In ordinary proceedings brought by MAGDA MONTERO BARQUERO and LUIS ÁNGEL QUESADA CÉSPEDES against KARLA PAOLA SOLANO JIMÉNEZ, in which counsel for the plaintiffs filed an appeal on points of law (recurso de casación) against judgment number 383-2021, issued at 8 hours on 1 de junio de 2021 by the Tribunal Primero Colegiado Primera Instancia Civil del Primer Circuito Judicial de San José, composed of Judges Jackeline Brenes Segura, Angélica Delgado Madrigal, and Ian Alberto Berrocal Azofeifa. I.This matter arises from the dispute concerning the construction of a dividing wall in julio de 2015 by Karla Paola Solano Jiménez, owner of property registered under number 1-580962. The plaintiffs, Magda Montero Barquero and Luis Ángel Quesada Céspedes, allege that the wall encroached by one meter and eighty-nine centimeters onto property number 1-588778, in which they hold interests 003 and 004. They further maintain that the wall obstructed their “right to an unobstructed view” (“derecho de vista hacia el infinito”), a right they had enjoyed since acquiring their property and that was exercised through one of their windows. They assert that an easement (servidumbre) for light, air, ventilation, and view existed, that it was infringed, and that it had been acquired through acquisitive prescription (prescripción positiva) and/or by agreement with the former owner, having been enjoyed peacefully, publicly, and in good faith for more than ten years.
They also state that the Municipalidad had ordered the defendant to seal certain illegally constructed windows, both because they were not part of the original design and lacked a construction permit and because they violated the required setback from the adjoining property. They allege that, in order to justify retaining those windows and prevent their closure, the defendant proceeded to build the wall. Their principal claims seek restoration of the area encroached upon along their southern boundaries; demolition of the wall along the southern boundary and, should the defendant fail to comply, authorization for the plaintiffs to demolish it; cessation of all “interference with the easement established by agreement with the former owner of the defendant’s property”; removal of trees or shrubs near their residence that obstruct the unobstructed view; and removal of the windows that, in their view, were constructed illegally because they were not included in the approved permits or plans, are less than one meter away, and are not authorized by the permits or plans for the residence.
They also seek compensation for non-pecuniary damages (daño moral) in the amount of ₡3.000.000, property damage (daño material) of ₡2.130.000, and consequential damages (perjuicios) totaling ₡5.630.000. Finally, they request all costs, interest, and indexation. The defendant, for her part, denies the claims and raises the defense of lack of legal entitlement (falta de derecho). She states that she has owned the adjoining property since marzo de 2014 and asserts that the 3,90-meter-high wall was constructed with the corresponding municipal permit and in accordance with the applicable regulations, denying that it encroached upon any boundaries. She rejects the allegation that she planted trees to obstruct the view, stating that they already existed on her property before she acquired it. She contends that no easement for light, air, and view exists, nor is there any acquisitive prescription supporting such a claim.
She states that the ten years required for acquisitive prescription refers to possession of property, and that a view “to infinity” is not property. Lastly, she emphasizes that there was no illegality on her part in constructing the infrastructure of her home, that everything was done with the corresponding permits from the administrative authorities, and that the windows which the plaintiffs allege adversely affect them are bathroom windows that remained covered until the wall was built. She states that the purpose of that wall is to demarcate the properties and safeguard the privacy of her home and property, a right granted by law.
II.The Tribunal Primero Colegiado de Primera Instancia Civil del Primer Circuito Judicial de San José, composed of Judges Jackeline Brenes Segura, Ian Alberto Berrocal Azofeifa, and Angélica Delgado Madrigal, ruled as follows in decision number 218-2021, issued at 8 hours 58 minutes (8:58 am) on 1 de junio de 2021: “…The defense of lack of legal entitlement is upheld. The complaint filed by Magda Montero Barquero and Luis Ángel Quesada Céspedes against Karla Paola Solano Jiménez is dismissed. Following assessment, the plaintiffs are held jointly and severally liable for payment to the defendant of the costs generated by this action.” Dissatisfied with that ruling, the plaintiffs’ special judicial attorney-in-fact appealed and requested an oral hearing. By order of this Chamber issued at 8 hours 40 minutes on 5 de mayo de 2022, only the fourth and eighth grounds alleging errors of substantive law were admitted.
III.Regarding the request for an oral hearing. The arguments and conclusions of the dissatisfied parties concerning the alleged errors are sufficiently clear to be considered and decided without the need for an oral hearing to facilitate their understanding. It should be clarified that the purpose of an oral hearing is not to expand the appeal, but to allow the issues already raised to be debated orally, with the parties appearing before the decision-making body, provided that the latter deems it appropriate to obtain greater clarity, precision, or a better understanding of matters whose particular characteristics warrant it. This occurs, for example, in matters involving exceptional complexity—which is not considered to be the case here—or when, on an exceptional basis, an evidentiary hearing is scheduled. Accordingly, because section 69.7.2 of the Código Procesal Civil provides that an oral hearing may be scheduled whenever the court of cassation deems it appropriate, the request is denied.
SUBSTANTIVE GROUNDS OF APPEAL
IV.In the first substantive grievance (the fourth ground of appeal), the appellant first challenges the contested judgment’s refusal to recognize the easement of view (servidumbre de vista). He alleges that Álvaro Montero’s testimony established that the plaintiffs’ residence had been built more than fifteen years earlier, a circumstance that, in his view, proves the existence of that easement and was not considered by the Tribunal. He maintains that this violates Article 378 of the Código Civil. His second claim of error (the eighth in the order of the appeal) raises a similar objection and will therefore be considered jointly, as it likewise concerns the rejection of easements of view, ventilation, air, and light in favor of the plaintiffs. He contends that the plaintiffs have enjoyed them peacefully, publicly, and continuously since purchasing the house in 2012 and that, in his view, the requirements of section 378 of the Código Civil are therefore satisfied.
He asserts that, by rejecting an easement of view established through acquisitive prescription, the Tribunal violated Articles 853, 854, and 860 of the same code. The appellant also invokes Articles 406, 806, 850, 852, 855, and 856 of the Código Civil, which, in his view, permit the alleged easements to be established by agreement, by last will, or through the use and tolerance of the owner of the servient estate (predio sirviente). He challenges the Tribunal’s reasoning that the requirement of ten years’ possession had not been satisfied because the plaintiffs acquired the property on 6 de julio de 2012. On that point, he alleged: “The easement of view was established through the passage of time because, as the witness Álvaro Barquero Monestel stated in his testimony, ‘When she purchased that property, it had been built for 15 years’; the defendant herself stated in her party examination that ‘I do not know whether they lived on that property’ and also indicated that she ‘… acquired the property in 2014.’” In the same vein, he contends that the report of the Colegio Federado de Ingenieros y Arquitectos states on page 17: “…because it is an older building constructed more than 15 years ago….” He adds: “The requirement of ten years’ possession is satisfied because the plaintiffs acquired the property on 06 de julio del 2012; 5 years had elapsed from the subdivision (segregación) in 2007 until 2012; by 2016, when the complaint was filed, they had owned it for 9 years; and the 6 years before the 2007 subdivision, during which the house had been built with municipal permits, must be added.” Finally, he alleges: “As to Article 407, it is asserted that the judge violated it because, in his view, it is enough for the easement to be exercised in evident good faith to disregard the fact that the windows as constructed failed to comply with the restrictions established by that provision.” He argues that the plaintiffs were not the ones who constructed the windows, but that they had already existed since 2012 on a property subdivided in 2007 and later sold to the defendant, thereby relieving the plaintiffs of responsibility for improper use.
V.With regard to the allegation raised, the Court ruled: “the next issue to be analyzed concerns the alleged interference with the right to a view or, as the plaintiffs call it, impairment of the easement (servidumbre) of light, airflow, ventilation, and view existing in their favor as a consequence of private agreements reached with the former owner of the adjoining property, on the basis of which they claim a right acquired through acquisitive prescription (prescripción positiva). They state that this interference was caused by the construction of the dividing wall undertaken by the defendant. In this regard, before determining whether the plaintiffs hold a right capable of protection, the concept of an easement of view or right to a view, its legal nature, classification, and methods of creation must be clarified. On this matter, the case law has stated: ‘There are several traditional classifications of easements that are important for their creation.— Articles 378 and 379 of our Civil Code refer to apparent and non-apparent easements, without any provision defining what those terms mean, although they relate to creation by adverse possession (usucapión), which helps to conceptualize them.— It may therefore be said that an easement is “apparent” when there is an external sign that indisputably demonstrates its existence.
Conversely, when the easement is not visible through any external sign, it is a “non-apparent” easement.— With respect to continuous and discontinuous easements, a “continuous” easement should be understood as one whose exercise requires no human act or activity, while a “discontinuous” easement is one whose exercise or enjoyment requires human activity.— There are other classifications that are not relevant to the present analysis.— Based on the foregoing, it may be concluded that an “easement of view” is discontinuous and non-apparent.— Under those circumstances, the applicable provision is Article 379 of the Civil Code, which establishes: “Discontinuous easements of every kind and continuous non-apparent easements may be created only by agreement or by last will. Possession, even from time immemorial, is insufficient to establish them.” (First Civil Court, Decision No. 142-E, issued at 8:50 a.m. on 26 de enero de 2001.) The plaintiffs claim the elimination of their right to a view and, at the same time, allege impairment of ventilation and airflow; however, all the arguments set forth in the complaint concern interference with the view toward “infinity” that existed from the windows of their house, which was the reason they purchased the property.
As to an alleged impairment of ventilation or lack of air, however, no argument whatsoever is made, much less any evidence submitted of such impairment. Therefore, under the burden of proof (carga probatoria), it is incumbent upon the plaintiffs to demonstrate the existence of that easement or the right they claim, duly registered; this circumstance is absent from these proceedings, and consequently the alleged right claimed cannot be protected. This concerns the violation of a right that may be created only by agreement or last will, and although the plaintiffs state that an agreement existed with the former owner of the property now belonging to the defendant, there is no evidence of it. The registry certifications for the properties in question, submitted in these proceedings, do not show the existence of any duly registered easement. Easements of view or light are, in any event, encumbrances (gravámenes) imposed on an estate in order to provide or increase the view or light for the benefit of another, thereby granting the right to enjoy them over another person’s land; it is the existence of such an easement that authorizes the beneficiary to prevent a neighbor’s works from diminishing or obstructing the established right.
Views are always linked to light; the combination of both gives rise to the imposition of an encumbrance on real property and is generally regarded as a limitation on ownership (limitación al dominio). Article 406 of the Civil Code provides: “The owner of a non-party dividing wall may open windows and skylights, provided that they are fitted with iron bars and wire mesh and are at least two and a half meters above the floor of the dwelling to which light is to be provided.” Likewise, Articles 407 and 408 ibid. provide that views into neighboring rooms, yards, and enclosures through balconies or windows are permitted at a minimum distance of three meters, measured between the vertical plane of the outermost line of the window or balcony and the vertical plane of the boundary line between the two properties. These provisions appear under the title governing burdens and limitations on property imposed by law, the purpose of which is to preserve social peace by implementing appropriate rules so that the interest of a particular property owner does not prevail over the community.
But if the existence of such a limitation on the right of ownership has not been established, it is not possible to prevent walls or buildings that eliminate or restrict such rights from being constructed on the neighboring or servient estate (fundo sirviente), by virtue of a much broader right, namely, the right to private property. Nevertheless, through the exercise of that same right of ownership among neighbors, such real burdens, limitations, or restrictions may be created because, as indicated, they may be established by agreement between the parties or by last will. Under these circumstances, if the plaintiffs failed to demonstrate the nonexistence of such an easement or right in favor of their estate and burdening the estate occupied by the defendant, as expressly provided by Article 308 of the Civil Code: “In the case of continuous non-apparent easements or discontinuous easements, a claim, in order to be cognizable, must be based on an instrument originating from the owner of the servient estate or from those from whom that owner acquired it,” the alleged violated right they claim through the filing of the complaint cannot be protected.
It bears emphasizing that mere possession cannot support the recognition and creation of an easement of view as a limitation on the property right over a neighboring estate, because it is not susceptible to such creation; moreover, the requirement of ten years’ possession is not satisfied, because the property was acquired by the plaintiffs on 06 de julio del 2012, as shown by the literal certifications accompanying the complaint, and in the first allegation of their pleading they expressly state that they had acquired it five years before these proceedings were filed (marzo del 2016). Accordingly, it is likewise impossible to analyze whether a right that, according to some schools of legal scholarship, may be acquired through acquisitive prescription is legally available. With respect to protection of possession of the right to a view under the circumstances described, settled case law has held: “...for it to qualify as such, possession would have to be exercised over an object capable of possession, that is, ‘over things’ or ‘over rights,’ whereas in the matter before the court it is sought over a limitation imposed by the legislature upon the right of ownership.
Articles 407 and 408 of the Civil Code establish the only circumstances in which windows, skylights, and balconies may be constructed in dividing walls and when they overlook neighboring property. These are limitations on ownership, not rights granting powers over neighboring properties. In principle, the right of ownership regulated by the Civil Code grants broad powers to its holder, which may be limited only by legislative enactment—a statutory reservation (reserva de ley), Article 45 of the Political Constitution. In the case of the construction of windows, skylights, and balconies, if the referenced limitations did not exist, the owner could construct them without more, thereby exercising that right. However, because the legislature imposed them, owners are compelled to exercise limited ownership, since the content of their right has been constrained or diminished by virtue of those limitations.
Therefore, no one could claim a right over neighboring property based on limitations, still less in circumstances that violate them, because that would constitute possession over an impossibility, not over an object that the legislature has recognized as capable of possession: things and rights. An easement over neighboring property could never be created on the basis of a limitation on the right of ownership over one’s own property, still less where that limitation is violated.” (Decision No. 638-G. First Civil Court, Second Section, issued at 1:00 p.m. on 31 de marzo de 2004.) (…) Although the cited case law is not binding, it is cited because it coincides with the position now shared and expressed by this Court. If there is a duly established limitation, the plaintiffs may not request the restoration of a right that does not form part of their property, in view of the constitutionally protected property right that the defendant also enjoys over her property.
Seeking to impose a right in their favor must not entail placing a burden or limitation upon the neighboring property merely through the unilateral volition of only one of the parties. Accordingly, the claim seeking protection of the alleged right to a view, light, and airflow must be denied.” (emphasis not in the original)
VI.The Tribunal is alleged to have improperly assessed the statement of Mr. Álvaro Montero, husband of the co-plaintiff, and the report of the Colegio Federado de Ingenieros y de Arquitectos, which, in the appellant’s view, established that the windows of the plaintiffs’ house had been in place for fifteen years. However, this Chamber considers that no useful cassation review (casación útil) would result from determining whether that evidence demonstrates that the plaintiffs’ windows had been in place for that length of time for purposes of establishing positive prescription (prescripción positiva). As stated in the preceding whereas clause (considerando), the Tribunal rejected the establishment of an easement of view (servidumbre de vista) as a limitation on the ownership right (derecho de propiedad) of the neighboring property, finding that it cannot be established or supported through possession, but only by agreement or by a testamentary act, pursuant to Articles 379 and 308 of the Código Civil.
In that regard, the challenged judgment classified the easement of view as non-apparent (no aparente), because it has no external sign evidencing its existence, and as discontinuous (discontinua), because it requires human activity. In addition, the challenged judgment stated that “in addition, the requirement of ten years’ possession is not met because the property was acquired by the plaintiffs on 6 de julio del 2012.” Nevertheless, the principal reason why the Tribunal rejected the establishment of the easement of view was that limitations imposed by law cannot be used as the basis for claiming a right over another person’s property, since doing so would entail protecting possession founded on a legal prohibition, which constitutes possession that cannot be legally recognized. In other words, an easement of view cannot be established through possession when that possession is exercised in violation of express prohibitions.
Regarding the rejection of the ventilation and aeration easement (servidumbre de ventilación y aireación), the Tribunal found that no specific arguments had been submitted to demonstrate an adverse effect in terms of ventilation and aeration, because the complaint focused on obstruction of the view—findings that were not challenged. Thus, without a clear argument challenging the conclusion that an easement of view cannot be established through possession in violation of express prohibitions, it cannot be concluded that the challenged judgment, specifically the Tribunal’s statements concerning the denied easement, has been properly contested. For the foregoing reasons, the claim of error must be dismissed. Furthermore, it is appropriate to note that the case law of this Chamber—including, among others, judgment number 000507-F-04, at 11 hours 55 minutes on 17 de junio del año 2004, 251-F-2006 at 15 hours 40 minutes on 12 de mayo de 2006, and 000275-F-00 at 16 hours 5 minutes on 14 de abril del año dos mil—has consistently held that easements of view and ventilation cannot be established through positive prescription in the face of express prohibitions, such as those invoked by the plaintiff in seeking the demolition of a wall built within the defendant’s property.
That would violate the legal system because it would contravene public-order rules (normas de orden público), such as the express prohibitions contained in Articles 407 of the Código Civil (regarding limitations on opening views and protecting a neighbor’s privacy) and 45 of the Constitución Política (guaranteeing respect for the right of ownership as a fundamental right; no one may be deprived of property except for a duly established public interest). This must be read in harmony with Article 50 of the Norma Suprema, as well as rules concerning public order, collective and environmental needs, overriding public interests, and the collective benefit (a healthy environment and the right to personal and family privacy). In the judgments cited above, which are similar in nature to the present matter, this adjudicatory body held “that rights cannot be imposed through positive prescription in violation of an absolute prohibition that transcends individual interests and resides within the body of individual interests as a whole, which supports the conclusion that easements cannot be established under factual circumstances that violate the Legal System, since the law itself cannot condone the establishment of rights based on conduct expressly prohibited for reasons of an overriding public interest.
The traditional easement doctrine that has been imposed in this regard through case law (for example, see the judgment of this Chamber, N° 275-F-00 at 16:05 hrs. on 14 de abril del 2000; as well as that of the Sección Primera del Tribunal Contencioso Administrativo. N° 179-99, at 15:10 hrs. on 31 de mayo de 1999; of the Tribunal Segundo Civil. Sección Primera. N° 278 at 9:00 hrs. on 22 de noviembre de 1996 and of the Tribunal Segundo Civil. Sección Segunda. N° 699 at 9:15 hrs. on 23 de diciembre de 1991; N° 315 at 9:10 hrs. on 11 de julio de 1991 and N° 299 at 9:25 hrs. on 14 de junio de 1993).” Those decisions included an analysis reflecting the contemporary conception and evolution of the right of ownership beyond its absolute and traditional conception. This view is influenced by French post-revolutionary ideas and is manifested in the Constitution, which redefines property not as an unrestricted right but as a “functional right” (derecho función) adapted to collective and environmental needs, as established in Articles 45 and 50 of the Norma Suprema.
Those articles characterize property as inviolable and reconcile it with limitations based on public interests, guaranteeing a healthy living environment for the inhabitants of the territory. They also address legally established limitations on property, such as those concerning the construction of windows adjacent to neighboring real property, contained in Articles 406 and 407 of the civil legislation. These are ex lege limitations (limitaciones ex lege), are not subject to waiver, and apply by operation of law to protect collective interests over individual interests. The decisions addressed the fact that the law is explicit, pursuant to Article 292 of the Código Civil, that the rights of transformation and disposition are inherent in ownership and may be restricted only by law, in specific cases and in the prescribed manner. Article 383 also states that private ownership of real property is subject to certain encumbrances or obligations that the law imposes for the benefit of neighboring properties on grounds of public utility.
In both cases, the decisions emphasized that an easement cannot be established on the basis of a situation that violates prohibitory public-order rules, because such an action would contradict the spirit of the legal system, which seeks to protect collective interests and prevent rights from arising out of unlawful conduct. Furthermore, the law clearly states that ownership rights may be subject to legally imposed encumbrances or obligations for the benefit of public utility, and easements that violate those provisions cannot be established. For further discussion of the matter, see judgment number 507-F-2004 of this Chamber, which developed extensive reasoning concerning the legal nature of the right of ownership and the limits imposed upon it by land-use regulations (ordenamiento urbanístico), subjecting it to its social function. In that judgment, this cassation body reaffirmed that ownership (dominio) is neither an absolute nor an unlimited right, but instead coexists with legal restrictions directed toward collective welfare, the environment, and urban planning—a position reiterated in judgment 0001309-F-S1-13.
Along those lines, it emphasized that urban planning and civil regulations governing construction define the essential content of the right of ownership; accordingly, owners must exercise their powers within the mandatory regulatory framework that guarantees safety, privacy, and social harmony. It thus concluded that the restrictions contained in Articles 406 and 407 of the Código Civil are not merely private-law rules or provisions subject to disposition by the parties, but public-order mandates established to protect collective legal interests such as privacy, public health, safety, and harmonious relations among neighbors. Consequently, such limitations cannot be derogated from either by tacit consent or by the passage of time. The Chamber therefore rejected the possibility of acquiring an easement of view or light through acquisitive prescription (usucapión) when it has been exercised in contravention of a mandatory rule, as occurs when windows are opened in violation of those legal limitations, because such exercise cannot prevail over the land-use regulatory framework.
It also linked land-use law (derecho urbanístico) with the constitutional right to a healthy environment, stating that private property must be harmonized with environmental protection and territorial planning (ordenamiento territorial). In this regard, land-use regulation serves as a bridge between the right of ownership and the right to the environment, ensuring rational, equitable, and sustainable development of urban space. It therefore concluded that the power to construct or modify real property is subject to compliance with legal building conditions, such as municipal permits, setbacks, height restrictions, safety measures, and other regulatory requirements. In the absence of such compliance, the exercise of the right of ownership becomes unlawful. All of this supports the Tribunal’s conclusion that an easement cannot be established on the basis of facts that violate prohibitory public-order rules. Accordingly, the claim must be rejected.
VII.In the third challenge on the merits (third cargo por el fondo) (second point, within the fourth claim of error in the order presented in the appeal). The appellant disagrees with the challenged judgment insofar as it denied the request for an order requiring the defendants to remove the windows on the property of the defendant KARLA PAOLA SOLANO JIMÉNEZ that face the plaintiffs’ property. The cassation appellant (casacionista) alleges that the testimony of Mr. Álvaro Montero Esquivel, the plaintiff’s father, recorded at minute 43:50 of the supplemental hearing, was improperly assessed, asserting that he stated: “that window that that lady put there, which violated the construction and setback law that the municipality must issue, is 1,83, and Article 408 of the Código Civil says that, to measure that distance from the house, it must be measured from the nearest part, or approximately, to see whether the three meters are there, do you understand me…
I measured it when it was under construction and I saw that it was approximately one meter eighty-three from the neighbor’s house, where she installed a window in violation of construction laws and rights, and then they put that pile of old metal sheets there… well, I was not curious enough to check, but you cannot see that; however, the wall behind my daughter’s house blocks it up to the roof.” The appellant maintains that the Tribunal erred by failing to consider this testimony together with the document at folio 149, dated 8 de junio de 2015, concerning the building permit, which, in his view, stipulated that buildings were required to maintain a minimum distance of three meters from neighboring properties.
VIII.With regard to the alleged violation, the Court ruled: “V.- In addition to the claim concerning interference with the purported right to a view, the respondent is accused of having unlawfully constructed windows on her property facing the claimants’ property. In this case, when the respondent built her dwelling and installed windows facing the claimants’ parcel, she had the municipal construction permits issued under number 213-14 dated 25 de agosto del 2014 (folios 145-147). However, as established by the local municipality in report MM-UI-043-2016 of 01 de agosto del 2016, issued by the Municipal Inspector of the Inspection and Municipal Police Unit of the Municipalidad de Mora (folios 150 and 234), following a complaint filed with that entity specifically concerning the existence of the windows, it was stated that an inspection visit had confirmed the existence of windows in both buildings that provided a direct view onto the respective properties.
Both property owners were therefore required to close the windows or comply with Article VI.20 of the Reglamento de Construcciones, which provides: ‘Article IV. 20.-Windows facing an adjoining property. Windows may not be opened toward the neighboring parcel unless there is a minimum distance of three meters (3,00 m), measured between the vertical plane of the outermost line of the window and the vertical plane of the boundary line between the parcels at the point where those lines are closest, if they are not parallel. Shorter distances shall be authorized only when the windows open onto courtyards and a wall has been built along the boundary line between the parcels in accordance with the dimensions specified in Article VI. 3.7. of these Regulations.’ (Emphasis added). As a result of that warning, the respondent applied for the corresponding permits to construct the dividing wall on 6 de abril del 2015.
It was likewise established that the windows were covered with black plastic to prevent visibility onto the neighboring parcel and that, on 08 de junio del 2015, authorization for construction was granted under number 120-15. The architect in charge certified that the wall would be built as required by the Reglamento de Construcciones, and it was built accordingly, since there is no evidence to the contrary. Indeed, one year before that report (MM-UI-043-2016) was prepared by the same Inspection Unit, claimant Quesada Céspedes had been informed, through report memorandum ref. 144-14 issued in response to his complaint, as follows in points two and eight: ‘Point 2: According to the visit conducted at the property of Ms. Karla Paola Solano Jiménez, construction was carried out as shown on the plans submitted for approval to the appropriate Department. Point 8: As stated in point 2, Ms. Solano complies with the setbacks (retiros) established by law for the installation of windows.’ (folio 189 of the physical case file).
Based on the foregoing, it may be concluded that the respondent had the corresponding municipal permits for the construction work, including the windows facing the boundary with the claimants’ property. Although both parties were ordered to seal their windows, the respondent complied by covering them with black plastic, as she acknowledged in her testimony recorded at the supplemental hearing beginning at minute 00:18:10, and subsequently resolved the matter by erecting the dividing wall, for which she likewise had the necessary municipal permits. It may therefore be concluded that Article 407 of the Código Civil was satisfied: ‘Windows and balconies overlooking the rooms, courtyards, or enclosures of a neighboring parcel may not be opened unless there is a distance of three meters’; as was Article 302 of that same Code, which states: ‘Every owner or possessor has the right to enclose their property or possession with walls, fences, ditches, or by any other means they deem appropriate, except for easements (servidumbres) established for the benefit of another parcel and as otherwise provided by police regulations.’ As stated, because there are no easements duly established in favor of the claimants, nor any that may be established through the right of adverse possession (usucapión), and because the construction complies with municipal provisions, there is no current interference warranting protection in favor of the petitioners as a consequence of the existence of the windows and the construction of the dividing wall. The claims made by the claimant in this regard must therefore be dismissed.”
IX.The claim is without merit. The appellant alleges the omission of: a) the construction permit issued in the claimant’s name, and b) the testimony of Mr. Álvaro Montero Esquivel, the claimant’s father, who stated that he had measured the distance between the window and the wall and found it to be less than three meters. Article 407 of the Código Civil provides that windows and balconies offering a direct view onto the rooms, courtyards, or enclosures of a neighboring parcel may not be opened unless there is a distance of at least three meters. Articles IV 20 and VI.3.8.3. of the Reglamento de Construcción, in turn, permit windows to be opened at a shorter distance under certain conditions that ensure that the legally protected interest of privacy—and thus the aforementioned public interest—is not infringed, provided that a wall is built along the boundary line between the parcels with the dimensions and specifications prescribed according to the number of stories.
In this regard: “Article IV. 20.-Windows facing an adjoining property. Windows may not be opened toward the neighboring parcel unless there is a minimum distance of three meters (3,00 m), measured between the vertical plane of the outermost line of the window and the vertical plane of the boundary line between the parcels at the point where those lines are closest, if they are not parallel. Shorter distances shall be authorized only when the windows open onto courtyards and a wall has been built along the boundary line between the parcels in accordance with the dimensions specified in Article VI. 3.83 of these Regulations”; and provision VI. 3.8.3.: “Side setback: It shall not be required when the wall material along the relevant boundary is noncombustible and has no window or skylight. Otherwise, the following shall be required:—One and one-half meters (1,50 m) for one-story dwelling units.—Three meters (3,00 m) for two-story dwelling units.—For each additional story, one meter (1,00 m) shall be added to the side setback.” The Court’s reasoning has not been challenged.
In this case, the contested judgment confirmed that, following an inspection by the Municipalidad de Mora in 2016, the existence of windows providing a direct view onto the neighboring property, at a distance of less than three meters and without a wall, was verified. The Municipality required the property owners (both parties) to close the windows or comply with the regulations requiring a minimum distance of three meters between the windows and the boundary line of the properties, or to build a wall along that line. That adjudicative body also found that the respondent complied by covering the windows with black plastic to prevent visibility and subsequently built a wall with the necessary permits. The Court concluded that the respondent had complied with the applicable rules and regulations and that, according to a second municipal inspection (ref. 144-14), the construction complied with municipal provisions and the legal rules governing the installation of windows.
It therefore found that there was no current interference for which relief could be granted in favor of the petitioners. Because the Court’s reasoning has not been challenged, introducing the aforementioned testimony would serve no purpose, since it would not overturn the judgment even if it were hypothetically admitted. Consequently, the asserted ground of appeal must be dismissed.
X - In view of the foregoing reasoning and findings, the requested oral hearing shall be denied. The appeal is dismissed, with costs assessed against those who filed it (provision 73.1 of the Código Procesal Civil Ley no. 9342).
THEREFORE
The requested oral hearing is denied. The appeal is dismissed, with costs assessed against those who filed it.

En proceso ordinario interpuesto por MAGDA MONTERO BARQUERO y LUIS ÁNGEL QUESADA CÉSPEDES contra KARLA PAOLA SOLANO JIMÉNEZ, en el cual, el apoderado de las partes accionantes presentó recurso de casación en contra de la sentencia número 383-2021 de las 8 horas del 1 de junio de 2021, del Tribunal Primero Colegiado Primera Instancia Civil del Primer Circuito Judicial de San José, integrado por las personas juzgadoras Jackeline Brenes Segura, Angélica Delgado Madrigal e Ian Alberto Berrocal Azofeifa. Intervienen, las personas profesionales en derecho, Heiner Alberto Lemaitre Zamora y Alwin Mendoza Oviedo; el primero en calidad de apoderado especial judicial de la parte actora y el segundo en su condición de abogado director de la parte demandada.
CONSIDERANDO
Redacta la magistrada Rojas Morales
I.El presente asunto se origina a partir de la controversia surgida por la construcción de una tapia divisoria en julio de 2015, realizada por Karla Paola Solano Jiménez, propietaria de la finca matrícula número 1-580962. Los accionantes Magda Montero Barquero y Luis Ángel Quesada Céspedes alegan que dicha tapia invadió un metro con ochenta y nueve centímetros de la finca número 1-588778, de la cual poseen los derechos 003 y 004. Además, sostienen que el muro obstruyó su “derecho de vista hacia el infinito”, derecho que disfrutaban desde la adquisición de su propiedad y que era visible desde una de sus ventanas. Afirman que existía una servidumbre de luz, aireación, ventilación y vista, que habría sido vulnerada y que fue adquirida por prescripción positiva y/o por acuerdo con el anterior propietario, disfrutándola de forma pacífica, pública y de buena fe durante más de diez años. Asimismo, señalan que la Municipalidad había ordenado a la demandada sellar unas ventanas construidas ilegalmente, tanto por no formar parte del diseño original ni contar con permiso de construcción, como por infringir la distancia reglamentaria con respecto a la propiedad colindante.
Alegan que, con el propósito de justificar la permanencia de dichas ventanas y evitar su clausura, la demandada procedió a edificar la tapia. En lo medular, pretenden la restitución del área invadida en sus linderos al sur; la demolición de la tapia del límite sur y, en caso de no cumplirse, se autorice a los actores a demolerla; se paralicen todas las “perturbaciones contra la servidumbre establecida por el convenio con el antiguo dueño de la propiedad demandada”; la eliminación de árboles o arbustos cercanos a su vivienda que obstruyan la vista hacia el infinito; la supresión de las ventanas construidas a su juicio ilegalmente, al no estar contempladas en los permisos ni planos aprobados, a menos de un metro de distancia, las cuales no están autorizadas en los permisos ni en los planos de la vivienda. Además, peticionan indemnización por conceptos de: daño moral por la suma de ₡3.000.000, daño material por ₡2.130.000 y perjuicios por el monto ₡5.630.000.
Finalmente, solicitan ambas costas, intereses e indexación. Por su parte, la accionada contesta en forma negativa e interpone la excepción de falta de derecho. Señala ser propietaria de la finca colindante desde marzo de 2014, y afirma que la tapia de 3,90 metros de altura fue construida con el permiso municipal correspondiente, conforme a la normativa vigente, negando haber invadido linderos. Rechaza la acusación de haber plantado árboles para obstruir la vista, señalando que ya existían en su propiedad antes de adquirirla. Aduce que no existe ninguna servidumbre de luz, aireación y vista, ni prescripción positiva que respalde tal reclamo. Indica que los diez años requeridos por la prescripción positiva, se refiere a la posesión sobre un bien, y la vista “al infinito” no es un bien. Por último, resalta que no existe de su parte ninguna ilegalidad en la construcción de la infraestructura de su casa, que todo se realizó contando con los permisos correspondientes por las autoridades administrativas y que las ventanas que alegan los actores les afectan, son ventanas de baños que se mantuvieron tapadas hasta que se construyó la tapia. Ese muro, dice tiene como justificación delimitar las propiedades, salvaguardar la privacidad del hogar y de su propiedad, derecho otorgado por ley.
II.El Tribunal Primero Colegiado de Primera Instancia Civil del Primer Circuito Judicial de San José, integrado por las personas juzgadoras Jackeline Brenes Segura, Ian Alberto Berrocal Azofeifa y Angélica Delgado Madrigal, en resolución número 218-2021 dictada a las 8 horas 58 minutos (8:58 am) del 1 de junio de 2021, dispuso: “…Se declara una falta de derecho. Se declara sin lugar la demanda interpuesta por Magda Montero Barquero y Luis Ángel Quesada Céspedes, en contra de Karla Paola Solano Jiménez. Previa liquidación, se condena de forma solidaria a la parte actora al pago de las costas generadas por esta acción a favor de la demandada”. Inconforme el apoderado especial judicial de las partes actoras recurre y solicita audiencia oral. Mediante el auto de las 8 horas 40 minutos del 5 de mayo de 2022 de esta Sala se admitieron únicamente los agravios cuarto y octavo por razones de fondo.
III.Sobre la solicitud de audiencia oral. Los argumentos y conclusiones de las partes disconformes con respecto a los yerros reclamados cuentan con una claridad suficiente como para ser atendidos y resueltos, sin que se aprecie la necesidad de una audiencia oral, para una mejor comprensión. Conviene aclarar, la audiencia oral no se encuentra prevista para ampliar el recurso, sino para que las cuestiones ya planteadas sean debatidas a viva voz, en concurrencia de las partes con el órgano decisor, siempre y cuando este lo estime pertinente para obtener mayor claridad, precisión o una mejor comprensión de aquellos asuntos cuyas características particulares lo ameriten, como ocurre, por ejemplo, cuando se trata de asuntos que revisten una complejidad especial, lo que no se estima que ocurra en la especie, o bien, cuando se realiza, de manera excepcional, algún señalamiento probatorio. Así las cosas, como el numeral 69.7.2 del Código Procesal Civil dispone que el señalamiento para audiencia oral es procedente siempre y cuando el órgano casacional lo estime pertinente, se procede rechazar la solicitud planteada.
MOTIVOS SUSTANTIVOS DEL RECURSO
IV.En el primer agravio de fondo (cuarto motivo del recurso). En un primer punto, el recurrente cuestiona que la sentencia impugnada negara el reconocimiento de la servidumbre de vista. Alega que, mediante el testimonio de Álvaro Montero, quedó demostrado que la vivienda de los actores tenía más de quince años de construida, circunstancia que, a su juicio, acredita la existencia de dicha servidumbre y que no fue valorada por el Tribunal. Considera que esto quebranta lo estipulado en el artículo 378 del Código Civil. En el segundo cargo (octavo en el orden del recurso) su disconformidad es similar, por lo que se conocerá en conjunto, su oposición es en cuanto al rechazo de las servidumbres de vista, ventilación, aireación y luz a favor de las partes accionantes. Aduce, que han sido disfrutadas, por los actores desde que compraron la casa en el 2012, en forma pacífica, pública, ininterrumpida, por lo que a su criterio se dan los presupuestos del numeral 378 del Código Civil.
Afirma que, al rechazar la servidumbre de vista constituida por prescripción positiva, el Tribunal vulneró los artículos 853, 854 y 860 de ese mismo cuerpo normativo. El recurrente invoca además los artículos 406, 806, 850, 852, 855 y 856 del Código Civil, que, a su entender, permiten constituir las servidumbres alegadas por convenio, por última voluntad o por el uso y la tolerancia del propietario del predio sirviente. Ataca, el razonamiento del Tribunal en el que estimó que el requisito de posesión decenal, no se cumplió, debido a que la propiedad fue adquirida por los actores, el 6 de julio de 2012. Sobre ese punto alegó: “La servidumbre de vista, se ha constituido conforme al tiempo, ya que desde hace 15 años, como lo dice el testigo Álvaro Barquero Monestel en su testimonio dijo ‘Cuando ella compró esa propiedad tenía 15 años de estar construida’, la misma demandada en su declaración de parte manifiesta que ‘desconozco si vivían en esa propiedad’ también indicó que ella ‘… adquirió la propiedad en el 2014’.
En ese mismo sentido, aduce que el informe del Colegio Federado de Ingenieros y Arquitectos en la página 17 dice “…al ser una construcción antigua con más de 15 años de construida…”. Agrega “el requisito de posesión decenal, se cumple, debido a que la propiedad fue adquirida por los actores, el 06 de julio del 2012, desde que se hizo la segregación en el 2007, al 2012, habían transcurrido 5 años, al 2016, cuando presentó la demanda tenía 9 años de haberla adquirido, y debe sumarse los 6 años antes del 2007 de la segregación que se había construido la casa con los permisos municipales.” Finalmente alega, “En cuanto al artículo 407, se indica que fue violentado por el juzgador, dado que para él basta que la servidumbre sea ejercida con evidente buena fe para soslayar el hecho de que los ventanales construidos incumplían con las restricciones establecidas por dicha norma”. Arguye, los actores no fueron quienes construyeron los ventanales, sino que ya existían desde 2012, en una propiedad segregada en 2007 y vendida posteriormente a la demandada, lo que exime a los actores de responsabilidad por un uso indebido.
V.Con relación al cargo reprochado, el Tribunal resolvió: “el siguiente punto para analizar, consiste en presunta la perturbación del derecho de vista, o como lo llama la parte accionante, afectación a la servidumbre de luz, aireación, ventilación y vista, que existe a su favor, como consciencia de acuerdos privados allegados con el anterior propietario de la finca colindante, y con base en el cual reclama, el derecho adquirido mediante prescripción positiva. Perturbación que indican les ha causado la construcción de la tapia divisoria realizada por la accionada. Al respecto y de previo a determinar si existe un derecho a favor de los actores, tendiente de ser tutelado, debe quedar en claro la figura de la servidumbre de vista o el derecho de vista, su naturaliza jurídica, clasificación y las formas de constitución. Al respecto ha dicho la jurisprudencia: ‘Existen varias clasificaciones tradicionales de las servidumbres que tienen importancia para la constitución de ellas.- Se habla en nuestro Código Civil artículos 378 y 379 de las servidumbres aparentes y no aparentes, sin conceptualizarse en ninguna norma lo que eso significa, pero que se refieren a la constitución por usucapión lo que ayuda a conceptualizarlas.- Se puede entonces decir que una servidumbre es ‘aparente’ cuando existe un signo externo que la evidencia inobjetablemente en su existencia.
Por otro lado, cuando la servidumbre no se manifiesta a simple vista por algún signo exterior estaríamos ante una servidumbre ‘no aparente’.- En relación con las servidumbres continuas y discontinuas podemos decir que se debe entender por ‘continua’ aquella cuyo ejercicio se lleva a cabo sin necesidad de un acto o actividad del hombre; y ‘discontinua’ aquella que para su ejercicio o disfrute requiere de la actividad del hombre.- Hay otras clasificaciones que ahora no interesan aquí analizar.- Por lo expuesto, se puede concluir que la ‘servidumbre de vista’ es de tipo discontinua, no aparente.- En esas condiciones la normativa aplicable es el numeral 379 del Código Civil, que establece: ‘Las servidumbres discontinuas de toda clase y las continuas no aparentes, sólo pueden constituirse por convenio o por última voluntad. La posesión, aún la inmemorial, no basta para establecerlas’. (Tribunal Primero Civil, resolución Nº 142-E, de las 8:50 horas del 26 de enero de 2001.) Ahora bien, la parte actora reclama la eliminación del derecho de vista y a la vez reclama afectación en la ventilación y la aireación, sin embargo, todos los argumentos que son expuesto en la demanda, se dirigen a la perturbación de la vista hacia el ‘infinito’ que existía desde los ventanales de su casa, que fue el motivo por el cual compraron la propiedad.
Pero en lo que respecta a una presunta afectación en la ventilación o afectación en cuanto a la falta de aire, no se expone alegato alguno, ni mucho menos se aporta pruebas de alguna afectación al respecto. Por ello, conforme a la carga probatoria, es que le corresponde a la parte actora demostrar la existencia de esa servidumbre o del derecho que reclama, debidamente inscrito, circunstancia que se echa de menos en este proceso y por ello, no es posible tutelar, el presunto derecho que se reclama. Se trata de la violación de un derecho, que sólo puede constituirse por convenio o última voluntad, y si bien indican los actores, que existió un convenio con el anterior propietario de la finca que ahora pertenece a la accionada, no existe prueba de ello. De las certificaciones registrales de las propiedades en cuestión, aportadas al proceso, no se desprende que exista servidumbre alguna debidamente inscrita.
Las servidumbres de vista o de luz, en todo caso, corresponden a gravamen impuesto a un fundo, para proporcionar y aumentar la vista o la luz a favor de otro, concediendo con ello el derecho a tenerlas sobre predios ajenos, y esta existencia, es la que facultad al beneficiario de impedir obras de su vecino que disminuyan o entorpezcan el derecho constituido. Las vistas siempre van unidas a la luz, de la combinación de ambas surge una imposición del gravamen sobre la propiedad inmobiliaria, y suele considerarse como una limitación al dominio. El numeral 406 del Código Civil, dispone que: ‘El dueño de pared divisoria no medianera puede abrir ventanas y claraboyas, con tal que estén guarnecidas por rejas de hierro y de una red de alambre, y que disten del piso de la vivienda a que se quiere dar luz, dos metros y medio a lo menos’. Asimismo los artículos 407 y 408 ibídem, disponen que las vistas a habitaciones, patios y corrales vecinos, a través de balcones o ventanas, se permiten a una distancia mínima de tres metros, que se medirá entre el plano vertical de la línea más sobresaliente de la ventana o balcón, y el plano vertical de la línea divisoria de los dos predios, disposiciones que se ubican dentro del título que se ocupa de las cargas y limitaciones de la propiedad impuestas por ley, cuyo fin es el mantenimiento de la paz social, implementando normas adecuadas, a fin de que el interés de un propietario en particular prevalezca sobre la comunidad.
Pero si no está comprobada la existencia de tal limitación al derecho de propiedad, no es posible impedir que en el predio vecino o sirviente, se construyan paredes o edificios que eliminen o limiten tales derechos, en virtud de uno mucho más amplio, como lo es el derecho de propiedad privada. Sin embargo, es el uso de ese mismo derecho de propiedad entre vecinos, que se pueden constituir tales cargas reales, limitaciones o restricciones, pues como se indicó, pueden ser constituidas por convenio entre partes, o de la última voluntad. Bajo estas circunstancias, si los actores no demostraron la inexistencia de tal servidumbre o derecho, a favor de su fundo y en contra del fundo ocupado por la demandada, conforme expresamente lo dispone el numeral 308 del Código Civil: ‘Tratándose de servidumbres continuas no aparentes, o de servidumbres discontinuas, el reclamo, para ser atendible, debe fundarse en título que provenga del propietario del fundo sirviente, o de aquellos de quienes éste lo hubo.’, no es posible tutelar el presunto derecho violado que reclaman con la interposición de la demanda.
Cabe resaltar que con fundamento en la mera posesión, no es amparable el reconocimiento y constitución de una servidumbre de vista como limitación la derecho de propiedad de fundo vecino, por no ser susceptible de ello, aunado a que el requisito de posesión decenal, no se cumple, debido a que la propiedad fue adquirida por los actores, el 06 de julio del 2012, según consta en las certificaciones literales que acompañan la demanda, y expresamente en el hecho primero de su escrito, narran haberla adquirido cinco años antes de la presentación del proceso (marzo del 2016), de esta forma, no es posible tampoco analizar la procedencia de un derecho que según algunas corrientes doctrinarias, es posible de ser adquirido mediante la prescripción positiva. En lo que respecta al amparo de la posesión del derecho de vista, bajo los términos narrados, ha dispuesto la reiterada jurisprudencia que: ‘...para que lo fuera, la posesión tendría que estarse ejerciendo sobre un objeto poseíble, esto es, ‘sobre cosas’ o ‘sobre derechos’ y en el subjudice se procura sobre una limitación que el legislador ha impuesto al derecho de propiedad.
Los artículos 407 y 408 del Código Civil disponen las únicas formas en que se admite la construcción de ventanas, claraboyas y balcones, en paredes divisorias y cuando aquellas den vistas al predio vecino. Son límites al dominio, no derechos que concedan facultades en predios vecinos. Veamos, en principio el derecho de propiedad regulado en el Código Civil concede amplias facultades a su titular, las que sólo pueden limitarse por disposición del legislador –reserva de ley, artículo 45 de la Constitución Política-. En el caso de la construcción de ventanas, claraboyas y balcones, si las limitaciones referidas no existieran, el propietario podría construirlas sin más, ejercitando así su derecho. Sin embargo, como el legislador las impuso, los propietarios se ven compelidos a ejercer el dominio limitado, pues el contenido de su derecho se ha visto comprimido o disminuido en virtud de esas limitantes.
Por ello, nadie podría alegar tener un derecho sobre el predio vecino sustentado en limitaciones, menos aún en situaciones que las violen, pues sería una posesión sobre un imposible, no sobre un objeto que el legislador ha reconocido poseíble: cosas y derechos. Jamás podría constituirse una servidumbre sobre el predio vecino, sustentándose en una limitación al derecho de propiedad sobre el propio predio, menos aún si se viola ese límite.’ (Resolución Nº 638 -G. Tribunal Primero Civil, Sección Segunda, de las 13:00 horas del 31 de marzo de 2004.) (…) Si bien la jurisprudencia citada no es de carácter vinculante, la misma es citada por coincidir con el criterio que comparte y externa ahora este Tribunal. Si existe una limitación debidamente constituida no puede la parte actora solicitar que se restablezca un derecho que no es parte de su inmueble, en razón del derecho de propiedad de protección constitucional del cual también goza la parte accionada sobre su inmueble.
El querer imponer un derecho a su favor no debe implicar hacer recaer una carga o limitación sobre el predio vecino por la simple liberalidad de la voluntad de solo una de las partes. De forma tal que el reclamo sobre el resguardo al presunto derecho de vista, luz y aireación debe ser denegado.” (el resaltado no es del original)
VI.Se acusa al Tribunal de haber realizado una valoración indebida de la declaración del señor Álvaro Montero, esposo de la coactora, y del informe del Colegio Federado de Ingenieros y de Arquitectos, que a juicio del recurrente acreditaban que las ventanas de la casa de los actores tenían quince años de construcción. Sin embargo, esta Sala estima que no existe una casación útil en determinar si dichas pruebas demuestran que las ventanas de los actores tenían ese tiempo de construidas, a efectos de acreditar la prescripción positiva. Como se indicó en el considerando anterior, el Tribunal rechazó la constitución de una servidumbre de vista como limitación al derecho de propiedad del fundo vecino, por considerar que esta no puede constituirse ni ampararse mediante posesión, sino únicamente por convenio o por acto de última voluntad, conforme a los artículos 379 y 308 del Código Civil. En ese sentido, la sentencia impugnada clasificó la servidumbre de vista dentro del tipo no aparente, ya que no tiene un signo externo que evidencie su existencia, y del tipo discontinua, ya que requiere de la actividad del ser humano.
Además, la sentencia impugnada señaló que “aunado a que el requisito de posesión decenal no se cumple debido a que la propiedad fue adquirida por los actores el 6 de julio del 2012”. No obstante, la principal razón por la cual el Tribunal rechazó la constitución de la servidumbre de vista fue que las limitaciones impuestas por ley no pueden ser utilizadas como base para reclamar un derecho sobre propiedad ajena, ya que ello implicaría amparar una posesión fundada en una prohibición legal, lo que constituye una posesión de imposible reconocimiento. En otras palabras, la servidumbre de vista no puede constituirse por posesión cuando esta se ejerce sobre prohibiciones expresas. Respecto del rechazo de la servidumbre de ventilación y aireación, el Tribunal estimó que no se aportaron alegatos específicos que demostraran la afectación en términos de ventilación y aireación, debido a que la demanda se centró en la perturbación de la vista, aspectos no atacados.
Así, sin un argumento claro que ataque que la servidumbre de vista no puede constituirse por posesión, sobre prohibiciones expresas, no es posible concluir que exista un adecuado combate al fallo impugnado para combatir lo dicho por el Tribunal sobre la servidumbre denegada. Por lo expuesto, deberá ser desestimado el agravio. Además, resulta oportuno señalar que en jurisprudencia de esta Sala —entre otras, la sentencia número 000507-F-04, de las 11 horas 55 minutos del 17 de junio del año 2004, 251-F-2006 de las 15 horas 40 minutos del 12 de mayo de 2006, 000275-F-00 de 16 horas 5 minutos del 14 de abril del año dos mil, se ha sostenido de forma reiterada la imposibilidad de constituir servidumbres de vista y ventilación por prescripción positiva frente a prohibiciones expresas, como las que invoca la actora al pretender el derribo de un muro construido dentro del terreno de la demandada.
Ello resultaría violatorio del ordenamiento jurídico, en tanto contravendría normas de orden público, tales como lo sería contravenir con la prohibición expresa de los numerales 407 del Código Civil (sobre las limitaciones para abrir vistas y proteger la intimidad del vecino), 45 de la Constitución Política (garantizar el respeto al derecho de propiedad, como un derecho fundamental, nadie puede ser privado de su propiedad sino por interés público debidamente comprobado). En armonía con el numeral 50 de la Norma Suprema, así como normas de orden público, de necesidades colectivas, ambientales, de intereses públicos superiores y en el beneficio colectivo (ambiente sano el derecho a la privacidad y a la intimidad personal y familiar,). En las sentencias supra citadas, cuya naturaleza es similar al presente asunto, este Órgano Decisor dispuso, “que no cabe imponer derechos por prescripción positiva en infracción de una prohibición absoluta que sobrepasa el interés individual para radicarse en el seno del conjunto de los intereses individuales, lo que permite afirmar que no es posible la constitución de servidumbres en circunstancias fácticas violatorias del Ordenamiento Jurídico, pues la misma ley no puede cohonestar la constitución de derechos sobre la base de conductas expresamente prohibidas por razones de un interés público superior.
La tesis tradicional de la servidumbre que en este sentido se ha impuesto por vía jurisprudencial (a manera de ejemplo, puede verse el voto de esta Sala, N° 275-F-00 de las 16:05 hrs. del 14 de abril del 2000; así como el de la Sección Primera del Tribunal Contencioso Administrativo. N° 179-99, de las 15:10 hrs. del 31 de mayo de 1999; del Tribunal Segundo Civil. Sección Primera. N° 278 de las 9:00 hrs. del 22 de noviembre de 1996 y del Tribunal Segundo Civil. Sección Segunda. N° 699 de 9:15 hrs. del 23 de diciembre de 1991; N° 315 de 9:10 hrs. del 11 de julio de 1991 y la N° 299 de 9:25 hrs. del 14 de junio de 1993).” En dichas resoluciones se realizó un análisis que refleja que la concepción contemporánea y la evolución del derecho de propiedad más allá del concepto absoluto y tradicional. Esta visión está influenciada por las ideas postrevolucionarias francesas y se manifiesta en la Constitución, que redefine la propiedad no como un derecho irrestricto, sino como un “derecho función” ajustado a necesidades colectivas y ambientales, conforme se establece en el artículo 45 y 50 de la Norma Suprema.
Estos artículos califican la propiedad como inviolable y se armonizan con limitaciones por intereses públicos, garantizando un medio de vida sano para los habitantes del territorio. Además, se abordan las limitaciones a la propiedad establecidas legalmente, como las referentes a la construcción de ventanas contiguas a inmuebles vecinos, contenidas en los artículos 406 y 407 de la normativa civil. Estas son limitaciones ex lege, no sujetas a renuncia, y se aplican en base a la ley para proteger intereses colectivos sobre los individuales. Abordó que la ley es explícita, según el artículo 292 del Código Civil, en que los derechos de transformación y enajenación son inherentes a la propiedad, y solo pueden ser restringidos por ley en casos específicos y de forma prescrita. El artículo 383 también señala que la propiedad privada sobre inmuebles está sujeta a ciertas cargas u obligaciones que la ley impone a favor de los predios vecinos por motivos de utilidad pública.
En ambos casos destacaron que no se puede establecer una servidumbre basada en una situación que infrinja normas prohibitivas de orden público, ya que tal acción contradiría el espíritu del sistema legal, que busca proteger los intereses colectivos y evitar la creación de derechos a partir de conductas ilegales. Además, la ley es clara al señalar que los derechos de propiedad pueden estar sujetos a cargas u obligaciones impuestas legalmente en beneficio de la utilidad pública, y no cabe la constitución de servidumbres que infrinjan estas disposiciones. A mayor abundamiento sobre el tema, puede consultarse el voto número 507-F-2004 de esta Sala, en el cual se desarrolló un extenso razonamiento sobre la naturaleza jurídica del derecho de propiedad y los límites que le impone el ordenamiento urbanístico, condicionándola a su función social. Este órgano casacional, en dicha sentencia, reafirmó que el dominio no es un derecho absoluto ni ilimitado, sino que convive con restricciones legales orientadas al bienestar colectivo, al ambiente y al urbanismo —criterio reiterado en la sentencia 0001309-F-S1-13—.En esa línea, se destacó que la planificación urbana y la normativa civil sobre construcciones delimitan el contenido esencial del derecho de propiedad, por lo que el propietario debe ejercer sus facultades dentro del marco normativo imperativo que garantiza la seguridad, la privacidad y la armonía social.
Así, se concluyó que las restricciones contenidas en los artículos 406 y 407 del Código Civil, no son meras normas privadas ni dispositivos disponibles por las partes, sino mandatos de orden público, establecidos para proteger bienes jurídicos colectivos como la privacidad, la salubridad, la seguridad y la convivencia vecinal. Por ende, tales limitaciones no pueden ser derogadas ni mediante consentimiento tácito ni por el transcurso del tiempo. En consecuencia, la Sala rechazó la posibilidad de adquirir por usucapión una servidumbre de vista o iluminación cuando esta se haya ejercido en contravención a una norma imperativa, como ocurre cuando se abren ventanas en infracción de dichas limitaciones legales, pues tal ejercicio no puede prevalecer sobre el marco urbanístico. Asimismo, se vinculó el derecho urbanístico con el derecho constitucional a un ambiente sano, afirmando que la propiedad privada debe armonizarse con la protección ambiental y el ordenamiento territorial.
En este sentido, la regulación urbanística funciona como un puente entre el derecho de propiedad y el derecho al ambiente, asegurando un desarrollo racional, equitativo y sostenible del espacio urbano. De esta forma, se concluyó que la potestad de edificar o modificar un inmueble está sujeta al cumplimiento de condiciones legales de edificabilidad, tales como permisos municipales, retiros, alturas, medidas de seguridad, entre otras exigencias normativas. En ausencia de dicho cumplimiento, el ejercicio del derecho de propiedad deviene antijurídico. Todo ello conduce a compartir el criterio del Tribunal de que no puede establecerse una servidumbre basada en hechos que infringen normas prohibitivas y de orden público. Por ende, procede el rechazo del cargo.
VII.En el tercer cargo por el fondo (segundo punto, en el agravio cuarto en el orden del recurso). Su disconformidad es en cuanto la sentencia impugnada denegó la pretensión de ordenarle a los demandados la eliminación de las ventanas de la propiedad de la demandada KARLA PAOLA SOLANO JIMÉNEZ que tienen dirección con el predio de los actores. El casacionista alega indebidamente valorado el testimonio del señor Álvaro Montero Esquivel, padre de la actora registrado en el minuto 43:50 de la audiencia complementaria, que asevera indicó “esa ventana que hizo esa señora ahí que irrespetó la ley de construcción y alineamiento que lo tiene que dar la municipalidad eso tiene 1,83 y el artículo 408 del Código Civil dice que para medir esa medida de la casa tiene que ser de la parte más cercana o aproximadamente para ver sin están los tres metros me explico…la medí cuando eso estaba en construcción y yo vi que era un metro ochenta y tres aproximadamente que hay de la casa de la vecina que hizo una ventana violando las leyes y los derechos de la construcción y entonces pusieron ese montón de latas viejas ahí…bueno no tuve la curiosidad pero eso si no se ve, pero eso si la tapia posterior a la casa de mi hija la tapa hasta el techo.” El recurrente sostiene que el Tribunal falló al no considerar este testimonio junto con el documento a folio 149, de fecha 8 de junio de 2015 sobre el permiso de construcción que a su criterio estipulaba que las construcciones debían mantener una distancia mínima de tres metros de las propiedades vecinas.
VIII.Con relación al cargo reprochado, el Tribunal resolvió: “V.- Aunado al reclamo de la perturbación al presunto derecho de vista, se reprocha la construcción de ventanas ilegalmente en la propiedad de la accionada, que dan hacia su propiedad. En este caso, la accionada al construir su casa de habitación y abrir ventanas dirigidas al predio de los actores contaba con los permisos municipales de construcción otorgados según el número 213-14 de fecha 25 de agosto del 2014 (folio145-147), sin embargo, según lo establecido por la municipalidad del lugar, en el informe MM-UI-043-2016 del 01 de agosto del 2016, emitido por Inspector Municipal de la Unidad de Inspecciones y Policía Municipal de la Municipalidad de Mora, (folio 150 y 234) ante una denuncia presentada en dicho ente, precisamente respecto a la existencia de las ventanas, indican que realizada la visita de inspección se corrobora la existencia de ventanas, en ambas construcciones, que dan vista directa a las propiedades y le requieren a ambos propietarios, que proceden con el cierre de las ventanas o se apeguen a lo establecido por el articulo VI.20 del Reglamento de Construcciones, el cual indica: " Artículo IV. 20.-Ventanas a colindancia.
No se permite abrir ventanas hacia el predio vecino, a menos que intervenga una distancia mínima de tres metros (3,00 m) medida entre el plano vertical de la línea más sobresaliente de la ventana y el plano vertical de la línea divisoria de los predios, en el punto en que dichas líneas se estrechen más, si no son paralelas. Sólo se autorizarán distancias menores cuando las ventanas abran a patios, con tapia construida en la línea divisoria entre los predios, de acuerdo con las dimensiones señaladas en el artículo VI. 3.7. de este Reglamento." (Lo subrayado no es del original). Como consecuencia de tal apercibimiento, es que la parte accionada realiza la solicitud de los permisos correspondientes para construcción de la tapia divisoria, ello en fecha 6 de abril del 2015, pero igualmente se prueba que las ventanas si fueron cubiertas con plástico negro a fin de impedir la visibilidad al predio vecino y para el 08 de junio del 2015, según el número 120-15 se dio la autorización para la construcción, y la arquitecta encargada da fe de que la tapia se construirá conforme a lo requerido por el Reglamento de Construcciones y de esa forma la construyó pues no hay prueba que acredite lo contrario.
Incluso, un año antes de la realización de ese informe (MM-UI-043-2016) por parte de la misma Unidad de Inspecciones, se le había comunicado al actor Quesada Céspedes mediante el oficio del informe ref. 144-14 ante la queja interpuesta, en su punto segundo y octavo que: " Punto 2: Según Visita realizada a la propiedad de la señora Karla Paola Solano Jiménez la construcción se efectuó tal y como se presentó en plano para ser aprobados por el Departamento correspondiente. Punto 8: Como se indicó en el punto 2 la señora Solano, cumple con los retiros establecidos por ley para la apertura de ventanas." (folio 189 del expediente físico). Por lo expuesto, se puede concluir que la parte accionada contaba con los permisos municipales correspondientes para la realización de su obra constructiva incluyendo las ventanas que daban a la colindancia con los actores, que aún y cuando, se les apercibió a ambas partes para sellar las mismas, la parte accionada cumplió con ello, al colocar plásticos negros sobre las ventanas, lo cual fue aceptado por la accionada en su declaración la cual consta en la grabación de la audiencia complementaria a partir del minuto 00:18:10, y posteriormente, lo soluciona al levantar la tapia divisoria, que igualmente contó con los permisos municipales necesarios.
De tal forma que se puede concluir que se cumple con lo establecido por el artículo 407 del Código Civil: "No pueden abrirse ventanas ni balcones que dan vista a las habitaciones, patios o corrales del predio vecino, a menos que intervenga una distancia de tres metros", y al amparo de lo dispuesto por el artículo 302 del mismo Código, el cual reza: " Todo propietario o poseedor tiene derecho de cerrar su propiedad o posesión con paredes, cercas, zanjas o cualquier otro modo que le convenga, salvo las servidumbres constituidas en favor de otro predio y lo que dispongan los reglamentos de policía", y como se ha indicado, al no existir servidumbres debidamente constituidas a favor de los actores, o que puedan ser constituidas mediante el derecho de usucapión, al estar lo construido acorde con las disposiciones municipales, no existe perturbación actual tendiente de ser amparada a favor de los gestionante, como consecuencia de la existencia de los ventanales y la construcción de la tapia divisoria, por lo cual se impone el rechazo de las pretensiones que al respecto realizó la parte actora.”
IX.El reclamo no es de recibo. El recurrente alega preterición de: a) el permiso de construcción a nombre de la actora y b) la declaración del señor Álvaro Montero Esquivel, padre de la actora, en la que manifestó haber medido la distancia entre la ventana y el muro, resultando ser menor a tres metros. El artículo 407 del Código Civil establece que no pueden abrirse ventanas ni balcones con vista directa hacia las habitaciones, patios o corrales del predio vecino, salvo que medie una distancia de al menos tres metros. Por su parte, el articulo IV 20 y VI.3.8.3. del Reglamento de Construcción, permite abrir a una distancia menor siempre, bajo ciertas condiciones, que garantizan no lesione el bien jurídico tutelado de la intimidad, y con ello el interés público supra citado, siempre que haya una tapia construida en la línea divisora entre los predios con las dimensiones y características especificaciones de acuerdo con el número de pisos.
En ese sentido “Artículo IV. 20.-Ventanas a colindancia. No se permite abrir ventanas hacia el predio vecino, a menos que intervenga una distancia mínima de tres metros (3,00 m) medida entre el plano vertical de la línea más sobresaliente de la ventana y el plano vertical de la línea divisoria de los predios, en el punto en que dichas líneas se estrechen más, si no son paralelas. Sólo se autorizarán distancias menores cuando las ventanas abran a patios, con tapia construida en la línea divisoria entre los predios, de acuerdo con las dimensiones señaladas en el artículo VI. 3.83de este Reglamento” y el numeral VI. 3.8.3. “Retido lateral: No se exigirá cuando el material de la pared en la respectiva colindancia sea incombustible y no tenga ventana o linternilla. En caso contrario se exigirá:- Uno y medio metros (1,50 m) para unidades habitacionales de un piso.- Tres metros (3,00 m) para las de dos pisos.- Por cada piso adicional deberá agregarse un metro (1,00 m) de retiro lateral”.
Los argumentos del Tribunal no son combatidos. En el caso concreto, la sentencia impugnada confirmó que, tras una inspección en 2016 de la Municipalidad de Mora, se confirmó la existencia de ventanas que daban vista directa a la propiedad vecina, menor a tres metros, sin un muro. La Municipalidad requirió a los propietarios (ambas partes) que cerraran las ventanas o que cumplieran con las regulaciones que exigen una distancia mínima de tres metros entre las ventanas y la línea divisoria de las propiedades, o que construyeran una tapia en dicha línea. También acreditó -ese Órgano Jurisdiccional- que la parte accionada respondió cubriendo las ventanas con plástico negro para impedir la visibilidad y, posteriormente, construyó una tapia con los permisos necesarios. El Tribunal concluyó que la parte accionada cumplió con las normativas y regulaciones aplicables, y que, conforme a una segunda inspección de la Municipalidad (ref. 144-14), lo construido se encontraba acorde con las disposiciones municipales y la normativa legal en materia de apertura de ventanas.
Por ello, estimó que no existía una perturbación actual susceptible de ser amparada en favor de los gestionantes. Por lo que, al no ser controvertido el razonamiento del Tribunal, a nada conduce introducir las declaraciones indicadas, ya que no lograrían quebrar el fallo, aun si se introdujeran hipotéticamente. En consecuencia, el agravio planteado debe ser desestimado.
X - En mérito de lo razonado y expuesto, se denegará la audiencia oral solicitada. Se declara sin lugar el recurso, con sus costas a cargo de quienes lo interpusieron (canon 73.1 del Código Procesal Civil Ley no. 9342).
POR TANTO
Se deniega la audiencia oral solicitada. Se declara sin lugar el recurso, con sus costas a cargo de quienes lo interpusieron.
