Constitutional challenge (acción de inconstitucionalidad) filed by [Nombre01 001], of legal age, holder of identity card number [CED01], in his capacity as attorney-in-fact with full powers (apoderado generalísimo) of [Nombre01 002], legal entity identification number CED02, against Article 26 of Ley 7018, Ley de Presupuesto 1986 (ordinario y extraordinario).

Considerations
I.Formal admissibility requirements for the constitutional challenge. A constitutional challenge is a proceeding subject to specific technical requirements that must be satisfied for the Chamber to validly consider the merits of the challenge. Article 75 of the Ley de la Jurisdicción Constitucional establishes the admissibility requirements for a constitutional challenge; these include the existence of an underlying or prior matter pending resolution, whether in judicial proceedings or in proceedings to exhaust administrative remedies (agotar la vía administrativa), in which the unconstitutionality must have been invoked as a reasonable means of protecting the right or interest alleged to have been infringed. The second and third paragraphs of that same provision, in turn, govern the exceptional circumstances in which no prior matter is required, namely, when the nature of the matter does not involve individual and direct harm, when protection of diffuse or collective interests (intereses difusos o colectivos) is sought, or when the challenge is filed directly by the Contralor General de la República, the Procurador General de la República, the Fiscal General de la República, or the Defensor de los Habitantes.
Regarding the requirement of a matter pending resolution, the Chamber stated in judgment number 1995-4190 that the challenge is “a proceeding of an incidental nature (proceso de naturaleza incidental), rather than a direct or popular action, meaning that a matter must be pending resolution—whether before the courts of justice or in proceedings to exhaust administrative remedies—in order to access constitutional review, but in such a way that the challenge constitutes a reasonable means of protecting the right deemed infringed in the principal matter, so that the Constitutional Court’s ruling has a positive or negative effect on that pending proceeding, because it addresses the constitutionality of the provisions that must be applied in that matter; direct access to this avenue is permitted only by exception—the circumstances set forth in the second and third paragraphs of Article 75 of the Ley de la Jurisdicción Constitucional.” For that reason, the requirement of a prior matter pending resolution is not merely a formal requirement: neither the existence of an underlying matter nor invocation of unconstitutionality is sufficient, because it is essential that the challenge constitute a reasonable means of protecting the right or interest considered to have been infringed.
This means that the challenged provisions must apply to the underlying matter—see, to similar effect, judgments numbers 1990-1668, 1993-408, 1994-798, 1994-3615, 1995-409, 1995-851,1995-4190 and 1996-791-. It is also appropriate to note that other technical requirements must be satisfied, including, for example, explicit identification of the challenged provisions, supported by reasons and specific references to the constitutional mandates and principles considered infringed; authentication of the brief initiating the challenge through attorney sponsorship (patrocinio letrado); proof of the conditions establishing standing—powers of attorney and certificates—and a verbatim certified copy of the pleading raising the challenge (libelo de impugnación). If the petitioners fail to provide these items, the Office of the President of the Chamber may order them to do so.
II.On the admissibility of this constitutional challenge (acción de inconstitucionalidad) and the standing (legitimación) of the petitioner. In accordance with the foregoing considerando, filing a constitutional challenge such as that sought by the petitioner requires the existence of an underlying proceeding (asunto base) that constitutes a suitable means for adjudicating the claim and with respect to which the challenge is a reasonable means of defending the right alleged to have been infringed. In this particular case, the petitioner files this constitutional challenge citing as the underlying proceeding an administrative proceeding conducted before the Dirección de Geología y Minas del Ministerio de Ambiente y Energía, in which the petitioner company applied for a concession to operate a quarry on property it owns, located in the Batán district of the Matina canton, where a rock deposit was discovered that can be used as construction aggregate.
That case file is being processed through administrative channels under number 2020-CAN-PRI-024, and within that proceeding, the Dirección de Geología y Minas issued resolution number 837-2020, denying the company’s application and the reservation of the area for extraction on the grounds that the property in question is located within the Reserva Forestal Río Pacuare. The company filed formal motions for reconsideration (recursos de revocatoria), with a subsidiary appeal (apelación en subsidio) and a concurrent claim of nullity (nulidad concomitante), at that time raising the grounds of unconstitutionality that it now likewise invokes. The motion for reconsideration was denied by resolution number 139-2021 of the Dirección de Geología y Minas, and the record was forwarded to the Ministra de Ambiente y Energía for consideration of the appeal. Pursuant to article 94 of the Código de Minería, the decision on the appeal in proceedings of this type exhausts administrative remedies (agota la vía administrativa).
Accordingly, the Chamber finds that, in this case, the administrative proceeding used as the underlying proceeding for filing this challenge is at the stage of exhaustion of administrative remedies; therefore, because the other requirements set forth in the Ley de la Jurisdicción Constitucional have been met, this challenge is admissible, and the subject matter and merits of the case shall be considered.
III.On the subject matter of the challenge. The petitioner alleges that article 26 of Law number 7018, Ley de Presupuesto 1986 (ordinary and extraordinary), is unconstitutional, contending that the article is an atypical provision (norma atípica) incorporated into the budget law for that period, because it creates the Reserva Forestal Río Pacuare.
The challenged provision states:
“Article 26.- The area located in the Siquirres canton, Limón province, which cartographically appears on the Las Hojas Bonilla, Matina, Tucurrique, and Barbilla maps of the Instituto Geográfico Nacional at a scale of 1:50.000, bounded by horizontal Lambert coordinates 220-229 and vertical Lambert coordinates 587-600, is hereby declared a forest reserve (reserva forestal).
The reserve shall be administered by the Dirección General Forestal, with the cooperation of the Municipalidad de Siquirres and the Colegio Agropecuario of that community.
The Dirección General Forestal shall establish the final boundaries of the reserve within ninety days.”
IV.On the specific content of budget laws and the impermissibility of provisions unrelated to budgetary matters. The consideration, nature, content, and legislative procedure of the Republic’s budget law are constitutionally defined in articles 176 et seq. of the Political Constitution (Constitución Política). In general terms, the content of budget laws is defined as the statement of public administration revenue and expenditures during a fiscal period, including, for that purpose, the budget implementation provisions (normas de ejecución presupuestaria) in effect for a particular fiscal period or financial year. It is therefore evident that incorporating provisions not directly related to budget implementation for a specific period is improper, which has led constitutional case law to regard provisions unrelated to such budget implementation for a particular period as “atypical provisions.”
Indeed, from its earliest years, this Chamber established its case-law doctrine on the subject, which was extensively developed at that time and identified a variety of such atypical provisions. In one of its first judgments, the Chamber expressly noted that incorporating provisions unrelated to budget implementation into a budget law was constitutionally impermissible, because, under paragraph 11 of article 121 of the Constitution, the Asamblea Legislativa was required, in laws of this kind, to confine itself specifically to budgetary matters. Thus, in judgment number 121-1989, the Chamber distinguished between general legislative power and legislative power over budgetary matters, stating that:
“[P]aragraphs 1) and 11) of article 121 of the Political Charter distinguish between two different modes and forms of legislating according to the subject matter concerned. The first text grants exclusively to the Poder Legislativo the power to enact, amend, repeal, and provide authoritative interpretations of laws, except as stated in the article concerning the Tribunal Supremo de Elecciones. Paragraph 11), in turn, also grants exclusively to that Branch the power to enact the Republic’s ordinary and extraordinary budgets. As may be observed, the authority under the first paragraph constitutes a very broad power concerning ordinary or general laws as a whole, whereas the authority under paragraph 11) is specialized in nature, with its implementation governed by articles 176, 177, 178, 179, and 180, in conjunction with the final clause of article 125, which precludes the Poder Ejecutivo from exercising a veto in matters of budget legislation (…).
It follows from the texts cited above that the jurisdiction or authority constitutionally conferred upon the Asamblea Legislativa over this important matter is to establish in the budgets the anticipated revenue and authorized expenditures of the Administración Pública, subject to the procedures that the Constitution itself establishes for amendments thereto and for extraordinary budgets. Consequently, the Poder Legislativo may not, under the aforementioned budgetary power, regulate matters of a nature or content different from that specialized subject matter.” (sic) -emphasis added- The provisions addressing matters whose nature or content differs from the specialized subject matter of budgets have come to be known as “atypical provisions,” precisely because they concern matters that are not “typical” of or proper to a budget law. Thus, in judgment number 4790-1993, the Chamber defined them as follows:
“Atypical provisions are those which, despite bearing no relationship to budget implementation provisions, are included in the budget and arise when the legislature repeals, amends, interprets, or even creates ordinary laws within the budget. The inclusion of such non-budgetary provisions in budget laws has repeatedly been deemed by case law to violate the constitutional provisions concerning the authority or jurisdiction of the Asamblea Legislativa to enact and amend laws. In this regard (…) it is entirely permissible to include general provisions in budget laws, provided that they are tied to the specialized nature of that subject matter, namely, budget implementation. What may not be included in budget laws are provisions lacking that character, since they must be governed by the rules applicable to general and ordinary laws.” -emphasis not in the original- This consistent line of case law led the Chamber to consolidate the following doctrine in judgment number 6970-2000 -see, to the same effect, among others, judgments 6043-2002, 3666-2003, 3497-2005, 14102-2006 and 56-2008-:
“[A]ny content unrelated to budgetary matters proper, within the meaning of article 176 of the Political Constitution, may not be included in the Budget Law because of the special conditions governing the approval of this type of enactment. Thus, the Budget Law follows an expedited procedure in comparison with ordinary laws because of the urgency of its approval, which means that all authorities involved in its processing have short periods within which to carry out their respective actions. It is also an act of legislative promulgation; that is, the Budget Law is promulgated by the Asamblea Legislativa itself rather than by the Poder Ejecutivo, which, under the ordinary procedure, has the power to approve or veto bills passed by the Assembly. This special procedure is reserved for a type of enactment that is likewise particular in terms of its content: the Budget Law, through which the anticipated revenue of the central government is projected and its possible expenditures are determined.
Provisions that do not concern the two aforementioned matters must be processed under the procedure for approving ordinary laws established in article 124 of the Political Constitution, and not through the special procedure for approving the Budget established in articles 177 et seq. of the Fundamental Law. Failure to comply with these provisions renders the budgetary provision unconstitutional.” (sic) -emphasis not in the original- Likewise, the Chamber has elaborated by stating that provisions deemed atypical are, ultimately, not only those unrelated to budgetary matters, but also those concerning matters that, by their very nature, are or should be governed by ordinary legislation. Thus, in judgment number 242-2001 -reiterated, among others, in judgments 7137-2007 and 2022-26652-, the Chamber expressly held:
“[T]he Budget Law may not validly contain general provisions unrelated to budgetary matters. In other words, the inclusion of atypical provisions concerning matters proper to ordinary legislation, whether to create or amend such legislation, is invalid.” -emphasis added-
V.On the constitutional invalidity of the challenged provision. Law 7018 is the Ley de Presupuesto 1986 (ordinary and extraordinary). Although, as explained above, laws of this type are by nature intended to implement the budget for a particular period and must not include ordinary matters that are not inherently budgetary, article 26 of this law clearly exceeds the subject matter that a budget law must address and instead establishes a provision that is ordinary in nature by creating a forest reserve. Indeed, the challenged article states:
“Article 26.- The area located in the Siquirres canton, Limón province, which cartographically appears on the Las Hojas Bonilla, Matina, Tucurrique, and Barbilla maps of the Instituto Geográfico Nacional at a scale of 1:50.000, bounded by horizontal Lambert coordinates 220-229 and vertical Lambert coordinates 587-600, is hereby declared a forest reserve.
The reserve shall be administered by the Dirección General Forestal, with the cooperation of the Municipalidad de Siquirres and the Colegio Agropecuario of that community.
The Dirección General Forestal shall establish the final boundaries of the reserve within ninety days.” It is evident that this article, despite being included in a budget law, in no way concerns budget execution or settlement, but is limited to creating a forest reserve (reserva forestal) in the canton of Siquirres, between the coordinates indicated therein, providing that such reserve shall be administered by the Dirección General Forestal, with the cooperation of the Municipalidad de Siquirres and the community’s Colegio Agropecuario, and that the Dirección General Forestal shall be responsible for establishing the boundaries or demarcations (linderos o delimitaciones) of that reserve.
For this reason, the Procuraduría General de la República states in its report:
“In the case before us, it is undeniable that a provision whose purpose is the creation of a Forest Reserve—as is the provision challenged in this action—has nothing to do with matters of budget execution, since it constitutes an ordinary, substantive law intended to remain in force (and not one relating to any type of budget execution for a particular period); hence, the alleged defect is established, insofar as it indeed constitutes an atypical provision that violates the special regulations governing the processing of budget laws, as well as those governing the procedure that must be followed for the enactment of ordinary laws (articles 123, 124, 176, 177, 178 and 180).” (sic)
Accordingly, given the evident atypical nature of the challenged provision, the appropriate course is to declare article 26 of Ley número 7018 unconstitutional, without prejudice to what is stated in the following recital (considerando).
VI.Regarding the continued environmental protection of the area concerned along the Río Pacuare. Granting this action on the basis of the atypical nature of the challenged article does not have the effect of leaving the geographic area in question environmentally unprotected. On the contrary, that area remains fully protected by the State, because the existence of the so-called protected zone (Zona Protectora) of the Río Pacuare has been declared, which, for all purposes, corresponds to and fully coincides with what until now has been the Forest Reserve at issue.
Indeed, it should be noted that Decreto Ejecutivo número DE-16815-MAG, adopted on 10 de enero de 1986 pursuant to the provisions of the Ley Forestal, declared the Zona Protectora Río Pacuare. This Decree provides, in relevant part:
“DECLARES THE RÍO PACUARE A PROTECTED ZONE N°16815-MAG THE PRESIDENTE DE LA REPÚBLICA AND THE MINISTRO DE AGRICULTURA Y GANADERIA, In exercise of the powers conferred upon them by article 140, subsections 3) and 18) of the Constitución Política, in accordance with articles 19 and 29; subsection b), 83 and 86 of Ley Forestal N° 4465 of 25 de noviembre de 1969, and
Whereas:
1°-It is an essential function of the State to ensure the technical planning and management of watersheds (cuencas hidrográficas), in a manner that permits their sustained yield and ensures that lands suitable for forestry always retain forest cover (cobertura boscosa).
2°-Because of the exceptional topographic, hydrological, soil, and vegetation characteristics of part of the Río Pacuare watershed, it is necessary to establish an area for the protection of forest resources. In turn, this is an area of vital importance for the future supply of drinking water to the canton of Siquirres.
3°-The area possesses unique scenic quality, particularly along the passage of the Río Pacuare, which may be developed for tourism.
4°-The area has 85'% of its forests undisturbed, constituting the last remnant of this quality in the central Atlantic region, with enormous biological potential.
Therefore,
THEY DECREE:
Article 1°-The territories comprising part of the watersheds of the Río Pacuare, Río Madre de Dios, and Río Matina are hereby declared the Zona Protectora rio Pacuare, beginning on the Tucurrique 34451 topographic sheet, at the confluence of Quebrada Temible or Alcantarilla with the Río Pacuare, coordinates N217,700- E586,050 (1)*; continuing downstream along the western bank of the Río Pacuare to the confluence of Quebrada Terciopelo with that river, coordinates N221-, 575-E588,775 (2), on the Bonilla 3446 Il topographic sheet. It then continues upstream along the left bank of Quebrada Terciopelo to its junction with Quebrada San Martín, following the latter to its spring (naciente) at coordinates N224,275-E587;500 (3). From there, it continues in a straight line to the spring of Quebrada Quebradón, coordinates N225,175-E587,175 (4). From there, it proceeds in a straight line to the spring of a tributary of the Río Siquirres, coordinates N226, 300-E587,650 (5).
It continues downstream to the confluence with the Río Siquirrítos at coordinates N228,375-E587,200 (6), then proceeds in a straight line to a small hill located at coordinates N228,500-E588,OOO (7), and follows the watershed divide between the Río Siquirritos and Quebrada La Planta to the spring of the latter, coordinates N228,OOO-E588,400 (8). It continues in a straight line until reaching Quebrada Cabros at coordinates N228,250-E589,100 (9). It continues in a straight line to a small hill labeled Nombre01 on the map, on the ridge at coordinates N227,200-E589,350 (10). It then continues along the crest of the ridge to the place known as Dos Montañas on the Río Pacuare, coordinates N228,550-E591,SOO (11), on the Matina 3549 m sheet. It then continues downstream along the eastern bank of the Río Pacuare to the confluence with the intermittent stream located at coordinates N229,700-E591,900 (12).
It proceeds upstream along the intermittent stream to coordinates N228,775-E593, 400 (13). From there, it continues in a straight line to a hill labeled Nombre01 on the map (14), whose photogrammetric elevation is 430 m and which is crossed by the road leading to Les Brisas de Pacuarito, following the points given below:

Article 2°-The State-owned and privately owned properties located within the boundaries specified in the preceding article are mandatorily subject to the Forestry Regime (Régimen Forestal). Consequently, any work to be performed must first be authorized by the Dirección General Forestal.
Article 3°-The following are prohibited on the State-owned and privately owned properties located within the boundaries specified in the preceding article:
Article 4°-The national reserves and other State lands affected by the protected zone created by this Decree are, as provided in article 25 of the Ley Forestal, inalienable and may not be recorded in the Registro Público through any procedure; the State’s action to recover title (acción reinvidicatoria) with respect to them is not subject to any limitation period.
Article 5°-The administration of this protected zone shall be entrusted to the Dirección General Forestal, with the cooperation of a commission composed of one representative from the Municipalidad de Siquirres, one from the Instituto de Desarrollo Agrario, one from the Instituto Costarricense de Electricidad, one from the Comisión Nacional de Asuntos Indígenas, one from the Instituto Costarricense de Turismo, and one from the tourism companies operating in the area.
The Dirección General Forestal shall be responsible for establishing this Commission and shall chair it.
Article 6°-The entities participating in the administration of this protected zone shall allocate the necessary appropriations in their budgets to ensure the management and protection of the area.
Article 7°-The minimum productive parcel area is established at 10 hectares. Therefore, subdivisions (segregaciones) resulting in parcels smaller than that minimum productive unit may not be authorized.
Article 8°-This Decree shall enter into force upon its publication.
Issued at the Presidencia de la República. -San José, on the tenth day of January of the year nineteen hundred and eighty-six.” To clarify whether this Protected Zone corresponds to the Forest Reserve created by the atypical provision in article 26 of Ley 7018, the technical opinion contained in report number SINAC-ACLAC-AL-241-2023 of the Sistema Nacional de Áreas de Conservación, dated 19 de setiembre de 2023, is particularly significant. It states:
“[T]he boundaries established by Decreto Ejecutivo número DE-16815-MAG of 10 de enero de 1986, which creates the Zona Protectora Río Pacuare, are the same boundaries applicable to the so-called Reserva Forestal Río Pacuare, created by Artículo 26 of Ley N°7018: Ley de Presupuesto Ordinario para el Período Fiscal de 1986.” Accordingly, it is clear that declaring article 26 of Ley 7018 unconstitutional is far from leaving the designated area unprotected, because the same area, with the boundaries defined by the Decree and the guarantee afforded by mandatory compliance with the Ley Forestal, retains the full protection required under article 50 of the Constitución Política. It should be noted that the Decree in question was adopted to implement the obligations established in the Ley Forestal, and the Decree itself states that its provisions must be applied and observed in accordance with the Ley Forestal and with the definition, assessment, and determination made in that regard by the Dirección General Forestal—cf. articles 2 and 3 of Decreto DE-16815-MAG.
It follows that any regime governing restrictions, protection, and development, as well as any activities that may be implemented or carried out, must be assessed and determined not only on the basis of this Decree but, especially, in accordance with the provisions of the Ley Forestal and by the Dirección General Forestal. Consequently, the entire related regime is confined to the legally established definitions and to the significance that specific situations may have within the framework of legality. It must also be taken into consideration that, with respect to determining the boundaries of protected areas, the Chamber’s case law has been careful to state that any adverse modification of those boundaries—that is, any reduction in area—must be enacted by law—see judgments of this Chamber, numbers 1993-5399, 2006-5975 and 2023-12817. That situation clearly does not arise in this case, because the Decree in question concerns the definition of an area deemed protected pursuant to the provisions of the Ley Forestal, rather than any reduction of that area.
VII.In conclusion, because it has been established that the challenged article is an atypical provision of Ley número 7018, Ley de Presupuesto 1986 (ordinario y extraordinario), this action must be granted, as stated in the operative portion of this judgment.
Therefore
The action is granted. Consequently, article 26 of Ley número 7018, Ley de Presupuesto 1986 (ordinario y extraordinario), is annulled as unconstitutional. The declaration of unconstitutionality shall have retroactive and declaratory effect as of the date on which the aforementioned provision entered into force, with the proviso that the Zona Protectora Río Pacuare remains intact in accordance with Decreto Ejecutivo No. 16815-MAG, and without prejudice to rights acquired in good faith, pursuant to article 91 of the Ley de la Jurisdicción Constitucional. Justice Garro Vargas files a separate note. A summary of this ruling shall be published in the Diario Oficial La Gaceta, and the ruling shall be published in full in the Boletín Judicial. Notice shall be given.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las dieciseis horas y treinta y uno minutos del seis de marzo de dos mil veinticuatro.
Acción de inconstitucionalidad promovida por [Nombre01 001], mayor, portador de la cédula de identidad número [CED01], en su condición de apoderado generalísimo de [Nombre01 002], cédula de persona jurídica número CED02, contra el artículo 26 de la Ley 7018, Ley de Presupuesto 1986 (ordinario y extraordinario).
Resultando
Redacta el Magistrado Delgado Faiht; y,
Considerando
I.Sobre los presupuestos formales de admisibilidad de la acción de inconstitucionalidad. La acción de inconstitucionalidad es un proceso con requisitos técnicos específicos, que deben ser cumplidos a efecto de que la Sala logre, de forma válida, conocer el fondo de la impugnación. El artículo 75 de la Ley de la Jurisdicción Constitucional, estipula los presupuestos de admisibilidad de la acción de inconstitucionalidad; entre estos se exige la existencia de un asunto base o previo pendiente de resolver, sea en vía judicial, o en el procedimiento para agotar la vía administrativa, en que se haya invocado la inconstitucionalidad como medio razonable para amparar el derecho o interés que se considera infringido. Por su parte, en el párrafo segundo y tercero de la misma norma, se regula de forma excepcional los presupuestos en los cuales no se requiere el asunto previo, es decir, cuando por la naturaleza del asunto no exista una lesión individual y directa, o bien, se trate de la tutela de intereses difusos o colectivos, o cuando la interpone de manera directa el Contralor General de la República, el Procurador General de la República, el Fiscal General de la República y el Defensor de los Habitantes.
Sobre la exigencia de un asunto pendiente de resolver, la Sala, mediante sentencia número 1995-4190, señaló que la acción es «un proceso de naturaleza incidental, y no de una acción directa o popular, con lo que se quiere decir que se requiere de la existencia de un asunto pendiente de resolver -sea ante los tribunales de justicia o en el procedimiento para agotar la vía administrativa- para poder acceder a la vía constitucional, pero de tal manera que la acción constituya un medio razonable para amparar el derecho considerado lesionado en el asunto principal, de manera que lo resuelto por el Tribunal Constitucional repercuta positiva o negativamente en dicho proceso pendiente de resolver, por cuanto se manifiesta sobre la constitucionalidad de las normas que deberán ser aplicadas en dicho asunto; y únicamente por excepción es que la legislación permite el acceso directo a esta vía -presupuestos de los párrafos segundo y tercero del artículo 75 de la Ley de la Jurisdicción Constitucional-».
Por tal razón, la exigencia de un asunto previo pendiente de resolver no configura un mero requisito de forma, pues no basta con la existencia de un asunto base, ni con la invocación de la inconstitucionalidad, pues resulta indispensable que la acción constituya un medio razonable para amparar el derecho o interés que se considera vulnerado, lo que significa, que las normas recurridas deben ser aplicables en el asunto base –ver, en similar sentido, sentencias números 1990-1668, 1993-408, 1994-798, 1994-3615, 1995-409, 1995-851,1995-4190 y 1996-791-. Por otra parte, es oportuno indicar que existen otros recaudos técnicos que deben cumplirse, como por ejemplo, la determinación explícita de las normas impugnadas debidamente motivadas, con referencia específica de los mandatos y principios constitucionales que se consideren infringidos, la autenticación mediante patrocinio letrado del escrito de interposición de la acción, la acreditación de las condiciones de legitimación -poderes y certificaciones-, así como la certificación literal del libelo de impugnación, los cuales, en caso de no ser aportadas por los accionantes, pueden ser prevenidos por la Presidencia de la Sala para su cumplimiento.
II.Sobre la admisibilidad de esta acción de inconstitucionalidad y la legitimación del accionante. De conformidad con lo señalado en el anterior considerando, para la interposición de una acción de inconstitucionalidad como la pretendida por el accionante, se requiere la existencia de un asunto base que sea medio idóneo para la discusión de la pretensión, y respecto del cual, la acción sea un medio razonable para la defensa del derecho que se estima lesionado. En este caso concreto, el accionante presenta esta acción de inconstitucionalidad aduciendo como asunto base, un procedimiento administrativo tramitado ante la Dirección de Geología y Minas del Ministerio de Ambiente y Energía, dentro del cual, la empresa accionante solicitó concesión para la explotación de un tajo en un inmueble de su propiedad, ubicado en el distrito Batán del cantón de Matina, en el cual se descubrió un yacimiento de roca que puede ser utilizada como agregados para la construcción.
Dicho expediente se tramita en vía administrativa bajo el número 2020-CAN-PRI-024, y dentro del mismo, la Dirección de Geología y Minas dictó la resolución número 837-2020, rechazando la solicitud de la empresa y la reserva de área para explotación, sobre la base que el inmueble en cuestión se ubica dentro de la Reserva Forestal Río Pacuare. Contra dicha resolución, la empresa interpuso formales recursos de revocatoria con apelación en subsidio y nulidad concomitante, planteando en ese momento los motivos de inconstitucionalidad que ahora igualmente invoca. El recurso de revocatoria fue denegado mediante resolución de la Dirección de Geología y Minas, número 139-2021, elevando los autos para el conocimiento del recurso de apelación ante la Ministra de Ambiente y Energía. De conformidad con el artículo 94 del Código de Minería, la resolución del recurso de apelación en este tipo de procedimientos, agota la vía administrativa. De tal manera, estima la Sala que en este caso, el procedimiento administrativo utilizado como asunto base para la interposición de esta acción, se encuentra en fase de agotamiento de la vía administrativa, motivo por el cual, habiéndose cumplido los demás recaudos señalados en la Ley de la Jurisdicción Constitucional, esta acción resulta admisible, por lo que se conoce el objeto y el fondo del asunto.
III.Sobre el objeto de la acción. El accionante aduce la inconstitucionalidad del artículo 26 de la Ley número 7018, Ley de Presupuesto 1986 (ordinario y extraordinario), al estimar que dicho artículo es una norma atípica incorporada a la ley de presupuesto de dicho período, ya que a través del mismo se crea la Reserva Forestal Río Pacuare.
La norma impugnada dispone:
“Artículo 26.- Declárase reserva forestal el área comprendida en el cantón de Siquirres, provincia de Limón que cartográficamente se ubica en Las Hojas Bonilla, Matina, Tucurrique, y Barbilla del Instituto Geográfico Nacional 1:50.000, enmarcado entre las coordenadas Lambert horizontales 220-229 y verticales 587-600.
La administración de la reserva estará a cargo de la Dirección General Forestal, con la colaboración de la Municipalidad de Siquirres y del Colegio Agropecuario de esa comunidad.
Corresponde a la Dirección General Forestal hacer la delimitación definitiva de la reserva en un plazo de noventa días.”
IV.Sobre el contenido específico de las leyes de presupuesto, y la improcedencia de normas ajenas a materia presupuestaria. El tema de la consideración, naturaleza, contenido y tramitación de la ley de presupuesto de la República, está definido constitucionalmente en los artículos 176 y siguientes de la Constitución Política. En términos generales, se define que el contenido de las leyes de presupuesto es la relación de ingresos y gastos de la administración pública durante un período fiscal, comprendiendo, al efecto, las normas de ejecución presupuestaria vigentes para un determinado período fiscal o ejercicio económico. De lo anterior, es evidente, que resulta impropio incorporar normas que no estén directamente relacionadas con la ejecución presupuestaria de un período específico, lo cual da lugar, a que aquellas normas que no se relacionen con esa ejecución presupuestaria para un período concreto, hayan sido consideradas por la jurisprudencia constitucional como «normas atípicas».
En efecto, desde sus primeros años, esta Sala sentó su doctrina jurisprudencial sobre la materia, la cual se desarrolló profusamente en aquel momento, identificando una diversidad de tales normas atípicas. En una de sus primeras sentencias, la Sala expresamente señaló la inconformidad constitucional de incorporar en la ley de presupuesto, normas ajenas a la ejecución presupuestaria, pues en aplicación del inciso 11 del artículo 121 de la Constitución, en este tipo de leyes, la Asamblea Legislativa debía limitarse, precisamente, a la materia presupuestaria. Así, mediante sentencia número 121-1989, la Sala diferenció entre la potestad legislativa de carácter general, y la que dispone en materia presupuestaria, señalando que:
“[E]n los incisos 1) y
“Las normas atípicas son aquellas que sin tener ninguna relación con las normas de ejecución presupuestaria, se encuentran incluidas dentro del presupuesto y nacen cuando el legislador deroga, modifica, interpreta o incluso crea leyes ordinarias dentro del presupuesto. Esta inclusión de disposiciones no presupuestarias en las leyes del presupuesto, ha sido considerada en reiterada jurisprudencia como violatoria los preceptos constitucionales que se refieren a la atribución o competencia de la Asamblea Legislativa para dictar las leyes, reformarlas. En tal sentido (…) es enteramente procedente que se incluyan normas generales en las leyes de presupuesto, siempre y cuando ellas se encuentren ligadas a la especialidad que esa materia significa, sea la ejecución del presupuesto. Lo que no es posible incluir en las leyes de presupuesto son las normas que no tienen ese carácter, ya que ellas deben regularse por lo dispuesto para las leyes comunes y ordinarias.”. -el destacado no es del original- La sostenida línea jurisprudencial, llevó a la Sala a consolidar, mediante sentencia número 6970-2000 -ver, en el mismo sentido, entre otras, sentencias 6043-2002, 3666-2003, 3497-2005, 14102-2006 y 56-2008-, que:
“[C]ualquier contenido ajeno a la materia propiamente presupuestaria, en los términos del artículo 176 de la Constitución Política, no puede ser incluido en la Ley de Presupuesto, debido a las especiales condiciones que rodean la aprobación de este tipo de actos. Así, la Ley de Presupuesto tiene un trámite privilegiado respecto de la ley ordinaria dada la urgencia de su aprobación, lo cual lleva a que todas las autorizadas involucradas de su tramitación tengan plazos cortos para realizar sus respectivas actuaciones. Es además un acto de promulgación legislativa, es decir, que quien promulga la Ley de Presupuesto es la propia Asamblea Legislativa y no el Poder Ejecutivo, órgano que respecto del trámite ordinario cuenta con las potestades de sanción y veto de los proyectos aprobados por la Asamblea. Ese procedimiento especial es reservado a un tipo de actos igualmente particulares en cuanto a su contenido: la Ley de Presupuesto, mediante la cual son previstos los ingresos probables del Estado central y determinados sus gastos posibles.
Las normas que no se refieran a los dos aspectos recién mencionados, deben ser tramitadas mediante el procedimiento para la aprobación de la Ley ordinaria, previsto en el artículo 124 de la Constitución Política, y no a través del procedimiento especial para la aprobación del Presupuesto, determinado por los numerales 177 y siguientes de la Ley Fundamental. El incumplimiento a estas disposiciones produce la inconstitucionalidad de la norma presupuestaria.” (sic) -el resaltado no es del original- De igual manera, la Sala ha profundizado, señalando que las consideradas normas atípicas, serían aquellas que, en definitiva, no sólo sean ajenas a la materia presupuestaria, sino que se trate de aspectos que, por su propia naturaleza, sean objeto o deban ser objeto de la legislación ordinaria. Así mediante sentencia número 242-2001 -reiterada, entre otras, por sentencia 7137-2007 y 2022-26652-, dispuso expresamente la Sala que:
“[L]a Ley de Presupuesto, no puede válidamente contener normas de carácter general, ajenas a la materia de presupuesto, Es decir, no es válida la inclusión de normas atípicas que versen sobre materia propia de la legislación ordinaria, ya sea para la creación o modificación de esta.” -énfasis suplido-
V.Sobre la inconformidad constitucional de la norma impugnada. La Ley 7018 es la Ley de Presupuesto 1986 (ordinario y extraordinario). No obstante que la naturaleza de este tipo de leyes es, según lo expuesto, la ejecución presupuestaria para un período determinado, y que no debe incluirse en esta normativa materia de carácter ordinario que no sea de suyo materia presupuestaria, el artículo 26 de esta ley claramente trasciende el objeto que debe contemplar una ley de presupuesto, y, en su lugar, dispone una norma que resulta ser de carácter ordinario, al crear una reserva forestal. En efecto, el artículo cuestionado señala:
“Artículo 26.- Declárase reserva forestal el área comprendida en el cantón de Siquirres, provincia de Limón que cartográficamente se ubica en Las Hojas Bonilla, Matina, Tucurrique, y Barbilla del Instituto Geográfico Nacional 1:50.000, enmarcado entre las coordenadas Lambert horizontales 220-229 y verticales 587-600.
La administración de la reserva estará a cargo de la Dirección General Forestal, con la colaboración de la Municipalidad de Siquirres y del Colegio Agropecuario de esa comunidad.
Corresponde a la Dirección General Forestal hacer la delimitación definitiva de la reserva en un plazo de noventa días.” Es evidente que este artículo, a pesar de estar incluido en una ley de presupuesto, de modo alguno se refiere a la ejecución o liquidación presupuestaria, sino que se circunscribe a crear una reserva forestal en el cantón de Siquirres, entre las coordenadas que allí se indica, definiendo que tal reserva estará administrada por la Dirección General Forestal, con la colaboración de la Municipalidad de Siquirres y el Colegio Agropecuario de la comunidad, y que corresponderá a la Dirección General Forestal establecer los linderos o delimitaciones de tal reserva.
Es por ello que la Procuraduría General de la República señala en su informe que:
“En el caso que aquí nos ocupa, resulta innegable que una norma cuyo objeto es la creación de una Reserva Forestal -como lo es la norma impugnada en esta acción-, no tiene nada que ver con la materia de ejecución presupuestaria, toda vez que consiste en una ley común y sustantiva, con vocación de permanencia (y no relativa a algún tipo de ejecución presupuestaria para un determinado período), de ahí que se configura el vicio alegado, en tanto ciertamente constituye una norma atípica, que violenta la regulaciones especiales destinadas al trámite de la leyes de presupuesto, y a su vez las relativas al trámite que debe seguirse para la aprobación de leyes ordinarias (artículos 123, 124, 176, 177, 178 y 180).” (sic)
De tal forma, ante la evidente atipicidad de la norma cuestionada, lo que procede es declarar que el artículo 26 de la Ley número 7018 es inconstitucional, sin perjuicio de lo que se indica en el siguiente considerando.
VI.Sobre el mantenimiento de la protección ambiental sobre la zona de atención en el Río Pacuare. La estimatoria de esta acción a partir de la atipicidad del artículo impugnado, carece del efecto de causar desprotección ambiental sobre la zona geográfica en cuestión, zona que, por el contrario, mantiene plena protección por parte del Estado, al haberse declarado la existencia de la denominada Zona Protectora del Río Pacuare que, para todos los efectos, se corresponde y coincide plenamente con la que hasta ahora sería la Reserva Forestal en cuestión.
En efecto, nótese que mediante el Decreto Ejecutivo número DE-16815-MAG, adoptado el 10 de enero de 1986 con base en lo establecido en la Ley Forestal, se declara la Zona Protectora Río Pacuare. Este Decreto dispone, en lo conducente:
“DECLARA ZONA PROTECTORA RÍO PACUARE N°16815-MAG EL PRESIDENTE DE LA REPÚBLICA Y EL MINISTRO DE AGRICULTURA Y GANADERIA, En el uso de las facultades que les confiere el artículo 140, incisos 3) y 18) de la Constitución Política, de conformidad con lo dispuesto por los artículos 19 y 29; inciso b), 83 y 86 de la Ley Forestal N° 4465 del 25 de noviembre de 1969, y
Considerando:
1°-Que es función esencial del Estado procurar el ordenamiento y manejo de las cuencas hidrográficas en forma técnica; de tal manera que permita su rendimiento continuo y asegure que los terrenos que son de aptitud forestal, mantengan siempre una cobertura boscosa.
2°-Que por las características topográficas, hídricas, edáficas y de vegetación excepcional en parte de la cuenca del río Pacuare es necesario establecer un área de protección de los recursos forestales. A su vez por ser un área. de vital importancia para el suministro futuro de agua potable al cantón de Siquirres.
3°-Que la zona posee una calidad escénica única, sobre todo en la travesía del río Pacuare, la cual puede ser explotada turísticamente.
4°-Que el área posee el 85'% de sus bosques inalterados, constituyendo el último remanente de esta calidad en el Atlántico medio, con un potencial biológico enorme.
Por tanto,
DECRETAN:
Artículo 1°-Declárense Zona Protectora rio Pacuare, los territorios que comprenden parte de las cuencas del río Pacuare, río Madre de Dios y río Matina, iniciando en la hoja topográñca Tucurrique 34451, en la confluencia de la quebrada Temible o Alcantarilla con el río Pacuare, coordenadas N217,700- E586,050 (1)*; continúa aguas abajo por la margen occidental del río Pacuare, hasta la confluencia de la quebrada Terciopelo con dicho río, coordenadas N221-, 575-E588,775 (2); en la hoja topo gráfica Bonilla 3446 Il. Luego sigue aguas arriba por la margen izquierda de la quebrada Terciopelo, hasta la unión con la quebrada San Martín, siguiendo esta última hasta su naciente con las coordenadas N224,275-E587;500 (3). De aquí continúa en línea recta hasta la naciente de la quebrada Quebradón coordenadas N225,175-E587,175 (4). De aquí se parte en línea recta hasta la naciente de un afluente 2el río Siquirres, coordenadas N226, 300-E587,650 (5).
Se continúa aguas abajo hasta la confluencia con el río Siquirrítos en las coordenadas N228,375-E587,200 (6), luego sigue en línea recta hasta un pequeño cerro localizado en las coordenadas N228,500-E588,OOO (7) para seguir la divisoria de aguas entre el río Siquirritos y la quebrada La Planta, hasta la naciente de esta última, coordenadas N228,OOO-E588,400 (8). Se sigue en línea recta hasta caer en la quebrada cabros en las coordenadas N228,250-E589,100 (9). Continúa en línea recta, hasta un pequeño cerro sin Nombre01 en el mapa, sobre la fila en las coordenadas N227,200-E589,350 (10). Continúa luego por la cima de la fila hasta el sitio Dos Montañas en el rio Pacuare, coordenadas N228,550-E591,SOO (11) en la hoja Matina 3549 m. Continúa luego aguas abajo por la margen oriental del rio Pacuare, hasta la confluencia con 18 quebrada intermitente localizada en las coordenadas N229,700-E591,900 (12).
Se sigue aguas arriba por la quebrada intermitente hasta las coordenadas N228,775-E593, 400 (13). De aquí continúa en línea recta hasta un cerro sin Nombre01 en el mapa (14), cuya cota fotogramétríea es de 430 m y es cruzado por el camino que conduce a les Brisas de Pacuarito siguiendo los puntos dados a. continuación:

Artículo 2°-Los inmuebles -estatales y privados- comprendidos dentro de los linderos señalados en el artículo anterior quedan sometidos obligatoriamente al Régimen Forestal. En consecuencia, toda labor a realizar deberá de previo contar con la autorización de la Dirección General Forestal.
Artículo 3°- Queda prohibido en los inmuebles -estatales y privados- comprendidos dentro de los linderos señalados en el artículo anterior:
Artículo 4°-Las reservas nacionales y demás terrenos del Estado afectados por la zona protectora creada por el presente Decreto, según lo dispone el artículo 25 de la Ley Forestal son inalienables y no susceptibles de inscripción en el Registro Público por trámite alguno y la acción reinvidicatoria del Estado respecto a ellos es imprescriptible.
Artículo 5°-La administración de esta zona protectora estará a cargo de la Dirección General Forestal, con la colaboración de una comisión integrada por un representante de la Municipalidad de Siquirres, uno del Instituto de Desarrollo Agrario, uno del Instituto Costarricense de Electricidad, uno de la Comisión Nacional de Asuntos Indígenas, uno del Instituto Costarricense de Turismo y uno de las empresas turísticas que trabajan en el área.
La instalación de esta Comisión le corresponde a la Dirección General Forestal quien la presidir.
Artículo 6°-Los participantes en la administración de esta zona protectora destinarán las partidas necesarias en su presupuesto para asegurar el manejo y protección del área.
Artículo 7°-Se establece en 10 hectáreas el área de la parcela mínimo productivo. Por lo tanto no pueden autorizarse segregaciones cuyas parcelas resultantes sean inferiores a esa unidad mínimo productivo.
Artículo 8°-Este Decreto rige a partir de su publicación.
Dado en la Presidencia de la República. -San José, a Ios diez días del mes de enero de mil novecientos ochenta y seis.” Para clarificar el tema de si esta Zona Protectora se corresponde con la Reserva Forestal creada por la norma atípica del artículo 26 de la Ley 7018, resulta de particular trascendencia el criterio técnico contenido en el informe del Sistema Nacional de Áreas de Conservación, número SINAC-ACLAC-AL-241-2023, de 19 de setiembre de 2023, el cual señala que:
“[E]l Decreto Ejecutivo número DE-16815-MAG, de 10 de enero de 1986, que crea la Zona Protectora Río Pacuare, son los mismos limites que aplican para la denominada Reserva Forestal Río Pacuare, creada mediante el Artículo 26 de la Ley N°7018: Ley de Presupuesto Ordinario para el Período Fiscal de 1986.” De tal manera, es claro que la declaratoria de inconstitucionalidad del artículo 26 de la Ley 7018, dista de configurar una desprotección del área señalada, por cuanto la misma zona, con los linderos definidos por el Decreto y la garantía que otorga la necesaria observancia de la Ley Forestal, mantiene la plena protección que corresponde en virtud del artículo 50 de la Constitución Política. Nótese que el Decreto en cuestión, se adopta para desarrollar las obligaciones establecidas en la Ley Forestal, y el mismo Decreto señala que lo allí dispuesto, debe acordarse en aplicación y respeto de la Ley Forestal, y de conformidad con la definición, valoración y resolución que al respecto se haga desde la Dirección General Forestal -cfr. artículos 2 y 3 del Decreto DE-16815-MAG-, de donde resulta que todo régimen de afectación, protección y desarrollo, así como actividades que puedan implementarse o ejecutarse, debe valorarse y determinarse no sólo sobre la base de este Decreto, sino, especialmente, de conformidad con lo que establezca la Ley Forestal y por parte de la Dirección General Forestal, de donde resulta, que todo el régimen relacionado se encuentra circunscrito a las definiciones legalmente establecidas y a la trascendencia que en el ámbito de la legalidad pudiere haber para situaciones concretas.
Asimismo, debe tomarse en consideración que, tratándose de la determinación de linderos de áreas de protección, la jurisprudencia de la Sala ha sido cuidadosa en señalar que será la afectación negativa de tales linderos -es decir, la disminución de área- la que deba disponerse por ley -ver sentencias de esta Sala, números 1993-5399, 2006-5975 y 2023-12817-, situación que, claramente, en este caso no se presenta, pues de lo que versa el decreto en cuestión es la definición de un área que se estima protegida en virtud de lo estatuido por la Ley Forestal, y no de la disminución de dicha área.
VII.En definitiva, al acreditarse que el artículo cuestionado es una norma atípica de la Ley número 7018, Ley de Presupuesto 1986 (ordinario y extraordinario), lo que corresponde es declarar con lugar esta acción, tal como se indica en la parte dispositiva de esta sentencia.
Por tanto
Se declara con lugar la acción. En consecuencia, se anula por inconstitucional el artículo 26 de la Ley número 7018, Ley de Presupuesto 1986 (ordinario y extraordinario). La declaración de inconstitucionalidad tendrá efecto retroactivo y declarativo a la fecha de vigencia de la norma antedicha, con la advertencia que la Zona Protectora Río Pacuare se mantiene incólume, de acuerdo con lo establecido en el Decreto Ejecutivo No. 16815-MAG, y sin perjuicio de derechos adquiridos de buena fe, de conformidad con el artículo 91 de la Ley de la Jurisdicción Constitucional. La magistrada Garro Vargas pone nota. Reséñese este pronunciamiento en el Diario Oficial La Gaceta y publíquese íntegramente en el Boletín Judicial. Notifíquese.
