Document Review CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine hours and fifteen minutes on the eighth of October of two thousand and twenty-one.

Writ of amparo (recurso de amparo) processed under case file N° 21-015688-0007-CO, filed by Nombre01, residence identification number CED01, against the MUNICIPALIDAD DE CARRILLO AND THE SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN.

WHEREAS:

  1. 1By means of a written submission received at the Chamber Secretariat at 10:23 hours on August 12, 2021, the petitioner filed a writ of amparo against the Municipalidad de Carrillo and the Sistema Nacional de Áreas de Conservación. He explains that, since September 2020, he has filed formal complaints (denuncias) for pollution before the Área de Conservación Tempisque and the Municipalidad de Carrillo, thereby notifying both authorities of the construction of makeshift structures within the protection zone (área de protección) of the Zapotal River. Despite this, he alleges that neither entity has ordered precautionary measures (medidas cautelares) to halt the violations of environmental regulations. He asserts that on September 16, 2020, he filed formal complaints before the Área and the Municipalidad named in this action and from that moment requested the immediate removal of the harmful works.This situation was acknowledged in official communication N° ACT-OSRSCC-237-2021, which stated that: "(...) the construction is located 100 percent within the water protection zone described in Article 33 of Ley 7575." He contends that the administrative authorities have limited themselves to disclaiming jurisdiction and referring the complaints to the Ministerio Público, as evidenced by criminal case N° 20-001215-0800-PE. He states that, on February 24, 2021, the group Ríos Guanacaste again urged officials of the Área de Conservación Tempisque and of the Municipalidad de Carrillo to address the seriousness of the works and the absence of preventive action. Additionally, he reported that the situation had grown beyond a single illegal construction within the protection zone of the Zapotal River, as tires were also being stockpiled there; this was brought to the attention of the criminal proceedings by means of a written submission filed on April 9, 2021, which also requested the issuance of a precautionary measure.He adds that on April 30, 2021, in addition to all of the foregoing violations continuing, a completely healthy tree was felled, in contravention of Article 34 of the Ley Forestal; he notes that this too was reported to the Área de Conservación Tempisque, the Municipalidad de Carrillo, and the Ministerio Público. Nonetheless, the absence of action has led to a proliferation of constructions, which now feature concrete floors and retaining walls built from tires, all situated along the edge of the riverbed (cauce) of the river. Furthermore, these structures fall within the forty-meter protection radius of a licensed well located on a neighboring property, in detriment to the provisions of Article 8 of the Ley de Aguas. According to Article 13 of the Reglamento de Perforación del Subsuelo para la Exploración y Aprovechamiento de Aguas Subterráneas, this setback exists to protect the aquifer (acuífero) from adjacent works that could affect it and thereby cause the contamination of groundwater (aguas subterráneas).The threat of groundwater contamination is an especially serious matter, more so in Guanacaste, where stable sources of that liquid are scarce. He further notes that the presence of tires in the protection zone of a river, used as a retaining wall for the riverbed, is equally serious. He considers that all of the above infringes upon his fundamental rights. He requests that the writ be granted.
  2. 2By means of a resolution issued at 16:09 hours on August 12, 2021, this proceeding was admitted.
  3. 3Carlos Gerardo Cantillo Álvarez, in his capacity as Mayor of the Municipalidad de Carrillo, reports under oath that the municipality did indeed learn of the alleged encroachment upon the protected environmental area, whereupon Henry Abarca Morales, the municipal environmental manager (gestor ambiental municipal), proceeded through official communication N° MC-DGA-O58-2020 of September 24, 2020, to notify the Sub-Regional Office of the Sistema de Áreas de Conservación of the Ministerio del Ambiente of the events, for the technical purpose of ensuring compliance with Articles 6 and 54 of Ley N° 7575. He notes that the municipality has chosen to respect the jurisdictional boundaries that the Constitutional Chamber itself has clarified with regard to the administration and protection of this type of territory (protected wildlife areas (áreas silvestres protegidas) within protected zones (zonas protectoras)).He mentions that, also in response to the petitioner's request, prior to the aforementioned referral by official communication N° MG-DGA-058-2020, a field inspection of the site was conducted in order to determine both the exact location of the encroachment and the identification of the encroacher or encroachers. He states that said inspection was carried out by the municipal environmental manager accompanied by Francisco Moraga Chavarría, notification inspector of the Municipal Territorial Development Department, and yielded the result that the location of the encroachment corresponds to land whose administration, oversight, and obligation to file the corresponding criminal complaint in the event of an encroachment falls primarily and by law upon the Ministerio de Ambiente y Energía, which is why they proceeded to refer the matter to that authority as indicated. He clarifies that, according to official communication N° ACT-OSRSCC-1067-2020 of October 13, 2020, signed by Engineer Orlando Matarrita Suárez, it is confirmed that the encroached land is located in "(…) the water protection zone established by the Ley Forestal (…)." He clarifies that the municipality carries out eviction and/or demolition operations on constructions built without an environmental feasibility clearance (viabilidad ambiental) or that, even when possessing such clearance, subsequently cause pollution.He notes that the powers of closure and demolition without jurisdictional limitation are held by both the Ministerio de Ambiente y Energía and the Ministerio de Salud, both of which were and remain aware of the alleged facts. He notes that the municipality is always available to assist in the demolition or eviction of structures not necessarily located on the land it administers, provided that a formal criminal complaint has been duly filed by the Ministerio de Ambiente y Energía, or alternatively, that a judicial order has been issued pursuant to Article 140 of the Código Procesal Penal, whereby a judge orders, as a provisional measure, the restoration of things to the state they were in before the act in question; all of this because they do not wish to act without proper authorization or to destroy evidentiary material belonging to the encroachers and thereby obstruct the criminal proceedings.He mentions that the matter is currently pending in criminal case N° 20-001215-0800-PE before the Criminal Court of the II Circuit of Guanacaste, against Nombre02 and Nombre03, who have been identified as alleged suspects of the offense of encroachment upon a conservation area. He requests that the writ be denied.
  4. 4Nelson Marín Mora, in his capacity as Regional Director of the Área de Conservación Tempisque, testifies under oath that the Santa Cruz Carrillo Sub-Regional Office of the Área de Conservación Tempisque attended to the complaints and carried out the corresponding administrative and judicial management actions as required by law. He states that on September 24, 2020, the Santa Cruz Carrillo Sub-Regional Office received official letter No. MC-DGA-058-2020, signed by biologist Henry Abarca Morales, acting as environmental manager (gestor ambiental) of the Municipalidad de Carrillo. That official letter indicates that the Municipalidad de Carrillo had received several complaints regarding the construction of structures within the protection zone of various public-domain watercourses (cauces de dominio público). Since, in order to carry out the notification process and eventual demolition of the built structures, they considered it necessary to obtain a certification from SINAC to serve as legal and technical input for conducting the proper administrative due process.In response to official letter No. MC-DGA-058-2020, the Head of the Santa Cruz Carrillo Office, Orlando Matarrita Suarez, sent the Municipalidad de Carrillo official letter No. ACT-OSRSCC-1067-2020, which states the following: "(…) It is hereby certified that the Galerón in Sardinal de Carrillo, from Dirección01, 200 meters southeast, cadastral plan (plano catastrado) number G-86661-1992, is located in its entirety—100 percent of its area—within the hydrological protection zone (área de protección hídrica) established by the Ley Forestal under Article 33, subparagraph B, thus complying with the request made by the Municipalidad de Carrillo, Guanacaste (…)." In view of the aforementioned official letter, that case was taken up ex officio by the office as a new environmental complaint (denuncia ambiental), and therefore, on September 28, 2021, Case No. 22976-2020 was created in the institutional platform known as SITADA and assigned to forestry engineer (ingeniero forestal) Carlos Pizarro Barrantes, who visited the site that same day—September 28, 2020.From that visit arose official letter No. ACT-OSRSCC-1036-2020 of October 6, 2020, which was forwarded to the sub-delegation of the Judicial Investigation Agency (Organismo de Investigación Judicial) of Santa Cruz on October 7, 2020, and investigation case file (expediente) No. 20-0001215-0800-PE was opened. On February 2, 2021, the Santa Cruz Carrillo Office received official letter No. MC-ALC-0198-2021, signed by the Municipal Mayor of Carrillo, forwarding the complaint regarding encroachment on the hydrological protection zone of stream (quebrada) Zapotal and construction without a municipal permit, so that SINAC could provide the appropriate administrative and judicial attention to the case. In response to that official letter, his office, through official letter No. ACT-OSRSCC-237-2021, informed the Municipal Mayor of Carrillo on February 24, 2021, as follows: "This sub-regional office received from you, on February 2, 2021, official letter MC-ALC-0198-2021, in which you notify this office of four cases of apparent encroachment upon the protection zones of public-domain watercourses." In that regard, the following is indicated: Case No. 1, construction within the hydrological protection zone of stream Zapotal, located in the Zapotal de Carrillo sector, at the site with coordinates 1161386-303911.This case was already known to the office, as the complaint had been entered into SITADA under consecutive number 22976-2020, and after being attended to, the report was forwarded through official letter No. ACT-OSRSCC-1036-2020 of October 6, 2020; the matter is under investigation by the Organismo de Investigación Judicial under case No. 20-001215-0800-PE; however, the status of the investigation is unknown. Pursuant to official letter No. ACT-OSRSCC-1067-2020, this officer, at the municipality's request, issued a certification that the construction is located 100 percent within (sic) the hydrological protection zone described in Article 33 of Ley 7575; therefore, regardless of the outcome in criminal jurisdiction (sede penal), since the construction was erected without a municipal permit, it is the absolute responsibility of that municipality to take action to demolish the structure. He clarifies that hydrological protection zones on private land remain private property, even though they carry a use restriction; consequently, they are not areas administered by SINAC – MINAE as part of the State Natural Heritage (Patrimonio Natural del Estado).In March 2021, the Santa Cruz Office received a written submission from the appellant reporting works encroaching on the hydrological protection zone at the same location. As his petition, the individual states verbatim: "Based on the factual and legal conditions set forth, this Conservation Area is requested to proceed with the removal of the works encroaching on the protection zone of the río Zapotal." On April 12, 2021, the sub-regional office sent the petitioner (tutelado) official letter No. ACT-OSRSCC-484-2021, informing him verbatim that, in response to the written complaint filed with that office on March 4, 2021, regarding activities encroaching on the hydrological protection zone of stream Zapotal, Playa Zapotal de Carrillo, Guanacaste, entered into SITADA under consecutive number 25710-2021, the following is stated: "This case had already been addressed by this office in October 2020, and since the alleged offender could not be located, this office referred the case to the OIJ sub-delegation in Santa Cruz for that agency to handle the investigation." The matter has been assigned judicial case file No. 20-001215-0800-PE.In this same case, on the recommendation of the assistant environmental prosecutor (Fiscala ambiental auxiliar) of Santa Cruz, his office, subsequent to April 12, 2021, conducted at least two visits to the site in order to serve the alleged offender with an administrative order to halt the environmentally harmful actions and, at the same time, to issue an order requiring the alleged offender to remove the works by his own means, failing which he would be reported for contempt of authority (desacato a la autoridad); however, on none of those occasions were any occupants found at the dwelling, making it impossible to carry out that administrative action. He clarifies that the case reported by the appellant, following the investigation conducted by the Organismo de Investigación Judicial, is now being prosecuted as a criminal matter by the Public Prosecutor's Office (Fiscalía) of Santa Cruz under case file No. 20-0001215-0800-PE. This demonstrates fulfillment of their environmental obligations. He requests that the appeal be dismissed.
  5. 5According to the certification of the Judicial Clerk and the Secretary of this Chamber, it is indicated that it did not appear—it did not appear—that, between August 24, 2021 and August 31, 2021, the Director of SINAC filed any written submission or document in order to render the report requested in the resolution issued at sixteen hours nine minutes on the twelfth of August two thousand twenty-one, in case file No. 21-015688-0007-CO.
  6. 6By resolution issued at 11:34 hours on September 17, 2021, this Court requested, as evidence for better adjudication: "a report from THE COORDINATING JUDGE OF THE CRIMINAL COURT (JUZGADO PENAL) OF THE SECOND JUDICIAL CIRCUIT OF GUANACASTE, to forward, in a sealed envelope, a certified copy of criminal case No. 20-001215-0800-PE, brought against Nombre02 and Nombre03, which shall not be incorporated into the digital case file or made publicly accessible. Likewise, the authorities of the Regional Directorate of the Área de Conservación Tempisque of SINAC and of the Municipalidad de Carrillo are hereby notified of the reports rendered by those authorities, so that they may comment on the arguments each of them raises regarding their own competences and those of the opposing institution (…)."
  7. 7Jorge Vallejos González, in his capacity as Coordinating Judge of the Criminal Court of Santa Cruz, testifies under oath that criminal case No. 20-001215-0800-PE has not been received by that court.
  8. 8Nelson Marín Mora, in his capacity as Director of the Área de Conservación Tempisque, testifies under oath that the Municipal Mayor gave notice of the events in order to comply with the provisions set forth in Articles 6 and 54 of the Ley Forestal. For that reason, the field inspection was conducted, which generated the report forwarded to the judicial authorities and gave rise to criminal case No. 20-001215-0800-PE. He states that the location of the alleged encroachment corresponds to land whose administration, oversight, protection, and obligation to file a criminal complaint in the event of encroachment falls primarily under MINAE. He emphasizes that the encroachment occurred on private land, located outside the State Natural Heritage, and that the construction lacked municipal permits.
  9. 9The legal requirements have been fulfilled in the proceedings followed.

The opinion is written by Justice Araya García; and,

CONSIDERING:

I. PRELIMINARY MATTER

Before analyzing the merits of the case, it must be clarified that, as of Judgment No. 2008-02545 issued at 08:55 hours on February 22, 2008, this Chamber has referred—with certain exceptions—to the administrative contentious jurisdiction (jurisdicción contenciosa administrativa) those matters in which it is disputed whether the public administration has or has not complied with the deadlines established by the Ley General de la Administración Pública (Articles 261 and 325) or by sector-specific laws governing special administrative proceedings, for the purpose of resolving by final administrative act (acto final) an administrative proceeding (procedimiento administrativo)—initiated ex officio or at the request of a party—or hearing the applicable administrative appeals. It is precisely in the sub lite that an exceptional scenario is presented, in view of the apparent failure to resolve an environmental complaint. In light of the subject matter of environmental complaints, this Chamber assesses potential delays in the resolution of proceedings of this type. Having clarified this point, the Court proceeds to resolve the specific situation raised in this amparo (constitutional protection proceeding).

II. SUBJECT MATTER OF THE APPEAL

The appellant requests that this Court order the respondent authorities to immediately remove the reported works constructed within the protection zone of the río Zapotal and to take the necessary measures for the recovery of the area.

III. PROVEN FACTS

Of importance for the decision in this matter, the following facts are deemed duly established:

1. On September 16, 2020, the appellant filed complaints with the Área de Conservación Tempisque and with the Municipalidad de Carrillo regarding the apparent encroachment on a protection zone, requesting the immediate removal of the constructed works (uncontested fact).

2. Regarding the actions taken by the Municipalidad de Carrillo:

  • a)Upon learning of the encroachment in the protected environmental area, the municipality proceeded, through official letter No. MC-DGA-O58-2020 of September 24, 2020, to notify the Sub-Regional Office of SINAC of MINAE of what had occurred (see sworn report and supporting evidence submitted).
  • b)According to official letter No. MG-DGA-058-2020, a field inspection was conducted at the site of the events in order to determine both the exact location of the encroachment and to identify the individuals responsible. The inspection was carried out by the municipal environmental manager, accompanied by an inspector from the Municipal Territorial Development Department, and it was determined that the location of the encroachment corresponds to land whose administration, oversight, and obligation to file the corresponding criminal complaint in the event of encroachment falls primarily and by law upon MINAE (see sworn report and supporting evidence submitted).
  • c)According to official communication No. ACT-OSRSCC-1067-2020 of October 13, 2020, signed by Engineer Orlando Matarrita Suárez, it is confirmed that the invaded land lies within a water protection zone (área de protección hídrica) established under the Ley Forestal (see sworn report and supporting evidence submitted).
  • d)Within criminal case (causa penal) No. 20-001215-0800-PE, pending before the Criminal Court of the Second Judicial Circuit of Guanacaste, a complaint was filed regarding the apparent invasion of a protected area against Nombre02 and Nombre03, who have been identified as alleged suspects of the offense of invasion of a conservation area (see sworn report and supporting evidence submitted).

3. Regarding the Actions of the Tempisque Conservation Area:

  • a)On September 24, 2020, the Santa Cruz Sub-regional Office received official communication No. MC-DGA-058-2020, signed by biologist Henry Abarca Morales, acting as environmental officer (gestor ambiental) of the Municipalidad de Carrillo. In that communication, it was indicated that the Municipalidad de Carrillo had received several complaints regarding the construction of buildings within the protection zone of several public waterways (cauces de dominio público) (see sworn report and supporting evidence submitted).
  • b)In response to official communication No. MC-DGA-058-2020, the Head of the Santa Cruz Office forwarded to the Municipalidad de Carrillo official communication No. ACT-OSRSCC-1067-2020, in which the following was stated: "(…) It is hereby confirmed that the shed (Galerón) in Sardinal de Carrillo, from Dirección01, 200 meters to the southeast, cadastral survey plan (plano catastrado) number G-86661-1992, is located one hundred percent within the water protection zone established by the Ley Forestal under Article 33, paragraph B. This is provided in compliance with the request made by the Municipalidad de Carrillo Guanacaste (…)". In light of the aforementioned communication, the office took up the matter on its own initiative as a new environmental complaint and, accordingly, on September 28, 2020, created case No. 22976-2020 in the institutional platform known as SITADA, which was assigned to forestry engineer Carlos Pizarro Barrantes. That same day, he visited the site and generated official communication No. ACT-OSRSCC-1036-2020 of October 6, 2020, which was forwarded to the OIJ Sub-delegation of the Organismo de Investigación Judicial of Santa Cruz on October 7, 2020, thereby initiating investigation file No. 20-0001215-0800-PE (see sworn report and supporting evidence submitted).
  • c)On February 2, 2021, the Santa Cruz Carrillo office received official communication No. MC-ALC-0198-2021, signed by the Municipal Mayor of Carrillo, by which the Mayor forwarded the complaint regarding the invasion of the protection zone of the Zapotal stream (quebrada Zapotal) and the unauthorized construction without a municipal permit, so that SINAC could provide the case with administrative and judicial attention (see sworn report and supporting evidence submitted).
  • d)In March 2021, the Santa Cruz office received a written submission from the petitioner (recurrente), in which he reported encroachments on the water protection zone at the same location (see sworn report and supporting evidence submitted).
  • e)On April 12, 2021, the Sub-regional Office forwarded to the protected party (tutelado) official communication No. ACT-OSRSCC-484-2021, in response to the complaint filed before that office on March 4, 2021, concerning the activities of encroachment on the water protection zone of the Zapotal stream, in which the following was stated: "This case had already been addressed by this office in October 2020, and since the alleged offender was not found, this office referred the case to the OIJ Sub-delegation in Santa Cruz so that that entity could take charge of the investigation" (see sworn report and supporting evidence submitted).

IV. ON THE FUNDAMENTAL RIGHT TO A HEALTHY AND ECOLOGICALLY BALANCED ENVIRONMENT

Article 50 of the Constitution establishes that every person has the right to a healthy and ecologically balanced environment, a right with broad content equivalent to the aspiration to improve the human living environment, such that it extends beyond criteria of natural conservation to encompass every sphere in which a person develops, whether family, work, or the surroundings in which that person lives. Hence the assertion that this is a cross-cutting right (derecho transversal); that is, one that runs throughout the entire legal order, shaping and reinterpreting its institutions.

The environment is defined by the Real Academia Española de la Lengua as the "conjunto de circunstancias físicas que rodean a los seres vivos" [set of physical circumstances surrounding living beings], which further underscores the general character of the right. The right to an ecologically balanced environment, on the other hand, is a more restricted concept referring to an important part of that surroundings in which a person develops—namely, the balance that must exist between societal progress and the conservation of natural resources. Both rights are expressly recognized in Article 50 of the Constitution, which defines the Social State under the Rule of Law (Estado Social de Derecho). The placement of the right to a healthy and ecologically balanced environment within the constitutional framework of the Social State under the Rule of Law is the starting point from which this right must be analyzed.

The Social State under the Rule of Law gives rise to the phenomenon of incorporating into the foundational text a series of highly socially relevant political objectives and of introducing a significant number of social rights that ensure the common good and the satisfaction of the essential needs of individuals. From this perspective, the Constitution emphasizes that the protection of natural resources is an appropriate means of safeguarding and improving the quality of life of all, which necessitates the intervention of public authorities with respect to factors that may disrupt the balance of natural resources and, more broadly, hinder individuals from developing and living in a healthy environment. Just as the principle of the Social State under the Rule of Law is directly applicable, so too is the right to a healthy and ecologically balanced environment, which manifests in the dual dimension of a subjective right of individuals and as a goal or objective of the actions of public authorities in general.

The impact that the right to a healthy and ecologically balanced environment has on the activities of the State finds its primary justification in the fact that, by definition, rights are not confined to the private sphere of individuals but also have significance in the very structure of the State in its role as guarantor of those rights, and secondly, because the activities of the State are directed toward satisfying the interests of the community.

The Constitution establishes that the State must guarantee, defend, and preserve that right. Prima facie, to guarantee means to ensure and protect the right against some risk or need; to defend means to prohibit and prevent any activity that infringes upon the right; and to preserve is an action aimed at proactively shielding the right from possible dangers so as to make it endure for future generations. The State must assume a dual obligation of action and restraint: on one hand, it must refrain from itself threatening the right to a healthy and ecologically balanced environment, and on the other hand, it must undertake the task of enacting the measures needed to meet the constitutional requirements. (Judgment No. 00644–99 of 11:24 hours of January 29, 1999; see also Judgment No. 4947-2002 of 09:24 hours of May 24, 2002).

V. ON THE SPECIFIC CASE

The petitioner brings an amparo constitutional protection action and requests that this Court order the Municipalidad de Carrillo and SINAC to immediately remove the reported works that were constructed within the protection zone of the Zapotal stream and to take the necessary measures for the recovery of the area.

Now, from the report submitted by the respondent authorities under the solemnity of oath, it is corroborated that the Municipalidad de Carrillo, upon learning of the cited invasion of the protected environmental area, proceeded—through official communication No. MC-DGA-O58-2020 of September 24, 2020—to notify the Sub-Regional Office of SINAC of the Ministry of Environment and Energy (MINAE) of what had occurred. By means of that communication, a field inspection of the site was conducted in order to determine both the exact location of the invasion and the identity of the invader or invaders. Said inspection was carried out by the municipal environmental officer accompanied by the notification inspector of the Municipal Territorial Development Department, and its findings indicated that the location of the invasion corresponds to land whose administration, surveillance, and obligation to file criminal complaints in the event of invasion is assigned by law to MINAE.

It is noted that the matter is currently under investigation within criminal case No. 20-001215-0800-PE, before the Criminal Court of the Second Judicial Circuit of Guanacaste, against Nombre02 and Nombre03, who have been identified as alleged suspects of the offense of invasion of a conservation area. The authorities state that they cannot demolish the reported structures unless a formal criminal complaint has been properly filed by MINAE, or alternatively, unless a judicial order is issued as specified in Article 140 of the Code of Criminal Procedure, whereby a judge orders, as a provisional measure, the restoration of things to the state they were in before the act occurred—all of this because they do not wish to act without standing or to destroy evidentiary proof belonging to the invaders, thereby obstructing the criminal proceedings.

Furthermore, based on the report submitted by the authorities of the Área de Conservación Tempisque, it is established that on September 24, 2020, the Sub-regional Office of Santa Cruz Carrillo received official communication (oficio) N° MC-DGA-058-2020, signed by biologist Henry Abarca Morales, acting as environmental officer (gestor ambiental) for the Municipalidad de Carrillo. In that communication, it was stated that the Municipalidad de Carrillo had received several complaints regarding the construction of structures within the protection zone of several public-domain waterways (cauces de dominio público); however, they clarified that, in order to carry out the notification process and the eventual demolition of the constructed structures, they considered it necessary for the Sistema Nacional de Áreas de Conservación (SINAC) to issue a certification. In response to official communication N° MC-DGA-058-2020, the Head of the Santa Cruz Carrillo Office sent the Municipalidad de Carrillo official communication N° ACT-OSRSCC-1067-2020, in which it states: "(…) It is hereby certified that the Galerón in Sardinal de Carrillo (…) is located, one hundred percent of its extent, within the water protection zone (área de protección hídrica) established by the Ley Forestal under article 33, subsection B. This is thus done in compliance with the request by the Municipalidad de Carrillo Guanacaste (…)".

In view of the cited communication, that case was assumed ex officio by that authority as a new environmental complaint and, therefore, on September 28, 2020, case N° 22976-2020 was created in the institutional case-management platform, and on that same date, a site visit was conducted and official communication N° ACT-OSRSCC-1036-2020 of October 6, 2020 was generated, which was forwarded to the Sub-delegation of the Organismo de Investigación Judicial (OIJ) of Santa Cruz on October 7, 2020. As a result, investigative case file (expediente) N° 20-0001215-0800-PE was opened. Subsequently, on February 2, 2021, the Santa Cruz Carrillo office received official communication N° MC-ALC-0198-2021, signed by the Municipal Mayor of Carrillo, through which the complaint was forwarded regarding the encroachment on the protection zone of the stream (quebrada) Zapotal and construction without a municipal permit; this was done so that SINAC would provide administrative and judicial attention to the case.

Additionally, on April 12, 2021, the Sub-regional Office sent the protected party (tutelado) official communication N° ACT-OSRSCC-484-2021, in response to the complaint filed before that office on March 4, 2021, concerning the encroachment on the water protection zone of the Zapotal stream, and informed him of the following: "This case had already been addressed by this office in October 2020, and since the alleged offender was not found, this office referred the case to the sub-delegation of the OIJ in Santa Cruz so that that body would handle the investigation." Having analyzed the factual background presented, as well as the evidence on the record, this Tribunal finds it established that the respondent authorities have confirmed the presence of encroachers in the water protection zone that is the subject of this writ and that, in response, they have taken various measures within the scope of their respective competencies.

In the same vein, it is established that they have attended to the petitioner's (recurrente's) requests by conducting the corresponding inspections and providing written responses to his complaints. Additionally, it is verified that both the Municipalidad de Carrillo and the Área de Conservación Tempisque have followed up on the criminal case before the OIJ by carrying out the appropriate proceedings. For all the foregoing reasons, this Court dismisses the alleged inaction on the part of the respondent authorities in processing the complaint filed by the protected party (amparado), and accordingly the appropriate ruling is to deny the writ, as is hereby ordered.

VI. TAKE NOTE, RESPONDENT AUTHORITIES

Notwithstanding the denial of this writ, it is necessary to remind the respondent authorities of their responsibility to diligently manage proceedings within the framework of their respective competencies, as well as their duty to seek a prompt and effective resolution to the situation that is the subject of this writ, within the scope of their competencies, since it is undeniable that the problem reported threatens the fundamental right to a healthy and ecologically balanced environment, and requires definitive attention and resolution.

VII. SEPARATE CONCURRING REASONS OF MAGISTRATE SALAZAR ALVARADO

With due respect, I agree with the majority opinion denying the writ; however, I ground my concurrence on the following reasons.

The protection of a healthy and ecologically balanced environment within the Costa Rican legal order (Ordenamiento Jurídico Costarricense) is safeguarded not only by Article 50 of the Political Constitution, but also by a number of currently in-force laws and executive decrees (regulations), such as the Ley Orgánica del Ambiente, Ley N° 7554 of October 4, 1995; the Ley de Biodiversidad, Ley N° 7788 of April 30, 1998; the Ley de Conservación de la Vida Silvestre, Ley N° 7317 of October 21, 1992; and Decreto Ejecutivo N° 31849 of May 24, 2004, Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental (EIA), to cite only a few. This makes it necessary, in environmental matters, to distinguish between constitutional review and legality review. In this regard, it is the opinion of the undersigned that this Court, by way of amparo (recurso de amparo), should only hear a matter in which a violation of the right to a healthy and ecologically balanced environment is alleged if the Administration has not yet intervened, and when the violation of that right is manifest and evident, easily verifiable, of a certain significance or gravity, and directly affects a specific person or community.

Otherwise, the matter must be raised and resolved through ordinary legal channels (vía de legalidad). Therefore, the mere failure to comply with obligations and duties imposed by law on the various public administrations in environmental matters is properly addressed through ordinary legal channels—administrative or judicial—where violations and omissions may be scrutinized with much greater breadth. It must be borne in mind that the writ of amparo is a summary, informal, simple, and expeditious proceeding, such that from the very moment the Administration intervenes in an environmental matter in the exercise of its competencies and conducts a proceeding through the issuance of administrative acts, the matter falls outside the scope of action of this specialized jurisdiction. Consequently, the review of administrative actions taken in connection with an environmental matter that requires, for its proper assessment, full plenary proceedings is only possible in the ordinary courts, since the design of the amparo proceeding is incompatible with the comparison or review of technical or legal criteria developed under existing legal or regulatory rules, or with the gathering of new and additional evidentiary elements necessary to compare or review criteria already on record in the administrative case file of the matter.

The contrary would transform the amparo into an ordinary plenary proceeding, which would distort its nature and render nugatory the purposes for which it was designed, thereby causing it to lose its character as an instrument for the effective protection of fundamental rights. As a consequence of the foregoing, I am of the opinion that when a public body or organ has intervened in various ways, or has issued administrative acts in relation to an environmental matter, its review and oversight fall within the competence of the administrative contentious jurisdiction (jurisdicción de lo contencioso-administrativo). It is precisely the verification of the existence of such administrative intervention that determines that the matter falls within the competence of the ordinary legal track. Accordingly, this writ should have been rejected outright, as its subject matter is a question that is properly to be debated, analyzed, and resolved through ordinary legal channels.

However, since that course of action was not taken, the appropriate ruling is to deny it, without making any pronouncement regarding the merits of the issue raised, as it falls to the ordinary courts—specifically, the administrative contentious jurisdiction—to determine whether the administrative actions and conduct at issue do or do not conform, in substance, to the provisions of the legal order regarding the protection, safeguarding, and conservation of the right to a healthy and ecologically balanced environment.

VIII. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are hereby advised that any document submitted in paper form, as well as any objects or evidence contained in additional electronic, computer, magnetic, optical, telematic, or new-technology devices, must be retrieved from the Office within a maximum period of thirty business days counted from the date of notification of this Judgment. Otherwise, all material not retrieved within this period will be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by the Corte Plena in Session N° 27-11 of August 22, 2011, article XXVI, and published in the Boletín Judicial N° 19 of January 26, 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial, in Session N° 43-12 held on May 3, 2012, article LXXXI.

POR TANTO:

The writ is denied. The respondent authorities are advised to take note of what is stated in Considerando VI of this Judgment. Magistrate Salazar Alvarado sets forth separate concurring reasons.— Fernando Castillo V.

Revisión del Documento SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas quince minutos del ocho de octubre de dos mil veintiuno .

Recurso de amparo que se tramita bajo el expediente N° 21-015688-0007-CO, interpuesto por Nombre01, cédula de residencia CED01, contra la MUNICIPALIDAD DE CARRILLO Y EL SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN.

RESULTANDO:

  1. 1Por medio del escrito recibido ante la Secretaría de la Sala a las 10:23 horas del 12 de agosto de 2021, el recurrente presentó un recurso de amparo contra la Municipalidad de Carrillo y el Sistema Nacional de Áreas de Conservación. Explica que, desde el mes de septiembre de 2020, ha procedido a entablar denuncias por contaminación ante el Área de Conservación Tempisque y la Municipalidad de Carrillo, con lo cual, ha informado a ambas autoridades acerca de la construcción de estructuras de carácter precario dentro del área de protección del río Zapotal. Pese a ello, acusa que ninguna de esas entidades ha ordenado medidas cautelares para frenar las violaciones a la normativa ambiental. Esgrime que el 16 de septiembre de 2020, planteó denuncias ante el Área y la Municipalidad accionadas y desde ese momento pidió la remoción inmediata de las obras dañinas. Esta situación fue reconocida en el oficio N° ACT-OSRSCC-237-2021, que indicó que: "(...) la construcción se ubica en un 100 por dentro del área de protección hídrica descrita en el artículo 33 de la Ley 7575".Asevera que las autoridades administrativas se han limitado a declinar su competencia y elevar las denuncias al Ministerio Público, según se desprende del proceso penal N° 20-001215-0800-PE. Dice que, para el 24 de febrero de 2021, la agrupación Ríos Guanacaste insistió a los funcionarios del Área de Conservación Tempisque y a los de la Municipalidad de Carrillo, sobre la gravedad de las obras y la ausencia de acciones preventivas. Adicionalmente, reportó que ya no se trataba solamente de una construcción ilegal dentro del área de protección del río Zapotal, sino que además se estaban acumulando llantas y esta situación fue puesta en conocimiento incluso, dentro del expediente penal, por medio de escrito presentado el 09 de abril de 2021; allí también se requirió el dictado de una medida cautelar. Agrega que el 30 de abril de 2021, además de mantenerse todas las violaciones descritas, se derribó un árbol completamente sano, lo que contraviene el artículo 34, de la Ley Forestal, señala que también fue reportado al Área de Conservación Tempisque, a la Municipalidad de Carrillo y al Ministerio Público; no obstante, la ausencia de acciones, ha provocado la proliferación de construcciones, las cuales tienen ahora pisos de concreto, muros de contención construidos con llantas y, todo eso, al borde del cauce del río.Además, se encuentran dentro del radio de protección de cuarenta metros de un pozo concesionado ubicado en una propiedad cercana, en detrimento de lo establecido en el artículo 8, de la Ley de Aguas. Según el artículo 13, del Reglamento de Perforación del Subsuelo para la Exploración y Aprovechamiento de Aguas Subterráneas, este retiro tiene la finalidad de proteger el acuífero contra obras aledañas que puedan afectarlo y, en consecuencia, causar la contaminación de aguas subterráneas. La amenaza de contaminación de aguas subterráneas es un asunto especialmente grave, más en Guanacaste donde escasean las fuentes estables de ese líquido. Por otro lado, señala que la presencia de neumáticos en el área de protección de un río, usados como muro de retención del cauce, es igualmente grave. Estima que todo lo descrito lesiona sus derechos fundamentales. Solicita se declare con lugar el recurso
  2. 2Mediante resolución de las 16:09 horas del 12 de agosto de 2021, se dio curso a este proceso.
  3. 3Informa bajo juramento Carlos Gerardo Cantillo Álvarez, en su condición de Alcalde de la Municipalidad de Carrillo, que, efectivamente, el municipio tuvo la noticia de la invasión citada al área ambiental protegida, razón por la cual Henry Abarca Morales, gestor ambiental municipal, procedió mediante el oficio N° MC-DGA-O58-2020 del 24 de septiembre de 2020, a dar aviso de lo acontecido a la Oficina Sub Regional del Sistema de Áreas de Conservación del Ministerio del Ambiente, con el fin técnico de que se cumpliera lo estipulado en los artículos 6 y 54, de la Ley N° 7575. Comenta que el municipio ha optado por ser respetuoso de las competencias que incluso la Sala Constitucional ha aclarado en cuanto a la administración y resguardo de este tipo de territorios (áreas silvestres protegidas propiamente en zonas protectoras). Menciona que siempre en atención al requerimiento del recurrente, con anterioridad al citado traslado mediante oficio N° MG-DGA-058-2020, se realizó una inspección de campo al sitio de los hechos a fin de determinar tanto la ubicación exacta de la invasión como la individualización de el o los invasores.Señala que dicha inspección se llevó a cabo por parte del gestor ambiental municipal en compañía de Francisco Moraga Chavarría, inspector notificador del Departamento de Desarrollo Territorial Municipal y arrojó como resultado, que la locación de dicha invasión corresponde a terrenos cuya administración, vigilancia y obligación de interposición de denuncia penal respectiva en caso de invasión, le corresponde primariamente y por ley, al Ministerio de Ambiente y Energía, razón por la cual procedieron a trasladar como se indicó a dicha representación. Aclara que según el oficio N° ACT-OSRSCC-1067-2020 del 13 de octubre de 2020, suscrito por el Ingeniero Orlando Matarrita Suárez, donde el confirma que el terreno invadido se encuentra en “(…) área de protección hídrica establecida por Ley Forestal (…)”. Aclara que el municipio ejerce labores de desalojo y/o demolición en construcciones levantadas sin viabilidad ambiental o que, aun teniéndola posteriormente contaminan.Señala que las potestades de clausura y demolición sin limitación de competencia territorial, la tiene tanto el Ministerio de Ambiente y Energía como el Ministerio de Salud, entidad que también tuvo y tiene el conocimiento de los hechos alegados. Comenta que el municipio siempre está a disposición de ayudar en la demolición o desalojo de estructuras que no necesariamente se encuentren en los terrenos que administran siempre y cuando se haya interpuesto de manera formal una denuncia penal como corresponde, por parte del Ministerio de Ambiente y Energía o bien, que se emane una orden judicial especificada en el artículo 140, del Código Procesal Penal, donde un juez ordene como medida provisional, el restablecimiento de las cosas al estado que tenían antes del hecho, todo esto debido a que no desean actuar sin legitimación o destruir evidencia probatoria de los invasores, y así entorpecer el proceso penal.Menciona que actualmente la situación se encuentra dentro del ámbito penal en la causa N° 20-001215-0800-PE, en el Juzgado Penal del II Circuito de Guanacaste, contra Nombre02 y Nombre03, quienes han sido individualizados como presuntos sospechosos del delito de invasión a un área de conservación. Solicita se declare sin lugar el recurso.
  4. 4Informa bajo juramento Nelson Marín Mora, en su condición de Director Regional del Área de Conservación Tempisque que, la Oficina Subregional de Santa Cruz Carrillo del Área de Conservación Tempisque atendió las denuncias y realizó las respectivas gestiones administrativas y judiciales como por ley le corresponde. Señala que el 24 de setiembre de 2020, la oficina Subregional de Santa Cruz Carrillo recibió el oficio N° MC-DGA-058-2020, suscrito por el biólogo Henry Abarca Morales, en calidad de gestor ambiental de la Municipalidad de Carrillo. En dicho oficio se indica que la Municipalidad de Carrillo ha recibido varias denuncias por la construcción de edificaciones dentro del área de protección de varios cauces de dominio público. Dado que, para poder realizar el proceso de notificación y eventual demolición de las estructuras edificada, consideran necesario la emisión de una certificación por parte del Sistema Nacional de Áreas de Conservación, de modo que les sirva como insumo legal y técnico para la realización del debido proceso administrativo.En respuesta al oficio N° MC-DGA-058-2020, el Jefe de la Oficina de Santa Cruz Carrillo, Orlando Matarrita Suarez, remitió a la Municipalidad de Carrillo el oficio N° ACT-OSRSCC-1067-2020, en el cual se indica lo siguiente: “(…) Se hace constar que el Galerón en Sardinal de Carrillo, del Dirección01, 200 metros sureste, plano catastrado número G-86661-1992, en un 100 por ciento de su extensión se ubica en zona de protección hídrica establecida por la Ley Forestal en el artículo 33 inciso B. así cumpliendo con lo solicitado por la Municipalidad de Carrillo Guanacaste (…)”. En vista del oficio anteriormente citado, ese caso es asumido de oficio por la oficina como una nueva denuncia de tipo ambiental y, por tanto, el 28 de setiembre de 2021, se creó en la plataforma institucional llamada SITADA, el caso N° 22976-2020, el cual fue asignado al ingeniero forestal Carlos Pizarro Barrantes, quien ese mismo día -28 de setiembre de 2020- visitó el sitio.De esa visita se desprendió el oficio N° ACT-OSRSCC-1036-2020 del 06 de octubre de 2020, el cual fue remitido a la subdelegación del Organismo de Investigación Judicial de Santa Cruz el 07 de octubre de 2020, y se abrió el expediente de investigación N° 20-0001215-0800-PE. El 02 de febrero de 2021, la oficina de Santa Cruz Carrillo recibió el oficio N° MC-ALC-0198-2021, suscrito por el alcalde municipal de Carrillo, mediante el cual traslada la denuncia por invasión del área de protección de la quebrada Zapotal y por edificación sin permiso municipal; esto a efectos de que el Sistema Nacional de Áreas de Conservación le diera la atención administrativa y judicial al caso. En respuesta a ese oficio, su oficina mediante el oficio N° ACT-OSRSCC-237-2021, le indicó el 24 de febrero de 2021, al alcalde municipal de Carrillo lo siguiente; “Esta oficina subregional recibió de su parte, el día 02 de febrero del año 2021, el oficio MC-ALC-0198-2021, en el cual notifica a esta oficina cobre cuatro casos de aparentes afectaciones de áreas de protección de cauces de dominio público”.Al respecto se le indica lo siguiente: Caso N° 1, construcción dentro del área de protección hídrica de la quebrada Zapotal, sita en el sector de Zapotal de Carrillo, en el sitio con las coordenadas 1161386-303911. De ese caso, ya se tenía conocimiento, ya que esa denuncia ingresó al SITADA con el consecutivo número 22976-2020 y luego de ser atendida, fue remitido el informe mediante oficio N° ACT-OSRSCC-1036-2020 del 06 de octubre de 2020, y se investiga en el Organismo de Investigación Judicial bajo el caso N° 20-001215-0800-PE; no obstante, se desconoce el estado de la investigación. Según oficio N° ACT-OSRSCC-1067-2020, este servidor a pedido de esa Municipalidad emitió constancia de que la Construcción se ubica en un 100 por dentro (sic) del área de protección hídrica descrita en el artículo 33, de la Ley 7575, por lo que independientemente de lo que suceda en la sede penal, al tratarse de una construcción levantada sin el permiso municipal, es responsabilidad absoluta de ese municipio ejercer las acciones para demoler dicha edificación.Aclara que las áreas de protección hídrica en terrenos privados, siguen siendo propiedad privada, aunque tienen una limitación de uso, por lo cual no son áreas administradas por el Sistema Nacional de Áreas de Conservación – Ministerio de Ambiente y Energía, como parte del Patrimonio Natural del Estado. En el mes de marzo de 2021, la oficina de Santa Cruz, recibió un escrito de parte del recurrente, en el cual denunciaba obras invasivas del área de protección hídrica en el mismo sitio. Como petitoria, esta persona textualmente indica: “En base a las condiciones de hecho y de derecho expuestas, se solicita a esta Área de Conservación proceda a la remoción de la obra invasiva al área de protección del río Zapotal”. El 12 de abril de 2021, la oficina subregional remitió al tutelado, el oficio N° ACT-OSRSCC-484-2021, mediante el cual textualmente se le informó que en respuesta a la denuncia planteada por escrito ante esa oficina el 04 de marzo de 2021, esto por las actividades de invasión de área de protección hídrica en la quebrada Zapotal, playa zapotal de Carrillo Guanacaste, ingresada al SITADA mediante el consecutivo 25710-2021, se le indica lo siguiente: Este caso ya había sido abordado por esta oficina en el mes de octubre de 2020, y al no encontrarse al supuesto infractor esta oficina remitió el caso ante la subdelegación del OIJ en Santa Cruz para que esa entidad se ocupe de la investigación”.Esta tiene asignado el expediente judicial N° 20- 001215-0800-PE. En este mismo caso por recomendación de la Fiscala ambiental auxiliar de Santa Cruz, su oficina posterior al 12 de abril de 2021, realizó al menos dos visitas al lugar de los hechos, esto a efectos de poder notificar al supuesto infractor una orden administrativa a efectos de paralizar las acciones lesivas al ambiente y de paso girar una orden para que el mismo supuesto infractor retirase por sus propios medios las obras, caso contrario se le denunciaría por desacato a la autoridad; sin embargo, en ninguna de esas oportunidades se encontró ocupantes en la vivienda, de allí que esa acción administrativa fue imposible de realizar. Aclara que el caso denunciado por el recurrente luego de la investigación realizada por el Organismo de investigación Judicial, ya se encuentra como una causa penal en investigación de la Fiscalía de Santa Cruz bajo el expediente N° 20-0001215-0800-PE. Con lo que se demuestra el cumplimiento de sus obligaciones en materia ambiental. Solicita se declare sin lugar el recurso.
  5. 5Según constancia de la Técnica Judicial y del Secretario de esta Sala, se indica que, no apareció que no apareció que, del 24 de agosto de 2021 al 31 de agosto de 2021, el Director del Sistema Nacional de Áreas de Conservación haya presentado escrito o documento alguno, a fin de rendir el informe que se le solicitó en la resolución dictada a las dieciséis horas nueve minutos del doce de agosto de dos mil veintiuno, en el expediente N° 21-015688-0007-CO.
  6. 6Mediante la resolución de las 11:34 horas del 17 de septiembre de 2021, este Tribunal solicitó, como prueba para mejor resolver: “informe al JUEZ COORDINADOR DEL JUZGADO PENAL DEL II CIRCUITO DE GUANACASTE, a fin remitir en sobre cerrado, copia certificada de la causa penal N° 20-001215-0800-PE, seguida contra Nombre02 y Nombre03, la cual no será incorporada al expediente digital ni de acceso público. Asimismo, se pone en conocimiento de las autoridades de la Dirección Regional del Área de Conservación Tempisque del Sistema Nacional de Áreas de Conservación y de la Municipalidad de Carrillo, los informes rendidos por esas autoridades, para que se pronuncien respecto a los argumentos que cada uno de ellos señala, respecto a sus propias competencias y las competencias de la institución contraria (…)”.
  7. 7Informa bajo juramento Jorge Vallejos González, en su condición de Juez Coordinador del Juzgado Penal de Santa Cruz, que la causa penal N° 20-001215-0800-PE no ha ingresado a ese despacho.
  8. 8Informa bajo juramento Nelson Marín Mora, en su condición de Director del Área de Conservación Tempisque, que el Alcalde Municipal dio aviso sobre lo ocurrido, para cumplir con lo estipulado en los artículos 6 y 54, de la Ley Forestal. Por ese motivo, se realizó la inspección de campo que generó el informe remitido a las instancias judiciales, con lo que se generó la causa penal N° 20-001215-0800-PE. Señala que la ubicación de la supuesta invasión, corresponde a terrenos cuya administración, vigilancia, resguardo y obligación de interposición de denuncia penal, en caso de invasión, corresponde primariamente al Ministerio de Ambiente y Energía. Recalca que el caso de invasión ocurrió en un terreno privado, ubicado fuera del Patrimonio Natural del Estado, y que no contaba con permisos municipales.
  9. 9En los procedimientos seguidos se han cumplido las prescripciones legales.

Redacta el Magistrado Araya García; y,

CONSIDERANDO:

I. CUESTIÓN PREVIA

Antes de analizar el fondo del asunto, debe aclararse que, a partir de la Sentencia N° 2008-02545 de las 08:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contenciosa administrativa -con algunas excepciones-, aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo -instruido de oficio o a instancia de parte- o conocer de los recursos administrativos procedentes. Precisamente, en el sub lite, se plantea un supuesto de excepción, ante la aparente falta de resolución de una denuncia ambiental. Atendiendo a la materia de denuncias ambientales, esta Sala valora las posibles dilaciones en la resolución de las gestiones de este tipo. Aclarado el punto, se entra a resolver la situación concreta planteada en este amparo.

II. OBJETO DEL RECURSO

La parte recurrente solicita a este Tribunal, ordenar a las autoridades recurridas remover, de forma inmediata, las obras denunciadas que fueron construidas dentro del área de protección del río Zapotal, y que tomen las medidas necesarias para la recuperación de la zona.

III. HECHOS PROBADOS

De importancia para la decisión de este asunto, se estima como debidamente demostrados los siguientes hechos:

1. El 16 de septiembre de 2020, el recurrente planteó denuncias ante el Área de Conservación Tempisque y ante la Municipalidad de Carrillo, por la aparente invasión de una zona de protección, solicitando la remoción inmediata de las obras construidas (hecho no controvertido).

2. Sobre las actuaciones de la Municipalidad de Carrillo:

  • a)El municipio, tras la noticia de la invasión en el área ambiental protegida procedió, mediante el oficio N° MC-DGA-O58-2020 del 24 de septiembre de 2020, a dar aviso de lo acontecido a la Oficina Sub - Regional del Sistema de Áreas de Conservación del Ministerio de Ambiente y Energía (ver informe rendido bajo juramento y prueba aportada).
  • b)Según el oficio N° MG-DGA-058-2020, se realizó una inspección de campo en el sitio de los hechos, a fin de determinar tanto la ubicación exacta de la invasión como la individualización de los invasores. Dicha inspección la realizó el gestor ambiental municipal, en compañía del inspector del Departamento de Desarrollo Territorial Municipal y se determinó que la ubicación de dicha invasión corresponde a terrenos cuya administración, vigilancia y obligación de interposición de la denuncia penal respectiva en caso de invasión, le corresponde primariamente y por ley, al Ministerio de Ambiente y Energía (ver informe rendido bajo juramento y prueba aportada).
  • c)Según el oficio N° ACT-OSRSCC-1067-2020 del 13 de octubre de 2020, suscrito por el Ingeniero Orlando Matarrita Suárez, confirma que el terreno invadido se encuentra en área de protección hídrica establecida por Ley Forestal (ver informe rendido bajo juramento y prueba aportada).
  • d)Dentro de la causa penal N° 20-001215-0800-PE, tramitada en el Juzgado Penal del II Circuito de Guanacaste, se denunció la aparente invasión a un área de protección, contra Nombre02 y Nombre03, quienes han sido individualizados como presuntos sospechosos del delito de invasión a un área de conservación (ver informe rendido bajo juramento y prueba aportada).

3. Sobre las actuaciones del Área de Conservación Tempisque:

  • a)El 24 de septiembre de 2020, la oficina Sub-regional de Santa Cruz, recibió el oficio N° MC-DGA-058-2020, suscrito por el biólogo Henry Abarca Morales, en calidad de gestor ambiental de la Municipalidad de Carrillo. En dicho oficio se indicó que la Municipalidad de Carrillo había recibido varias denuncias por la construcción de edificaciones dentro del área de protección de varios cauces de dominio público (ver informe rendido bajo juramento y prueba aportada).
  • b)En respuesta al oficio N° MC-DGA-058-2020, el Jefe de la Oficina de Santa Cruz, remitió a la Municipalidad de Carrillo el oficio N° ACT-OSRSCC-1067-2020, en el cual se indicó lo siguiente: “(…) Se hace constar que el Galerón en Sardinal de Carrillo, del Dirección01, 200 metros sureste, plano catastrado número G-86661-1992, en un 100 por ciento de su extensión se ubica en zona de protección hídrica establecida por la Ley Forestal en el artículo 33 inciso B. así cumpliendo con lo solicitado por la Municipalidad de Carrillo Guanacaste (…)”. En vista del oficio citado, ese caso fue asumido de oficio por la oficina como una nueva denuncia de tipo ambiental y, por lo tanto, el 28 de septiembre de 2020, se creó en la plataforma institucional llamada SITADA; el caso N° 22976-2020, el cual fue asignado al ingeniero forestal Carlos Pizarro Barrantes, quien ese mismo día visitó el sitio, y generó el oficio N° ACT-OSRSCC-1036-2020 del 06 de octubre de 2020, el cual fue remitido a la Sub-delegación del Organismo de Investigación Judicial de Santa Cruz el 07 de octubre de 2020, iniciando el expediente de investigación N° 20-0001215-0800-PE (ver informe rendido bajo juramento y prueba aportada).
  • c)El 02 de febrero de 2021, la oficina de Santa Cruz Carrillo recibió el oficio N° MC-ALC-0198-2021, suscrito por el Alcalde Municipal de Carrillo, mediante el cual trasladaba la denuncia por invasión del área de protección de la quebrada Zapotal y por edificación sin permiso municipal; a efectos de que el Sistema Nacional de Áreas de Conservación le diera la atención administrativa y judicial al caso (ver informe rendido bajo juramento y prueba aportada).
  • d)En el mes de marzo de 2021, la oficina de Santa Cruz, recibió un escrito por parte del recurrente, en el cual denunciaba obras invasivas del área de protección hídrica en el mismo sitio (ver informe rendido bajo juramento y prueba aportada).
  • e)El 12 de abril de 2021, la oficina Sub-regional le remitió al tutelado, el oficio N° ACT-OSRSCC-484-2021, en respuesta a la denuncia planteada ante esa oficina el 04 de marzo de 2021, por las actividades de invasión de área de protección hídrica en la quebrada Zapotal, y se le indicó: “Este caso ya había sido abordado por esta oficina en el mes de octubre de 2020, y al no encontrarse al supuesto infractor esta oficina remitió el caso ante la subdelegación del OIJ en Santa Cruz para que esa entidad se ocupe de la investigación” (ver informe rendido bajo juramento y prueba aportada).

IV. SOBRE EL DERECHO FUNDAMENTAL A UN AMBIENTE SANO Y ECOLÓGICAMENTE EQUILIBRADO

El artículo 50, de la Constitución Política, establece que toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado, el cual tiene un contenido amplio que equivale a la aspiración de mejorar el entorno de vida del ser humano, de manera que desborda los criterios de conservación natural para ubicarse dentro de toda esfera en la que se desarrolle la persona, sea la familiar, la laboral o la del medio en el cual habita. De ahí, que se afirme que se trata de un derecho transversal; es decir, que se desplaza a todo lo largo del ordenamiento jurídico, modelando y reinterpretando sus institutos.

El ambiente es definido por la Real Academia Española de la Lengua como el “conjunto de circunstancias físicas que rodean a los seres vivos”, lo que recalca aún más el carácter general del derecho. En cambio, el derecho a un ambiente ecológicamente equilibrado es un concepto más restringido referido a una parte importante de ese entorno en el que se desarrolla el ser humano, al equilibrio que debe existir entre el avance de la sociedad y la conservación de los recursos naturales. Ambos derechos se encuentran reconocidos expresamente en el artículo 50, de la Constitución Política, que perfila el Estado Social de Derecho. La ubicación del derecho a un ambiente sano y ecológicamente equilibrado dentro de las regulaciones constitucionales del Estado Social de Derecho es el punto a partir del cual debe este ser analizado.

El Estado Social de Derecho produce el fenómeno de incorporación al texto fundamental de una serie de objetivos políticos de gran relevancia social y de la introducción de un importante número de derechos sociales que aseguran el bien común y la satisfacción de las necesidades elementales de las personas. En esta perspectiva, la Constitución Política enfatiza que la protección de los recursos naturales es un medio adecuado para tutelar y mejorar la calidad de vida de todos, lo que hace necesaria la intervención de los poderes públicos sobre los factores que pueden alterar el equilibrio de los recursos naturales y, más ampliamente, obstaculizar que la persona se desarrolle y desenvuelva en un ambiente sano. De igual forma que el principio del Estado Social de Derecho es de aplicación inmediata, el derecho a un ambiente sano y ecológicamente equilibrado también lo es, de manera que se manifiesta en la doble vertiente de derecho subjetivo de las personas y configuración como meta o fin de la acción de los poderes públicos en general.

La incidencia que tiene el derecho a un ambiente sano y ecológicamente equilibrado dentro de la actividad del Estado, encuentra su primera razón de ser en que por definición los derechos no se limitan a la esfera privada de los individuos, sino que tienen asimismo trascendencia en la propia estructura del Estado en su papel de garante de los mismos y, en segundo término, porque la actividad del Estado se dirige hacia la satisfacción de los intereses de la colectividad.

La Constitución Política establece que el Estado debe garantizar, defender y preservar ese derecho. Prima facie garantizar es asegurar y proteger el derecho contra algún riesgo o necesidad, defender es vedar, prohibir e impedir toda actividad que atente contra el derecho, y preservar es una acción dirigida a poner a cubierto anticipadamente el derecho de posibles peligros a efectos de hacerlo perdurar para futuras generaciones. El Estado debe asumir un doble comportamiento de hacer y de no hacer; por un lado, debe abstenerse de atentar él mismo contra el derecho a contar con un ambiente sano y ecológicamente equilibrado, y por otro lado, debe asumir la tarea de dictar las medidas que permitan cumplir con los requerimientos constitucionales. (Sentencia N° 00644–99 de las 11:24 horas del 29 de enero de 1999; en el mismo sentido se puede consultar la Sentencia N° 4947-2002 de las 09:24 horas con del 24 de mayo de 2002).

V. SOBRE EL CASO CONCRETO

El recurrente acude en amparo y solicita que esta Sala ordene a la Municipalidad de Carrillo y al Sistema Nacional de Áreas de Conservación, remover de forma inmediata las obras denunciadas que fueron construidas dentro del área de protección del río Zapotal y tomen las medidas necesarias para la recuperación de la zona.

Ahora bien, del informe rendido por las autoridades recurridas, que se tiene dado bajo la solemnidad del juramento, se corrobora que la Municipalidad de Carrillo, al tener noticia de la invasión citada al área ambiental protegida procedió, mediante el oficio N° MC-DGA-O58-2020 del 24 de septiembre de 2020, a dar aviso de lo acontecido a la Oficina Sub - Regional del Sistema de Áreas de Conservación del Ministerio del Ambiente. Mediante dicho oficio, se realizó una inspección de campo al sitio de los hechos a fin de determinar tanto la ubicación exacta de la invasión como la individualización de el o los invasores. Dicha inspección la realizó el gestor ambiental municipal en compañía del inspector notificador del Departamento de Desarrollo Territorial Municipal y arrojó como resultado, que la locación de dicha invasión corresponde a terrenos cuya administración, vigilancia y obligación de interposición de denuncia penal en caso de invasión, le corresponde por ley, al Ministerio de Ambiente y Energía.

Señala que, actualmente, la situación se encuentra en investigación dentro de la causa penal N° 20-001215-0800-PE, en el Juzgado Penal del II Circuito de Guanacaste, contra Nombre02 y Nombre03, quienes han sido individualizados como presuntos sospechosos del delito de invasión a un área de conservación. Comentan que no pueden demoler las estructuras denunciadas, a menos que ya que se haya interpuesto de manera formal una denuncia penal como corresponde, por parte del Ministerio de Ambiente y Energía o bien, que se emane una orden judicial especificada en el artículo 140, del Código Procesal Penal, donde un juez ordene, como medida provisional, el restablecimiento de las cosas al estado que tenían antes del hecho, todo esto debido a que no desean actuar sin legitimación o destruir evidencia probatoria de los invasores, y así entorpecer el proceso penal.

Por otro lado, del informe rendido por las autoridades del Área de Conservación Tempisque, se logra acreditar que el 24 de septiembre de 2020, la Oficina Sub-regional de Santa Cruz Carrillo recibió el oficio N° MC-DGA-058-2020, suscrito por el biólogo Henry Abarca Morales, en calidad de gestor ambiental de la Municipalidad de Carrillo. En dicho oficio, se indicó que la Municipalidad de Carrillo había recibido varias denuncias por la construcción de edificaciones dentro del área de protección de varios cauces de dominio público; no obstante, aclaran que, para poder realizar el proceso de notificación y eventual demolición de las estructuras edificada, consideran necesario la emisión de una certificación por parte del Sistema Nacional de Áreas de Conservación. En respuesta al oficio N° MC-DGA-058-2020, el Jefe de la Oficina de Santa Cruz Carrillo, remitió a la Municipalidad de Carrillo el oficio N° ACT-OSRSCC-1067-2020, en el cual indica: “(…) Se hace constar que el Galerón en Sardinal de Carrillo (…) en un 100 por ciento de su extensión se ubica en zona de protección hídrica establecida por la Ley Forestal en el artículo 33 inciso B. así cumpliendo con lo solicitado por la Municipalidad de Carrillo Guanacaste (…)”.

En vista del oficio citado, ese caso fue asumido de oficio por esa autoridad, como una nueva denuncia de tipo ambiental y, por lo tanto, el 28 de septiembre de 2020, se creó en la plataforma institucional el caso N° 22976-2020, y en esa misma fecha, se realizó una visita al sitio y se generó el oficio N° ACT-OSRSCC-1036-2020 del 06 de octubre de 2020, el cual fue remitido a la Sub - delegación del Organismo de Investigación Judicial de Santa Cruz el 07 de octubre de 2020. Por ello, se inició el expediente de investigación N° 20-0001215-0800-PE. Posteriormente, el 02 de febrero de 2021, la oficina de Santa Cruz Carrillo recibió el oficio N° MC-ALC-0198-2021, suscrito por el Alcalde Municipal de Carrillo, mediante el cual trasladaba la denuncia por invasión del área de protección de la quebrada Zapotal y por edificación sin permiso municipal; a efectos de que el Sistema Nacional de Áreas de Conservación le diera la atención administrativa y judicial al caso.

Además, el 12 de abril de 2021, la Oficina Sub-regional le remitió al tutelado, el oficio N° ACT-OSRSCC-484-2021, en respuesta a la denuncia planteada ante esa oficina el 04 de marzo de 2021, por las actividades de invasión de área de protección hídrica en la quebrada Zapotal y le indicó lo siguiente: “Este caso ya había sido abordado por esta oficina en el mes de octubre de 2020, y al no encontrarse al supuesto infractor esta oficina remitió el caso ante la subdelegación del OIJ en Santa Cruz para que esa entidad se ocupe de la investigación”.

Analizado el cuadro fáctico planteado, así como la prueba que consta en autos, este Tribunal tiene por acreditado que las autoridades recurridas han constatado la existencia de invasores en el área de protección hídrica objeto de este recurso y que, ante ello, han tomado distintas medidas según el ámbito de sus competencias. En igual sentido, se comprueba que han atendido las gestiones del recurrente, al realizar las inspecciones respectivas y dar respuesta, por escrito, a sus denuncias. Adicionalmente, se verifica que tanto la Municipalidad de Carrillo como el Área de Conservación Tempisque, han dado seguimiento a la causa penal a cargo del Organismo de Investigación Judicial, al realizar las diligencias correspondientes. Por todo lo expuesto, esta Sala descarta la acusada inacción, de parte de las autoridades recurridas, en dar el trámite respectivo a la denuncia planteada por el amparado, por lo que lo procedente es declarar sin lugar el recurso, como en efecto se dispone.

VI. TOMEN NOTA LAS AUTORIDADES RECURRIDAS

A pesar de la desestimatoria del presente recurso, resulta menester recordar a las autoridades recurridas su responsabilidad de procurar, dentro del marco de sus competencias, la gestión diligente de los procesos, así como el deber de procurar una solución pronta y eficaz a la situación objeto del recurso, dentro del ámbito de sus competencias, pues resulta innegable que la problemática denunciada, amenaza el derecho fundamental a un ambiente sano y ecológicamente equilibrado, y requiere ser atendida y resuelta de forma definitiva.

VII. RAZONES DIFERENTES DEL MAGISTRADO SALAZAR ALVARADO

Con el debido respeto, concuerdo con el voto de mayoría que declara sin lugar el recurso; sin embargo, lo fundamento con las siguientes razones.

La protección a un ambiente sano y ecológicamente equilibrado, en el Ordenamiento Jurídico Costarricense, está tutelado no solo en el artículo 50, de la Constitución Política, sino también en una serie de leyes y decretos ejecutivos (reglamentos) vigentes, tales como la Ley Orgánica del Ambiente, Ley N° 7554 de 4 de octubre de 1995; la Ley de Biodiversidad, Ley N° 7788 de 30 de abril de 1998; la Ley de Conservación de la Vida Silvestre, Ley N° 7317 de 21 de octubre de 1992; y el Decreto Ejecutivo N° 31849 de 24 de mayo de 2004, Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental (EIA), para citar solo algunos. Esto hace necesario, en materia ambiental, separar el control de constitucionalidad del control de legalidad. En este sentido, es criterio del suscrito que esta Sala, por vía de amparo, solo debe conocer un asunto en que se alega violación al derecho a un ambiente sano y ecológicamente equilibrado, si la Administración no ha intervenido aún y cuando la violación a ese derecho sea manifiesta y evidente, de fácil constatación, de cierta importancia o gravedad y que afecte, de forma directa, a alguna persona o comunidad en concreto.

De lo contrario, el tema debe plantearse y discutirse en la vía de legalidad. Por ello, el simple incumplimiento de obligaciones y deberes impuestos legalmente a las diversas administraciones públicas en materia ambiental es propio de ser conocido en la vía de legalidad –administrativa o jurisdiccional-, donde, con mucha mayor amplitud, podrán fiscalizarse los incumplimientos u omisiones que se acusen. Debe tenerse presente que el recurso de amparo es un proceso sumario, informal, sencillo y rápido, de manera tal, que desde el momento mismo en que la Administración interviene en un asunto ambiental, en ejercicio de sus competencias, y sustancia un procedimiento, con el dictado de actos administrativos, su conocimiento resulta ajeno al ámbito de acción de esta jurisdicción especializada. Por ello, la revisión de las actuaciones administrativas llevadas a cabo en torno a un tema ambiental que requiera, para su correcta valoración, de un proceso de conocimiento pleno, solo es posible en la jurisdicción ordinaria, toda vez que el diseño del proceso de amparo es incompatible con la contrastación o revisión de criterios técnicos o jurídicos elaborados al amparo de las normas legales o reglamentarias vigentes o con la evacuación de nuevos y mayores elementos de convicción necesarios para la contrastación o revisión de los criterios que ya consten en el expediente administrativo del caso.

Lo contrario implicaría transformar el amparo en un proceso ordinario de pleno conocimiento, con lo cual se desnaturalizaría y se tornarían nugatorios los fines para los cuales ha sido diseñado, con lo cual, perdería su condición de instrumento para la tutela eficaz de los derechos fundamentales. Como consecuencia de lo anterior, estimo que cuando un ente u órgano público ha intervenido, en diversas formas, o ha dictado actos administrativos en relación con un asunto ambiental, su conocimiento y fiscalización corresponde a la jurisdicción de lo contencioso-administrativo. Es, precisamente, la verificación de la existencia de esa intervención administrativa lo que determina que el asunto sea competencia de la vía legalidad. En consecuencia, este recurso debió haberse rechazado de plano, ya que su objeto es una cuestión propia de ser discutida, analizada y resuelta en la vía de legalidad. Empero, como no se hizo así, lo procedente es declararlo sin lugar, sin hacer pronunciamiento alguno con respecto al fondo de la cuestión planteada por corresponderle a la jurisdicción ordinaria, en específico, a la contencioso-administrativa, determinar si las actuaciones y conductas administrativas acusadas se ajustan o no, en sustancia, a lo preceptuado en el ordenamiento jurídico de rango legal, en cuanto a la protección, tutela y conservación del derecho a un ambiente sano y ecológicamente equilibrado.

VIII. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta Sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en Sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

POR TANTO:

Se declara sin lugar el recurso. Tomen nota las autoridades recurridas de lo indicado en el Considerando VI de esta Sentencia. El Magistrado Salazar Alvarado consigna razones diferentes.- Fernando Castillo V.
