Constitutional Chamber Case File: 25-005392-0007-CO Type of Matter: Amparo appeal Case File: 25-005392-0007-CO CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine hours and fifteen minutes on the twenty-second of August, two thousand twenty-five.

Whereas:
That is why, from the Executive Decree of creation in 1985 until the issuance of the Law for the Recognition of the Inhabitants of the South Caribbean No. 9223 in 2014, multiple interpretations of the boundaries of the RNVS-GM arose by regulatory discretion, a situation that was collected and described by the Constitutional Chamber in Resolution No. 2009-001056 at fourteen hours and fifty-nine minutes on January twenty-eight, two thousand nine. THIRD: That the general management plan is defined by the Biodiversity Law as: “It is the planning instrument that allows guiding the management of a protected wilderness area toward the fulfillment of its long-term conservation objectives. It is based on medium-term strategic lines of action and management objectives for the natural and cultural elements included within the area, as well as the relationship of the latter with their socio-environmental surroundings.
It is the basis for the development of other planning and regulatory instruments for Protected Wilderness Areas” (Regulation to the Biodiversity Law). “The General Management Plan (PGM) is the technical instrument that defines the route that the staff of the Protected Wilderness Area (ASP) and its allies must follow to maintain the values of the ASP. It is the navigation chart for a successful administration and comprehensive management of the protected area” (SINAC Guide). The planning instrument of the Gandoca Manzanillo Mixed Category National Wildlife Refuge (RNVSGM) was published in Scope No. 42 to La Gaceta No. 39 of February 28, 2022. The 2017-2026 Refuge Management Plan clearly establishes its objective and zoning. “I.4. General Objective of the General Management Plan of the Gandoca Manzanillo National Wildlife Refuge: Guide the Administration in the process of consolidating the Refuge, providing strategic guidelines that allow for adequate management of biodiversity, human and financial resources, goods and ecosystem services, the relationship with communities, the reduction of threats, and the adaptation of the ASP to the impacts of climate change…(…) III.3.2 Proposed Intervention Zones for the RNVS-GM The RNVS-GM has a continental section and a marine section, so the proposed zoning also has these two sections.
For each intervention zone, its objective, general description, and permitted activities are presented. The specific regulation is presented in the RNVSGM Public Use Regulation. The four proposed terrestrial intervention zones for the RNVS-GM are (Figure III-1): 1. Minimum Intervention Zone 2. Low Intervention Zone 3. Medium Intervention Zone 4. High Intervention Zone The two proposed marine intervention zones for the RNVS-GM are (Figure III-1): 1. Minimum Intervention Zone 2. Low Intervention Zone” For these purposes, the Management Plan can be consulted at the following link: https://www.sinac.go.cr/ES/planmanejo/Plan%20Manejo%20ACLAC/Plan%20 General%20de%20Manejo%20RNVS%20Gandoca%20Manzanillo%202017- 2026.pdCUARTO: Based on the foregoing, it is noted that the appellant is unaware of Article 19 and 20 of the current Forestry Law No. 7575, which regulates “private forestry property” and forest use (aprovechamiento del bosque), in which it is indeed possible to carry out legal activities.
“TITLE THREE Private forestry property CHAPTER I Forest management ARTICLE 19.- Authorized activities On land covered by forest, it shall not be permitted to change land use (cambio de uso del suelo) or establish forest plantations. However, the State Forestry Administration may grant permission in these areas for the following purposes: a) Build dwellings, offices, stables, corrals, nurseries, roads, bridges, and facilities intended for recreation, ecotourism, and other analogous improvements on privately owned land and properties where forests are located. b) Carry out infrastructure projects, state or private, of national convenience. c) Cut trees for reasons of human safety or scientific interest. d) Prevent forest fires, natural disasters, or other analogous causes or their consequences. In these cases, forest cutting shall be limited, proportional, and reasonable for the purposes set forth above.
Previously, a pre-selection questionnaire must be completed before the State Forestry Administration to determine the possibility of requiring an environmental impact assessment (evaluación del impacto ambiental), as established in the regulation of this law.” (Highlighting is ours) For the case of forest use on private properties, cutting is regulated in Article 20, which states: “ARTICLE 20.- Forest management plan Forests may be used only if they have a management plan that addresses the impact it may cause on the environment. The State Forestry Administration shall approve it based on previously certified sustainability criteria, in accordance with the oversight principles and procedures established in the regulation of this law for that purpose. Upon approval of the forest management plan, its execution shall be deemed authorized during the period contemplated therein, without the need to periodically obtain new authorizations for use.” (Highlighting is ours) FIFTH: That the La Amistad Caribe Conservation Area has not issued use permits within the Gandoca Manzanillo National Wildlife Refuge, mixed category.
SIXTH: That regarding Law 9223, called Law for the Recognition of the Rights of the Inhabitants of the South Caribbean, this honorable Chamber has issued Constitutional rulings 2019-24745 and 2024-26300, which the Ministry of Environment and Energy, as well as the National System of Conservation Areas, are specifically attending to as indicated for the 188 ha of forest cover (cobertura boscosa). The information can be reviewed in constitutional case file 14-019174-000-CO. SEVENTH: That in order to guarantee due compliance with Constitutional rulings 2019-24745 and 2024-26300, the Regional Directorate of the La Amistad Caribe Conservation Area issued instruction SINAC-ACLAC-DR-0049-2025 dated January 14, 2025, for the purpose of not issuing forest use permits in the area comprised within the 188 ha referenced in the indicated resolutions, until the technical studies addressing said rulings are available.
III. Conclusion In a first conclusion, it is shown that national wildlife refuges with mixed property are legally established by the Executive Branch; without there being limitations on private forestry property, except those established in specific laws that regulate any activity through a Management Plan. Its planning instrument is the General Refuge Management Plan. They present a shared administration between the State (MINAE-SINAC) and private parties. As a second conclusion, in the case of Mixed Property National Wildlife Refuges (RNVS), said instrument becomes more important, since their administration involves the natural resource and private property owners; for the purpose of adequately protecting the focal management elements (EFM) that support the declaration and future of the Protected Wilderness Area (ASP) and, on the other hand, for the full and legal exercise of the use of private real estate included within the ASP boundaries.
Therefore, it is an error to force the treatment of this protected wilderness area as if it were a national park. Likewise, it is stated that matters related to forest use on private properties are duly regulated by Articles 19 and 20 of the current Forestry Law No. 7575. That the appellant is not correct, since in order to guarantee due compliance with Constitutional rulings 2019-24745 and 2024-26300, the Regional Directorate of the La Amistad Caribe Conservation Area of the National System of Conservation Areas issued instruction SINAC-ACLAC-DR-0049-2025 dated January 14, 2025, for the purpose of not issuing forest use permits in the area comprised within the 188 ha referenced in the indicated resolutions, until the technical studies addressing said rulings are available. In this regard, the generalized suspension of these applications would harm private property owners who comply with the requirements established by law, taking into consideration that the Chamber's ruling refers only to a small area, not the entire extension of said mixed refuge. It requests that the appeal be dismissed.

Considering:
The appellant states that in the Gandoca Manzanillo zone, the extension of the National Wildlife Refuge, including the biological corridor, has been unduly reduced. Likewise, they question the development of tourist activities incompatible with the refuge's protection regime, including noise pollution, vehicular traffic, constructions, removal and generation of waste and wastewater which, in their opinion, cause environmental impact in that area, endangering the environment. They ask this Chamber to analyze the imposition of immediate measures that safeguard the integrity and existence of the ecosystems and species found there. Among these, that the Municipality of Talamanca be ordered to immediately suspend any type of construction and land-use permit, concession application or precarious use, and approval of any activity requiring its authorization to be carried out in the area. Furthermore, they request that the National System of Conservation Areas be ordered to suspend any application or permit for tree use or any other permit involving activity in the area. Both requests, until the zone is duly delimited by the institutions tasked with doing so.
Of importance for the decision in this matter, the following facts are deemed duly proven, either because they have been so accredited or because the appealed authority has omitted to refer to them, as provided in the initial order:
Notify the plaintiff, the President of the Legislative Assembly or whoever holds that office, the Office of the Attorney General of the Republic, and all interveners.” (see case file 14-019174-000-CO).
“(…) In accordance with the provisions of the fourth paragraph of Article 41 of the cited Law, and pursuant to the other competencies of this Constitutional Jurisdiction, any precautionary conservation or security measure that prudence advises may be ordered, to prevent material risks or avoid the production of other damages as a consequence of the acts carried out. It is thus resolved that, in the time interval of the delimitation and until the Final Report on compliance with judgment No. 2019-12745 of 12:10 hours on July 10, 2019 reaches this Chamber; while this Chamber does not order otherwise; and to avoid serious and irreparable damage to the environment, THE FOLLOWING PRECAUTIONARY MEASURES ARE ORDERED: A) The granting of new concessions or permits is suspended; and the execution of concessions or permits already granted is suspended, by the Municipality of Talamanca, over the 20.1 ha of land classified as forest located within the maritime-terrestrial zone of the Gandoca-Manzanillo National Wildlife Refuge.
In the present matter, the appellant requests the suspension of all authorization for land use, construction, and forest use in the zone. They set forth general considerations on the environmental value of the Gandoca-Manzanillo zone and refer to what was resolved in unconstitutionality action No. 14-19174-0007-CO, by judgment number 2019-012745 of July 10, 2019.
From a careful analysis of what is raised by the appellant, who fundamentally alleges aspects directly related to the disobedience of what was ordered by this Chamber within the indicated case file 14-19174-0007-CO, and given that within the same this Chamber has recently ordered several “precautionary measures” by resolution at 12:56 hours on March 7, 2025, namely that: “A) The granting of new concessions or permits is suspended; and the execution of concessions or permits already granted is suspended, by the Municipality of Talamanca, over the 20.1 ha of land classified as forest located within the maritime-terrestrial zone of the Gandoca-Manzanillo National Wildlife Refuge. B) Directive 09-2023 of the Ministry of Environment and Energy, which states that the official boundaries of the Gandoca-Manzanillo National Wildlife Refuge are those established in Law No. 9223, Recognition of the rights of the inhabitants of the South Caribbean, effective as of April 8, 2014, is suspended.
Consequently, the proper course is for all briefs contained in the electronic records of this process to be added to case file number 14-19174-0007-CO, so that what is legally appropriate may be resolved therein.
V- DOCUMENTATION PROVIDED TO THE CASE FILE. The parties are warned that if any document on paper has been provided, as well as objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic device or one produced by new technologies, these must be withdrawn from the office within a maximum period of 30 working days counted from the notification of this judgment. Otherwise, all material not withdrawn within this period shall be destroyed, in accordance with the provisions of the "Regulation on Electronic Case Files before the Judiciary", approved by the Full Court in session number 27-11 of August 22, 2011, Article XXVI and published in Judicial Bulletin number 19 of January 26, 2012, as well as the agreement approved by the Superior Council of the Judiciary, in session number 43-12 held on May 3, 2012, Article LXXXI.
THEREFORE:
Separate all briefs incorporated into the digital case file at 16:48 hours on February 4, at 14:12 on March 24, and at 13:52 on August 4, all of 2025, and send them to case file No. 14-19174-0007-CO, so that what is legally appropriate may be resolved.

SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas quince minutos del veintidos de agosto de dos mil veinticinco .
Recurso de amparo que se tramita en expediente nro. 25-005392-0007-CO, interpuesto por Nombre440 , cédula de identidad CED5781, contra la MUNICIPALIDAD DE TALAMANCA Y EL SISTEMA NACIONAL DE AREAS DE CONSERVACIÓN
Resultando:
Redacta el Magistrado Cruz Castro; y,
Considerando:
El recurrente expone que en la zona de Gandoca Manzanillo se ha reducido de manera indebida la extensión del Refugio Nacional de Vida Silvestre, incluido el corredor biológico. Asimismo, cuestiona el desarrollo de actividades turísticas incompatibles con el régimen de protección del refugio, incluyendo contaminación sonora, tránsito vehicular, construcciones, remoción y generación de desechos y aguas residuales que, a su criterio, ocasionan afectación ambiental en esa área, que ponen en peligro el medio ambiente. Pide a esta Sala analizar la imposición de medidas inmediatas que resguarden la integridad y existencia, de los ecosistemas y especies que ahí se encuentran. Entre estas, que se ordene a la Municipalidad de Talamanca la inmediata suspensión de cualquier tipo de permiso de construcción y uso de suelo, solicitud de concesión o de uso en precario, y aprobación de cualquier actividad que necesite de su autorización para ser llevada a cabo en el área. Además, pide que se ordene al Sistema Nacional de Áreas de Conservación suspender cualquier solicitud o permiso de aprovechamiento de árboles o cualquier otro permiso que implique actividad en el área. Ambas solicitudes, hasta que la zona se encuentre debidamente delimitada por las instituciones encomendadas para ello.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque la autoridad recurrida haya omitido referirse a ellos, según lo prevenido en el auto inicial:
Notifíquese al accionante, a la Presidenta de la Asamblea Legislativa o a quien ocupe su cargo, a la Procuraduría General de la República y a todos los intervinientes.” (ver expediente 14-019174-000-CO).
“(…) De conformidad con lo dispuesto por el párrafo cuarto del artículo 41 de la citada Ley, y conforme al resto de competencias de esta Jurisdicción Constitucional, se podrá dictar cualquier medida cautelar de conservación o seguridad que la prudencia aconseje, para prevenir riesgos materiales o evitar que se produzcan otros daños como consecuencia de los hechos realizados. Así se resuelve que, en el intervalo de tiempo de la delimitación y hasta tanto no llegue a esta Sala el Informe Final de cumplimiento de la sentencia n°2019-12745 de las 12:10 horas del 10 de julio del 2019; mientras esta Sala no disponga otra cosa; y para evitar daños graves e irreparables al ambiente, se DICTAN LAS SIGUIENTES MEDIDAS CAUTELARES: A) Se suspende el otorgamiento de concesiones o permisos nuevos; y se suspende la ejecución de concesiones o permisos ya otorgados, por parte de Municipalidad de Talamanca, sobre las 20,1 has de terrenos clasificados como bosque que se ubican dentro de la zona marítimo terrestre del Refugio Nacional de Vida Silvestre Gandoca-Manzanillo.
En el presente asunto la parte recurrente pide la suspensión de toda autorización de uso de suelo, construcción y aprovechamiento forestal en la zona. Expone consideraciones generales sobre el valor ambiental de la zona Gandoca-Manzanillo y refiere a lo resuelto en acción de inconstitucionalidad N°14-19174-0007-CO, por la sentencia número 2019-012745 del 10 de julio de 2019.
Del análisis cuidadoso de lo planteado por la parte recurrente, que en lo fundamental alega aspectos relacionados directamente con la desobediencia a lo ordenado por esta Sala dentro del expediente 14-19174-0007-CO indicado, y siendo que dentro del mismo ya esta Sala ha ordenado recientemente varias “medidas cautelares” mediante resolución de las de las 12:56 horas del 7 de marzo de 2025, a saber que: “A) Se suspende el otorgamiento de concesiones o permisos nuevos; y se suspende la ejecución de concesiones o permisos ya otorgados, por parte de Municipalidad de Talamanca, sobre las 20,1 has de terrenos clasificados como bosque que se ubican dentro de la zona marítimo terrestre del Refugio Nacional de Vida Silvestre Gandoca-Manzanillo. B) Se suspende la directriz 09-2023 del Ministerio de Ambiente y Energía que dispone que los límites oficiales del Refugio Nacional de Vida Silvestre Gandoca-Manzanillo son los establecidos en la Ley N° 9223, Reconocimiento de los derechos de los habitantes del Caribe Sur, vigente desde el 8 de abril 2014.
En consecuencia, lo procedente es que todos los escritos contenidos en los registros electrónicos de este proceso se agreguen al expediente número 14-19174-0007-CO, para que allí se resuelva lo que en derecho corresponda.
V- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión número 27-11 del 22 de agosto de 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero de2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión número 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI.
´POR TANTO:
Desglósense todos los escritos incorporados al expediente digital a las 16:48 horas del 4 de febrero, a las 14:12 del 24 de marzo y a las 13:52 del 4 de agosto todos de 2025, y remítanse al expediente No. 14-19174-0007-CO, para que se resuelva lo que en derecho corresponda.
