Amparo proceeding (recurso de amparo) processed under expediente No. 25- 038691-0007-CO, filed by [Name 001], identity card [Value 001], against the MINISTERIO DE SALUD.
BACKGROUND:
“(…) Second: On 07 de junio de 2024, a complaint was received at the institutional email address [email protected] concerning a property located in Urbanización Tolentino, La Lima, Cartago, described as uninhabited, roofless, with accumulated waste, standing water, and the presence of disease vectors (vectores). Processing number 0214- 2024 was assigned. Folios 0001-0005. Complaint file 0214-2024. Confidential. Third: On 17 de septiembre de 2024, an inspection was conducted at the reported location, confirming the conditions described (dismantled structure, no roof, solid waste, health risk). An inspection record was prepared and photographs were taken. Technical report MS-DRRSCE-DARSC-IT-2084-2024 was prepared, recommending the issuance of a Health Order (Orden Sanitaria) pursuant to Articles 314, 316, and 318 of the Ley General de Salud. Folios 0006-0009. Case file 0214-2024. Respondent.
Fourth: On 04 de noviembre de 2024, Health Order MS-DRRSCE-DARSCOS-0261-2024 was issued to the registered owner, Norma Cecilia Rivera Acevedo, granting 20 business days for compliance. Folio 0010. Case file 0214-2024. Respondent. Fifth: On 20 de noviembre de 2024, the complainant was informed that the Health Order had been issued, and a copy of oficio MS-DRRSCE-DARSC-1255-2024 was attached. Folios 0006- 0008. Complaint file 0214-2024. Confidential. Sixth: On 05 de diciembre de 2024, an inquiry was received from the complainant regarding the progress of the case. She was informed that the case file was undergoing legal analysis because the person who had been served had died. Folios 0009-0011. Complaint file 0214- 2024. Confidential. Seventh: On 06 de febrero de 2025, legal opinion CARTA-MS-DRRSCE-0118- 2025 determined that the Health Order was rendered void by the death of the regulated party (administrada), recommending that the matter be resumed through a new inspection or service upon the heirs.

Eighth: On 25 de abril de 2025, a registry inquiry and certification from the Tribunal Supremo de Elecciones confirmed the death of the registered owner, rendering the Health Order void. Ninth: On 04 de julio de 2025, the technical team was instructed to investigate with the Municipalidad de Cartago to locate potential responsible parties or heirs to the property. Folio 0016-0018. Case file 0214-2024. Respondent. Tenth: On 1 de noviembre de 2025, the Municipalidad de Cartago conducted an inspection and provided notice that it would proceed within the scope of its authority. Folio 0019. Case file 0214-2024. Respondent. Eleventh: On 05 de diciembre de 2025, a technical visit was conducted and an inspection record was prepared, confirming the state of abandonment and requesting interinstitutional cooperation.
Folio 0020-0022. Case file 0214-2024. Respondent. Twelfth: On 06 de enero de 2026, the complainant submitted updated photographs of the property and reported the filing of the amparo proceeding. Folio 0023-0029. Case file 0214-2024. Respondent. Thirtieth: On 13 de enero de 2026, technical report CARTA-MS-DRRSCEDARSC-IT-019-2026 was issued, concluding that: • The lot is in unsanitary conditions and is abandoned. • It was not possible to locate the legally responsible party because of the owner’s death and the absence of succession information. • The case should be referred to the Municipalidad de Cartago pursuant to Article 84 of the Código Municipal. That same day, the case file was formally referred to the Municipalidad for its intervention. Folio 0032-0035. Case file 0214-2024. Respondent. (…)”.

CONSIDERING:
I.Preliminary matter. Before analyzing the merits of the allegation—concerning the alleged violation of the right to prompt and proper proceedings (derecho a un procedimiento pronto y cumplido)—it must be clarified that, since judgment No. 2008-02545 issued at 8:55 hrs. on 22 de febrero de 2008, this Chamber has referred to the administrative-law jurisdiction (jurisdicción contencioso administrativa)—with certain exceptions—those matters involving disputes over whether the public administration has complied with the deadlines established by the Ley General de la Administración Pública (Articles 261 and 325) or by sector-specific laws governing special administrative proceedings, either to conclude through a final administrative act a proceeding initiated ex officio or at the request of a party, or to hear the applicable administrative appeals. This case presents precisely such an exception because it concerns an environmental complaint (denuncia ambiental) that the Ministerio de Salud allegedly failed to resolve within a reasonable period. Having clarified this point, the Chamber now rules on the specific situation raised in this amparo proceeding.
The petitioner considers that the petitioner’s fundamental rights have been violated. The petitioner states that, on 7 de junio de 2024, a complaint was sent to the respondent authority at the email address [email protected], reporting that a house in the petitioner’s community was uninhabited, roofless, and contained accumulated waste, standing water, and disease vectors. The petitioner states that processing number 0214-2024 was assigned to the complaint. The petitioner further mentions that, on 19 de junio de 2024, oficio IDU-OF-192-2024 was received, confirming the inspection and the reported conditions. The petitioner adds that, on 5 de diciembre de 2024, notice was given of the property owner’s death and the uncertainty regarding the current owner, for which reason the case was referred for legal review. The petitioner alleges that, as of the filing date of this proceeding, no decision had been received regarding the submissions made. The petitioner states that this problem jeopardizes the health of the petitioner and the petitioner’s neighbors.
The following facts are deemed duly established and relevant to the disposition of this matter:

On 17 de septiembre de 2024, the respondent Área Rectora de Salud conducted an inspection at the reported location, confirming the conditions described (dismantled structure, no roof, solid waste, health risk). An inspection record was prepared and photographs were taken. Technical report MS-DRRSCE-DARSC-IT-2084-2024 was prepared, recommending the issuance of a Health Order (see the report submitted and the documentation provided).
On 4 de noviembre de 2024, the respondent Área Rectora de Salud issued Health Order MS-DRRSCE-DARSCOS-0261-2024 to the registered owner, Norma Cecilia Rivera Acevedo, granting 20 business days for compliance (see the report submitted and the documentation provided).
On 20 de noviembre de 2024, the respondent authorities informed the complainant that the Health Order had been issued and attached a copy of oficio MS-DRRSCE-DARSC-1255-2024 (see the report submitted and the documentation provided).
On 5 de diciembre de 2024, the respondent Área Rectora de Salud received an inquiry from the complainant regarding the progress of the case. She was informed that the case file was undergoing legal analysis because the person who had been served had died (see the report submitted and the documentation provided).
On 6 de febrero de 2025, legal opinion CARTA-MS-DRRSCE-0118- 2025 determined that the Health Order was rendered void by the death of the regulated party, recommending that the matter be resumed through a new inspection or service upon the heirs (see the report submitted and the documentation provided).
On 25 de abril de 2025, officials of the respondent Área Rectora de Salud confirmed, through a registry inquiry and certification from the Tribunal Supremo de Elecciones, the death of the registered owner of the abandoned real property, rendering the Health Order void (see the report submitted and the documentation provided).
On 12 de enero de 2026, the respondent authority was served with notice of the decision admitting this proceeding for consideration (see certificate of service).
On 13 de enero de 2026, the respondent Área Rectora de Salud issued technical report CARTA-MS-DRRSCEDARSC-IT-019-2026, concluding: 1. The lot is in unsanitary conditions and is abandoned. 2. It was not possible to locate the legally responsible party because of the owner’s death and the absence of succession information. 3. The case should be referred to the Municipalidad de Cartago pursuant to Article 84 of the Código Municipal. That same day, the case file was formally referred to the Municipalidad for its intervention (see the report submitted and the documentation provided).
In the sub lite matter, it is established that on June 7, 2024, the protected person filed a complaint with the Área Rectora de Salud de Cartago concerning a property located in Urbanización Tolentino, La Lima, Cartago, described as uninhabited, without a roof, and containing accumulated waste, standing water, and vectors. Processing number 0214- 2024 was assigned. It may further be inferred that on September 17, 2024, the respondent health governing area inspected the reported site and confirmed the conditions described (a dismantled structure, without a roof, solid waste, and a health hazard). A record was drawn up and photographs were taken. Technical report MS-DRRSCE-DARSC-IT-2084-2024 was prepared, recommending the issuance of a Health Order (Orden Sanitaria). It may likewise be inferred that on November 4, 2024, the respondent health governing area issued Health Order MS-DRRSCE-DARSCOS-0261-2024 to the registered owner, Norma Cecilia Rivera Acevedo, granting a compliance period of 20 business days.
It is similarly established that on November 20, 2024, the respondent authorities informed the complainant that the Health Order had been issued and attached a copy of official letter MS-DRRSCE-DARSC-1255-2024. On December 5, 2024, the respondent health governing area received an inquiry from the complainant concerning the progress of the case. In response, she was informed that the case file was undergoing legal analysis due to the death of the person who had been served notice. It is additionally established that on February 6, 2025, legal opinion CARTA-MS-DRRSCE-0118- 2025 determined that the Health Order was rendered ineffective because of the death of the subject of the administrative proceeding, and recommended resuming the matter through a new inspection or by notifying the heirs. It is further established that on April 25, 2025, officials from the respondent health governing area confirmed, through a registry inquiry and certification from the Tribunal Supremo de Elecciones, the death of the registered owner of the abandoned real property, thereby rendering the Health Order ineffective.
Finally, it is established that on January 13, 2026, in connection with this amparo action (recurso de amparo), the respondent health governing area issued technical report CARTA-MS-DRRSCEDARSC-IT-019-2026, concluding: 1. The lot is in unsanitary and abandoned condition. 2. It was not possible to locate the legally responsible person because the owner had died and no succession information was available. 3. The matter should be referred to the Municipalidad de Cartago pursuant to Article 84 of the Código Municipal. That same day, the case file was formally referred to the Municipalidad for intervention.
In connection with the foregoing, Article 84, subsection b), of the Código Municipal provides:
“Article 84.- In accordance with the municipal regulatory plan (plan regulador municipal), natural or legal persons who own or possess real property under any title shall comply with the following obligations (…) b) Fence and clean both lots on which there are no buildings and those with uninhabited dwellings or dwellings undergoing demolition (…) When a lot contains an uninhabitable building that endangers the life, property, or physical integrity of third parties, or whose abandoned condition facilitates the commission of criminal acts, the municipality may file the corresponding complaint with the health authorities and cooperate with them in enforcing Ley 5395, Ley General de Salud, dated October 30, 1973. Except as ordered under the Ley General de Salud, when municipal residents fail to comply with the foregoing obligations (…) the municipality is authorized to remedy the omission of those duties by directly performing the work or providing the corresponding services (…)” (emphasis not in the original).
In accordance with the foregoing, the violation of the protected person’s fundamental rights is established. Indeed, although the authorities of the Área Rectora de Salud de Cartago have taken various actions intended to address the problem reported by the appellant since June 7, 2024, the fact remains that, despite having known since April 25, 2025, of the death of the registered owner of the real property at issue in this amparo action, it was not until those authorities learned that this action had been filed that they formally referred administrative case file n.° 0214-2024 to the Municipalidad de Cartago for application of Article 84 of the Código Municipal. In connection with the foregoing, it is essential to point out that, in this Court’s view, that action does not relieve the respondent health governing area of its responsibility to provide appropriate follow-up regarding the actions of the Municipalidad de Cartago, so that the reported situation may be definitively resolved. Furthermore, the Court notes that the matter is not referred to the local government entity, because the amparo action would be premature with respect to its intervention, as it was officially notified on January 13 of the current year. Consequently, the proper course is to grant the action, as set forth in the operative portion.
V.Note by Justice Castillo Víquez concerning prompt and effective administrative justice (justicia administrativa pronta y cumplida). I have supported this Court’s position that, when a litigant alleges a violation of the right to prompt and effective justice in administrative proceedings (sede administrativa), the legal dispute must be heard by the Tribunales de lo Contencioso-Administrativo and not by this Chamber. Nevertheless, with the recent enactment of Ley n.° 9097, Ley de Regulación del Derecho de Petición, it has been established that this right may receive judicial protection through the amparo action provided for in Article 32 of the Ley de la Jurisdicción Constitucional, in relation to Article 27 of the Constitución Política de la República de Costa Rica, in cases where the petitioner considers that the Administration’s material conduct, administrative acts, or response are affecting the petitioner’s fundamental rights.
In my view, the recently enacted legislation does not mean that this Court must modify its line of precedent, as, under section 7 of its Law, this Court has exclusive authority to define its own jurisdiction. Therefore, except for those legal-constitutional disputes that this Chamber itself has recognized as exceptional circumstances and that may be heard in this jurisdiction through the constitutional proceeding guaranteeing amparo relief, in all other cases, and for the reasons provided by this Court (judgment N° 2008-02545 at 8:55 a.m. on February 22, 2008), jurisdiction lies with the judges of the contentious-administrative jurisdiction (jurisdicción de lo contencioso-administrativo). All of this is consistent with Article 25 of the Convención Americana sobre Derechos Humanos, the Law of the Constitution (Derecho de la Constitución) (values, principles, and rules), and the corresponding statutory provisions, based on a logical, systemic, and purposive interpretation of the legal system.
In environmental matters, it is also my view that, if the Public Administration has already intervened, jurisdiction to hear and decide the matter lies with the contentious-administrative jurisdiction. Nevertheless, I do examine the merits when other rights of persons affected by the source of pollution are at stake, including health, quality of life, and the right to enjoy a healthy environment free from pollution (Article 50 of the Constitución Política), as is the case here, in which the appellant alleges that on June 7, 2024, she submitted a complaint to the respondent authority reporting that a house in her community was uninhabited, without a roof, and contained accumulated waste, standing water, and vectors, such that this problem endangers her health and that of her community’s residents, to the detriment of a healthy and ecologically balanced environment and a dignified standard of quality of life.
The parties are advised that, if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced through new technologies, these must be collected from the Court within a maximum period of 30 business days from service of this judgment. Otherwise, any material not collected within that period will be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena at session N° 27-11 of August 22, 2011, Article XXVI, and published in Boletín Judicial number 19 of January 26, 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on May 3, 2012, Article LXXXI.
Por tanto:
The action is granted. Andrea Morales Fiesler, in her capacity as Director of the Área Rectora de Salud de Cartago, or whoever holds that position in her stead, is ordered to issue the appropriate instructions and carry out all actions within the scope of her authority so that, within THREE MONTHS from service of this judgment, the problem reported by the protected person is effectively resolved. The respondent authority is warned that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, imprisonment of three months to two years or a fine of twenty to sixty days shall be imposed on anyone who receives an order issued in an amparo action that the person must comply with or enforce and fails to comply with or enforce it, provided that the offense is not subject to a more severe penalty. The State is ordered to pay the legal costs, damages, and losses caused, which shall be assessed during enforcement of the judgment before the contentious-administrative jurisdiction. Recurso de amparo que se tramita en expediente No. 25- 038691-0007-CO, interpuesto por [Nombre 001], cédula de identidad [Valor 001], contra el MINISTERIO DE SALUD.
RESULTANDO:
“(…) Segundo: El 07 de junio de 2024 se recibió en el correo institucional [email protected] la denuncia sobre un inmueble ubicado en Urbanización Tolentino, La Lima, Cartago, descrito como deshabitado, sin techo, con acumulación de residuos, agua empozada y presencia de vectores. Se asignó el número de trámite 0214- 2024. Folios 0001-0005. Expediente denuncia 0214-2024. Confidencial. Tercero: El 17 de septiembre de 2024 se realizó inspección en el sitio denunciado, constatando las condiciones descritas (estructura desmantelada, sin techo, residuos sólidos, riesgo sanitario). Se elaboró el informe técnico MS-DRRSCE-DARSC-IT-2084-2024 y se recomendó emitir Orden Sanitaria conforme a los artículos 314, 316 y 318 de la Ley General de Salud. Folios 0006-0009. Cuarto: El 04 de noviembre de 2024 se emitió la Orden Sanitaria MS-DRRSCE-DARSCOS-0261-2024 dirigida a la propietaria registral Norma Cecilia Rivera Acevedo, con plazo de cumplimiento de 20 días hábiles.
Folio 0010. Expediente 0214-2024. Denunciado(a). Quinto: El 20 de noviembre de 2024 se informó a la denunciante sobre la emisión de la orden sanitaria y se adjuntó copia del oficio MS-DRRSCE-DARSC-1255-2024. Folios 0006- 0008. Expediente denuncia 0214-2024. Confidencial. Sexto: El 05 de diciembre de 2024 se recibió consulta de la denunciante sobre el avance del caso. Se le indicó que el expediente estaba en análisis jurídico por la situación del fallecimiento de la persona notificada. Folios 0009-0011. Expediente denuncia 0214- 2024. Confidencial. Séptimo: El 06 de febrero de 2025, mediante criterio jurídico CARTA-MS-DRRSCE-0118- 2025, se determinó que la orden sanitaria quedaba sin efecto por el deceso de la administrada, recomendando retomar la atención mediante nueva inspección o notificación a herederos. Folio 0011. Expediente 0214-2024. Denunciado(a). Octavo: El 25 de abril de 2025 se confirmó mediante consulta registral y certificación del Tribunal Supremo de Elecciones el fallecimiento de la propietaria registral, dejando sin efecto la orden sanitaria.
Folio 0012-0014. Expediente 0214-2024. Denunciado(a). Noveno: El 04 de julio de 2025 se instruyó al equipo técnico investigar con la Municipalidad de Cartago para ubicar posibles responsables o herederos del inmueble. Folio 0016-0018. Expediente 0214-2024. Denunciado(a). Décimo: El 1 de noviembre de 2025 la Municipalidad de Cartago realizó inspección y notificó que procedería conforme a sus competencias. Folio 0019. Expediente 0214-2024. Denunciado(a). Undécimo: El 05 de diciembre de 2025 se realizó visita técnica y se levantó acta de inspección, confirmando el estado de abandono y solicitando colaboración interinstitucional. Folio 0020-0022. Expediente 0214-2024. Denunciado(a). Duodécimo: El 06 de enero de 2026 la denunciante aportó fotografías actualizadas del inmueble y comunicó la interposición del recurso de amparo. Folio 0023-0029. Expediente 0214-2024. Denunciado(a). Trigésimo: El 13 de enero de 2026 se emitió el informe técnico CARTA-MS-DRRSCEDARSC-IT-019-2026, concluyendo que: • El lote se encuentra en condiciones insalubres y abandono. • No fue posible localizar responsable legal por fallecimiento de la propietaria y ausencia de información sucesoria. • Corresponde trasladar el caso a la Municipalidad de Cartago conforme al artículo 84 del Código Municipal. Ese mismo día se trasladó formalmente el expediente a la Municipalidad para su intervención. Folio 0032-0035. Expediente 0214-2024. Denunciado(a). (…)”.
Solicita se declare sin lugar el recurso.
Redacta la Magistrada Hess Herrera; y,
CONSIDERANDO:
I.De previo. De previo a analizar el fondo del alegato –por la presunta violación del derecho a un procedimiento pronto y cumplido– debe aclararse que, a partir de la sentencia No. 2008-02545 de las 8:55 hrs. de 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa –con algunas excepciones– aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo –instruido de oficio o a instancia de parte– o conocer de los recursos administrativos procedentes. Precisamente, en este caso, se plantea un supuesto de excepción, pues, se está ante una denuncia ambiental, la cual, presuntamente, no ha sido resuelta dentro de un plazo razonable por parte del Ministerio de Salud. Aclarado el punto, se entra a resolver la situación concreta planteada en este amparo.
La persona recurrente considera conculcados sus derechos fundamentales. Refiere que el 7 de junio de 2024 remitió a la dirección electrónica [email protected] una denuncia dirigida a la autoridad recurrida, donde informó que una casa en su comunidad estaba deshabitada, sin techo, con acumulación de residuos, agua empozada y presencia de vectores. Afirma que a su denuncia se le asignó el número de trámite 0214-2024. Además, menciona que el 19 de junio de 2024 recibió el oficio IDU-OF-192-2024 donde se confirmó la inspección y condiciones denunciadas. Agrega que el 5 de diciembre de 2024 se le informó sobre el fallecimiento de la dueña del inmueble y la no claridad sobre el dueño actual, razón por la que el caso fue trasladado a consulta jurídica. Acusa que a la fecha de interposición del presente recurso no han obtenido resolución alguna a las gestiones planteadas. Indica que dicha problemática pone en riesgo su salud y la de los vecinos de su comunidad.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
El 7 de junio de 2024, la persona amparada presentó ante el Área Rectora de Salud de Cartago, una denuncia sobre un inmueble ubicado en Urbanización Tolentino, La Lima, Cartago, descrito como deshabitado, sin techo, con acumulación de residuos, agua empozada y presencia de vectores. Se asignó el número de trámite 0214- 2024 (hecho no controvertido).
El 17 de septiembre de 2024, el área rectora de salud accionada realizó inspección en el sitio denunciado, constatando las condiciones descritas (estructura desmantelada, sin techo, residuos sólidos, riesgo sanitario). Se levantó acta y se tomaron fotografías. Se elaboró el informe técnico MS-DRRSCE-DARSC-IT-2084-2024 y se recomendó emitir Orden Sanitaria (véase informe rendido y documentación aportada).
El 4 de noviembre de 2024 el área rectora de salud recurrida emitió la Orden Sanitaria MS-DRRSCE-DARSCOS-0261-2024 dirigida a la propietaria registral Norma Cecilia Rivera Acevedo, con plazo de cumplimiento de 20 días hábiles (véase informe rendido y documentación aportada).
El 20 de noviembre de 2024 las autoridades recurridas informaron a la denunciante sobre la emisión de la orden sanitaria y se adjuntó copia del oficio MS-DRRSCE-DARSC-1255-2024 (véase informe rendido y documentación aportada).
El 5 de diciembre de 2024 el área rectora de salud accionada recibió consulta de la denunciante sobre el avance del caso. Al respecto, se le indicó que el expediente estaba en análisis jurídico por la situación del fallecimiento de la persona notificada (véase informe rendido y documentación aportada).
El 6 de febrero de 2025, mediante criterio jurídico CARTA-MS-DRRSCE-0118- 2025, se determinó que la orden sanitaria quedaba sin efecto por el deceso de la administrada, recomendando retomar la atención mediante nueva inspección o notificación a herederos (véase informe rendido y documentación aportada).
El 25 de abril de 2025, funcionarios del área rectora de salud accionada confirmaron mediante consulta registral y certificación del Tribunal Supremo de Elecciones, el fallecimiento de la propietaria registral del bien inmueble abandonado, dejando sin efecto la orden sanitaria (véase informe rendido y documentación aportada).
El 12 de enero de 2026, la autoridad accionada fue notificada de la resolución que diera curso a este proceso (véase acta de notificación).
El 13 de enero de 2026, el área rectora de salud accionada emitió el informe técnico CARTA-MS-DRRSCEDARSC-IT-019-2026, concluyendo: 1. El lote se encuentra en condiciones insalubres y abandono. 2. No fue posible localizar al responsable legal por fallecimiento de la propietaria y ausencia de información sucesoria. 3. Corresponde trasladar el caso a la Municipalidad de Cartago conforme al artículo 84 del Código Municipal. Ese mismo día se trasladó formalmente el expediente a la Municipalidad para su intervención (véase informe rendido y documentación aportada).
En el sub lite, se tiene por acreditado que el 7 de junio de 2024, la persona amparada presentó ante el Área Rectora de Salud de Cartago, una denuncia sobre un inmueble ubicado en Urbanización Tolentino, La Lima, Cartago, descrito como deshabitado, sin techo, con acumulación de residuos, agua empozada y presencia de vectores. Se asignó el número de trámite 0214- 2024. Además, se colige que el 17 de septiembre de 2024, el área rectora de salud accionada realizó inspección en el sitio denunciado, constatando las condiciones descritas (estructura desmantelada, sin techo, residuos sólidos, riesgo sanitario). Se levantó acta y se tomaron fotografías. Se elaboró el informe técnico MS-DRRSCE-DARSC-IT-2084-2024 y se recomendó emitir Orden Sanitaria. A su vez, se colige que el 4 de noviembre de 2024 el área rectora de salud recurrida emitió la Orden Sanitaria MS-DRRSCE-DARSCOS-0261-2024 dirigida a la propietaria registral Norma Cecilia Rivera Acevedo, con plazo de cumplimiento de 20 días hábiles.
De igual forma, se tiene que el 20 de noviembre de 2024, las autoridades recurridas informaron a la denunciante sobre la emisión de la orden sanitaria y se adjuntó copia del oficio MS-DRRSCE-DARSC-1255-2024. Que el 5 de diciembre de 2024 el área rectora de salud accionada recibió consulta de la denunciante sobre el avance del caso. Al respecto, se le indicó que el expediente estaba en análisis jurídico por la situación del fallecimiento de la persona notificada. Adicionalmente, se acredita que el 6 de febrero de 2025, mediante criterio jurídico CARTA-MS-DRRSCE-0118- 2025, se determinó que la orden sanitaria quedaba sin efecto por el deceso de la administrada, recomendando retomar la atención mediante nueva inspección o notificación a herederos. Además, se tiene que el 25 de abril de 2025, funcionarios del área rectora de salud recurrida confirmaron mediante consulta registral y certificación del Tribunal Supremo de Elecciones, el fallecimiento de la propietaria registral del bien inmueble abandonado, dejando sin efecto la orden sanitaria.
Finalmente, se tiene que el 13 de enero de 2026, el área rectora de salud accionada emitió, con ocasión del presente recurso, el informe técnico CARTA-MS-DRRSCEDARSC-IT-019-2026, concluyendo: 1. El lote se encuentra en condiciones insalubres y abandono. 2. No fue posible localizar al responsable legal por fallecimiento de la propietaria y ausencia de información sucesoria. 3. Corresponde trasladar el caso a la Municipalidad de Cartago conforme al artículo 84 del Código Municipal. Ese mismo día se trasladó formalmente el expediente a la Municipalidad para su intervención.
En relación con lo anterior, se tiene que el Código Municipal en su artículo 84, inciso b) indica:
“Artículo 84.- De conformidad con el plan regulador municipal, las personas físicas o jurídicas, propietarias o poseedoras, por cualquier título, de bienes inmuebles, deberán cumplir las siguientes obligaciones (…) b) Cercar y limpiar tanto los lotes donde no haya construcciones como aquellos con viviendas deshabitadas o en estado de demolición (…) Cuando en un lote exista una edificación inhabitable que arriesgue la vida, el patrimonio o la integridad física de terceros, o cuyo estado de abandono favorezca la comisión de actos delictivos, la municipalidad podrá formular la denuncia correspondiente ante las autoridades de salud y colaborar con ellas en el cumplimiento de la Ley 5395, Ley General de Salud, de 30 de octubre de 1973. Salvo lo ordenado en la Ley General de Salud, cuando los munícipes incumplan las obligaciones anteriores (…) la municipalidad está facultada para suplir la omisión de esos deberes, realizando de forma directa las obras o prestando los servicios correspondientes (…)” (el resaltado no es del original).
De conformidad con lo expuesto, se tiene por acreditada la lesión a los derechos fundamentales de la persona amparada. En efecto, si bien las autoridades del Área Rectora de Salud de Cartago han realizado diversas actuaciones tendientes a atender la problemática denunciada por la recurrente desde el 7 de junio de 2024, lo cierto es que, pese a haber tenido conocimiento del fallecimiento de la propietaria registral del bien inmueble objeto del presente recurso desde el 25 de abril de 2025, no fue sino hasta que dichas autoridades tuvieron conocimiento de la interposición de este recurso que procedieron a efectuar el traslado formal del expediente administrativo n.° 0214-2024 a la Municipalidad de Cartago, para la aplicación de lo dispuesto en el artículo 84 del Código Municipal. En relación con lo anterior, es imperioso señalar que la acción referida, a criterio de este Tribunal, no elimina la responsabilidad del área de salud recurrida de brindar el seguimiento correspondiente a las actuaciones de la Municipalidad de Cartago, a fin de que se resuelva de manera definitiva la situación denunciada.
Por otra parte, se advierte que no se da traslado a la corporación local, pues el amparo sería prematuro respecto de su intervención, ya que se le informó el 13 de enero del año en curso de manera official. En consecuencia, lo procedente es declarar con lugar el recurso, conforme se establecerá en la parte dispositiva.
V.Nota del Magistrado Castillo Víquez, en cuanto a la justicia administrativa pronta y cumplida. He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales.
A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia. Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.
En asuntos ambientales, es también criterio del suscrito, de que si ya ha habido intervención de la Administración Pública, considero que su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que la parte recurrente acusa que el 7 de junio de 2024 remitió una denuncia dirigida a la autoridad recurrida, donde informó que una casa en su comunidad estaba deshabitada, sin techo, con acumulación de residuos, agua empozada y presencia de vectores, de manera que dicha problemática pone en riesgo su salud y la de los vecinos de su comunidad, en detrimento de un ambiente sano y ecológicamente equilibrado y de un nivel digno de calidad de vida.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara con lugar el recurso. Se ordena a Andrea Morales Fiesler, en su condición de directora del Área Rectora de Salud de Cartago, o a quien en su lugar ocupe ese cargo, que gire las órdenes pertinentes y lleve a cabo todas las actuaciones que estén dentro del ámbito de su competencia, para que, dentro en el plazo de TRES MESES, contado a partir de la notificación de esta sentencia, se solucione efectivamente la problemática denunciada por la persona amparada. Se advierte a la autoridad recurrida que, de conformidad con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado al pago de las costas, daños y perjuicios causados, los que se liquidarán en ejecución de sentencia ante la jurisdicción contencioso administrativa.
