in the entirety of the text - Full Text of Norm 44058 Declaration of Public Interest of the “High-Level Event on Ocean Action” N° 44058-RREE-MINAE THE PRESIDENT OF THE REPUBLIC, THE MINISTER OF FOREIGN AFFAIRS AND WORSHIP, AND THE MINISTER OF ENVIRONMENT AND ENERGY In use of the powers conferred by article 140 subsections 3), 20) and 146 of the Political Constitution; as well as numerals 25 subsection 1), 27 subsection 1), 28 subsection 2) paragraph b) of the General Law of Public Administration, Law number 6227 of May 2, 1978, and;
I.-That during the seventieth session of the United Nations General Assembly, resolution 70/1 was approved, thereby adopting the 2030 Agenda for Sustainable Development, which includes seventeen Sustainable Development Goals.
II.-That through resolution 70/226, it was decided to convene a high-level Conference to support the achievement of "Sustainable Development Goal 14: Conserve and Sustainably Use the Oceans, Seas and Marine Resources for Sustainable Development".
III.-That, in June 2017 in New York, United States of America, the first United Nations Ocean Conference was held, with the governments of Fiji and Sweden as hosts.
IV.-That, in December 2017, the United Nations recognized the period 2021-2030 as the United Nations Decade of Ocean Science for Sustainable Development, which offers a common framework to ensure that ocean sciences can fully support the actions of countries for the sustainable management of the ocean and, more specifically, to achieve the 2030 Agenda for Sustainable Development.
V.-That, in June 2022, the second edition of the United Nations Ocean Conference was held in Lisbon, Portugal, with the governments of Portugal and Kenya as hosts, whose central theme was "Scaling up ocean action based on science and innovation for the achievement of Goal 14: stocktaking, partnerships and solutions".
VI.-That, within the framework of the second United Nations Conference, the Governments of Costa Rica and France offered to be co-hosts of the third edition of this Conference, to be held in 2025 in France; and on December 20, 2022, through resolution A/RES/77/242 of the United Nations General Assembly, the holding of this third Conference was agreed upon and the offer of both countries to organize it was accepted.
VII.-That the Government of Costa Rica, in its capacity as co-host of the Third United Nations Ocean Conference, will host the "High-Level Event on Ocean Action", which will be held on June 7 and 8, 2024, in different areas of the country.
VIII.-That, from June 9 to 14, 2025, the Third United Nations Ocean Conference will be held in Nice, France, for which Costa Rica will work together with that country for its organization.
IX.-That with the 2024 high-level event, the aim is to position topics of relevance for the global ocean agenda, as well as to promote specific actions to address the severe environmental crisis it faces.
X.-That for the preparation of this high-level event, the formation of an inter-institutional organizing committee is necessary, as well as a support committee that is broad and participatory, so that various sectors of civil society, the academic and scientific community, and non-governmental organizations can also contribute to the process.
XI.-That for Costa Rica, it is essential to ensure broad and effective participation within the processes towards the Ocean Conference and its high-level event, including youth, coastal communities, local governments, interested communities, in particular artisanal fishers, scientific and academic institutions, civil society organizations, and the private sector that have an interest in the matter.
XII.-That, within the framework of this high-level event, leaders from the public, business, financial, and social sectors, and international and national opinion makers will be invited to interact with various actors and decision-makers from diverse countries.
XIII.-That such a gathering will allow the collective exchange of ideas and successful ocean, addressing issues such as pollution, the impacts of climate change and biodiversity loss, acidification, illegal, unreported and unregulated fishing, the blue economy, deep-seabed mining, marine governance, lack of scientific knowledge, and transfer of marine technology.
XIV.-That through agreement number AJDIP/117-2023 of the Board of Directors of the Instituto Costarricense de Pesca y Acuicultura and official letter number DM-313-2023 from the Minister of the Instituto Costarricense de Turismo, said institutions are authorized to participate in the organization of the High-Level Event on Ocean Action.

Considering:
Therefore,
The "High-Level Event on Ocean Action", to be held in different areas of the country, on June 7 and 8, 2024, organized by the Government of Costa Rica, is declared of public interest.
The dependencies of the Public Sector and the Private Sector, within their respective legal framework of competencies, may collaborate to the extent of their possibilities and without prejudice to the fulfillment of their own objectives, for the successful realization of the event indicated.
This Executive Decree does not grant tax benefits, such as exemptions or any other tax benefit, as established by article 5 of Executive Decree N° 40540-H of August 1, 2017.
The Organizing Committee of the United Nations Ocean Conference is hereby created, as a temporary inter-ministerial coordination body, which will conclude its functions once said Conference is held, and which will act as the general coordinator for the articulation and integrated management among the different public sector entities that participate in the organization of the high-level event in Costa Rica in 2024, as well as the Conference that will be held in France in 2025, indicated in article 1°.
The Organizing Committee shall be integrated by representatives of the following institutions:
a. The Ministry of Foreign Affairs and Worship.
b. The Ministry of Environment and Energy.
c. The Instituto Costarricense de Pesca y Acuicultura (INCOPESCA) d. The Instituto Costarricense de Turismo (ICT).
The coordination of the Organizing Committee shall fall to the Ministry of Foreign Affairs and Worship, which shall be responsible for the call for meetings, preparation of agendas and minutes, and follow-up on agreements. Likewise, in said Committee, there shall be an optional participation of a member from the Presidency of the Republic.
The Organizing Committee may invite to its sessions representatives of other public or private institutions, including the scientific and academic community and organizations of civil society, whose activities are related to the objective of this Decree, when it deems it convenient, who shall participate with voice, but without vote. This session shall be convened as an Expanded Committee.
This decree is effective as of the date of its publication in the Official Gazette La Gaceta.

I.-Que durante el septuagésimo período de sesiones de la Asamblea General de Naciones Unidas, se aprobó la resolución 70/1 mediante la cual se adoptó la Agenda 2030 para el Desarrollo Sostenible, que incluye diecisiete Objetivos de Desarrollo Sostenible.
II.-Que mediante la resolución 70/226 se decidió convocar a una Conferencia de alto nivel para apoyar la consecución del "Objetivo de Desarrollo Sostenible 14: Conservar y Utilizar Sosteniblemente los Océanos, los Mares y los Recursos Marinos para el Desarrollo Sostenible".
III.-Que, en junio del 2017 en Nueva York, Estados Unidos de América, se celebró la primera Conferencia de las Naciones Unidas sobre el Océano, con los gobiernos de Fiyi y Suecia como anfitriones.
IV.-Que, en diciembre del 2017, la Organización de las Naciones Unidas reconoció el período 2021-2030 como la Década de las Ciencias Oceánicas para el Desarrollo Sostenible de las Naciones Unidas, lo cual ofrece un marco común para garantizar que las ciencias oceánicas puedan apoyar plenamente las acciones de los países para la gestión sostenible del océano y, más concretamente, para lograr la Agenda 2030 para el Desarrollo Sostenible V.-Que, en junio del 2022, se celebró en Lisboa, Portugal, la segunda edición de la Conferencia de las Naciones Unidas sobre el Océano, con los gobiernos de Portugal y Kenia como anfitriones, cuyo tema central fue "Ampliación de la acción oceánica basada en la ciencia y la innovación para la consecución del Objetivo 14: balance, asociaciones y soluciones".
VI.-Que, en el marco de la segunda Conferencia de las Naciones Unidas, los Gobiernos de Costa Rica y Francia se ofrecieron a ser coanfitriones de la tercera edición de esta Conferencia, a celebrarse en el año 2025 en Francia; y el 20 de diciembre del 2022 mediante la resolución A/RES/77/242 de la Asamblea General de Naciones Unidas, se acordó la celebración de esta tercera Conferencia y se acogió el ofrecimiento de ambos países para organizarla.
VII.-Que el Gobierno de Costa Rica en su condición de coanfitrión de la Tercera Conferencia de las Naciones Unidas sobre el Océano, albergará el "Evento de Alto Nivel sobre Acción Oceánica", que se realizará los días 7 y 8 de junio del 2024, en diferentes zonas del país.
VIII.-Que, del 9 al 14 de junio del 2025, se celebrará la Tercera Conferencia de las Naciones Unidas sobre el Océano, en Niza, Francia, para lo cual Costa Rica trabajará junto con ese país para la organización de esta.
IX.-Que con el evento de alto nivel del 2024 se busca posicionar temas de relevancia para la agenda global del océano, así como impulsar acciones específicas para atender la grave crisis ambiental que éste enfrenta.
X.-Que para la preparación de este evento de alto nivel es necesario la conformación de un comité organizador interinstitucional, así como de un comité de apoyo que sea amplio y participativo, para que diversos sectores de la sociedad civil, la comunidad académica y científica y las organizaciones no gubernamentales también puedan aportar al proceso.
XI.-Que para Costa Rica es fundamental asegurar una participación amplia y efectiva dentro de los procesos hacia la Conferencia sobre el Océano y su evento de alto nivel, que incluya a los jóvenes, las comunidades costeras, a los gobiernos locales, comunidades interesadas en particular pescadores artesanales, instituciones científicas y académicas, organizaciones de la sociedad civil y sector privado que tengan interés en la materia.
XII.-Que, en el marco de este evento de alto nivel, se invitará a líderes del sector público, empresarial, financiero, social, formadores de opinión internacional y nacional que interactúen con actores varios y tomadores de decisión de diversos países.
XIII.-Que tal congregación permitirá el intercambio colectivo de ideas y experiencias exitosas en posibles soluciones para atender la grave crisis que enfrenta el océano atendiendo temas como la contaminación, los impactos del cambio climático y la pérdida de biodiversidad, acidificación, pesca ilegal no declarada y no reglamentada, economía azul, minería de fondos marinos, gobernanza marina, falta de conocimiento científico y transferencia de tecnología marina.
XIV.-Que mediante el acuerdo número AJDIP/117-2023 de la Junta Directiva del Instituto Costarricense de Pesca y Acuicultura y el oficio número DM-313-2023 del Señor Ministro del Instituto Costarricense de Turismo, se autoriza a dichas instituciones para participar en la organización del Evento de Alto Nivel sobre Acción Oceánica.
Declaratoria de Interés Público del "Evento de Alto Nivel sobre Acción Oceánica"
Considerando:
Por tanto,
Decretan:
Se declara de interés público el "Evento de Alto Nivel sobre Acción Oceánica", a realizarse en diferentes zonas del país, los días 7 y 8 de junio del 2024, organizado por el Gobierno de Costa Rica.
Las dependencias del Sector Público y del Sector Privado, dentro del marco legal respectivo de sus competencias, podrán colaborar en la medida de sus posibilidades y sin perjuicio del cumplimiento de sus propios objetivos, para la exitosa realización del evento indicado.
El presente Decreto Ejecutivo no otorga beneficios fiscales, tales como exoneraciones o cualquier otro beneficio fiscal, tal y como lo establece el artículo 5 del Decreto Ejecutivo N° 40540-H del 01 de agosto del 2017.
Créase. el Comité Organizador de la Conferencia de las Naciones Unidas sobre el Océano, como órgano interministerial de coordinación de carácter temporal, que culminará sus funciones una vez se lleve a cabo dicha Conferencia, y que fungirá como coordinador general para la articulación y gestión integrada entre las diferentes instancias del sector público que participen en la organización del evento de alto nivel en Costa Rica en el 2024, así como de la Conferencia que se llevará a cabo en Francia en el 2025, indicados en el artículo 1°.
El Comité Organizador estará integrado por representantes de las siguientes instituciones:
a. El Ministerio de Relaciones Exteriores y Culto.
b. El Ministerio de Ambiente y Energía.
c. El Instituto Costarricense de Pesca y Acuicultura (INCOPESCA) d. El Instituto Costarricense de Turismo (ICT).
La coordinación del Comité Organizador recaerá en el Ministerio de Relaciones Exteriores y Culto, a quien le corresponderá la convocatoria, preparación de agendas y actas y seguimiento a los acuerdos. Asimismo, en dicho Comité habrá una participación facultativa de un miembro de la Presidencia de la República.
El Comité Organizador podrá invitar a sus sesiones a representantes de otras instituciones públicas o privadas, incluyendo a la comunidad científica y académica y organizaciones de la sociedad civil, cuyas actividades están relacionadas con el objetivo de este Decreto, cuando lo considere conveniente, los cuales participarán con voz, pero sin voto. Esta sesión se convocará como un Comité Ampliado.
El presente decreto rige a partir de la fecha de su publicación en el Diario Oficial La Gaceta.
