throughout the text - Complete Text of Norm 003 Delimitation of a Sector of Public Zone Corresponding to the Estero-Manglar Boca Vieja, District 01° Quepos, Canton 06° Quepos, Province 06° Puntarenas NATIONAL GEOGRAPHIC INSTITUTE NOTICE N° 003-2023 MARITIME TERRESTRIAL ZONE DELIMITATION OF A SECTOR OF PUBLIC ZONE CORRESPONDING TO THE ESTERO- MANGLAR BOCA VIEJA, DISTRICT 01° QUEPOS, CANTON 06° QUEPOS, PROVINCE 06° PUNTARENAS Based on the provisions set forth in articles 140 and 240 of Law N° 6227, General Law of Public Administration, dated May 2, 1978, and its amendments; Law N° 59, Law for the Creation and Organization of the National Geographic Institute, dated July 4, 1944, and its amendments; Law N° 8905, Amendment to Article 2 of Law N° 5695, Creation of the National Registry, and its amendments; and modification of Law N° 59, Creation and Organization of the National Geographic Institute, dated July 4, 1944, and its amendments, dated December 7, 2010; Law N° 6043, Law on the Maritime Terrestrial Zone, dated March 2, 1977, with its respective regulations; and articles 2 and 3 of Law N° 5695, Law for the Creation of the National Registry, dated May 28, 1975, and its amendments.

1. 1That through Law N° 8905, the National Geographic Institute, hereinafter IGN, is established as a dependency of the National Registry, which shall sign the necessary contracts and agreements for the exercise of its functions. Likewise, in accordance with Law N° 59, the IGN is the governing scientific and technical entity of national cartography, tasked with the execution of the official Basic Map and the basic geographic Description of the Republic of Costa Rica, and with studies, research, or work and the development of national policies of a cartographic, geographic, geodetic, geophysical, and similar nature related to said works, to support planning processes.
2. 2That Law N° 59 constitutes the IGN permanently, and on behalf of the State, as the official authority in geodetic matters and the spatial representation of the geography of the Republic of Costa Rica, its authority extending to activities of any nature originating from the work entrusted to it.
3. 3That in accordance with Law N° 59; article 62 of Decreto Ejecutivo N° 7841-P, Regulation to the Law on the Maritime Terrestrial Zone, recognizes the IGN's competence for delimiting the public zone of the Maritime Terrestrial Zone (Zona Marítimo Terrestre, ZMT), and its officialization through publication in the Official Gazette La Gaceta; article 63 of Decreto Ejecutivo N° 7841-P states that "The National Geographic Institute shall publish a notice in the Official Gazette for each portion of the maritime terrestrial zone in which it has demarcated the public zone."
4. 4That in Decreto Ejecutivo N° 36642-MP-MOPT-MINAET, Regulation of Specifications for the Delimitation of the Public Zone of the Maritime Terrestrial Zone, it is established according to article 18 that for the delimitation of the public zone of the Maritime Terrestrial Zone, the IGN may resort to two execution methodologies, indicated in articles 19 and 20, corresponding to the delimitation of the public zone of the Maritime Terrestrial Zone through the placement of boundary markers (mojones) and/or through georeferenced digital delimitation, this in order to expedite delimitations and provide greater technical security to interested parties.
5. 5That in Decreto Ejecutivo N° 33797-MJ-MOPT, declaring CR05 as the official horizontal datum for Costa Rica, linked to the International Terrestrial Reference Frame (ITRF2000) of the International Earth Rotation Service (IERS) for the measurement epoch 2005.83, which among other aspects determines the National Horizontal Reference Geodetic Network CR05, and its associated cartographic projection CRTM05, as the official system to which the coordinates of all geodetic, cartographic, and cadastral work executed in our country must be referenced, specifically stating in article 11 that: "The National Horizontal Reference Geodetic Network CR05 and the CRTM05 cartographic projection system shall constitute the sole official coordinate system for the Republic of Costa Rica, from which all cartographic and geodetic surveys and activities carried out in the National Territory by any public entity, person, or private entity, national or foreign, must be referenced."; while article 7 states that "As cartographic data are produced in the new CRTM05 cartographic projection system, the National Geographic Institute shall publish, through appropriate means, that information which has been officialized."
6. 6That Decreto Ejecutivo N° 40962-MJP, Update of the Official Horizontal Reference Geodetic System for Costa Rica, declares in its article 1 that "The official horizontal reference geodetic system for Costa Rica, previously named CR05 and materialized through the National Geodetic Network, changes its acronym to CRSIRGAS, as the official horizontal reference system for the Republic of Costa Rica, linked to the International Terrestrial Reference Frame ITRF2008 (IGb08), for the measurement epoch 2014.59, and henceforth, its changes and updates shall be governed in accordance with the new ITRF definitions implemented in the continental network of the Geocentric Reference System for the Americas (Sistema de Referencia Geocéntrico para las Américas, SIRGAS) called SIRGAS-CON", while article 2 establishes that "The CRTM05 cartographic projection system shall continue to be the official system for the cartographic representation of the continental national territory, extended for purposes of applying this cartographic projection up to the baseline of the territorial sea in the Pacific Ocean and the Caribbean Sea, this baseline defined in accordance with articles 5, 6, and 7 of the United Nations Convention on the Law of the Sea, as the starting point for calculating the maximum width of all jurisdictional marine areas of the Costa Rican State."

Furthermore, article 12 of the cited decree reinforces the application of the CRTM05 cartographic projection as the official national coordinate system to which cartographic works in the continental territory of our country must be referenced, by stating that "The horizontal reference system CRSIRGAS and its associated cartographic projection CRTM05 for the continental territory extended to the baseline of the territorial sea, and the Universal Transverse Mercator (UTM) cartographic projection, zones 16 and 17 for the jurisdictional marine and insular areas in the Pacific Ocean and the Caribbean Sea, shall constitute the sole official coordinate system for the Republic of Costa Rica, from which all cartographic and geodetic surveys and activities carried out in the national territory by any public entity, person, or private entity, national or foreign, that undertakes or contracts geodetic and cartographic work must be referenced, thereby helping to avoid public expenditure and obtaining, on the other hand, reliable, uniform, and comparable geographic information that is of general utility and supports decision-making at different levels of the State."

1. 7That georeferencing to the national coordinate system as a mechanism for delimiting the public zone of the Maritime Terrestrial Zone enables the correct delimitation of the public zone for the purposes of preparing regulatory plans (planes reguladores), approving survey plans (planos de agrimensura), granting concessions in the Zona Restringida, and other aspects of coastal territorial planning (ordenamiento territorial costero).
2. 8That the georeferenced digital information on the delimitation of the public zone of the Maritime Terrestrial Zone held by the IGN is called the Georeferenced Digital Geodatabase (Geodatabase Digital Georreferenciada, GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT).
3. 9That the Georeferenced Digital Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT) is technically based on applying the regulations established by: a) Decreto Ejecutivo N° 7841-P, Regulation to Law N° 6043 on the Maritime Terrestrial Zone, b) Decreto Ejecutivo N° 33797-MJ-MOPT, Declaring CR05 as the official horizontal datum for Costa Rica, and its associated cartographic projection, CRTM05; and c) Decreto Ejecutivo N° 36642-MP-MOPT-MINAET "Regulation of Specifications for the Delimitation of the Public Zone of the Maritime Terrestrial Zone".

10.-That article 16 of the Ley Forestal, Law N° 7575 of February 13, 1996, and its amendments, establishes that the Ministry of Environment and Energy (Ministerio del Ambiente y Energía, MINAE) shall delimit on the ground the boundaries of the areas that constitute the Natural Heritage of the State (Patrimonio Natural del Estado, PNE).

11.-That according to article 11 of Chapter I, General Provisions of Law N° 6043, it establishes that the "Public zone is also, whatever its extension, that occupied by all mangroves of the continental and insular coastlines and estuaries (esteros) of the national territory." 12.-That Decreto Ejecutivo N° 36786-MINAET, Manual for the classification of lands dedicated to the conservation of natural resources within the Maritime Terrestrial Zone in Costa Rica, published in La Gaceta N° 217 of November 11, 2011, establishes among its objectives "To identify within the Maritime Terrestrial Zone those lands that classify as forests, of forest aptitude (Class VII and VIII soils), wetlands (mangroves, estuaries, rias, salt marshes, coastal lagoons, swamps, flooded forests, salt flats), to certify them and incorporate them as part of the Natural Heritage of the State (PNE)." 13.-That Decreto Ejecutivo N° 36786-MINAET in Point III.- Competencies for delimitation and certification establishes that "The classification of lands within the ZMT shall correspond to the Conservation Areas (Áreas de Conservación, AC) of the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación, SINAC) and to duly accredited private professionals by the respective Professional Associations to classify forests, lands of forest aptitude (Class VII and VIII soils), (mangroves, estuaries, rias, salt marshes, coastal lagoons, swamps, flooded forests, salt flats) and wetlands.

The validity of classification documents issued by private professionals shall be subject to the approval issued by the AC that has territorial jurisdiction. The ACs of SINAC with jurisdiction in the ZMT shall also be responsible for the verification, oversight, demarcation, and certification of Natural Heritage of the State lands and protection zones.

The location and delimitation of Natural Heritage of the State areas within the Maritime Terrestrial Zone must be carried out as part of the approval process for the Coastal Regulatory Plan (Plan Regulador Costero, PRC), defined by Law 6043, since the Coastal Regulatory Plan is the territorial planning instrument that defines and locates all areas to be concessioned within the ZMT and for its classification at the cadastral map level. Therefore, the Coastal Regulatory Plan must clearly and expressly indicate the PNE areas so as not to account for them in the total area to be concessioned." 14.-The National Geographic Institute used the Digital Delimitation methodology to delimit the public zone of the Maritime Terrestrial Zone corresponding to the estuary/mangrove ecosystem Boca Vieja - Quepos, District 01° Quepos, Canton 06° Quepos, Province 06° Puntarenas.

15.-That the delimitation of the estuary/mangrove Boca Vieja corresponds to a section of the mangroves located in the canton of Quepos, in accordance with what was ordered by the Constitutional Chamber (Sala Constitucional) through Resolution N° 2021002741 at 09:15 hours on February 12, 2021, which ordered the Central Pacific Conservation Area (Área de Conservación Pacífico Central, ACOPAC) and the National Geographic Institute (IGN) the following: "that jointly and in coordination they carry out the corresponding actions so that, within a maximum period of three months from the notification of this ruling, they delimit the mangrove ecosystem of the Quepos area." (The highlighting is provided) 16.-The digital delimitation of the estuary/mangrove Boca Vieja ecosystem corresponds to the technical report issued in official documents DIG-TOT-INF-001-2023 dated January 09, 2023, and SINAC-ACOPAC-IRT-PNE-098-2022 dated December 20, 2022, generated by the Official Limits Subprocess of the Topographic and Territory Observation Department of the National Geographic Institute (IGN) and the Office of Territory Information and Regularization Programs, Natural Heritage of the State Program of the Central Pacific Conservation Area (ACOPAC), respectively.

17.-That article 140 of Law N° 6227, General Law of Public Administration, states that "the administrative act shall produce its effect after being communicated to the administered party, except if it solely grants rights, in which case it shall produce them from the time of its adoption," a provision that must necessarily be related to numeral 204, subsection 1) of the same regulatory body, which defines the suitable instrument for communicating acts of a generic nature by stating: "Acts of a general nature shall be communicated by publication, and specific acts by notification." COMMUNICATES:

1. 1That, during the month of February 2022, the IGN and ACOPAC jointly conducted the field work to delimit the mangrove ecosystem belonging to the public zone of a sector of the estuary/mangrove Boca Vieja, District 01° Quepos, Canton 06° Quepos, Province 06° Puntarenas.

2º-The National Geographic Institute publishes the georeferenced digital delimitation of the public zone of sector 1, comprised between the settlements of El Cocal and Boca Vieja, which forms part of a sector of the mangrove ecosystem located in District 01° Quepos, Canton 06° Quepos, Province 06° Puntarenas, based on the Regulation of Specifications for the Delimitation of the Public Zone of the Maritime Terrestrial Zone and the methodology used and validated by the Central Pacific Conservation Area (ACOPAC) of SINAC-MINAE.

1. 3That the delimited public zone corresponds to a sector of the estuary/mangrove Boca Vieja ecosystem, District 01° Quepos, Canton 06° Quepos, Province 06º Puntarenas, in accordance with official documents N° DIG-TOT-INF-001-2023 dated January 09, 2023, issued by the Official Limits Subprocess of the Topographic and Territory Observation Department of the National Geographic Institute (IGN), and N° SINAC-ACOPAC-IRT-PNE-098-2022 dated December 20, 2022, issued by the Central Pacific Conservation Area (ACOPAC) of SINAC-MINAE.

4º-The sectors located in Quepos, District 01° Quepos, Canton 06° Quepos, Province 06° Puntarenas, which to date have delimitation of the public zone of the Maritime Terrestrial Zone through the placement of boundary markers and respective publication in the Official Gazette La Gaceta, maintain their official status.

1. 5That the public zone of the Maritime Terrestrial Zone concerning the sector of the mangrove ecosystem verified and delimited by the Central Pacific Conservation Area corresponds to the following coordinates in the official cartographic projection system of Costa Rica CRTM05:

ESTERO/MANGLAR BOCA VIEJA SECTOR

6º-The official technical data of the georeferenced digital delimitation of the public zone of the Maritime Terrestrial Zone of the estuary/mangrove Boca Vieja ecosystem located in Quepos, District 01° Quepos, Canton 06° Quepos, Province 06° Puntarenas, have been registered in the Georeferenced Digital Geodatabase of the Maritime Terrestrial Zone (ZMT) of the IGN in a vector shapefile format, under the coding: RN/IGN_GDG-IGN-ZMT_digital lines.

7º-Effective as of its publication.

Given in Curridabat, on the 09th day of the month of February of the year 2023.

1. 1Que mediante Ley N° 8905 se establece el Instituto Geográfico Nacional, en adelante IGN, como una dependencia del Registro Nacional, quien suscribirá los contratos y convenios necesarios para el ejercicio de sus funciones. Asimismo, de conformidad con la Ley N° 59, el IGN es la dependencia científica y técnica rectora de la cartografía nacional, destinada a la ejecución del Mapa básico oficial y la Descripción básica geográfica de la República de Costa Rica y a los estudios, las investigaciones o labores y el desarrollo de políticas nacionales de carácter cartográfico, geográfico, geodésico, geofísico y de índole similar que tenga relación con dichas obras, con el fin de apoyar los procesos de planificación.
2. 2Que la Ley N° 59 constituye al IGN de manera permanente y en representación del Estado, como la autoridad oficial en materia geodésica y de la representación espacial de la geografía de la República de Costa Rica, extendiéndose su autoridad a las actividades de cualquier orden que tengan por origen los trabajos confiados a su cargo.
3. 3Que de conformidad con la Ley N° 59; el artículo 62 del Decreto Ejecutivo N° 7841-P Reglamento a la Ley sobre la Zona Marítimo Terrestre se reconoce la competencia del IGN para la delimitación de la zona pública de la Zona Marítimo Terrestre, y su oficialización a través de publicación en el Diario Oficial La Gaceta; el artículo 63 del Decreto Ejecutivo N° 7841-P señala que "El Instituto Geográfico Nacional deberá publicar aviso en el Diario Oficial, de cada porción de la zona marítimo-terrestre en que haya demarcado la zona pública."
4. 4Que en el Decreto Ejecutivo N° 36642-MP-MOPT-MINAET Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre, se establece según el artículo 18 que para la delimitación de la zona pública de la Zona Marítimo Terrestre, el IGN podrá acudir a dos metodologías de ejecución, que se indican en los artículos 19 y 20, correspondientes a la delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y/o a la delimitación digital georreferenciada, esto con el fin de agilizar las delimitaciones y proporcionar mayor seguridad técnica a los interesados.
5. 5Que en el Decreto Ejecutivo N° 33797-MJ-MOPT Declara como datum horizontal oficial para Costa Rica, el CR05, enlazado al Marco Internacional de Referencia Terrestre (ITRF2000) del Servicio Internacional de Rotación de la Tierra (IERS) para la época de medición 2005.83, el cual entre otros aspectos determina, a la Red Geodésica Nacional de Referencia Horizontal CR05, y su proyección cartográfica asociada CRTM05, como el sistema oficial al cual deben estar referidas las coordenadas de todos los trabajos geodésicos, cartográficos y catastrales que se ejecuten en nuestro país, señalando específicamente en artículo 11 que: "La Red Geodésica Nacional de Referencia Horizontal CR05 y el sistema de proyección cartográfica CRTM05, constituirán el único sistema oficial de coordenadas para la República de Costa Rica a partir del cual se debe referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el Territorio Nacional toda dependencia pública, persona o entidad privada nacional o extranjera."; mientras que el artículo 7° indica que "Conforme se produzcan datos cartográficos en el nuevo sistema de proyección cartográfica CRTM05, el Instituto Geográfico Nacional publicará por los medios adecuados aquella información que se ha oficializado."
6. 6Que el Decreto Ejecutivo N° 40962-MJP Actualización del Sistema Geodésico de Referencia Horizontal Oficial para Costa Rica declara en su artículo 1 que "El sistema geodésico de referencia horizontal oficial para Costa Rica, denominado como CR05 y su materialización mediante la Red Geodésica Nacional, cambia en sus siglas a CRSIRGAS, como sistema de referencia horizontal oficial para la República de Costa Rica, enlazado al Marco Internacional de Referencia Terrestre ITRF2008 (IGb08), para la época de medición 2014.59, y en adelante, los cambios y su actualización, se regirán de acuerdo a las nuevas definiciones del ITRF que se implementen en la red continental del Sistema de Referencia Geocéntrico para las Américas (SIRGAS) denominada SIRGAS-CON", mientras que el artículo 2° establece que "El sistema de proyección cartográfica CRTM05 seguirá siendo el oficial para la representación cartográfica del territorio nacional continental, extendido para efectos de aplicación de esta proyección cartográfica, hasta la línea de base del mar territorial en el océano Pacífico y el mar Caribe, definida esta línea conforme a los artículos 5°, 6° y 7° de la Convención de las Naciones Unidas sobre el Derecho del Mar, como punto de partida para el cómputo de la anchura máxima de todas las áreas marinas jurisdiccionales del Estado costarricense."

Por su parte, el artículo 12 del decreto de cita, refuerza la aplicación de la proyección cartográfica CRTM05 como el sistema nacional de coordenadas oficial a la cual se deben referenciar en el territorio continental de nuestro país, al señalar que "El sistema de referencia horizontal CRSIRGAS y su proyección cartográfica asociada CRTM05 para el territorio continental extendido hasta la línea de base del mar territorial y, la proyección cartográfica "Universal Transversal de Mercator" (UTM), zonas 16 y 17 para las áreas marinas e insulares jurisdiccionales en el océano Pacífico y el mar Caribe, constituirán el único sistema oficial de coordenadas para la República de Costa Rica, a partir del cual, se deben referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el territorio nacional toda dependencia pública, persona o entidad privada, nacional o extranjera, que emprendan o contraten trabajos geodésicos y cartográficos, contribuyéndose a evitar el gasto público y obteniendo, por otra parte, información geográfica confiable, uniforme y comparable, que sea de utilidad general y que apoye la toma de decisiones en los distintos niveles del Estado."

1. 7Que la georreferenciación al sistema nacional de coordenadas como mecanismo para delimitar la zona pública de la Zona Marítimo Terrestre, posibilita la correcta delimitación de la zona pública a los efectos de la elaboración de planes reguladores, el visado de planos de agrimensura, el otorgamiento de concesiones en la Zona Restringida y otros aspectos de ordenamiento territorial costero.
2. 8Que la información digital georreferenciada sobre delimitación de la zona pública de la Zona Marítimo Terrestre con que cuenta el IGN, se le denomina Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT).
3. 9Que la Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT) se fundamenta técnicamente en aplicación de la regulación establecida por: a) el Decreto Ejecutivo N° 7841-P Reglamento a la Ley N° 6043 sobre la Zona Marítimo Terrestre, b) el Decreto Ejecutivo N° 33797-MJ-MOPT Declara como datum horizontal oficial para Costa Rica, el CR05, y su proyección cartográfica asociada, CRTM05; y c) el Decreto Ejecutivo N° 36642-MP-MOPT-MINAET "Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre".

10.-Que el artículo 16 de la Ley Forestal, Ley N° 7575 del 13 de febrero de 1996 y sus reformas, establece que el Ministerio del Ambiente y Energía (MINAE) delimitará en el terreno los linderos de las áreas que conforman el Patrimonio Natural del Estado.

11.-Que según el artículo 11 del Capítulo I, Disposiciones Generales de la Ley N° 6043, establece que la "Zona pública es también, sea cual fuere su extensión, la ocupada por todos los manglares de los litorales continentales e insulares y esteros del territorio nacional." 12.-Que el Decreto Ejecutivo N° 36786-MINAET Manual para la clasificación de tierras dedicadas a la conservación de los recursos naturales dentro de la Zona Marítimo Terrestre en Costa Rica publicado en La Gaceta N° 217 del 11 de noviembre del 2011, establece entre sus objetivos "Identificar dentro de la Zona Marítimo Terrestre aquellos terrenos que clasifiquen como bosques, de aptitud forestal (suelos Clase VII y VIII), humedales (manglares, esteros, rías, marismas, lagunas costeras, pantanos, bosques anegados, salitrales), para certificarlos e incorporarlos como parte del Patrimonio Natural del Estado (PNE)." 13.-Que el Decreto Ejecutivo N° 36786-MINAET en el Punto III.-Competencias para la delimitación y certificación establece que "La clasificación de los terrenos dentro de la ZMT corresponderá a las Áreas de Conservación (AC) del Sistema Nacional de Áreas de Conservación (SINAC) y a profesionales privados debidamente acreditados por los Colegios Profesionales respectivos para que clasifiquen los bosques, terrenos de aptitud forestal (suelos Clase VII y VIII), (manglares, esteros, rías, marismas, lagunas costeras, pantanos, bosques anegados, salitrales) y humedales.

La validez de los documentos de clasificación emitidos por profesionales privados quedará sujeta a la aprobación que emita el AC que por competencia territorial le corresponda. A las AC del SINAC con jurisdicción en la ZMT les competerá, además, la verificación, fiscalización, deslinde y certificación de las tierras del Patrimonio Natural del Estado y las zonas de protección.

La ubicación y delimitación de las áreas del Patrimonio Natural del Estado dentro de la Zona Marítimo Terrestre, debe realizarse como parte del proceso de aprobación del Plan Regulador Costero (PRC), definido por la Ley 6043, ya que el Plan Regulador Costero es el instrumento de ordenamiento territorial, que define y ubica todas las zonas a concesionar dentro de la ZMT y para la clasificación de ésta a nivel de los planos de catastro. Por tanto, el Plan Regulador Costero debe indicar clara y concesionar." 14.-El Instituto Geográfico Nacional, utilizó la metodología de Delimitación Digital, para delimitar la zona pública de la Zona Marítimo Terrestre correspondiente al ecosistema de estero/manglar Boca Vieja - Quepos, distrito 01° Quepos, cantón 06° Quepos, provincia 06° Puntarenas.

15.-Que la delimitación del estero/manglar Boca Vieja corresponde a una sección de los manglares ubicados en el cantón de Quepos, de acuerdo a lo indicado por la Sala Constitucional según Resolución N° 2021002741 de las 09:15 horas del 12 de febrero de 2021, se ordenó al Área de Conservación Pacífico Central (ACOPAC) y al Instituto Geográfico Nacional (IGN) lo siguiente: "que de manera conjunta y coordinada realicen las actuaciones correspondientes para que, en el plazo máximo de tres meses a partir de la notificación de esta sentencia, delimiten el ecosistema de manglar de la zona de Quepos." (El resaltado es suplido) 16.-La delimitación digital del ecosistema de estero/ manglar Boca Vieja corresponde al informe técnico oficios DIG-TOT-INF-001-2023 de fecha 09 de enero de 2023 y SINAC-ACOPAC-IRT-PNE-098-2022 de fecha 20 de diciembre de 2022, generados por el Subproceso de Límites Oficiales del Departamento Topográfico y Observación del Territorio del Instituto Geográfico Nacional (IGN) y la Oficina Programas Información y Regularización del Territorio, Programa Patrimonio Natural del Estado de Área de Conservación Pacífico Central (ACOPAC), respectivamente.

17.-Que el artículo 140 de la Ley N° 6227 Ley General de la Administración Pública, señala que "el acto administrativo producirá su efecto después de comunicado al administrado, excepto si le concede únicamente derechos, en cuyo caso lo producirá desde que se adopte", disposición que necesariamente debe relacionarse con el numeral 204 inciso 1) del mismo cuerpo normativo, que define el instrumento idóneo para comunicar actos de naturaleza genérica al señalar que: "Se comunicarán por publicación los actos generales y por notificación, los concretos".

COMUNICA:

1. 1Que, durante el mes de febrero de 2022, se realizó el trabajo de campo en conjunto el IGN y ACOPAC para delimitar el ecosistema de manglar perteneciente a la zona pública de un sector de estero/manglar Boca Vieja, distrito 01° Quepos, cantón 06° Quepos, provincia 06° Puntarenas.

2º-El Instituto Geográfico Nacional publica la delimitación digital georreferenciada de la zona pública del sector 1, comprendido entre los poblados El Cocal y Boca Vieja que forma parte de un sector del ecosistema de manglar ubicado en el distrito 01° Quepos, cantón 06° Quepos, provincia 06° Puntarenas, con base al Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre y la metodología usada y validada por el Área de Conservación Pacífico Central (ACOPAC) del SINAC-MINAE.

1. 3Que la zona pública delimitada corresponde a un sector del ecosistema de estero/manglar Boca Vieja, distrito 01° Quepos, cantón 06° Quepos, provincia 06º Puntarenas en conformidad a los oficios N° DIG-TOT-INF-001-2023 de fecha 09 de enero de 2023 emitido por Subproceso de Límites Oficiales del Departamento Topográfico y Observación del Territorio del Instituto Geográfico Nacional (IGN) y N° SINAC-ACOPAC-IRT-PNE-098-2022 de fecha 20 de diciembre de 2022 emitido por Área de Conservación Pacífico Central (ACOPAC) del SINAC-MINAE.

4º-Los sectores ubicados en Quepos, distrito 01° Quepos, cantón 06° Quepos, provincia 06° Puntarenas que cuentan a la fecha con delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y respectiva publicación en el Diario Oficial La Gaceta, mantienen su condición oficial.

1. 5Que la zona pública de la Zona Marítimo Terrestre concerniente al sector del ecosistema de manglar verificado y delimitado por el Área de Conservación Pacífico Central corresponde a las siguientes coordenadas en el sistema de proyección cartográfica oficial de Costa Rica CRTM05:

6º-Los datos técnicos oficiales de la delimitación digital georreferenciada de la zona pública de la Zona Marítimo Terrestre del ecosistema de estero/manglar Boca Vieja ubicado en Quepos, distrito 01° Quepos, cantón 06° Quepos, provincia 06° Puntarenas, han quedado registrados en la Geodatabase Digital Georreferenciada de la Zona Marítimo Terrestre (ZMT) del IGN en archivo con formato vectorial shape, bajo la codificación: RN/IGN_GDG-IGN-ZMT_líneas digitales.

7º-Rige a partir de su publicación.
