Full Text of Standard 040 Decree establishing a closed season for sardine fishing with any fishing gear COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE AJDIP/040-2023.—Puntarenas, on the twenty-eighth day of February, two thousand twenty-three.
1.—That through Board of Directors agreement AJDIP/049-2020, a closed season was established for semi-industrial sardine purse-seine (bolichera/cerco) fishing, in the area comprised by an imaginary line running from Punta Agujas (84°38´57´´ West Longitude, 09°43´46´´ North Latitude) to the Lighthouse of Isla Negritos afuera (84°49´35´´ West Longitude, 09°49´14´´ North Latitude) and from there to the eastern part of Punta Cuchillo on the Nicoya Peninsula (09°50´03" North Latitude, 084°53´42" West Longitude) and from these lines seaward to the mouth of the Tempisque River; from March 1 through May 31.
2.—That Board of Directors agreement AJDIP/049-2020 established the sardine closed season permanently for at least 5 years, until such time as new scientific research determines a change to the agreement.
3.—That additionally, official communication INCOPESCA-DOPA-009-2023 is submitted, in relation to the study carried out by the Research Department for the characterization of catches made by the semi-industrial sardine fleet during the months of June and July (small-scale closed season), in Zone C of the Gulf of Nicoya, as stipulated by Board of Directors agreement AJDIP/100-2021.
4.—That in accordance with the preceding considering clause, a biologist observer from INCOPESCA’s Fisheries Research Department worked on board each of the semi-industrial sardine purse-seine (bolichera/cerco) fishing vessels during the indicated period to determine the relationship between the catch of target species (sardine Ophistonema sp) and non-target species or bycatch (corvina, jacks, mackerel, barracuda, among others).
5.—That the bycatch for sardine fishing in the study conducted in 2022 represented less than 3% of the total catch of the vessels and falls within the maximum 10% tolerance margin pursuant to that established through Board of Directors agreement AJDIP/049-2020.
6.—That the Fisheries and Aquaculture Management Directorate will additionally establish the corresponding measures to ensure that all landings (descargas) carried out as part of this agreement are duly inspected by the Enforcement Department. In turn, the Research Department will conduct biological sampling of said catches to evaluate the reproductive behavior of the sardines.
7.—That the Fisheries and Aquaculture Management Directorate held meetings with the representatives of the semi-industrial sardine purse-seine (bolichera/cerco) fishing sector, in which they requested that the original measures dating from 2018 be reinstated, allowing entry to fish one day a week into the closed area defined as Tárcoles, in order to supply sardine for bait to the national fishing fleet.
8.—That, with the implementation of this closed season, as conceived, the pressing need to protect the sardine resource during its reproductive stage is addressed in pursuit of the sustainability of this fishery resource and, at the same time, to resolve the bait requirements of the national fishing fleet, reason for which, the Board of Directors of the Costa Rican Institute of Fisheries and Aquaculture, Therefore; AGREES 1.—To acknowledge receipt of official communication INCOPESCA-PE-DOPA-014-2023 and to decree a closed season for sardine fishing with any fishing gear from March 1, 2023, through May 31, 2023, in the following zones of the Costa Rican Pacific coastline:
Zone C of the Gulf of Nicoya, which for the purposes of this agreement is that which is comprised by an imaginary line starting at the zone known as Peñón or Roca Carballo (9° 53' 57.54 North Latitude and 84° 43'47.99 West Longitude) and extending to the lighthouse at Punta de Isla Negritos afuera (84°49´35´´ West Longitude, 09°49´14´´ North Latitude); from there another imaginary line to Punta Cuchillo on the Nicoya Peninsula (09°50´03" North Latitude, 084°53´42" West Longitude) and from this point another imaginary line to Punta del muelle grande in Puntarenas (9° 58´ 36.03´´ North Latitude 84° 51´ 03.93´´ West Longitude).
In addition to the area described above, another area is added in which this closed season also applies: from the zone known as Peñón or Roca Carballo (9° 53' 57.54 North Latitude and 84° 43'47.99 West Longitude) an imaginary line that extends to Punta Agujas (84°38´57´´ West Longitude, 09°43´46´´ North Latitude) and from this point another imaginary line to the lighthouse at Punta de Isla Negritos afuera, from this point another imaginary line to Punta Cuchillo on the Nicoya Peninsula (09°50´03" North Latitude, 084°53´42" West Longitude) and from that last point another imaginary line to Peñon or Roca Carballo (9° 53' 57.54 North Latitude and 84° 43'47.99 West Longitude). This new area is called Tárcoles, for the purposes of this agreement.
2.—During this closed season, in the zone called Tárcoles, the entry of one of the two semi-industrial sardine vessels is authorized to fish one day a week, in order to supply sardine for bait to the national fishing fleet. Surpluses may be marketed for other purposes as established in Board of Directors agreement AJDIP/100-2021. This access will be used in 12-hour daytime slots, each one on an alternating weekly basis by each vessel, so that both vessels cannot be within said area in the same week, and prior to their entry, their owners, shipowners, or Captain must coordinate the week in which each vessel will enter and must notify the INCOPESCA Registry Department and Enforcement Department of the schedule with the date and time of entry for each vessel into the established zone during the closed season.
3.—That all landings (descargas) carried out by the semi-industrial sardine purse-seine fleet will be duly inspected by the Institution’s inspectors. Said inspection must cover not only the sardine landings, but also that of the accompanying fauna. In turn, the Fisheries Research Department will conduct biological sampling of said catches to evaluate the reproductive behavior of the sardines and compliance with the legal minimum size at first capture.
4.—As long as new research is not available, it is recommended to maintain the sardine closed season under the conditions established in agreement AJDIP/049-2020.
5.—Agreement is final. Let it be published and communicated. It takes effect as of March 1, 2023.

2º-Durante esta veda, en la zona denominada Tárcoles, se autoriza el ingreso de una de las dos embarcaciones semi-industrial sardineras para faenar un día a la semana, a efectos de que puedan suplir sardina para carnada a la flota pesquera nacional. Los excedentes podrán ser comercializados para otros fines según lo establecido en el acuerdo de Junta Directiva AJDIP/100-2021. Este acceso será utilizado en franjas diurnas de 12 horas cada una de forma semanal alterna por cada embarcación de modo que no podrán estar dentro de dicha área las 2 embarcaciones en la misma semana y de previo a su ingreso, deberán sus propietarios, armadores o Capitán; coordinar la semana en que ingresará cada embarcación y deberán notificar al Departamento de Registro y al Departamento de Fiscalización del Incopesca el cronograma con la fecha y hora de ingreso de cada embarcación a la zona establecida durante la temporada de veda.
4º-Mientras no se cuente con nuevas investigaciones, se recomienda mantener la veda de sardina en las condiciones establecidas en el acuerdo AJDIP/049-2020.
5º-Acuerdo en firme. Publíquese y comuníquese. Rige a partir del 01 de marzo del 2023.
