in the entirety of the text - Full Text of Regulation 040 Decrees a closed season for sardine fishing with any fishing gear COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE AJDIP/040-2023.-Puntarenas, on the twenty-eighth day of the month of February two thousand twenty-three.

1. 1That through Board of Directors agreement AJDIP/049-2020, a closed season was established for semi-industrial sardine purse-seine (bolichera (cerco)) fishing, in the area comprised by an imaginary line running from Punta Agujas (84°38´57´´Longitud Oeste, 09°43´46´´ Latitud Norte) to the outer lighthouse of Isla Negritos (84°49´35´´ Longitud Oeste, 09°49´14´´ Latitud Norte) and from there to the eastern part of Punta Cuchillo on the Nicoya Peninsula (09°50´03"Latitud Norte, 084°53´42" Longitud Oeste) and from these lines seaward to the mouth of the Tempisque River; from March 1 through May 31
2. 2That Board of Directors agreement AJDIP/049-2020 established the sardine closed season on a permanent basis for at least 5 years, until such time as new scientific research determines a change to the agreement.
3. 3That additionally, official memorandum INCOPESCA-DOPA-009-2023 is presented, in relation to the study carried out by the Research Department, for the characterization of catches made by the semi-industrial sardine fleet during the months of June and July (small-scale closed season), in Zone C of the Golfo de Nicoya, as provided by Board of Directors agreement AJDIP/100-2021.
4. 4That in accordance with the preceding considering clause, a biologist observer from the Fisheries Research Department of INCOPESCA worked aboard each of the semi-industrial sardine purse-seine (bolichera (cerco)) vessels during the aforementioned period to determine the catch ratio between the target species (sardina Ophistonema sp) and non-target species or bycatch (corvina, jureles, macarela, barracuda, among others).
5. 5That bycatch for sardine fishing in the study conducted in the year 2022 represented less than 3% of the total catch of the vessels and falls within the maximum 10% tolerance margin as established by Board of Directors agreement AJDIP/049-2020.
6. 6That the Directorate of Fisheries and Aquaculture Management will additionally establish the corresponding measures to ensure that all landings made as part of this agreement are duly inspected by the Enforcement Department. In turn, the Research Department will conduct biological sampling of said catches to evaluate the reproductive behavior of sardines.
7. 7That the Directorate of Fisheries and Aquaculture Management held meetings with representatives of the semi-industrial sardine purse-seine (bolichera (cerco)) sector, in which they requested that the original measures dating from 2018 be reestablished, allowing entry to fish one day per week in the closed area defined as Tárcoles, in order to supply sardine for bait to the national fishing fleet.
8. 8That, with the implementation of this closed season, as conceived, the pressing need to protect the sardine resource during its reproduction stage is addressed, in pursuit of the sustainability of this fishery resource, and at the same time the bait requirements of the national fishing fleet are met, reason for which, the Board of Directors of the Instituto Costarricense de Pesca y Acuicultura, Therefore;

AGREES 1º-To acknowledge receipt of official memorandum INCOPESCA-PE-DOPA-014-2023 and decree a closed season for sardine fishing with any fishing gear from March 01, 2023 through May 31, 2023, in the following zones of the Costa Rican Pacific coastline:

Zone C of the Golfo de Nicoya, which for the purposes of this agreement is that which is comprised by an imaginary line that begins at the area known as El Peñón or Roca Carballo (9° 53' 57.54 Latitud Norte and 84° 43'47.99 Longitud Oeste) and extends to the outer lighthouse of Punta de Isla Negritos (84°49´35´´ Longitud Oeste, 09°49´14´´ Latitud Norte); from there another imaginary line to Punta Cuchillo on the Nicoya Peninsula (09°50´03"Latitud Norte, 084°53´42" Longitud Oeste) and from this point another imaginary line to the Punta of the large pier in Puntarenas (9° 58´ 36.03´´ Latitud Norte 84° 51´ 03.93´´Longitud Oeste) In addition to the area described above, another area is added in which this closed season also applies: from the area known as El Peñón or Roca Carballo ((9° 53' 57.54 Latitud Norte and 84° 43'47.99 Longitud Oeste) an imaginary line that extends to Punta Agujas (84°38´57´´Longitud Oeste, 09°43´46´´ Latitud Norte) and from this point another imaginary line to the lighthouse at Punta de Isla Negritos offshore, from this point another imaginary line to Punta Cuchillo on the Nicoya Peninsula (09°50´03"Latitud Norte, 084°53´42" Longitud Oeste) and from that last point another imaginary line to El Peñón or Roca Carballo (9° 53' 57.54 Latitud Norte and 84° 43'47.99 Longitud Oeste). This new area is called Tárcoles, for the purposes of this agreement.

2º-During this closed season, in the zone called Tárcoles, the entry of one of the two semi-industrial sardine vessels is authorized to fish one day per week, in order to supply sardine for bait to the national fishing fleet. Surpluses may be marketed for other purposes as established in Board of Directors agreement AJDIP/100-2021. This access will be used in 12-hour daytime windows, each on an alternating weekly basis by each vessel, such that the 2 vessels may not be within said area in the same week, and prior to their entry, their owners, shipowners, or Captain must coordinate the week in which each vessel will enter and must notify the Registration Department and the Enforcement Department of Incopesca of the schedule with the date and time of entry of each vessel into the established zone during the closed season.

1. 3That all landings carried out by the semi-industrial sardine purse-seine fleet will be duly inspected by the Institution's inspectors. Said inspection must cover not only sardine landings, but also that of the bycatch fauna. In turn, the Fisheries Research Department will conduct biological sampling of said catches to evaluate the reproductive behavior of sardines and compliance with the legal minimum size of first capture.

4º-As long as no new research is available, it is recommended to maintain the sardine closed season under the conditions established in agreement AJDIP/049-2020.

5º-Agreement is final. Let it be published and communicated. Takes effect as of March 01, 2023.

Considering:

en la totalidad del texto - Texto Completo Norma 040 Decreta veda de pesca de sardina con cualquier arte de pesca INSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA AJDIP/040-2023.-Puntarenas, a los veintiocho días del mes de febrero de dos mil veintitrés.

1. 1Que mediante acuerdo de Junta Directiva AJDIP/049-2020, se estableció una veda para la pesca semi-industrial sardinera bolichera (cerco), en el área comprendida por una línea imaginaria que va desde Punta Agujas (84°38´57´´Longitud Oeste, 09°43´46´´ Latitud Norte) al Faro de la Isla Negritos afuera (84°49´35´´ Longitud Oeste, 09°49´14´´ Latitud Norte) y desde ahí hasta la parte Este de Punta Cuchillo en la Península de Nicoya (09°50´03"Latitud Norte, 084°53´42" Longitud Oeste) y de estas líneas aguas adentro hasta la desembocadura del río Tempisque; a partir del 01 de marzo hasta el 31 de mayo
2. 2Que el acuerdo de Junta Directiva AJDIP/049-2020, estableció la veda de sardina de manera permanente durante al menos 5 años, hasta tanto no se tengan nuevas investigaciones científicas que determinen el cambio del acuerdo.
3. 3Que de forma adicional se presenta oficio INCOPESCA-DOPA-009-2023, en relación al estudio realizado por el Departamento de Investigación, para la caracterización de las capturas realizadas por la flota semi-industrial sardinera durante los meses de junio y julio (veda de pequeña escala), en la zona C del Golfo de Nicoya, según lo dispuso el acuerdo de Junta Directiva AJDIP/100-2021.
4. 4Que de conformidad con el considerando anterior, un biólogo observador del Departamento de Investigación Pesquera del INCOPESCA, trabajó a bordo de cada una de las embarcaciones de pesca semi-industrial sardinera bolichera (cerco), durante el periodo ya indicado para determinar la relación de captura entre especie objetivo (sardina Ophistonema sp) y especies no objetivo o pesca incidental (corvina, jureles, macarela, barracuda, entre otros).
5. 5Que la captura incidental para la pesca de sardina del estudio realizado en el año 2022 representó menos del 3% de la captura total de las embarcaciones y se ubica dentro del 10% máximo del margen de tolerancia conforme a lo establecido mediante acuerdo de Junta Directiva AJDIP/049-2020.
6. 6Que la Dirección de Ordenamiento Pesquero y Acuícola, adicionalmente establecerá las medidas correspondientes para efectos de que todas las descargas que se realicen como parte de este acuerdo sean debidamente inspeccionadas por el Departamento de Fiscalización. A su vez el Departamento de Investigación realizará muestreos biológicos de dichas capturas para evaluar el comportamiento reproductivo de las sardinas.
7. 7Que la Dirección de Ordenamiento Pesquero y Acuícola sostuvo reuniones con los representantes del sector de pesca semi-industrial de sardina bolichera (cerco), en la cual solicitaron se reestablezcan las medidas originales que datan del año 2018, permitiendo el ingreso a faenar un día a la semana al área vedada definida como Tárcoles, a efectos de que puedan suplir de sardina para carnada a la flota pesquera nacional.
8. 8Que, con la puesta en marcha de esta veda, tal cual se ha concebido, se atiende la imperiosa necesidad de proteger el recurso sardina en su etapa de reproducción en procura de la sostenibilidad de este recurso pesquero y a la vez solventar los requerimientos de carnada de la flota pesquera nacional, razón por la cual, la Junta Directiva del Instituto Costarricense de Pesca y Acuicultura, Por tanto;

ACUERDA 1º-Dar por recibido el oficio INCOPESCA-PE-DOPA-014-2023 y decretar la veda de pesca de sardina con cualquier arte de pesca a partir del 01 de marzo 2023 hasta el 31 de mayo 2023, en las siguientes zonas del litoral pacífico costarricense:

Zona C del Golfo de Nicoya, que para efectos de este acuerdo es aquella que está comprendida por una línea imaginaria que inicia en la zona conocida como el Peñón o Roca Carballo (9° 53' 57.54 Latitud Norte y 84° 43'47.99 Longitud Oeste) y se extiende hasta el faro de la Punta de Isla Negritos afuera (84°49´35´´ Longitud Oeste, 09°49´14´´ Latitud Norte); de ahí otra línea imaginaria hasta Punta Cuchillo en la Península de Nicoya (09°50´03"Latitud Norte, 084°53´42" Longitud Oeste) y desde este punto otra línea imaginaria hasta la Punta del muelle grande en Puntarenas (9° 58´ 36.03´´ Latitud Norte 84° 51´ 03.93´´Longitud Oeste) Además del área descrita anteriormente, se adiciona otra área en la cual también aplica esta veda: de la zona conocida como el Peñón o Roca Carballo ((9° 53' 57.54 Latitud Norte y 84° 43'47.99 Longitud Oeste) una línea imaginaria que se extiende hasta Punta Agujas (84°38´57´´Longitud Oeste, 09°43´46´´ Latitud Norte) y desde este punto otra línea imaginaria hasta el faro en la Punta de Isla Negritos afuera, desde este punto otra línea imaginaria hasta Punta Cuchillo en la Península de Nicoya (09°50´03"Latitud Norte, 084°53´42" Longitud Oeste) y desde ese último punto otra línea imaginaria hasta el Peñon o Roca Carballo (9° 53' 57.54 Latitud Norte y 84° 43'47.99 Longitud Oeste. A esta nueva área se le denomina Tárcoles, para efectos de este acuerdo.

2º-Durante esta veda, en la zona denominada Tárcoles, se autoriza el ingreso de una de las dos embarcaciones semi-industrial sardineras para faenar un día a la semana, a efectos de que puedan suplir sardina para carnada a la flota pesquera nacional. Los excedentes podrán ser comercializados para otros fines según lo establecido en el acuerdo de Junta Directiva AJDIP/100-2021. Este acceso será utilizado en franjas diurnas de 12 horas cada una de forma semanal alterna por cada embarcación de modo que no podrán estar dentro de dicha área las 2 embarcaciones en la misma semana y de previo a su ingreso, deberán sus propietarios, armadores o Capitán; coordinar la semana en que ingresará cada embarcación y deberán notificar al Departamento de Registro y al Departamento de Fiscalización del Incopesca el cronograma con la fecha y hora de ingreso de cada embarcación a la zona establecida durante la temporada de veda.

1. 3Que todas las descargas que se realicen por parte de la flota semi-industrial bolichera de sardina serán debidamente inspeccionadas por parte de los inspectores de la Institución. Dicha inspección debe cubrir no solo las descargas de sardina, sino también la de fauna de acompañamiento. A su vez el Departamento de Investigación Pesquera realizará muestreos biológicos de dichas capturas para evaluar el comportamiento reproductivo de las sardinas y el cumplimiento de la talla legal de primera captura.

4º-Mientras no se cuente con nuevas investigaciones, se recomienda mantener la veda de sardina en las condiciones establecidas en el acuerdo AJDIP/049-2020.

5º-Acuerdo en firme. Publíquese y comuníquese. Rige a partir del 01 de marzo del 2023.
