CONSIDERING

I.The Instituto de Desarrollo Rural (INDER) filed this ordinary proceeding (harmfulness action) against Apolonio Zúñiga Zúñiga and Jabe Maquinaria Agrícola S.A. (JABE). It requests: “1.-That this complaint be deemed duly filed. 2. That, because it is harmful to the public interest, the resolution adopted by the Board of Directors of the Instituto de Desarrollo Agrario in Article 21 of session 005-01, dated 22 de enero del año 2001, be annulled solely insofar as it concerns the titling of the property registered in the Puntarenas Registry District under Real Folio number 127017-000 in favor of APOLINARIO ZUÑIGA (sic) ZUÑIGA (sic), whose particulars are indicated, corresponding to cadastral plan P-0621916-2000. 3. By reason of relatedness (conexidad), that the public deed issued by the Instituto de Desarrollo Agrario be annulled solely insofar as it concerns the titling of the property registered in the PUNTARENAS Registry District under Real Folio number 127017-000 in favor of APOLINARIO ZUÑIGA (sic) ZUÑIGA (sic), whose particulars are indicated, corresponding to cadastral plan P-0621916-2000. 4.

By reason of relatedness, that the registration entry for the property registered under the Real Folio system in the Puntarenas Registry District, Real Folio number 127017-000, issued by the Registro Nacional, be annulled. 5. By reason of relatedness, that any registration arising from the registration of the real property recorded in the Registro Nacional, Province of Puntarenas, Real Folio Registration number 127017-000, be annulled. 6. That the defendant be ordered to pay both categories of costs (ambas costas) of this proceeding.” In addition, as a provisional measure (medida cautelar), INDER requested that notice of the complaint be recorded and that the real property be frozen. By decision number 728-2016 at 10 hours on 7 de abril de 2016, the duty Pretrial Judge partially granted the request for a provisional measure, ordering that notice of this complaint be entered in the margin of the record for property registration number 127017-000 in the Puntarenas Registry District, registered in the name of the company JABE.

The defendants were declared in default (rebeldía). At the plaintiff’s request, the Pretrial Judge joined the State and the Servicio Nacional de Áreas de Conservación (SINAC) to the proceeding as necessary co-parties (litisconsortes necesarios), as well as Armando Gómez Bermúdez, Keiry Berrocal Vega, and the Cooperativa de Ahorro y Crédito de los Empleados del Ministerio de Educación Pública R.L., in their capacity as owners of properties created through subdivisions (segregaciones) of the property registered in the Puntarenas Registry District under Real Folio registration number 176826-000. The defendant cooperative acquiesced to the complaint (se allanó a la demanda). Berrocal Vega and Gómez Bermúdez, who had been joined to the proceeding, did not appear to answer the complaint and were likewise declared in default. Subsequently, at the State’s request, Ms. Betty Lázaro Calderón, the current owner of the real property in the Province of Puntarenas, registration number 176826-000, was joined to the proceeding as a defendant co-party (litisconsorte pasiva).

She opposed the complaint and, through the Poder Judicial’s public defense service, alleged that the land at issue is located within the Reserva Indígena Salitre. She also raised the defenses (excepciones) of limitations and lack of a current interest. Ruling on the first was deferred until judgment. The Tribunal Contencioso Administrativo y Civil de Hacienda, Sección Sétima, Segundo Circuito Judicial de San José, composed of Judges Francisco Hidalgo Rueda, Karla Madriz Martínez, and Gustavo Irías Obando, in its judgment at 10 hours on 28 de enero de 2022, ruled: “THEREFORE / The defenses of limitations, lack of standing as a defendant, lack of a current interest, and failure to state a legal right are rejected. Accordingly, this harmfulness action brought by the Instituto de Desarrollo Rural -INDER- is granted, and Resolution number 21 adopted by the Board of Directors of the former Instituto de Desarrollo Agrario -IDA- at Ordinary Session number 005-01, held on 22 de enero de 2001, is declared absolutely null and void, as is the corresponding deed transferring the parcel, which was executed on 23 de marzo del 2001 and resulted in the registration of the property in the Puntarenas Registry District under Real Folio registration number 127017-000, initially in the name of Mr.

Apolinario Zúñiga Zúñiga and currently registered in favor of Jabe Maquinaria Agrícola Sociedad Anónima, measuring eighty-two thousand four hundred twenty-five square meters, which registration is hereby annulled. By reason of relatedness, the registration entries derived from the registration of property 127017-000 shall also be annulled, namely, the properties registered in the Province of Puntarenas under numbers 137040-000, titled in the name of the Cooperativa de Empleados del Ministerio de Educación Pública R.L., measuring four thousand square meters; 176826-000, initially in the name of Mr. Armando Gómez Bermúdez and currently registered in the name of Ms. Betty Lázaro Calderón, measuring twenty-eight thousand eight hundred ninety-three square meters; and 185425-000, in the name of Ms. Keiry Berrocal Vega, measuring one thousand eight hundred square meters, as well as the respective public deeds through which those transfers were effected.

Finally, the provisional measure ordered by interlocutory decision during the preliminary phase shall remain in effect until this judgment becomes final. No special award of costs is made.” M.Sc. Ericka Quesada Madrigal, Public Defender and representative of Ms. Betty Lázaro Calderón, filed an appeal in cassation (recurso de casación) on procedural and substantive grounds. This Chamber admitted only the third ground for review.

II.In the third ground, the appellant in cassation actually raises several challenges, which will therefore be addressed separately and in order. First, the appellant contends that the Tribunal erroneously applied substantive law because, in its complaint, INDER argues that the challenged transfer failed to comply with the requirements established in Ley no. 7599 and its regulations; provisions which, she states, were declared unconstitutional by the Sala Constitucional in judgment no. 8560-2001 at 15 hours 37 minutes on 28 de agosto de 2001. Thus, she argues, because those provisions were “expelled” from the legal system, they do not affect the adjudication or the subsequent registry entries challenged in this matter. She therefore asserts that failure to comply with requirements established by provisions declared unconstitutional cannot constitute the defect giving rise to nullity (vicio de nulidad) that the plaintiff entity seeks to have declared in this harmfulness action.

III.In judgment no. 8560-2001 at 15 hours 37 minutes on 28 de agosto de 2001, the Sala Constitucional held: “VI.- Likewise, because the existence of the statute would be meaningless without the titling procedure contemplated in Articles 3 and 9 under review here, the Ley de Titulación de Tierras ubicadas en Reservas Nacionales under review must be declared unconstitutional in its entirety because it is contrary to Articles 7, 33, 39, 45, 50, 89, and 121 subsection 14 of the Constitución Política. Pursuant to Article 91 of the Ley de la Jurisdicción Constitucional, this declaration shall have retroactive effect as of the effective date of the annulled provisions, without prejudice to rights acquired in good faith. Nevertheless, pursuant to the cited Article 91, the effects of the declaration of unconstitutionality are qualified such that it shall not affect persons who obtained title to their lands under the statute that will be declared unconstitutional, provided that the three-year period for challenging the effects of that declaration has elapsed.

The foregoing is without prejudice to the State’s ability to bring actions aimed at recovering any titled lands that constitute public-domain property (bienes de dominio público)” (emphasis added). Given that it was by Resolution number 21 of the Board of Directors of the Instituto de Desarrollo Agrario, now INDER, adopted at Ordinary Session no. 005-01 held on 22 de enero de 2001 (seven months before the declaration that the Ley de Titulación de Tierras ubicadas en Reservas Nacionales, Ley no. 7599, was unconstitutional), that the subdivision and transfer to Apolonio Zúñiga Zúñiga and other possessors of lots and parcels within Proyecto Coto Brus was ordered—including, in his case, the property registered in the Puntarenas Registry District under registration number 127017-000, which is the subject of this dispute—it is clear that the titling in this case occurred under Ley no. 7599 and that noncompliance with the requirements established in that statute could indeed constitute grounds for nullity and give rise to the harmfulness action that was brought, contrary to the appellant’s assertion. The ground must therefore be rejected.

IV.Second, the appellant in cassation (casacionista) states: “In another vein, regarding the propriety of a judicial declaration that an act is injurious to the public interest (declaratoria jurisdiccional de la lesividad), we must be clear that this is an abnormal and exceptional situation in relation to the principle preventing the Administration from repudiating its own acts (principio de intangibilidad de los actos propios) (…)”. In this regard, she cites Constitutional Chamber decision no. 9335-2012 of 14 hours 30 minutes on 18 July 2012. She notes that a judicial declaration of injuriousness (declaratoria judicial de lesividad) is an exceptional proceeding that must satisfy certain requirements. Pursuant to Article 158 of the General Public Administration Law (Ley General de la Administración Pública, LGAP), she explains, a declaration of injuriousness based on invalidity (invalidez) is appropriate when any requirement of the administrative act (acto administrativo), expressly or implicitly required by the legal system, is absent, thereby rendering the act inconsistent with the legal system.

In this case, she asserts, the complaint filed did not identify the provision that was violated or that establishes the requirements allegedly lacking in the resolution that granted the property in question to Mr. Apolinario Zúñiga Zúñiga. She notes that the minutes of the INDER Board of Directors, ordinary session 36 of 5 October 2015, Article 51, resolution 51, stated that, in the case of Mr. Apolinario Zúñiga Zúñiga, no MINAE certification excluding the land from Wilderness Areas was submitted, nor was a land-use certification from the Instituto Nacional de Innovación y Transferencia en Tecnología Agropecuaria (INTA), or a report from the Instituto Geográfico Nacional. However, she adds, that resolution did not identify the provisions requiring those documents whose absence the Court considers to render the act null and void (nulidad), much less explain the public interest that should precede decisions of this kind. She therefore considers that the requirements applicable to every application for a declaration of injuriousness before the courts were not satisfied.

V.The appellant is incorrect. A review of the complaint shows that, in the section entitled “NULLITY OF THE ADMINISTRATIVE ACTS AUTHORIZING THE TITLING AND TRANSFER OF PARCEL 114-92075 IN FAVOR OF APOLONIO ZÚÑIGA ZÚÑIGA, AND HOW THAT GROUND FOR NULLITY AFFECTS THE PUBLIC INTEREST,” INDER not only invokes the provisions that it alleges were breached in the titling in favor of Mr. Zúñiga Zúñiga, but also clearly explains the failures to comply that it considers to entail the nullity of that act conferring rights (acto declaratorio de derechos).

VI.On the other hand, she states, Article 155 of the LGAP provides that the revocation (revocación) of acts conferring rights must be carried out by the head of the institution, following an opinion from the Contraloría General de la República. She adds that subsection 2 of that provision also requires the act to recognize the damages caused by the declaration of injuriousness and, if possible, to establish their amount, on pain of nullity. She states that the resolution adopted at ordinary session 36-2015, repeatedly cited above, omitted any provision regarding such recognition and calculation and is therefore tainted by absolute nullity (nulidad absoluta). She elaborates that this prevents its enforcement, as provided in Article 169 of the LGAP, and that this defect cannot be cured, as established in Article 172 ibidem. She also cites Article 1045 of the Civil Code and Article 190 of the LGAP, provisions that she alleges support the need to determine the corresponding compensation if an act conferring rights is revoked. She then reproduces the resolution adopted under Article 51 of ordinary session 36-2015 of 5 October 2015, in which, she says, the revocation of the challenged administrative act was effected.

VII.To render one of its own administrative acts ineffective, the Administration may revoke it on grounds of expediency, convenience, or merit, pursuant to Articles 152 through 157 of the LGAP. But if the act contains defects causing nullity, it must be annulled. Pursuant to Article 183.3 of the LGAP and the principle preventing the Administration from repudiating its own acts, however, the Administration may not annul ex officio (anular de oficio) acts it has issued that confer rights and must resort to judicial proceedings for a declaration of injuriousness (proceso judicial de lesividad) in order to have them annulled. Proceedings for a declaration of injuriousness are governed by Articles 10 subsection 5), 34, and 39 subsection 1 point e) of the Contentious-Administrative Procedure Code (Código Procesal Contencioso Administrativo, CPCA). This is a judicial proceeding in which the Administration that issued an administrative act conferring rights itself seeks its nullity.

To that end, the highest-ranking superior authority must, by means of a decision, declare the act injurious to public, economic, or other interests within one year of its issuance, unless it contains defects causing absolute nullity, in which case the declaration of injuriousness may be made for as long as its effects continue. Once injuriousness has been declared, the action before the contentious-administrative jurisdiction (jurisdicción contencioso administrativa) must be brought within one year from the day following the date on which the act declaring injuriousness becomes final. In light of the foregoing, because the relief sought in this case is the nullification of an administrative act, the LGAP provisions invoked by the appellant, which concern the procedure for revoking administrative acts conferring rights, clearly do not apply to this case and, consequently, logically cannot have been violated. The objection must therefore be rejected.

VIII.On the other hand, she objects that it is enough to examine the statement of reasons (motivación) for the act whose nullity is sought to verify that, in the case of Apolinario Zúñiga Zúñiga, “(…) the apparent requirements or grounds for annulling the act creating the right are that the file (sic) does not contain a MINAE certification establishing that the land is not part of the Protected Wilderness Areas, or the INTA study confirming compatible land use, such that it would appear that we are actually dealing with aspects or elements whose absence gives rise to a presumption of relative nullity (nulidad relativa), rather than absolute nullity. / On the other hand, what are those certifications that are apparently missing supposed to demonstrate? One is supposed to establish whether the land registered in the name of Apolinario Zuñiga Zúniga is located within a protected wilderness area, and the other establishes the land use, which has already been determined in advance.

Thus, if we are not certain whether that land is located within a protected wilderness area, how can we proceed on the assumption that it is, when this has not been demonstrated either in the administrative record or in the judicial case file before us? How, then, can it be presumed that the property title was granted to the detriment of the State’s Natural Heritage?” She further states that fact 5 of the complaint refers to the absence of a certification indicating whether the land formed part of the State’s natural heritage, as established in Articles 13, 14, and 15 of the Ley Forestal, although those arguments are not part of the resolution annulling the act granting rights to Mr. Zúñiga Zúñiga, but instead concern other awardees. She then states that, according to the land-registry certification submitted as evidence, it has been established that the property in the Puntarenas registry district, folio number 176826-000, lawfully registered in her client’s name, lies within the Reserva Indígena de Salitre.

Therefore, pursuant to Articles 2 and 3 of Ley Indígena no. 61721 and Articles 3, 4, and 5 of its Regulations, INDER lacks the capacity, right, and standing (legitimación) to bring proceedings of this kind. She further asserts that Ms. Betty Lázaro Calderón is an Indigenous person belonging to the Pueblo Bribri of the territorio indígena de Salitre. Based on the foregoing, she argues, these proceedings for a declaration of injuriousness were not appropriate for annulling the transfer and registration of the property on which her client has resided throughout her life; the action must therefore be dismissed. She also states that Ms. Lázaro Calderón has occupied the disputed land for many years together with her former husband, Mr. Apolonio Zúñiga Zuñiga. She adds: “The disagreement arises from the Contentious-Administrative Court’s validation of a provision that was declared unconstitutional, because in making that transfer, IDA granted ownership of lands belonging to the State, even though those lands had already been in the possession of Apolinario Zúñiga Zúñiga and his wife, Betty Lázaro Calderón, for a great many years, as is abundantly clear from the very complaint filed by INDER in these proceedings (…)”.

She reproduces the relevant portions of INDER’s complaint. She considers that annulling the award of the lands that remained in the possession of defendants Zúñiga Zúñiga and Lázaro Calderón and dispossessing them without due compensation constitutes an act violating their property rights. INDER’s attempt now to annul the award and the subsequent registrations resulting from transfers would violate not only the principle of public notice through the land registry (principio de publicidad registral), but also, egregiously, the principles of legal certainty or legal security (certeza o seguridad jurídica), as well as the principle of legitimate expectations (principio de legítima confianza) in legal transactions conducted with the Public Administration.

IX.As the judges stated in the challenged judgment, the purpose of these proceedings is to determine whether the initial award and the authorization of transfer and registration carried out by the Instituto de Desarrollo Agrario (IDA), now INDER, failed to comply with the regulatory requirements in force at the time. In other words, the evidentiary proceedings were aimed at verifying whether such noncompliance had in fact occurred and, therefore, whether the requested declaration of nullity was warranted, regardless of whether the property constituted State Natural Heritage (Patrimonio Natural del Estado) or whether it consists of indigenous lands today, matters extraneous to the dispute. In this regard, the Court stated: “The nullity declared herein results from this Court’s finding that, in the initial award and the authorization of transfer and registration carried out by the former IDA, regulatory requirements in force at the time that were of importance were disregarded—such as proof of possession of the property to be titled, review of the conservation of natural resources, a declaration that the areas encompassed by the property did not affect State Natural Heritage, and the land-use certificate (certificado de uso de suelo)—which means that, as a matter of law, title to the property in question could not have been granted, at least not in the manner in which it was done, by conveying the entirety of the awarded property without specifying whether any portion thereof formed part of the State Natural Heritage.

Consequently, it having been demonstrated that the regulated procedure for the award of land and the issuance of title in the name of Mr. Apolinio Zúñiga Zúñiga was not followed, and that the omissions identified seriously affect the act issued and render it absolutely null and void, because it failed to provide the necessary protection to the pro natura principle (principio pro natura) that governs environmental matters and in which all citizens must participate, the action seeking a declaration that the act was injurious to the public interest (lesividad) filed by INDER must be granted.” When a judgment rests on several legal grounds, the appellant, for the challenge to succeed, has a duty to contest all of them under the same ground of appeal (cargo), because failure to challenge one or more of them continues to provide a firm basis for the judgment. The ground of appeal examined here, as is apparent from the foregoing summary of its essential substance, fails to refute the Court’s considerations regarding the lack of legal requirements, a finding that led the judges to conclude that the requested declaration of lesividad should be granted.

The principal argument is not challenged under the ground of appeal examined here; therefore, it remains protected by the presumption of correctness and has sufficient force to sustain the decision. Accordingly, this ground of appeal must be dismissed.

X. Consequently, for the reasons stated, the appeal must be dismissed. Costs shall be borne by the unsuccessful party

THEREFORE

Proceso de Conocimiento (Lesividad) incoado por el INSTITUTO DE DESARROLLO RURAL, representado por el señor Ricardo Rodríguez Barquero, soltero, Licenciado en Planificación, con cédula de identidad número 2-0379-0749, vecino de Moravia, en su condición de Presidente Ejecutivo con facultades de apoderado generalísimo sin límite de suma y el señor Rodrigo Cervantes Barrantes, abogado con facultades de apoderado especial judicial, carné de colegiado número 7896, en contra del señor APOLONIO ZÚÑIGA ZÚÑIGA, cédula número 6-0160-0269, de demás calidades desconocidas y JABE MAQUINARIA AGRÍCOLA SOCIEDAD ANÓNIMA, cédula jurídica número 3-101-255500, representada por el señor Juan Félix Vásquez Calderón, abogado, con carné profesional número 2956. Participa también en representación de la COOPERATIVA DE EMPLEADOS DEL MINISTERIO DE EDUCACIÓN PÚBLICA, el señor José Aquiles Mata Porras, abogado con carné número 2558 y de la señora BETTY LÁZARO CALDERÓN, representada por la defensora pública Ericka Quesada Madrigal, colegiada número 8376, ambos en defensa de los litisconsortes pasivos integrados al proceso.

Intervienen como terceros interesados y en representación del Estado y del SINAC, respectivamente, la señora Silvia Quesada Casares, abogada, agremiada número 13586, en su carácter de Procuradora Adjunta y el señor Verny Avendaño Moya, abogado, colegiado número 20438, en su condición de apoderado especial judicial.

CONSIDERANDO

I.El Instituto de Desarrollo Rural (INDER), interpuso el presente proceso de conocimiento (lesividad) contra Apolonio Zúñiga Zúñiga y Jabe Maquinaria Agrícola S.A. (JABE). Solicita: "1.-Que se tenga por interpuesta la presente demanda. 2. Que en razón de ser lesivos a los intereses públicos se anule el acuerdo tomado por la Junta Directiva del Instituto de Desarrollo Agrario, en el artículo 21 de la sesión 005-01, de fecha 22 de enero del año 2001, únicamente en lo que se refiere a la titulación de la finca Partido de Puntarenas, Folio Real número 127017-000 a favor de APOLINARIO ZUÑIGA (sic) ZUÑIGA (sic), de calidades indicadas, correspondiente al plano catastrado P-0621916-2000. 3. Por conexidad, que se anule la escritura pública emitida por el Instituto de Desarrollo Agrario, únicamente en lo que se refiere a la titulación de la finca Partido de PUNTARENAS, Folio Real número 127017-000, a favor de APOLINARIO ZUÑIGA (sic) ZUÑIGA (sic) de calidades indicadas, correspondiente al plano catastrado P-0621916-2000. 4.

Por conexidad, que se anule el asiento registral de inscripción de la finca inscrita bajo sistema de Folio Real Partido de Puntarenas, Folio Real número 127017-000 emitido por el Registro Nacional. 5. Por conexidad, se anule cualquier inscripción que depare de la inscripción del inmueble inscritos en el Registro Nacional, Provincia de Puntarenas Folio Real Matricula número 127017-000. 6. Que se condene al demandado al pago de ambas costas de este juicio". Además, a título de medida cautelar, solicitó el INDER la anotación de la demanda e inmovilización del inmueble. Por resolución número 728-2016 de las 10 horas del 7 de abril de 2016, el Juez Tramitador de turno acogió parcialmente la solicitud de medida cautelar, ordenando anotar la presente demanda al margen de la finca del Partido de Puntarenas matrícula número 127017-000, propiedad registrada a nombre de empresa JABE. Los demandados fueron declarados en estado de rebeldía.

Ante la petición de la parte actora, el Juzgador de Trámite integró al proceso al Estado y al Servicio Nacional de Áreas de Conservación (SINAC) como litisconsortes necesarios, así como a Armando Gómez Bermúdez, a Keiry Berrocal Vega y a la Cooperativa de Ahorro y Crédito de los Empleados del Ministerio de Educación Pública R.L., en calidad de propietarios de fincas surgidas debido a segregaciones realizadas a la finca del Partido de Puntarenas, matrícula folio real 176826-000. La cooperativa demandada se allanó a la demanda. Los integrados al proceso Berrocal Vega y Gómez Bermúdez no se apersonaron a contestar la demanda, por lo que igualmente fueron declarados en estado de rebeldía. Posteriormente, a solicitud del Estado, se integró al proceso como litisconsorte pasiva a la señora Betty Lázaro Calderón, actual propietaria del inmueble de la provincia de Puntarenas, matrícula número 176826-000, quien contestó la demanda en forma negativa y alegó, por medio de la defensa pública del Poder Judicial, que el terreno objeto de litigio se encuentra en la Reserva Indígena Salitre.

Opuso además las excepciones de prescripción y falta de interés actual. La primera se difirió para ser resuelta en sentencia. El Tribunal Contencioso Administrativo y Civil de Hacienda, Sección Sétima, Segundo Circuito Judicial de San José, integrado por los jueces Francisco Hidalgo Rueda, Karla Madriz Martínez y Gustavo Irías Obando, sentencia de las 10 horas del 28 de enero de 2022, resolvieron: “POR TANTO / Se rechazan las excepciones de prescripción, falta de legitimación pasiva, de interés actual y falta de derecho. Por consiguiente, se declara con lugar la presente acción de lesividad incoada por el Instituto de Desarrollo Rural -INDER- y se dispone la nulidad absoluta del acuerdo número 21 tomado por la Junta Directiva del entonces Instituto de Desarrollo Agrario -IDA- en la Sesión Ordinaria número 005-01, celebrada el 22 de enero de 2001, así como la correspondiente escritura del traspaso de la parcela que fue otorgada el 23 de marzo del 2001 y que dio origen a la inscripción de la finca bajo el Folio Real del Partido de Puntarenas matrícula 127017-000, primeramente a nombre de don Apolinario Zúñiga Zúñiga y hoy día registrada en favor de la empresa Jabe Maquinaria Agrícola Sociedad Anónima, con una medida de ochenta y dos mil cuatrocientos veinticinco metros cuadrados, cuya anulación se dispone en este acto.

Por conexidad, deberán anularse también los asientos regístrales que han derivado de la inscripción del inmueble 127017-000, sea las fincas inscritas en la Provincia de Puntarenas bajo los números 137040-000 titulada a nombre de la Cooperativa de Empleados del Ministerio de Educación Pública R.L., con una medida de cuatro mil metros cuadrados; 176826-000, inicialmente a nombre del señor Armando Gómez Bermúdez y actualmente registrada a nombre de la señora Betty Lázaro Calderón, que mide veintiocho mil ochocientos noventa y tres metros cuadrados; y 185425-000 a nombre de la señora Keiry Berrocal Vega, con una medida de mil ochocientos metros cuadrados, así como las respectivas escrituras públicas donde se materializaron dichos traspasos. Finalmente, habrá de mantenerse la medida cautelar ordenada interlocutoriamente en fase de trámite, hasta que la presente sentencia adquiera firmeza. Se resuelve sin especial condenatoria en costas”.

La M.Sc. Ericka Quesada Madrigal, Defensora Pública, representante de la señora Betty Lázaro Calderón, formula recurso de casación por razones procesales y de fondo. Esta Sala admitió únicamente el tercer cargo para su estudio.

II.En el tercer motivo, en realidad, la recurrente plantea varios reproches, por lo que serán resueltos en forma independiente, en su orden. En primer lugar, estima la casacionista, incurrió el Tribunal en una errónea aplicación de la ley sustantiva ya que en su demanda el INDER arguye que en el traspaso cuestionado se incumplió con los requisitos establecidos en la Ley no. 7599 y su reglamento; normativa que, dice, fue declarada inconstitucional por la Sala Constitucional mediante voto no. 8560-2001 de las 15 horas 37 minutos del 28 de agosto de 2001. De tal manera, indica, al ser “expulsada” del ordenamiento jurídico, no afecta la adjudicación ni las posteriores inscripciones registrales que en el presente asunto se cuestionan. De ahí que, asegura, el incumplimiento de requisitos establecidos en la normativa declarada inconstitucional no puede constituir el vicio de nulidad que pretende la entidad actora se declare en el presente proceso de lesividad.

III.En el voto no. 8560-2001 de las 15 horas 37 minutos del 28 de agosto de 2001, dispuso la Sala Constitucional: “VI.- De igual modo, por no tener sentido la existencia de la ley sin el procedimiento para titular contemplado en los artículos 3 y 9 aquí consultados, cabe declarar en su totalidad, la inconstitucionalidad de la Ley de Titulación de Tierras ubicadas en Reservas Nacionales en estudio, por ser contraria a lo dispuesto en los artículos 7, 33, 39, 45, 50, 89 y 121 inc 14 de la Constitución Política. De conformidad con lo establecido en el artículo 91 de la Ley de la Jurisdicción Constitucional, esta declaratoria es retroactiva a la fecha de vigencia de las normas anuladas, sin perjuicio de los derechos adquiridos de buena fe. Sin embargo de conformidad con lo expuesto por el artículo 91 citado, se dimensionan los efectos de la declaratoria de inconstitucionalidad, en el sentido de que no afecta a las personas que hayan titulado sus tierras al amparo de la Ley, que se declarará inconstitucional, siempre y cuando haya transcurrido el término de tres años para impugnar los efectos de esa declaratoria.

Lo anterior sin perjuicio de que el Estado pueda ejercer las acciones tendentes a recuperar aquellos terrenos titulados, que constituyan bienes de dominio público” (el subrayado es suplido). Siendo que fue mediante acuerdo de la Junta Directiva del Instituto de Desarrollo Agrario, hoy INDER, número 21 de la Sesión Ordinaria no. 005-01, celebrada el 22 de enero de 2001 (siete meses antes de la declaratoria de inconstitucionalidad de la Ley de Titulación de Tierras ubicadas en Reservas Nacionales, Ley no. 7599), que se dispuso segregar y traspasar a Apolonio Zúñiga Zúñiga, entre otros poseedores, lotes y parcelas del Proyecto Coto Brus, en su caso la finca del Partido de Puntarenas matrícula 127017-000 objeto de este litigio, es claro que la titulación en este caso se dio al amparo de la Ley no. 7599, y que bien podía constituir el incumplimiento de requisitos establecidos en ese cuerpo legal, motivo de nulidad y dar lugar a la lesividad que se incoó, contrario a lo que afirma la recurrente. De tal manera deberá rechazarse el cargo.

IV.En segundo lugar, dice la casacionista: “En otro orden de ideas, dentro del tema de la procedencia de la declaratoria jurisdiccional de la Lesividad, debemos tener claro que ello es una situación anormal y de excepción frente al principio de intangibilidad de los actos propios (…)”. Cita al respecto el voto de la Sala Constitucional no. 9335-2012 de las 14 horas 30 minutos del 18 de julio de 2012. La declaratoria judicial de lesividad, anota, es un proceso excepcional que debe cumplir con ciertos requisitos. De conformidad con el artículo 158 de la Ley General de la Administración Pública (LGAP), explica, procede la declaratoria de lesividad por invalidez cuando esté ausente algún requisito del acto administrativo, expresa o implícitamente exigido por el ordenamiento jurídico, con lo cual será disconforme con el ordenamiento jurídico. En la especie, afirma, en la demanda planteada no se indicó cuál es la norma violentada o que establece los requisitos que se dicen adolece el acuerdo que le otorgó la propiedad en cuestión al señor Apolinario Zúñiga Zúñiga.

En el acta de Junta Directiva del INDER, anota, sesión ordinaria 36 del 5 de octubre de 2015, artículo 51, acuerdo 51, se indicó que en caso de don Apolinario Zúñiga Zúñiga, no se presentó certificación del MINAE sobre la exclusión del terreno de Áreas Silvestres, así como la de usos de suelo del Instituto Nacional de Innovación y Transferencia en Tecnología Agropecuaria (INTA), así como un informe del Instituto Geográfico Nacional. Sin embargo, añade, no se indicó en ese acuerdo, cuáles normas exigen esos requisitos cuya ausencia estima el Tribunal vician de nulidad el acto, menos aún se justificó cuál es el interés público que debería preceder este tipo de decisiones. De ahí, estima se incumplieron los requisitos que debe tener toda solicitud de lesividad en sede jurisdiccional.

V.No lleva razón la impugnante, revisada la demanda, se observa que el INDER en el acápite titulado “NULIDAD DE LOS ACTOS ADMINISTRATIVOS QUE AUTORIZAN LA TITULACIÓN Y EL TRASPASO DE LA PARCELA 114-92075 A FAVOR DE APOLONIO ZÚÑIGA ZÚÑIGA, Y EL COMO DICHA CAUSAL DE NULIDAD AFECTA EL INTERÉS PÚBLICO” , no solo invoca la normativa que alega se incumplió en la titulación a favor del señor Zúñiga Zúñiga, sino que explica con claridad en qué consistió las inobservancias que estima conllevan la nulidad de ese acto declaratorio de derechos.

VI.Por otra parte, indica, el numeral 155 de la LGAP establece que la revocación de actos que declaren derechos debe hacerla el jerarca de la institución, previo dictamen de la Contraloría General de la República. En el inciso 2 del citado precepto, agrega, requiere también que debe reconocerse en ese acto los daños y perjuicios causados con la declaratoria de lesividad y, de ser posible, establecerse el cálculo de estos, so pena de nulidad. El acuerdo tomado en la sesión ordinaria 36-2015, de múltiple cita, señala, omitió disponer sobre el reconocimiento y cálculo aludido, por lo cual se encuentra viciado de nulidad absoluta. Ello, amplía, impide su ejecución, según dispone el canon 169 de la LGAP, falencia que no puede subsanarse tal y como establece el ordinal 172 ibidem. Cita también el artículo 1045 del Código Civil y el numeral 190 de la LGAP, normas que alega respaldan la necesidad de determinarse la respectiva indemnización en caso de revocarse un acto declarativo de derechos. Copia luego el acuerdo tomado en el artículo 51 de la sesión ordinaria 36-2015 del 5 de octubre de 2015, en el que dice se materializa la revocación del acto administrativo cuestionado.

VII.Para dejar sin efecto un acto administrativo propio, la Administración puede revocarlo por razones de oportunidad, conveniencia o mérito, de conformidad con lo dispuesto por los artículos 152 a 157 de la LGAP. Pero si el acto contiene vicios de nulidad, éste debe ser anulado. Ahora bien, de conformidad con lo dispuesto en el artículo 183.3 de la LGAP y el principio de intangibilidad de los actos propios, la Administración no puede anular de oficio, los actos que haya emitido y que sean declaratorios de derechos, debiendo recurrir al proceso judicial de lesividad para su anulación. El proceso de lesividad está regulado en los artículos 10 inciso 5), 34 y 39 inciso 1 punto e) del Código Procesal Contencioso Administrativo (CPCA). Se trata de proceso judicial en el cual la propia Administración autora de un acto administrativo declaratorio de derechos solicita su nulidad. Para ello, el superior jerárquico supremo debe, mediante una resolución, declarar que el acto es lesivo a los intereses públicos, económicos o de cualquier otra naturaleza, dentro del plazo de un año contado a partir de su dictado, salvo que contenga vicios de nulidad absoluta, caso en el que podrá hacerse la declaratoria de lesividad mientras perduren sus efectos.

Una vez declarada la lesividad, la demanda ante la jurisdicción contencioso administrativa debe incoarse en el plazo de un año, contado a partir del día siguiente a la firmeza del acto que declara la lesividad. A la luz de lo anterior, tratándose en la especie de una pretensión de nulidad de un acto administrativo, evidentemente no resultan aplicables al caso las disposiciones de la LGAP invocadas por la recurrente, referidas al procedimiento de revocación de actos administrativos declaratorios de derechos y, por ende, tampoco resulta, lógicamente, quebrantadas. De tal manera, el reproche deberá rechazarse.

VIII.Por otro lado, reprocha, basta ver la motivación del acto cuya nulidad se pretende para constatar que en el caso de Apolinario Zúñiga Zúñiga, “(…) los aparentes requisitos o fundamentos para anular el acto constitutivo de derecho son que en el expediente de (sic) no consta certificación del MINAE estableciendo que el terreno no es parte de las Áreas Silvestres Protegidas, así como el estudio de uso conforme de suelos del INTA, por lo que pareciera que en realidad estarnos frente a aspectos o elementos que por su ausencia hacen presumir una nulidad relativa y no una absolula. / Por otro lado, qué es lo que deben demostrar esas certificaciones que aparentemente se echan de menos, una si el terreno inscrito a nombre de Apolinario Zuñiga Zúniga se encuentra en un área silvestre protegida y la otra es el uso de suelo que ya se encuentra determinado con antelación y de esa manera si no tenemos claro que ese terreno se encuentra o no en un área silvestre protegida, cómo vamos a partir del hecho de que si lo está si ello no está demostrado ni en el expediente administrativo ni en este expediente judicial que nos ocupa, entonces cómo se va a presumir que dicho título de propiedad fue otorgado en detrimento del Patrimonio Natural del Estado”.

Véase además, expresa, que en el hecho 5 de la demanda, se indica la ausencia de una certificación que indicara si el terreno era parte o no del patrimonio natural del Estado, según lo establecido en los artículos 13, 14 y 15 de la Ley Forestal, argumentos que no son parte del acuerdo que resuelve la anulación del acto que otorga derechos al señor Zúñiga Zúñiga, sino de otros adjudicatarios. Señala luego, que según con la certificación registral que se adjuntó como prueba, se tiene por demostrado que la finca del Partido de Puntarenas, matrícula número 176826-000, inscrita de manera legítima a nombre de su patrocinada, se encuentra dentro de la Reserva Indígena de Salitre, por lo que atendiendo a lo dispuesto en los artículos 2 y 3 de la Ley Indígena no. 61721 y en los numerales 3, 4 y 5 de su Reglamento, carece de capacidad, derecho y legitimación el INDER para plantear este tipo de procesos.

Además, asegura, la señora Betty Lázaro Calderón es una persona indígena, perteneciente al Pueblo Bribri, territorio indígena de Salitre. Por lo anterior, argumenta, el presente proceso de lesividad no procedía para anular el traspaso e inscripción del fundo donde ha residido su representada toda su vida; por ello debe declararse sin lugar. Dice, además la señora Lázaro Calderón ha ocupado desde hace muchos años el terreno en litigio junto a quien fuera su esposo, el señor Apolonio Zúñiga Zuñiga. Adiciona: “La inconformidad resulta de la validación que hace el Tribunal Contencioso Administrativo de una norma que fue declarada inconstitucional, ello porque al realizar ese traspaso, el IDA otorgó propiedad sobre terrenos pertenecientes al Estado, pues esos terrenos estaban ya en posesión desde muchísimos años atrás de Apolinario Zúñiga Zúñiga y su esposa Betty Lázaro Calderón, siendo que se desprende con meridiana claridad, de la misma demanda planteada por el INDER en este proceso (…)”.

Trascribe en lo de su interés la demanda del INDER. Considera que anular la adjudicación de los terrenos que permanecían en posesión de los demandados Zúñiga Zúñiga y Lázaro Calderón y despojarlos sin las debidas indemnizaciones constituye un acto violatorio de sus derechos de propiedad. Venir ahora el INDER a intentar anular la adjudicación y posteriores inscripciones por traspasos no solamente violentarían el principio de publicidad registral, sino también se estaría violentándose de manera grosera los principios de certeza o seguridad jurídica, además del principio de legítima confianza en los negocios jurídicos realizados con la Administración Pública.

IX.Tal y como indicaron los juzgadores en el fallo impugnado, el objeto del presente proceso radica en establecer si en la adjudicación inicial y autorización de traspaso e inscripción realizada por el Instituto de Desarrollo Agrario (IDA), hoy INDER, se obviaron requisitos normativos vigente en su momento. Es decir, que la actividad probatoria estaba dirigida a verificar si efectivamente hubo tales incumplimientos y por tanto procedía la declaratoria de nulidad pretendida, con independencia de si se estaba o no ante bienes Patrimonio Natural del Estado o si se trata de terrenos indígenas al día de hoy, asuntos ajenos a la discusión. Manifestó al respecto el Tribunal: “La nulidad aquí declarada, obedece a que ha tenido por acreditado este Tribunal, que en la adjudicación inicial y autorización de traspaso e inscripción realizada por el otrora IDA, se obviaron requisitos normativos vigentes en su momento y que resultaban importantes -tales como la prueba de posesión del inmueble a titular, la revisión sobre la conservación del recurso natural, la declaratoria de que las áreas comprendidas en el inmueble no afectaban Patrimonio Natural y el certificado de uso de suelo-, lo cual implica que en buen derecho, la titulación del inmueble referido no se hubiera podido realizar, al menos no en la forma en que se hizo, disponiendo la totalidad adjudicada, sin precisar si existía alguna porción que formara parte del Patrimonio Natural del Estado.

Por consiguiente, quedando demostrado que no se siguió el procedimiento normado para la adjudicación de tierras y titulación a nombre de don Apolinio Zúñiga Zúñiga y que las omisiones percibidas, afectan gravemente el acto dictado y lo vicia de nulidad absoluta, al no darle la protección necesaria al principio pro natura que impera en materia ambiental y sobre el cual todos los ciudadanos deban ser partícipes, la lesividad solicitada por el INDER debe ser acogida”. Cuando un fallo se apoye en varias consideraciones de orden jurídico, es deber del recurrente, para que prospere la censura, combatirlas todas en el mismo cargo, puesto que la no impugnación de uno o algunos sigue prestándole base firme a la sentencia. El reproche que aquí se estudia, como aparece del resumen que en lo fundamental se ha hecho de él, omite refutar las consideraciones en torno a la falta de requisitos legales que observó el Tribunal, criterio que llevó a concluir a los jueces que debía acogerse la lesividad planteada.

El argumento capital no se impugna en el cargo que aquí se estudia, por tanto, éste sigue amparado en la presunción de acierto y con fuerza suficiente para sostener la decisión. Deberá, entonces, desestimarse el cargo.

X.En consecuencia, por las razones señaladas, el recurso deberá deberá declararse sin lugar. Son sus costas a cargo del perdidoso.
