in the entirety of the text - Complete Text of Standard 017 Reform of Management Measures for the Use of Live Bait by the Commercial Fishing Fleet and Sport Fishing in the Costa Rican Pacific Ocean COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE AJDIP/017-2023.-Puntarenas, on the thirty-first day of January of two thousand twenty-three.

1. 1That it is the responsibility of the Costa Rican Institute of Fisheries and Aquaculture (INCOPESCA) to coordinate the fisheries sector, as well as to promote and manage the development of Fisheries and Aquaculture.
2. 2That it is of special interest to promote the development of tourist fishing and sport fishing activities, as well as the different commercial fishing sectors, which is why it is considered that with the correct management of catches of species of tourist interest, the sustainable use of the fishery, the necessary balance between all these activities can be achieved and the conflicts that could arise over the space where these fishing activities take place can be reduced.
3. 3That among the powers of INCOPESCA are those of controlling fisheries and the hunting of marine species in jurisdictional waters, determining the species of marine organisms that may be exploited commercially, establishing the number of licenses and their regulations, as well as the technical limitations to be incorporated into them, and determining the closed seasons and areas, as well as the species and sizes whose catch is restricted or prohibited.
4. 4That the medium- and large-scale fishery sector, as a commitment to the sustainability and conservation of the resource, has voluntarily expressed its acceptance of provisions aimed at the regulation of the Pacific Sailfish (Istiophorus platypterus), in order to reduce the percentage of bycatch (pesca incidental) established by Article 8 of the Board of Directors Agreement AJDIP/280-2014, so that it goes from 15% to 10% of the permitted bycatch percentage.
5. 5That in compliance with the provisions of Article 50 of the Political Constitution of Costa Rica, as well as the application of the principles of sustainable development, precautionary, preventive, and democratic access to fishery resources, and in accordance with the provisions of Law 7384: Law of Creation of the Costa Rican Institute of Fisheries and Aquaculture, and Law 8436: Law of Fisheries and Aquaculture, the Board of Directors of the Costa Rican Institute of Fisheries and Aquaculture, Therefore,

AGREES:

1°-To modify the Board of Directors Agreement AJDIP/280-2014, in its Article 8, so that from now on it reads as follows: "In the event of bycatch (pesca incidental) of Sailfish (Istiophorus platypterus) occurring during non-tourist commercial fishing activity, without it having been possible to return the still-living specimen to the sea; the commercialization of the product will be permitted only in a fresh or frozen state for human consumption exclusively in the domestic market. For the purposes of the above, the bycatch may not exceed 10% (eviscerated weight), of the total catch of the vessel per each non-tourist commercial fishing trip carried out.

The export of Sailfish (Istiophorus platypterus) is prohibited, in accordance with the provisions of the preceding paragraph, a fishery management measure that will be reviewed annually." 2°-For the purposes of the application of the provisions of subsection 1, bycatch is considered to be that in which the specimens of Sailfish (Istiophorus platypterus) are caught using longline (palangre) without the use of live bait, provided that they do not correspond to more than 10% of the total catch of the vessel per each non-tourist commercial fishing trip carried out.

3°-Continue with the corresponding procedures.

4°-Firm Agreement.

5°-Publish.

Considering:

en la totalidad del texto - Texto Completo Norma 017 Reforma Medidas de ordenamiento para el uso de carnada viva para la flota pesquera comercial y de pesca deportiva en el Océano Pacífico Costarricense INSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA AJDIP/017-2023.-Puntarenas, a los treinta y un días del mes de enero de dos mil veintitrés.

1. 1Que corresponde al Instituto Costarricense de Pesca y Acuicultura (INCOPESCA), coordinar el sector pesquero, así como promover y ordenar el desarrollo de la Pesca y la Acuicultura.
2. 2Que es de especial interés el promover el desarrollo de las actividades de la pesca turística y la pesca deportiva, lo mismo que los diferentes sectores de la pesca comercial, por lo que se considera que con el correcto ordenamiento de las capturas de especies de interés turístico, el aprovechamiento sostenible de la pesca, se puede lograr el equilibrio necesario entre todas estas actividades y disminuir los conflictos que se podrían generar por el espacio donde se desarrollan estas actividades pesqueras.
3. 3Que dentro de las atribuciones del INCOPESCA están las de controlar la pesca y la caza de especies marinas en aguas jurisdiccionales, determinar las especies de organismos marinos que podrían explotarse comercialmente, establecer el número de licencias y sus regulaciones, así como, las limitaciones técnicas que se han de incorporar a estas, determinar los períodos y áreas de veda, así como, las especies y tamaños cuya captura está restringida o prohibida.
4. 4Que el sector pesquero de mediana y avanzada escala como compromiso hacia la sostenibilidad y conservación del recurso ha manifestado de manera voluntaria aceptar disposiciones orientadas a la regulación del Pez Vela del Pacífico (Istiophorus platypterus), con el fin de reducir el porcentaje de pesca incidental establecido por medio del Artículo 8 del Acuerdo de Junta Directiva AJDIP/280-2014, para que este pase del 15% al 10% del porcentaje de pesca incidental permitida.
5. 5Que en cumplimiento de lo que dispone el artículo 50 de la Constitución Política de Costa Rica, así como, de la aplicación de los principios de desarrollo sostenible, precautorio, preventivo y de acceso democrático a los recursos pesqueros y de conformidad con lo dispuesto en la Ley 7384: Ley de Creación del Instituto Costarricense de Pesca y Acuicultura, Ley 8436: Ley de Pesca y Acuicultura, la Junta Directiva del Instituto Costarricense de Pesca y Acuicultura, Por tanto,

ACUERDA:

1°-Modificar el Acuerdo de Junta Directiva AJDIP/280-2014, en su Artículo 8, con el fin de que en adelante se lea de la siguiente manera: "En caso de producirse pesca incidental de Pez Vela (Istiophorus platypterus) en la actividad de pesca comercial no turística, sin que hubiere sido posible la devolución al mar del ejemplar aún vivo; solo se permitirá la comercialización del producto en estado fresco o congelado para consumo humano exclusivamente en el mercado nacional. Para efectos de lo anterior, la pesca incidental no podrá exceder el 10% (peso eviscerado), de la captura total de la embarcación por cada viaje de pesca comercial no turística realizado.

Se prohíbe la exportación de Pez Vela (Istiophorus platypterus), en concordancia con lo señalado en el párrafo anterior, medida de ordenación pesquera que será revisada anualmente." 2°-Para los efectos de la aplicación de lo dispuesto en el inciso 1, se considera pesca incidental, aquella en la cual los ejemplares de Pez Vela (Istiophorus platypterus), son capturados utilizando palangre sin mediar el uso de carnada viva, siempre que, no correspondan a más del 10% de la captura total de la embarcación por cada viaje de pesca comercial no turística realizado.

3°-Continúese con los trámites correspondientes.

4°-Acuerdo Firme.

5°-Publíquese.
