across the entirety of the text - Complete Text of Regulation 44053 Declares of public interest the "National Action Plan on gender equality in climate action-PGCC nationally determined contribution Paris agreement" No. 44053-MINAE-MCM THE PRESIDENT OF THE REPUBLIC, THE MINISTER OF ENVIRONMENT AND ENERGY, AND THE MINISTER OF WOMEN'S AFFAIRS In exercise of the powers and attributions conferred upon them by articles 50, 140 clauses 3), 8), 18) and 20) and 146 of the Political Constitution; 25 clause 1), 27 clause 1) and 28 clause 2) subparagraph b) of the General Public Administration Law No. 6227 of May 2, 1978; the Law of the National Institute for Women, No. 7801 of April 30, 1998; articles 1 and 2 of the Organic Law of the Ministry of Environment and Energy, No. 7152 of June 5, 1990; the United Nations Framework Convention on Climate Change, ratified by Law No. 7414 of June 13, 1994; the Paris Agreement, ratified by Law No. 9405 of October 4, 2016; Executive Decree No. 41091-MINAE National Climate Change Adaptation Policy, of April 20, 2018 and Executive Decree No. 43491-MINAE Officialization and Declaration of Public Interest of the 2022-2026 Action Plan of the National Climate Change Adaptation Policy 2018-2030, of April 25, 2022.
I.—That our country has set out to lay the foundations of the new 21st-century economy, capable of responding to changes in the global context, transitioning towards a green economy based on human rights and equality between women and men, thus demonstrating that it is possible to fulfill the commitments made in the 2030 Agenda for Sustainable Development.
II.—That the Paris Agreement was formalized as Law of the Republic No. 9405 on October 4, 2016 and in its article 4, paragraph 2 indicates that countries shall prepare, communicate, and maintain successive nationally determined contributions that they intend to achieve. And it is under this framework that Costa Rica submitted its Nationally Determined Contribution (NDC) which includes the commitment to carry out the Gender and Climate Change Action Plan.
III.—That the formulation of the National Climate Change Policy was a pioneering process in Costa Rica, participatory and innovative, with high inter-institutional and multisectoral coordination that incorporates the gender perspective, the Human Rights approach, and traditional knowledge to strengthen the climate adaptation actions of the annual operational processes of public institutions, private entities, and civil society.
IV.—That the political aspiration for 2030 is to be a country that transforms threats into opportunities, strengthens its capacities and conditions for social, environmental, and economic resilience, prevents and recovers from the adverse effects of climate change in a measurable, verifiable, and reportable manner.
V.—That Costa Rica has ratified and implemented actions in favor of equality between women and men and the advancement of women's human rights, in accordance with what is established in supra-constitutional regulations, mainly the Convention on the Elimination of All Forms of Discrimination against Women-CEDAW and the Beijing Declaration and Platform for Action.
VI.—That Costa Rica, in a tripartite alliance between the Latin American Faculty of Social Sciences-FLACSO, the Ministry of Environment and Energy-MINAE, and the National Institute for Women-INAMU led the Feminism for Climate Justice Coalition of the Generation Equality Forum, a global initiative for the review and updating of the Beijing Platform for Action.
VII.—That the Sustainable Development Goals (SDGs) constitute the universal aspirations to end poverty, protect the planet, and ensure peace and prosperity without leaving anyone behind, with gender equality (SDG 5) and climate action (SDG 13) being two of the 17 goals that contribute to this purpose.
VIII.—That there exist international agreements and mandates for the incorporation of the gender perspective into climate action, emanating mainly from the Lima Work Programme on Gender agreed upon at COP 20 in 2014 and its Gender Action Plans.
IX.—That within the framework of the global commitments emanating from the Paris Agreement (2015), Costa Rica presented in 2020 the update of its Nationally Determined Contributions, among which stands out "5.2 By 2022 the country will have a Gender and Climate Change Action Plan." X.—That the gender perspective has been considered as an approach and cross-cutting axis in public policies on environmental matters, climate change, and risk management, in particular, the National Climate Change Adaptation Policy and the National Decarbonization Plan.
XI.—That the National Policy for Effective Equality between Women and Men 2018-2030 contemplates the perspective of sustainability, as well as expected results linked to climate change in the institutional commitments registered in its Action Plans.
XII.—That the inter-institutional alliance between the Ministry of Environment and Energy and the National Institute for Women in matters of gender equality and the environment is significantly consolidated through the construction, implementation, and monitoring of this Plan, as well as through the proactive involvement of other public institutions, local governments, civil society organizations, and international cooperation in favor of equality between women and men in harmony with nature.
XIII.—That, in accordance with the Regulation to the Law for the Protection of Citizens from Excessive Administrative Requirements and Procedures, Executive Decree No. 37045-MP-MEIC and its amendments, it was determined that this proposal does not establish or modify procedures, requirements, or formalities that the citizen must comply with, a situation for which the prior control procedure was not carried out. Therefore;
DECLARATION OF PUBLIC INTEREST "NATIONAL ACTION PLAN ON GENDER EQUALITY IN CLIMATE ACTION-PGCC NATIONALLY DETERMINED CONTRIBUTION PARIS AGREEMENT"

The "National Action Plan on Gender Equality in Climate Action-PGCC Nationally Determined Contribution Paris Agreement" is declared of public interest, which creates the governance and management mechanism for the promotion, advancement, execution, monitoring, accountability, evaluation, and updating of the work axes and actions of said Plan.
The Central and Decentralized Administration is urged, within the framework of its competencies and in strict adherence to the legal order, to provide all the facilities and cooperation required for the correct, successful, effective, and efficient realization of the aspects described in the previous article.
The Ministry of Environment and Energy-MINAE, as the national governing institution and international focal point on environment and climate action matters, together with the National Institute for Women-INAMU, the national mechanism for the advancement of women's human rights and governing institution on equality between women and men, shall be the coordinating, overseeing, and reporting institutions for the progress and updates of the PGCC.
Said coordination shall include the participation of governing institutions in the prioritized sectors of the PGCC: the Ministry of Agriculture and Livestock-MAG, the Costa Rican Institute of Tourism-ICT, the Ministry of Public Works and Transport-MOPT, the National Commission for Risk Prevention and Emergency Response-CNE, without being exclusive of other institutions that explicitly express their interest in being part of this alliance for the implementation of strategic actions consistent with the objectives of this Plan.
Likewise, the involvement and participation of local governments and regional planning mechanisms is urged, in close coordination with the governance mechanism defined in this decree.
MINAE and INAMU must coordinate the management of specialized technical and financial cooperation—inter-institutional, international, from civil society, and/or public-private—through the designation of the specialized technical teams that articulate initiatives; being able to establish specific public-public and public-private cooperation agreements, including triangular collaborations.
MINAE and INAMU shall define and create a Management Unit with permanent support and communication with the Ministerial and Municipal Offices, which convenes a technical team linked to the counterpart institutions of the PGCC to form the National Network for Effective Equality between Women and Men in Climate Action, which shall have the following functions:
This Network may also integrate the representation of regional mechanisms that incorporate into their inter-institutional and intersectoral work agendas objectives and actions related to those proposed by the National Action Plan on Gender Equality in Climate Action.
The PGCC shall be in force until 2025 and shall be updated every 5 years within the framework of the national updates of the NDC.
It shall take effect as of its publication in the Official Gazette La Gaceta.

I.-Que nuestro país se ha propuesto sentar las bases de la nueva economía del siglo XXI, capaz de responder a los cambios del contexto mundial, transitando hacia una economía verde desde los derechos humanos y la igualdad entre mujeres y hombres, demostrando así que es posible cumplir los compromisos adquiridos en la Agenda 2030 de Desarrollo Sostenible.
II.-Que el Acuerdo de París fue formalizado como Ley de la República N° 9405 el 4 de octubre de 2016 y en su artículo 4 párrafo 2 indica que los países deberán preparar, comunicar y mantener las sucesivas contribuciones determinadas a nivel nacional que tenga previsto efectuar. Y es bajo este marco que Costa Rica entregó su Compromiso Nacionalmente Determinado (NDC) donde se encuentra el compromiso a realizar el Plan de Acción de Género y Cambio Climático.
III.-Que la formulación de la Política Nacional de Cambio Climático fue un proceso pionero en Costa Rica, participativo e innovador, con una alta coordinación interinstitucional y multisectorial que incorpora la perspectiva de género, el enfoque de Derechos Humanos y los conocimientos tradicionales para fortalecer las acciones climáticas de adaptación de los procesos operativos anuales de las instituciones públicas, los entes privados y la sociedad civil.
IV.-Que la aspiración política para el 2030 es ser un país que transforma las amenazas en oportunidades, fortalece sus capacidades y condiciones para la resiliencia social, ambiental y económica, previene y se recupera ante los efectos adversos del cambio climático de forma medible, verificable y reportable.
V.-Que Costa Rica ha ratificado y puesto en marcha acciones a favor de la igualdad entre mujeres y hombres y el avance de los derechos humanos de las mujeres, de acuerdo con lo establecido en normativa supraconstitucional, principalmente la Convención para la Eliminación de todas las formas de Discriminación contra la Mujer-CEDAW y la Declaración y Plataforma de Acción de Beijing.
VI.-Que Costa Rica, en una alianza tripartita entre la Facultad Latinoamericana de Ciencias Sociales-FLACSO, el Ministerio de Ambiente y Energía-MINAE y el Instituto Nacional de la Mujeres-INAMU lideró la Coalición Feminismo por la Justicia Climática del Foro Generación Igualdad, iniciativa mundial de revisión y actualización de la Plataforma de Acción de Beijing.
VII.-Que los Objetivos de Desarrollo Sostenible (ODS) constituyen las aspiraciones universales para poner fin a la pobreza, proteger el planeta y garantizar la paz y prosperidad sin dejar a nadie atrás, siendo la igualdad entre los géneros (ODS 5) y la acción climática (ODS13) dos de los 17 objetivos que contribuyen a dicho propósito.
VIII.-Que existen acuerdos y mandatos internacionales para la incorporación de la perspectiva de género en la acción climática emanados principalmente del Programa de Trabajo de Lima sobre Género acordado en la COP 20 de 2014 y sus Planes de Acción de Género.
IX.-Que en el marco de los compromisos globales emanados del Acuerdo París (2015), Costa Rica presenta en el 2020 la actualización de sus Compromisos Nacionalmente Determinados, entre los que destaca "5.2 Al 2022 el país contará con un Plan de Acción en Género y Cambio Climático." X.-Que la perspectiva de género ha sido considerada como enfoque y eje transversal en las políticas públicas en materia ambiental, cambio climático y gestión del riesgo, en especial, la Política Nacional de Adaptación al Cambio Climático y el Plan Nacional de Descarbonización.
XI.-Que la Política Nacional para la Igualdad Efectiva entre Mujeres y Hombres 2018-2030 contempla la perspectiva de sostenibilidad, así como resultados esperados vinculados a cambio climático en los compromisos institucionales inscritos en sus Planes de Acción.
XII.-Que la alianza interinstitucional entre el Ministerio de Ambiente y Energía y el Instituto Nacional de las Mujeres en materia de igualdad de género y ambiente se consolida significativamente a través de la construcción, implementación y seguimiento del presente Plan, así como del involucramiento proactivo de otras instituciones públicas, gobiernos locales, organizaciones de sociedad civil y cooperación internacional a favor de la igualdad entre mujeres y hombres en armonía con la naturaleza.
XIII.-Que, de conformidad con el Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos, Decreto Ejecutivo Nº 37045-MP-MEIC y sus reformas, se determinó que la presente propuesta no establece ni modifica trámites, requisitos o procedimientos que el administrado deba cumplir, situación por la cual no se procedió con el trámite de control previo. Por tanto;
DECLARATORIA DE INTERÉS PÚBLICO "PLAN DE ACCIÓN NACIONAL SOBRE IGUALDAD DE GÉNERO EN LA ACCIÓN CLIMÁTICA-PGCC COMPROMISO NACIONALMENTE DETERMINADO ACUERDO PARÍS"
Considerando:
Decretan:
Se declara de interés público el "Plan De Acción Nacional Sobre Igualdad De Género En La Acción Climática-PGCC Compromiso Nacionalmente Determinado Acuerdo París" que crea el mecanismo de gobernanza y gestión para la promoción, impulso, ejecución, seguimiento, rendición de cuentas, evaluación, actualización de los ejes de trabajo y acciones de dicho Plan.
Se insta a la Administración Central y Descentralizada para que, dentro del marco de sus competencias y en estricto apego al ordenamiento jurídico, brinden todas las facilidades y cooperación requeridas para la correcta, exitosa, eficaz y eficiente realización de los aspectos descritos en el artículo anterior.
El Ministerio de Ambiente y Energía-MINAE, como institución rectora nacional y punto focal internacional en materia de ambiente y acción climática, junto con el Instituto Nacional de las Mujeres- INAMU mecanismo nacional para el avance de los derechos humanos de las mujeres e institución rectora en materia de igualdad entre mujeres y hombres, serán las instituciones coordinadoras, vigilantes e informantes de los avances y actualizaciones del PGCC.
Dicha coordinación contará con la participación de instituciones rectoras en los sectores priorizados del PGCC: el Ministerio de Agricultura y Ganadería-MAG, el Instituto Costarricense de Turismo-ICT, el Ministerio de Obras Públicas y Transportes-MOPT, la Comisión Nacional para la Prevención del Riesgo y Atención de Emergencias-CNE, sin ser excluyente de otras instituciones que manifiesten explícitamente su interés en formar parte de esta alianza para la implementación de acciones estratégicas consecuentes con los objetivos de este Plan.
Asimismo, se insta el involucramiento y participación de los gobiernos locales y mecanismos de planificación regional, en estrecha coordinación con el mecanismo de gobernanza definido en este decreto.
MINAE e INAMU deberán coordinar la gestión de cooperación técnica y financiera especializada interinstitucional, internacional, de sociedad civil y/o público-privada, mediante la designación de los equipos técnicos especializados que articulen iniciativas; pudiendo establecer convenios específicos de cooperación pública - pública y público-privada, incluyendo triangular colaboraciones.
El MINAE y el INAMU definirán y crearán una Unidad de Gestión con apoyo y comunicación permanente con los Despachos Ministeriales y Municipales, que convoque un equipo técnico vinculado a las instituciones contraparte del PGCC para conformar la Red Nacional de Igualdad Efectiva entre Mujeres y Hombres en la Acción Climática, la cual tendrá las siguientes funciones:
Esta Red también podrá integrar la representación de mecanismos regionales que incorporen en sus agendas de trabajo interinstitucional e intersectorial objetivos y acciones afines a los propuestos por el Plan Nacional de Acción sobre Igualdad de Género en la Acción Climática.
El PGCC tendrá vigencia al 2025 y será actualizado cada 5 años en el marco de las actualizaciones nacionales de la NDC.
