Document Review Decision 2024-00450 CRIMINAL CASSATION CHAMBER. San José, at ten sixteen a.m. on May twenty-eight, two thousand twenty-four.
Appeals in cassation (recursos de casación) filed in the present proceedings brought against [Nombre 019], known as pisco, an adult, a Costa Rican national, holder of identity card number [Valor 001], born in grecia on November 26, 1959, son of [Nombre 001] and [Nombre 002], for the offenses of encroachment upon a protection area (invasión a una área de protección) and fraudulent conveyance (estelionato), committed to the detriment of [Nombre 005], [Nombre 006], and the State. Justices Jesús Alberto Ramírez Quirós, Gerardo Rubén Alfaro Vargas, Sandra Eugenia Zúñiga Morales, Patricia Vargas González, and Rafael Segura Bonilla, the latter serving as a substitute justice, participated in deciding the appeal. Also appearing before this Court were attorneys Randall Aguirre Mena, as Criminal Counsel for the Attorney General’s Office representing the State; Frankarlo Pessoa Solera, as General Judicial Attorney-in-Fact for Banco Nacional de Costa Rica in its capacity as an Interested Civil Third Party (Tercero Civil Interesado); and Jannette Salazar Araya, legal representative of the Private Prosecutor and Civil Plaintiff (Querellante y Actora Civil), [Nombre 005]. Background:
1. By judgment N° 2022-001109, issued at thirteen fifty-five on November twenty-nine, two thousand twenty-two, the Tribunal de Apelación de Sentencia del Tercer Circuito Judicial de Alajuela, Sección San Ramón, ruled: “THEREFORE: The appeals against the judgment filed by the Ministerio Público and the Procuraduría General de la república are denied” José Alberto Rojas Chacón, Yadira Godínez Segura, and karina Redondo Gómez. Appellate Judge and Judges". (sic).
2. Attorney Randall Aguirre Mena, as Criminal Counsel for the Attorney General’s Office representing the State, and attorney Arturo Figueroa García, Prosecutor with the Fiscalía de Grecia, representing the Ministerio Público, filed appeals in cassation against the foregoing decision.
3. Following the corresponding deliberation, the Chamber considered the issues raised in the appeal.
4. The pertinent legal requirements have been observed in the proceedings; and, Justice Segura Bonilla delivers the opinion; and,
Considerations:
I.In decision N°2023-00286, at 11:00 hours, on March 22, 2023, this Chamber admitted for review on the merits the second ground of each appeal filed by attorney Randall Aguirre Mena, Procurador General de la República, and attorney Arturo Figueroa García, representing the Ministerio Público, against decision N° 2022-001109, at 13:55 hours, on November 29, 2022, issued by the Tribunal de Apelación de Sentencia Penal del Tercer Circuito Judicial de Alajuela, Sección Primera, San Ramón, which denied the challenges filed against judgment number 154-TGRE-2021, at 16:15 hours on November 2, 2021, issued by the Tribunal Penal del Tercer Circuito Judicial de Alajuela, sede Grecia, with respect to the request to demolish the dwelling that was then registered in the name of the accused, [Nombre 019] (compare folios 1169, front and back; 1171, front and back; and 1172).
II.Subject matter of the challenge. Attorney Randall Aguirre Mena, in his capacity as criminal counsel, states, pursuant to subsection b) of Article 468 of the Código Procesal Penal, that, in rejecting the fifth ground of appeal concerning the demolition request (compare folios 1041 to 1044), the appellate court failed to apply Article 11 of the Ley de Biodiversidad, because its reasoning lacked factual and legal support for denying the requested relief. He contends that this decision arose from the acquittal entered in favor of the accused, [Nombre 019], after the prosecution’s technical evidence proved insufficient to establish “that the body of water was a permanent spring (naciente) …” (compare folio 1134, second paragraph). Accordingly, he states that the judicial authority’s reasoning was aimed “at maintaining that, where there is doubt as to whether the springs are permanent in nature (not as to the presence of springs at the site), the proper course is to deny the demolition…,” for the purpose of avoiding any arbitrariness (compare folio 1134, third paragraph).
He asserts that, by acting in this manner, the appellate court disregarded, in environmental matters, the primacy of the outcome most beneficial to the environment, which serves to ensure protection of water resources. In support of his position, he cites precedent number 2019-9221 of the Sala Constitucional de la Corte Suprema de Justicia. He thus reiterates: “Therefore, for the appellate court, the existence of doubt as to whether the springs are permanent in nature, based on a comparison of the conclusions of two items of technical evidence, must inexorably result in the structure remaining in place, even though such doubt, while it is true that in criminal matters it favors the accused (sic), in environmental matters must favor the environment, that is, whichever outcome is most favorable to the preservation and conservation of natural resources; preserving a structure built where springs exist is contrary to environmental principles and the intent of the legislature …” (compare folios 1134, fifth paragraph, to 1135).
He requests that this Chamber sustain the ground, vacate the challenged judicial decision, and remand the matter for a new assessment of the fifth ground of appeal raised (compare folio 1135, third paragraph). For his part, Prosecutor Figueroa García, expressing a similar view, endorses in his joinder the alleged failure to apply the aforementioned Article 11 of the Ley de Biodiversidad, stating that the appellate court’s arguments were insufficient to resolve the issue of demolition. In this regard, he transcribes a portion of the reasoning and then repeats the claim made by the representative of the Procuraduría General de la República, stating: “The court bases its rejection of the fifth ground of appeal on the accused’s criminal acquittal and on the argument that the prosecution’s technical evidence was (sic) insufficient to demonstrate that the body of water was a permanent spring; in this regard, it is assumed (because this is not stated in that section of the judgment) that one must abide by the ruling in the portion of the decision relating to that issue.
The judges’ reasoning is (sic) directed toward maintaining that, where there is doubt as to whether the springs are permanent in nature (not as to the presence of springs at the site), the proper course is to deny the demolition, since, according to the appellate court, ruling otherwise would be arbitrary...” (compare folio 1149, front). He argues that, in the matter under review, the appellate court undermines the pro natura and precautionary principles (principios pro natura y precautorio) by allowing the structure to remain, to the detriment of the environment and the interests of the State. Based on the foregoing, he seeks to have the challenged decision vacated and the matter handled in accordance with law (compare folio 1149, front and back).
III.Response to the appeals in cassation (recursos de casación). On January 17, 2023, Frankarlo Pessoa Solera, in his capacity as general attorney-in-fact for judicial matters (apoderado general judicial) of Banco Nacional de Costa Rica and as an interested civil third party (tercero civil interesado), responded to the notice issued concerning the challenge filed by criminal-law prosecutor Randall Aguirre Mena (see folio 1136). After briefly recounting the judicial proceedings (see front and back of folio 1139), the representative of the legal department of that banking institution addresses arguments concerning the dispute over the area surrounding the spring (naciente) and the requested demolition (derribo) mentioned by the State’s representative. He then states that, according to the first and second points of the complaint filed by Mr. Eliden Alcázar Barahona (SINAC) in 2009 regarding a possible unlawful encroachment upon a protection zone (zona de protección), the apparent existence of a spring at that location was inferred.
In this regard, he asserts that the report of a suspected crime (notitia criminis) states: “That on November 18 of the current year, accompanied by Carlos Gutiérrez Santana, an official of the Sistema Nacional de Áreas de Conservación de Grecia, we responded to a complaint filed by local residents, in which we were informed that a house was being built on the property of Mr. [Name 019] within the protection area of a permanent spring. […] That once at the property, my colleague and I proceeded to document the site with photographs and to use a Garmin-brand GPS device and a measuring tape to measure the distance from the house under construction to the spring; according to the GPS points taken in the field, the house under construction is 71.5 meters away, which indicates that it is within the 100-meter protection area established by the Ley Forestal for permanent springs” (see folio 1140).
Attorney Pessoa Solera then characterizes the prosecution service’s hasty investigation as ineffective because, in his view, rather than establishing the existence of any spring, it “… proceeded on the assumption that the emergence of water was permanent, when in fact the investigation never addressed the issue; consequently, it was impossible to establish an encroachment upon a protection zone” (see front of folio 1140, final paragraph, and back, first paragraph). He emphasizes that, as stated by the ad quem, no actual degree of environmental harm (afectación al medio ambiente) was demonstrated, “because the existence of a spring was never clearly established”; therefore, because actual environmental damage (daño al ambiente), including damage to the water resource, had been disproved, demolition of the structure was unwarranted (emphasis in the original text; see back of folio 1140, second paragraph).
Regarding the principle of in dubio pro natura (in dubio pro natura), he states that this principle is not unrestricted, since its application must be supported by technical evidence demonstrating “first, the existence of the alleged spring and, second, that environmental damage (daño ambiental) had occurred; nevertheless, given the complete lack of investigation by the Ministerio Público, SINAC’s lack of legal standing to act as it did, SENARA’s lack of appropriate techniques for determining the existence of a spring, and the absence of the Dirección de Aguas from the investigation, the position of the Procuraduría General de la República should not be accepted” (boldface in the original text). In support of his argument, he invokes decision number 17155-2009, issued at 14:00 hours on November 5, 2009, by the Sala Constitucional de la Corte Suprema de Justicia. He asserts that, under that precedent, the pro natura principle must be accompanied by technical analyses “that make it possible to establish beyond a reasonable doubt—not the defendants’ conduct in relation to the environmental offense, but rather the existence of environmental damage, which cannot exist in the present case because it was never demonstrated that a spring was present” (emphasis not supplied; see back of folio 1140, final paragraph).
After addressing what he titles “regarding the suspect witness” (see front of folio 1141), he requests that the appeal in cassation be dismissed (see back of folio 1141). It may likewise be inferred that, at 14:00 hours on January 17, 2023, the judge responsible for processing the matter before the appellate court granted the corresponding hearing on the cross-appeal in cassation (recurso de casación por adhesión) filed by Attorney Arturo Figueroa García, prosecutor for the canton of Grecia (see front and back of folio 1150 and folios 1145 to 1149). In that regard, Attorney Jeannette Salazar Araya, legal representative of the private complainant (querellante) and civil claimant (actora civil), Ms. [Name 005], states that the decision issued by the ad quem is consistent and well-founded and, consequently, refutes the existence of any failures to observe legal provisions. She further specifies: “To argue that the pro natura principle is based on preserving the environment despite scientific uncertainty is to split hairs and constitutes a clear violation of the Principles of Due Process and Proportionality.
Given uncertainty regarding harm to the environment, taking a measure such as demolition to mitigate harm whose very existence is unknown would be disproportionate and unlawful, since throughout all the trials (three trials, two annulled and the third concluded), THE EXISTENCE OF THE SPRING ALLEGED BY THE PROCURADURIA WAS NOT PROVEN; CONSEQUENTLY, THERE CAN BE NO DAMAGE TO SOMETHING THAT DOES NOT EXIST” (capitalization in the original text; see front and back of folio 1155). Lastly, she adds: “To conclude, I adopt as my own the attorney for the procuraduría’s citations to case law on this issue, which he introduced during his closing arguments and regarding which he now maintains the opposite: decision of the sala constitucional: 9221-2019, ‘verification of whether a spring is permanent or nonpermanent … shall be a matter for the dirección de aguas del ministerio de ambiente y energía, in close cooperation with the servicio nacional de aguas subterráneas, riego y avenamiento and the instituto costarricense de acueductos y alcantarillados.’ (boldface not in the original) […] there were no failures to observe legal provisions […] The Judgment under appeal is affirmed in all respects” (see back of folio 1155).
Attorney Salazar Araya concludes that the appellate court’s decision is reasoned and consistent, ruling out deficiencies in the interpretation of legal rules, whether substantive or procedural, and even contradictory value judgments in the present litigation. For the reasons stated, she requests that the aforementioned challenge be dismissed (see back of folio 1160).
IV.The challenges (impugnaciones) are denied. Because they contain a similar line of argument, framed pursuant to subsection b) of the Code of Criminal Procedure, consisting of the appellate court’s alleged failure to observe the in dubio pro natura and precautionary principles, based on its purported error in failing to apply Article 11 of the Biodiversity Law and thus disregarding the request for demolition brought against the structure built to the detriment of the permanent nature of the springs (nacientes), thereby preventing restoration of matters to their prior condition, the representative of the Office of the Attorney General of the Republic and the Grecia prosecutor identify as a defect the insufficient factual and legal grounds concerning the joint request for demolition, considering its denial improper. For a better understanding of the present decision, it is appropriate first to recount carefully the reasoning underlying it.
In this regard, the grounds for appeal arise from the following aspects: i) Acquittal of the accused. They add that the technical evidence presented was not conclusive for the purpose of establishing that “the body of water” constituted a permanent spring. ii) State of doubt. Regarding the denial of demolition, they consider that it arose from the persistence of doubts concerning the permanent nature of the springs, rather than from whether springs existed at the site. iii) Exclusion of constitutional precedents. They object to the failure to consider, within the environmental context, that under the principle of legality and the erga omnes effect of the Constitutional Chamber’s decisions, whichever outcome provides the greatest benefit to the environment must prevail. iv) Violation of the in dubio pro natura principle. They dispute that the appellate court’s legal position concerning the state of doubt regarding “the permanent nature of the spring,” based on a conclusive comparison of two items of technical evidence, provides an adequate basis for not demolishing the structure, thereby impairing the conservation of natural resources. v) Adverse effect.
The challengers state that denial of the demolition request causes harm by dismantling the sphere of protection afforded to biodiversity through the impairment of the aforementioned in dubio pro natura and precautionary principles. Accordingly, they request that the judgment under appeal be vacated and the matter remanded as required by the governing law. As a preamble to the ruling to be issued, it is useful to determine the factual circumstances affirmed by the appellate court in the matter at issue and its subsequent assessment of the findings made by the criminal trial court, as required by the principles of oral proceedings and immediacy. Regarding the circumstances of manner, place, and time, the following may be inferred: “FIRST: In the year 2008, the accused [Nombre 019] built (sic) a house on the property located in San Isidro de Grecia, on the road to Carbonal, 300 meters north of the Montecarlo hall, property registered in the Alajuela district, real-property folio registration number 2-215969-000, geographically located at horizontal coordinate 233267 and vertical coordinate 506347, Naranjo map sheet, scale 1:50.0000, measuring 3.300 square meters and through which a body of water flows.
SECOND: In April 2011, the defendant [Nombre 019], knowing of criminal proceeding number 09-204266-0331-Pe brought against him for the offense of Violation (sic) of the Ley Forestal, the object to which that forestry violation related being the property in the Alajuela district, real-property folio registration number 2-215969-000, sold it to the injured parties [Nombre 005] and [Nombre 006] for the sum of ONE HUNDRED THIRTY MILLION COLONES, concealing from them criminal proceeding 09-204266-0331-PE, in which restrictions on the property that made its enjoyment impossible were at issue, thereby causing these (sic) parties financial loss to their assets. THIRD: The defendant [Nombre 019] has no prior convictions.” (capitalization not supplied; compare reverse of folio 988 and folios 1109 to 1110). For its part, in analyzing the alleged unlawfulness consisting of a violation of the Ley Forestal, the criminal trial court determined, in a coherent and reasoned manner, that it was impossible to establish, within the framework of the facts alleged in the indictment and private prosecution, the defendant’s participation, because the actual source or “characterization of the body of water” located along the northern boundary of the property at issue in the litigation had not been established, and because doubt also existed as to the accused’s knowledge of the normative element of that criminal offense (compare front of folio 989).
More specifically, Judges Arguedas Carballo and Portuguez Herrera, together with their colleague Vargas Rojas, relying on the evidentiary record admitted pursuant to sections 142 and 184 of the Code of Criminal Procedure, verified the existence of the property registered in the Public Registry under real-property folio registration number 2-215469-000, in relation to which a body of water was referenced that, when entered in the national cadastre in 1995, was identified as a stream known as “Quebrada Flores.” This information was obtained from the testimony of [Nombre 006], [Nombre 007], and [Nombre 008], who stated “that the defendant and the attorney whom they hired to prepare the deed of transfer told them that a stream was referenced along one of the boundaries of that property” (compare front of folio 989, third paragraph). In turn, based on the weight assigned to each item of evidence, the court of first instance (a quo) found that: “… based on the statement made by the defendant in the full exercise of his right to present a personal defense, he states that he had not been informed of any restrictions on building on the property; that he knew of the watercourse at the site, but understood it to be Quebrada Flores; that he completed all the procedures necessary to build and the municipality granted him the permits, and he therefore believed there was no impediment to building his house on the property; that later (sic), when the work was halted, he sought advice from municipal officials so that he could continue it and also paid for a private study of the watercourse, on the basis of which the municipality allowed him to complete construction.
Accordingly, following the principles of the theory of criminal liability, it cannot be established with certainty that, when construction was undertaken, the defendant knew that the watercourse was a spring and, consequently, that construction of the house was within its protected radius” (underlining and emphasis not in the original text; compare reverse of folio 993 to folio 994, first paragraph). Likewise, as part of the effort inherent in disproving that the body of water was a spring, the court of first instance, after descriptively weighing the evidence (compare folios 989 to 998, first paragraph), stated: “… despite having concluded the trial, and because of the importance of determining with certainty whether this was a spring, the Court consulted the Water Directorate; although that entity informed us that a site visit was conducted in 2019 and that the existence of an unnamed spring was recorded, it cannot determine from the materials provided (sic) to it (sic) whether the watercourse at the stated coordinates in that area is a spring, because a study of the area is required for that purpose” (compare reverse of folio 998, end of first paragraph).
In its analysis of the evidentiary matters, the judicial authority, applying the rules of sound reasoning, stated: “For the Court (sic) to accept the opinion issued by SENARA and by the witness Matamoros, it would have to base the classification as a spring on an appeal to authority and state that it is a spring because SENARA said so and because the Water Directorate also said so. How did they reach that conclusion? This is unclear; it appears that observing the site and the fact that water emerges throughout the year are sufficient for those entities to determine whether or not it is a spring. Beyond that observation, however, which appears quite empirical and not very scientific, when the method is questioned both institutions fall short and fail to analyze the existing evidence, or they state that a more extensive study is required to answer the question presented, once again leaving unresolved the possibility of comparing those empirical assessments with the scientific method.
The Court does not seek, merely on a whim, to question either the Water Directorate’s determination or the statement of the SENARA representative; rather, there is a normative element that clearly defines what a spring is. In this regard, the Water Directorate states that a spring is a flow of groundwater that emerges at the surface because of topographical changes, preferential zones, geological or structural features such as faults, changes in hydraulic conductivity, fractures, or discontinuities. As can be seen, for a spring to exist, that emergence must necessarily be connected to an aquifer, and the spring must be the point at which the water emerges. In this case, however, that could not be determined, given that the Fundevi study, which is a public document used as a reference by SENARA and by the Geotec report, indicates various groundwater depths at the site that differ greatly from the elevation above sea level at which the study point was located.
Furthermore, SENARA’s water-table contour map for the Alajuela area, which is also available on its website, shows that the Colima aquifer is extremely far from the San Isidro de Grecia area; according to that map, what exists there are water-table contour lines, and no one has been able to tell us whether the emergence under study is related to those contour lines or to any particular aquifer, or at what (sic) depth that aquifer is located” (emphasis not in the original text; compare reverse of folio 998, second paragraph, to folio 999, first paragraph). In keeping with that reasoning, the judicial authority states: “The Court further understands that, although it might be said that a field inspection is required to provide that answer, such an inspection would in turn be more scientific and would be based on data already collected at the site, such as the depth of wells already drilled in the area or information held by various state entities, including the Universidad de Costa Rica, that would make it possible to establish the groundwater level at the site and whether it coincides with the location of the emergence, rather than simply assuming that it does without providing any further grounds.
For these reasons, the Court cannot state clearly that a spring exists at the site or that it is permanent” (emphasis not in the original text; compare front of folio 999, final portion of first paragraph). It should be noted that this substantive assessment was addressed comprehensively by the appellate court (ad quem), which undertook the necessary comparison with the arguments contained in the appeal and found that assessment more persuasive than a narrative aimed at challenging the legal reasoning as insufficient on the assumption that it had disregarded examination of “the evidence establishing the existence of a spring and a protected zone, but above all had failed to provide any legal reasoning whatsoever…” and had—hypothetically—consigned to oblivion the precautionary and pro natura principles, which are indispensable when addressing actions concerning biodiversity (compare reverse of folio 1109, second paragraph).
Thus, the hermeneutic weighing (ponderación hermenéutica) undertaken by Judges Godínez Segura and Redondo Gómez and Judge Rojas Chacón supports rejecting the claim of failure to observe Article 11 of the Ley de Biodiversidad because, according to the analysis of the factual circumstances deemed proven in the adversarial proceedings (contradictorio) and of the evidence presented (pruebas evacuadas), what stands out is the inability to establish the existence of a danger or threat of serious or imminent harm “to the components of biodiversity and the knowledge associated with them”; that is, they disprove the alleged encroachment upon the protection area (área de protección) and the existence of any direct, actual harm to the environment. This legal position follows from the careful weighing of the issue raised on appeal and the lack of factual identity (falta de identidad fáctica) between the precedents of the appellate courts, together with the State representative’s slanted interpretation of constitutional case law and the analytical examination of insufficient technical prosecution evidence (prueba técnica de cargo) regarding “whether that body of water was a permanent spring (naciente permanente).
And if that is so, neither can the existence of harm to the environment be affirmed, and therefore, under these circumstances, ordering the demolition of the structure would be arbitrary” (compare folios 1109 verso to 1110 recto). Fully consistent with the foregoing, it confirms the absence of the objective parameters necessary to fit the specific facts (compare folio 1109 verso, second paragraph) within the situation contemplated by the legislature in point 2 of the Ley de Biodiversidad, which provides: “Article 11. Criteria for applying this law. The following are criteria for applying this law: 1.-Preventive criterion (criterio preventivo): It is recognized that anticipating, preventing, and addressing the causes of biodiversity loss or threats thereto are of vital importance. 2.-Precautionary or in dubio pro natura criterion (criterio precautorio o indubio pro natura): When there is a danger or threat of serious or imminent harm to the components of biodiversity and the knowledge associated with them, the absence of scientific certainty shall not be used as a reason to postpone the adoption of effective protective measures. 3.-Environmental public-interest criterion (criterio de interés público ambiental): The use of biodiversity components shall safeguard future generations’ development options, food security, ecosystem conservation, protection of human health, and improvement of citizens’ quality of life. 4.-Integration criterion (criterio de integración): The conservation and sustainable use of biodiversity shall be incorporated into sectoral and intersectoral plans, programs, activities, and strategies so that they are integrated into the development process” (emphasis not in the original text).
Accordingly, based on the evidence admitted, the reasoning rejects the existence of environmental harm because the presence of a permanent spring on the property then owned by the accused was not, in fact, proven; consequently, the criminal judgment appellate court was unable to verify the scope of the allegations originally made, and therefore, as will be discussed below, the alleged defect lacks materiality under Article 439 of the adjective criminal law (ley penal adjetiva). Broadly speaking, in fulfilling its duty to conduct a comprehensive descriptive and intellectual assessment of the judgment (compare folios 1092 to 1098 and 1099 to 1105), pursuant to provisions 459, 462, and 465 of the criminal procedural code (ordenanza procesal penal), the court ad quem stated: “The appellants fail to refute the Trial Court’s arguments and instead confine their assertions to claiming that, if there was a water outcrop (afloramiento) at the investigated site during both winter and summer, its source necessarily consisted of groundwater (aguas subterráneas).
But in a case as particular as the one before us, without a hydrogeological study (estudio hidrogeológico) confirming this, that fact may be treated merely as circumstantial evidence (indicio) of a permanent spring, but not with the certainty required for the application of criminal law. Contrary to what is asserted in the grounds for appeal, the court of first instance (órgano de instancia) explains in its judgment that, according to the position advanced by geologist Rafael Matamoros, based precisely on FUNDEVI’s and UCR’s own study, the surface waters (aguas superficiales) referred to by SENARE (sic) would come from the Colima aquifer (manto acuífero); however, according to SENARA’s water-table contour map (mapa isofreático) for the Alajuela area, […] the Colima aquifer is extremely far from the San Isidro de Grecia area, and what exists there, according to that map, are water-table contour lines (curvas isofreáticas), with no one having been able to answer the Trial Court as to whether the water outcrop under examination was related to those contours.
It is therefore untrue, as the Procuraduría claims, that the A quo merely cited the testimony given by expert witness Rafael Matamoros without analyzing its content, because an intellectual assessment of the prosecution evidence is evident here. For the same reasons set forth above, the Trial Court is correct in noting that official letter DA-UHTPCPSR-0240-2019 from the Dirección de Aguas (cf. Folios 924 to 929) adds no further substantive information to that reported by SENARA, to the effect that the spring is classified as permanent essentially because it maintains its flow rate (caudal) during the summer (cf. Folio 926); however, that report likewise does not state that a hydrogeological study existed confirming that groundwater was the source. Therefore, the Trial Court’s assertion that this is a predominantly empirical criterion cannot be deemed incorrect” (Capitalization appears in the original text; compare folio 1098 recto and verso).
In that regard, as Lic. Salazar Araya and Lic. Pessoa Solera correctly point out in responding to the hearings granted (compare folios 1139 to 1141 and 1152 to 1156), and as this Chamber indeed verifies, the asserted failure to observe the Ley de Biodiversidad cannot be established because the appellate court did consider and address the complaint alleging that the refusal to order demolition of the structure lacked grounds and, by unanimous decision, affirmed the ruling of the a quo. In turn, upon reading the entire logical path of reasoning (iter lógico)—understood as a logical and legal whole—the appellate court ruled out, in accordance with the legal system, any infringement of the in dubio pro natura or precautionary principle (principio precautorio), after finding that, based on its own analytical development of the facts and the evidence presented, it was not possible to establish as true a danger or threat of serious or imminent harm “to the components of biodiversity and the knowledge associated with them”; in other words, based on its reasoned deductions, it affirmed the a quo’s decision finding that encroachment upon a protection area had been disproven and, ultimately, that no harm to the environment had occurred.
Along those lines, as follows from the intellectual reasoning provided by the a quo and the ad quem concerning the details of the prosecutorial investigation (investigación fiscal), the present analysis on the merits centered on an iuris tantum presumption (premisa iuris tantum) concerning the existence of a spring, arising from a report endorsed by the Sistema Nacional de Áreas de Conservación de la Cordillera Volcánica Central, Subregión Occidental -SINAC- (compare folios 1 to 15 of the case file, volume I), and by the servicio Nacional de Aguas Subterráneas, Riego y Avenamiento -SENARA- (compare folios 74 to 97, 120 to 126, and 132 to 140), as opposed to the conflicting opinion in the expert examination (pericia) conducted by GEOTEC on the property formerly owned by the accused [Nombre 019], under geologist Leonel Rojas Castro, whose documentation addressed to architect Luis Enrique Corrales Ramírez, coordinator of the Departamento de Planificación Urbana y Control Constructivo de la Municipalidad de Grecia, concluded: “Based on the elements considered and analyzed in this report, it is concluded that, because a group of springs (manantiales) arranged in a more or less linear manner appears in the area as it descends from quebrada Flores, they constitute the base of that stream and form an intrinsic part thereof; accordingly, the body of water to be protected in terms of forest resources (recurso forestal) (applying only the Ley Forestal, not the Ley de Aguas) is quebrada Flores, taking into account a 50 m protection strip (franja de protección)” (compare folios 100 to 106).
Furthermore, the evaluative findings (juicios de valor) set forth by the ad quem state: “As can be seen, the position advanced by the defense expert witness (perito de la defensa) is that the conclusions of the GEOTEC study are correct, whereas those of SENARA are not, first, because according to the FUNDEVI and UCR study, there are no aquifers in the affected area, since the Colima aquifer is located in an entirely different and distant sector; thus, far from contradicting his conclusions, that study instead supported them. Second, he states that the FUNDEVI and UCR document places the water table (nivel freático) in the area of interest at 70 meters, which is incompatible with SENARA’s assertions, such that the only way to establish with certainty that the body of water located near the residence built by the defendant was a permanent spring was through a hydrogeological study” (compare folio 1094 verso).
This chain of facts and evidence allowed the judgment appellate court to resolve the doubt concerning the existence of the spring by closely examining the third opinion regarding the matter at issue, which the a quo sought pursuant to the principle of freedom of proof (principio de libertad probatoria), and on that basis held: “… the Trial Court decided to request a third opinion, this time from the Dirección de Aguas, which, according to SINAC official letter OG-1212-2017 of August 25, 2017 (cf. Folios 646 and 647), is the agency competent to characterize a body of water in cases of doubt, in order to definitively clarify the nature of the site where the water emerges, with the result that this latter department was likewise unable to provide a definitive answer, for which reason the defendant’s acquittal (absolutoria) was required …” (compare folio 1094 verso). Moreover, in view of the appellants’ disagreement, the ad quem examines the intellectual analysis undertaken by the criminal court, stating as follows: “… the judges—in summary—explained that, in this case, there were not only doubts regarding the nomenclature used by the different institutions involved in safeguarding the water resource (recurso hídrico) (SINAC, SENARA, and the Dirección de Aguas), as well as doubts regarding its georeferenced location (ubicación georeferencial), but also doubts as to whether the tributary (afluente) with the characteristics identified by SINAC and SENARA was a ‘spring.’ They note that the prosecutors speak of the existence of two springs at the site, 27 and 258, based on the SINAC report prepared by Eliden Alcázar Barahona and Carlos Gutiérrez Santana, which reports that the structure built by the defendant is located 71.5 meters from the tributary they identify as a spring, whose geographic location, according to its coordinates, is 233267 horizontal and 506347 vertical, whereas SENARE report DIGH-1092-11 informed the prosecution service that, as of November 17, 2011, a review of that institution’s database within a 2000-meter radius of the location of the accused’s property identified a spring designated NAC 1189, situated 82 meters from the site.
Nevertheless—the judges continue—once SENARA’s field study had been conducted through report DIGH-UGH-OF-066-2012, the professionals who performed the inspection reported the location of a spring (naciente), now situated at coordinates 233293 north latitude and 506368 east longitude, concluding that it was NAC 1189, previously registered according to that entity’s database, and that the distance between the infrastructure and the outcrop (afloramiento) was 48 metros; thus, neither institution was even clear about the nomenclature used to identify the body of water, and they provided different coordinates and distances between the location of the tributary and the dwelling” (The capitalization does not appear in the original text, folio 1095 front, volume III; to similar effect, see folio 1100 front and back). In addition to the foregoing and the remaining documentary evidence entered into the record (compare folio 988 front and back, volume III), consideration must be given, in light of the principles of orality and immediacy (inmediación), to the testimonial evidence presented, namely: [Nombre 010], Carlos Gutiérrez Santana, Eliden Alcázar Barahona, [Nombre 013], Rafael Matamoros Arguedas, [Nombre 014], [Nombre 015], [Nombre 016] and [Nombre 017], [Nombre 018], and Luis E. Corrales Ramírez (compare folios 953 to 988).
Based on that evidence, the criminal trial court determined, pursuant to the principle of freedom of proof (libertad probatoria), that the proceedings had to be reopened in order to ascertain the position of the Dirección de Aguas, an administrative office of the Ministerio de Ambiente y de Energía (MINAET)—the only entity legally authorized to define and identify what is to be understood as a spring. With regard to the dispute between SENARA and GOTEC concerning whether a spring existed in the contested matter reported by SINAC, that judicial authority rejected any connection between the outcrop and an aquifer (manto acuífero), reasoning that its assessment of the Fundevi documentation used by SENARA and the GEOTEC report reflected different groundwater depths at the site, far removed from the elevation above sea level at which the point in question was located (compare folio 999 front, first paragraph).
The appellate court likewise upheld the actions of the court below (a quo) in light of the uncertainty concerning the characterization of the body of water at the heart of the dispute, stating: “As explained in the recital (considerando) of this ruling, the prosecuting authority had conflicting findings in the expert reports from SENARE and Gotec concerning the characterization of the bodies of water located on the accused’s property. In this Chamber’s view, it was therefore reasonable to consult the Dirección de Aguas, which is precisely the entity with jurisdiction to determine whether an outcrop may be classified as a permanent spring …” (compare folio 1108 back). From the reasoning employed by the appellate court (ad quem) in addressing the appellants’ opposing argument, the following stands out: “… Mr. [Nombre 019] was provided with an expert opinion prepared by geologist Leonel Rojas Castro, which stated categorically that the water outcrops identified by SINAC were not permanent springs, but rather a stream, which was precisely the same information available to the accused and allowed him to complete the construction …” (compare folio 1104 Back, volume II).
Regarding this highly relevant issue, Sala Constitucional, in judgment N° 2019-009221, at 11:41 horas on 22 de mayo de 2019, composed of Castillo Víquez, Cruz Castro, Hernández López, Salazar Alvarado, Araya García, Esquivel R, and Picado B, stated: “… verification of whether a spring is permanent or non-permanent is a determination falling within the purview of the Administration’s technical bodies and, in accordance with their respective spheres of authority, would be a matter for the Dirección de Aguas del Ministerio del Ambiente y Energía, in close coordination with other related bodies such as the Servicio de Aguas Subterráneas, Riego y Avenamiento and the Instituto Costarricense de Acueductos y Alcantarillados itself; that determination must likewise be observed even by municipalities when preparing land-use permits (permisos de uso de suelo) or denying them. Accordingly, it is for the Administration, through the preparation of the necessary technical studies, to determine whether a water-resource spring is permanent or non-permanent …”.
It should be noted, still within the argumentative context described above, that the judgment appellate court questioned why neither the Ministerio Público nor the Procuraduría General de la República had sought a technical opinion from the Dirección de Aguas from the outset of the preparatory stage. It explicitly referred to essential evidence that had not been obtained: “… if the Ministerio Público and the Procuraduría General de la República sought to have the accused convicted of the offense of Encroachment on a Protected Area (Invasión a Área Protegida) (art. 58, first subsection, of the Ley Forestal), they had to rebut the defense’s theory. And that is precisely what they failed to do in the case at bar (súb júdice), because, as will be discussed below, the judgment explains that the testimony of both Rafael Matamoros and Leonel Rojas was extensive and clear, conveying sincerity and an absence of any intent to favor or prejudice the accused; consequently, there was no reason to diminish their credibility” (compare folio 1094 back).
In order to determine the characterization of an outcrop with certainty, the appellate court summarized: “It is therefore not the Court’s responsibility that, when its members determined that this study was necessary, the Dirección de Aguas was unable to conduct it because of the time of year in which the trial took place. It must be reiterated here that this problem would not have arisen if the prosecution had previously taken steps to enter this evidence into the case record …” (compare folio 1109 back, volume III). This Chamber confirms that the reasoning adopted by the judicial authorities responsible for this proceeding is consistent with the principle of legality (principio de legalidad), because the crux or indisputable essence of this matter—the verification of the existence of a spring—precludes, in light of the principle of legal certainty (principio de seguridad jurídica), contemplating a conviction for the offense of encroachment on a protected area, much less ordering the demolition of a residential structure whose various permits, including the building permit, were approved by Municipalidad de Grecia and served precisely as the basis for Banco Nacional de Costa Rica’s decision to grant the private complainant and civil plaintiff (persona querellante y actora civil) a mortgage loan secured by that property.
The grounds must be dismissed because, in a Social and Democratic State Governed by the Rule of Law (Estado Social y Democrático de Derecho), the precautionary principle (criterio precautorio), or in dubio pro natura, arises only when encroachment on a protection area (área de protección) has been fully established—an occurrence that was entirely ruled out during the trial and appellate stages and that, during the investigation and intermediate stages, gave rise to an impairment of the principle of effective judicial protection (principio de tutela judicial efectiva). This was because the initial theory—a rebuttable presumption (presunción iuris tantun)—that a spring existed (compare folio 998 back, volume I) operated in this criminal proceeding as an irrebuttable presumption (presunción iure et iure), contrary to the technical and scientific findings and to the detriment of a prompt and proportionate resolution consistent with provisions 39 and 41 of the Carta Magna, for example: “… in a case as particular as the one before us, and without a hydrogeological study confirming it, this may be stated merely as an indication of a permanent spring, but not with the certainty required for the application of criminal law.
Contrary to what is asserted in the grounds, the trial court explained in its judgment that, according to the theory advanced by geologist Rafael Matamoros and based precisely on FUNDEVI’s and UCR’s own study, the surface waters referred to by SENARE would originate in the Colima aquifer; however, according to SENARA’s potentiometric map for the Alajuela area, which also appears on its website, the Colima aquifer is extremely far from the San Isidro de Grecia area and, according to that map, what exists there are potentiometric contours (curvas isofráticas) (sic), with no one having been able to answer the Court as to whether the outcrop under study was related to those contours. It is therefore untrue, as the Procuraduría claims, that the A quo merely cited the testimony of expert Rafael Matamoros without analyzing its content, because an analytical assessment of the prosecution evidence is evident here” (The capitalization does not appear in the original text, compare folio 1098 front, volume III.
Regarding the aforementioned principle and the protection of groundwater (aguas subterráneas), see judgment number 2010-06922, at 14:35 horas, on 16 de abril de 2010 [Calzada Miranda, Mora Mora, Armijo Sancho, Jinesta Lobo, Cruz Castro, Castillo Víquez, and Rodríguez A], Sala Constitucional de la Corte Suprema de Justicia). Accordingly, the demonstrable reasoning of the appellate court reveals its evident reasonableness, since that conclusion arose from the absence of the objective parameters needed to fit the specific facts (compare folio 1109 back, second paragraph) within the circumstances contemplated by the legislature in point 2 of article 11 of the Ley de Biodiversidad; that is, the evidence entered into the record does not establish the existence of a spring on the property at issue in the dispute, and the judgment appellate court was therefore unable to establish the extent of any harm to the environment.
The alleged defect is not material; the appellants disregard the indispensable requirement of a verifiable and actual injury resulting from the ruling of the competent authority, thereby seeking nullity for nullity’s own sake (judgment number 2023-00112, at 12:09 horas, on 3 de febrero de 2023 [Solano Castro, Ramírez Quirós, Alfaro Vargas, Zúñiga Morales, and Segura Bonilla], Sala Tercera de la Corte Suprema de Justicia). There was no failure to observe section 11 of the Ley de Biodiversidad, because the judicial authorities responsible for this proceeding rejected, on reasoned grounds, the existence of any spring on the property involved in the judicial dispute and, consequently, there was a clear impossibility of identifying any threat or danger to water resources and the environment generally. In addition to the foregoing concerning the prosecution service’s functional direction (dirección funcional), the appellate court explained: “… as the Trial Court correctly explained, it was incumbent upon the prosecution to demonstrate with certainty that the waters feeding the outcrop on the accused’s land originated from underground flows supplied by aquifers.
It never did so because, inexplicably, it had never requested the corresponding studies from the Dirección de Aguas del MINAET during the investigation stage, until that evidence was ordered by the Trial Court on its own motion (de oficio)” (compare folio 1099 front). Consequently, the appeals on points of law (recursos de casación) must be dismissed, since the appellate court’s ruling complies with the legal framework currently in force, pursuant to provisions 39, 41 and 50 of the Carta Magna, in conjunction with articles 1 to 3, 7.2, 9, and 11.2 of the Ley de Biodiversidad; principle N° 15 of the Declaración de Río-Conferencia de Naciones Unidas sobre el Medio Ambiente y el Desarrollo; and article 439 in relation to provisions 469 and 471 of the criminal procedural code.
Therefore:
The challenges filed by the representative of the Procuraduría General de la República and the Ministerio Público are hereby denied. Let notice be given.

Revisión del Documento Res. 2024-00450 SALA DE CASACIÓN PENAL. San José, a las diez horas dieciséis minutos del veintiocho de mayo de dos mil veinticuatro.
Recursos de Casación, interpuestos en la presente causa seguida contra [Nombre 019], conocido como pisco, mayor, nacionalidad costarricense, cédula de identidad número [Valor 001], nativo de grecia, el 26 de noviembre de 1959, hijo de [Nombre 001] y [Nombre 002], por los delitos de invasión a una área de protección y estelionato, cometido en perjuicio [Nombre 005], [Nombre 006] y del Estado. Intervienen en la decisión del recurso, las magistradas y los magistrados Jesús Alberto Ramírez Quirós, Gerardo Rubén Alfaro Vargas, Sandra Eugenia Zúñiga Morales, Patricia Vargas González y Rafael Segura Bonilla, este último en su condición de suplente. También intervienen ante esta instancia, los licenciados Randall Aguirre Mena en condición de Procurador Penal en representación del Estado, así como el licenciado Frankarlo Pessoa Solera, en condición de Apoderado General Judicial del Banco Nacional de Costa Rica en su calidad de Tercero Civil Interesado y la licenciada Jannette Salazar Araya, representante legal de la parte Querellantes y Actora Civil [Nombre 005]. El licenciado Arturo Figueroa García Fiscal de la Fiscalía de Grecia, en representación del Ministerio Público.
Resultando:
1. Mediante sentencia N° 2022-001109, dictada a las trece horas cincuenta y cinco minutos del veintinueve de noviembre de dos mil veintidós, el Tribunal de Apelación de Sentencia del Tercer Circuito Judicial de Alajuela, Sección San Ramón, resolvió: “POR TANTO: Se declara sin lugar los recurso de apelación de sentencia interpuestos por el Ministerio Público y la Procuraduría General de la república” José Alberto Rojas Chacón, Yadira Godínez Segura y karina Redondo Gómez. Juez y Juezas de Apelación de Sentencia". (sic).
2. Contra el anterior pronunciamiento, el licenciado Randall Aguirre Mena en condición de Procurador Penal en representación del Estado, así como el licenciado Arturo Figueroa García Fiscal de la Fiscalía de Grecia, en representación del Ministerio Público, interpusieron recursos de casación.
3. Verificada la deliberación respectiva, la Sala se planteó las cuestiones formuladas en el recurso.
4. En los procedimientos se han observado las prescripciones legales pertinentes; y, Informa el magistrado Segura Bonilla; y,
Considerando:
I.En resolución N°2023-00286, de las 11:00 horas, del 22 de marzo de 2023, esta Sala, admitió para estudio de fondo el motivo segundo de cada recurso formulado por el licenciado Randall Aguirre Mena, Procurador General de la República, y el licenciado Arturo Figueroa García, en representación del Ministerio Público, contra la resolución N° 2022-001109, de las 13:55 horas, del 29 de noviembre de 2022, dictada por el Tribunal de Apelación de Sentencia Penal del Tercer Circuito Judicial de Alajuela, Sección Primera, San Ramón, que declaró sin lugar las impugnaciones presentadas contra la sentencia número 154-TGRE-2021, de las 16:15 horas del 2 de noviembre de 2021, del Tribunal Penal del Tercer Circuito Judicial de Alajuela, sede Grecia, en lo referente a la solicitud planteada de derribo de la vivienda inscrita en ese entonces, a nombre del imputado [Nombre 019] (confrontar folios 1169 frente y vuelto; 1171 frente y vuelto, y 1172).
II.Objeto de impugnación. Refiere el licenciado Randall Aguirre Mena, en su condición de procurador penal, de conformidad con el inciso b) del ordinal 468 del Código Procesal Penal, que el ad quem al rechazar el quinto reclamo de apelación referente a la solicitud de derribo (confrontar folios 1041 a 1044), inobservó el artículo 11 de la Ley de Biodiversidad, por cuanto el fundamento realizado, carece de sustento fáctico y jurídico al denegar lo gestionado. Aduce que tal decisión, surge de la absolutoria emitida a favor de la persona imputada [Nombre 019], al evidenciarse la insuficiencia de la prueba técnica de cargo, para lograr acreditar “que el cuerpo de agua fuera una naciente permanente …” (confrontar folio 1134 párrafo segundo). Así las cosas, establece que lo fundado por la autoridad jurisdiccional se dirige “en sostener que ante una duda de la existencia de la naturaleza permanente de las nacientes (no de la presencia de nacientes en el lugar) lo que corresponde es el rechazo del derribo…”, ello, con el propósito de evitar cualquier arbitrariedad (confrontar folio 1134, párrafo tercero).
Afirma que con tal actuar, el tribunal de alzada, excluye en el ámbito ambiental, la preminencia de lo más beneficioso al medio ambiente, en razón de garantizar la tutela del recurso hídrico. En respaldo de su tesis, enuncia el precedente número 2019-9221 de la Sala Constitucional de la Corte Suprema de Justicia. Así, reitera: “Entonces, para el Tribunal de apelación al existir una duda sobre la naturaleza permanente de las nacientes al amparo de una comparación de las conclusiones de dos pruebas técnicas ello debe llevar insoslayablemente a que se mantenga la construcción a pesar que la duda si bien es cierto en materia penal favorece al imputado (sic) pero en materia ambiental debe favorecer al medio ambiente, es decir, a lo que sea más favorable a la preservación y conservación de los recursos naturales siendo contrario a los principios ambientales y al espíritu del legislador preservar una obra construida donde existen nacientes …” (confrontar folios 1134 párrafo quinto a 1135).
Solicita a esta Cámara, declarar con lugar el motivo, se anule el fallo judicial recurrido, ordenándose el reenvío para una nueva valoración de la quinta queja de apelación formulada (confrontar folio 1135, párrafo tercero). Por su parte, el fiscal Figueroa García, en similar criterio, avala en su adhesión, la aparente omisión del citado artículo 11 de la Ley de Biodiversidad, pues, alude que los argumentos del ad quem, resultan insuficientes al zanjar la temática del derribo. Al respecto, transcribe un segmento de lo argüido para luego, replicar el reclamo del representante de la Procuraduría General de la República, al señalar: “El tribunal sustenta el rechazo del quinto motivo de apelación al amparo del absolutorio penal del imputado y bajo el argumento que la prueba técnica de cargo resulto (sic) insuficiente para demostrar que el cuerpo de agua fuera una naciente permanente, sobre ello se asume (en virtud que no se dice en ese apartado del fallo) que hay que atenerse a lo resuelto en el apartado del voto que guarda relación con ese aspecto.
La argumentación de los señores jueces, se direccionan (sic) en sostener que ante una duda de la existencia de la naturaleza permanente de las nacientes (no de la presencia de nacientes en el lugar) lo que corresponde es el rechazo del derribo ya que resolver para el tribunal de apelación sería arbitrario...” (confrontar folio 1149 frente). Arguye que, en el asunto de estudio, el ad quem menoscaba los principios pro natura y precautorio, al mantener la construcción de la obra en perjuicio del medio ambiente y de los intereses del Estado. De acuerdo a lo referido, promueve anular la resolución impugnada y se proceda conforme a derecho (confrontar folio 1149 frente y vuelto).
III.Contestación de los recursos de casación. En fecha 17 de enero de 2023, Frankarlo Pessoa Solera, en su condición de apoderado general judicial del Banco Nacional de Costa Rica, acorde a su calidad de tercero civil interesado, procedió a contestar el emplazamiento dado sobre la impugnación incoada por el procurador penal Randall Aguirre Mena (confrontar folio 1136). Posterior a la introducción de un breve recuento de actuaciones jurisdiccionales (confrontar folio 1139 frente y vuelto), el personero de la dirección jurídica de dicha entidad bancaria, se detiene en argumentaciones referentes a la discusión sobre el ámbito de la naciente y del pretendido derribo mencionado por el representante del Estado, para luego, expresar que de acuerdo con los puntos primero y segundo de la denuncia por parte del señor Eliden Alcázar Barahona (SINAC), en el año 2009 sobre un posible ilícito de invasión a zona de protección, se estimó la aparente existencia de una naciente en el citado lugar.
Al respecto, aduce que la notitia criminis da cuenta: “Que el día 18 de noviembre de los corrientes, en compañía de Carlos Gutiérrez Santana funcionario del Sistema Nacional de Áreas de Conservación de Grecia, se atendió una denuncia presentada por los vecinos del lugar, en la cual se nos informaba que en la propiedad del señor [Nombre 019], se estaba construyendo una casa en el área de protección de una naciente permanente. […] Que una vez en la finca, procedimos mi compañero y este servidor a documentar con fotografías y medir con GPS marca garmin y con cinta métrica, la (sic) distancias de la casa en construcción a la naciente y de acuerdo a los puntos de GPS que se tomaron en el campo, la casa en construcción esta (sic) a 71.5 metros, lo que indica que esta (sic) dentro de los 100 metros del área de protección, que establece la ley forestal, para las (sic) naciente (sic) permanentes” (confrontar folio 1140).
De seguido, el licenciado Pessoa Solera, cataloga como ineficiente la investigación apresurada de la fiscalía, porque en su parecer, lejos de precisar alguna naciente, “… partió que el afloramiento de agua era de carácter permanente, cuando en realidad, la investigación nunca abordó el tema; por lo anterior, fue imposible acreditar una invasión a una zona de protección” (confrontar 1140 frente, párrafo final y vuelto, párrafo primero). Enfatiza que según lo estipulado por el ad quem, no se demostró algún grado real de afectación al medio ambiente, “porque nunca se tuvo clara la existencia de una naciente”, y por esa razón, al desvirtuarse un verdadero daño al ambiente, a su recurso hídrico, no se justificaba el derribo de lo construido (lo resaltado pertenece al texto original, confrontar folio 1140 vuelto, párrafo segundo). En lo conducente al tema de in dubio pro natura, señala que tal principio, no resulta irrestricto pues, su demostración deviene de pruebas técnicas, “por un lado, la existencia de la presunta naciente y por otro, que había un daño ambiental; y sin embargo, ante la nula investigación del Ministerio Público, la falta de legitimación jurídica que tenía SINAC para actuar como lo hizo, la falta de técnicas apropiadas del SENARA para determinar la existencia de una naciente y la ausencia de la Dirección de Aguas en el proceso de investigación, no resulta de recibo acoger la posición de la Procuraduría General de la República” (la negrita es propia del texto original).
En respaldo de su argumento, invoca el voto número 17155-2009, de las 14:00 horas del 5 de noviembre de 2009, de la Sala Constitucional de la Corte Suprema de Justicia. Afirma que al tenor de dicho precedente, el principio pro natura tiene que acompañarse de análisis técnicos “que permitan despejar, más allá de toda duda razonable, no la actuación de los imputados respecto al delito ambiental, sino más bien, la existencia de un daño ambiental, el cual no puede existir en el presente caso porque nunca se demostró que estuviéramos en presencia de una naciente” (lo resaltado no se suple, confrontar folio 1140 vuelto, párrafo último). Luego de referirse a lo que titula “respecto al testigo sospechoso” (confrontar folio 1141 frente), solicita el rechazo del recurso de casación presentado (confrontar 1141 vuelto). A su vez, se colige que a las 14:00 horas del 17 de enero de 2023, la jueza tramitadora del tribunal de alzada, otorga la correspondiente audiencia del recurso de casación por adhesión implementado por el licenciado Arturo Figueroa García, fiscal del cantón de Grecia (confrontar folios 1150 frente y vuelto, 1145 a 1149).
En ese sentido, la licenciada Jeannette Salazar Araya, representante legal de la querellante y actora civil señora [Nombre 005], indica que la resolución dictada por el ad quem, resulta congruente y sustentada, por lo consecuente, desvirtúa la concurrencia de inobservancias a preceptos legales. A mayor abundamiento, puntualiza: “Argumentar que el principio pro natura se base en preservar el medio ambiente pese a (sic) incerteza científica, es hilar delgado y (sic) evidente quebranto de los Principios de Debido Proceso (sic) y de Proporcionalidad (sic). Al haber incerteza del daño al medio ambiente sería desproporcional y antijurídico tomar una medida como la de derribo para mitigar un daño que no se sabe si existe, por cuanto a lo largo de todos los debates (tres debates, dos anulados y el tercero con término) NO SE DEMOSTRO LA EXISTENCIA DE UNA NACIENTE ARGUMENTADA POR LA PROCURADURIA, CONSECUENTEMENTE, NO PUEDE HABER DAÑO DE ALGO INEXISTENTE” (la mayúscula pertenece al texto original, confrontar folios 1155 frente y vuelto).
Por último, adiciona: “Para terminar (sic) hago mías las citas de Jurisprudencia del abogado de la procuraduría ante este tema, que desde sus conclusiones las trajo a la mesa y ahora insiste lo contrario: voto de la sala constitucional: 9221-2019 “la verificación de una naciente de carácter permanente o no permanente … será un asunto propio de la dirección de aguas del ministerio de ambiente y energía, en estricta cooperación con el servicio nacional de aguas subterráneas, riego y avenamiento, y el propio instituto costarricense de acueductos y alcantarillados”. (la negrita no es del original) […] no hay inobservancias de preceptos […] Se confirme en todos sus extremos la Sentencia (sic) venida en alzada” (confrontar folio 1155 vuelto). Concluye la abogada Salazar Araya, que lo resuelto por el tribunal de alzada, muestra motivación y congruencia, descartándose falencias en la interpretación de normas legales (sustantivas o procesales), e incluso, de juicios de valor contradictorios en el presente litigio. Por las razones expuestas, solicita rechazar la referida impugnación (confrontar folio 1160 vuelto).
IV.Las impugnaciones se declaran sin lugar. En virtud de contener similar línea de argumentación, diseñada de acuerdo con el inciso b) del Código Procesal Penal, que consiste en una presunta inobservancia por parte del tribunal de alzada, de los principios de in dubio pro natura y precautorio, ante el supuesto yerro de inaplicar el artículo 11 de la Ley de Biodiversidad, y así, desatender la solicitud de derribo incoada contra la construcción realizada en detrimento de la naturaleza permanente de nacientes, e impedir restituir las cosas a su estado anterior, el representante de la Procuraduría General de la República, y el fiscal de Grecia, identifican como vicio, un insuficiente fundamento fáctico y jurídico en lo relativo a la petitoria común de derribo, al considerar inadecuada tal denegatoria. A efectos de obtener una mejor comprensión de las presentes resultas, en primer orden es oportuno realizar un cuidadoso recuento de la motivación que le antecede.
Al respecto, la línea recursiva tiene origen en los siguientes aspectos: i) Absolutoria del endilgado. Agregan que la prueba técnica evacuada no fue determinante con el propósito de acreditar que “el cuerpo de agua”, constituía una naciente permanente. ii) Estado dubitativo. En lo que concierne al rechazo del derribo, estiman su origen en la persistencia de dudas en relación con la naturaleza definitiva de las nacientes, y no de la concurrencia de nacientes en el sitio. iii) Exclusión de precedentes constitucionales. Reclaman la omisión de valorar en el contexto ambiental, que según el principio de legalidad y los alcances erga omnes de las resoluciones de la Sala Constitucional, debe predominar lo que resulte de mayor beneficio al medio ambiente. iv) Vulneración del principio de in dubio pro natura. Refutan que la posición jurídica del tribunal de alzada, relativa al estado dubitativo en relación a “la naturaleza permanente de la naciente” según una comparación conclusiva de dos pruebas técnicas, resulte apta para no demoler la obra construida, lo anterior, en quebranto a la conservación de los recursos naturales. v) Afectación.
Señalan los impugnantes, que el rechazo de la gestión de derribo produce agravio al desarticularse la esfera de tutela a la biodiversidad, ante el menoscabo de los mencionados principios de in dubio pro natura y precautorio. Así, peticionan la nulidad del fallo venido en alzada, y su reenvío según el mandato legal imperante. Ahora bien, a manera de preámbulo de lo que se resolverá, conviene determinar del asunto en cuestión, las circunstancias fácticas ratificadas por el tribunal de alzada, y su posterior valoración de lo estipulado por el tribunal penal, ello en menester de los principios de oralidad y de inmediación. Atinente al cuadro de incidencias modales, espaciales y temporales, se infiere: “PRIMERO: Para el año 2008, el encausado [Nombre 019] construyo (sic) una vivienda en la propiedad ubicada en San Isidro de Grecia, calle a Carbonal, del salón Montecarlo 300 metros al norte, finca inscrita en el partido de Alajuela, matrícula de folio real número 2-215969-000, ubicación geográfica en las coordenadas horizontales 233267 y verticales 506347, hoja cartográfica Naranjo, escala 1:50.0000, que mide 3.300 metros cuadrados y por la cual discurre un cuerpo de agua.
SEGUNDO: Para el mes de abril 2011, el encartado [Nombre 019], a sabiendas del proceso penal número 09-204266-0331-Pe seguido en su contra por el delito de Infracción (sic) ley Forestal, donde el objeto, sobre el cual recae dicha infracción forestal, lo era la propiedad partido de Alajuela, matrícula de folio real número 2-215969-000, le vende a los ofendidos [Nombre 005] y [Nombre 006] en la suma de CIENTO TREINTA MILLONES DE COLONES, ocultándoles el proceso penal 09-204266-0331-PE, en el cual se discutía limitaciones a la propiedad que le hacían imposible el disfrute de esta, produciendo un perjuicio económico a los éstos (sic) en su patrimonio, TERCERO: Que el encartado [Nombre 019] no cuenta con juzgamientos anteriores.” (la mayúscula no se suple, confrontar folio 988 vuelto y folios 1109 a 1110). Por su parte, el tribunal penal, en el análisis de la ilicitud reprochada de infracción a la ley forestal, dispuso de forma armónica y razonada la imposibilidad de demostrar en el marco de hechos acusados y querellados, la participación del imputado, al no constatarse el origen real o “la caracterización del cuerpo de agua” ubicado en el límite norte del inmueble objeto de la litis , además, de la duda sobre el conocimiento del endilgado, hacia el elemento normativo de dicho tipo penal (confrontar folio 989 frente).
A mayor amplitud, las juzgadoras Arguedas Carballo, y Portuguez Herrera, junto a su homólogo Vargas Rojas, y con apoyo del acervo probatorio incorporado, según los numerales 142 y 184 del Código Procesal Penal, verificaron la existencia de la finca inscrita en el Registro Público a folio real matrícula número 2-215469-000, de la cual, se referencia un cuerpo de agua que desde el año de 1995 -al presentarse en el catastro nacional- identificaba su naturaleza de quebrada, denominada como “Quebrada Flores”. Información obtenida de la testimonial de [Nombre 006], [Nombre 007] y [Nombre 008], quienes relataron “que la comunicación realizada a ellos por parte del imputado y la abogada que contrataron para realizar la escritura de traspaso era que en dicha propiedad en uno de sus linderos se referenciaba una quebrada” (confrontar folio 989 frente, párrafo tercero). A su vez, en apego al valor concedido a cada elemento de prueba, el a quo comprobó que: “… a partir de lo declarado por el encartado en el ejercicio pleno de su derecho de defensa material, éste manifiesta no haber sido informado de limitaciones para construir en la propiedad, que él conocía del afluente de agua existente en el lugar, pero que este se trataba de la quebrada Flores, que él realiza todos los trámites para poder construir y la municipalidad le otorga los permisos, y por ende consideró que no había problema alguno en la propiedad para la construcción de su casa, que luego (sic) cuando le paralizan la obra se asesora con los personeros municipales para poder continuar con la misma y además paga un estudio particular del afluente con el cual la municipalidad le permite finalizar la construcción; por lo que siguiendo los lineamientos de la teoría del delito, no es posible acreditar con el grado de certeza que el encartado conociera para el momento en que se realiza la construcción que el afluente se trataba de una naciente, y por ende que la construcción de la vivienda estaba dentro del radio de protección de la misma” (Lo subrayado y resaltado no pertenece al texto original, confrontar folios 993 vuelto a 994, párrafo primero).
Asimismo, dentro del ejercicio consustancial de desvirtuar tal cuerpo de agua como naciente, el a quo, luego de la ponderación probatoria descriptiva (confrontar folios 989 a 998 párrafo primero), aseveró: “… el Tribunal a pesar de haber concluido el debate y en razón de la trascendencia que (sic) dilucidar certeramente si nos encontrábamos frente a una naciente, realiza la consulta a la Dirección de aguas y si bien dicha entidad, nos refiere que en el 2019 se hizo una visita en el sitio el cual se referencio (sic) la existencia de una naciente sin nombre, no pueden con los elementos que se (sic) le hicieron llegar (sic) determinar que en las coordenadas indicadas el afluente existente en dicha zona se trate de una naciente ya que para ello se hace necesario un estudio de la zona” (confrontar folio 998 vuelto, final del párrafo primero). En su desarrollo analítico y frente a las incidencias de las probanzas, la autoridad judicial, de acuerdo a las reglas del correcto entendimiento humano, aseguró: “Para el Tribunal (sic) de acoger el criterio rendido por Senara y por el testigo Matamoros, tendría que fundamentar la categoría de naciente, apelando a un criterio de autoridad y señalar que se trata de una naciente porque el SENARA lo dijo y porque la Dirección de Agua también lo refirieron.
¿Cómo llegaron a esa conclusión? No se tiene claridad, parece ser que la observación en el sitio y el hecho de que aflore agua todo el año es suficiente para dichas entidades para determinar que es una naciente o no. Pero lejos de esa observación que parece bastante empírica y poco científica, cuando se cuestiona el método, ambas instituciones se quedan cortas y no analizan la evidencia existente o dicen que para dar respuesta a lo peticionado se requiere un estudio mayor, dejando nuevamente en el aire, la posibilidad de confrontar esas valoraciones empíricas con el método científico. Y es que el Tribunal no busca tampoco cuestionar por simple capricho lo dictaminado por la Dirección de Aguas, o lo dicho por el representante del SENARA, sino que existe un aspecto normativo que claramente nos define que es una naciente. Al respecto la Dirección de Aguas indica que una naciente es el flujo de agua subterránea que aflora en la superficie debido a cambios topográficos, zonas preferenciales, rasgos geológicos, estructurales como fallas, o cambios en la conductividad hidráulica, fracturas o discontinuidades.
Como se puede apreciar, para que exista naciente, es por que (sic) ese afloramiento necesariamente se tiene que relacionar con un manto acuífero, y que ésta sea el punto de afloramiento. Pero en esta causa eso no se pudo determinar, considerando que el estudio del Fundevi que es un documento de carácter público y usado como referencia por el SENARA y por el informe de Geotec, señala diferentes niveles de profundidad de las aguas en el sitio que distan mucho de la altura en relación al nivel del mar en el que se ubicó el punto de estudio. Además, el mapa isofreático del SENARA para la zona de Alajuela, que también consta en su página de internet hace ver que el acuífero colima está sumamente alejado de la zona de San Isidro de Grecia, ahí lo que hay según dicho mapa son curvas isofreáticas y nadie nos ha podido contestar si ese afloramiento en estudio tiene o no relación con estas curvas o con cual manto acuífero en particular y que a (sic) profundidad se ubica el mismo” (lo resaltado no pertenece al texto original, confrontar folios 998 vuelto párrafo segundo a 999 párrafo primero).
Acorde a tales silogismos, la autoridad judicial sostiene: “El tribunal entiende además, que aunque podrá decirse que se requiere una inspección de campo para dar esa respuesta, la misma, a su vez es más científica y se basa en datos ya recopilados en el sitio como la profundidad de pozos ya excavados en la zona o la información existente en diferentes entidades estatales como la Universidad de Costa Rica, que permitan establecer a que (sic) nivel se encuentra en el sitio el nivel (sic) del agua subterránea y si esto coincide con la ubicación del afloramiento, y no darlo por sentado sin indicar mayor fundamento alguno. Por estas razones, el Tribunal no puede señalar que en el sitio existe con claridad una naciente, y que esa sea ésta (sic) de carácter permanente” (lo destacado no es propio del texto original, confrontar folio 999 frente, parte final del párrafo primero). Nótese que esta valoración de fondo, fue abordada integralmente por el ad quem, al realizar el necesario contraste con el contenido argumentativo de lo apelado, imponiéndose sobre un relato discursivo direccionado en atacar la motivación jurídica como insuficiente, bajo el supuesto de soslayar el examen de “la prueba que determina la existencia de una naciente y de una zona de protección, pero sobre todo de no realizar ninguna fundamentación jurídica…” y dejar -hipotéticamente- en el olvido los principios precautorio y pro natura, indispensables en el trato de actuaciones concernientes a la biodiversidad (confrontar folio 1109 vuelto, párrafo segundo).
Así, la ponderación hermenéutica ejercida por las juezas Godínez Segura, y Redondo Gómez, y el juez Rojas Chacón, faculta rechazar el alegato de inobservancia del artículo 11 de la Ley de Biodiversidad, porque de acuerdo al análisis de las circunstancias fácticas tenidas por probadas en el contradictorio, y de las pruebas evacuadas, sobresale el impedimento de acreditar la existencia de peligro o amenazas de daños graves o inminentes “a los elementos de la biodiversidad y al conocimiento asociado con estos”, es decir, desvirtúan la invasión al área de protección aludido, y algún perjuicio directo, real al medio ambiente. Posición jurídica que se deriva del ejercicio detenido al sopesar el cuestionamiento de apelación, y la temática de falta de identidad fáctica de los precedentes de los tribunales de apelación, en suma a la sesgada interpretación jurisprudencial de carácter constitucional utilizada por el representante del Estado; y del desarrollo analítico de prueba técnica de cargo insuficiente en relación a “que ese cuerpo de agua fuese una naciente permanente.
Y si esto es así, tampoco se puede afirmar la existencia de un daño al medio ambiente, por lo que en estas circunstancias resultaría arbitrario ordenar el derribo de la obra” (confrontar folios 1109 vuelto a 1110 frente). En plena congruencia a lo narrado, ratifica la ausencia de parámetros objetivos necesarios a fin de ajustar los hechos específicos (confrontar folio 1109 vuelto, párrafo segundo), al supuesto previsto por el legislador en el punto 2 de la Ley de Biodiversidad, que indica: “Artículo 11. Criterios para aplicar esta ley. Son criterios para aplicar esta ley: 1.-Criterio preventivo: Se reconoce que es de vital importancia anticipar, prevenir y atacar las causas de la pérdida de la biodiversidad o sus amenazas. 2.-Criterio precautorio o indubio pro natura: Cuando exista peligro o amenaza de daños graves o inminentes a los elementos de la biodiversidad y al conocimiento asociado con estos, la ausencia de certeza científica no deberá utilizarse como razón para postergar la adopción de medidas eficaces de protección. 3.-Criterio de interés público ambiental: El uso de los elementos de la biodiversidad deberá garantizar las opciones de desarrollo de las futuras generaciones, la seguridad alimentaria, la conservación de los ecosistemas, la protección de la salud humana y el mejoramiento de la calidad de vida de los ciudadanos. 4.-Criterio de integración: La conservación y el uso sostenible de la biodiversidad deberán incorporarse a los planes, los programas, las actividades y estrategias sectoriales e intersectoriales, para los efectos de que se integren al proceso de desarrollo” (lo resaltado no pertenece al texto original).
Así las cosas, la argumentación diseñada rechaza según la prueba incorporada, la existencia de un daño ambiental porque en efecto, no se tuvo por demostrado la presencia de una naciente permanente en el inmueble propiedad en su momento del endilgado, de manera que para el tribunal de apelación de sentencia penal, resultó inviable corroborar los alcances inicialmente denunciados, de ahí, que el vicio alegado como se verá más adelante, carece de esencialidad según el artículo 439 de la ley penal adjetiva. A grosso modo, el ad quem en su deber de realizar una evaluación integral descriptiva e intelectiva del fallo (confrontar folios 1092 a 1098, y 1099 a 1105), conforme a los preceptos 459, 462 y 465 de la ordenanza procesal penal, precisó: “Los apelantes no logran refutar los argumentos del Tribunal y, en su lugar, sus alegatos se circunscriben a que, si en el lugar investigado había un afloramiento, en invierno y verano, necesariamente su fuente de alimentación eran aguas subterráneas.
Pero en un caso tan particular como el que aquí nos ocupa, sin un estudio hidrogeológico que así lo confirme, ello se puede afirmar como mero indicio de un (sic) naciente permanente, pero no con la certeza que requiere la aplicación de la ley penal. Contrario a lo que se afirma en los motivos, el órgano de instancia hace ver en sentencia que, según la tesis sostenida por el geólogo Rafael Matamoros, justamente con base en el propio estudio de FUNDEVI y la UCR, las aguas superficiales a que hace referencia SENARE (sic) vendrían del manto acuífero de Colima, pero según el mapa isofreático del SENARA para la zona de Alajuela, […] el acuífero Colima está sumamente alejado de la zona de San Isidro de Grecia, y ahí lo que hay, según dicho mapa son curva isofreáticas, sin que nadie haya podido contestar al Tribunal si el afloramiento en estudio tenía o no relación con estas curvas. Entonces no es cierto, como lo afirma la Procuraduría, que el A quo se limitó a citar lo depuesto por el perito Rafael Matamoros, sin analizar su contenido, pues aquí se aprecia un análisis intelectivo de la prueba de cargo.
Por las mismas razones arriba expuestas, lleva razón el Tribunal de Juicio al señalar que el oficio de la Dirección de Aguas DA-UHTPCPSR-0240-2019 (cf. Folios 924 a 929), no agrega ninguna información de calidad adicional a lo referido por el SENARA, en el sentido de que la naciente se cataloga como permanente, básicamente porque mantiene su caudal en verano (cf. Folio 926), pero dicho informe tampoco refiere que existiese estudio hidrogeológico que confirme que la fuente fuese aguas subterráneas. Por ende, no se puede tachar como incorrecta la afirmación del Tribunal de Juicio respecto a que se trata de un criterio predominantemente empírico” (La mayúscula pertenece al texto original, confrontar folio 1098 frente y vuelto). En ese sentido, como de forma atinada lo señalan la licenciada Salazar Araya, y el licenciado Pessoa Solera, al contestar las audiencias conferidas (confrontar folios 1139 a 1141 y 1152 a 1156), y realmente esta Cámara lo verifica, no resulta posible acreditar el alegato invocado de inobservancia de la Ley de Biodiversidad, porque el tribunal de alzada, si conoció y trató la queja de falta de fundamento de la denegatoria de derribo de la obra, y en decisión unánime, confirmó lo resuelto del a quo.
A su vez, de la lectura integral del iter lógico -entendido como una unidad lógico jurídica-, descartó conforme al ordenamiento jurídico, cualquier afectación al principio in dubio pro natura o precautorio, al constatarse que de acuerdo con el desarrollo analítico propio de los hechos y las pruebas evacuadas, no fue posible tener por cierto un peligro o amenaza de daños graves o inminentes “a los elementos de la biodiversidad y al conocimiento asociado con estos”; o sea, de las deducciones razonadas, ratifica la decisión del a quo de desvirtuar la invasión a un área de protección, y en definitiva, de la producción de algún daño al medio ambiente. En ese orden de ideas, el presente análisis de fondo, como se deriva del fundamento intelectivo dado por el a quo y el ad quem, en relación a los pormenores de la investigación fiscal, giró en torno a una premisa iuris tantum atinente a la existencia de una naciente, surgida de un informe refrendado por el Sistema Nacional de Áreas de Conservación de la Cordillera Volcánica Central, Subregión Occidental -SINAC- (confrontar folios 1 a 15 de los autos, tomo I), y del servicio Nacional de Aguas Subterráneas, Riego y Avenamiento -SENARA- (confrontar folios 74 a 97, 120 a 126, y 132 a 140), frente al criterio antagónico de la pericia llevada a cabo en la otrora propiedad del endilgado [Nombre 019], por parte de GEOTEC, a cargo del geólogo Leonel Rojas Castro, que en su documentación dirigida al arquitecto Luis Enrique Corrales Ramírez, coordinador del Departamento de Planificación Urbana y Control Constructivo de la Municipalidad de Grecia, dictaminó: “Con base en los elementos considerados y analizados en el presente reporte, se concluye que al presentarse en la zona un grupo de manantiales dispuestos de forma más o menos lineal conforme desciende de la quebrada Flores, estos constituyen base de esta quebrada y forma parte intrínseca de ella, por lo cual el cuerpo de agua a proteger en cuanto al recurso forestal (al aplicar solo la Ley Forestal, no la Ley de Aguas), es la quebrada Flores, considerando una franja de protección de 50 m” (confrontar folios 100 a 106).
Además, de los juicios de valor preceptuados por el ad quem, se indica: “Como puede verse, la tesis sostenida por el perito de la defensa es que las conclusiones del estudio de GEOTEC son correctas, no así las del SENARA, en primer lugar, porque de acuerdo con el estudio de FUNDEVI y la UCR, no hay mantos acuíferos en la zona afectada, toda vez que el manto de Colima se ubica en el sector totalmente distinto y alejado, de ahí entonces dicho estudio, lejos de contradecir sus conclusiones, más bien las avalaba. En segundo lugar, refiere que el documento de FUNDEVI y la UCR ubica el nivel freático en el área de interés en 70 metros, lo que resulta incompatible con las afirmaciones de SENARA, de manera que la única forma de establecer, con certeza, que el cuerpo de agua que se encuentra acerca de la vivienda que construyó el imputado era una naciente permanente, era a través de un estadio hidrogeológico” (confrontar folio 1094 vuelto).
Dicha concatenación de hechos y de pruebas permitió al tribunal de apelación de sentencia, rechazar la duda sobre la existencia de la naciente, al escudriñar el tercer criterio sobre la temática originada, que en apoyo con el principio de libertad probatoria promovió el a quo y mediante esa consideración sostuvo: “… el Tribunal de Juicio decidió solicitar un tercer criterio, esta vez a la Dirección de Aguas, que de acuerdo con el oficio del SINAC OG-1212-2017 del 25 de agosto de 2017 (cf. Folios 646 y 647), es el ente competente para caracterizar un cuerpo de agua en caso de duda, en procura del esclarecimiento definitivo de la naturaleza del sitio donde aflora el agua, con el resultado de que este último departamento tampoco pudo dar una respuesta definitiva, razón por la cual se impuso la absolutoria del imputado …” (confrontar folio 1094 vuelto). Más aún, el ad quem, vista la inconformidad de los apelantes, se detiene en el trabajo intelectivo generado por el tribunal penal, al señalar lo siguiente: “… los juzgadores -en síntesis- explicaron que en este caso no solo existía duda en cuanto a las nomenclaturas utilizadas por las diferentes instituciones involucradas en el resguardo del recurso hídrico (SINAC, SENARA y la Dirección de Aguas), así como dudas en cuanto a la ubicación georeferencial de la misma, sino además dudas en cuanto a si el afluente con las características indicadas por SINAC y SENARA se trataba de una “naciente”.
Señalan que los acusadores hablan de la existencia de dos nacientes en el sitio, la 27 y 258, basándose en el informe del SINAC practicado por Eliden Alcázar Barahona y Carlos Gutiérrez Santana, el cual reporta que la construcción realizada por el imputado se ubica a 71.5 metros del afluente que ellos identifican como naciente, cuya ubicación geográfica, según coordenadas de éste, es 233267 horizontales y verticales 506347, en tanto que en el informe DIGH-1092-11 del SENARE se reporta a la fiscalía que, para el 17 de noviembre del 2011, revisada la base de datos de dicha institución en una radio de 2000 metros a la redonda donde se ubica la propiedad del encartado, se localiza una naciente identificada como la NAC 1189, situada a 82 metros del sitio. No obstante -prosiguen los juzgadores- una vez realizado el estudio de campo del SENARA, mediante el informe DIGH-UGH-OF-066-2012, los profesionales que efectuaron la inspección refieren la localización de una naciente ubicada ahora en las coordenadas 233293 latitud norte y 506368 longitud este, concluyendo que se trata de la NAC 1189, registrada de forma previa según la base de datos de dicha entidad, así como que la distancia entre la infraestructura y el afloramiento es de 48 metros, de manera que ambas instituciones ni siquiera tenían claridad en cuanto a la nomenclatura con que identifican el cuerpo de agua, brindaron distintas coordenadas y distancias entre la ubicación del afluente con respecto a la vivienda” (La mayúscula no pertenece al texto original, folio 1095 frente, tomo III; en similar sentido, puede apreciarse el folio 1100 frente y vuelto).
A lo anteriormente expuesto, y de la restante prueba documental incorporada (confrontar folio 988 frente y vuelto, tomo III), se suma la ponderación imperante a la luz de los principios de oralidad y de inmediación de la prueba testimonial evacuada, a saber: [Nombre 010], Carlos Gutiérrez Santana, Eliden Alcázar Barahona, [Nombre 013], Rafael Matamoros Arguedas, [Nombre 014], [Nombre 015], [Nombre 016] y [Nombre 017], [Nombre 018], y Luis E. Corrales Ramírez (confrontar folios 953 a 988), en la cual, el tribunal penal determinó la necesidad conforme al principio de libertad probatoria, de reabrir el debate, para conocer la posición de la Dirección de Aguas dependencia administrativa del Ministerio de Ambiente y de Energía (MINAET) -única entidad legitimada para definir e identificar lo que debe entenderse como naciente. En lo correspondiente a la discusión de SENARA y GOTEC relativa a la existencia o no de una naciente en el conflicto litigioso denunciado por SINAC, dicha autoridad judicial, rechazó algún vínculo del afloramiento con un manto acuífero, al sustentar que de la valoración de la documentación del Fundevi, utilizada por SENARA, y del informe de GEOTEC, se reflejaron distintos niveles de profundidad de las aguas en el lugar, que dista mucho de la altura según al nivel del mar en que se ubicó el punto en cuestión (confrontar folio 999 frente, párrafo primero.
Asimismo, el tribunal de alzada, avaló lo actuado por el a quo ante el estado dubitativo referente a la caracterización del cuerpo de agua consustancial de la polémica, al señalar: “Tal como se explicó en el considerando de la presente resolución, el órgano acusador contaba con criterios contrapuestos entre los peritajes de SENARE y Gotec sobre la caracterización de los cuerpos de agua ubicados en la finca del imputado, por lo que a criterio de esta Cámara resultaba razonable consultar a la Dirección de Aguas, que es precisamente la entidad competente para determinar si un afloramiento puede ser calificado como una naciente permanente …” (confrontar folio 1108 vuelto). Derivado del fundamento intelectivo implementado por el ad quem, al hilvanar la tesis opuesta de los recurrentes, se destaca: “… al señor [Nombre 019] le fue entregado un dictamen pericial elaborado por el geológo Leonel Rojas Castro, en el cual se afirma, categóricamente que los afloramientos de agua señalados por el SINAC, no eran nacientes permanentes, sino una quebrada que era justamente la misma información que manejaba el imputado, lo que le permitió concluir la construcción …” (confrontar folio 1104 Vuelto, tomo II): En consideración a este tópico de notoria relevancia, la Sala Constitucional en el fallo N° 2019-009221, de las 11:41 horas del 22 de mayo de 2019, con la integración de Castillo Víquez, Cruz Castro, Hernández López, Salazar Alvarado, Araya García, Esquivel R, y Picado B, indicó: “… la verificación de si una naciente es de carácter permanente o no permanente, es una determinación que compete a las instancias técnicas de la administración, que de conformidad con sus respectivos ámbitos de competencia, sería un asunto propio de la Dirección de Aguas del Ministerio del Ambiente y Energía, en estricta coordinación con otras instancias relacionadas, como el Servicio de Aguas Subterráneas, Riego y Avenamiento, y el propio Instituto Costarricense de Acueductos y Alcantarillados, definición que igualmente debe ser observada incluso por las municipalidades al momento de la elaboración de los permisos de uso de suelo o sus denegatorias.
De tal forma, corresponde a la administración, mediante la elaboración de los estudios técnicos necesarios, determinar el carácter de permanente o no permanente de una naciente de recurso hídrico …”. Obsérvese, siempre dentro del contexto argumentativo aludido, que el tribunal de apelación de sentencia, extraña el por qué ni el Ministerio Público, y la Procuraduría General de la República, desde los albores de la fase preparatoria, gestionaron el criterio técnico de la Dirección de Aguas. A modo explícito, se invoca prueba esencial no recabada: “… si el Ministerio Público y la Procuraduría General de la República pretendían la condenatoria del imputado por el delito de Invasión a Área Protegida (art. 58 inciso primero de la Ley Forestal), debían rebatir la tesis defensiva. Y eso fue justamente lo que no consiguieron en el súb júdice, puesto que, como se verá más adelante, en sentencia se explica que tanto los testimonios de Rafael Matamoros como de Leonel Rojas fueron amplios y claros, impresionando sinceridad y ausencia de intencionalidad de favorecer o perjudicar al imputado, razón por la cual no había razones para restarles credibilidad” (confrontar folio 1094 vuelto).
A fin de estipular con certeza la caracterización de un afloramiento, el tribunal de alzada, sintetiza: “De ahí que no es responsabilidad del Tribunal que, cuando sus integrantes determinaron la necesidad de contar con este estudio, para la Dirección de Aguas no fue posible la realización de éste, debido a la época del año en que se realizó el debate, debiendo reiterarse aquí que este problema no se hubiese presentado si, con anterioridad, la parte acusadora se hubiera ocupado de hacer llegar esta prueba a los autos …” (confrontar folio 1109 vuelto, tomo III). Ratifica la Sala que la argumentación prevaleciente por la administración de justicia a cargo de este proceso, resulta apegada al principio de legalidad, porque en este asunto el quid o la esencia incontrovertible, de verificar la existencia de una naciente, impide a la luz del principio de seguridad jurídica, visualizar una condena por un delito de invasión a zona protegida, y menos aún, promover el derribo de una construcción de vivienda, cuyos diversos permisos, entre ellos de construcción, fueron avalados por la Municipalidad de Grecia, y precisamente sirvieron de sustento a la decisión del Banco Nacional de Costa Rica, para conceder un préstamo hipotecario a la persona querellante y actora civil, ateniéndose a la garantía del referido inmueble.
Los motivos deben declararse sin lugar, porque el criterio precautorio o in dubio pro natura, en un Estado Social y Democrático de Derecho, solo surge ante la plena acreditación de una invasión a un área de protección, evento que ha sido totalmente descartado en la etapa plenaria y de impugnación, y que constituyó en la fase de investigación e intermedia, la génesis de un menoscabo al principio de tutela judicial efectiva, pues, la tesis inicial (presunción iuris tantun) de naciente (confrontar folio 998 vuelto, tomo I), gravitó en este proceso penal, como una presunción iure et iure, en contravención del criterio técnico-científico, al traste de una solución célere, y proporcional acorde a los preceptos 39 y 41 de la Carta Magna, verbigracia: “… en un caso tan particular como el que aquí nos ocupa, sin un estudio hidrogeológico que así lo confirme, ello se puede afirmar como mero indicio de un (sic) naciente permanente, pero no con la certeza que requiere la aplicación de la ley penal.
Contrario a lo que se afirma en los motivos, el órgano de instancia hace ver en sentencia que, según la tesis sostenida por el geólogo Rafael Matamoros, justamente con base en el propio estudio de FUNDEVI y la UCR, las aguas superficiales a que hace referencia SENARE vendrían del manto acuífero de Colima, pero según el mapa isofrático del SENARA para la zona de Alajuela, que también consta en su página de Internet, el acuífero Colima está sumamente alejado de la zona de San Isidro de Grecia, y ahí lo que hay, según dicho mapa, son curvas isofráticas (sic), sin que nadie haya podido contestar al Tribunal si el afloramiento en estudio tenía o no relación con estas curvas. Entonces no es cierto, como lo afirma la Procuraduría, que el A quo se limitó a citar lo depuesto por el perito Rafael Matamoros, sin analizar su contenido, pues aquí se aprecia un análisis intelectivo de la prueba de cargo” (la mayúscula no pertenece al texto original, confrontar folio 1098 frente, tomo III.
En relación al citado principio, y a la protección de las aguas subterráneas, puede consultarse el voto número 2010-06922, de las 14:35 horas, del 16 de abril de 2010 [Calzada Miranda, Mora Mora, Armijo Sancho, Jinesta Lobo, Cruz Castro, Castillo Víquez, y Rodríguez A], Sala Constitucional de la Corte Suprema de Justicia). Por lo consecuente, del fundamento intelectivo constatable del tribunal de alzada, se desprende su notoria razonabilidad, pues, tal decisión argumentativa, surge al no encontrar parámetros objetivos necesarios a fin de ajustar los hechos específicos (confrontar folio 1109 vuelto, párrafo segundo), al supuesto previsto por el legislador en el punto 2 del artículo 11 de la Ley de Biodiversidad; es decir, no se certifica con la prueba incorporada, la existencia de una naciente en el inmueble objeto de la controversia, de tal manera que para el tribunal de apelación de sentencia penal, fue inviable acreditar los alcances de una afectación al medio ambiente.
El vicio alegado carece de esencialidad, los impugnantes excluyen el indispensable requerimiento de un perjuicio verificable y real producto de lo resuelto por la autoridad competente, al auspiciar la nulidad por la nulidad misma (voto número 2023-00112, de las 12:09 horas, del 3 de febrero de 2023 [Solano Castro, Ramírez Quirós, Alfaro Vargas, Zúñiga Morales, y Segura Bonilla], Sala Tercera de la Corte Suprema de Justicia). No existe inobservancia al ordinal 11 de la Ley de Biodiversidad, pues la administración de justicia a cargo del presente proceso, de forma fundada desvirtuó la existencia de alguna naciente en el inmueble propio de la disputa judicial, y de ahí, la clara imposibilidad de precisar alguna amenaza o peligro al recurso hídrico y en general al medio ambiente; adicional a lo descrito, referente a la dirección funcional de la fiscalía, el ad quem, detalló: “… como bien lo explica el Tribunal de Juicio, correspondía a la parte acusadora demostrar, con certeza, que las aguas que alimentaban el afloramiento en el terreno del imputado, provenía de caudales subterráneos alimentados por mantos acuíferos, cosa que nunca hicieron puesto que, inexplicablemente, desde la fase de investigación nunca solicitaron los estudios respectivos a la Dirección de Aguas del MINAET, hasta que dicha prueba fue requerida -de oficio- por el Tribunal de Juicio” (confrontar folio 1099 frente).En consecuencia, los recursos de casación deben declararse sin lugar, por cuanto la resolución del tribunal de alzada, resulta apegada al marco de legalidad vigente, lo anterior al tenor de los preceptos 39, 41 y 50 de la Carta Magna, en concordancia con los artículos 1 a 3, 7.2, 9, y 11.2 de la Ley de Biodiversidad; principio N° 15 de la Declaración de Río-Conferencia de Naciones Unidas sobre el Medio Ambiente y el Desarrollo, artículo 439 en relación con los preceptos 469 y 471 de la ordenanza procesal penal.
Por tanto:
Se declara sin lugar las impugnaciones interpuestas por el representante de la Procuraduría General de la República y del Ministerio Público. Notifíquese.
