These regulations have the purpose of regulating the conditions for the use of existing municipal dog parks, and those that may be created in the future in the canton of Moravia.

The provisions of these regulations are of mandatory application and observance for the owners or companions of dogs who make use of the facilities of the municipal dog parks located in the canton of Moravia.

For the purposes of these regulations, the following concepts are established:

• a)Companion: one who accompanies at all times, whether in a risk situation or not.
• b)Muzzles: Device placed around the snout of certain animals, especially dogs, so they cannot bite.
• c)Conflict: fight, dispute, or disagreement that occurs between two or more individuals.
• d)Potentially dangerous pet: Animal that may have an aggressive nature or the capacity to cause death or injury to persons or other animals and damage to property.
• e)Municipal dog parks: Those spaces owned by the Municipalidad de Moravia, intended for canine recreation where, under the supervision and control of their owners or companions, dogs can enjoy, run, and play without risks.
• f)Sick dog: is a qualifying adjective used to designate the health status of an individual that is altered by the presence of an illness, pathology, or ailment.
• g)Owner: The owner is that natural person who exercises the action of ownership or dominion over an asset, exercises possession and control over a particular good.

On the parks

These spaces have been conceived with the objective of offering residents of the canton of Moravia, as well as its visitors, public areas where exercise, play, and healthy coexistence of canines with others of their same species are promoted, resulting in healthier, socialized, and balanced dogs. Likewise, to improve coexistence between people and canines.

Owners or companions of dogs who visit the municipal dog parks shall be considered users. Any person of legal age who wants to enjoy watching the animals, the activities, and/or events that may be organized in said parks with the dog as the main protagonist may also access these areas, as long as the animals inside are not put at risk. In this case, persons who wish to interact with the dogs must always have the corresponding permission of the owner. Minors under 12 years of age must always be accompanied by their father, mother, guardian, or a person of legal age who takes responsibility at all times for the minor.

The Municipalidad de Moravia shall provide adequate maintenance of the parks by carrying out the necessary works and maintenance tasks that guarantee their best and most appropriate use.

Any activity outside the ordinary use of the park must be of general interest and previously authorized by the Municipalidad.

On use

The municipal dog parks shall be open to the public permanently and shall be free of charge.

For the use of the parks, the following mandatory and strictly enforced rules are established:

• a)The park is for the exclusive use of dogs, their owners, or companions.
• b)The animals must be accompanied at all times, whether by their owner or whoever acts as a companion.
• c)It is the obligation of the owner or companion to pick up the excrement generated by their dogs; for this purpose, they must carry their bags and deposit them completely closed in the containers installed for this purpose.
• d)The park door must remain closed at all times.
• e)Dogs must enter and exit the park on a leash; their owners or companions must not release their leashes until after closing the park door.
• f)Dogs must wear a collar at all times to facilitate their separation in case of a confrontation.
• g)Those pets that are classified as potentially dangerous or with characteristics that so advise (strong musculature, large jaws, aggressiveness) must permanently be on a leash and muzzled.
• h)If an animal becomes aggressive, it must leave the park immediately.
• i)At the slightest sign of aggressiveness, the owner or companion of the dog shall secure it with the leash and must leave the park for a prudent time until the dog has calmed down.
• j)Dogs may remain in the enclosure for as long as they wish, within the permitted hours, as long as no conflicts arise.
• k)Smoking and consuming alcoholic beverages are strictly prohibited.
• l)Park users shall ensure that the tranquility and rest of the municipality's neighbors are respected, preventing excessive noise from being made, both by the dogs and by the people.

Prohibitions and responsibilities

• a)The entry of dogs in heat, sick, or unvaccinated, and those wearing prong or teeth collars, is prohibited.
• b)The dog must be watched at all times; therefore, leaving them alone in the park is absolutely prohibited.
• c)Bathing pets inside the park is strictly prohibited.
• d)Entering the park with solid foods is strictly prohibited, as well as the consumption of alcoholic beverages on the premises.
• e)Feeding the animals in the park is strictly prohibited.

The owners or companions of the dogs shall be obligated to respect the park's rules of use, being legally responsible for any type of damages that may be caused to the public infrastructure, as well as for complying with current regulations on the protection of domestic animals, ownership of potentially dangerous animals, and municipal ordinances relating to the environment, the Municipalidad being released from this type of responsibility.

Provisions on animal abuse and dissemination of regulations

When a visitor to the dog parks witnesses conduct that may constitute animal abuse in light of the Animal Welfare Law, No. 7451 and its amendments, as well as any other rule that regulates the matter, they must file the complaint before the Environmental Management Office of the Municipalidad de Moravia, for which an official mechanism for handling will be available.

The Institutional Communication Department shall be responsible for promoting the dissemination of the rules set forth in these Regulations.

Likewise, the Municipalidad de Moravia shall endeavor to have sufficient resources to maintain adequate signage on these measures in the dog parks.

It shall take effect upon its publication.

Este reglamento tiene por objeto regular las condiciones para el uso de los parques caninos municipales existentes, y los que a futuro se lleguen a crear en el cantón de Moravia.

Las disposiciones de este reglamento son de aplicación y acatamiento obligatorio para los propietarios o acompañantes de los perros que hagan uso de las instalaciones de los parques caninos municipales ubicados en el cantón de Moravia.

Para efectos del presente reglamento, se establecen los siguientes conceptos:

• a)Acompañante: que acompaña en todo momento, sea que se encuentre en una situación de riesgo o no.
• b)Bozales: Aparato que se coloca alrededor del hocico de ciertos animales, especialmente los perros, para que no puedan morder.
• c)Conflicto: pelea, disputa o discrepancia que se da entre dos o más individuos.
• d)Mascota potencialmente peligrosa: Animal que puede tener carácter agresivo o la capacidad de causar la muerte o lesiones a las personas o a otros animales y daños a las cosas.
• e)Parques caninos municipales: Aquellos espacios propiedad de la Municipalidad de Moravia, destinados para el recreo canino donde, bajo la supervisión y control de sus propietarios o acompañantes, los perros pueden disfrutar, correr y jugar sin riesgos.
• f)Perro enfermo: es un adjetivo de tipo calificativo que se utiliza para designar el estado de salud de un individuo que se ve alterado por la presencia de alguna enfermedad, patología o dolencia.
• g)Propietario: El propietario es aquella persona física que ejerce la acción de propiedad o dominio de un activo, ejerce posesión y control sobre un bien en particular.

Sobre los parques

Estos espacios han sido concebidos con el objetivo de ofrecer a las personas vecinas del cantón de Moravia, así como a sus visitantes, de áreas públicas donde se promueva el ejercicio, el juego y una sana convivencia de los caninos con otros de su misma especie, teniendo como resultado perros más sanos, socializados y equilibrados. Asimismo, mejorar la convivencia entre las personas y los caninos.

Se considerarán usuarios a los propietarios o acompañantes de los perros que visiten los parques caninos municipales. También podrá acceder a estas áreas, cualquier persona mayor de edad que quiera disfrutar viendo a los animales, las actividades y/o eventos que pudieran organizarse en dichos parques con el perro como principal protagonista, siempre y cuando no se ponga en riesgo a los animales que se encuentran en el interior. En este caso, las personas que deseen interactuar con los perros deberán contar siempre con el permiso correspondiente del propietario. Los menores de 12 años deberán ir siempre acompañados de su padre, madre, tutor o persona mayor de edad que se haga responsable en todo momento del menor.

La Municipalidad de Moravia dará el mantenimiento adecuado de los parques mediante la realización de las obras y labores de mantenimiento necesarias, que garanticen su mejor y más adecuado uso.

Toda actividad fuera del uso ordinario del parque, debe ser de interés general y previamente autorizada por la Municipalidad.

Del uso

Los parques caninos municipales estarán abiertos al público de forma permanente y serán de uso gratuito.

Para el uso de los parques, se establecen las siguientes normas obligatorias y de estricto cumplimiento:

• a)El parque es de uso exclusivo para los perros, sus propietarios o acompañantes.
• b)Los animales deben estar en todo momento acompañados, ya sea por su propietario o quien figure como acompañante.
• c)Es obligación del propietario o acompañante, recoger los excrementos que generen sus perros, para ello deberán portar sus bolsas y depositarlas completamente cerradas en los contenedores instalados para tal fin.
• d)La puerta del parque debe de permanecer en todo momento cerrada.
• e)Los perros deben de entrar y salir del parque, sujetos con correa, sus propietarios o acompañantes no deben soltar sus correas hasta haber cerrado la puerta del parque.
• f)Los perros deben estar con el collar en todo momento para facilitar su separación en caso de enfrentamiento.
• g)Aquellas mascotas que estén catalogadas como potencialmente peligrosas o con características que así lo aconsejen (fuerte musculatura, grandes mandíbulas, agresividad), deberán estar permanentemente con correa y bozal.
• h)Si un animal se muestra agresivo deberá abandonar el parque inmediatamente.
• i)Al menor indicio de agresividad, el propietario o acompañante del perro, lo sujetará con la correa y deberá abandonar el parque por un tiempo prudencial hasta que el perro se haya tranquilizado.
• j)Los perros pueden permanecer en el recinto el tiempo que deseen, dentro del horario permitido, siempre y cuando no se generen conflictos.
• k)Queda totalmente prohibido fumar e ingerir bebidas de contenido alcohólico.
• l)Los usuarios del parque velarán por que se respete la tranquilidad y el descanso, de los vecinos del municipio, evitando que se realice un ruido excesivo, tanto por parte de los perros como por las personas.

Prohibiciones y responsabilidades

• a)Se prohíbe la entrada de perros en celo, enfermos o sin vacunar y aquellos que porten collares de púas o dientes.
• b)El perro debe estar vigilado en todo momento, por lo que está absolutamente prohibido dejarlos solos en el parque.
• c)Queda totalmente prohibido bañar a las mascotas dentro del parque.
• d)Queda totalmente prohibido el ingreso al parque con alimentos sólidos, así como el consumo de bebidas alcohólicas en el lugar.
• e)Queda totalmente prohibido alimentar a los animales en el parque.

Los propietarios o acompañantes de los perros estarán obligados a respetar las normas de uso del parque, siendo responsables legales por cualquier tipo de daños que se puedan ocasionar en la infraestructura pública, así como de cumplir la normativa vigente en materia de protección de animales domésticos, tenencia de animales potencialmente peligrosos y ordenanza municipal relativas al medioambiente, quedando liberada la Municipalidad de este tipo de responsabilidad.

y difusión de reglamento

Cuando una persona visitante de los parques para perros presencie una conducta que pueda configurar maltrato animal a la luz de la Ley de Bienestar de los Animales, N° 7451 y sus reformas, así como cualquier otra norma que regule la materia, deberá interponer la denuncia ante la Oficina de Gestión Ambiental de la Municipalidad de Moravia, para lo cual se dispondrá de un mecanismo oficial de atención.

El Departamento de Comunicación Institucional será el encargado de promover la difusión de la normativa dispuesta en este Reglamento.

Asimismo, la Municipalidad de Moravia procurará disponer de recursos suficientes para mantener adecuada rotulación sobre estas medidas en los parques para canes.
