en la totalidad del texto - Complete Text of Norm 44006 Declaration of National Convenience for the Project called "Industrial Park Project HT Administrative File No. D1-0218-2020-SETENA" No. 44006-MINAE-MOPT THE PRESIDENT OF THE REPUBLIC, THE MINISTER OF ENVIRONMENT AND ENERGY AND THE MINISTER OF PUBLIC WORKS AND TRANSPORT In exercise of the powers conferred upon them by articles 50, 140 subsections 3) and 18), and 146 of the Political Constitution; articles 27 subsection 1) and 28 subsection 2) heading b) of the General Law of Public Administration No. 6227 of May 2, 1978; the Law Creating the Ministry of Public Works and Transport No. 3155 of August 5, 1963, amended by Law No. 4786 of July 5, 1971; articles 3 subsection m), 19 subsections b), 33 and 34 of the Forestry Law (Ley Forestal) No. 7575 of February 13, 1996; article 2 subsection m) of the Regulation to the Forestry Law, Executive Decree No. 25721-MINAE of October 17, 1996; and articles 1 and 2 of the Organic Law of the Ministry of Environment and Energy No. 7152 of June 5, 1990.
I.-That the project "Industrial Park HT Administrative File No. Dl-0218-2020-Setena" arises from the need to expand free zones to places where a series of logistical, human, and financial facilities exist for the construction and operation of this type of economy and the dynamics it entails, which today generates thousands of jobs in all areas of the country, in both rural and urban zones.
II.-That the project is linked to the National Public Development and Investment Plan 2023-2029, an instrument built from the best international practices in public policy planning and evaluation, where those strategic areas with high potential for the economic and social development required by our country are considered (MIDEPLAN 2022). It also serves as the country's main medium-term public policy instrument, where the democratic promise is materialized and validated directly by the government mandate given at the ballot box in the past democratic election process.
III.-That the project is strategically located with direct access to the North Inter-American Highway or National Route No. 1, according to the approval before the Restricted Access Highways Commission (MOPT), which facilitates access to the country's main highways and ports. Being located just fifteen minutes from the Juan Santamaría International Airport, in the western part of the Central Valley, this Industrial Park benefits from the differentiated incentives of the Free Zone for projects outside the Greater Metropolitan Area. Furthermore, it is located no more than thirty minutes from the main western cities, providing access to a new and ample quarry of valuable, prepared human talent, eager for opportunities and with an outstanding technical and academic level.
IV.-That as part of the project is the construction of the overpass and its roundabout on National Route No. 1, which generates total and efficient interaction without road impact for each of the route's users, as well as for the thousands of people who will constantly enter and leave this free zone 24 hours a day. This in turn will notably improve, with first-world standards, the limited level of traffic service currently present in this zone.
V.-That the total budget for the project amounts to ¢137,608,793,595 (one hundred thirty-seven thousand six hundred eight million seven hundred ninety-three thousand five hundred ninety-five colones). Considering an exchange rate of 1 USD = ₡638.30 (12-month average), the result is a dollar budget of $215,586,391 USD (two hundred fifteen million five hundred eighty-six thousand three hundred ninety-one). As a note for the project cost issue, due to the project's dimension and the time it takes to fully develop the park, initially parametric budgets per m2 are worked with based on company historical data, and as investments are carried out, budgets are refined according to information from the Zona Franca Evolution Project.
VI.-That the project will benefit approximately a population of 5,870 people, which represents approximately 27% of the inhabitants of the Tacares and Puente de Piedra districts and 7% of the canton's population.
VII.-That the Project called: "Industrial Park HT", which includes the Access-interconnection National Route 01, under the protection of article 17 of the Organic Law of the Environment No. 7554, has the respective environmental feasibility (viabilidad ambiental) issued by the National Environmental Technical Secretariat (Secretaria Técnica Nacional Ambiental, SETENA), according to Resolution No. 1500-2020-SETENA of 11 hours 28 minutes of August 26, 2020 (administrative file No. D1-0218-2020-SETENA).
VIII.-That in accordance with official letter No. ACC-PNE-C-007 of March 9, 2023, issued by the Central Conservation Area, Central Volcanic Mountain Range Biosphere Reserve, Regional Directorate of the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación, SINAC), it was stated regarding the project site Construction of overpass and roundabout for access to HT Evolution Free Zone File 01-36/01-19, that: "... it is located outside of State Natural Heritage (Patrimonio Natural del Estado, PNE) lands, defined in article 13 of the Forestry Law No. 7575, and outside of any protected wild area, whatever its management category administered by the National System of Conservation Areas." IX.-That articles 19 subsection b) and 34 of the Forestry Law No. 7575 prohibit land-use change (cambio de uso del suelo) and the cutting of trees on private lands covered with forest, as well as the cutting of trees in the protection areas defined in numeral 33 of the same regulatory body, excepting those state or private projects that the Executive Branch declares of National Convenience, constituting these as those projects whose social benefits are greater than the socio-environmental costs.
X.-That due to the preceding Considering, the economic-social evaluation of the cited project was prepared through the Economic Evaluation Report No. MOPT-01-06-01-001-2023 (CT) of March 2023 and the Social Diagnosis of January 2020, which were submitted for assessment by the Ministry of Environment and Energy, in order to weigh that the social benefits are superior to the socio-environmental costs, under subsection m) of article 03 of the Forestry Law No. 7575, the foregoing in order for the respective recommendations to be issued, which, as pertinent, stated that the procedure used by the developer allows for the demonstration of social well-being, and ultimately it was established:
"In conclusion, the project would allow for promoting direct foreign investment and commercial exchange, as well as generating quality employment for the country.
(...)
For this reason, considering the foregoing and in view that there are only 25 trees included in the inventory, and in this particular case, the declaration of national convenience could be granted to the project." XI.-That, in accordance with the Regulation to the Law for the Protection of the Citizen from an Excess of Requirements and Administrative Procedures, Executive Decree No. 37045-MP-MEIC of February 22, 2012, and its amendments, it is determined that this proposal does not establish or modify procedures, requirements, or formalities that the administered party must comply with, a situation for which the prior control procedure was not carried out. I.-Que el proyecto "Parque Industrial HT Expediente Administrativo N° Dl-0218-2020-Setena" surge de la necesidad de expandir las zonas francas a lugares donde se dan una serie de facilidades tanto logísticas, humanas y financieras para la construcción y puesta en operación de este tipo de economía y la dinámica que esta conlleva, donde hoy por hoy genera miles de empleos en todas las zonas del país, tanto en zonas rurales como urbanas.
II.-Que el proyecto se encuentra vinculado al Plan Nacional de Desarrollo e Inversión Pública 2023-2029, un instrumento que se construye a partir de las mejores prácticas internacionales en materia de planificación y evaluación de las políticas públicas, donde se consideran aquellos ámbitos estratégicos con alto potencial hacia el desarrollo económico y social requerido por nuestro país (MIDEPLAN 2022). También, sirve de instrumento principal de política pública de mediano plazo para el país, donde la promesa democrática se concreta y se valida de forma directa por el mandato de gobierno dado en las urnas en el pasado proceso de elecciones democráticas.
III.-Que el proyecto se encuentra estratégicamente ubicado con acceso directo a la Carretera Interamericana Norte o Ruta Nacional N° 1, según la aprobación ante la Comisión de Carreteras de Acceso Restringido (MOPT), lo que facilita el acceso a las principales carreteras y puertos del país. Al estar ubicado a solo quince minutos del Aeropuerto Internacional Juan Santamaria, en la parte occidental del Valle Central, este Parque Industrial se beneficia de los incentivos diferenciados de la Zona Franca para proyectos fuera de la Gran Área Metropolitana. Además, se encuentra a no más de treinta minutos de las principales ciudades de occidente, brindando acceso a una nueva y amplia cantera de talento humano valioso, preparado, ávido de oportunidades y con un destacado nivel técnico y académico.
IV.-Que como parte del proyecto se encuentra la construcción del paso elevado y su rotonda sobre Ruta Nacional N° 1, lo que genera una interacción total y eficiente sin impacto vial para cada uno de los usuarios de la ruta, así como para los miles de personas que entrarán y saldrán de manera constante las 24 horas del día de esta zona franca. Esto a su vez mejorará notablemente con estándares de primer mundo, el limitado nivel de servicio al tránsito hoy por hoy que se presenta en esta zona.
V.-Que el presupuesto total del proyecto asciende a ¢137.608,793.595 (ciento treinta y siete mil seiscientos ocho millones setecientos noventa y tres mil quinientos noventa y cinco colones). Considerando un tipo de cambio de 1 USD =$638,30 (promedio 12 meses), resulta un presupuesto en dólares de $215,586,391 USD (doscientos quince millones quinientos ochenta y seis mil trecientos noventa y uno). Como nota para el tema de costos del proyecto se tiene que por la dimensión del mismo y el tiempo que se tarda desarrollando por completo el parque, inicialmente se trabajan con presupuestos paramétricos por m2 según históricos de la empresa y conforme se van llevando a cabo las inversiones, se van afinando los presupuestos según información del Proyecto Zona Franca Evolution.
VI.-Que el proyecto beneficiará aproximadamente a una población de 5.870 personas, que representa aproximadamente el 27% de los habitantes de los distritos Tacares y Puente de Piedra y el 7% de la población del cantón.
VII.-Que el Proyecto denominado: "Parque Industrial HT", el cual contempla los Accesos-interconexión Ruta Nacional 01, al amparo del artículo 17 de la Ley Orgánica del Ambiente N° 7554, cuenta con la respectiva viabilidad ambiental emitida por la Secretaria Técnica Nacional Ambiental (SETENA), según Resolución N° 1500-2020-SETENA de las 11 horas 28 minutos del 26 de agosto de 2020 (expediente administrative N° D1-0218-2020- SETENA).
VIII.-Que de conformidad con el oficio N° ACC-PNE-C-007 del 9 de marzo de 2023, emitido por el Área de Conservación Central, Reserva de Biósfera Cordillera Volcánica Central, Dirección Regional del Sistema Nacional de Áreas de Conservación (SINAC), se hizo constar sobre el sitio del proyecto Construcción de paso a desnivel y rotonda para acceso a Zona Franca HT Evolution Expediente 01-36/01-19, que: "., se encuentra fuera de terrenos Patrimonio Natural del Estado (PNE), definido este en el artículo 13 de la Ley Forestal N° 7575, y fuera de cualquier área silvestre protegida, sea cual sea su categoría de manejo administrada por el Sistema Nacional de Áreas de Conservación".
IX.-Que los artículos 19 inciso b) y 34 de la Ley Forestal N° 7575 prohíben el cambio de uso de suelo y la corta de árboles en terrenes privados cubiertos de bosque, así como la corta de árboles en las áreas de protección definidas en el numeral 33 del mismo cuerpo normativo, exceptuando aquellos proyectos estatales o privados que el Poder Ejecutivo declare de Conveniencia Nacional, constituyéndose en estos, aquellos proyectos cuyos beneficios sociales son mayores a los costos socio ambientales.
X.-Que en razón del Considerando anterior, se elaboró la evaluación económica-social del citado proyecto mediante los informes de Evaluación Económica N° MOPT-01-06-01- 001- 2023 (CT) de marzo 2023 y Diagnóstico Social de enero 2020, los cuales fueron sometidos a valoración por parte del Ministerio de Ambiente y Energía, en aras de ponderar que los beneficios sociales sean superiores a los costos socio-ambientales, al amparo del inciso m) del artículo 03 de la Ley Forestal N° 7575, lo anterior a efecto de que se emitieran las recomendaciones respectivas, mismas que en lo conducente, refirieron que el procedimiento utilizado por el desarrollador permite demostrar el bienestar social, y a la postre se estableció:
"En conclusión, el proyecto permitiría promover la inversión extranjera directa y el intercambio comercial, así como generar empleo de calidad para el país.
(...)
Por tal motivo, considerando lo anterior y en vista que únicamente son 25 árboles los incluidos en el inventario, y en este caso en particular, al proyecto podría otorgársele la declaratoria de conveniencia nacional." XI.-Que, de conformidad con el Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos, Decreto Ejecutivo N° 37045-MP-MEIC del 22 de febrero de 2012 y sus reformas, se determine que la presente propuesta no establece ni modifica trámites, requisitos o procedimientos que el administrado deba cumplir, situación por la que no se procedió con el trámite de control previo.
