COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE (This norm was rendered null and void by agreement No. AJDIP/116-2023 of June 6, 2023) AJDIP/031-2023.-Puntarenas, on the twenty-first day of the month of February, two thousand twenty-three.

1. 1That through Board of Directors Agreements AJDIP/077-2020, AJDIP/076-2022, AJDIP/247-2022, and AJDIP/030-2023, respectively, the "Regulation for the Monitoring, Control, and Surveillance of Fishing Vessels of the National and Foreign Fleets" was established, which entails the obligation for vessels of the national and foreign fishing fleet to have duly installed and in use a radio beacon system linked to the INCOPESCA Center for Control, Monitoring, and Surveillance.
2. 2That these regulatory provisions not only contemplated said obligation, but also include differentiated effective dates for the various fishing fleets; among which are vessels belonging to the medium-scale sport and tourist fishing fleet, the last of which has been incorporated and for which, in principle, its effective date was set as February 28, 2023.
3. 3That through official document CRMAR-002-2023, submitted by the Asociación Costa Rica Marina, a request is received for an extension of the deadline for the effective date for the installation of beacons for the sport and tourist fishing fleet, based mainly on the complexity of carrying out the necessary coordination involved in implementing these, regarding the installation of equipment and software, without this affecting the high season for sport fishing, which ends in the month of June.
4. 4That, having duly analyzed the proposed amendment and considering it appropriate, the Board of Directors of the Costa Rican Institute of Fisheries and Aquaculture, Therefore;

AGREES 1º-To approve the requested extension and amend Board of Directors agreement AJDIP/076-2022, in its Transitory II, so that henceforth it reads as follows:

INSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA (Esta norma se dejó sin efecto mediante acuerdo N° AJDIP/116-2023 del 6 de junio del 2023) AJDIP/031-2023.-Puntarenas, a los veintiún días del mes de febrero de dos mil veintitrés.

1. 1Que por medio de los Acuerdos de Junta Directiva AJDIP/077-2020, AJDIP/076-2022, AJDIP/247-2022 y AJDIP/030-2023, respectivamente, se estableció el "Reglamento para el Seguimiento, Control y Vigilancia de Embarcaciones Pesqueras de las Flotas Nacional y Extranjera", mismo que conlleva la obligatoriedad para las embarcaciones de la flota pesquera nacional y extranjera de contar debidamente instalada y en uso un sistema de radio baliza enlazada con el Centro de Control, Monitoreo y Vigilancia del INCOPESCA.
2. 2Que en esas disposiciones reglamentarias no sólo se contempló la obligatoriedad dicha; sino que comprenden plazos diferenciados de entrada en vigencia para las diversas flotas pesqueras; entre las cuales se encuentran las embarcaciones pertenecientes a la flota de pesca deportiva y turística de mediana escala, última de las cuales ha sido incorporada y para la cual se tenía en principio su entrada en vigencia a partir del 28 de febrero de 2023.
3. 3Que por medio de oficio CRMAR-002-2023, remitido por la Asociación Costa Rica Marina, se recibe solicitud de prórroga del plazo para la entrada en vigencia para la instalación de balizas para la flota de pesca deportiva y turística, fundamentada principalmente en la complejidad de llevar a cabo las coordinaciones necesarias que implica la implementación de éstas, en cuanto a la instalación de equipos y software, sin que ello afecte la temporada alta de pesca deportiva, que finaliza en el mes de junio.
4. 4Que, debidamente analizada la modificación propuesta y por considerarla procedente, la Junta Directiva del Instituto Costarricense de Pesca y Acuicultura, Por tanto;

ACUERDA 1º-Aprobar la solicitud de prórroga solicitada y modificar el acuerdo de Junta Directiva AJDIP/076-2022, en su Transitorio II, para que en lo sucesivo se lea de la siguiente manera:
