1.—That through the Notice published on page 08 of the Official Gazette (Diario Oficial La Gaceta) No. 51 of March 13, 1981, the officialization of the boundary-marking (amojonamiento) of the public zone in Playa Bejuco, Playa Esterillos Este, Esterillos Oeste and the strip up to the Tusubres River, district 01 Parrita, canton 09 Parrita, province 06 Puntarenas, was carried out, under the establishment of 95 boundary markers (mojones) numbered 01 to 95.
2.—That in accordance with Law No. 59 Law of the IGN, and in Article 62 of the Regulation to Law No. 6043, the competence of the IGN is recognized for the delimitation of the public zone of the Maritime-Terrestrial Zone (Zona Marítimo Terrestre), and its officialization through publication in the Official Gazette (Diario Oficial La Gaceta), while Article 63 of the same Regulation states that "The Instituto Geográfico Nacional must publish a notice in the Official Gazette, for each portion of the maritime-terrestrial zone (zona marítimo-terrestre) in which it has demarcated the public zone." 3.—That Article 140 of Law No. 6227 General Law of Public Administration (Ley General de la Administración Pública) states that "the administrative act shall produce its effect after it has been communicated to the administered party, except if it grants only rights, in which case it shall produce its effect from the moment it is adopted," a provision that must necessarily be related to numeral 204 subsection 1) of the same normative body, which defines the suitable instrument for communicating acts of a generic nature by stating that: "General acts shall be communicated by publication and concrete acts by notification." Therefore, COMMUNICATES:
1.—That based on the demarcation published in the Official Gazette (Diario Oficial La Gaceta) No. 51 of Friday, March 13, 1981, boundary marker (mojón) M31, published on page 8 of the Official Gazette (Diario Oficial La Gaceta) No. 51 of March 13, 1981, is eliminated from the Maritime-Terrestrial Zone Registry (Registro de Zona Marítimo Terrestre).
2.—It takes effect as of its publication.
