8.2. Unregistered properties.

In addition to the provisions of article 9 of Law No. 8640 and articles 39 and 107 of the Regulations to the Forestry Law, its amendments and this manual, applications for entry on unregistered farms must comply with the following:

8.2.1. The application shall indicate the map number, the applicant’s qualifications, and other information.

Likewise, a photocopy of the cadastral map must be submitted.

8.2.2. The map subject to the application must remain registered and current in accordance with article 71, subsection a) of the Regulations to the National Cadastre Law. In the event the map is cancelled, the application shall be archived.

8.2.3. The Regional Office shall request the documents and statements established in article 9 of Law No. 8640 from those applications that meet the established requirements, for which a period of up to 15 business days will be granted; if these are not provided within the granted period, the application shall be denied and proceed to archiving.

8.2.4. The sworn statements and documents referred to in subsections a), b), c) and d) of numeral 9 of Law No. 8640 must contain the required fiscal stamps and have been issued in the contracting period corresponding to the formulation of the application for entry before Fonafifo. In the case of photocopied documents submitted to meet the requirements of the indicated subsections, they must be notarized or certified by the administrative or judicial entity that issued them.

8.2.5. In the event of submitting witness statements, these must, in addition to what is required in Law No. 8640, indicate the time for which they are aware of the possession of the property and the reasons why they know the circumstances about which they declare.

8.2.6. After the legal authorization, Fonafifo personnel shall conduct an inspection of the land and issue a recommendation that will give approval or not for the signing of the contract or the archiving of the proceeding, according to Annex 3.

8.2.7. If the property subject to the application is located within a Protected Wild Area, the field inspection may be coordinated with the Sistema Nacional de Áreas de Conservación.

In the particular case that SINAC personnel are not part of the field inspection, the report generated by Fonafifo will be sent to the corresponding Conservation Area (Área de Conservación), so that within a period no longer than 10 calendar days it expresses its criteria, regarding the file being consulted by the Fondo Nacional de Financiamiento Forestal; in which it will indicate if there are elements related to the applicant, regarding whether the same is registered in any census of the Conservation Area (Área de Conservación) or has collaborated in volunteer brigades for surveillance or firefighting; if the land indicated in the file is in the process of purchase or expropriation by MINAE; if the applicant has been administratively or judicially denounced for crimes against the environment, at the instance of SINAC; if there are firebreaks or other land demarcation elements and if there are constructions such as houses, corrals, roads, trails, paths, crops, livestock, or other human, agricultural, commercial, and tourist activity on it.

8.2.8. For applications located on INDER farms, in addition to what is established in article 9, subsection b) of Law No. 8640, they must present the document issued by this Institution proving their status as a censused possessor, declared beneficiary, awardee, and the time of holding it.

8.2.9. In the case of SAF-PAF projects, if the property is located outside the Natural Heritage of the State (Patrimonio Natural del Estado) it must meet the following requirements: present a cadastral map, sworn statement authenticated by a notary public (containing the description of the nature of the property, location by province, canton, district, hamlet or local population, indication of the full names of all current adjoining owners, cadastral map number, measurement, time of possession, mode of acquisition, and description of the possessory acts); certification or record from INDER identifying them as an awardee possessor or any other figure. After the legal authorization, Fonafifo personnel shall conduct an inspection of the land and issue a recommendation that will give approval or not for the signing of the contract or the archiving of the proceeding, according to Annex 3. If the property is located within the Natural Heritage of the State (Patrimonio Natural del Estado), it must meet the requirements established in Law No. 8640.

8.2.10 In the case of SAF mixed systems projects, if the property is located outside the Natural Heritage of the State (Patrimonio Natural del Estado) it must meet the following requirements: present a cadastral map, sworn statement authenticated by a notary public (containing the description of the nature of the property, location by province, canton, district, hamlet or local population, indication of the full names of all current adjoining owners, cadastral map number, measurement, time of possession, mode of acquisition, and description of the possessory acts); certification or record from INDER identifying them as an awardee possessor or any other figure. After the legal authorization, Fonafifo personnel shall conduct an inspection of the land and issue a recommendation that will give approval or not for the signing of the contract or the archiving of the proceeding, according to Annex 3. If the property is located within the Natural Heritage of the State (Patrimonio Natural del Estado), it must comply with the requirements established in Law No. 8640.

8.2.11 In the event that the property is eventually registered in the National Registry, the encumbrances and limitations established in the Forestry Law (Ley Forestal) must be applied.

20.12. Keep active an international bank account number (according to its acronym in English IBAN) in colones issued by a banking, financial, mutual and/or savings and credit cooperative entity. Exceptionally, payments may be issued in favor of a third party to whom the contract beneficiary or beneficiaries have assigned their right to payment by means of an assignment document authenticated by a notary public. When there are co-owners, these must indicate to FONAFIFO in the application, in whose name the resources will be disbursed, which will be recorded in the respective contract.

43. Distribution of payment amounts. The distribution of the PSA amount will be in 6 annual installments in the following percentages: 11%, 16%, 17%, 18%, 19%, and 19%, which will be delivered provided the beneficiary has consented through a formal document included in the file. With the resources, Fonafifo will pay the annual interest generated by the pilot projects, and if any PSA balance remains in the transaction, it shall be used to amortize the principal debt.

FIFTH CLAUSE: Price and method of payment FONAFIFO, as consideration for the assignment established in this contract, will pay for the environmental services acquired, a sum of ___ colones per hectare of forest committed to the protection program. FONAFIFO, as provided in Ministerial Resolution ___ _, will make an annual payment for ten years. The first payment will be made after the forest regent certifies to the respective Regional Office the forest area, and that it remains unaltered, fully complying with the obligations acquired in this contract. The payments for the following years will be scheduled and made taking into consideration the signing quarter of this contract and the resources that the Ministry of Finance grants to Fonafifo for this purpose. These disbursements will be conditioned on compliance with the obligations agreed upon in this contract and any others established in the Procedures Manual. From the third disbursement onwards, the respective payment will not be made if the regent's report for the immediately previous year has not been submitted to the satisfaction of Fonafifo.

8.2. Los inmuebles sin inscribir.

Además, de lo dispuesto en el artículo 9 de la Ley N º 8640 y artículos 39 y 107 del Reglamento a la Ley Forestal, sus modificaciones y el presente manual, las solicitudes de ingreso en fincas sin inscribir deberán cumplir con lo siguiente:

8.2.1. En la solicitud se indicará el número de plano, las calidades del solicitante y demás información.

Asimismo, debe presentar fotocopia del plano catastrado.

8.2.2. El plano objeto de la solicitud debe mantenerse inscrito y vigente de conformidad con el artículo 71, inciso a) del Reglamento a la Ley de Catastro Nacional. En caso de cancelarse el plano, procederá al archivo de la solicitud.

8.2.3. La Oficina Regional solicitará los documentos y declaraciones establecidos en el artículo 9 de la Ley N° 8640 de aquellas solicitudes que cumplan con los requisitos establecidos, para lo cual otorgará un plazo de hasta 15 días hábiles, de no aportarse los mismos dentro del plazo conferido se procederá a denegar la solicitud y proceder con el archivo.

8.2.4. Las declaraciones juradas y documentos a las que refieren los incisos a), b), c) y d) del numeral 9 de la Ley N º 8640, deberán contener las especies fiscales y haberse expedido en el periodo de contratación correspondiente a la formulación de la solicitud de ingreso ante Fonafifo. Tratándose de documentos fotocopiados que se presenten para cumplir los requisitos de los incisos señalados, deben encontrarse certificados notarialmente o por la entidad administrativa o judicial que los expida.

8.2.5. En el caso de presentar declaraciones de testigos, estos deberán, además de lo requerido en la Ley N º 8640, indicar el tiempo que les consta la posesión del inmueble y las razones por las cuales conocen las circunstancias sobre las que declaran.

8.2.6. Posterior a la autorización legal, el personal de Fonafifo, realizará una inspección al terreno y emitirá una recomendación que dará el aval o no para la suscripción del contrato o el archivo de la gestión, según anexo 3.

8.2.7. Si el inmueble objeto de la solicitud se ubica dentro de un Área Silvestre Protegida, la inspección de campo podrá ser coordinada con el Sistema Nacional de Áreas de Conservación.

En caso particular de que el personal del SINAC no sea parte de la inspección de campo, el informe generado por Fonafifo será remitido al Área de Conservación correspondiente, a fin de que en un plazo no mayor a 10 días naturales exprese su criterio, sobre el expediente que se le consulte por parte del Fondo Nacional de Financiamiento Forestal; en el cual indicará si existen elementos relacionados al solicitante, en cuanto a si el mismo se encuentra inscrito en algún censo del Área de Conservación o haya colaborado en brigadas voluntarias de vigilancia o lucha contra incendios; si el terreno indicado en el expediente se encuentra en trámite de compra o expropiación por parte del MINAE; si el solicitante ha sido denunciado administrativa o judicialmente por delitos en contra del medio ambiente, a instancia del SINAC; si existen carriles u otros elementos de delimitación de terreno y si en el mismo existen construcciones como casas, corrales, caminos trochas, senderos, cultivos, ganado u otra actividad humana, agrícola, comercial y turística.

8.2.8. Para el caso de solicitudes que se ubiquen en fincas INDER, además a lo establecido en el artículo 9 inciso b) de la Ley Nº 8640, deberán presentar el documento emitido por esta Institución, que demuestre su condición de poseedor censado, declarado beneficiario, adjudicatario y el tiempo de ostentarla.

8.2.9. Tratándose de proyectos SAF-PAF, si el inmueble se ubica fuera del Patrimonio Natural del Estado deberá cumplir con los siguientes requisitos: presentar plano catastrado, declaración jurada autenticada por notario público (que contenga la descripción de la naturaleza del inmueble, ubicación por provincia, cantón, distrito, caserío o población local, indicación de los nombres completos de todos los colindantes actuales, número de plano catastrado, medida, tiempo de poseerlo, modo de adquisición y descripción de los actos posesorios); constancia o certificación del INDER donde se tenga como poseedor adjudicatario o cualquier otra figura. Posterior a la autorización legal, el personal de Fonafifo, realizará una inspección al terreno y emitirá una recomendación que dará el aval o no de la suscripción del contrato o el archivo de la gestión, según anexo 3. Si el inmueble se ubica dentro del Patrimonio Natural del Estado, deberá cumplir con los requisitos establecidos en la Ley Nº 8640.

8.2.10 Tratándose de proyectos SAF sistemas mixtos, si el inmueble se ubica fuera del Patrimonio Natural del Estado deberá cumplir con los siguientes requisitos: presentar plano catastrado, declaración jurada autenticada por notario público (que contenga la descripción de la naturaleza del inmueble, ubicación por provincia, cantón, distrito, caserío o población local, indicación de los nombres completos de todos los colindantes actuales, número de plano catastrado, medida, tiempo de poseerlo, modo de adquisición y descripción de los actos posesorios); constancia o certificación del INDER donde se tenga como poseedor adjudicatario o cualquier otra figura. Posterior a la autorización legal, el personal de Fonafifo, realizará una inspección al terreno y emitirá una recomendación que dará el aval o no de la suscripción del contrato o el archivo de la gestión, según anexo 3. Si el inmueble se ubica dentro del Patrimonio Natural del Estado, deberá cumplir con los requisitos establecidos en la Ley N º 8640.

8.2.11 En el supuesto en que el inmueble se llegue a inscribir en el Registro Nacional deberá procederse con las afectaciones y limitaciones establecidas en la Ley Forestal.

20.12. Mantener activo un número de cuenta bancaria internacional (de acuerdo a sus siglas en inglés IBAN) en colones emitida por una entidad bancaria, financieras, mutual y/o cooperativa de ahorro y crédito. Excepcionalmente podrán emitirse los pagos a favor de un tercero a quien el o los beneficiarios del contrato hayan cedido su derecho al pago mediante un documento de cesión autenticado por un notario público. Cuando existan co-propietarios, éstos deberán de indicar al FONAFIFO en la solicitud, a nombre de quien se girarán los recursos, lo cual estará consignado en el contrato respectivo.

43. Distribución de los montos de pago. La distribución del monto de PSA será en 6 tractos anuales en los siguientes porcentajes: 11 %, 16%, 17%, 18%, 19% y 19%, que se entregará siempre y cuando el beneficiario haya consentido mediante documento formal que conste en el expediente. Con los recursos Fonafifo cancelara el interés anual generado por los proyectos del piloto y de quedar algún saldo del PSA en la transacción, que este se utilice para amortizar la deuda del principal.

CLÁUSULA QUINTA: Del precio y forma de pago FONAFIFO, como contraprestación por la cesión establecida en este contrato, pagará por los servicios ambientales adquiridos, una suma de ___ colones por cada hectárea de bosque comprometida en el programa de protección. FONAFIFO según lo dispuesto en la Resolución Ministerial ___ _, realizará un pago anual durante diez años. El primer pago se realizará después de que el regente forestal certifique ante la Oficina Regional respectiva, el área de bosque, y que la misma se mantiene inalterada, cumpliendo a cabalidad las obligaciones adquiridas en el presente contrato. Los pagos de los años siguientes serán programados y realizados tomando en consideración el trimestre de firma del presente contrato y los recursos que al efecto otorgue el Ministerio de Hacienda a Fonafifo. Estos desembolsos estarán condicionados al cumplimiento de las obligaciones pactadas en este contrato y a cualesquier otras establecidas en el Manual de Procedimiento. A partir del tercer desembolso no se realizará el pago respectivo si no se ha presentado a satisfacción de Fonafifo el informe de regencia del año inmediato anterior.
