PJEDITOR Document Res. 002605-C-S1-2022 FIRST CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at eleven fifty-six a.m. on November twenty-nine, two thousand twenty-two.

In the summary demolition proceeding (proceso sumario de derribo) filed by VIRGILIO ANGEL SOTO VEGA, representing himself, the Agrarian Court of the Second Judicial Circuit of San José declared that it lacked subject-matter jurisdiction to hear this matter and therefore referred the case file to the Civil and Labor Court of Cañas. The latter court disagreed with that ruling, and the jurisdictional dispute was therefore referred to this Chamber.

WHEREAS

I.The plaintiff filed a summary demolition proceeding, requesting: “In view of the foregoing and in accordance with the recommendation made to the petitioner in the third section of the decision, I request that this Court assess and rule on cutting the tree and harvesting the timber to build my humble home, through a demolition injunction (interdicto de derribo).” By decision No. 145-C-21, issued at one fifty p.m. on February eighteen, two thousand twenty-one, the Agrarian Court of the Second Judicial Circuit of San José declared that it lacked jurisdiction, stating: “…the Agrarian Jurisdiction has jurisdiction to hear possessory injunction proceedings (procesos interdictales) when they concern properties devoted to agricultural activities (actividades agrarias) (articles 1 and 2, subsections b), d), and 4 of the Agrarian Jurisdiction Law). In this case, the requested relief is the felling of a tree located on land intended for construction.

It is not agricultural property, nor are agricultural activities carried out there; moreover, the land is very small (507 square meters) and is located in Las Juntas de Abangares, Guanacaste.” The Civil and Labor Court of Cañas, for its part, stated: “this Court does not agree with the Agrarian Court’s finding that it lacked jurisdiction because, regardless of the size of the lot on which the tree or tree trunk is located, for which the petitioner seeks permission to cut and harvest the timber, this is a matter of environmental significance that, notwithstanding the size of the property, is unquestionably agrarian. It should be noted that the petitioner submits administrative decision number AT-AT01-PAF-PP-0001-2021 dated 20-01-2021, issued by MINISTERIO DE AMBIENTE Y ENERGÍA, through which that agency denied his request to cut the tree and harvest the timber (agricultural activities, not civil activities); and that agency’s precise reason for denying the permit requested by the petitioner was that the tree for which the cutting and timber-harvesting permit was sought is located within a protection area (área de protección) defined in articles 33 and 34 of the Ley Forestal. The administrative decision attached by the plaintiff to his filing even states that ‘the tree is located near a body of water.’” –

II.In the case under review, the requested relief is the felling and utilization of a “Guanacaste” tree located on a property in Santa Lucía, Las Juntas de Abangares, Guanacaste. According to the “Decision on a Permit to Cut Trees in Agricultural-Use Areas Without Forest under the Small-Permit Modality” (Resolución para Permiso de Corta de Árboles en Áreas de Uso Agropecuario sin Bosque bajo modalidad de permiso pequeño), No. AT-AT01-PAF-PP-0001-2021, issued by Sistema Nacional de Conservación, the tree is located within a stream protection area, at a distance of 12 meters (Ley Forestal No. 7575, articles 33 and 34). Under article 33 of those regulations, strips measuring 15 meters in rural areas and 10 meters in urban areas, measured horizontally on both sides along the banks of rivers, streams, or brooks when the land is flat, and 50 meters horizontally when the terrain is uneven, are protection areas and, consequently, form part of the public domain, over which the State exercises guardianship. Because the area that the petitioner seeks to use may form part of the strip deemed a protection area, the Contentious-Administrative Jurisdiction (Jurisdicción Contencioso Administrativa), specifically the Contentious-Administrative and Civil Treasury Court, has jurisdiction to hear this matter (art. 110 of the Organic Law of the Judiciary).

POR TANTO

Documento PJEDITOR Res. 002605-C-S1-2022 SALA PRIMERA DE LA CORTE SUPREMA DE JUSTICIA. San José, a las once horas cincuenta y seis minutos del veintinueve de noviembre de dos mil veintidos .

En proceso sumario de derribo interpuesto por VIRGILIO ANGEL SOTO VEGA, quien se representa a sí mismo; el Tribunal Agrario del II Circuito Judicial de San José, declaró la incompetencia por razón de la materia para conocer el presente asunto, por lo que remitió los autos al Juzgado Civil y Trabajo de Cañas. Esta última jurisdicción disintió de lo resuelto, por lo que se remitió el asunto en conflicto ante esta Sala.

CONSIDERANDO

I.La parte actora interpuso proceso sumario de derribo, donde solicita: “Por lo antes expuesto y atendiendo a la recomendación del administrado, en el aparte tercero de la resolución, solicito ante ese Juzgado la valoración y resolución para cortar y aprovechar la madera para construir mi humilde casa, por medio de interdicto de derribo”. Mediante resolución Nro. 145-C-21 de las trece horas cincuenta minutos del dieciocho de febrero de dos mil veintiuno, el Tribunal Agrario del II Circuito Judicial de San José declaró la incompetencia señalando: “…la Jurisdicción Agraria es competente para conocer de los procesos interdictales, cuando los mismos se refieran a fundos dedicados a las actividades agrarias (artículos 1 y 2 inciso b), d) y 4 de la Ley de Jurisdicción Agraria. En el presente caso, se pretende el derribo de un árbol ubicado en un terreno para construir. No se trata de un fundo agrario, ni se ejercitan actividades agrarias, además de la escasa dimensión del terreno (507 metros cuadrados), está ubicado en Las Juntas de Abangares, Guanacaste”.

Por su parte, el Juzgado Civil y Trabajo de Cañas indicó: “no se comparte este criterio de incompetencia utilizado por el Juzgado Agrario por cuanto independientemente de la medida del lote en el cual se encuentra el árbol o tronco de árbol, sobre el que el solicitante pide permiso de cortar y aprovechar la madera; nos encontramos frente a un asunto de importancia ambiental, que resulta a pesar de la medida de terreno, indiscutiblemente agrario. Véase que el solicitante aporta la resolución administrativa número AT-AT01-PAF-PP-0001-2021 de fecha 20-01-2021 del MINISTERIO DE AMBIENTE Y ENERGÍA, mediante la cual en esa sede, se resuelve negativamente su petición de corta y aprovechamiento de madera (actividades agrarias, no civiles), y precisamente el argumento de esa entidad para denegar el permiso solicitado por el promovente de la gestión, es que el árbol sobre el cual se tramita permiso de corta y aprovechamiento de madera, se encuentra dentro de un área de protección definido en el artículo 33 y 34 de la Ley Forestal. Incluso se lee en la resolución administrativa que el actor agrega a su escrito que " hay una cercanía entre el árbol y un cuerpo de agua". –
