The Tribunal Agrario del Segundo Circuito Judicial de San José denied the objection to subject-matter jurisdiction (excepción de incompetencia en razón de la materia) raised by the State’s representative, who, disagreeing with that decision, filed an appeal (recurso de apelación), which was denied. Disagreeing with that ruling, the State filed an appeal of nonconformity (recurso de disconformidad), and the matter was therefore referred for consultation (consulta) before this Chamber.

WHEREAS

I.The principal complaint alleges that properties 6-080352-000 and 6-111169-000 overlap. It is alleged that the latter was sold by Inder pursuant to the “Ley de Titulación de Tierras Ubicadas en Reservas Nacionales,” which was declared unconstitutional in voto 8560-2001 of the Sala Cuarta Constitucional. The complaint requests that the judgment order the following: a) Declare null and void, because it was based on a law declared unconstitutional, the sale and purchase (compraventa) of the purported property 6-111169-000 carried out between Instituto de Desarrollo Agrario and José Ramón Torres Aguilar; order the Registro Inmobiliario to cancel the registration entries (asientos de inscripción) for the purported property 6- 111169-000 dated July 26, 1999, Volume 467, Entry 10696, consecutive number 01; b) Annul the sales and purchases involving the purported property 6-111169-000 carried out between José Ramón Torres Aguilar and Inversiones Rymlau S.A., registration entry Volume 470, Entry 07113, and between the latter and 3-102-457874 S.R.L., together with its registration entry Volume 569, Entry 51242-01; c) Annul the second-ranking mortgage (hipoteca en segundo grado), references: 569-51242-01-0030-001, over the purported property 6-111169-000, whose creditors are Inversiones Rymlau S.A., Rancho de Lujo S.A. and Marca ACE S.A., because it was created over nonexistent real property, as well as its registration entry; d) Annul the rights-of-way (servidumbres de paso), references: 569-51242-010012-001, created over property 6-111169-000, as well as their registration entry; e) Order Catastro Nacional to annul cadastral plan (plano catastrado) P-558109-99; f) Declare that the lands usurped by defendant 3-102-457874 S.R.L. form part of property 6-080352-000 and belong to Turubal S.A., and order their immediate restitution; and g) Order the defendants to pay the damages and losses (daños y perjuicios) caused.

The counterclaim (contrademanda) filed by Inversiones Rymlau S.A. requests that the transfers carried out on August 27, 1999, of property 111169-000 of Puntarenas from José Ramón Torres Aguilar to Inversiones Rymlau, and on October 19, 2006, from the counterclaiming company to 3-102-457874 S.R.L., together with their registry entries, be declared valid, and that the resulting registrations be declared not to have been and not to be affected by the (potential) nullity resulting from the declaration that Ley 7599/1996 was unconstitutional, as declared in voto 8560-2001 of the Sala Cuarta Constitucional. It states that the plaintiff and counterclaim defendant La Turubal S.A., Carlos Alberto Hidalgo Cárdenas and José Ramón Torres Aguilar acted through abuse of rights (abuso de derecho) and legal fraud (fraude legal) and caused it both pecuniary and non-pecuniary damages. The State’s counterclaim requests: the partial annulment of deed 25 in volume 16 of notary Carmelina Vargas, insofar as it transfers to José Ramón Torres Aguilar a parcel of land measuring 86 hectares 4132.59 meters; the annulment of the registration entries for properties 6-80352-001-002 and 6-111169-000; an order directing their cancellation before Registro Nacional; and the annulment of cadastral plans P-929890-90 and P-558109-99.

All of the foregoing is sought on the ground that Patrimonio Natural del Estado was improperly included within those properties. Inder’s counterclaim requests a declaration that the attorney-in-fact for Turubal S.A. acknowledges that cadastral plan P-929890-1990 contains incorrect cartographic information, and that property 80352-000 of Puntarenas was registered using a cadastral plan containing incorrect cartographic information; it seeks an order directing Catastro Nacional to annul cadastral plan P 929890-1990 and remove it from the information system, as well as a declaration that Carlos Hidalgo Cárdenas caused Instituto de Desarrollo Agrario to err by submitting, together with the application for title to the land, a cadastral plan containing incorrect information. II.In her response, the State’s representative raised the defense of lack of subject-matter jurisdiction, contending that the matter falls within the jurisdiction of the Administrative Litigation Courts, and alleged: “(…) Rights are being claimed over land that forms part of the Natural Heritage of the State (Patrimonio Natural del Estado), because forest constitutes 97% of its cover, and the State and other institutions are being asked to pay damages for a potential nullification of the registration in the Property Registry. Because these are public-domain assets (bienes demaniales), their legal regime, including the means by which they may be used, is governed by the rules and principles of Administrative Law. It must therefore be assessed from the perspective of Public Law whether the asserted claim is proper, and the legality of the acts upon which it is based must always be examined from that perspective.

Given the nature of the disputed property, that assessment must be conducted within the administrative litigation jurisdiction, in light of its governing criteria, in order to exercise the protection and oversight of public assets (Código Procesal Contencioso Administrativo, artículos. 1 y 36). The jurisdiction of the Administrative Litigation and Civil Treasury Courts (Tribunales de lo Contencioso-Administrativo y Civil de Hacienda) follows criteria different from those of Agrarian Law, cannot be extended, and is governed by special statutes enacted after the Ley de Jurisdicción Agraria, which take precedence and must be observed, such as the Código Procesal Contencioso Administrativo….” By judgment number 2024000331, issued at fourteen hours fifty-one minutes on cinco de abril de dos mil veinticuatro, the Agrarian Court of the Second Judicial Circuit of San José denied the defense of lack of jurisdiction and held that the agrarian courts retained jurisdiction over this matter, stating: “In voto 982 de 24.11.2017, issued in these proceedings, the defense of lack of jurisdiction raised by counterclaimant Rymlau was denied because that defense could not be asserted in a complaint.

The arguments presented by the State as counterclaim defendant—which entered the proceedings after that judgment—are unavailing. No supervening circumstances are alleged that were unknown when that judgment was issued or that have altered the status of the disputed properties. The issue under discussion concerns an alleged overlap said to exist between two properties that currently have registered title as private property; the origin of one of them is related to Ley 7599/1996, which was declared unconstitutional in voto 8560-2001 de la Sala Cuarta Constitucional; the effects of that situation; and the nullity of the deeds, registry entries, and plats associated with those properties due to the referenced overlap. The State, in turn, seeks nullification of the registration of both properties and their plats because the land contains forest and, therefore, it considers the land to fall within the Natural Heritage of the State.

Such property is in the public domain pursuant to artículos 13 y 14 Ley Forestal 7575. As will be explained, the fact that the latter may ultimately be declared does not change the fact that the legal situation presented involves, in principle, an impact on private property rights (derechos reales). If it is established that the property at issue in the proceedings is in the public domain, that may affect the outcome, but it does not prevent the agrarian courts from properly resolving the dispute and applying the corresponding rules, whether to protect private ownership and other property rights or, as applicable, the public domain (demanio público). Nor does the fact that payment of damages is sought as ancillary relief, or that the State and an autonomous state institution such as Inder are parties, prevent the agrarian courts from adjudicating the dispute. In this regard, it is clarified that if the State or its institutions act as a public authority in any legal situation (one requiring determination of the specific legal consequences or effects that relate to or arise from a factual situation relevant to the law), the related disputes must be resolved under rules of Public Law.

However, if they act without sovereign powers (potestades de imperio), the situation must be resolved by applying rules of Private Law (artículo 3 Ley General de Administración Pública). There are therefore various circumstances in which, although the State, a state entity, or one of its auxiliary bodies participates in the proceedings, the subject matter under dispute places jurisdiction with the Agrarian Courts (see, in this regard, the precedents in votos 222 de 11.03.2015, 16 de 22.01.2009 y 246 de 17.03.2021). Furthermore, in cases such as this one, given the subject matter under dispute and pursuant to numerales 1, 15, 22 Ley de Jurisdicción Agraria, the principal criterion for determining subject-matter jurisdiction is not the subjective criterion (the organizational nature of the parties), but rather the activity conducted or capable of being conducted on the properties at issue and the nature of the alleged right under dispute.

Second, the relief sought cannot be considered a legal situation that must be resolved on the basis of the rules and purposes of Public Law, which would fall within the exclusive jurisdiction of the Administrative Litigation Courts. Protecting the public domain is a duty incumbent upon every type of court, within its respective jurisdiction, particularly when real property is involved, because it may be agrarian in nature or constitute property of environmental interest, as occurs with the Natural Heritage of the State. Statutes enacted both before and after the Código Procesal Contencioso-Administrativo: Ley 8508 del 28/04/ 2006, in force since 2008, recognize this. These include the Código Penal (artículo 227: encroachment upon the public domain); Ley de Informaciones Posesorias (artículo 7: permits title to forested areas provided that the statutory requirements are shown to have been met); and Código Procesal Civil (artículos 107 y 108, which concern summary proceedings that may involve public-domain assets) ...

Nor, for purposes of determining jurisdiction, is the argument that the provisions of the Código Procesal Contencioso-Administrativo postdate those of the Ley de Jurisdicción Agraria applicable to this case. Agrarian law is specialized, and the amendments introduced by that Code upon its entry into force in 2008 did not alter the prevailing criteria under which every court may and should properly protect the public domain when property so classified may be involved in proceedings before it. In this case, as noted, nullification is sought of the deeds, plats, and registry entries for properties belonging to the plaintiffs and counterclaimants, based on allegations of duplicate titling, and recovery of possession (reivindicación) is also sought. Those claims are governed by the rules of Private Law. Through its counterclaim, the State introduces another issue for adjudication: that the properties in question cannot be privately owned and that their registry entries and cadastral plats should therefore be nullified.

Undeniably, whether or not that position is correct must be determined in the final judgment before the referenced private-law claims are analyzed. However, as explained, its assertion does not mean that the agrarian courts lack jurisdiction to conduct the corresponding analysis and grant such relief as may be proper regarding the matters disputed in this case. Finally, a reading of the complaint does not show that nullification or revocation of any administrative act or any state conduct is being requested that must exclusively and necessarily be ordered by an administrative litigation court. Cancelling deeds, plats, and registry entries when they must be nullified is also a power held by agrarian, civil, criminal, and other courts, as established in artículos 471 a 477 Código Civil. Likewise, every court is empowered to apply rules governing liability for damages, regardless of whether they operate for or against the State or one of its entities, by applying the attribution criteria relevant to the situation under dispute (numerales 41 Constitución Política, 701 a 707 Código Civil).

In accordance with the foregoing, the defense of lack of subject-matter jurisdiction must be denied pursuant to numerales 1 a 4 Ley de Jurisdicción Agraria y 113 Ley Orgánica del Poder Judicial.” The State’s representative disagreed and filed an objection, alleging: “I base my objection on the following grounds:

  • 1)The counterclaimant seeks a declaration of rights over land that forms part of the Natural Heritage of the State because forest constitutes 97% of its cover.
  • 2)It is sought that the State and other institutions pay damages arising from a potential nullification of the registration in the Property Registry. In that regard, it must be noted that the dispute would concern public-domain assets, and because state property is involved, its legal regime, including the means by which it may be used, is governed by the rules and principles of Administrative Law.
  • 3)It is necessary to assess from the perspective of Public Law whether the asserted claim is proper and, always from that perspective, to examine the legality of the acts upon which it is based. Given the nature of the disputed property, that assessment must be conducted within the administrative litigation jurisdiction, in light of its governing criteria, in order to exercise the protection and oversight of public assets. Furthermore, the State appears as a defendant. (Código Procesal Contencioso Administrativo, arts. 1° y 36).
  • 4)The jurisdiction of the Administrative Litigation and Civil Treasury Courts follows criteria different from those of Agrarian Law, cannot be extended, and is governed by special statutes enacted after the Ley de Jurisdicción Agraria, which take precedence and must be observed, such as Código Procesal Contencioso Administrativo, Ley 8508/2008, arts. 1°, 2°, 3°, 5° y 36. 1. It is clear that the relief sought in these proceedings involves public-domain assets because they belong to the Natural Heritage of the State, as demonstrated by official letter SINAC-SE-IRT-038-2020, which is contained in the case file and states that property 6-111169-000, with cadastral plat number P-558109-99, has 97% forest cover (cobertura forestal), evidencing that this case concerns an improper registration of the public domain.
  • 5)The legal regime governing title to, use of, and protection of this type of property is Administrative Law, and disputes involving such property, given the specialized nature of the subject matter, must be resolved through administrative litigation proceedings. Administrative Law, as is well known, constitutes an autonomous system with its own doctrines, sources, analytical methodology, and dogmatic conception, which is incompatible with the superimposition of other branches of law without proper legal support.
  • 6)The jurisdiction of the Administrative Litigation and Civil Treasury Courts follows criteria different from those of Agrarian Law, cannot be extended, and is governed by special statutes enacted after the Ley de Jurisdicción Agraria, which take precedence and must be observed, such as Ley 7333/1993, comprehensive amendment to the Ley Orgánica del Poder Judicial, artículo 110, inciso 3°; Código Procesal Contencioso Administrativo, Ley 8508/2008, arts. 1°, 2°, 3°, 5° y 36; Ley 7788/1998, de Biodiversidad, art. 108, etc… In view of the foregoing, I request a declaration that jurisdiction to conduct these proceedings lies with the administrative litigation jurisdiction.” Consequently, the matter was referred to this Chamber for consultation.

III.The dispute arising here seeks to determine whether the conflict falls within administrative litigation jurisdiction (jurisdicción contencioso-administrativa) or agrarian jurisdiction (jurisdicción agraria). This Chamber has recognized agrarian jurisdiction pursuant to the general provisions established in Articles 1 and 2 of the Ley de Jurisdicción Agraria, which provide that it shall have exclusive jurisdiction to hear and resolve disputes arising from the application of agrarian legislation and legal provisions governing animal or plant production activities, as well as related activities involving the processing, industrialization, marketing, and disposal of agricultural products. In this particular case, an examination of the record shows that the relief sought in the proceeding is a declaration of nullity (nulidad) of the deeds, survey plans, and registry entries for the disputed properties, on the grounds that they allegedly have duplicate title (doble titulación) and overlap (traslape).

In addition, they seek an order for recovery of the property (reivindicación). The State, in turn, requests the nullification of the registration of both properties and their survey plans because they are forested lands and, therefore, are considered to fall within the Patrimonio Natural del Estado. In summary, the dispute concerns the determination of rights over agrarian properties that also possess characteristics of public-domain status (demanialidad). In this regard, Article 22 of the Ley de la Jurisdicción Agraria provides: “Article 22. The following shall be parties in matters heard by the agrarian jurisdiction: (...) ch) The Procuraduría General de la República, in all matters relating to the protection of the public domain (dominio público) and the exercise of the powers conferred upon it by law in this area.” As can be seen, this provision contemplates and permits the State, through the Procuraduría General de la República, to be a party to proceedings involving the protection of the public domain.

Thus, the mere fact that one of the parties is the State and that the dispute concerns real property (bien inmueble) with alleged public-domain status does not transform it into an administrative litigation proceeding (proceso contencioso-administrativo), particularly where an agrarian activity (actividad agraria) is conducted on the property or where one of the parties is an agricultural entrepreneur (empresario agrícola), as in this case, in which the plaintiff is an agricultural entrepreneur. Consequently, the conflict is deemed agrarian in nature; therefore, jurisdiction over it by subject matter and territory, pursuant to Articles 1, 2, and 22 of the Ley de la Jurisdicción Agraria and Articles 8.1, 8.3, and 8.3.1.1 of the Código Procesal Civil, lies with the Juzgado Agrario de Puntarenas, where the proceeding was commenced and had been pending.

San José, a las diez horas doce minutos del doce de setiembre de dos mil veinticuatro .- En proceso agrario interpuesto por LA TURUBAL SOCIEDAD ANÓNIMA, cédula jurídica número 3-101-275602, representada por el señor Carlos Alberto Hidalgo Cárdenas, agricultor, vecino de Parrita, en calidad de apoderado general y el licenciado Claudio Miranda Martínez en calidad de apoderado especial judicial, contra INVERSIONES RYMLAU SOCIEDAD ANÓNIMA, cédula jurídica número 3-101-226958, representada por su presidente con facultades de apoderado generalísimo sin límite de suma Luis Ricardo Charpentier Soto y el licenciado Roberto Yglesias Mora; TRES - CIENTO DOS - CUATROCIENTOS CINCUENTA Y SIETE MIL OCHOCIENTOS SETENTA Y CUATRO SOCIEDAD DE RESPONSABILIDAD LIMITADA, representada por Teresa Bueno, de un solo apellido en razón de su nacionalidad estadounidense y el licenciado Roberto Enrique Umaña Blaser; INSTITUTO DE DESARROLLO RURAL, cédula jurídica número 4-000-0421143-11, representada por su presidente ejecutivo con facultades de apoderado generalísimo Ricardo Rodríguez Barquero y la licenciada Carmelina Vargas Hidalgo en calidad de apoderada especial judicial; JOSÉ RAMÓN TORRES AGUILAR, representado por el licenciado Miguel Ángel Quirós Miranda y la PROCURADURÍA GENERAL DE LA REPÚBLICA representada por la procuradora Heilyn Sánchez Calderón.

El Tribunal Agrario del Segundo Circuito Judicial de San José, rechazó la excepción de incompetencia en razón de la materia interpuesta por la representante del Estado, que inconforme presentó recurso de apelación el cual fue rechazado. En desacuerdo, el Estado interpuso recurso de disconformidad contra lo resuelto, por lo que se remitió el asunto en consulta ante esta Sala.

CONSIDERANDO

I.En la demanda principal se reclama que existe un traslape de las fincas 6-080352-000 y 6-111169-000. Se alega que la segunda fue vendida por el Inder al amparo de la "Ley de Titulación de Tierras Ubicadas en Reservas Nacionales”, declarada inconstitucional en voto 8560-2001 de la Sala Cuarta Constitucional. Se solicita que en sentencia se ordene: a) Se declare nula, por estar basada en una Ley declarada inconstitucional, la compraventa sobre la supuesta finca 6-111169-000 realizada entre Instituto de Desarrollo Agrario y José Ramón Torres Aguilar; se ordene al Registro Inmobiliario anular los asientos de inscripción de la supuesta finca 6- 111169-000 del 26 de julio de 1999, Tomo 467, Asiento 10696, consecutivo 01, b) Anular las compraventas sobre la supuesta finca 6-111169-000, realizada entre José Ramón Torres Aguilar e Inversiones Rymlau S.A., asiento de inscripción Tomo 470, Asiento 07113 y la de tal a 3-102-457874 S.R.L. y su asiento de inscripción Tomo 569, Asiento 51242-01, c) Anular la hipoteca en segundo grado citas: 569-51242-01-0030-001 sobre la supuesta finca 6-111169-000, cuyos acreedores son Inversiones Rymlau S.A., Rancho de Lujo S.A. y Marca ACE S.A., por estar constituida sobre un bien inmueble inexistente y su asiento de inscripción, d) Anular las servidumbres de paso citas: 569-51242-010012-001, constituidas sobre la finca 6-111169-000 y su asiento de inscripción, e) Ordenar al Catastro Nacional anular el plano catastrado P-558109-99, f) Declarar que las tierras usurpadas por la demandada 3-102-457874 S.R.L., son parte de la finca 6-080352-000 y pertenecen a Turubal S.A., se ordene su inmediata reposición y g) Se condene a los demandados al pago de los daños y perjuicios ocasionados.

En la contrademanda de Inversiones Rymlau S.A., se pide se declaren válidos los traspasos realizados el 27 de agosto del año 1999 de la finca 111169-000 de Puntarenas, de José Ramón Torres Aguilar a favor de Inversiones Rymlau, y el 19 de octubre del año 2006, de la sociedad reconventora a favor de 3-102-457874 S.R.L. y sus asientos registrales y declarar que las inscripciones derivadas no fueron ni están afectadas por la (eventual) nulidad que acarrea la declaratoria de inconstitucionalidad de la Ley 7599/1996, declarada en voto 8560-2001 de la Sala Cuarta Constitucional. Señala que la sociedad actora reconvenida La Turubal S.A., Carlos Alberto Hidalgo Cárdenas y José Ramón Torres Aguilar, han procedido con abuso de derecho y fraude legal y han causado daños y perjuicios, tanto materiales como morales, en su perjuicio. En la contrademanda del Estado se pide: la nulidad parcial de la escritura 25 del tomo 16 de la notaria Carmelina Vargas en cuanto traspasa a José Ramón Torres Aguilar un terreno de 86 hectáreas 4132.59 metros; la nulidad de los asientos de inscripción de las fincas 6-80352-001-002 y 6-111169-000; ordenar su cancelación ante el Registro Nacional y la nulidad de los planos catastrados P-929890-90 y P-558109-99.

Todo lo anterior por reclamarse que se incluye indebidamente el Patrimonio Natural del Estado dentro de tales. En la contrademanda del Inder se pide se declare que el apoderado de Turubal S.A., reconoce que el plano catastrado P-929890-1990, tiene información cartográfica incorrecta, que la finca de Puntarenas 80352-000 fue inscrita con un plano catastrado que tiene información cartográfica incorrecta; pretende se ordene al Catastro Nacional anular y excluir del sistema de información el plano catastrado P 929890-1990 y se declare que Carlos Hidalgo Cárdenas indujo a error al Instituto de Desarrollo Agrario, al presentarle con el trámite de solicitud de título de propiedad del terreno un plano catastrado con información incorrecta. (Según expediente digital y documentos que constan en autos).

II.La representante del Estado, en escrito de contestación formuló la excepción de incompetencia en razón de materia al considerar que el asunto es competencia de la jurisdicción Contenciosa Administrativa, alegó. “(…) Se pretenden derechos sobre terrenos que forman parte del Patrimonio Natural del Estado, por constituir bosque un 97% de su cobertura y pide al Estado y otras instituciones el pago de daños y perjuicios por una eventual nulidad de la inscripción registral. Por tratarse de bienes demaniales su régimen jurídico, incluidos los modos de aprovechamiento, se rigen por las normas y principios del Derecho Administrativo. Por ello, debe valorarse desde la perspectiva del Derecho Público si es procedente la pretensión esgrimida y examinar, siempre bajo esa óptica, la legitimidad de los actos en que se apoya. Por la naturaleza del bien litigioso, tal valoración debe hacerse en la jurisdicción contencioso administrativo, a la luz de los criterios que la informan, a fin de ejercer la protección y vigilancia de los bienes públicos (Código Procesal Contencioso Administrativo, artículos. 1 y 36).

La competencia de los Tribunales de lo Contencioso-Administrativo y Civil de Hacienda sigue criterios diversos al derecho agrario, es improrrogable, y la regulan leyes especiales, posteriores a la Ley de Jurisdicción Agraria, de aplicación prevalente y acatamiento obligatorio, como lo son el Código Procesal Contencioso Administrativo…”. Mediante voto número 2024000331 de las catorce horas cincuenta y uno minutos del cinco de abril de dos mil veinticuatro, el Tribunal Agrario del Segundo Circuito Judicial de San José, rechazó la excepción de incompetencia y mantuvo la competencia de este asunto a cargo de los tribunales agrarios, señaló: “En voto 982 de 24.11.2017 emitido en este proceso, se rechazó la excepción de incompetencia que interpuso la reconventora Rymlau, por no ser oponible esa defensa en un escrito de demanda. Los argumentos expuestos por el Estado como reconvenido -que interviene en el proceso posterior a ese voto-, no son de recibo.

No se alegan aspectos sobrevinientes, que se desconociesen cuando se emitió, ni que hayan variado la situación de los bienes en litigio. El tema en discusión se relaciona con un alegado traslape que se afirma existe entre dos fincas que actualmente cuentan con título registral de propiedad privada; el origen de una de ellas relacionado con Ley 7599/1996, declarada inconstitucional en voto 8560-2001 de la Sala Cuarta Constitucional; los efectos de dicha situación; la nulidad de las escrituras, asientos registrales y planos relacionados con tales por el traslape referido. El Estado, a su vez, pide la nulidad de la inscripción de ambas fincas y sus planos por ser terrenos con bosque y considerar por ende que están dentro del Patrimonio Natural del Estado. Tal es un bien demanial conforme lo disponen los artículos 13 y 14 Ley Forestal 7575. Como se explicará, el que eventualmente pueda declararse lo último no cambia que la situación jurídica planteada involucra, en principio, la afectación a derecho reales de naturaleza privada.

Si se comprueba que el bien objeto del proceso es demanial ello puede incidir en el resultado, pero no es un factor que impida a los tribunales agrarios resolver el conflicto debidamente y aplicar las normas correspondientes, sea para tutelar la propiedad privada y otros derechos reales o, en su caso, el demanio público. Tampoco son factores que impidan a los tribunales agrarios conocer el conflicto, el que se reclame como acción accesoria el pago de daños y perjuicios ni el que participen como partes el Estado y una institución autónoma estatal como lo es el Inder. Se aclara al respecto que, si en alguna situación jurídica (que implique determinar las consecuencias o efectos jurídicos concretos que se relacionan o surgen ante una situación de hecho relevante para el Derecho) interviene el Estado o sus instituciones como poder público, los conflictos relacionados con tal deben resolverse a través de normas de Derecho Público.

Pero si intervienen sin potestades de imperio, se trata de una situación que debe resolver aplicando reglas del Derecho Privado (artículo 3 Ley General de Administración Pública). Existen así diversos supuestos en los cuáles, pese a participar en el proceso el Estado, un ente estatal o un órgano auxiliar de tal, por lo debatido, la competencia corresponde a la Jurisdicción Agraria (ver al respecto precedentes en votos 222 de 11.03.2015, 16 de 22.01.2009 y 246 de 17.03.2021). Además, en casos como el presente, por lo debatido, conforme lo disponen los numerales 1, 15, 22 Ley de Jurisdicción Agraria, en el tema de la competencia material, el principal criterio para fijarla no es el subjetivo (naturaleza organizativa de las partes), sino el de la actividad que se desarrolla o puede desarrollar en los bienes objeto de litigio y la naturaleza del presunto derecho debatido. En segundo lugar, lo que es objeto de pretensión no se puede considerar una situación jurídica que deba ser resuelta con base en normas y fines del Derecho Público, lo cual correspondería a una competencia exclusiva de la Jurisdicción Contenciosa Administrativa.

La tutela del dominio público es un deber que atañe a todo tipo de tribunal jurisdiccional, según sus competencias; máxime tratándose de inmuebles, porque pueden tener naturaleza agraria o bien ser bienes de interés ambiental, como sucede en el caso del Patrimonio Natural del Estado. Normas anteriores y posteriores al Código Procesal Contencioso-Administrativo: Ley 8508 del 28/04/ 2006, vigentes desde el 2008, así lo reconocen. Entre ellas del Código Penal (artículo 227: usurpación de dominio público); Ley de Informaciones Posesorias (artículo 7: permite titular áreas boscosas siempre que se demuestre los requisitos legales para ello); Código Procesal Civil (artículos 107 y 108, que se refieren a procesos sumarios en los cuáles puedan estar involucrados bienes demaniales) ... Tampoco es aplicable al caso, para efectos de determinar la competencia, lo reclamado en cuanto a que las normas del Código Procesal Contencioso-Administrativo son posteriores a las de la Ley de Jurisdicción Agraria.

La materia agraria es especial y las reformas que plantea ese Código a partir de su vigencia en el año 2008, no modificaron los criterios imperantes en cuanto a que es posible y pertinente que todo tribunal tutele el demanio público en la forma debida, cuando se pueda ver involucrado un bien con esa calificación en un proceso a su cargo. En este caso, como se indicó, se pretende la nulidad de escrituras, planos y asientos registrales de fincas de las partes actoras y reconventoras por alegarse existe una doble titulación y también la reivindicación. Esos reclamos se regulan por las reglas del Derecho Privado. El Estado, a través de la contrademanda, introduce otro tema a debatir: que los bienes en cuestión no pueden ser propiedad privada y por tanto pide la nulidad de sus asientos registrales y planos catastrados. Innegablemente, si lleva o no razón, eso deberá determinarse en la sentencia definitiva, antes de analizar las acciones de naturaleza privada referidas.

Pero su planteamiento no implica, como se explicó, que los tribunales agrarios carezcan de competencia para hacer el análisis respectivo y declarar lo que proceda en relación con lo debatido en este caso. Finalmente, de la lectura de la demanda no se observa que se esté solicitando la nulidad o revocatoria de acto administrativo alguno o de alguna conducta estatal que deba exclusiva y necesariamente ordenarse por un tribunal contencioso administrativo. Cancelar escrituras, planos y asientos registrales, cuando deban ser anulados, es una facultad que ostentan también los tribunales agrarios, civiles, penales, etc., conforme se establece en los artículos 471 a 477 Código Civil. De igual forma, todo tribunal está capacitado para aplicar normas que regulen la responsabilidad por daños, independientemente de que sean a favor o en contra del Estado o una de sus entidades, aplicando los criterios de imputación pertinentes a la situación debatida (numerales 41 Constitución Política, 701 a 707 Código Civil).

Conforme lo explicado, procede rechazar la excepción de incompetencia por razón de la materia, de conformidad con lo dispuesto en los numerales 1 a 4 Ley de Jurisdicción Agraria y 113 Ley Orgánica del Poder Judicial.”. La representante estatal en desacuerdo, presentó recurso de disconformidad, en el que alegó: “Fundamento mi disconformidad en los siguientes razonamientos:

  • 1)La reconventora pretende que se declaren derechos sobre terrenos que forman parte del Patrimonio Natural del Estado por constituir bosque un 97% de su cobertura.
  • 2)Se pretende que el Estado y otras instituciones cubran el pago de daños y perjuicios por una eventual nulidad de la inscripción registral. En ese sentido es necesario indicar que estaríamos debatiendo sobre bienes demaniales y al tratarse de un bien estatal, su régimen jurídico, incluidos los modos de aprovechamiento, se rigen por las normas y principios del Derecho Administrativo.
  • 3)Es necesario valorar si desde la perspectiva del Derecho Público es procedente la pretensión esgrimida y examinar, siempre bajo esa óptica, la legitimidad de los actos en que se apoya. Por la naturaleza del bien litigioso, tal valoración debe hacerse en la jurisdicción contencioso administrativo, a la luz de los criterios que la informan, a fin de ejercer la protección y vigilancia de los bienes públicos. Además, el Estado figura como parte demandada. (Código Procesal Contencioso Administrativo, arts. 1° y 36).
  • 4)La competencia de los Tribunales de lo Contencioso-Administrativo y Civil de Hacienda sigue criterios diversos al derecho agrario, es improrrogable, y la regulan leyes especiales, posteriores a la Ley de Jurisdicción Agraria, de aplicación prevalente y acatamiento obligatorio, como lo son el Código Procesal Contencioso Administrativo, Ley 8508/2008, arts. 1°, 2°, 3°, 5° y 36. 1. Es claro que la pretensión de este proceso involucra bienes demaniales por pertenecer al Patrimonio Natural del Estado, según se demuestra con oficio del SINAC-SE-IRT-038-2020, que consta en el expediente, y que indica que la finca 6-111169-000 con el plano catastrado número P-558109-99 presenta un 97% de cobertura forestal, lo que evidencia que en este caso estamos ante una indebida inscripción del dominio público.
  • 5)El régimen jurídico que disciplina la titularidad, uso y tutela de ese tipo de bienes, es de Derecho Administrativo, y las controversias que los involucren, por la especialidad de la materia, han de dilucidarse en la vía de lo Contencioso Administrativo. El Derecho Administrativo, se sabe, constituye un sistema autónomo, con sus propios institutos, fuentes, método de análisis, concepción dogmática, irreconciliable con la superposición de otras ramas jurídicas sin el debido soporte legal.
  • 6)La competencia de los Tribunales de lo Contencioso-Administrativo y Civil de Hacienda sigue criterios diversos del derecho agrario, es improrrogable, y la regulan leyes especiales, posteriores a la Ley de Jurisdicción Agraria, de aplicación prevalente y acatamiento obligatorio, como son la Ley 7333/1993, reforma integral a la Ley Orgánica del Poder Judicial, artículo 110, inciso 3°, el Código Procesal Contencioso Administrativo, Ley 8508/2008, arts. 1°, 2°, 3°, 5° y 36; la Ley 7788/1998, de Biodiversidad, art. 108, etc… En virtud de lo anterior, solicito que se declare que la competencia para tramitar este proceso corresponde a la jurisdicción contencioso administrativa.”. En razón de lo anterior, se remitió el asunto en consulta ante esta Sala.

III.La discusión aquí suscitada, tiende a determinar si el conflicto es de orden contencioso administrativo, o bien, agrario. Esta Sala ha dado cabida a la competencia agraria en función de las normas genéricas establecidas en el artículo 1 y 2 de la Ley de Jurisdicción Agraria, cuando establece que ésta conocerá y resolverá en forma exclusiva de los conflictos que se susciten con motivo de la aplicación de la legislación agraria y de las disposiciones jurídicas que regulan las actividades de producción animal o vegetal o bien, conexas de transformación, industrialización, comercialización y enajenación de productos agrarios. En este caso en particular, del análisis de autos se observa, que la pretensión objeto del proceso corresponde el declarar la nulidad de escrituras, planos y asientos registrales de las propiedades en disputa, por tener supuestamente una doble titulación y un traslape. Aunado, pretenden se ordene la reivindicación.

El Estado, a su vez, pide la nulidad de la inscripción de ambas fincas y sus planos por ser terrenos con bosque y considerar, por ende, que están dentro del Patrimonio Natural del Estado. En resumen, se discute la determinación de derechos sobre propiedades de naturaleza agraria, pero con características de demanialidad. Al respecto, el artículo 22 de la Ley de la Jurisdicción Agraria señala: “Artículo 22. En los negocios de conocimiento de la jurisdicción agraria, son parte: (...) ch) La Procuraduría General de la República, en todos los asuntos relativos a la tutela del dominio público y al ejercicio de las atribuciones que la ley le confiere en esta materia”. Como se ve, dicho numeral prevé y permite tener como parte del proceso al Estado por medio de la Procuraduría General de la República, en los asuntos relativos a la tutela del dominio público. Entonces, el simple hecho de que una de las partes sea el Estado, y se discuta sobre un bien inmueble con presunta demanialidad, esto no lo convierte en un proceso contencioso administrativo, máxime si dicha propiedad existe actividad agraria o cuando sea parte un empresario agrícola, como sucede en este caso, que la parte actora es un empresario agrícola.

Consecuentemente, se reconoce que el conflicto resulta de naturaleza agraria, por lo que su conocimiento en razón de materia y territorio, según el artículo, 1,2 y 22 de la Ley de la Jurisdicción Agraria, 8.1, 8.3, y 8.3.1.1 del Código Procesal Civil, corresponde al Juzgado Agrario de Puntarenas que fue donde inició y donde se venía tramitando.

POR TANTO

Se declara que el conocimiento del presente proceso corresponde al Juzgado Agrario de Puntarenas. - Luis Guillermo Rivas Loaiciga Rocío Rojas Morales Damaris Vargas Vásquez Jorge Leiva Poveda Carlos Guillermo Zamora Campos
