in the entirety of the text - Complete Text of Norm 007 Cancellation of survey markers enumerated from 01 to 13 of the delimitation of the public zone of the maritime terrestrial zone in the sector of Playa Guines, District 06 Nosara, Canton 02 Nicoya, Province 05 Guanacaste INSTITUTO GEOGRÁFICO NACIONAL DEPARTAMENTO TOPOGRÁFICO Y OBSERVACIÓN DEL TERRITORIO NOTICE Nº 007-2023 ZONA MARÍTIMO TERRESTRE CANCELLATION OF SURVEY MARKERS ENUMERATED FROM 01 TO 13 OF THE DELIMITATION OF THE PUBLIC ZONE OF THE ZONA MARÍTIMO TERRESTRE IN THE SECTOR OF PLAYA GUIONES, DISTRICT 06° NOSARA, CANTON 02° NICOYA, PROVINCE 05° GUANACASTE Based on the provisions set forth in Articles 140 and 240, subsection 1 of Law N°6227, General Law of Public Administration, dated May 2, 1978, and its amendments; Law N°59, Law of Creation of the Instituto Geográfico Nacional of July 4, 1944, effective as of January 1, 1945, and its amendments; Law N°8905, Law transferring the Instituto Geográfico Nacional to the Registro Nacional of December 7, 2010; Law Nº6043, Law on the Zona Marítimo Terrestre of March 2, 1977, and its amendments and its Regulations; and Articles 2 and 3 of Law N°5695, Law of Creation of the Registro Nacional of May 28, 1975, and its amendments.

1st—That through the Notice published on page 20 of the Official Gazette La Gaceta N° 74 of April 20, 1981, it is mentioned that the officialization of the marking (amojonamiento) of the public zone in the northern portion of Playa Guiones, district 01° (currently district 06) Nosara, canton 02° Nicoya, province 05° Guanacaste, was carried out, through the establishment of 13 survey markers enumerated from 01 to 13.

2nd—That in accordance with Law N°59, the IGN Law, and Article 62 of the Regulation to Law N°6043, the competence of the IGN for the delimitation of the public zone of the Zona Marítimo Terrestre, and its officialization through publication in the Official Gazette La Gaceta is recognized, while Article 63 of the same Regulation states that "The Instituto Geográfico Nacional must publish a notice in the Official Gazette, for each portion of the zona marítimo-terrestre in which it has demarcated the public zone." 3rd—That Article 140 of Law N°6227, General Law of Public Administration, states that "the administrative act shall produce its effect after being communicated to the administered party, except if it grants only rights, in which case it shall produce it from the time it is adopted," a provision that must necessarily be related to numeral 204, subsection 1) of the same regulatory body, which defines the suitable instrument for communicating acts of a generic nature by stating that: "General acts shall be communicated by publication and specific acts by notification." NOTIFIES:

1st—That based on the demarcation published in the Official Gazette La Gaceta N° 74 of April 20, 1981, page 20, the survey markers enumerated from 1 to 13 are hereby removed from the Registro de Zona Marítimo Terrestre.

2nd—The beach sectors located at Playa Guiones, district 06° Nosara, canton 02° Nicoya, province 05° Guanacaste, which to date have a delimitation of the public zone of the Zona Marítimo Terrestre through the placement of survey markers and the respective publication in the Official Gazette La Gaceta, maintain their official status.

3rd—Effective as of its publication.

en la totalidad del texto - Texto Completo Norma 007 Cancelación de mojones enumerados del 01 al 13 de la delimitación de la zona pública de la zona marítimo terrestre en el sector de Playa Guines, Distrito 06 Nosara, Cantón 02 Nicoya, Provincia 05 Guanacaste INSTITUTO GEOGRÁFICO NACIONAL DEPARTAMENTO TOPOGRÁFICO Y OBSERVACIÓN DEL TERRITORIO AVISO Nº 007-2023 ZONA MARÍTIMO TERRESTRE CANCELACIÓN DE MOJONES ENUMERADOS DEL 01 AL 13 DE LA DELIMITACIÓN DE LA ZONA PÚBLICA DE LA ZONA MARÍTIMO TERRESTRE EN EL SECTOR DE PLAYA GUIONES, DISTRITO 06° NOSARA, CANTÓN 02° NICOYA, PROVINCIA 05° GUANACASTE Con fundamento en lo dispuesto en los artículos 140 y 240 inciso 1 de la Ley N°6227 Ley General de la Administración Pública de fecha 2 de mayo de 1978 y sus reformas; Ley N°59 Ley de Creación del Instituto Geográfico Nacional del 04 de julio de 1944 vigente desde el 1 de enero de 1945 y sus reformas; Ley N°8905 Ley de traslado del Instituto Geográfico Nacional al Registro Nacional de fecha 7 de diciembre del 2010; Ley Nº6043 Ley sobre la Zona Marítimo Terrestre del 2 de marzo de 1977 y sus reformas y su Reglamento; y artículos 2 y 3 de la Ley N°5695 Ley de Creación del Registro Nacional de fecha 28 de mayo de 1975 y sus reformas.

1. 1Que mediante el Aviso publicado en la página 20 del Diario Oficial La Gaceta N° 74 del 20 de abril de 1981 se menciona que se llevó a cabo la oficialización del amojonamiento de la zona pública en la porción norte de Playa Guiones, distrito 01° (actualmente distrito 06) Nosara, cantón 02° Nicoya, provincia 05° Guanacaste, bajo el establecimiento de 13 mojones enumerados del 01 al 13.
2. 2Que de conformidad con la Ley N°59 Ley de IGN, y en el artículo 62 del Reglamento a la Ley N°6043, se reconoce la competencia del IGN para la delimitación de la zona pública de la Zona Marítimo Terrestre, y su oficialización a través de publicación en el Diario Oficial La Gaceta, mientras que el artículo 63 del mismo Reglamento, señala que "El Instituto Geográfico Nacional deberá publicar aviso en el Diario Oficial, de cada porción de la zona marítimo-terrestre en que haya demarcado la zona pública".
3. 3Que el artículo 140 de la Ley N°6227 Ley General de la Administración Pública señala que "el acto administrativo producirá su efecto después de comunicado al administrado, excepto si le concede únicamente derechos, en cuyo caso lo producirá desde que se adopte", disposición que necesariamente debe relacionarse con el numeral 204 inciso

• 1)del mismo cuerpo normativo, que define el instrumento idóneo para comunicar actos de naturaleza genérica al señalar que: "Se comunicaran por publicación los actos generales y por notificación, los concretos".

COMUNICA:

1. 1Que con base en la demarcación publicada en el Diario Oficial La Gaceta N° 74 del 20 de abril de 1981, página 20, quedan eliminados del Registro de Zona Marítimo Terrestre los mojones enumerados del 1 al 13.

2º-Los sectores de playa ubicados en Playa Guiones, distrito 06° Nosara, cantón 02° Nicoya, provincia 05° Guanacaste que cuentan a la fecha con delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y respectiva publicación en el Diario Oficial La Gaceta, mantienen su condición oficial.

3º-Rige a partir de su publicación.
