Document Review Decision No. 002407-C-S1-2023 SALA PRIMERA DE LA CORTE SUPREMA DE JUSTICIA. San José, at eleven forty-eight on catorce de diciembre de dos mil veintitres.

In proceedings (proceso) brought by PARQUE DE PAVONES DEL PACÍFICO S.A., represented by Luis Miguel Carballo Pérez, against ALAN RICHARD NELSON, the Tribunal Colegiado de Primera Instancia Civil del I Circuito Judicial de la Zona Sur (Pérez Zeledón) declared that it lacked subject-matter jurisdiction (incompetencia por razón de la materia) and ordered that the case file be forwarded to the Agrarian jurisdiction (jurisdicción Agraria) to hear these proceedings. The plaintiff appealed the decision, and the matter was therefore referred to this Chamber for consultation.

CONSIDERATIONS

I.The plaintiff brought proceedings seeking the following: “1. Based on the facts set forth, I request a declaration that PARQUE PAVONES DEL PACIFICO SOCIEDAD ANONIMA owns 100% of the share capital (Capital Social) of CARAO SOCIEDAD ANONIMA, as demonstrated by the share-capital certificate. 2. That all General Shareholders’ Meetings held by Mr. Alan Richard Nelson, mentioned in the second, ninth, and tenth facts, be declared null and void, as he neither held nor at any time represented the company’s share capital. 3. That all out-of-court agreements and contracts entered into by Alan Richard Nelson, in his capacity as president—a position he acquired unlawfully—with Mr. José Ángel Figueroa Castillo and others mentioned in the twentieth fact be declared null and void. 4. That the judgments granting title to Mr. José Ángel Figueroa Castillo and all transfers made by him to third parties be annulled. 5.

That all persons currently occupying land belonging to our client be evicted. 6. That Ms. Valeria de los Ángeles Reyes Aguirre, a resident of San José, San Rafael de Escazú, 100 meters north of Mini Super La Primavera, first entrance on the right, dead-end street, second-to-last house on the right, holder of identity card number 1-1750-0633, be summoned personally—and not through a special attorney-in-fact—to provide a party statement and confession (declaración de parte y confesional).”. –

II.By Decision No. 2023000075, issued at 13:51 on 27 de abril del año 2023, the Tribunal Colegiado de Primera Instancia Civil del I Circuito Judicial de la Zona Sur declared that it lacked subject-matter jurisdiction, stating: “The claim or claims (pretensión/es) asserted in these proceedings, in relation to the facts recounted in the complaint or initial filing, concern the invalidity of resolutions adopted at General Meetings allegedly held by co-defendant Alan Richard Nelson and, as a consequence, the return to the plaintiff company of the real properties described in the facts of the complaint, namely: property registration number 33989-000, consisting of land for reforestation with a house and measuring two hundred forty-six thousand four hundred two meters and thirty-one square decimeters, as shown by the certificate submitted and fact number 12; property number 138033-000, consisting of pastureland and measuring two thousand five hundred eighty-one meters and sixty-eight square decimeters; property 179460-001, consisting of grazing land and measuring thirty-seven thousand eight hundred eighty-nine meters and fifty-seven square decimeters; property registration number 204814-000, consisting of pastureland and measuring nineteen thousand nine hundred thirty-nine square meters; property registration number 228977-000, consisting of residential-lot land and measuring sixty-one thousand seven hundred fifty-six square meters; and property registration number 241535-000, consisting of residential-lot land and forest and measuring five thousand square meters.

It may be inferred from the foregoing that the legal issue at stake in these proceedings is governed by agrarian law (derecho agrario), since the properties involved in the dispute are agrarian in nature and extensive in size. Special jurisdiction (competencia especial) also derives from the provisions of Article 2 of the Ley de Jurisdicción Agraria.”. The appellant, in turn, stated: “Referring this matter to an Agrarian Court merely because some of the land indirectly in dispute is located in areas that might have an agrarian use potential is incorrect. None of the parties to these proceedings is an agrarian operator. These proceedings primarily concern the invalidity of minutes, the granting of improper powers of attorney and their fraudulent use, sales of land and rights, and so forth. Subject-matter jurisdiction (competencia objetiva) clearly lies in civil and commercial matters and, in any event, under the principle of residual jurisdiction (principio de competencia residual), it is civil because it does not fall within any other subject matter.”. -

III.The dispute arising here concerns whether the conflict is civil or agrarian in nature. This Chamber has recognized agrarian jurisdiction based on the general rules established in Articles 1 and 2 of the Ley de Jurisdicción Agraria, which provide that it shall have exclusive jurisdiction to hear and decide disputes arising from the application of agrarian legislation and legal provisions governing animal or plant production activities, or related activities involving the processing, industrialization, marketing, and transfer of agricultural products, as is the case here. Although the plaintiff has stated that neither party is an agricultural producer, this Chamber observes, in images 150, 162, 166, 170, 174, 177, and 180 of the electronic court file, the registry certificates for the real properties whose occupants the plaintiff seeks to have evicted, as well as the invalidation of the titles and their respective transfers.

Those certificates establish that the properties, which are separate from one another, are classified as “for reforestation,” “grazing land,” “pastureland,” “residential-lot land,” and “residential-lot land and forest,” and measure from 5.000 square meters to 246.402 meters and 31 square decimeters. Although there is no exact measurement for determining whether real property is deemed to be used for agrarian activity, the Reglamento de Fraccionamiento y Urbanizaciones provides as follows in section 30: “Article 30. Minimum dimensions of parcels in subdivisions (fraccionamientos) for agricultural, livestock, forestry, or mixed purposes. According to the land-use-capability classes established in the Metodología para la determinación de la Capacidad de Uso de las Tierras de Costa Rica, Decreto Ejecutivo N°41960-MAGMINAE, its amendments, or any regulations replacing it, agricultural, livestock, forestry, or mixed parcels classified as I, II, III, IV, V, and VI must have a minimum area of 5 000,00 m².

All of the foregoing is without prejudice to the provisions issued by the municipality in its zoning plan (plan regulador), the authorities with jurisdiction over environmental matters, and the regional plans currently in force. When the property is located within the Gran Área Metropolitana, the minimum area for agricultural parcels is 7000,00 m², as established by the Reforma Plan Regional Desarrollo Urbano Gran Área Metropolitana, Decreto Ejecutivo N° 25902-MIVAH-MP-MINAE, and Decreto Ejecutivo N°38334-PLAN-MINAE-MIVAH-MOPT-S-MAG, entitled: Aprueba Plan GAM 2013-2030, Actualización del Plan Regional de la Gran Área Metropolitana, their amendments, or any regulations replacing them.”. Accordingly, as shown by the evidence in the case file, the Tribunal Colegiado de Primera Instancia Civil del I Circuito Judicial de la Zona Sur was correct in finding that the properties are productive in nature or constitute properties suitable for agrarian use (fundo de aptitud agraria).

It follows from the foregoing that the matter involves animal or plant production activities, or related activities involving the processing, industrialization, marketing, and transfer of agricultural products. Consequently, the dispute is agrarian in nature and jurisdiction to hear it lies with the Juzgado Agrario de Corredores. -

THEREFORE

Revisión del Documento Res. Nº 002407-C-S1-2023 SALA PRIMERA DE LA CORTE SUPREMA DE JUSTICIA. San José, a las once horas cuarenta y ocho minutos del catorce de diciembre de dos mil veintitres .

En proceso interpuesto por PARQUE DE PAVONES DEL PACÍFICO S.A., representado por Luis Miguel Carballo Pérez, contra ALAN RICHARD NELSON; el Tribunal Colegiado de Primera Instancia Civil del I Circuito Judicial de la Zona Sur (Pérez Zeledón) se declaró incompetente por razón de la materia, ordenando el envío de los autos a la jurisdicción Agraria para el conocimiento del presente proceso. La parte actora apeló lo resuelto, por lo que el asunto se remite en consulta ante esta Sala.

CONSIDERANDO

I.La parte actora interpuso proceso en el cual solicita: “1. Con fundamento en los hechos expuestos, solicito se declare que la Sociedad PARQUE PAVONES DEL PACIFICO SOCIEDAD ANONIMA es la dueña del 100% del Capital Social de la compañía CARAO SOCIEDAD ANONIMA, según se demuestra en certificación de capital accionario. 2. Que se declaren nulas la totalidad de las Asambleas Generales de accionistas realizadas por el señor Alan Richard Nelson, mencionadas en los hechos segundo, hecho noveno y hecho decimo sin disponer ni en ningún momento ni representar el capital social de la empresa. 3. Que se declaren nulos todos los acuerdos extrajudiciales y contratos que Alan Richard Nelson en su capacidad de presidente, posición que adquirió ilegalmente, suscribió con el señor José Ángel Figueroa Castillo y otros mencionados en el hecho vigésimo. 4. Que se anulen las sentencias que le otorgaron títulos al señor José Ángel Figueroa Castillo y la totalidad de los traspasos realizados por él a favor de terceros. 5.

Que se proceda al desalojo de todas aquellas personas que actualmente ocupan terrenos de nuestra representada. 6. Que se llame a declaración de parte y confesional y no por medio de Apoderado especial a la señorita Valeria de los Ángeles Reyes Aguirre vecina de San José, San Rafael de Escazú, del Mini Super La Primavera, 100 metros al norte primera entrada a mano derecha, calle sin salida, penúltima casa a mano derecha, portadora de la cedula de identidad número 1-1750-0633.”. –

II.Mediante resolución Nro. 2023000075 de las 13 horas con 51 minutos del día 27 de abril del año 2023, el Tribunal Colegiado de Primera Instancia Civil del I Circuito Judicial de la Zona Sur se declaró incompetente en razón de la materia, señalando: "La (s) pretensión (es) establecida (s) en este proceso en relación con los hechos narrados en la demanda o gestión inicial, comprende la nulidad de acuerdos de Asambleas Generales supuestamente celebradas por el co-demandado Alan Richard Nelson, y como consecuencia se reintegre los bienes inmuebles descritos en los hechos de la demanda a la sociedad actora, sea la finca matrícula número 33989-000 la cual es terreno para reforestar con una casa con una medida de doscientos cuarenta y seis mil cuatrocientos dos metros con treinta y un decímetros cuadrados, tal y como se aprecia de la certificación aportada y del hecho número 12, la finca número 138033-000 de naturaleza terreno de pasto con una medida de dos mil quinientos ochenta y un metros con sesenta y ocho decímetros cuadrados, la finca 179460-001 terreno de potrero con una medida de treinta y siete mil ochocientos ochenta y nueve metros con cincuenta y siete decímetros cuadrados, la finca matrícula número 204814-000 de naturaleza terreno de pasto con una medida de diecinueve mil novecientos treinta y nueve metros cuadrados, la finca matrícula número 228977-000 terreno de solar con una medida de sesenta y un mil setecientos cincuenta y seis metros cuadrados, la finca matrícula número 241535-000 naturaleza terreno de solar y bosque con una medida de cinco mil metros cuadrados.

De lo anterior se infiere que el tema jurídico objeto del proceso es regulado por el derecho agrario; ya que las propiedades que forman parte del litigio son de naturaleza agraria y de gran extensión. La competencia especial se deriva además de lo dispuesto por en el artículo 2 de la Ley de Jurisdicción Agraria.”. Por su parte, el apelante indicó: “El derivar este asunto a un Juzgado Agrario solamente porque algunos de los terrenos en disputa indirecta se encuentran en zonas que podrían tener vocación agraria no es correcto. Ninguna de las partes de este proceso es un operador agrario. El presente proceso tiene que ver principalmente con nulidad de actas, otorgamiento de poderes irregulares y su uso fraudulento, ventas de terrenos y derechos, etc. La competencia objetiva es de materia evidentemente civil y comercial y en todo caso por principio de competencia residual es civil ya que no corresponde a ninguna otra materia.”. -

III.La discusión aquí suscitada, tiende a determinar si el conflicto es de orden civil o agrario. Esta Sala ha dado cabida a la competencia agraria en función de las normas genéricas establecidas en el artículo 1 y 2 de la Ley de Jurisdicción Agraria, cuando establece que ésta conocerá y resolverá en forma exclusiva de los conflictos que se susciten con motivo de la aplicación de la legislación agraria y de las disposiciones jurídicas que regulan las actividades de producción animal o vegetal, o conexas de transformación, industrialización, comercialización y enajenación de productos agrarios, lo que sucede en el caso de estudio. Si bien la parte accionante ha señalado que ninguna de las partes es productora agraria, lo cierto es que esta Sala observa a imágenes 150, 162, 166, 170, 174, 177 y 180 del expediente judicial electrónico, las certificaciones registrales de los bienes inmuebles que se pretenden declarar su desalojo, así como la nulidad de los títulos y de sus respectivos traspasos.

En dichas certificaciones se determina que esos bienes los cuales son independientes entre sí, tener naturaleza “para reforestar”, “terreno de potrero”, “terreno de pasto”, “terreno de solar”, “terreno de solar y bosque”, y con mediciones que van desde los 5.000 metros cuadrados hasta los 246.402 metros con 31 decímetros cuadrados. Si bien no existe una medida exacta para determinar que un bien inmueble es considerado de actividad agraria, el Reglamento de Fraccionamiento y Urbanizaciones establece en su numeral 30 lo siguiente: “Artículo 30. Dimensiones mínimas de parcelas en fraccionamientos con fines agrícolas, pecuarios forestales o mixto. Según las clases de capacidad de uso establecidas en la Metodología para la determinación de la Capacidad de Uso de las Tierras de Costa Rica, Decreto Ejecutivo N°41960-MAGMINAE, sus reformas o normativa que le sustituya, las parcelas agrícolas, pecuarias, forestales o mixtas cuya clasificación sea I, II, III, IV, V y VI deben tener un área mínima de 5 000,00 m².

Todo lo anterior sin perjuicio de las disposiciones emitidas por la municipalidad en su plan regulador, los entes competentes en materia ambiental y los planes regionales vigente. Cuando el predio se localice dentro del Gran Área Metropolitana, el área mínima para parcelas agrícolas es 7000,00 m², según lo establece la Reforma Plan Regional Desarrollo Urbano Gran Área Metropolitana, Decreto Ejecutivo N° 25902-MIVAH-MP-MINAE, el Decreto Ejecutivo N°38334-PLAN-MINAE-MIVAH-MOPT-S-MAG, denominado: Aprueba Plan GAM 2013-2030, Actualización del Plan Regional de la Gran Área Metropolitana, sus reformas o normativa que les sustituya.”. Por ello, tal y como se observa de la prueba que compone los autos, lleva razón el Tribunal Colegiado de Primera Instancia Civil del I Circuito Judicial de la Zona Sur al indicar que los bienes tienen naturaleza productiva o fundo de aptitud agraria. Por lo anterior, se desprende que estamos ante actividades de producción animal o vegetal, o conexas de transformación, industrialización, comercialización y enajenación de productos agrarios. Consecuentemente, el conflicto resulta de naturaleza agraria, por lo que su conocimiento corresponde al Juzgado Agrario de Corredores. -

POR TANTO
