July 8, 2026 PGR-C-106-2026 Dear Sir, Alex Solano Araya President, Association for the Administration of the Water Supply and Sewerage System of San Isidro de El Guarco With the approval and at the direction of the Attorney General of the Republic, this Office responds to the request submitted by letter dated January 27, 2026, signed by Mr. Alex Solano Araya, in his capacity as President of the Association for the Administration of the Water Supply and Sewerage System of San Isidro de El Guarco, Cartago (hereinafter, the ASADA of San Isidro de El Guarco or the Association), received by this Office of the Attorney General on February 12, 2026, by which the following is requested:

The requests submitted by the petitioner focus on the protection zones (áreas de protección) of the concession-held springs (nacientes) from which the Association draws water to supply the community of San Isidro de El Guarco, as well as on the situation of certain properties (fincas) adjoining those zones and the Mollejones stream (quebrada Mollejones), currently subject to possessory title proceedings (información posesoria) before the Agrarian Court (Juzgado Agrario) of Cartago.

Specifically, the petitioner asks this Office of the Attorney General to indicate whether it is legally possible for the Costa Rican Water and Sewerage Institute (Instituto Costarricense de Acueductos y Alcantarillados, AyA) to declare the protection zones of the concession-held springs located on privately owned properties as areas of public domain (dominio público).

The petitioner also asks whether the protection zones located within a watershed (cuenca hidrográfica), corresponding to a perimeter of up to 300 meters around the water intake sites (sitios de captación) of the springs that supply drinking water to the community, and which are situated on unregistered properties (fincas sin inscribir), may or may not be subject to possession or titling through possessory title proceedings brought by private individuals.

Finally, the petitioner asks this Office of the Attorney General to direct an advisory opinion to the Agrarian Court of Cartago in the possessory title proceedings filed under case numbers 21-000014-0699-AG-5 and 22-000181-0699-AG, to the effect that the protection zones of concession-held springs cannot be subject to possessory title proceedings by private individuals.

ON THE QUERIES SUBMITTED TO THE OFFICE OF THE ATTORNEY GENERAL OF THE REPUBLIC The advisory function assigned to the Office of the Attorney General of the Republic is expressly governed by Article 1 of its Organic Law, Law No. 6815 of September 27, 1982, as a technical-legal competence aimed at ensuring the correct interpretation and application of the legal system by the Public Administration, in protection of the principle of legality (principio de legalidad), the public interest, and legal certainty (seguridad jurídica). This function does not operate without restrictions; rather, it is subject to strict compliance with the admissibility requirements set forth in Articles 3(b), 4, and 5 of that same body of law, which delimit both the objective and subjective scope of the advisory function.

From the systematic and consistent interpretation of those statutory provisions, this Office of the Attorney General has developed a uniform doctrinal line around three minimum and indispensable requirements for the admissibility of queries submitted for its consideration, which constitute true procedural prerequisites whose absence invariably determines, as a matter of law, the legal impossibility of issuing a binding advisory opinion (dictamen).

First, the subject matter of the query must be presented in a clear, precise, and concrete manner, and must relate exclusively to legal questions formulated in the abstract or in general terms. This requirement means that the query may not encompass, directly or indirectly, questions referring to specific or individualized cases, matters pending resolution by the active Administration, requests to review or evaluate specific administrative acts or decisions already adopted, or the review of technical reports or legal opinions previously issued. Likewise, matters submitted to judicial jurisdiction, issues falling within the competence of another State body, and, in general, any request seeking to satisfy a personal or particular interest of the official or individual submitting the query are expressly excluded, as such requests distort the institutional purpose of the advisory function and divert it toward attending to individual interests.

Second, pursuant to Article 4 of the Organic Law of the Office of the Attorney General of the Republic, No. 6815, the query must be accompanied by the legal opinion of the legal counsel (asesoría jurídica) of the consulting institution, addressing each and every issue submitted for consideration. This requirement is not a mere formality; it is a substantive condition that allows this Office to learn the legal position previously taken by the Administration, to assess the legal arguments already analyzed internally, and to exercise its advisory function in a complementary manner, without replacing or displacing the institutional legal counsel, in strict respect for the principle of administrative self-organization and the internal distribution of competencies.

Finally, it is established as an indispensable requirement that the query be submitted by the administrative head (jerarca administrativo) of the respective institution. This prerequisite reflects both the binding nature of the advisory opinions issued by the Office of the Attorney General of the Republic and the principle of administrative hierarchy, since only the administrative head holds the organic representation necessary to institutionally commit the consulting Administration and to request a legal opinion that, by mandate of law, is binding upon it. Accordingly, requests brought by officials acting in a personal capacity, bodies lacking hierarchical competence, or individuals outside the Public Administration do not have standing to validly invoke the advisory function.

The foregoing is closely related to Article 2 of the Organic Law of the Office of the Attorney General of the Republic, No. 6815, under which the advisory opinions and rulings of this body constitute administrative case law (jurisprudencia administrativa) that is binding upon the Public Administration. Precisely because of that binding character, only those who hold the organic representation of the consulting institution—that is, its administrative head—are empowered to commit it by submitting a query, since it is that authority who is responsible for assuming, on behalf of the Administration, the legal consequences of the binding opinion issued.

This interpretive line has been consistently and repeatedly upheld by the Office of the Attorney General of the Republic in numerous advisory opinions, among which may be cited, by way of illustration, advisory opinions No. C-157-2013 of August 19, 2013; C-121-2014 of April 8, 2014; C-099-2016 of April 29, 2016; C-377-2019 of December 19, 2019; C-080-2020 of March 4, 2020; C-277-2020 of July 10, 2020; C-065-2021 of March 4, 2021; PGR-C-110-2023 of May 24, 2023; and PGR-C-055-2025 of March 17, 2025, among many others, in which it has been reaffirmed that failure to comply with any of the stated requirements determines, by operation of law, the inadmissibility of the query, in strict adherence to the principle of rule of law (principio de juridicidad) that governs the conduct of the Costa Rican Public Administration.

ON THE PRIVATE LEGAL NATURE OF THE ASSOCIATION FOR THE ADMINISTRATION OF THE WATER SUPPLY AND SEWERAGE SYSTEM OF SAN ISIDRO DE EL GUARCO, THE ABSENCE OF A LEGAL OPINION, AND THE SUBMISSION OF A SPECIFIC CASE THAT IS SUB JUDICE, AS GROUNDS FOR INADMISSIBILITY OF THE REQUEST:

In accordance with the Costa Rican legal system currently in force, it is clearly established that the Office of the Attorney General of the Republic is the superior advisory, technical-legal body of the Public Administration, in the terms set forth in Article 1 of its Organic Law, Law No. 6815 of September 27, 1982. This status means that the advisory competence of the Office is exercised exclusively with respect to queries submitted by the State, and only in relation to legal questions formulated in the abstract or in general terms, in accordance with the legally established parameters.

The powers of the Office of the Attorney General of the Republic are expressly delimited in Article 3 of the Organic Law of the Office of the Attorney General of the Republic, and they do not include responding to queries submitted by private law entities, even when those entities carry out activities of public interest. In the present case, the Association for the Administration of the Water Supply and Sewerage System of San Isidro de El Guarco is a public utility association (asociación de utilidad pública), incorporated and registered under the Law of Associations (Ley de Asociaciones), No. 218 of August 8, 1939, and therefore has an essentially private legal nature—a status that is not altered by the fact that it provides the rural water supply service by delegation from AyA, pursuant to Article 2(g) of the Constitutive Law of the Costa Rican Water and Sewerage Institute, No. 2726 of April 14, 1961, and the Regulation of Associations for the Administration of Community Water Supply and Sewerage Systems (Reglamento de las Asociaciones Administradoras de los Sistemas de Acueductos y Alcantarillados Comunales), Decreto Ejecutivo No. 32529-S-MINAE of February 2, 2005, and its amendments.

This Office of the Attorney General has repeatedly and consistently maintained that the Associations for the Administration of Water Supply and Sewerage Systems (ASADAS) are legal entities of a private nature that carry out a task of public interest—a circumstance that does not alter their associative character nor transform them into part of the Public Administration for purposes of invoking the binding advisory function of this superior advisory body. The special subjection relationship (sujeción especial) these associations maintain with AyA—by virtue of the powers of direction, control, and oversight that AyA exercises over them—does not alter their private legal nature nor, consequently, entitle them to request a binding opinion from this Office.

Therefore, since there is no express provision authorizing this advisory body to render a legal opinion on queries submitted by associations of a private nature, and since the ASADA of San Isidro de El Guarco is not a public institution nor is its president the administrative head of an entity forming part of the Public Administration, it is legally impermissible to address the request submitted by Mr. Alex Solano Araya in his capacity as president of that Association. This limitation holds even when the consulting association provides a public service by delegation, since, as has been consistently reiterated, only the administrative heads of public administrations are legally empowered to request a binding opinion from the Office of the Attorney General of the Republic. In this regard, reference may be made, among others, to advisory opinions PGR-C-329-2021 of November 26, 2021, PGR-C-211-2024 of November 20, 2024, and PGR-C-057-2024 of April 1, 2024.

With specific regard to the legal nature of the Associations for the Administration of Water Supply and Sewerage Systems, this Office has consistently maintained that such associations are legal entities of a private nature that carry out a task of public interest, without this affecting their associative character. In this regard, reference may be made to advisory opinions C-190-96 of November 27, 1996; OJ-066-2002 of April 30, 2002; C-169-2007 of May 28, 2007; C-061-2008 of March 4, 2008; and, more recently, PGR-C-123-2024, in which it was reiterated that, in the case of associations of a private legal nature, the Office of the Attorney General of the Republic is not legally empowered to exercise its advisory function with respect to the requests they submit, as they do not form part of the Public Administration within the meaning of Articles 1, 3, and 4 of this Office's Organic Law.

Aside from the foregoing, Mr. Alex Solano Araya lacks legal standing to submit formal queries to the Office of the Attorney General of the Republic, since, although he holds the representation of the ASADA of San Isidro de El Guarco under that Association's own bylaws, the Association does not have the status of a public institution, nor does its president hold the status of administrative head of an entity forming part of the Public Administration.

Additionally, it is noted that, even though the request was signed by Mr. Solano Araya invoking his capacity as president of the Association's Board of Directors, this does not alter the foregoing analysis, since the admissibility defect does not stem from a representational deficiency within the Association itself, but from the Association's private legal nature, which excludes it from the subjective scope of application of Articles 1, 3, and 4 of the Organic Law of the Office of the Attorney General of the Republic.

Consequently, the private legal nature of the ASADA of San Isidro de El Guarco constitutes, in and of itself, a sufficient ground to determine the legal impermissibility of the request, since the indispensable subjective prerequisite (presupuesto subjetivo) for invoking the binding advisory function of this Office is not met—a function that is strictly reserved for queries submitted by the Public Administration, in protection of the public interest and legal certainty; this is without prejudice to the additional and independent deficiencies set out below.

In addition to the foregoing, the second admissibility requirement imposed by Article 4 of the Organic Law of the Office of the Attorney General of the Republic is in any event also not met. Indeed, upon reviewing the request, it is found that it is not accompanied by a legal opinion issued by the Association's legal counsel that concretely and conclusively analyzes the matters submitted for consideration. The only item on record is a notarial certification (razón notarial) by which Lic. Gerardo Cerdas Rojas attests to the authenticity of the petitioner's signature—an act limited to certifying the identity of the signatory, which in no way constitutes a legal opinion on the merits of the matter consulted. Accordingly, the request also fails to satisfy the requirement of a prior institutional legal opinion, which constitutes an autonomous and additional ground for inadmissibility.

Likewise, non-compliance with the first admissibility requirement is also noted, since the matters queried are not framed in generic or abstract legal terms, but instead openly refer to a specific and individualized situation: particular springs located on identified properties, a parcel whose owner—a foreign national—has died, a stream identified as Mollejones, and an area of approximately nine hectares in the possession of the requesting Association. Moreover, the request itself expressly acknowledges that those areas are the subject of two possessory title proceedings currently before the Agrarian Court of Cartago, under case numbers 21-000014-0699-AG-5 and 22-000181-0699-AG, with respect to which the petitioner even asks this Office to direct an advisory opinion to that judicial body. This is, therefore, a matter submitted to judicial authority, on which this Office is expressly prohibited from issuing an opinion in the exercise of its advisory function, as well as a specific case that falls outside the abstract and general scope that characterizes our advisory opinions. These circumstances each independently constitute additional grounds for inadmissibility of the request submitted.

For the reasons stated—the private legal nature of the requesting Association, the absence of an institutional legal opinion, and the submission of a specific case that is before the courts—this Office of the Attorney General regrets that it is unable to address the request submitted by Mr. Alex Solano Araya in his capacity as President of the Association for the Administration of the Water Supply and Sewerage System of San Isidro de El Guarco, by virtue of the legal limitations expressly established in the Costa Rican legal system, which are mandatory in protection of the principle of rule of law and the proper delimitation of institutional competencies. This is without prejudice to the possibility that the concerns raised regarding the protection of the recharge areas (áreas de recarga) and the concession-held springs may be transmitted, through the appropriate channels, to AyA, as the governing body (ente rector) in matters of water supply and sewerage, and to the other competent administrative and judicial authorities.

CONCLUSION:

For the reasons stated, the query submitted is hereby DECLARED INADMISSIBLE, as it constitutes a request submitted by an association of a private legal nature—the Association for the Administration of the Water Supply and Sewerage System of San Isidro de El Guarco—that moreover fails to provide the legal opinion required by Article 4 of this Office's Organic Law and that raises a specific case before the courts, all of which determines that the request does not satisfy the admissibility requirements set forth in this Office's Organic Law.

ALEX SOLANO ARAYA, PRESIDENT OF THE ASSOCIATION FOR THE ADMINISTRATION OF THE WATER SUPPLY AND SEWERAGE SYSTEM OF SAN ISIDRO DE EL GUARCO, CARTAGO, REGARDING THE PROTECTION OF AREAS AROUND CONCESSION-HELD SPRINGS AND THEIR POSSIBLE DECLARATION AS PUBLIC DOMAIN BY AyA, AS WELL AS THE IMPERMISSIBILITY OF POSSESSORY TITLE PROCEEDINGS OVER THOSE AREAS IN THE PROCEEDINGS BEFORE THE AGRARIAN COURT OF CARTAGO, CASE NUMBERS 21-000014-0699-AG-5 AND 22-000181-0699-AG. THE REQUEST WAS SUBMITTED BY LETTER DATED JANUARY 27, 2026, RECEIVED ON FEBRUARY 12, 2026.

Mr. Alex Solano Araya, in his capacity as president of the Association for the Administration of the Water Supply and Sewerage System of San Isidro de El Guarco, Cartago, asks this Office to indicate whether it is legally possible for AyA to declare as public domain the protection zones of the concession-held springs located on privately owned properties, whether those zones—corresponding to a perimeter of up to 300 meters around the water intake sites—may be subject to possession or titling through possessory title proceedings brought by private individuals, and furthermore asks that this Office direct an advisory opinion to the Agrarian Court of Cartago in the possessory title proceedings filed under case numbers 21-000014-0699-AG-5 and 22-000181-0699-AG.

Notwithstanding the foregoing, upon analyzing the content of the request, this Office concludes that the query is inadmissible, as several concurrent grounds are found that prevent the exercise of the advisory function in accordance with Articles 1, 3, 4, and 5 of Organic Law No. 6815.

First, it is noted that the requesting Association is a public utility association, incorporated under the Law of Associations (Ley de Asociaciones), No. 218, of an essentially private legal nature, and that this status is not altered by its provision of the rural water supply service by delegation from AyA. ASADAS are legal entities of a private nature that carry out a task of public interest, which does not make them part of the Public Administration for purposes of invoking the binding advisory function of this Office, nor does the special subjection relationship they maintain with AyA alter that nature.

Second, the request is not accompanied by a legal opinion issued by the Association's legal counsel that concretely and conclusively analyzes the matters queried, thus failing to meet the requirement set forth in Article 4 of the Organic Law of the Office of the Attorney General of the Republic; the only item on record is a notarial certification attesting to the authenticity of the petitioner's signature, which does not constitute a legal opinion on the merits of the matter.

Third, the matters queried are not framed in generic and abstract legal terms, but instead refer to a specific and individualized situation, relating to particular springs, identified properties, and a named stream, whose areas are the subject of two possessory title proceedings currently before the Agrarian Court of Cartago, case numbers 21-000014-0699-AG-5 and 22-000181-0699-AG—thus constituting a matter submitted to judicial authority, on which this Office is prohibited from issuing an opinion in the exercise of its advisory function.

Notwithstanding the inadmissibility finding, the advisory opinion is grounded in the jurisprudential line consistently upheld by this Office regarding the admissibility requirements for the advisory function and the private legal nature of ASADAS, as reflected, among others, in advisory opinions No. C-190-96 of November 27, 1996; OJ-066-2002 of April 30, 2002; C-169-2007 of May 28, 2007; C-061-2008 of March 4, 2008; PGR-C-123-2024; PGR-C-329-2021 of November 26, 2021; PGR-C-211-2024 of November 20, 2024; and PGR-C-057-2024 of April 1, 2024, in which it is reaffirmed that failure to comply with any of the admissibility requirements determines, by operation of law, the inadmissibility of the query.

In light of the foregoing, and given that the request does not meet the admissibility requirements set forth in the Organic Law of the Office of the Attorney General of the Republic—namely, the private legal nature of the requesting Association, the absence of an institutional legal opinion, and the submission of a specific case before the courts—this Office concludes that the request submitted must be declared inadmissible and that a ruling on the merits must be declined. This is without prejudice to the possibility that the concerns raised may be transmitted, through the appropriate channels, to AyA, as the governing body in matters of water supply and sewerage, and to the other competent administrative and judicial authorities.

8 de julio del 2026 PGR-C-106-2026 Estimado señor, Alex Solano Araya Presidente, Asociación Administradora del Acueducto y Alcantarillado de San Isidro de El Guarco Con la aprobación y por encargo del Procurador General de la República, se atiende la gestión formulada mediante oficio de fecha 27 de enero de 2026, suscrito por el señor Alex Solano Araya, en su condición de Presidente de la Asociación Administradora del Acueducto y Alcantarillado de San Isidro de El Guarco, Cartago (en adelante, la ASADA de San Isidro de El Guarco o la Asociación), recibido en esta Procuraduría el 12 de febrero de 2026, mediante la cual se solicita lo siguiente:

Las solicitudes formuladas por el gestionante se centran en las áreas de protección de las nacientes concesionadas de donde su representada capta el agua para el abastecimiento de la comunidad de San Isidro de El Guarco, así como en la situación de determinadas fincas colindantes con dichas áreas y con la quebrada Mollejones, actualmente sujetas a procesos de información posesoria tramitados ante el Juzgado Agrario de Cartago.

En concreto, se solicita a esta Procuraduría indicar si es jurídicamente posible declarar como áreas de dominio público, por parte del Instituto Costarricense de Acueductos y Alcantarillados (AyA), las áreas de protección de las nacientes concesionadas que se encuentran ubicadas en fincas de propiedad privada.

Asimismo, se solicita indicar si las áreas de protección ubicadas en una cuenca hidrográfica, correspondientes a un perímetro de hasta 300 metros alrededor de los sitios de captación de las nacientes que abastecen de agua potable a la comunidad, y que se encuentran en fincas sin inscribir, pueden o no ser objeto de posesión o de titulación mediante el proceso de información posesoria promovido por personas particulares.

Finalmente, se solicita a esta Procuraduría dirigir un pronunciamiento al Juzgado Agrario de Cartago, dentro de los procesos de información posesoria tramitados bajo los expedientes 21-000014-0699-AG-5 y 22-000181-0699-AG, en el sentido de que las áreas de protección de nacientes concesionadas no pueden ser objeto de información posesoria por parte de particulares.

SOBRE LAS CONSULTAS PLANTEADAS A LA PROCURADURÍA GENERAL DE LA REPÚBLICA La función consultiva atribuida a la Procuraduría General de la República se encuentra expresamente regulada en el artículo 1 de su Ley Orgánica, Ley n.° 6815 del 27 de setiembre de 1982, como una competencia técnico-jurídica orientada a la correcta interpretación y aplicación del ordenamiento jurídico por parte de la Administración Pública, en resguardo del principio de legalidad, del interés público y de la seguridad jurídica. Dicha función no opera de manera irrestricta, sino que se encuentra sujeta al estricto cumplimiento de los requisitos de admisibilidad previstos en los artículos 3 inciso b), 4 y 5 del citado cuerpo normativo, los cuales delimitan tanto el ámbito objetivo como el subjetivo del ejercicio consultivo.

De la interpretación sistemática y reiterada de dichas disposiciones legales, esta Procuraduría ha desarrollado una línea doctrinaria uniforme en torno a la existencia de tres requisitos mínimos e indispensables para la admisibilidad de las consultas sometidas a su conocimiento, los cuales constituyen verdaderos presupuestos de procedibilidad y cuya ausencia determina, de forma insalvable, la imposibilidad jurídica de emitir un pronunciamiento vinculante.

En primer término, se exige que el objeto de la consulta sea planteado de forma clara, precisa y concreta, y que verse exclusivamente sobre cuestiones jurídicas formuladas en abstracto o en genérico. Este requisito implica que el planteamiento consultivo no puede comprender, directa ni indirectamente, cuestionamientos referidos a casos concretos o individualizados, asuntos pendientes de resolución por parte de la Administración activa, solicitudes de revisión o valoración de actos administrativos específicos o decisiones ya adoptadas, ni la revisión de informes técnicos o criterios legales previamente emitidos. Asimismo, se excluyen de manera expresa los asuntos que se encuentren sometidos a conocimiento de la jurisdicción, los temas cuya competencia corresponda a otro órgano del Estado y, en general, cualquier gestión que persiga la satisfacción de un interés particular o personal del funcionario o sujeto que formula la consulta, por cuanto ello desnaturaliza la finalidad institucional de la función consultiva y la desvía hacia la atención de intereses individuales.

En segundo lugar, la normativa exige, conforme al artículo 4 de la Ley Orgánica de la Procuraduría General de la República, n.° 6815, que la consulta se acompañe del criterio de la asesoría legal de la institución consultante, emitido respecto de todos y cada uno de los temas sometidos a consideración. Este requisito no constituye una mera formalidad, sino una condición sustantiva que permite a la Procuraduría conocer la posición jurídica previamente asumida por la Administración, valorar los argumentos legales ya analizados internamente y ejercer su función consultiva de manera complementaria, sin sustituir ni desplazar a la asesoría jurídica institucional, en estricto respeto al principio de autoorganización administrativa y a la distribución interna de competencias.

Finalmente, se establece como requisito indispensable que la consulta sea formulada por el jerarca administrativo de la institución respectiva. Este presupuesto responde a la naturaleza vinculante de los dictámenes que emite la Procuraduría General de la República y al principio de jerarquía administrativa, en tanto únicamente el jerarca ostenta la representación orgánica necesaria para comprometer institucionalmente a la Administración consultante y para solicitar un criterio que, por mandato legal, resulta obligatorio para esta. En consecuencia, las gestiones promovidas por funcionarios a título personal, órganos sin competencia jerárquica o sujetos ajenos a la Administración Pública carecen de legitimación para activar válidamente la función consultiva.

Lo anterior guarda estrecha relación con lo dispuesto en el artículo 2 de la Ley Orgánica de la Procuraduría General de la República, n.° 6815, conforme al cual los dictámenes y pronunciamientos de este órgano constituyen jurisprudencia administrativa de acatamiento obligatorio para la Administración Pública. Precisamente en razón de ese carácter vinculante, únicamente quien ostenta la representación orgánica de la institución consultante -esto es, su jerarca administrativo- se encuentra facultado para comprometerla mediante la formulación de una consulta, pues es a dicha autoridad a quien corresponde asumir, en nombre de la Administración, las consecuencias jurídicas del criterio vinculante que se emita.

Esta línea interpretativa ha sido sostenida de manera constante y reiterada por la Procuraduría General de la República en numerosos pronunciamientos, entre los cuales pueden citarse, a modo ilustrativo, los dictámenes n.° C-157-2013 del 19 de agosto de 2013, C-121-2014 del 08 de abril de 2014, C-099-2016 del 29 de abril de 2016, C-377-2019 del 19 de diciembre de 2019, C-080-2020 del 04 de marzo de 2020, C-277-2020 del 10 de julio de 2020, C-065-2021 del 04 de marzo de 2021, PGR-C-110-2023 del 24 de mayo de 2023 y PGR-C-055-2025 del 17 de marzo de 2025, entre muchos otros, en los cuales se ha reafirmado que el incumplimiento de cualquiera de los requisitos señalados determina, de pleno derecho, la inadmisibilidad de la consulta, en estricto apego al principio de juridicidad que rige la actuación de la Administración Pública costarricense.

SOBRE LA NATURALEZA JURÍDICA PRIVADA DE LA ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO Y ALCANTARILLADO DE SAN ISIDRO DE EL GUARCO, LA AUSENCIA DE CRITERIO LEGAL Y EL PLANTEAMIENTO DE UN CASO CONCRETO SUB JÚDICE, COMO CAUSALES DE INADMISIBILIDAD DE LA GESTIÓN:

De conformidad con el ordenamiento jurídico costarricense vigente, queda claramente establecido que la Procuraduría General de la República ostenta la condición de órgano superior consultivo, técnico-jurídico de la Administración Pública, en los términos previstos en el artículo 1 de su Ley Orgánica, Ley n.° 6815 del 27 de setiembre 1982. Esta condición implica que la competencia consultiva de la Procuraduría se ejerce exclusivamente respecto de las consultas formuladas por el Estado, y únicamente en relación con cuestiones jurídicas planteadas en abstracto o en genérico, de conformidad con los parámetros legalmente establecidos.

Las atribuciones de la Procuraduría General de la República se encuentran expresamente delimitadas en el artículo 3 de la Ley Orgánica de la Procuraduría General de la República, dentro de las cuales no se incluye la atención de consultas formuladas por sujetos de derecho privado, aun cuando estos desarrollen actividades de interés público. En el caso que nos ocupa, la Asociación Administradora del Acueducto y Alcantarillado de San Isidro de El Guarco constituye una asociación de utilidad pública, constituida e inscrita al amparo de la Ley de Asociaciones, n.° 218 del 8 de agosto de 1939, por lo que ostenta una naturaleza jurídica eminentemente privada, sin que dicha condición se vea alterada por el hecho de que preste el servicio de acueducto rural mediante delegación del Instituto Costarricense de Acueductos y Alcantarillados (AyA), en los términos del artículo 2, inciso g), de la Ley Constitutiva del Instituto Costarricense de Acueductos y Alcantarillados, n.° 2726 del 14 de abril de 1961, y del Reglamento de las Asociaciones Administradoras de los Sistemas de Acueductos y Alcantarillados Comunales, Decreto Ejecutivo n.° 32529-S-MINAE del 2 de febrero de 2005 y sus reformas.

Esta Procuraduría ha sido enfática, de manera reiterada y uniforme, en sostener que las Asociaciones Administradoras de Acueductos y Alcantarillados (ASADAS) constituyen personas jurídicas de naturaleza privada que realizan una labor de interés público, circunstancia que no modifica su carácter asociativo ni las convierte en parte de la Administración Pública para efectos de activar la función consultiva vinculante de este órgano superior consultivo. La relación de sujeción especial que estas asociaciones mantienen frente al AyA -en virtud de las potestades de dirección, control y fiscalización que dicho Instituto ejerce sobre ellas- no altera su naturaleza jurídica privada ni las habilita, en consecuencia, para requerir el criterio vinculante de esta Procuraduría.

Por ende, al no existir una norma expresa que habilite a este órgano asesor para rendir criterio jurídico ante consultas formuladas por asociaciones de naturaleza privada, ni tratándose la ASADA de San Isidro de El Guarco de una institución integrante de la Administración Pública en los términos del artículo 4 de nuestra Ley Orgánica, resulta jurídicamente improcedente atender la gestión planteada por el señor Alex Solano Araya, en su condición de presidente de dicha Asociación. Esta limitación se mantiene incluso cuando la asociación consultante preste un servicio público por delegación, pues, como se ha reiterado de forma constante, únicamente los jerarcas de las administraciones públicas se encuentran legitimados para requerir el criterio vinculante de la Procuraduría General de la República. En este sentido, pueden consultarse, entre otros, los dictámenes PGR-C-329-2021 del 26 de noviembre de 2021, PGR-C-211-2024 del 20 de noviembre de 2024 y PGR-C-057-2024 del 01 de abril de 2024.

En relación específicamente con la naturaleza jurídica de las Asociaciones Administradoras de Acueductos y Alcantarillados, esta Procuraduría ha sostenido, de forma reiterada, que dichas asociaciones constituyen personas jurídicas de naturaleza privada que realizan una labor de interés público, sin que ello modifique su carácter asociativo. En ese sentido, pueden consultarse los dictámenes C-190-96 del 27 de noviembre de 1996, OJ-066-2002 del 30 de abril de 2002, C-169-2007 del 28 de mayo de 2007, C-061-2008 del 4 de marzo de 2008 y, más recientemente, el PGR-C-123-2024, en el cual se reiteró que, tratándose de asociaciones de naturaleza jurídica privada, la Procuraduría General de la República no se encuentra jurídicamente habilitada para ejercer su función consultiva respecto de las gestiones que estas formulen, por no constituir parte de la Administración Pública en los términos de los artículos 1, 3 y 4 de nuestra Ley Orgánica.

Al margen de lo anterior, el señor Alex Solano Araya carece de legitimación jurídica para formular consultas formales ante la Procuraduría General de la República, por cuanto, si bien ostenta la representación de la ASADA de San Isidro de El Guarco conforme a sus propios estatutos, dicha Asociación no ostenta la condición de institución pública ni su presidente la de jerarca administrativo de una entidad integrante de la Administración Pública.

Adicionalmente, se observa que, aun cuando la gestión fue suscrita por el señor Solano Araya invocando su condición de presidente de la Junta Directiva de la Asociación, ello no modifica el análisis expuesto, pues el vicio de admisibilidad no deriva de un defecto de representación dentro de la propia Asociación, sino de la naturaleza jurídica privada de esta última, la cual la excluye del ámbito subjetivo de aplicación de los artículos 1, 3 y 4 de la Ley Orgánica de la Procuraduría General de la República.

En consecuencia, la naturaleza jurídica privada de la ASADA de San Isidro de El Guarco constituye, por sí misma, una causal suficiente para determinar la improcedencia jurídica de la gestión planteada, en tanto no se configura el presupuesto subjetivo indispensable para la activación de la función consultiva vinculante de esta Procuraduría, la cual se encuentra estrictamente reservada a las consultas formuladas por la Administración Pública, en resguardo del interés público y de la seguridad jurídica; ello sin perjuicio de los incumplimientos adicionales e independientes que se exponen a continuación.

A lo anterior se suma que, en todo caso, tampoco se cumple el segundo requisito de admisibilidad exigido por el artículo 4 de la Ley Orgánica de la Procuraduría General de la República. En efecto, de la revisión del oficio de mérito se constata que este no viene acompañado de un criterio legal emitido por la asesoría jurídica de la Asociación, que analice de forma concreta y concluyente los puntos sometidos a nuestra consideración. Lo único que consta es una razón notarial mediante la cual el Lic. Gerardo Cerdas Rojas da fe de la autenticidad de la firma del gestionante, actuación que se limita a certificar la identidad de quien suscribe el documento, sin que ello equivalga, en modo alguno, a un criterio jurídico sobre el fondo de lo consultado. Por consiguiente, la gestión tampoco satisface el requisito relativo a la existencia de un criterio legal institucional previo, lo que constituye una causal autónoma y adicional de inadmisibilidad.

Asimismo, se advierte el incumplimiento del primer requisito de admisibilidad, en tanto lo consultado no se plantea en términos jurídicos genéricos o abstractos, sino que se refiere abiertamente a una situación concreta e individualizada: nacientes específicas ubicadas en fincas determinadas, un inmueble cuyo propietario -de nacionalidad extranjera- falleció, una quebrada identificada como Mollejones, y un área de aproximadamente nueve hectáreas en posesión de la Asociación gestionante. A ello se aúna que la propia gestión reconoce expresamente que dichas áreas son objeto de dos procesos de Información Posesoria actualmente en trámite ante el Juzgado Agrario de Cartago, bajo los expedientes 21-000014-0699-AG-5 y 22-000181-0699-AG, respecto de los cuales se solicita, incluso, que esta Procuraduría dirija un pronunciamiento a dicho despacho judicial. Se trata, entonces, de un asunto sometido al conocimiento de la autoridad jurisdiccional, sobre el cual esta Procuraduría tiene expresamente vedado pronunciarse en el ejercicio de su función consultiva, así como de un caso concreto que escapa al ámbito abstracto y genérico que caracteriza a nuestros dictámenes. Estas circunstancias configuran, cada una por separado, causales adicionales e independientes de inadmisibilidad de la gestión planteada.

Por las razones expuestas -la naturaleza jurídica privada de la Asociación gestionante, la ausencia de un criterio legal institucional y el planteamiento de un caso concreto sometido a conocimiento judicial-, esta Procuraduría lamenta no poder atender la gestión formulada por el señor Alex Solano Araya, en su condición de Presidente de la Asociación Administradora del Acueducto y Alcantarillado de San Isidro de El Guarco, en virtud de las limitaciones legales expresamente establecidas en el ordenamiento jurídico costarricense, las cuales resultan de acatamiento obligatorio en resguardo del principio de juridicidad y de la correcta delimitación de las competencias institucionales. Lo anterior, sin perjuicio de que las inquietudes planteadas en torno a la protección de las áreas de recarga y de las nacientes concesionadas puedan ser trasladadas, por los canales correspondientes, al Instituto Costarricense de Acueductos y Alcantarillados (AyA), como ente rector en materia de acueductos y alcantarillados, y a las demás autoridades administrativas y judiciales competentes.

CONCLUSIÓN:

Por las razones expuestas, la consulta formulada SE DECLARA INADMISIBLE, por tratarse de una gestión formulada por una asociación de naturaleza jurídica privada -la Asociación Administradora del Acueducto y Alcantarillado de San Isidro de El Guarco-, que además no aporta el criterio legal exigido por el artículo 4 de nuestra Ley Orgánica y que plantea un caso concreto sometido a conocimiento judicial, todo lo cual determina que la gestión no satisface los requisitos de admisibilidad previstos en nuestra Ley Orgánica.

LA GESTIÓN SE FORMULA MEDIANTE OFICIO DEL 27 DE ENERO DE 2026, RECIBIDO EL 12 DE FEBRERO DE 2026.

El señor Alex Solano Araya, en su condición de presidente de la Asociación Administradora del Acueducto y Alcantarillado de San Isidro de El Guarco, Cartago, solicita a esta Procuraduría indicar si es jurídicamente posible que el Instituto Costarricense de Acueductos y Alcantarillados (AyA) declare como áreas de dominio público las áreas de protección de las nacientes concesionadas ubicadas en fincas de propiedad privada, si dichas áreas, correspondientes a un perímetro de hasta 300 metros alrededor de los sitios de captación, pueden ser objeto de posesión o de titulación mediante información posesoria promovida por particulares, y solicita además que esta Procuraduría dirija un pronunciamiento al Juzgado Agrario de Cartago dentro de los procesos de información posesoria tramitados bajo los expedientes 21-000014-0699-AG-5 y 22-000181-0699-AG.

No obstante lo anterior, una vez analizado el contenido de la gestión, esta Procuraduría concluye que la consulta es inadmisible, al verificarse varios supuestos concurrentes que impiden el ejercicio de la función consultiva conforme a los artículos 1, 3, 4 y 5 de la Ley Orgánica n.° 6815.

En primer lugar, se advierte que la Asociación gestionante constituye una asociación de utilidad pública, constituida al amparo de la Ley de Asociaciones, n.° 218, de naturaleza jurídica eminentemente privada, sin que dicha condición se vea alterada por prestar el servicio de acueducto rural mediante delegación del AyA. Las Asociaciones Administradoras de Acueductos y Alcantarillados (ASADAS) son personas jurídicas de naturaleza privada que realizan una labor de interés público, lo cual no las convierte en parte de la Administración Pública para efectos de activar la función consultiva vinculante de esta Procuraduría, sin que la sujeción especial que mantienen frente al AyA modifique dicha naturaleza.

En segundo lugar, la gestión no viene acompañada de un criterio legal emitido por la asesoría jurídica de la Asociación que analice de forma concreta y concluyente los puntos consultados, incumpliendo así el requisito previsto en el artículo 4 de la Ley Orgánica de la Procuraduría General de la República; lo único que consta es una razón notarial que certifica la autenticidad de la firma del gestionante, lo cual no equivale a un criterio jurídico sobre el fondo del asunto.

En tercer lugar, lo consultado no se plantea en términos jurídicos genéricos y abstractos, sino que se refiere a una situación concreta e individualizada, relativa a nacientes específicas, fincas determinadas y una quebrada identificada, cuyas áreas son objeto de dos procesos de información posesoria actualmente en trámite ante el Juzgado Agrario de Cartago, expedientes 21-000014-0699-AG-5 y 22-000181-0699-AG, tratándose así de un asunto sometido al conocimiento de la autoridad jurisdiccional, sobre el cual esta Procuraduría tiene vedado pronunciarse en el ejercicio de su función consultiva.

A pesar de la inadmisibilidad, el dictamen se sustenta en la línea jurisprudencial reiterada por la Procuraduría en torno a los requisitos de admisibilidad de la función consultiva y a la naturaleza jurídica privada de las ASADAS, recogida, entre otros, en los dictámenes n.° C-190-96 del 27 de noviembre de 1996, OJ-066-2002 del 30 de abril de 2002, C-169-2007 del 28 de mayo de 2007, C-061-2008 del 4 de marzo de 2008, PGR-C-123-2024, PGR-C-329-2021 del 26 de noviembre de 2021, PGR-C-211-2024 del 20 de noviembre de 2024 y PGR-C-057-2024 del 01 de abril de 2024, en los cuales se reafirma que el incumplimiento de cualquiera de los requisitos de admisibilidad determina, de pleno derecho, la inadmisibilidad de la consulta.

En virtud de lo expuesto, y dado que la gestión no cumple con los requisitos de admisibilidad previstos en la Ley Orgánica de la Procuraduría General de la República, naturaleza jurídica privada de la Asociación gestionante, ausencia de criterio legal institucional y planteamiento de un caso concreto sometido a conocimiento judicial, esta Procuraduría concluye que corresponde declarar inadmisible la gestión presentada y abstenerse de resolver el fondo del asunto. Ello sin perjuicio de que las inquietudes planteadas puedan ser trasladadas, por los canales correspondientes, al Instituto Costarricense de Acueductos y Alcantarillados (AyA), como ente rector en materia de acueductos y alcantarillados, y a las demás autoridades administrativas y judiciales competentes.
