Considerandos:
2726, which creates the Institute to direct, set policies, establish and apply standards, carry out and promote planning, financing, and development, and to resolve everything related solely to the supply of potable water and the collection and evacuation of blackwater and liquid industrial waste, as well as the regulatory aspect of storm sewer systems in urban areas, for the entire national territory.
Under this hypothesis, it may only perform those acts or provide those public services that said system authorizes, according to the hierarchical scale of its sources. In such a way, the acts emanating from it must be previously authorized by written norm, that is, the act must be regulated.
Furthermore, Article 4 indicates that every procedure or requirement, regardless of its normative source or the subject matter involved, in order to be demanded from the administered party, must be set forth in a law, an executive decree, a regulation, or in administrative provisions such as general resolutions. Furthermore, it must be published in the Official Gazette La Gaceta and in the National Catalog of Procedures. In the case of instructions, manuals, forms, annexes, and other documents corresponding to a procedure or requirement, they must be published in the National Catalog of Procedures, having to previously comply with the regulatory control ordered by the Ministry of Economy, Industry and Commerce (MEIC). The information offices for the administered party of the entities or bodies of the Public Administration will be responsible for explaining the procedures or requirements to the administered party. In the event of not having such an office, the institution must designate a department or an official for this purpose.

Por tanto; Based on the provisions of Article 11 of the Political Constitution, Articles 4, 11, and 16 of the General Law of Public Administration, Articles 3 and 4 of Law 8220 and its reforms Law 8990 and Law 10700, Articles 4 and 5 of Executive Decree No. 37045-MP-MEIC and its reforms, and Articles 1, 2, 5, and 11 of the Constitutive Law of AyA, the following modification to the RPS is approved:
"Article 36.-Regarding the issuance of the certificate of service availability (constancia de disponibilidad de servicios). Once the requirements and conditions established in Article 30 of this regulation have been reviewed and verified to the satisfaction of AyA, the certificate of service availability (constancia de disponibilidad de servicios) will be issued within a maximum term of up to 15 business days, both for cases of individual housing and commerce, and for residential, industrial, and commercial urban development projects.
Said certificate shall indicate at least the following: date, sequential number, real estate folio number, exact address of the property, cadastral or survey plan, nature of the project, quantity of allocated flow, number of services considered, measurement type, technical criterion, sequential number, electronic signature (fi) and seal in case the document is issued in physical form.
The technical criterion that supports the certificate must refer to the water and hydraulic capacity conditions presented by the aqueduct and/or sanitation system, which by coverage correspond to the property indicated in the request; additionally, it must contain the verification and analysis solely of the aspects established in the official procedure approved and published by AyA.
When there is no sanitary sewer network planned, and in order to address another type of sanitary solution, housing may be exempted, and the construction of wastewater treatment plants will be recommended when appropriate.
For requests regarding properties belonging to ministries, institutions attached to the central government, autonomous institutions, and education boards that present any delinquency on the property indicated in the application, AyA will issue the certificate, on the understanding that the payment management is in the process of being applied in favor of AyA.
The certificates will be issued by the Operational Deputy Managements of System Management or by the Deputy Management of Delegated System Management, respectively, as appropriate according to the established procedure.
Regarding requests made by third parties in good faith who receive service provision from another type of non-legalized operator, the provisions of Article 46 of this regulation will apply. It will be the responsibility of the Deputy Management of Delegated System Management to issue the certificates for the ASADAS that do not have a Delegation Agreement or have an expired legal status.
The issuance of this certificate shall not yield any pecuniary cost for the applicant." Firm Agreement.

Considerandos:
Bajo esta hipótesis, solo podrá realizar aquellos actos o prestar aquellos servicios públicos que autorice dicho ordenamiento, conforme a la escala jerárquica de sus fuentes. De tal forma, los actos que de ella emanen, deberán estar previamente autorizados por norma escrita, es decir, el acto deberá estar regulado.
Además, el artículo 4 indica que todo trámite o requisito, con independencia de su fuente normativa o de la materia de que se trate, para que pueda exigirse al administrado deberá, constar en una ley, un decreto ejecutivo, un reglamento o en disposiciones administrativas como resoluciones generales. Además, deberá estar publicado en el diario Oficial La Gaceta y en el Catálogo Nacional de Trámites. Para el caso de los instructivos, manuales, formularios, anexos y demás documentos correspondientes a un trámite o requisito, deberán estar publicados en el Catálogo Nacional de Trámites, debiendo cumplir de previo con el control regulatorio ordenado por el Ministerio de Economía, Industria y Comercio (MEIC). Las oficinas de información al administrado de las entidades u órganos de la Administración Pública serán las encargadas de explicar al administrado los trámites o requisitos. En caso de no contar con esa oficina, la institución deberá designar un departamento o un funcionario para este fin.

Además, mediante la revisión permanente de los procesos de trámites que ejecuta la Administración Pública, se eliminarán los excesos de documentación y requisitos que no tengan fundamento legal y no cuenten con los respectivos estudios técnicos que los justifiquen. 10 .-Que los artículos 4 y 16 de la Ley General de la Administración Pública, disponen lo siguiente:
(...)." 11.-Que la Ley Constitutiva de AyA, Ley 2726 establece en sus artículos 5 y a 11 respectivamente lo siguiente:

i. Dictar, reformar e interpretar los reglamentos internos necesarios para el mejor desarrollo de los fines del Instituto; (.)
Por tanto; Con fundamento en lo dispuesto en el artículo 11 de la Constitución Política, artículos 4, 11 y 16 de la Ley General de la Administración Pública, artículos 3 y 4 de la Ley 8220 y sus reformas Ley 8990 y Ley 10700, artículos 4 y 5 del Decreto Ejecutivo N° 37045-MP-MEIC y sus reformas, y artículos 1, 2, 5 y 11 de la Ley Constitutiva de AyA, se aprueba la siguiente modificación al RPS:
"Artículo 36.-De la emisión de la constancia de disponibilidad de servicios. Una vez revisados y verificados a satisfacción de AyA los requisitos y condiciones establecidos en el artículo 30 del presente reglamento, se emitirá la constancia de disponibilidad de servicios dentro de un plazo máximo de hasta 15 días hábiles, tanto para los casos de vivienda y comercio individuales, como para proyectos de desarrollos urbanísticos habitacionales, industriales y comerciales.
En dicha constancia se indicará como mínimo lo siguiente: fecha, número de consecutivo, número de folio real, dirección exacta de la propiedad, plano catastrado o de agrimensura, naturaleza del proyecto, cantidad de caudal asignado, número de servicios considerados, tipo de medición, criterio técnico, número de consecutivo, fi y sello en caso de que se extienda el documento de forma física.
El criterio técnico que fundamentará la constancia deberá referirse a las condiciones de capacidad hídrica e hidráulica que presenta el sistema de acueducto y/o saneamiento, que por cobertura corresponden al inmueble indicado en la solicitud; adicionalmente deberá contener la verificación y análisis, únicamente de los aspectos establecidos en el procedimiento oficial aprobado y divulgado por AyA.
Cuando no exista red de alcantarillado sanitario prevista, y con el fin de atender otro tipo de solución sanitaria, se podrá exonerar a las viviendas, asimismo se recomendará la construcción de plantas de tratamiento de aguas residuales cuando corresponda.
Para el caso de solicitudes referidas a inmuebles pertenecientes a ministerios, instituciones adscritas al gobierno central, instituciones autónomas y juntas de educación, que presenten alguna morosidad en la finca indicada en la gestión, AyA emitirá la constancia, en el entendido de que la gestión de pago se encuentra en proceso de aplicación a favor de AyA.
Las constancias serán emitidas por las Subgerencias Operativas de Gestión de Sistemas o por la Subgerencia de Gestión de Sistemas Delegados, respectivamente según corresponda conforme al procedimiento establecido.
En cuanto a solicitudes que realicen terceros de buena fe que reciban la prestación del servicio por parte de otro tipo de operador no legalizado, se aplicará lo establecido en el artículo 46 del presente reglamento. Corresponderá a la Subgerencia de Gestión de Sistemas Delegados emitir las constancias para las ASADAS que no cuenten con Convenio de Delegación o tengan la personería vencida.
La emisión de esta constancia no devengará ningún costo pecuniario para el solicitante".
