Document Review Decision No. 2025035872 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine thirty on treinta y uno de octubre de dos mil veinticinco.

Amparo proceeding (recurso de amparo) processed under case No. 25-030570-0007-CO, filed by Nombre90972, identity card CED51206, against the SERVICIO NACIONAL DE SALUD ANIMAL (SENASA) GUÁPILES.

Background:

  1. 1In a written submission added to the electronic case file on 04 de octubre de 2025, the petitioner filed this proceeding against the SERVICIO NACIONAL DE SALUD ANIMAL (SENASA) GUÁPILES. He states that on 07 de enero de 2025 he filed a formal complaint with the SENASA office in Guápiles regarding the construction of a corral only 5 meters from his home, a situation that causes serious health problems, environmental pollution, and disruption of the peace and quiet of his home. That property belongs to Mr. Nombre90973, a resident of Pococí, 650 meters north of the Catholic church in Hojancha. He states that animals are kept confined in that corral for up to two days and bellow day and night, preventing the family from resting and exercising their right to sleep under dignified conditions. He states that the animals brought there often come from auctions and arrive sick; several die on the farm, and instead of being buried or handled in accordance with health regulations, their bodies are dumped in the open less than 600 meters from his home, exposing them to vultures and generating unbearable odors of putrefaction.He recounts that a forage chopper is operated continuously beginning at 05:00 hours, generating excessive noise that interferes with his family’s rest and tranquility. He adds that when cattle are taken out for auction, other cattle are left confined and spend the entire night bellowing and striking the corral’s metal pipes with their horns, making it impossible for them to sleep. He states that the corral’s proximity causes strong odors of manure, putrefaction, and mud, as well as large numbers of flies, to accumulate in his home, a situation aggravated by the presence of injured animals infested with New World screwworm (gusano barrenador). He complains that despite the complaints filed, SENASA has neither acted nor conducted an inspection or implemented corrective measures, and that there is a well-founded suspicion of a friendship between the veterinarian in charge and the farm owners, which would explain the respondent authority’s inaction.
  2. 2By the decision issued at 17:12 hours on 14 de octubre de 2025, this proceeding was admitted for consideration.
  3. 3Bernardo Calvo Rodríguez, in his capacity as head of the Departamento Regional Huetar Norte of the Servicio Nacional de Salud Animal (SENASA), reports under oath as follows: “…The Dirección Nacional de Operaciones of SENASA formally established the Complaint Management Procedure (Gestión de Denuncias), whose objective is to ‘Establish guidelines for the proper management of activities related to all complaints filed by members of the public, in accordance with the powers granted under Ley Nº 8495, and formally received by SENASA through the Dirección Nacional de Operaciones.’ THIRD: As shown in the administrative case file opened for this matter, Mr. Nombre90972 filed a complaint against Mr. Nombre90973, a resident of Hoja Ancha, Cariari, Limón, 800 m northeast of the Catholic church in Hoja Ancha, on 07/01/2025, concerning the presence of a corral containing approximately 15 to 20 head of cattle, located only 5 m from the boundary adjoining his residence, which allegedly generates foul odors.He further alleges that the animals have exposed wounds infested with New World screwworm and that, because he has a daughter who was injured in a motorcycle accident and has exposed wounds, he fears that a screwworm fly may bite her. He also states that the animals sleep in the corral and that children and older adults are exposed to the odors and flies generated by the animals. (Complaint consecutive number 927D68682F2025). FOURTH: In response to that complaint, on 13 de febrero del 2025, officials from the SENASA cantonal office in Pococí, Dr. Hernán Barrantes Lobo and Technician Rubén Sánchez Alvarado, inspected the site, as recorded in Site Visit Form (Hoja de Visita) N° 0315976. They verified that there was a corral on the site containing two cows and two calves. The animals showed no signs of wounds or screwworm infestation. Waste was properly managed, and stormwater was discharged within the respondent’s property.It was determined that foul odors and flies were minimal, and it could not be established that the animals slept inside the corral. According to the respondent, the animals were kept at pasture over an area of 12 ha. Accordingly, no sanitary measure (medida sanitaria) was ordered. FIFTH: On 16 de mayo del 2025, a second complaint was filed against the same Mr. Nombre90973 before that same SENASA cantonal office. It alleged that approximately 5 cattle were kept in the corral, confined during the day and night and fed poultry litter and bananas, thereby generating flies and foul odors that affected neighbors, including children and older adults; SENASA’s intervention was therefore requested to correct the situation. (Complaint code D81E03E4892025). SIXTH: In response to this new complaint, on 18 de junio del año en curso, officials from the SENASA cantonal office in Pococí, Dr. Hernán Barrantes Lobo and Technician Rubén Sánchez Alvarado, inspected the site, as recorded in Site Visit Form N° 0331633.They verified that there were no confined cattle and observed no animal-feed byproducts in the facilities. Nor was there any outbreak of flies or any foul odors, and no evidence was found that animals were kept in the facilities overnight. Once again, no sanitary measure was ordered on this occasion. SEVENTH: On 21 de octubre, in response to the filing of the amparo proceeding before us, I, the undersigned Bernardo Calvo Rodríguez, veterinarian, in my capacity as head of the Departamento Regional Huetar Caribe of the Servicio Nacional de Salud Animal (SENASA), and considering the petitioner’s allegation that there is a well-founded suspicion that SENASA failed to address his complaints because of a friendship between the responsible veterinarian and the farm owners, inspected the site. As recorded in Site Visit Forms N° 0331653 and N° 0331655, I verified the following: at the specified location there is a roofed corral measuring approximately 9 x 9 m, with two concrete feeders, plastic drinking troughs, and a motorized forage chopper.During the inspection, there was no evidence of animals in the corral, although sugarcane remnants were observed in the feeders and a few cattle droppings were found on the floor, indicating that cattle had recently been present. No foul odors or flies were detected, other than what could be considered natural for that type of location. In another corral approximately 20 m away, there was a pigsty containing 8 pigs, 2 adult males and 6 growing pigs (3 females and 3 males). The cleanliness conditions were adequate, and no foul odors, flies, or other pests were detected. Mr. Nombre90973, an older adult 91 years of age, states that he keeps 3 adult cows and 4 calves on the farm; they are kept at pasture and are given chopped sugarcane as supplemental feed in the above-described corral in the mornings. EIGHTH: Although the visit did not substantiate the facts reported by the petitioner—namely, that animals are kept confined at the site; that there are sick and dead animals whose bodies are dumped in the open; that there are strong odors of manure, putrefaction, and mud, as well as large numbers of flies; and that injured animals are infested with New World screwworm—it was established that the establishment is not authorized by SENASA to operate under a Veterinary Operating Certificate (Certificado Veterinario de Operación, CVO), as required by Ley General del Servicio Nacional de Salud Animal (SENASA), N° 8495.It was therefore ordered to suspend all livestock activities (actividades pecuarias) within no more than five calendar days and to relocate the animals present on the farm to another establishment holding a CVO. Mr. Nombre90973 was informed that he may complete the relevant procedures before SENASA to obtain authorization for any livestock activities he requires, provided that compliance with the requirements and regulations in force for each particular activity is ensured. This will be monitored over the coming days. FACTUAL AND LEGAL CONSIDERATIONS. Pursuant to Article 6(p) of Ley N.º 8495, SENASA is the body with jurisdiction to process and resolve complaints concerning animal welfare, animal health, and the safety of livestock activities; accordingly, its handling of the complaints filed falls within its statutory powers. That law also authorizes SENASA, through its officials, to order the sanitary measures necessary to prevent, control, or eliminate risks that threaten animal health, veterinary public health, and the environment.Accordingly, and as explained above, officials from the Departamento Región Huetar Caribe visited the site of the reported events on three occasions—13 de febrero, 18 de junio, and 21 de octubre, all in the current year—and on none of those occasions were they able to detect evidence substantiating the petitioner’s allegations. SENASA therefore issued no sanitary measure, except during the 21 de octubre inspection concerning the need to obtain the CVO, which the establishment lacks. The Reglamento para el Otorgamiento del Certificado Veterinario de Operación (CVO) establishes that establishments engaged in the production, keeping, or sale of animals or animal products must hold such authorization in order to operate. In this case, upon confirming the absence of a CVO, SENASA acted in accordance with the applicable regulations by ordering the suspension of livestock activities within a maximum period of 5 calendar days and the relocation of the animals until such authorization is obtained.As is evident from the foregoing, SENASA did not fail to address the complaints, as the petitioner claims in his submission, nor were any facts established demonstrating negligence or a lack of objectivity on the part of the officials involved. Three inspections were conducted on different dates, and the appropriate actions were taken based on the technical findings observed; notably, none of the visits to the site substantiated the reported conditions.”

Considerations:

I. PRELIMINARY CLARIFICATION

Before analyzing the merits of the matter, it must be clarified that, since Judgment No. 2008-02545 of 08:55 hours on 22 de febrero de 2008, this Chamber has referred to the administrative litigation jurisdiction (jurisdicción contencioso administrativa)—with some exceptions—those matters in which it is disputed whether the Public Administration has complied with the reasonably established time limits for deciding applications submitted by individuals, in light of the provisions of Article 41 of the Political Constitution. This particular case presents an exception, since it concerns the failure to address several complaints filed with SENASA regarding acts related to environmental pollution that could affect the health of the petitioner and his family. In view of the foregoing, the Chamber proceeds to decide the specific situation raised in this proceeding.

II. SUBJECT MATTER OF THE PROCEEDING

The petitioner complains of the inaction of the Servicio Nacional de Salud Animal (SENASA) office in Guápiles regarding a health complaint (denuncia sanitaria) filed on 07 de enero de 2025, in which he requested immediate intervention to inspect and close a livestock pen built approximately five meters from his home and belonging to Mr. Nombre90973. He asks this Chamber to order SENASA to verify the unsanitary conditions and improper animal management causing nauseating odors, proliferation of flies, environmental pollution, the presence of sick animals, and waste exposed in the open air. Accordingly, he requests that the respondent authority adopt immediate corrective or punitive measures against those responsible and ensure that the pollution ceases, because he considers that his rights to health, a healthy environment, and family tranquility have been violated.

III. PROVEN FACTS

The following facts are deemed duly established and relevant to the decision in this matter:

  • a)On 07 de enero de 2025, Mr. Nombre90972 filed a formal complaint with the SENASA Guápiles office against Mr. Nombre90973, a resident of Hoja Ancha, Cariari, Limón, concerning the existence of a livestock pen containing between 15 and 20 head of cattle and located approximately 5 meters from his home. He stated that the animals had screwworm-infested wounds, generated foul odors and a proliferation of flies, and that children and a daughter with exposed wounds lived in his home, thereby increasing the health risk. (complaint No. 927D68682F2025) (see report submitted under oath and attached evidence).
  • b)On 13 de febrero de 2025, in response to that complaint, SENASA Pococí officials Dr. Hernán Barrantes Lobo and technician Rubén Sánchez Alvarado conducted an on-site inspection, as documented in inspection sheet No. 0315976. They confirmed the existence of a livestock pen containing two cows and two calves, with no visible injuries or screwworm infestation. Waste and stormwater management was adequate, and the presence of odors and flies was minimal. There was no evidence that the animals slept in the pen. Therefore, no health measure was ordered (see report submitted under oath and attached evidence).
  • c)On 16 de mayo de 2025, a second complaint was filed against the same Mr. Nombre90973, stating that approximately five cattle were kept confined in the pen day and night and fed poultry litter and bananas, generating foul odors and flies that affected the neighbors. (complaint code D81E03E4892025) (see report submitted under oath and attached evidence).
  • d)On 18 de junio de 2025, in response to the new complaint, the same SENASA Pococí officials conducted a second on-site inspection, as documented in inspection sheet No. Telf7193. They found no confined cattle or by-products intended for feeding them. Nor did they detect foul odors, an outbreak of flies, or indications that the animals remained in the pen overnight. Consequently, no health measure was issued (see report submitted under oath and attached evidence).
  • e)On 21 de octubre de 2025, following the filing of the amparo proceeding (recurso de amparo) by the complainant, Dr. Bernardo Calvo Rodríguez, head of the Departamento Regional Huetar Caribe of SENASA, personally conducted a third inspection of the site, as documented in inspection sheets No. Telf7194 and No. Telf7195. He verified the existence of an approximately 9 x 9-meter roofed pen equipped with cement feeding troughs, plastic drinking troughs, and a motorized forage chopper. No animals were present during the visit, although remnants of sugarcane and fresh cattle dung were observed, evidencing its recent use (see report submitted under oath and attached evidence).
  • f)During the same visit on 21 de octubre de 2025, a pigsty containing eight pigs (two adults and six growing pigs) was observed approximately 20 meters away. It was in good sanitary condition, with no foul odors or pests. Mr. Nombre90973—91 years old—stated that he kept three adult cows and four calves on the farm, which grazed in the open field and were fed chopped sugarcane in the pen in the mornings. During that inspection, the facts alleged by the petitioner were not verified (sick or dead animals, intense odors, putrefaction, proliferation of flies, or screwworm); however, it was established that the facility lacked the Veterinary Operating Certificate (Certificado Veterinario de Operación, CVO) required by Law No. 8495. Consequently, SENASA ordered the suspension of all livestock activity within no more than five calendar days and directed that the animals be relocated to a duly authorized facility with a CVO, informing the owner that he could apply for such authorization by complying with the applicable regulations (see report submitted under oath and attached evidence).

IV. REGARDING THE SPECIFIC CASE

The report submitted under oath by the authorities of the Servicio Nacional de Salud Animal (SENASA) and the evidence in the record establish that Mr. Nombre90972 filed formal complaints on 07 de enero and 16 de mayo de 2025 with the SENASA Guápiles regional office against Mr. Nombre90973 concerning the existence of a livestock pen located only a few meters from his home, which—according to his allegations—generated foul odors, a proliferation of flies, environmental pollution, and health risks to his family. The record shows that the respondent authority processed the complaints and conducted three on-site inspections (13 de febrero, 18 de junio and 21 de octubre de 2025), concluding during the last inspection that the facility lacked the Veterinary Operating Certificate required by Law No. 8495; therefore, it ordered the suspension of all livestock activity and the relocation of the animals to an authorized site.

Nevertheless, neither the report submitted under oath nor the body of evidence indicates that SENASA notified the complainant of the results of each inspection or formally informed him of the measures adopted, compliance with the suspension, or follow-up concerning the ordered relocation. This lack of communication constitutes a material administrative omission that affects the principle of public disclosure and the duty to state the reasons for administrative acts (actos administrativos). Those rules require the Administration to expressly decide every application submitted by individuals and to communicate the results, thereby ensuring legal certainty, citizen oversight, and effective protection of the rights of persons affected by regulated activities.

Consequently, although it has been established that SENASA substantively addressed the complaints and ordered corrective measures, its failure to notify the complainant and formally follow up with him concerning the inspection results and enforcement of the imposed suspension demonstrates noncompliance with the duties of information, diligence, and oversight inherent in its regulatory function.

For the foregoing reasons, the amparo proceeding is granted.

V. NOTE BY JUSTICE SALAZAR ALVARADO

In environmental matters, it is my view that, where the Public Administration has already intervened, jurisdiction to hear and decide the matter lies with the administrative litigation jurisdiction. Nevertheless, I do address the merits when other rights of persons affected by the source of pollution are at stake, including health, quality of life, and the right to enjoy a healthy environment free from pollution (Article 50 of the Political Constitution), as in this case, in which the petitioner alleges pollution, unsanitary conditions, and improper animal management causing nauseating odors, a proliferation of flies, the presence of sick animals, and waste exposed in the open air on a property near the petitioner’s home. He asserts that he previously submitted requests to the Servicio Nacional de Salud Animal (SENASA) without obtaining an effective solution.

The situation described constitutes an exception to my general position on this subject; I therefore consider it necessary for this Constitutional Court to examine the merits of the matter in order to verify or reject the petitioner’s allegations.

VII. DOCUMENTATION SUBMITTED TO THE CASE FILE

The petitioner is advised that, if any paper document was submitted, as well as any objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device, they must be collected from the Court’s offices within a maximum period of 30 business days counted from service of this judgment. Otherwise, any material not collected within that period will be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session No. 27-11 of 22 de agosto del 2011, Article XXVI, and published in Boletín Judicial No. 19 of 26 de enero del 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session No. 43-12 held on 3 de mayo del 2012, Article LXXXI.

Por tanto:

The proceeding is granted. Bernardo Calvo Rodríguez, in his capacity as head of the Departamento Regional Huetar Norte of the Servicio Nacional de Salud Animal (SENASA), or whoever holds that position in his stead, is ordered to coordinate and carry out the appropriate actions within the scope of his authority so that he IMMEDIATELY provides Mr. Nombre90972 with formal notice of the results of each inspection conducted (13 de febrero, 18 de junio and 21 de octubre de 2025), including the corresponding technical observations and conclusions. He shall also inform the protected party of the current status of compliance with the order suspending livestock activities and the actual relocation of the animals to a duly authorized facility. The representative of the respondent authority is warned that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, anyone who receives an order from this Chamber that must be complied with or enforced and fails to comply with it shall be punished by imprisonment for three months to two years or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty.

The State is ordered to pay the costs, damages, and losses caused by the facts underlying this judgment, which shall be assessed during enforcement of the judgment before the administrative litigation jurisdiction. Justice Salazar Alvarado files a note. Let notice be served. – Fernando Cruz C.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del treinta y uno de octubre de dos mil veinticinco .

Recurso de amparo que se tramita en expediente No. 25-030570-0007-CO, interpuesto por Nombre90972, cédula de identidad CED51206, contra el SERVICIO NACIONAL DE SALUD ANIMAL (SENASA) GUÁPILES.

Resultando:

  1. 1Por escrito incorporado al expediente electrónico el 04 de octubre de 2025, el recurrente interpone recurso contra el SERVICIO NACIONAL DE SALUD ANIMAL (SENASA) GUÁPILES. Manifiesta que el 07 de enero de 2025 presentó ante la oficina de SENASA en Guápiles una denuncia formal debido a la construcción de un corral a escasos 5 metros de su vivienda, situación que genera graves problemas de salud, contaminación ambiental y afectación a la paz y tranquilidad de su hogar, dicha propiedad es del señor Nombre90973, vecino de Pococí, 650 metros norte de la iglesia católica de Hojancha. Indica que en dicho corral mantienen animales hasta por dos días encerrados, los cuales, pasan bramando día y noche, impidiendo el descanso y el derecho a dormir en condiciones dignas. Manifiesta que los animales que ingresan provienen en muchos casos de subastas y llegan enfermos, varios mueren en la finca y en lugar de ser enterrados o tratados conforme a las normas sanitarias, los cuerpos son arrojados a campo abierto a menos de 600 metros de su casa, exponiéndolos a los zopilotes y generando olores insoportables a putrefacción.Narra que desde las 05:00 horas operan constantemente una picadora de pasto, generando ruidos excesivos que afectan el descanso y la tranquilidad de su familia. Agrega que cuando sacan ganado para la subasta dejan el ganado encerrado y estos pasan toda la noche berreando y golpeando con sus cuernos los tubos de metal del corral, lo cual imposibilita que puedan dormir. Indica que la cercanía del corral ocasiona que en su hogar se concentren fuertes olores a estiércol, putrefacción, lodo y presencia masiva de moscas, agravado por la existencia de animales heridos con el gusano barrenador. Reclama que pese a las denuncias planteadas, SENASA no ha actuado ni ha realizado inspección o medidas correctivas, existiendo la fundada sospecha de que existe una relación de amistad entre el médico veterinario encargado y los dueños de la finca, lo que explicaría la inacción de la autoridad recurrida.
  2. 2Mediante la resolución de las 17:12 horas del 14 de octubre de 2025, se dio curso a este proceso.
  3. 3Informa bajo juramento Bernardo Calvo Rodríguez, en su condición de jefe del Departamento Regional Huetar Norte del Servicio Nacional de Salud Animal (SENASA), quien manifiesta lo siguiente: “… La Dirección Nacional de Operaciones del SENASA, oficializó la Gestión de Denuncias, en la que tiene como objetivo “Establecer los lineamientos para la gestión adecuada de las actividades relacionadas a todas las denuncias que interponen la ciudadanía, de acuerdo a las facultades dadas por medio de la Ley Nº 8495, y que ingresen de manera formal al SENASA por medio de la Dirección Nacional de Operaciones” TERCERO: Que según consta en el expediente administrativo levantado el Sr. Nombre90972, plantea denuncia contra el Sr. Nombre90973, vecino de Hoja Ancha, Cariari, Limón, 800 m noreste de la iglesia Católica de Hoja Ancha, el día 07/01/2025, por la presencia de un corral con aproximadamente 15 a 20 cabezas, corral que se ubica a solo 5 m de distancia de la colindancia de su casa de habitación, lo que supuestamente genera malos olores, además los animales tienen heridas expuestas con gusano barrenador y que por tener una hija que sufrió un accidente en moto y tiene heridas expuestas, teme que la mosca del gusano barrenador la pique.Señala además que los animales duermen en el corral y que tiene niños y adultos mayores expuestos a los olores y moscas que generan los animales. (Denuncia número de consecutivo 927D68682F2025). CUARTO: Que, en atención a dicha denuncia, el día 13 de febrero del 2025, los funcionarios de la oficina cantonal del SENASA en Pococí, Dr. Hernán Barrantes Lobo y Tec. Rubén Sánchez Alvarado, realizaron una inspección al lugar, según consta en la Hoja de Visita N° 0315976 en la que se pudo constatar que en el sitio hay un corral en el que se encontraron dos vacas y dos terneros. No se evidenciaron heridas en los animales, ni afectación por gusano barrenador. El manejo de los desechos es adecuado y las aguas pluviales son vertidas dentro de la propiedad del denunciado. Se determinó que la presencia de malos olores y moscas es mínima y no se pudo comprobar que los animales duerman dentro del corral y según declaró el denunciado, los animales se mantienen en pastoreo en una extensión de 12 ha.Por lo anterior, no se ordenó ninguna medida sanitaria. QUINTO: Que en fecha, 16 de mayo del 2025, se presentó ante la misma Oficina Cantonal del SENASA, una segunda denuncia contra el mismo Sr. Nombre90973, en la que se señala que en el corral se mantienen aproximadamente 5 bovinos, los cuales se mantienen encerrados durante el día y la noche y se alimentan con pollinaza y banano, lo que genera moscas y malos olores que afectan a los vecinos donde habitan niños y adultos mayores, por lo que pide la intervención del SENASA para corregir la situación. (Denuncia código D81E03E4892025) SEXTO: Que, en atención a esta nueva denuncia, el día 18 de junio del año en curso, los funcionarios de la oficina cantonal del SENASA en Pococí, Dr. Hernán Barrantes Lobo y Tec. Rubén Sánchez Alvarado, realizaron una inspección al lugar, según conta en la Hoja Visita N° 0331633, en la cual se constató que, no había bovinos estabulados, no se observaron subproductos para la alimentación en las instalaciones.Tampoco se observó un brote de moscas ni malos olores, no se encontraron indicios de que los animales se mantuvieran en las instalaciones durante la noche. De igual manera en esta ocasión tampoco se ordenó ninguna medida sanitaria. SÉTIMO: Que el día 21 de octubre en atención a la interposición del recurso de amparo que nos atiende, el suscrito Bernardo Calvo Rodríguez, médico veterinario, en mi condición de jefe del Departamento Regional Huetar Caribe del Servicio Nacional de Salud Animal (SENASA), y considerando que el recurrente alega que existe fundada sospecha de que el SENASA no ha atendido sus denuncias por relación de amistad entre el médico veterinario responsable y los dueños de la finca, realicé una inspección al sitio en la que he podido constatar según Hoja de Vista N° 0331653 y N° 0331655, lo siguiente: en el lugar señalado existe un corral del aproximadamente 9 x 9 m, techado, con dos comederos de cemento y bebederos de plástico y una picadora de pasto a motor.Durante la inspección no se evidencia presencia de animales en el corral, pero se observaron restos de caña de azúcar en los comederos y algunas pocas boñigas en el piso lo que evidencia que recientemente había habido bovinos en el lugar. No se percibieron malos olores ni presencia de moscas, salvo lo que se pudo considerar natural para ese tipo de lugar. En otro corral a unos 20 m de distancia se observó un chiquero con 8 cerdos, 2 machos adultos y 6 en desarrollo (3 hembras, 3 machos), las condiciones de limpieza son adecuadas y no se percibieron malos olores ni presencia de moscas u otras plagas. El Sr. Nombre90973, persona adulta mayor, de 91 años de edad, manifiesta que mantiene en la finca 3 vacas adultas y 4 terneros, los cuales se mantienen en pastoreo y suplementa en las mañanas en el corral descrito con caña de azúcar picada. OCTAVO: Que aunque durante la visita no se pudieron constatar los hechos denunciados por el recurrente como: que el sitio se mantienen animales encerrados, que hay animales enfermos y muertos y que sus cuerpos son arrojados a campo abierto, que existen fuertes olores a estiércol, putrefacción, lodo y presencia masiva de moscas, animales heridos con gusano barrenador; sí se puedo constatar que el establecimiento no se encuentra autorizado para operar por el SENASA, mediante el Certificado Veterinario de Operación (CVO), conforme a lo que la Ley General del Servicio Nacional de Salud Animal (SENASA), N° 8495 exige, por lo que se ordenó suspender todo tipo de actividad pecuaria en un plazo no mayor de cinco días calendario y reubicar los animales existentes en la finca en otro establecimiento que cuente con CVO.Se le explicó al Sr. Nombre90973 que puede realizar los trámites correspondientes ante el SENASA para que se le autorice las actividades pecuarias que requiera, siempre que se asegure el cumplimento de los requisitos y la normativa vigente para cada actividad en particular. Lo cual se está supervisando en próximos días. CONSIDERACIONES FÁCTICAS Y JURÍDICAS. Conforme al artículo 6 inciso p) de la Ley N.º 8495, el SENASA es el órgano competente para tramitar y resolver las denuncias relacionadas con el bienestar animal, la sanidad y la inocuidad de las actividades pecuarias, por lo que la atención brindada a las denuncias presentadas se enmarca dentro de sus atribuciones legales. Asimismo, dicho cuerpo legal faculta al SENASA, a través de sus funcionarios a dictar las medidas sanitarias necesarias a fin de prevenir, controlar o eliminar riesgos que atenten contra la salud animal, la salud pública veterinaria y el ambiente.En ese sentido y conforme fue expuesto, funcionarios del Departamento Región Huetar Caribe, han acudido al lugar de los hechos denunciados en tres ocasiones, a saber, 13 de febrero, 18 de junio y 21 de octubre, todos del presente año, en todas las cuales no se logró detectar evidencia en ninguna de ellas lo denunciado por el recurrente, por lo cual el SENASA no giró medida sanitaria alguna, salvo, en inspección del 21 de octubre referente a la obtención del Certificado Veterinario de Operación (CVO), del cual carece. El Reglamento para el Otorgamiento del Certificado Veterinario de Operación (CVO), establece la obligatoriedad de contar con dicha autorización para el funcionamiento de establecimientos dedicados a la producción, tenencia o comercialización de animales o sus productos. En el presente caso, al comprobarse la inexistencia del CVO, el SENASA actuó conforme a la normativa al ordenar la suspensión de actividades pecuarias en un plazo máximo de 5 días calendario y proceder a la reubicación de los animales, esto hasta tanto no obtenga dicha autorización.Como se evidencia de lo dicho en líneas anteriores, no existe omisión de parte de SENASA en la atención de las denuncias, como lo hace ver el recurrente en su escrito, ni se comprobaron hechos que configuren negligencia o falta de objetividad por parte de los funcionarios intervinientes, habiéndose realizado tres inspecciones en distintas fechas y emitido las acciones correspondientes conforme a los hallazgos técnicos observados, que valga señalar, lo denunciado no fue posible de verificar en ninguna de las visitas al lugar.”.
  4. 4En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta la Magistrada Hess Herrera; y,

Considerando:

I. ACLARACIÓN PREVIA

Antes de analizar el fondo del asunto debe aclararse que, a partir de la Sentencia Nº 2008-02545 de las 08:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa -con algunas excepciones- aquellos asuntos en los que se discute si la Administración Pública ha cumplido o no los plazos razonablemente pautados para resolver las solicitudes planteadas por los administrados a la luz de lo dispuesto por el artículo 41, de la Constitución Política. En el caso concreto, se plantea un supuesto de excepción, pues se plantea la falta de atención de varias denuncias ante SENASA acerca de hechos relacionados con contaminación ambiental que podrían afectar la salud del recurrente y la de su familia. Atendiendo a lo expuesto, se entra a resolver la situación concreta planteada en este recurso.

II. OBJETO DEL RECURSO

El recurrente reclama la inacción del Servicio Nacional de Salud Animal (SENASA) de Guápiles ante una denuncia sanitaria presentada el 07 de enero de 2025, mediante la cual solicitó la intervención inmediata para inspeccionar y clausurar un corral construido a unos cinco metros de su vivienda, perteneciente al señor Nombre90973. Solicita a esta Sala que se ordene a SENASA verificar las condiciones insalubres y de mal manejo animal que ocasionan olores nauseabundos, proliferación de moscas, contaminación ambiental, presencia de animales enfermos y desechos a cielo abierto. En consecuencia, requiere que la autoridad recurrida adopte medidas correctivas o sancionatorias inmediatas contra los responsables y garantice el cese de la contaminación, al considerar vulnerados sus derechos a la salud, al ambiente sano y a la tranquilidad familiar.

III. HECHOS PROBADOS

De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:

  • a)El 07 de enero de 2025, el señor Nombre90972 presenta ante la oficina de SENASA Guápiles una denuncia formal contra el señor Nombre90973, vecino de Hoja Ancha, Cariari, Limón, por la existencia de un corral con entre 15 y 20 cabezas de ganado ubicado a unos 5 metros de su vivienda. Señala que los animales presentan heridas con gusano barrenador, generan malos olores y proliferación de moscas, y que en su hogar habitan niños y una hija con heridas expuestas, lo que aumenta el riesgo sanitario. (denuncia N.º 927D68682F2025) (ver informe rendido bajo juramento y prueba adjunta).
  • b)El 13 de febrero de 2025, en atención a dicha denuncia los funcionarios del SENASA Pococí, Dr. Hernán Barrantes Lobo y el técnico Rubén Sánchez Alvarado, realizaron una inspección en el sitio, según hoja de visita N.º 0315976. Se constató la existencia de un corral con dos vacas y dos terneros, sin lesiones visibles ni afectación por gusano barrenador. El manejo de desechos y aguas pluviales es adecuado y la presencia de olores y moscas es mínima. No se evidencia que los animales duerman en el corral. Por lo tanto, no se ordenó ninguna medida sanitaria (ver informe rendido bajo juramento y prueba adjunta).
  • c)El 16 de mayo de 2025, se presentó una segunda denuncia contra el mismo señor Nombre90973, en la que se indicó que el corral mantiene aproximadamente cinco bovinos encerrados día y noche, alimentados con pollinaza y banano, lo que genera malos olores y moscas que afectan a los vecinos. (denuncia código D81E03E4892025) (ver informe rendido bajo juramento y prueba adjunta).
  • d)El 18 de junio de 2025, en atención a la nueva denuncia, los mismos funcionarios del SENASA Pococí realizaron una segunda inspección in situ, según hoja de visita N.º Telf7193. Se constata que no hay bovinos estabulados, ni subproductos para su alimentación. Tampoco se percibieron malos olores ni brote de moscas, ni indicios de que los animales permanezcan en el corral durante la noche. En consecuencia, no se emitió ninguna medida sanitaria (ver informe rendido bajo juramento y prueba adjunta).
  • e)El 21 de octubre de 2025, a raíz de la interposición del recurso de amparo por parte del denunciante, el Dr. Bernardo Calvo Rodríguez, jefe del Departamento Regional Huetar Caribe del SENASA efectuó una tercera inspección personal al sitio, según hojas de visita N.º Telf7194 y N.º Telf7195. Se verificó la existencia de un corral de aproximadamente 9 x 9 metros, techado, con comederos de cemento, bebederos de plástico y picadora de pasto a motor. Durante la visita no se encuentran animales presentes, aunque se observaron restos de caña de azúcar y boñigas recientes, lo evidenció su uso reciente (ver informe rendido bajo juramento y prueba adjunta).
  • f)En la misma visita del 21 de octubre de 2025, se observó a unos 20 metros de distancia un chiquero con ocho cerdos (dos adultos y seis en desarrollo) en buenas condiciones de limpieza, sin malos olores ni plagas. El señor Nombre90973 -de 91 años- aseguró mantener en la finca tres vacas adultas y cuatro terneros, los cuales pastorean en campo abierto y se alimentan en el corral por las mañanas con caña de azúcar picada. En esa inspección, no se constataron los hechos denunciados por el recurrente (animales enfermos o muertos, olores intensos, putrefacción, proliferación de moscas o gusano barrenador); sin embargo, se verificó que el establecimiento carece del Certificado Veterinario de Operación (CVO) exigido por la Ley N.º 8495. En consecuencia, el SENASA ordenó la suspensión de toda actividad pecuaria en un plazo no mayor de cinco días calendario y dispuso la reubicación de los animales en un establecimiento debidamente autorizado con CVO, informando al propietario que puede gestionar dicha autorización cumpliendo la normativa aplicable (ver informe rendido bajo juramento y prueba adjunta).

IV. SOBRE EL CASO CONCRETO

Del informe rendido bajo juramento por las autoridades del Servicio Nacional de Salud Animal (SENASA) y de la prueba que obra en autos, se tiene por acreditado que el señor Nombre90972 presentó denuncias formales los días 07 de enero y 16 de mayo de 2025, ante la oficina regional de SENASA Guápiles contra el señor Nombre90973, por la existencia de un corral de ganado ubicado a escasos metros de su vivienda, el cual —según afirmó— generaba malos olores, proliferación de moscas, contaminación ambiental y riesgos sanitarios para su familia. Consta que la autoridad recurrida tramitó las denuncias y efectuó tres inspecciones in situ (13 de febrero, 18 de junio y 21 de octubre de 2025) concluyendo en la última que el establecimiento carecía del Certificado Veterinario de Operación (CVO) exigido por la Ley N.º 8495, por lo que se ordenó la suspensión de toda actividad pecuaria y la reubicación de los animales en un sitio autorizado.

No obstante, del informe rendido bajo juramento, ni del acervo probatorio se desprende que SENASA haya notificado al denunciante los resultados de cada inspección, ni que le haya informado formalmente las medidas adoptadas, el cumplimiento de la suspensión ni el seguimiento de la reubicación ordenada. Esta falta de comunicación constituye una omisión administrativa relevante, que afecta el principio de publicidad y el deber de motivación de los actos administrativos. Dichas normas obligan a la Administración a resolver expresamente toda gestión formulada por los particulares y a comunicar los resultados, garantizando con ello certeza jurídica, control ciudadano y tutela efectiva de los derechos de las personas afectadas por actividades fiscalizadas.

En consecuencia, aunque se acredita que el SENASA atendió materialmente las denuncias y ordenó medidas correctivas, la omisión de notificar y dar seguimiento formal al denunciante sobre los resultados de las inspecciones y la ejecución de la suspensión impuesta evidencia un incumplimiento de los deberes de información, diligencia y control propios de su función fiscalizadora.

Por lo anterior, se declara con lugar el recurso de amparo planteado.

V. NOTA DEL MAGISTRADO SALAZAR ALVARADO

En asuntos ambientales, es criterio del suscrito, que, si ya ha habido intervención de la Administración Pública, su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que el recurrente denuncia la presunta contaminación, las condiciones insalubres y de mal manejo animal que ocasionan olores nauseabundos, proliferación de moscas, presencia de animales enfermos y desechos a cielo abierto en una propiedad cercana a la vivienda del recurrente. Aduce que ha realizado gestiones previas ante el Servicio Nacional de Salud Animal (SENASA), sin obtener una solución efectiva.

La situación descrita constituye una excepción a mi posición general en esta materia, por lo que estimo necesario que este Tribunal Constitucional analizara por el fondo el asunto, con el fin de verificar o descartar los alegatos de la parte recurrente.

VII. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a la parte recurrente que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se declara con lugar el recurso. Se ordena a Bernardo Calvo Rodríguez, en su condición de jefe del Departamento Regional Huetar Norte del Servicio Nacional de Salud Animal (SENASA), o a quien en su lugar ocupe tal cargo, que coordine y ejecute las acciones pertinentes dentro del ámbito de sus competencias, para que de INMEDIATO notifique formalmente al señor Nombre90972 los resultados de cada una de las inspecciones realizadas (13 de febrero, 18 de junio y 21 de octubre de 2025) incluyendo las observaciones técnicas y conclusiones correspondientes. Asimismo, informe al amparado sobre el estado actual del cumplimiento de la orden de suspensión de actividades pecuarias y la efectiva reubicación de los animales en un establecimiento debidamente autorizado. Se advierte al representante de la autoridad recurrida que, de conformidad con el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá pena de prisión de tres meses a dos años o de veinte a sesenta días multa a quien reciba una orden de esta Sala que deba cumplir o hacer cumplir y la inobserve, siempre que el delito no esté más gravemente penado.

Se condena al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de fundamento a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. El magistrado Salazar Alvarado consigna nota. Notifíquese. – Fernando Cruz C.
