesgo para las personas y los vehículos que transitan por el lugar.

Lo anterior, sin ninguna determinación subjetiva concreta o individualización específica, aduce que esta situación genera dificultades en el tránsito vehicular y peatonal, provocando riesgos de seguridad para las personas que circulan por el sector. Ya solo ese elemento, en mi criterio, es suficiente para desestimar el recurso de amparo. Este Tribunal ha advertido que, partiendo de los efectos que la Ley de la Jurisdicción Constitucional confiere al recurso de amparo (arts. 41 y 49), debe concluirse que cualquier persona puede interponerlo, siempre y cuando individualice a los sujetos cuyos derechos fundamentales considera fueron conculcados (ver, por ejemplo, las sentencias números 2019-003879, 2021-017532 y 2022-009133, entre otras). En consecuencia, respetuosamente y desde mi perspectiva, no luce válido que, a tenor de un argumento genérico, se conozca en esta sede sobre una supuesta inactividad administrativa que más corresponde ser residenciada en la jurisdicción contencioso-administrativa.

A la luz de tales elementos, considero que no se encuentra acreditada una amenaza directa e inminente a los derechos fundamentales supra mencionados. Más bien, la intervención de este Tribunal podría alterar la debida planificación administrativa del Consejo Nacional de Vialidad (CONAVI) para la ejecución de obras de significativa complejidad técnica y elevado costo, lo cual podría afectar la adecuada administración y previsión de los recursos con los que cuenta dicha institución para tales efectos.

En virtud de lo expuesto, salvo el voto y declaro sin lugar el recurso de amparo.

VIII.Documentación aportada al expediente. Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión No. 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial No. 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión No. 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se declara con lugar el recurso, únicamente por la omisión del Consejo Nacional de Vialidad en ejecutar una solución definitiva respecto del deslizamiento ocurrido en el sector de Pascua de Siquirres, en la Ruta Nacional n.° 415. En consecuencia, se ordena a Mauricio Sojo Quesada, en su condición de director ejecutivo a.i del Consejo Nacional de Vialidad, o a quien ocupe dicho cargo, que coordinen lo pertinente, tomen las medidas necesarias y giren las órdenes correspondientes dentro del ámbito de su competencia, para que, en el plazo máximo de DOCE MESES, contado a partir de la notificación de esta sentencia, se ejecute la solución definitiva para atender el deslizamiento indicado, garantizando la restitución segura y adecuada de la transitabilidad en el tramo afectado de la Ruta Nacional n.° 415. Se apercibe a la parte recurrida que, de conformidad con lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o hiciere cumplir, siempre que el delito no esté más gravemente penado.

Se condena a la Consejo Nacional de Vialidad al pago de los daños y perjuicios causados con los hechos que sirven de fundamento a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. En lo demás, se declara sin lugar el recurso. El magistrado Castillo Víquez consigna nota. El magistrado Salazar Alvarado pone nota.
