Document Review *230215890007CO* SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine thirty a.m. on uno de agosto de dos mil veinticuatro.
Constitutional rights action (recurso de amparo) processed under expediente nro. 23-021589-0007-CO, filed by [Nombre01 001], identity card [Valor CED02], against INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS, MINISTERIO DE HACIENDA, MUNICIPALIDADES DE GOLFITO, Nombre02 Y GARABITO, subsequently extended to include MUNICIPALIDAD DE PALMARES.
Considering the Facts:
In light of this problem, the communities of Golfito, Quepos, Jacó and Palmares had been included in the Programa de Saneamiento en Zonas Prioritarias, thereby authorizing the construction of treatment plants and their respective sanitary sewer systems.
Its contents are set out below: “Based on the available financing, different scenarios for making use of the investment were proposed. The changes in the projects to be considered were due to the opposition of Municipalidad and Marina Bahía Golfito to the location of the future Wastewater Treatment Plant (Planta de Tratamiento de Aguas Residuales), as described in document PRE-2023-00493 (attached). The need to adapt to current social conditions in the Golfito Sanitary Sewer Project resulted in the proposal to carry out the Jacó and Palmares projects with a scope consistent with the available resources. During the June del 2023 mission with Banco KfW, in which MINISTERIO DE HACIENDA participated, it was determined that the borrower needed to assess the Program’s appropriateness and urgency. On this basis, through note MH-DM-OF-1303-2023 of 16 de agosto, MINISTERIO DE HACIENDA asked AyA to coordinate the appropriate actions to carry out the orderly closing of the credit operation and the other activities associated with it.
With respect to the actions that the Executive Presidency will take in response to the decision of MINISTERIO DE HACIENDA, in its capacity as borrower under Loan Agreement 28568, the Senior Administration is preparing an analysis of risks, implications and actions to be undertaken from legal, financial, technical and environmental perspectives, in order to facilitate the proposal of other alternatives and the establishment of a feasible financing strategy that will enable the program to be completed.” He asks that the action be denied.
• In the interests of transparency and accountability, the Ministerio de Hacienda has made available to the public, through the Ministry’s website, information related to the implementation of the external loans (créditos externos) financing various public investment programs/projects. This information shows that, for several years, the Program has faced a series of delays, problems, and periods of stagnation due to the limited implementation capacity of the Instituto Costarricense de Acueductos y Alcantarillados, which have contributed to its critical performance situation, with very little progress to date. • In this regard, since the I Semester of 2021, the Program has exhibited critical performance from which it has been unable to recover; instead, this condition has worsened over the years, despite the efforts made by this Ministry to urge the Instituto Costarricense de Acueductos y Alcantarillados to implement the Program and the loan financing it efficiently and effectively.
Evidence of the foregoing can be found in the official letters (oficios) sent to various senior officials of that Institute to warn them of these situations and request prompt solutions regarding implementation. In that regard, official letter number DM-1219-2021 dated 11 de noviembre de 2021, addressed to Mr. Tomás Martínez, Executive President of the Instituto Costarricense de Acueductos y Alcantarillados, conveyed this Ministry’s concern regarding the Program’s performance and the clear and significant delays already evident at that time, including those relating to one of the principal procurements (contrataciones) required for implementation of the Program, namely the engagement of the Implementation Consultant (Consultor de Implementación, CI), and the extensions of the deadlines for receipt of bids, which led to constant replanning in both financial matters (payments to be made) and the activity schedule.
The Instituto Costarricense de Acueductos y Alcantarillados was also informed that the types of situations observed in the specific case involving KFW were considered significant because they had also arisen in other similar programs of the Institution, creating uncertainty regarding the effectiveness and efficiency with which the lessons learned from ongoing and completed programs/projects in the Institute’s portfolio were being applied. Subsequently, the declaration that the company prequalification process (concurso de Precalificación) had yielded no successful bidder led the Instituto Costarricense de Acueductos y Alcantarillados to decide to restart the procurement processes individually, by project. The Institute was therefore advised of the concern regarding the additional period that, even at that time, it estimated it would require to complete the Program, namely 24 additional months.
With respect to the works for the PTAR Golfito, Palmares and Jacó, the Institute was also urged to continue coordinating the necessary channels of communication with stakeholders and key personnel so that it could optimize and improve stakeholder management and establish the strategic partnerships and agreements required to ensure that the works began in a timely manner, while minimizing any setbacks in their development. In its capacity as Borrower under Loan Agreement (Contrato de Préstamo) KfW 28568, this Ministerio de Hacienda stated that it was urgent and necessary for the Instituto Costarricense de Acueductos y Alcantarillados, as the Implementing Entity (Entidad Ejecutora), to coordinate the measures required to remedy its difficulties so as to make appropriate progress in implementing the Program and minimize future impacts on the implementation schedule, thereby allowing it to be completed within the contractually established period without generating cost overruns.
Accordingly, the Ministerio de Hacienda awaited notification of the measures that the Instituto Costarricense de Acueductos y Alcantarillados would implement to improve and strengthen management of the Program, so that those measures would produce and be reflected in improved implementation indicators in the short term; however, they never materialized. Consistent with the foregoing, through official letter number MH-DM-OF-2702-2022 dated 09 de noviembre del 2022, addressed to Mr. Roberto Guzmán Gutiérrez, who was then Executive President of the Instituto Costarricense de Acueductos y Alcantarillados, concern was expressed regarding the Program’s critical performance. As of that date, none of the financing had been disbursed, and the Program’s physical progress stood at 18.22%, representing less than 1% progress during the preceding year. At that time, he was advised of other matters that remained critical:
In this regard, the Minutes of the Meeting dated 22 de junio de 2023, held in connection with the KFW supervision mission, stated the following: Extension of the disbursement period: Mention is made of the uncertainty regarding the costs to the Borrower should it terminate the Loan Agreement or in the event of a possible extension, and the need to have projected information in this regard in order to make decisions. It is emphasized that a specific amount for each matter could not be guaranteed at the time of the meeting. Despite this, the Ministry of Finance does need the aforementioned information in order to analyze realistic scenarios that support timely decision-making, and therefore requests that KfW provide an estimate in this regard. (Boldface does not appear in the original) Once reviewed from a technical standpoint and its implications assessed, this information led the Ministry of Finance to decide to request the closing of the credit transaction, as this was deemed beneficial to the interests of the State, which this Ministry protects in accordance with its powers.
It is reiterated that the decision to reduce the scope of the projects from 4 to 2, with a reduced scope under the Program, originated within the Instituto Costarricense de Acueductos y Alcantarillados itself, and the Ministry of Finance had no involvement whatsoever in it. It is also emphasized that this Ministry did not in any way instruct that the Program be left without budgetary funding, since the Instituto Costarricense de Acueductos y Alcantarillados is technically and legally capable of carrying out the Program’s works with the resources it budgets for that purpose. III. Relief Requested. On the basis of the factual and legal grounds set forth above, I request that the constitutional rights petition (recurso de amparo) filed by Mr. [Nombre01 001] be dismissed, since this Ministry, within the scope of its powers, has complied with the applicable regulations and has not violated the fundamental rights to Health, to a Healthy and Ecologically Balanced Environment, or to the Protection of Natural Beauty.”
In the same vein, section 2° establishes the legal functions granted to AyA by the founding legislation, namely:
‘a) To direct and oversee all matters concerning the provision to the inhabitants of the Republic of drinking-water services and the collection and disposal of sewage, liquid industrial waste, and stormwater in urban areas; b) To determine the priority, advisability, and feasibility of the various proposed projects for constructing, renovating, expanding, or modifying aqueduct and sewerage works, which may not be carried out without its approval; c) To promote watershed conservation (conservación de las cuencas hidrográficas) and ecological protection, as well as the control of water pollution (…); g) To directly administer and operate aqueduct and sewerage systems throughout the country, assuming responsibility for them progressively in light of the advisability and availability of resources. Systems currently administered and operated by municipal corporations may remain under their authority as long as they provide efficient service.
Under no circumstances may it delegate the administration of the aqueduct and sanitary sewer systems of the Área Metropolitana.
Nor may it delegate the administration of systems for which financial responsibility exists while that responsibility rests directly with the Instituto.
The institution is authorized to enter into agreements with local bodies for the administration of such services, or to administer them through administrative boards composed jointly of the Instituto and the respective communities, whenever doing so is advisable for the improved provision of services and in accordance with the applicable regulations. For the same reasons and with the same characteristics, regional administrative boards involving several municipalities may also be created, (...)
THIRD: To comply with the order issued in expediente 02-007756-0007-CO, by resolution rendered at catorce horas treinta minutos del tres de febrero del dos mil quince, insofar as the Municipalidad de Palmares is concerned, it ordered “(...) that all necessary measures be taken so that, within the non-extendable period of one year counted from notification of this resolution, the Regulatory Plan (Plan Regulador) for the Cantón de Palmares is provided to this Institute, so that the wastewater and sewage treatment system (sistema de tratamiento de aguas negras y residuales) for the Cantón de Palmares may be completed within the following three and a half years.” On 27 de marzo del 2023, at diez horas 00n catorce minutos, Arq. Silvia Carazo Angulo, Acting Head of the Departamento de Ingeniería Municipal, sent official letter MP-DU-108-2023 by email to the representatives of the Instituto de Acueductos y Alcantarillados for the Cantón de Palmares, Pedro Barrantes Ramírez, Head of the Oficina Cantonal de Palmares; Melvin Castro González, Director of Operations and Maintenance for the Región Central Oeste; and Tatiana Vindas Valerio, Operations and Maintenance Engineer for the Región Central Oeste, thereby delivering to them the hydrogeological variable (variable hidrogeológica) forming part of the Plan Regulador del Cantón de Palmares process and thus providing the required input so that said Institute may complete the wastewater and sewage treatment system for the Cantón de Palmares, in accordance with the Plan de Inversión de Saneamiento 20212026 de AYA.
As stated in section 1.1, Rationale, the hydrogeological study (estudio hidrogeológico) that was conducted constitutes that input and arose from the need to generate technical knowledge concerning the availability, quality, and vulnerability of groundwater resources (recurso hídrico subterráneo), so that decision-making institutions may have access to more technical and scientific information.
Accordingly, the Municipalidad de Palmares has no outstanding document requested by AyA that would prevent this Institute from completing the wastewater and sewage treatment system for the Cantón de Palmares, since the remaining applicable legal regulations concern construction-permit procedures (trámites de construcción), governed by the Ley de Construcciones and its respective regulations, which apply nationwide and to which both public institutions are subject.” (…) REQUESTS: Therefore, since the Municipalidad de Palmares delivered the hydrogeological variable from the Plan Regulador process, which AyA required to complete the wastewater and sewage treatment system for the Cantón de Palmares, I request that the order issued to the entity I represent by the Sala Constitucional de la Corte Suprema de Justicia be deemed fulfilled.” She requests that the petition be dismissed.
Magistrada Alvarado Paniagua writes the opinion; and,
Whereas:
The petitioner states that there is neither a treatment plant (planta de tratamiento) nor a sanitary sewer system (alcantarillado sanitario) in the central district of Palmares (a situation addressed in expediente nro. 02- 007756-0007-CO). He states that the situation in Garabito, specifically Jacó, is similar to that in Palmares, because residents are affected by extensive anthropogenic pollution (contaminación antrópica) in their streams and rivers, causing the death of aquatic life and health problems for residents and for river and marine ecosystems. He comments that water sanitation (saneamiento de las aguas) apparently has never been a priority for the respondents. In light of this problem, the communities of Golfito, Quepos, Jacó and Palmares had been included in the Programa de Saneamiento en Zonas Prioritarias, thereby authorizing the construction of treatment plants and their respective sanitary sewer systems.
Nevertheless, he complains that, through official letter MH-DM-OF-1303-2023 dated 16 de agosto de 2023, the Ministro de Hacienda informed the Executive President of the Instituto de Acueductos y Alcantarillados (ICAA) that the program had been canceled. He adds that the budget and financing for the projects in the 4 communities were eliminated on the crude pretext that there had been no prompt progress in carrying out the works or obtaining the necessary enabling acts (actos habilitadores). Part of the rationale was even that the President of ICAA had asked the Ministro de Hacienda to remove the Nombre02 and Golfito projects from the schedule of activities and financing, intending to retain only the Palmares and Jacó projects. He complains that none of the 4 projects will be carried out because the Ministro de Hacienda ordered that the Programa de Saneamiento en Zonas Prioritarias be left without budgetary funding, a matter that irrationally brings all works in the 4 cities to a halt.
He alleges that the actions of the respondent authorities violate constitutional provisions 21, 50 and 89, because they will usher in a period of uncontrolled and irreversible environmental damage, impairing the rights even of people who have not yet been born. He requests that the petition be granted and that the respondents be ordered to take the appropriate steps to activate the source of financing for the treatment-plant and sanitary-sewer projects in Palmares, Jacó, Nombre02 and Golfito.
The following facts are deemed duly established and material to the adjudication of this matter, either because they have been substantiated or because the respondent authority failed to address them, as directed in the initial order:
Regarding the treatment plant and sewer systems of the Municipalidad de Palmares:
THOSE AUTHORITIES ARE LIKEWISE ORDERED TO PROVIDE IN THEIR BUDGETS THE APPROPRIATIONS NECESSARY FOR CONSTRUCTION OF THE AFOREMENTIONED TREATMENT PLANT AND TO PROVIDE THE PETITIONER WITH A LETTER DETAILING THE BUDGET TO BE ALLOCATED FOR THAT PURPOSE AND A SCHEDULE OF ACTIVITIES, SO THAT COMPLIANCE WITH THE CONSTRUCTION PHASES MAY BE MONITORED; ALL OF THIS WITH THE UNDERSTANDING THAT THEY MUST COMPLETE THE INDICATED TASK WITHIN A REASONABLE PERIOD, WHICH MAY NOT EXCEED DOS AÑOS. IN ADDITION, EDUARDO LOPEZ C ARDENAS, IN HIS CAPACITY AS MINISTRO DE SALUD A.I., OR WHOMEVER HOLDS THAT OFFICE, IS ORDERED, UNDER PENALTY OF DISOBEDIENCE, TO COORDINATE EFFORTS WITH THE OTHER RESPONDENTS AND MONITOR THAT THE AFOREMENTIONED TREATMENT PLANT IS CONSTRUCTED IN ACCORDANCE WITH HEALTH REGULATIONS. THE ALCALDE AND THE REGIDORES DE LA MUNICIPALIDAD DE PALMARES, OR WHOMEVER HOLDS THEIR RESPECTIVE OFFICES, ARE ORDERED, UNDER PENALTY OF DISOBEDIENCE, TO PROVIDE A PERMANENT SOLUTION TO THE PUBLIC-HEALTH PROBLEM CAUSED BY THE MER CADO MUNICIPAL DE PALMARES WITHIN THE NON-EXTENDABLE PERIOD OF DOS AÑOS; AND EDUARDO LOPEZ CARDENAS, IN HIS CAPACITY AS MINISTRO DE SALUD A.I., OR WHOMEVER HOLDS THAT OFFICE, IS ORDERED, UNDER PENALTY OF DISOBEDIENCE, TO ORDER THE CLOSURE OF THE MERCADO MUNICIPAL DE PALMARES IF THE PROBLEM AT ISSUE IS NOT CORRECTED WITHIN THE INDICATED PERIOD” (see expediente número 02-007756-0007-CO, incorporated ad effectum videndi et probandi).
Regarding the treatment plants and sewer systems of Jacó, Nombre02 and Golfito d) By Ley número 9723 dated 14 de agosto de 2019, Contrato de préstamo N° 28568 para financiar el programa de saneamiento de zonas prioritarias, executed with Banco KFW Frankfurt am Main (hereinafter KFW), was approved and published in Alcance 210 a la Gaceta 183 del 27 de setiembre del 2019. Said Program consists of four components for constructing infrastructure works in four cities in Costa Rica that were selected as priorities according to several technical selection criteria, including the impact on the beneficiary population and the project’s environmental and economic impact: Palmares, Jacó, Nombre02 and Golfito. It provides that wastewater-sanitation infrastructure works (obras de infraestructura para el saneamiento de aguas residuales) will be constructed in each city, including a sewer system, a water-collection network (red de recolección de aguas), and a treatment plant and, in the case of the city of Palmares, a Centro de Investigación y Formación en Tecnologías de Saneamiento. (See the report of the Ministerio de Hacienda and the Asamblea Legislativa portal: Archivo_Leyes - Contrato de préstamo N° 28568 para financiar... (asamblea.go.cr)).
The Instituto Costarricense de Acueductos y Alcantarillados was also advised that situations of the type encountered in this particular case involving KFW were considered relevant because they had also arisen in other similar Programs of the Institution, creating uncertainty as to the effectiveness and efficiency with which lessons learned from ongoing and completed Programs/projects in the Instituto’s Portfolio were being applied. Subsequently, the declaration that the corporate prequalification tender was unsuccessful (Declaración desierta del concurso de Precalificación de las empresas) led the Instituto Costarricense de Acueductos y Alcantarillados to decide to restart the procurement procedures, but individually (by project); it was therefore advised of the concern regarding the additional period that the Instituto already estimated it would require from that point to complete the Program, corresponding to an additional 24 months (see report).
III.ON THE COLLECTION, TREATMENT AND FINAL DISPOSAL OF SEWAGE (RECOLECCIÓN, TRATAMIENTO Y DISPOSICIÓN FINAL DE LAS AGUAS NEGRAS). To effectively ensure the protection of a healthy and ecologically balanced environment, the State, understood in the broad sense, has a duty to adopt the measures necessary to provide timely and effective treatment of sewage in the country’s communities. In this regard, this Constitutional Court has held that the Instituto Costarricense de Acueductos y Alcantarillados, the Municipalities and the Ministerio de Salud are responsible—within their respective areas of authority—for ensuring the proper collection, treatment and final disposal of such wastewater. Thus, in the specific case of the Instituto Costarricense de Acueductos y Alcantarillados, its own Enabling Law (Ley Constitutiva)—Ley No. 2726 de 14 de abril de 1961 y sus reformas—provides as follows:
“Article 1.- For the purpose of directing, setting policies, establishing and applying standards, undertaking and promoting the planning, financing and development of, and resolving all matters related to, the supply of drinking water and the collection and disposal of sewage and liquid industrial waste, as well as the regulatory aspects of storm-sewer systems in urban areas throughout the national territory, the Instituto Costarricense de Acueductos y Alcantarillados is hereby created as an autonomous institution of the State.” Accordingly, pursuant to Article 2 of that same body of law, that institution is responsible for (…) Directing and overseeing all matters pertaining to providing the inhabitants of the republic with drinking-water services and services for the collection and disposal of sewage, liquid industrial waste and stormwater in urban areas (…)”. Similarly, the Ley General de Salud—Ley No. 5395 de 30 de octubre de 1973—provides in Article 2 that the Executive Branch, through the Ministerio de Salud, is responsible for defining national health policy and for planning and coordinating all public and private health-related activities, as well as carrying out those activities assigned to it by law.
Likewise, Article 341 of that law establishes, among the powers of the Ministerio de Salud, the authority to order and adopt the special measures authorized by that legislation to prevent risks or harm to human health, or to prevent such risks or harm from spreading or worsening, and to prevent private parties from continuing or repeating violations. Regarding the specific matter at issue, the Ley General de Salud, in Book 1, Title 3, Chapter 3, “Obligations and Restrictions Governing the Sanitary Disposal of Excreta and Wastewater,” provides, insofar as relevant, as follows:
“Article 285.- Excreta, sewage, wastewater and stormwater shall be disposed of properly and hygienically in order to prevent contamination of the soil and natural water sources intended for human use and consumption, the creation of breeding grounds for disease vectors, and air pollution caused by conditions that compromise its purity or quality.” (Emphasis not in the original).
“Article 287.- Every natural or legal person who owns dwellings, establishments or buildings in which persons conduct their activities shall be responsible for ensuring that such property has a system for the disposal of excreta, sewage and wastewater approved by the Ministerio, and the users of dwellings, establishments or buildings shall be required to maintain that system in proper working condition.” “Article 288.- Every owner is required to connect the system for disposal of excreta, sewage, and wastewater from their property to the sanitary sewer system (alcantarillado sanitario) in places where it is operational, except in those cases recognized as proper exceptions under the relevant regulations.” Likewise, it follows from those provisions that the authorities of the Ministerio de Salud are obligated to ensure the application of and compliance with the provisions of that law and its regulations, without prejudice to the powers and obligations conferred and imposed by special laws upon other public bodies or entities within their respective fields of action (Article 337).
This thus confirms the various functions and obligations that the legal system imposes upon the Instituto Costarricense de Acueductos y Alcantarillados and the Ministerio de Salud regarding the collection, treatment, and final disposal of sewage (aguas negras). Moreover—as stated previously in the preceding recital (considerando)—those functions and obligations must be exercised in a coordinated manner to ensure administrative effectiveness and efficiency.
IV.The lack of a waste and sewage treatment plant in Palmares. The petitioner claims that, as of the date this proceeding was filed, several cantons still lacked a waste and sewage treatment plant (planta de tratamiento de desechos y aguas negras). Insofar as the proceeding concerns the lack of infrastructure in the Cantón de Palmares specifically, the AyA representative, in the report submitted in this matter, asks the Chamber to consider the provisions of ruling 03-01431, issued at 10:53 a.m. on February 21, 2003, which granted the proceeding filed on September 18, 2002, by the same petitioner, [Nombre01 002]. He recalls that, on that occasion, this Chamber ordered the respondent Instituto Costarricense de Acueductos y Alcantarillados, the Municipalidad de Palmares, and the Ministerio de Salud to begin the necessary steps to build a treatment plant within 12 months.
Indeed, in 2003, this Court ruled as follows: “The proceeding is hereby GRANTED. Jorge Isaac Vásquez Pérez, in his capacity as Alcalde Municipal de Palmares, and Heidi Ramírez Sánchez, Luis Carlos Araya Badilla, Coralia Pacheco Moreira, Oldemar Segura Rodríguez, and Miguel Ángel Vásquez, in their capacity as Regidores de la Municipalidad de Palmares, and Everardo Rodríguez Bastos, in his capacity as Presidente Ejecutivo del Instituto Costarricense de Acueductos y Alcantarillados, or whoever may hold their respective offices, are hereby ORDERED, UNDER PENALTY OF DISOBEDIENCE, within the non-extendable period of TWELVE MONTHS from service of this judgment, to take the necessary steps to construct a sewage treatment plant for the entire locality of Palmares, for which purpose an environmental impact study (estudio de impacto ambiental) must be submitted to SETENA. Those authorities are likewise ordered to provide in their budgets the appropriations necessary to construct the aforementioned treatment plant and to furnish the petitioner with a memorandum detailing the budget allocated for that purpose and a schedule of activities, so that compliance with the stages of construction may be monitored; all of this on the understanding that they must complete the specified task within a reasonable period, which may not exceed TWO YEARS.
In addition, Eduardo López Cárdenas, in his capacity as Ministro de Salud a.i., or whoever holds that office, is hereby ordered, UNDER PENALTY OF DISOBEDIENCE, to coordinate efforts with the other respondents and oversee the construction of the aforementioned treatment plant in accordance with health regulations. The Alcalde and the Regidores de la Municipalidad de Palmares, or whoever holds their respective offices, are hereby ordered, UNDER PENALTY OF DISOBEDIENCE, to provide a definitive solution to the public-health problem caused by the Mercado Municipal de Palmares within the NON-EXTENDABLE PERIOD OF TWO YEARS; and Eduardo López Cárdenas, in his capacity as Ministro de Salud a.i., or whoever holds that office, is hereby ordered, UNDER PENALTY OF DISOBEDIENCE, to order the closure of the Mercado Municipal de Palmares if the problem at issue is not corrected within the specified period.
The State, the Instituto Costarricense de Acueductos y Alcantarillados, and the Municipalidad de Palmares are ordered to pay the damages and losses caused by the facts underlying this declaration, which shall be assessed in proceedings to enforce the judgment before the contentious-administrative jurisdiction. The respondents are advised that, pursuant to Article 71 of the Ley de esta jurisdicción, any person who receives an order issued in an amparo proceeding (recurso de amparo) that they must comply with or enforce, and who fails to comply with or enforce it, shall be subject to imprisonment for three months to two years, or a fine of twenty to sixty days, provided that the offense is not punishable by a more severe penalty. This decision shall be personally served on ALL OFFICIALS MENTIONED IN THE OPERATIVE PART OF THIS JUDGMENT, or on whoever holds those same offices in their stead.
Regarding this matter, the Alcalde de la Municipalidad de Palmares informs this Chamber that, at present, with respect to that canton’s water-treatment project, on March 27, 2023, Arq. Silvia Carazo Angulo, Encargada del Departamento de Ingeniería Municipal de Palmares, sent official letter MP-DU-108-2023 by email to the Jefe de Oficina Cantonal de Palmares, the Director Operación y Mantenimiento Región Central Oeste, and the Ingeniera Operación y Mantenimiento de la Región Central Oeste, all of the Instituto de Acueductos y Alcantarillados del cantón de Palmares, thereby delivering to them the hydrogeological variable (variable hidrogeológica) forming part of the Plan Regulador del Cantón de Palmares process. This input was required so that the Institute could complete the sewage and wastewater treatment system (sistema de tratamiento de aguas negras y residuales) for the canton of Palmares, in accordance with AYA’s Plan de Inversión de Saneamiento 20212026.
He adds that the Municipalidad “is in (sic) constant meetings with AYA officials from the regional office in Palmares for the purpose of coordinating the project’s development, since that institute is responsible for obtaining the public funds for its construction. The Municipalidad de Palmares is therefore awaiting AyA’s submission of the construction project for approval, in accordance with the regulations governing wastewater treatment.” From the factual circumstances described, insofar as they concern the failure to construct the water-treatment plant in the Municipalidad de Palmares, which is alleged against that Municipalidad and the Instituto de Acueductos y Alcantarillados, this matter shall be severed for processing under expediente 02-7556-0007-CO.
Insofar as the proceeding concerns the lack of waste and sewage treatment infrastructure and sewer systems in the municipalities of Jacó, Nombre02, and Golfito, a review of the reports submitted under oath and the evidence provided shows that, despite the need for a waste and sewage treatment plant and sewer system in those areas—in the same sense indicated in the preceding Considerando IV concerning the Municipalidad de Palmares—the respondent authorities reveal that the cantons of Jacó, Nombre02, and Golfito likewise lack the infrastructure necessary to carry out wastewater treatment processes in accordance with applicable national legislation and technical regulations.
Regarding that omission, the representative of the Ministerio de Hacienda explains to this Chamber in his report that, although a loan agreement to finance the Programa de Saneamiento de Zonas Prioritarias was approved in 2019 through ley 9723 and entered into with Banco KFW Frankfurt am Main (hereinafter KFW, published in Alcance 210 to Gaceta 183 of September 27, 2019), the fact remains that, for that program—which was intended to construct wastewater sanitation infrastructure, including a sewer system, a water collection network, a treatment plant, and, in the case of the city of Palmares, a Centro de Investigación y Formación en Tecnologías de Saneamiento—the Ministerio de Hacienda deemed it necessary for AyA to prepare an action plan, which it had already requested in November 2022 through official letter MH-DM-OF-2702-2022.
In the report, the representative of the Ministerio de Hacienda emphasizes that the Dirección de Crédito Público of that Ministry had requested on several occasions that the Unidad Ejecutora del Programa prepare a plan defining the courses of action to be taken by the Administración Superior del Instituto Costarricense de Acueductos y Alcantarillados to reassess the scope of the Program and its increased costs. This was due to the Program’s critically poor performance results, since at that time, according to the Cronograma del Acuerdo Separado del Préstamo, the works for the four sanitation projects were clearly delayed: they should have begun in July 2021, whereas the calls for tenders would not be published until the second quarter of 2023.
He further reports that the Ministerio de Hacienda warned the Instituto Costarricense de Acueductos y Alcantarillados of the severe impact on the Program’s monitoring indicators caused by the complete lack of disbursement of loan funds as of December 31, 2022, considering that the loan had entered into force in September 2019. He explains that, for the Ministerio de Hacienda, it was particularly important for the Unidad Ejecutora del Programa to make the required decisions and submit the specified action plan, establishing clear and precise planning to achieve the Program’s prompt acceleration and setting out the activities, responsible parties, and compliance deadlines that would definitively resolve, among other matters, the exponential increase in the Program’s total cost. Nevertheless, the repeated requests were disregarded.
Based on the foregoing situation, through official letter number MH-DM-OF-1303-2023 of August 2023, the Ministerio de Hacienda asked AyA to coordinate the appropriate actions for an orderly termination of the credit operation and the other activities associated with the financing. He explains that this request arose from statements by the Instituto Costarricense Acueductos y Alcantarillados concerning the impossibility of completing, in their intended number and scope, the projects initially agreed upon with KFW using the amount provided under the loan agreement.
For his part, the representative of respondent AyA adds in his report that, in view of the changes to the treatment-plant construction projects for the four cantons (Jacó, Palmares, Nombre02, and Golfito) and the directive from the Ministerio de Hacienda ordering the termination of the credit operation intended to fund that infrastructure, the Presidencia Ejecutiva del AyA is preparing an analysis of risks, implications, and actions to be undertaken from legal, financial, technical, and environmental perspectives. This analysis is intended to facilitate the proposal of other alternatives and the definition of a feasible financing strategy that will enable the Program to be carried out (AyA report).
However, the report submitted by the representative of respondent AyA neither informs this Chamber, nor does the evidence added to the expediente show, the project’s stage of development, if any, or what actions have been taken to remedy the lack of treatment plants in the various cantons of Palmares, Jacó, Nombre02, and Golfito.
In accordance with the considerations set forth, the Chamber finds it established that, five years after the loan to finance the sanitation program for the priority areas of Golfito, Nombre02 Palmares and Jacó, entered into with KFW, was approved by law and published in Supplement 210 to La Gaceta 183 of 27 de setiembre del 2019, it has been in the closing phase since agosto de 2023 due to the lack of implementation. This Chamber notes with concern that, since 2022, the Ministry of Finance had asked AyA to prepare an action plan so that the loan could be secured; however, to date AyA has not responded to the Ministry of Finance. Nor has it proposed any strategy, much less begun construction of the infrastructure works for wastewater sanitation (saneamiento de aguas residuales) and the related facilities for the cantons of Palmares, Jacó, Golfito and Quepos.
Accordingly, the alleged violation of fundamental rights (derechos fundamentales) by the Ministry of Finance is dismissed, and the amparo action (recurso) is granted insofar as it is directed against AyA, because this Chamber observes that the respondent authority (autoridad recurrida) has not only failed to provide a definitive solution to the reported problems, but there is also no indication that it has devised an alternative strategy in response to the closing of the loan entered into with KFW, of Germany.
It is also observed that the municipalities in question have not taken definite and concrete action to press AyA to fulfill its legal duty to provide the residents of their jurisdictions with a sewage disposal service (servicio de evacuación de aguas negras), as required by the Ley Constitutiva Instituto Costarricense Acueductos y Alcantarillados), or to coordinate a solution to the water-related problem described.
As this Court has stated on other occasions, it understands that some environmental problems require coordination among various government entities; however, this does not justify AyA, within the scope of its powers and in view of the needs of the governed population (administrados), simply deciding in this case not to respond to the notices sent by the Ministry of Finance urging it to act since 2022, or failing to submit the action plan requested of it to establish clear and precise planning aimed at promptly accelerating the loan agreement to finance the sanitation program for priority areas.
In short, there is no indication that significant efforts were made to implement the loan agreement to finance the sanitation program for priority areas, or that the necessary actions were taken in coordination with the corresponding municipal and health authorities to provide solutions to the lack of water sanitation. Consequently, the action must be granted insofar as it is directed against the Instituto de Acueductos y Alcantarillados and the municipalities of Jacó, Golfito and Quepos, because the petitioner’s right to a healthy and ecologically balanced environment (derecho a un ambiente sano y ecológicamente equilibrado) was violated.
VI.Conclusion. Accordingly, insofar as the action is directed against the Municipalidad de Palmares, the petitioner must abide by the ruling in judgment number 03-01431 at 10:53 hours on 21 de febrero de 2003, which granted the action filed on 18 de setiembre de 2002. Insofar as it is directed against the Ministry of Finance, the action must be dismissed, and it is partially granted insofar as it is directed against AyA and the municipalities of Garabito, Golfito and Quepos, for violation of the petitioner’s right to a healthy and ecologically balanced environment, under the terms set forth in the operative part (parte dispositiva) of this judgment.
The parties are hereby advised that, if they have submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical or telematic device or produced using new technologies, these must be retrieved from the Court within a maximum period of 30 business days following service of this judgment. Otherwise, any such material not retrieved within that period shall be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena at session N° 27-11 of 22 de agosto del 2011, article XXVI, and published in Boletín Judicial number 19 of 26 de enero del 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 de mayo del 2012, article LXXXI.
Por tanto:
The action is partially granted for violation of the right to a healthy and ecologically balanced environment. Insofar as the action is directed in part against the Municipalidad de Palmares and the Instituto de Acueductos y Alcantarillados with respect to that Municipality, this matter shall be severed for processing under case file 02-7556-0007-CO. Insofar as the action is directed against the municipalities of Garabito, Golfito and Nombre02 and the Instituto de Acueductos y Alcantarillados with respect to those municipalities, the action is granted. Luis Alejandro Guillén Guardia, in his capacity as executive president of the Instituto Costarricense de Acueductos y Alcantarillados; Jong Kwan Kim Jin, in his capacity as mayor of Nombre02; Freiner Lara Blanco, in his capacity as mayor of Golfito; and Tobías Murillo Rodríguez, in his capacity as mayor of Garabito, or whoever may hold those offices, are ordered, within the scope of their powers and within eighteen months following service of this judgment, to take the appropriate measures and arrange and coordinate the construction of a sewage treatment plant (planta de tratamientos de aguas negras) and sewerage system (alcantarillado) for the respective localities of Quepos, Golfito and Garabito.
Those authorities are ordered to include in their budgets the appropriations necessary to construct the aforementioned treatment plant and sewerage system, and to provide the petitioner with details of the budget allocated for that purpose, as well as a schedule of activities so that the petitioner may monitor compliance with the stages of construction; all with the understanding that they must complete the specified task within a reasonable period, which may not exceed two years. The respondent authorities are warned that, pursuant to article 71 of the Ley de la Jurisdicción Constitucional, any person who receives an order issued in an amparo proceeding (recurso de amparo) that the person must comply with or enforce, and who fails to comply with or enforce it, shall be subject to imprisonment for three months to two years or a fine of twenty to sixty days, provided that the offense is not punishable by a more severe penalty.
The Instituto Costarricense de Acueductos y Alcantarillados and the Municipalidades de Quepos, Golfito and Garabito are ordered to pay the legal costs, damages and losses arising from the events underlying this declaration, which shall be assessed during enforcement of the judgment before the administrative litigation jurisdiction (jurisdicción de lo contencioso administrativo). Insofar as the action is directed against the Ministry of Finance, it is denied. The Ministro de Salud shall be notified so that he may coordinate efforts with the respondents and oversee the construction of the aforementioned treatment plants and infrastructure in each locality in accordance with health regulations.

Revisión del Documento *230215890007CO* SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del uno de agosto de dos mil veinticuatro .
Recurso de amparo que se tramita en expediente nro. 23-021589-0007-CO, interpuesto por, [Nombre01 001], cédula de identidad [Valor CED02], contra INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS, MINISTERIO DE HACIENDA, MUNICIPALIDADES DE GOLFITO, Nombre02 Y GARABITO, AMPLIADO A LA MUNICIPALIDAD DE PALMARES.
Resultando:
Ante dicha problemática las comunidades de Golfito, Quepos, Jacó y Palmares habían sido incluidas en el Programa de Saneamiento en Zonas Prioritarias, autorizándose así la construcción de plantas de tratamiento y sus respectivos alcantarillados sanitarios A continuación se detalla el contenido del mismo: “En función del financiamiento disponible, se plantearon diferentes escenarios de aprovechamiento de la inversión. Los cambios en los proyectos a considerar se debieron a la oposición de la Municipalidad y la Marina Bahía Golfito sobre la ubicación de la futura Planta de Tratamiento de Aguas Residuales, conforme con lo descrito en el documento PRE-2023-00493 (adjunto). La necesidad de ajustarse a las condiciones sociales actuales en el Proyecto del Alcantarillado Sanitario de Golfito dio como resultado la propuesta para la ejecución de los proyectos de Jacó y Palmares, con un alcance acorde con los recursos disponibles.
Durante la misión de junio del 2023 con el Banco KfW, la cual contó con la participación del Ministerio de Hacienda, se determinó la necesidad de valorar la pertinencia y urgencia del Programa por parte del prestatario. Bajo esta premisa, el Ministerio de Hacienda mediante nota MH-DM-OF-1303-2023 del 16 de agosto, solicitó al AyA proceder a coordinar las acciones que correspondan para realizar el cierre ordenado de la operación del crédito y demás actividades asociadas al mismo. Con respecto a las acciones que tomará la Presidencia Ejecutiva ante la decisión del Ministerio de Hacienda, en calidad de prestatario del Contrato de Préstamo 28568, la Administración Superior se encuentra construyendo un análisis de riegos, implicaciones y acciones a desarrollar, desde el punto de vista legal, financiero, técnico y ambiental, que faciliten la propuesta de otras alternativas y la definición de una estrategia factible de financiamiento que permita la consecución del programa” Pide se declare sin lugar el recurso.
Al respecto, en la Minuta de la Reunión de fecha 22 de junio de 2023 realizada con motivo de la misión de supervisión de KFW se manifestó lo siguiente: Ampliación de plazo de desembolso: Se menciona la incertidumbre sobre los costos para el Prestatario en caso de que éste rescinda el Contrato de Préstamo o ante una posible prórroga y la necesidad de tener información proyectada al respecto, para tomar decisiones. Se destaca que no puede garantizarse un monto concreto para cada tema al momento de la reunión. A pesar de esto, para el Ministerio de Hacienda sí es necesario el contar con la información citada para analizar escenarios realistas que apoyen la toma de decisiones oportunas, por lo que le solicita al KfW brindar una estimación al respecto. (La negrita no pertenece al original) Información que una vez revisada desde el ámbito técnico y valoradas sus implicaciones, llevó al Ministerio de Hacienda a tomar la decisión de solicitar el cierre de la operación de crédito, por considerarse beneficioso a los intereses del Estado que la presente Cartera protege conforme sus competencias.
Se reitera que la decisión de acortar el alcance de los proyectos de 4 a 2 con un alcance reducido en el marco del Programa, fue una decisión gestada desde el seno del propio Instituto Costarricense de Acueductos y Alcantarillados, en la cual el Ministerio de Hacienda no tuvo ninguna injerencia. Asimismo, se hace énfasis en que este Ministerio no instruyó de ninguna manera a dejar sin contenido presupuestario el Programa, siendo que el Instituto Costarricense de Acueductos y Alcantarillados técnica y legalmente está en capacidad de llevar a cabo las obras del Programa con los recursos que presupueste para ello. III. Petitoria Al amparo de las razones de hecho y de derecho expuestas, solicito declarar sin lugar el recurso de amparo interpuesto por el señor [Nombre01 001], ya que este Ministerio dentro de sus competencias se ha ajustado a lo dispuesto por la normativa y no ha violentado los derechos fundamentales a la Salud, al Ambiente Sano y Ecológicamente Equilibrado, y la Protección de las Bellezas Naturales”.
En ese mismo sentido, el numeral 2° establece las funciones legales que el constituyente a AyA, a saber:
"a) Dirigir y vigilar todo lo concerniente para proveer a los habitantes de la república de un servicio de agua potable, recolección y evacuación de aguas negras y residuos industriales líquidos y de aguas pluviales en las áreas urbanas; b) Determinar la prioridad, conveniencia y viabilidad de los diferentes proyectos que se propongan para construir, reformar, ampliar, modificar obras de acueductos y alcantarillados, las cuales no se podrán ejecutar sin su aprobación; c) Promover la conservación de las cuencas hidrográficas y la protección ecológica, así como el control de la contaminación de las aguas (…); g) Administrar y operar directamente los sistemas de acueductos y alcantarillados en todo el país, los cuales se irán asumiendo tomando en cuenta la conveniencia y disponibilidad de recursos. Los sistemas que actualmente están administrados y operados por las corporaciones municipales podrán seguir a cargo de éstas, mientras suministren un servicio eficiente.
Bajo ningún concepto podrá delegar la administración de los sistemas de acueductos y alcantarillado sanitario del Área Metropolitana.
Tampoco podrá delegar la administración de los sistemas sobre los cuales exista responsabilidad financiera y mientras ésta corresponda directamente al Instituto.
Queda facultada la institución para convenir con organismos locales, la administración de fales servicios o administrarlos a través de juntas administradoras de integración mixta entre el instituto y las respectivas comunidades, siempre que así conviniere para la mejor prestación de los servicios y de acuerdo con los reglamentos respectivos. Por las mismas razones y con las mismas características, también podrán crearse juntas administradoras regionales que involucren a varias municipalidades, (...)
TERCERO: Para cumplir con lo ordenado en el expediente 02-007756-0007-CO, mediante resolución de las catorce horas treinta minutos del tres de febrero del dos mil quince, en lo que respecta a la Municipalidad de Palmares, dispuso"(...) disponer lo necesario a efecto que en el término improrrogable de un año contado a partir de la notificación de esta resolución, se le suministre el Plan Regulador del Cantón de Palmares a este Instituto, a fin de que dentro de los tres años y medio siguientes se concluya con el sistema de tratamiento de aguas negras y residuales del cantón de Palmares," en fecha 27 de marzo del 2023, al ser las diez horas 00n catorce minutos, la Arq. Silvia Carazo Angulo, Encargada del Departamento de Ingeniería Municipal a.i., remitió a través de correo electrónico a los representantes del Instituto de Acueductos y Alcantarillados del cantón de Palmares, señores Pedro Barrantes Ramírez, Jefe de Oficina Cantonal de Palmares, Melvin Castro González, Director Operación y Mantenimiento Región Central Oeste, y Tatiana Vindas Valerio, Ingeniera Operación y Mantenimiento de la Región Central Oeste, el oficio MP-DU-108-2023, haciéndoles entrega de la variable hidrogeológica que conforma el proceso del Plan Regulador del Cantón de Palmares, cumpliendo de esta forma en la entrega del insumo requerido para que dicho Instituto pueda concluir el sistema de tratamiento de aguas negras y residuales del cantón de Palmares, ello conforme al Plan de Inversión de Saneamiento 20212026 de AYA.
El estudio hidrogeológico realizado, tal y como consta en el apartado 1.1 Justificación, constituye el insumo y nace como una necesidad de generar conocimiento técnico en temas relacionados con disponibilidad, calidad y vulnerabilidad del recurso hídrico subterráneo, para que las instituciones tomadoras de decisiones cuenten con mayor información técnico científica.
Siendo así, de parte de la Municipalidad de Palmares no existe documento requerido por AyA pendiente para que éste Instituto pueda concluir el sistema de tratamiento de aguas negras y residuales del cantón de Palmares, ya que la restante normativa legal aplicable es la respectiva a trámites de construcción, regulados por la Ley de Construcciones y su respectivo reglamento, el cual es de alcance nacional, mismo al que se encuentran sujetos ambas instituciones públicas" (…)PETICIONES: Por Io tanto, al haber entregado la Municipalidad de Palmares la variable hidrogeológica del proceso del Plan Regulador, misma que era requerida por AyA para concluir el sistema de tratamiento de aguas negras y residuales del cantón de Palmares, solicito que se tenga por cumplido por parte de mi representada lo ordenado por la Sala Constitucional de la Corte Suprema de Justicia.” Pide se declare sin lugar el recurso.
Redacta la Magistrada Alvarado Paniagua; y,
Considerando:
El accionante expone que no existe planta de tratamiento, ni alcantarillado sanitario en el distrito central de Palmares (situación conocida en el expediente nro. 02- 007756-0007-CO). Indica que, en Garabito, propiamente Jacó, la situación es similar a la de Palmares, pues los ciudadanos se ven afectados por gran contaminación antrópica en sus quebradas y ríos, trayendo muerte a la vida fluvial y problemas de salud a los pobladores, a los ecosistemas fluviales y marinos. Comenta que, al parecer, el saneamiento de las aguas nunca ha sido prioridad de los recurridos. Ante dicha problemática las comunidades de Golfito, Quepos, Jacó y Palmares habían sido incluidas en el Programa de Saneamiento en Zonas Prioritarias, autorizándose así la construcción de plantas de tratamiento y sus respectivos alcantarillados sanitarios. No obstante, reclama que el ministro de Hacienda mediante el oficio MH-DM-OF-1303-2023 de fecha 16 de agosto de 2023, le comunicó al presidente ejecutivo del Instituto de Acueductos y Alcantarillados (ICAA) la cancelación del programa.
Añade que la eliminación del presupuesto y financiamiento de los proyectos de las 4 comunidades, se da bajo el burdo argumento que no existe prontitud en materializar las obras ni la obtención de actos habilitadores necesarios. Incluso, parte de la argumentación es que el presidente del ICAA solicitó al ministro de Hacienda eliminar del cronograma de actividades y financiamiento a los proyectos de Nombre02 y de Golfito, queriendo dejar solo los Palmares y Jacó. Reclama que ninguno de los 4 proyectos se llevarán a cabo por orden del Ministro de Hacienda, que dispuso dejar el Programa de Saneamiento en Zonas Prioritarias sin contenido presupuestario, asunto que conlleva al cierre irracional de la materialización de todas las obras en las 4 ciudades. Acusa que la actuación de las autoridades recurridas, violenta los numerales 21, 50 y 89 constitucionales, pues se entrará en un periodo desenfrenado, así como irreversible de daños ambientales perjudicando derechos de gente que incluso no ha nacido.
Solicita declarar con lugar el recurso y ordenar a las recurridas tomar las acciones pertinentes para activar la fuente de financiamiento de los proyectos de plantas de tratamiento y alcantarillados sanitarios de Palmares, Jacó, Nombre02 y Golfito.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque la autoridad recurrida haya omitido referirse a ellos, según lo prevenido en el auto inicial:
En cuanto a la planta de tratamiento y alcantarillados de la Municipalidad de Palmares:
EN LOS MISMOS TÉRMINOS, SE LES ORDENA A ESAS AUTORIDADES QUE PREVEAN, DENTRO DE SUS PRESUPUESTOS, LAS PARTIDAS NECESARIAS PARA LA CONSTRUCCION DE LA REFERIDA PLANTA DE TRATAMIENTO, Y QUE LE SUMINISTREN AL RECURRENTE UNA NOTA DONDE SE DETALLE EL PRESUPUESTO QUE SE DESTINARA A ESE FIN, Y UN CRONOGRAMA DE ACTIVIDADES, CON EL OBJETO DE QUE SE PUEDA FISCALIZAR EL CUMPLIMIENTO DE LAS ETAPAS DE LA CONSTRUCCION; TODO ESTO, EN EL ENTENDIDO QUE DEBERAN FINALIZAR LA TAREA INDICADA, EN UN TÉRMINO RAZONABLE, QUE NO PODRA EXCEDER DE DOS AÑOS. ADEMAS, SE LE ORDENA A EDUARDO LOPEZ C ARDENAS, EN SU CALIDAD DE MINISTRO DE SALUD A.I., O A QUIEN OCUPE SU PUESTO, BAJO PENA DE DESOBEDIENCIA, QUE COORDINE ESFUERZOS CON LOS OTROS RECURRIDOS Y FISCALICE QUE LA ME NCIONADA PLANTA DE TRATAMIENTO SE CONSTRUYA DE CONFORMIDAD CON LA NORMATIVA DE SALUD. SE LE ORDENA AL ALCALDE Y A LOS REGIDORES DE LA MUNICIPALIDAD DE PALMARES, O A QUIENES OCUPEN SUS CARGOS, BAJO PENA DE DESOBEDIENCIA, QUE DEN SOLUCION DEFINITIVA AL PROBLEMA SANITARIO PROVOCADO POR EL MER CADO MUNICIPAL DE PALMARES, EN EL PLAZO IMPRORROGABLE DE DOS AÑOS, Y A EDUARDO LOPEZ CARDENAS, EN SU CALIDAD DE MINISTRO DE SALUD A.I., O A QUIEN OCUPE SU PUESTO, BAJO PENA DE DESOBEDIENCIA, QUE ORDENE EL CIERRE DEL MERCADO MUNICIPAL DE PALMARES, SI EL PROBLEMA DE MARRAS NO ES CORREGIDO EN EL PLAZO INDICADO” (ver expediente número 02-007756-0007-CO, traído ad efectum videndi et probandi).
En cuanto a la planta de tratamiento y alcantarillados de Jacó, Nombre02 y Golfito d) Mediante la Ley número 9723 de fecha 14 de agosto de 2019, se aprobó Contrato de préstamo N° 28568 para financiar el programa de saneamiento de zonas prioritarias, suscrito con el Banco KFW Frankfurt am Main (en adelante KFW), publicada en el Alcance 210 a la Gaceta 183 del 27 de setiembre del 2019. Dicho Programa consta de cuatro componentes, para construir las obras de infraestructura en cuatro ciudades de Costa Rica, las cuales han sido escogidas como prioritarias según varios criterios técnicos de selección que implican entre otros el impacto sobre la población beneficiaria, el impacto ambiental y económico del proyecto, que son: Palmares, Jacó, Nombre02 y Golfito. Se dispone que en cada una de ellas se construirán obras de infraestructura para el saneamiento de aguas residuales que incluyen la construcción del alcantarillado, la red de recolección de aguas, una planta de tratamiento y en el caso de la ciudad de Palmares un Centro de Investigación y Formación en Tecnologías de Saneamiento. (ver informe de Ministerio de Hacienda y portal de la Asamblea Legislativa: Archivo_Leyes - Contrato de préstamo N° 28568 para financiar... (asamblea.go.cr)).
También se le externó al Instituto Costarricense de Acueductos y Alcantarillados que el tipo de situaciones mostradas para el caso particular con el KFW se consideraban relevantes debido a que en otros Programas similares de la Institución ya se habían también evidenciado, generando incertidumbre en cuanto a la eficacia y eficiencia con que se estaban aplicando las lecciones aprendidas generadas en los Programas/proyectos de la Cartera del Instituto en ejecución y finalizados. Posterior a ello, la Declaración desierta del concurso de Precalificación de las empresas, implicó que luego el Instituto Costarricense de Acueductos y Alcantarillados tomara la decisión de iniciar nuevamente los procesos de contratación, pero de forma individual (por proyecto), por lo que se le hizo ver la preocupación sobre el plazo que desde ese momento el citado Instituto ya estimaba iba a requerir de más, para concluir el Programa y que correspondía a 24 meses adicionales (ver informe).
Sin embargo, al Ministerio de Hacienda mediante nota MH-DM-OF-1303-2023 del 16 de agosto, al AyA proceder a coordinar las acciones que correspondan para realizar el cierre ordenado de la operación del crédito y demás actividades asociadas al mismo, la Presidencia Ejecutiva del AyA, se encuentra construyendo un análisis de riegos, implicaciones y acciones a desarrollar, desde el punto de vista legal, financiero, técnico y ambiental, que faciliten la propuesta de otras alternativas y la definición de una estrategia factible de financiamiento que permita la consecución del programa (informe del AyA).
Para cumplir, efectivamente, con la protección a un ambiente sano y ecológicamente equilibrado, el Estado, entendido en sentido amplio, está en el deber de disponer de las medidas necesarias para que en las comunidades del país se brinde tratamiento oportuno y efectivo a las aguas negras. En ese sentido, este Tribunal Constitucional ha sido del criterio que, tanto al Instituto Costarricense de Acueductos y Alcantarillados, como a las Municipalidades y al Ministerio de Salud, les corresponde -dentro de sus respectivos ámbitos de competencia-, velar por la debida recolección, tratamiento y disposición final de tales aguas. Así, en el caso específico del Instituto Costarricense de Acueductos y Alcantarillados, su propia Ley Constitutiva -Ley No. 2726 de 14 de abril de 1961 y sus reformas-, dispone lo siguiente:
“Artículo 1.- Con el objeto de dirigir, fijar políticas, establecer y aplicar normas, realizar y promover el planeamiento, financiamiento y desarrollo y de resolver todo lo relacionado con el suministro de agua potable y recolección y evacuación de aguas negras y residuos industriales líquidos, lo mismo que el aspecto normativo de los sistemas de alcantarillado pluvial en áreas urbanas, para todo el territorio nacional se crea el Instituto Costarricense de Acueductos y Alcantarillados, como institución autónoma del Estado.” Por lo que a dicha institución le corresponde, conforme a lo dispuesto en el artículo 2° de ese mismo cuerpo normativo (…) Dirigir y vigilar todo lo concerniente para proveer a los habitantes de la república de un servicio de agua potable, recolección y evacuación de aguas negras y residuos industriales líquidos y de aguas pluviales en las áreas urbanas (…)”. De igual forma, la Ley General de Salud -Ley No. 5395 de 30 de octubre de 1973-, dispone, en su artículo 2°, que le corresponde al Poder Ejecutivo, a través del Ministerio de Salud, la definición de la política nacional de salud, planificación y coordinación de todas las actividades públicas y privadas relativas a salud, así como la ejecución de aquellas actividades que le competen conforme a la ley.
De igual forma, el artículo 341 de la referida ley establece, dentro de las atribuciones del Ministerio de Salud, la de ordenar y tomar las medidas especiales que habilita esa normativa para evitar el riesgo o daño a la salud de las personas o que éstos se difundan o se agraven y para inhibir la continuación o reincidencia en la infracción de los particulares. En cuanto al tema específico, la Ley General de Salud, en su Libro 1, Título 3, Capítulo 3, “De las obligaciones y restricciones para la evacuación sanitaria de excretas y aguas servidas”, dispone -en lo conducente-, lo siguiente:
“Artículo 285.- Las excretas, las aguas negras, las servidas y las pluviales, deberán ser eliminadas adecuada y sanitariamente a fin de evitar la contaminación del suelo y de las fuentes naturales de agua para el uso y consumo humano, la formación de criaderos de vectores y enfermedades y la contaminación del aire mediante condiciones que atenten contra su pureza o calidad.” (El destacado no forma parte del original).
“Artículo 287.- Toda persona, natural o jurídica, propietaria de viviendas o de establecimientos o edificios en que las personas desarrollen sus actividades, responderá de que tales bienes dispongan de un sistema de disposición de excretas y de aguas negras y servidas aprobado por el Ministerio y los usuarios de viviendas, establecimientos o edificios estarán obligados a mantener dicho sistema en buenas condiciones de funcionamiento.” “Artículo 288.- Todo propietario queda obligado a conectar el sistema de eliminación de excretas de aguas negras y servidas de su propiedad al alcantarillado sanitario en los lugares en que éste estuviera en funcionamiento, salvo en los casos de excepción que los reglamentos pertinentes reconozcan como procedentes.” Asimismo, de dicha normativa se colige la obligación de las autoridades del Ministerio de Salud de velar por la aplicación y el control del cumplimiento de las disposiciones de esa ley y de su reglamentación, sin perjuicio de las facultades y obligaciones que leyes especiales otorguen e impongan a otros órganos o entes públicos dentro de sus respectivos campos de acción (artículo 337).
Se corrobora, así, las distintas funciones y obligaciones que el ordenamiento jurídico le impone al Instituto Costarricense de Acueductos y Alcantarillados, y al Ministerio de Salud, en materia de recolección, tratamiento y disposición final de las aguas negras. Funciones y obligaciones que, además -y como ya se adelantó en el considerando anterior-, se deben ejercer de forma coordinada, para asegurar así la eficacia y eficiencia administrativas.
IV.De la falta de una planta de tratamiento de desechos y aguas negras en Palmares. El recurrente reclama que a la fecha de interposición de este recurso, aun no se cuenta con una planta de tratamiento de desechos y aguas negras en diversos cantones. En cuanto el recurso se refiere a la falta de infraestructura del Cantón de Palmares en particular, en el informe dado en este asunto por el representante del AyA, este pide a la Sala tomar en cuenta lo dispuesto por el voto 03-01431 de las 10:53 horas del 21 de febrero de 2003, que dispuso acoger el recurso planteado el 18 de setiembre de 2002, por el mismo recurrente [Nombre01 002]. Recuerda que en esa oportunidad, esta Sala ordenó a los recurridos Instituto Costarricense de Acueductos y Alcantarillados y la Municipalidad de Palmares así como al Ministerio de Salud que iniciaran las gestiones para construir una planta de tratamiento en el término de 12 meses.
Efectivamente, en el año 2003, dispuso al efecto este Tribunal: “Se declara CON LUGAR el recurso. Se le ORDENA Jorge Isaac Vásquez Pérez, en su condición de Alcalde Municipal de Palmares, y a Heidi Ramírez Sánchez, Luis Carlos Araya Badilla, Coralia Pacheco Moreira, Oldemar Segura Rodríguez, y Miguel Ángel Vásquez, en su condición de Regidores de la Municipalidad de Palmares, y a Everardo Rodríguez Bastos, en su calidad de Presidente Ejecutivo del Instituto Costarricense de Acueductos y Alcantarillados, o a quien en su lugar ejerza sus cargos, BAJO PENA DE DESOBEDIENCIA, que en el término improrrogable de DOCE MESES contado a partir de la notificación de esta sentencia, gestionen la construcción de una planta de tratamientos de aguas negras para toda la localidad de Palmares, para lo cual se deberá incluir la presentación de un estudio de impacto ambiental a la SETENA. En los mismos términos, se les ordena a esas Autoridades que prevean, dentro de sus presupuestos, las partidas necesarias para la construcción de la referida planta de tratamiento, y que le suministren al recurrente una nota donde se detalle el presupuesto que se destinará a ese fin, y un cronograma de actividades, con el objeto de que se pueda fiscalizar el cumplimiento de las etapas de la construcción; todo esto, en el entendido que deberán finalizar la tarea indicada, en un término razonable, que no podrá exceder de DOS AÑOS.
Además, se le ordena a Eduardo López Cárdenas, en su calidad de Ministro de Salud a.i., o a quien ocupe su puesto, BAJO PENA DE DESOBEDIENCIA, que coordine esfuerzos con los otros recurridos y fiscalice que la mencionada planta de tratamiento se construya de conformidad con la normativa de Salud. Se le ordena al Alcalde y a los Regidores de la Municipalidad de Palmares, o a quienes ocupen sus cargos, BAJO PENA DE DESOBEDIENCIA, que den solución definitiva al problema sanitario provocado por el Mercado Municipal de Palmares, en el plazo IMPRORROGABLE DE DOS AÑOS, y a Eduardo López Cárdenas, en su calidad de Ministro de Salud a.i., o a quien ocupe su puesto, BAJO PENA DE DESOBEDIENCIA, que ordene el cierre del Mercado Municipal de Palmares, si el problema de marras no es corregido en el plazo indicado. Se condena al Estado, al Instituto Costarricense de Acueductos y Alcantarillados y a la Municipalidad de Palmares, al pago de los daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo.
Se le advierte los recurridos que, de conformidad con el artículo 71 de la Ley de esta jurisdicción, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Notifíquese la presente resolución TODOS LOS FUNCIONARIOS MENCIONADOS EN LA PARTE DISPOSITIVA DE ESTA SENTENCIA, o a quienes ocupen esos mismos puestos en su lugar, EN FORMA PERSONAL Sobre este extremo, el Alcalde de la Municipalidad de Palmares informa a esta Sala que, en la actualidad, en lo que se refiere al proyecto de tratamiento de aguas de ese Cantón, desde el 27 de marzo del 2023, la Arq. Silvia Carazo Angulo, Encargada del Departamento de Ingeniería Municipal de Palmares, remitió a través de correo electrónico al Jefe de Oficina Cantonal de Palmares, al Director Operación y Mantenimiento Región Central Oeste, y a la Ingeniera Operación y Mantenimiento de la Región Central Oeste todos del Instituto de Acueductos y Alcantarillados del cantón de Palmares, el oficio MP-DU-108-2023, haciéndoles entrega de la variable hidrogeológica que conforma el proceso del Plan Regulador del Cantón de Palmares, insumo requerido para que dicho Instituto pueda concluir el sistema de tratamiento de aguas negras y residuales del cantón de Palmares, conforme al Plan de Inversión de Saneamiento 20212026 de AYA.
Añade que la Municipalidad “está en (sic) constantes reuniones con los personeros de AYA, oficina regional de Palmares, con la finalidad de coordinar que el proyecto se desarrolle, ello en razón de que es competencia de dicho instituto buscar los fondos públicos para la construcción del mismo, por lo que, la Municipalidad de Palmares está a la espera de que AyA presente el proyecto constructivo para aprobación, conforme la normativa que regula el tratamiento de aguas residuales”.
Del cuadro fáctico descrito, en cuanto a la falta de construcción de la planta de tratamiento de aguas en la Municipalidad de Palmares, que se reclama a esa Municipalidad y al Instituto de Acueductos y Alcantarillados; desglósese este asunto para que sea tramitado en el expediente 02-7556-0007-CO.
En cuanto el recurso se refiere a la falta de infraestructura de tratameinto de desechos y aguas negras y alcantarillados en las municipalidades de Jacó Nombre02 y Golfito; luego de revisados los informes rendidos bajo la solemnidad de juramento, así como la prueba aportada, se desprende que pese a la necesidad de contar en esas zonas con la planta de tratamiento de desechos y aguas negras y alcantarillado, – en el mismo sentido indicado en el Considerando IV anterior, referido a la Municipalidad de Palmares- en los cantones de Jacó, Nombre02 y Golfito, las autoridades recurridas revelan que, tampoco cuentan con esa infraestructura, necesaria para para ejecutar los procesos de tratamiento de las aguas residuales, según la legislación nacional y normativa técnica aplicable.
Sobre la omisión apuntada, el representante del Ministerio de Hacienda explica a esta Sala en su informe que, si bien desde el año 2019 por la ley 9723 se aprobó un contrato de préstamo para financiar el programa de saneamiento de zonas prioritarias, suscrito con el Banco KFW Frankfurt am Main (en adelante KFW, publicado en el Alcance 210 a la Gaceta 183 del 27 de setiembre del 2019). Lo cierto es que tal programa, -para construir las obras de infraestructura para el saneamiento de aguas residuales que incluyen la construcción del alcantarillado, la red de recolección de aguas, una planta de tratamiento y en el caso de la ciudad de Palmares un Centro de Investigación y Formación en Tecnologías de Saneamiento-, el Ministerio de Hacienda estimó necesario que el AyA hiciera un plan de acción, que ya había solicitado en noviembre del 2022, mediante el oficio MH-DM-OF-2702-2022.
En el informe, el representante del Ministerio de Hacienda hace énfasis en que la Dirección de Crédito Público de esa Cartera había solicitado un Plan a la Unidad Ejecutora del Programa en distintas oportunidades; que definiera las líneas de acción por parte de la Administración Superior del Instituto Costarricense de Acueductos y Alcantarillados para revalorar el alcance del Programa y el aumento en los costos del mismo. Lo anterior dado los críticos resultados de desempeño mostrados por el Programa, donde a ese momento, según el Cronograma del Acuerdo Separado del Préstamo, las obras de los cuatro proyectos de saneamiento mostraban un evidente retraso pues debieron haber iniciado en julio de 2021, cuando las licitaciones serían publicadas hasta el segundo trimestre del 2023.
Informa además, que el Ministerio de Hacienda advirtió al Instituto Costarricense de Acueductos y Alcantarillados, el alto impacto en los indicadores de seguimiento del Programa, debido a la nula ejecución de recursos del préstamo al 31 de diciembre 2022, considerando que su entrada en vigencia data desde setiembre 2019. Explica que para el Ministerio de Hacienda, la toma de decisiones que la Unidad Ejecutora del Programa requería y la presentación del Plan de acción indicado, en donde estableciera una planificación clara y precisa para lograr la pronta aceleración del mismo y plasmara las actividades, responsables y plazos de cumplimiento, que llevarían a resolver de forma definitiva, entre otros, el tema del incremento exponencial del costo total del Programa, resultaba de especial importancia, no obstante se hizo caso omiso a las reiteradas solicitudes.
Con base en la situación anterior, por el oficio número MH-DM-OF-1303-2023 de agosto de 2023, el Ministerio de Hacienda pidió al AyA, coordinar las acciones que correspondan para realizar el cierre ordenado de la operación del crédito y demás actividades asociadas al financiamiento; solicitud que explica obedece, a las manifestaciones del Instituto Costarricense Acueductos y Alcantarillados, respecto a la imposibilidad de llevar a término, en cantidad y alcance, los proyectos inicialmente consensuados con el KFW con el monto del contrato de préstamo.
Por su parte, el representante del AyA recurrido, añade en su informe que, en atención a los cambios en los proyectos de construcción de planta de tratamiento de los cuatro cantones (Jacó, Palmares, Nombre02 y Golfito) y ante la disposición del Ministerio de Hacienda que ordena el cierre de la operación de crédito para hacer dicha infraestructura, la Presidencia Ejecutiva del AyA se encuentra construyendo un análisis de riegos, implicaciones y acciones a desarrollar, desde el punto de vista legal, financiero, técnico y ambiental, que faciliten la propuesta de otras alternativas y la definición de una estrategia factible de financiamiento que permita la consecución del programa (informe del AyA).
Sin embargo, en el informe rendido por el representante del AyA recurrido, no se indica a esta Sala ni se desprende de la prueba aportada al expediente, qué desarrollo tiene el proyecto, si existiere, o qué acciones se han tomado, dirigidas a dar una solución a la falta de planta de tratamiento en los distintos cantones de Palmares, Jacó, Nombre02 y Golfito.
De conformidad con las consideraciones expuestas, la Sala tiene por acreditado que luego de cinco años que por ley se aprobó el préstamo para financiar el programa de saneamiento de zonas prioritarias de Golfito, Nombre02 Palmares y Jacó, suscrito con el KFW, publicado en el Alcance 210 a la Gaceta 183 del 27 de setiembre del 2019, el mismo se encuentra e en fase de cierre desde agosto de 2023, por la falta de ejecución. Llama la atención de esta Sala que el Ministerio de Hacienda pidió desde el año 2022 al AyA levantara un plan de acción para poder contar con el préstamos; sin embargo, a la fecha el AyA no ha respondido al Ministerio de Hacienda. Tampoco ha planteado alguna estrategia y mucho menos empezado a construir las obras de infraestructura para el saneamiento de aguas residuales y las construcciones que ello incluye, para los cantones de Palmares, Jacó, Golfito y Quepos.
Así las cosas, se descarta la vulneración a los derechos fundamentales que se atribuyen al Ministerio de Hacienda; y se acoge el recurso en cuanto se dirige contra el AyA, pues observa esta Sala que la autoridad recurrida no sólo no ha brindado una solución definitiva a los problemas denunciados, sino que tampoco se desprende que haya diseñado una estrategia distinta, ante el cierre del préstamo suscrito con el KFW, de Alemania.
Por otro lado se observa que tampoco las municipalidades en cuestión han tomado acciones definidas y concretas para impulsar a que el AyA asuma su deber legal de para proveer a los habitantes de sus circunscripciones de un servicio de evacuación de aguas negras, conforme lo dispone la Ley Constitutiva Instituto Costarricense Acueductos y Alcantarillados) y se dé de manera coordinada una solución al problema de aguas descrito.
Como en otras ocasiones se ha expuesto, comprende este Tribunal, que algunos problemas ambientales requieren coordinación entre diversas instancias estatales; sin embargo, ello no justifica que el AyA dentro del ámbito de sus competencias y en atención a las necesidades de los administrados, decida en este caso, simplemente no responder a las notas enviadas por el Ministerio de Hacienda que le instan desde el 2022; y no presentara el plan de acción que se le pidió para establecer una planificación clara y precisa para lograr la pronta aceleración del contrato de préstamo para financiar el programa de saneamiento de zonas prioritarias.
En suma, no se observa que se hayan hecho esfuerzos importantes para hacer efectivo el contrato de préstamo para financiar el programa de saneamiento de zonas prioritarias o que se tomaran acciones necesarias en coordinación con las instancias municipales y sanitarias que corresponden, a fin de brindar las soluciones a la falta de saneamiento de las aguas. Como consecuencia procede acoger el recurso en cuanto se dirige contra el Instituto de Acueductos y Alcantarillados y las municipalidades de Jacó, Golfito y Quepos, al haberse quebrantado el derecho a un ambiente sano y ecológicamente equilibrado del recurrente.
VI.Conclusión. Así las cosas, en cuanto el recurso se dirige contra la Municipalidad de Palmares, debe estarse el recurrente a lo indicado en la sentencia número 03-01431 de las 10:53 horas del 21 de febrero de 2003, que dispuso acoger el recurso planteado el 18 de setiembre de 2002. En cuanto se dirige contra el Ministerio de Hacienda, procede desestimar el recurso y se acoge parcialmente, en cuanto se dirige contra el AyA y las municipalidades de Garabito, Golfito y Quepos, por violación del derecho a un ambiente sano y ecológicamente equilibrado del recurrente, en los términos que se indican en la parte dispositiva de esta sentencia.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara parcialmente con lugar el recurso por violación del derecho a un ambiente sano y ecológicamente equilibrado. En cuanto el recurso se dirige en parte contra la Municipalidad de Palmares y el Instituto de Acueductos y Alcantarillados en lo referente a esa Municipalidad, desglósese este asunto para que sea tramitado en el expediente 02-7556-0007-CO. En cuanto el recurso se dirige contra las municipalidades de Garabito, Golfito y Nombre02 y el Instituto de Acueductos y Alcantarillados, en lo referente a esas municipalidades, se declara con lugar el recurso. Se ordena a Luis Alejandro Guillén Guardia, en su condición de presidente ejecutivo del Instituto Costarricense de Acueductos y Alcantarillados, Jong Kwan Kim Jin, en su condición de alcalde de Nombre02 Freiner Lara Blanco, en su condición de alcalde de Golfito y Tobías Murillo Rodríguez, en su condición de alcalde de Garabito o a quienes ocupen tales cargos, que dentro del ámbito de sus competencias, en el término de dieciocho meses contado a partir de la notificación de esta sentencia, tomen las medidas que corresponden, gestionen y coordinen la construcción de una planta de tratamientos de aguas negras y alcantarillado para las distintas localidades de Quepos, Golfito y Garabito, respectivamente.
Se les ordena a esas autoridades que prevean, dentro de sus presupuestos, las partidas necesarias para la construcción de la referida planta de tratamiento y alcantarillado, y que suministren al recurrente el detalle del presupuesto que se destinará a ese fin, así como un cronograma de las actividades, con el objeto de que pueda fiscalizar el cumplimiento de las etapas de la construcción; todo esto, en el entendido de que deberán finalizar la tarea indicada, en un término razonable, que no podrá exceder los dos años. Se advierte a las autoridades recurridas que, de conformidad con lo establecido por el artículo 71, de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.
Se condena a la Instituto Costarricense de Acueductos y Alcantarillados, a las Municipalidades de Quepos, Golfito y Garabito al pago de las costas, daños y perjuicios ocasionados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. En cuanto al Ministerio de Hacienda, se declara sin lugar el recurso. Se notifica al Ministro de Salud para que coordine esfuerzos con los recurridos y fiscalice que las mencionadas plantas de tratamiento e infraestructura, se construyan en cada localidad, de conformidad con la normativa de salud.
